Um we received uh communications to

their attorney that they're going to
revise and resubmit their application.

Uh they were seeking an appeal of the
zoning officer's decision and they're
[13:43]
going to be resubmitting the application
as a just a request for variance relief.
[13:47]
They did provide notice several months
ago, but based on the very nature of
[13:52]
their application changing. Um, we're
going to require that they redo their
[13:56]
notice appropriately for the the type of
relief being requested now instead of
[14:00]
before. So, just want to note that if
anyone's here for those applications,
[14:05]
the that's again that's the 59 South
Finley LLC, 87 South Finley LLC, 93
[14:10]
South Finley LLC applications. It's not
going to be heard tonight. I think we're

a hearing uh for the modification of

time to begin the project ZB25-015A.

to request an extension to our approved

variance uh for another one-year
extension to do the
[17:02]
our existing two uh twotory barn as well
as um regrading and putting block
[17:10]
granite curving in our existing
driveway. Uh the request is really due

to extensive health and rehab
requirements uh from me going through
[17:21]
emergency surgery.
Um this has required a lot of extensive
[17:27]
uh work uh six months to a year and my
focus has been to you know become um I
[17:34]
would say mobile flexible and uh ability
and have an ability to get around
[17:39]
starting with the surgery having 10
weeks can't even put any weight
[17:49]
it's been and I'm still going through
the uh process So,

as it relates to the variance. There's
no changes to the land development
[18:37]
ordinance. There's no changes to the
approved
[18:43]
uh September 3rd 2025 resolution.
One thing of the conditions have
[18:49]
advanced is the requirement to get
approval from Bernard's Township Sewer
[18:54]
Authority to uh hook the existing sewer
line from the barn to our existing sewer
[18:59]
line. So that was approved in October
and we paid the um the hookup fee uh in
[19:06]
November of this year. So there was work
already uh going on that we had intended
[19:11]
to do. Um we have moved the project
forward with requests from uh to finish
[19:16]
up the drawings and we've identified
three u contra licensed contractors
[19:22]
where we'll you know be looking.
But with that said we're just asking for
[19:27]
another year's extension of approved
variance as is.

and tried to start something but

December after after Christmas we had a
uh a house fire uh that that started in
[24:08]
our garage um and uh kind of destroyed
that that portion of the home that third

of the home. Um rest of our home had uh
extensive smoke and heat damage
[24:18]
throughout. Um we worked through with
our insurance company which is pretty
[24:24]
much at a near end at this point. Um the
whole home is gutted. Um and we kind of
[24:29]
were in a position to um say you know
want to make this our home where we stay
[24:35]
here you know for the next couple of
decades. And we were
[24:40]
crammed as it was. And so this is kind
of our opportunity to say let's let's
[24:44]
add a little bit to it if we um
[25:00]
» happened and was really
we were like you know
[25:11]
moved here with we moved here with no
kids and this is our third five years
[25:16]
ago and now we have
[25:26]

otherwise but you know obviously it's
been a really long nine months we are in

a rental ambass but

out of lemons is sort of what we're

» Uh, I have a bachelor of science uh,
degree from the Clarkson University

School of Engineering in New York. Uh, I
obtained my uh, professional engineers
[29:02]
license in New Jersey in 2004.
I've had it in co standing ever since.

Uh I have not appeared before uh this
board, but I've appeared before uh
[29:12]
several dozen other boards throughout
central New Jersey. Uh many of the
[29:16]
surrounding communities

good standing.

» Uh so I did uh meet with the Jennings at
the site at the beginning of the
[29:32]
project. Uh I noted the house was fire
damaged and uninhabitable. Um they're
[29:39]
working with Mr. Welish, the architect,
who you'll hear from shortly, uh to
[29:42]
develop some plans for the house. And u
my job was to prepare the the site plans
[29:48]
uh for the project.
Uh the project I'm going to be referring
[29:53]
basically to sheet one of my plan set
for my testimony.
[29:58]
That's the plan set dated uh 10th, 2026,
revised May 28th.

So as you look at that plan, the drawing
[30:12]
to the left is the existing conditions
and demolition plan and the plan to the
[30:17]
right is basically a um dimensional
proposed plan.

Uh the proposed project uh encompasses
um additions to the front of the house
[30:30]
uh which is an expansion of the existing
porch and the existing of a gazebo
[30:36]
uh as well as the reconstruction of uh
the front walkway.
[30:41]
Um the gazebo and all that is shaded in
the the light green color.
[30:49]
The gazebo is situated forward from the
house from the front facade and you'll
[30:54]
hear from the architect that was done
for aesthetic reasons. Uh but that does
[30:58]
trigger a front yard variance. Um 75 ft
is required and 66.3 feet is proposed.

Uh to the rear uh of the house there is
a proposed garage with second floor and
[31:15]
then an additional uh second floor uh
addition towards the central portion of
[31:21]
the the rear of the house. Along with
that there is a proposed gazebo.
[31:30]
Uh you heard that the house uh the
project does currently uh exceed the
[31:35]
impervious coverage.
Um I discussed with the the Jennings how
[31:40]
important um block coverage is viewed by
the township. Uh so we met at the site
[31:45]
again. We walked the site and we tried
to find areas that we could remove uh
[31:50]
coverage.
[31:54]
Uh if you look at the drawing to the
left uh of the driveway, you'll see that
[31:58]
kind of L-shaped red hatched area. uh
that indicates an area of the um
[32:05]
existing driveway that would be removed.
Uh the net result would be uh a decrease
[32:12]
of coverage of 24 square ft.
[32:19]
Uh also in the engineering memo uh it
was noted that we should be subtracting
[32:24]
the um water surface of the pool from
the previous coverage calculations. Uh
[32:30]
the water surface is approximately 600
square feet.
[32:45]

so the net result of the project right
[32:51]
now is a decrease of coverage of 24
square feet.

Uh to put this in context of of how much
you know over
[33:07]
um that is
um we're coming in at 18.4%
[33:13]
or 15% is allowed. So it's a overage of
3.4% for impervious coverage.

engineer had said, we are pretty much
keeping almost everything what we have

in the plans themselves. Whatever you
see in dash lines is what walls that we
[57:27]
dig out. whatever is back.
The floor plan is very easy to um you
[57:34]
know do one and the other um we are
increasing the overall area of the house
[57:40]
by about 1314 ft to 413
ft altogether. That's living space only
[57:48]
first and second floor not including the
basement attic is not being used. Um
[57:55]
what we try to do is simply have a very
modern upto-ate
[58:01]
colonian if you will. You can still use
these ancient words. New sighting, new
[58:08]
windows, new roof, new homes,
everything. So from the outside it will
[58:12]
look like a brand new house. We're
adding a garage as you know. And we're
[58:17]
also heading a cover cl in the back of
our heartscape
[58:23]
hoping. We are also putting the zero.
That was a special request from the
[58:28]
owner. They love it. They love it too. I
understand that it's over the subject by
[58:34]
8.7 ft. But I believe it really will add
a lot to the way that the house looks.

The house is like turning a little bit
to the left. that puts it back
[58:46]
kind of an equal. You look from the
road, the cur is on. Of course, we could
[58:53]
push it to the back. We really loses,
but the zippers usually they are in the
[58:58]
front a little bit more in the main body
of the house. Um, we don't have to put a
[59:05]
railing on the on the uh,
but on the zipper, it's more than 30 in
[59:10]
in a few spots. So, we do have to and
open the hook is open. It's like a It's
[59:16]
like a dance stand, if you will. It's
open all sides, front, back, to sides.

Uh the roof is a little bit steeper than
what it was before, and that will help
[59:29]
us with the water situation. It doesn't
go over the height restriction of the
[59:34]
house.
Description of the house itself, it was
[59:37]
a four bedroomedroom. Uh it's going to
be six bedroom
[59:42]
my department. I know that they want to
have more kids. So they told me uh that
[59:49]
also the inner
plan of the house itself is a lot better
[59:54]
than it was before
whatever whoever did it before. I'm not
[59:58]
criticizing it, but
back and now it's pretty much family

dinette kitchen in the back overlooking
the backyard which is really nice. Big
[1:00:13]
windows actually big windows all over
the house. All the windows are going to
[1:00:17]
be new. All the trim is going to be new.
Going to use part siding, no vinyl, no
[1:00:23]
wood is going to be practically zero.
And also the
[1:00:32]

in attorney review and someone spooked

it away. Um at the time my mom was alive
and visited the home and it was what we

my mom passed away of glyobblasto and so

in our home um 178 Galving Hill and um,

I grew up with a porch and it was one of
those things that I always hoped that I

would be able to do and um, so she is no
longer with us but um, in the history of

the house we almost had and loved and I
had shown Mr.
[1:11:29]
um the gazebo. Um and also in the you
know honor of my mom personally um not
[1:11:35]
to bring that in but it's the truth. I
had said to him like if there's just any
[1:11:38]
way that we feel like it wouldn't be
such a um issue um could we at least try
[1:11:45]
to see if that was possible. So that's a
little bit of the personal side but also
[1:11:48]
the craziness of the market when we were
buying to hopefully be in this town. So,

would ask the question, is there
anywhere do you that you feel you could

walked the property um with both of the

architect and the engineer. And one of
the um areas that we looked to move was
[1:21:27]
actually around the pool. And because we
have three young kids, when we moved in

um they did not have young children, we
had a fresh company put one of those
[1:21:34]
fences like right near the pool. So when
we were looking at that, that fence is
[1:21:38]
not going anywhere. We have a
four-year-old, a three-year-old, and a
[1:21:40]
four-month-old. So, when we were looking
at places where the around the pool
[1:21:44]
technically I think um could come in
because we have the fence as a safety
[1:21:49]
element, it it it's not something that's
going to be there for the next two to
[1:21:53]
three years. So, I think we could
probably relook at that instead of
[1:21:55]
getting rid of the porch if we had to,
but it it does it does make it a little
[1:22:00]
bit more challenging because we have,
you know, the fence around our property
[1:22:03]
as well as the safety fence right
directly near the shape of the pool. So,

we were trying to find areas where it
would even make sense like to not have
[1:22:11]
grass right into a fence, right into a
pool. Do you see what I'm saying? So, I

just wanted to mention that that that
was a little bit challenging because of

our safety element we had put on. But I

town nine years ago, bought our house,

had a beautiful pool, patio. Very long
story short, the pool started the
[2:21:15]
concrete in the pool started chipping
away at the end of last season. So, we
[2:21:18]
knew that it was time to resurface the
pool. And with resurfacing the concrete
[2:21:22]
pool, then all the pavs had to come up
from around the pool. And if we were
[2:21:27]
doing the paviors up by the pool, we
were going to do the pavers that we
[2:21:29]
already had down by the house as well.
So, we started doing this work. I got a
[2:21:34]
call from the zoning department
essentially saying, "Hey, you need a
[2:21:37]
permit for this." which I didn't realize
knowing we were just like essentially
[2:21:42]
redoing. I didn't realize what was going
on. We're first-time homeowners. So,
[2:21:46]
obviously put a stop on it immediately,
hired an engineer, like went the whole
[2:21:51]
nine, went in for the permit, and then
when we applied for the permit, we were
[2:21:54]
told we were already over on our
coverage, that we don't have coverage of
[2:21:58]
18%. We actually had already had 19.83
when we moved in. So now we're just sort
[2:22:04]
of back at square one trying to figure
out the project trying to So we're just
[2:22:09]
trying to make our backyard a little
nicer, trying to put in some new brick,
[2:22:12]
make it a little bigger. We've already
tried uh to pull back on the coverage in
[2:22:16]
existing places where we already have
it. We have a shed in the backyard that
[2:22:19]
we'll get rid of. Uh a couple other
spots around the house that we're trying
[2:22:23]
to trim back on,
but that's more or less where we're at
[2:22:27]
right now. We're not trying to come for
some crazy percentage. We just want to
[2:22:33]
make it a little nicer and a little
bigger. And that's more

time, but just this is our you know plan
that was submitted to the uh to the

board and um we we were retained after
the work was already started. Um
[2:26:20]
fortunately the contractor did have the
before pictures. So before that work was
[2:26:24]
started we actually had pictures
document what was there but um
[2:26:28]
fortunately there was a 2017 survey that
the applicant had from when he bought
[2:26:33]
the property. So we have a good snapshot
of what was on the ground u before the
[2:26:39]
work was started. Uh we then went out
and did a supplemental survey and up on
[2:26:44]
the top um left of the of the of the
plan is the um kind of the asbuilt
[2:26:50]
what's there now. This is kind of the
work in progress. We went out and we
[2:26:53]
surveyed what was on the ground just to
establish um what the the coverages are.
[2:26:58]
And then on the top right is what the
applicant is proposing um which is uh
[2:27:05]
continue to finish the work uh complete
the papers uh and um again that's why
[2:27:12]
they're here asking for the variance. Um
they are planning to remove the shed and
[2:27:17]
some of the existing sidewalk uh in
order to help you know mitigate the the
[2:27:22]
additional
moving a shed removing some existing
[2:27:26]
sidewalks
uh and then again to help uh get bal
[2:27:30]
balance.
So um just to get into the numbers um
[2:27:35]
again there was a question about what
the uh
[2:27:39]
coverage were. So we we um actually
forgot to include the uh the pool pad,
[2:27:46]
the pump pad for the pool, the generator
pad and the air conditioning pads. So
[2:27:51]
that actually add it adds an additional
55 square ft. So um the numbers are a
[2:27:57]
little different than what we had on the
plan but if we look at the pre-existing
[2:28:01]
conditions what was there what we
documented in 2017
[2:28:07]
uh the impervious coverage was 7,399
square ft which equated to n equates to
[2:28:13]
19.97%.
uh what's there now with the work that's
[2:28:18]
in progress uh equates to 7,666
square feet of total impervious which is
[2:28:26]
2069%
and what we're showing as the proposed
[2:28:31]
with everything being removed and
adjusted is 7,397
[2:28:36]
square ft uh which equates to 19.96%
when um we were first retained
[2:28:44]
» we were going for the 26 Well, I'm I'm
I'm going to get there. So, um when we
[2:28:49]
were first retained, the first thing we
did, we we put our plan together,
[2:28:52]
submitted it to the zoning officer, we
weren't aware either that uh we know it
[2:28:56]
was over the 18%. Uh but we weren't
aware that um apparently there was no
[2:29:01]
record of previous permits. Um so, when
they bought the property in 2017, this
[2:29:06]
is what was there. Um you know, nobody
had any idea whether were permits or
[2:29:10]
not. Most people don't don't know that
and really don't know what their
[2:29:13]
coverage is. Um, so then that's why we
we we submitted the app.
[2:29:20]
Um, looking at the um the pictures,
looking at the style of the pavers, the
[2:29:25]
amount of weathering, I my estimate is
they're probably at least 30 years old.
[2:29:30]
Um, just looking at the style, looking
at the way they're weathered. I we've
[2:29:33]
done a lot of these. I've seen a lot of
papers over the years. Kind of get a
[2:29:37]
feel for the age of how old they are.
Um, so I know we submitted the
[2:29:43]
application, we to the zoning officer,
we're trying to match what was there.
[2:29:46]
That's what ended up in the application
here tonight. Um, looking back and
[2:29:51]
discussing it with the applicant. They
would like try to keep what's on the
[2:29:55]
ground, which is the 20.69%.
Um, again, I I kind of pushed them to do
[2:30:02]
the 19.96. I was trying to just match
what was there, but since they were
[2:30:06]
coming here, I you know, we maybe just
um percentage. So uh you know it's it's
[2:30:13]
18% is permitted what is upon
pre-existing 19.97 they would
[2:30:21]
average it would be 20 uh 69%. So it's
um you know less than a 1% percent
[2:30:30]
increase in the cover.
um
[2:30:34]
the the physical characteristics of the
site, the everything drains from the
[2:30:38]
back to the to the front. So all the
runoff goes from the back of the
[2:30:41]
property and runs out uh into Lexington.
Um there's no runoff either currently or
[2:30:48]
proposed that would go on to any
um actually the uh they're taking
[2:30:53]
actually some runoff from the adjoining
pre-existing runoff pattern. It is what
[2:30:58]
it is. Um there's no um proposal to
really regrade the property. The grades
[2:31:04]
are stay
uh just the disturbance is really just
[2:31:07]
limited to around the pool and
area in the rear.
[2:31:14]
So which lends itself to the uh you know
leads into the variance. Um obviously
[2:31:20]
it's a it's a C2 variance. Um
from the negative criteria standpoint we
[2:31:26]
really don't see any impact.
[2:31:31]
um run
property. Uh there's no trees being
[2:31:36]
removed.
[2:31:40]
Patio actually in the rear, you know,
it's kind of tucked in behind the house,
[2:31:46]
the garage, so it's really not even
visible. Um it's
[2:31:53]
fielded on or screened on
[2:31:58]
um so again I I don't I don't see that
having having any negative impact uh
[2:32:03]
from the uh positive criteria. This is
really a I call it a modernization of
[2:32:08]
the property. Um
significant uh aesthetic improvement
[2:32:15]
favors uh coming in with newer um new
papers, modern papers,
[2:32:21]
papers have come a long way since the
90s, you know, as far as styles, colors,
[2:32:25]
textures, uh and it selection then today
there's like a million different styles
[2:32:31]
and patterns, colors that you you can
pick.
[2:32:36]
I think that the uh again the both
criteria are met. My opinion, I think
[2:32:41]
the balance system
[2:32:47]
And that's all I have as far as as
direct
[2:32:53]
fence around the pool and then around
the property.
[2:32:55]

around the pool originally when the
papers came up. The fence is no.
