[1:46] of city development. Uh before you tonight is a proposed UD UDC text
[1:50] amendment related to short-term rentals. The purpose of this amendment is not to
[1:56] prohibit short-term rentals, but to establish a more clear and enforceable
[1:59] standard that addresses life safety, neighborhood compatibility, and tax
[2:04] compliance. This item comes forward in response to city council's direction and
[2:09] community concerns related to STR operations, particularly around noise,
[2:15] parking occupancy, and the city's ability to ensure hotel motel tax
[2:20] compliance. At a high level, this amendment modifies
[2:24] three sections of the code. First is chapter 605 business licensing. Second
[2:29] is chapter 655 hotel motel. And third is the UDC. There are key operational
[2:37] standards. Uh for occupancy, two persons are allowed per legal bedroom plus two
[2:42] additional occupants, a maximum of 10 occupants unless otherwise approved by
[2:47] the fire marshall. parking. Uh, one off- streetet parking space per bedroom up to
[2:52] four spaces. For properties located in downtown, on street parking within a
[2:57] quarter mile may be used to satisfy this requirement. For noise and events, there
[3:02] are quiet hours of operation from 11:00 p.m. to 6:00 a.m. And outdoor amplified
[3:08] sound is prohibited during this time, and it does not allow for commercial or
[3:12] ticketed events. Life safety uh requires smoke detector,
[3:17] carbon monoxide detector and fire extinguishers
[3:21] as a self compliant report and a code compliant egress.
[3:28] For local contact, a responsible agent must be available 247 and respond on
[3:34] site within 60 minutes. The development advisory committee has reviewed this
[3:38] item at their January 20th meeting and recommends approval. Based on the
[3:42] analysis provided in the staff report, staff recommends approval of the UDC
[3:47] text amendment for short-term rentals as presented.

[4:51] for the commission to only look at short-term rentals. It does not address

[5:09] proposed to
[5:13] address the needs of the community as well as the needs of the rental
[5:18] individuals, we're we're not really
[5:22] addressing the needs. If we're only looking at those that are
[5:26] renting for 30 days, we're also then not we're not looking at a comprehensive
[5:32] plan because then our community also is not asking the same for landlords. We
[5:39] only ask for them to voluntarily submit their contact information. We're
[5:46] asking for short-term rental landlords, hosts to be available or have
[5:52] an agent available 24/7, but we're only asking for our landlords in the
[5:57] community to voluntarily give contact information
[6:01] if they were needed to be contacted in case of an emergency. It seems like
[6:05] quite a disparity. It seems to me that it would be a better for our commission
[6:11] to look at a comprehensive plan that would address all of these areas and not
[6:17] just that of short-term rental. And I agree with you, Mr. Henning, that a 247
[6:23] 60 minute uh uh prompt response time. I'm sorry. My
[6:32] husband has decided that we should take this venture. But there are times when I
[6:38] can't be available within 60 minutes and he is working and I know [clears throat]
[6:44] that he can't. Um it's just not realistic.
[6:50] Um, I want to comply and I will agree that if if the proposal is the same as
[6:56] it was last month, it does it also does not address how we're going to fulfill
[7:05] the safety requirements. Who's going to meet those? Who who's
[7:10] going to police? Excuse me, that's not really the best term, but who's going to
[7:18] police that that the properties are meeting the safety requirements?
[7:23] It's purely voluntary if we are not implementing something that requires
[7:30] and that would have to be funded, but for the the fire department to come out
[7:33] and and and to inspect each property, um I just think it needs to be more
[7:40] complete. I want our guests in our community to be
[7:46] safe, but I just think it needs to be thought out better.

[9:14] sense about discussing what the comprehensive plan talking about
[9:18] short-term, midterm, and what she suggested and having a plan in place for
[9:23] everybody. and we want to make sure that we're taking care of all of our
[9:26] residents and our neighborhoods are safe. Of course, that's the main
[9:30] objective. Um, I would support responsible
[9:34] short-term rentals with clear enforceable standards that protect
[9:38] neighborhood integrity and property values rather than overly restrictive
[9:42] owner and occupancy mandates. I believe requiring a [clears throat] local point
[9:46] of contact, somebody who can respond within 24 hours to have somebody
[9:51] designated is a is maybe a practical way to ensure accountability.
[9:56] Enforcement should be complaint driven and focused on repeat verified
[10:01] violations with registration escalating penalties and potential permit
[10:06] suspension for chronic offenders. responsible pro property owners
[10:10] shouldn't be overburdened but persistent problems should have real consequences
[10:16] and we talked about uh some enforcement mechanisms
[10:21] and I had a chance to look at some I'm sure the rest of you probably glance at
[10:25] something I saw something where it mentioned something about registration
[10:28] and permit requirement u doing that annually reg doing an annual
[10:33] registration with the city uh having a 24-hour contact require environment.
[10:39] They must respond within a set time frame. And maybe a three strike rule
[10:45] repeated verified violations for such things as noise, nuisance, and safety
[10:51] would result in fines and possible permit suspension. And also permit
[10:56] revocation for chronic violations, but only after due process. And of course,
[11:01] complaintbased enforcement. enforcement should be triggered by documented
[11:06] complaints but with no random inspections and getting to the point
[11:10] where the group brought in they came in there talking about the child care
[11:14] centers I think that's very important that's something that should be
[11:17] addressed [clears throat] we should probably have some kind of stipulation
[11:21] to protect the children and in those type of areas for whatever our zoning
[11:26] requirements are and again to address uh the lady who came in and talked about
[11:32] the mid uh term rentals as well. I think that's something we should consider.

[15:52] neighborhood. Uh inhome daycarees are identified as a conditional use within
[15:57] residential districts and are required to remain subordinate to the primary
[16:01] residents residential use of the property.
[16:06] uh with the proposed conditions listed in the staff report, the request is
[16:09] consistent with the intent of the zoning district and is compatible with the
[16:14] surrounding residential properties. In addition to maintaining and renewing a

[17:26] daycare uh within the next couple months. This is just temporary for us to
[17:31] be able to resume business until we can secure our outside facility and will no

[18:28] I live at 9309 Southwest Orchid Court. I'm just east of
[18:34] where the proposed daycare is wanting to go.
[18:38] So, let me give you a little background. We got [clears throat] lucky. We hit the
[18:40] jackpot in 2021 after living in Independence my entire
[18:45] life. I'm 67 years old. My wife is in her 60s. We spent our entire life there.
[18:51] We hit the jackpot, moved the Blue Springs, moved into a little nicer
[18:55] upscale neighborhood. The perfect scenario was finding a
[19:00] culde-sac that backed up to nothing but woods. And we found that and it's been
[19:07] absolutely wonderful. We have one of the smallest of all of the actual culde-sacs
[19:14] in the neighborhood. There's only five homes.
[19:17] That's it. Five. Clark and Robin live at the main entrance that ties into Orca
[19:22] off of of Conch. And then there's four homes wrapped around the bottom of the
[19:28] circle. Out of those five homes, three of them
[19:32] have retirees. My wife and I are retired. Clark's retired. We have le uh
[19:40] police officer detective that's retired. So you kind of get the feel for what our
[19:46] little culde-sac kind of looks like. We love kids. We all have kids. We've
[19:51] raised kids. We have grandkids. So so on and so forth. One of the things that we
[19:57] got was this ladder. And oh, excuse me. And unfortunately, this didn't go out to
[20:02] our entire neighborhood because it had a boundary limit on it of 185 ft. That's
[20:08] it. So nobody else outside of who's here. one of the neighbors son's having
[20:14] a birthday so he's spending that with his family so didn't have a lot of time
[20:18] to really get prepared and you know with something like this it could either be
[20:23] in the favor of the neighborhood or maybe not as favorable for the
[20:28] neighborhood so that's why I'm here so what I did in the process of trying to
[20:32] find out we didn't have a lot of time to put things together I couldn't believe
[20:36] how efficient the blue springs government actually is this thing right
[20:41] here I thought I'm going to find out what there is to know about home
[20:46] industry. That's what I wanted to know. I wanted
[20:49] to learn about it. And when I got to gleaning through some of the pages here,
[20:53] one of the most important things here is on this page. It says things to
[20:58] consider. If you live in a neighborhood managed by a homeowners association, it
[21:03] is a good idea to check whether it can restrict your business activities.
[21:09] Well, I'm here to tell you that we have a very robust website.
[21:16] All the information that you need if you live in that neighborhood could be found
[21:20] on that website. ARC request forms. That's the first thing that needed to
[21:26] happen with this case was that they needed to glean through, get an ARC
[21:31] request, send it in, let it go through the approval process.

[22:40] one thing. Playing outdoors, they have no fenced in area there. And they back
[22:46] up to one of the two entrances, main entrances into our neighborhood, which
[22:51] is uh Timber Meadows. My concerns are
[22:58] we have a swimming pool. We have a a walking trail that goes all the way
[23:03] around. What happens if they take the kids out and somebody falls and gets

[23:32] situation that we have right now. If that is in case the fact,
[23:37] okay? Because right now, uh the neighbors that are here, we're not in
[23:42] favor of having a daycare in our culde-sac.

[26:38] to obtain a business license which is um kind of where one of the conditions
[26:42] comes in that they have to meet all state requirements which is kind of
[26:46] where the fencing that the the residents brought up would come into play is
[26:50] they'd have to meet all the requirements for the state to obtain state lensure
[26:55] and then they would be given a city business license

[27:06] triggered this is because when they submitted the business license and we
[27:10] saw the number of children that's when uh myself reached out to the applicant
