[15:47]
oh seven Hoover late
[15:49]

[15:54]

[17:03]
for public comments received ... into your office
[17:08]
thank you Mr Deputy Mayor I confirm that notice of
[17:11]
this public meeting was given in accordance with the planning
[17:13]
act and in response comments have been received
[17:17]
council has received the comments in their entirety and what
[17:19]
I'm reading right now is just a summary of those
[17:22]
thing comments from the county of great given that the
[17:25]
uses existing and all new development or change of use
[17:28]
is proposed county staff have no significant concerns with the
[17:32]
subject application it is recommended that further comments be received
[17:36]
from the conservation authority regarding the proximity to to Georgian
[17:39]
bay from Kerry Eagleson I am writing to you to
[17:43]
support the rezoning application I do have several questions that
[17:46]
I would like answered how did the zoning get changed
[17:50]
in two thousand eighteen why is it taking so long
[17:52]
to correct this problem this is clearly an error and
[17:55]
should be corrected immediately the machine of the zoning amendment
[17:59]
in the first place from don rate over the years
[18:03]
construction of new built around our property and the associated
[18:06]
grading changes that was recommend
[18:09]
the surrounding lots have significantly raise the ground level and
[18:12]
has resulted in an increase in stormwater runoff through our
[18:15]
property increased lot ... run walk run up is now
[18:20]
joining
[18:22]
in an increasing groundwater level the current zoning of the
[18:25]
applicant's property being open space does indicate some thoughtful planning
[18:29]
for stormwater control my rezoning back to residential the township
[18:34]
will in effect removal planning opportunity for stormwater controls in
[18:38]
this area and continue to ignore the effects on our
[18:40]
property we respectfully request that the township insurers that in
[18:45]
rezoning this land the effects of storm water and increased
[18:48]
groundwater on our property ... adequate adequately mitigated and that
[18:52]
there will be no negative impact where property due to
[18:55]
this application and that's it ... Mr chair
[19:00]
thank you ... with that I will take it to
[19:03]
... staff to start and then and into council
[19:12]
our presentations are planning service development one of seven who
[19:16]
were lane ... who's gonna walk us through this
[19:21]
... ... ... I'm going to walk through ... Walker
[19:25]
this presentation ... throughout the
[19:28]
you wanna call it dawned on me my name's Alexander
[19:30]
Graham planner to for the for the town
[19:34]
... so as with that the ball is that this
[19:36]
is a public meeting for site specific zoning bylaw amendment
[19:40]
for one oh seven moved away
[19:43]
our next slide please clean up
[19:46]
... this is that in general information that the application
[19:49]
... the property is owned by Gordon felt heavy and
[19:52]
then she did consent ... the town of the blue
[19:55]
mountains is actually the applicant missed eight on the order
[19:58]
detail will be ... provided on that aspect a little
[20:01]
later on the presentation
[20:04]
the property is located walk Devin Booker lane which is
[20:06]
in the general secretary of AMPA down area ... and
[20:11]
the property in question is about twelve hundred square meters
[20:13]
in size
[20:15]
and next slide please
[20:18]
I'm in terms of the application to protest ... there's
[20:22]
a few major milestones ... at this point we are
[20:24]
at the public meeting stage ... and before there's a
[20:28]
decision made by council and there's any bylaw considered by
[20:31]
council ... following today's staff are going to complete a
[20:34]
more detailed review of the application including the comments received
[20:38]
... as well as throughout the planning documents
[20:43]
I think I just
[20:46]
they have lost the presentation that
[20:50]
critically ill go back to the tournament yeah something's up
[20:53]
here there we go thank you thank you
[20:59]
staff more than ... prepare reports council ... at this
[21:03]
at this point that specific date is undetermined ... but
[21:06]
just to highlight there's no decision being made today today
[21:09]
is ... the intent of today's is that the pain
[21:12]
comments from the public and and council at this application
[21:18]
next slide please
[21:21]
aerial photo of the subject lands um provide a little
[21:24]
bit of contacts of where where the property is that
[21:27]
you can tell ... the areas yeah I know the
[21:31]
... generally consider that low density residential uses characterized a
[21:36]
single detached dwelling units there has been some ...
[21:41]
some redevelopment of this area where number these properties have
[21:45]
have undergone a new constructed ... with single detached dwelling
[21:50]
units
[21:52]
next slide please
[21:56]
by the subject property is located within the residential recreational
[22:00]
area designation of the town's official plan ... B. R.
[22:03]
A. designation is a settlement area ... is generally comports
[22:08]
residential uses ... thought of their to you just for
[22:12]
a recreational amenity in the area
[22:16]
next slide please
[22:20]
um so the current zoning on the subject property as
[22:23]
open space or the ... Aspell ... and not zone
[22:27]
category I'm no buildings or structures that permitted and no
[22:31]
residential uses are permitted hence the work pants are the
[22:35]
purpose for the zoning in on that
[22:38]
our next slide which will provide more detail on that
[22:42]
aspect
[22:44]
so formally this part of this property was zoned R.
[22:49]
street with a small portrait of open space along need
[22:52]
this provides both David garden bay there is an amending
[22:55]
bylaw is in that and nineteen ninety two ... which
[23:00]
rezoned
[23:02]
property in order to increase the size are result of
[23:05]
the land ... and I was under the former colony
[23:08]
bylaw bylaw eighty three forty of the township of calling
[23:12]
with ... and not ours rezone permitted a single detached
[23:16]
residential dwelling unit ... and it was under those zoning
[23:20]
provisions that the existing structure was built ... and and
[23:25]
and that at that time did conform with those that
[23:28]
those previous felony provisions
[23:33]
at the end of the passing of the new comprehensive
[23:35]
zoning bylaw and twenty eighteen ... being brought down about
[23:39]
twenty eighteen fifty five on this property was rezoned into
[23:43]
the open space ... completely into the open space owned
[23:47]
allegory ... and at that point the single detached dwelling
[23:51]
unit on the lands ... became a legal non conforming
[23:54]
use
[23:56]
... at the at this time ... it's proposed that
[24:00]
the entirety of the land be rezoned back to the
[24:04]
R. one dash one zone in order to recognize the
[24:07]
existing dwelling unit and use of the land ... and
[24:11]
which is constructed with all the neighboring properties have basically
[24:15]
just to put it back into that that residential zone
[24:17]
category and I should note that no new developments is
[24:21]
proposed that the part of this application it simply to
[24:25]
put it back into the original phone category under bylaw
[24:28]
eighty three forty ... in doing so would that take
[24:31]
away that legal nonconforming use that it would just become
[24:34]
a legal conforming yes
[24:39]
and that's the ... the summary of a staff presentation
[24:43]
hopefully that provides ... some appropriate context so it's it's
[24:47]
from the fact that
[24:49]
thanks Travis ... with that I will open up to
[24:52]
my council colleagues for questions or comments ... doesn't have
[24:56]
any questions or comments for Travis at this time
[25:02]
that way of thinking ... they're out Travis I'm just
[25:05]
gonna ask one so I hate use what housekeeping issue
[25:08]
because this is only as the anything but housekeeping but
[25:10]
is this
[25:12]
is this really more administration than it is change
[25:18]
our
[25:19]
... ... I I would jobs the fact that it
[25:22]
is exactly that it's more of an administrative ... attraction
[25:26]
of that of that building map ... rather than than
[25:30]
any actual physical change on the property
[25:33]
thank you ... with that there's ... make colleagues have
[25:38]
any other questions for Travis
[25:42]
and Madame clerk you have ... you have gone through
[25:44]
all the ... public comments correct
[25:48]
that's correct Mister chair and I confirm that and no
[25:50]
one has registered to speak at today's public meeting
[25:55]
thank you ... with that I believe we can close
[25:58]
off B. one Madame clerk
[26:01]
that's correct Mister chair thank you thank you with that
[26:04]
we ... we have three more on the agenda today
[26:06]
... B. two which is a public meeting revisions to
[26:11]
the sale or other deposit deposition of land policy that's
[26:15]
P. O. L. C. or zero seven zero two
[26:19]
what is being proposed staff are recommending repealing replacing the
[26:22]
current sailing deposition of land policy P. O. L. C.
[26:26]
O. R. zero seven zero two two include revisions that
[26:29]
will make the process clearer and more efficient the revised
[26:33]
draft policy and supporting process supports council's direction not to
[26:37]
consider any request to sell town owned waterfront property staff
[26:41]
are suggesting there were land as been identified as road
[26:44]
allowance street lane way fairly or is of the sizes
[26:50]
deemed not to be building lot actually registered on title
[26:54]
and there shall be no future requests for building permits
[26:56]
or vacancies considered for subject lands because it because of
[27:00]
it being acquired from the town to protect the overall
[27:04]
feel and character of the local area the current policy
[27:07]
allows for exclusions for land formerly used for railway lines
[27:12]
staff suggested that this reference to be removed and the
[27:14]
land that was formerly a railway line in most cases
[27:18]
is currently with alignment of the Georgian trail
[27:21]
for the exception of the sections of the trail that
[27:23]
have an existing realignment staff recommend that no sale of
[27:27]
these lands that be part of the former railway line
[27:30]
shall be considered for potential disposition or surpluses for the
[27:33]
foreseeable future town staff recommend a process where twice a
[27:38]
year consideration may be brought forward to consider land surplus
[27:42]
with the purpose
[27:44]
being to dispose of land from the town's current land
[27:47]
inventory
[27:54]
we cannot start by about employers as a without interacting
[27:58]
with the clerk
[28:00]
thank you ... I just wanted to make mention that
[28:03]
notice of this public meeting has been given in accordance
[28:06]
with our notice policy in response comments have been received
[28:10]
I confirm that all the comments received were circulated to
[28:13]
council in their entirety and what it I'm reading right
[28:15]
now is just a summary of those seen comments
[28:19]
I'm Paul Graham and Sally leopard we are in support
[28:22]
of the provision to prohibit the sale of publicly owned
[28:25]
let owned waterfront lands being road allowances etcetera the town
[28:29]
has a scarcity of publicly accessible waterfront lands considering the
[28:33]
extent of our shore line thus protecting the what the
[28:36]
lands we have is vital the town is encouraged not
[28:40]
only to protect the lands we all but to develop
[28:42]
a water front acquisition policy in order to take advantage
[28:45]
of extending public access to the waterfront when opportunities arise
[28:50]
thank you for the opportunity to provide our comments from
[28:53]
John roar with respect to the public meeting to be
[28:56]
held on January twenty fourth at one PM I have
[28:59]
two questions with two parts as they relate to adjoining
[29:02]
owners that have joined town owned lands described as a
[29:06]
stopped up non traveled road allowance that may be deemed
[29:10]
surplus these may have been stopped up and close but
[29:13]
it joined both residential and employment lands currently my driveway
[29:18]
and garage is at the end of a stocked up
[29:21]
non traveled road allowance stopped up stopped up post op
[29:26]
motion is also stopped off close our motion to in
[29:31]
two in a row allowance on the other side the
[29:34]
services access to employment lands the full length of my
[29:37]
property adjoins a non traveled road allowance my driveway has
[29:41]
utilized this non travel road allowance since the nineteen fifties
[29:45]
as a provides access to my garage which is at
[29:48]
the end of the non travel grow allowance question number
[29:52]
one eight with the surplus lands be considered a joining
[29:57]
to commercial lands where the residential I'm traveled road loan
[30:00]
stoppage is located where employment or I see I land
[30:03]
begins and B. what guidelines are are being discussed that
[30:08]
prevented commercial purchaser from acquiring surplus lands in a residential
[30:13]
zone and
[30:14]
using them as an access road to the employment lands
[30:17]
question number two
[30:19]
eight I have been steward of the land since I
[30:22]
moved to the area in two thousand fifteen what liabilities
[30:26]
what I face if the appraised value of this land
[30:28]
is deemed unaffordable and another purchases that being if another
[30:33]
purchases this property when I lose my access to my
[30:36]
driveway and garage thank you for taking the time to
[30:38]
respond to my questions from Allison mackenzie as an adjoining
[30:43]
landowner to a possible disposition of a road allowance I'm
[30:47]
wondering about the possibility of a first right of refusal
[30:49]
to purchase this land I would also like to ask
[30:52]
whether the flow chart included in this file is representative
[30:56]
of how things are going to proceed in the future
[30:58]
alright this is the past flowchart and Mister chair ...
[31:01]
Heery Burkman also provided comments Mr Bergman is on the
[31:05]
line so I will leave it to Mr Bergman to
[31:08]
provide those comments you may be having some technical ...
[31:11]
difficulties with the sound that we'll see if you can
[31:13]
provide those comments or questions thank you Karina Mr Bergman
[31:17]
can you hear us
[31:20]
you can you hear me now go to your telephone
[31:23]
it's just big through the phone there you go
[31:27]
no that's that's worse
[31:30]
maybe in your microphone on the computer Mr Bergman
[31:40]
while he's doing that Mister chair ... if you wanted
[31:44]
to go to the town presentation Shawn Everett CA ...
[31:47]
he has a presentation
[31:49]
to provide where we owe to the public actually all
[31:51]
right ... thank you so with that ... Mr Brookman
[31:55]
well your figure that out where to go to R.
[31:58]
C. A. O. Sean Everitt Sean Doherty
[32:03]
thank you at Deputy Mayor aboard you know
[32:08]
if you can go to the next slide yeah
[32:11]
so just a bit of an overview of how we
[32:14]
got here ... we broader brought forward a ... ...
[32:18]
report in November first of twenty twenty one I would
[32:21]
line ... the ability for us to move for with
[32:24]
this public meeting ... which shall over the Christmas break
[32:28]
identified the January the twenty fourth is being ... today
[32:32]
being that the date for the public meeting next light
[32:37]
as you can see the
[32:42]
public notice in the approval process ... we've all the
[32:44]
required public notice ... ... process ... with some additional
[32:50]
time being provide it and ... looking towards ... report
[32:55]
coming back to council ... with follow up to this
[32:59]
public meeting ... that would be at anticipating February the
[33:02]
fifteenth and if all goes well and we're able to
[33:06]
provide the information for council we would see the ...
[33:10]
of the March twenty eighth ... council are considering the
[33:12]
recommendations from the March fifteenth committee of the whole next
[33:16]
slide
[33:19]
the key things that ... we want to identify through
[33:22]
this ... public meeting is first that we already have
[33:25]
an existing land disposition of Policy but thought it would
[33:29]
be appropriate time to have of some ... ... revisions
[33:34]
review completed ... we're seeing over the last number of
[33:38]
years a definite intake ... opted to the number of
[33:41]
requests for ... potential disposition of lands from a residence
[33:46]
... council had made it very clear ... decision and
[33:50]
recommendation ... for us not to for staff not to
[33:54]
consider town water front properties as being surplus this ...
[34:00]
... staff is moving forward with that same understanding that
[34:04]
... water front access that would not be considered for
[34:07]
... disposition of lands I think one of the key
[34:10]
areas and and some of the comments received thus far
[34:13]
to the public in regards to the road allowance in
[34:16]
the streets and laneways and fire lanes ... there is
[34:19]
a lot of work and I think some additional explanation
[34:21]
that we're happy to provide through the follow up to
[34:24]
the public meeting these are actually the areas that you
[34:27]
know we're very interested in and having further discussions with
[34:30]
council just to consider ... on our on a regular
[34:34]
and very consistent basis how we deal with these ...
[34:38]
... these types of properties where they may be a
[34:40]
stopped up in close around on open road allowance or
[34:43]
fire lane ... we feel that the municipality is in
[34:46]
a position where we would like to get the clarity
[34:48]
and consistency of how we deal with these on a
[34:51]
regular basis ... and one of the key things in
[34:55]
this goes back a number of years ago the protection
[34:57]
of the Jordan trail is as critical and one of
[35:00]
one of the things that we believe that should be
[35:02]
in the disposition of land policy very clearly is that
[35:05]
no areas within the Georgian trail will be considered a
[35:09]
surplus in the future ... just for the clarity in
[35:12]
and again the consistency for individuals who may wish to
[35:16]
... make that request
[35:18]
it would be ... very ... very handy for staff
[35:21]
to be able to just clearly state that the lands
[35:24]
that ... affect the Jordan trail would not be considered
[35:28]
... the other key thing which is that we thought
[35:31]
it was was a good idea was to be able
[35:34]
to bring the council twice per year there the request
[35:37]
for this positions of land so ... that way we
[35:41]
could be doing in a very consistent and transparent ...
[35:44]
method where ... council would be considering any disposition of
[35:49]
land are as a group as opposed to one office
[35:52]
the other one of us are very you know
[35:56]
they're fine but for council to be able to take
[35:59]
a look on a regular basis of any request in
[36:02]
a very ... consistent manner I think would be very
[36:05]
beneficial ... just when you start consideration are considering where
[36:09]
potential lands could be declared surplus
[36:14]
the next slide thank you grant ... the appraisals for
[36:17]
specific types of land and we're very very clear that
[36:20]
not these would not be for building a redevelopment properties
[36:24]
we believe that there is the ... a benefit to
[36:28]
getting appraisals done for our ... certain types of lands
[36:32]
whether or not there be per per meter per square
[36:36]
meter per ... that could be wrong allowances or we
[36:39]
could just simply say this is this these these appraisals
[36:43]
would actually create the minimum bets um so we were
[36:46]
to go out and say you know this road allowance
[36:49]
I don't run allowance that's been stopped up in close
[36:52]
that it meets all the requirements as we went through
[36:55]
a public process public consultation process we could just simply
[36:59]
say based on the appraised value this is the minimum
[37:02]
bid ... ... we have seen in the past where
[37:06]
you know trying to do the appraisals as we go
[37:10]
...
[37:12]
it it it becomes very very ... time ... time
[37:17]
management sort of gets thrown out the window because it
[37:19]
is it is sometimes very hard from a timeliness to
[37:23]
get appraisals done so this would just allow us to
[37:25]
move the process through from appraisal process the one key
[37:29]
thing that I do want to make very clear through
[37:30]
this disposition of land policy is that this is only
[37:34]
the process for council to be brought forward a recommendation
[37:39]
to consider lands surplus this does not replace the public
[37:45]
consultation process so that's still process staff could come forward
[37:49]
to council and suggest three or four different piece of
[37:53]
the property is being concise being able to be considered
[37:57]
for this position
[37:59]
if council so where's the would still require ... staff
[38:03]
would still require council approval to initiate the actual public
[38:06]
consultation process so I know that there is a there
[38:10]
is a fear that this would ... maybe replace that
[38:13]
does not replace it all this just to simply allows
[38:16]
us to get the subject matter in front of council
[38:19]
if council wished to for most for staff to initiate
[38:22]
the public process to then consider lands surplus dot public
[38:27]
process would still take place and council with that and
[38:31]
with the benefit of hearing from the public and local
[38:33]
residents of whether or not they believe it's a good
[38:36]
idea to sell land that process is still in place
[38:41]
the next slide
[38:44]
so next steps is ... we we plan on on
[38:47]
receiving ... reviewing the public comments that have been received
[38:51]
... and then provide a follow up report we've identified
[38:55]
February the fifteenth ... to bring up a follow up
[38:58]
report back to committee the hall ... and some of
[39:02]
the ... the comments that we've received to date R.
[39:05]
one R. wanna thank the public for providing those ...
[39:08]
they acted they have provided some good additional insight for
[39:11]
staff to be able to go back and ... and
[39:15]
review ... those comments and also provide the clarity that
[39:18]
... the cap and that the public can council's looking
[39:21]
for thank you for that
[39:25]
thank you shot
[39:27]
... with that before I go to the council and
[39:30]
see if Mr Bergman is ...
[39:35]
it is available for his comment
[39:38]
can you run with you your
[39:42]
Mr back when are you able to hear style yes
[39:46]
on the tele yes we can are you through the
[39:49]
telephone that's great okay with apologies sorry ... I bought
[39:53]
a new computer a week ago and I'm having trouble
[39:56]
connecting to teams ... might sound ... I can see
[40:01]
that ... I'm there ... video Weiss ...
[40:05]
I have no substantial ... issues with that what is
[40:10]
proposed ... what I do note and I've sent a
[40:14]
letter is that the official policy only does half of
[40:21]
what the province intense and the province by the Municipal
[40:26]
actors established that the municipality shall have an official policy
[40:32]
that deals with sales and other dispositions of land
[40:38]
and if one looks through the existing policy
[40:42]
dating back to two thousand and eight it only deals
[40:46]
with sales it doesn't deal with other dispositions of land
[40:51]
although which entitles sale and other dispositions of land ...
[40:57]
I provided a ... a copy of the existing policy
[41:03]
and ... I'm uncertain effect can be showing online and
[41:08]
I will ... to show ... by color highlighting exactly
[41:13]
what I'm referring to is is that possible
[41:18]
Mr it
[41:20]
thank you so the comments that that Mr Bergman's sent
[41:23]
and they were circulated to council in their entirety we
[41:27]
don't we have the policy here in front of us
[41:28]
but we don't have is highlighted document in front of
[41:31]
us oh okay well alright then then we'll proceed so
[41:36]
you can see the subject title on page one of
[41:38]
sailing of the disposition of land ... the policy direction
[41:42]
is the sale another disposition of land the application of
[41:47]
the bottom line refers to the sale and other disposition
[41:50]
of land but then when we had two pages to
[41:54]
through the conclusion there are no more references to other
[41:58]
dispositions of laughter it's all sales that's what happens if
[42:02]
you sell ... the same with the current with the
[42:07]
proposed new policy ... it is called the policy for
[42:11]
the sale of and disposition of land but it only
[42:15]
deals with sales and so one would ask for what
[42:19]
is other disposition of land well it would include at
[42:23]
least it would include a ... a license it would
[42:27]
include a right of way it would include a permit
[42:31]
so there are so many ways that one can actually
[42:36]
... have a transaction with respect to lamb that is
[42:39]
not a sales so what is happening here is the
[42:43]
town ... and I believe this happened sort of inadvertently
[42:47]
dating back to prior to two thousand and eight ...
[42:51]
has only concerned itself with sales but you no one
[42:55]
can the end and by the way I I don't
[42:58]
know offhand where to locate the registry of town owned
[43:04]
lands according to this document it's supposed to be a
[43:07]
public document but when I go to the ... the
[43:10]
website I I can't locate it but the town owns
[43:14]
land and road allowances and rapes and throughout the ...
[43:19]
is
[43:20]
its geographic boundaries and ... there are future developments ...
[43:28]
both for the infrastructure and ... you know residential ...
[43:34]
in the prospect and the town can basically circumvent all
[43:39]
these policies are for sale by simply leasing the lands
[43:45]
giving a right away over the lands giving a right
[43:48]
to occupy the lands giving a license for the lands
[43:52]
so in that regard ... this policy is is basically
[43:57]
half good it doesn't cover half of what the municipal
[44:01]
act says that it's supposed to cover and ... ...
[44:06]
it's an easy oversight but there are too many transactions
[44:10]
that can possibly happen going forward ... for ... you
[44:15]
know such an oversight to be allowed to continue it
[44:18]
also is
[44:20]
strictly speaking in violation of the municipal act requirements I'm
[44:25]
at a few comments that I did make ... in
[44:28]
my letter with respect to what is proposed ... the
[44:33]
... number one was the word ... best use ...
[44:39]
as a modifier of fair market value ... I I
[44:44]
I I I realize this is the thorny issue and
[44:47]
it's very difficult ... but ... in one place the
[44:50]
proposed new policy says that they will be ... ...
[44:54]
potentially requesting a best use fair market value appraisal well
[45:03]
we'll be ... ... that that that will be an
[45:06]
interesting challenge ... you know to obtain exactly that appraisal
[45:12]
I understand the the the complexity ... is there there
[45:17]
is we're doing and the ... ... you know that
[45:22]
the public benefit may be considered ... but in my
[45:25]
letter I basically ask what is the best use for
[45:29]
a piece of property that could potentially be a park
[45:33]
or a beach is at a park or a beach
[45:36]
or is it a ... commercial subdivision
[45:40]
and ... recently I was ... ... in ... southern
[45:45]
Ontario town driving along and I noticed all these beautiful
[45:48]
beach fronts and very expensive ... you know subdivision country
[45:53]
and ... and that thought that came to my mind
[45:57]
... there is an out clause one G. of the
[46:01]
procedures of the ... sorry clause one a of the
[46:06]
procedures ... and that deals with requests and I believe
[46:11]
it's just the sort of garbled for lack of a
[46:15]
better description request may be received and considered twice per
[46:18]
year and that it goes on to say formal requests
[46:22]
will be submitted to the town via a formal request
[46:25]
for consideration
[46:27]
by individuals groups and our corporations or number company now
[46:35]
... I I don't know what's meant by that does
[46:38]
the town have corporations and a number company that can
[46:42]
be making requests or is it just basically a a
[46:45]
clause that needs to be ... ... we worked hard
[46:50]
because as it stands it sounds like the town's corporations
[46:54]
maybe making requests to buy town owned land but that
[46:58]
doesn't make sense so ... just to a tiny issue
[47:03]
and then the final thought I had was ... in
[47:06]
the timing clause under proposed call us proposed policy clause
[47:11]
one G. it refers depending council direction to to clear
[47:16]
the town owned lands surplus staff may proceed with the
[47:21]
disposition of town owned land and follow the process outlined
[47:25]
and I I do believe that the intention is that
[47:30]
... council would direct before staff proceeds with the any
[47:37]
disposition ... so other than that ... might be ...
[47:42]
a better comments are in my letter and if you
[47:46]
can turn your attention when you have a chance to
[47:49]
the color highlighted versions of the existing policy on the
[47:53]
current policy you'll notice thank thanks means sale and you'll
[47:59]
notice in those pages where they're at the highlighting is
[48:01]
just paying there is no green meaning for other dispositions
[48:07]
so ... I'm available to my attorney questions you may
[48:10]
wish to ask
[48:12]
thank you Mr Bergman ... during during the the public
[48:16]
section ... we'll take that take the notes in from
[48:18]
from yourself and ... there's normally not back forth on
[48:22]
the on the on the public comments section but I
[48:25]
know I saw our CEO us writing notes as you're
[48:28]
going along ... for that process most definitely ... so
[48:32]
Sean if you wanna comment on that
[48:34]
thank you W. more Deputy Mayor working out I wanna
[48:37]
thank ... misprint for forced comments I will ensure that
[48:41]
those comments and the review of his document ... are
[48:45]
part of the ... report follow up report to the
[48:49]
public being great points ... you know very helpful ...
[48:53]
from from the perspective of of this sale as compared
[48:57]
to the lease ... and the license in the right
[49:01]
way comments so those ... those points will be ...
[49:04]
included in the next ... follow up report and ...
[49:08]
... I would suggest that we may I may actually
[49:11]
retired at some point during the drafting of that report
[49:13]
to ... Mr Bergman just to make sure that we're
[49:16]
on the right page so ... very very very helpful
[49:19]
comments are being received thank you
[49:24]
yes thank you Mr Bergman the very very clear and
[49:25]
concise comments and ... you know if if that's okay
[49:28]
with you than I do the sale may reach out
[49:31]
to you well is drafting its report if that's alright
[49:33]
with you
[49:35]
yes it is thank you
[49:37]
thank you very much for your comments Mr Bergman boy
[49:39]
were received ... with that man clerk I see councillor
[49:43]
Sampson has joined the meeting if you want to reflect
[49:45]
that in the minutes
[49:46]
and
[49:48]
and with that ... I will go to the counsel
[49:52]
table for questions for Mister Everett ... before we go
[49:56]
back to the other comments so with that ...
[50:00]
council colleagues of my questions for
[50:03]
for Sean press CEO
[50:06]
archer has presentation
[50:11]
any comments relating to the the policy
[50:15]

not read his his correspondence thank you
[50:37]
thank you and Mister Berger that has been distributed to
[50:39]

[50:42]

[50:45]
B. two thank you to all the people that have
[50:49]
responded and I just wanna make sure that ...
[50:52]
M. weather's questions and comments to come in that staff
[50:56]
and I know that is this ... just want to
[50:57]
say that they will be they will be addressed and
[50:59]
sent back out to ... when when people did ask
[51:01]
questions part as part of their correspondence to the proper
[51:04]
department will reach out a business six years ago greetings
[51:08]
it's good is one but the comment there think you
[51:10]
... with that amount of parking not sure if that
[51:14]
matters here yet so I can continue on to be
[51:16]
three ... with the addition of our councillor Sampson
[51:20]
... B. three is revisions to the corporate hiring of
[51:23]
employees policy peel L. C. O. R. zero seven zero
[51:28]

[51:33]

[51:43]

[52:24]
more responsive staffing needs they can in that consistently changing
[52:29]

[52:32]
so with that man clerk ... I will have any

[54:15]
also enhanced our internal process for hiring managers to initiate
[54:19]

... just around the improper influencing our permanent selection decisions
[54:28]
and that's with just within the consequences for non compliance
[54:30]
section
[54:32]
in the next slide please all right so most of
[54:35]
the recommended revisions are around job posting and advertising of
[54:40]
positions and really the intent is to incorporate new strategy
[54:44]
and the bucs ability to allow staff to be more
[54:46]
responsive and nimble to developing conditions while ensuring ... a
[54:51]
fair consistent and transparent hiring process and what is very
[54:55]
much at competitive labor market
[54:58]
the some of those suggest revisions include reducing the number
[55:01]
of
[55:02]
business days a position would be posted for so from
[55:05]
ten to five business days ... and there would be
[55:09]
still that option or if the hiring manager to extend
[55:13]
our that post hosting if they felt it was necessary
[55:16]
... allowing for temporary contract contracts of any duration to
[55:21]
be posted internally first and that would just give her
[55:25]
employees priority consideration for these opportunities so to promote career
[55:29]
development cross training assists with succession planning and provide opportunity
[55:33]
for employees to take on some special work assignment
[55:37]
and another suggest revision and again in an effort to
[55:40]
promote employees from within and retain our greats
[55:44]
yeah if a temporary position becomes permanent so whether that
[55:47]
be through the budget process or ... incumbent not returning
[55:50]
from a leave of absence an employee in a temporary
[55:53]
role would be placed in a permanent position with out
[55:56]
of competition subject to acceptable performance ... and the director's
[56:01]
approval
[56:03]
and next slide please
[56:07]
so those there again just some overview an overview of
[56:10]
some of the proposed revisions and in terms of next
[56:13]
steps ... doppler view public comment that we received I
[56:18]
had to date ... and any suggestion that we received
[56:22]
from council during this public meeting hi as well including
[56:26]
some of the comments that we did receive at the
[56:28]
November twenty third street home meeting as well and then
[56:31]
the report will be brought forward February fifteenth committee of
[56:35]
the whole meeting
[56:37]
addicts thank you and all of minutes any comments or
[56:40]
questions that
[56:41]
council may have
[56:43]
thank you Sir ... for the presentation with that ...
[56:46]
the floor is open to the council colleagues for questions
[56:50]
for our human resources department in relation to this new
[56:53]
policy change
[56:56]
are there any questions for Sir
[57:02]
not seeing any site just of it jabber quick when
[57:04]
... I assume that ... because there the tighter competitive
[57:08]
market and a lot of these changes are being made
[57:10]
and ... I assume that ... from people you compete
[57:13]
against are making similar changes
[57:18]
but it hasn't been a discussion within the HR network
[57:22]
but again we are trying to really justify their own
[57:25]
process then and where we can be more competitive responsive
[57:29]
... at was really ... weren't an internal process soliciting
[57:33]
feedback from hiring interested to make these recommended changes
[57:37]
good to know thank you ... without announcing any other
[57:40]
questions ... Madame clerk over you any that would close
[57:45]
the public comments correct that's correct Mister chair no additional
[57:49]
public comments regarding agenda item be three
[57:52]
thank you with that we can close off the three
[57:55]
and ...
[57:57]
as I have not seen the merit believe still a
[58:01]
conference I will continue on with B. for madam clerk
[58:05]
...
[58:07]
with regard to your vision substantial bylaw at twenty twenty
[58:11]
one seventy six as it relates to timelines associate with
[58:13]
the release of agendas what is being proposed the blue
[58:18]
mountains council will be holding a public meeting to receive
[58:20]
comments on the proposed changes of the procedure bylaw twenty
[58:23]
twenty one dash seventy six as it relates to timelines
[58:26]
associated with the release of objectives number one move the
[58:31]
timeline for the release of agendas to Monday at three
[58:33]
PM one week in advance of the meeting from the
[58:36]
current Wednesday at three PM five days in advance of
[58:39]
the meeting
[58:41]
to move the deadline for submission of correspondence or a
[58:44]
deputation request to Friday at nine AM ten days in
[58:48]
advance of the meeting from the current Monday at nine
[58:51]
AM one week in advance of the meeting
[58:54]
and number three is move the deadline for submission of
[58:57]
correspondence or deputations following the release of an agenda to
[59:01]
Wednesday at twelve noon five days in advance of the
[59:04]
meeting my current Friday twelve noon three days in advance
[59:07]
of the meeting
[59:09]
doesn't close changes ... without Madame clerk will turn it
[59:11]
over to you for public comments received
[59:15]
thank you Mr chair notice of this public meeting was
[59:18]
given in accordance with the town's notice policy in response
[59:21]
to comments have been received the first being a from
[59:25]
the ... communications advisory committee ... their motion is as
[59:30]
follows where's the committees what supports the earlier release of
[59:34]
gender and agenda items and where's the public has been
[59:37]
following the existing agenda released process for the last ten
[59:40]
years the communications advisory committee recommends that the deadline to
[59:45]
provide deputations any correspondence from the public remain the same
[59:49]
being Monday at nine AM
[59:51]
and from Blue Mountain ratepayers association this is from Terry
[59:55]
Keller I read the comments now I'm Terry Keller in
[1:00:00]
my comments on behalf of myself and the Blue Mountain
[1:00:02]
ratepayers association I am currently on that board we support
[1:00:06]
the proposal to move the release of the agenda as
[1:00:09]
from Wednesday to the Monday being seven days before the
[1:00:12]
meetings this move will give ratepayers who may have an
[1:00:15]
interest or concern with an item on and that any
[1:00:18]
agenda and earlier opportunity to research research and prepare however
[1:00:23]
the proposed date for the submission of correspondence or deputation
[1:00:27]
if the taxpayer is to respond to a concern remains
[1:00:30]
at forty five hours after the agendas publication and our
[1:00:34]
experience forty five hours is not adequate to research consult
[1:00:38]
and to prepare proper response members of committees of the
[1:00:42]
blue route repairs Association have always struggled with and sometimes
[1:00:45]
fail to meet the short timeline would it be possible
[1:00:48]
to have the deadline at nine AM on the Friday
[1:00:51]
prior to the meeting
[1:00:53]
as volunteers we have neither managers nor staff to handle
[1:00:56]
the work and so we must budget our time many
[1:00:59]
interested citizens have working families and often the research and
[1:01:02]
preparation must be accomplished in the evenings we feel that
[1:01:06]
this would encourage more more participation by taxpayers worth both
[1:01:11]
working and retired the process can be intimidating and the
[1:01:15]
average citizen it made it takes time to find out
[1:01:18]
what the process is and to work through it participation
[1:01:21]
in a democracy is everyone's right and this is just
[1:01:24]
the role should allow that participation to be easy and
[1:01:27]
achievable please consider this recommendation as it comes from the
[1:01:30]
extensive experience of art association and that's it Mr chair
[1:01:36]
thank you Madame clerk and thank you to the communications
[1:01:39]
the treasury committee as well as ...
[1:01:42]
Terry and ... the PMR A. for their comments without
[1:01:45]
a water bacteriophage station Madame clerk thank you Mr chair
[1:01:51]
so I have a small presentation just to go over
[1:01:54]
the proposed changes
[1:01:56]
I'm on the second slide you'll see um we received
[1:01:59]
a direction from council to move forward with the public
[1:02:02]
meeting at today to ... provide ... to allow the
[1:02:06]
public an opportunity to provide their comments in response to
[1:02:09]
the proposed changes
[1:02:12]
the next slide shows of the public notice and approval
[1:02:15]
process we received that ... council direction we advertised on
[1:02:20]
in the newspaper and on the town's website we ...
[1:02:24]
received correspondence interest in response being two comments
[1:02:29]
... if the depending on on how many comments are
[1:02:33]
received to date I'm hoping to provide a follow up
[1:02:36]
report to the public meeting ... to the committee of
[1:02:39]
the whole meeting on February the first
[1:02:42]
and recommendations from February first maybe the whole will be
[1:02:45]
considered by council on February the fourteenth
[1:02:49]
she was gonna do a short overview of the proposed
[1:02:52]
revisions
[1:02:54]
so
[1:02:55]
the proposed revisions are the deputation requesting correspondences are to
[1:03:00]
be included on the council committee the whole agenda must
[1:03:02]
be received by the clerk's office by nine AM on
[1:03:05]
the Friday being ten days in advance of the subject
[1:03:07]
meeting
[1:03:09]
council committee the whole agendas are released by three on
[1:03:12]
the Monday prior to accounts or committee of the whole
[1:03:14]
meeting this will be our one week in advance of
[1:03:17]
the meeting
[1:03:19]
following the recent release of the agenda as the public
[1:03:21]
will have until noon on the Wednesday evening five days
[1:03:24]
in advance just a minute Deputy shore Custer correspondence in
[1:03:28]
response to any matter that's included on the agenda on
[1:03:30]
an agenda at the in the council or committee of
[1:03:33]
the whole
[1:03:35]
the revised council committees will agenda is released by the
[1:03:38]
end of the day Wednesday five days in advance of
[1:03:41]
the kit councillor committee of the whole meeting
[1:03:45]
and on the following the next page I've done a
[1:03:47]
bit of a a summary just to show the current
[1:03:50]
in the proposed deadlines
[1:03:53]
what you'll see is an example of the deadlines as
[1:03:56]
it relates to the January thirty first council and February
[1:03:59]
first committee of the whole meeting so the first bulleted
[1:04:02]
item ... the so anyone that wants to appear as
[1:04:06]
a deputation earth provide comments or correspondence to council of
[1:04:11]
the current deadline is Monday January twenty fourth at nine
[1:04:14]
AM the proposed deadline would go to the Friday January
[1:04:17]
twenty first at nine AM
[1:04:20]
the council committee the whole package is released the current
[1:04:23]
deadline is Wednesday January twenty six the proposed deadline would
[1:04:28]
be Monday January twenty fourth
[1:04:32]
once that packages released ... that often he also will
[1:04:36]
be aware of the public will receive a package and
[1:04:40]
they'll say ... I would like to submit deputation request
[1:04:43]
or correspondence in response to an item that's included on
[1:04:46]
the agenda so that deadline will move from the Friday
[1:04:49]
immediately before the meeting to the Wednesday being five days
[1:04:53]
in advance from the from the current three days in
[1:04:56]
advance
[1:04:58]
and then the revised agenda including all additional deputations and
[1:05:02]
correspondence currently the deadline if it's released by end of
[1:05:06]
day Friday now we'll go to Wednesday January twenty six
[1:05:10]
days that
[1:05:13]
I believe rob since
[1:05:16]
is that question
[1:05:19]
yeah really just just your summary amount parking then we'll
[1:05:21]
go to council sense okay thank you ... and next
[1:05:25]
steps counts ... staff will review the public comments and
[1:05:28]
council's comments and bring forward at a follow up report
[1:05:31]
for council consideration if it fits council's desire we will
[1:05:36]
pass that a by law to amend the procedural
[1:05:40]
I can answer any questions
[1:05:42]
thank you Madame clerk ... I believe that should be
[1:05:45]
February first twenty twenty two cal football sorry thank you
[1:05:50]
no problem ... with that I will turn it over
[1:05:52]
to the counsel table and I can sense and because
[1:05:55]
it's virtual end up near ... Bravo at
[1:05:59]
yes thank
[1:06:00]
you're going up so what would be the fix them
[1:06:03]
to the point that Terry raise I guess it would
[1:06:06]
be going back to the Friday is that is that
[1:06:08]
the fix it would fix the concerns done so and
[1:06:13]
thank you through you Mr chair so concern raised by
[1:06:17]
Keller implement ratepayers association was this the span of time
[1:06:21]
between when the package goes out so currently the package
[1:06:25]
goes out on the Wednesday and anyone wanting to submit
[1:06:28]
a correspondence or deputation in response to an item on
[1:06:31]
the agenda what would have until the Friday so that
[1:06:34]
would be from Wednesday at potentially three and tell Friday
[1:06:39]
at noon so what I'm proposing is is moving those
[1:06:42]
dates back two days old the package what Monday they
[1:06:47]
would have until Wednesday noon so ... Mr Keller is
[1:06:51]
asking if we could continue the deadline being a Friday
[1:06:56]
so they would have until from Monday when the package
[1:06:59]
is released so the Friday at noon to provide that
[1:07:03]
additional deputation there or correspondence to be added to ...
[1:07:08]
to the package the concern I have with that
[1:07:12]
is that
[1:07:14]
when we receive the follow up visit deputies request a
[1:07:17]
follow up correspondence what happens is we receive that the
[1:07:21]
package goes out Friday afternoon it includes it could include
[1:07:25]
a number of deputations could include a number of number
[1:07:29]
of additional correspondences then
[1:07:32]
eight trigger sometimes others wishing to provide additional comments and
[1:07:36]
when we meet on Monday morning at nine AM I
[1:07:40]
monitor my my emails all weekend so that council has
[1:07:43]
the most up to date information and comments in response
[1:07:47]
so I do as council's aware I'm I'm often replying
[1:07:51]
over the weekend to provide council with that information because
[1:07:54]
there's no time on Monday morning before council meetings are
[1:07:57]
meeting start at nine AM so that was something that
[1:08:01]
that ... Terry Keller had asked that that deadline continue
[1:08:04]
on the frock to the Friday
[1:08:06]
I'm just so
[1:08:09]
10
[1:08:11]
just relation that the time frame we are was what
[1:08:13]
date is it still the same amount of time it's
[1:08:16]
right for the public correct that's right okay ... follow
[1:08:20]
up robin and ... accounts here
[1:08:23]
it ... yes ... just wanting whether you did the
[1:08:28]
old Canadian thing coming had yet made it Thursday
[1:08:33]
yeah thank you very much the difference in the game
[1:08:36]
make everybody happy noted that not but I'll getting inside
[1:08:39]
it gives a little bit more time for the point
[1:08:43]
that Mr Callum was raising which is you know I
[1:08:46]
think people need the chance to do their research
[1:08:50]
and yet gives you a bit of time to recover
[1:08:54]
from that ... because there's some things to deal with
[1:08:57]
on Friday on the business day not quite ...
[1:09:01]
you know complete but I'm just gonna whether we might
[1:09:04]
do a lot of the we've it to see if
[1:09:06]
you could make that work if I can certainly include
[1:09:09]
that in the fall of staff report most definitely thank
[1:09:11]
you thanks Anderson thank you thanks Robert see I was
[1:09:14]
going to suggest something you know ... if we allow
[1:09:17]
the public little part time but you know so the
[1:09:19]
nature not getting enough the emails from Karina well
[1:09:24]
that's okay work part of the part of the job
[1:09:27]
with that'll go to council your
[1:09:30]
all those two things to keep in mind when we
[1:09:33]
look talking about to access extending that particular time or
[1:09:37]
giving it a little bit of flexibility ...
[1:09:42]
one is most of the most important things that we
[1:09:45]
do with me with the council have already been in
[1:09:48]
front of the public for quite some time by the
[1:09:50]
time they get to this stage
[1:09:53]
so at that point I think
[1:09:56]
particulate blue not rate payers may have had a head
[1:09:59]
start on some of these things yes to boot the
[1:10:03]
other party is there's always the day of the council
[1:10:07]
meeting itself where they're allowed to add items to whatever
[1:10:12]
their presentation would have normally being sold I'm not so
[1:10:16]
sure that ...
[1:10:18]
one it's as important
[1:10:22]
to give them that much flexibility and I'm not saying
[1:10:26]
not to I'm just saying that I'm not sure it's
[1:10:28]
all that important because most of the really good stuff
[1:10:32]
they we give them a lot more time
[1:10:35]
to take a look at it then what does this
[1:10:39]
kind of exercise really shelves
[1:10:45]
thank you Jim your comments ... without over a concert
[1:10:48]
hall the next in the queue ... counselor at yes
[1:10:52]
thank you other P. Mayor I think that ... the
[1:10:55]
ex so first of all I think would be ...
[1:10:58]
suggestion of Thursday councillor Sampson suggestions sort of going down
[1:11:01]
the middle it's a very good one because I do
[1:11:03]
think the public is looking for more time so with
[1:11:07]
forty five hours before forty five hours now we extend
[1:11:10]
that on the proposal of weeks on that I think
[1:11:13]
that that would be meaningful the public because ... there
[1:11:16]
is a strategic time frame as well to make sure
[1:11:19]
that your input is placed and and I do I
[1:11:21]
do think it's important ... as part of the process
[1:11:26]
that we that council here's what it needs to here's
[1:11:29]
as soon as it can yeah ... so I think
[1:11:32]
that that's the first thing second ... item for me
[1:11:36]
... Mr chair is for you to the clerk I
[1:11:39]
believe that the community ... a communications advisory committee if
[1:11:43]
you can bring forward their motion I believe that it
[1:11:46]
does and that comes from citizens ... I am a
[1:11:49]
member of that group and and so is our at
[1:11:52]
the lake to Deputy Mayor our OP hotter ... so
[1:11:56]
when that motion came forward ... I do believe that
[1:11:59]
that's exactly the request as well would you want to
[1:12:01]
just to ... confirm that ... madam chair I don't
[1:12:04]
have the motion in front of me
[1:12:08]
through you Mr chair I can read that again yes
[1:12:11]
I read it verbatim where where is the committee supports
[1:12:15]
the earlier release object of agenda and agenda items
[1:12:19]
and where is the public has been following the existing
[1:12:22]
agenda released process for the last ten years
[1:12:25]
that the community communications advisory committee recommends that the deadline
[1:12:31]
to provide deputations any correspondence for the public remain the
[1:12:35]
same being Monday at nine AM
[1:12:41]
oh okay all right so
[1:12:49]
right so so the committee is looking for yes okay
[1:12:52]
no I just wanted to confirm what the understanding was
[1:12:55]
... and as I said I do think that ...
[1:12:59]
that that extra time is very meaningful to the public
[1:13:01]
so and we are making a change when something is
[1:13:04]
ten years ... establish we want to make sure that
[1:13:07]
we give people time in and out to make a
[1:13:11]
change and to be able to have more time to
[1:13:15]
prepare their case so ... so great to hear all
[1:13:19]
of the input and ... thank you Mr chair
[1:13:22]
I think answer hope
[1:13:24]
any other questions any other questions or comments from the
[1:13:27]
floor
[1:13:29]
no I'm I'm I'm
[1:13:32]
I think the suggestions are are great and maybe Thursday's
[1:13:34]
a great compromise that gives the public a little more
[1:13:36]
time but also because the clerk time to do her
[1:13:38]
job and then that it information and our ends as
[1:13:41]
well ... so ... we'll leave that to Madame clerk
[1:13:44]
because she will be bringing forth a staff report to
[1:13:46]
... cal first this only public meeting we have to
[1:13:49]
go to cal and we still to go to council
[1:13:51]
so the time for further discussion once we do that
[1:13:54]
unplug settle public comments received during in relation to be
[1:13:57]
for
[1:13:58]
that said Mr chairman thank you for the comments she
[1:14:01]
thank you with that we can close off our last
[1:14:03]
public comment ... we move right into notice of meeting
[1:14:06]
dates ... we have a council meeting January thirty first
[1:14:10]
twenty twenty two town hall council chambers and virtual ...
[1:14:14]
that we have a Cao meeting on February first twenty
[1:14:17]
twenty two same ... virtual and online and council public
[1:14:22]
meeting will be February seventh ... which will be virtual
[1:14:26]
as well ... without that concludes our our for our
[1:14:30]
four sections or public comments today thank you public for
[1:14:32]
making all their comments and staff and counsel for the
[1:14:35]
questions comments recommendations with that I will look for more
[1:14:39]
that this council does not return at two eight PM
[1:14:43]
to meet again February seventh twenty twenty two town hall
[1:14:46]
council chambers or at the call of the chair cover
[1:14:48]
mover to second place
[1:14:52]
I will move Andrea councillor match such move that seconded
[1:14:56]
by councillor local second councillor hope thank you moved across
[1:15:00]
much of technical circle might clear to you for the
[1:15:02]
vote
[1:15:08]
thank you Mr chair the borders open
[1:15:11]
that was closed
