you are pretty familiar with this at
this point. Uh,

essentially what this comes down to is
when when there's an annexation that is
[2:51]
directly adjacent to a city boundary,
that city is required to notice the
[2:56]
county, but they do not need the
county's approval to annex that
[3:00]
property. when there is an island
annexation. So, a piece of property that
[3:05]
is not directly adjacent to the city's
existing boundary, as is the case here,
[3:10]
this piece of property is separated by a
few other properties from the city
[3:14]
boundary. Um, it is within just a couple
hundred feet, then an island annexation
[3:20]
per state code requires that both the
city uh approve that annexation and that
[3:26]
the county approve that annexation. So,
both parties would need to approve it.
[3:30]
So, with that said, the city um in your
letter, you have their May 20th at their
[3:38]
council meeting, they uh approved this
annexation. Um and so then it would need
[3:44]
to be approved by the county. Uh you
don't have to approve it. Uh but it is
[3:50]
being this property is already being
serviced by uh Garland City's water. Uh
[3:56]
the water line runs from the west side
of this west side of the interstate
[4:02]
actually across in front of this
property and then into Garland City from
[4:05]
there. Uh the letter that you have from
Garland City addresses some other
[4:10]
concerns regarding zoning, emergency
access and services, um right-of-way
[4:16]
width, snow, and also has a letter from
their fire chief. Um, I think that
[4:22]
addresses many of the questions that
have been brought up over the last month
[4:25]
and a half. Um, but yeah, that is kind
of some background on that particular
[4:31]
request.

they're we we tried to get them here and
they have got a busy schedule because

our employee of the month are full-time
members of our weed department. It's
[5:56]
Wyatt Freeze, Courtland Richards, and
Kaden Marshall. We just want to bring
[6:00]
out the fact that uh they not only do
they they go out and do the job, but
[6:04]
they go the extra mile. They try to make
sure that they're helping the farmers
[6:07]
and the people who have lot land in the
county um attack the weed problem that
[6:13]
occurs so that it doesn't encroach upon
their neighbors and go to other places
[6:16]
like that and uh they put in many
numerous hours. The other thing that's
[6:20]
neat about these weed department that
they had the weed department but they
[6:23]
work with the road department and so
sometimes if the road department needs a
[6:27]
little extra help they can cut come
across and help them out and they're
[6:30]
willing to help other departments in the
county out. We just wanted to recognize
[6:33]
those three that uh year round are
constantly uh trying to help out
[6:38]
anywhere they can because during the
winter months we don't have to deal with
[6:41]
weeds. They have to deal with getting
grants and things like that, but they
[6:44]
step in and help other departments
during that process. We just want to
[6:46]
congratulate our weed department for
being our employee of the month for the
[6:49]
month of July.

we have a great weed department, too.

government. Government was instituted
among men for the protection of our

ineligible rights given by God. The Utah
state legislature is violating their
[12:20]
oath oaths by creating quasi government
agencies. We are a republic and we elect
[12:27]
our representatives, not appoint them.
Representatives keep violating their
[12:32]
oath of office by going along to get
along instead of being the checks and
[12:36]
balance to make sure their state
representatives are following the US
[12:40]
both the US and state constitutions as
well as themselves. It is extortion for
[12:46]
the government to acquire to require
land owners to pay a fee in order as the
[12:51]
state and local representatives say to
have protection. As the saying goes, I'm
[12:57]
here for them. I'm here from the
government and I'm here to help.

Government wants to regulate and
control. They are not. They and they are
[13:06]
doing this by usurping power they do not
have. The land owners are being deceived
[13:11]
by their own government because they
lack the knowledge that what the
[13:14]
government is doing is unconstitutional.
Government is taking advantage of the
[13:19]
people due to their lack of knowledge of
both the US and state constitutions and
[13:23]
our true and correct history. The
government-run education system has not
[13:27]
educated the people correctly. Only the
honest in heart will be able to restore
[13:32]
a republic form of government. Thank

December, and do the first and third
Wednesdays of those months as commission
[17:03]
meetings with the similar type of
schedule. the afternoon um meeting being
[17:07]
the late afternoon meeting or evening
meeting being on the 1st and then the
[17:12]
afternoon meeting the daytime meeting
being on the 2nd or the third Wednesday
[17:16]
of the month in there. So schedule would
go as follow. We would cancel August
[17:19]
26th. Then we would have a September
2nd, September 16th, October 7th,

October 21st, November 4th, and then on
this in November, rather than being the
[17:31]
third Wednesday, we will do the third
we'll do the third Tuesday, which is

November 17th. We'll move our commission
meeting to that day in order to hold the
[17:40]
canvas for the election that will be
held in November. We can do the canvas,

follow it up with the commission meeting
immediately afterwards. So that would

change it to the 17th and then we'll
have December 2nd and December 16th

work that goes into those grants. I also

want to that goes into our part, but I
also want to thank Charlene and her
[19:13]
office. They do a huge part of that as
well. A lot of her staff does the f the
[19:17]
finance and the numbers of that. So,
that was all taken care of and and
[19:20]

This is uh request
for a two parcels um in the Hansel
[25:04]
Valley area to be reszoned from the
unzoned to the MGEX which is mining
[25:09]
corey sand and gravel excavation zone.
Uh the two parcels total 1,240.5
[25:18]
acres in size. Um the two parcels
uh are used for agriculture and uh
[25:28]
historic gravel excavation. Um the
property to the north, southeast, and
[25:33]
west is all unzoned. And this
application went to the planning
[25:38]
commission uh at their July meeting last
week. A public hearing was held. Uh
[25:43]
there were a few comments. All comments
were in support of the request requested
[25:49]
reszone and the planning commission uh
found that it meets the approval
[25:54]
standards established in our code. I'll
go through those real quickly. Uh when
[26:00]
reviewing for a change in zoning, the
following four approval standards uh are
[26:06]
to be considered. whether the proposed
uh amendment is consistent with goals,
[26:12]
objectives, and policies of the county's
general plan. Whether the proposed
[26:15]
amendment is harmonious with the overall
character of existing development in the
[26:19]
vicinity of the subject property. The
extent to which the proposed amendment
[26:23]
may adversely affect adjacent property
and the adequacy of facilities and
[26:28]
services intended to serve the subject
property, including but not limited to
[26:33]
roadways, parks and recreation
facilities, police and fire protection,
[26:37]
schools, storm water drainage systems,
water supplies, and wastewater and
[26:41]
refuge collection. Uh so as stated, the
planning commission held their public
[26:45]
hearing uh reviewed those approval
standards and have forwarded a
[26:51]
recommendation of approval on this
request.

is a text amendment that addresses
[28:20]
multiple uses, mult multiple sections of
the uh, county land use code. Uh, so as
[28:27]
you've heard from us before,
occasionally what we'll do in our office
[28:31]
is the land use code is essentially a
living document. um constantly receiving
[28:36]
adjustments and things like that. Uh
also state code is a living document
[28:42]
constantly receiving adjustments. So
with those two things um always being
[28:46]
changed uh there are a variety of
reasons that we may need to come back
[28:52]
with kind of a group uh change like
this. So, we kind of keep tabs on
[28:58]
different sections when we realize
numbering is off or we realize there's
[29:02]
conflicting uh sections of our code and
our code or our code and state code and
[29:09]
we make note of those and then you know
whether it's uh two, three, four times a
[29:13]
year, we'll kind of cluster those
together in one amendment and bring
[29:16]
those to the planning commission for
their review and then uh once they've
[29:21]
had a chance to review it, hold a public
hearing, then we'll bring them to you
[29:25]
for final approval. approval. So, uh, as
you go through these amendments, uh, the
[29:31]
they were all included in your packet,
but it's everything from, uh, changes in
[29:37]
numbering. So, section 2-2180
is a reference uh, in one section of our
[29:43]
code, and it should be 2-2190. So, it's
just changing those numbers. state code
[29:48]
in uh November of last year, the county
section of state code that applies to us
[29:53]
went from 1727A to 1779.
And so uh there's multiple sections in
[30:00]
our code that reference 1727A of SE of
state code and we've had to go in and
[30:06]
change those to 1779 so they're
consistent with the new location of
[30:10]
state code. Um, we found that there were
regulations for flag lots were addressed
[30:18]
in two separate sections of our code.
Uh, one in five-1 and one in uh 6-1. One
[30:25]
of those applies to all areas of the
county. One of those applies to new
[30:28]
developments. And those two sections uh
had conflicting requirements. So we went
[30:34]
through those requirements and uh made
them consistent with one another and
[30:40]
then asked the planning commission to
review those and uh then put that those
[30:46]
consistent regulations uh in those
locations. Um something that the
[30:52]
planning commission did want to address
that is new uh protection strips. uh
[31:01]
they wanted to clarify. So, historically
in the county, uh we haven't permitted,
[31:06]
at least in the 15 and a half years I've
been here, have not permitted protection
[31:09]
strips. A protection strip is when a uh
usually what happens, it's when a
[31:15]
developer puts in a new development and
at the end of their where their road
[31:19]
ends, they'll create a parcel that's
about a foot wide. Um and they'll
[31:24]
maintain ownership of that parcel.
That's essentially their way of not
[31:29]
allowing that road to extend into the
adjacent property without that adjacent
[31:34]
property paying them uh you know
handsomely for access to that road. Uh
[31:40]
so
we one of our planning commissioners
[31:44]
came to us and said hey we should do
away with the or make it clear that we
[31:51]
don't allow protection strips actually
include that in our code instead of just
[31:55]
having that as a historically we haven't
allowed these things. So, that's one
[32:00]
thing that was added. Uh, a
clarification in our development code
[32:04]
section that, uh, makes it clear that a
developer can't begin work on site
[32:11]
until, um, the subdivision has been
approved. Uh, we've seen some developers
[32:18]
starting work without uh, final approval
on the subdivision, trying to get a
[32:23]
little bit of a head start. Uh but we
wanted to be clear that site prep work
[32:27]
shouldn't get started until they've sat
down and had a pre-construction meeting
[32:30]
with all you know myself, the county
roads department, the county engineer.
[32:35]
We generally have one meeting with all
all departments involved uh and the
[32:40]
developer and his contractor. So um also
another one is violation on property.
[32:46]
So, if there's a current violation on a
property that's going through the
[32:50]
enforcement procedure that the the uh
landowner can't is not uh
[33:01]
no land use permit or building permit
would be issued on that property until
[33:05]
that violation has been cured.
Um, we have another one of our zones or
[33:12]
three I should say three of our zones,
the MU zone. Um, MU160, MU80, MU40. Each
[33:18]
of those zones, we've had different
areas of our code where they're called a
[33:23]
mixeduse zone or a multipleuse zone. Um,
and so we went in to make those
[33:29]
consistent. And what we proposed to the
planning commission is that we actually
[33:33]
call it a minimal use zone because those
zones being the large acreage and the
[33:37]
description for those zone, if you read
what the intention of those zones is,
[33:41]
you often find them um on hillsides or
in areas uh like out west where you have
[33:49]
very little infrastructure to support
development. Um, and so instead of
[33:54]
calling them a mixeduse zone, which is
commonly referred to in land use as like
[34:00]
commercial and residential as a mixeduse
zone, uh, or calling it a multiple use
[34:05]
zone, which could be confusing, uh, we
proposed to rename it to a minimal use
[34:11]
zone. Planning commission very much
liked that idea. It makes the purpose of
[34:16]
the zone uh, much more clear. Uh, so
that was forwarded on as well. Um
[34:23]
and then finally uh the last proposed
change was regarding noticing
[34:30]
requirements just bringing those more
consistent with state code. So state
[34:35]
code on a uh public noticing for zoning
map amendments
[34:40]
uh requires that the property owners are
are noticed. Uh we have always noticed
[34:46]
the property owners uh as well as
adjacent property owners. Um, so we
[34:52]
would like to continue to notice
adjacent property owners. We feel it's
[34:55]
helpful to have uh their feedback and
input. Uh, but on we've seen we've had
[35:01]
some zoning map amendments over the last
couple years that are much larger in
[35:06]
size and it has been very taxing to
notice the property owners and the
[35:10]
adjacent property owners. It's turned
into hundreds if not thousands of
[35:14]
notices. So, we're proposing on these
very large uh zoning uh map amendments,
[35:21]
uh we're proposing areas over 5,000
acres that uh the just the property
[35:28]
owners are noticed, not the adjacent
property owners.
[35:32]
So,
all of those went to the planning
[35:35]
commission at their meeting last week.
Public hearing was held. Um there I
[35:40]
believe there was no comment on those at
the public hearing. The planning
[35:45]
commission found that the proposed
amendment meets the approval standards
[35:50]
and they forwarded a recommendation of
approval.
[35:53]

map amendment. Uh this is a reszone uh
[36:32]
from the RR5 zone to the RR20 uh zone.
The RR20 zone, not to be confused with a
[36:39]
20 acre zone, it is actually a 20,000
square foot zone. So approximately a
[36:44]
halfacre zone. Um what happened on this
one is the current property owners, they
[36:52]
acquired the home approximately five
years ago and they are now attempting to
[36:58]
sell the home and uh their lender
reached out to our department and found
[37:05]
out that the parcel the home sits on is
actually an illegal parcel. if the home
[37:10]
were to burn down, uh, they would not be
eligible for a rebuild building permit.
[37:16]
Um, and so they asked, okay, what can be
done to correct this situation? And
[37:23]
really the two options are to either
being that it's in an RR5 zone, rural
[37:29]
residential 5acre zone, it's a halfacre
parcel, they would need to acquire an
[37:33]
additional 4 and a half acres to come
into compliance with the zone or they
[37:37]
would need to change the zoning to a
halfacre zone to be in compliance with
[37:41]
the zone. Uh so they've requested the uh
RR20 being a halfacre zone. Um, and that
[37:51]
was taken to the planning commission.
Planning commission held a public
[37:54]
hearing last week on it. Um, like I said
in the staff report, comments were
[38:00]
generally in support of that change. Uh,
the residents in the area understood
[38:05]
that that home has been in play. The
home was built 45 years ago, I think is
[38:11]
what I said, constructed 1976 to 77. um
zoning was adopted in 78 and then the
[38:18]
home was split off from the farm in '
84. So it was about 6 years later that
[38:23]
split is what created the illegal
parcel. Um so the neighbors understand
[38:29]
that it's just bringing this into
compliance. The the concern that was
[38:32]
brought up a few times during the public
hearing was that this didn't set some
[38:35]
sort of precedence in the Bothwell area
of halfacre zoning on a larger scale.
[38:41]
With that said, the planning commission
uh following the public hearing, they
[38:46]
went through the approval standards.
They found that it met the four approval
[38:49]
standards. Um and that they also
requested that this particular ordinance
[38:56]
include a statement that the property
only owner only desires to bring the
[39:02]
property in compliance with with uh
current zoning ordinances and it's no
[39:06]
way trying to set a precedent to reszone
other properties in both. Uh so that was
[39:12]
added to this specific ordinance.

Uh you should have received a cover
letter as well as copy of agreement and

map um regarding this. So this this
agreement would be with a company
[40:04]
Rotherm. Uh this is a geothermal lease
for subsurface resource development. Um
[40:14]
so essentially if you if you look at
that map in the proposal uh the the
[40:22]
Rotoirm is looking at they're working
towards leasing properties from
[40:29]
basically west of Honeyville to west of
Brigham City. Uh there's a large
[40:34]
geothermal pocket in that area that has
uh you know no geologists I don't know
[40:41]
how long it's existed but it has been ha
it has had interest and has had test
[40:46]
wells drilled and different things like
that uh for decades and decades going
[40:52]
back to 60s7s somewhere in that time. Um
the temperatures that have come from
[40:59]
those test wells have uh my
understanding is have never been quite
[41:03]
hot enough for uh previous geothermal
technology. With newer technologies are
[41:09]
that are coming out it it uh they can
function on that the temperatures that
[41:15]
are there. Uh so with that said, Rotom
uh one of the companies that uses these
[41:21]
newer technologies has or is in the
process of working with land owners
[41:27]
throughout that corridor that pocket to
lease uh the subsurface uh resource
[41:34]
development rights. Um
where it comes to the county is we
[41:39]
essentially have a spiderweb of roads
throughout that area, right? So they're
[41:43]
leasing property property and then they
hit a road and they need to subsurface,
[41:50]
you know, go underneath that road and
then property property road. So what
[41:54]
this uh proposed lease does, it would
lease the land beneath the road for them
[42:02]
to extend their infrastructure from the
north end of that pocket to the south
[42:07]
end of that pocket.
Um anyway, questions

» I can't answer them. Glenn can answer
them. The the attorney's office has
[42:17]
reviewed this agreement. Um as well as
the applicant or the the the uh Rotoirm,
[42:23]
they are here as well. Uh and they would

about it's two miles down and so, you
know, obviously we have some I you know,

just ideas. Is it like an aquifer or we
drilling down into it somewhere else?

and and so I just think for our citizens
it'd be good to have kind of a little
[42:56]
bit of an idea what it is and and and
what you're doing, what is the impact of
[43:00]
the properties and those type of things.
And so anyway, we're glad to have you

Dabs with Rotherm Energy Corporation. So
we are what we call a waterless
[43:11]
geothermal system. Um we're not your
traditional geothermal. We operate on a
[43:15]
much lower temperature and you're
totally correct. What we do is we drill
[43:19]
down 2 miles and then we go horizontally
for two to three miles and then we
[43:22]
connect those horizontal wells. So
essentially what we're creating um and
[43:26]
this simplifies it is the back of your
fridge 2 miles below the ground. So if
[43:31]
you look at the back of your fridge, it
has a bunch of coils that gets rid of
[43:34]
heat and it has a compressor. What we're
doing is we're taking that compressor
[43:37]
out. We're putting in a turbo expander
and we're attracting the heat. So we we
[43:42]
pump down a liquid refrigerant, the same
one in the back of your fridge. It goes
[43:46]
down as a liquid. It collects heat two
miles out and two miles back. It turns
[43:51]
into a gas, comes up up the hole really
really fast, turns the turbo expander.
[43:56]
We condense it. We throw it back down
and we recycle that fluid millions and
[44:00]
millions of times. Our surface footprint
is about 3 to four acres for a
[44:04]
production pad. And that 3 to 4 acres
can generate heat from surrounding area
[44:09]
of about 960 acres. So our footprint is
very very small.

agreement, the lease agreement is just
the ability to use that property

permits and county land use permits,

which is where more of the details of
that uh site locations and things where
[44:47]
the wells are going to be and different
things like that will actually be
[44:50]
located, what those will look like as
far as the access and uh you know,
[44:55]
everything else that gets reviewed
during uh site plan review would be
[44:59]
addressed at that phase.

look at some of your agreements.
Um what I what I think would be really
[45:07]
good what I would like to see you do is
have because the people that have come
[45:10]
and talked to me they have this
agreement right and they're looking at
[45:13]
it and you know they're looking at this
going what what the heck is this and
[45:17]
trying to understand well they bring it
to me and want me to understand it and
[45:20]
I'm kind of in the same place and so
Scott and I had a conversation
[45:24]
the other day about well this morning
about this and so I just think
[45:28]
especially those people um where you're
going to you're going to
[45:34]
under their ground, maybe giving them
some type of a a a sheet explaining to
[45:40]
them what this really is. Because the
packet that I looked at, it just talked
[45:44]
about the agreement, but it didn't
really I mean, it was there was some
[45:48]
information in there, but a lot of
people when it gets real technical and
[45:52]
they would like it more in layman's
terms so they kind of have a better
[45:55]
understanding and I would like to see
that happen.

[49:16]
heritage zone. Um
he is in an area third ward area west of
[49:22]
Lwood where uh group reszone came in. he
was not aware of that uh group reszone
[49:29]
application or some somehow missed out
on it, but did want to join his
[49:33]
neighbors in zoning his property to the
agricultural heritage zone. Uh the land
[49:38]
use surrounding this specific parcel uh
is all agriculture and the zoning
[49:45]
surrounding this parcel to the uh north
and west is unzoned and to the south and
[49:51]
east is zoned agricultural heritage zone
as part of that group effort a few
[49:56]
months back. Um, the planning commission
held a public hearing last week on this
[50:03]
and uh
there I'm trying to remember if there
[50:07]
was any public comment on it. There was
no public comment uh in opposition to
[50:11]
it. I don't believe there was any public
comment on this specific item. Um the
[50:16]
planning commission did go through the
approval standards uh whether the
[50:20]
proposed amendment is consistent with
goals, objectives, and policies of the
[50:23]
county's general plan. whether the
proposed amendment is harmonious with
[50:27]
the overall character of the existing
development in the vicinity of the

adequacy of facilities and services

found that this proposal met each of

are appointed not elected. These quasi
government boards tax the people without

their consent. Therefore, you have
taxation without representation. The

same problem our founding fathers
incurred by King George III and the
[58:46]
British Parliament. The 10th complaint
in the Declaration of Independence,
[58:50]
which we just celebrated its 250th
anniversary says, "He has erected a
[58:55]
multitude of new offices and sent hither
swarms of officers to harass our people
[59:00]
and eat out their substance." The 17th
complaint says, "For imposing taxes on
[59:06]
us without our consent." The 21st
complaint says, "Altering altering
[59:11]
fundamentally the forms of our
government." Maida is another quasi
[59:16]
government agency which is ran by an
appointed board and taxes the people
[59:21]
without their consent altering and
changing a republic form of government.

The history of the present king of Great
Britain is a history of repeated
[59:29]
injuries and usurppations all having in
direct object the establishment
[59:34]
establishment of an absolute tyranny
over these states. History keeps
[59:40]
repeating the same mistakes over and
over again. We ask you again follow the

contracts which are the constitutions.
Repentance is necessary to restore a

public form of government that was

will be given tax exemption and the

people will be paying higher taxes.
Example, the taxing entities like the
[1:00:27]
school district, mosquito abatement and
the bar water conservy district wave the
[1:00:31]
taxes they would have received for 20 25
plus years. But then those same quasi
[1:00:37]
taxing entities tax the people several
times through the years without the
[1:00:42]
consent of the people like we've
experienced since interlocal agreements
[1:00:46]
were established.
We ask you again restore the free market
[1:00:50]
as stated in our Utah Constitution
article 12 section 20. Stop giving
[1:00:55]
special privileges to certain businesses
