[1:09] Okay. Um, we'll do the roll call for us, please.
[1:14] » Fish >> here.
[1:15] » Johnson. >> Cole.
[1:20] » He's not here. >> Okay. Uh, Lawrence.
[1:23] » Uh, Maro >> here.
[1:25] » Mayor Buck >> here. So, we have a quorum.
[1:30] Uh you have the agenda. Any additions or corrections on the agenda?
[1:34] » Then I'll look for a motion to approve. >> Motion and a second to approve the
[1:38] agenda. All in favor say I. >> Both same sign. Motion carries. We have
[1:44] the minutes from the February 17 uh meeting.
[1:50] Um so we'll look for a motion on the minutes.
[1:56] » Second. Motion on a second to approve the minutes. All in favor say I.
[2:00] » Oppose. Same sign. Motion carries. Uh we've got the claims on pages 10 and
[2:06] 11. Had a chance to look them over. Um any questions,
[2:14] comments? Otherwise, I'll look for a motion.
[2:17] » Second. >> Motion a second to approve the claims.
[2:20] All in favor say I. >> Post same sign. Motion carries. got the
[2:26] consent calendar in front of you. We had uh wage adjustments, a couple of them
[2:31] for Richard and and Bower, and we've got a tax abatement.
[2:36] » One change, we can we can pull the one for Anderson offend.
[2:40] » Okay.
[2:49] » Just make a motion to approve the consent with
[2:53] Anderson's weight.
[3:06] Motion a second. All in favor say I. >> Post same sign. Motion carries.
[3:15] And visitors and timed items. This is an opportunity for anyone that would like
[3:18] to visit with the council on any particular issue whether it's on the
[3:21] agenda or not on the agenda. We ask that you come up and give us your name and
[3:26] address. If it's something that's on the agenda, you might want to wait until
[3:28] then, but you're welcome to come now and uh let us know what your thoughts are.
[3:34] If you have some Tim, you look like you're you're good.
[3:39] Okay. Save. All right. Seeing none, then we'll move
[3:44] on.
[3:47] Public hearing. Uh it's the first reading of ordinance 749
[3:53] um establishing interstate signage overlay district.
[3:58] » So this is something planning and zoning has worked on for quite a while. It
[4:02] started back in our talk of when Le Schwab and Quickstar were looking for
[4:06] variances. That got them thinking that's kind of
[4:11] the situation for a lot of the properties down in Brandon 90 Plaza.
[4:14] It's about 30 feet below kind of the other side of the road. So, do they all
[4:19] have a problem? If so, there's it's a broader problem. Maybe we should address
[4:23] it directly. So, >> this is So, they propose an overlay
[4:27] district. Rather than adding a new zoning district, it just adds new or
[4:31] different regulations on top of our existing general business. It also
[4:35] recognizes that Sunshine and Holly Boulevard and other places in town are
[4:41] different than Brandon 90, so treat them differently. So, this allows a sign up
[4:47] to 90 ft in height. Once you you get there,
[4:55] you zero to 50, you can have a 200 square foot sign. If you can go above
[5:01] that, you can have one above that, but half of it has to be above 50 feet in
[5:05] height if you go up to 90. So then they also have some things in there about
[5:09] separation not only from other signs but from residential districts to try to
[5:14] protect those neighbors. So it exists conceptually within 1400 ft on each side
[5:19] of I90 to stretch it out. So not just 90 butch
[5:24] to account for the interate traffic. >> This was a do pass recommendation for
[5:29] planning and zoning. >> Good work on the part of planning and
[5:31] zoning. I think this is what we need to do.
[5:33] And remind me real quick, is this similar to what we already passed for
[5:37] Quickstars? They're they're going to be in compliance with this, right? Is that
[5:41] » the Quickstar sign will be a little bit larger, but it I think theirs was 500ish
[5:48] something. This allows up to 400. So they'll be a little larger, but it it's
[5:54] better than what we have moving in the right direction, allowing
[5:58] more signs. So Patrick, I think this is a great
[6:03] plan, but the question is with that residential that is kind of over there
[6:06] and these signs are going to be taller, right? Are there any light restrictions
[6:10] that might impact or is that already built into the ordinance?
[6:14] » So we did not directly address lights, but kind of our general landscaping
[6:20] light policy is don't be a jerk. Don't point them directly at your neighbor.
[6:25] It's kind of our broad policy on that. This does not specifically address
[6:35] Okay.
[6:38] » Motion a second to approve uh the first reading of 749.
[6:43] Any other discussion? Hearing none. All in favor say I.
[6:47] » I. >> Oppos. Same sign. Motion carries.
[6:50] Thanks. Good job. Uh, the Brandon Development Foundation
[6:55] wetland bank update.
[7:11] » What would you like to know?
[7:16] » Tell us where we're at. Tell us where we're at.
[7:19] » Okay. So, first of all, do you know what we're doing with the Wetland Bank?
[7:22] » Okay. So, we have recently also um acquired some more land to expand our
[7:29] offering a little bit more uh to the north. Um I do believe when it's all
[7:34] said and done, initially we have a trail planned for about two miles or so that
[7:40] could be up there. Probably what four or five acres left for a park of some sort.
[7:48] So, Yep. We have to go to them next. But
[7:52] yes, that is what we've been working on.
[7:56] » So, one of the questions um will be saving wetland for our local
[8:02] » Yep. >> people.
[8:03] » That's our plan. >> Yeah. In fact, there is a development
[8:07] currently in Brandon that is being redesigned because they didn't have
[8:11] wetland bankrupt. So, yes, it's necessary. Tim, are we going to specify
[8:18] in theouou how many credits we're going to save back for our area? Have we
[8:24] talked about that? >> No.
[8:26] » Okay. >> Uh, not specific.
[8:29] » Okay. >> Okay.
[8:33] » Yeah. Go ahead. This is This is our I'm the one that is helping with designing
[8:38] of the bank. I'm an environmental specialist that I make. So I am helping
[8:43] them approve this through the core of engineers and state agencies. The
[8:48] credits question is we know that it's credits will be available for the entire
[8:54] service area which is the lower rivered but the board has alreadyated
[8:59] that there will be a percentage of the credits that will be set back for local
[9:04] brand. We don't know how many credits that will be because we don't have the
[9:07] design yet. We don't know how many credits that will be. So that will be
[9:10] set once we know details of exact credits that are
[9:16] at that time. >> Okay.
[9:21] » The idea is to support
[9:34] and how often how fast ide.
[9:53] » So, Anthony, um, so this this property if if we didn't develop this wetland
[9:59] bank, [clears throat] my understanding is it would need to be mitigated anyway,
[10:03] Carrie or Anthony, >> because it's got on the map there
[10:10] already.
[10:32] If you go to that northwest corner, that's
[10:56] » So Carrie, we'd have to spend money as a city to mitigate this if we don't do
[11:01] something. Yes, I've done the site work and we've done the site and the channel
[11:05] is so attra
[11:15] to make sure that you know portions of that in the south
[11:19] have been dug out for additional water coming from
[11:25] both sides of it and with future development coming into that area the
[11:29] size of that channel probably increase so it'll flush through the system faster
[11:35] what that's going to cut through and it's going to
[11:38] flush the system and not hold the water like it's supposed to in that area and
[11:43] with the addition future res.
[11:50] So this would otherwise there would have to be some
[11:55] sort of plan put in place to improve that.
[12:04] » So we'd have to spend some money on it. So, uh, I understand that there's going
[12:09] to be some like a neighborhood meeting for the residents in that area. I think
[12:14] that's something important to note for them that, you know, we're trying to
[12:19] improve this area, not so they don't have flooding issues.
[12:22] » Yep. We already had health meeting and received some of their comments and
[12:25] inputs and are going to when we get to the design phase of this complet
[12:37] so that they can see that everybody
[13:00] » and the the benefit by having the development foundation do it is they are
[13:04] not tied to the bid process. So when they sell those wet line credits, they
[13:08] don't have to follow necessarily our rules. So I it's a win-win in my mind. I
[13:13] don't see any downside.
[13:34] You had a public meeting. Was there
[13:40] » what was what was the push back if any? Bottom line
[13:49] » in the southern portion >> looking.
[14:11] So, I appreciate you guys taking this on. So, thank you.
[14:14] » Yeah, good job.
[14:20] » We believe so. >> I believe so, too.
[14:34] » Okay. Thanks for coming in. Thanks for Thanks for your work.
[14:39] All right. That's want to >> do. So, do we need to do anything? So,
[14:43] you just wanted confirmation that we support you.
[14:46] » Yeah. >> Before you buy land,
[14:48] » they're looking at buying some land. So, I thought bring them in. Let's get an
[14:52] update and then I'll have Lisa start working on
[14:57] the development foundation.
[15:11] Okay, we don't have any old business, so we'll
[15:15] move to standing committee reports. >> Uh the golf course, we have uh some more
[15:21] seasonal hires. >> Yep. Got some more.
[15:29] » What do you have a life? [laughter]
[15:32] » What's up with that? Seasonal hires.
[15:38] » Got all the help you need now. >> Okay.
[15:43] » Move to approve. >> Second.
[15:45] » Motion a second to approve the seasonal hires for the golf course. Any
[15:49] discussion? All in favor say I.
[15:52] » Both same sign. Motion carries. Uh parks and wreck. You got the work report on
[15:57] page 25. Uh nothing there tonight to uh to discuss
[16:03] uh public safety. You've got the excuse [clears throat]
[16:06] me, the fire department report and we have first reading of ordinance
[16:11] 750 amending uh the plumbing code on pages 27 through
[16:17] 54. >> It was some nice read. It was great
[16:21] reading. >> So we last adopted the 2018 uniform
[16:26] plumbing code without amendments in 2019. So what we kind of do is we wait
[16:31] for Sou Falls to do all the heavy lifting. We take all the regional
[16:34] amendments they make just because the contractors learn one thing, we want to
[16:38] keep it relatively consistent for them. So, they've adopted the 2024 uniform
[16:43] plumbing code with a couple of amendments. So, we're looking to follow
[16:47] suit. We looked at it that we didn't make a lot of changes. The one we did is
[16:51] we don't really have a board of plumbing appeals just because I know I wouldn't
[16:56] feel qualified to say anything about that. So, basically, if they have an
[17:00] issue with it, take us to court. Um, we don't really do plan review fees.
[17:06] We have plumbing inspection fees, but we don't charge for plan review. So, that
[17:10] was a big chunk of Sou Falls and stuff taken out. As well as we don't use the
[17:15] city of Sou Falls cross connection control manual. So, we defaulted to the
[17:20] default text rather than reference something we don't have. So,
[17:25] th those are kind of the big changes. So Dale, our plumbing inspector, would like
[17:29] us to be up to date with Z Falls. And so this allows us to do that.
[17:35] » All right. >> Is there anything controversial?
[17:38] » I I probably wouldn't really know it if I saw it.
[17:41] » But other probably similar towns around Sou Falls are kind of following suit. I
[17:46] would I would imagine >> it does. You take the soup ball stuff,
[17:48] you look at it and you make your minor changes like we did because we don't
[17:52] have certain things and but for the most part it's designed to keep it level for
[17:57] all the contractors. So you can do work in Sou Falls, you can do work here, you
[18:00] can do work in Hartford, you can do work in Harrisburg and roughly know kind of
[18:03] everything. >> That's kind of what we did with our fees
[18:06] a few months ago. So I would move to approve.
[18:11] » Motion a second to approve the first reading of uh ordinance 750.
[18:16] All in favor say I. I. >> Oppose. Same sign. Motion carries. Now
[18:21] we have quotes to install uh and relocate
[18:25] warning sirens.
[18:32] » Yeah, we have seven sirens right now.
[18:39] » Okay. >> All right.
[18:44] » Okay. Okay, I'll look for a motion on that.
[18:46] » Move to approve. >> Motion a second.
[18:50] » Second. >> Okay, a motion, a second to approve the
[18:53] quote. >> All in favor say I.
[18:55] » I. >> Post the same sign.
[18:57] » Motion carries. And we have an intern. >> Yes. The I can't remember if it was last
[19:03] meeting or the meeting before that when we had our high school intern. Um and so
[19:08] we do have a college intern for the spring semester.
[19:12] » Have that in front of you. We have any questions?
[19:18] » USF individuals going to school for law enforcement.
[19:21] » How long do these internships usually last?
[19:23] » It depends if they're doing it for credit or if they're just doing it for
[19:28] experience. This one for colleges I believe for credit. So it'sund
[19:34] I I can't remember. I have it written down is how I can't remember though. But
[19:37] there's so many hours they have to fulfill for the college. So they get
[19:40] credit for it. We're not going to start calling you
[19:42] professor, are we? >> You could.
[19:46] » I don't know of what, but you could. [laughter]
[19:51] » I'm glad. It's It's a good thing. It's a It's a good thing that they're want to
[19:55] come out here. >> Perfect.
[19:58] » So, we need a motion on that. >> Second.
[20:03] » Motion second to approve. All in favor say I.
[20:05] » I. >> Motion carries. Good job, Jamie.
[20:10] In regards to the item that was stricken earlier, um unfortunately our newest
[20:16] officer, although he was doing extremely well, has decided law enforcement in
[20:20] general is probably not the uh career he wants to stay in. So after having a
[20:25] conversation with him this morning, it's unfortunate. Um but I certainly
[20:29] understand his uh his reasoning. So um yeah, unfortunately we will be
[20:36] advertising to fill that post. Well, you've been getting a lot of applicants
[20:40] the last time we had to do it. So, >> yeah. Yeah. Applicants luckily for
[20:44] hasn't been a concern. So, it is but it is unfortunate.
[20:47] » Um, is there an do we have an eligibility list from the last hire that
[20:51] we did? >> Um, we typically every time we do we
[20:54] have an eligibility list. It kind of depends on the the time lapse that goes
[20:58] and we usually confer with the city attorney as to how long we should keep
[21:02] that. So, um we are planning on posting for this time. Sometimes a lot of times
[21:07] you know of we might they might be second or third in line for us but by
[21:10] the time it comes back around they've been hired by another agency. So a lot
[21:13] of times they're not available even if he wanted to. So they're they're usually
[21:17] a a real shortterm kind of eligibility list.
[21:20] » So we did send him to the academy and he decided after that that he was not
[21:25] » yes >> going to pursue this.
[21:28] » He actually I mean because of the timing with the academy he was actually he had
[21:31] went through the entire field training before he even went to the academy. So
[21:34] he just had to do some ride outs after the academy. But yeah, so it was
[21:37] unexpected, but for personal reasons, he has decided to
[21:42] step away. >> It happens.
[21:45] » All right. Do we need to approve a resation or anything?
[21:49] » Not yet. >> Not yet. Okay.
[21:52] » All right. We'll move on to streets. We've got the uh public work report on
[21:56] page 84 and uh slurry field project bids. N
[22:03] resolution yet? >> Got a couple of things.
[22:08] » Oh, I'm sorry. >> Yes, the resolution
[22:13] 02-26. >> Yeah, we have a resolution authorizing
[22:16] certain staff members to sign plats. We're adding the director of engineering
[22:22] services as an authorized signature agent for the city engineer and the road
[22:27] authority. Any
[22:31] questions, comments? >> Move to approve.
[22:34] » Motion, second to approve. All in favor say I.
[22:37] » Post same sign. Motion carries. And request for the council to support
[22:44] commercial residential formula page 73 to 82. What's that?
[22:50] » There's there's a letter from Nick Van Overshield. I think everybody's got it.
[22:54] uh regarding the discretionary formula for new commercial residential
[22:58] construction which is anything over four units. Uh a few years ago originally
[23:04] this uh we have a discretionary formula for commercial industrial was adopted
[23:10] quite a while ago that used to include commercial resided
[23:18] split that up separate categories no longer have for commercial
[23:24] residential specific. So Nick Ben Overshield, the the
[23:28] developer for Chestnut Ridge
[23:33] found out from the county um that he's already starting building some some town
[23:39] homes that are not going to qualify for the discretion.
[23:44] I've spoken with Chris Li, the director of equalization of Min County. Anything
[23:49] that's in the process of being built or built already would not qualify. We
[23:52] can't retroactively go back and those city council wants to adopt some type of
[24:00] discretionary future
[24:06] call and find out if the council adopts it inif
[24:15] our current discretionary formula it's only 20% first year%
[24:23] For commercial residential it is 25 25 50 7575
[24:30] and then it goes to 100. So they don't get a full zove
[24:45] qualify for it. Second one is affordable housing. So it's based upon
[24:54] the state. So
[24:59] that qualify for that. And the other one is redevelopment
[25:04] district.
[25:08] So no action needed at this point in time. I talked with Nick this morning.
[25:13] He understands where we're at.
[25:17] Okay. >> Do you feel
[25:20] » Brian, I'm sorry. Sorry. But Brian, would this So, this is specifically
[25:24] being asked for Nick's development over there on the bridge, right? Would this
[25:29] apply to any other existing developments, say like over in Aspen
[25:33] Ridge where they built those? >> It would not already built.
[25:36] » So, it's only new. >> Only only new after the resolution.
[25:42] » Thank you. So when it was all combined before the state split it out, do you
[25:48] think we ever did it >> for residential? Who knows? Huh?
[25:55] » Trying to think. You know, there hasn't been much any
[26:00] built historically last two or three or four years
[26:05] » and nobody else picked up on it.
[26:09] Do you believe this might help with, you know, future development in Brandon
[26:15] that, you know, if we adopted something like this, this might help? I mean, I
[26:19] know they're these style of homes are becoming very, very popular, you know.
[26:23] » Correct. And you know, like I said, up until the last two or three years,
[26:34] you know, if you go to falls, there's a ton of them built all over.
[26:40] You know, as a developer, it would certainly help with cash flow.
[26:45] It may spur additional towns or condo development. I don't know. down.
[27:04] So I don't I don't have a real good answer.
[27:07] I don't know.
[27:19] » The only way it could hurt is if they would have been built anyway,
[27:22] » right? >> So, I you know, I have a lot of
[27:25] confidence in your judgment. So, why don't you look into it for us?
[27:29] » We'll take a look at
[27:34] Okay. All right.
[27:38] We'll move on uh resolution 03-26
[27:44] compensating compensating compensation levels for planning and zoning
[27:48] commission. >> I had some recent conversations with
[27:50] council uh since zoning seems to be doing a heck of a lot of work. There's
[27:56] an opinion feeling that they should currently get
[28:01] $75 a meeting. Maybe bump that up meeting
[28:08] They do a lot of work. They really do. And they they they have a lot of long
[28:12] meetings. I know that. And so >> they don't do it for the money, but I
[28:16] think it's a good sign of goodwill. Thank you from us. Yes.
[28:25] » Exactly. I had not thought about that. Had not thought about that.
[28:29] » When was the last time they had an increase in their per? We bumped we
[28:33] bumped all the boards and commissions up uh was it two years ago 75 from I think
[28:38] it was 50. So a couple years ago we went to 75
[28:42] » but I look at park board and what zone planning and zoning does and there's no
[28:47] comparison. So they need to they need to be more
[28:51] » would if we pass this would this be start right away this start
[28:56] » next meeting. So, how about budget-wise? We're
[28:58] » I [clears throat] mean, this kind of money is not going to be a
[29:01] » No, I mean it's not a huge amount. It's just per
[29:07] when we do the budget, we figure $75 for two meetings a month for everybody.
[29:13] » It's not a big deal. >> Financially, it's a Thank you.
[29:20] » I would motion a second to approve. All in favor
[29:25] say I. >> Both same sign. Motion carries.
[29:30] Uh right now we can move on to page two. Streets public works reports on page 84.
[29:39] We have a slurry seal bid. Tammy. >> Yes. This is our annual slurry seal
[29:45] project. We participate in the city of Sou Falls's project. Um they had over 20
[29:50] well they had 20 communities participate this year and their total build bid was
[29:55] over $6 million. So our portion is just under 329,000.
[30:01] The lowest bidder was Aztec which we've had them before. They did a really good
[30:06] job for us last year. Um it is paid for through the street maintenance fund and
[30:12] it is under budget. All right.
[30:16] » A little less little less than that last year then or were we kind of somewhat
[30:20] comparable you feel >> as far as like the amount?
[30:24] » Yes. >> Oh, we did less last year. So we did a
[30:27] little less than 200,000 I think. >> Approve.
[30:33] » Motion a second to approve. All in favor say I.
[30:37] » Same sign. Motion carries. And back in the core area, 3B design
[30:44] contract, Tammy.
[30:46] » Oh, it's actually 3A. >> Excuse me. 3A. It says 3B here. 3A.
[30:52] » Okay. >> This is the design contract with HDR.
[30:56] So, we designed this year and then built next year
[30:58] » and this is on fourth street. >> Yes. So, there is a map on page
[31:06] 94. So, you can see it's the south half of
[31:10] Fourth Avenue and Fifth Avenue, kind of everything south of Elm Street all the
[31:16] way to Aspen.
[31:21] » Okay. >> I move to approve Corey area phase 3A
[31:26] design contract with HDR Engineering. >> Well, I want it on record to be
