[1:59] to Etna Street in the Glen Allen area of town.
[2:03] Uh subdivision question proposes 52
[2:06] dwelling units of two units semi-detached nature, therefore 26 lots
[2:11] with two unit dwellings. The subdivision also includes two new
[2:15] public streets, Cedar Drive and Hollow Drive. Street names were approved by
[2:20] council in January of this year upon having a received recommendation for the
[2:26] Cedar Drive and Hollow Drive street names from the Heritage Advisory
[2:30] Committee. Today staff recommend the council
[2:33] approve the acceptance of Cedar Drive and Hollow Drive as public streets and
[2:38] authorize the development officer to accept the street deeds on behalf of the
[2:42] town. This approval, however, would be
[2:45] conditional on the developer submitting all required acceptance requirements
[2:49] under part nine of the subdivision bylaw to the satisfaction of the town
[2:54] engineer. Additionally, staff recommend that if
[2:57] the developer chooses not to complete the landscaping within the street right
[3:00] of streets right of way adjacent to future building lots at this
[3:05] time, that council authorize the development
[3:07] officer to enter into a servicing agreement with the developer
[3:12] before approval of the final subdivision plan.
[3:15] Under this agreement, the developer would be required to provide a
[3:18] performance surety acceptable to the to the town equal to
[3:23] 125% of the estimated cost of completing the landscaping work in this case. The
[3:28] security would ensure the landscaping is completed to town standards at a later
[3:33] date, usually within 12 months. Uh regarding that second part, the
[3:38] performance surety part, staff believe that the developer intends to complete
[3:42] the required landscaping, so for full completion of the streets and services
[3:47] by the end of this week. Therefore, performance surety process is
[3:51] quite likely not needed. Uh however, staff are still seeking this approval in
[3:56] the event that it's that it's needed to be sure no delays in receiving and
[4:00] approving the takeover package uh per the subdivision bylaw acceptance
[4:05] requirements. So, in accord in accordance with the
[4:08] subdivision bylaw, before the town can accept any new streets and services,
[4:14] the developer must submit the takeover package for approval.
[4:18] So, this includes a a 12-month maintenance surety in the
[4:22] amount of 10% of the actual cost of construction of the streets and
[4:26] services, reproducible record uh records and
[4:30] as-built drawings of engineering design, all test reports, operating procedural
[4:34] manner manuals, copies of the survey plan and all deeds,
[4:38] easements, etc., etc. Any new streets cannot be deemed public
[4:43] streets until such time as the acceptance requirements have been
[4:46] satisfied. Uh normally, the streets and services
[4:49] would be completed to the town standard, takeover package submitted, and upon
[4:54] approval by the engineering department, staff would recommend that council
[4:58] declare the the subject streets as public streets vested in the town.
[5:03] And then we go and we'd register the plan of survey and the deed to transfer
[5:07] the street parcels. And then once
[5:11] those are public streets, subdivision of lots and issuance of building permits
[5:15] can proceed. Building lots cannot be created without
[5:19] public street frontage, thus the the necessity of of this process.
[5:25] In this case, council approval council's approval would be conditioned on an
[5:29] approved takeover package. This approach would allow staff, under
[5:34] the authority of council, to review and approve the takeover
[5:37] package and begin the process of creating the street parcels and
[5:41] transferring ownership to the town as soon as possible,
[5:45] rather than needing to take time to approach Council later on.
[5:48] Uh the advance approval will allow the developer to create the lots and obtain
[5:52] permits to construct sooner. Um so with that, I'll um
[5:58] yeah, I'm here to answer any any any questions that's uh that Council may

[7:28] within the street street right-of-way adjacent to the future buildings prior
[7:33] to approval for the final subdivision plan.
