[0:01] Let's see, what's that we got about three minutes or so, here's the girl.
[0:10] Oh, one minute.
[0:13] That's what I'm seeing here too, so one minute.
[0:17] Girl, and I group grabs them.
[0:23] You can, on time point.
[0:32] And Wayne is here. Welcome, Wayne.
[0:37] That's what I thought you hesitated for. You were going to go over the ground.
[0:43] Hopefully that's not what the night is going to be like.
[0:47] No, no, no.
[0:48] Just sit there and I'll say.
[0:51] Okay, please everyone turn on your mic.
[0:52] This is time to begin.
[0:56] Okay, welcome.
[0:58] As we begin, the Brigham City Planning Commission meeting for Tuesday, August 18, 2026.
[1:05] We start off with the pledge of allegiance.
[1:08] So if you would like to join us in the pledge of allegiance, please do so.
[1:15] I pledge allegiance to the flag of the United States of America.
[1:20] And due to the Republic for which it stands, one nation under God, indivisible with liberty and justice for all.
[1:41] Okay, the minutes for the meeting that we have last time.
[1:46] I know I was not here, but do we have any changes that we need to make to the minutes?
[1:54] Jake, what do we start down with your side?
[1:57] None for me.
[1:58] None.
[1:59] None for me.
[1:59] Okay.
[2:00] I didn't see any.
[2:04] Go.
[2:05] We're clear under here.
[2:06] And Jason Nunn.
[2:07] Okay.
[2:08] Then I am looking for a motion for the approval of the minute minutes to the meeting on August
[2:15] 4, 2026.
[2:17] Mr. Commissioner, I chair, I move the minutes from the planning commission meeting of
[2:23] Tuesday August 4, 2026 be approved as they are currently constituted.
[2:29] Thank you.
[2:30] Do I have a second?
[2:30] I'll second that. Thank you, Isaac.
[2:36] All in favor? Say aye.
[2:38] Aye. Any opposed? Say nay.
[2:41] Thank you.
[2:43] Okay, we are quickly down to application of
[2:45] 26-076, permitted use permit.
[2:51] Bring them city fueling station at 1560 north,
[2:54] 2,400 west, and mark you'll help us with the presentation on that one.
[3:00] Yeah, and we do, we have three individuals here for the application that can, and so after I do the introduction and then you can hear from them a little more and ask questions.
[3:12] All right, so here is the locator map, this area recently went through an annexation back in April of this year.
[3:19] They're at the corner of 2400 and a blast in S.R. 13, the skid-more trucking facility is what you can see there to the east of it.
[3:31] And that was annexed in several years ago for their truck wash, taken into the city services.
[3:40] All right, here is a enlarged area to kind of show you that site little more.
[3:44] that the site extends, if you will, the improvements for the project, will extend into the
[3:51] skid more, which is the brown bear investment property to the north for across access.
[3:58] We'll get into that a little more.
[4:01] So here is the site plan, I'll try to zoom in a little more.
[4:03] It's a little hard to see, so I broke it into two components.
[4:07] This is the north end, more of the semi-truck, I'll let them kind of get into the flow of it
[4:13] a little more, but on the north side there is an exit, you can see that the dark arrows
[4:19] of the truck wash that enters, I mean exits out onto 2,400 West. And so that would remain
[4:27] the same, but they would have an entrance on the far end of the north for the semi trucks, and
[4:33] then it's designed so that they would actually kind of loop back around and exit out of that
[4:38] the more the exit because of how close the the other exit is for the
[4:42] automobiles down by SR13 and the future stack and is that area
[4:47] develops.
[4:49] All right on the south side is where you'll see that the sea
[4:52] store, the QSR will let them kind of get into that a little more on the
[4:57] design of that but it's a quick service restaurant.
[5:00] They can explain a little more how that kind of functions different
[5:03] And you'll notice in the staff comments,
[5:07] there are parking questions that need to be further addressed
[5:11] because it's based on the numbers.
[5:14] And also there is some designated parking for,
[5:18] or at least charging station stalls
[5:21] for the EVs, electrical vehicles
[5:24] that they don't count towards that requirement,
[5:27] where it's a designated recharge.
[5:30] It's a lot like a few spot there.
[5:34] The building, okay, so yeah, so there are two access points.
[5:40] The further south one here would be the automobile access.
[5:46] And they are, excuse me, QSR.
[5:50] I'd like to know is that really a restaurant,
[5:52] and so we'll talk about this.
[5:53] Yeah, that's totally right.
[5:56] Help us with that little later on.
[5:58] Yeah, I agree.
[5:59] because I mean, we can be very specific and trying to separate them, or we can treat
[6:03] that a lot like QT that came through.
[6:06] They have a larger commercial store and sea store, but they have a kitchen element inside
[6:14] there.
[6:15] And even with, I'm trying to recall, it's been a long time, but with loves, they do have a couple
[6:22] restaurants.
[6:23] And I think the one was broken apart because of Carl's junior, but you also have a subway
[6:29] sandwich place there, and so it varies, but that's what we want to look at, and see how
[6:34] we can try to address the parking. There is a drive through that you'll notice there,
[6:40] and we've asked that they provide some a little more detail on the next review on the stacking,
[6:45] the menu boards, things like that, to see how they meet the requirements. And then there is
[6:50] an elevation difference between this property and the adjacent property. So we'd like to better
[6:55] understand how that will work with the retaining walls along there and in that area.
[7:03] They're working with between the city and the applicants working with Utah on some requirements
[7:11] for the intersection and improvements along that area.
[7:16] Here's the landscape plan.
[7:18] there's also some comments there and then the elevation complement them on a very nice
[7:25] elevation for their building. This is the front elevation face.
[7:30] In the west, the rear, and then the side elevations that you have in your packet, and then the materials there.
[7:37] So it's a quality looking building. We generally get an elevation on the canopies. We haven't seen that, so we'll look at that and see what's most likely will represent the gas company to with that.
[7:50] And then there are a number of comments that we need to little more addressed with the outdoor lighting.
[7:58] But I believe that's the overall overview of the project and I'll just come back to this site here and then we can go back and forth so it's a little more clear in the presentation.
[8:15] But in short, I guess let me, I think I did have one more slide.
[8:20] You'll see the staff supports this and subject them addressing those items.
[8:29] And then the stipulations identify, they do need to do a deed of 20 feet to widen
[8:37] 2400 West that will be dedicated to the city.
[8:41] And that will become part of a road dedication at a later time as the properties
[8:46] develop kind of similar to what was done on 1200 West. And then they'll need to execute
[8:52] a cross-access agreement between them and this give more trucking to the North. And then
[8:59] just overall subject to you dot requirements. Those are the key stipulations there along with
[9:05] this staff for view comments.
[9:10] All right, that's all I have as far as introducing the item.
[9:15] Okay, we'd like to have our applicants also please join us now what we need to do since we are recording this, we're going to have you state your name and full and also write it down as well as part of the records.
[9:29] It's not perfect. Russell's used with campfire partners.
[9:33] We are representing the client.
[9:36] I also have with me our engineer and our general contractor.
[9:42] And we agree with all the stipulations.
[9:46] And we'd also like to thank staff that we've been working closely on this project for quite some time now.
[9:52] And we really appreciate all the opportunities that we've been able to work closely with a month.
[9:58] And we're here to answer any questions that we may have.
[10:03] Okay.
[10:03] Would you like to tell us a little bit about the QSR and the traffic and the flow and stuff?
[10:10] Are you ready to do that and tell us a little bit more about that?
[10:14] From the QSR standpoint, I don't believe that they have selected anyone yet.
[10:19] And so we are aware of the parking.
[10:22] And so that is something that we are going to be working with whether it's going to be a combination.
[10:27] similar to what Mark was saying that Quick Trip had done where, you know, it's internal
[10:32] to that. So, that hasn't been determined yet, but we are aware of that and we are
[10:37] making the necessary adjustments to that.
[10:42] Okay, and that parking will go which direction to the north.
[10:46] Yeah, we've been looking at a couple of different options. We actually did have
[10:51] We were parking then was required originally, but based on all the onsite retention that we're going to need we actually had that where it says southwest basin there that was a whole row of parking
[11:05] So we did meet that parking at that time, but in this process and going through it we had to make the adjustments. So understanding this I do believe though that that
[11:17] depending on how this is, you know, the QSR and the C-store, if it's a combination, we should
[11:25] be able to meet the parking requirements without any issue.
[11:32] So, is that an open area or closed wall to the QSR?
[11:34] No, it'll be an open area.
[11:36] They'll be able to pass through.
[11:39] Yeah, we don't have a floor plan of it, but I've seen the floor plan and then there
[11:44] is a pastor.
[11:46] Mark, if we could go back to the main, yeah, the main drawing, help me understand a little bit how the semi trucks versus the cars will be going through.
[12:01] And that's something that we worked with real closely with staff on 2,400.
[12:07] And the reason why you kind of see that plan right now is that we've been working with engineering
[12:12] because there hasn't been a final design for 2,400 yet.
[12:16] So that's why you're seeing that.
[12:18] And initially when we came in, you know, we actually had the driveway was a little bit closer
[12:23] and we had to make sure that we met the U. requirements for having that distance there.
[12:30] So at one time, we were thinking about being able to pull trucks in and out of that.
[12:34] And, you know, we listened to what staff had to say and we client went and that was skid more.
[12:40] And that's why we turned that into that opportunity to actually come in at that point and that's where the
[12:47] semi-trucks would be coming in. So they would actually come in, make that right hand turn, go into those
[12:53] high flow lanes and then they could actually, we have a turning template that it actually will come back
[12:59] ground, go around the tanks there, and then it will come back out where you can see where
[13:04] we have that little island up there, you have a lane where they can actually come out.
[13:09] So from the skid more site, there really isn't any way to get to the skid more site, they
[13:14] actually have to come in off of 13.
[13:18] So they would come in through there and then they would exit that they have no way to be going
[13:22] back and forth there.
[13:23] And that was something that we had worked out with skid more as well.
[13:26] They didn't want the trucks to be able to go back and forth, so we created it so that they could actually exit out there.
[13:37] With it being a template, nothing prevents them per se from going out that southernmost exit.
[13:43] That'll be striped and signed.
[13:46] We'll make sure that that's signed that way.
[13:48] So the intention is they come in from the north, pull through the high flows, turn to the east, and then go back out to the north.
[13:56] Yeah. So based on that, there is no intention of having any parking for the semi-trucks.
[14:02] No, no intention. I mean, there is a long, that eastern border there. There is an area that
[14:10] we left aside for one truck. Right. But if they pull back into it. Yeah, I know they wouldn't
[14:17] be able to back into it. And when you have the turning template shown on there, that actually,
[14:23] We don't want to foster that.
[14:28] Okay.
[14:31] So definitely no overnight parking?
[14:34] No.
[14:34] Not playing that.
[14:35] Howard, you're going to enforce that if somebody decides to park there.
[14:43] Yeah.
[14:44] Okay.
[14:45] On site.
[14:48] Let's see.
[14:49] You mentioned skid more a couple of times.
[14:51] It sounds like you've been working with them and they're aware.
[14:53] They onboard and supportive of what you're looking to do.
[14:56] Yeah, we do.
[14:57] We do have the agreement.
[14:58] The lease agreement has already been executed.
[15:07] Okay, let's officially go down and see if there's more questions or Russell, well, is anyone else wanting to help present a little bit more?
[15:19] Yeah, please do. And then, because we'd like to ask more questions. I'm going to introduce him, but I'll put my name down. I'm Drew Lange, I'm one of the owners.
[15:27] And this and yeah, I just want to introduce Jim, because Jim's a long time friend of mine and we brought him on as the general because he's done he's done a lot of these and I've got him for a lot longer over the years and I just want to introduce Jim as he's also going to be an equity holder in the operation. So he can speak for us as collectively as a partnership as well.
[15:54] very good. And Jim, please write your full name down to so we can keep it for record.
[15:59] Thanks, Jim. That wasn't necessary.
[16:02] Lastly, I'm sorry, Jim.
[16:05] So I just, the only thing I'd add to your questions is that this is a little bit tight.
[16:09] We realize it's a bit tight, but working with a lot of fuel filling facilities and my
[16:14] time at Flying J and other places, we've done the best we can to try to fit what we need
[16:19] to fit on the property and make it work.
[16:22] Ideally, we'd have more room for parking and whatnot, but we will have signies like Drew
[16:30] mentioned.
[16:31] The idea is to keep the autos separate from the trucks, we don't want any other trucks
[16:34] coming in on the auto lane and getting mixed up with the cars and the pedestrians and
[16:40] that sort of thing.
[16:41] So we'll have some really, really good signies to keep the trucks routed as was described.
[16:47] And then they'll run to the store and do their stuff and jump back in and take off as the plan there.
[16:55] So.
[16:55] Am I seeing 10 pumps right there then for the autos?
[16:58] Yeah, so there's double pumps on each island and then both sides.
[17:03] Yep.
[17:04] And then the trucks out.
[17:07] Yeah.
[17:07] We got diesel.
[17:08] We have DEF.
[17:09] We'll have unlettered and premium unlettered.
[17:14] So I have a variety of all the fuels there.
[17:18] Any other questions from the, I don't know, construction perspective or layout or anything like that?
[17:28] I think we'll go through officially in just a minute.
[17:30] Let's see if there's any more, anyone else who'd like to present anything?
[17:33] Thank you.
[17:35] Okay.
[17:38] All right.
[17:39] So my name is Eric Villobos.
[17:41] I'm with Campfire Partners and the Engineer of Record.
[17:43] And so I've been coordinating with Mark and his staff,
[17:46] the reanxation process and taking some of their comments and really bringing this design to
[17:52] to reality. And so we do know with the addition of the QSR that we're going to have to look at
[17:58] parking a little bit more. You know, hopefully there's some coordination there of something along
[18:02] with those basins is that the drainage in this area is really tight. We also have high ground water as
[18:08] well. And so someone spoke about the elevations and having to raise that site. And so to be able
[18:15] have positive conveyance of storm water and going into the adjacent areas. This is where we ended up
[18:20] with about three to about five feet of fill within this area. Now these improvements have allowed
[18:27] us to fully detain within our site and hold those historical flows as we go into either you dot
[18:33] right away and to the north canal. And so we've been working a lot with Brett Jones as well
[18:38] just as what that looks like from a design standpoint and the interaction between you dot and the
[18:43] out of the north.
[18:46] And so definitely taking notes as far as what that parking looks like, kind of going forward.
[18:51] What we need to do, we have some thoughts there, as far as what that parking is, also
[18:55] and maybe even looking at some of our EV parking spaces, maybe we dedicate a couple of less
[19:01] parking spaces, and then also, we are tight along the west side of the site, and looking
[19:08] in some of the preliminary cross sections, there is also a 20 foot dedication that was
[19:13] brought up. But there's also a 15-foot PUE within our site as well. So that's something that
[19:18] we're trying to mind as much as possible so that we don't have permanent improvements within
[19:22] that PUE.
[19:25] And then here for any other questions regarding the development as well.
[19:28] Are you expecting the water basins then to have water in the mirror around with the ground floor?
[19:33] Are you going to bring it up high enough that they would bring? Correct. We were able to raise the
[19:37] elevations high enough so that we won't have your around a ponding within those basins. They will fully
[19:44] convey any type of drainage within there.
[19:47] I think we call those mosquito retention changes.
[19:49] Yeah, I'm a really from Texas,
[19:51] so they call them plighters out there.
[19:53] And so, yes, depending on where you're at,
[19:55] they refer to them a little differently.
[19:57] How many parking spots are we sure?
[20:00] As of right now, including the EV,
[20:03] I believe we are at 29 stalls, based on how we look at the parking
[20:10] with the QSR being in-store.
[20:12] I think we're looking at two different parameters between a hundred square feet per one space per 100 square feet or the one space per the 250 square feet
[20:23] And so if we were to look at the 250 square foot approach, I think we're shy maybe about one or two parking spaces
[20:32] And then if we were to consider the other approach with the 100 square feet, we probably have to squeeze out about five more stalls
[20:40] Is that realistic? Is that possible?
[20:44] It's a challenge, you know, especially with the drainage in this area and what we had to do with the basins.
[20:49] And so that we can have positive and advanced leaving the site and not having those mosquito ponds there in the area.
[20:56] You know, if we were to look at that curve line, that west curve line along the southwest basin.
[21:00] There is an opportunity to maybe have some parallel parking there that may not impact.
[21:10] The operations there within the fuel system, and we could probably squeeze another three parking spaces
[21:16] out in that area, and depending on the PUE as well, there's something that we can look at as we try
[21:22] to hold an offset with the basin within that PUE. If we can encroach a little bit more to the west,
[21:29] there's some opportunity that we will be able to hold that dryvile and still add a couple of parallel parking spaces
[21:36] there as well. Up there on the north side, where it says 22, there's no room for parking
[21:40] along there. By the two tables in the dumpster area, the looks like that could be.
[21:47] Yeah, yeah. Our Jake, we're actually looking at possibly extending that right there about
[21:52] another two or three stalls. Now, something that we can evaluate is a location of that
[21:57] trash enclosure. Now, we like the proximity to the building. I think it keeps everybody in
[22:03] safe environment accessing that trash enclosure. But there might be a little bit of
[22:09] opportunity where we can look at parking for that 22 is that it may require a
[22:14] relocation of the trash enclosure.
[22:25] Mr. Chairman, why are you here?
[22:28] here maybe you could just talk
[22:30] About the elevation then. So how would the elevation with the existing building work, right there on the property line?
[22:37] You mentioned was three to five feet. Higher? Is that right? Correct.
[22:42] Then on the skid more side? Okay.
[22:52] There's going to be have an elevation take off.
[22:55] I just wasn't sure with the elevation and with the cars come around and how that was with the building right there.
[23:02] Yeah, but we did ask for a little some sections that we'll look at a little closer, but
[23:07] Okay, so you're
[23:10] Yeah, something to prevent
[23:12] Car from dropping off
[23:14] Absolutely, and I believe it was a city common as well something that you know that this design here working with Brett Jones and just understanding
[23:22] The challenges there with drainage, you know, that's a release sprung up raising the site as we did and so we did locate a retaining wall over there
[23:29] Something that we failed to show is just some some type of fancy
[23:32] some safety fencing within there.
[23:34] And so with this iteration, we'll address that comment.
[23:36] We'll add some safety fencing there so that it will prohibit
[23:40] anybody driving off over that retaining wall.
[23:47] I think we're going to do.
[23:48] We're going to go around even more than once
[23:50] that we have to.
[23:51] But Jason, let's go ahead and start with you.
[23:53] See if we have comments.
[23:55] And then as thoughts come up, we'll ask any member of the group.
[24:01] So you mentioned roughly 29 stalls, including the EV stalls, how many EV stalls are there?
[24:08] As a right now, we're showing five.
[24:12] That could be flexible as far as what the approach is there.
[24:17] And so...
[24:17] I suppose we're located where right down here at the south end.
[24:21] Correct.
[24:22] Yes, adjacent to state road 13.
[24:24] Okay.
[24:26] For those EV stalls, those cannot be claimed as parking.
[24:30] Correct.
[24:31] Yeah.
[24:31] Correct.
[24:32] If you have five and then you're already short one or two, you're really short six or seven.
[24:39] Correct.
[24:40] Depending on the approach based on comments.
[24:42] And again, that was kind of understanding the building, the QSR and what that interaction
[24:46] is.
[24:47] I think we're looking at two parameters where if it's a standalone QSR, it's the one parking
[24:52] space per 100 square feet, if it is with an opening, I'm kind of passes way, you know, curious
[24:59] of what that consideration is, if it's the one parking space for 250 square feet, if that's
[25:04] the case, we have yet to talk to the client as what they approach is, but in talking about
[25:11] where that 22 keynote is, we can add a couple more spaces there, and I think we can remove
[25:16] one EV parking space, and that will help us meet that threshold, and so we'll be reducing
[25:21] down to either four or three EV parking spaces, but definitely want to talk those options,
[25:26] through with the client and see what that best approach is.
[25:31] Now, the QSR drive through here, is that a two lane drive through?
[25:36] It is a one lane drive through with a secondary pass through lane, which will be utilized for
[25:43] loading as well.
[25:44] Well, there's no intention to have two ordering areas, one on each side, correct?
[25:51] Just the one, okay.
[25:52] Correct. Just the one adjacent to the building.
[25:54] And then with you talked about the dumpster may move, because the right words is you've got the QSR traffic coming out.
[26:01] You're telling the semi-tracks to turn right there.
[26:04] So potentially, whenever pickup occurs, you would have a kind of bottleneck right there at the dumpster.
[26:10] On those hours of pickup day, there could be a little bit of a bottleneck there.
[26:15] I think in the day-to-day operations, we're hoping that isn't not an issue there, but you are right, it is located in that traffic area.
[26:24] I'm assuming this is going to be a 24 by 7 operation.
[26:29] Other than the QSR, probably isn't open 24 hours, but correct.
[26:33] Fuel stops would be.
[26:36] Again, the other thing I struggle with is the lack of parking for your trucks,
[26:41] Because all you're doing is encourage your truck traffic to come in by fuel and get out.
[26:45] There's no way for them to park, stop, come into the building, go to the QSR.
[26:52] I don't know how that works for us in my truck driver.
[26:55] They just pull up, they pull up.
[26:58] Next guy stacks behind him, they get their stuff, and they pull out.
[27:02] It's tight, but what do you do?
[27:04] Right.
[27:06] And the original layout, we actually had some parking within that area.
[27:10] It wasn't once we started coordinating there with the city engineer in Jones and Associates where we started looking at drainage and what this all met and so as we went through the coordination and iterations of design
[27:23] Unfortunately, we had to remove that extra park in area and we had to increase the size of that base and just so that we could have positive conveyance going out and no ponding that stays there within the ponds.
[27:34] Well, I just, I hope we, it'll work because if you give a truck driver enough of an option to go somewhere else, they'll just go somewhere else.
[27:43] If they come here enough times and have to wait them, you know, three or four deep to get their fuel,
[27:48] they'll just say, oh, loves us down the road. I don't wait that long for them.
[27:51] Or, Maverick's down the road. I don't wait that long for them. So, just keep that in mind.
[27:57] Absolutely. That's all I've got.
[28:00] Okay, I don't have any questions.
[28:06] So there's been kind of, I mean, the loves are just two miles down the road.
[28:10] There's many studies suggesting a demand for this at the location where it's being proposed.
[28:17] You know, Andrew might have a little more background here, but we did see a report that was provided to us that kind of talked about the general area and the different options they had for guests.
[28:29] for fuel. And in the report, it did mention that there was a demand for gas area, and maybe
[28:38] you can speak more to that as well.
[28:40] We did a full site analysis.
[28:43] Drew, will you come to the mic? Sorry, I didn't need it on record.
[28:47] Yeah, so again, this is Drew. So we did. We long before we even evaluated this for an
[28:55] actual C-store. We had a professional C-store site analysis study done and they went through it
[29:07] and we based all of the design and development based on that and so we took in consideration
[29:15] the Mavericks and we want to have something that's appealing and but we're aware of some of the
[29:24] model next, as I'm looking at this, you know, on the base and the base and extension, I wasn't
[29:30] in all of those, but, you know, that did take up some of the opportunity, maybe, but I think
[29:37] they've addressed it the best way that we can, so, but yeah, based on the analysis we did,
[29:45] this, you know, even on a conservative level, we're pretty confident.
[29:53] With the growth we have going on on the north end of town I can see the value of something like this.
[30:00] There,
[30:03] back to the loves that I drive by their twice a day going to and coming from work, and it can be a challenge for cars to get out of there.
[30:14] I don't know what the situation would be coming off of 2400 onto the highway there, the need of maybe a stoplight at that location in the future.
[30:26] Yeah, I mean, long term, that is the plan when Rita Ranchary gets developed to the South,
[30:36] that 2,400 would or could be a future traffic controlled intersection area there.
[30:45] It is obviously close to the new functioning traffic lights that they have there coming off the freeway.
[30:53] But that has been something that was discussed and has been working with Utah in the
[30:59] railroad for quite some time, is that 2,400.
[31:02] That intersection is the key entrance into the Rita Ranch Industrial Park, where we would
[31:09] anticipate trucks coming in and out of that area to the south.
[31:13] So until that time, it will be just like loves.
[31:17] they're going to have to wait for those gaps to come out because that would all be managed by
[31:24] you dot, but at least 2400 is going to be a four-way at some point in time.
[31:32] Mark, at one point in time, wasn't that road to the south going to be moved because of development
[31:37] that was going to take place on reader ranch?
[31:40] Yeah, sure what happened to my mind here.
[32:06] Yeah, so the current access for down by the Rita Ranch goes along the river there.
[32:12] That will be closed off and then 2,400 will become the main route and the wider road that will have unceded access other than just the crossing with the route road.
[32:34] It may not know this yet, but the type of stations and Claire Chevron, Exxon, to the
[32:42] Devitational
[32:45] Chronicle.
[32:57] With future developments, more from Mark probably, with future development and probably storm drains coming through 2400 in the future.
[33:12] Could we look at removing or making more parking for a storm drain over one of these basins?
[33:21] I mean, that's a lot of basins.
[33:26] And you've got three different basins there.
[33:28] And I do know that's because there's no ex out for the water to run off site,
[33:35] but with development that will come through there.
[33:37] that you're talking about probably more of a removal of a base,
[33:41] and possibly to be able to add more parking or green space.
[33:46] Yeah, I mean, all that's in time as the city can continue its infrastructure
[33:50] out in that area.
[33:53] The challenges they need to meet the requirement right now for the use.
[33:57] If not, we're going to run into the problem.
[34:00] And so that's, I think there was some good comment.
[34:06] There might be a dollar too that go there on the south that they're talking about, but then you've got your entrance into your driveway, so you don't want to, I mean, that drive through, so you don't want to have a lot of cars coming in and out of there, conflicting.
[34:21] I think what Commissioner Barker mentioned there on that north side of there could be some north south design stalls.
[34:28] Obviously, it just depends how much width and that radius of the diesel trucks making that
[34:36] right.
[34:36] I guess they'll come in and make that left turn to go north and hopefully there'd be enough
[34:42] area there between that turn, which appears there should be in some stalls that you could
[34:47] have, what four or five stalls in that area that they could park and still lead the trash and
[34:53] closure at that location.
[34:54] But I'm also almost wondering that if we were to shift the parking from where it's at now
[35:01] up towards the entryway next one down.
[35:06] So from the let's see that be the north side of that southwest basin
[35:10] If we were to shift that parking up there and make this basin more of an L-shaped
[35:16] Where it would come down more where 19 is called out where your your catch basin would be for it to run in
[35:24] to be able to then elixate down towards and become all one basin with the southeast basin and
[35:29] the southwest basin and have your parking more right up here by the stalls.
[35:36] We have a we also have a thought and that would be we don't know what 2,400 is going to
[35:42] look like what what the cross section is now there has been a request to add additional 20 feet
[35:49] that. That 20 feet could potentially be a part of the basin along there to convey the flows.
[35:57] And then this way we could actually, you know, we could work with staff and everybody on that
[36:02] design where then there was that potential where we could shift that basin back to 20 feet
[36:07] and then you get all those parking salts back. I don't know if Mark actually, if you have an old
[36:11] plan that actually showed, like I said, that whole southwest basin there, that was all parking.
[36:18] I just know that part of that road dedication is going to be for the road with and we don't have the basin in that area.
[36:28] But did Jones and Associates send you the design?
[36:33] I thought Carter was going to send that to you.
[36:36] I don't think they've received that.
[36:38] So that's one of the comments in there is that.
[36:40] So Jones and Associates who's been working on that design for 2400 West, they will be sending if I thought they had sent it.
[36:49] But if not, they'll send that design for them to incorporate to show with their final plan set on how that will all work.
[36:58] Because 2400 is a key major roadway as that area.
[37:02] I mean, there's a lot of discussion and anticipation with those properties and
[37:08] vaccine within a short period of time and improving those areas.
[37:14] So that's going to carry a lot of traffic that will start to address some of those questions
[37:19] that Vince talked about as far as getting traffic out into the highway 13.
[37:28] But, um...
[37:30] But bottom line is, we need to have them go back in. I think there's been some very good input that they can go back in and evaluate the site and look at how they're going to have some of the net additional parking.
[37:48] No further questions?
[37:54] My question was about the U.S. and you addressed that already, so.
[37:58] So there was talk about adding parking up top of North on this part we're 22 is and potentially reducing the EV spots down.
[38:08] So the EV spots are actually self-inflicted.
[38:12] So we added them.
[38:14] That was going to be my question was there any requirements of those.
[38:18] Sounds like there's not.
[38:20] What about in your.
[38:22] Do you expect any detrimental impact by reducing those in terms of
[38:27] traffic that you'll get from those EVs.
[38:33] So that's where we thought it would be.
[38:34] We could reduce some of that.
[38:37] Easy effects.
[38:38] Okay.
[38:39] That's all.
[38:39] Thank you.
[38:47] Commissioners, is there any more questions that we have?
[38:55] Thank you.
[38:56] Thank you.
[38:57] Okay.
[38:58] Mark, do you have anything else to discuss with us?
[39:01] No.
[39:06] Okay.
[39:06] As a planning commission,
[39:07] And we are the land use authority for this application,
[39:14] and we've
[39:18] talked a lot about the city
[39:19] standards.
[39:19] There was so much information there that came up with city standards and stuff and we were
[39:23] reading through them and it looks like is there anything that you guys are worried about as far
[39:30] as the city's questions, needs, requirements, that whole big list of things?
[39:37] Okay.
[39:41] But just relating the interstating of just the challenge that it is within the drainage area and then just the hitting the required parking lots as well.
[39:51] But everything seems straightforward and it's something that we can coordinate with the client with and do our best that we can hit those numbers.
[39:58] We should have a lot more property there that you could work with.
[40:03] Okay, let's go back to our requirements and the planning commission is the land use
[40:07] authority for this project.
[40:12] I don't know with anything specific on the motions that we need to bring forth with the
[40:18] motion.
[40:18] I can't, I did not write anything down.
[40:22] So, I am looking for motion on
[40:31] this application, which is application of 26-076.
[40:38] Do I have one of the commissioners that would please give us a motion on that?
[40:45] Mr. Chairman, I moved that the Planning Commission, acting as the land use authority, approved
[40:51] application number 26-076 the permitted use permit for the fuel center convenience store and quick service
[40:59] restaurant at 1560 north 2400 West based upon staff recommendation stipulations of findings of
[41:07] fact and just emphasizing the need to follow Brigham City standards especially when it comes to
[41:13] working and the storm drain areas.
[41:18] Oh, second that.
[41:19] Who is going to second?
[41:20] Is it?
[41:21] I think we're okay.
[41:26] I'll in favor say aye.
[41:28] Aye.
[41:29] Anyone opposed?
[41:30] Please say nay.
[41:33] Okay.
[41:33] Looks like this past.
[41:34] Thank you.
[41:35] Easy parts done.
[41:36] Now the hard part began.
[41:38] Yeah.
[41:38] Thank you.
[41:38] So much for your time tonight.
[41:40] Thank you.
[41:40] You're welcome.
[41:41] Thank you.
[41:47] Okay.
[41:48] Our next item on the agenda.
[41:50] Mark is we have some training that you would like to do for us.
[41:56] All right, we're just going to keep this pretty simple tonight, but kind of go through a few.
[42:06] Let's see, let me go ahead and share the screen.
[42:09] Before we do the training, I just wanted to mention as a reminder, and we'll send out another email,
[42:16] but we do have the fall UTIPE conference that is coming up on September 9th and 10th if there's any interest for, you know,
[42:25] social attendance or full attendance whenever and again we understand that some of you may not
[42:30] cannot make that and so but we just want to make that possible and then we'll remind you
[42:38] as we get closer into October and mid-October we have the fall and you'll work shop with the
[42:43] Wassage choice here in the Perry lodge or I say the lodge but the Perry city office building
[42:51] Yeah, what was that last fun? It's a workshop. The last one. Yes, so annually was at regional council. They had the was at choice. That's a really good one to to the revisit their plans every year in our constantly updating it. They're dealing with traffic. I mean transportation. They're dealing with trails. Just the various connectivity and you know, basically we all along the north. Yeah. And that's that's a good one to
[43:20] participate in in that that one is uh there wasn't email we can recent that but that's coming up
[43:26] it's a Wednesday October 21st and it goes from four to six they just kind of start it and you move
[43:35] through and people can trickle and that's great but yeah I mean it just depends with the schedule
[43:40] yeah to RSVP you just show up you just show up yeah it's been here appearing now what two years
[43:46] in a row. Yeah, and we've had it in this building. We've had it in the county far west at one time
[43:51] when they were trying to, but lately they just like to do it. This area down at the Perry city
[43:57] building seems to work out really well. And can you show the details on that September 9th and 10th on
[44:03] the September 9th? Yeah, the September 9th. You want the date? It was it. Well, I got the date, but the time.
[44:08] All the time, it's all day, I think.
[44:11] And there's different sessions.
[44:12] Yeah, Fox through to it.
[44:15] So yeah, eight till 4.30 or something like that.
[44:20] How much does that want to get?
[44:21] And that one's down at the Davis Convention Center
[44:24] down in the lake.
[44:26] They rotate having those fall conferences throughout.
[44:29] And when it's close enough, it's nice to,
[44:34] I know I think Roger made the Ogden one, yes, we hosted one here a number of years ago at the Academy Center, which was pretty cool.
[44:46] Wayne's wife Cindy went to that one down in Ogden a little bit and so.
[44:50] But yeah, very worthwhile. Both of these are good ones to go to to understand what's going on, how we kind of fit in with the state, give our input.
[45:00] If we're not there to give our input, sometimes things go around us, and we don't have an input.
[45:07] But it's also good thing to learn what's going on through the rest of the state and what our jobs are.
[45:11] And they teach us more of what our jobs are.
[45:14] In neither need, you said the first one, the Wasatch choice doesn't need an RSVP, the September doesn't.
[45:20] The September one, we wouldn't need to get you registered for that.
[45:24] And they actually have some, so what we'll do is we'll have
[45:29] DESTRIE sent out that information again tomorrow.
[45:33] And then, let's say it's a two-day conference,
[45:37] and we've had some like Solomon who was able to slip over
[45:41] for like a couple sessions one time on Monday.
[45:45] You know, just, again, we realize you have to work
[45:47] and you've got things going on in your lives.
[45:50] But, you know, if it's an interest and you're able to do it,
[45:52] Just look at it and let us know and we'll get you registered and you can attend to what you can.
[46:00] But if not, we'll report back on those who can to do a load.
[46:04] That we can use that for a little training, some meeting as well.
[46:10] All right, good question.
[46:13] What we want to do is just kind of go really over the staff evaluation to see if there's any questions there.
[46:18] With the format, I mean, it's pretty basic.
[46:22] We have the application information, the application type,
[46:28] and so forth.
[46:29] We'll just hear a couple of things.
[46:30] We've talked about this in the past as the application type is either legislative or administrative.
[46:37] Today it was administrative.
[46:40] The Planning Commission role here to land use authority today.
[46:44] A lot of times you're recommending body.
[46:45] So those are the two roles there.
[46:51] Then we'll just get right into the Planning Commission responsibility,
[46:56] which we kind of talk about the role.
[46:58] We try to list it there in your evaluation
[47:02] and then you know you're to verify the city standards.
[47:05] A good comment.
[47:06] I mean we don't really have any standards for a diesel parking,
[47:11] but those are some good questions that in a way
[47:16] It's going to be like a lot of overnight stay, but in a situation
[47:21] it's like that if they're going to go eat where they're going to park,
[47:25] bathroom break, things like that.
[47:26] But as far as the other park with the park,
[47:29] they need to, you know, staff will identify, you know,
[47:32] that's a deficiency that needs to be addressed.
[47:34] And we'll review that with their updated plans,
[47:38] whether it's a two or three-time review process.
[47:42] But those are good things, a lot of good discussion.
[47:44] But the concern, unfortunately, was something like that.
[47:46] I know they said, let's stack them up at the pumps.
[47:49] Sometimes drivers will just parallel park along 2400.
[47:53] And now you got yourself kind of a dangerous situation there.
[47:59] Well, they're already parking off the side of the road at the, at the, at the, in, in current, right.
[48:04] And they don't have a fuel pipe.
[48:06] I see some part on the side of the road on 1200 West when I'm heading into work.
[48:12] So if loves is overflow, they just find a spot to park, they'll park on the off ramp, the on ramps, wherever.
[48:19] Yeah, and one good comment on this one too is an example, I think Jason brought it up as we had.
[48:27] I think is one of the Garce projects on the San Piper phase one with the townhomes that one of the good catches is where is your guess parking.
[48:38] And so those are things that we have more eyes on it and try to catch everything and as a result they have their guess parking design and did a pretty good job with some adjustments, so that's some good examples right there.
[48:53] And then we want to be very specific in motion there's times that we need to clarify things that have been included or if you need to add additional information.
[49:05] With the staff recommendations, obviously, we're going to try to express that they're support or concerns on items that need to be included, and so we'll reference those additional items in the stipulations, which are items that obviously require conditions of approval or things that need to be done, just like the cross access agreement needs to be done.
[49:32] as a staff will fall through to make sure those items are being addressed.
[49:37] And then the findings of fact, you know, as a staff, we try to identify those factual, legal reasons for that land use decision in your approval.
[49:47] Anything that's supporting evidence of that application.
[49:50] So again, if you ever get to a project, a lot of times we're identifying there's been some challenging applications,
[49:58] where we try to include both kind of four or against, you know, that type of act, why
[50:05] there's a reason you could prove it and reasons you could deny it.
[50:11] But if there was ever a feel free if there was an additional finding effect that you feel
[50:18] like you ever need to include, or if there's an application that just does not merit the approval
[50:25] Obviously, then those findings of facts need to be changed a little, I mean, again, if the difficult thing is an administrative application,
[50:38] there's not many, you'd necessarily deny, it would be more of either you'd continue an application, which you could have done tonight, if you felt like, hey, I want to, you could continue it and haven't bring it back, but, but there are close enough that it's okay, they can work through those with staff as well.
[50:56] That was almost a question tonight because there's still a lot of open questions that we have here, too.
[51:02] One that I didn't feel really comfortable with is about the fence.
[51:05] What are we going to do so that we separate the two properties?
[51:09] Is that going to be a chain length fence, ugly?
[51:12] Is that going to be a cement fence fence?
[51:15] That's just one little tiny thing.
[51:17] And all the other questions should we really have approved it or should we have them bring it back?
[51:23] I don't know. I'm not sure. I question that myself.
[51:26] And this one's really six is on. I mean, I'm comfortable with it. You're
[51:31] approving it and moving on to staff. I mean, if we weren't quite comfortable, we've
[51:36] usually been pretty upfront saying, hey, we just feel like we need to continue this to get
[51:42] a little more information. But it could have been one that definitely you could have
[51:47] You didn't say, hey, bring it back.
[51:49] We want to see how you're parking is.
[51:51] I think there's some really good solutions we'll see.
[51:56] But it is tight.
[51:57] But ultimately, when it comes to recommendation,
[52:00] the stipulations, and findings of facts,
[52:02] even if something isn't pinpointed,
[52:04] like let's just say, we didn't put, you know,
[52:06] you got to follow you dot requirements.
[52:08] If that wasn't in there.
[52:10] By us approving it doesn't take away the fact,
[52:12] they still have to follow you dot requirements.
[52:14] There are just things they have to do.
[52:16] Yeah, cities requirements because they still have to follow that
[52:20] We may emphasize one or two or maybe we've come up with some
[52:25] Thought here that needs to be make sure that it's double triple emphasis
[52:30] As I don't know. There could be conditions when we have conditional use permits where we're talking about maybe giving them a difference than what's actually stipulated in Brigham City. Like I guess two weeks ago, the parking requirements for the house there on 100 North, that was all about, well, here's what Brigham City says, the historical section of town is supposed to have, but they're asking for a little bit of a leeway there.
[52:59] Yeah. And it's always difficult, too, and, you know,
[53:04] Commissioner Crain talking about how do you get, you're going to increase traffic,
[53:09] how you can get back on that road.
[53:12] That's tough because we're dealing with the same thing with Taco Bell.
[53:16] When it gets built, getting out on medical drive is going to be crazy.
[53:22] The next step is the city and, for example, there, really quick,
[53:28] Perry and Brigham City got together and talked about a proposed plan and they went and met
[53:34] with you dot and on the south side when you all that challenges of getting out onto Commer
[53:40] Strive basically you've got to take a right out of that frontied road and go down towards
[53:46] Perry and eventually have a roundabout and then come back towards the light and eventually
[53:52] we're going to have to mirror that on the north side somewhere where vehicles can get out,
[53:57] so they're not cutting through the new medical center to turn left onto a medical drive.
[54:03] And those are the challenges that we have to kind of work through and it's hard when we're trying to approve a project.
[54:11] But getting into the motions then is an opportunity.
[54:15] We've talked about this briefly, so here are the two motions.
[54:20] So, as acting as a recommending body in the city council, once you get to the standard language,
[54:26] you know, approval of application such and such, naturally there's really kind of a couple
[54:32] options there.
[54:33] One, you can just get right into and say subject to addressing the staff comments, stipulations
[54:38] with the noted findings of fact.
[54:41] The other one, if you want the second one down, you can just say, you know, your approval
[54:45] based on staff recommendations and stipulations subject, if you're going to say based on staff recommendations,
[54:53] we would like you to include also subject to addressing staff comments. So, either one that you use,
[55:01] as long as it's noted so it's clear, even though they understand, we really haven't had a lot of pushback,
[55:09] but it's nice to have that on record saying, hey we're proving this, but you need to address all those items.
[55:14] Now, you may have some staff comments that, I don't know, I can't think of a good example,
[55:22] but if there was a staff comment that was just, it wasn't really a city code requirement,
[55:29] but something that they were in planning commission degree, any time it's a city code,
[55:34] they've got to meet those requirements, just like was mentioned.
[55:38] But if there was an example where it was just a recommendation, but not a requirement
[55:43] of the City College. The planning commission could approve the project with the exception of that particular item saying we
[55:50] we understand it's a recommendation but we support this and you could actually note that in your motion.
[55:58] We just want to make sure.
[55:59] The first thing that comes to mind is when auto leave did that solar bank there along 1200 and they were supposed to do the normal improvements to the road and everything because of the changes there.
[56:12] And so we all understood that.
[56:14] We made that part of our recommendation and it was after the fact you said, well, they've
[56:18] got together with legal and that changed.
[56:21] Yeah.
[56:22] I still struggle with that one, that decision, because they were doing some site improvements
[56:30] that they should have done their roadway improvements.
[56:33] But legally, I guess, where it was a conditional use permit and a certain element of that
[56:41] like legally the city had could not require 1200 West to be completely built along their
[56:49] side there.
[56:51] I still struggle in understanding that, but yes, that's an example.
[56:58] But, and then that's so the first little blue asterisk is just a reminder you can add
[57:05] I think we've done that on time to time, and then as just as general reminder, after a motion is made, we need to have a second, and then we can have any discussion, for example, so let's just say Isaac made a motion,
[57:27] and you had a discussion about something and he forgot to include it.
[57:31] Then Wayne could second the motion, and then Jacob jumped in and said, okay, we talked about this.
[57:38] Do you mind if we included that in the motion, and then Isaac could amend his emotion?
[57:45] Wayne could approve that second amendment, and then you could vote on it.
[57:51] So Mark going back to where we're the land use authority, I didn't think we recommended it at that point.
[57:57] I thought we just approved or deny or whatever, I didn't think that.
[58:01] Yeah. And I thought about that when I was writing it. In fact, I was looking back at some
[58:07] motions and Isaac did a good job last week where he just said the planning commission
[58:11] acting as land use authority approved application. The only reason I included in there is because
[58:18] the individuals recommending to you guys. So Isaac is recommending to the planning commission that
[58:25] approve it and then you guys can approve or so either way you could just leave it take
[58:32] out the recommend but he's recommending to the planning commission.
[58:36] I don't take it that way I take it is the person giving the motion is saying if you agree
[58:40] with me this is what we as a planning commission are going to do if you don't agree with
[58:44] me then you've got something else to offer so.
[58:49] And that's that that is a good way you can just say the planning commission act in his
[58:53] And then use the authority to prove application or, yeah, so you can leave out that recommend.
[59:02] What happens if you disagree and you want to motion to not approve?
[59:08] Like, how did it?
[59:08] If there's a motion to approve, you just say nay and vote nay and then you would encounter that with a motion to.
[59:15] If you need to make the motion, and you would say the planning commission act in as the
[59:21] land use authority deny application, once a motion to approve has been done, there's
[59:27] not really a room for a month.
[59:29] There we go.
[59:30] There we go.
[59:31] And you can deny it.
[59:33] You can say, you're just, you're just a one-on-door that I still disagree.
[59:39] I see you go the opposite.
[59:40] But if you go.
[59:41] Yeah.
[59:42] And that's part of the language that you'll have.
[59:45] just say, you know, the planning commission acting as language authority, I recommend that we deny this application, basically.
[59:52] So you're still, even though you could either say acting as a language authority, deny application, or I...
[1:00:00] I mean, either way, it just needs to be clear. And then after you had made that motion, again, you need to have a second.
[1:00:12] And if no one seconds that motion, then it basically dies.
[1:00:17] Yeah, we had one then went that way. Oh, that's when I had to make the decision, wasn't it?
[1:00:23] And I think, you know, when you, a lot of the items that you'll have as the land use
[1:00:32] authority, but you are considering applications based on a doctored code.
[1:00:40] So if you're going to deny it, it's not because you, you've got to be careful, you don't
[1:00:44] deny it because you might not like it, but if they can't meet the requirements, for example,
[1:00:51] I'll just, I mean, I'll try to use this one as example.
[1:00:54] Let's just say, if they got up there and said,
[1:00:56] we cannot meet the parking at all, then you could say,
[1:01:00] well, I mean, you could actually continue
[1:01:03] them for them to bring in a revised plan
[1:01:05] and make a smaller C-store or smaller area of footprints.
[1:01:09] They can make it work.
[1:01:11] Or you could deny it based on that,
[1:01:13] and then they could bring another application back in.
[1:01:16] But usually you would just continue it to allow them
[1:01:21] But it comes to conditional use permits.
[1:01:25] I mean we've had people come before just to discuss
[1:01:29] and the one that comes to mind was allowing roosters.
[1:01:33] You know chickens.
[1:01:34] Just to get the feel for what the planning commission was going to do
[1:01:38] and the feeling was we weren't in favor of roosters
[1:01:42] but that individual still went back and at one point in time
[1:01:46] was still wanting to move forward with the application
[1:01:48] but then something changed and they never brought it forth.
[1:01:52] But there are times we've had people come in and just say,
[1:01:55] I just wanted to discuss this first before I make a formal application.
[1:02:00] Yeah, we've had some requests and by the city bylaws,
[1:02:04] we allow individuals if they want to submit something
[1:02:07] to discuss the planning commission they could.
[1:02:10] And we don't see a lot of those, but we did have the gal that
[1:02:15] to on the tattoo, it's called Body Art now and changed that code because for the years it
[1:02:23] was not allowed in commercial and central business. It was only allowed in industrial districts.
[1:02:30] And she said, hey, I do this body art and type of things. I want to place where a grandma can
[1:02:36] come in and feel comfortable not being in an old industrial, you know, area of town. And so
[1:02:41] So as she talked about it and there was a lot of consensus that, hey, it makes sense to
[1:02:46] revisit that and so she felt confident enough to go back and make application, but even
[1:02:53] in those discussion items you can't, you're not voting, you're just kind of giving feedback
[1:02:58] and then it gives them an idea as it worked my time and money to make an application.
[1:03:03] And that one went in her favor and actually her storefront is very tastefully done.
[1:03:09] It's not your traditional, you know, or she had,
[1:03:13] just right here on First North on Maine.
[1:03:16] She getting a lot of gramasis, patrons.
[1:03:19] They don't know.
[1:03:20] They're young.
[1:03:22] They're young.
[1:03:23] They're not.
[1:03:24] Still young.
[1:03:24] See them sister Ross's ankle.
[1:03:27] Anyway.
[1:03:30] But anyway, those are some examples of, yeah.
[1:03:33] We've had the guy with the rooster.
[1:03:36] Sometimes we'll get applications with the recommendy body,
[1:03:39] just like the gentleman that wanted to
[1:03:42] rezone in general plan amendment to allow for the roof trust
[1:03:46] and he was a recommendation for denial.
[1:03:50] Were you here on that one?
[1:03:52] So the planning commission actually recommended denial to the city council
[1:03:55] on both the general plan and the rezone.
[1:03:59] And so when we after the meeting, we talked with him and he wanted to
[1:04:04] pursue the next level to do diligence to go to the city council
[1:04:08] And then I think he realizes there's just a lot of appeal battle with utilities on that property, too.
[1:04:15] That he withdrew his application and didn't go on to the city council.
[1:04:19] So sometimes that would be a sign.
[1:04:21] You have to put it there.
[1:04:23] It's hard.
[1:04:25] And we continue to get a lot of inquiries on that sign.
[1:04:28] Maybe the Rift Trust system would have been a good place for anybody.
[1:04:32] It's interesting to tell you on that, it's just not conducive.
[1:04:35] I'm going to turn trucks in it.
[1:04:37] Yeah, and you can access that set up or they had a way
[1:04:39] or you'd have what's going to be $5 million.
[1:04:42] What would you think that would be a good thing, yeah?
[1:04:43] Yeah, that would be a good thing.
[1:04:44] Yeah, that would be a good thing.
[1:04:45] Just off of 13 is the property on the right.
[1:04:47] That's a really great corner.
[1:04:48] Right there, all right.
[1:04:49] So that's all that I have tonight.
[1:04:51] Just to really refresh and just to really make sure when you're
[1:04:58] making the motion, if there's things that you want to make sure
[1:05:02] addressed a lot of times, it's a pretty simple issue, there's something to know.
[1:05:07] Does anybody have any questions on what Mark has taught us tonight?
[1:05:10] Every there is no.
[1:05:11] No, appreciate it.
[1:05:13] I see.
[1:05:14] So, a denial forces them to, if they wanted to come back, that have to
[1:05:19] re-submit everything.
[1:05:20] A continuation does not.
[1:05:22] Is that right?
[1:05:24] Yeah, I mean, that's a good question.
[1:05:26] If you're the land use authority, and if it was like a unanimous, or a
[1:05:33] like you'd have to have let's say it's afforded to denial or a six-old denial of that
[1:05:38] application. Yeah, I think if it's denied they would have to resummit a new application
[1:05:44] and all the costs that come with. Yeah, of course we'd have to explain why it's denied.
[1:05:50] Sure, always when we deny it, I mean even for the City Council recommendations, we
[1:05:54] should explain why we're denying it. Absolutely. Well, years ago there was a previous
[1:05:59] a person had a conditional use for application disposal and things like appliance disposal, appliance
[1:06:07] disposal, so like that. And they felt that they needed to increase the size of their business
[1:06:12] which went beyond the scope of the original conditional permit. And of course, of discussing
[1:06:18] it, I don't think any of us felt good about increasing to that magnitude in a residential area,
[1:06:24] so we declined it on that very basis, and I don't know if they still have the business.
[1:06:29] They end up selling the property and now a different owner lives there and so yeah, but yeah, that one is an example of a
[1:06:39] One that was denied and they just realized okay, that's yeah, that'll let's not fight
[1:06:46] Have anything that we've talked about in the last few months six months or something that we need to know a basketball
[1:06:55] For again
[1:06:56] No Jack in the box, Roger.
[1:06:59] Yeah.
[1:06:59] No Jack in the box.
[1:07:01] She'll play now.
[1:07:04] Yeah.
[1:07:04] The station's going to have a Chick-fil-A.
[1:07:06] To get that will prove it.
[1:07:08] You don't have to be a double lane.
[1:07:10] Yeah, they don't have it.
[1:07:11] They don't have enough throughput for each other.
[1:07:13] That's all.
[1:07:14] When they come, we just need to make sure they have adequate drive through for sure.
[1:07:21] We do not want to be an example of what they consistently do.
[1:07:25] Yeah, but some people in an off road. Yeah, I can't
[1:07:30] Okay, let's take that. Let's say they did come and say it's going to be a Chick-fil-A, based on the current plans right now.
[1:07:39] And we know what we're hearing from all the other neighborhoods that get Chick-fil-A's and there's lines of cars going out and around the roadways and blocking drive-ins and stuff.
[1:07:49] Would we be within our rights to say we don't think this is a good fit for this piece of property?
[1:07:54] Well, I think, I mean, number one is per our code, they would have to meet the minimum requirements.
[1:08:01] If they met the minimum requirements, we're somewhat obligated to approve.
[1:08:05] That's a trick, because Chick-fil-A, minimum requirements, and different than anybody else.
[1:08:10] Exactly. Same with like in and out. They're not, but they almost-
[1:08:13] Exactly, but in that situation, it would really be good to, I mean, hopefully at a staff level we can try to flush out a lot of those things,
[1:08:22] But sometimes it gets to this point, like you're seeing.
[1:08:25] Chick-fil-a tries their darnity to really improve their drive-through capabilities.
[1:08:30] You've seen the double staggered lanes and runners that bring the food out, all kinds of stuff.
[1:08:37] Yeah, I think you're seeing that, you know, a lot of improvements with their sites.
[1:08:44] But, you know, I think if you got to that point, we could just say, you know, historically there's so much
[1:08:48] many issues, can we continue this to work and see what else, you know, what we can do to try
[1:08:55] to improve this so that it's not impacting you in the long run and also just have an improvement
[1:09:02] to the site.
[1:09:04] So I think you get to that point, you could just say, hey, let's, we need to further work through
[1:09:09] this and let's see what you can come back in.
[1:09:12] I've been in that parking lot by the Chick-fil-A that's on basically 12th street there on
[1:09:16] I've just been in the parking lot parked and I couldn't get out until people were willing to let me back out and they were in the
[1:09:24] The lines. Yeah, it goes through the parking lot instead. Yeah, that's terrible
[1:09:29] And that's what we didn't want to see with that additional parking
[1:09:33] Where cars get trapped in that drive through
[1:09:37] Yeah, you know, you've got to be care. Yeah, so
[1:09:40] But I anyway, I think there'll be some good options that they hopefully these guys will do other than the trucks
[1:09:46] maybe. But I know with the QT, just to let, you know, they're getting pretty close and where
[1:09:53] they go in. And they're going to be just across the road from the four dealership on the corner,
[1:09:59] the first one in Brigham Crossing. Who is it? And they will not have the high flow gas pump.
[1:10:05] Well, they're just doing gas station. There. Yeah. So it's a QT. They just barely open
[1:10:11] a new one in Slaterville. It's in. And they are really getting aggressive.
[1:10:16] So actually he will be on the brick and city side then. Yes, well, but and they do have like a kitchen type of a service inside there
[1:10:25] And about 10-12 rollers for hot dogs and stuff like I pretty much like the Maverick of Arizona
[1:10:33] Yeah, that's why I kind of stand and even in the south a little bit
[1:10:37] That's going across from the for the on the on the cross to the west
[1:10:42] Across the West
[1:10:43] Okay, the difference there is they wanted to maximize their parking
[1:10:50] Because we actually have in our parking not to see more than like 10% of your required parking
[1:10:55] Because I guess that came out after the Walmart building and anyway they wanted to maximize the parking
[1:11:02] But so they're gonna have a lot more parking, but we would not allow
[1:11:07] them to have the high flow diesel
[1:11:11] Pants there because we did not want to compound diesel trucks coming right there on
[1:11:17] 1,100.
[1:11:18] We already have it with loves, of course you'll see that here, and it just, it just
[1:11:22] not, we, oh come on, Mark, yeah, it was, it was quite an experience down on the truckers.
[1:11:29] I can't even believe that.
[1:11:30] I mean, I know.
[1:11:31] All the people that are going to be in that one, you want to get in the truck and they're
[1:11:35] cross truck 4 deal.
[1:11:36] We're going to love that gas station.
[1:11:41] Yeah, but yeah, anyway, that's like, right now.
[1:11:46] Fuckies.
[1:11:46] That's what we need.
[1:11:48] What is that?
[1:11:50] I've heard of them.
[1:11:51] Springville.
[1:11:52] There we go.
[1:11:53] They're big.
[1:11:54] But I've gone to quite a few bookies and they are nice.
[1:11:57] Yeah, you go there in your new city.
[1:12:00] I've never been to bookies.
[1:12:02] It is Walmart.
[1:12:03] Yeah.
[1:12:03] Pretty much as a gas station.
[1:12:06] underposed.
[1:12:08] Sonic, Sonic went out of business.
[1:12:11] What's happening?
[1:12:12] Sonic went out of business.
[1:12:14] We had contacted that there's an interested group that would like to do more of a coffee,
[1:12:21] drink shop.
[1:12:21] I don't know.
[1:12:22] And we haven't seen anything coming in, but there was a lot of inquiries on that.
[1:12:28] Any ideas about opening up that road there between Wal-Mart and Sonic?
[1:12:32] making that wider and getting, you know, of course,
[1:12:35] would have to work with Walmart to open that up
[1:12:37] because it's a private road still,
[1:12:39] and there's still something working with it.
[1:12:40] Yeah, the cities reached out to Walmart
[1:12:42] and see if they would help, you know,
[1:12:44] dedicate additional right away, and so we can widen it
[1:12:47] because that was the effort we made on the other side, right?
[1:12:51] And so that is the goal is to continue to work with Walmart
[1:12:54] and get that widen and then dedicate it
[1:12:57] as a public road and we get to that point.
[1:12:59] Nothing moving.
[1:13:00] But nothing's really moving right now, anything else happening by the BI, the new D.I.
[1:13:07] It's over there.
[1:13:08] That's all we're in Perry.
[1:13:09] Oh, that's right.
[1:13:09] You're right, Eric.
[1:13:10] But there will be a road that goes between the D.I. and their, um,
[1:13:14] because here we're going to be told, what do you call the, the distribution?
[1:13:17] Yeah, that's definitely service building all the service building.
[1:13:20] Usually they're kind of on the same side of the parking lot, but there's a separation
[1:13:23] because of that road that we'll continue through.
[1:13:27] I'm just wondering where that road is.
[1:13:28] I feel like they're going to be on a certain level.
[1:13:30] They're out about all I'm installing right now is everywhere around the world.
[1:13:35] I know some are not a favorite, you know, the city.
[1:13:39] But there may be, there needs to be.
[1:13:42] But isn't that, I think someone mentioned that for the Taco Bell.
[1:13:46] Yeah.
[1:13:48] They're on fifth tractors.
[1:13:49] Well, that's what I'm building for Hill Air Force Base.
[1:13:52] I'm building their brand new gate.
[1:13:54] And I'm putting it around about it right off of their gate.
[1:13:58] You'll enter in for 1,800 North, go through the gate, and then be immediately met with the
[1:14:03] roundabout right after you're through.
[1:14:07] Interesting.
[1:14:07] I'm sure you're curving slowly, and you're still bouncing over here.
[1:14:10] That's not an ever problem.
[1:14:13] Okay, I think it's time that we close on out, so I am looking for a motion to adjourn the meeting.
[1:14:21] Oh, please.
[1:14:22] Someone's got to.
[1:14:23] Wayne, I would like to make a motion that we adjourn this meeting.
[1:14:27] I'll second it.
[1:14:31] All in favor say aye.
[1:14:34] Anybody opposed say nay.
[1:14:37] Thank you.
[1:14:38] And I'm going to call this one.
[1:14:40] Seven and thirteen.
[1:14:44] I'll just have to.
[1:14:48] I saw that blink on and off like your connection isn't making.
