[5:35] the privilege of serving as a
[5:36] growing grads intern. Tonight,

[5:38] m also honored to be inducted
[5:38] as a member of the Brighton
[5:40] Youth Commission. One of the
[5:41] things that I
[5:41] ve learned this
[5:42] summer is that Brighton just
[5:43] doesn
[5:44] t ask young people to be
[5:45] the future. It gives us
[5:46] opportunities to contribute.
[5:48] Today. Tonight, you
[5:48] re
[5:50] welcoming new members into two
[5:52] of these opportunities. The
[5:53] Brand Youth Commission gives
[5:54] young people meaningful
[5:56] opportunities to engage with
[5:58] local government, develop as
[5:59] leaders, and make a positive
[5:59] impact in the Brighton
[6:01] community. Brian Impact
[6:03] provides hands on opportunities
[6:04] to develop leadership through
[6:06] service, teamwork and community
[6:07] involvement. These programs
[6:09] remind us that leadership isn
[6:09] t
[6:10] about a title. It
[6:10] s about
[6:12] listening, taking initiative,
[6:13] serving others, and being
[6:14] willing to make a difference.
[6:16] They help us build confidence,
[6:17] develop new skills, and
[6:18] discover that our voices
[6:19] matter. As someone who
[6:19] s
[6:20] experienced one city youth
[6:22] leadership program and is now
[6:23] beginning another, I can say
[6:24] these opportunities have a real
[6:25] impact. They don
[6:26] t just prepare
[6:27] for someday. They allow us to
[6:29] make a difference. Today, on
[6:30] behalf of everyone being
[6:31] inducted tonight. Thank you for
[6:32] believing in young people
[6:34] enough to invest in us. Your
[6:35] support creates opportunities
[6:36] that help us grow into leaders

[15:56] Brighton Highway seven that I
[15:58] bought about two years ago. Um,
[16:00] ve been having some. My water
[16:03] bill is, like, extremely high.

[16:04] ve talked to the water
[16:05] people here in Brighton, and
[16:07] nobody seems to want to be able
[16:08] to do anything like my water
[16:14] bill for this month is $652. I
[16:15] have an ice maker. I have a
[16:17] toilet and a mop, sink and a
[16:18] sink. There
[16:18] s no grass or
[16:20] anything. Uh, what I understand
[16:21] is the building was built in
[16:23] 1961, roughly, and it was
[16:25] laundromat. Then years later,
[16:27] it went half laundromat, half
[16:28] liquor store. And it
[16:28] s been the
[16:30] liquor store for the last 35
[16:33] rough years. Um, I
[16:34] ve asked
[16:36] this, this city water person,
[16:36] if there
[16:38] s some way I can get a
[16:39] variance to choke the line
[16:40] down, because I would
[16:41] understand is when it was the
[16:42] laundromat, they have a two
[16:44] inch line coming from the
[16:46] street. And he said, the only
[16:47] way I can do that. So if I turn
[16:49] my parking lot up and put a
[16:51] whole new line in, tear the
[16:52] meter or tear the stuff out of
[16:53] the street, and that
[16:54] s going to
[16:57] be 10 to $15,000. So I

[18:49] behalf of the city as Associate
[18:50] Planner Stephanie Adams.

[18:54] Mayor, mayor pro tem and
[18:56] members of council. My name is
[18:57] Stephanie Ames, associate
[18:58] planner with the city. And I
[19:00] here to present the Prairie
[19:01] Center Metropolitan District
[19:03] number seven service plan
[19:06] amendment. The subject property
[19:07] outlined on the map is
[19:08] generally located to the north
[19:10] of Eagle Boulevard, south of
[19:12] Kite Street and South 35th
[19:14] Avenue, east of South 27th
[19:15] Avenue, and west of Prairie
[19:17] Center Parkway. Comprised of
[19:18] all property within Prairie
[19:21] Center Village, one subdivision.
[19:25] To provide some background, the
[19:26] original service plan for the
[19:29] district was approved in 2006.
[19:31] In 2008, there was an amendment
[19:32] to the service plan increasing
[19:33] the cost of public
[19:34] improvements. Currently, the
[19:36] district has two outstanding
[19:38] general obligation bonds with a
[19:40] final maturity of 2045 and
[19:43] 2046, and in accordance with
[19:44] the approved Service plan, any
[19:45] modifications to the service
[19:47] plan require approval from the
[19:51] City Council. With this Second
[19:52] Amendment to the service plan,
[19:53] the district is seeking to
[19:56] refund the existing bonds,
[19:58] change the bond maturity limits
[20:00] from 25 years to 30 years to
[20:01] align with the city
[20:01] s model
[20:03] service plan and lower annual
[20:05] debt service. Mill levies
[20:07] remove the restriction
[20:08] prohibiting issuance of new
[20:10] money debt after DECEMBER 1st,
[20:13] 2025, and replace that
[20:14] restriction with the rule
[20:15] limiting the debt service mill
[20:17] levy to no more than 40 years.
[20:18] We
[20:19] ll also preserve flexibility
[20:21] for future financing by
[20:22] allowing additional new money
[20:23] debt with approval from the
[20:27] district board. By extending
[20:28] the repair the repayment
[20:29] period, this would reduce the
[20:34] debt service mill levy from
[20:39] 63.495 to 39.617 starting in
[20:42] 2027. Collections. At this
[20:43] time, the options for
[20:44] consideration are before you on

[21:12] Of the Board of directors for
[21:14] Metro District seven. I
[21:16] honored to represent the 370
[21:20] home owners in this community.
[21:21] And our effort tonight to try
[21:23] to modify the bond debt for
[21:24] this community to offer
[21:26] significant annual property tax
[21:29] relief for its residents. I
[21:31] joined by other members of our
[21:33] 100% Resident Control Board
[21:35] here tonight are including our
[21:36] treasurer, Ron Johnson, and
[21:38] members Alan Greenfield,
[21:40] Jeffrey Hunter and Megan Smith,
[21:41] as well as the members of our
[21:42] community. I
[21:43] m not an expert in
[21:45] this field by any means. I
[21:46] just a volunteer and I
[21:47] m a
[21:48] homeowner. But we
[21:49] re fortunate
[21:50] to have experts here with us,
[21:52] uh, including Kathy Conda,
[21:52] who
[21:54] s with McGeady, Beacher,
[21:56] Cortez and Williams, our
[21:58] general counsel for the
[21:59] district, and Matt Chalk, who
[22:02] a director with D.A. Davidson.
[22:04] This amendment will give us the
[22:08] option to extend our refi to 30
[22:09] years so we can explore as many
[22:12] possibilities as possible to
[22:14] maximize the property tax
[22:20] reduction for the residents. As
[22:24] I said, just a very brief, um,
[22:27] set of slides here where a 100%
[22:30] district board comprised of
[22:31] residents, uh, we have five
[22:33] board members. Currently, the
[22:35] metro district portion of the
[22:37] resident property taxes is
[22:39] approximately 40% of our total
[22:41] tax bill. Um, due to our
[22:43] maximum mill levy that we have
[22:45] to pay based on how the bonds
[22:48] are structured currently, in
[22:52] addition to taking care of of
[22:54] the statutory compliances, we
[22:56] also performed the hoa
[22:57] functions, including operations
[22:58] of maintenance of the public,
[22:59] improvements including the
[23:01] common area, landscaping. If
[23:01] you
[23:02] ve been by the community,
[23:03] you know we have a tremendous
[23:05] amount of landscaping there and
[23:06] snow removal, the entry
[23:08] monuments, the lighting, the
[23:10] under drainage system, as well
[23:11] as the design review and
[23:13] covenant Enforcement district
[23:14] board takes care of all of
[23:16] that. So here
[23:17] s the opportunity
[23:19] to try to decrease the
[23:19] district
[23:21] s property taxes,
[23:22] where we can refund the
[23:24] existing bonds from the series
[23:27] 20 and the series 21 bonds. Uh,
[23:29] and take those to market. We
[23:29] re
[23:31] not adding any additional debt.
[23:33] Uh, no additional debt is being
[23:35] added or contemplated. Any
[23:36] additional debt to this
[23:38] community would require a vote
[23:40] of the residents. So there
[23:41] nothing we can do on our own
[23:43] anyway. Um, we
[23:44] ll propose the
[23:46] refunding plan based on present
[23:47] market conditions. We
[23:47] ll go to
[23:48] the market, take a look, see
[23:50] what makes the most sense. Um,

[24:15] $950 per home per year. If we
[24:17] take this to market the way
[24:18] that we think we can, it can
[24:19] work. It
[24:20] ll also minimize the
[24:21] quarterly operations and
[24:23] maintenance fee increases. In
[24:25] addition to the to the the
[24:26] property tax amount that we
[24:28] pay, we also pay quarterly
[24:33] operations fees of $828 a year
[24:34] per home. And they
[24:34] re billed
[24:37] quarterly. And so hopefully
[24:41] this refi restructure will
[24:43] allow us to minimize any of
[24:45] those increases as well and
[24:48] give us some financial
[24:50] flexibility to maintain and
[24:51] enhance the public interest
[24:52] infrastructure in the community
[24:54] amenities that we have, should
[24:57] we need additional monies for
[24:58] something. This gives us a
[24:59] little bit more flexibility in

[31:52] opportunities to lower the debt
[31:54] service mill levy because when
[31:55] the bonds were originally
[31:57] issued, their cash flow bonds.
[31:58] So until they
[31:59] re paid off,
[31:59] there
[32:02] s no opportunity to
[32:04] reduce the, you know, the debt
[32:07] service mill levy versus
[32:09] structured bonds that have an
[32:13] annual amortization, where if
[32:13] you
[32:14] re producing more, then you
[32:16] need to make an annual payment.
[32:17] You know, that mill levy could
[32:19] actually go down. So that was
[32:21] that was the beginning point,
[32:24] right. The board um, talked to
[32:27] two different underwriters and
[32:29] looked at more than one
[32:32] refunding scenario, including a
[32:35] 25 year term bond, which is
[32:37] what their current service plan
[32:40] allows. And realize that with a
[32:42] 30 year term, they could
[32:44] actually realize a bigger
[32:46] reduction in their mill levy.
[32:48] And I think the analogy for
[32:52] those of us who are not met ski
[32:54] is think about a home mortgage,
[32:57] right? The longer your term,
[32:59] the lower your monthly payment.
[33:01] If you finance with a shorter
[33:04] term, the payment is bigger.
[33:04] That
[33:05] s the way that somebody
[33:07] like me, who is not really good
[33:09] with numbers, sort of
[33:11] understood this. Under your
[33:14] current model service plan, it
[33:16] allows districts to issue bonds
[33:20] for terms of 40 years. So our
[33:22] request to increase the term
[33:25] from 25 to 30 is actually less
[33:26] than what
[33:27] s currently allowed
[33:30] in the model service plan.
[33:30] There
[33:32] s also a provision in our
[33:33] service plan, because it was
[33:35] one of the first ones that was
[33:37] approved by Brighton way back
[33:40] in 2006. There was there was
[33:44] um, the expectation or the
[33:47] desire that the entire 2400
[33:50] acre. Um, yeah. Prairie Center
[33:51] development would be fully
[33:54] developed by 2025. And so there
[33:57] was a provision in the service
[33:59] plan that said districts
[33:59] couldn
[34:01] t issue any additional
[34:04] debt after 2025. Well, that
[34:06] ship has sailed. There is an
[34:08] exception for refunding, which
[34:11] is what we have here. And in
[34:12] some of the discussions we
[34:14] talked about maybe issuing even
[34:17] a little more debt, um, either
[34:19] to pay off past developer
[34:21] advances or build up a capital
[34:22] reserve for additional
[34:24] community amenities and that
[34:26] sort of thing. And when we
[34:29] spoke with, um, city, the
[34:29] city
[34:30] s consultants, outside
[34:33] legal counsel at Butler Snow,
[34:35] rather than, you know, we
[34:37] started out with, well, do we
[34:41] extend from 2025 to 20 20, 30,
[34:42] 2035, you know, what are we
[34:44] going to do here? What makes
[34:46] sense? And what we mutually
[34:49] agreed upon is in the current
[34:51] model service plan, there
[34:51] s a
[34:54] limitation that says a district
[34:57] cannot impose a debt service
[34:58] mill levy for more than 40
[35:00] years after the first issuance
[35:05] of debt without, um, a decision
[35:08] to extend that term by a
[35:11] resident controlled board of
[35:13] directors. Because what we
[35:13] re
[35:16] proposing, if we issue this
[35:20] year, which is 20, 26, 30
[35:24] years, takes us out to 2056, I
[35:24] can
[35:25] t do math in my head. I
[35:28] so sorry. And if you go back to
[35:29] when they initially issued in
[35:32] 2020, we fall within that 40
[35:36] year, um, frame. And again, um,
[35:40] it, it brings the this district
[35:44] service plan in alignment with
[35:45] the provisions of the current
[35:47] model service plan that was
[35:50] adopted, um, in when was that
[35:56] adopted in 2021. Did I make
[35:57] sense?
[35:59] Not exactly. Um.

[36:03] Because it was, uh, structural
[36:05] adjust restrictions on new debt
[36:06] issuance. But now I
[36:06] m hearing
[36:08] that you MAY issue new debt and
[36:10] then remove the prohibition on
[36:12] issuing new money debt after
[36:14] DECEMBER 2025, replaced it with
[36:15] a rule of limiting the debt
[36:17] service mill levy to no more
[36:18] than 40 years. So that means
[36:20] that if we do this 30 year
[36:20] term, you
[36:21] d still have another
[36:23] ten years, uh, to think about
[36:25] issuing new debt, right?
[36:26] Just like all the other
[36:27] metropolitan districts in the
[36:28] city of Brighton right now that
[36:30] have been organized since the
[36:33] model service plan was put into
[36:36] place. So and we have a 100%
[36:39] resident control board. And the
[36:40] other thing that I want to
[36:42] emphasize is no new money debt
[36:46] is contemplated. Now. But
[36:48] because this district does have
[36:51] significant public improvement,
[36:52] operation and maintenance
[36:54] responsibility, we don
[36:57] foresee any need in the
[36:59] foreseeable future for any new
[37:00] money debt. We just don
[37:01] t see
[37:04] it at all. But in terms of
[37:05] coming into compliance with
[37:07] your current model and being
[37:09] able to do what they need to do
[37:12] now, we agreed that that would
[37:15] be a logical thing to do.
[37:17] Okay, like I said, there
[37:17] s that
[37:19] now is acting a lot. Yeah,
[37:19] there
[37:21] s nothing now. But, um.
[37:23] Well, I mean, but you saw some
[37:24] of the comments from residents,
[37:24] right.

[37:31] was mentioned, the district
[37:33] functions like an hoa. So

[37:47] district itself maintains. If
[37:48] if you had an earthquake and
[37:49] that whole underground system
[37:50] went under, you know, they
[37:52] might need to go out and get a
[37:53] little bank loan, which would
[37:54] be debt if they
[37:55] re using debt
[37:56] service levy to pay for it. But
[37:56] we
[37:57] re not seeing, you know,
[37:57] we
[37:59] re not anticipating that
[38:01] now. It was just that when we
[38:04] had the conversation about
[38:06] making sure that this district,
[38:08] which is controlled by
[38:09] residents, had the most
[38:11] flexibility to do what they
[38:13] need to do now and what they
[38:15] MAY need to do in the future,
[38:16] coming into compliance with the
[38:18] current model service plan seem
[38:21] like the most efficient and
[38:22] easy way to go.
[38:24] Okay, I understand that, but my
[38:25] other concern is that it took
[38:27] you six years to pay off a
[38:29] third of the debt, but now you
[38:30] want to extend it to 30 years
[38:33] to pay off the remainder. So,
[38:35] and I understand that it
[38:36] going to lower the taxes and
[38:36] everything else.
[38:39] But okay, so the, the, the
[38:42] bonds that were issued in 2020,
[38:43] the interest rate environment
[38:45] was very good. And for those of
[38:46] you who are around when these,
[38:48] uh, Prairie Center districts
[38:51] were organized, um, there
[38:51] s an
[38:52] agreement with the city that
[38:55] returned to the districts, a
[38:57] portion of the use taxes that
[38:59] are paid at building permit. So
[39:01] the reason the district was
[39:03] able to issue bonds early in
[39:06] the development cycle for this
[39:10] district was because when they
[39:14] were marketed, there was a big
[39:18] bubble of, um, basically use
[39:19] taxes that came to the
[39:21] district. And because their
[39:22] cash flow and then as the
[39:24] district built out, it built
[39:26] out more quickly than anybody
[39:29] anticipated. Um, the property
[39:31] taxes and those use taxes
[39:33] enabled the district to sort of
[39:36] pay off those. The first series
[39:40] of 2020 bonds, the 2021 bonds,
[39:42] however, are carrying interest
[39:47] at 6.3 6.4%. And so what
[39:48] happening? Because they
[39:49] re cash
[39:51] flow bonds and the 2020 ones
[39:53] are subordinate. Every penny is
[39:55] going into those senior bonds
[39:56] that were issued in 2020.
[39:58] Nothing is going toward the
[40:01] principal on those 2021 bonds
[40:03] that are accruing interest at
[40:06] 6.4%, and will continue to do
[40:08] so until they get paid off. So
[40:13] the payoff on the 2021 bonds is
[40:16] going to be a more protracted
[40:18] period. And it because they
[40:20] pledge their maximum debt
[40:21] service mill levy, there
[40:22] s no
[40:23] opportunity for that debt
[40:25] service mill levy to come down.
[40:28] And so again sort of based
[40:31] preliminary estimates at this
[40:33] point is that there could be a
[40:36] significant, um, property tax
[40:38] reduction and it is going to be
[40:39] a policy decision that the
[40:41] board will make in conjunction
[40:42] with the input they receive
[40:44] from the residents, whether
[40:46] they want to extend, you know,
[40:47] go a little bit longer on the
[40:50] debt to realize bigger property
[40:53] tax savings today, or maybe,
[40:54] you know, do something in
[40:58] between, do nothing and just
[41:01] pay off the 2021 bonds as are
[41:02] currently structured or
[41:04] something in between. Right.
[41:06] And the opportunity does
[41:07] present itself to get a lower
[41:08] interest rate. That
[41:09] something.

[42:00] two reasons to refi a mortgage.
[42:02] One is to get a lower interest
[42:03] rate, in which case you might
[42:05] actually save some money. Two
[42:05] is you don
[42:06] t want to make the
[42:07] monthly payment. You want to
[42:10] reduce your monthly debt by
[42:11] extending it. The problem with
[42:12] that one is, is it
[42:13] s smoke and
[42:14] mirrors because you pay less
[42:16] this month, but in the end you
[42:17] end up paying a lot more money
[42:19] than you would have paid if you
[42:21] just left the debt alone. So
[42:21] that
[42:23] s my concern. Are we
[42:26] burdening the residents with
[42:28] more out of pocket debt over
[42:31] the period of this thing? Um,
[42:34] because last time I checked,
[42:35] interest rates weren
[42:36] extremely favorable. Right now,
[42:37] they
[42:38] re better than they were a
[42:38] year ago, but they
[42:39] re not
[42:40] great. And so I
[42:41] m wondering if
[42:41] we
[42:42] re going to burden the
[42:44] residents with more debt
[42:45] overall. The other thing is,
[42:46] Americans typically live in a
[42:49] home 20 years. Extending this
[42:51] 30 is kicking the can down the
[42:52] road to the next people that
[42:52] buy in. I
[42:53] m not sure I like
[42:55] that either. So those are my
[42:59] concerns about it is have you
[43:02] calculated the final out of
[43:03] pocket costs? Are the residents
[43:05] paying more for this? Are they
[43:06] paying? I mean, I know they
[43:07] re
[43:08] paying less monthly. I don
[43:08] care about that. I
[43:09] m talking
[43:11] about the total cost of the
[43:12] debt. Are they going to end up
[43:13] paying more than they
[43:14] re paying
[43:20] now?

[43:24] exactly how that works. When
[43:26] you extend the amortization on
[43:27] a debt, you are going to pay
[43:29] more debt over the long run.
[43:31] Based on our numbers. And just
[43:34] a point, Council Member Greene,
[43:35] if we leave the debt
[43:38] outstanding, those bonds don
[43:40] get paid off until 2043. So
[43:40] really what we
[43:41] re talking about
[43:45] is a 30 year extension to 2056.
[43:46] And the additional debt that
[43:47] going to accrue on those bonds
[43:51] is about $3.4 million of
[43:53] accrued and unpaid interest,
[43:55] which to me is a waste of money
[43:57] for these residents. The total
[43:59] debt, if you compare the
[44:00] existing debt structure, it
[44:03] about seven 17.3 million.
[44:04] Assuming we don
[44:04] t do anything
[44:06] with the existing debt under a
[44:09] 30 year amortization, yes, the
[44:10] debt increases to about 20
[44:12] million. So about a roughly a
[44:14] $3 million delta, slightly
[44:18] under. And if we stick to a 25
[44:19] year arm, which is currently in
[44:21] the district service plan,
[44:23] about 17.8. So it
[44:24] s kind of a
[44:25] wash between the current
[44:27] existing debt structure in a 25
[44:30] year Am. But again, the goal of
[44:32] these taxpayers is to lower
[44:34] their taxes. And just a point
[44:39] on the the actual the average
[44:40] homeowner stays in a house
[44:43] about 7 to 8 years. So, you
[44:43] know, it
[44:44] s not 20 and we
[44:44] re not
[44:46] kicking the can. Um, this will
[44:48] be obviously a burden, tax
[44:50] burden for the next property
[44:52] owner. But depending on when
[44:53] they move into that house, it
[44:55] not going to be a 30 year
[44:57] obligation. So I just wanted to
[45:00] make that point.

[47:33] discussed with the applicant
[47:35] early on, because this is one
[47:37] of the metro districts in
[47:39] connection with an aggregate
[47:41] group of Prairie Center metro
[47:43] districts that have maximum met
[47:46] or maximum debt cap limits for
[47:48] all of the districts, and for
[47:49] them to try and bring that
[47:51] service plan fully in
[47:54] compliance with the model. Um,
[47:56] would require all of the other
[47:58] districts to also then come
[48:00] back and submit all of their
[48:02] service plans to come into
[48:03] compliance with the model.
[48:05] Otherwise, we have
[48:06] inconsistencies with
[48:08] enforcement of the model of the
[48:11] service plans and how they all
[48:13] intertwine and work together.
[48:14] And so what
[48:15] s in front of you
[48:18] today are really minor changes
[48:19] to their service plan, while
[48:22] keeping everything in place as
[48:26] is currently. So yes, there are
[48:27] differences between the model,
[48:30] which includes some reporting
[48:32] requirements, some, um,
[48:34] different, you know, their
[48:35] initial one didn
[48:35] t have this
[48:38] mill levy imposition term, but
[48:40] the thrust of the changes that
[48:41] they
[48:42] re asking for have all
[48:44] been contemplated in the model
[48:46] where as soon as it
[48:46] s a
[48:48] resident control board, if the
[48:50] board approves extending that
[48:51] debt limit or extending the
[48:53] imposition term, or extending a
[48:56] longer debt term, your model in
[48:57] the in the policy decision
[48:57] that
[48:59] s surrounds that model,
[49:02] um, provision supports this
[49:03] amendment.

[49:06] That makes sense because I
[49:06] we
[49:07] re not being asked to make
[49:10] the decision refi and extend,
[49:12] uh, lower the monthly payments
[49:14] in trade for a longer debt
[49:15] cycle. Uh, that

[49:18] residents who get to make that
[49:19] that decision. And if they
[49:20] don
[49:20] t like it, I suppose they
[49:22] can, uh, vote in a new board
[49:25] and go for something else. But,
[49:27] that that really is the attempt
[49:28] to put it back in your hands. I
[49:31] think you answered the question
[49:33] that I had around. Uh, is it
[49:35] worth trying to uplift the
[49:36] whole thing? But really, we
[49:37] ve
[49:39] got such a patchwork or
[49:41] interconnected set of, uh,
[49:42] districts that that
[49:43] s perhaps
[49:45] more complicated than it is
[49:47] worthwhile to consider. Uh,
[49:48] this one specifically. My other
[49:51] question is, is this metro
[49:53] district built out or does it
[49:55] have a new enough time, uh,
[49:56] projection of timeline to build
[49:59] out that that 40 years now
[50:02] gives you enough runway.?

[50:07] is fully built out, 370 homes.
[50:08] So. So we don
[50:10] t have a problem
[50:11] of you still need to develop
[50:14] another 120 homes and we create
[50:15] that problem farther down the
[50:15] road.

[50:37] the metro district would be a
[50:38] simplifying factor and would
[50:40] potentially eliminate your
[50:42] problem of assessments,

[50:46] figure out how you need to
[50:48] organize all of that. Uh, it
[50:50] just causes me a little bit of,
[50:52] of angst, but I don

[51:05] the metro district, uh, in
[51:07] accordance with how things are
[51:09] structured and recognizing, uh,

[55:56] procedures for procurement of
[55:58] construction services and
[55:59] procurement solicitation.
[56:05] Protest procedures. The table
[56:07] on the screen before you
[56:08] outlines the amendment. Staff
[56:10] is proposing to article two.
[56:12] First, staff proposes to align
[56:13] the deadline to cure defects
[56:15] and petitions of nomination and
[56:16] affidavits, with the deadline
[56:18] set forth in title one of the
[56:20] Colorado Revised Statutes.
[56:21] Changing the deadline from 18
[56:23] days before the election to 64
[56:25] days before the election. This
[56:27] change is necessary to provide
[56:28] deadline cohesion and
[56:29] Elections coordinated with the
[56:32] county. Staff seeks to provide
[56:34] cohesion by clarifying the
[56:36] applicable computation of time
[56:38] based on whether the election
[56:39] is coordinated with the county

[1:06:20] construction of a regional
[1:06:23] detention pond. Uh, this
[1:06:25] proposed agreement defines
[1:06:27] roles, easements, right of way,
[1:06:28] needs, construction
[1:06:31] coordination, and long term
[1:06:35] maintenance responsibilities.
[1:06:37] District owns the property at
[1:06:39] 88 North 40th Avenue. The city
[1:06:42] will build roadway in a pond
[1:06:44] while maintaining bus access
[1:06:48] throughout construction. Uh
[1:06:50] project components. Stormwater
[1:06:52] conveyance to new detention
[1:06:54] pond. Pond construction and
[1:06:56] site grading. Removal of dirt
[1:06:58] and concrete debris.
[1:07:01] Acquisition of right of way and
[1:07:03] easements shown in exhibits. On
[1:07:05] my next slide. And this is the
[1:07:07] exhibit of the actually right
[1:07:07] of way. There
[1:07:08] s going to be a
[1:07:10] requiring the easements as well
[1:07:11] as temporary easements that
[1:07:12] re going to need during
[1:07:14] construction, and then a
[1:07:15] drainage easement over the
[1:07:16] pond. So those are the
[1:07:18] different colors. Red is pretty
[1:07:20] much right away. Green is
[1:07:22] utility easement. Uh, the the
[1:07:24] yellow is the drainage
[1:07:25] easement. And then the kind of
[1:07:26] I guess doesn
[1:07:26] t look too
[1:07:28] orange, but the, uh, off
[1:07:30] yellow, it would be, um, um,
[1:07:32] the temporary easement we would
[1:07:38] need to clean that area up. Uh,
[1:07:40] the district will convey right
[1:07:42] of way and easements to us. Uh,
[1:07:44] the city will manage the
[1:07:49] construction. The city
[1:07:50] maintains the ponds. For the
[1:07:52] first five years, the district
[1:07:53] will handle mowing. Uh, the
[1:07:55] city will maintain stormwater
[1:07:56] inlet structures for the long
[1:08:00] term. Uh, there are no no new
[1:08:03] long term city obligations that
[1:08:05] the future dredging costs will
[1:08:09] be a cost share with 86%, uh,
[1:08:11] paid by the district, 14%, uh,
[1:08:12] subject to pay by the city,
[1:08:15] subject to annual appropriation.

[1:08:19] to secure right of way.

[1:10:25] dinner. It was in Arvada. It
[1:10:26] was at a restaurant on the
[1:10:28] Adams County side in Arvada. I
[1:10:29] was the only Brighton
[1:10:30] representative there, but it
[1:10:32] was good to hear updates from
[1:10:35] our peer peer municipalities in
[1:10:38] the area. Um, and just so you
[1:10:39] know, MR. Green, they actually
[1:10:40] had Pepsi products, so you
[1:10:41] would have got a mountain dew
[1:10:44] over there. So you missed out.
[1:10:48] So, um, and we dodged a
[1:10:50] thunderstorm, but, uh, it was
[1:10:52] good. Uh, I also attended,
[1:10:54] obviously, the city barbecue,
[1:10:56] like many of us here. It was
[1:10:57] great to have everybody out,
[1:10:59] despite a little bit of a
[1:11:00] threatening of rain. And then,
[1:11:02] of course, rain kind of started
[1:11:04] towards the end, but it was
[1:11:06] great to interact with a lot of
[1:11:08] the youth that were out there
[1:11:10] selling a lot of the a lot of
[1:11:12] the goods that they had either
[1:11:14] made or put together or
[1:11:15] whatever they did, and it
[1:11:18] teaches them how to create, um,
[1:11:20] you know, that entrepreneurial
[1:11:21] spirit. And it was it was just
[1:11:23] a fabulous, uh, showing from
[1:11:26] the youth. So good job for them
[1:11:29] that the, uh, police swearing
[1:11:31] in ceremony, they do those a
[1:11:32] couple times a year with new
[1:11:33] officers coming in or
[1:11:36] promotions or staff coming in,
[1:11:36] and it
[1:11:37] s good to honor those
[1:11:40] that are serving in, uh, you
[1:11:41] know, serving as our first
[1:11:44] responder. Uh, last week we had
[1:11:46] the ribbon cutting to the a470
[1:11:49] and Sable interchange. It was
[1:11:51] good to get that open. Uh, last
[1:11:52] time I drove by, I think the
[1:11:53] lights were flashing, so I
[1:11:55] think those will be going solid
[1:11:56] really soon, if they haven
[1:11:59] already, then, uh, I was at
[1:12:01] the, uh, metro Denver State of
[1:12:03] the cities address. Um, what
[1:12:05] was interesting about that is,
[1:12:07] uh, the the mayor of Denver was
[1:12:09] not there, but they had a panel
[1:12:10] of other mayors throughout the
[1:12:12] area talking about, uh, you
[1:12:14] know, the collaboration of
[1:12:16] cities in the, in the region.
[1:12:17] And it was good to be a part of
[1:12:19] that. I was, uh, they they get
[1:12:21] people to do a host table. And
[1:12:23] so I encourage you all the next
[1:12:25] opportunity to, to do that if,
[1:12:26] uh, if becoming a host table
[1:12:29] opens up again next year, it
[1:12:33] also at the chambers Cinerama
[1:12:36] event. Uh, Cinerama for like,
[1:12:38] probably several years in a
[1:12:40] row, puts on a great networking
[1:12:41] event. They involve four of the
[1:12:43] area chambers, and it was good
[1:12:45] to interact with so many of
[1:12:47] our, even a lot of our friends
[1:12:49] from the surrounding chambers.
[1:12:51] And so good job on them. I
[1:12:52] think it was their 20th
[1:12:53] anniversary, if I remember
[1:12:55] right. And then, uh,
[1:12:56] unofficially, I took my family
[1:12:57] to the county fair. That just
[1:12:58] happened over the weekend. It
[1:13:00] was good to see what
[1:13:01] s at the
[1:13:03] fair and and partake of the fun
[1:13:04] activities they have at the
[1:13:07] fair on Friday. Tomorrow I
[1:13:10] be at my, uh, Metro mayor

[1:13:14] meeting tomorrow morning. Um,

[1:13:17] be a member of the media there

[1:14:58] will be looking at potentially
[1:14:59] changing some of the criteria
[1:15:01] for those youth members coming

[1:21:53] silos. Everybody

[1:22:02] lot of silos. But we really
[1:22:03] want to get them to really
[1:22:05] start focusing on the long
