[21:44] in 1961. Just to give you uh some conception of how old the pool was.
[21:51] » She had left in 92, returned in 94 or 82, I'm sorry.
[21:56] » Is the green light on in the mic? >> Yes.
[21:59] » She returned She left in ' 82, returned in 1992, has been living there ever
[22:05] since. uh her parents passed away and the house was uh given to her in 2014.
[22:12] In 2018, she filled in the pool because it was
[22:17] deteriorating. Um they filled it in with top soil and 4
[22:22] in of cement. She did not get a permit because she
[22:26] didn't know she needed one. Um, she also increased the driveway by 75 ft to her
[22:34] backyard so she could put the boat in there. Again, she didn't know that she
[22:39] needed a permit. When she applied for a permit, it was denied saying it was
[22:43] above the imperous surface. Um, we have photographs of what the pool
[22:49] used to look like and what they
[23:06] is what the pool used to look like. P5 is when they filled it in with dirt.
[23:28] » You're talking in the microphone so they can they can capture you.
[23:32] driveway was extended. There was an original driveway there, but grass had
[23:37] grown through the original stone. They put new stone in there and then they
[23:43] extended it because they had a boat and they wanted to put the boat in the
[23:47] backyard.
[23:51] Uh again, they were unaware that they
[23:54] needed to get a permit for that. So, what we're asking is
[24:01] that the um impervious surface be extended to 51.6
[24:09] ft 51.6% which uh we check with the township and
[24:15] that's what it is. The side yard uh was
[24:21] 7 foot and it's now six foot. The backyard is 20 foot set back and with
[24:28] the patio it's six foot short of that. I might say that the pool was closer than
[24:35] that. However, the other
[24:44] [clears throat]
[24:52] » any event they They filled in the pool. It's smaller
[24:57] because the deck area, you know, is now grass
[25:04] and they are planning to sell the house and move in the next year. So, we're
[25:10] just merely asking that this uh variance be granted.
[25:21] Is that all you have? You would look at P7.
[25:29] [clears throat]
[25:44] [snorts]
[25:47] » Okay.
[26:10] Just uh I would ask that you review P8 and
[26:26] What they did
[26:31] the area
[26:37] Mr. Cars will mark these as P910. >> Yes.
[27:12] So The gazebo and the patio already there, right?
[27:17] » Yes. >> And have been for a while.
[27:18] » Well, they put they filled it in and then afterwards they put a gazebo on.
[27:22] But the gazeos can be removed by screws. >> Exactly. Right. Because you're selling
[27:27] in a year, right? So what does that take away? Your setback and your sideyard set
[27:30] back, right? >> Yes.
[27:32] » Okay. Right. Okay. But >> the patio is the setback issue.
[27:37] » Oh, this the patio is the set. Okay. It's not the gazebo. Gazebo has nothing
[27:42] to do with anything. >> The patio would it's the permanent
[27:45] structure. That gazebo is just something they popped up.
[27:47] » Okay. Right. The patio part. All right. >> They filled it in with, you know, top
[27:54] soil. >> The patio is considered the concrete
[27:56] that's that covers the pool. >> Yes. [clears throat]
[28:01] But it's actually less than what the pool with the deck around it was.
[28:06] Um they they didn't realize they needed to get a permit and when they did it was
[28:12] denied. So we're here. They, you know, generally have like
[28:19] Halloween and Christmas decorations and it came to I think the board's attention
[28:24] because they stored them in a container and they removed that. That was the
[28:28] reason that the I believe uh the officer came and noticed that the
[28:33] patio was there >> and the stone driveway has got the boat
[28:37] on it. >> The stone driveway was extended
[28:41] 75 by 14 ft. If the board wants us >> Well, that's where the two storage units
[28:47] were. >> Okay.
[28:47] » They were removed. >> Okay. No, you you got it sworn in.
[28:59] But as I understand it, there was a stone driveway leading up to the middle
[29:05] of the house that grass was growing on it. You rested it.
[29:09] » Right. >> That was there when your dad had bought
[29:11] the property. Correct. And then you and then you had a fence and on the other
[29:16] side of the fence, which is your back and side yard, you increased it by 75 by
[29:21] 14 ft of stone to put a uh the boat that you had out there because you didn't
[29:26] want on the street or in the driveway. It's a small driveway. Is that correct?
[29:31] » And if necessary, you would remove the driveway to decrease the impervious
[29:38] surface if you have to. >> I needed to. Yes.
[29:42] Okay. I love that idea.
[29:49] Uh, anybody from the board? Are you Sorry. Are you done, sir?
[29:52] » Yes, you're on. >> All right. [clears throat] Uh, anybody
[29:55] from the U board like to have have any questions, comments, concerns?
[30:03] » How long ago was the pool? I'm sorry, the uh the patio installed.
[30:07] » 2018. >> And when was the driveway extended?
[30:11] Jamie, here we go. >> Okay.
[30:16] Anybody else? >> I have a question. So, you said you were
[30:18] willing to get rid of the driveway, right? Correct. Turn that back to grass.
[30:21] Did I hear that correctly? >> Part of it. Yeah.
[30:24] » Does anybody know the number that would change the impervious service if that
[30:27] happens? >> Be a lot of math.
[30:30] » Sorry, I just [laughter] >> Go ahead, Bob. You can do it.
[30:38] So, we're at 51.6, Right now with everything
[30:41] » it's50 probably bring the percentage down to
[30:46] around 40 46 45
[30:53] let's give 45 the benefit of it down here. Um all right but that' be the
[30:58] whole whole stone driveway not just half of the stone driveway. That's a whole 75
[31:02] by 14 would be the extension. the extension. All right.
[31:09] » I'd rather see the boat in my backyard. >> Well, they're uh they're moving the boat
[31:14] down to Tennessee. They're they're that'll be gone in the next month or two
[31:18] and then they plan to move down there next year.
[31:21] » Okay. This is going better and better. All
[31:24] right. Um anybody else from the board? >> All right. Anybody from the audience?
[31:33] Okay. So,
[31:37] we can put a condition on this, correct? All right.
[31:41] Um, [clears throat] >> I'd request that you grant it subject to
[31:44] them taking out the extension of the driveway, which was 75 by 14.
[31:50] » That's the condition we're going to make on the condition that they remove the 75
[31:55] by 14 ft stone driveway. All right. >> I'm not understand. Do you agree with
[32:02] that? >> Yes.
[32:02] » Okay. All right. And the sideyard setbacks.
[32:07] Everybody's fine with the sideyard setbacks, right? Was the one six foot
[32:12] and the other one was
[32:17] What was the What was the >> both? Okay. All right.
[32:23] All right. Um, I'm going to make a motion on the
[32:27] condition of the uh 14 by or 75 by 14 stone driveway be removed. I'll make a
[32:34] motion to approve. Do I have a second?
[32:37] » I'll second. >> Call the board, please.
[32:40] » Gerard Lyon, >> yes.
[32:42] » Mark Demarcus, >> yes.
[32:44] » Jim McMahon, >> yes.
[32:45] » Ed Murphy, yes. Good luck. >> There you go.
[32:48] » Thank you. >> Thank you. Have a nice evening.
[33:00] That's a That's a that came in education right there, bro.
[33:08] » Uh, next up, Hilbert Synindor, uh, 1007 Steven Avenue, Cudden, please
[33:14] come on up.
[33:18] boy.
[33:30] » Good evening everyone. My name is Barbara Kirk. I represent Mr. Senator.
[33:34] Um I have with me the affidavit of posting as well as my affidavit of
[33:39] mailing notices in addition to three or four additional um notices that Mr.
[33:44] percentage door secured from residence. >> Miss Kirk, if you don't have pre-marked
[33:48] exhibits, I'll mark these as collectively A1.
[33:52] » I marked P1 through P4. So, if you >> P5,
[33:56] » that's fine. >> Thank you.
[34:03] » So, if the board may recall, we were before you in April, at which time Mr.
[34:07] Senator has a house that was t that he lives in primarily and it's was titled
[34:13] in his mother's name with him who has passed away. He had added an addition to
[34:19] that house which originally was a four post open air gazebo in 2014. Thereafter
[34:27] that was enclosed and Mr. Senator has a group of people that come to his house
[34:32] on Sundays up and until the date of the hearing um
[34:37] and they they participate in religious worship. So he was asking for approval
[34:41] to have an accessory use to the for the that addition area for religious
[34:46] worship. He then had an additional structure constructed in the back,
[34:51] another forosted um gazebo, open air gazebo, which ended
[34:56] up prompting the application in that it was practically to the rear property
[35:01] line. The board based on their comments and questions had two major concerns
[35:07] from what I remember. One, that second structure being built so close to the
[35:13] property nine and the need for it. The second was there at the time could not
[35:18] locate permits to show that the enclosed g first edition area had been inspected
[35:26] and maintained and there was concerns about electrical.
[35:30] Those permits have since been found and Mr. Dumac or engineer will verify as to
[35:36] which permits were received and how they were obtained. In the meantime, Mr.
[35:42] Senator has removed the rear structure which has been verified by the
[35:48] township's code enforcement officer and I would like to present to the board
[35:54] exhibit P1 which is a photograph of the rear of the property without the
[35:58] structure and exhibit P2 which is a confirming email from Miss Heling to me
[36:05] that you went to the property and saw that the structure had been removed as
[36:08] early as June 9th of this here. >> I can confirm that also it has been
[36:13] removed. >> Okay.
[36:14] » And there's copies for everybody. >> Thanks.
[36:21] » With that second structure being removed, the variance request that Mr.
[36:26] Senator originally was asking for has sub has changed substantially.
[36:33] In order to make it easy for the board, I had prepared an updated addendum and
[36:40] I've included a highlighted sections as to what specific variance relief was
[36:47] modified. Basically, the building area as that rear structure is not there.
[36:52] Impervious surface coverage, the rear yard setback which has substantially
[36:57] increased from the 1.41 ft originally requested up to 18.43 43 ft and the um
[37:07] request to add that second pavilion area in the rear has been eliminated.
[37:14] Otherwise, the uh variance requests are mostly the accessory use for religious
[37:19] purposes to have worship there as well as um dimensional variances including
[37:25] off- streetet parking. For the board's ease, I've got a chart for you that I've
[37:30] marked as exhibit P3 to present.
[37:38] » And to help move things along, Mr. Senator, you have just heard my
[37:42] recitation of the facts to the board, correct?
[37:44] » Yes. >> And has everything I said so far been
[37:48] true and correct? >> Yes. And you are still asking to uh
[37:52] allow that congregation of 10 to 12 people come to your house on Sundays for
[37:57] religious uh worship for about an hour. Correct?
[38:01] » Yes. >> And would they still continue to come by
[38:04] way of either walking or being transported in a van that you own?
[38:10] » Yes. >> Okay. And you are in still in agreement
[38:13] that should the board grant the relief requested, you would agree to a
[38:16] limitation as to the number of people that come to your house. Yes.
[38:20] » For that purpose on Sundays. Is that correct?
[38:22] » Yes. >> Okay.
[38:24] » If the board has no questions of Mr. Senator, I'd like to move into speaking
[38:28] to Mr. Dumac in his testimony. >> Anybody have any questions for Mr.
[38:32] » How many people come to worship at your house? Average
[38:36] » your order look like eight people and they're all senior citizens.
[38:41] I'm going to pick it up there to their home and bring in my in my place to
[38:45] Bible study. >> But Mr. Senator did confirm that there
[38:49] may be an an additional one or two persons that come.
[38:53] » So that's why we were saying 10 to 12. >> Um just to be safe because he doesn't
[38:58] want to say strictly eight and then somebody else had popped up.
[39:03] » Okay. >> Anybody else have any questions for Mr.
[39:06] Senator? I >> I have one question. So you you're
[39:08] requesting the house of worship. >> Yes.
[39:11] » Does that have any tax implications? >> Yes.
[39:14] » I have a 51 C3. >> Sorry.
[39:17] » 501c3. >> You have a 501c3.
[39:20] » You would need that permit to to acquire. You would need to acquire that
[39:24] permit to allow that at the residence. Correct.
[39:27] » Yes. >> Okay. Thank you.
[39:33] » All right. Any Okay. Is that it? All right. Good.
[39:37] » Mr. Dumac, please uh introduce yourself to the board.
[39:41] » Hi. Uh Heath Dumac, Dumac Engineering. I've been here numerous times over the
[39:47] past 30 plus years. >> This board [clears throat] had accepted
[39:50] him as an expert at the last hearing. Is that still the case? Still moved. Yes.
[39:53] » Thank you. >> Mr. Dumac, please go through the
[39:56] variance requests that have been um asked of tonight's amended or remanded
[40:01] application. >> Sure. Um the first one that
[40:05] realistically was just discussed was uh section 205-25
[40:10] to permit accessory uh use as a religious worship um where uh by right
[40:19] it's a principal use in this instance we're looking for accessory use uh
[40:23] section 205-26c to permit the building area of 28.76%
[40:31] uh where 25% is allowed with the uh pavilion that was demolished
[40:36] uh it would have been 32.94%. [clears throat]
[40:39] So we have reduced uh next section 205.26D
[40:45] to permit the imperous surface ratio of 42.44%
[40:50] where 35% is allowed. The original request was for 46.69.
[40:55] I'm basically just going through the memo um as Miss Kirk Mrs. Kirk has uh
[41:01] issued um section 205-26E3 to permit the rear yard setback of 18.43
[41:10] ft in lie of the 1.41 ft from the demolished pavilion.
[41:15] uh section 205-131 to permit an accessory building setback
[41:21] of 0.91 ft instead of the required feet uh 5T and that's a shed on the uh
[41:28] northwest corner of the property. Uh lastly, section 205-120A1
[41:35] and 4 to permit less than otherwise required off- streetet parking for
[41:39] residential and place of worship. uh required two off streetet for
[41:43] residential use um one off streetet for every 40 square ft of gross floor area
[41:50] uh which and plus one for each employee estimated at 17 parking spaces.
[41:56] » Now Mr. Dumac based on the removal of that second gazebo which was
[42:01] approximately what [clears throat] 20 by 20 at the time?
[42:03] » Yes ma'am. >> How has that affected
[42:06] » the variance relief being requested today? The majority of the items have
[42:10] all been reduced. Um, some considerably looking at uh 28% versus 33% for
[42:17] building area. Impervious surface going from uh 46.69 to 42. Um, and the rear
[42:24] yard set back from 1.41 ft to now 18.43. >> And you were present at the last hearing
[42:32] in April, correct? >> Yes, ma'am. And after you heard the
[42:35] board's questions with respect to inspections of that section of the
[42:40] addition that had been enclosed, what did you undertake in order to ascertain
[42:45] if permits were received? >> Uh my office reached out to um codes and
[42:51] building permitting. Uh filed a right to know request and roughly April 24th, we
[42:56] received an email from that office with uh a series of permits. Um and I don't
[43:02] know, have you handed it? and I haven't handed them up. It's a big for
[43:06] everybody. I grouped them all together just to make it easier.
[43:10] » Basically, three sets of permits. Uh the first is from 2014 uh allowing an open
[43:15] air pavilion or or uh gazebo. Uh the next which was from 2017 which was to uh
[43:23] enclose the pavilion or gazebo with walls and windows. And then uh lastly
[43:29] the 2018 permits which were for uh mechanical systems uh HVAC equipment.
[43:37] » Now the 2017 permit also allowed for the installation of windows in that pavilion
[43:43] area. >> Yes ma'am.
[43:44] » And in the 2018 uh permit that was provided that dealt
[43:50] with also electrical alterations and not just installation of smoke detectors or
[43:55] HVAC or things of that nature. >> That is correct. Yes.
[43:58] » And based on the information that you have received from the uh township and
[44:03] reviewing these permits, what is your professional opinion as to the
[44:07] inspections and safety of that first edition that was installed?
[44:11] » Uh I believe they're uh it's reasonable and intact. I believe the permits were
[44:17] uh fully in process with just basically final uh CO inspection required.
[44:23] » All the finals were done on every permit >> I believe. So yes. and and we will
[44:27] stipulate that I believe we only need to take care of the sheds.
[44:32] » That is correct, >> which we will do. We wanted to wrap this
[44:36] up. The sheds were installed without permits because Mr. Senator did not
[44:40] realize that you had to put up a get a permit for the sheds, but we will take
[44:44] care of that and that can be a condition of the board's approval if they're so
[44:47] inclined. Is there anything else else Mr. Dumac you would like to submit in
[44:51] support of this application? >> Um, at this time, no. Okay.
[44:57] Uh, anybody have any questions for Mr. Dac
[45:00] from the board? [clears throat]
[45:03] » No. Done. This Kirk? >> Uh, the only thing I would like to point
[45:07] out is the property is located in the R2 residential district. The section 205-25
[45:14] does permit a place of worship as a matter of right. Um, again, Mr. uh
[45:22] senator is simply asking that he be permitted to entertain a group of people
[45:25] to his house on Sundays which for all purposes they'll be doing worshiping. So
[45:30] we wanted to ask for the accessory use variance from the board.
[45:36] » Okay. Thank you. >> Nothing else.
[45:40] » I does anybody else have any questions? >> Um
[45:43] » go ahead. >> I don't know if it's a question. I just
[45:48] want to give my opinion. And I think what you did with the building around it
[45:51] surroundings was wonderful to reduce everything. That's great. I'm just not
[45:54] comfortable with the religious use of worship permanent there because there
[45:59] are tax things that can change in the neighborhood and I'm just afraid that
[46:03] everyone's going to want to be a religious worship place of worship
[46:07] because there's a tax implic implication that would allow him to reduce his uh
[46:11] real estate tax. >> And if I may,
[46:13] » sure. This was not this was filed not as a result of tax implications, but
[46:19] technically it was filed as a result of a notice of violation because there had
[46:22] been a complaint lodged that seeing people coming to his house on a regular
[46:25] basis, it appeared that he was operating a rental unit without a permit. And
[46:31] because of that, we felt it best to come to the board and ask for permission.
[46:35] He's having a group of people over to his house every Sunday. It's not any
[46:39] different than having a group of people come to your house and sit down for a
[46:42] dinner. I understand. >> I agree with you 100%. I'm not arguing
[46:45] that at all. >> Okay.
[46:46] » That's not my concern. >> And if this board's inclined to say that
[46:49] it's for the life of this owner or a declaration of restriction on the deed
[46:55] has to be imposed that it cannot be extended past Mr. Senator's ownership,
[47:00] then we'll accept the um condition imposed by the board.
[47:06] » Okay. >> Thank you.
[47:07] » Thank you. I also noticed that the street is a tight street. Parking
[47:12] [clears throat] look a little tight out in front of his house. Um, and on
[47:16] Sunday, everybody's home. Most people are home and that's just more traffic
[47:20] even though he vans them in, but other people come. Obviously, neighbors seeing
[47:24] it. A lot of traffic going in and out. That's a little tough on a residential
[47:28] area. >> I think it was mostly walking traffic.
[47:30] And he did indicate at the prior testimony, which I would ask to be
[47:34] incorporated into this record, that the van can park on a driveway at the
[47:38] property. So, it doesn't even have to park on the street. His van will park in
[47:42] the driveway. Like he said, most of them are senior citizens. Most of them don't
[47:46] even drive. A lot of them rely on him going to pick him up and bring him to
[47:51] his house or if they are there walking. >> I mean, I'm all for the worshipping, but
[47:56] in the residential areas, you [clears throat] know, we start setting
[48:00] the standard might be a problem. >> Well, that's why I wanted to point out
[48:03] that the code does permit a place of worship in the R2 district.
[48:09] » Okay. Thank you. >> Okay.
[48:14] Anybody else have any questions? Anybody from the audience like to come up? Okay.
[48:18] Um, [clears throat] please come on up.
[48:27] » Let me move my slip out of your way. Please get sworn in.
[48:39] » I do. >> Stephen M. Lzinski. L Z C Z Y N S K I.
[48:52] » Yes. [clears throat] The last meeting we were
[48:56] at, they were talking that there was no electricity to the garage. There is
[49:00] electricity to the garage and there's a lot of the neighbors
[49:04] next to me have a deck higher and they see a lot of activity all hours of the
[49:08] night. So, this is not more than just
[49:12] Sundays, >> right?
[49:14] » Okay. Secondly,
[49:18] are these permits what they threw in front of you valid? Did you they go
[49:22] through us? you. >> Mhm.
[49:24] » Okay. Because last time there was no record of any of it and they all
[49:27] disappeared. >> So Okay. So they're valid.
[49:29] » They're valid. Yes. Okay. With final inspections, CEO,
[49:33] » it's fine. >> Yes. So
[49:34] » that just as long as it's safe and you guys all are on board with it. Um the
[49:39] traffic, it's a single family dwelling. They're all single family dwellings and
[49:45] this is going multiple people, people coming and going. And that's about all I
[49:51] have to say. is as long as the permits are valid. [clears throat] It's up to
[49:53] you. >> It's nothing to do with the
[49:55] » Excuse me. >> Are they walking or driving?
[49:58] » The people coming >> both. Best I can tell. I'm not watching
[50:02] it. I'm being told by other neighbors there. I'm talking about in the yard.
[50:05] They're going into the garage. It's supposed to be dark with no electricity.
[50:09] That has electricity. >> Well, they stated that the sheds will be
[50:12] taken care of permanent wise. Well, there's there's a garage with you have a
[50:17] house an 800 foot house with an addition on the back. You have a 800 foot house
[50:22] with the addition attached with a pavilion. The pavilion went to a house.
[50:27] You have a garage that has an addition attached onto it plus your shed. There's
[50:31] a lot going on there. There's not enough property. It's a big yard and it might
[50:35] handle it because it's on the outside pie. But they did take down the other
[50:40] pro the other piece which was the big complaint, the religious thing.
[50:44] » The other neighbors on the other street should be here talking to you about
[50:47] that. That's on them, >> right?
[50:49] » They're not noisy. They're not disturbing anybody.
[50:52] » Yeah. >> But uh that's all I got.
[50:55] » Okay. >> Thank you. All right, man. Come on up.
[51:02] » Hello. >> Hello.
[51:04] » Stephanie Matt Singer. M A T S I N G E R and my husband Brian.
[51:10] » Same last name.
[51:17] » Yes, we do. >> Hi. Uh we have been a member of the
[51:21] township since uh we moved here back in August of 2015.
[51:26] And uh during that time uh we lived across the street at at 106 Stephen
[51:32] Avenue. Um and uh during that time uh we have been witnesses to the uh religious
[51:40] uh worship that has been going on across the street and we have no problem with
[51:44] anyone exercising their religion. That's not the issue. Uh but we do want to
[51:48] refute some pieces of information that were uh given last at the previous
[51:53] hearing as well as this one in terms of uh the amount of traffic as well as how
[51:57] the amount of traffic is delivered. Uh the saying that most of the traffic is
[52:04] walking or strictly from the van is inaccurate. Uh the amount of people
[52:09] coming via van is very small. Maybe three to four people at one time that we
[52:14] see coming in and out of the van. Most of the traffic that we have seen coming
[52:18] to the church or to the the place of worship is via additional vehicles
[52:23] whether it be car SUV and we've seen anywhere between I want to say uh 5 to
[52:30] 10 additional vehicles on the street from let's say midafter afternoon till 8
[52:36] 9 10:00 at night on a Sunday. I have pictures
[52:39] » and um as >> bring them on up.
[52:43] » As [clears throat] you attested to earlier, it's a small street and a lot
[52:46] of cars on that street. It it it creates a bit of a bottleneck going up and down
[52:52] that street on a Sunday afternoon like you said when uh people are are at home.
[53:00] » Yes, >> that's everything I have.
[53:03] » Give her a copy. >> Mr. Chairman, if we can just we'll mark
[53:05] these collectively as uh M1 for Metsinger. If you can provide a copy to
[53:11] Miss Kirk so she can see them. [cough and clears throat]
[53:19] » Parking both sides. >> Unfortunately, because uh the worship uh
[53:24] apparently according to uh what was said earlier has been suspended because of
[53:28] the hearing. >> This is the point.
[53:30] » Okay. >> Okay. Oh, there's also they have they
[53:32] have the 26 up there. I've been giving them throughout the month.
[53:35] » Okay. Okay. Up here. Up here. Up here. >> Okay. The pictures without dates were
[53:40] just this last Sunday. The other ones are the 26th and the other ones are the
[53:43] 9th of July because once we got the hearing notice, suddenly there's not so
[53:46] many cars. >> Yeah. We we didn't know that that it was
[53:49] suspended as a result. But when there is normal service, cars are parked,
[53:55] multiple cars on both sides of the street. So it becomes very congested and
[54:01] uh it becomes difficult travel up and down the street even with you know
[54:05] everything everyone else being home or doing something or having other
[54:09] gatherings on other houses in that block whether it be a party or some other
[54:14] gathering. >> The problem is we're it's a two-lane
[54:16] road, but when you have a car parked on both sides, it becomes a one lane road.
[54:20] Y >> and then like someone's got to back up
[54:22] so someone else can go down the road. Like it's
[54:25] we're not trying to give them a hard time. It's just we're worried about
[54:28] traffic. Other neighbors said they were going to come the same.
[54:31] » This picture, >> that picture is where the van uh that
[54:34] they use for church services. That's where it's currently parked. It's been
[54:37] parked there for the past month and a half.
[54:40] » No, >> no, it's not the driveway. It's in the
[54:42] street at the end of the block. >> And that end of the block, there is a
[54:46] neighbor that has cars parked there that are pretty much haven't been moved for a
[54:50] while. And if they are moved, they're kind of moved here and then moved back.
[54:54] be more offended by those than I would be by.
[54:56] » As long as they're all covered, right? >> Yeah, they're all covered. As long as
[54:59] it's all legal and all that, that's fine.
[55:00] » As long as cars can get down safely, I don't really care.
[55:03] » It's just when you run into issues is like like I said, when there's cars on
[55:07] each every side, no one can get down easily.
[55:10] » Um other neighbors said they were going to come to voice their opinion, but
[55:13] unfortunately, they didn't make it either.
[55:14] » Yeah. But we at least wanted to voice our opinion for Stephen Avenue and the
[55:19] the issues that we see with granting them uh a religious worship exemption
[55:24] based on the amount of traffic that comes in in and out of house on a on a
[55:27] Sunday. >> All right.
[55:31] » Is that it? >> That's it. Thank you.
[55:33] » Thanks. >> Anybody else?
[55:38] » I don't actually live on that street. >> You have to come up.
[55:41] » Come up. You have to come up.
[55:45] Uh, admittedly I don't want to waste Andrew Lovado.
[55:48] » L A V A D O.
[55:56] » Yes. >> Okay. Um, I don't live on the street.
[56:01] I'm here for a different purpose. So long as we're here and the neighbors
[56:05] came to voice their opinion, I just wanted to share mine while I'm here and
[56:08] able to give one. um if they were the neighbors on my street. I live on the
[56:13] Shammy Road, by the way, and I noticed that there were visitors coming and a
[56:19] gentleman go in a bus or in a van and picking up visitors that they can do
[56:24] worship to me as a neighbor, I'd be happy to see them. That would be a good
[56:28] use of the public street and I would be friendly with them. That's all I wanted
[56:31] to share. >> Thank you.
[56:32] » Thank you. >> Okay.
[56:36] » If I may. >> Sure.
[56:37] » I would just like Mr. Dumac to address the issue of the allegation of
[56:42] electricity in the garage if you don't mind. Mr. Dumac, you've been out to the
[56:47] property, correct? >> Yes, ma'am.
[56:49] » Yeah. >> And have you inspected the property?
[56:52] » Yes, ma'am. >> And have you inspected the garage?
[56:55] » Yes, ma'am. >> And what type of electricity is in the
[56:57] garage? >> There is electricity in the garage
[57:00] » as to >> like lights going in and out.
[57:03] » Standard standard uh garage. There is electricity. There is lights. Um,
[57:10] » uh, it's not a cold storage shell, so to speak,
[57:15] » but is it equipped to have hold [clears throat] large groups of people
[57:18] for events? >> No, it's a storage garage. It's a
[57:21] garage. >> Okay.
[57:23] » Thank you. And we understand neighbors concerns of traffic, but again, it's
[57:27] like I said, if he decided to have a dinner with 12 people every Sunday, he'd
[57:32] be well within his rights. We've asked prefer permission to allow him to
[57:36] continue something. And it's a group of people coming and what they're doing is
[57:40] religious worship.
[57:43] » Okay. Anybody else?
[57:50] » Okay. Bob, anything to add? >> Nothing to add, Jim.
[57:53] » Okay. What's the pleasure of the board?
[57:58] » I need a motion, please.
[58:03] I'm going to make a motion against this because I don't think the religious
[58:06] worship uh permit should be given. Everything else seems fine. I have no
[58:12] problem with someone worshiping. That's if you want to invite people to your
[58:14] house, that's great. I just that is my issue.
[58:19] » All right. I need a second.
[58:26] » All right. >> I'll second it. Okay.
[58:33] Okay. Uh, call to board. >> Mark Demarcus.
[58:39] » No. >> Gerard Lon.
[58:42] » Yes. >> Jim McMahon.
[58:46] » No. >> Ed Murphy. Yes.
[58:49] » All right.
[58:53] So,
[58:56] » Miss Kirk, as you know, two two vote status quo uh and then application is
[59:02] and the the request of relief is denied. >> Thank you.
[59:17] » Okay, let's
[59:28] Andrew Sherman,
[59:33] come on up.
[59:40] [clears throat] >> Um, might I ask if you don't mind if
[59:43] before we get started, uh, there are packets that I gave copies of. I have
[59:47] the same documents, but not organized the same way. If by any chance you have
[59:50] an extra copy of them, I could refer to the same pages if if necessary.
[59:54] » The copies were provided to you guys. That's
[59:56] » We have copies. I don't have an extra one.
[59:58] » Okay. Sorry.
[1:00:05] » I do. >> You do you need a copy, Andrew?
[1:00:07] » If if you have one, >> you can use it.
[1:00:08] » I appreciate it. >> You had stated a a different last name.
[1:00:13] » Lovado Sherman is my official last name. >> Perfect. Okay. Thank you.
[1:00:18] » Mr. Lato, do you have uh proof of your uh notice to your neighbors and proof of
[1:00:23] posting of the property? >> May,
[1:00:25] » please.
[1:00:49] Mr. Lovado, you're uh previously sworn you're still under oath. Uh you handed
[1:00:52] me a couple documents. Uh the first set is the neighbor notifications. You had
[1:00:56] your neighbor sign the forms provided to you by the township?
[1:00:59] » Correct. >> All right. And there was four of them,
[1:01:01] » correct? >> Okay. And then you also handed me uh two
[1:01:04] colored photographs showing that the property was posted. And you I think you
[1:01:08] advised the property was posted July 27th.
[1:01:10] » Correct. And that placard has remained up for a period of two weeks.
[1:01:12] » Correct. >> Thank you.
[1:01:16] » Good. >> Okay. Um
[1:01:21] I am here because I purchased this property uh I'm not looking exactly off
[1:01:26] off date. Uh 2020 2021. Uh, and I'm seeing now that I purchased it already
[1:01:33] constructed as a multif family duplex. Uh, zoned as single family residential
[1:01:40] and and I I wasn't aware of any of the legal things of that. I haven't rented
[1:01:43] it out. Uh, friend of the family has been living upstairs with me. So, um,
[1:01:49] I'm very recently divorced now and facing financial hardship and I am
[1:01:54] looking to now rent out the other unit. Um, so
[1:02:00] I I don't have any of uh you know the permits or the building plans or
[1:02:04] anything like that because it was already constructed. I believe uh in
[1:02:08] 2024 the home the address is now uh able to be zoned duplex or multif family and
[1:02:18] I believe it meets the requirements. It has
[1:02:24] and as you can see from the pictures it is completely constructed and uh ready
[1:02:29] for somebody to safely use. Um so there is one requirement of the multif family
[1:02:36] that this property does not meet and that is the four parking spaces two for
[1:02:40] each unit. So I'm requesting a variance for that requirement. If you can go to
[1:02:47] two, three, four, five, six, seven, eight, nine, 10, the 12.
[1:02:59] Sorry, there's a lot of pages.
[1:03:04] After all the images, it looks like somewhere like the 18th.
[1:03:08] Yeah, after the images, the first set of images, there's a police crash report.
[1:03:12] That police crash report is from June 2nd of 2024.
[1:03:18] And there is after the police crash report, there are images demonstrating
[1:03:23] where the incident took place and out of order.
[1:03:30] Sorry about that. Two pages before the police crash report, uh there's actually
[1:03:35] a photo of the car that hit the f that went down. It it I'm sorry. I'm going to
[1:03:40] start from the beginning of that incident.
[1:03:42] on Belmont A. A car went through a stop
[1:03:47] sign in into the property of my next door
[1:03:51] neighbor, ricocheted into the next property, went through the fence, and I
[1:03:56] believe into the house. There is a picture of that. And
[1:04:01] the next door neighbor where that car went down into the driveway has I I
[1:04:06] can't say exactly maybe like a 40 50 foot drop and it goes downhill into the
[1:04:10] property. My neighbor there's a picture of me talking to him right there. He
[1:04:14] said my my wife usually sleeps at the front of that and she could have easily
[1:04:18] gotten hit. Um, my property is only like a 15- ft drop until the property uh
[1:04:25] until the house passes the curb or I should say where where the cement of the
[1:04:29] parking spot is. And I believe that if there were a parking spot there and
[1:04:36] somebody were to go through the stop sign, it would be pretty
[1:04:40] possible that the car would go right into the front of the house. And I
[1:04:44] believe that by constructing and you can see it in uh
[1:04:51] sorry which there there's I I'll I'll let you know which page. Yes. So the fir
[1:04:57] the very page before all of the pictures is demonstrating that if I were to
[1:05:02] construct parking spots right there and where Belmont is, it's the most
[1:05:07] vulnerable for going into the house. So, I believe that if I were to construct
[1:05:11] two parking spots right there, they would be acting as a ramp and then going
[1:05:16] right into the house. And I think it's really dangerous. Uh, and that is my
[1:05:22] reason for asking for a variance for the only requirement out of making it a
[1:05:26] multif family just to not construct two additional parking spaces.
[1:05:46] So, I'm assuming you don't have space for two extra parking spaces. Is that
[1:05:49] what you're telling us? >> No.
[1:05:51] » Um, that is So, there is one space. So, I I own a motorcycle, too. Right now,
[1:05:57] it's the only vehicle. Well, I have a car and a motorcycle. And I usually park
[1:06:01] right where that barrier is. There's a bush and a fence right there and that's
[1:06:05] where I posted the u the sign for this meeting. Uh it acts as a barrier and I
[1:06:12] think that when a car is parked there parallel to the street now it is on the
[1:06:17] sidewalk but it's you know it's safely parked in the house. I think that that
[1:06:21] is an extra measure of security and I think it's great when a car is parked
[1:06:24] there. It makes me feel secure. I usually park an SUV there when I can.
[1:06:28] » Not what I asked you. >> Okay. I'm sorry.
[1:06:30] There any room for additional spots on your property?
[1:06:36] » So >> So you got two now,
[1:06:38] » correct? >> Is there is there enough for three? Is
[1:06:41] there enough for four or just two? >> No. Right. The way that the property is,
[1:06:45] there is no space for to the only possibility that I see unless I were to
[1:06:50] pave a driveway beyond like where there's sewage right above and there's
[1:06:54] already a walkway. It's it's really not possible. And if I did construct that,
[1:06:59] it would only be one more spot.
[1:07:03] » Three is better. Three is better than two,
[1:07:07] » but it would also be back to front and it would cause traffic and I don't think
[1:07:12] that >> it physically could work. There's just
[1:07:16] physically space. It's an extreme downhill and there and I would have to
[1:07:20] get rid of one of the spots to create that.
[1:07:24] » Ain't going to work. >> Okay.
[1:07:27] All right.
[1:07:31] » Anybody from the board? Are you >> I do struggle with the uh street parking
[1:07:34] because of snow removal. >> Mhm.
[1:07:37] » The sweeper that comes down the street. Um big trash trucks come down, cars out
[1:07:41] in the street. It is a problem. I mean, I plow snow a lot on the streets and
[1:07:45] it's a problem. >> I understand.
[1:07:47] » And you're not going to be able to move those cars on the front yard or
[1:07:49] anywhere, right? >> So, that's a problem. And if you have
[1:07:52] two more parking spots and say a friend comes over, another friend comes over,
[1:07:56] » I your place is tight. I mean, where you are is ridiculously tight. You're on top
[1:08:00] of your neighbors. Um there's like no park in there.
[1:08:04] » There's a very active road too, >> right? I Belmont A. Uh I spoke with this
[1:08:10] I, you know, I have this conversation also with my neighbors and especially
[1:08:13] the neighbor right in front of me that has the corner spot on Belmont and
[1:08:18] Namin. Uh I spoke with them. I had a nice conversation. He said, "Please,
[1:08:22] what I don't like is that, you know, they're parking on the grass right in
[1:08:24] front of me." And I said, "Great. We're going to work with that." And he
[1:08:27] suggested that on Belmont there's this the parking is, you know, it's not in
[1:08:32] front of the the main traffic of N. >> Yeah, that's a lot of traffic there.
[1:08:36] » Yeah. Okay.
[1:08:39] » But you really need to control it on your property, not around a corner.
[1:08:43] » Right. Um, I will say too the
[1:08:47] » let's be honest, street parking in this township is a big
[1:08:50] » that's a problem. >> It's a problem, right?
[1:08:52] » All right. So, let's take take that at face value here.
[1:08:57] Um, >> but all right. Is that all you have?
[1:09:00] » Um, I just wanted to say the upstairs unit is a onebedroom. So, I agree it's
[1:09:05] two spots per unit, but most likely it might only be one vehicle.
[1:09:09] » All right. Anybody from the uh board have any
[1:09:12] questions? I have a question for Bob. So, it's single family right now. It's
[1:09:17] not a duplex. >> It was a single family home that was
[1:09:19] illegally converted. >> Illegally converted
[1:09:21] » and he purchased it from that person. >> Correct. [clears throat]
[1:09:24] » Okay. Thank you.
[1:09:30] » Anybody else in the board?
[1:09:34] Anybody from the audience?
[1:09:39] Okay. I need a motion from the board.
[1:09:51] » I'll make a motion that we do not approve. I need a second.
[1:09:56] » I'll second. >> Call to board.
[1:09:58] » John Lyon, >> yes.
[1:10:00] » Mark Demarcus, >> yes.
[1:10:02] » Jim McMahon, >> no.
[1:10:04] » Ed Murphy, yes. >> All right, Mr. Sherman, sorry.
[1:10:08] » Okay. Uh, might I just clarify? Um, does this mean that the potential for it to
[1:10:15] be zoned to multif family is still on the table if I comply with creating the
[1:10:20] two spots? >> As of right now, your A6 residential
[1:10:25] conversion for the duplex is denied. >> Okay. Does that mean I can apply and
[1:10:30] come and do that? >> I I don't think I can give him advice on
[1:10:36] » Okay. >> Yeah. I I mean consult with an attorney,
[1:10:39] » okay, >> is my best advice for you.
[1:10:41] » Okay.
[1:10:47] » All right. >> Thank you,
[1:10:50] » John.
[1:11:18] Why do you come? Because I'm not good at turning. So if you stand behind me, it's
[1:11:21] not. Thank you.
[1:11:32] put me in presentation mode there. Thank you.
[1:11:38] » Perfect. Thank you.
[1:11:41] » Okay. >> Good evening. Chelsea Jackman from
[1:11:43] Begley Carlin Mandio here tonight on behalf of John Tan to my left. Uh Mr.
[1:11:48] Biddlinger just provided you with the uh notice for tonight's hearing. I believe
[1:11:52] it was posted on uh July 24th, 2026. Yes, noses are satisfactory. This matter
[1:11:58] can proceed. >> Thank you very much. Uh so we're here
[1:12:00] tonight uh many of the board members uh might remember that we were here in June
[1:12:06] uh and we're seeking a variance for impervious surface coverage. It was uh
[1:12:11] practically speaking denied at a 2-2 vote. Uh so went back to the drawing
[1:12:16] board. Mr. Tin revised his proposed plan. Uh but some some of the salient
[1:12:20] facts to include that this is 56 Orangewood Lane, excuse me, Drive. uh
[1:12:24] tax parcel number 050042-00001
[1:12:29] in the R3 residential district and it is 0.167 acres. Uh and uh we are seeking a
[1:12:37] variance from section 205-29D to allow impervious service coverage of
[1:12:42] 55.86% where 40 is the maximum uh permitted
[1:12:46] under the ordinance. When Mr. Talin purchased the home uh he purchased it uh
[1:12:50] with existing 52.13%. Uh so at that hearing in June, we pro
[1:12:56] presented evidence uh that after John purchased the property, he added uh 558
[1:13:03] square ft of driveway and PA walkway to his home together with additional tree
[1:13:08] removal and sidewalk replacement. Bob, can I use this to go next or do you have
[1:13:11] to do it?
[1:13:15] » Nope. That help? No, it's not. It's not. Let's
[1:13:19] see if it works. Hold on. Cool. Thank you. Uh so
[1:13:26] generally speaking, the property looks a lot better than it did when Mr. uh Tin
[1:13:31] purchased it. I think that is a a generally accepted fact. Uh
[1:13:36] however, um one of the issues from the last hearing
[1:13:41] was that there were concerns about whether or not he got confirmation. Miss
[1:13:45] Dunn's not here, but I believe that was one of her concerns. Did he get did he
[1:13:48] get the proper uh confirmation from the water authority that his work wouldn't
[1:13:52] interfere with the existing infrastructure and the easement on the
[1:13:56] property? Since June, Mr. Tin uh actually prior to that confirming he did
[1:14:01] in fact get that and ensure that there was no issue with what the with the work
[1:14:05] that he had done. Uh so today, Mr. Tin, so actually we'll start with this.
[1:14:10] Here's what it looked like uh when he purchased the property. Currently, this
[1:14:14] is what it looks like. So you can see here he added this uh walkway here as
[1:14:18] well as back towards here. Um and that was already existing. And what he's
[1:14:22] seeking now is again a proposed he's proposing impervious surface coverage
[1:14:26] higher than what's allowed more than what he purchased but he is seeking to
[1:14:30] remove this area right here in red. Uh so uh additionally when we were
[1:14:37] discussing some of the improvements the last time that John had made on the
[1:14:40] property after he purchased it, it included the fact that he uh uh got a
[1:14:45] fence. There were some questions as to whether or not he got a permit. He did
[1:14:48] uh get a permit for that and he wanted to replace deteriorating sidewalk. He
[1:14:52] did also get a permit for that. So to the extent that you're looking at his
[1:14:56] intent behind all of this, he sought two of the permits he needed to get three.
[1:15:02] denied the last hearing. We understand he came back and said I am still asking
[1:15:06] for uh some a variance on this matter but far less than what I was in June. Uh
[1:15:12] let's see what else I wanted to talk about here. So uh again he's uh we were
[1:15:16] asking for approval to maintain 558 square feet of imperous surface which
[1:15:21] was an extra 7.74% and now we're seeking 3.74%
[1:15:27] based on what Mr. Tan's proposing to remove from his property. Uh so allowing
[1:15:32] this uh variance will serve as the middle ground of him receiving the
[1:15:37] benefit of the improvements that he candidly put in without a permit uh
[1:15:41] while minimizing the impact from a zoning standpoint. Uh it would allow him
[1:15:45] to generally uh maintain the aesthetic improvement uh of the property. Uh and
[1:15:51] just prior to today's hearing, I uh spoke with John just about sort of the
[1:15:55] the if he's had any communication with the neighbors, and he said they think
[1:15:58] the property looks really nice. uh there's no detrimental impact to the
[1:16:02] neighborhood and uh the improvements will allow John, his three children, his
[1:16:07] family to continue using the improvements uh that he uh that he put
[1:16:11] on right after he moved in. So I have John here with me tonight and everything
[1:16:15] pretty much the same as the last time we were here. Again, just reducing what's
[1:16:19] being requested with a little bit more confirmation that he did seek out that
[1:16:22] he did seek and obtain certain permits and get confirmation um from various
[1:16:27] authorities with regards to the easement. So, if that's okay, I'm just
[1:16:30] going to have John uh get sworn and I'll call for him.
[1:16:33] » Do you swear affirm the truth?
[1:16:37] » I do. >> Okay, John, lean right into the
[1:16:40] microphone there. Uh, you heard my statements to the board this evening,
[1:16:43] correct? >> Yes.
[1:16:44] » And are they true and correct to the best of your knowledge?
[1:16:46] » Yes. >> Is there anything that I said that you
[1:16:48] want to clarify or add to or change? >> No.
[1:16:51] » Are you willing to adopt my statements uh as if it was your testimony to the
[1:16:55] board this evening? >> Yes. And are you willing to answer any
[1:16:59] of the questions the board might have? >> Yes.
[1:17:01] » And accept any reasonable conditions uh that would uh go along with any approval
[1:17:05] they might give? >> Yes.
[1:17:07] » That's all we have. Open to questions. >> Anybody have any questions?

[1:17:46] » All right. Sebad SDA Patel.
[1:17:52] » Yes. 34 Rainbow Lane, Levittown, please come on up.
[1:17:57] » I would like to get an approval for the Bard and the gaming store that would
[1:18:01] like to
[1:18:07] » I can you bring up the notices to your uh
[1:18:11] neighbors? >> Yes.
[1:18:14] » Okay. >> More than four.
[1:18:19] » Okay. I'm going to ask you some questions about these.
[1:18:21] » Okay. No, when you take when you can get back to the podium
[1:18:27] » and your name for the record. >> S the Catal.
[1:18:30] » All right. Uh, Miss Catel, uh, you hand me documents. Uh, one set is the
[1:18:34] neighbor notifications uh, that the township gave you. Is that correct?
[1:18:37] » Correct. >> And you had the neighbors sign these
[1:18:39] forms. >> Yes.
[1:18:40] » All right. And then you also handed me a second set of documents uh, showing that
[1:18:44] the property was posted as required. Is that right?
[1:18:46] » Yes. >> Do you know the date that that this was
[1:18:48] posted? Same date that I got it on the July 24th, I believe. Same day.
[1:18:53] » And has it rem remained up for a period of two weeks?
[1:18:55] » Yes. >> Thank you.
[1:18:57] » Okay, you can proceed. >> I would like to open up a bard salon
[1:19:01] over there with like a pimples machines. >> It's a pool tables like a gaming salon.
[1:19:08] » Billiard Hall, right? >> H
[1:19:10] » a billiard hall. >> Yes,
[1:19:17] » that's it. That's it. [laughter] I have two stores there already. One of
[1:19:22] them it's a restaurant and another one is a coffee shop. Two store down. So my
[1:19:26] customers that comes there and they waiting for their foods and it was an
[1:19:30] empty store. I figured, you know, no alcohol, no
[1:19:35] smoke in there. [clears throat]
[1:19:38] » How many pool tables? >> I'm planning to put two pool tables and
[1:19:42] pin pinballs machines. Pinball >> pinball machines there and some um
[1:19:48] change machines. >> Some what?
[1:19:50] » Change machines for the >> change.
[1:19:53] » Yes. >> No gambling machines.
[1:19:56] » No. >> Okay.
[1:19:58] » What would the hours be? >> Well, my restaurant is 10 to 10. It's
[1:20:02] going to be like from 12 to 9. >> From 12
[1:20:05] » to 9:00 p.m.
[1:20:12] » Anybody else?
[1:20:19] Go ahead. >> I'm just just curious about are there
[1:20:22] parking issues with I mean is it >> No parking issues to our knowledge.
[1:20:28] Okay. >> Yeah. Um the township does have a
[1:20:30] standalone ordinance for billiard halls. Um it's pretty stringent process. The
[1:20:34] owner has to pass a background check and there's the whole laundry list of items
[1:20:38] they have to pass to obtain the license. >> So she obtains this variance. She's got
[1:20:42] a long road. >> Correct.
[1:20:45] » Okay, fair enough. >> Certain hours of operation, Monday
[1:20:49] through [clears throat] Fridays, 8 to 12, and then Saturday has its own. Um,
[1:20:53] but yeah, it's a it's a laundry list of items that she would have to go through.
[1:20:56] » Fair enough. >> Okay. [clears throat]
[1:20:59] » Which about which store would it be? Like the old Caesars?
[1:21:02] » I think it was a dry cleaner. >> Oh, dry cleaners. It's in the middle.
[1:21:05] Yeah. >> Right next to the pharmacy. Not I'm the
[1:21:07] dry clean. I took the dry clean as a >> restaurant. That's right. Yeah. So, it's
[1:21:11] in the middle of the shopping center.
[1:21:15] Gerard, >> I'm good.
[1:21:18] » Okay. Anybody from the audience like to come up?

[1:21:50] » Those opposed? Eyes have it. Meetings adjourned.
[1:22:07] » I I have a question. Wasn't there um weren't they going to talk about the
[1:22:11] hotel and
