Um I have with me the affidavit of
posting as well as my affidavit of
[33:39]
mailing notices in addition to three or
four additional um notices that Mr.

percentage door secured from residence.

before you in April, at which time Mr.

Senator has a house that was t that he
lives in primarily and it's was titled
[34:13]
in his mother's name with him who has
passed away. He had added an addition to
[34:19]
that house which originally was a four
post open air gazebo in 2014. Thereafter
[34:27]
that was enclosed and Mr. Senator has a
group of people that come to his house
[34:32]
on Sundays
up and until the date of the hearing um
[34:37]
and they they participate in religious
worship. So he was asking for approval
[34:41]
to have an accessory use to the for the
that addition area for religious
[34:46]
worship. He then had an additional
structure constructed in the back,
[34:51]
another forosted
um gazebo, open air gazebo, which ended
[34:56]
up prompting the application in that it
was practically to the rear property
[35:01]
line. The board based on their comments
and questions had two major concerns
[35:07]
from what I remember. One, that second
structure being built so close to the
[35:13]
property nine and the need for it. The
second was there at the time could not
[35:18]
locate permits to show that the enclosed
g first edition area had been inspected
[35:26]
and maintained and there was concerns
about electrical.
[35:30]
Those permits have since been found and
Mr. Dumac or engineer will verify as to
[35:36]
which permits were received and how they
were obtained. In the meantime, Mr.
[35:42]
Senator has removed the rear structure
which has been verified by the
[35:48]
township's code enforcement officer and
I would like to present to the board
[35:54]
exhibit P1 which is a photograph of the
rear of the property without the
[35:58]
structure and exhibit P2 which is a
confirming email from Miss Heling to me
[36:05]
that you went to the property and saw
that the structure had been removed as
[36:08]
early as June 9th of this here.

» With that second structure being
removed, the variance request that Mr.
[36:26]
Senator originally was asking for has
sub has changed substantially.

In order to make it easy for the board,
I had prepared an updated addendum and

I've included a highlighted sections as
to what specific variance relief was
[36:47]
modified. Basically, the building area
as that rear structure is not there.

Impervious surface coverage, the rear
yard setback which has substantially
[36:57]
increased from the 1.41 ft originally
requested up to 18.43 43 ft and the um
[37:07]
request to add that second pavilion area
in the rear has been eliminated.
[37:14]
Otherwise, the uh variance requests are
mostly the accessory use for religious
[37:19]
purposes to have worship there as well
as um dimensional variances including
[37:25]
off- streetet parking. For the board's
ease, I've got a chart for you that I've
[37:30]
marked as exhibit P3 to present.

to permit the building area of 28.76%
[40:31]
uh where 25% is allowed
with the uh pavilion that was demolished
[40:36]
uh it would have been 32.94%.

So we have reduced
uh next section 205.26D
[40:45]
to permit the imperous surface ratio of
42.44%
[40:50]
where 35% is allowed. The original
request was for 46.69.

I'm basically just going through the
memo um as Miss Kirk Mrs. Kirk has uh
[41:01]
issued um section 205-26E3
to permit the rear yard setback of 18.43
[41:10]
ft in lie of the 1.41 ft from the
demolished pavilion.
[41:15]
uh section 205-131
to permit an accessory building setback
[41:21]
of 0.91 ft instead of the required feet
uh 5T and that's a shed on the uh
[41:28]
northwest corner of the property. Uh
lastly, section 205-120A1
[41:35]
and 4 to permit less than otherwise
required off- streetet parking for
[41:39]
residential and place of worship. uh
required two off streetet for
[41:43]
residential use um one off streetet for
every 40 square ft of gross floor area
[41:50]
uh which and plus one for each employee
estimated at 17 parking spaces.

20 at the time?

>> Yes, ma'am. And after you heard the

board's questions with respect to
inspections of that section of the
[42:40]
addition that had been enclosed, what
did you undertake in order to ascertain
[42:45]
if permits were received?
>> Uh my office reached out to um codes and
[42:51]
building permitting. Uh filed a right to
know request and roughly April 24th, we
[42:56]
received an email from that office with
uh a series of permits. Um and I don't
[43:02]
know, have you handed it? and I haven't
handed them up. It's a big for
[43:06]
everybody. I grouped them all together
just to make it easier.
[43:10]
» Basically, three sets of permits. Uh the
first is from 2014 uh allowing an open
[43:15]
air pavilion or or uh gazebo. Uh the
next which was from 2017 which was to uh
[43:23]
enclose the pavilion or gazebo with
walls and windows. And then uh lastly
[43:29]
the 2018 permits which were for uh
mechanical systems uh HVAC equipment.
[43:37]
» Now the 2017 permit also allowed for the
installation of windows in that pavilion
[43:43]
area.

» And in the 2018
uh permit that was provided that dealt
[43:50]
with also electrical alterations and not
just installation of smoke detectors or

HVAC or things of that nature.

have received from the uh township and

reviewing these permits, what is your
professional opinion as to the
[44:07]
inspections and safety of that first
edition that was installed?

» Uh I believe they're uh it's reasonable
and intact. I believe the permits were
[44:17]
uh fully in process with just basically
final uh CO inspection required.

» All the finals were done on every permit
>> I believe. So yes. and and we will
[44:27]
stipulate that I believe we only need to
take care of the sheds.

>> which we will do. We wanted to wrap this

up. The sheds were installed without
permits because Mr. Senator did not
[44:40]
realize that you had to put up a get a
permit for the sheds, but we will take
[44:44]
care of that and that can be a condition
of the board's approval if they're so

permitted to entertain a group of people

to his house on Sundays which for all
purposes they'll be doing worshiping. So
[45:30]
we wanted to ask for the accessory use
variance from the board.

neighborhood and I'm just afraid that
[46:03]
everyone's going to want to be a
religious worship place of worship
[46:07]
because there's a tax implic implication
that would allow him to reduce his uh
[46:11]
real estate tax.

» sure. This was not this was filed not as
a result of tax implications, but
[46:19]
technically it was filed as a result of
a notice of violation because there had
[46:22]
been a complaint lodged that seeing
people coming to his house on a regular
[46:25]
basis, it appeared that he was operating
a rental unit without a permit. And
[46:31]
because of that, we felt it best to come
to the board and ask for permission.

He's having a group of people over to
his house every Sunday. It's not any
[46:39]
different than having a group of people
come to your house and sit down for a
[46:42]
dinner. I understand.
>> I agree with you 100%. I'm not arguing

that at all.

it's for the life of this owner or a
declaration of restriction on the deed

That's a little tough on a residential

area.

And he did indicate at the prior
testimony, which I would ask to be

incorporated into this record, that the
van can park on a driveway at the
[47:38]
property. So, it doesn't even have to
park on the street. His van will park in
[47:42]
the driveway. Like he said, most of them
are senior citizens. Most of them don't
[47:46]
even drive. A lot of them rely on him
going to pick him up and bring him to
[47:51]
his house or if they are there walking.
>> I mean, I'm all for the worshipping, but

in the residential areas, you
[clears throat] know, we start setting
[48:00]
the standard might be a problem.

that the code does permit a place of
worship in the R2 district.

refute some pieces of information that

hearing as well as this one in terms of
uh the amount of traffic as well as how
[51:57]
the amount of traffic is delivered. Uh
the saying that most of the traffic is
[52:04]
walking or strictly from the van is
inaccurate. Uh the amount of people
[52:09]
coming via van is very small. Maybe
three to four people at one time that we
[52:14]
see coming in and out of the van. Most
of the traffic that we have seen coming

worship is via additional vehicles

from let's say midafter afternoon till 8

I'm very recently divorced now and
facing financial hardship and I am

looking to now rent out the other unit.
Um, so

I I don't have any of uh you know the
permits or the building plans or

anything like that because it was
already constructed. I believe uh in
[1:02:08]
2024 the home the address is now uh able
to be zoned duplex or multif family and
[1:02:18]
I believe it meets the requirements. It
has

and as you can see from the pictures it
is completely constructed and uh ready
[1:02:29]
for somebody to safely use. Um so there
is one requirement of the multif family
[1:02:36]
that this property does not meet and
that is the four parking spaces two for
[1:02:40]
each unit. So I'm requesting a variance
for that requirement. If you can go to

foot drop and it goes downhill into the

of me talking to him right there. He

said my my wife usually sleeps at the
front of that and she could have easily

gotten hit. Um, my property is only like
a 15- ft drop until the property uh
[1:04:25]
until the house passes the curb or I
should say where where the cement of the
[1:04:29]
parking spot is. And I believe that if
there were a parking spot there and
[1:04:36]
somebody were to go through the stop
sign, it would be pretty
[1:04:40]
possible that the car would go right
into the front of the house. And I
[1:04:44]
believe that by constructing and you can
see it in uh
[1:04:51]
sorry which there there's I I'll I'll
let you know which page. Yes. So the fir

the very page before all of the pictures
is demonstrating that if I were to
[1:05:02]
construct parking spots right there and
where Belmont is, it's the most
[1:05:07]
vulnerable for going into the house. So,
I believe that if I were to construct

two parking spots right there, they
would be acting as a ramp and then going
[1:05:16]
right into the house. And I think it's
really dangerous. Uh, and that is my

reason for asking for a variance for the
only requirement out of making it a

multif family just to not construct two
additional parking spaces.

tonight uh many of the board members uh
might remember that we were here in June
[1:12:06]
uh and we're seeking a variance for
impervious surface coverage. It was uh
[1:12:11]
practically speaking denied at a 2-2
vote. Uh so went back to the drawing
[1:12:16]
board. Mr. Tin revised his proposed
plan. Uh but some some of the salient
[1:12:20]
facts to include that this is 56
Orangewood Lane, excuse me, Drive. uh
[1:12:24]
tax parcel number 050042-00001
[1:12:29]
in the R3 residential district and it is
0.167 acres. Uh and uh we are seeking a
[1:12:37]
variance from section 205-29D
to allow impervious service coverage of
[1:12:42]
55.86%
where 40 is the maximum uh permitted
[1:12:46]
under the ordinance. When Mr. Talin
purchased the home uh he purchased it uh
[1:12:50]
with existing 52.13%.
Uh so at that hearing in June, we pro
[1:12:56]
presented evidence uh that after John
purchased the property, he added uh 558
[1:13:03]
square ft of driveway and PA walkway to
his home together with additional tree
[1:13:08]
removal and sidewalk replacement. Bob,
can I use this to go next or do you have
[1:13:11]
to do it?

generally speaking, the property looks a
lot better than it did when Mr. uh Tin
[1:13:31]
purchased it. I think that is a a
generally accepted fact. Uh
[1:13:36]
however, um
one of the issues from the last hearing
[1:13:41]
was that there were concerns about
whether or not he got confirmation. Miss
[1:13:45]
Dunn's not here, but I believe that was
one of her concerns. Did he get did he
[1:13:48]
get the proper uh confirmation from the
water authority that his work wouldn't
[1:13:52]
interfere with the existing
infrastructure and the easement on the
[1:13:56]
property? Since June, Mr. Tin uh
actually prior to that confirming he did
[1:14:01]
in fact get that and ensure that there
was no issue with what the with the work
[1:14:05]
that he had done. Uh so today, Mr. Tin,
so actually we'll start with this.
[1:14:10]
Here's what it looked like uh when he
purchased the property. Currently, this
[1:14:14]
is what it looks like. So you can see
here he added this uh walkway here as
[1:14:18]
well as back towards here. Um and that
was already existing. And what he's
[1:14:22]
seeking now is again a proposed he's
proposing impervious surface coverage
[1:14:26]
higher than what's allowed more than
what he purchased but he is seeking to
[1:14:30]
remove this area right here in red.
Uh so uh additionally when we were
[1:14:37]
discussing some of the improvements the
last time that John had made on the
[1:14:40]
property after he purchased it, it
included the fact that he uh uh got a
[1:14:45]
fence. There were some questions as to
whether or not he got a permit. He did
[1:14:48]
uh get a permit for that and he wanted
to replace deteriorating sidewalk. He
[1:14:52]
did also get a permit for that. So to
the extent that you're looking at his
[1:14:56]
intent behind all of this, he sought two
of the permits he needed to get three.
[1:15:02]
denied the last hearing. We understand
he came back and said I am still asking
[1:15:06]
for uh some a variance on this matter
but far less than what I was in June. Uh
[1:15:12]
let's see what else I wanted to talk
about here. So uh again he's uh we were
[1:15:16]
asking for approval to maintain 558
square feet of imperous surface which
[1:15:21]
was an extra 7.74%
and now we're seeking 3.74%
[1:15:27]
based on what Mr. Tan's proposing to
remove from his property. Uh so allowing
[1:15:32]
this uh variance will serve as the
middle ground of him receiving the
[1:15:37]
benefit of the improvements that he
candidly put in without a permit uh
[1:15:41]
while minimizing the impact from a
zoning standpoint. Uh it would allow him
[1:15:45]
to generally uh maintain the aesthetic
improvement uh of the property. Uh and
[1:15:51]
just prior to today's hearing, I uh
spoke with John just about sort of the
[1:15:55]
the if he's had any communication with
the neighbors, and he said they think
[1:15:58]
the property looks really nice. uh
there's no detrimental impact to the
[1:16:02]
neighborhood and uh the improvements
will allow John, his three children, his
[1:16:07]
family to continue using the
improvements uh that he uh that he put
[1:16:11]
on right after he moved in. So I have
John here with me tonight and everything
[1:16:15]
pretty much the same as the last time we
were here. Again, just reducing what's
[1:16:19]
being requested with a little bit more
confirmation that he did seek out that
[1:16:22]
he did seek and obtain certain permits
and get confirmation um from various
[1:16:27]
authorities with regards to the
easement. So, if that's okay, I'm just
[1:16:30]
going to have John uh get sworn and I'll
