it is, you see from down here instead of having big huge offices, which we don't need
[18:35]
to have standard offices. We reduce the office building from 100 and some million to
[18:42]
70 Million. This is this in the people from Cisco which are here. These were not exact
[18:46]
numbers. But guesstimate numbers and basically comes down to 274 million, 600,000
[18:54]
so basically, we added we saved if you look at the the white sheet just summarizing.

We saved basically 300, nearly 350 million, not 200 Million. We would save 300 and
[19:10]
50 million dollars. I'm happy to have Monica go through show you how we know. We just

instead of taking the original numbers which are bigger offices and everything now we

have a point of saving 350 Million. And I just think that's important of taxpayer
[19:29]
money. that we can say and it's huge amount of money. know, go love for affordable

look, brand new carpeting in offices. Also, you could move in. The plug is working. Air

conditioning is working electric twerking. If you had, obviously we have to things to
[24:35]
the building that's ready to move in right now, according to them, everything works
[24:41]
except there's you have to go. Comcast. Xfinity to get Internet. The only thing
[24:45]
that's not there is the Internet. Everything else works perfectly again. If you
[24:53]
know what or how many people Monica in in in one in How many people in your risk
[24:58]
management have workstations versus offices. >> Of the top? My head. So

don't know. But if I had to guess we have roughly 40 some 40 some folks and risk

management probably less than 5 have offices in the rest of them have.

all 10 by 12 offices and got rid of everything and they said we can bring the price
[25:45]
down all this. These numbers here have to do with bringing the price down from from what
[25:52]
the original was down to 2.75. The cause. So that's where I get. We're saving nearly
[26:02]
350 million dollars. 350 million versus the current, the current project.

That's before from administration 3 quarters of a billion dollars. So I mean, I
[26:15]
going to make public know I would never agreed to spend 3 quarters of a billion dollars
[26:20]
on a building. You guys can. I'm not going to and we could save the public 350 Million.
[26:26]
I'm not gonna say it again. So I wanted to to do that note, we item 2 and according to
[26:34]
council, it would be best that we do not take a vote today because we need all the
[26:41]
members here. If it's going to vote. Yes, we would need all the people here in person that

would have to do that. But based on talking to counsel, I would have to reschedule defer

>> Yeah, I thank you so much for having me here. I am representing the city of Dania
[28:14]
Beach as the mayor. This is very sensitive item for us. I don't have to let you all know
[28:20]
what's going on with property taxes in Tallahassee. we need every single dollar that we
[28:27]
can save in the city of Dania Beach. This proposed Spirit Airlines campus would
[28:35]
represent a significant and long-term revenue, economic revenue loss for the city of
[28:41]
Dania Beach. I sat down with my CFO and city manager yesterday and it would be the
[28:45]
1.2 million dollars in perpetuity. And I can understand if you're going to
[28:50]
have a cost savings. But if we get cost savings of one time as opposed to being able to
[28:55]
read generate revenue perpetuity for the city of Dania Beach. I also wanted to
[29:01]
say that the Spirit Airlines facility, it's not just the standard building office. This
[29:07]
is a specialized space that was specifically designed to serve airline headquarters and
[29:14]
aviation training center. We have specialized infrastructure and flight
[29:21]
simulators that I have personally one. The corporate layout is uniquely suited for
[29:28]
aviation industry. And so we would like to explore those options. I know that our city
[29:33]
manager has been in contact with the the greater Fort lighten rated Fort Lauderdale
[29:41]
Alliance, along with Kim Cohen, other people. And there are interested parties who are
[29:46]
interested in its turn. Key aviation facilities. So >> I'm asking for you all to
[29:51]
look at the large picture of looking at the revenue that we would be able to generate in
[29:57]
perpetuity. And look at that long-term goal of bringing economic development jobs to
[30:01]
the city of being a beat. >> This is the only facility that is like this in all of
[30:07]
Broward County. So we would not be able to just, you know, it's not just regular office
[30:12]
space. We are asking you to. >> Not vote in favor of this and that I respectfully oppose
[30:19]
acquisition of the Spirit Airlines property because it would eliminate and be a
[30:25]
reoccurring local development revenue with many units Halley's are already asking to
[30:33]
having facing unprecedented fiscal uncertainty. So we need your support to support the
[30:39]
city of Dania Beach and bring huge economic development with another company that would
[30:45]
work. >> generate revenue opportunity for our city and
[30:47]
county. >> Thank you. Thank you, Mayor.

I think it's very right. Mister Mayor. So I have a question for Mister chair,

which why come to be sure Mr. Swinney bell at the last meeting. I raise concern based
[31:41]
upon prior conversation that you and I had that. >> The

looking at this building because I'd said then. I think you said this many times. My

top priorities bring high paid jobs to Broward. And if we could make this a corporate
[32:09]
headquarters, either National International regional for a major company that would bring
[32:13]
lots of high-paid jobs here. That was something that would be a factor. Maybe not the
[32:18]
only factor, but certainly a factor in my consideration. It is my understanding that you
[32:26]
now have an opinion on that. Is that correct? And if so, what is that opinion? Yes,
[32:31]
senator, thank you. >> The mayor, you approach is like a CEO of a corporation is
[32:37]
considering relocation, right? You look at the space. But your drivers are exactly what
[32:41]
makes appealing to business as well to have 180,000 square foot, 10 trip to Turkey
[32:48]
facility. We don't have that inventory available anywhere in Broward County right now.
[32:51]
And that's what's made it so attractive. We've got to. Really strong candidates that
[32:58]
we work for the past. They're actually they're competing with the with the bankruptcy
[33:01]
court. There are already engaged with the bankruptcy court for this building. I've
[33:03]
got a 3rd that's also pursuing it. don't know the company as well. We've got 6 share this
[33:10]
with the county administrator, 6 other companies. We have a tech company that wants to put
[33:13]
their headquarters there. Why write? Because, you know, this was really design is an
[33:19]
aviation facility like we want to be embedded in a mixed use of like new point. Weve got
[33:26]
retail. There's housing. There's there's hotel space. There's temporary housing, all
[33:30]
those things that make it attractive. You guys you're competing with business
[33:33]
because it's such an attractive location. we are team could probably measure
[33:39]
this. But I think I mentioned is the county administrator. If you think about new
[33:42]
employees coming to Broward and then payroll being spent and Broward counties,
[33:47]
additional taxes generated by that. You know, customers of the stores, the restaurants,
[33:52]
the retail. That's that point. And if they're bringing travelers in, we have I told
[33:59]
you the name of the company and Mary, you, have you have a strong suspicion, probably
[34:02]
it's a global brand. You recognize them immediately. So if if they're going to feel
[34:07]
that building with employees that are new to that part of Broward County, I'm not sure
[34:10]
there's some dark, any residents that they work for this company already. But you
[34:15]
get you're looking at the turn of with their spending in payroll was being spent. That
[34:18]
impacts our GDP as a county. It's a very attractive building. But the answer
[34:23]
yours, your question, senator, and we talked about this the other day to these projects.
[34:27]
We have worked previously and did not have an appropriate facility for one is aviation
[34:33]
related. We came really close. But to be honest with you, the finances and what you're
[34:37]
looking at, a new way to go to build a new governmental center. You guys can the best
[34:41]
rates possible Triple-A been rated county. But, you know, other companies don't have
[34:46]
that benefit. And when you look at cost of building the financing, it's it's it's
[34:51]
topical police projects their tracks because they want to corporate housing that one of
[34:54]
the things that you've got that this facility. >> when do based on everything
[35:00]
you said you have a recommendation for us. >> My recommendation would be
[35:05]
and it essentially had public relations firm reached out to me the tax man and how they
[35:08]
got my number. But they were talking about. The image of the county competing with
[35:15]
business for a facility like this. And they recommended to me that they could fix that
[35:17]
for me. And like. We have a I know this county commission, they're going to evaluate all
[35:23]
the factors and they're going to make the best decision but only for our county. But from
[35:25]
pennies in the area. My recommendation is I don't think it's a good look for us
[35:29]
to compete with businesses are going after the same building. I don't know that we could win
[35:33]
as a county they can be a little more nimble, maybe with a bankruptcy court. But this
[35:39]
is the most valuable asset that spearheads. And so it's going to be highly sought
[35:44]
after and they will get the highest dollar they can get for this building and they
[35:47]
hope And do you recommend I believe that in conversations, County administrator that you
[35:52]
had. >> Said something like that, you would recommend that we
[35:57]
not pursue this because you believe that. There will be a private, large private
[36:05]
companies. Maybe you don't know which one that would come in and benefit the Brevard
[36:12]
County Economy. Yeah, I know there's 3 there will be directly competing with you
[36:14]
for the space. but again, I go back to >> the additional economic
[36:19]
impact of those new employees spending money in Dania Pointe supporting those retailers and
[36:23]
restaurants. And I know that the county employees would do the same, but we've already
[36:27]
got those folks spending money in our county. We're looking to bring additional people in
[36:29]
and that's why I think it would be. It would be a bad decision to to take this off
[36:38]
of the inventory for commercial I trust me. I get that. There's no inventory out
[36:41]
there. I understand the frustration with that. I deal with it on a regular basis.

>> Any other things, Mister Mayor and I'm I have 2 questions for you, sir. As you
[36:52]
can in changed since the first time spoke to Senator Gathers cent. On this. Senator Geller
[36:58]
said this at our last meeting. So I'm wondering why you brought them up to say the
[37:01]
same thing live in. And they're usually because instead of my saying what he
[37:07]
said, I wanted him to say what he said. Okay. it's just an opinion like So let me ask you
[37:13]
question. And this is you're making a recommendation to us as elected officials as
[37:16]
economic development organization, right? Do you think which weighs more saving
[37:20]
the public? 350 million dollars or getting high paying jobs in that building? We
[37:26]
would cause you're talking a tax base attribute excuse me. You brought up tax base. So
[37:31]
tell me based on your recommendation, what kind of tax revenue would we get from
[37:38]
that versus the savings of 350 million dollars because I assume you're saying that will
[37:44]
benefit more over through more than 350 Million. Because you done that analysis.
[37:51]
>> I've not done that analysis. That's one of the things I mentioned that we
[37:53]
could do the analysis on what would be the impact of new to Broward employee? You I'm just
[37:58]
a guy that you made. You made a recommendation based on you talked about tax.
[38:04]
>> But tax. And so you're getting in front of us. Make your recommendation without
[38:06]
doing any analysis and how much tax revenue we would generate from putting a
[38:12]
corporate entity in their first is saving the public. 350 Million. Is that correct?

Okay. So just a couple things. And I've spoken to some of the companies to that are that are
[38:31]
talking and that want to look at this building. And assuming that there would be some
[38:35]
interest in this building. And I. >> If we're interested in it,
[38:39]
other people are interested and it's a valuable piece of property and that's why people
[38:41]
are looking at it. I'm not as sure as the length and depth of the corporal reloads that
[38:50]
will go there. But that's wonderful thing about this process is that if you become
[38:55]
a better on this I'm not saying you definitely get it. But you're in the game to do
[38:58]
it. And if we we helped Dania, if we if we raise the value of this piece of property, that's
[39:04]
a OK, I'm not here to give corporate welfare to a corporation that wants to come
[39:12]
by this property by saying we're not here. Trust me. And I've heard from this day as
[39:15]
before that, we're not gonna get it. We're not going to enough. We're not going to be
[39:19]
there. Our number should be out there to be a number that we feel comfortable with
[39:24]
before before you came today. And I appreciate everything you did. I'm glad you were
[39:26]
there. We were still a 200 million dollars savings. With this coverage is original
[39:31]
numbers, which when they were tasked by staff, they said put that building in the Dania
[39:38]
Pointe building and give us the same exact thing. And it was still a 200 million
[39:42]
dollars savings. I know it can be much more, you know, could be much more. But even
[39:45]
200 million dollars, a lot of money to save. >> Dania Pointe makes a very
[39:52]
in my opinion, impressive argument. I agree with their argument. But when you save,
[39:56]
if you can save taxpayers 250 million on one side. There's a way that we can make
[40:02]
Dania Pointe Hall, you know, with any kind of tax revenue that they're looking at. Plus,
[40:08]
I don't think there's been a study on how valuable that land becomes. If there's now X
[40:13]
and another 1000 employees that are there full time. I think that we should stay in
[40:17]
the game here. I think if there's corporations that want to bid for this property, they
[40:22]
should bid for this property. They may be to us in which case we take our ball and we
[40:27]
go home. We may not be the stalking horse on this, but I'll say again, do not think
[40:35]
there's going to be 5 votes for 3 quarters of a billion dollars that the Gore private
[40:38]
property. I've said that before. And the other thing I would say it's a lot of people
[40:43]
think this is very fast. This is something that's happening fast. Well, that's because 2
[40:46]
months ago, the issue didn't didn't. You know, we've we've dealt with this core property
[40:52]
for what, 10 years dealing with joint government meetings. It was going to be a
[40:59]
joint center. It was going not be a joint government center. You are going to go here. We
[41:01]
were going to look there. It's been a multi-year, you know, 5, 6, 7, 10 year process. This
[41:07]
is something that just came up. I think by anybody's imagination by anybody's
[41:13]
facts, we save 200 million dollars right off the back. I think it's going to be much,
[41:18]
much more than that. And this is in a rehab of a building. This this half of this
[41:23]
building is really have most of the space is ready to go. We have a risk management
[41:26]
department. They had a risk management department. It's basically the same thing. We
[41:33]
have a human relations. They had human relations department and I know people say, well,
[41:39]
there's HIPPA things. There's this that the other thing when you tour the spirit building
[41:42]
on the first floor where they have their HR in the back, they had to hit the area, too,

just mention the the taxes that are paid by spirit right now. This is this year's

proposed tax taxes, 700 and 50. Yes, 715 million, 688. And then the total ad valorem

taxes and so forth that they pay or 2.8 million dollars. So we just so we know what. But

the last possibly could be for Virginia Beach. I I said this at at the meeting and I'm just
[43:14]
going to repeat it. I think we need to put the brakes like the idea that we're sitting
[43:20]
here. Some people are sitting here and saying it's well, now we're not going to spend
[43:24]
600 Million. We're going to spend 300 million or 259. We should be putting the brakes
[43:28]
on everything right now. We are looking at a dangerous Advil tax issue on the agenda
[43:35]
that could kill this county. And you talk about affordable housing. This has nothing to
[43:42]
do with affordable housing are hold everything we would be doing would be cut all across
[43:45]
the board. I feel at this point that this is this is a horrible message to send to
[43:53]
people. To go out there and do this. When we own a piece of property already at 65 million
[44:01]
dollars, the Gore billion building. I mean, how much do we want to have here? And
[44:06]
something would have to be go if we got it. And this this piece of paper, I'm sorry,
[44:13]
having in the building, a carpeted drive, kinds of construction business. family.
[44:21]
I have this is estimated cost. Nobody knows. Nobody knows what the cost would be to
[44:25]
renovate this building. Absolutely not. So I just feel like we're looking at
[44:30]
something that's so. Going to be so difficult for so many people in this county.

Everything we care about in services. Can be can be done. Reduced dramatically. So for
[44:44]
me, I am not going to support doing this. And even if we're saving, we're not saving.

We're not saving 250 million dollars. We're spending 250 million dollars and I'm
[44:55]
not willing to do that. And by the way, we compare down the Gore building plans to we can
[45:05]
plant, we can we can make the same kind of facility that we're talking about here. We
[45:09]
don't have to have the big offices. We don't have to have a lot of the things that are
[45:13]
in that building. We do need is a childcare center in that building. But we don't need of
[45:18]
this other stuff that we have there. And we could. We could we could save several
[45:21]
100 million dollars in that building. Well said the since the I agree with you. I agree
[45:29]
with the mayor. Also, thank you. Do not want to. We rushed into a decision. I think we've

when they would want that. 95, the Grand Prix was relocated. There before the Grand Prix.

Those addition of what they thought would work at that property. And before that
[46:32]
powers will was there when I was kid. So it was a small. Temple of Disney World. role?
[46:39]
But that was part of So wouldn't go to calls that he built. So, Dana, his struggle.
[46:50]
development based my of debt. So we look at this. 100 million dollar investment.

And I read this and going to bring in. The 800 million dollar. Thank you. Point

development has transformed. Thank you. Beach into a regional Travon, massive tax
[47:09]
revenues, job growth, corporate investment. Why didn't who? Could mix Mixed

use project has fundamentally reshape the local economy. Through 4 main pillars. The

revenue generation. The job creation, the corporate location. The mixed use
[47:31]
expansion. And if we take that opportunity way, we always. We always turn to window. We're
[47:43]
trying to validate company coming here, Maria, they wait the pants, a situation of who
[47:50]
they bring the town to entertain. We go to Bob Sunday. But today. We
[47:56]
dismissed in effect. And I've had numerous conversations Bill because I want to know if
[47:59]
there was any other interest in this property and there's nothing else. The developments
[48:08]
downtown today. I was very much a part of it. We are running out of space. There
[48:13]
are no opportunities for big companies to come here because you don't have a mask. The
[48:16]
Lamb Mayor Mike does well and industrial peace because they have all that land at
[48:25]
company's at the Cubs. Se. All of the tract. Is craze going out there, bringing companies
[48:30]
to town? We don't have that here. We have an opportunity with the of investment may
[48:35]
have a 65 billion dollars across the street. I want keep going in that direction. But I
[48:42]
want to pump the brakes. I want to take the vote up or down. What we do because we
[48:50]
can keep keep changing scenarios. Day day out. I don't do. Overnight projects
[48:58]
is I work in industry and I do a lot of time before I go out and say I can build something
[49:05]
4 x amount of dollars because typically what happens in in the real world. I got eat that
[49:11]
cost. But what as a government agency? The 450 the 200 meter 300 not turn into twice the
[49:21]
amount of money. Once we get any real last. It is not the space that we can utilize day
[49:26]
one like has been said So I'd like to see is pump the brakes. I think this is a
[49:33]
great opportunity for our economy to keep growing in Dania. Dania has done well.
[49:38]
And that was I think it's gonna one of the first projects that may. Less. For
[49:42]
in perpetuity. Because of what they put there. What they put their to sustain that space.
[49:50]
If you go step further. We can't do that. This footprint, we can decide we're going to
[49:57]
stop. And then it could bring major corporation. had a brow bullet and that footprint that
[50:01]
footprint works for We purchased the property with intent to do that. Dania Beach
[50:04]
point. Should be exactly what it was built to be when it opened 2 years ago. It's a
[50:11]
great building. It has a space we're only talking about you last half of the space of
[50:16]
these of this parcel and we'll talk a piece in between that we could have a future of
[50:24]
future building. Our future building is where we've already invested our time and
[50:28]
talents. And we can put brakes on all of these projects if need be. But Daniel Point, my
[50:33]
commissioners today, his vote this up or down. The only thing I think that will be
[50:38]
question of the city attorney the county attorney There are 2 members missing here today.
[50:48]
How does that play out with a vote today? And I'm not trying to kill. We do want to make
[50:52]
sure that what we're doing can be justified. The votes. Yeah, it's these or

notice. We're dealing with bankruptcy court deadlines were also technically we have

around for a while. I'm always very conservative in terms of whether remote should count,

it would be my strong preference not to do vote. I'm risk-averse. I was like that

better. So it's better to do it. It in person. But if we had 5 affirmative votes,

including remote boats. I I think God, if the thought that they were in order for these
[51:44]
extraordinary circumstances, I think we'd be able to sustain it. That would be valid and

that if there were problem with it, that we there would be some flexibility, 2 things
[51:57]
that I wouldn't say that. But for the circuit, I don't want to come one of us. I want.

what kind of money we're going to be having coming in on tax revenues. It may be we may not

have a choice. And I don't want us to get so far out ahead that we can be coming

back. If we may have seen here for years and that, okay, the last thing we you want to do
[53:53]
is I think showing the public that we're about spent a whole lot of money when, you know,
[53:59]
that just gives them reason to vote against. thing is and I've said this numerous times.

The you know, when I think of county building, I have my own. You know, I think of he
[54:13]
would like him, you know, children. You have the main building in the square or
[54:16]
borders towns. I've lived in where it's the people's building. And if feels like
[54:21]
and looks like that's I still would rather see that the fact that we're we're about to
[54:29]
build where we're going is a cartographic center of the county seat corner and used
[54:35]
great. That's the view know north South East West. the corner. Easy access. And I
[54:41]
think access is a very important thing here. You know, people have to be able
[54:46]
sometimes they have to come here and you've got to make it. So it's easy for the other
[54:53]
part in to Bob. I think I would like if there's a chance of doing the analysis of
[54:59]
showing the multiplier effect, what happens when you have 1000 people spending money
[55:04]
into place? What does that turn into the because the tax revenues, one part of it. The
[55:09]
multiplier effect is by far. The bigger. As a as Mike and in Kentucky. You know. Danny
[55:17]
Point is it's doing well, but it's not. It's still, you know, you don't want to take
[55:24]
out from under You know what support help supporting it right across the street in the
[55:31]
coming year as you're about to have a lot of development as well. So you're going to you
[55:36]
know, you're having couple areas are very dependent on that kind of multiplier effect
[55:41]
to keep it going. So we know for those kind of things on not inclined to be supporting
[55:48]
this right now. I do. I don't think it makes and I don't think the timing is right. And
[55:54]
I think for a city like Dania and Hollywood, both the right on the line right there. This,
[56:04]
you know, begins to write their it makes a difference. It helps support it. Those
[56:07]
kind of jobs are in the fact that we might have another very big industry come in. You
[56:13]
know, we're bored or or or business I think don't you want take that away? I think
[56:19]
we're on the right track where we're going. I think it was the right place. I It gives us
[56:27]
the opportunity to build the way we what we can scale it down. We can do whatever we
[56:30]
have to do and we don't have to build it tomorrow. We have our choice. We can. We can. We
[56:36]
can do what we do when it when we when it makes sense. But we need to send a message to the
[56:43]
people in this county that we're not going to be that we're not spending w****
[56:47]
nilly. And then we understand what's in front of them. And we're going we're going to do
[56:52]
the right thing. So that's the and that's one thing. I think you do want to everyone for
[56:58]
put it doing all. This is a lot of work. Thanks for letting us see it. I like what
[57:02]
I saw in terms that I didn't think was a government building. But I was glad to be
[57:06]

please share those companies that you've been dealing with and talking to? Because I

issue city spoke to a couple of them. I just want to see the magnitude of the companies

that that's what can ask in public. And so you when you can, and for someone not just
[57:35]
luxury months with these companies, they can talk one on one.

hopefully. That I've been doing this. You've got some trust in me. I wouldn't tell

you that they work. Well known. Remarkable companies that are looking at this. I

that have been great business advocates and you're approaching this like a
[58:03]
business with and that's what we're competing with business. This is a unique site Broward

County. I can't disclose the company's name specifically, but I can tell you that they
[58:12]
would be substantial and trust me. We have worked with them trying to save them in Broward
[58:16]
County previously commissioner >> I have been called by multiple companies and
[58:24]
multiple different hedge funds. I don't think they were official like with this is we
[58:27]
want to do this and we might do this. But I think it's you might want I haven't had as
[58:33]
much experience as Drew has had with bankruptcy. I mean, maybe they don't want Broward
[58:39]
County to be in this bankruptcy game. But I have a feeling that it's, you know,
[58:41]
for what everyone is saying. They want Broward County to be there for a lot of different
[58:46]
reasons. In this bankruptcy court. But like I said, it's it's a free market. And if
[58:52]
somebody out bids us, they out that President. >> I just want I get to the
[58:56]
company's. I want to see what the competition was. And I don't want to get into
[59:00]
bankruptcy world. explain that several times to the to the commission, but time
[59:07]
definitely and 40 is not on our side. So we do need to make a decision very quickly.

We're 8 days away from find the bankruptcy court that we are in tension to be a better.

Or that we submit our stalking horse offer. So time is again, not our size. It is becoming

time is of the essence for that? I said publicly that I'm bullish on this. I I have been

from the beginning, especially when I visit it. But now I have grave concerns basically
[59:42]
from the memorandum that we received last evening from the attorney's office. That
[59:47]
concerns me puts the county position that I don't know that we want to be. And I just
[59:53]
want to bring that to light. Yes, you could. You come forward because I know that
[59:59]
you are been dealing with like talk to because council day for yesterday outside counsel
[1:00:04]
got their feelings on a couple of things. But what concerns me of this June 15th memo are
[1:00:09]
several things and what the public understand that. Kim Co national international firm
[1:00:18]
that owns and operates shopping centers, malls. Developments such as the new
[1:00:26]
point there, the developer, the master developers of that. And when you do a master
[1:00:28]
development plan, mixed use. You. Create a document, you create rules, regulations, you
[1:00:34]
create. Development agreement you to do to create all these rules and so forth and gives
[1:00:44]
them much more power and rightly so. Because what they want to do is they want to
[1:00:49]
kind of control what's in that and their development, their spending, billions of dollars.
[1:00:54]
Developing this site. They want to make sure they protect their tickets that have been
[1:00:57]
there today. The ownerships that are in there today. So I get that. But to the extent
[1:01:04]
that >> providing. Rights to them kind of over even.
[1:01:14]
>> A city like new beach. And I say that because if you look in the restrictions, you look
[1:01:16]
in the guidelines. In order to even get a variance on something you might want to do
[1:01:22]
with the site. You have to go through them before you say the city davies's. Yeah. We'll

give you that variants. Kym Koch and say my sorry, you're not gonna get that variance
[1:01:34]
because you're not going to be able to do that because of our development rights in orders.

So when you're in a masterful a plan, you have like the kind H.O.A. per se, but you have to

pay your portion of the grass getting caught in and maintenance of the facilities,

the roads because he's a private roads in here. So you have all these things that you
[1:02:23]
have to do. And that's a cost to that. And I understand yes to that. We have not even been
[1:02:32]
provider, cannot get from Cam Co what the camp costs are. >> So we haven't been able to
[1:02:39]
get the actual cost. current cost paid by spirit for their allocation. We've been trying
[1:02:43]
to work with those spirits Council and the Kim code to get that information. But we
[1:02:49]
did. We have not been able to get >> And I understand that. But
[1:02:55]
we talked about today that the communication with Kim Cohen, he's against, can't go by
[1:02:57]
communication a camp go. Is that? They only put. answers and that the only responded
[1:03:04]
was via e-mails. Correct? We can't have that. We have a to have a Kirk conversation with
[1:03:10]
them because here here getting that is. Is that the current use of the facility, the
[1:03:16]
property today, his office and correct if I'm wrong is asked. And so we want to change the
[1:03:21]
used to a government use. It's a permitted use. In the city of Dania Beach allows it. They

say yes, you could permitted use for area. This particular property you can use
[1:03:32]
government. However. However. Kim Kohat my understanding has the right. To dictate the use.
[1:03:44]
That's it's not what exists today. So here's the problem there. And here's the problem
[1:03:49]
Commission is that? >> They will not give us a preapproval written letter.
[1:04:00]
>> Stating that we can use this property for what we want to use. Is that correct?

>> They haven't stated that. So there, you know, they've stated that they're trying to
[1:04:08]
treat us at what's to create arm's length with respect to all the interested parties in
[1:04:13]
the transaction. And so they'll provide information to us but are not necessarily
[1:04:19]
negotiating with or at least what they've told us any of the bidders as to our specific
[1:04:25]
uses. They're just telling us you know, answers factual question.
[1:04:32]
>> So have you asked them for a preapproval? Letter from them that they will pre
[1:04:39]
approve us as a use of the facility. We have not specifically ask for proof. So
[1:04:43]
I think that's very important because if we do not have in writing. From Kim Co that we
[1:04:52]
can use this facility for what we want to use. We want to have commission chambers, we
[1:04:58]
whatever those that laundry list issues that we need to use this property for. If we
[1:05:02]
don't receive written approval from them. Then this you because we can't buy a
[1:05:06]
property. A bit on the property, much less buy a property. And all of a sudden
[1:05:12]
we're told we can use it for what our use. So again, get in the bankruptcy arena. We are
[1:05:18]
today as is where is no continue. See, says we can't say our purchases. Ciliving is
[1:05:24]
subject to getting approvals of these uses. So it's very important to me. I can't vote
[1:05:31]
on something that I can say to the public. Yeah, we can buy so we can use what we want to
[1:05:34]
use it for. >> And I'm understanding that thing they even that to us
[1:05:40]
without asking us what we have an asset. But I'm asking mayor, we've got to find that
[1:05:43]
out. First before we can even move forward because without that. The title, when will see
[1:05:54]
transaction as commissioner UT nose and real estate transactions, you have a title
[1:05:57]
commitment to title policy. Right? And in the due diligence, period, they
[1:06:02]
provided a title commitment and they have schedule bees, which is basically a list of
[1:06:09]
restrictions or things that have to be satisfied prior to closing that transaction order
[1:06:14]
for you to pass free clear title right? always and conferences. Isn't. Is it
[1:06:19]
something here? Yes, sir. She should me some meat. My understanding it had looked at
[1:06:25]
the title yet on title. say all agree on. Policy you know, first, American or felt like
[1:06:33]
that. But my understand is how many schedule bees were 70. >> There were good after good
[1:06:42]
morning. There were 7, 0, so many exceptions that I the office the county attorney
[1:06:46]
along with County staff is review. >> And then you have the

even want to be a better. So you're competing with again. The original developer
[1:07:37]
competing with the market, the private sector and now a loss. We're pretty much are. We
[1:07:41]
really are. And I again, I've been bullish on this the whole time when Commissioner Union
[1:07:46]
border forward, I said no way when saw the facility saw the opportunities that we could be
[1:07:52]
there. I thought it would really work for us to save the hundreds of millions of
[1:07:54]
dollars that I'm hearing. But the day, we don't have it in writing, but we can exactly do
[1:07:59]
it. I mean, exactly. We can put commission chambers and there we can park them there.
[1:08:03]
We can use your roads there. We can use X x* if we don't have that in writing. This is
[1:08:09]
null and void as far as I'm concerned and then deal with the title issue separately. So
[1:08:15]
that's what really, really concerns me at this tea at this late hour. Unfortunately,
[1:08:20]
see this, I think at 8 o'clock last night. And again, I commend you for due diligence
[1:08:25]
and it needs to continue because the obviously is very extensive. I haven't been in
[1:08:28]
the data room, but I leave that to the experts when it comes to that. But so that's
[1:08:32]
my feeling. Is point? just commissioner decided on that, right? So we are continuing to
[1:08:39]
do diligence. We've, you know, as you state, we may not >> be in a position to be the
[1:08:43]
stalking horse to next week. But if you know, the board wanted to to be something on,
[1:08:48]
the extended >> But by nursing talking to legal counsel, council, you
[1:08:53]
have. Preferential treatment, but you have the better in sight. If you become stalking
[1:09:02]
horse or least play the game as a stalking horse, you have the ability to gain more
[1:09:07]
information, more opportunities, then you would just coming in as outside
[1:09:11]
bitter to the day for the July 23rd options going to take place, correct?

frugal as we can. And I sincerely mean it when I say that. I appreciate both you
[1:10:23]
and commissioner unity in for leading efforts to try and save us. Hundreds of millions
[1:10:28]
of dollars. And I will say that as of yesterday, I was still undecided as to where I
[1:10:35]
was as of today. I am not because 3 issues have come up that have decided in
[1:10:42]
opposition to this. The first one is. At the last meeting I raised questions about where
[1:10:52]
the alliance was based on a prior conversation. But at the time, I did not know exactly
[1:10:59]
what that position of Mister Swindle was. Just a great questions this morning. I find
[1:11:06]
found out what Mister Swindle its position is and how serious these discussions had
[1:11:11]
And that is one of the 3 factors with which led me to the second one is I drove it
[1:11:19]
today this morning. I just want to read the directions to directions to get to this
[1:11:27]
building are go to Broward Boulevard. Take a right on what's The I was coming due
[1:11:36]
West, a wave on offer of Stirling Road. So I just came east from West. Stirling Road
[1:11:43]
to 18th Avenue to Point Boulevard to North campus, way to Rady and Drive. And by the
[1:11:49]
way, I lost a GPS but cause North campus way doesn't have a street sign on. So it had to
[1:11:59]
go around that. I don't think is the appropriate location for for a government center to
[1:12:07]
have it in the middle of a master development where candidly, as I said a GPS, I
[1:12:13]
got lost. But the major factor, the when I read it and said no. It's the

same issue. That my colleague Commissioner Fisher just brought up. I think all of,
[1:12:32]
you land use attorney. When I read the memo from Anika this morning. I looked at that and
[1:12:40]
