[2:22] We recognize them.
[2:24] We cherish them and do this in the name

[2:28] And if you'd stand, we'll
[2:30] follow me in the pledge of pledge of
[2:32] allegiance.
[2:37] Pledge allegiance
[2:38] >> to the flag of the United States of
[2:41] America and to the republic for which it
[2:44] stands, one nation under God,
[2:47] indivisible, with liberty and justice
[2:50] for all.
[2:55] » Thank you, Council member Dave.
[2:58] Um this actually will be the last
[3:00] meeting we have before we go through the
[3:02] 4th of July celebrations. And so, I hope
[3:05] you're all ready to go to parades and
[3:07] have wonderful time celebrating the
[3:09] 250th anniversary of our country. What a
[3:12] special time.
[3:14] Um I would accept a motion to approve
[3:18] our agenda.
[3:19] >> So moved.
[3:19] >> Second. It's been moved and seconded
[3:21] that we approve the agenda. Those in
[3:22] favor?
[3:23] >> I.
[3:24] >> Any opposed?
[3:26] Okay, what about the minutes from our
[3:27] last workshop and our County Council
[3:29] regular meeting, both on June 9th?
[3:33] >> I noticed that Keegan was added in all
[3:36] the votes, but he wasn't here. So,
[3:38] >> Yeah.
[3:38] >> Okay. Other than that, I'll take it.
[3:40] >> have power, don't they?
[3:41] >> Yeah, not that much. It doesn't extend
[3:43] that far.
[3:44] >> Clerk's office. Okay.
[3:46] >> Here.
[3:46] >> Other than that, I'll make a motion to
[3:48] approve them.
[3:49] >> Second.
[3:50] >> Okay, it's been moved and seconded that
[3:51] we approve the minutes from our regular
[3:54] council meeting and our workshop meeting
[3:56] on June 9th excluding Keegan from any of
[3:59] the votes because he was absent that
[4:01] night.
[4:02] Those in favor say I.
[4:03] >> I.
[4:04] >> Any opposed?
[4:05] >> I'll abstain.
[4:06] >> Okay.
[4:08] All right, report of the county
[4:10] executive Oh, he just walked out.
[4:11] >> I'll give his report. Don't have
[4:13] anything to report. Let's go.
[4:16] >> I've got him, Keith.
[4:17] >> Keith's got something, I know so.
[4:18] >> Yeah, you know what? I know one of the
[4:19] things that he was going to do, I'll
[4:20] just go ahead and take care of it. Um,
[4:23] is we wanted Oh, there you are. It was I
[4:25] was going to start for you, but you go
[4:27] ahead.
[4:28] >> for what you had.
[4:28] >> Oh, I have it all with me. So,
[4:31] if you want to if you want to
[4:32] tee it up, I'll bring it all together.
[4:35] >> Uh,
[4:36] Mr. Miller
[4:38] has um,
[4:41] really taken to heart honoring our
[4:44] country.
[4:45] Uh, he's an 89-year-old gentleman
[4:48] who has
[4:50] produced some
[4:52] really beautiful artwork
[4:54] uh, and coloring.
[4:56] And we thought it was appropriate to
[4:58] honor him with a declaration
[5:01] and to have him come before us and have
[5:04] our county
[5:06] >> It's cool.
[5:07] >> chair
[5:08] present him with a plaque on behalf of
[5:11] Cache County.
[5:13] >> Okay.
[5:13] so I'm going to read this first
[5:15] and then we'll ask Mr. Miller to come
[5:16] forward and we will we have this for
[5:18] you.
[5:19] It says, "Presented to Bill Miller in
[5:22] grateful recognition of your outstanding
[5:24] participation in Cache County's America
[5:26] 250 celebration through the completion
[5:29] and submission of county-themed coloring
[5:31] pages featuring fun places and landmarks
[5:33] throughout Cache County.
[5:35] Your enthusiasm, creativity, and
[5:37] community spirit helped make our America
[5:40] 250 festivities more meaningful and
[5:42] reminded us that patriotism, curiosity,
[5:45] and fun can be celebrated at every age.
[5:48] Thank you for helping us color your way
[5:50] across Cache County and for inspiring
[5:52] others to join in celebrating our
[5:54] nation's story and local heritage
[5:57] presented by Cache County America 250
[5:59] celebration. So Mr. Miller, if you'd
[6:01] come forward
[6:02] and EVERYONE YES, PLEASE.
[6:04] >> [applause]
[6:16] » I DIDN'T DO THAT GOOD IN SCHOOL.
[6:20] » [laughter]
[6:21] >> YOU WANT TO JUST STAND RIGHT there for a
[6:22] minute? Let someone take your picture.
[6:24] We'll all We'll all sit down.
[6:28] Hold your placard.
[6:31] We also gave him a a new book with all
[6:34] of the pages in it.
[6:36] >> No, this one's in mine. Is this one or
[6:38] yours?
[6:39] >> Nope,
[6:40] got them here.
[6:45] » Thank you so much. We appreciate your
[6:47] participation in our community.
[6:49] >> [applause]
[6:49] >> That's awesome.
[6:55] » Did you Did you get an A in art?
[6:59] >> I don't know.
[7:00] >> [laughter]
[7:01] >> You should have.
[7:04] » That's awesome.
[7:05] >> I know that Bill did more than more than
[7:07] 30 different colorings
[7:10] >> Yes.
[7:10] >> done in that book.
[7:12] I work with the Visitors Bureau and so I
[7:14] would go through them and I knew which
[7:15] ones you didn't have. So I would take
[7:17] them to him.
[7:19] And he has done a marvelous job.
[7:21] >> That's awesome. We presented him with a
[7:23] book with a whole new set of all of the
[7:26] pages. You can color them again if you
[7:28] want. They're all That's for you to to
[7:30] continue.
[7:31] Yep.
[7:32] >> We are appreciative of that. Thank you
[7:34] very much.
[7:34] >> Yep, thank you.
[7:37] so much.
[7:40] Okay.
[7:42] >> You would like a report?
[7:44] >> You have a lot
[7:50] Yep, thanks for joining us.
[7:54] » Thank you, folks.
[7:55] >> Thank you.
[7:59] » I have a number of things I'd like to
[8:01] kind of walk through with you.
[8:04] >> Okay.
[8:05] >> I met
[8:07] yesterday with
[8:08] >> Dean, would you maybe close those doors
[8:10] real quick?
[8:12] >> [clears throat]
[8:22] » I met yesterday with the mayor of
[8:24] Millville and their city manager and um
[8:28] Matt Phillips and I walked portions of
[8:31] the road that as it enters and goes
[8:35] through Millville. We discussed what
[8:37] kind of work would be done on the road.
[8:40] I've asked Matt to prepare a cost
[8:42] estimate for us.
[8:44] Um
[8:45] we are due to do some regular
[8:48] maintenance on the road. If we looked at
[8:49] the road in some areas, the shoulders
[8:53] have been damaged either by use or maybe
[8:57] by the sewer system that was put in. I
[9:01] anticipate I'll have that estimate and I
[9:04] will bring you the estimate and we will
[9:06] have a discussion.
[9:08] Um
[9:10] We We do have a cog project that's
[9:14] pending that is the whole road, so we're going to have to kind of manage
[9:18] that in connection with it, but that's
[9:20] what's happening with respect to County
[9:22] Road 238.
[9:24] Um also I'm setting up a meeting with
[9:27] River Heights on the subdivision as
[9:30] well.
[9:32] On Clarkston Mountain, we've received a
[9:36] an estimate from the appraiser. Kurt, I
[9:39] believe that was $5,000,
[9:41] $4,000 to do the appraisal. Um
[9:47] I hope that comes out of your budget,
[9:49] Danny.
[9:51] But it's it's a nominal amount. If
[9:55] I think it would be important to get
[9:57] that appraisal done so we have that
[9:59] evaluation. So
[10:02] Danny and I will arm wrestle over whose
[10:04] budget it comes out of. But we'd like to
[10:06] go ahead with that. I don't know that we
[10:09] need a formal council resolution. All
[10:12] we're doing at this stage is simply
[10:14] having an appraisal done.
[10:15] >> Okay.
[10:17] >> Um
[10:18] There are other stages where we need to
[10:20] give public notice and so on and so
[10:22] forth. But this stage is just to get an
[10:24] appraisal. Once that's done, we will
[10:25] share that with you and with the
[10:27] landowner.
[10:29] >> Okay.
[10:30] >> Um
[10:32] In a real active time period with the
[10:34] fire board. Um I'm I'm going to release
[10:38] a letter that kind of deals with some of
[10:39] the public back and forth about what's
[10:42] been happening in the fire board
[10:44] meetings. Um Dave, you know there's a
[10:47] little kerfuffle going on there.
[10:49] Um [clears throat]
[10:51] And that letter will address it. The
[10:53] most important thing that's happened
[10:55] isn't that. It's that for the first time
[10:58] we've got the north mayors together in a
[11:00] meeting and discussed what what they
[11:03] want to do with their cities and the
[11:06] unincorporated area in [clears throat]
[11:07] the north.
[11:09] That meeting occurred last week. At the
[11:11] meeting, um
[11:16] They they made They elected as chairman of
[11:23] the meeting Jeff Yon.
[11:26] And they
[11:28] are making a recommendation
[11:30] that we appoint Mayor Brady Bodily of
[11:34] Lewiston to be a member of the fire
[11:37] board. That's a recommendation. We're
[11:40] going to collect those and then we're
[11:42] going to come back and talk more
[11:44] generally about service on that board.
[11:47] So,
[11:49] that is and we do have a fire board
[11:51] meeting pending this Friday.
[11:54] In the south, we've also had a meeting.
[11:56] In that meeting, uh Chad Lindley, the
[11:59] mayor of Wellsville, was selected as the
[12:01] chair and Mayor Ed Buys was nominated by
[12:06] the smaller cities to be their
[12:08] representative to the fire board.
[12:10] So, that's happened. They came up with a
[12:14] set of
[12:15] questions that they wanted answers to
[12:17] from the county
[12:19] and I'm collecting that material and
[12:21] hope to distribute it to them tomorrow
[12:24] or on Thursday.
[12:27] Um
[12:28] good meetings. The meetings have been
[12:30] productive and we're we're finally
[12:33] getting to the operational details of
[12:35] how this would actually work.
[12:37] So,
[12:39] >> [snorts]
[12:40] >> I believe that's a
[12:41] report of what my activities have been
[12:44] most recently.
[12:46] >> Okay.
[12:47] Does anybody have any questions for the
[12:48] executive?
[12:50] Okay. Thank you for that report. We
[12:51] appreciate it.
[12:53] Okay. Um next on our
[12:55] agenda is the Bear River Health
[12:57] Department advised interlocal agreement.
[13:00] I'll turn time over to Jordan Mathis.
[13:06] » Thank you. Jordan Mathis, director of
[13:08] the Bear River Health Department. Um
[13:11] given some of the changes that we've
[13:13] gone through in the integration of
[13:16] behavioral services in our three
[13:17] counties,
[13:18] uh
[13:19] it necessitated some minor changes uh to
[13:22] the interlocal agreement uh that you all
[13:25] approved last February.
[13:28] Um
[13:29] not last February cuz that'd be February
[13:32] 20
[13:33] 26.
[13:34] February 2025 is when it was approved
[13:37] uh by the three counties.
[13:40] I don't know if you want me to walk
[13:41] through the substance of changes or if
[13:43] you had a chance to look at them.
[13:45] Um
[13:46] they were all marked in green. I can
[13:48] explain some of them if you'd like and
[13:50] why those changes were were brought
[13:52] about. Whatever you'd like me to do, I'm
[13:55] prepared to do whatever you
[13:57] would like that would help you in
[14:00] making your decision.
[14:01] >> You know what, Jordan? I don't see
[14:02] anything green on my copy.
[14:05] >> Oh, was it
[14:05] >> So maybe maybe um
[14:07] >> Blue. I printed it to PDF.
[14:10] >> Yeah. Maybe you could just mention some
[14:12] of the bigger things. Like I'm I'm
[14:13] familiar with it, but let's
[14:14] >> Well, I'd be happy to do that.
[14:16] Real quickly, uh on page three in 2.1,
[14:21] um we just changed the formation to
[14:23] rather than reaffirm to firms
[14:26] and added February of 2025
[14:30] as the formation. That was when the the
[14:33] health department was made a united
[14:35] a multi united
[14:38] multi-county health department.
[14:41] Um the biggest changes that we had were
[14:44] under duties.
[14:46] Uh as we reviewed that,
[14:48] um
[14:49] we we hit on some of the behavioral
[14:50] health duties uh last time, uh
[14:54] but we didn't add uh the specific duties
[14:57] under code for public health. And so we
[15:00] put those back in there and then we also
[15:01] expanded some of the duties under
[15:04] behavioral health to make sure that we
[15:06] were um
[15:07] being very clear um for
[15:11] It's very clear to me in my brain, but
[15:13] for my predecessor to
[15:16] whoever replaces me uh would understand
[15:19] what that what those duties and
[15:20] responsibilities are. So we we expanded
[15:23] the duties section quite a bit just to
[15:25] be a little more explicit and broke it
[15:27] out between public health
[15:28] responsibilities and behavioral health
[15:30] responsibilities because there's two
[15:32] separate codes there.
[15:34] Questions there?
[15:35] >> Is
[15:36] Uh 2.
[15:39] 3.3.1.1
[15:41] is blank. Is there a reason that's
[15:42] blank?
[15:45] » It's not blank on the one that I have.
[15:48] >> And then we've got some just
[15:50] misspellings. Carry out is carry is
[15:53] spelled wrong in both of those.
[15:55] >> Three of them.
[15:56] >> Yeah.
[15:56] 2322
[15:58] >> Carry is spelled with one R.
[16:00] >> 231, 232, and 233.
[16:02] >> That's spelled wrong.
[16:04] >> Two.
[16:07] » Under duties, each time it it explains a
[16:09] duty it's carry.
[16:11] >> And the two one that I the 2.1 that I'm
[16:13] looking at doesn't mention anything
[16:15] about the February 2025.
[16:18] >> No, it doesn't.
[16:19] >> Yeah, I don't know the
[16:19] >> Yeah, quickly.
[16:20] >> Maybe we don't have the right I don't
[16:21] think we have the right copy.
[16:25] » All right.
[16:31] We we've been sharing it as a a Google
[16:33] Doc.
[16:34] >> Yeah.
[16:35] Just
[16:36] So, there are two different instances of
[16:38] the agreement in your media packet.
[16:41] Uh this one was just for reading
[16:42] reference while Mr. Mathis was
[16:44] presenting on the item. The actual
[16:47] correct version that Mr. Mathis is
[16:49] referring to should be marked
[16:52] as item eight.
[16:55] >> That's what I'm the res the resolution
[16:58] part.
[16:58] >> What page did you all
[17:00] >> 8C.
[17:01] >> Yeah. It's the actual resolution.
[17:06] Yeah.
[17:07] >> And that one should be the correct one.
[17:08] >> Resolution. Yeah, 2026-22.
[17:13] » I don't know. My iPad's not working.
[17:17] Okay, carry has been spelled correctly.
[17:19] >> That one is still left blank though.
[17:21] 2.3.3
[17:24] » is blank.
[17:26] There's a 1.2.
[17:28] 1.1 is blank.
[17:36] 2.3.3,
[17:38] the very first one under that, 1.1 is
[17:40] blank. Is that
[17:41] >> No, we didn't get all of it.
[17:42] >> It's not supposed to be blank. And And I
[17:44] just printed
[17:45] >> 2.1 still doesn't mention the
[17:47] >> It still doesn't mention February 8th.
[17:51] >> It's the same.
[17:52] >> It's Well, the Carrie is spelled
[17:54] correctly now.
[18:02] Yeah.
[18:03] There's nothing green line.
[18:06] » Talk about Let's Why don't we just have
[18:08] the changes and then
[18:10] >> I can send you a link
[18:12] a not editable link to the Google Doc
[18:14] that shows you the the edits. That's
[18:17] what you like.
[18:18] >> Cuz Cuz don't we have to pass this?
[18:20] Don't we have to approve this tonight by
[18:22] a vote?
[18:23] >> We can approve it whenever you guys feel
[18:25] you're ready to approve it.
[18:26] >> There you go.
[18:27] >> Um
[18:28] it We are Quick question, you passed.
[18:30] >> It's It's not It's not time sensitive.
[18:32] It's not like
[18:34] >> It's not super critical. We were
[18:36] shooting for July 1.
[18:39] Um
[18:40] Uh what this allows us to do is to
[18:42] execute a contract with Bear River
[18:44] Mental Health. That does need to get put
[18:46] in place by July 1.
[18:48] Um
[18:49] I don't know that it
[18:51] We
[18:52] What I'll say is and and maybe Mr.
[18:54] Murray can chime in. We were already
[18:56] given the authority to contract in the
[18:58] last one, so I'm not that concerned.
[19:00] >> Okay.
[19:01] >> Um
[19:02] >> If we waited
[19:03] >> to my ability to execute that, there are
[19:05] some minor changes with regards to the
[19:07] behavioral health director that are
[19:09] involved in this that we would just need
[19:11] to wrap up pretty quick after that.
[19:14] >> But that could be ratified that second
[19:17] week of July pretty easy.
[19:18] >> July 14th or something.
[19:19] >> I'm not going to be in front of
[19:21] um Rich County until July 1st.
[19:24] >> Okay.
[19:25] >> So,
[19:26] we have some time.
[19:27] >> Yeah, I I would rather see the the
[19:30] completed version of
[19:32] >> Okay. Have him go over those main points
[19:34] and everything and
[19:35] >> Yeah, go ahead and go over those main
[19:36] points and then when we get after the
[19:38] second reading
[19:39] >> ready to study it and
[19:41] >> Okay.
[19:41] >> on it on the 14th.
[19:42] >> Under Under organization, maybe this
[19:44] one's there. Under organization four, um
[19:48] we we made um some minor adjustments to
[19:52] the membership of the Board of Health.
[19:55] Um
[19:56] and what you have there is we split it
[19:58] into a voting members and ex officio
[20:01] members. The voting members stay the
[20:03] same and the voting members are still
[20:06] nine members that are appointed by the
[20:08] legislative bodies of each county
[20:11] according to the population.
[20:14] Uh it adds two ex officio members, one
[20:17] of those being the Cache County
[20:18] Executive, so whoever holds that office
[20:21] would be an ex officio member. And then
[20:24] we've been working with Utah State to
[20:27] have an ex officio member um
[20:29] of Utah State. They're in talking to the
[20:32] president's office, they would like to
[20:34] have somebody from their emergency
[20:36] manager be that ex officio member um
[20:40] because they both look at
[20:43] student side of things and and being the
[20:46] largest employer in Cache County also
[20:48] look at the employee side of things. So,
[20:51] they have kind of a a double vision
[20:53] there um and look at the impacts that
[20:56] they're having on the community. So,
[20:58] that's the position they're looking to
[21:00] potentially um
[21:02] have serve in that.
[21:04] Um
[21:05] >> Jordan, in your version, is that under
[21:07] 4.2.2? Because we don't have anything in
[21:09] ours about ex officio members.
[21:11] >> It's 4.2.2.
[21:13] >> 4.2.2 is blank on our version.
[21:18] » As Well, it's probably under 4.1, 4.5.4.
[21:24] And that was blank.
[21:26] >> Yeah, suffice it to say we probably need
[21:29] the updated one.
[21:34] » Let me get you
[21:37] my [snorts]
[21:39] Uh that is not my first copy here.
[21:42] >> Cuz I just printed this right before I
[21:43] came over.
[21:46] >> I will get Andrew my version of it. I
[21:49] apparently
[21:51] we have a different version from the
[21:53] attorney's office.
[21:54] >> Are you available on July 14th to come
[21:56] to our meeting?
[21:58] >> Yeah, do you just want me to sit down
[21:59] and come back?
[22:00] >> Yeah. Well, I'm I'm just thinking this
[22:01] is it's going to frustrate all of us cuz
[22:03] we're not looking at the same thing you
[22:04] are. And
[22:06] um
[22:06] >> A fine group.
[22:07] >> Cuz I was looking for that ex officio
[22:09] portion of it and I never had seen it
[22:11] and so I didn't know.
[22:21] » It looks like I am available then.
[22:23] >> Okay. How would that Would that be okay
[22:25] if we if we put this aside for now and
[22:29] wait until we have a
[22:30] >> Yeah.
[22:30] >> completed copy in front of us and then
[22:32] we can ask questions and
[22:34] go over those changes.
[22:36] >> It sounds like they're not It's not
[22:37] going to be a big deal, but it should go
[22:39] pretty quickly.
[22:40] >> I think so.
[22:40] >> I just think
[22:41] >> Could Could we go ahead with 6B then
[22:43] though?
[22:44] >> Yeah.
[22:44] >> I think we could still can.
[22:45] >> Yeah, let's do that.
[22:46] >> Yeah, let's move Let's go ahead and
[22:49] >> So, I go to 6B um
[22:51] in statute it allows for and the
[22:56] language is transferred from there into
[22:58] the interlocal agreement. It allows for
[23:01] the appointment either directly or by
[23:06] contract for a behavioral health
[23:08] director.
[23:10] That would oversee um
[23:13] that would oversee both mental health
[23:15] and substance abuse
[23:17] programs, the delivery of those programs
[23:20] in the community.
[23:21] Um given the integration work that we've
[23:23] done, last year I had you appoint an
[23:26] individual that directly worked for Bear
[23:29] River Health Department. As we look to
[23:31] integrate those and and put that under
[23:34] one contract with
[23:36] Bear River Mental Health, who will be
[23:38] called Bear River Behavioral Health from
[23:40] now on.
[23:43] My proposal would be that the council
[23:46] give consideration to appoint by
[23:48] contract uh
[23:51] Trevor Cook, who is currently the
[23:53] executive director of Bear River
[23:56] Behavioral Health.
[23:58] Um
[23:59] just to note the interlocal agreement
[24:01] and the language there, reviewed by the
[24:03] county attorney's office, was very clear
[24:06] that
[24:08] if that position changes
[24:10] um
[24:11] as a
[24:12] not-for-profit agency, they can hire
[24:15] whoever they want as their executive
[24:16] director,
[24:18] but that does not necessarily mean that
[24:21] they will become the behavioral health
[24:23] director. That is still subject to
[24:25] appointment by
[24:28] counties.
[24:29] Uh that's in code and that has to that
[24:32] has to exist.
[24:34] Um we've also transferred that same
[24:36] thing over to the contract so that
[24:37] they're aware that that's the case.
[24:40] Um
[24:41] so that's how we would we would work
[24:43] that, but my proposal
[24:45] um to the council right now is that you
[24:49] consider
[24:51] uh Trevor Cook to serve in that
[24:53] function.
[24:55] » I I have a question.
[24:56] >> motion
[24:57] >> something or
[24:57] >> Yeah, we'll we'll do that but I that
[24:59] says the term there's no term. He just
[25:01] is there until the
[25:04] their nonprofit makes a change and then
[25:06] that we would consider a change.
[25:08] >> Yeah, so the
[25:10] it would be subject to it would be
[25:13] subject to the the current contract
[25:16] which has eight more years on it.
[25:18] >> Okay.
[25:19] >> That's what that's the contract that we
[25:21] would sign and then
[25:23] we we would have to go through
[25:26] a bid process at the end of that
[25:29] to determine if there's any other
[25:32] entities in our community that could
[25:33] provide the scope of services that we
[25:36] need
[25:37] for comprehensive behavioral health
[25:39] services.
[25:40] They will
[25:42] most likely put in an application and
[25:45] would go through this process again
[25:49] at that point.
[25:50] So, it would be for the term of the
[25:52] contract. Thanks for the clarification.
[25:54] >> Okay.
[25:56] Um someone like to make a motion on that
[25:58] consideration?
[25:59] >> I would move that to uh approve Trevor Cook as the Bear River
[26:04] Health Department's Behavioral Health
[26:05] Director.
[26:06] >> Second.
[26:08] >> Okay, it's been moved and seconded that
[26:09] we approve Trevor Cook as the Bear River
[26:11] Health Department Behavioral Health
[26:13] Director. Is there any further
[26:14] discussion?
[26:15] >> Can I make one point of clarification?
[26:17] It'd be to the end of the term of the
[26:19] contract or until Trevor
[26:22] is not serving in that role anymore. So,
[26:25] if he were to quit, we would have to go
[26:26] through this again.
[26:27] >> Okay, we'll we'll add that to the we'll
[26:29] consider adding that to your motion.
[26:30] >> That's a friendly amendment, I bet.
[26:32] >> Okay.
[26:32] Um
[26:33] just as to note in his resume it does
[26:36] say that he is a justice court um
[26:39] >> judge in Rich County.
[26:41] >> Yeah.
[26:42] >> Where he does serve all three counties
[26:45] just
[26:46] It just that yeah.
[26:49] I don't I don't think that's changes
[26:51] but it's just to
[26:54] >> Keep it above board.
[26:55] >> Above board. Yeah.
[26:57] >> You want to restate the motion with the
[26:59] amendment?
[27:02] I accept that as as a friendly
[27:03] amendment. Does anyone want want to make
[27:05] that you well anyone want to make that
[27:07] as a friendly amendment or I can restate
[27:09] it.
[27:10] I well I would move that we accept
[27:12] Trevor Cook as the Bear River Health
[27:13] Department's Behavioral Health Director
[27:15] for the term of the contract or
[27:19] >> Until
[27:20] >> The other statement.
[27:21] >> Until he ends his employment.
[27:23] >> Or until he ends his employment.
[27:25] >> Okay.
[27:26] >> Is that a second motion?
[27:27] >> Does that second still stand? Okay.
[27:29] >> [clears throat]
[27:29] >> Those in favor say I.
[27:31] >> I.
[27:31] >> Any opposed?
[27:33] Okay.
[27:34] Thank you, Jordan. Sorry about the
[27:36] mix-up.
[27:40] Okay, it's public hearings. Does someone
[27:42] want to make a motion for this?
[27:44] >> Yeah, move that we schedule a public
[27:46] hearing for July 14th, 2026 at or about
[27:50] 5:30 for resolution 2026-21
[27:53] resolution opening and amending the
[27:55] Cache County 2026 budget fourth
[27:57] amendment.
[27:58] >> I'll second that.
[27:59] >> Okay, so moved and seconded that we
[28:00] schedule a public hearing for July 14th
[28:02] to amend the Cache County budget. Those
[28:05] in favor say I.
[28:06] >> I.
[28:07] >> Any opposed?
[28:09] Okay.
[28:10] Um initial proposals for consideration
[28:13] of action. Andrew,
[28:15] um do you want to talk about this first
[28:17] one, please?
[28:17] >> Yes, ma'am. One minute.
[28:31] Good evening, Council. Uh before you is
[28:33] ordinance 2026-27.
[28:36] The ordinance in question deals with
[28:37] electronic meeting procedures for the
[28:39] County Council.
[28:40] Uh
[28:41] this is
[28:42] for the most part largely an effort to
[28:45] essentially consolidate the Council's
[28:47] rules, but there are some also some rule
[28:49] changes involved as well.
[28:51] Um before I begin my presentation, I'm
[28:52] going to pass out a a flowchart that
[28:54] will be referenced later in the
[28:56] presentation, but it's really helpful to
[28:58] look at.
[29:29] Okay.
[29:32] So, ordinance 2026-27,
[29:34] um got a little typo up there. Sorry
[29:37] about that. It proposes an enactment to
[29:38] county code that governs electronic
[29:40] meeting procedures of the county
[29:41] council.
[29:42] Why is this necessary? It places
[29:44] electronic meeting procedures with other
[29:46] county council meeting procedure
[29:47] provisions in chapter 2.16 of county
[29:49] code. In short, it puts all the meeting
[29:51] rules together in one place. Uh in the
[29:54] event of an emergency or if a question
[29:55] about meeting procedure arises, all
[29:58] relevant county level rules are in one
[30:00] place just for reference.
[30:04] So,
[30:06] uh here's a little bit of context.
[30:08] In response to the in uh in the
[30:11] excuse me, in response to the COVID-19
[30:13] pandemic, the Utah legislature actually
[30:15] through the bill itself was authored by
[30:16] Mr. Val Potter, who is here in
[30:18] attendance with us.
[30:19] Uh
[30:20] it passed HB 5002, which amended the
[30:25] Utah Open and Public Meetings Act. It
[30:27] initiated some requirements and expanded
[30:29] some allowances for local governments to
[30:31] have rules and procedures for electronic
[30:33] meetings.
[30:34] The county council adopted resolutions
[30:36] 2026 and 27 and 2022-12
[30:41] to establish electronic meeting
[30:42] procedures, but these didn't add or
[30:44] amend to existing rules in county code.
[30:46] So, essentially you had
[30:48] different sets of rules that were
[30:50] floating
[30:51] out
[30:53] not in reference to all the regular
[30:55] rules. So, Cache County Code
[30:58] Chapter 2.16 is the main repository for
[31:01] count county council rules and
[31:02] procedures.
[31:03] Right now, it does not contain any
[31:05] provisions related to electronic meeting
[31:06] procedures. So,
[31:10] the ordinance itself, it would establish
[31:12] clear guidelines under the Open and
[31:14] Public Meetings Act for conducting
[31:16] county council meetings remotely.
[31:18] It establishes that the anchor location
[31:20] for meetings, which is more or less
[31:22] where the meeting physically happens,
[31:25] of the county council is the Cache
[31:27] County Historic Courthouse, which is the
[31:28] building that we're in now.
[31:31] It requires a physical quorum
[31:33] at the county historic courthouse to
[31:35] approve a standard electronic
[31:37] participation by majority vote. Uh let's
[31:40] say that Mr. Garrity is
[31:43] on a business trip. Let's say he's in
[31:45] Ohio,
[31:47] and he would like to attend the county
[31:49] council meeting. He has a a work thing
[31:52] that he he can't miss, but still wants
[31:54] to participate. He would send in a
[31:57] request, and
[31:59] that request would come before the
[32:00] county council.
[32:02] You all would have to vote to approve uh
[32:04] Mr. Garrity's or anyone else's
[32:06] attendance. Then once that vote is
[32:09] approved, then
[32:10] those other council members can
[32:12] participate remotely.
[32:14] Uh it
[32:15] this ordinance itself would grant uh
[32:19] remote council members full voting and
[32:21] participation rights once the electronic meeting format is
[32:25] officially approved.
[32:28] Uh in the event of an emergency, it
[32:30] authorizes the county council chair to
[32:31] completely waive the physical anchor
[32:34] location requirements during health or
[32:36] safety emergencies via a written
[32:37] determination. That is a rule that is
[32:40] currently not enacted by either of those
[32:42] resolutions I referenced. Uh this would
[32:45] be something that uh would definitely
[32:48] I would say help in the event of
[32:50] emergency.
[32:51] And it also provides a backup mechanism
[32:54] to use the
[32:55] uh
[32:56] if the county executive declares a state
[32:58] of emergency and he designates a
[33:00] temporary seat of government.
[33:02] This would also allow you to use that
[33:03] temporary seat of government as an
[33:05] anchor location. So a lot of this is
[33:07] technicalities, but
[33:09] if you were going to be wanting to
[33:10] follow the rules during an emergency,
[33:12] this would more or less give you that
[33:14] authority.
[33:16] And something that was not put in my
[33:17] presentation itself uh was the question
[33:20] about
[33:22] uh public participation. There is a
[33:24] provision in the ordinance itself that
[33:26] does talk about
[33:27] public participation. Uh that says if
[33:30] it's uh requested by the council chair
[33:33] or any other council member
[33:35] has to be approved by I believe it's
[33:36] also majority vote um or if it's
[33:39] required by state law, like for example
[33:40] during truth and taxation. So it also
[33:43] addresses that as well.
[33:46] Uh here's the flowchart. It's a little
[33:47] blurry to see, but
[33:49] do any of you have any questions?
[33:51] >> I I have two. So one just for
[33:53] clarification,
[33:54] uh I'm gone um
[33:57] I request a that there's a
[34:00] public or an electronic meeting.
[34:03] That can be approved at the beginning of
[34:05] the meeting or does it have to be
[34:06] approved in a prior meeting?
[34:08] >> It has to be approved uh at the
[34:10] beginning of the meeting that you want
[34:11] to join.
[34:12] >> Okay. So if I'm gone on
[34:14] the 22nd, it can be approved on the 22nd
[34:17] and I can still participate if
[34:19] voted yes.
[34:20] >> Yes.
[34:21] >> Uh
[34:21] >> If we vote yes.
[34:22] >> If we Yeah. Yeah.
[34:25] Um [laughter]
[34:26] depends on the issues at hand, I guess.
[34:28] Um
[34:28] and then the other question is it does
[34:30] say um
[34:32] that notice of the meeting is
[34:35] a required 24 hours. Is that happening
[34:37] by default because we're saying yes,
[34:39] there's a meeting it's live streaming on
[34:41] YouTube or is this a separate
[34:43] requirement where you have to notice
[34:45] that it's specifically an electronic
[34:47] meeting 24 hours in advance?
[34:49] >> It would have to be a separate notice.
[34:51] The The second answer. There would have
[34:52] to be a separate answer for an
[34:53] electronic meeting.
[34:54] >> So
[34:55] someone who's going to be gone should
[34:58] know 24 So then
[35:00] you could notice that there's a that
[35:02] there's an electronic meeting and even
[35:04] if they voted no, you're still covered
[35:05] because you noticed that Okay.
[35:09] So basically what I'm gathering is at
[35:11] least 24 hours notice is kind of the
[35:14] absolute minimum requirement.
[35:16] >> Yes.
[35:16] >> And I guess another part of that
[35:18] question is by designating it as an
[35:21] electronic
[35:22] meeting, does that mean that if there's
[35:24] a public hearing that participants can
[35:27] participate electronically automatically
[35:29] or are those two things separate?
[35:32] >> I'm going to say I believe as it's
[35:33] written under the ordinance itself, the
[35:35] two would be separate.
[35:37] >> Okay. And that would that also have to
[35:39] be voted on as well separately then?
[35:41] >> I believe so.
[35:41] >> So like one vote to say Keegan can
[35:43] participate remotely and then another
[35:44] vote to say the public can participate
[35:46] remotely. Okay.
[35:47] >> Yes.
[35:48] >> I think that answers my question. Thank
[35:50] you.
[35:50] >> want to also add that I believe the 24
[35:52] hour notice part, if I recall correctly,
[35:55] is a requirement that's actually from
[35:56] the Open and Public Meetings Act. That's
[35:57] not me just making something up out of
[35:59] thin
[35:59] >> This is you trying to gather those
[36:01] things.
[36:02] >> Yes.
[36:02] >> So when it's truth and taxation and
[36:03] we're required to allow public comment,
[36:05] we don't have to vote on
[36:06] >> have to vote for that.
[36:07] >> That Okay. That's just automatic.
[36:10] >> Yes.
[36:10] >> Okay.
[36:11] Um
[36:12] So if someone is attending remotely,
[36:14] we'll just throw Keegan again.
[36:16] He can't be included in the vote for a
[36:18] quorum though.
[36:20] >> Not for the initial.
[36:21] >> So there has to be a physical quorum at
[36:23] the physical location. Yeah.
[36:26] >> And then that unlocks the gate
[36:28] essentially that
[36:28] >> for you to participate and vote.
[36:30] >> Okay.
[36:35] >> Does anybody have any other questions
[36:36] for Andrew?
[36:37] >> Can we require that someone mutes their
[36:39] microphone if they're attending remotely
[36:40] and there's distracting things going on?
[36:42] >> I was going to say I'm sure I could, you
[36:44] know, force that from my end of things,
[36:46] but sure.
[36:49] » Anybody else?
[36:51] >> I just wonder what the security is
[36:55] for the the council with the person
[36:57] that's doing the remote electronic.
[37:00] >> That kind of seems like that leaves the
[37:03] door open for
[37:05] we don't know.
[37:06] >> That is a good question, and I know that
[37:08] at the beginning of the pandemic that
[37:10] was a really big concern of for, you know,
[37:13] using Zoom or Google Meet if it was very
[37:16] secure or not for organizations to use.
[37:19] Uh I believe
[37:21] though I can't testify to it, we do use
[37:24] a lot of Google, occasionally use Zoom.
[37:27] Uh
[37:28] In terms of security, I think we we're
[37:29] pretty covered with that though.
[37:31] >> Yeah, but what if Keegan Keegan has a
[37:34] gun to his head?
[37:35] >> Oh, I see.
[37:36] >> Okay, fair point. Could be voting under
[37:38] duress.
[37:39] >> Right.
[37:41] >> Well, you have the same situation of if
[37:43] you open up to public and somebody
[37:45] stands and says who they are, do we know
[37:47] who they are cuz we don't have a vision
[37:49] of them.
[37:50] >> There's so much we can do.
[37:51] >> Well, I
[37:52] >> We can be on a required video
[37:53] confirmation as well.
[37:57] » I I've
[37:59] I'm okay with
[38:00] >> Can we Do you want me to establish a
[38:01] safe word?
[38:03] >> Duress. [laughter]
[38:05] » The eagle has landed.
[38:09] » Sorry.
[38:10] >> I'm I'm comfortable with how it is. I
[38:12] think we're
[38:14] getting in the weeds.
[38:17] I I think we're okay.
[38:18] >> And sorry if I misunderstood your
[38:20] question.
[38:21] >> I think it'll be nice to be I I have
[38:24] at times when I've had to miss a meeting
[38:25] and I've really
[38:27] had a desire to participate. And when
[38:29] you're on a speaker phone that's sitting
[38:31] on the dais, it's really hard to
[38:34] I want him to say something.
[38:35] >> Yep.
[38:36] >> So, this I think this will be good.
[38:38] Okay, does someone want to make a motion
[38:40] about this?
[38:41] >> comment.
[38:41] >> You sure can.
[38:43] >> I just think that's kind of ironic that
[38:45] we would allow this when we don't allow
[38:48] the transparency of a public open
[38:50] comment period.
[38:52] >> Um I think it's totally two different
[38:54] two two different things.
[38:55] >> both transparent
[38:57] >> Yes.
[38:58] >> issues.
[38:58] >> Yes.
[38:59] >> in my opinion.
[39:00] >> I agree.
[39:02] >> Well, but we still have to approve it in
[39:03] this if we're opening it to public. So,
[39:05] I think we watch that in a very
[39:08] protective manner. So.
[39:10] >> Okay.
[39:12] Does anyone want to make a motion about
[39:13] this?
[39:15] >> I'll make a motion that Let's see, it's
[39:17] a resolution or an ordinance?
[39:19] >> ordinance.
[39:20] >> It's an initial proposal, too.
[39:21] >> Okay, so I do need to suspend the rules
[39:23] then.
[39:24] And uh
[39:26] make a motion that we approve Let's see,
[39:28] what number is it? Um ordinance 2026-27
[39:33] establishing and amending the electronic
[39:35] meetings procedures of the Cache County
[39:37] Council.
[39:38] >> Second.
[39:39] >> It's been moved and seconded that we
[39:41] approve ordinance 2026-27.
[39:44] Is there any further comments?
[39:45] >> Yep. I just want to state that it did go
[39:47] through OMP
[39:49] >> It did.
[39:49] >> and was vetted in here,
[39:50] >> too, so.
[39:50] >> Thank you for your work there.
[39:51] >> Yeah, thank you.
[39:52] >> Okay, those in favor say I.
[39:54] >> I.
[39:54] >> Any opposed?
[39:56] >> Uh nay.
[39:57] >> Okay.
[39:59] All right.
[40:00] 8B ordinance 2026-32,
[40:12] » Good evening. Uh Brian Abbott with
[40:13] Development Services.
[40:16] Uh Uh tonight we have a ordinance
[40:17] 2026-32
[40:20] uh establishing a temporary moratorium
[40:23] on the development of utility scale data
[40:25] centers.
[40:26] Um
[40:28] need for a pause. Our current county
[40:30] code
[40:32] or uh zoning, development, and
[40:34] construction standards do not contain
[40:36] clear definitions
[40:38] um or regulations
[40:40] uh to manage industrial scale digital
[40:42] installations um
[40:44] adjacent to any of our agricultural or residential areas.
[40:49] So, what is this ordinance? Um it's a
[40:52] 180-day protective pause.
[40:55] Um and this will give uh planning and
[40:58] zoning time to prepare permanent code
[41:01] text amendments
[41:02] >> [clears throat]
[41:03] >> during that moratorium.
[41:05] Uh during this moratorium, uh Cache
[41:08] County will not accept, review, or
[41:10] process any applications for data
[41:12] centers in any zone.
[41:16] Um also, we will evaluate if we will
[41:18] allow data centers, what codes do we
[41:20] need to add or code that prohibits them
[41:23] all together.
[41:24] And during this time, we'll workshop and
[41:27] keep everyone in the loop, including
[41:29] planning commission and and county
[41:31] council throughout the whole process.
[41:33] Um
[41:36] that's kind of all we've got for this uh
[41:37] moratorium to present to you. Do you
[41:39] have any questions concerning this?
[41:41] >> I just want to state publicly and I I
[41:45] said this for the newspaper, too. We
[41:46] have not received any interest that
[41:49] we're aware of of somebody wanting to
[41:51] put a data center. So, this is not in
[41:52] reaction to any kind of inquiry. This is
[41:55] just us trying to get ahead of something
[41:59] that may or may not even come, but we we
[42:01] want to be ready if it does.
[42:03] >> And And this is only for the
[42:06] unincorporated
[42:07] >> Yes.
[42:08] >> properties. It is It's
[42:10] >> include municipal
[42:11] >> it does not spill over into all of
[42:12] municipalities. That's their business.
[42:15] >> Yeah, I will add that I did meet with
[42:17] the chair of the Logan City Council and
[42:19] they're doing something very similar.
[42:21] >> Yeah.
[42:21] >> They realize that their code isn't
[42:22] caught up with
[42:24] some of the potential demands that could
[42:26] be coming. So,
[42:27] I think it's just a
[42:29] precautionary
[42:30] >> Yeah, proactive. I like it.
[42:33] Okay, does someone want to Does anyone
[42:35] have any more questions for Brian?
[42:37] >> Please do.
[42:38] >> Let me add that to that that we have an
[42:41] exam of the board that's going to govern
[42:44] any such application.
[42:47] >> It would be our planning and zoning It's
[42:48] our planning and zoning commission.
[42:50] >> would be the ones to examine that.
[42:52] >> Yeah, it would come through It would
[42:53] come first to our development services,
[42:55] then through them, and then to us for
[42:56] final. And it would have to be probably
[42:59] a zone change, which would always come
[43:00] to us
[43:01] um in the end. So, it's That's the
[43:04] process that would happen.
[43:09] So.
[43:09] >> Okay, I will suspend the rules and for
[43:13] ordinance 2026-32
[43:16] establishing a temporary moratorium on
[43:18] the development of data centers.
[43:20] >> Second.
[43:21] It's been moved and seconded that we
[43:22] suspend the rules and pass ordinance
[43:24] 2026-32.
[43:27] Is there any further discussion?
[43:29] >> Is that 180 days or years?
[43:32] >> [laughter]
[43:33] >> 180 days.
[43:34] >> Days, okay.
[43:35] >> Okay.
[43:36] Those in favor say I. I. Any opposed?
[43:41] Okay.
[43:41] >> Thank you.
[43:42] >> All right, approving the Oh, we're we're
[43:44] not going to do the
[43:46] number C.
[43:48] Okay, D, Dane Murray. This is
[43:53] the airport.
[44:02] » I'm not sure how I drew the short straw
[44:03] to present on the airport, but this has
[44:05] been a lot of work that
[44:08] Keegan and Dave and Mark and all of OMP
[44:11] have put in in the executive um
[44:15] So, just to give some background to
[44:16] everyone, back in December there was
[44:20] um discussion with Logan City about
[44:22] Logan City withdrawing from their
[44:24] participation in the airport.
[44:26] Um they [clears throat] they did pass a
[44:29] um resolution through their City Council
[44:31] that withdrew, but as we looked into
[44:34] all of the FAA regulations and our grant
[44:37] requirements as the airport authority
[44:39] um we realized it's not so simple just
[44:42] to have one of the parties of the
[44:43] airport authority withdraw. And a reason
[44:47] for that is the airport authority is an
[44:48] interlocal entity separate from the
[44:51] county or the city. Um so, it's its own
[44:54] um
[44:55] legal entity, and they are the ones who
[44:57] have applied for all of these FAA grants
[45:01] that have a lot of really strict
[45:03] regulations on how that money's used,
[45:06] who controls the money. And and so, we
[45:10] went to work with Logan City and with
[45:12] our um
[45:14] ordinance and policy to come up with a
[45:15] way that
[45:18] keeps the airport authority intact, but
[45:21] has the same outcome that we were
[45:22] seeking when Logan City was going to
[45:24] withdraw.
[45:25] And one thing that's important to know
[45:27] is when you're talking about airports,
[45:29] um
[45:30] even if the county is running the
[45:31] airport because it's located in Logan
[45:33] City, Logan City under FAA regulations
[45:37] gets a lot of say in in what's happening
[45:40] with the airport. And so, they were
[45:41] going to have to continue being
[45:43] involved. Um so, what we've proposed is
[45:46] an amendment to the 19 93 interlocal
[45:51] agreement between Logan City and Cache
[45:53] County that created the airport
[45:55] authority.
[45:56] And what it does is it retains Logan
[45:58] City's involvement within because it's
[46:01] within their boundaries, but it removes
[46:02] their financial liabilities, which was
[46:04] what we were going for when they were
[46:07] withdrawing from the airport. And then
[46:09] it restructures the governance of the
[46:11] airport
[46:12] um
[46:13] really to to try to get in line with the
[46:17] there was an an auditor report done a
[46:19] couple years ago about the airport's
[46:21] governance
[46:22] um trying to move the airport from
[46:24] something that's a financial liability
[46:26] for the county and the city to something
[46:28] that's self-sustaining and is an
[46:29] economic um
[46:32] positive for the community, which I I
[46:33] think it is even with what the the
[46:35] county has to put in. But the the hope
[46:38] is under this this new form of
[46:41] governance that
[46:42] there's going to be an enterprise fund
[46:44] that's that they're going to be required
[46:45] to start, and that's going to
[46:48] um eventually become something that's
[46:50] self-sufficient without any taxpayer
[46:51] money going into it.
[46:53] Um the county will take the financial
[46:56] lead
[46:57] in the meantime. So, if there are
[46:58] appropriations, they will come through
[47:01] the county council through our normal
[47:02] budgeting process.
[47:04] Um if you can move to the next slide.
[47:06] So, so what the the new interlocal
[47:08] agreement, the amended interlocal
[47:10] agreement does is it creates an airport
[47:12] authority sponsor board. When we're
[47:14] talking using the term sponsor, that's a term of art that's used by the FAA um
[47:20] for whoever is ultimately responsible
[47:23] for the airport and is um
[47:27] on on the hook to make sure all of the laws are being followed. And that is the two
[47:33] entities that created the interlocal
[47:35] entity. So, that's going to be composed
[47:37] of seven members, three members of the
[47:40] Cache County Council, one of which would
[47:42] live in Logan City.
[47:44] Um the Logan City mayor or their
[47:46] designee, a Logan City Council member,
[47:49] and then two county elected officials.
[47:51] So, whether that's the county executive,
[47:53] the county auditor, the county clerk,
[47:55] two countywide elected officials would
[47:56] serve on that.
[47:58] They would approve the the airport's
[48:00] budget, the airport authority's budget.
[48:03] Um
[48:05] So, the overall budget of the airport,
[48:06] not what they're asking for for the
[48:08] county, but what their overall budget is
[48:09] for the year.
[48:10] Enact bylaws, appoint remove people from
[48:13] the operational board, and they can
[48:15] overall override any action taken by the airport authority board, which would
[48:20] be in charge of operations that would
[48:22] violate any law or any FAA regulation.
[48:25] That's the oversight they have to make
[48:26] sure we're not violating any grant
[48:28] conditions.
[48:30] The other side of that is the airport
[48:31] authority board, which is in charge of
[48:33] operations. Um the going to be people
[48:36] who have some technical
[48:38] aviation business expertise to actually
[48:40] run the airport like a business and move
[48:43] it to where it'd be profitable.
[48:45] There'll be six members from the general
[48:47] public.
[48:49] Um and then one countywide elected
[48:51] official.
[48:52] They're responsible for the daily
[48:54] operations, technical oversight,
[48:56] maintenance, contract leases, and hiring
[48:58] of any personnel they need.
[49:00] They'll be stacked appointed in
[49:02] staggered four-year terms with a maximum
[49:04] of three consecutive terms to to limit
[49:07] the amount of time someone can spend on
[49:09] that board without being replaced. And
[49:12] all of that it might not be exactly what
[49:14] was proposed in the the report, but it's what we came to
[49:20] be as close as we could to adopt those
[49:22] recommendations.
[49:24] I'm ready for the next slide.
[49:25] >> Um I have a question about that, Dean.
[49:26] >> Yeah.
[49:27] >> The the management board, who is the
[49:29] appointing authority? Is it the the
[49:33] >> sponsor board?
[49:34] >> board would be the appointing authority
[49:35] to the management board.
[49:37] >> Okay.
[49:37] Thank you.
[49:39] >> What can I just say something real
[49:41] quick? I think when we were talking
[49:42] about this, we were if we if we are
[49:44] comparing it to a business model, we
[49:46] were using um
[49:48] you know, the analogy that the sponsor
[49:50] board would be like shareholders and the
[49:52] authority board would be more like a
[49:54] board of directors.
[49:56] If that helps.
[49:57] >> Yeah.
[49:58] >> Thank you.
[50:01] » Um so just to go into a little bit
[50:05] because we were here on the precipice of
[50:07] this agreement ending and we've kind of
[50:09] walked that back. So it's valid for the
[50:11] new interlocal agreement will be valid
[50:13] for a minimum of 10 years and then not
[50:16] to exceed 50. So
[50:18] if everything's going really well in 50
[50:20] years, that's when we're going to have
[50:21] to come back and and take a look at this
[50:23] again.
[50:24] Um I think as we've gone through OMP,
[50:26] there's a realization that we'll
[50:27] probably need to come back and look at
[50:29] the interlocal agreement once things
[50:31] start running to see if there's things
[50:33] that need to be adjusted.
[50:34] Um
[50:36] and then just to talk about dissolution
[50:38] a little bit um cuz I I think that
[50:40] that's something it'd be good to put on
[50:42] the the public record of
[50:44] dissolution of the the airport. So
[50:47] in one scenario, that's where we were we
[50:49] were almost with Logan City, that
[50:52] it would dissolve and
[50:55] Cache County would continue running it.
[50:57] Um Logan City would be out.
[51:00] That's that's one scenario. Um
[51:02] in the in the agreement, it's must be
[51:05] run for at least 20 years and the the
[51:07] reason for that is when we accept FAA um
[51:11] loans or grants,
[51:13] the requirement is that
[51:15] and some of them it actually is in
[51:17] perpetuity. It has to be used as a
[51:20] if you're using this as an airport or
[51:21] you're taking this money, it has to be
[51:23] used as an airport. You can't
[51:25] take this money for the runway and then
[51:26] turn it into a road or something.
[51:28] Um otherwise, it's 20 years from the
[51:31] last time you accepted money from the
[51:33] FAA that it has to continue running as
[51:35] an airport. Um one of there's a
[51:38] case out there where
[51:40] um
[51:41] City of Cincinnati had two airports,
[51:43] their international airport and then a
[51:44] smaller airport and they wanted to stop
[51:46] running the smaller airport, and it took
[51:47] them 20 years of not accepting FAA
[51:50] funds, but having to pay to run the
[51:52] airport to get out from under without
[51:54] having to pay back the the funds for
[51:56] that. Um and so that's something I think
[51:58] everyone and hopefully in the future
[52:01] takes into account that we have to keep
[52:03] running this as an airport as long as
[52:05] we're we're taking FAA funds.
[52:08] Um and that would even be with the
[52:09] intent to close the airport where the
[52:11] city and the county both say we you know
[52:13] what, we don't want to to run an airport
[52:15] anymore. And in that case, um the assets
[52:18] would be split 50/50.
[52:20] Um
[52:20] I can't imagine a situation based on the volume of flights at our airport
[52:25] that that would ever be the the case,
[52:27] but I just wanted to
[52:28] put that out there.
[52:29] Um
[52:31] The one thing I I did want to mention, I got Andrew and George a copy earlier
[52:36] today, and I just heard from Logan City
[52:38] the format that that Logan City had
[52:42] proposed for this is what's in your
[52:43] packets. Um
[52:45] as we talked about that in OMP, I I'd
[52:48] propose something different that was a
[52:50] more of a standalone document where you
[52:51] didn't have to refer back to the 1993
[52:54] agreement. Um
[52:57] incorporated all of our changes, so you
[52:59] did not have to
[53:01] look back at 1993 where it's a
[53:03] standalone document. Um I I heard from
[53:06] Logan City that they're okay with that
[53:08] um from their attorney. Logan City will
[53:10] still need to go through their process
[53:11] with this, but really what our this
[53:13] resolution is is um
[53:16] you're you're agreeing with the content
[53:18] of the the interlocal agreement, and
[53:21] you're giving the county executive the authority to go sign that agreement.
[53:26] Um there there could be some small edits that are not
[53:32] that are that don't go into any of the
[53:33] substance as we're trying to get the
[53:36] formatting and things right, but that I I
[53:39] there's no problem with giving him the
[53:41] authority to enter into that. Him and um
[53:44] Logan City's mayor can can work that out
[53:46] with the attorneys, but this is really
[53:48] the content of this and the structure is
[53:52] what we're we're giving him authority to
[53:54] approve.
[53:55] >> But but the version you have will be
[53:57] different than this.
[53:59] >> It it's it's different in the If you
[54:01] look at this version, it says this amend
[54:03] it's it's actually a little bit
[54:05] confusing cuz you have to refer back to
[54:07] the 1993 agreement to see what this is
[54:10] actually amending.
[54:11] Um what what will eventually be passed
[54:14] and has been passed on to the executive now
[54:18] is
[54:19] um it's it's all a standalone document.
[54:21] You don't have to look back at the the
[54:23] previous interlocal agreement.
[54:25] Everything from the previous interlocal
[54:27] agreement um
[54:29] will will be um
[54:31] replaced with this with the exception of
[54:34] the legal description of the airport.
[54:36] Um
[54:37] That that is the only part of that
[54:38] agreement that is incorporated.
[54:42] >> Is there a time sensitivity on this one?
[54:46] >> So, Logan City's council is not meeting
[54:48] again until
[54:50] the middle of July.
[54:52] Um
[54:53] And really what they
[54:55] the city government has a little bit
[54:56] different
[54:58] um their their mayor has the ability to enter into these agreements without
[55:03] the council. Um they don't have a
[55:05] they don't This isn't implicating their
[55:07] budget at all. So, so Mayor Anderson can
[55:09] enter into this and we can work through
[55:11] that.
[55:12] Their council is going to need to pass a
[55:13] resolution rescinding their
[55:16] withdrawal from the airport.
[55:20] As we talked through it from a legal
[55:21] standpoint, I I think that's more
[55:23] symbolic because the FAA isn't going to
[55:26] recognize their withdrawal because we
[55:28] didn't go through the withdrawal process
[55:30] with the FAA.
[55:31] And so
[55:33] the the time sensitivity is more
[55:38] um um
[55:40] just to say we we have this in place,
[55:42] but the airport can continue
[55:44] functioning. I I do think we need to as
[55:47] far as the airport board
[55:48] um
[55:49] we need to hold off on meetings meetings
[55:52] of the airport board until we can
[55:54] reconstitute these two boards and
[55:57] um
[55:58] get get that going, which is is a burden
[56:00] on the airport cuz we have we've had
[56:03] some time without an airport board
[56:04] meeting trying to work this out.
[56:07] But we are
[56:09] the effective date will be retroactive
[56:11] to July 1st um
[56:13] is when they're their uh
[56:16] withdrawal is effective um but
[56:19] Logan City's attorney and I have have
[56:20] said we'll keep that as a retroactive
[56:22] date to say this is when it started and
[56:24] we can start working on getting board members in place and
[56:28] having meetings.
[56:30] >> So so this interlocal agreement will in
[56:32] effect complete their withdrawal
[56:34] agreement. Like it'll take the place of
[56:36] the one they signed that was not valid.
[56:38] >> Yes, so
[56:39] >> This will do the same thing.
[56:41] >> So so they'll need to pass a resolution
[56:43] just saying actually we're not
[56:45] withdrawing um
[56:46] but this will replace this will be the
[56:49] agreement between the cities cuz cuz
[56:51] right now the the official agreement
[56:52] between the cities is still that 1993
[56:55] agreement. Um this is an amendment the
[56:57] first amendment to that agreement. But
[56:59] Logan City does need to go through the
[57:01] process of making it clear that they are
[57:03] not withdrawing.
[57:09] » Um I have I had one question too. On
[57:11] page one it says the parties intend that
[57:15] the airport authority continue the
[57:16] ownership and management of the airport
[57:19] as a distinct legal entity separate from
[57:21] the city from the county and city.
[57:24] So which It just says airport authority.
[57:27] Is that the the
[57:29] >> So the air So there's the airport
[57:31] authority, which is the legal entity.
[57:33] Then there's the airport authority board
[57:35] and the airport sponsor board are are
[57:38] part of the governance of the airport
[57:40] authority.
[57:41] So,
[57:43] I guess to to put it analogy
[57:45] >> boards is
[57:46] >> they're part of the airport authority.
[57:48] is an is it's
[57:50] almost to say the it's the county the
[57:53] county council and planning and zoning.
[57:55] They're two different
[57:57] um boards within or governing structures
[58:00] within this one legal entity.
[58:02] >> So, the airport authority will own and
[58:05] manage the airport separate from the
[58:07] county and the city.
[58:08] >> Yes, and that that is the status quo.
[58:10] That is what currently exists.
[58:12] >> And I think maybe to add to that like in
[58:15] the section about budgeting
[58:17] um on section six, I guess it's what
[58:20] would that be thir- 13? It's number 13
[58:23] but called section 10.
[58:25] Number six, it says the airport
[58:26] authority board shall establish and
[58:28] maintain an enterprise fund for airport
[58:30] operations and services that are
[58:32] financed primarily through user fees and
[58:34] other airport generated revenues.
[58:37] So, I think the objective is that they
[58:39] are a self-sustaining entity. Of course,
[58:42] there'll be a lot to untangle, you know,
[58:44] they'll
[58:45] have to take county property or
[58:49] vehicles or whatnot and will have to
[58:51] sell that to them, you know.
[58:54] So, it's under their ownership.
[58:56] Um
[58:57] but yeah, I think that's the that's the
[58:59] vision
[59:01] long-term.
[59:04] » Okay, what other questions does anyone
[59:06] have for Dane?
[59:10] » Yes.
[59:11] >> It just seemed I read in there this that
[59:14] they had meet once a year
[59:16] the
[59:17] support board.
[59:19] >> The the sponsor board
[59:21] >> Sorry, I couldn't think of the word.
[59:23] >> So,
[59:24] >> kind of
[59:26] I like a little closer would be better,
[59:28] but
[59:29] >> I think it was a minimum of once per
[59:30] year.
[59:30] >> It is, yeah.
[59:31] >> So, it's just setting the making sure
[59:33] they they meet at least once per year,
[59:34] but I
[59:35] and that
[59:37] that's going to be I mean, there'll be
[59:38] members of the council potentially um
[59:41] potentially
[59:42] three people will uh
[59:43] will be three people potentially you or
[59:45] Keegan or Sandy that's on there. So, you
[59:47] can you whoever's on there can advocate for we should meet more
[59:51] often than that.
[59:52] >> I think the minimum was again to use the
[59:54] analogy of a shareholder meeting. It'd
[59:56] be like you have to provide a prospectus
[59:59] once a year. Yeah.
[1:00:02] >> I just like to compliment everybody that
[1:00:04] worked on it cuz I really liked it. I
[1:00:07] thought it was well put together and
[1:00:09] every
[1:00:11] >> Good job.
[1:00:11] >> thing was included in it. Any like the
[1:00:14] dissolution and all of that. I I really
[1:00:17] like to compliment all of you guys that
[1:00:20] worked on it.
[1:00:22] >> It's
[1:00:22] >> It only took what? 13 O&P meetings?
[1:00:24] >> [laughter]
[1:00:26] >> Every every week.
[1:00:27] >> More O&P meetings for this than
[1:00:30] everything else we passed this year
[1:00:31] combined, so.
[1:00:32] But but thank you. I know a lot of
[1:00:34] people worked really hard to put this
[1:00:36] together and try to make our airport
[1:00:38] some
[1:00:40] >> And the progress was it was incremental
[1:00:42] and it was methodical as we developed
[1:00:45] through it. It I thought it was
[1:00:47] it's been kind of exciting to
[1:00:49] you know, to to be part of that and and
[1:00:50] bringing all that together. It's uh
[1:00:52] I can see some uh
[1:00:55] quite dynamic things happening now out
[1:00:57] there when the thumb gets pulled off and
[1:01:02] they're able to
[1:01:03] run it uh independently as a well,
[1:01:08] semi-independently and and like a a good
[1:01:10] business model would probably be created
[1:01:13] there.
[1:01:13] So.
[1:01:14] >> This will be the only county operated
[1:01:17] airport in Utah.
[1:01:19] All the The airports are
[1:01:21] sponsored and run by cities.
[1:01:24] >> Yeah.
[1:01:25] So, that's that's a
[1:01:27] that's
[1:01:28] kind of an interesting aspect that we've
[1:01:31] chosen to do it by county
[1:01:36] this valley.
[1:01:38] >> I mean new territory.
[1:01:40] >> Good.
[1:01:41] >> Okay. Um
[1:01:42] does anyone feel like they want to um
[1:01:45] suspend the rules and pass this? Do you
[1:01:47] want to wait a couple It's a resolution.
[1:01:49] We don't have to suspend the rules. Do
[1:01:50] you want to pass it or do you want to
[1:01:51] wait?
[1:01:52] >> I I just want to say one more thing,
[1:01:53] too. This um um this isn't a hill I'm
[1:01:56] going to die on, but I just want to
[1:01:57] mention that Dr. Jones did specifically
[1:02:00] recommend in the report not to have
[1:02:01] elected officials on the Airport
[1:02:04] Authority Board, and
[1:02:06] we do have one. It's one of seven, but
[1:02:10] um as um Mr. Murray mentioned,
[1:02:13] there was some deviation from the
[1:02:14] recommendation, and that was probably
[1:02:16] the most glaring example of that.
[1:02:22] » So, what was his reasoning for not
[1:02:25] >> Uh cuz well, I mean, just to be blunt,
[1:02:28] cuz politicians often don't know about
[1:02:31] engineering challenges or aviation or
[1:02:34] aeronautical issues, and sometimes
[1:02:36] they're influent they're influenced by
[1:02:37] other factors that may not be in the
[1:02:39] best interest of
[1:02:42] >> You mean like self-interest?
[1:02:45] >> That's could be one of them. Um
[1:02:47] but yeah, we're uh
[1:02:50] we're a potentially a Airport Authority
[1:02:52] Board that doesn't have
[1:02:54] a an elected person could just focus on
[1:02:56] the economic impact.
[1:02:59] >> Well, I think having an elected person
[1:03:01] actually makes it better
[1:03:03] because you've got
[1:03:05] a representative of the people
[1:03:08] with skin in the game, kind of.
[1:03:10] >> Well, and keep in mind, we do have a
[1:03:11] sponsor board that appoints those
[1:03:13] people. We'll have three of us on on
[1:03:15] that oversees
[1:03:17] that, but yeah.
[1:03:18] >> Let me just respond to that by saying
[1:03:23] it it doesn't say which elected
[1:03:25] officials.
[1:03:26] And I think the critical thing is the
[1:03:29] sponsor board looks at the situation is
[1:03:32] to make sure that the person that we
[1:03:35] choose from amongst our elected
[1:03:37] officials
[1:03:38] is someone who has some skill apart from
[1:03:42] the ability to
[1:03:44] become a politician and get elected.
[1:03:47] We have a number of elected officials
[1:03:50] who have real skills that would be
[1:03:53] welcome on a
[1:03:54] board not because they're an elected
[1:03:56] official, but because they have other
[1:03:58] skills.
[1:04:00] For example,
[1:04:02] Matt Funk
[1:04:04] has a set of skills that any airport
[1:04:07] authority board would welcome having him
[1:04:10] on the board.
[1:04:12] But I do think it's wrong to appoint
[1:04:15] someone because they're an elected
[1:04:17] official. That's that's the distinction
[1:04:19] I'd make here.
[1:04:20] >> I agree.
[1:04:21] >> Uh
[1:04:22] And and I I acknowledge that that we have
[1:04:28] five or six elected officials. Surely we
[1:04:31] can find one of them that has skills
[1:04:35] that are appropriate for the airport
[1:04:37] authority board.
[1:04:39] And quite frankly, we can amend this if
[1:04:42] we decide later on that we don't like
[1:04:46] that.
[1:04:49] I think this is a
[1:04:51] transition period
[1:04:53] where we've never had this operate this
[1:04:56] way. We do need to keep our thumb on it
[1:04:59] a little bit. I know we want to take our
[1:05:01] thumb off, but I think
[1:05:05] we need to make sure this is going to
[1:05:06] work and work how we intend it to work
[1:05:09] before we completely unleash controls on
[1:05:12] it.
[1:05:13] So.
[1:05:16] » But there's only one thumb.
[1:05:19] >> And there has been two and that's that's
[1:05:20] kind of created some inefficiencies.
[1:05:22] >> Only one thumb.
[1:05:24] >> Well, they would have Cash County, I
[1:05:26] mean
[1:05:27] it's it it's I think we're narrowing things down.
[1:05:31] >> We would like to sit down with the
[1:05:33] County Council and talk about the
[1:05:35] Airport Authority Board because
[1:05:38] um I I think the way it's set up,
[1:05:41] correct me if I'm wrong, Dave, is is the
[1:05:43] I'm going to nominate one of the elected
[1:05:46] officials. So, I'm the one that makes
[1:05:49] that decision which elected official
[1:05:51] goes there and which ones go on the
[1:05:54] sponsor board and I expect to get advice
[1:05:57] and consent from you with respect to
[1:06:00] that appointment.
[1:06:02] That comes from the county, not advice
[1:06:05] and consent from the sponsor board, but advice and
[1:06:09] consent from the county.
[1:06:12] >> And that is the language in the
[1:06:14] agreement to have it say advice and
[1:06:15] consent.
[1:06:16] And I'll go on the record saying I agree
[1:06:18] with the executive that it is possible
[1:06:20] for a politician to have real-world
[1:06:22] skills.
[1:06:24] >> You're
[1:06:25] really
[1:06:28] » Okay. All right, so does someone want to
[1:06:30] make a motion about this or do you want
[1:06:31] to keep studying it?
[1:06:33] >> I would move to approve resolution
[1:06:34] 2026-23
[1:06:36] approving the amendment number one to
[1:06:38] the
[1:06:39] Logan Cache Airport Authority low
[1:06:41] interlocal agreement.
[1:06:44] >> Second.
[1:06:45] >> It's been moved and seconded that we
[1:06:46] approve resolution 2026-23.
[1:06:49] Is there any further discussion?
[1:06:52] Those in favor say I.
[1:06:53] >> I.
[1:06:54] >> Any opposed?
[1:06:56] Okay.
[1:06:57] All right, um so our
[1:07:00] Class B road is still pending.
[1:07:04] Um okay.
[1:07:06] Other business.
[1:07:09] Schedule council meeting to canvass the
[1:07:11] June 2023rd primary election results.
[1:07:13] What is the time frame on that, Andrew?
[1:07:16] >> Yes, so the county clerk spoke to me and
[1:07:18] I believe he [clears throat] would like
[1:07:20] one
[1:07:22] I believe a special meeting the first
[1:07:24] week in July to
[1:07:27] essentially canvass the primary election
[1:07:29] results
[1:07:33] » Next week?
[1:07:35] Yeah, that would be Yep, that would be
[1:07:37] next week.
[1:07:40] >> I mean the the first full week. Perhaps
[1:07:43] the 6th or the 7th.
[1:07:45] >> Oh, okay.
[1:07:50] » Why couldn't you just do it at the next
[1:07:52] regular council meeting?
[1:07:54] >> I think that's too long.
[1:07:55] >> I believe the county clerk needs to
[1:07:57] >> so many days, right?
[1:07:58] >> I believe so.
[1:07:59] >> So many days after the election you have
[1:08:01] >> Like is it What is it? 14 days after the
[1:08:03] election? I don't know.
[1:08:06] >> Well, I wish our county clerk were here
[1:08:07] to answer that.
[1:08:08] >> Yeah, I don't remember the number, but
[1:08:09] >> busy.
[1:08:09] >> Yes, he is.
[1:08:12] Yeah.
[1:08:13] there is a
[1:08:14] >> You guys want to do Okay, tell Look at
[1:08:16] your calendars. We could do like June
[1:08:19] 30th. We could do it next week on
[1:08:21] Tuesday night, or we could wait till the
[1:08:23] following week and do If we stick with
[1:08:25] Tuesday, it would be July 7th.
[1:08:28] >> It doesn't have to be an evening. It can
[1:08:30] be anytime.
[1:08:32] >> Yes, in the middle of the day.
[1:08:33] >> And we just need a quorum and it'll take
[1:08:35] >> Get a quorum.
[1:08:36] >> Yeah.
[1:08:36] it's usually Yeah.
[1:08:37] >> Yeah, let's do June 30th.
[1:08:39] >> Pretty cute.
[1:08:41] >> Um
[1:08:42] >> So so it needs to be no less than 7 days
[1:08:44] from when the election ends and no later
[1:08:47] than 14 days.
[1:08:48] >> Okay, so no less. So June 30th would be
[1:08:51] no less than
[1:08:58] » But June 30th is uh
[1:09:01] >> after the day of the election,
[1:09:03] >> A
[1:09:03] >> June 30th would work.
[1:09:05] >> A June 30th would work then.
[1:09:06] Do we count?
[1:09:08] >> And what time would if we met like at
[1:09:10] 1:00?
[1:09:12] >> So so seven calendar days after the day
[1:09:14] of the election.
[1:09:15] >> Yeah. Oh, calendar days.
[1:09:16] >> Calendar days.
[1:09:17] >> So Wednesday would be the same
[1:09:18] >> So Wednesday.
[1:09:19] >> Wednesday, July 1st.
[1:09:22] >> At noon?
[1:09:24] >> Oh.
[1:09:26] no, I can't come at noon.
[1:09:27] But you can Mike form a quorum without
[1:09:29] me. Quorum without me.
[1:09:31] >> I probably can't either.
[1:09:33] >> I don't think you have to.
[1:09:35] >> Could form I could
[1:09:36] >> True.
[1:09:39] How many
[1:09:39] >> Can I participate electronically?
[1:09:40] >> Just a couple. Two or three is required.
[1:09:42] You have to have a quorum.
[1:09:43] >> Four we'd have to have four of us here.
[1:09:45] >> Oops.
[1:09:46] >> How about at 3:00 on Wednesday, July
[1:09:48] 1st?
[1:09:50] Would that work better for you?
[1:09:52] >> Busy until
[1:09:54] 4:00.
[1:09:56] on Wednesday, July 1st. Would that
[1:09:58] work for everybody for a 15-minute
[1:10:00] meeting?
[1:10:02] >> Yeah, I can.
[1:10:03] >> Probably.
[1:10:07] » So we'll say 3:00 or 4:00.
[1:10:10] >> Let's do 4:00.
[1:10:11] >> Okay.
[1:10:12] >> Um
[1:10:14] The canvass meeting.
[1:10:18] To to accept that. That's what it's
[1:10:19] called, right?
[1:10:20] >> Yeah.
[1:10:22] >> You just send out a reminder.
[1:10:24] >> Yes.
[1:10:27] Okay.
[1:10:28] For those and if you can't be there,
[1:10:29] make sure and let Andrew know right away
[1:10:31] so we'll make sure we have a quorum.
[1:10:33] All right. Um the USAT conference
[1:10:36] tomorrow, I think um Joanne and Dave and
[1:10:38] I are going to go down and Andrew
[1:10:41] to to the um meeting about the
[1:10:45] data centers.
[1:10:46] >> However, we did learn today that they
[1:10:48] will send a link in the morning for
[1:10:50] those of us that
[1:10:51] >> They wanted to make sure they had enough
[1:10:52] people in person so they didn't announce
[1:10:54] that there was going going a link, but
[1:10:55] there will be a link that they send out
[1:10:57] first thing in the morning.
[1:10:58] >> Do they have an agenda so we could jump
[1:11:00] in at certain points or is it
[1:11:02] >> I would think so and it it'll probably
[1:11:03] be attached to the link.
[1:11:04] >> to the link.
[1:11:05] >> I'd be interested in that.
[1:11:07] >> And then on the very next day is the UAC
[1:11:09] Justice Summit. Again, Andrew and I and
[1:11:12] Sheriff Jensen and Dane are going to go
[1:11:13] down to that so that we can
[1:11:14] >> Thank you for going.
[1:11:16] >> I got registered.
[1:11:17] >> Okay. So, we're going to do that and
[1:11:19] learn about the criminal justice
[1:11:21] coordinator or criminal justice
[1:11:22] coordinating council.
[1:11:24] >> Thank you for representing us.
[1:11:25] >> Okay. The Hyrum and Lewiston independent
[1:11:27] day parades. I'm really excited. We have
[1:11:30] a horse-drawn
[1:11:33] wagon
[1:11:34] for Hyrum and for Lewiston.
[1:11:37] And we have some wonderful decorations.
[1:11:40] And we're going to invite all county
[1:11:43] employees to join us and I need to write
[1:11:45] something up and get it to Janine so she
[1:11:46] can put that out there that anybody who
[1:11:48] works for the county can join us in
[1:11:49] either one of those parades.
[1:11:50] >> for Lewiston's is 9:00.
[1:11:52] >> Lewiston's parade is going to start at
[1:11:54] 9:00.
[1:11:54] >> Yes.
[1:11:55] >> Oh, wow.
[1:11:56] I'm rocking the boat.
[1:11:58] >> It's It's been like that for a few
[1:11:59] years.
[1:12:00] >> Oh, okay. Hyrum starts at 10:00.
[1:12:03] >> So, will the same thing be able to go to
[1:12:05] both?
[1:12:05] >> Um probably not.
[1:12:08] I don't think so. I don't No, no. It'll
[1:12:09] be We'll have two separate entries for
[1:12:11] that for that day.
[1:12:13] And so um I know I'm going to go to
[1:12:16] Hyrum with Katherine.
[1:12:18] Dave will be in Lewiston. I don't know
[1:12:20] how many else people are available. It'd
[1:12:22] be nice to have at least two council
[1:12:23] members at each one of these parades.
[1:12:25] >> I could go to Hyrum.
[1:12:26] I plan on probably going to Hyrum.
[1:12:29] >> Okay. We'll see if [clears throat] Mark
[1:12:30] can Mark went to Lewiston last year.
[1:12:32] >> So, at Hyrum, are we s-
[1:12:34] we sitting on the
[1:12:36] float and throwing candy because Hyrum
[1:12:38] Yeah, we have to walk.
[1:12:40] >> you have to walk if you want to throw
[1:12:40] candy. If you want to sit and wave,
[1:12:42] you're welcome to do that as well.
[1:12:44] >> Okay.
[1:12:44] >> They'll be
[1:12:45] >> Yeah, you have to walk to hand out
[1:12:47] candy.
[1:12:47] >> Yeah. You have to walk if you want to
[1:12:49] throw candy.
[1:12:50] Um I will purchase candy. I will take
[1:12:54] care of getting candy.
[1:12:57] >> You have to walk if you want to throw
[1:12:59] candy.
[1:12:59] >> Yeah, you can't throw candy from a
[1:13:00] moving vehicle. You have to be walking
[1:13:02] on the sides of the
[1:13:03] >> Yeah, no drive-by candy.
[1:13:05] >> They don't want people getting hurt.
[1:13:06] >> Kids are not smart, George.
[1:13:08] >> I will not agree to that.
[1:13:10] >> You know what? Kids Kids come out to get
[1:13:13] too close to the vehicles.
[1:13:14] >> Kids wrestle candy out of your hands,
[1:13:16] George.
[1:13:16] >> I know. I I've had
[1:13:18] >> Well, and maybe in Hyrum.
[1:13:20] >> Kids that come out they get too close to
[1:13:21] the
[1:13:21] >> Are they better
[1:13:22] >> Lewiston, but not Lewiston. They're
[1:13:24] respectful in Lewiston.
[1:13:25] >> That North Star is shining brightly
[1:13:27] above you right now, isn't it?
[1:13:29] >> I always throw the candy behind them.
[1:13:31] They like cuz they they get too close to
[1:13:33] the vehicles. I'm like, "Go over there
[1:13:34] and get your candy."
[1:13:36] >> [laughter]
[1:13:37] >> They love me.
[1:13:37] >> Yeah.
[1:13:38] >> Hey.
[1:13:38] I'm a mom, too. I do the same
[1:13:40] thing.
[1:13:40] >> Okay, Hyde Park Hometown parade is on
[1:13:44] July 18th, North Logan.
[1:13:46] Um, we've got two July 24th parades.
[1:13:49] >> They're at the same time?
[1:13:51] >> Yep, they're doing it at the exact same
[1:13:52] time. So again, we'll need to split. And
[1:13:54] I have two banners that we've made for
[1:13:57] these two different parades that we can
[1:13:58] use. We'll use them over and over again
[1:14:00] for years to come.
[1:14:02] Um,
[1:14:03] so that'll be fun. So, everybody has to
[1:14:05] decide where they're going to go on
[1:14:07] Pioneer Day or if you're even available.
[1:14:09] Let Andrew know. And are we registered
[1:14:11] for those all parades?
[1:14:12] >> Uh, at least for July 4th. I I was
[1:14:15] waiting to hear back from Mark, I
[1:14:16] believe, on July 18th for the Hyde Park
[1:14:18] Hometown Days parade.
[1:14:20] >> Is there anybody who knows they can or I
[1:14:23] know that I cannot be there on the 18th.
[1:14:25] >> I cannot be there on the 18th.
[1:14:26] >> I have a family reunion that day.
[1:14:30] So,
[1:14:31] that Let Andrew know. It Look at it
[1:14:32] You're going to Look at your calendars
[1:14:34] for all three of those parades and let
[1:14:36] Andrew know. And if we have at least two
[1:14:37] people that want to go in the parade,
[1:14:39] we'll
[1:14:40] have a truck or something.
[1:14:43] Okay, council member reports. Dave, do
[1:14:45] you have anything to report?
[1:14:47] >> Uh
[1:14:48] the going too fast.
[1:14:51] There's a lot going on but uh
[1:14:52] >> Did you get your hay in?
[1:14:54] >> First crop.
[1:14:55] >> Okay.
[1:14:55] >> Start getting the second next week.
[1:14:58] Uh it's going down fast.
[1:15:00] The creek flows are are
[1:15:03] Logan River, you know, it's it's under
[1:15:05] 200 second feet right now. Flow it's dropping.
[1:15:08] >> That's the end of August.
[1:15:11] >> Yeah, we're over a month ahead ahead of
[1:15:14] schedule in the summer.
[1:15:17] and it's it's it's tough. It's going to
[1:15:20] be a it's going to be a lean year. Uh
[1:15:23] I think there is
[1:15:25] we do have some rains kind of La Niña or
[1:15:28] El Niño supposed to be kicking in
[1:15:29] bringing maybe some rains but
[1:15:31] often this time of year sometimes
[1:15:35] like was experienced in Cornish, there
[1:15:37] was a
[1:15:38] hailstorm out there that literally just
[1:15:41] wiped out wheat fields.
[1:15:44] I was just I was two or three kernels on
[1:15:47] stem and no leaves, nothing. It was it
[1:15:50] was bad so
[1:15:51] I don't know. We hope for the best but
[1:15:55] it's going to be a little bit a lot
[1:15:56] tougher this year. We all know it.
[1:16:00] other than that I've it's it'll it'll
[1:16:02] work out whatever
[1:16:03] happens if we will accept it.
[1:16:09] » Okay, Catherine.
[1:16:11] >> I have nothing.
[1:16:12] >> Do you want to give us an update on the
[1:16:13] fire board?
[1:16:15] >> It's
[1:16:16] still going.
[1:16:17] >> Exactly.
[1:16:17] >> [laughter]
[1:16:18] >> Okay, Nolan.
[1:16:20] >> Um not much. On Thursday, there's
[1:16:24] Kirk Bab and myself and some guys from
[1:16:26] planning and zoning going to meeting to
[1:16:27] see if we can work on the things which
[1:16:28] we've been assigned as far as the
[1:16:30] subdivision and that.
[1:16:32] So we're moving on that. I am very
[1:16:34] anxious to see that moving ahead because
[1:16:35] when you talk about water,
[1:16:37] I think we're going to be looking at
[1:16:39] water and wells this summer.
[1:16:41] >> Agreed.
[1:16:42] Keegan.
[1:16:43] >> Um I wasn't here for last meeting, but I
[1:16:45] saw the the two Cossack initial
[1:16:47] approvals, so um you know, there was an
[1:16:50] effort made a few months ago to go on
[1:16:52] the radio for someone I think Eric went
[1:16:54] on the radio and they sent out the
[1:16:56] mailer. I think the the efforts to
[1:16:59] promote the program
[1:17:00] were
[1:17:02] very minimal in cost, but I think that
[1:17:04] raised some awareness, so
[1:17:06] um might consider doing that again in
[1:17:08] the coming months.
[1:17:10] Um airport board, we just covered that,
[1:17:12] so I think that's a a good milestone. Um
[1:17:15] if you'd indulge me for a second, I just
[1:17:17] I want to talk about rec center
[1:17:19] and kind of where we're at with that and
[1:17:21] a proposal that I have.
[1:17:22] >> Okay.
[1:17:22] >> Is that all right? It'll just take a
[1:17:23] couple minutes.
[1:17:24] >> Absolutely.
[1:17:25] >> Um so there was a presentation last
[1:17:28] time. I I wasn't That was again, I
[1:17:30] wasn't in attendance, but I watched the
[1:17:32] video and
[1:17:33] um just to do a quick recap, there were
[1:17:36] three proposals um put forth, which was
[1:17:40] potentially one rec center um in a
[1:17:43] central location, two, a north and
[1:17:45] south, or three, a north, a Logan, and a
[1:17:48] south. And I don't want to speak for the
[1:17:50] council, but it seems like nobody was
[1:17:53] interested in doing three.
[1:17:56] That
[1:17:58] Okay. So, I think maybe one or two were
[1:18:00] entertaining, but we have VCBO that I
[1:18:03] think
[1:18:04] is somewhat confused on
[1:18:07] um the guidance that's coming from this
[1:18:10] I I guess we're calling it a
[1:18:13] advisory board?
[1:18:14] >> Steering committee.
[1:18:16] Um from what I understand, the steering
[1:18:18] committee um was never officially
[1:18:20] appointed by either the executive or the
[1:18:22] council. I think they were a
[1:18:24] self-forming. This is not a criticism of
[1:18:26] them because I think they took it upon
[1:18:28] themselves to study issues and but I
[1:18:30] think it it'd be
[1:18:32] it causes some confusion for the for
[1:18:34] VCBO because we approved the
[1:18:38] uh RAP tax money to fund that, but
[1:18:40] they're looking for direction from a
[1:18:42] board that isn't actually appointed by
[1:18:44] us. And I don't know that it the
[1:18:46] representation is geographically
[1:18:49] equitable, either. I think sometimes one
[1:18:51] city might bring more people to it, and
[1:18:53] so it it gives the appearance that maybe
[1:18:56] there's more support because for for one
[1:18:58] idea because there's more members from
[1:19:00] that city there.
[1:19:02] So, um I guess just to cut to the chase,
[1:19:04] my proposal would be that we look at
[1:19:06] that board and and officially appoint
[1:19:09] members. Um maybe it's a seven-member
[1:19:12] board that has more equal geographic
[1:19:15] representation, and it it could also
[1:19:18] have many of the members that are on it
[1:19:19] now. But I think that would help VCBO
[1:19:22] understand that, okay, this is a
[1:19:24] county-sanctioned
[1:19:26] um board, and they're advising. Um and I
[1:19:30] would also recommend that there be
[1:19:32] probably two of us on that board.
[1:19:37] I'll say one more thing about this, and
[1:19:38] that is
[1:19:40] I think there's interest in getting this
[1:19:42] on the ballot to let the public decide
[1:19:45] um if they want to fund it, because it
[1:19:47] would need to be bonded. But I think if
[1:19:50] we want to do that, put our best foot
[1:19:52] forward in that, I think we need to have
[1:19:53] a clear vision of how it's how much it's
[1:19:55] going to cost. Nolan brought up a good
[1:19:57] point that I saw on the video, which was
[1:20:00] people need to be able to take into
[1:20:01] consideration what's happening with the
[1:20:03] school board, what's happening with the
[1:20:04] fire board, so they're going in eyes
[1:20:05] wide open of how how much costs are
[1:20:08] going to affect them. And I think Mark
[1:20:10] made an excellent point of if we don't
[1:20:13] give people a clear vision of what's
[1:20:14] going to happen, then if it's voted
[1:20:16] down, that could be used for the next 20
[1:20:18] years as people just don't like rec
[1:20:20] centers, but that's probably not an
[1:20:22] accurate representation of the public's
[1:20:24] wishes.
[1:20:26] So, my proposal would be that maybe next
[1:20:28] meeting uh Andrew works with me to put
[1:20:31] together the language of what that board
[1:20:33] would look like and maybe in a following
[1:20:35] meeting we start talking about what
[1:20:37] members would be on it. And then we give
[1:20:39] them, let's say, 6 months to make a
[1:20:41] recommendation on a location and maybe
[1:20:43] how it should be managed. Those could be
[1:20:46] some of the topics that that are
[1:20:47] discussed.
[1:20:48] But we can get into that later, but
[1:20:51] that's what I would like to see happen.
[1:20:53] So, and then potentially we look at
[1:20:55] getting this on the 2028
[1:20:58] ballot during the presidential election.
[1:21:01] >> Um just so you know, Keegan, I I've been
[1:21:04] to every steering committee meeting
[1:21:05] except one, I think.
[1:21:08] And um I think we're way beyond
[1:21:10] appointing a board and I think they the
[1:21:12] people that have been
[1:21:14] working with BCBO, BCBO has a present
[1:21:18] has a proposal ready for for two
[1:21:21] locations. They're they've already got
[1:21:23] They've already scouted out the exact
[1:21:25] locations and what they would cost.
[1:21:26] They're ready to give a cost proposal
[1:21:29] and bring something to that that
[1:21:31] committee's ready to bring something to
[1:21:32] us as a council to say, "Would you vote
[1:21:35] to put this on the ballot?" And I and I
[1:21:37] think they're I think they're ready to
[1:21:39] do that. I don't think there's an
[1:21:41] appetite amongst the people there to go
[1:21:43] back to the beginning and and appoint a
[1:21:46] new board
[1:21:47] um and wait until 2028. I think by 2028
[1:21:50] they'll they will have all done
[1:21:51] something different, which might be the
[1:21:53] answer.
[1:21:54] But um
[1:21:55] just just so you know that like I I've been to those meetings. I spoke to
[1:22:00] Whitney after the last meeting. They're
[1:22:02] ready to bring us a proposal with actual
[1:22:05] costs that can go to the voters.
[1:22:07] And um
[1:22:09] I think the committee is ready
[1:22:11] pretty There's never been a consensus on
[1:22:13] that committee ever on that steering
[1:22:15] committee, but there's been generally
[1:22:18] at the last meeting the last one of the
[1:22:20] last comments that was made was, "Well,
[1:22:22] the council just needs to take charge of
[1:22:24] this and make it happen." Like the
[1:22:25] council approved the study the money for
[1:22:29] a study for this group that wanted to
[1:22:31] study it and I don't know that
[1:22:35] we ever as a council said, "Yes, we
[1:22:37] would like to have
[1:22:39] county-wide recreation." Like, that was
[1:22:41] not a vote we took. We vote to say,
[1:22:43] "Yes, go ahead and study it. If you
[1:22:44] bring us a proposal and if the people
[1:22:47] want it, then we'll support it." But But
[1:22:49] I think they're ready for something to
[1:22:50] go on the ballot in '26. I really do.
[1:22:53] >> So, I watched the video and from what I
[1:22:55] understand
[1:22:56] >> the When Whitney proposed to us
[1:22:58] >> Yeah, from 3 weeks ago and what I
[1:22:59] thought you had said was
[1:23:02] we need time to inform the public on
[1:23:04] maybe what this looks like, you know,
[1:23:07] maybe renderings of the
[1:23:10] >> That was
[1:23:10] >> potentially what the facility could look
[1:23:12] like and quite frankly, I don't think
[1:23:14] November is enough time to do that. So,
[1:23:16] >> That
[1:23:17] >> I wouldn't support putting something on
[1:23:18] the ballot that quickly because I don't
[1:23:20] think it gives the public enough time to
[1:23:23] make an informed decision.
[1:23:25] >> It'll be good.
[1:23:25] >> And to And to take into the
[1:23:26] consideration the things Nolan
[1:23:28] mentioned.
[1:23:29] >> There's a
[1:23:30] fundamental issue that that really
[1:23:32] doesn't get addressed, Sandy, and that is
[1:23:36] what what the fundamental
[1:23:39] discussion as I understand it is
[1:23:41] the county would bond to build these
[1:23:45] things.
[1:23:47] But then they're operated by the cities.
[1:23:51] >> The county would have to have an
[1:23:53] interlocal or an MOU kind of a contract
[1:23:56] with whoever runs them.
[1:23:57] >> and and just how will you enforce that
[1:23:59] contract?
[1:24:00] >> Yeah.
[1:24:01] >> I mean, I just fundamentally
[1:24:03] somebody's got to convince me that one
[1:24:06] person owning it and another person
[1:24:09] running it makes sense. I can tell you
[1:24:11] one thing and that is if
[1:24:14] our county government is not capable of
[1:24:18] taking on the 50 to 100 employees that
[1:24:21] would be needed to run three centers. We can't [snorts] do it.
[1:24:26] We we don't have the structure or the
[1:24:29] capability to do that.
[1:24:31] So, you're dependent on building
[1:24:34] expensive facilities
[1:24:36] and having
[1:24:38] And and nobody talks about how much
[1:24:41] money it talks takes to run these. And
[1:24:44] when they do their projections, they
[1:24:45] talk about these dollars and those
[1:24:48] dollars. Well, if those dollars and
[1:24:50] these dollars don't come in, who's on
[1:24:52] the hook for three
[1:24:55] centers? I just have to tell you,
[1:24:58] somebody needs to get realistic about
[1:25:00] what a recreation center finances look
[1:25:03] like.
[1:25:04] And Patty, I I just don't see it yet.
[1:25:07] >> I
[1:25:08] George, I am totally in agreement with
[1:25:10] what you're saying. I'm just saying this
[1:25:12] group that has been meeting, they were
[1:25:14] they put themselves together, made their
[1:25:16] own steering committee, and they've been
[1:25:18] meeting for a year and a half. They they
[1:25:20] took the money that we approved for the
[1:25:21] study, and they've been listening to
[1:25:23] VCBO. VCBO has drawings, they have
[1:25:26] contract contractor costs. They could
[1:25:29] give us everything needed to put on a
[1:25:32] ballot.
[1:25:33] If that's what we decided that we wanted
[1:25:36] to do. But as far as going back and
[1:25:37] doing a new port
[1:25:39] >> Show me a city that will sign on
[1:25:43] being responsible to us to pay the
[1:25:47] payments due on a bond on a recreation
[1:25:50] center. Show me a city that will sign
[1:25:52] their name to that.
[1:25:55] >> Yeah,
[1:25:56] I just I just think to put an interlocal
[1:25:58] agreement I mean cuz realistically you'd
[1:26:00] have to figure it out by August to get
[1:26:02] it on the November ballot in my opinion.
[1:26:04] So So, we don't even have consisten-
[1:26:06] con- consensus here if we would support
[1:26:09] one or two. So, that I mean that's the
[1:26:10] absolute lowest baseline and
[1:26:13] >> I'll be real frank with you.
[1:26:15] Consistency support one or two sounds
[1:26:18] like one or two.
[1:26:20] There There's a whole lot of
[1:26:22] people who say zero sounds a lot better
[1:26:24] than one or two.
[1:26:25] >> Sure.
[1:26:26] >> And And frankly, until somebody's
[1:26:30] I mean, North Logan keeps saying, "Why
[1:26:32] can't the county ever get anything
[1:26:34] done?"
[1:26:35] Well,
[1:26:36] we're going to build it and you're going
[1:26:38] to operate it. And we're on the hook for
[1:26:40] the money and you can walk. So, well,
[1:26:43] we'll sign an interlocal agreement. Have
[1:26:45] you ever thought about what it really
[1:26:46] means to enforce an interlocal agreement
[1:26:48] with a city that doesn't want to pay?
[1:26:51] >> Yeah, and
[1:26:51] >> How How do you do that? Do you get a
[1:26:54] judgment against them and go seize a
[1:26:56] fire engine that we own or do you What do What do you actually do
[1:27:02] >> And and
[1:27:02] >> to make them pay?
[1:27:04] >> And can we put a an agreement like that
[1:27:05] together in
[1:27:07] a month and a half? I just There's no way. So, I
[1:27:11] >> There There is only one way to do it and
[1:27:14] that is
[1:27:15] to have them be responsible on the bond.
[1:27:19] >> And build it.
[1:27:19] >> And I haven't heard any of them lined up
[1:27:22] to say we'll put our name on the bond.
[1:27:25] >> Well, in fact, there's several cities
[1:27:26] who already support a robust recreation
[1:27:29] program
[1:27:29] >> Oh, they're They're supporting
[1:27:31] you putting your name on the bond. I I I
[1:27:35] tell you there's great support for that
[1:27:37] idea.
[1:27:38] >> And I'm not pushing and have never
[1:27:39] pushed for a county-wide recreation
[1:27:41] program. I'm just saying where that
[1:27:44] committee is, if you start to ask them
[1:27:46] to back up and let's appoint somebody,
[1:27:49] there it's There's no way.
[1:27:50] >> we What can we offer them, Sandy? I
[1:27:52] mean, what benefit having the county
[1:27:55] involved in this is there?
[1:27:57] Why Why is that a good idea?
[1:27:59] >> There's More people More people pay for
[1:28:01] it.
[1:28:02] >> Yeah.
[1:28:02] >> Oh, well.
[1:28:03] That's
[1:28:04] >> Yes.
[1:28:04] >> What do you know, then?
[1:28:05] >> Yeah.
[1:28:06] >> It's the golden rule
[1:28:07] of paying for it.
[1:28:09] >> But nobody uses it.
[1:28:09] >> I think that's I think that's one way to look at it,
[1:28:13] but another way is like why would you
[1:28:15] establish a county library system? Why
[1:28:18] would you establish a countywide waste
[1:28:21] management system? Why? Well, for
[1:28:24] efficiency and economy of scale and
[1:28:27] because
[1:28:28] most people don't even know where the
[1:28:29] boundaries of a city I ran for Logan
[1:28:32] City Council and I still don't know the
[1:28:33] exact notches where North Logan starts
[1:28:37] and Logan ends. Like the average person
[1:28:40] doesn't know, "Okay, I'm leaving Logan.
[1:28:42] Now I'm entering North Logan." No, they
[1:28:43] just look at here's a rec center in the
[1:28:45] county that benefits all of us and
[1:28:47] there's a lot of people who do want that
[1:28:49] as made manifest by the study that's
[1:28:52] been done in the questionnaire that's
[1:28:53] been done. So, I'm saying if we're
[1:28:54] trying to be good stewards and represent
[1:28:56] our people who want something, let's
[1:28:59] give it the best shot and say, "If you
[1:29:01] want it, here's how much it would cost,
[1:29:03] here's where it would go." Here and I
[1:29:04] really I think it's only realistic to
[1:29:06] have one. I'll just go on the record
[1:29:08] saying that. So, I think even if it's a
[1:29:10] hypothetical exercise of saying, "Look,
[1:29:12] board, you get one rec center, you get
[1:29:14] $50 million. If you want water slides,
[1:29:17] if you want that, figure out what you
[1:29:19] want. Let's put it together. Let's show
[1:29:20] people pictures of it. Let's explain
[1:29:23] what all the all the other taxes they're
[1:29:24] paying. Let's talk about how much it's
[1:29:27] going to cost to maintain and you can go
[1:29:29] in eyes wide open with this is what you
[1:29:32] want and this is how much you pay." I
[1:29:33] think we owe it to our population to do
[1:29:36] that and that's what I'm saying and I'm
[1:29:38] saying I don't think it's realistic to
[1:29:40] do that in 2 months. So, if if we
[1:29:42] appoint people and they want to reject
[1:29:43] that appointment cuz they're so fed up
[1:29:45] on they're done with it or if Nibley
[1:29:47] wants to say, "I'm going to just I know
[1:29:49] they have a what, annual budget of $2
[1:29:51] million and for example, the the North
[1:29:54] Logan soccer facility is 70,000 square
[1:29:57] foot and cost $6 million 10 years ago.
[1:30:00] If they with their $2 million budget
[1:30:02] want to say, "We're going to build
[1:30:03] something." They can build a $10,000
[1:30:06] facility and they can move forward on
[1:30:08] that if if that's their prerogative, but
[1:30:10] I don't think we put our best foot
[1:30:11] forward. I don't think we've had
[1:30:14] equitable geographic representation. So,
[1:30:16] I'm saying is let's give that a fair
[1:30:17] shake and if people don't want to do
[1:30:19] that, that's fine, but I am saying this
[1:30:22] is how I would approach it and I'm
[1:30:23] putting that proposal forward so we
[1:30:25] actually are moving forward.
[1:30:26] >> I think with a plan the idea to study it
[1:30:29] is a great idea.
[1:30:33] » And if we put it to a vote, all we've
[1:30:34] done is considered frustration because
[1:30:37] we haven't come down to what you said,
[1:30:38] who's responsible, who's running.
[1:30:40] >> We have to figure that out.
[1:30:41] >> If I can speak up,
[1:30:43] cuz I I see
[1:30:44] >> Be careful, aren't you running for
[1:30:46] election?
[1:30:46] >> Well, there'll only be a little bit of
[1:30:47] time.
[1:30:49] >> That's That's George speaking shut up.
[1:30:51] >> No campaigning here.
[1:30:54] >> If it wasn't for citizens
[1:30:56] >> I I'm I'm kind of where George is at is
[1:30:59] one, there's a lot of legal questions
[1:31:01] here. So, we're talking about interlocal
[1:31:02] agreements and I I don't know
[1:31:06] enforce that. Like George said, I think
[1:31:07] that has to be part of
[1:31:09] what's being voted on.
[1:31:11] >> Caesar's city offices.
[1:31:13] >> But but I think a lot of the issues that
[1:31:16] we've been dealing with in the county
[1:31:17] over the last
[1:31:19] 10 years while while I've been here
[1:31:21] are where we've kind of the county has
[1:31:23] taken the lead on something and then
[1:31:25] kind of gets stuck holding the bag. And
[1:31:28] then people it's a convenient place for
[1:31:30] people to point fingers and say, oh,
[1:31:33] look, the county's dysfunctional. But
[1:31:35] really we're trying to hold things together that were put on
[1:31:39] the county that really shouldn't have
[1:31:40] been there in the first place and
[1:31:41] responsibilities that aren't there. And so, I think we
[1:31:45] need to take this slow and make sure
[1:31:46] that if the county is taking this on, we
[1:31:50] have
[1:31:51] everything in place that [clears throat]
[1:31:52] we're not going to be stuck with
[1:31:54] a $100 million
[1:31:56] bond
[1:31:57] and then operating costs in perpetuity
[1:32:00] for a building that's just sitting
[1:32:02] vacant because we can't afford to run
[1:32:03] it.
[1:32:04] >> I think
[1:32:07] No,
[1:32:09] Keegan,
[1:32:10] I'm I would your hand, I don't have any
[1:32:12] objection to studying the issue, but I
[1:32:16] my vision for the county is to try and
[1:32:19] take
[1:32:20] selected things and do them well.
[1:32:24] And the airport is a huge responsibility
[1:32:28] that we've taken and and it's it's a
[1:32:32] it's an opportunity with
[1:32:34] blue ocean in front of it. It's wide
[1:32:37] open what we can do with that.
[1:32:41] if we spread ourselves and our energy
[1:32:44] too thinly, we won't get anything done.
[1:32:48] I I just
[1:32:50] from what you the capacity you have in
[1:32:54] our government is somewhat limited. We
[1:32:57] don't have a large staff contingent to
[1:33:00] do these things.
[1:33:03] if if you go over and and look at the
[1:33:05] cities,
[1:33:07] they're better staffed than we are at
[1:33:09] the county at doing a whole number of
[1:33:11] things.
[1:33:12] North Logan, for example, is better
[1:33:14] staffed
[1:33:16] and more capable of accomplishing a goal
[1:33:18] like this than we are.
[1:33:22] We we have broad responsibilities that we need to take care of. Anyway, I
[1:33:27] did I'm sorry to have taken up time.
[1:33:30] >> No.
[1:33:30] >> have one thing I'd like to do if you
[1:33:32] have 3 minutes.
[1:33:34] I meant to have Kurt talk a little bit
[1:33:37] about what we think should be done with
[1:33:40] subdivisions and and as
[1:33:43] a study that we'd like to to do. Do you
[1:33:47] have 5 minutes to listen to that before
[1:33:49] we go?
[1:33:49] >> Jo Ann still needs to do her report.
[1:33:52] >> Well, I have a question too about the
[1:33:54] steering committee.
[1:33:55] >> Okay.
[1:33:55] >> Before we leave the rec thing, how
[1:33:59] how's it made up geographically? Is it
[1:34:02] all one city or what?
[1:34:03] >> No, it was it was a few individuals who
[1:34:05] decided they wanted this study and they
[1:34:08] asked the county if we would fund the
[1:34:10] study and they said yes and they opened
[1:34:12] it up said anybody who wants to come be
[1:34:14] a part of steering committee can and it
[1:34:15] was mostly two cities that showed up to
[1:34:18] >> Which which two?
[1:34:19] >> Um North Logan and Nibley.
[1:34:21] >> Oh, okay.
[1:34:21] >> And Smithfield has been quite active
[1:34:23] just recently. Um
[1:34:25] I I was I just want to make clear I'm
[1:34:28] not advocating for to push this to put
[1:34:30] it on the ballot. I'm just saying the
[1:34:32] steering committee
[1:34:33] is uh
[1:34:36] pretty much to a point where they're
[1:34:39] I I just don't know. And and I I agree
[1:34:41] with what you're saying, Keegan. Like if
[1:34:43] we're going to do it and I don't know
[1:34:45] that we should do it.
[1:34:46] I think that the role of of county
[1:34:48] government and I've said this all along
[1:34:50] and every meeting I've ever been in, I'm
[1:34:52] here is to just listen and um
[1:34:57] if anything goes to the ballot, it has
[1:34:58] to be spelled out to the penny what it's
[1:35:00] going to cost people. And that was my
[1:35:03] contention all along is that whatever
[1:35:05] goes to the ballot, whenever it goes, it
[1:35:07] needs to be to the penny what it's going
[1:35:09] to cost so that people make an informed
[1:35:11] decision.
[1:35:12] And um
[1:35:15] I just I just think that they've
[1:35:17] they have never come to a consensus.
[1:35:19] You've been to those meetings. They
[1:35:20] There's never been a consensus. Well, if we choose one location, then the
[1:35:24] other people are going to vote no. If we
[1:35:25] choose two locations, Logan might vote
[1:35:27] no. It's it's kind of a mess and maybe
[1:35:31] I I feel like
[1:35:34] sometimes I feel like we as a county can
[1:35:36] do a better job of leadership in some
[1:35:39] ways. The economy of scale, fire and
[1:35:41] public safety, we should be making that
[1:35:44] a priority and and those are the kinds
[1:35:46] of things that that are very important
[1:35:49] to everyone to be to have public safety
[1:35:51] and fire safety.
[1:35:54] I don't know if this is in the realms of
[1:35:56] what we need to do as a I don't know if
[1:35:58] this is the one
[1:35:59] project to take on as a whole county at
[1:36:02] the time. So
[1:36:03] >> Well, we we funded $150,000 to study it. So I I
[1:36:08] sure hope we're not saying we shouldn't
[1:36:10] have done that in the first place.
[1:36:11] >> No, I think we absolutely did a good job
[1:36:13] of studying it. BCBO's done a great job
[1:36:15] and there's some really good information
[1:36:17] about the logistics and demographics and
[1:36:20] what it would cost and what the
[1:36:21] construction costs would be and what
[1:36:23] potential locations are. They've done a
[1:36:25] really good job and answered a lot of
[1:36:27] questions for the people that are really
[1:36:30] um pushing to to have that information.
[1:36:33] So I I I I think that the RAPS RAPS is
[1:36:36] supposed to be recreation arts parks and
[1:36:38] zoo. And so it is part of what RAPS is
[1:36:40] for and I think this absolutely was an
[1:36:42] appropriate use of RAPS money.
[1:36:44] >> Yeah, and I think that information And
[1:36:45] from what I understand, they're not the
[1:36:48] BCBO isn't saying, "Well, we've looked
[1:36:50] at it and you guys really don't need a
[1:36:51] rec center." I think they're saying
[1:36:53] like, "You
[1:36:54] I mean, they're saying you probably need
[1:36:55] three. I I don't agree with that
[1:36:57] personally. I don't think there's a
[1:36:58] financial appetite for that, but
[1:37:01] I do think it would be a shame if they
[1:37:02] said, "We recommend at least one." and
[1:37:04] we're like, "Cool, thanks. Take our
[1:37:06] money." and
[1:37:08] "See you." like
[1:37:10] I don't think our voters our people
[1:37:12] wanted that outcome.
[1:37:14] >> No.
[1:37:15] And and literally it comes the bottom
[1:37:16] line is it comes to this council to say,
[1:37:19] "We accept your proposal. We will put it
[1:37:22] on the ballot."
[1:37:22] >> Yeah, so I think it's an opportunity for
[1:37:24] us to lead out. And so let's be leaders
[1:37:27] and make decisions. And sometimes that
[1:37:29] means offending some people. We say it
[1:37:32] needs to go here. Other people will say,
[1:37:33] "That's we're driving too long." and but
[1:37:37] a decision needs to be made. So let's
[1:37:39] get closer to that.
[1:37:41] That's all I'm saying.
[1:37:42] >> Yeah, I agree. Okay, Joanne, did you
[1:37:44] want to give a council report before we
[1:37:47] move to Kurt.
[1:37:48] >> I just attended the cog meeting. They
[1:37:51] talked about how to do the application
[1:37:54] and the visitors bureau.
[1:37:57] They're doing good. You know, we've all
[1:37:59] seen it throughout the county through
[1:38:00] the summer. So
[1:38:02] >> When are the cog applications due?
[1:38:04] Do you know? Do you remember?
[1:38:05] >> I don't know.
[1:38:07] I think it's I think it's August like
[1:38:10] August 4th.
[1:38:11] >> Okay.
[1:38:12] >> Seems like.
[1:38:13] >> I think they come to us in October. So
[1:38:15] Okay. Now, let me ask
[1:38:17] >> I'm sorry. I I have to just jump in
[1:38:20] ahead of Kurt. I just got a text from
[1:38:22] Bryson saying that we need to schedule a
[1:38:24] canvas either on the 6th or the 7th
[1:38:27] because the cure letters that they're
[1:38:29] sending have a deadline of the 3rd.
[1:38:31] >> Oh.
[1:38:31] >> Okay.
[1:38:33] >> That was a good thing to know. The 6th
[1:38:35] or the 7th?
[1:38:36] >> Yes.
[1:38:39] » Okay.
[1:38:42] The 6th would be much better for me.
[1:38:45] >> Same.
[1:38:45] >> Saturday or Monday?
[1:38:46] >> Yeah.
[1:38:47] Can we do that? Monday afternoon?
[1:38:51] Do you still want to say 4:00 or would
[1:38:52] mornings or noon be better? What works
[1:38:54] for everybody most?
[1:38:56] >> Afternoon's better for me.
[1:38:58] >> 5:00 is better for me.
[1:38:59] >> Same.
[1:39:01] >> Okay. 4:00?
[1:39:03] Is 4:00
[1:39:03] >> 5:00 if we can.
[1:39:04] >> 5:00 is better.
[1:39:05] >> We say 5:00. Does that work for
[1:39:07] everybody?
[1:39:08] On a Monday?
[1:39:09] >> If it's a 15-minute, that's fine.
[1:39:11] >> Okay.
[1:39:12] >> Last one didn't take very long. So
[1:39:14] >> Yeah, they haven't. I think I have it
[1:39:16] the record. Yeah, I think it was
[1:39:18] 2 and 1/2 minutes.
[1:39:20] >> Mhm.
[1:39:20] >> Okay.
[1:39:21] So, the 6th.
[1:39:23] Okay, thanks, Dean. And now, I I know I
[1:39:25] want to hear from Kurt cuz we had an
[1:39:27] interesting conversation earlier. But
[1:39:29] because it's not on the agenda, is that
[1:39:31] are we okay to just let him tell us what
[1:39:33] he's
[1:39:35] >> I would
[1:39:36] suggest amending the agenda for another
[1:39:38] item of business.
[1:39:40] >> Okay.
[1:39:41] All right. Somebody want to make a that
[1:39:43] we amend the agenda for another item of
[1:39:44] business.
[1:39:46] >> I'll make the motion.
[1:39:49] >> Anyone second?
[1:39:49] >> Second.
[1:39:50] >> Okay, so it's been moved and seconded
[1:39:51] that we amend the agenda and add another
[1:39:52] item of business.
[1:39:53] >> What what is the item of business?
[1:39:54] Should we state what it is?
[1:39:56] >> To discuss
[1:39:57] >> It's not really It's not
[1:39:59] Point of order here. It's It's I I had
[1:40:02] it in my list to bring it up and I
[1:40:04] didn't get to it. I was racing around
[1:40:07] trying to find a plaque.
[1:40:10] >> Jordyn gave it to me. Sorry.
[1:40:11] >> So she Part of the Finally ran into Part
[1:40:13] of the executive's report?
[1:40:14] >> Where is it? It was here. It's I gave it
[1:40:17] to Sandy.
[1:40:18] Okay. But that's why I
[1:40:21] >> Okay.
[1:40:22] >> actually part of my report of county
[1:40:24] executive that didn't get done.
[1:40:27] >> Okay.
[1:40:28] >> I want to draw the motion.
[1:40:29] >> Okay. I I think we're fine. Go ahead,
[1:40:31] Kurt. Please. Yep.
[1:40:33] >> All right. How many minutes?
[1:40:35] >> Hm?
[1:40:36] >> He said three.
[1:40:37] >> Three and five.
[1:40:39] But
[1:40:40] >> Ready, set, go.
[1:40:41] >> Deputy County Executive
[1:40:43] Potter Mountain, you got the memo on
[1:40:44] that. I don't have all of the agreements
[1:40:47] yet. I'm a little frustrated I don't
[1:40:48] have them, but they are pending. We'll
[1:40:50] have them to you as soon as we can. So,
[1:40:52] agreements
[1:40:54] We've come to those agreements. They
[1:40:55] just need to be more memorialized in
[1:40:57] writing. We'll get them to you as soon
[1:40:59] as we can.
[1:41:00] On subdivision issue, for the last
[1:41:02] month, we have about 25 or 30 hours
[1:41:05] invested in just meeting with
[1:41:06] individuals and small groups to get
[1:41:08] ideas about what they're doing in other
[1:41:09] counties or how how subdivision
[1:41:12] ordinances affect them, and just
[1:41:15] It It may result in nothing,
[1:41:17] but at least we're getting in-depth uh
[1:41:22] viewpoints from people who are involved
[1:41:25] in the development business and in the growth and we've had We spent
[1:41:30] time with Jordan. We took him to lunch
[1:41:32] and and got a lot of good information
[1:41:34] out of him. That's the kind of
[1:41:36] interviews that we're doing.
[1:41:38] So, if you got any questions
[1:41:39] >> Yeah, Kurt, I have a question. So, how
[1:41:40] granular are you getting? Is it like
[1:41:42] cross sections for the roads? Are we
[1:41:44] talking curb and gutter? Are we talking
[1:41:46] water? Is it everything?
[1:41:49] >> We're talking everything. We're just
[1:41:50] talking about There are really two
[1:41:51] categories. That is
[1:41:54] We've been talking about the philosophy
[1:41:55] of of having growth be in the cities.
[1:41:58] And how that looks. We talked We talked
[1:42:00] to cities. We talked to
[1:42:03] health, water, without Those are the
[1:42:05] kinds of discussions that we're having.
[1:42:07] And then the other the other pressure
[1:42:09] that we've got is then we've got our
[1:42:11] rural developments, the unincorporated
[1:42:14] uh developments that are not
[1:42:17] being proposed next to a city. All of
[1:42:19] those things are being considered. I
[1:42:21] don't have anything to report to you. I
[1:42:22] don't intend to have anything to report
[1:42:24] to you yet. We're just in the sit down
[1:42:26] and have discussions, get ideas. Uh
[1:42:30] I've learned things I didn't and I and
[1:42:32] heard ideas that I'd never thought of
[1:42:34] before.
[1:42:35] Things that are going on other places uh
[1:42:38] that are really effective. Well, we just
[1:42:39] need to talk about those things. And in
[1:42:41] the end, hopefully there'll be some
[1:42:43] recommendations. Maybe we'll get a a
[1:42:45] really good ordinance out of it. But in
[1:42:47] the meantime, those discussions are
[1:42:48] turning out to be really interesting.
[1:42:51] >> We're trying to memorialize and so that
[1:42:54] we can give you some feedback on that.
[1:42:57] They may lead nowhere. I Kurt, I think
[1:43:00] the observation you made about what's
[1:43:02] causing pressure in the undeveloped in
[1:43:05] the unincorporated counties was an
[1:43:07] interesting one. Why don't you just
[1:43:09] share that with them?
[1:43:11] >> What we're finding is that the unincorporated areas, the more
[1:43:15] rural ones that aren't next to next to
[1:43:17] cities
[1:43:18] the pressures aren't being driven by
[1:43:20] developers.
[1:43:22] The pressures are coming from the
[1:43:23] property owners themselves.
[1:43:25] And we just need
[1:43:27] and
[1:43:28] we're having discussion on on Thursday
[1:43:30] with part of the planning commission and
[1:43:32] with Nolan to discuss if those things we
[1:43:35] think those are the
[1:43:36] uh those pressures are the same here as
[1:43:39] they're feeling elsewhere. Those are
[1:43:40] just the kind of discussions that we've
[1:43:42] had.
[1:43:44] I really hope that there's something
[1:43:45] that'll come of this and that we'll
[1:43:46] really like a solution.
[1:43:49] But we don't know for sure that we'll
[1:43:50] come there, but I think without doing
[1:43:52] this
[1:43:54] and getting a feel for and getting
[1:43:56] in-depth feedback
[1:43:59] from stakeholders who are affected by
[1:44:02] uh the ordinance we passed, I think that
[1:44:05] there's a there's a real possibility
[1:44:07] we'll come up come up with something
[1:44:09] good. Or if we didn't listen, we'd come
[1:44:11] up with something that was was harmful
[1:44:13] without realizing it.
[1:44:16] >> Good. Oh, yeah. I I think that we're on
[1:44:18] such a cusp of growth that in 20 years
[1:44:20] from now, I want people to look back and
[1:44:22] think
[1:44:23] that we got something right. That we managed that growth in a way
[1:44:27] that is still going to be good in 20
[1:44:29] years.
[1:44:29] >> big enough deal that it's worth a try.
[1:44:32] >> Yep.
[1:44:32] Okay.
[1:44:33] >> Thanks, Fred.
[1:44:34] >> Thank you.
[1:44:35] >> Okay, anybody else?
[1:44:37] Okay, motion to adjourn.
[1:44:40] >> So moved.
[1:44:41] >> Second.
[1:44:47] I can't second the motion.
