[2:15] further
[2:16] discussion hearing none roll call please
[2:19] Power yeso yesk yes Bas yes D yes yes
[2:25] thank you item number four on tonight's
[2:27] agenda as always we have oral requests
[2:29] and Communications from the audience
[2:31] this is where the members of the public
[2:33] wishing to address the council for an
[2:34] item that is not on tonight's agenda may
[2:37] come forth and do so at this time and
[2:40] these comments are limited to five
[2:42] minutes or less do we have one yes I
[2:45] do uh done War home toal performance GW
[2:49] property at uh 8:14 West 6 Street in
[2:52] Carrol um what's going to take to get
[2:55] that road paath guys it's um Carol's
[2:58] hottest dirt track uh I get County
[3:00] trucks going up and down at 54 mph our
[3:03] speed limits 25 I have a certified radar
[3:06] gun the dust is out of control um I've
[3:09] been down 11 years I've seen the city
[3:11] run a snow PL one time in the winter
[3:13] time 11 years it's not maintained it's a
[3:17] dust bow can we get it PA the whole
[3:20] Street's full of businesses it's the
[3:22] only place in Carol we have a dirt road
[3:24] that we got businesses
[3:28] on what road talking about West six
[3:30] Street indust yep I even brought I
[3:33] brought c b can you put that up on the
[3:36] right where that red dot is put it
[3:37] underneath
[3:40] there all right um up in the corner got
[3:43] a little arrow pointing down it runs
[3:44] from basically Ry diesel down to Highway
[3:47] 71
[3:52] vok that in the city limits yes I pay
[3:55] city taxes it's City Limits why is it
[3:58] not why is it not paid
[4:04] curious over
[4:07] the several years ago to pave that and
[4:11] it was a special assessment project the
[4:14] road had always been gravel now obiously
[4:18] but entered a special assessment project
[4:21] for Paving and it was rejected by the
[4:24] adjacent owners at the time I know a lot
[4:27] of properties have changed hands since
[4:29] that time but it had been addressed at
[4:32] one time cuz it is full of businesses
[4:34] Now isn't there a bunch of new buildings
[4:35] oh yeah
[4:37] full and like I said I've never been
[4:39] notified for anything in 11 years I've
[4:41] owned it and I've talked to other
[4:43] business owners along there and um
[4:46] fortunately they could not make this
[4:47] meeting but they said they'll make the
[4:49] next one if there is next one about it
[4:51] and um it's time to get
[4:55] aath is that something we talk about
[4:58] budgeting or that something you vote on
[4:59] well again we for protocol we I I had
[5:03] told Benton a couple weeks ago I see he
[5:05] can bring it you know to probably the
[5:07] more appropriate thing to do is to get
[5:09] it on an agenda okay I spoke with um
[5:11] Aaron about that and um he told me I
[5:14] need to come here and bring it up like
[5:15] We Are Tonight first which is fine and
[5:17] then we can go through it from there
[5:19] yeah and the council is not obligated to
[5:21] respond if at all I mean you know we can
[5:24] certainly ask questions at our will but
[5:26] you know we can just it's been noted
[5:28] within our minutes so we noted in our
[5:30] minutes that uh a request has been made
[5:33] and then we can take it up and put it
[5:34] into the standard CIP process you know
[5:38] beginning as early as this cycle but you
[5:40] know that's going to be a council
[5:42] decision and and so on so um so just to
[5:45] confirm there's gravel on the North and
[5:47] the South side of the tracks correct so
[5:50] yeah I believe so I I'm certainly aware
[5:52] of it on his side South sides farmr or
[5:55] sides
[5:56] businesses Randy H how long is the uh
[6:00] Street how much I mean is it quarter
[6:03] mile I I can't probably three4 of three
[6:06] qu quarters I'll agree with
[6:10] that it goes from right behind oh the
[6:16] Pam Avenue adjacent IV from there out to
[6:20] burges okay okay thank you last five
[6:23] years a lot of businesses have moved out
[6:25] there developed
[6:28] yeah so I think with this coming to us
[6:33] tonight I think it's a good opportunity
[6:35] for the council now knows aware of the
[6:37] issue and then we can talk about it in
[6:39] our strategic planning session coming up
[6:42] as to where we want to put it what we
[6:44] want to do with it as far as in our
[6:47] streets plan which I'm sure we have I
[6:49] haven't looked at it real close but I
[6:51] know we're going to have a number of
[6:53] projects that we're already scheduled to
[6:56] move forward with so how we want to fit
[6:58] that in if we want to look at an assess
[7:01] assessment project we can certainly do
[7:03] that since it's never been paved so I
[7:06] think that's actually a good opportunity
[7:07] for that type of a project but moving
[7:10] forward I think that's that's the proper
[7:12] way to look at it as far as we have
[7:14] people interested in that being paved at
[7:17] this point and then moving forward we
[7:18] can talk it in our strategic planning
[7:20] and then program it into our uh streets
[7:23] plan from
[7:25] there okay sewer and water's already
[7:27] there is it oh yeah oh yeah sewer water
[7:29] yeah I mean it's all developed I mean
[7:32] it's not even empty lock there anymore
[7:33] but it's all developed all the way down
[7:35] so thank you guys thank you you very
[7:38] much and again it is noted that you've
[7:41] made a request perfect thank
[7:43] you okay very well so we will move to uh
[7:47] the other items tonight's agenda
[7:49] beginning with uh under five we have
[7:51] ordinances and we will start first with
[7:54] you Aaron and Rolling Hill South condo's
[7:57] second urban renewal plan and this is
[7:59] our second reading correct correct okay
[8:02] this is the uh ordinance that puts in
[8:05] place the urban renewal area down in the
[8:07] uh Southeast southwest corner of the
[8:09] city for the urban renewal plan with 702
[8:13] development 704 704 uh I would recommend
[8:17] probably waving the second how do we
[8:19] work read third read the second wave the
[8:22] third okay read the second and wave the
[8:24] third readings to approve this ordinance
[8:26] to get this uh urban renewal area
[8:30] place any questions for
[8:34] Aaron okay so the recommendation is to
[8:37] approve the second wave the third is
[8:40] there a motion to that
[8:41] effect was a
[8:43] tie I give it to Carolyn better looking
[8:47] second
[8:49] okay okay By Carolyn seconded by lever
[8:53] uh any further discussion and it is to
[8:55] wave the third then correct y okay any
[8:58] further discussion hearing none roll
[9:00] call please face yes yes yes yes yes perfect thank you under five I'm
[9:11] sorry we're done with five so under six
[9:13] under resolutions no notion oh I got to
[9:16] adopt that don't I sorry and there's a
[9:18] resolution with this as that's why I put
[9:20] that note on there that I skipped right
[9:21] by I need to adopt that so is there a
[9:23] motion to adopt the uh said resol yep
[9:27] second uh by
[9:29] Le and then Carolyn any further
[9:31] discussion heing none roll call please
[9:34] yes yes power yes yes yes yes thank you
[9:41] aded thank you and then under
[9:44] resolutions tonight Aaron you're on up
[9:47] to bat again uh region 12 we need to
[9:51] finish the resolution authorizing
[9:52] confirming the how am I
[9:54] missing for urban Ren project well we
[9:57] adopted we adopted the ordinance but
[9:59] yeah we didn't talk about it during our
[10:01] discussion here okay I'm sorry that's
[10:04] all right I I kind of put this together
[10:06] so basically what this resolution does
[10:08] is allows us to be able to capture or
[10:11] repay the city for the administrative
[10:13] cost it was to set up the I don't want
[10:15] to break any rules so thanks for the
[10:17] catch after we get done working through
[10:20] the development of process or the
[10:22] development agreement the obligation
[10:24] there so now I need another motion for
[10:25] the resolution
[10:28] then so moved Carolyn seconded by JJ any
[10:32] further discussion hearing none roll
[10:34] call please Power yes a yeso yes yes
[10:39] Shrek yes SE yes resolution is approved
[10:43] can I move to resolutions yet let's do
[10:44] it okay let's do that I think I'll do
[10:46] that region region 12 Council of
[10:49] governments home construction and Rehab
[10:51] agreement Aaron um you have a copy of
[10:54] the actual agreement with highlighted
[10:57] sections changed in front of you we
[10:59] actually had the old agreement that we
[11:01] had prior to us making the changes that
[11:04] had the well the current one with the
[11:07] purchase of lots we would repay uh
[11:09] region 12 for those purchase of lots so
[11:13] in the agreement you have in front of us
[11:15] it's highlighted where it where it talks
[11:17] about a rehabilitation or what we would
[11:20] do if if uh region 12 was doing a
[11:23] rehabilitated unit rather than a
[11:26] purchase of an old or empty lot and then
[11:28] a new house the most what I would call
[11:32] the most important changes are under
[11:34] Section
[11:35] 2.1 responsibilities of the Cog under
[11:38] number three it says rehabilitate homes
[11:42] ensuring all major infrastructure will
[11:44] be serviceable for at least 10 years to
[11:46] include roof Foundation sighting Windows
[11:48] HVAC electrical systems Plumbing total
[11:51] project investment excluding the
[11:53] residential purchase or resident
[11:55] purchase will be at least $100,000 per
[11:58] rehabilitation unit so we would be
[12:00] investing
[12:02] $30,000 with region 12 basically to
[12:05] purchase the house and then region 12
[12:06] would be doing the investment to
[12:09] rehabilitate the house the other part of
[12:11] that would then be that this project
[12:13] would be eligible for the cogs local
[12:16] Housing Trust Fund which is very s
[12:19] similar to LMI funds or an LMI qualified
[12:24] financing but it actually opens it up to
[12:25] a little bit more of individuals that uh
[12:29] make a little bit more money than what
[12:31] LMI would qualify
[12:34] for so that's kind of the agreement in a
[12:37] nutshell aside from what we did
[12:40] before uh Randy is here if you have any
[12:44] specific questions for him but I can
[12:45] certainly mean Rick Rick Randy Rick ry's
[12:49] over
[12:51] here Rick is here but U otherwise the
[12:55] agreements hasn't changed a lot it's
[12:57] pretty similar to what we had had before
[13:00] but just adding a rehabilitation option
[13:02] rather than trying to find empty lots so
[13:05] Rick one question I have maybe I'm
[13:07] overlooking this is if I would purchase
[13:09] one of these homes how long do I have to
[13:12] own this before I can resell
[13:15] this so um there really you could resell
[13:20] it at any time the question is is there
[13:21] any recapture provision if there is if
[13:25] we enroll this as this would be set up
[13:27] to do that 15 ,000 in uh the grant that
[13:31] we've got through the state the the
[13:35] person would be purchasing the house at
[13:37] fair market value so if that happens and
[13:41] they purchase it at fair market value
[13:42] and we provide no down payment
[13:44] assistance there is no clawback there's
[13:46] no regulation that they would have to
[13:47] keep at any specific period of time but
[13:49] they're paying full fair market value
[13:51] for it if there is a benefit to them
[13:55] which is probably going to come in the
[13:56] form of down payment assistance which we
[13:58] would do through that State article
[13:59] program there there's a specific clra
[14:02] provision which would be based upon the
[14:03] amount of assistance that would be
[14:05] provided to them probably a five-year
[14:08] forgivable period because I can't
[14:10] imagine that the down payment assistance
[14:11] will be more than5 or $10,000 but that's
[14:14] going to depend upon the buyer uh or it
[14:16] may be outside of this program so we
[14:19] talked about the Housing Trust Fund that
[14:22] itself has a down payment
[14:24] assistance portion of it so it may be
[14:27] outside this other funding but through a separate funding agreement and again a
[14:31] 5 to 10 year uh forgiv ability period
[14:35] should there be
[14:38] any am I missing it where it it needs to
[14:41] be occupied I see the 18 months of the
[14:43] construction time has to be done but it
[14:45] doesn't say anything about having to be
[14:48] occupied like the program we have now
[14:51] it's owner occupied in 18 months right
[14:55] but there's nothing in here saying you
[14:57] know you can have this and remod model
[14:58] it but our goal is to get our you know
[15:02] people in homes yes so we don't have
[15:04] anything in here that it has to be
[15:07] occupied well the goal in in the con in
[15:10] here it says it's intent is to have
[15:13] single family owner occupied homes
[15:15] where's that at I missed it uh it's in
[15:18] .2 and in both paragraphs when it talks
[15:21] about Rehabilitation and for new
[15:23] construction but
[15:25] if if it takes longer to get it sold
[15:29] than 18 months what what are we going to
[15:31] do I I don't think we would do anything
[15:33] other than say Rick keep trying to sell
[15:36] the house okay right I don't want to sit
[15:39] on empty
[15:40] houses it's fine
[15:43] just what we discussed
[15:47] it yeah that would be our goal and the program that we have through the
[15:52] state that has to be own
[15:54] occupied
[15:57] okay were you thinking of a situation
[16:00] where somebody may buy it and rent it
[16:02] out or just sit on it for a while and
[16:05] wait for CES to cheat you know just it
[16:07] yeah so I mean that's probably a good
[16:09] question but you kind of just answered
[16:11] that I think yeah yeah the rental the no
[16:13] rental provision on a rehabed house is
[16:17] going to happen if we do down payment
[16:18] assistance which I tell you we will do
[16:20] on everyone because if we don't do a
[16:21] little bit then that repayment ability
[16:24] is that whole 150,000 which nobody's
[16:26] going to buy a house that they have to
[16:28] pay any money that they've already given
[16:30] us so we'll do a degree of down payment
[16:32] assistance with every house and that
[16:34] would have that fiveyear part of the
[16:37] default as if they would rent it which
[16:40] some it's very hard to uh enforce easier
[16:44] for us to enforce in Carol because we're
[16:46] here uh but that is that would be
[16:49] written that's a um one of the uh
[16:53] situations of default in that clawback
[16:56] agreement we're looking at vacant homes
[16:59] aren doing this yes so that would be uh
[17:03] well anything that's on the market so it
[17:06] may not be currently vacant for example
[17:09] it may be a rental house that has a
[17:11] renter in it that's on the market and
[17:13] available we're not going to want to I'm
[17:16] not going to want to buy anything that
[17:17] has a renter currently in it because
[17:20] these are federal funds and then that
[17:21] will kick in a particular set of
[17:24] unpleasant things to do as far as
[17:27] relocation is concern concerned so
[17:29] generally it's going to be houses that
[17:31] are vacant are available for sale that's
[17:33] what we're going to be looking for or
[17:34] it's 657a or it's a donated homes
[17:40] um well our goal is to create more
[17:43] housing so you want to build a vacant
[17:45] home you don't want to have somebody
[17:47] renting and then they're out and you
[17:50] remodel you know and you get somebody
[17:53] you haven't really created any extra
[17:55] housing or a vacant home you will on
[17:57] this true I and this is your program to
[18:01] determine how you wish to have it run
[18:03] I'll give you two reasons why I think
[18:04] having somebody rent even if it's a
[18:06] rental unit why you would want to think
[18:08] about enrolling it in this program one
[18:10] is that it's an owner occupied program
[18:12] so that you transition that person into
[18:13] Home Ownership second is uh the amount
[18:17] of Rehabilitation that we're going to
[18:18] put into that housing unit is probably
[18:20] going to be more than a person that is
[18:22] renting it now that may not be 100% true
[18:25] but just looking at the repayment that
[18:28] you're going to have on the rent that
[18:29] you're going to collect over a period of
[18:31] time who's going to stick $150,000 into
[18:34] a house and where that becomes an
[18:36] advantage is that housing unit then is a
[18:38] long-term housing unit for the community
[18:40] as opposed to potentially continuing to
[18:42] degrade over time which I'm not saying
[18:44] that happens in Carol but there are a
[18:46] lot of rental units that don't see as
[18:47] much investment just because it doesn't
[18:49] pay for the person that's owning them to
[18:50] put that investment in the home so even
[18:53] though it may have a renter that's
[18:55] currently in it and that may hurt your
[18:57] rental market which I know we need to
[18:58] have rental units those are the two
[19:00] reasons that I would say that maybe you
[19:02] don't want to worry about it but if you
[19:04] do want to worry about it it's your
[19:05] program and you can tell me what you
[19:06] want to do and we'll do whatever you
[19:11] want hear that LE you get your own
[19:15] program the Royal the Royal U this what
[19:18] I I I would also ask um you mentioned
[19:21] that you're looking for homes that are
[19:22] currently on the market are are you guys
[19:24] searching out homes that are maybe
[19:26] currently in foreclosure or we have uh I mean our our feelers are
[19:34] out there we have looked at houses that
[19:36] are on
[19:37] foreclosure sometimes that the part of
[19:41] the reason that they're in foreclosure
[19:42] is because they're behind and they're
[19:43] behind on what the value of the house is
[19:45] so it just kind of depends on how much
[19:47] the financial institution would want for
[19:49] it uh but anything we would look for
[19:52] anything I've got if we if I'm looking
[19:55] to I've got really six slots to do one
[19:58] slot is through a specific state of Iowa
[20:00] program I don't have as much money so my
[20:03] house is going to have to not need as
[20:05] much uh that we en roll into that
[20:07] program or not cost me as much the other
[20:10] five I've got one of those five slots
[20:12] taken currently uh so we're actively
[20:15] looking for projects for those and of
[20:17] course this is only the rehab part of
[20:19] this I'd still like lots which as you
[20:22] know it's tough to find an infill lot in
[20:24] Carol that's going to be available that
[20:26] is uh a price where we can actually put
[20:30] a house on it and sell to the price
[20:32] point that we're trying to get at so
[20:34] it's not a bad thing I mean if we're if
[20:36] we end up not finding any infill Lots
[20:38] either because other people are are
[20:40] buying them to put houses on it that's
[20:42] great because that's the goal we want
[20:43] right even if even if we highlight lots
[20:47] and say why don't we do a project here
[20:49] and they end up going somewhere else and
[20:50] a house gets built that's what the goal
[20:52] is so it doesn't matter if we do it if
[20:53] the private sector will do it that's
[20:56] awesome is that the reason for the the ask for the change from the
[21:01] construct to
[21:04] or you can't find any Lots is that I did
[21:07] not ask for the change but I think
[21:08] that's probably part of the reason that
[21:10] the change is thrown out there is
[21:12] because we have the money available from
[21:13] the state to put significant amounts in
[21:16] and so the city's essentially putting up
[21:18] money to say look at projects in our
[21:20] community to invest that large amount so
[21:22] that would be one change the second is
[21:25] we haven't been able to locate lot one
[21:27] yet that um and we went around with the
[21:31] city of help of the city to look at all
[21:34] potential vacant lots to see what was
[21:37] developable what made sense what wasn't
[21:39] already you know if it's a lot that's
[21:41] owned by a neighbor they're not that's
[21:43] their yard they're not going to be
[21:44] interested in selling that and just have
[21:47] not been able to come upon anything yet
[21:50] that's available in
[21:52] town some of it came from the state
[21:55] housing convention I went to and they
[21:57] talked about if you want to you know get
[22:00] housing faster in your town this is one
[22:03] of the fastest
[22:07] ways okay I guess my question was I mean
[22:11] the whole thought behind that was we're
[22:13] idea was to construct to kind of promote
[22:15] that as well I mean now we're going to
[22:18] existing that are potentially already
[22:20] occupied so for me it was I mean I was
[22:23] kind of on the fence in the beginning
[22:25] anyways but to construct which is going
[22:27] to put up new housing and now we're
[22:29] going to rehab which isn't providing any
[22:32] new housing potentially well if it's
[22:34] vacant would be if it's vacant but we
[22:37] can't guarantee that we're going to get
[22:38] a vacant house well they can do your
[22:40] best at going after vacants well and
[22:42] again you tell me what vacant is I me
[22:45] generally anything that's on the
[22:46] Market's probably going to be vacant but
[22:48] if there is I mean we want to work with
[22:52] you so if there's something specific
[22:55] that you want us to stay away from then
[22:57] we will
[23:01] when I when I look at vacon I would look
[23:02] at pulling like water meters hey which
[23:05] one hasn't had service in a certain
[23:07] period of time you mean abandoned yes
[23:10] yeah yeah yeah right a't that the better
[23:12] term for that yeah probably better than
[23:14] vacant yeah um my house is vacant right
[23:17] now no one's home right now over over a
[23:20] period of time I would just hate
[23:22] to to buy homes that are on the market
[23:25] for people that are potential buyers
[23:27] right now especially with the limited
[23:29] selection so I think for me I think if
[23:31] we go after something that's sitting
[23:34] abandoned for a period of time two three
[23:37] four years um or that hasn't had any
[23:40] activity there that would I would be
[23:43] more in favor of that versus something
[23:44] that's on the
[23:46] market I my only reaction to that and
[23:49] again we'll do whatever you want to do
[23:51] it is going to be hard for us to be able
[23:53] to do something that's vacant because
[23:55] generally that's going to need an entire
[23:57] new rewire it's going to need all new
[23:59] Plumbing you're probably going to have
[24:00] to blow out the kitchen sighting Windows
[24:03] roof the house we're doing in Kon Rapids
[24:06] were not doing a lot in the interior
[24:07] we're at 120,000 already for a house
[24:10] that assessed it 70,000 that was donated
[24:13] to us and part of that is because I
[24:15] don't have a crew you know we're hiring
[24:17] all this work done by local contractors
[24:19] and so uh if we had a a crew we could
[24:23] probably do it and and get a lot more
[24:26] done then I do through the procurement
[24:29] methods that we need to follow to hire
[24:31] somebody not that's not to say that
[24:33] there aren't some abandoned houses that
[24:35] have been cared for but typically if you
[24:39] really want to make it a serviceable
[24:40] unit for somebody that if you're going
[24:42] to sell the low mod income they're not
[24:44] going to have really the ability to go
[24:45] out and take out larger loans that they
[24:47] can deal with the failure of a furnace
[24:49] or a hole in a roof so we want to make
[24:52] sure that we've kind of got that
[24:53] exterior envelope all set to go for them
[24:56] and that's without any foundation
[24:58] problems uh so it can be we've been
[25:00] through a lot of houses that cities were
[25:02] going to take on
[25:03] 657a and you look at the outside of it
[25:06] and think I'm I'm at 150 before I even
[25:09] step inside uh the house and usually
[25:11] that's because there's Foundation
[25:12] problems but uh that's where that's
[25:17] where those type of abandoned properties
[25:19] can be tough but that's not all of them
[25:21] there's and and we only need five uh
[25:24] throughout the region to figure out
[25:27] where we might be able to make a
[25:28] significant difference but so what's really The Sweet Spot for a
[25:32] purchase I know something that small
[25:34] communities have that we ask what are
[25:36] you you're going my house I think it's
[25:38] going to depend on the house um I'm
[25:41] looking on the real estate right now and
[25:43] there's like five of them under 140,000
[25:46] yeah that's so that's going to be tough
[25:49] for but I mean they're they are out
[25:51] there periodically but I would think if
[25:53] there's something 50 60 we're not
[25:56] looking at a huge
[25:58] house you know probably
[26:02] two-bedroom you know infill can be
[26:05] smaller
[26:06] yard it's it's not easy I mean and the
[26:10] Carol Market's tough but the goal of
[26:13] this program is to take those houses
[26:17] that really need a lot of infrastructure
[26:19] work to make sure that they don't become
[26:22] dilapidated and lost housing units in 20
[26:25] years to make them last a lot longer well are there any abandoned ones
[26:32] on Carol that we know well you
[26:34] identified you identified 15 Midsummer
[26:38] 15 of them and and there was probably
[26:40] just doing like a driveby there was
[26:43] probably six or seven of them that
[26:45] appeared to be fine now maybe they had a
[26:49] severe structural problem unb notes to
[26:51] the naked eye but there was five six
[26:54] seven of them that looked pretty and we
[26:56] know for one for sure was definitely
[26:58] decent they were just waiting for a
[26:59] family issue to get settled um but there was some to start with you know I
[27:08] think those are the ones that we'd
[27:09] really be in that we can do the best
[27:11] because to your point they're vacant
[27:12] they're not being lived in now right the
[27:14] only problem with all 15 of those they
[27:17] weren't necessarily up for sale right
[27:19] this minute right you know they're not
[27:21] putting them up for
[27:22] sale you you get the uh answer well I'm
[27:26] going to work on them and inv or you
[27:29] know improve it and then I'm going to
[27:31] put up for sale well some some of these
[27:33] Builders we know aren't going to get
[27:35] around to it anytime soon and some of
[27:38] them had work in process but hadn't hammered a nail in months so so
[27:44] we're looking at you know talking about
[27:46] adding this AR to the new home so we're
[27:48] still going to stay with the new home
[27:49] project buying lots and doing that so
[27:52] we're looking at an alternative here so
[27:54] the the the decision would I would
[27:56] imagine comes with region 12 is this
[27:58] doesn't pencil out on this particular
[28:00] home so we're not going to do
[28:02] it so that would be on you guys we don't
[28:05] get involved in that that is correct
[28:07] okay so if if things don't pencil out on
[28:10] these used homes or abandoned homes then
[28:12] you you still have the new home that we
[28:15] have in you know in place now yes as
[28:18] long as we can find lots but yes yeah
[28:20] well that's as long as you can find an
[28:22] abandoned home that's worth fixing up
[28:24] too the same scenario right so you may
[28:26] get into this and it's not working very
[28:28] well on half the homes that you're
[28:30] looking at you don't know that until you
[28:32] get going but but it's just another
[28:34] Avenue for us to get some
[28:37] homes and if they don't pencil out then
[28:40] that's it and ultimately we don't spend
[28:42] any money till it's found or done ex
[28:45] exactly and we're not out anything until
[28:47] we do find a lot or a residence that
[28:49] region 12 gives the green light too I
[28:52] just didn't realize there were that many
[28:54] abandoned properties well we're working
[28:56] on an ordinance to
[28:58] work on that also so Tom there are
[29:01] several um in Ward 4 and I've been told
[29:05] by the neighbors who have talked to me
[29:06] about them that they're very rundown
[29:10] looking and the neighbors have tried to
[29:14] because there are nice houses near these
[29:17] really prominent isour and neighbors
[29:21] have tried to buy these abandoned homes
[29:24] and they're getting worse and worse one
[29:26] in particular has been abandoned for 12
[29:29] years the owner lives I believe in in
[29:33] Atlantic and they have tried to buy them
[29:35] they will not sell and they're just
[29:37] leaving them to further
[29:40] deteriorate and like the neighbors have
[29:44] just had it and they want us to do
[29:47] something now this may be these may be
[29:50] so run down you couldn't meet your price
[29:53] point Rick but I think there may be some
[29:57] that could be rehab that Rick could
[29:59] handle and improve some of these
[30:02] neighborhoods it's you know it people
[30:05] are worried about their property values
[30:07] going down and they're worried also what
[30:09] if there's a buy or you know all the
[30:12] problems that can come with
[30:15] abandonment so I you know re I I think
[30:19] giving Rick a chance to try can't hurt
[30:23] us since it's pay as we go I mean it's
[30:26] just enough another option versus infill would be great to get a new home
[30:31] because it's just a lot somebody's
[30:33] paying you know taxes on we need we need
[30:37] to build our tax
[30:41] base so I think it's worth a try they
[30:45] take a
[30:48] while so we just need to give direction
[30:52] on this I mean and simply not I mean our
[30:56] goal would be to go with the abandonment
[30:58] right and not the on the
[31:01] market
[31:03] right well I think if I understood Rick
[31:07] correctly he's he's wanting all
[31:10] comers did I understand that earlier
[31:13] yeah the developer I would like to be
[31:15] able to go after whatever I we could
[31:18] find to be able to work on if there is
[31:22] uh a provision that you wish to add to
[31:26] the contract
[31:27] uh you can certainly propose that on
[31:30] that that somehow deals with vacant or
[31:33] provides a definition for what vacant is
[31:35] to where you would feel a house should
[31:37] be enrolled in the program
[31:39] or you know that we would have to run it
[31:42] by the city manager or something if
[31:43] there's language that you want to
[31:44] propose in the contract
[31:46] then then you should do that I want you
[31:48] to feel comfortable with it and he said
[31:52] it's our program you know it's our
[31:54] program but but he would have more
[31:57] opportunities if it was even currently
[32:00] inhabited or rented or whatever I mean
[32:03] my goal the whole goal is to get vacant
[32:05] properties the the program that we based
[32:07] this on was one that we had 15 years ago
[32:10] that it had to be vacant they defined
[32:12] vacant is really on the market so even
[32:14] though it may be your house that you're
[32:15] selling because you're moving and you
[32:17] were living in it up until that point
[32:19] because it was on the market we could
[32:20] acquire it and then rehab it uh we
[32:24] didn't deal with any that had any rental
[32:27] in it and I don't want to now because of
[32:29] the uniform relocation act that I don't
[32:31] want to get into uh which is a whole
[32:33] specific other set of rules that we need
[32:35] to follow so it's it's it's really up to
[32:40] whatever you're comfortable with because
[32:43] you know you're the ones that are
[32:45] investing the funds and you're the
[32:46] partners and we're not talking about a
[32:47] lot of houses uh that I can go in and do
[32:50] this with anyway because I only have a
[32:52] specific amount of money in this program
[32:53] and I have it it turns into a pumpkin I
[32:56] found I thought thought it was June 30th
[32:58] but it's actually the end of next year
[33:00] that we've got to have our contracts in
[33:01] place we've probably got to have all of
[33:03] our properties required at least by next
[33:05] summer so that we'd have time to get our
[33:06] contracts in place with contractors to
[33:08] do the
[33:09] work and if that's the case and you
[33:11] don't find them then the pumpkin turns
[33:13] and we're done yeah then I think it's
[33:16] back to just
[33:17] construction only on and not the rehab
[33:20] piece of
[33:21] it well I think it's worth a shot of I
[33:24] think the ones on the market are
[33:27] available should be available also just
[33:29] because I know the ones you're going
[33:31] after are going to be those that they
[33:33] probably could be purchased um could be
[33:36] purchased probably like somebody like me
[33:38] who wanted to renovate them and resell
[33:40] them but if if it's something that fits
[33:42] their program they may as well have the
[33:43] option to do it too because right now we
[33:46] don't have enough people in town that
[33:47] want to do that I mean we've taken our
[33:51] last few years buying and renovating
[33:53] personally homes and I can't get enough
[33:56] done so like let somebody else jump in
[33:59] and do it and our big contractors are
[34:01] building homes so let them help us get
[34:04] some of those rejuvenated so that
[34:06] they're on our tax base for more than
[34:09] $70,000 get them up
[34:12] to150 220 whatever based on what you can
[34:16] do to rejuvenate
[34:19] it and we talked about this a couple
[34:22] weeks ago but is it still understood
[34:24] that these homes would still be
[34:25] available for the tax batement the 5year
[34:28] tax abatement I think we talked about
[34:29] that I we talked about it but I didn't
[34:31] it it I didn't see it in the agreement
[34:34] or just leave it as unless is that just
[34:37] a given it's understood yeah unless it's
[34:39] under a an urban renewal area it would
[34:42] be available for the tax and and I'm I'm
[34:44] just going to bring this up just because
[34:46] it probably is just overly obvious but
[34:48] um it's got to be within the city
[34:51] limits I mean it's it's not written here
[34:54] but it's clearly understood that that
[34:57] it's construction must meet city city
[35:01] building code but not it doesn't say
[35:03] City says City
[35:10] yeah okay I'm sorry I did I missed it
[35:13] that's my bad thank you sorry yeah okay
[35:17] so we're at a point to make a motion to
[35:21] move forward with this or not
[35:25] yes it's it's not like it's 50 homes
[35:28] it's 10 homes I think it's worth a
[35:31] try that a motion that's a motion second
[35:35] seconded by By Carolyn any further
[35:38] discussion Haring none roll call please
[35:42] yes
[35:44] no yes yes yes thank you thank you Rick thank
[35:55] you
[35:59] okay so that's the region 12 so now we
[36:02] are at 6B which is fiscal year 24 budget
[36:06] amendment number one and I have
[36:10] 551 Laura and we'll go ahead and open
[36:13] the public hearing for this one and turn
[36:15] it over to you yes thank you Mark so
[36:18] time this is a time for the public
[36:19] hearing on our first budget amendment
[36:21] for our fisal year
[36:22] 24 uh there's a list included with the
[36:25] memo the items would be included in that
[36:27] as a quick refresher it was items that
[36:29] were either budgeted or part of our
[36:32] reestimates when we ended our fisal 23
[36:34] year and that were not completed as of
[36:36] June 30th of 2023 except for two
[36:39] transfers that were noted in the memo um
[36:42] at the time um actually even up to today
[36:45] no comments were received in the office
[36:47] that was my question thank you it was
[36:49] published in the Carol Times Herald as
[36:51] required by state code and it was
[36:52] published on Friday October
[36:55] 27th
[36:58] you do a really nice job itemizing these
[37:00] things out and particularly which ones
[37:02] that didn't get into the
[37:04] 23 budget
[37:07] so pretty well
[37:09] straightforward does anybody have any
[37:12] questions uh any members of the public
[37:15] with
[37:16] questions now this could be the fastest
[37:18] public hearing we've had this year so I
[37:22] see it at
[37:24] 5:52 we'll go ahead and close public
[37:27] hearing and then per your recommendation
[37:30] I need a motion to approve the
[37:32] resolution for the uh uh budget
[37:36] amendment number
[37:38] one there a motion Tom Tom second
[37:43] seconded by KY any further discussion
[37:46] hearing none roll call please Power yes yes yes yes yes resoltion approved
[37:55] thank you very much uh let's see we are
[37:57] item 6 C and the ninth amended and
[38:00] restated Central business district urban
[38:03] renewal plan a new Ziggler urban renewal
[38:05] plan and related development agreements
[38:07] and I'll turn it back over to you again
[38:09] Aon yeah this is a resolution uh
[38:11] accepting an engagement letter with
[38:13] allers and Cooney to rewrite and add
[38:15] projects to the ninth amended and
[38:17] restated Central business district also
[38:19] to create the Ziggler urban renewal plan
[38:23] and the related development agreement
[38:25] with Ziggler to put in well which will
[38:28] actually go into item D the uh sanitary
[38:31] sewer and water main extension but uh
[38:34] this is to write the agreements and make
[38:37] sure we're doing everything correct by
[38:39] uh legal standards for the urban renewal
[38:49] areas pretty straightforward stuff any
[38:52] questions for Aaron on
[38:55] this if not I would seek a motion to
[38:57] approve the resolution to enter into the
[38:59] scope of Engagement agreement with
[39:01] allers and
[39:02] Cooney is that lever second seconded by
[39:06] Misty is that Misty yeah any further
[39:08] discussion hearing none roll call
[39:11] please yes yes yeso yes yes yes
[39:17] resolution approved thank you uh item uh
[39:20] 6D is us30 West sanitary sewer and water
[39:24] main extension 2024 related to the
[39:27] previous topic and turn it over to Randy
[39:30] thank you mayor um we have proposed a
[39:33] us3 West sanitary sewer and water main
[39:36] extension to serve that Ziggler property
[39:39] on the west Edge of Town um it the
[39:42] project includes extension of about 1100
[39:46] ft of sewer and
[39:48] water um from Kittyhawk Avenue to
[39:51] Highway 30 and then West on Highway 30
[39:54] to the east property line of the the
[39:56] Ziggler property uh we prepared a
[39:59] Professional Services agreement uh with
[40:02] Snider and Associates to perform the
[40:05] design work necessary to get the project
[40:07] to uh a bidding
[40:09] phase uh Snider and Associates has a
[40:13] long relationship with uh Ziggler and
[40:16] they will be they have done the Ziggler
[40:19] site plan work for the property and
[40:23] they'll be doing some additional um
[40:25] utility work for Ziggler so we are
[40:29] recommending that Snider be retained to
[40:33] help coordinate this project the city
[40:36] project and the Ziggler
[40:39] project uh anyway the the Professional
[40:43] Services agreement includes Design
[40:46] Services uh bid services and con some
[40:49] construction service a total estimated
[40:52] amount of 99,354
[40:56] the project schedule is pretty
[40:59] aggressive but it is set up to uh
[41:03] parallel the needs of of the Ziggler
[41:05] property so that these services are
[41:08] available when Ziggler needs needs them
[41:12] and Ziggler's development schedule is
[41:15] also pretty
[41:17] aggressive um unless there are any
[41:19] questions I'd recommend your
[41:21] consideration of approving the agreement
[41:24] with Snider and Associates uh for the
[41:27] water main and sanitary sewer
[41:31] extension very good Randy um and you had
[41:35] outlined in your narrative that we're
[41:37] using Snider because that's who Ziggler
[41:40] uses but it would the council have any
[41:43] concerns about uh whether or not that
[41:46] would limit or inhibit any prospective
[41:49] biders that it would be open to all
[41:52] comers you know once that you know once
[41:55] that the the design is is open and then
[41:56] we we let the bids oh yeah it would
[41:59] inhibit that in any way that would not
[42:01] inhibit it that's this is just a design
[42:03] work and
[42:06] the there is like work on the Ziggler
[42:10] property so if
[42:13] Ziggler negotiates their contract or if
[42:15] they bid their contract I don't they'll
[42:18] get it under contract however they
[42:20] desire okay that may
[42:23] influence biders uh the that that
[42:26] successful bidder uh may want to be the
[42:29] successful bidder for the city uh
[42:32] portion of the project um so it could
[42:34] work to to the advantage in bidding uh
[42:39] that way good um it's not guaranteed but
[42:42] it's possibility it makes a a quite a
[42:46] bit larger project almost double the
[42:48] size size in length uh when you add the Ziggler work into it okay and this
[42:55] is all recoverable through the Tiff
[42:58] agreement that we'll talk about in just
[43:00] a moment one thing about Ziggler is they
[43:01] try to emphasize having local
[43:08] first any other questions for
[43:11] Randy okay so the recommendation is uh
[43:14] approval of the resolution to adopt the
[43:17] agreement or approve the agreement with
[43:19] SN and Associates uh for the us30 West
[43:23] sanitary sewer and water main extension
[43:25] project is there a motion to
[43:28] that Tom is that Misty yes uh any
[43:32] further discussion heing none roll call
[43:34] please Power yes yes yes yes yes perfect thank you Randy okay moving
[43:46] right along we have item six e which is
[43:49] the Biometrics Holdings LLC and dmba
[43:53] properties and Consulting the annual ual
[43:56] tax increment Finance appropriate for
[43:59] 2025 Laura yes thank you Mark so we've
[44:03] been working with b and electrics and
[44:05] DMV properties for a number of years um
[44:07] for some improvements that were done at
[44:08] the property located across the street
[44:12] from
[44:13] the and part of the agreement with them
[44:16] was for the city to provide a grant in
[44:18] the amount of $300,000 to rehab and put
[44:21] up a new building part of that also
[44:24] includes the annual a we've been doing
[44:26] this for a number of years where um so
[44:30] that way the whole 300,000 doesn't count
[44:32] against the city's death that only the
[44:34] portion of the agreement that would be
[44:36] paid in the next fiscal year actually
[44:38] gets counted towards our debt
[44:40] obligation the developer has completed
[44:43] the construction of the building and
[44:44] certified also then with that is the
[44:46] certification of the number of jobs that
[44:48] were created that was part of the
[44:49] agreement and the uh developer did
[44:52] certified that there were 10 new jobs
[44:53] that were created um some additional
[44:56] work was done to investigate the number
[45:00] of jobs and that was outlined in here
[45:01] what the work was done to verify the
[45:03] jobs that were created so what's it
[45:06] before you tonight is a resolution what
[45:07] we call our annual Appropriations
[45:09] resolution to ask for the Tiff dollars
[45:12] to pay um the developer for the taxes or
[45:15] the portion of the taxes that relate to
[45:17] the incremental value that was created
[45:19] with that new building building those
[45:21] taxes would be repaid to him next fiscal
[45:24] year excuse me the the develop year so
[45:27] this is um we've been doing this for a
[45:29] number of years fiscal 25 will be the
[45:31] second year of the annual Appropriations
[45:34] and after the fiscal 24 appropriation
[45:36] payments will be made there will be
[45:39] roughly 193,000 left on to be paid
[45:44] back are there any questions about what
[45:48] the annual Appropriations resolution
[45:54] is um I have a quick question um you
[45:58] talked with their representative Mr
[46:01] Jacobs and um you were shown the that
[46:06] biometric has 8 W2 employees 6
[46:10] 1099 two of which meet the criteria you
[46:15] were shown the information but my
[46:17] question is was Nathan overberg who
[46:20] wrote this um agreement with bioin metc
[46:26] and he's aware of the content was he
[46:29] good with the documents that were
[46:33] provided and is good with how the number
[46:39] of employees were
[46:41] certified that the information you were
[46:45] privy to um meets the criteria and he
[46:49] does indeed have the 10 so we're we're
[46:55] good as far as overberg is concerned
[46:58] yeah actually Nathan didn't write this
[47:01] agreement it was his predecessor that
[47:03] actually wrote the agreement and uh but
[47:06] yes he he was we were Consulting with
[47:08] him as far as what we could do to kind
[47:10] of certify the jobs without just saying
[47:14] having them fill out of form saying yeah
[47:16] we have 10 jobs and he was he was
[47:19] comfortable with the way we had
[47:21] certified the jobs in this in this
[47:23] aspect yes even the
[47:26] 1090s y he was good with it so even
[47:29] though he didn't write it I apologize he
[47:32] is fully aware of the content yes and
[47:35] the spirit of the content correct
[47:39] okay so we're on firm legal standing
[47:43] then correct okay thank
[47:52] you any other questions for Laura or for
[48:00] Aaron so the recommendation is to for
[48:03] the approval of obligating funds from
[48:05] the central business district Tiff to uh
[48:08] micro Biometrics and dmba properties
[48:14] Consulting there a motion to
[48:17] that so
[48:19] moved is it Kyle and then
[48:23] JJ is there any further discussion
[48:27] hearing none roll call please D yes
[48:30] Shrek yes yes yes yes Carolyn thanks for asking that
[48:38] question I do have a comment okay before
[48:41] we move on to the next one moving
[48:43] forward and following the lessons
[48:45] learned during this process and herein I
[48:48] highly recommend that the uh any new
[48:51] business agreement that is considered uh
[48:54] by the council moving forward
[48:56] particularly those that with their
[48:58] spirit and intent rooted in job creation
[49:02] in Carol that the language contain
[49:05] airtight and
[49:06] explicit definitions that are well
[49:09] understood and mutually agreed upon by
[49:11] all parties that are both binding and
[49:15] irrefutable agreements should always be
[49:17] crystal clear and beneficial to all
[49:20] parties and that's my
[49:23] comment so we will move on to the next
[49:26] one which is the same type of agreement
[49:29] with Western isowa networks
[49:33] BTC go ahead Laura thank you um yes so
[49:36] same very similar situation that the
[49:38] developer um improved some area on the
[49:41] west side of town over by Walmart and
[49:43] doing so there were some storm water
[49:45] improvements that they did at that time
[49:47] and so the city is rebating back the
[49:49] taxes to repay them for those Stone
[49:52] water improvements this is scheduled to
[49:54] be paid out over six consecutive
[49:56] semiannual pment of three fiscal years
[49:59] of which fiscal 24 is our first year
[50:03] this is to appropriate the Tiff
[50:05] collections for fisal 25 so we can
[50:08] continue those payments for the
[50:13] agreement very good we just paid one
[50:15] tonight
[50:17] y aren't our
[50:20] bills so once again council's requested
[50:24] their consideration approval of
[50:26] resolution obligating funds from Western
[50:29] Urban Westfield urban renewal tax
[50:32] revenue fund for appropriation of the
[50:34] tax payment to BTC
[50:37] Inc is that
[50:39] LE seconded by uh JJ any further
[50:43] discussion hearing none roll call please
[50:46] B yes foro yes dir yes shre yes yes yes
[50:52] motion is approved thank you and 6G
[50:56] Laura I think you're still up with the
[50:57] seat Bel
[51:04] policy yes thank you you don't know it
[51:06] by heart yet huh IA buckle up and that
[51:11] summarized by just saying Buckle the
[51:12] policy buckle up well a couple months
[51:15] ago um a representative from imwc the
[51:17] city's work count carrier was here to
[51:20] review our po uh a number of our
[51:21] practices and one of the things that
[51:23] came about that was um
[51:25] not that we didn't necessarily have a
[51:27] seat belt policy but it was just a
[51:29] really short oneline thing and this is a
[51:31] the policy before you tonight is a
[51:32] little bit more expansive and goes into
[51:35] a little bit deep more detail about use
[51:38] of a seat belt not only in vehicles and
[51:40] if you're personal vehicle while on City
[51:42] business but while you're using other
[51:44] City equipment if it is equipped with a
[51:47] seat belt you will be required to wear
[51:49] that seat Bel as well this is a model
[51:51] policy that we got from IM WCA so we're
[51:53] pretty sure they're going to sign off
[51:55] once Council approves it
[51:58] so this will be added to it and then our
[52:00] policies and procedure manual and then
[52:02] we will distribute to all employees and
[52:04] talk about
[52:06] it very good any questions about seat
[52:09] belt
[52:11] policy if not Council consideration
[52:14] approval of a resolution adopting the
[52:16] new seat belt policy policy number
[52:21] 0903 JJ Tom any further discussion heing
[52:25] on roll call
[52:27] please yes yes yes yes yes Shrek yes
[52:33] conations very good thanks Laura okay
[52:37] under reports seven first one a
[52:40] wastewater treatment plant digestor
[52:44] evaluation and Randy thank you mayor Vin
[52:47] Kim has completed the digest
[52:50] evaluation at the wastewater treatment
[52:52] plant if you'll recall that that
[52:55] evaluation was
[52:56] initiated um actually in April of
[53:00] 22 um to uh evaluate the condition of
[53:04] the current anerobic digestor uh propose
[53:07] whatever upgrades updating it needs um
[53:11] the equipment is actually about 20 years
[53:13] old uh now in that
[53:17] digestor and then look into an
[53:19] alternative of converting or switching
[53:22] to aerobic
[53:24] digestion uh
[53:26] the
[53:26] report contains the detail on what vnk
[53:30] did if you have any questions on that uh
[53:33] I can sure attempt to answer them in
[53:36] summary though uh the U analysis was put
[53:42] uh boiled down to a 20-year present
[53:44] value worth value of both the upgrades
[53:48] to the anerobic digestor and the switch
[53:52] to an aerobic
[53:53] digestion uh those are including your
[53:56] memorandum the aerobic treat anerobic
[53:59] treatment alternative was about 5.5
[54:02] million uh 20year present worth and the
[54:06] aerobic um treatment alternative was
[54:10] about 3.5 million so um the airic
[54:14] treatment was recommended uh to for the
[54:17] wastewater treatment plant and at this
[54:20] point unless there are questions um I'd
[54:24] recommend your acceptance of the uh
[54:26] digestive evaluation report and upon
[54:29] that we'll we'll initiate the next steps
[54:32] toward moving toward uh converting to
[54:35] aerobic
[54:37] digestion and that will entail
[54:39] construction project obviously and if
[54:43] you'll also recall the intent was also
[54:47] to add the uh VR air piping project to
[54:52] that contract uh it was n't a very
[54:55] attractive contract when we did let it
[54:59] uh bids were rejected and this would add
[55:01] it to a larger project and hopefully
[55:05] make it more attractive to a
[55:12] contractor very
[55:15] good if you're seeing glassy look on my
[55:17] face
[55:19] it I I actually right
[55:24] arm
[55:25] yeah we're supposed to know uh yeah all
[55:28] about this right 115 page
[55:31] report and
[55:34] uh yeah Carolyn you read everything but
[55:37] no I skimmed it I have to admit but I
[55:40] went for the summary there wasn't a
[55:41] summary I
[55:43] know so what I'm daring is any council
[55:46] member to go Toe to Toe with
[55:49] Randy thing it's not going to be this
[55:52] mayor I can promise you that I barely
[55:56] passed selling cars 101 so um we are at
[56:02] your you know
[56:05] directions that too but uh the one thing
[56:09] I would like to point out is on that
[56:11] summary on the on ry's memo the onm cost
[56:14] or the operation and maintenance cost
[56:15] over time for the aerobic digestor is a
[56:19] third of the cost less than what the
[56:22] it's here anob so it really behooves us
[56:25] to move in the aerobic digestion
[56:27] Direction well and I'm not going to blav
[56:29] this discussion why would anybody go why
[56:32] would anybody go the Anor robic then I
[56:34] mean what what you know I mean there's
[56:37] no long-term benefit there's certainly
[56:39] no short-term monetary benefit but I
[56:42] mean okay um that be a space restriction
[56:46] or they got to do it in a smaller area
[56:49] uh no they'll be the same areas we'll
[56:52] use the same tanks that we're using now
[56:54] they'll just be converted aobing It also
[56:56] says anerobic is not as safe either no
[57:00] an anerobic digestion is historically
[57:02] used in bi well I guess biological
[57:07] treatment units and is it's really
[57:10] customary to to use that um it's a good
[57:15] process it's a little more expensive
[57:17] than aerobic uh when you get to an
[57:20] activated sludge type process that we
[57:23] have converted to
[57:25] uh aerobic is more common and we knew
[57:28] that 25 or 20 years ago when we
[57:31] converted the plant to activate sludge
[57:35] and uh but the decision at the time was
[57:38] to stick with the anerobic
[57:41] well as time progressed we did upgrade
[57:45] all of the Anor robic digestion at that
[57:48] time um But as time progressed that
[57:51] equipment wore out and that was the
[57:53] reason for the evaluation of the current
[57:55] equipment and the high cost of replacing
[57:58] it um so it is now an opportune time
[58:04] really to switch over to aerobic uh for
[58:07] the 20-year
[58:14] cost so the next step would be that you
[58:17] enter into what design services and a
[58:20] document to prepare for the conversion
[58:22] itself yep yep at least that part I get
[58:25] but yeah ad hello yeah Tom it takes less Pepto Bismol this this way so
[58:34] digestor any other questions I certainly
[58:37] don't I need a motion to uh to approve
[58:41] the the the study is that correct yeah acceptance of the uh evaluation
[58:48] report second time and then mising any
[58:51] further discussion hearing none roll
[58:53] call please
[58:55] yes B yes face yeso yes yes stri
[59:02] yes thank
[59:03] you okay so we're moving right along to
[59:07] item 7 B which is the West Golf View
[59:11] subdivision Paving section seel
[59:14] selection and Randy you're still up sir
[59:16] thank you mayor um as you recall the
[59:20] West Golf View subdivision public
[59:23] platting and public Improvement work has
[59:25] been uh the design has been initiated at
[59:29] this time where you're at a kind of a
[59:33] critical point in selecting the paving
[59:37] section that you desire on West
[59:40] Street there you have two Alternatives
[59:42] basically a rural section which it
[59:44] currently is which is a pavement a
[59:47] shoulder and a ditch open ditch and
[59:50] regardless of what type of if that were
[59:52] selected regardless of what type of of
[59:55] adjacent development there is that ditch
[59:57] would have to remain in place the
[1:00:00] alternative is an urban section which we
[1:00:03] would uh add curban gutter to the
[1:00:06] pavement uh at least on the east side of
[1:00:10] the road we the left West Side would
[1:00:13] remain unchanged but adding curban
[1:00:15] Gutter and some storm sewer uh then the
[1:00:18] ditch could be filled and uh it would be
[1:00:21] more of an urban type section that we
[1:00:23] have in most of our streets in town uh
[1:00:26] it's it's critical uh the selection is
[1:00:29] critical certainly for the Aesthetics
[1:00:32] you know whether you like curbs or no
[1:00:34] curbs um and then this is impact will
[1:00:39] impact the the sanitary sewer location
[1:00:42] in this particular development and then
[1:00:45] the needs for plating the uh rural
[1:00:48] section will require more ride of way to
[1:00:52] be platted than an urban section does
[1:00:55] so those are it's kind of important to make that selection so we can
[1:00:59] continue to move forward with those
[1:01:02] plats and
[1:01:04] plans um we have prepared some
[1:01:08] conceptual opinions of probable cost uh
[1:01:12] for the rural and urban uh they are
[1:01:14] included in your memorandum in in short
[1:01:17] uh rural is anticipated to cost
[1:01:21] including uh the the grading and the
[1:01:25] sanitary sewer work storm sewer work and
[1:01:27] erosion control um
[1:01:30] $834,900
[1:01:32] the urban section is anticipated to cost
[1:01:40] 1,747 so at this point I would be happy
[1:01:45] to answer any questions uh if not I
[1:01:48] would recommend that you consider a
[1:01:52] selection of urban or rural for the the
[1:01:55] West Street golf West Golf View
[1:02:01] subdivision perfect questions for
[1:02:06] Ry I'll start with a couple um so
[1:02:08] essentially what we've got and I know we
[1:02:10] talked about this earlier on this summer
[1:02:13] um the rural is essentially what we've
[1:02:15] got along Grant Road which I think we
[1:02:18] kind of seem to agree with most that
[1:02:20] night that might not want to be
[1:02:22] replicated um so so the is the only
[1:02:25] decision we're making tonight then is
[1:02:28] just whether or not we want a curb and
[1:02:30] gutter it or not curb and gutter it and
[1:02:32] that's the only decision we're making
[1:02:33] tonight yes okay so it it does involve
[1:02:38] grading and erosion control which you've
[1:02:40] got listed in here but remember you and
[1:02:42] I talked one day about some of those
[1:02:44] lots particularly those interior lots
[1:02:46] are a little below the the the street
[1:02:49] grade does does does that 171 or 345
[1:02:53] include that that's over and above isn't
[1:02:56] it yeah if you wanted to bring the lot
[1:02:59] to street level on a on a couple of
[1:03:02] those lots uh that would be in addition
[1:03:05] to this uh these would include uh the
[1:03:10] grading and erosion control uh includes
[1:03:13] the filling of the ditches right and if you go to an urban section uh but
[1:03:19] then there may be more cost in changing
[1:03:22] the lot elevation yeah I walked it today
[1:03:25] and it it's it's very very similar to
[1:03:27] Grant Road in its current form the ditch
[1:03:31] just has enough they're they're both
[1:03:33] rural sections that's the way they were
[1:03:35] built now the the major difference uh
[1:03:40] between the two is
[1:03:43] um Grant Road has a 53 foot R half width
[1:03:47] ride of way so that road rideway extends
[1:03:50] to the back of the back slope so where
[1:03:54] the the ditch comes up that's where the
[1:03:55] lot starts and then goes in um but the
[1:03:58] housing houses on Grant Road have a 75
[1:04:02] ft setback I wondered yeah it's it's a
[1:04:05] unusually deep setback so in you know
[1:04:09] aesthetically it puts the ditch a little
[1:04:11] bit farther away from the front door
[1:04:13] than than a 35 foot setback and I guess
[1:04:17] you could establish whatever setback you
[1:04:20] want in the subdivision but the zoning
[1:04:23] will probably carry a 35t setback and
[1:04:27] then of course these lots are really
[1:04:30] only 10 20 ft deep or whatever we
[1:04:34] planted them so the the more setback you
[1:04:36] get the less rear yard you get and the
[1:04:38] closer you put them to the Fairway so um
[1:04:43] those are th that's kind of the
[1:04:45] difference between the what this would
[1:04:48] ultimately be and what Grant Road is
[1:04:52] now it looked as though and like whereas
[1:04:54] Grant Road has three East West stre
[1:04:57] streets and thus CS it looks like this
[1:05:01] one would only just have the one there
[1:05:03] at the golf course maintenance shed is
[1:05:06] there is there a second one at the
[1:05:07] clubhouse perhaps oh um in terms of
[1:05:11] coverts driveway coverts right each
[1:05:14] driveway would have to have a covert yes
[1:05:16] there might be one lot on the top of the
[1:05:18] hill that doesn't need it but otherwise
[1:05:21] it drains both North and South but n
[1:05:23] there's no other Street covers that's
[1:05:25] right okay no this driveway coverts on
[1:05:28] each each entry okay and then as I was
[1:05:30] walking I was walking on our Trail this
[1:05:33] neither neither decision would impact
[1:05:35] the trail whatsoever
[1:05:37] correct um would it yeah well the trail
[1:05:41] will be put back in but if it's an urban
[1:05:45] section there would be uh the street
[1:05:47] would be widened with a curbing Gutter
[1:05:49] and then the trail would have to be
[1:05:51] located relocated behind the the the
[1:05:54] curb and then
[1:05:56] sidewalks well it's either Trail or side
[1:05:58] I mean the trail would be a sidewalk uh
[1:06:01] as it is now uh with the rural section
[1:06:05] the the trail would stay where it is
[1:06:08] just I'm I took a picture yesterday walk
[1:06:12] the whole um area from the golf course
[1:06:17] North to one
[1:06:18] 8th and all of the all the residential
[1:06:22] homes on Northwest Street
[1:06:24] have cban gutter I to me it is illogical
[1:06:28] not to continue that and to expect and
[1:06:31] we're being very
[1:06:32] conservative at the assessed value of
[1:06:35] each house potentially being
[1:06:38] 700,000 um if if we are anticipating
[1:06:42] that uh price point I I think it will be
[1:06:46] very hard to sell Lots whoever ends up
[1:06:49] selling them uh and then expecting
[1:06:53] someone to to build a house at this
[1:06:56] price point when you have no curban
[1:06:58] Gutter and we even have curban gutter
[1:07:00] going past the golf course
[1:07:04] um um buildings are up to the the the
[1:07:09] buildings the City Maintenance building
[1:07:11] and so we have kbin gutter going right
[1:07:13] by the golf course parking lot by the
[1:07:16] clubhouse Etc and then as you look
[1:07:20] farther north you you get the
[1:07:23] perspective this is the very last the
[1:07:25] end of the uh curban gutter right before
[1:07:28] the city buildings the maintenance
[1:07:30] buildings so you know it's I guess we
[1:07:35] have to look at it yes it costs more but
[1:07:37] thinking long term and thinking about
[1:07:40] what we would like develop there to me
[1:07:43] it makes sense to continue the curban
[1:07:45] gutter and um that I think long term it
[1:07:49] will pay off for us as far as um right
[1:07:53] now we're getting nothing for that land
[1:07:57] so the um property taxes you look at the chart we have here um we're getting
[1:08:05] more than what we're getting
[1:08:10] now but the decision right now is just
[1:08:12] for curb and gutter right so right
[1:08:15] correct yeah I would agree with your I
[1:08:18] me thinking ahead deal with this is
[1:08:20] going to impact the price point of the
[1:08:23] homes and what we can what the Lots can
[1:08:25] be sold
[1:08:28] for I actually had somebody on Grant
[1:08:30] Road not even knowing that we were doing
[1:08:33] this wanted to fill in their ditch just
[1:08:36] because of the hassle with it the
[1:08:38] insects in the summertime and and that's
[1:08:41] even with a 75 foot
[1:08:43] setb U you know at first when I looked
[1:08:46] at this I thought well that's 340,000
[1:08:48] that's quite a bit difference but once
[1:08:51] that person called me and then I talked
[1:08:52] to another person I know they're not
[1:08:54] happy with what they have on cramp Road
[1:08:56] nobody is
[1:09:02] yeah any other questions for
[1:09:07] rannie what's the council's
[1:09:10] wishes urban urban is there a motion to
[1:09:13] that effect so moved uh was it Carolyn
[1:09:17] and then Tom any further discussion
[1:09:20] hearing none roll call
[1:09:22] please yes face yes power yes SE yes yes thank
[1:09:31] you okay we are moving right along to
[1:09:35] item 7 C and that is us30 traffic signal
[1:09:40] removal study on Adam Street and Court
[1:09:42] Street Randy thank you mayor um I don't
[1:09:45] know if you'll recall but in 2016 there
[1:09:48] was a study conducted for removal of two
[1:09:50] traffic signals along Highway 30 those
[1:09:53] were at Adam Street and Court Street uh
[1:09:57] the
[1:09:58] procedure that used was a developed out
[1:10:02] of the mutcd and the institute for
[1:10:05] Traffic Engineers um and that procedure
[1:10:09] um basically was twofold it uh included
[1:10:14] public notification in advance and then
[1:10:18] covering the signals for a period of 90
[1:10:22] days and during that that time the city
[1:10:25] received responses from the public and
[1:10:30] um at that time the decision was made
[1:10:34] not to remove the signals now it's been
[1:10:37] suggested that that that U process be
[1:10:42] reinitiated uh currently uh to uh begin
[1:10:47] to that to remove the signals and I've
[1:10:50] outlined the process in the memorandum
[1:10:53] and in includes Advanced notification to
[1:10:55] the public and then a period of
[1:10:59] non-operation in which we will observe
[1:11:02] and record uh some data we'll take any
[1:11:06] comments and bring those back at the end
[1:11:09] of 90 days so at at this point unless
[1:11:13] there's there are any questions I'd re
[1:11:16] just recommend you um consider the
[1:11:20] initiation of that type of study for the
[1:11:22] removal of those two
[1:11:26] signals quick question just to get
[1:11:28] clarification got it says stop signs in
[1:11:30] here stop signs will be placed on Adam
[1:11:33] Street to cross 30 in same withouth core
[1:11:36] correct okay yes
[1:11:40] yep temporary stop signs yep right yeah
[1:11:46] M at one time you mentioned that we're
[1:11:48] going to upgrade
[1:11:50] these yes does that replacing them all
[1:11:54] or what is that upgrade cost or what is
[1:11:56] it the upgrade that's envisioned at the
[1:11:58] current time in the capital Improvement
[1:11:59] program is for the uh computer equipment
[1:12:04] the electronic equipment in in the
[1:12:07] signals not the poles are not included
[1:12:11] but it's the
[1:12:12] controllers uh and everything in within
[1:12:14] the controller uh is the proposal at
[1:12:17] this point because you can't get parts
[1:12:21] for these much anymore can you we cannot
[1:12:23] get parts for those controllers
[1:12:28] now you don't have an estimated cost on
[1:12:32] one of those controllers it it'll run
[1:12:35] between 100 and 150,000 per
[1:12:40] intersection so if we eliminate Adams in
[1:12:43] court quarter of a million two to
[1:12:45] 300,000 yes
[1:12:48] M I think the question Tom and I had
[1:12:52] prior of the meeting that we had had for
[1:12:53] you is does it require a whole another
[1:12:56] study again we can't use the data from
[1:13:01] 2016 um and just move forward at the
[1:13:04] council's discretion right well the the
[1:13:07] process is set up to be pretty
[1:13:10] transparent you know to to warn people
[1:13:13] that you're we're going to be looking at
[1:13:15] this we are looking at it and now we've
[1:13:19] got data now the the data won't change
[1:13:22] that much the the hard data there will
[1:13:25] be reduction in delay time and we had
[1:13:28] anticipated about in 2016 about 17 hours
[1:13:32] of reduction in delay time during that
[1:13:35] 90day period uh which is huge in traffic
[1:13:39] counts um but more more likely it it's
[1:13:45] for transparency to to tell people it's
[1:13:48] going to happen and then make it happen
[1:13:51] and then decide if you really want to
[1:13:54] remove it I mean most the discussion
[1:13:57] within the building let's say in 2016
[1:14:01] favored the removal but the outcome
[1:14:05] after public input um was not removal so
[1:14:11] it just gives the public the opportunity
[1:14:13] to weigh in on uh something like that
[1:14:17] thank you I and I'm and I'm all for that
[1:14:19] part of it I so maybe something Tom and
[1:14:22] I weren't exactly clear on is we just do
[1:14:24] our own study Randy we don't do an
[1:14:27] outside consultant no nobody okay so
[1:14:30] it's just our own internal study so
[1:14:32] another question we turn this to
[1:14:34] flashing hellow and we had Adams going
[1:14:37] okay so can't we do that with I was ask
[1:14:40] Adams and court and just leave them
[1:14:42] flashing for a while that's an one of
[1:14:45] the
[1:14:46] Alternatives is to part of our stud to
[1:14:49] perform this with those flashing but the
[1:14:53] downside of doing that is people are
[1:14:56] still reading that signal and what we
[1:14:58] want to do is make that intersection
[1:15:00] look like there's no signal there so we
[1:15:03] get the the public reaction both in in a
[1:15:07] you know crashes is all is part of it
[1:15:11] and and then just in the public
[1:15:12] perception of no signal being there
[1:15:15] rather than because at the end of 90
[1:15:18] days you wouldn't want to keep this
[1:15:20] thing flashing forever I mean it just
[1:15:23] that's
[1:15:23] you'd have to replace the controller and
[1:15:25] it wouldn't save any money and whatever
[1:15:28] so um that it more likely this
[1:15:32] process reflects more of what it would
[1:15:35] be with no signal there and if we kept
[1:15:38] them flashing you'd still need the new
[1:15:40] controllers eventually too right so
[1:15:41] there'd be no there'd be no
[1:15:44] Savings in charge when this was flashing
[1:15:47] here we had quite a few accidents did
[1:15:49] you over this summer correct in more
[1:15:52] than normal in
[1:15:54] 2016 we had one accident in 90 days and
[1:15:58] it was a left turn I think at court and
[1:16:01] we've had quite a few this summer Brad
[1:16:03] more than normal really for what what
[1:16:06] were they for uh people were see the
[1:16:09] yellow light and slow to a stop and the
[1:16:11] cars behind them would not stop oh rear
[1:16:13] Enders huh
[1:16:16] nice so that's why you don't want flash
[1:16:18] he correct so with the lights gone I
[1:16:22] just want to clarify by how does one get
[1:16:24] across the road you have to you you
[1:16:26] definitely have to wait on your own to
[1:16:29] go there is no button to push right yeah
[1:16:32] put in unless you have new controllers
[1:16:35] well
[1:16:37] um I guess first of all to to try to
[1:16:40] answer that question yes you you have no
[1:16:43] protected
[1:16:45] Crossing um there the other signals do
[1:16:50] create gaps in the traffic uh uh so that
[1:16:54] you can enter and you can cross on these
[1:16:57] side streets and also one of the I guess
[1:17:02] casual observations during the 2016
[1:17:06] study um it was I was approached and and
[1:17:10] someone said where's all the traffic on
[1:17:12] Highway 30 you know really early in the
[1:17:15] study
[1:17:16] and a a response was given by another
[1:17:19] person that people are avoiding it
[1:17:21] because those signals are bagged that
[1:17:24] wasn't actually the case we we counted
[1:17:27] the traffic it was similar to what it
[1:17:30] was without the signals being bagged but
[1:17:33] it was moving through the town and there
[1:17:37] were so it really created uh reasonable
[1:17:40] gaps for entry vehicle entry onto the
[1:17:44] highway from these two intersections and
[1:17:47] ped Crossings uh at these two
[1:17:50] intersections so it's you know that's
[1:17:53] kind of what
[1:17:55] happens is a goal for this to to get the
[1:17:58] traffic through
[1:18:00] faster now this last time you did that prove that traffic went through
[1:18:06] town faster M it did yes okay and what
[1:18:10] spawned this most recently I had I had a
[1:18:13] number of citizens hey we really like
[1:18:16] this um can we look at this again and so
[1:18:19] I've had a number of them so I talked to
[1:18:20] Randy and said hey what would be the
[1:18:22] process so
[1:18:24] you've heard him too the same you know I
[1:18:26] had I had one don't mean to single yet
[1:18:28] but I'll I'll visit with her maybe as
[1:18:30] early as tomorrow but with with Adam
[1:18:32] Street I had one complaint from the
[1:18:33] treasurer's office that they couldn't
[1:18:36] get to the bank they couldn't C it was
[1:18:38] hard for them to cross the street and
[1:18:40] I've got to clarify that with her
[1:18:42] because I don't know why you couldn't
[1:18:43] cross at Maine and then go down rather
[1:18:47] than just crossing at Adams but I'll
[1:18:49] clarify that with her because she's a
[1:18:52] constituent to too and and there are
[1:18:55] Partners as well and I don't want to
[1:18:56] have any treasur deputies hit making a
[1:19:00] deposit with my tax money so
[1:19:03] um I'll I'll I'll follow up with her but but again I don't know I mean to me
[1:19:11] it makes perfect sense I use Adam Street
[1:19:15] when I'm shopping probably more so than
[1:19:19] do you know Court Street but that's more
[1:19:23] ped traffic for the housing along there
[1:19:28] um you know I mean I I told Aon when we
[1:19:31] put it on the agenda that I'm I'm really
[1:19:33] mooded on it but just want to do what
[1:19:35] the people want us to do and
[1:19:37] transparency is great and I mean and I
[1:19:39] appreciate your comments on that I I
[1:19:41] want to be fully but I was a little bit
[1:19:43] concerned about you know if we if if we
[1:19:45] invested x amount of money you know just
[1:19:47] seven years ago but we do it all
[1:19:49] internally so I'm good with that too so
[1:19:52] right that's fine we will have to make
[1:19:54] sure we have sign signing and that may
[1:19:56] be some upfront expense but those are
[1:19:59] outlined in that timeline so about a
[1:20:01] 90day process here is about what we're
[1:20:03] talking so um it's really about 120 day
[1:20:06] we start 30 days in advance so 30 90
[1:20:10] this is going to go under study and then
[1:20:14] uh also Public Announcement of that okay
[1:20:19] and then at at day Zero we be we begin
[1:20:22] and the okay the actual bagging turning
[1:20:25] off the signals and putting bags over
[1:20:27] them we'll be just in time for the
[1:20:28] Christmas holiday shopping season then
[1:20:31] so all right have it get started at that
[1:20:34] point like I say we have to make sure we
[1:20:35] secure signing yep um and have
[1:20:38] everything ready also on on day Zero we
[1:20:41] uh we reset the timing on the rest of
[1:20:44] the signals that are in place so that
[1:20:46] that's optimized uh for traffic okay
[1:20:51] council's wishes
[1:20:56] anyone would need a motion for the
[1:21:00] commencement of the removal study would
[1:21:02] be in order want to move forward so Tom
[1:21:06] Misty any further discussion hearing
[1:21:08] none roll call
[1:21:10] please yes yes yes yes yes yes thank
[1:21:19] you so we are at item 7D and police
[1:21:23] vehicle purchase Brad thank you mayor
[1:21:26] we'll do this the third time here
[1:21:27] hopefully um the notified late October
[1:21:30] by both new way and Champion Ford that
[1:21:33] um Ford was releasing their 24 models
[1:21:36] for bid um so we discussed that one at
[1:21:40] the council meeting I believe that night
[1:21:41] that we were the last council meeting we
[1:21:42] had about this um I did receive bids
[1:21:45] from Champion Ford and from New Way Ford
[1:21:48] we were not able to get a state bid for
[1:21:50] comparison for the third bid due to the
[1:21:52] fact fact that they're not ready yet so
[1:21:54] champion in a new way moved faster than
[1:21:56] the state did on this one to get his bid
[1:21:58] prices um one of the purchases is from
[1:22:01] last fiscal year and one is for this
[1:22:03] current fiscal year and the bids were
[1:22:06] put out and received by new way in
[1:22:08] Champion Ford within about 24 hours um
[1:22:11] newa Ford was the low bid by with a
[1:22:15] total bid of 91,4 $456 for the two
[1:22:19] vehicles um by only receiving two bids
[1:22:21] though we will need to wave the purchase
[1:22:24] policy 501 if we're to move forward with
[1:22:26] this bid and then we will also be
[1:22:28] selling a vehicle on gov deals um if we get these get a vehicle in this
[1:22:34] time so the plan will be to have no
[1:22:36] trade in but then the ton seld on go
[1:22:38] deals which we had planned to do back in
[1:22:40] the
[1:22:41] 2023 fiscal year also so if there is any
[1:22:46] questions I'll feel free to answer them
[1:22:47] otherwise my recommendation would be to
[1:22:49] accept the bid well first we have to
[1:22:50] wave the purchase policy 501 accept the
[1:22:52] bid for the two vehicles from New Way
[1:22:54] Ford and then also uh approve the sale
[1:22:57] of the 2008 Ford police interceptor
[1:22:59] through the gov deals auction
[1:23:01] site got a question on the sale one will
[1:23:04] be good enough for the airport one of
[1:23:06] those used ones pass on this one okay
[1:23:10] you
[1:23:11] could it's going to have a lot of miles
[1:23:13] on it by the time we are done with it so
[1:23:15] we spend what5 $600 a month now rent
[1:23:18] something that we could eliminate I mean
[1:23:20] it's a it's it's possibility you're it's
[1:23:22] probably going to have 130 plus th000
[1:23:24] miles on it um of police driving
[1:23:27] so it also has a water pump on the back
[1:23:30] of the motor which if you have any
[1:23:33] knowledge of cost about 3,000 to replace
[1:23:42] jeez okay so you heard the
[1:23:45] recommendation is there a motion to that
[1:23:50] effect second and then seconded by Le um
[1:23:54] any further discussion hearing none roll
[1:23:57] call please D yes sh yes Sean yes power
[1:24:02] yes B
[1:24:06] yes that's fine yeah motion is yeah
[1:24:13] thank
[1:24:14] you that did include I I kind of missed
[1:24:18] that there's a a second part of that to
[1:24:20] sell the other one on govdeals.com
[1:24:22] least that'll be the intention for right
[1:24:24] now the intent correct yeah sorry I kind
[1:24:25] of we see we get the plan is to I think
[1:24:28] production is set for January February
[1:24:30] for the 24 models it's a quick
[1:24:36] window well El say she's a whole new
[1:24:39] ball game today folks okay um we are at
[1:24:43] the end of tonight's agenda then under
[1:24:46] committee reports they're in our packet
[1:24:49] comments from the mayor I have none
[1:24:51] other than my uh reiterate my earlier
[1:24:54] comment about business development
[1:24:57] agreements and then comments from the
[1:24:59] city council it's nice to see Adam
[1:25:01] Street done very nice
[1:25:05] yeah anything else comments from the
[1:25:07] city manager you heard from me enough
[1:25:09] tonight Thomas we're at that moment is
[1:25:13] there a second second and JJ any further
[1:25:16] discussion hearing none roll call power
[1:25:19] yes yes yes yes it
[1:25:24] yes thank you
