Whereas, professional engineers make significant contributions to improve and support our quality of life in marion county through innovative and creative solutions to technical problems.

Wereas, professional engineers hold considerable responsibilities for the benefit and protection of marion county citizens and the areas of public safety, health, welfare, the environment, transportation, water power and communications as well
[15:08]
as mechanical electrical and electronic devices important to everyday life.

Whereas, engineers are encouraging our young math and science students to realize the practical power of their knowledge.
[15:20]
And.

Whereas, the purpose of national engineers week is to increase public awareness and appreciation of the engineering profession.

Whereas, the 2026 national engineers week theme transform your future is a powerful reminder that engineering shapes our opportunities, our communities and the futures we can imagine for ourselves and for our children.

Now therefore the board of county commissioners of marion county, florida by virtue of the authority vested in us do hereby proclaim february 22nd through february 28th 2026 be known as the engineers week duly proclaimed the 17th day of february

So I want to first want to thank all of you for all that you do in the community, all that you do for our county.

And then we also have engineering day march 7th.

>> item 8.1 relates o a board decision back in december of last year denying a small scale plan amendment that had a concurrent result owning for a period attached to t for a property off of southwest 80th street and southwest 72nd court.

So he board denied that application and for the small scale amendment and then the property owner withdrew the rezoning because they needed the complaint amendment for the rezoning.

Subsequent to that in january of this year the applicant ms.
[24:10]
Campos only through her attorney mr.
[24:17]
Roper in orlando filed a request for a mediation and I flew her hearing.
[24:25]
We're becoming more familiar with those things lately and among other things that would call for a mediation process that could take a day of board a board member and staff time to go through that in lieu of that and discussions with attorney
[24:47]
roper, we've subject to the board's approval of course agreed that we would I would recommend to the board that the board allow this as a way to be able to bring her application potentially with modifications back before the normal 12 month
[25:09]
period that you usually have to wait and then that would come before the board.
[25:17]
This this agreement makes no commitment whatsoever that the board would approve any new application for ms.
[25:25]
Campos okay.

But this is in lieu of the the florida proceeding.
[25:32]
One of the outcome potential outcomes of the polluter proceeding is that it might end up coming back before the board anyway.

So it's the thought of mr.

Roper and myself that this might save all the parties concerned some time and attorney fees.

>> so my recommendation is the board allow this if the board agrees with this then at the next board meeting I would bring a very brief agreement signed by both parties back to the board itemizing these items.

Jason roberts, the ceo of upper communities made a presentation to the board regarding his firm's proposal a very unique proposal to provide affordable housing for essential workforce for government agencies including potentially marion county

employee city of ocala employees, marion county public school and marion county sheriff's office employees and this would be a a unique project that among other things
[30:17]

sheriff's office employees and this would be a a unique would provide for marion county- to own the tract of land and then there would be a master lease agreement between marion county and the developer.

The developer would develop several hundred a single family homes, single family and or potentially multifamily homes that would have the benefit of lower than normal arket rates for rentals for qualifying public employees the idea being that
[30:56]
this would address the dual needs of public agencies both for attracting new employees because of the need for affordable housing and also retaining employees that we already have for the same reason.

So it's a very interesting proposal.

The same company currently has a project that they're working through the details on up in franklin county a little bit different than us but at this point all I'm asking for from the board is consensus is for us to continue our due diligence
[31:33]
review of this.
[31:36]
That was a request of upward communities they have a council with gray robinson in orlando and also their bond counsel up in tallahassee, brian miller and have and we're going to be having a subsequent meeting when I say we chris traver, our
[31:55]
bond counsel and myself and representatives from the clerk's office this coming friday to continue to evaluate the aspects of the financing.
[32:06]
Of course our objective in this is to look at it from every possible angle and determine that this would be safe for the board of county commissioners to enter into such a deal.
[32:19]
It would be kind of somewhat similar to a conduit financing that we enter into with industrial revenue bonds.
[32:28]
So generally speaking the board would not have direct liability on any of the bonds that would be used to finance it.
[32:34]
But we want to make sure that the board wouldn't be exposed to any indirect negative impacts on our financial statement as a result of the project.
[32:44]
So again we've been working aong in discussions both in person with representative from upwork communities and munir's office and online zoom calls with their representatives and we're just asking for their benefit.

They want to know that the board is really has an interest in this and that's so I'm asking for today commissioners any questions comments yeah I mean yeah I'm still very interested to to see the process through and to see what the possibility
[33:21]
of doing that is.

I think there's a significant benefit that that could that could be for for the county and for our staff and employees and I think it's a great idea.

You know, just like when we kind of did the landfill deal, I want to make sure at the end of it that worst case scenario and we know exactly what that is and taxpayers don't lose.

And so ust wanting to continue those discussions more than anything I think the concern is how what the actual documents would look like and say and how that would translate to what would be on the county's books as far s potential liability

Would it affect our bonding in the future those kind of questions right.

They're all great questions that we need to know at least if we yeah and just as an aside commissioner curry, I would say to you know I think you know as the discussion goes forward if the sort of methodology nd approach looks sound you know

I think it's worth having an honest conversation for you all amongst yourselves and with each other at meetings.

>> you know there is sort of the national narrative of a need for public housing.

I will say at least in my own experience part of the growth we're experiencing here in marion county is still relative to other places even in the state, much less he country.

We're actually in pretty good shape.

I mean I keep getting new employees from south florida because they're moving up here because it's more affordable to buy housing here.

So I think, you know, before you get too far down the road of does the financial package make sense, it's like is that something you really want to commit to or not?

Craig well, you know the only originally I think the big concern from the commission was that it was looking like we were going to encumber upwards of $200 million of bonding but that doesn't seem to be the case.

>> yeah, I think you know all that remains to be seen.

We certainly we've heard representations from their principal that it wouldn't be the case but it's still a fairly novel concept that's still being worked out in its first iterations elsewhere.

So it's not in my opinion sort of a tried and true proven approach yet it's not to say can't work or you can't get there but there's definitely some lingering concern about you know, somebody is going to be on the hook and it's most likely the
[36:38]
county that kind of money in that scope project isn't done without somebody ultimately being on the hook for it.

>> well, I mean I think we've all said about the same thing and I don't think our position has changed.

W're very interested but again we are not willing to encumber our our borrowing abilities and bonding abilities in the future .

We need to figure that part out and then once once the deal comes to us and we get a draft paper document then we can actually make it we can actually start to make some decisions until then we're interested.

Just a reminder for the public to this is just a snapshot of what we've got going on in the county.
[38:13]
If you o to the agenda you can download the map of some of our highest priority projects as well as more information on numerous projects throughout the county.

With that I'll go right into the presentation.

I wanted to highlight the southwest 40th the 49th avenue phase one project as well lots o work going on right now southwest 60 street 66th street intersection improvement phase one detour is an acted.

We're also improving upon that detour.
[38:42]

Just last week we met with the school board and the new principal at the south marion high school and have some more school presentations that will be giving the later part of this month southwest 80th and 70th avenue segment three.

We're finishing up some of our last few negotiations.

The good news for us work is the largest roperty owner as it relates to outstanding teaching properties.

What that does is open up that project for us as we're negotiating and settling the last few remaining parcels that'll open up the entire north half of this project potentially they have a lot of holdings on the east side down here as well that

We can work with the contractor saying you can work in these areas, you cannot work in these areas.

We have two main categories of activities that the board of county commissioners deals with.

The most important category is comprehensive land use planning state of florida and florida courts have called the comprehensive plan the land use constitution for the state of florida when the board is dealing with comprehensive plan issues

they are acting in a legislative policymaking function and they have broad discretion in the decisions they can make about that.
[56:32]
The chairman indicated that we're where you have a forum where you can express a your opinions and actually the opinions are more relevant when we're dealing with policymaking functions.
[56:47]

All of the items are what we call quasi judicial proceedings and that means they're either rezonings or special use permits and the rezoning include applications for a planned unit development which is a specific type of rezoning .

The issue for special use permits and planning developments is there are three three criteria that are most important.
[57:28]
Number one, all of these applications have to be consistent with the future land use map in our comprehensive plan.
[57:39]
For instance, if someone was coming in for some kind of intense commercial development in a rezoning but he comprehensive plan for that property said it was for agricultural or rural property it would be inconsistent and would not be allowed.
[57:54]
I don't think we have that situation here today.
[57:58]
So the first item is is the application consistent with the cob plan?
[58:02]
Second item is is the item in the public interest and now this is an area where the board really engages in quite a bit of balancing of different interests between the interests of the public at large.
[58:20]
Obviously the board is elected by the electors f marion county so the board has to consider the interests of the public at large.
[58:31]
But at the same time the board also has to balance the interest and concerns of the public at large with the property rights of the property owner and or developer who is making the application and property rights have constitutional protections
[58:47]
in in america and in the state of oregon.
[58:52]
And so the board is always concerned about both of those factors when balancing considerations of whether something is or is not in the public interest.
[59:02]
And then finally we have the issue of whether or not the application is compatible with the surrounding property.
[59:10]
>> the unique thing about special use permits and planning developments as opposed to a regular rezoning is that both the special use permit and the planning unit developments allow the board to impose certain specific conditions on that particular
[59:30]
project.
[59:30]
One of the most important goals of those conditions is to provide for enhancing the compatibility of the application with the surrounding property and when the application comes up the applicant or our staff will read out the conditions that
[59:49]
are recommended if the board is going to approve that item.
[59:53]
If you are here not upporting the item but if you're opposed to it listen carefully to the conditions that are being recommended.
[1:00:02]
If there's some reason that you believe some additional condition or more stringent conditions should be imposed imposed as part of your statement to the board, you're free to recommend omething in addition to what staff has already listed in
[1:00:20]
the application materials and the board has the discretion to evaluate that when it comes to their deliberation the order of presentation is that generally speaking the staff will introduce the item then we will invite the applicant up to provide
[1:00:39]
more specific information about why they're asking for what they're asking for, what the project will entail and so forth.
[1:00:46]
After we finish the staff presents ation and the individual applicant's presentation then we open the hearing up to comments from the public and we have two podiums and particularly with an enthusiastic crowd like we have today we encourage
[1:01:05]
people that want to speak to utilize both of these podiums and so what does that mean?
[1:01:13]
We recommend that a couple of people kind of line up on the wall not candy but a couple of people and kind of wait your turn behind the podium so that as soon as someone speaks at this podium we usually go to that one but then you'll be moving
[1:01:28]
up to this podium so that you can be ready to speak so that we can keep the proceedings moving along steadily.
[1:01:36]

They are requesting to waive the wall requirement completely so not been an offense or anything but nstead provide an enhanced buffer.

gift shop, the distillery itself and a couple of outbuildings just some site photos of the property.

We gave them a little bit more time to try to get things finalized.

Came before you in august and then at that time they were granted the six month period in which to have one of two things happen which we'll get into in a moment.

Of course we had those list of concerns at the time staff recommended denial planning and zoning recommended denial and that brought us to the six months.

So we did ask why that was.
[1:49:58]
We were told that the process itself was cost prohibitive just for needing to do things like reach out to have an engineer provide a site plan the cost of building permits.

So they said that the that option was cost prohibitive and then option two they said that they did look for some alternative locations but they did not find anything that would match the needs of the distillery for present or future.

So currently either of those things have happened and that's where we are today.

There is commercial here to the west which is the dollar general and then to the south there's also a little bit of commercial to the north is the tropicana village residential community and into the west and south you have other residential

communities and to the far east over here and the belleview area is an industrial commercial park coming in future land use is commercial and the zoning is b one hich allows for restaurants but no drive thrus and everything must be completely
[2:07:55]
indoors and as it is intended to serve neighborhoods, here's some site photos.

This is the location the actual property here and this site this part this one right here is looking through north into the vacant parcel.

Here's the proposed site plan originally the request was for 24 food trucks is the applicant did back it down to 21.

One key note here is anything above 15 food trucks would require a full traffic study a 15 food trucks and below is a traffic assessment and they are proposing 120 seats within the facility with a dining hall and permanent restrooms with parking
[2:08:53]
of 60 spaces and on the site plan here they're showing two two buffers the first one being 25 foot with a six foot vinyl fence and the second being another 25ft with a nother six foot vinyl fence.
[2:09:12]
One thing to note here is this site plan does not account for stormwater if approved they would need a place to put heir stormwater and it's likely that it would be pointers not working today very well likely would be in the buffer rea so that
[2:09:29]
needs to be taken into account if this is approved when it comes to access the applicant would like access here where there's an existing apron curb cut for on highway 44 however stuff does not like that access code they would need to come in
[2:09:52]
through on southeast fourth avenue come through the dollar general and through parallel access and enter the site that way.
[2:10:01]
One issue here this does not this this access does not meet the distance between access points for measurement and also you have the merge lane coming in from from belleview that is like right here at the end of the property and that would be
[2:10:19]
potentially a very dangerous access point.

Here's he site with the site plan on it showing the growing the access through dollar general when we compare this to other restaurants we're looking at a high turnover sit down restaurant.

They might get what 142 seats they get 55 peak hour trips in the evening fast food with a drive through with 103 seats but get 99.9 peak hour trips and then you can see here when we calculate the different food trucks at nine food trucks 5,
[2:11:07]
1592 and then at 0 food trucks you get 123 123 premium peak hour trips that's comparable to more of a fast food restaurant when you come nto the the pm peak hour trips when parking looking at the required parking staff broke it down to something
[2:11:31]
comparable to a food truck park like in osceola county which is right here they have for food for for parking spaces for the first vehicle and then two spaces for each additional vehicle beyond that .
[2:11:46]
And here a proposed 120 seats and of 20 food trucks they would need t least 42 parking spaces and they're offering 60 .
[2:12:02]
>> it is one when we look at utilities, the water sewer is about 1000ft away and they are within connection distance to the city of belleview central water and central waste sewer water, sewer lines.

The applicant I believe just not want to connect to centralized water sewer looking at planning principles within the rugby his would allow for a mix of land ses to create compact commercial areas and employment hubs that would strengthen and

direct development towards existing communities and foster distinct and communities.

That's what staff's analysis found.

So with that said we have found that it on its face it would not affect would not adversely affect a public interest.

Originally we had a proposal to have a playground for all the kids in the area and all of our visitors our ommunity behind us voiced their concern about noise after certain hour that playground was going to have a fence around it nd it was going

to be closed.

The fence and the playground itself 20 minutes before closing but in light and in lieu of what everyone has voiced like said, it is a very open ended project and I'm very open minded to everything and the concerns of our community.

We've gotten rid of the playground itself on top of that we've gone ahead and we've done two buffers to 25 foot buffers which I don't want to speak for everyone but that's that's a pretty big buffer and it's a total of 50 50 foot buffer approximately

14,000ft2 of buffer area and I'm proposing two different fences one at the 25 foot mark and one at a 50 foot mark as well.
[2:16:08]
We have brought down the the amount of proposed food trucks to 2024 could add traffic to the area.
[2:16:18]
So obviously we're very cautious like I said, we are down to 20 and ithin our market study and our business study 20 is what we need to operate within business sense and business bounds.

Like said we are a full operational we plan on being there for for a while for decades to come.
[2:16:41]
This is a heavy investment obviously not $24 million like the previous gentleman I'm just a kid that grew up in a low income family and worked his way up in the world and intend to keep it so it's about 600,000 as far as development costs go

and I mean for someone like me or someone like us that's pretty half the amount we are.
[2:17:06]
We know we understand that all of the conditions are public that would deter most developers and most entrepreneurs.

pretty good job of creating one that does that.

Having said that, our food vendors are to be inspected periodic periodically and actually I'm the one to impose this periodically by the health and fire department as mandated by applicable restaurant industry standards.

two line of fences one at the 25 foot mark and one at the 50 foot mark that we may be given a waiver for the mason wall.

It is of note that we are also proposing a chain link fence at the very front and sides of the whole compound for safekeeping and to be able to close the entry gate to public access 20 minutes before closing so that way we ensure that we are
[2:23:28]
following what we propose at all times.

It ill be like clockwork 20 minutes before closing time no one else will be allowed in, will be allowed in.

This is a one way driveway so the entry get will be closed 20 minutes before closing time and again those are pretty comprehensive and very limited hours but alas something that I'm willing to work with we ask that we are able to get the here's

the bill the boogeyman that always keeps coming back.

We asked that we are able to connect to a water well with a filtration system and a septic tank for the first five years we asked that we are able to connect to our local water and sewer systems between year five and six.

This is obviously as part of a five year business plan as right now the closest per the city of belleview, the closest connection point for both water and sewer sewage are at 1006 hundred and 30ft.

That's I mean that's pretty cost prohibitive for any corporation.

Never mind someone like ourselves at this point in water sewer connection of this magnitude is understandably cost prohibitive worth it is cost prohibitive for us and that is of note that I myself proposed and insisted on providing clean water

for the greater safety of our community.

For this project's very inception we will be providing water to all of the food vendors and we will also be clean water of course and we will also be providing electrical hookups 30 amp 50 amp hookups that way there is virtually zero noise coming
[2:25:08]
out of our compound that is 50ft of buffer space two separate fences that is no not a single generator site.
[2:25:16]
Everything will be underground electric joint underground infrastructure that is very expensive as revenue up our cost but I'll be this is something we're okay with because again we re here to do right by the community and if you want to you
[2:25:34]
know if people talk about traffic okay is now the number two most moved to region in the whole country I can't stop it no of course not that developers are developing left and right.

We can't stop that at all.

park service that is a centralized company, a centralized subcontractor company by ourselves by the management company company that guarantees that all the trucks are pumped out at the right time and it's done in a professional manner.

We're not going to let anyone just do what they want to do the dining hall itself was and actually I did the scientist myself I did take a little bit credit for that.

My main concern is the safety issues created by the use of the dollar general parking lot as egress to and from 47th avenue kids jump out of cars in ad in their excitement make a beeline to the store not waiting for the adult or thought of checking

lot of the church located directly across on the north side of 44 thereby crossing four lanes of traffic with no designated pedestrian crossing or lights only a ditch as a safety zone separating the lanes.

So obviously there will be a photometric plan and also a photometric plan for a soft light nightlight and so that obviously because we're going to have a 24 hour surveillance system at all times as far as security goes, we're going to have a

There's going to be a second fence at the 50 foot mark, a third fence at a 25 foot mark and then a fourth fence at the at your own on your own perimeter on your own property's perimeter.
