[2:54] here for the sikh awareness and appreciation
[2:55] month

[3:05] sikh awareness and appreciation month
[3:07] whereas
[3:09] sikh is the 5th largest religion with
[3:10] 25 million
[3:13] followers worldwide and more than
[3:14] 500,000 in the united states many
[3:16] of whom have called california home
[3:19] since the late 1800s whereas sikh
[3:20] americans
[3:21] have contributed significantly to
[3:22] the
[3:25] nations growth to their work
[3:26] in agriculture, business, education, technology
[3:28] and public service including
[3:31] the city of martinez where
[3:33] councilmember malhi became the city's
[3:34] 1st sikh
[3:40] american council member whereas the
[3:41] values of equality, service
[3:42] and justice are reflected through
[3:43] acts
[3:44] of community service including providing
[3:46] free meals,
[3:49] aiding seniors
[3:51] and supporting local relief efforts
[3:52] whereas despite
[3:53] facing discrimination and hate crimes
[3:55] sikh americans continue to demonstrate
[3:56] resilience,
[3:58] compassion and eternal optimism
[4:01] in opposing the dignity of
[4:04] all people.
[4:05] whereas the city of martinez honors
[4:07] and celebrates the many ways sikh
[4:08] americans
[4:09] strengthen communities and enrich
[4:10] the social and cultural
[4:12] fabric of our city and our nation.
[4:15] now therefore be it resolved that
[4:19] mayor zorn and
[4:21] city council on behalf of our entire
[4:22] council I should
[4:25] say do hereby proclaim november 2025 as
[4:28] sikh awareness and appreciation month
[4:29] in
[4:31] the city of martinez.
[4:40] and so, very quickly I
[4:42] have up here many local residents
[4:46] in martinez including business owners including
[4:49] daisy and
[4:52] , the owners of the subway and we
[4:53] have the
[4:55] owners of the marina minimart
[4:58] and pacheco truck stop
[5:00] and we have some other local residents
[5:01] here as well and
[5:04] I want to say thank you, we are so
[5:05] proud you
[5:07] have chosen to call martin is
[5:09] your home . We have a representative
[5:10] of the local
[5:13] house of worship
[5:16] where many of
[5:19] our local sikh go to worship. Did

[8:44] swearing in our 3 newest sergeants

[8:46] this time I would like to call forward
[8:47] sgt. Mayberry,

[9:35] so, before we get started with
[9:36] their portion I wanted to recognize
[9:38] a few people 1st of all current serving
[9:39] officers
[9:40] that are here if you're not standing,
[9:41] stand up so we can recognize your
[9:44] service to our community.
[9:47] thank you. Some are still shy.
[9:55] secondly I want to recognize we have
[9:56] numerous retirees
[9:58] that have joined us, including 2 prior chiefs.

[10:14] I just want to point out in
[10:17] law enforcement
[10:20] particularly serving in
[10:21] the city of martinez service extends beyond
[10:23] any one of us
[10:24] it is about the connection to the
[10:25] community and connection to the profession
[10:26] and I was incredibly
[10:28] delighted to see all the retirees
[10:29] that have shown up to support
[10:31] this legacy. We have one individual
[10:35] sgt. Mayberry
[10:36] who essentially grew up through the
[10:38] department and it is nice to see people
[10:41] coming back and supporting, I
[10:43] want to stand here to say how much we
[10:44] appreciate all of your service
[10:46] and we never forget what you have
[10:47] done for the city
[10:49] and we will do everything to continue
[10:50] to take care of
[10:51] you, we are delighted to have one
[10:53] retired k-9 dog that's
[10:56] hiding in the corner.

[12:55] important people in the department
[12:57] in leadership
[12:59] by the front-line supervisors 24 hours
[13:00] a day
[13:01] providing support , leadership and
[13:03] guidance in the mentorship
[13:04] for officers coming into the agency
[13:17] it takes a lot to go through the testing process.
[13:18] preparing yourselves to do it
[13:19] and these 3 individuals have done
[13:20] everything they need to do to earn
[13:21] this position.
[13:22] and the coming months the coming years
[13:23] will demonstrate that through their
[13:24] hard work. I
[13:25] appreciate you stepping up to do this
[13:27] and behind them we have
[13:30] 2 more sergeants promoted
[13:32] so it is a big deal for martinez police
[13:33] and maybe the most
[13:34] sergeants promoted in a short period
[13:36] of time.

[19:55] a special business of the month and
[19:58] I am honored to do this one in

[20:06] the mayor and city council for having
[20:07] us tonight, thank
[20:10] you everyone and city staff and my
[20:11] chamber
[20:12] staff for being here. In the business community
[20:13] we
[20:16] talk about the successes
[20:19] of businesses and a special success
[20:22] is when a business is able to start and
[20:25] and last for a really long time and
[20:27] then move on without the business
[20:31] closing, have the business change hands
[20:34] and that is a
[20:35] huge tremendous success story when
[20:37] a small business can do that and the
[20:38] california
[20:40] magic club is a great example of that situation.
[20:43] jerry griffin started the
[20:46] magic theater many years ago.
[20:47] has been a fixture of martinez 21
[20:49] years and announced
[20:52] his retirement last month. And
[20:55] now taking the home he
[20:56] has bought the business and is carrying
[20:58] on the magic
[21:00] and we could not be more thrilled
[21:01] for knowing that jerry
[21:04] is able to lead
[21:07] , lead to the next phase of
[21:10] his dream and that john is
[21:12] going to be able to carry on his dream
[21:13] as well within
[21:16] the business. So I want to thank and
[21:17] honor both
[21:19] jerry and john as business
[21:21] of the month for chamber of commerce and
[21:25] to wish you both well, great success and
[21:26] to
[21:27] applaud you for what you are doing
[21:28] in the community

[24:09] room the 1st person I saw when I came
[24:11] in was joe sitting
[24:12] over there. That gentleman was here
[24:14] in town 21
[24:16] years ago when we 1st got started
[24:17] he would come in
[24:19] and have lunch when we were serving
[24:20] lunch but for
[24:21] anyone in business for themselves
[24:23] they know it's a lot of hard
[24:26] work, sweat and a few
[24:28] tears when you get started. I am very grateful
[24:29] we have been
[24:32] here as long as we have and it
[24:33] is a wonderful time and I want to
[24:35] say thank you to the city
[24:38] who welcomed me so well back in the day
[24:41] when we opened on april
[24:44] fools' day of 2004. I had been to
[24:47] a number of cities,
[24:49] the one I grew up in, antioch, pleasant
[24:50] hill where I had my
[24:51] magic store at the time and there
[24:53] was a lot of hoops to jump through
[24:55] and a young lady by the name of debbie
[24:56] dodson who had a
[24:58] business in town said you have to
[24:59] come to martinez and see
[25:01] what they are doing so when I came down
[25:05] a lady
[25:06] by the name of leanne I can't remember
[25:08] her last name she was
[25:10] the business development lady at the
[25:11] time, she
[25:12] took me around and showed me all of
[25:13] this. Everyone, the gentleman in charge
[25:14] of
[25:16] the business building codes and everything
[25:17] like that, he took
[25:20] me in and made it very easy
[25:25] to get started so I want to say how
[25:26] grateful I am to the city
[25:28] of martinez and all the help you have
[25:29] given me over the years
[25:32] now to my dear friend john
[25:33] who I have known at least 30 years
[25:35] and as the old song
[25:37] goes. I do believe that truly so thank
[25:38] you
[25:41] very much everyone. Thank you.

[33:03] we have to offer versus a traditional
[33:04] public
[33:05] restroom we will give you a quick
[33:06] overview and talk about how the throne
[33:08] in martinez is going so far so one
[33:09] of the benefits
[33:12] is we are able to collect a lot
[33:15] of awesome data , not on your specific
[33:16] usage,
[33:18] I swear but on usage trends in general
[33:19] so
[33:20] we will go over that and time at the
[33:21] end if
[33:24] anyone has specific questions.
[33:27] jumping into how we
[33:29] got here today. Martinez was the 1st
[33:30] city to actually bring
[33:33] smart restrooms to the bay
[33:36] area and after you we had south
[33:38] san francisco and berkeley follow suit.
[33:42] one to highlight you as you are the
[33:44] leaders of innovation of the bay area
[33:45] when it comes to smart restrooms which
[33:47] has been exciting to see this newer
[33:48] innovative bathroom
[33:51] really take hold into your town
[33:54] and we have seen comments from
[33:57] users letting us know it has made
[33:59] it easier for residents to shop, dine
[34:00] and stay around main street
[34:03] known to have a public restroom option
[34:04] available
[34:06] to them. You might be
[34:07] wondering what is different about
[34:09] the thrown
[34:12] advised this public restroom something
[34:13] we're
[34:14] talking about today? The throne is a innovative
[34:15] new smart bathroom
[34:21] so it is ada compliant making it easy
[34:22] for folks to
[34:24] use even in a wheelchair,
[34:29] fast and flexible we can pick it up
[34:30] it is prefabricated and
[34:32] move it to the place we want to be
[34:33] in with no hookups and for
[34:35] that reason, no hassle, you don't
[34:36] have to have a sewage system or plumbing
[34:38] system underground and you don't have
[34:39] to have electrical hookups if you're
[34:42] able to access solar so that makes
[34:43] it easy for
[34:44] you to put it where you might need
[34:46] a portable bathroom.
[34:49] we also have smart systems
[34:50] in place that promote user accountability
[34:52] so while
[34:54] in some traditional bathrooms you
[34:55] may have issues
[34:58] around users using it or misusing
[35:01] the space we don't see that
[35:03] as much in throne because we have
[35:04] accountability
[35:06] systems built in and we have smart
[35:08] cleaning system we will talk more
[35:10] about where we are able
[35:11] to proactively and reactively clean
[35:18] thrones based off of usage patterns
[35:19] and we hold all the
[35:20] cleaning and maintenance for you.
[35:22] this slide
[35:24] says the same thing. Wanting the highlights,
[35:28] you don't have to do upfront capital cost
[35:31] where traditionally you may have to
[35:33] do a lot of planning to make a new
[35:34] public
[35:35] bathroom, this, you can deploy quickly
[35:37] because you
[35:39] don't have to spend the time planning
[35:43] and digging
[35:45] and doing the upfront capital that you would
[35:46] do
[35:47] in traditional bathrooms, able to
[35:49] deploy thrones within hours of knowing
[35:50] where
[35:52] we will put it and then planning
[35:53] in advance. Highlights include having
[35:55] a baby changing
[35:57] station in which we know parents comment
[35:58] they appreciate
[36:01] having a clean space to take their child
[36:04] into the restroom. We are
[36:07] launching this qr code
[36:10] integration with our system
[36:12] that makes it accessible for blind
[36:13] and low
[36:15] vision folks coming to all thrones
[36:19] fleetwide
[36:20] 2026 so we are excited to make it
[36:22] go beyond what is necessary
[36:25] to be ada compliant, but even
[36:28] become more accessible for a larger variety
[36:30] of folks and we have the option to
[36:31] add
[36:33] menstrual product dispensers and sharps
[36:34] containers and other things
[36:37] that make ours really accessible
[36:39] for a larger group of audience so this is
[36:40] a photo
[36:42] of what it might look like out in
[36:43] the wild.
[36:46] one of
[36:48] the things I mentioned was smart cleaning and
[36:51] the smart cleaning system is designed around
[36:52] a couple of
[36:55] different inputs. If we know the throne
[36:56] has
[36:57] been used a lot or folks are commenting
[36:58] the throne was
[37:01] really dirty, maybe somebody was washing
[37:03] their hands and they splashed everywhere
[37:06] where they had thrown the paper towels
[37:07] to the side rather than putting
[37:09] it in the bin users give us feedback,
[37:13] they ask how is the experience with
[37:16] throne today or can they rate cleanliness
[37:19] so if we start to see that going down
[37:20] that goes into the algorithm and how
[37:22] many times has
[37:25] the throne been used
[37:28] since the last clean as well as additional
[37:29] pieces
[37:30] that go into this formula. That tells
[37:31] us when do we need
[37:34] to go out and service the throne proactively
[37:35] so
[37:37] we can maintain a really sparkling
[37:38] service experience for any user who
[37:40] will use one
[37:43] so that's what the flow will look
[37:44] like
[37:45] a user uses the throne they are asked
[37:46] how it is
[37:49] that goes to the algorithm
[37:52] and you can see the algorithm of the
[37:53] cleaner who
[37:54] goes into clean the throne and send
[37:55] the update saying that it is good
[37:58] to go. So far
[38:00] while the throne has been in martinez
[38:01] here are results to date.
[38:04] from that cleanliness score that
[38:07] users are putting in
[38:10] after use we
[38:11] have maintained 4.3 out of 5 average
[38:12] cleanliness score for the duration
[38:13] of the time
[38:15] we had the throne which is pretty
[38:16] good anything
[38:19] over 4 is pretty remarkable. Seems
[38:21] like folks in martinez have taken
[38:22] good care of
[38:25] the throne and see it
[38:27] as part of their community. We can
[38:28] tell from
[38:31] pieces like
[38:32] there been no instances of vandalism
[38:34] to the bathroom and we have had
[38:37] no users with access restricted
[38:39] due to repeated misuse, to explain that
[38:40] we
[38:42] have this accountability mechanism built
[38:43] into the
[38:46] throne where if you're inside,
[38:49] your use is tied to a user id attached
[38:52] to your phone number
[38:55] so it does not tell us natasha is using
[38:57] the throne but user abc is using the throne
[39:01] and if the person goes in and misuses
[39:04] the throne which could mean they
[39:06] stay past the allotted 10 minute time
[39:07] period or
[39:10] their smoking in the throne or doing
[39:13] something else that can spark

[39:52] are not staying past the allotted time
[39:57] so, in 15 minutes 99.8% of people
[39:59] are leaving
[40:00] and most people take less than 2 minutes
[40:02] so it's not a place
[40:05] that's having any loitering or
[40:08] any vandalism issues. It has become
[40:09] a great shared resource and we see
[40:11] that in the data.
[40:13] one of the other positive things I
[40:14] wanted
[40:16] to highlight is 34% of users have
[40:17] come
[40:19] back more than once so this is a testament
[40:20] to
[40:22] how much this is a community resource,
[40:24] folks are using it multiple times.
[40:32] last year I want to share copy
[40:33] and pasted comments directly from users
[40:35] that they have shared with
[40:38] us. 1
[40:40] user uses the throne and asked how
[40:41] the
[40:43] expense was if they let us know on
[40:46] scale of 1 to 5 over text they are
[40:47] asked if
[40:48] they would like to leave additional
[40:50] comments about their use.
[40:51] these are some comments that folks
[40:53] have shared
[40:56] and one of
[40:57] the best ones was amazing expense,
[40:58] I was panicking for any place for
[40:59] relief,
[41:02] this experience blew my mind,
[41:04] 10 out of 10 will be back again probably.

[52:27] unleaded fuel, buchanan continues

[52:33] toxic leaded fuel, each propeller
[52:34] plane flying out of concord
[52:37] releases an estimated 2.3 teaspoons
[52:38] of
[52:40] toxic lead dust per hour.
[52:43] in 2016 there were over 122,000
[52:46] takeoffs and landings , that's a lot
[52:49] of lead. Flight schools based at
[52:52] buchanan burn leaded fuel
[52:55] as they do loops around the airfield
[52:56] all
[52:57] day long every day, our concern needs
[52:58] to focus on the counties
[53:01] lack of concern.
[53:03] please read the airport director's
[53:04] county
[53:06] website update regarding the transition
[53:07] to
[53:10] unleaded fuel it states that an
[53:13] unleaded option has been on the market
[53:16] for the last 6 years and
[53:19] he added only 68%
[53:25] of the
[53:27] piston powered planes can use it. He is
[53:28] pointing out the failure of the county
[53:30] to provide 60% of all propeller planes with an
[53:31] unleaded option for the last
[53:33] 6 years. Shame on them, lead is a
[53:34] well-known health risk delaying
[53:37] 6 years seems criminal what
[53:40] can we do? 1st, read about
[53:43] san jose's read
[53:45] hillview airport horrible results
[53:46] from a study in 2020
[53:49] on the lead levels
[53:52] in children's blood, they absorb easily
[53:55] and is only causes permanent
[53:57] cognitive damage. Next contact supervisor
[54:01] preston scales she is aware of the
[54:04] health crisis,
[54:06] urge her to use community benefit
[54:07] award funds to offer incentives to
[54:08] pilots so
[54:09] they will use unleaded fuel. Next,

[54:16] reps on the board of the bay area
[54:17] air district and
[54:19] ask him to get
[54:21] blood testing done within a mile and

[54:24] runway's of buchanan. In 2021 john

[54:28] the state health department to do more
[54:31] blood testing at other airports,
[54:33] the air board told us it has a lot
[54:34] of money from fines. Our
[54:37] families need a study
[54:39] so they can know the danger and how
[54:40] to deal with it.

[54:43] school within
[54:46] 1 1/2
[54:47] miles of buchanan, please work to
[54:49] protect kids from these lead spewing
[54:52] flying recreational vehicles.

[1:02:06] boy figure how
[1:02:09] the boy is slightly different
[1:02:10] in particular the outline and it is
[1:02:12] being revised
[1:02:15] so the outline style
[1:02:16] is more consistent with the outline
[1:02:18] style of the primary
[1:02:21] woman figure in the foreground.

[1:16:14] when we adopted
[1:16:17] the annual budget for this fiscal
[1:16:18] year we made
[1:16:20] a commitment to come back to you before
[1:16:22] regularly scheduled midyear review
[1:16:23] in the fall
[1:16:26] to say checking on how we are doing
[1:16:28] for the economic uncertainty that
[1:16:29] we had.
[1:16:32] the information that
[1:16:34] fit into this report is from july
[1:16:35] 1 to october 31.
[1:16:38] a little over 1/4.
[1:16:41] junior sitting here next to me,
[1:16:43] in case there is detailed questions,
[1:16:44] we will do our
[1:16:46] best to pull up details on the fly
[1:16:47] , but
[1:16:49] I will give a pretty good check in
[1:16:50] on various
[1:16:53] department budgets that I think
[1:16:55] were of higher interest during the
[1:16:57] budget adoption back
[1:17:00] in june. And as a reminder we
[1:17:02] do have our midyear review which is
[1:17:06] more comprehensive, more detail
[1:17:09] , that's coming up in february.
[1:17:11] so a quick agenda I will provide a
[1:17:14] budget overview sort of where we were
[1:17:18] when we adopted the budget,
[1:17:19] what were the conditions, I will be
[1:17:21] focusing tonight
[1:17:23] progress on the general fund, expenditures
[1:17:25] and revenues. I will give a brief
[1:17:29] marina fund update although I know
[1:17:30] that
[1:17:31] will be the focus of one of the upcoming
[1:17:33] items and then our public works
[1:17:36] director will provide a cip
[1:17:38] update, everything fairly high-level.
[1:17:41] a quick strategic plan alignment, this
[1:17:45] item tonight aligns with goal
[1:17:48] a fiscal around
[1:17:49] financial sustainability. A quick
[1:17:51] budget overview.
[1:17:54] going into this fiscal year
[1:17:56] we had various cost drivers and revenue drivers
[1:18:00] that went into the formation of the
[1:18:01] budget ultimately resulting in a starting
[1:18:03] deficit of $1.5 million
[1:18:09] so I will not go through each
[1:18:10] of these individually, but you may
[1:18:11] recall cost drivers include continued
[1:18:12] increases to
[1:18:14] insurance, continued labor increases
[1:18:15] due
[1:18:18] to cola and step and
[1:18:20] merit increases, unfunded liabilities
[1:18:23] which are said to continue ramping
[1:18:27] starting this fiscal year over the
[1:18:29] next 5 years as well as retiree health
[1:18:30] and
[1:18:31] of course one of our biggest cost
[1:18:33] drivers which is the general
[1:18:36] fund support to the marina
[1:18:39] which has continued to be a subsidy, year-over-year.
[1:18:42] on the revenue side
[1:18:44] as we have reported over a handful
[1:18:45] of years now
[1:18:48] expenses are just rising
[1:18:50] at a pace faster than revenue is increasing.
[1:18:54] so, there has been
[1:18:56] slowing revenue over the last couple
[1:18:57] of years, of
[1:18:59] course we know there's a lot of economic
[1:19:01] uncertainty now we are keeping track
[1:19:03] of so we have budgeted
[1:19:06] underperforming sales tax
[1:19:09] with reduced permit, we budgeted
[1:19:10] for reduced permit and inspection
[1:19:12] revenues although
[1:19:14] I think I have good news tonight about
[1:19:15] that, lower
[1:19:18] interest income
[1:19:19] and lower-than-expected franchise
[1:19:21] fees. So how did we deal with that
[1:19:23] when we were here in june trying to
[1:19:26] figure out how to close the $1.5 million gap?
[1:19:29] all of the departments came together and
[1:19:32] every single department submitted
[1:19:35] budget cuts, I want to remind you
[1:19:36] that there is
[1:19:38] no potential to restore the budget cuts,
[1:19:41] these are ongoing budget cuts that have
[1:19:44] to remain until we figure out more revenue.
[1:19:47] until we find more revenue so budget
[1:19:48] cuts what
[1:19:51] we did was we looked at
[1:19:53] 3 year trends across all city departments
[1:19:54] and
[1:19:57] we focused on making sure we could
[1:19:59] maintain baseline services or core services
[1:20:02] and anything that was nice to have
[1:20:03] that could
[1:20:06] be deferred is what we focused
[1:20:08] on reducing. So, in administration
[1:20:11] a lot of this was looking holistically
[1:20:14] at all departments were clean above supplies,
[1:20:17] meeting costs, training, we centralize costs
[1:20:21] to make it more efficient. We took
[1:20:23] a good look at part-time staff, even
[1:20:24] full-time staff when
[1:20:27] we were feeling the vacancies.
[1:20:30] we could achieve budget savings by
[1:20:35] filling a position later in the fiscal year,
[1:20:36] we opted to do that.
[1:20:37] as always we looked at consultants
[1:20:39] and really considered the minimum need
[1:20:42] for the city. So we
[1:20:44] did give up our emergency services contract
[1:20:47] that was under the police department.
[1:20:51] gave up a planning consultant to defer
[1:20:54] short term housing
[1:20:57] and we reduced , for the reduced
[1:21:00] planning on call consultant
[1:21:03] within the planning department.
[1:21:06] we also eliminated private security
[1:21:11] the homeless and this was a priority
[1:21:12] robust conversation
[1:21:15] we were dust maintenance
[1:21:20] but it was based on 3 year trends
[1:21:21] we felt good about. In
[1:21:23] light of these budget reductions we
[1:21:24] made if you recall
[1:21:27] we also increased we chose
[1:21:29] to increase city manager contingency budget
[1:21:32] up to 130,000 so the thought was if
[1:21:33] something came up, we
[1:21:36] have some wiggle room we can go to
[1:21:38] the city manager and request it for
[1:21:39] . So,
[1:21:42] a very quick progress report on current
[1:21:45] general fund, this always looks
[1:21:47] pretty stunning after the 1st quarter because
[1:21:50] we always have a lot more expenses
[1:21:51] than we do revenue
[1:21:54] so I want to caution how
[1:21:56] we look at the information. Early
[1:21:57] expenses come in right in july
[1:22:00] which is the
[1:22:02] up from pension and insurance payments,
[1:22:03] large lump-sum payments
[1:22:05] along with all the typical labor costs
[1:22:08] that happen in the 1st several months
[1:22:09] of the fiscal year. And
[1:22:12] then on the revenue side while we
[1:22:13] are collecting
[1:22:16] sales tax and franchise fees and
[1:22:19] cannabis fees
[1:22:21] are not collecting property tax. So
[1:22:22] we don't get property
[1:22:23] tax until later so that is why there
[1:22:25] is a significant
[1:22:27] imbalance. On the expenditure side
[1:22:29] will give a quick highlight on some
[1:22:31] of the, how the
[1:22:34] department's are doing, but
[1:22:36] if you look at this slide here we are
[1:22:39] doing fine. We are 41% a budget, we
[1:22:40] don't see any
[1:22:42] red flags, as I mentioned up from
[1:22:46] we spent $7.6
[1:22:47] million toward insurance and pensions in
[1:22:49] july. Our
[1:22:51] operating expenses are tracking with
[1:22:52] budget. There has
[1:22:55] been no impact to core services
[1:22:58] and I was
[1:22:59] telling this to somebody earlier.
[1:23:01] since I have been
[1:23:02] here this is the 1st quarter where
[1:23:04] we have
[1:23:06] not had an emergency. So in the past
[1:23:07] we had
[1:23:10] a mercury spill or the incident
[1:23:12] that occurred where we needed to run high
[1:23:16] on police overtime or
[1:23:17] help with certain department expenses
[1:23:21] and we are tracking just well for once
[1:23:22] , so we're
[1:23:23] happy to hear that. Let me explain
[1:23:25] briefly because
[1:23:28] these items came up in
[1:23:29] the budget process, repair and maintenance,
[1:23:31] we have 52%
[1:23:34] that has been spent
[1:23:38] overall, so far. About $3.2 million
[1:23:40] repair maintenance budget across the city.
[1:23:43] namely what we
[1:23:44] are tracking if there's anything high
[1:23:46] it is
[1:23:49] utilities across the city that
[1:23:51] we have seen that might come in a
[1:23:52] little over budget.'s we will track
[1:23:54] for the midyear and if we have to
[1:23:55] make changes
[1:23:58] down the road we will. I did talk
[1:24:01] to our superintendent and I asked
[1:24:04] his subjective opinion on how
[1:24:07] things are going and again with
[1:24:09] no unforeseen issues that have popped up
[1:24:12] but we know it is early and inclement
[1:24:13] weather
[1:24:15] is coming and that is usually where
[1:24:16] his crew starts to
[1:24:19] see the
[1:24:20] unbudgeted and unplanned expenses
[1:24:22] pop up due to
[1:24:25] rain or any other sort of inclement
[1:24:28] weather. Also,
[1:24:30] the pool is something most expenses
[1:24:31] occurred or significant
[1:24:33] portion occurred over the summer.
[1:24:37] that is tracking the budget.
[1:24:39] we expect to be on target and then
[1:24:42] lastly I will mention the city manager
[1:24:43] contingency
[1:24:45] which I said we bolstered we have
[1:24:49] only spent 2500 of that contingency fund
[1:24:51] so everything is looking very good.
[1:24:55] on the
[1:24:58] revenue side, we are 10% of budget
[1:25:01] this point. We
[1:25:04] are sales tax and measure x
[1:25:06] is tracking on target we budgeted
[1:25:07] $9.8 million for the
[1:25:10] whole fiscal year. So far we
[1:25:13] have received $2.1 million.
[1:25:14] mentioned earlier property tax will
[1:25:16] come later. One of the
[1:25:19] , one of the benefits
[1:25:20] that I have seen digging into the
[1:25:22] data as our permit
[1:25:25] and fees which we thought would
[1:25:28] be slowing or low is actually doing
[1:25:30] pretty well so we are ahead of the budget
[1:25:34] permit fees
[1:25:36] and one of the things that jill told
[1:25:37] me could be the reason
[1:25:38] was we have had several significant
[1:25:40] tenant improvement
[1:25:42] projects come through, increased activity
[1:25:44] the refineries with recent submission
[1:25:46] of the river house
[1:25:49] of the housing application which again
[1:25:52] is a pretty significant
[1:25:55] permit fee to be processed
[1:25:56] with 94 additional building permits
[1:25:57] received for the same timeframe than
[1:25:58] last year
[1:26:01] compared to last year.
[1:26:04] >> can I interrupt?
[1:26:07] you said activities at the
[1:26:10] refineries are we talking about because
[1:26:13] the refinery is not in
[1:26:15] the city so we don't get any permit
[1:26:16] fees or
[1:26:19] anything.

[1:26:22] us with permits.
[1:26:25] is that what happened last year? We're

[1:26:46] to be on loan from the general fund

[1:26:49] marina fund.
[1:26:52] so far we are at $126,000 or just
[1:26:55] over. That is lower than what
[1:26:57] we budgeted and the reason for that
[1:26:58] is because
[1:27:01] early on in the fiscal year
[1:27:03] f3 was fully staffed so they were
[1:27:04] not operating with
[1:27:07] the budget provided with the number
[1:27:10] of staff. I think it is 3 or 4 people
[1:27:11] in total
[1:27:13] so we do expect
[1:27:15] those expenses to go up. Revenue collected
[1:27:16] over there
[1:27:19] is $90,000,
[1:27:22] expenditures have been $117,000.
[1:27:25] total expenditures at 57% of
[1:27:28] the budget and it is primarily
[1:27:31] due to the labor cost savings as I
[1:27:32] mentioned.
[1:27:34] the net loss is 27,000 now so we
[1:27:37] will continue to track.
[1:27:39] it is early but if we can come in
[1:27:40] under budget on 560,000 we
[1:27:43] will be happy with that.
[1:27:46] and before turnover to joe
[1:27:49] a quick reminder we adopted the 5 year
[1:27:53] cip at the same time as
[1:27:56] the budget.
[1:27:57] one small amendment made to the cip
[1:27:59] when we adopted it where we
[1:28:00] shifted $50,000 from the downtown plaza
[1:28:05] to the centennial project.
[1:28:07] and then one item I want to mention
[1:28:10] coming up midyear we don't have to
[1:28:14] flush it out tonight, but since
[1:28:16] we do have a waterfront revitalization
[1:28:17] project
[1:28:19] underway which is exploring the amphitheater
[1:28:24] and obviously adding robust activity in
[1:28:26] the area including
[1:28:28] entertainment and retail we are recommending
[1:28:33] an amendment midyear regarding the
[1:28:35] waterfront stage so
[1:28:38] this is the
[1:28:39] budget we have been partnering with
[1:28:41] kiwanis on.
[1:28:43] and a to have a personal conversation
[1:28:44] about this
[1:28:46] it is not make logical sense to build
[1:28:47] a waterfront stage
[1:28:49] when we have a whole project being built
[1:28:53] so what we have
[1:28:55] committed to in the spirit of them
[1:28:57] wanting to partner with us on a project
[1:28:59] will go back
[1:29:02] to the drawing board with them
[1:29:04] in a future discussion to see what
[1:29:05] we can collaborate
[1:29:08] on so I will turn it over

[1:29:18] on some of these completed projects.
[1:29:23] when we started listing them it
[1:29:26] became quite a list and covered all phases
[1:29:28] , some highlights were definitely
[1:29:32] the fishing pier long
[1:29:34] awaited with the ribbon-cutting a
[1:29:35] few
[1:29:37] weeks ago. It had been packed almost
[1:29:40] every day from what I have heard.
[1:29:43] the other one I wanted to highlight
[1:29:44] was
[1:29:47] the hydrant maintenance, we serviced
[1:29:50] nearly 1000 fire hydrants
[1:29:53] to confirm that they were
[1:29:56] flowing and functional.
[1:29:59] we did find I believe 3
[1:30:02] that were out of service
[1:30:04] for a couple of reasons typically
[1:30:08] they had been repaired and the valve
[1:30:11] had been reopened.
[1:30:17] if you have been anywhere
[1:30:19] downtown we have completed a huge
[1:30:20] amount of paving,
[1:30:23] alhambra avenue paging.
[1:30:26] we are wrapping up the
[1:30:29] zone 3, the downtown paving
[1:30:32] with a lot of downtown the final
[1:30:35] pieces remaining is striping

[1:31:05] shaving program which we completed
[1:31:07] last year over 900 locations shaped
[1:31:11] and we are about to go out with another project
[1:31:13] and there will be more significant
[1:31:14] this spring.
[1:31:17] sidewalks with
[1:31:20] the gap closure.
[1:31:23] we touched on facilities
[1:31:25] city hall improvements, the roof is completed.
[1:31:32] parks , last year both
[1:31:35] sports courts and the
[1:31:37] grand opening of pine meadows park
[1:31:44] with water, water projects had
[1:31:45] extensive water main replacement administered
[1:31:47] to the
[1:31:50] fire hydrants. We
[1:31:51] are about to start construction on
[1:31:53] the next water main project and we
[1:31:54] are wrapping
[1:31:56] up a pump station project
[1:31:59] and then if you have been in
[1:32:01] the downtown the last couple days
[1:32:02] we have finally started
[1:32:05] the long awaited infill
[1:32:08] on parking lot 4. Started
[1:32:11] on monday, depending on the
[1:32:14] weather, they might possibly be completed
[1:32:17] before thanksgiving.
[1:32:23] are close to wrapping up the design phase
[1:32:26] on the parking meter and destination
[1:32:29] sign program
[1:32:34] and we are ready to place the order
[1:32:35] for the downtown bike racks as
[1:32:38] well. So it is moving forward
[1:32:41] I think those were the
[1:32:44] some of the main highlights.
[1:32:47] one of the ones
[1:32:49] we wanted to point out was phase 1
[1:32:50] street trees
[1:32:53] the 150 trees. Unless
[1:32:56] we get weeks of weather
[1:32:59] our contractor
[1:33:01] assures us he can have those completed
[1:33:02] by the end of
[1:33:05] the year.

[1:33:16] we have bounced back and forth but
[1:33:17] I believe it

[1:33:53] their bid package and their scheduled
[1:33:56] to go to coverage by next spring.

[1:34:04] amtrak elevator is on us, security
[1:34:06] is on
[1:34:09] them and when
[1:34:10] security improvements are made we
[1:34:12] can move forward.

[1:34:17] some additional security and hardening improvements
[1:34:21] that would be on the city
[1:34:24] to secure some of the , the
[1:34:27] heating and
[1:34:28] ventilation equipment on the platform
[1:34:30] and then some
[1:34:33] of the ,
[1:34:35] securing those so they are not hiding
[1:34:39] hiding spots and then
[1:34:42] lastly one
[1:34:45] of our strategic projects and
[1:34:47] for the 150th our park master plan
[1:34:51] not necessarily cip per se
[1:34:54] but it is one of the key projects and
[1:34:56] you know we are probably one month
[1:35:00] into that . I
[1:35:01] think we had our 4th project team
[1:35:03] meeting
[1:35:06] last week , lauren gave a
[1:35:08] pretty complete update on that last week
[1:35:11] but we will be kicking off a robust
[1:35:12] public
[1:35:14] engagement process right after the
[1:35:18] 1st of the year.
[1:35:22] >> so just to conclude, next steps 2026
[1:35:24] back to
[1:35:27] budget season for us. January,
[1:35:29] we will be scheduling a budget and
[1:35:32] finance subcommittee meeting. We will
[1:35:36] bringing the
[1:35:37] midyear budget to the finance subcommittee
[1:35:39] before going to city council.
[1:35:41] we will be kicking off fiscal year
[1:35:42] 26-27 budget
[1:35:45] development process that
[1:35:46] happens largely at the staff level
[1:35:48] initially before
[1:35:50] we bring conversations to the council.
[1:35:51] in february we will
[1:35:54] bring midyear budget
[1:35:56] and then we will bring the cip amendment
[1:35:57] we spoke about.
[1:35:59] in march we will be a little earlier
[1:36:00] but at least by march bringing the
[1:36:03] recreation fee update, so
[1:36:05] debbie hernandez is working now on
[1:36:06] that
[1:36:08] and they are studying all of the various
[1:36:09] user fees
[1:36:12] so they will bring
[1:36:14] recommendation to you on that. April is
[1:36:15] when we typically
[1:36:18] bring the broad city administrative fees
[1:36:21] that we bring annually.
[1:36:24] in april we will have
[1:36:26] a study session, we will update the
[1:36:27] long-range forecast
[1:36:32] and we will want to talk with council
[1:36:33] on fiscal sustainability measures.
[1:36:36] have spoke , we focus a lot on expenditures
[1:36:39] over the last few years pretty much
[1:36:41] have been taking a chopping block
[1:36:45] to a lot of city services and we have
[1:36:47] cut millions out of the budget, but
[1:36:50] we still have no revenue coming in
[1:36:51] so we
[1:36:53] really have to sit down and figure
[1:36:57] that problem out. So june and I were
[1:36:58] talking
[1:36:59] about this today putting a study session together
[1:37:02] to look at all the options on the
[1:37:03] table and get a
[1:37:05] sense from the council where you want
[1:37:06] us to further pursue.

[1:37:12] have the fiscal
[1:37:14] year 26-27 budget workshop and june
[1:37:15] is the adoption. That

[1:39:46] mindful because it always has a
[1:39:48] trickle-down approach. So, there are
[1:39:52] a lot of moving parts that are somewhat
[1:39:55] out of our control
[1:39:57] at the state and federal level so
[1:39:58] we need to
[1:40:01] be vigilant and stay close
[1:40:03] to see how some of these things happening
[1:40:04] above our
[1:40:05] head are going to impact us locally.

[1:44:13] me a lot of pause and
[1:44:16] then to
[1:44:19] greg's point in terms of the headwinds
[1:44:20] that the
[1:44:21] state is continuing to face as well that
[1:44:22] is all going to have
[1:44:25] impacts on municipalities such as ours
[1:44:28] . To bring it more local
[1:44:31] it really underscores the pressing
[1:44:34] need for us to be able to identify
[1:44:35] the revenue.
[1:44:38] so from my standpoint
[1:44:41] I think oftentimes we
[1:44:43] have seen other jurisdictions there
[1:44:44] has been a
[1:44:46] quick pivot to let's just ask residents
[1:44:52] to pony up more. They go through it
[1:44:53] 2 years later and
[1:44:54] say pony up some more and it is a
[1:44:56] never ending cycle and am
[1:44:57] grateful that has not been a practice
[1:44:59] of this city at
[1:45:01] least historically and of the recent council
[1:45:05] and debbie is the
[1:45:07] veteran here. And I really appreciate
[1:45:08] the
[1:45:11] fact that you know we have had a
[1:45:14] fiscally conservative approach
[1:45:17] and are trying to continue to do that,
[1:45:18] but I think it really underscores
[1:45:20] the importance of the discussion
[1:45:22] we are having and we will continue
[1:45:23] to have certainly
[1:45:25] with the community in terms of where
[1:45:26] opportunities
[1:45:28] are to help bring us that revenue.

[1:47:53] to discuss the
[1:47:54] marina fee schedule and recommendation
[1:47:56] to adopt resolution amending
[1:47:58] the marina fee schedule related to
[1:47:59] mooring
[1:48:02] utilities and liver board fees.
[1:48:05] a brief update how this
[1:48:08] particular item aligns with strategic plan
[1:48:11] and
[1:48:13] that is under the goal of fiscal sustainability
[1:48:14] promoting financial health
[1:48:16] through long-term planning responsible
[1:48:17] budgeting,
[1:48:19] cost recovery which is what we are
[1:48:20] here tonight
[1:48:23] and increased
[1:48:25] awareness. To provide a little background,
[1:48:26] in october awareness. To provide a
[1:48:27] little background, in
[1:48:28] october 2024, the staff brought forward
[1:48:31] the similar item to have a discussion
[1:48:32] about increasing the fees
[1:48:34] after our marina operator had left
[1:48:38] and we were in the process of taking over
[1:48:39] the
[1:48:40] marina. It was identified the fees
[1:48:41] were not
[1:48:44] demonstrated full cost recovery
[1:48:46] or getting close to cost recovery
[1:48:50] at the time council
[1:48:52] provided direction so after hearing
[1:48:53] from the community
[1:48:56] they wanted to wait
[1:48:57] until improvements had been made to
[1:48:59] the marina as well as
[1:49:01] having staff research a little bit
[1:49:02] further about a
[1:49:05] water leak as to why we're using so
[1:49:08] much water at the time.
[1:49:10] since then the water leak has been
[1:49:11] resolved, this was
[1:49:14] a main underneath the ramp
[1:49:16] that has been corrected and fixed.
[1:49:20] well as the city, in january the city,
[1:49:21] in january
[1:49:23] 2025 brought on f3, to manage
[1:49:26] the marina. Since they have arrived
[1:49:27] they
[1:49:29] have done incredible amount of improvements
[1:49:32] and enhancements.
[1:49:34] everything related to safety lighting
[1:49:35] security, painting, they
[1:49:37] have done a lot of repairs to docs,
[1:49:38] building ramps
[1:49:40] to get infrastructure out of the water
[1:49:41] so boaters
[1:49:44] can get to the vessels during the
[1:49:45] day
[1:49:47] related to the tides moving up and
[1:49:48] down as well
[1:49:49] as overall operational managements
[1:49:53] and maintenance and so forth.
[1:49:56] october of this year
[1:49:58] we brought this item to the marina
[1:49:59] and waterfront
[1:50:02] subcommittee and had a hearty discussion
[1:50:05] which we will talk about. Additionally
[1:50:08] following off the previous presentation
[1:50:11] , the marina has long-standing
[1:50:16] deficits because we talked about the
[1:50:17] $560,000 loan that was made and
[1:50:20] it is projected we may
[1:50:23] be around 650
[1:50:26] in loans moving forward creating a compromise
[1:50:29] on the city's future reserves.
[1:50:32] at this time I will turn
[1:50:34] it over to talk a little bit more
[1:50:35] about the
[1:50:38] financial aspect.
[1:50:39] >> sure,
[1:50:41] so what is
[1:50:43] up on the screen is the long-range
[1:50:44] forecast done
[1:50:47] in may or june of the last year and
[1:50:48] this
[1:50:50] scenario assumes an ongoing
[1:50:52] subsidy from the general fund, to
[1:50:53] the marina.
[1:50:56] on an ongoing basis, something
[1:50:59] we have decided to do
[1:51:01] as a council and city organization
[1:51:04] is start planning for the next 5 to
[1:51:05] 10 years making sure
[1:51:07] we are being responsible today and understanding
[1:51:10] what the long-term liabilities are
[1:51:15] on the city's general funds
[1:51:16] so this is what the picture depicts
[1:51:18] for your. As mentioned, the
[1:51:20] marina enterprise fund has had a long-standing
[1:51:23] structural deficit. We brought on
[1:51:25] f3, they have done a fabulous job
[1:51:27] from everything we have heard
[1:51:30] and seen, but now we
[1:51:31] are paying for that, things are getting
[1:51:33] fixed. We have more employees at
[1:51:36] the marina. Like
[1:51:37] I said earlier we are coming under
[1:51:39] budget right now
[1:51:41] but it is something we assume is going
[1:51:42] to continue
[1:51:44] to be of high cost on the city. Since
[1:51:45] fiscal
[1:51:48] year 21 -22 the general fund
[1:51:50] , there has been $2 million general
[1:51:51] fund
[1:51:53] reserves spent toward the marina 's
[1:51:55] are trying to be careful. We want
[1:51:57] to meet
[1:51:59] the reserve target, we are nervous
[1:52:00] about the next
[1:52:03] few years so in order to sort of maintain
[1:52:05] status quo with the subsidy to the marina,
[1:52:09] which includes the
[1:52:11] loan to the state, the utility cost and
[1:52:14] f3 operation costs we are looking at
[1:52:18] needing $1.2 million
[1:52:20] in a new ongoing budget with budget cuts
[1:52:24] over the next few years
[1:52:26] phased in over the next few years.
[1:52:27] always
[1:52:29] trying to keep your eyes on that and
[1:52:30] again it
[1:52:33] comes down to it is cutting into our
[1:52:36] core services as a city
[1:52:39] and that is why it is critical,
[1:52:40] jill is bringing forward a proposal
[1:52:42] tonight to modestly
[1:52:45] fill the gap a little bit.
[1:52:52] all right, again with the fee schedule
[1:52:54] the goal is to reduce dependency on
[1:52:56] the general fund, in research we have discovered
[1:52:57] the last
[1:53:00] fee increase was in 2014
[1:53:02] and as you know the cost of operations
[1:53:04] have dramatically increased since
[1:53:06] that time. As well as with
[1:53:09] f3 coming on and
[1:53:10] permits being made everything from
[1:53:11] lumber and labor has all increased.
[1:53:15] when looking at the methodology
[1:53:17] of what's the best way of doing this
[1:53:18] we looked to
[1:53:19] our partners in some of the other
[1:53:21] regional markets with
[1:53:24] comparisons and
[1:53:26] a lot of the increases are based on
[1:53:27] consumer price
[1:53:29] index and when we are talking about tonight
[1:53:32] is the consumer price index for inflation
[1:53:33] for the bay area region
[1:53:36] as well
[1:53:39] as we received information
[1:53:40] from the bureau of labor statistics
[1:53:42] and pg&e data with
[1:53:45] utility rates and we did a market
[1:53:46] analysis
[1:53:48] with some of the similar
[1:53:51] marinas
[1:53:53] in the area comparable to us and that
[1:53:54] would be monisha, vallejo, pittsburgh
[1:53:55] and
[1:53:56] antioch. That also to touch upon it
[1:54:00] , several of those also have
[1:54:03] wooden docs similar to ours so we
[1:54:06] were only pulling those forward
[1:54:08] not necessarily the nice concrete or
[1:54:11] covered structures. Some of the marinas
[1:54:12] have expensive rates
[1:54:14] as well. Even with the comparison
[1:54:15] you
[1:54:18] will see in the attachment
[1:54:20] martinez has the lowest rates and
[1:54:21] one of the things
[1:54:23] of the follow-up the subcommittee
[1:54:24] wanted to do was to
[1:54:26] find out when jurisdictions had their
[1:54:27] last increases so
[1:54:30] we went back and they did increase
[1:54:33] in 2025,
[1:54:35] vallejo 2023, pittsburgh 2025 and antioch
[1:54:39] in 2023. To give you an idea
[1:54:41] where they are with the rates that are
[1:54:42] relatively recent
[1:54:45] . So, tonight
[1:54:48] as part of the fee schedule in
[1:54:51] exhibit a there's
[1:54:53] a lot of fees associated with the
[1:54:54] marina, tonight we
[1:54:56] are asking for increases for the 3 fees
[1:54:57] the
[1:54:59] morning fee, the vessel and the monthly rate
[1:55:03] the utility fee which is electricity
[1:55:06] and gas provided by the marina
[1:55:09] it does not include water because
[1:55:11] we never had a water rate listed and
[1:55:12] then the
[1:55:15] fee which is the surcharge for the boaters
[1:55:18] permitted to remain on their vessels
[1:55:19] longer than
[1:55:20] 72 hours with 72 hour restriction.
[1:55:21] we will start
[1:55:24] with the mooring fees again proposed
[1:55:27] based on cpi index. Local
[1:55:30] marina market and best practice of
[1:55:31] what other
[1:55:33] marinas are doing and
[1:55:34] our recommendation is to align the
[1:55:36] fee with cumulative
[1:55:39] cpi from 2014 to 2025
[1:55:42] which is 40.69%.
[1:55:45] very straightforward methodology and improves
[1:55:46] the
[1:55:48] overall enterprise ,
[1:55:50] the marina enterprise financial position.
[1:55:51] competitive with other marinas
[1:55:54] but far below the average and we're still
[1:55:57] getting toward the lower end.
[1:56:00] implementation for the fee the
[1:56:02] recommendation that was to the subcommittee
[1:56:03] and I will go back when I
[1:56:06] get to the end I will tell you what

[1:56:12] we implement all at once or look at
[1:56:15] the phase in model over 2 years which
[1:56:17] is what we do with some of the other
[1:56:18] fees especially administrative
[1:56:21] fees restart was 75%
[1:56:24] 1st year and then 25% in the 2nd
[1:56:27] year on them.
[1:56:30] so, this particular attachment is
[1:56:32] a little different from the one in
[1:56:33] the staff report
[1:56:36] this is what we presented showing
[1:56:38] you an idea of what it would look like if
[1:56:40] we did 75/25.
[1:56:43] one of the things I
[1:56:44] want to point out is the ones that
[1:56:46] are color-coded, those
[1:56:49] are actually the vessels at the
[1:56:50] marina currently. While we have rates
[1:56:52] going from 20 foot
[1:56:55] all the way to 70
[1:56:58] foot slips, because of the
[1:56:59] marina being downsized, losing docs
[1:57:01] and so forth
[1:57:03] the primary vessel slips are 30, 35 and
[1:57:07] 45 with just one , 60 being
[1:57:10] occupied. That gives you an idea
[1:57:11] of where the main increase will affect those
[1:57:13] that
[1:57:15] have boats at the marina. If you look
[1:57:20] or actually the other thing I want
[1:57:22] to point out
[1:57:23] is the dry storage comparison. A lot
[1:57:25] of times
[1:57:27] it is more of a luxury to have your
[1:57:28] boat in the marina
[1:57:31] to get on and go so
[1:57:32] if you look at the dry storage comparison
[1:57:34] which is more
[1:57:36] of a process to get your boat to the
[1:57:37] water that is averaging
[1:57:39] from 200 to 300 for the uncovered storage.
[1:57:43] and
[1:57:44] then again as I mentioned, the antioch,
[1:57:46] pittsburgh and
[1:57:49] vallejo rates are covered
[1:57:52] because they do include , you know
[1:58:30] the increase for the
[1:58:33] utility fee they felt made
[1:58:34] sense, understanding the need for
[1:58:36] the increase.
[1:58:39] I mean they understood there was a
[1:58:40] need
[1:58:41] and why. They did acknowledge the
[1:58:42] acknowledgment of
[1:58:44] improvements under
[1:58:46] f3 leadership and it was nice to hear the
[1:58:47] praise given to them
[1:58:48] by the voters that were out there.
[1:58:50] I did forget to
[1:58:53] mention jamie is on the line, he is sick
[1:58:55] he is here but with us online should
[1:58:57] we have questions that
[1:59:00] are asked.
[1:59:02] and then some of the comments were
[1:59:03] about some additional improvements
[1:59:05] they would like to see, comments about the
[1:59:06] pump out being
[1:59:09] replaced, the bathrooms, isolated
[1:59:10] incident at the bathrooms having issues
[1:59:12] with that corrected
[1:59:15] and locks have been updated as
[1:59:17] well as the water and
[1:59:19] electricity upgrades like there are
[1:59:20] things they will
[1:59:23] upgrade their. The pump out had a recent
[1:59:27] inspection of compliance and I
[1:59:28] don't recall the agency that is required
[1:59:30] it might be the health
[1:59:33] department and it did pass just fine.
[1:59:35] but we are looking at options that
[1:59:36] if we have the
[1:59:39] ability to improve that we
[1:59:41] will look at that as well in the future.
[1:59:45] again, complements
[1:59:47] about f3 and then you know there was understanding
[1:59:49] of additional funding to help close
[1:59:50] the gap a little bit.
[1:59:53] so, we went
[1:59:56] through forward subcommittee.
[1:59:58] the recommendation that they came
[2:00:01] back with
[2:00:02] --they felt like 40% was a big bite
[2:00:04] right off the bat and wanted to pass
[2:00:05] on this cost with the understanding
[2:00:07] knowing that we had to look towards
[2:00:08] cost recovery and having to close
[2:00:09] the
[2:00:10] gap anyway we can. So they estimate
[2:00:11] --the recommendation that was passed
[2:00:12] forward to
[2:00:13] the council, they created option three,
[2:00:14] which is to look at
[2:00:20] 2026 of
[2:00:23] rolling in half of that increase
[2:00:25] in 2026 and half of that increase
[2:00:26] in 2027. For the utility fees, they
[2:00:27] agreed that doubling
[2:00:28] the cost made sense and adding the
[2:00:29] five dollars a month and
[2:00:31] they asked for the five dollars a
[2:00:32] month to be rolled into the fee
[2:00:34] itself. [ inaudible ] which is the
[2:00:35] standard practice that are some of
[2:00:36] the
[2:00:39] other marinas are also doing. As
[2:00:40] for the liveaboard fee, increasing
[2:00:42] that fee
[2:00:46] by $75 to 275. The implementation
[2:00:47] for the utility fee and liveaboard
[2:00:48] fee
[2:00:50] was recommended january 1st and then
[2:00:54] just the facts he would have a
[2:00:55] timeframe over two years. If you look
[2:00:57] at number one, it
[2:01:00] gives you an
[2:01:01] idea that by 2027, we should see an
[2:01:03] increase
[2:01:09] of 129,000.
[2:01:15] while that is a great increase
[2:01:16] based on what we talked about it doesn't necessarily
[2:01:18] get closer to that larger
[2:01:19] gap so we'll have to look at other
[2:01:21] things which we can do to either
[2:01:22] increase revenue or look at how our
[2:01:23] services are being offered. On that.
[2:01:24] so,
[2:01:25] with that, staff is available for

[2:02:24] interim solution until we do
[2:02:26] more research on whether it makes
[2:02:27] sense to re-key
[2:02:30] everything.

[2:09:04] marina by itself and so this is
[2:09:07] handed to you the 20 year income
[2:09:09] expense accounting produced by the
[2:09:10] city
[2:09:16] staff as pulled
[2:09:17] off of your website. It's from 2006.
[2:09:19] it ends
[2:09:22] around 2023, '24. It's the budget
[2:09:23] and it
[2:09:24] is pretty detailed. And it condensed
[2:09:25] down
[2:09:31] to just an expense and income on that
[2:09:34] first page. And this
[2:09:37] is in an effort to address the
[2:09:43] staff report goal b, strategy 2, engage
[2:09:46] the community about
[2:09:49] the marina's fiscal reality and
[2:09:50] its future. And the reality is that
[2:09:52] the budget shows near break
[2:09:55] even income
[2:10:00] operational expenses. It's got nothing
[2:10:01] to do with the
[2:10:04] capital expenditures. But
[2:10:07] the marina operational expenses
[2:10:09] are conflated with the outlays of
[2:10:10] the
[2:10:12] enterprise fund. Staff writes, the
[2:10:13] city
[2:10:19] has used $1.7 million to cover marina
[2:10:20] needs.
[2:10:22] the message we hear is that
[2:10:25] the marina is costing us
[2:10:27] $1.7 million and I think jay was outraged when
[2:10:28] he heard that back
[2:10:31] in july
[2:10:34] and said we probably want to shut
[2:10:35] down the marina because of that. But
[2:10:37] that's not really the
[2:10:40] case. When you look
[2:10:43] at the --breaking down the
[2:10:46] $1.7 million, dredging project,
[2:10:49] $750,000. That's
[2:10:51] in the 1.7. That is a capital expenditure.
[2:10:54] that's not an operational expense.
[2:10:55] the water
[2:10:58] front
[2:11:00] trust --half $1 million. That is not
[2:11:01] an operational expense. That is a
[2:11:07] capital expenditure.
[2:11:10] design fees for the eastern wall,
[2:11:12] we don't know if that's been spent
[2:11:13] but that's $250,000. I don't think
[2:11:15] spent that. Temporary repairs --the
[2:11:16] fishing pier --the fishing pier is
[2:11:19] not a marina. It's part of
[2:11:22] the enterprise fund, but that
[2:11:28] is not
[2:11:34] an operational expenditure. The funds set aside for
[2:11:35] entrance doc d,
[2:11:36] $60,000, that probably wasn't even
[2:11:37] spent. I don't think so. That was

[2:19:39] financial hardship
[2:19:42] waiver or something there to
[2:19:43] help, but that's just me. But I think
[2:19:45] sort of moving forward, it is
[2:19:48] really incumbent upon
[2:19:49] us to manage these much more closely
[2:19:51] than
[2:19:53] we have, to the commentators earlier
[2:19:54] point,
[2:19:59] you know, the annual two, three, 5%
[2:20:00] we need to
[2:20:01] do --it needs to keep up. Because
[2:20:03] this is a lot to hit
[2:20:09] them with.

[2:21:05] if I could make some clarifications
[2:21:07] that. So, one of the things to understand
[2:21:09] about the marina enterprise fund is
[2:21:11] has five funds and those five funds
[2:21:12] are divided up into different things.
[2:21:13] you
[2:21:14] have capital. You have the marina
[2:21:15] itself. The waterfront area. There's
[2:21:16] one for --what
[2:21:17] is it? Railroad. And what was the
[2:21:18] last one? And debt service for
[2:21:20] debt service. The amounts that we
[2:21:22] put into this presentation were focused on the
[2:21:24] marina and that is fund 78. What kevin presented
[2:21:27] here was how mars
[2:21:28] budget from what their revenue might've
[2:21:30] been from the 10
[2:21:31] year projection. But it is important
[2:21:33] to note on this back in
[2:21:39] 2025 and a lot of this year, we
[2:21:40] had more slips. We had a lot more
[2:21:42] slips. We had the bait shop which
[2:21:43] was
[2:21:45] bringing in revenue. All of
[2:21:46] that revenue went back to the operations
[2:21:48] of the marina. Over time, as we have
[2:21:49] gone through the plaintiff the deficit
[2:21:51] and having to close
[2:21:57] down docs,
[2:21:58] losing boaters and so forth, that
[2:22:00] is what has changed and shifted it
[2:22:01] to what
[2:22:02] we are getting out to the point of
[2:22:03] the discussion we are having tonight
[2:22:04] with the amount. So this is just almar's
[2:22:06] part. It doesn't include --because
[2:22:07] one
[2:22:08] of the things that the city took on
[2:22:09] was a lot of the
[2:22:12] utility cost. There was a
[2:22:15] set utility that they had
[2:22:21] almar
[2:22:24] that they were paying and the rest
[2:22:26] that the city covered in a different fund.
[2:22:27] this is not accurate when you're talking
[2:22:29] about the bigger picture of the entire
[2:22:30] arena. --marina. It
[2:22:33] is only telling part of
[2:22:36] the story.
[2:22:39] expenditures --none of
[2:22:41] them made it was collected in fund 78
[2:22:42] goes to any of these types of
[2:22:45] items so those all come out of fund
[2:22:46] 74,
[2:22:47] which is our capital fund. So the
[2:22:48] marina --the boaters of the
[2:22:54] marina
[2:22:57] do not pay for these
[2:22:58] items. That something that's important
[2:22:59] to clarify. I just wanted to make sure
[2:23:00] --and that's
[2:23:02] --all the --the peer --the work at
[2:23:03] --doing the capital project
[2:23:06] --the land
[2:23:09] use plan
[2:23:15] which is a requirement by the state
[2:23:17] of california. That was not paid for
[2:23:18] by the boaters. Just wanted to verify
[2:23:19] that on those two points.

[2:23:22] do those funds
[2:23:23] come from?
[2:23:24] >> a little bit of everything.
[2:23:25] from the general fund, krantz.
[2:23:27] for the marina operations, since almar's

[2:23:30] bill and insurance and a lot of the
[2:23:31] other,
[2:23:36] costs --doing maintenance on
[2:23:37] the marina itself. Those funds before
[2:23:39] I come up to the 2023 fiscal year,
[2:23:40] the
[2:23:42] funds itself [
[2:23:44] inaudible ] in particular for 78 we
[2:23:45] talk
[2:23:51] about, --$97 in deficits in the balance
[2:23:54] --and that's on top of the
[2:23:57] $109,000 loan we already loaned
[2:23:59] them at that point in time. The total
[2:24:00] deficit before fiscal year 2024 is
[2:24:03] $506,000 for marina operations.
[2:24:06] so almar's budget in here is just
[2:24:09] part of it. Only. There's
[2:24:15] a more
[2:24:30] portion and then the portion the city
[2:24:31] handles the
[2:24:32] operation as well. [ inaudible ]
[2:24:34] can I add the thing I feel like
[2:24:35] neither of you mentioned? I requested
[2:24:37] a copy of the fund 78 so I
[2:24:38] could see the individual line items,
[2:24:39] and the largest line item is salary
[2:24:40] and benefits
[2:24:41] for the employees that work at the
[2:24:42] marina. Right? And that's a 300,000
[2:24:44] --so all of the repairs that are being
[2:24:46] made using this budget, but we
[2:24:47] are paying them, and so I think this
[2:24:49] conversation feels not quite --
[2:24:50] we are not comparing the same buckets
[2:24:53] of monies. We are talking about one
[2:24:55] thing over here and
[2:24:56] then they are talking about something
[2:24:57] completely different, so I don't know
[2:24:58] if it is worth
[2:25:01] providing the council
[2:25:04] the full
[2:25:10] fund
[2:25:11] 78 to talk to if we have additional
[2:25:12] questions about this because that
[2:25:13] has been
[2:25:14] --has always felt a little awkward,
[2:25:15] and I think that the deficit that
[2:25:16] you
[2:25:17] are talking about, and it does not
[2:25:19] --you said
[2:25:22] 390,000
[2:25:23] deficit but that does not include
[2:25:24] the debt service to write to the state,
[2:25:26] it's in addition to that and that's
[2:25:28] how we are coming up with
[2:25:31] this 500 some odd
[2:25:32] thousand year rite, of the loans we
[2:25:33] are giving to the fund and those numbers
[2:25:35] are never really presented at the
[2:25:36] same time so I think from our perspective
[2:25:39] gets confusing why we are saying how
[2:25:40] we are spending the
[2:25:42] money.
[2:25:43] >> I can help because I know I
[2:25:44] brought this up in my
[2:25:46] last presentation, so there are
[2:25:49] two things.
[2:25:59] there is operational, right? And there's
[2:26:01] a loan, as well. In the
[2:26:03] mix of the $560,000, so what we started putting
[2:26:04] into our budget and also the
[2:26:05] forecast, and I'm sorry, june, if
[2:26:07] I'm off on the number but I recall
[2:26:10] it is
[2:26:13] $375,000 for f3
[2:26:14] operations. Then I get that correct?
[2:26:16] >> yes. >> there is the loan
[2:26:17] payment and then the utility payment
[2:26:18] that makes up the 516,000 print in
[2:26:19] ongoing years it
[2:26:20] is 650,000, right, in total. There
[2:26:21] was capital projects mentioned earlier.
[2:26:22] that's a whole
[2:26:23] different bucket, but what I have
[2:26:31] to reinforcement
[2:26:37] --reinforce with the council --this
[2:26:38] council in prior councils, by the
[2:26:40] way, I have taken money out of the
[2:26:41] reserves
[2:26:42] to pay for those capital improvements,
[2:26:43] so, either, whether it's operations
[2:26:44] or whether it
[2:26:45] is capital, we have been taking money
[2:26:46] out of reserves for
[2:26:48] the marina, and it's unsustainable.
[2:26:49] one point I do want to
[2:26:50] make, too, and this is where it is
[2:26:52] unfortunate because there is an impact,
[2:26:55] right?
[2:26:58] two people,
[2:27:09] and I have set up here for the last three
[2:27:10] years having to take similar
[2:27:11] conversations on our city administration
[2:27:12] fees, that were significantly behind
[2:27:13] --you remember a few
[2:27:14] years ago, mike chandler had to bring,
[2:27:16] you know, we hadn't touched those
[2:27:18] 10 years and we had to just rip the
[2:27:19] band-aid off. And in same with
[2:27:20] our recreation fees. Just two years
[2:27:22] ago, had to bring fee increases of
[2:27:23] 50,
[2:27:24] 60% because we hadn't touched the
[2:27:28] fees, and
[2:27:30] --in 10, 15, 20 years, but at the
[2:27:31] same time, we are sitting here,
[2:27:32] cutting every department down to its
[2:27:34] core. We almost had to freeze positions
[2:27:35] this past
[2:27:38] fiscal year. Right, so it's very difficult.
[2:27:40] it's not that we
[2:27:42] don't empathize with that user groups
[2:27:43] who are
[2:27:46] affected by
[2:27:49] this, but,
[2:27:57] everyone in the community --tonight,
[2:27:58] it's obviously the boaters. Right?
[2:27:59] and
[2:28:00] the live aboards, but in the past,
[2:28:01] we've had to deal with other user
[2:28:02] groups
[2:28:03] within the committee, so it's never
[2:28:04] easy, and I just want to recognize
[2:28:05] that, but at the same time, there's
[2:28:07] really not
[2:28:09] much --we are operating at a skeleton
[2:28:10] at this point in the city. It's
[2:28:11] a give-and-take and I recognize a
[2:28:13] difficult decision in front
[2:28:19] of you.
[2:28:21] >> okay, so, lauren, thank you for
[2:28:22] that context. Very helpful. So
[2:28:24] I guess sort of --assuming --okay
[2:28:25] --so we are
[2:28:28] going to act on
[2:28:30] this tonight. What is the next step?
[2:28:31] how do we ensure there's
[2:28:37] regular reviews --that we are bird
[2:28:38] dogging this
[2:28:39] and doing actual work necessary to
[2:28:40] make sure
[2:28:46] that our
[2:28:49] dose that we are keeping up with
[2:28:50] the actual expenses, if that makes
[2:28:52] sense. What reassurance can we provide
[2:28:53] to the stakeholders
[2:28:54] moving forward that we are not going to
[2:28:55] find ourselves in a situation like
[2:28:57] this. What are the sort of --what
[2:28:58] have we learned? What sort of
[2:29:00] policy changes will we be making to
[2:29:01] ensure that a future council
[2:29:04] doesn't find themselves in a situation
[2:29:06] like this.
[2:29:07] >> it's already done. You adopted
[2:29:13] strategic plan.
[2:29:15] it spells out loud and clear that
[2:29:16] this council is committed to reducing
[2:29:18] subsidies that are straining the general
[2:29:19] funds. So we have it very clearly
[2:29:20] spelled
[2:29:25] out.
[2:29:31] in prior fee increases that
[2:29:33] we've taken in other areas, though,
[2:29:34] you have consistently said to us,
[2:29:35] yeah, let's put
[2:29:36] this on a more routine schedule, so,
[2:29:37] for example, as you know, our administrative
[2:29:38] fees
[2:29:39] come every year. Our rec fees come
[2:29:40] every --years, so things don't fall
[2:29:42] behind. Same --same potential here.
[2:29:43] once very challenging here is we have
[2:29:44] a project
[2:29:46] coming up, so it's hard
[2:29:49] to know when we would actually come with
[2:29:50] another fee
[2:29:52] increase in
[2:29:54] the future, because, we don't --we
[2:29:55] don't really understand the timeline
[2:29:56] with
[2:29:58] the project, and the other piece of
[2:29:59] this
[2:30:01] is when we come in
[2:30:04] the spring
[2:30:13] and jim and I
[2:30:15] bring, you know, a discussion about
[2:30:16] long-term fiscal sustainability, I
[2:30:17] think we will have a
[2:30:18] better sense there about what our
[2:30:19] options are on how to close the gap
[2:30:21] the marina, so it's hard to answer
[2:30:22] now, whether in another two years
[2:30:24] are going to be coming back --because
[2:30:26] the project might be moving in
[2:30:27] a direction at that point, where,
[2:30:29] yeah. Exactly. It's hard to know
[2:30:32] today.
[2:30:33] >> no. I --I --
[2:30:35] I recognize
[2:30:36] the discomfort. I'm sitting here,
[2:30:38] having
[2:30:41] flashbacks because my day job, I
[2:30:42] work for the state, and we went through
[2:30:44] this same
[2:30:50] exercise, where,
[2:30:59] fees for the work we do had
[2:31:00] not been adjusted for 20, 30 years,
[2:31:01] and for some of our licensees, it
[2:31:02] was
[2:31:03] sticker shock, and we can get into
[2:31:06] why previous administrations weren't
[2:31:08] raising fees every two or
[2:31:11] 3% per year, but we had to make
[2:31:17] the adjustment
[2:31:21] because if we didn't, we were moving
[2:31:22] towards the brink of insolvency, but
[2:31:23] in some
[2:31:25] cases, we did do a step approach so
[2:31:26] over
[2:31:32] two years, in some cases
[2:31:33] we would say, hey, we would work with
[2:31:35] licensees to provide some
[2:31:38] type of payment
[2:31:39] plan if there was --was --was hardship,
[2:31:41] but it's about writing
[2:31:43] the ship and very similar to what
[2:31:47] we are
[2:31:53] experiences tonight,
[2:31:56] even with the increases, it's still
[2:31:58] not covering all of the cost. But
[2:31:59] we have to
[2:32:02] try to
[2:32:05] do something to try
[2:32:06] to prevent the bleeding. Now, if we
[2:32:08] were down
[2:32:11] the path with
[2:32:12] some other projects on the horizon,
[2:32:13] we probably wouldn't be sitting here
[2:32:14] having
[2:32:15] this conversation, but unfortunately,
[2:32:20] aren't there yet.
[2:32:22] but we have to try to do something
[2:32:26] because, again, this is taking
[2:32:29] away from our
[2:32:32] general fund and if
[2:32:35] our reserves
[2:32:37] go below a certain threshold with
[2:32:38] our general fund, then this is
[2:32:41] a very different conversation here.
[2:32:43] that we are having as a council and
[2:32:44] having to talk of
[2:32:57] our residents about it. I know having
[2:32:59] gone through it, it is an uncomfortable
[2:33:00] situation. You're talking about increases
[2:33:02] and my boat is stuck
[2:33:08] in mud. I --I --I hear
[2:33:10] it. So, we are just trying to --given
[2:33:11] the hand that we have
[2:33:13] to play, to just tried to do something
[2:33:14] to mitigate what we are having to
[2:33:17] fund to keep
[2:33:20] the marina operational at this
[2:33:23] time, so.
[2:33:26] I just want to
[2:33:31] remind everyone that we are in a very
[2:33:32] different place than we were just
[2:33:35] a couple of
[2:33:38] years ago.
[2:33:44] there's been posts on rants and raves
[2:33:45] where people say,
[2:33:46] have they even dredged up marine in
[2:33:47] the last few decades
[2:33:48] and someone that jackson says, yes,
[2:33:50] we dredged in 2020 22
[2:33:56] -- 2022 --and the seawalls --
[2:33:58] we just finished the repairs of the
[2:33:59] fishing pier which blocked an
[2:34:05] entire hole that had been set a minting
[2:34:07] in that whole side of the marina and
[2:34:08] one of the things that has been
[2:34:10] brought up over the last couple of
[2:34:11] years is
[2:34:12] talking about public-private partnership.
[2:34:14] that's the direction we need to go
[2:34:15] and anyone who
[2:34:16] has been here knows that is what our council
[2:34:17] had to present to
[2:34:19] us in july and we are in the process
[2:34:20] of talking through some of
[2:34:21] that, so we are not raising rates
[2:34:23] and
[2:34:26] doing nothing.
[2:34:28] we are raising rates while we are
[2:34:29] doing a bunch of other stuff and
[2:34:32] I do want to thank you
[2:34:35] for including all of the work that
[2:34:37] f3 has done that again, a couple of
[2:34:38] years ago --last december
[2:34:41] --f3
[2:34:43] has only been around since last january.
[2:34:44] at this time last year, we couldn't
[2:34:45] you
[2:34:46] all in the face and say that things
[2:34:47] were happening because
[2:34:50] a lot of that repair was not
[2:34:55] getting done, and in this calendar
[2:34:56] year, I've seen so
[2:34:57] many improvements. I acknowledge they're
[2:34:59] not perfect but we've all been
[2:35:05] down there. We've all taken --
[2:35:06] we either have friends with bullets
[2:35:07] or we've done field trips. We know
[2:35:08] what it looks like
[2:35:09] and it has improved significantly,
[2:35:11] so I recognize that --what you
[2:35:14] said --
[2:35:16] we are always the ones stuck approving
[2:35:17] rate increases which is super frustrating,
[2:35:18] but
[2:35:19] we know that it's not just the rate
[2:35:20] increases. This
[2:35:22] is a much bigger project and a much
[2:35:23] bigger problem and we are here
[2:35:29] for it,
[2:35:35] and we are playing the wrong game
[2:35:36] for the
[2:35:37] marina and so I appreciate, lauren,
[2:35:38] your comment about, we don't know
[2:35:39] where we
[2:35:40] are going to be because potentially,
[2:35:41] you know, this time next year, we
[2:35:42] are
[2:35:44] going
[2:35:47] to be
[2:35:53] talking about
[2:35:55] steps 4 for that partnership. We are
[2:35:56] going to be in a different place
[2:35:58] in a couple of months if everything
[2:35:59] goes the way that it was propose to
[2:36:01] us over the summer, so, yeah. That
[2:36:02] was my comment because I know we have
[2:36:04] received lots of --some frustration
[2:36:05] from the public and from people here
[2:36:06] tonight.

[2:38:49] would like to discuss why we are here
[2:38:51] and some other
[2:38:57] important context.
[2:39:09] so there's a couple of things
[2:39:10] in the ordinance. I'll get into the
[2:39:11] specifics shortly, but here's a high-level
[2:39:12] summary. The vast
[2:39:13] majority of the ordinance and what
[2:39:15] we'll be discussing tonight is the
[2:39:16] establishment of
[2:39:17] an inclusionary housing program. We
[2:39:18] are also providing some additional
[2:39:19] modifications to our offstreet
[2:39:20] parking standards, permitting unbundled
[2:39:21] parking, establishing ground mounted
[2:39:22] mechanical equipment, clarifying some
[2:39:23] adu regulations --
[2:39:24] state exemption adus, throughout
[2:39:30] the ordinance.
[2:39:33] now we know what's in the ordinance.
[2:39:34] here's some important policy context
[2:39:35] that the streets why we are here.
[2:39:36] for scott housing
[2:39:37] element provides direction for the
[2:39:39] city to consider adopting
[2:39:44] an inclusionary housing ordinance.
[2:39:45] second is consistency with the metropolitan
[2:39:46] transportation
[2:39:47] commission's transit oriented communities,
[2:39:48] also known as the toc policy. The
[2:39:49] toc policy is a voluntary program
[2:39:51] that rewards the
[2:39:54] sword significant
[2:39:59] funding including inclusionary housing
[2:40:00] requirements and some of
[2:40:01] the parking management strategies
[2:40:03] that we are discussing today.

[2:40:22] difficult to hear the presentation.

[2:40:26] has
[2:40:27] previously directed staff to update our policies
[2:40:28] and regulations to be consistent with
[2:40:29] the toc
[2:40:30] policy. Ab 1505 has
[2:40:36] requirements . This is
[2:40:37] consistent with goal c, economic development
[2:40:39] and housing from strategic
[2:40:45] policies.
[2:40:48] so we are going to be talking about
[2:40:50] lot of technicalities around affordable
[2:40:51] housing. Before we dive too deep,
[2:40:52] it is impertinent
[2:40:53] to take a moment and talk about what
[2:40:54] affordable housing actually means.
[2:40:55] there are a
[2:41:00] lot of
[2:41:06] concerns. I want to make sure we are
[2:41:08] all on the same page. Affordable housing
[2:41:09] is just a blanket term that is also
[2:41:10] sometimes called lower income housing
[2:41:12] or below market rate housing. What
[2:41:13] it boils down
[2:41:18] to is
[2:41:21] affordable housing is a requirement
[2:41:22] that homes
[2:41:23] to be printed or so the film is based
[2:41:24] on one, their household income and
[2:41:26] two, their household size. Not all
[2:41:27] affordable housing is the same. Based
[2:41:29] these two variables of income and
[2:41:30] size, there are different tiers of
[2:41:31] affordable housing
[2:41:33] but it is based on ami, which
[2:41:36] is the median income level for house
[2:41:37] hold levels based
[2:41:39] on the county so half of the households
[2:41:41] the county earn more. Half earned
[2:41:42] less. For
[2:41:44] example in contra costa county, the
[2:41:45] jiggling for a family of
[2:41:48] four was
[2:41:51] $155,700. Now that we know
[2:41:54] what the
[2:41:56] ami is, we can do calculations to
[2:41:57] figure out what the various income
[2:41:58] and
[2:42:00] affordable --affordability
[2:42:03] levels are for different
[2:42:05] budgets. They generally fall into the categories
[2:42:06] you see in the columns. Acutely low
[2:42:10] 17%
[2:42:12] aye --ami very low is up to 50. Close
[2:42:13] up to
[2:42:19] 80.
[2:42:22] water it is up to 120. When
[2:42:23] summons is affordable housing, I can
[2:42:24] mean a lot of different things depending
[2:42:26] who it is intended to serve. Now,
[2:42:28] one of the biggest
[2:42:29] misconceptions about affordable housing
[2:42:30] is that it is for only the lowest
[2:42:31] wage
[2:42:32] earners. While that can be true for
[2:42:34] some projects --15, 30% ami,
[2:42:35] it's not actually usually the case.
[2:42:37] for instance, nausea contra
[2:42:40] costa
[2:42:46] county --
[2:42:49] hundred $86,000 is
[2:42:50] considered moderate income. Both of
[2:42:51] these families could qualify for affordable
[2:42:52] housing. And
[2:42:53] that really surprises people because
[2:42:54] they don't realize that affordable
[2:42:55] housing
[2:42:56] --they're not thinking families that
[2:42:58] make six figures.
[2:43:04] so, with that out of the way, let's
[2:43:05] get into what the actual inclusionary housing
[2:43:07] program that
[2:43:10] we are proposing is. So,
[2:43:11] starting off what is inclusionary
[2:43:12] housing? Sometimes it is referred
[2:43:16] to as
[2:43:17] inclusionary zoning but it refers
[2:43:18] to requirements imposed on developers
[2:43:19] of residential projects to set
[2:43:22] aside a
[2:43:23] shared --a share of their proposed
[2:43:24] units as affordable housing. Inclusionary
[2:43:25] housing can be
[2:43:31] limited to
[2:43:39] address segregation by ensuring housing
[2:43:40] is available for lower
[2:43:41] wage workers, guarding against concentrations
[2:43:42] of poverty and events and making it
[2:43:43] possible for lower
[2:43:44] income households to live in higher
[2:43:45] resourced neighborhoods. Okay, so
[2:43:46] now that we have covered
[2:43:49] our bases let's talk
[2:43:50] about the program. So the next two
[2:43:52] slides are the most important for
[2:43:53] understanding. Projects which generally
[2:43:55] have the creation
[2:44:01] of 11
[2:44:05] new dwelling units will be required
[2:44:06] to comply. However, there are certain
[2:44:07] types of exclusions.
[2:44:08] that includes projects like reconstructions,
[2:44:09] modifications to existing buildings
[2:44:10] and other projects that you see
[2:44:11] listed here. Now, these types of qualifying
[2:44:13] projects would be
[2:44:19] required to dedicate 15% of their
[2:44:20] total units to affordable housing. Depending
[2:44:21] on if they are rental or ownership,
[2:44:22] the average ami
[2:44:25] must meet 80 or 120% of
[2:44:28] ami average. 120
[2:44:34] for ownership.
[2:44:42] to kind of put these regulations into
[2:44:43] a little bit of
[2:44:44] context, I provided two real-world
[2:44:45] examples of recently approved projects.
[2:44:46] the first is the
[2:44:49] amare apartments project which
[2:44:53] currently approved for 183 units.
[2:44:54] hypothetically, if we were to apply
[2:44:55] our program here,
[2:44:57] 15% of their units would need to be
[2:44:58] affordable which would equate to
[2:45:00] 28 units being the restricted. Affordable.
[2:45:01] from there, again, rental
[2:45:03] would have to have an average of no
[2:45:04] more
[2:45:07] than 80% ami, so there's a different
[2:45:08] way you
[2:45:09] can break that down but here's just
[2:45:10] an example of a
[2:45:13] potential income unit mix there. And
[2:45:14] then the
[2:45:15] same thing for the wyoming heights
[2:45:16] project which was just recently approved
[2:45:17] and
[2:45:20] the ownership project for 21 townhomes.
[2:45:22] if we were to apply these standards,
[2:45:23] seven
[2:45:25] of the
[2:45:28] units would
[2:45:34] be required to be affordable
[2:45:36] housing. And again, that one is 120% ami,
[2:45:37] so the mix can be a little
[2:45:38] bit different depending on the rental
[2:45:40] or ownership components.
[2:45:41] >> can I
[2:45:42] interrupt really
[2:45:43] quickly? This is not the actual breakdown
[2:45:45] affordable units. These are hypothetical
[2:45:46] numbers.
[2:45:47] >> and just for context,
[2:45:48] amare project
[2:45:50] isn't entitled for nine affordable
[2:45:52] units and the wyoming heights project
[2:45:55] entitled
[2:45:58] 48. --
[2:46:00] for 8. Leon two general requirements
[2:46:07] of inclusionary units. Any units built on
[2:46:08] site would need to be of a standard
[2:46:10] comparable to the above
[2:46:16] moderate units
[2:46:27] or the market rate units. This includes
[2:46:28] the design, the finishes, the access
[2:46:29] to amenities. These units need to
[2:46:30] be reasonably dispersed throughout
[2:46:31] the project site kind
[2:46:33] of how you would envision it in this
[2:46:34] image that you see here. Really, the
[2:46:36] goal is to make affordable units indistinguishable
[2:46:37] from market rate units. You shouldn't
[2:46:38] be able
[2:46:39] to go to a project site and figure
[2:46:40] out which ones are affordable and
[2:46:42] which ones are market rate. So, to
[2:46:43] assist in offsetting the cost of incorporating
[2:46:44] affordable housing into these types
[2:46:49] of projects,
[2:47:18] we do make sure that these projects
[2:47:19] are available for a couple
[2:47:20] of different incentives. The first
[2:47:22] is they would still be eligible for
[2:47:23] california state density
[2:47:24] bonus law which provides a pretty
[2:47:25] significant density bonus to projects
[2:47:26] already providing affordable housing.
[2:47:27] it also allows them several concessions
[2:47:28] and waivers to development standards.
[2:47:29] things like heights,
[2:47:30] setbacks, and light coverage, or projects
[2:47:31] would be eligible for development
[2:47:32] incentive and community benefits
[2:47:33] program which was passed I believe
[2:47:34] last year, which provides even greater
[2:47:35] residential
[2:47:36] density bonus then under state. The first
[2:47:37] is we are proposing to explicitly
[2:47:43] permit unbundled
[2:47:44] it allows
[2:47:46] them several
[2:47:48] this would not be a
[2:47:50] requirement of projects. It would
[2:47:51] just
[2:47:52] create the option. Another requirement
[2:47:54] of the chick told us we
[2:47:57] are providing
[2:47:58] --administrative offices for any new
[2:48:00] development. And while not
[2:48:03] a requirement
[2:48:06] of the
[2:48:09] toc
[2:48:10] policy we are proposing a couple of
[2:48:11] additional cleanup to create some
[2:48:12] parking standards and ratios
[2:48:13] for retail complexes and shopping
[2:48:16] centers. The code currently lacks
[2:48:17] regulations relating to small ground
[2:48:18] mounted income
[2:48:21] such as
[2:48:24] hvac and [ inaudible ] which
[2:48:25] has been a gray area and as I could.
[2:48:27] we are proposing to allow
[2:48:29] them to project into the side yard
[2:48:30] setbacks.
[2:48:33] no closer than three pairs --
[2:48:36] feet
[2:48:37] --closer to the primary structure
[2:48:39] as opposed to the
[2:48:40] property line. So just add some clarification
[2:48:48] the zoning.
[2:48:51] we also have a couple of updates
[2:48:52] to our adu code. The first one is related
[2:48:54] to privacy standards. So the zoning
[2:48:57] ordinance generally only permits adus
[2:48:59] be two stories if they are additions
[2:49:00] to existing structures or if there's
[2:49:01] some
[2:49:03] kind of approval
[2:49:04] of an exception. So to alleviate the
[2:49:06] potential privacy concerns of a two-story
[2:49:07] adu we incorporated devisee standards
[2:49:09] such as frosted
[2:49:10] or opaque windows or windows having
[2:49:18] to be
[2:49:25] a certain height above the floor level. The
[2:49:27] intent was always for these standards
[2:49:28] to apply to windows only on second
[2:49:29] stories, however, that's not unfortunately
[2:49:30] the way it is
[2:49:31] written in the codes of this is more
[2:49:33] of a cleanup to make sure
[2:49:34] that these privacy standards are enforced
[2:49:36] on the second story
[2:49:41] windows only. And second adu has to
[2:49:43] --amendment has to do with the state
[2:49:45] exemption adus. I'll kind of get into
[2:49:46] what
[2:49:47] those are in just a second but generally
[2:49:48] we are just doing a little
[2:49:49] bit of cleanup related to those. So
[2:49:51] after publication of the
[2:49:57] planning commission
[2:49:58] ordinance we received one public comment from
[2:49:59] the california housing defense --
[2:50:00] I forget the acronym.
[2:50:02] defense fund. Thank you. So calhdf.
[2:50:03] they had
[2:50:06] two comments. One is that we
[2:50:07] are incorrectly referencing the state
[2:50:09] good. We corrected
[2:50:10] that any state ordinance. It just
[2:50:12] hasn't been reflected in the online
[2:50:13] code
[2:50:14] yet. [ inaudible ] the second had
[2:50:15] to do with how we
[2:50:20] treat state exemption adus. The state
[2:50:21] exemption adus are an envelope
[2:50:22] for adus. High requirements, square-foot
[2:50:24] requirements
[2:50:29] pretty you meet those requirements,
[2:50:30] the city basically has no
[2:50:31] discretion and you're allowed to go
[2:50:33] straight for building
[2:50:34] permit. Calhdf had a common related
[2:50:36] to how he described those in our
[2:50:41] code. And we were applying some of
[2:50:42] our discretionary standards to them that
[2:50:45] for clarity we were never
[2:50:48] doing that.
[2:50:50] we already had some carveout at the
[2:50:51] beginning but we went
[2:50:52] ahead and made some additional clarifications
[2:50:54] to ensure that that is extremely clear
[2:51:00] our code.
[2:51:06] and finally, we presented the
[2:51:07] ordinance to the planning commission
[2:51:08] on october 28th. There was a minority
[2:51:09] concern about
[2:51:10] the unbundled parking amendment in
[2:51:11] the ordinance. There was a citation
[2:51:12] of concerns that it
[2:51:13] could potentially result in price
[2:51:15] gouging separating the pricing --
[2:51:16] leases
[2:51:17] --and there was a motion to remove
[2:51:18] it from the ordinance but the motion
[2:51:21] failed and
[2:51:24] --adopted --with some other
[2:51:30] minor amendments.
[2:51:53] okay. So with that, tonight's recommendation
[2:51:54] is a little long so please bear
[2:51:55] with me. Staff's recommendation is
[2:51:56] to conduct a public hearing, waive
[2:51:57] the reading, and introduce
[2:51:58] an ordinance approving zoning text
[2:51:59] mems to the martinez municipal code
[2:52:00] by 1, adding chapter
[2:52:01] 22.82, inclusionary housing, 2, amending
[2:52:02] chapters 22.04, definitions, and chapters
[2:52:03] 22.12, residential districts to
[2:52:04] reference a new chapter 22.82, 3,
[2:52:09] amending
[2:52:10] chapter 22.3 for general requirements
[2:52:11] and exceptions to add regulations
[2:52:12] related to ground mounted mechanical
[2:52:13] equipment, 4,
[2:52:14] amending chapter 22.36, offstreet
[2:52:15] parking and loading facilities to
[2:52:16] update
[2:52:18] automobile and bicycle parking ratios
[2:52:19] for residential, commercial,
[2:52:20] and office projects and permit unbundled
[2:52:21] parking pursuant to the housing element
[2:52:27] and ntc,
[2:52:36] metropolitan transpiration commissions
[2:52:37] parking
[2:52:38] pursuant to the housing element and
[2:52:39] metropolitan transportation commission's
[2:52:40] transit oriented communities, policy,
[2:52:41] 4 amending chapter

[2:54:10] a year. That's a whole

[2:54:31] of questions that had come

[2:54:37] page five, alternative means
[2:54:39] of compliance. So you referenced ab
[2:54:44] 1505 . There are these alternatives
[2:54:46] that are laid
[2:54:52] out. So, this --if this is
[2:54:55] adopted
[2:54:56] tonight, and these are the options
[2:54:57] that would be available to affordable housing
[2:54:58] developers
[2:55:04] to meet
[2:55:08] their requirements. Correct? They
[2:55:09] could take advantage of one of these,
[2:55:10] all of
[2:55:11] these? Is there a limit? How does
[2:55:13] that work?
[2:55:15] for clarification, this would be for
[2:55:16] any developer. Not just affordable
[2:55:17] housing developers.

[2:55:24] language in the code is carved out
[2:55:25] that they can take advantage of one,
[2:55:28] multiple combination

[2:55:43] housing policy,
[2:55:53] what has been the general trend? Have they
[2:55:55] actually seen -- have they
[2:55:56] been able to move the needle on these
[2:55:57] types of projects in their respective
[2:55:58] communities?
[2:55:59] >> yeah,
[2:56:00] so, in my research, the turner center
[2:56:01] out of uc berkeley, which is one of
[2:56:02] the foremost leaders in housing policy
[2:56:03] research, they did a pretty thorough
[2:56:04] study
[2:56:09] and analyzed the effects of inclusionary
[2:56:10] housing ordinance and their general consensus
[2:56:12] is that it tends to slightly reduce overall
[2:56:17] housing production but increase overall
[2:56:19] housing production.
[2:56:22] interesting. Okay.
[2:56:24] and then the last question I had was
[2:56:25] with
[2:56:28] respect to
[2:56:29] the parking that you referenced as
[2:56:31] part of
[2:56:34] your presentation. I
[2:56:37] could see unbundled parking making
[2:56:38] sense,
[2:56:40] particularly if you are within a certain
[2:56:43] diameter
[2:56:46] radius of [ inaudible ]
[2:56:49] forgive me. I get
[2:56:52] my terminology --
[2:56:53] >> major transit stops. >> if you
[2:56:55] say okay, we built
[2:57:01] something not too
[2:57:02] far from the amtrak station. Somebody says,
[2:57:04] I don't need a car. I have
[2:57:07] the train, or I can walk to
[2:57:08] the bus. Fair. Right? We build something
[2:57:10] closer to virginia hills, it becomes
[2:57:13] --it
[2:57:14] becomes a little bit of a different
[2:57:16] ball
[2:57:21] game. Right? But if I understand you
[2:57:22] correctly, it's not a mandate. It's
[2:57:25] an option. So, that would be
[2:57:28] up to the developer
[2:57:31] to say,
[2:57:34] I think
[2:57:36] I'm going to get more people here.
[2:57:37] parking is going to have to
[2:57:38] be a necessity based on the layout
[2:57:40] of the proposal. Right? So, I just
[2:57:41] wanted
[2:57:42] to kind of feel that out and make
[2:57:43] sure I was understanding that correct
[2:57:44] because
[2:57:48] from a developer standpoint, I could
[2:57:49] see it being advantageous
[2:57:51] on one hand but then on the other
[2:57:52] hand, it may not
[2:57:58] make sense,
[2:58:01] but we are not, we are just
[2:58:02] giving them the option to do that.
[2:58:04] we are not requiring them to do that.
[2:58:06] >> right. >> and I just want to clarify,
[2:58:07] generally speaking, it's been seen
[2:58:08] that
[2:58:09] unbundling parking reduces the cost
[2:58:10] of housing because if you are paying
[2:58:11] for the price
[2:58:16] of parking
[2:58:25] but
[2:58:27] you don't use it, you are basically
[2:58:28] subsidizing all of your neighbors,
[2:58:29] or they are
[2:58:30] subsidizing you, and that's already
[2:58:31] included in the cost of your housing
[2:58:32] as opposed to
[2:58:33] if you detach the two, you technically
[2:58:34] could lower the cost of overall housing.
[2:58:36] okay. And the last question I had
[2:58:37] here was --I appreciated the hypothetical
[2:58:40] you put in
[2:58:43] there with
[2:58:45] respect to amare and wyoming heights. I
[2:58:46] guess the question that came to
[2:58:48] mind is if such a policy was in place
[2:58:49] before the projects were
[2:58:51] [ inaudible -low volume ] I don't
[2:58:52] know what
[2:58:58] the right
[2:59:00] word is, permitted.
[2:59:01] >> entitled. >>
[2:59:02] entitled. Excuse me. Do you think
[2:59:03] the developers
[2:59:04] would've moved forward in the way
[2:59:05] that they did?
[2:59:06] >> you know, I'm not
[2:59:07] really sure. But like I --that's why
[2:59:10] kind of mentioned before, that generally
[2:59:11] speaking,
[2:59:13] cities with inclusionary
[2:59:16] housing have seen slightly
[2:59:19] decreased overall
[2:59:24] housing production, but in turn, have
[2:59:25] seen higher affordable so I
[2:59:27] don't want to speak for any of those
[2:59:28] other developers, but,
[2:59:31] you know, affordable housing is
[2:59:33] not cheap. It's very expensive, which
[2:59:34] is why it's really important that
[2:59:37] we included the certain incentives
[2:59:38] like our community
[2:59:39] benefits program, like allowing them
[2:59:47] to utilize
[2:59:54] state density bonus. Those things are
[2:59:55] -- result in significant cost savings
[2:59:57] and help offset the price of affordable housing.
[2:59:59] I appreciate you bringing that up
[3:00:00] because sometimes, we
[3:00:01] have to remind folks, we are not in
[3:00:02] the business
[3:00:05] of building housing. We don't build
[3:00:07] houses, but we do help create the
[3:00:08] conditions hopefully that
[3:00:09] fosters housing, so I just want to
[3:00:10] make sure as we are going through
[3:00:11] this
[3:00:12] policy and related items, that we
[3:00:13] are hopefully making it easier and
[3:00:14] more attractive
[3:00:17] for folks to be able to help us
[3:00:20] move this needle on bringing
[3:00:21] more affordable workforce housing
[3:00:23] to our community, which
[3:00:28] sounds like based on what I'm hearing
[3:00:29] tonight, it will.
[3:00:31] I'm going to give additional context
[3:00:32] and additional
[3:00:33] information with what brandon said.
[3:00:39] he said earlier in his presentation
[3:00:41] using wyoming heights as an example,
[3:00:44] the affordability requirement
[3:00:47] under the
[3:00:49] inclusionary ordinance is 15%, but
[3:00:50] with each
[3:00:51] of the overlays, is adopted, it's
[3:00:52] actually 20%, so this is not actually
[3:00:53] impeding
[3:00:54] them anymore than the incentives that
[3:00:56] they actually
[3:00:59] already have, so where we
[3:01:00] had envisioned from her housing element
[3:01:02] that we are going to see housing growth
[3:01:05] -- these regulations won't
[3:01:08] impact them. Amare is a
[3:01:14] different
[3:01:17] story. It's
[3:01:18] an abnormality. It's not a typical
[3:01:19] project we are going to have. I don't
[3:01:20] foresee a
[3:01:21] project like that in the foreseeable
[3:01:22] future. Housing element does not envision
[3:01:23] a project
[3:01:26] of that skill for the
[3:01:29] foreseeable future.
[3:01:31] I wouldn't recommend making a decision
[3:01:32] based on that and we
[3:01:33] have included a carveouts of that because that
[3:01:35] project is already entitled, these
[3:01:36] regulations
[3:01:37] won't impact that project.
[3:01:38] >> I do
[3:01:39] also want to add one more thing. [
[3:01:40] inaudible ] I have an extra slide
[3:01:41] for
[3:01:46] it. In contra costa county, we are
[3:01:47] only one
[3:01:49] of four or five --I don't recall --
[3:01:50] cities that do not have
[3:01:54] an inclusionary housing ordinance
[3:01:55] and of those four or five cities, only
[3:01:56] two that
[3:01:57] we are aware of are not actually planning
[3:01:59] on doing one, so, almost every single
[3:02:02] city in contra costa county will have
[3:02:04] an inclusionary ordinance.
[3:02:05] >> so,
[3:02:06] in the text
[3:02:11] of the staff report, it says it
[3:02:14] is less
[3:02:17] than 15%.
[3:02:20] would be allowed but
[3:02:21] it requires a feasibility study. Can
[3:02:23] you just restate that or speak to
[3:02:24] it one
[3:02:25] more time?
[3:02:26] >> yeah. So, one of the
[3:02:27] caveats for adopting this is
[3:02:32] that the toc policy has
[3:02:33] a minimum requirement for affordability
[3:02:35] which is
[3:02:38] 15%. They do allow
[3:02:39] us to reduce it or developers to reduce
[3:02:40] it if they can provide substantial
[3:02:46] proof that that would result in infeasibility
[3:02:50] their project. So.
[3:02:51] >> all right. Then
[3:02:53] the
[3:02:55] other question --
[3:02:56] >> from our perspective,
[3:02:57] I was
[3:02:59] going through, what our options were,
[3:03:00] and this
[3:03:01] happened a couple of times with some
[3:03:08] the items
[3:03:10] you brought to us where we start with 30%
[3:03:11] but we end up
[3:03:13] at 50 or whatever but in this particular
[3:03:14] case, 15 is the lowest we
[3:03:17] can go. We don't have any
[3:03:22] flexibility there'd , tonight, at
[3:03:23] least.
[3:03:24] >> so we can
[3:03:25] start at 15%, and if the city conducts
[3:03:26] a feasibility study, we can potentially
[3:03:29] lower it. That would have to be
[3:03:32] reviewed by mtc following but in terms of
[3:03:33] timelines
[3:03:34] for getting the discretionary funding
[3:03:35] ball rolling
[3:03:41] from
[3:03:58] mtc, it's important that we adopt
[3:03:59] an ordinance today and then if
[3:04:01] we need to amend it after we do a
[3:04:02] study, we can do so.
[3:04:04] on the slide before we had all the
[3:04:05] other cities, there were a couple
[3:04:06] that
[3:04:07] said 5% or something. They would've
[3:04:08] done a feasibility study?
[3:04:09] >> some
[3:04:10] of them
[3:04:11] may have. We weren't able to get into
[3:04:12] that level of research but we are
[3:04:13] also aware that a lot of the cities, knowing
[3:04:14] that they are also going
[3:04:16] to comply with toc policy are probably going
[3:04:17] to have to update their percentages
[3:04:19] as well.
[3:04:20] >> okay. The other thing
[3:04:21] that's in the staff report --
[3:04:22] the weight it was worded in my notes
[3:04:23] are bad but something like it needs
[3:04:25] to average out to 80% ami for those
[3:04:26] 15%. Why did we write it
[3:04:28] that way? Is there another state law
[3:04:29] that requires it?
[3:04:30] >> it is toc policy
[3:04:31] requirement.
[3:04:32] >> toc policy --because
[3:04:33] from
[3:04:38] my perspective,
[3:04:41] I think that I would like to remove
[3:04:43] the requirement for what percentage of
[3:04:44] ami and I would love to
[3:04:45] leave that up to the developer because
[3:04:47] from --it was my understanding that there
[3:04:53] is often
[3:04:55] like grant funding. There's other funding
[3:04:56] sources for low and very
[3:04:58] low, but maybe not for the higher,
[3:04:59] and so if you're a developer that
[3:05:01] has access to that funding, you would want
[3:05:02] to do possibly one way and
[3:05:07] then other developers may want to
[3:05:08] have all of their
[3:05:10] units be moderate and I would rather
[3:05:11] us not dictate that.
[3:05:12] >> again,
[3:05:14] it is a requirement
[3:05:17] in the
[3:05:48] toc policy, but in
[3:05:49] a way, it does provide flexibility
[3:05:50] kind of like in the example that I
[3:05:51] pulled
[3:05:52] up here. They are required to provide
[3:05:53] 28 units but the distribution can
[3:05:54] be up

[3:06:27] they could see
[3:06:28] themselves out of affordable housing,
[3:06:29] so. They're not really trying to do
[3:06:30] a lot of
[3:06:31] moderate housing from what we've heard.

[3:06:34] be consistent with the way the toc
[3:06:36] policy is written

[3:07:13] affordable is. They are thinking the
[3:07:15] lowest of the low, and that is not
[3:07:16] theirs
[3:07:18] that is simply not true.
[3:07:19] I mean, the statistics that you shared
[3:07:21] bear that out and I think it's something
[3:07:22] that we collectively need to be mindful
[3:07:24] of as in our negations with
[3:07:30] community members, as affordable is
[3:07:31] not,
[3:07:33] you know, what you think it is.
[3:07:35] you know. And getting more and more
[3:07:36] challenging if
[3:07:37] anything. Even for folks, like you
[3:07:45] said --
[3:07:57] and other
[3:07:58] parts of the country, sure. Six figures.

[3:08:01] the case here, and I think that's
[3:08:03] really important for us, so what I

[3:08:08] flexibility. Not making it so rigid
[3:08:09] that it's going to
[3:08:10] unnecessarily drive up the cost because
[3:08:12] our goal --certainly michael --has
[3:08:13] been,
[3:08:14] had we make this a more attractive
[3:08:15] place for developers to come and say,
[3:08:16] hey,
[3:08:17] we want to invest in your community.
[3:08:18] we want to help those folks that
[3:08:21] are, you know, that are

[3:12:35] christmas tree lighting. That will be

[3:18:17] them. They might even be ready by

[3:18:48] quickly, council member mckillop and
[3:18:49] I sit on
[3:18:50] the economic development
[3:18:53] subcommittee. We had a robust discussion
[3:18:56] with kaiser permanente and
[3:18:59] the county
[3:19:04] hospital who provided of reviews of their
[3:19:05] operations here in martinez and a
[3:19:06] discussion
[3:19:07] about the impacts of some of the rim
[3:19:08] healthcare cuts as a result
[3:19:11] of recent federal actions that
[3:19:14] were undertaken.
[3:19:16] one thing which was news to me was
[3:19:17] that in
[3:19:18] spite of that, the county hospital
[3:19:20] is actually looking at a very ambitious
[3:19:21] expansion, so they are going to be
[3:19:23] doing a lot of construction
[3:19:26] it sounds like in the very
[3:19:29] near future.
[3:20:00] which will no doubt bring a lot of construction workers
[3:20:02] into martinez, but also, there will
[3:20:03] be some
[3:20:04] associated headaches, perhaps with
[3:20:05] that. We want to make sure we mitigate
[3:20:06] that to
[3:20:07] the extent possible, and so, I think
[3:20:08] we got a commitment from them. They
[3:20:09] have
[3:20:10] a plan in place to do that. The v-8
[3:20:11] was not able to participate because
[3:20:12] of the federal government shutdown
[3:20:14] which is still going on but we hope
[3:20:16] bring them back, but would love to
[3:20:17] be able to schedule tours of all
[3:20:18] of those facilities at some point
[3:20:20] next year, as well, so. But that was
[3:20:21] it. Debbie, did I miss anything?
[3:20:23] I think you mentioned all the things
[3:20:24] we discussed.
[3:20:25] coincidentally, this morning, I got
[3:20:26] to meet with david culberson, the
[3:20:27] ceo of the
[3:20:28] hospital, and we got to see where
[3:20:29] the new building is going to be built
[3:20:31] in the future. I was there on another
[3:20:32] unrelated matter but got
[3:20:33] to visit the hospital, and they will
[3:20:35] be a lot of change and I'm looking
[3:20:37] forward to that, as well.
[3:20:38] >> the one
[3:20:39] thing I think was really a
[3:20:41] big take
[3:20:44] away was, we
[3:20:46] are a city of 36,000 but we have these
[3:20:47] three medical centers and they
[3:20:49] are a huge linchpin for our community. There's
[3:20:50] a lot of martinez residence and played
[3:20:52] at those centers but then when you
[3:20:53] think about
[3:20:55] the economic impact that these facilities
[3:20:56] have, it was a
[3:20:58] really good, it was one of the better
[3:20:59] subcommittees I have to say that
[3:21:00] --meetings that I've had the opportunity
[3:21:02] to participate in. Anyway, that was
[3:21:08] it.
[3:21:14] one of the
[3:21:15] additional challenges they talked about
[3:21:17] was parking and so hopefully we can find
[3:21:18] ways in which
[3:21:19] we can help support some of their
[3:21:20] parking needs especially during construction
[3:21:21] phases in
[3:21:22] early next year or by 2026.
[3:21:23] >> are

[3:22:05] to get approval before we
[3:22:07] were able to bring it back to the
[3:22:08] council for discussion, and they did
[3:22:09] that yesterday,
[3:22:10] so they got approval yesterday so
[3:22:11] the goal would be to try to bring
[3:22:12] something
[3:22:13] before the council before the end
[3:22:14] of the year because they actually
[3:22:15] need the
[3:22:16] temporary parking as soon as possible.
[3:22:17] and then we figured, the two years,
[3:22:18] we would
[3:22:19] have a discussion based on where we
[3:22:20] are the conversation to see if we
[3:22:21] get
[3:22:22] accepted for another year.

[3:22:24] that generate revenue?

[3:22:26] actually, yes.
[3:22:27] he would generate revenue. Part of
[3:22:28] the agreement would

[3:22:37] for that cost as well as doing $12,000 a

[3:23:59] from so we've narrowed down the field

[3:24:16] really nice to see them. It was kind

[3:24:50] a 3 with the hospital and david culberson's
[3:24:51] on that call because he represents
[3:24:52] the hospital. The biggest concerns of course
[3:24:54] are releasing people from the jail,
[3:24:55] releasing people
[3:24:56] from psychiatric emergency services
[3:24:57] and everyone
[3:25:03] kind of being
[3:25:04] in martinez and not necessarily having
[3:25:05] transportation or taking advantage
[3:25:06] of transportation and leaving, so,
[3:25:08] that was the driver for starting that meeting
[3:25:09] this past meeting that we
[3:25:10] had really was talking a lot about
[3:25:11] mental health issues, and we were
[3:25:12] able to
[3:25:13] provide after that meeting some stats
[3:25:15] for --from martinez on some of the
[3:25:16] issues
[3:25:18] that we have been
[3:25:21] having with
[3:25:24] mental health
[3:25:25] calls and not getting the support
[3:25:27] that we need from the county, so that
[3:25:28] was that
[3:25:29] meeting that we had. Any other outside

[3:25:42] is measured j21a
[3:25:47] fund safe transportation for children
[3:25:48] which includes funding
[3:25:51] to improve
[3:25:52] transportation access and safety for
[3:25:54] students in our sub impact region.
[3:25:55] so, we approved funds in
[3:25:57] the amount
[3:26:00] of 41,000 two
[3:26:03] participate
[3:26:06] in a two-month
[3:26:08] summer program. It would be june and
[3:26:09] july of 2026 for
[3:26:12] youth ages
[3:26:14] 6 to 18 can ride buses free without
[3:26:15] passes.
[3:26:18] and then, on the heels of that will
[3:26:21] be the existing past the class school
[3:26:27] your program
[3:26:33] which is august
[3:26:34] to september next year, providing
[3:26:35] free passes to enrolled students.
[3:26:36] so we
[3:26:38] will be contributing $41,000 so students can
[3:26:39] ride free in june and july. We
[3:26:40] also asked staff because it seems
[3:26:44] a bit cumbersome, but we have asked
[3:26:45] staff to
[3:26:48] see about if we
[3:26:51] could extend that free time
[3:26:57] without enrollment
[3:26:59] because with children being able to write
[3:27:00] for free for june and july, they
[3:27:03] just get on a bus. They
[3:27:05] don't have to enroll. And some of
[3:27:06] the information we got back is that
[3:27:07] the
[3:27:08] parents really appreciate it because
[3:27:09] it kept them out
[3:27:11] of cars. Kept gas bills down. So we
[3:27:12] want to just
[3:27:15] see about --because in
[3:27:20] our measured j21a fund, we've got 4.2 million
[3:27:21] available, so we can easily
[3:27:24] for four months
[3:27:26] have folks write for free, so that
[3:27:27] came out of
[3:27:32] our meeting.

[3:27:37] of the
[3:27:39] latest fairy was introduced

[3:28:09] upcoming technologies
[3:28:12] they helped unveil, so that's it.

[3:30:36] lot of work that goes in behind the

[3:30:44] public works, parks and rec, and everyone.

[3:31:00] not just the lack of timely response
[3:31:02] on the striping and what have you,
[3:31:04] but, that stretch of highway
[3:31:09] folks, between hercules in martinez,
[3:31:10] it's a dump, and it is
[3:31:13] frustrating. Every
[3:31:16] time I
[3:31:20] driving by there, that's like the
[3:31:22] gateway to our city. I'm like, why
[3:31:23] aren't
[3:31:24] they picking this up? How often are
[3:31:25] they sending crews? Highway 24 don't
[3:31:26] look like
[3:31:28] that. It's like, can
[3:31:31] we --
[3:31:35] think there's an opportunity here
[3:31:37] to really engage them and if we need
[3:31:38] to engage our state representatives
[3:31:39] in this conversation, but caltrans
[3:31:40] really needs to step up their
[3:31:41] game. I just feel that more could
[3:31:45] be done. We have a real safety issue
[3:31:46] quite frankly but it's
[3:31:48] also we've spent a lot of time on
[3:31:49] beautification of
[3:31:50] our city. What about beautification
[3:31:52] of the entryway into our city?
[3:31:58] highway 4. So maybe this is something
[3:31:59] we could work collaboratively with
[3:32:00] our counterparts in hercules and see
[3:32:01] if maybe we
[3:32:02] can collectively lean on caltrans
[3:32:10] step up.
[3:32:22] the striping and -- that's
[3:32:23] got to be a priority and the fact -- the
[3:32:25] lack of lighting as well is a
[3:32:27] contributing factor, as well, I have to
[3:32:28] say. It's really dark on highway 4
[3:32:29] at certain points, so you combine
[3:32:31] that with the lack of striping and
[3:32:32] it's a
[3:32:33] real safety issue. So we need to get
[3:32:34] that done. Happy to connect off-line
[3:32:36] terms of how best we can advocate
[3:32:37] on that. The last thing I wanted
[3:32:39] to say --I just wanted to extend my
[3:32:40] heartfelt condolences to the family
[3:32:41] of gwen moore, a longtime munro --

[3:33:27] caltrans to our contact and I've seen

[3:33:31] to us and I think we can take advantage
[3:33:33] that relationship, and request additional
[3:33:34] things, so, that's that update. So,
[3:33:35] for me, today, I
[3:33:36] got a chance to go to --high school
[3:33:37] to their leadership exchange. We
[3:33:39] had kids in the leadership program
[3:33:46] from seventh
[3:33:57] --2nd to 5th grade. There was a lot of
[3:33:58] local folks and
[3:34:00] the kids got to ask us questions and
[3:34:01] I really enjoyed it, so kudos to
[3:34:03] luciana who is a freshman who coordinated
[3:34:04] all of that. There were about 50 kids
[3:34:06] there. We talked about the tree lighting that I'm able
[3:34:08] to join --so I'm
[3:34:09] glad that you all will be covering
[3:34:10] it. A reminder that the downtown cleanup
[3:34:12] is on saturday the 22nd, and that
[3:34:14] is the last cleanup
[3:34:15] of the year, and that is really to help
[3:34:17] kick off the
[3:34:18] holiday season, you know, spruce up
[3:34:20] our
[3:34:21] downtown for shopping. Happy thanks giving to everybody. I

[3:34:40] the pleasant hill people and all the
[3:34:41] martinez people
[3:34:42] and going to the concord hospice tree.

[3:34:47] director of hospice
[3:34:50] east bay
[3:35:06] couple of days ago to talk about with
[3:35:07] an entry might look like. Other cities
[3:35:08] aren't finding new trees. They're
[3:35:10] finding new trees to make the hospice
[3:35:11] tree out of so
[3:35:12] I wanted to pass that on to all of
[3:35:14] you because she had even
[3:35:15] acknowledged that our hospice treat
[3:35:16] was in a really weird place. The fact
[3:35:17] that it
[3:35:18] was in the middle of the road someone
[3:35:20] we had events, we had to
[3:35:21] close the road down together. So if
[3:35:23] we can find a beautiful old tree, that's
[3:35:24] in a park or something, that would
[3:35:25] be much more conducive to what they
[3:35:26] are
[3:35:27] looking for, and it would be consistent
[3:35:29] with other cities so if anybody has
[3:35:30] any ideas, I was thinking can part
[3:35:31] might be an interesting location.

[3:36:34] help contribute toward a protein fund

[3:36:41] the holidays. Turkey,
[3:36:42] chicken, ham, tofu, whatever you might want

[3:36:50] holidays. So
[3:36:51] city council actually has a little
[3:36:52] bit of money in our discretionary

[3:36:54] has been unspent so I wanted to propose
[3:36:56] this as an option to donate a
[3:36:58] little extra to our contra costa food
