[23:35] a nonprofit in olathe provides food and services dogs and
[23:42] medical equipment and christmas parties to honor a lot of
[23:48] military kids with $44,000 for double am at the and
[23:54] veterans but today, we're doing this for my friend terry
[23:58] and terry served in vietnam he served is from 1967 to 72 a
[24:08] special sworn in the infantry and completed the training
[24:13] advanced training and after a brief 20-day terry deployed
[24:25] and served with the fit battalion and operating throughout
[24:30] the central islands the service took him though areas with
[24:37] the antelope valley and sun valley and july and.

[24:47] >> after vietnam terry served as fort hood before
[24:53] running to cancel after the service terry returned back to
[24:59] the olathe, kansas lived in the area and now he's
[25:02] witnessed a lot of changes here in the hometown in this
[25:07] community and tera proud supporter of fish and terry I'm
[25:17] glad the city wants to honor you.
[25:20] >> I'll read the proclamation. So the proclamation
[25:26] reads whereas, each year on november 11th we pause to
[25:34] remember those who served in the americans armed services
[25:41] and more than one hundred and fifty thousand veterans call
[25:44] kansas home and continuing to better our communities with
[25:48] the service and patriotism. And whereas, on veteran day
[25:53] we commemorate the sacrifices of your veterans most lost
[25:59] and those who are still with us. And whereas, the city of
[26:06] olathe will be closed november 11th for the opportunity to
[26:11] express gratitude to our veterans for the freedom and
[26:16] democracy for the corner of our great nation.

[28:06] the first in the state to be accredited by the kleap and
[28:12] here to present the award have vice and director of the
[28:21] local training for the state of kansas and the director
[28:25] for the kleap and captain void will accept this award and
[28:34] will you all please come forward.

[29:14] and oversee a program called the kansas law enforcement
[29:21] accreditation program, alfred coffee & glossier a state
[29:22] accreditation program it is designed to honor and
[29:30] recognize the top agencies in the state and we recognize
[29:34] that by having created a council and council is made up of
[29:38] 6 people that chiefs and 3 sheriff's and chair and they
[29:44] decide where the standards are in the agencies will be
[29:50] judged by from tell requirement for law enforcement
[29:54] agencies to best practices for the law enforcement and
[29:57] those are the standards those law enforcement officials
[30:01] say need to be present for every agree that will be an
[30:06] accredited agency for the state of kansas and one hundred
[30:10] and 67 of those standards. For accreditation we have the
[30:16] kleap accreditation and the the other thing is that is
[30:20] really that is tough is okay. We have the standard how do
[30:24] we know those standards are met? Number 1 through policy
[30:30] but how do know those policies are being followed. This is
[30:36] where the tires meet the road and every agree has to prove
[30:45] they're people are following the policies. That are have
[30:49] been established. This is a voluntary program not a
[30:53] required program we call that regulation. Not a
[30:57] regulation. It is not a regulated environment because the
[31:02] chief decided the chief want to step up and say come in
[31:07] and valve any agency and they starred on the progress
[31:15] along with a lot of another agencies in the state happened
[31:19] to finish first in the first ever state accreditation for
[31:24] an agency not nationally accredited but first ever
[31:31] accreditation being award backseat by the kleap council
[31:36] and informed they were able to proof though their
[31:41] satisfaction they meet the standard and award in 10/13,
[31:52] 2025 and present to the police department showing you are
[31:56] an accredited agency with the kleap council.

[35:05] packaging production facility on approximately 60 acres of
[35:06] a 138-acre site located near the northwest corner of 167th
[35:25] street & 169 highways. The city has an intent to issue the
[35:29] bonds in march of 2023, the building is complete.

[39:31] order police and currently a - an olathe resident. The f o
[39:39] p has come before you in the prior and felt listened to,
[39:44] supported by the council, we appreciate that. I know in
[39:48] the past few years brand new station and some really good
[39:55] measure k unfortunately, I'm here to say - and many of the
[40:02] people effected but this plan were retired before they
[40:07] with the got the benefit from the station. I know all of
[40:12] you are - regarding this and I believe that is what all
[40:18] the speakers are plan to speak about give you a little bit
[40:22] of background in 1989, the city decided that employees
[40:27] will pay individual or family rates for the healthcare
[40:32] after retirement. This included arriving including
[40:37] retireed employees to assist as we move into a time when a
[40:45] - in 2005, that switched at the 3 tiers we're discussing
[40:52] 5 and retired before 09. But 4 years to retire or expected
[41:09] a pay difference increase of only getting individual
[41:15] retired rate not family having additional - in that
[41:20] announcement, it specifically said they'll make every
[41:24] effort to protect the vulnerable for the healthcare
[41:29] program and the city managers offers will work with the
[41:33] retirees task force and the employee benefits and the
[41:38] human services department to investigate that helps to
[41:46] plan and provide for healthcare costs. For over 20 years
[41:52] what was in 2005 that includes through the 2008 financial
[41:59] crisis all the way through the furloughs. In mention of
[42:05] possible changes let alone this drastic of a change. In
[42:09] preparation for retirement employees meet with the
[42:12] benefits program manager. Including employees required a
[42:18] couple of months ago were told in the meetings will
[42:21] continue to pay rate. (bell ringing) definitely ran out of

[42:50] the city of olathe retirement 2026 health insurance and
[42:57] the hike in the premise and the hardships we are
[43:02] encouraging paying $82 a month and each and in january of
[43:08] 2026 the monthly amount will go up to $494 each $412 more
[43:18] a month for each of us. The monthly amount of $494 and
[43:27] others is very stressful. We received this information
[43:30] about the 2026, cost increase we're trying to figure out
[43:37] how we can afford it. With retirement you all set incomes
[43:43] and our money does not go up and some have additional jobs
[43:50] and seen such a hike in the health insurance premise we or
[43:58] worried this hit and my wife and I retire from the olathe
[44:03] police department and da have lived in the city over
[44:09] 21 years our daughter graduated and our grandchildren the
[44:14] bells are invested. We love our community and have to pay
[44:19] off over $1,000 a month to be honest this is scary. And
[44:27] we're asking for help to make the premium respectfully
[44:38] damon.

[44:50] >> good evening, counsel and members here. My name
[44:57] is gary I started with olathe fire department in 1982 with
[45:04] two stations. We figured out fires and saved the hospital
[45:09] and lots of fires. This a job I don't want a 63-year-old
[45:15] man like myself riding on a fire truck any member of the
[45:26] fire department we had bad knees and shoulders that is a
[45:32] tough job I was part of 205 got completely changed because
[45:42] - my whole retirement plan changed with little notice.
[45:48] every financial seminar we tenant we got to plan 10 years
[45:55] in advance or 5 years in advance I had to completely
[46:01] change. Now this is happening good morning you're up
[46:06] ending my retirement I may have to look for a full-time
[46:12] job as you can see under k p and f the first year was the
[46:21] best year it gets worse and in the and need goals to keep
[46:28] on pcia things act. Okay. K p and f didn't give my
[46:39] insurance whereby raised $800 a month that the city is
[46:47] paying zero for me. Not a thing paying other members in
[46:53] different plans I'm in the ppo they're paying zero and
[46:59] other member can be in a long-term two late for me.
[47:05] >> I can't do that. And to make matters worse people
[47:12] in washington, d.c. Have everything screwed up I can't
[47:18] provide - nobody knows so I'm held hostage I don't know
[47:26] what I'm going to do and something that didn't sneak up on
[47:35] nobody healthcare is rising should be a long-term plan to
[47:39] deal with that and now need our reactions what we're going
[47:44] to do this year. Needs to be planned. Healthcare will
[47:50] continue to rise and needs to be a long-term plan like any
[47:53] other financial issues

[48:16] >> tyler west one hundred and 58 place I want to say
[48:23] good evening, city council thank you for letting me speak
[48:28] I'm with the firefighters I rise in support of
[48:35] firefighters who healthcare cost has drastically increased
[48:45] firefighters work 24 hours and have ready to run in and
[48:52] help. The oath we take on the first day our police
[49:01] officers feel the same way with a 36 years with the city
[49:06] we're told to retire and retires at the age of 58 we have
[49:14] to find help for medicaid making this designation for the
[49:23] future employees to work and doesn't come down to pay but
[49:29] how we're treated after that wards those retirees didn't
[49:33] have the opportunity for the planning the healthcare costs
[49:38] and once retired they're on a fixed income we have a have
[49:45] members can't adjust they're recent changes and have
[49:49] members not retiring because of those changes and they're
[49:54] eligible have served the city and we're ready to retire
[49:59] but - we understand this is not isolated to olathe but
[50:09] others cities we ask that you remember the years of
[50:13] service those members provided to our citizens. And to
[50:17] doing everything we can to support them in retirement..

[50:29] >> good evening mr. Mayor and councilmembers good to
[50:47] see you.
[50:48] >> retire police chief and started with the olathe
[51:06] police department in 1988. And after 31 years of service,
[51:11] I retired in april of 2013, and seen this complicated
[51:20] issue providing healthcare to current employees and to
[51:23] those who retire from the city services. The retirement
[51:28] healthcare offered by the city of olathe in 1988 were
[51:34] impressive and they have employees to remain on the city's
[51:39] healthcare plan at same rates as current employees that
[51:45] retire at 65 and at that time the incentives to stay with
[51:52] the city and into retirement.
[51:55] >> that was important for public safety were able to
[52:00] reach the retirement angle in the 60s and other actuaries
[52:08] of retirement benefits based on the hiring dates and with
[52:14] each change reducing tells us the year costs creeped up
[52:24] and with the current employees for healthcare has spiked.
[52:28] that brings us to the cost of healthcare insurance for
[52:34] retirees is increasing significantly and
[52:37] disproportionately in 2026.
[52:39] >> from current employees to retired employees so
[52:43] current employees their ability to retire next year will
[52:48] not happen because of this the constitutional costs in
[52:53] healthcare insurance offered to retirees. The restored
[52:57] employees under one plan or tier are now face to face
[53:04] impacts that are greater. Personally if I stay will go up
[53:18] up to $31,000 at $39 in 2026 in one year will there by 9
[53:27] thousand plus for families coverage which is what I have.
[53:33] that is a .32 percent increase and other retirees are
[53:39] upwards of hundreds of increases based on the individual
[53:43] conform and to allow thirty me to wrap up city of olathe
[53:49] past, present, and future employees are most important
[53:53] asset to the city and all contributor to the success and
[53:56] recognize of the city services to our citizens and
[53:59] businesses. We are setting the standard for excellence for
[54:03] public services. The budget process for the 2026 retiree
[54:08] healthcare plans and cost sharing misses the mark. I ask
[54:14] you look at it and take care of people who served our
[54:19] city. Thank you.

[54:31] >> good evening council I'm bryan. I started my
[54:41] career with the don't recall police department 32 years
[54:44] you and served in my capacities what brings us here the
[54:51] employees 2026 plan - that goes against human decency all
[54:59] the retirees we expected an increase we were told that
[55:05] last year 50 or 100 percent and 500800 percent in one
[55:11] year?
[55:13] >> based on katie - have a reasonable price that is
[55:26] a sacrifice for the retirees what is the objective?
[55:32] >> the city has known about the costs going up for
[55:35] years. And it couldn't increase our rates. I take into
[55:44] account they reserves for 2026 and the city is proposing
[55:49] an 8.5 percent increase in the reserves for 2026. That
[55:54] taking it up to 46 thousand plus. That's an increase over
[56:01] $4 million from 2025.
[56:04] >> keeping our promise and doing the right thing
[56:09] would allow the city three hundred 5 out of reserves.
[56:15] >> let's talk about the federal government was
[56:19] already mentioned once.
[56:21] >> our federal government is shut down on one month
[56:26] baseline is affordable c.a.r.e. Act the subsidies are not
[56:33] passed we'll see an increase of 75 up to one hundred and
[56:39] 14 percent. But not 5 hundred and or 800 percent we're
[56:49] shutting down the country shouldn't be a hard decision to
[56:58] do the right thing and rethink the massive increases and
[57:02] the royal out we've received all we want to be treated
[57:06] right and with human decency and want to thank the ones
[57:13] that responded back from an e-mail owe sent this means a
[57:19] lot and olathe has set the standard of conference and all
[57:24] we're doing is asking you to continue that. Thank you for

[57:39] >> I'm dawn and my husband. And for some retirees
[57:50] they district attorney have a luxury of being healthy
[57:55] enough for employment. Eventually you run out of things
[58:04] sacrifice and have a total final collapse it increases the
[58:11] healthcare costs and last but not least causes hardship
[58:17] and financial ruin for people that sacrificed and in part
[58:23] due to a promise that is now being broken. It is hard to
[58:28] phenomena people that sacrificed can be dismissed and take
[58:35] advantage of.
[58:36] >> and though important to know I share the

[59:33] on the task force I took the lead for this personally I
[59:39] would love to tell you about the ideas we had all the
[59:44] ideas were presented and could have solved this issue so
[59:49] we didn't have to be here we had staggering scales and
[59:55] percentages the employees put towards. And I see some of
[59:59] the people are retired in this with me well as well and to
[1:00:07] get this is personal we gave one hundred and 10 percentage
[1:00:13] with the city manager told us no and caused a rifle. I was
[1:00:19] the first ever reciprocate of the integrity award I have

[1:01:01] 35 years of my life and spent time in the military and the
[1:01:09] last with the 25 years with the city of olathe I have
[1:01:15] awards and with the chiefs association and wards from
[1:01:20] individuals and awards and bring those up not to brag
[1:01:27] about myself will you every retiree in the room as a
[1:01:31] police officer and employee industry stories and employees
[1:01:41] like us that help city of olathe into was it guess today.
[1:01:47] >> what brought me the director from the last 80s we
[1:01:54] want our employees to know we continue to be concerned
[1:01:57] about the welfare and happiness and as an employee and the
[1:02:03] retirees will pay the same amount as current employees I -
[1:02:13] I will going from 10 thousand and now 74 thousand just for
[1:02:21] me alone those changes are not consistent what I building
[1:02:25] the city of olathe stood for this is a financial and
[1:02:30] hardship on every employee that is retired or about to
[1:02:36] retire. I've submitted any paperwork and any salary is set
[1:02:42] any - I leave - survivor benefits and didn't reduce I
[1:02:49] can't change that to be irreversible had I known the city
[1:02:56] would have increased my premiums you would have - but
[1:03:02] because we had no time to plan I was not able to do this
[1:03:07] in the u.s. The police officer I want to spend the time
[1:03:12] left with my family not working longer than than expected
[1:03:18] to afford medical coverage I have asked the city to honor
[1:03:24] they're - by continuing to offer medical benefits we
[1:03:33] depend on. Thank you for listening

[1:04:46] city attorney before this ordinance is intended to address
[1:04:50] a couple of issues I've been working through and related
[1:04:54] to the public utilities the city manager and as well as
[1:04:59] request the rest of engineering the first two section
[1:05:04] protect codifying the practice related to utility
[1:05:10] easements and codify the right-of-way for easements for
[1:05:15] the per city code we have the right-of-way ordinance in
[1:05:20] the section but some overwhelms some public utilities
[1:05:23] easements and utility easements dedicated to the city not
[1:05:31] with the right-of-way we want to codify our approach so
[1:05:35] this is clear with for the right-of-way and the post
[1:05:51] action to address ongoing issues related to the city
[1:05:56] ordinance and now let aab expand on o but essentially we
[1:06:02] think to have issues with the utilities trying to look at
[1:06:06] their utilities that can result in delays from the start
[1:06:13] project and is increase costs to the city. And we have to
[1:06:16] do a redesign other complications. So we think that adding
[1:06:22] this to the code will again help to establish clear
[1:06:28] expectations you may be aware the state law that is really
[1:06:34] only intended to address locates in the shovel ready so
[1:06:41] contact them involved and calls in 811 and come out and
[1:06:47] market but, you know, if you're shovel ready and all of a
[1:06:51] sudden figure out there is a bunch of conflicts we have to
[1:06:57] contract so mobilize and maybe paying when you can't work.
[1:07:02] so we talked about that corporation the oversight and the
[1:07:09] staff did tell us addressed this gap in terms of location
[1:07:15] of planning purposes and the ordinance we're trying to do
[1:07:21] that and the expects have similar to others cities and the
[1:07:26] park has about location for planning purposes and is the
[1:07:32] responsibility to provide locates so this will fill 3 gap
[1:07:39] we have and there is also a provision we had a utility
[1:07:45] initially indicate that there is are facilities
[1:07:48] unlocateable and turns out what they meant they have to do
[1:07:54] more expensive locating them and which they didn't want to
[1:08:00] do. But that raised our - what if we have a situation
[1:08:07] there is a facility that the utilities can't locate this
[1:08:11] could present a risk to the public safety that allows the
[1:08:22] city to address the risks. So bob.
[1:08:26] >> some languages about penalties explain was that
[1:08:35] looks like I'm curious about the process.

[1:08:38] >> so it refers to the existing penalties for the
[1:08:43] right-of-way I don't have those in front of me but and
[1:08:48] then there is also some effective provisions in there.
[1:08:52] really intended to address the damages that the city could
[1:08:57] incur for the delays. So the cost to make the project
[1:09:03] design change.

[1:09:11] penalties are we build it and the city has to pay that.

[1:09:17] >> we have franchisee agreements with some of the
[1:09:22] utilities. The video service providers operate from or
[1:09:29] under a - we have some to insure that takes some of the
[1:09:40] enforcement.
[1:09:41] >> I want to emphasize those are the things we should
[1:09:48] protect but we'll have not actually encountered.

[1:10:12] forever and it was related to the utilities and easements

[1:10:32] been a big issue about 10-year ago we developed a position
[1:10:37] just to manage the utilities on our projects because it
[1:10:42] was such an issue. But on average we have 25 percent of
[1:10:47] utilities respond to 3 request to locate for the planning
[1:10:52] purpose.
[1:10:53] >> we we need to do is partnership between us and
[1:10:57] them we're not facing that looking at change orders to
[1:11:09] help us to move along. Right now us begging and trying to
[1:11:15] puncture delays design for example, right now have a
[1:11:19] project on harold street within resistance road and 6
[1:11:28] facilities 23 you're getting 25 percent you know urging to
[1:11:34] run both construction issues and that helps us to talking
[1:11:39] about with the utilities and encourage them to better
[1:11:44] participate.
[1:11:45] >> I was confused I'm going I don't want to sign
[1:11:50] this. You know. I don't want to provide the utility kind
[1:11:56] of.

[1:12:01] deterrent.

[1:13:21] to pass that 30 days subject to two hundred to $500
[1:13:29] penalty we hope didn't come to that.

[1:14:52] on this right now maybe sample ordinances from others.

[1:15:32] considered. And then we do continue to welcome any
[1:15:37] questions or comments that you have so we can make sure
[1:15:40] that we're adrc them as soon as possible as we see there
[1:15:44] are revisions and once we get it set we'll have that - we
[1:15:53] thought instead of the education before we are sure what
[1:15:58] we want the ordinance to be we want to marry we have that

[1:17:39] adopted or considered some of those to summarize these.
