Um, so, um, I have a number of upcoming
events. We are winding up summer and,
[1:03]
uh, fall is always super busy for us.
So, we encourage everybody to come out
[1:08]
to Paris Baguette, um, August 31st,
which is next Monday between 8 and 10:00
[1:15]
a.m. in the morning to meet with one of
our, uh, police officers. So, coffee
[1:20]
with a cop uh, will be during that time.
There will be coffee and some limited
[1:25]
free pastries. So, if you have not had a
chance to uh try a pastry at Paris
[1:31]
Baguette, this would be a great
opportunity to do that, as well as uh
[1:35]
come talk to one of Olivet's finests.
[1:40]
Uh and September 15th is Night Out. So,
this is an opportunity for you and your
[1:46]
neighbors to gather to have a block
party and then if you sign up uh some
[1:52]
oliveette city officials, including the
uh police officers, the fire department,
[1:58]
you might get the fire truck or the
ambulance uh to come and to stop by and
[2:02]
to say hello um meet and greet with uh
our oliveette community. So, um we would
[2:08]
encourage all of the neighbors to go
ahead and sign up. If you have
[2:12]
questions, uh, please reach out to
Lieutenant Selzer in the police
[2:16]
department.
[2:20]
And every year we do the Battle of the
Badges, which is a competition between
[2:26]
the fire department and the police
department. Uh, it is essentially a
[2:30]
blood drive for the American Red Cross.
And both our fire department and our
[2:36]
police department have compelling
stories, personal stories about
[2:41]
grandchildren uh and their need for
blood, hence the blood drive. And so
[2:46]
individuals who come and donate blood
are given an opportunity to cast a vote
[2:52]
for either the police department or the
fire department. Um and at the you know
[2:57]
at the end of the drive the winning
department receives some gift from the
[3:04]
losing department. Um the fire
department has more years that they have
[3:09]
won uh than the police department. So
come out donate for a good cause to the
[3:14]
American cross and then choose which
public safety group is your favorite.
[3:22]
Trivia night is being hosted at Five
Oaks on September 18th. There are nine
[3:28]
tables left, so bring your friends uh
for a table of eight. The theme this
[3:33]
year is 90s and 2000s sitcoms, so there
should be something for everyone. Um
[3:40]
register for your table and we hope to
see you there. I think there's at least
[3:44]
one staff table. Um and I think a couple
other folks have gotten um tables for
[3:50]
the trivia night.

The great Olivet cleanout is happening
again. It is at Five Oaks on Warson.
[3:58]
This is a change from um Stacy Park. So
in years past it's been at Stacy Park.

This year it is at Five Oaks on Warson.
It's on the lower parking lot. So this
[4:08]
is an opportunity for residents to
either have documents shredded if you
[4:14]
have some of those in your office or
your home office. This is not for um a
[4:19]
business cleanout, but if you do have a
home office and you have documents that
[4:23]
you would like shredded or if you have
any um e-waste, so almost anything with
[4:28]
a cord, uh they will take and uh recycle
those for you.

drive-thru. And so there is a very
specific route for you to uh to come
[4:40]
through. They will take the items um out
of your vehicle. It's very easy. you
[4:45]
should be um in and out in not much time
at all. So, and we did receive the
[4:49]
grant. So, we've signed off on that and
we did receive the grant for this.

out. These are all of the recreational

programs that the city is offering
through the fall and the winter. We have

some hard copies out in the lobby if you
would like. Uh it's also on the city's

website and should be hitting should

would encourage you to check those out.
We have activities for all ages.

And then just some general city updates.

Um, our new finance director, Julia
Gwyn, starts tomorrow. So, we probably
[5:38]
uh in September, we will bringing be
bringing her to council to to introduce
[5:41]
her. Uh we are recruiting for another
police officer. Uh two weeks ago I told
[5:48]
you that we had made conditional officer
offers to two individuals. Uh one of
[5:54]
them accepted. They are in the
pre-employment screening phase. Um the
[5:58]
other candidate decided that uh he was
going to remain at his uh his place of
[6:02]
employment. Um and then the follow-up
from the Hicks Carter Hicks the
[6:07]
employment engagement committee is
meeting this week. They're going to
[6:10]
start working on um employee recognition
and then um I have asked Hicks Carter
[6:17]
Hicks to craft a proposal to help the
city with an internal communications
[6:22]
plan. uh one of the uh comments and
areas of deficiency on the survey was
[6:29]
communication and that's a pretty broad
um topic and so I do think working with
[6:34]
them to create and improve some of our
internal communications is a good start
[6:39]
to making headway on that uh survey
result. Are they going to talk to
[6:44]
employees to understand kind of like
what I I know they have the survey
[6:48]
results, but to understand like where
they saw gaps in communication. Will
[6:51]
they have those conversations before
they craft?

» They're going to craft me a proposal to
do it. So like we'll get a scope of
[6:56]
work.

staff reports, please, then.
>> All right. Uh, starting with fire
[7:23]
department. So, we often talk about the
fire department and their um
[7:27]
firefighting training and their um calls
for fire. But I thought this month we
[7:33]
might just kind of highlight the fact
that they do run an ambulance and that
[7:39]
takes a a good amount of their time.
They actually run quite a few medical
[7:43]
calls. So just
uh looking at this chart, this is on
[7:48]
average about five calls a day that
they're running. Um, as you can see,
[7:53]
they spend a lot of time in the city of
Alvette, but we are also contracted for
[7:58]
um, fire service, fire and EMS service
for the pocket of uninccorporated that's
[8:04]
just north of us on Dealman. So, we
respond there. St. Louis County
[8:09]
contracts with us, pays us to provide
that service to them. And then we do get
[8:13]
called out of town um often to um Creve
Corps or U City um or certain things on
[8:21]
the highway we might get called out for
for both police and or for EMS and fire
[8:28]
parks and wreck. Uh we just finished
earlier this month uh municipals. So,
[8:34]
municipals is this uh part of this photo
right here is h offered every other year
[8:41]
and it is a camp that highlights the
city departments. So, the police
[8:47]
department had a day and brought out the
mounted patrol from St. Charles County,
[8:54]
brought out some therapy dogs, brought
out some um other fun police things. The
[9:02]
fire department had a day had an half a
day and they got to go down the slide
[9:06]
and the fire department because we have
a slide and not a pole and they got to
[9:11]
do some other fun uh firefighter things.
This particular picture we had an
[9:16]
opportunity to partner with Emerson who
is a business here in the city of
[9:20]
Alvette and they came and did uh science
things with uh with the kids. So they
[9:26]
did the egg drop project um learning
about gravity and um force distribution
[9:32]
and things like that. And so the kids
had a good time. And then the other
[9:35]
thing with uh the parks department, this
happens to be the segment uh one of the
[9:40]
new segments of the Centennial Greenway.
So now that that greenway has been in
[9:45]
for more than one year, maintenance
falls to the city. And so this is our um
[9:50]
horiculturalist
and our park staff who are clearing um
[9:55]
clearing the fence lines uh along along
that particular section of the trail
[10:03]
planning department. So these are fiscal
year to date. So from June of 25 through
[10:09]
July uh no I'm sorry July of 25 through
June of this year. So, as you can see,
[10:15]
um they were pretty consistent. Uh lots
of people got their roof replaced um in
[10:22]
this particular fiscal year, most likely
from uh the storm that came through in
[10:27]
um in this in May of last year. Um and
we see a lot of um tenant finishes. So,
[10:34]
this could be like reinvestment by
businesses or new businesses coming in
[10:39]
or updates to businesses. Uh so this is
a good sign and what has um been keeping
[10:45]
one aspect of what has been keeping um
Carlos and his staff very busy over the
[10:51]
course of the year.

The police department uh officer Bagsby,
this is Officer Bagsby here. He went to
[11:00]
Aphina Healthc Care's event um talking
about gun safety in particular uh
[11:06]
gunlocks. The Alvette Police Department
donated 50 gunlocks for this particular
[11:11]
event. So, this is just a reminder that
our police department has gunlocks
[11:17]
available to anyone in the community who
is interested. There's no cost. Uh, and
[11:22]
they are available Monday through
Friday, normal business hours. Just go
[11:26]
see the records clerk um here at city
center uh if that's something that you
[11:30]
are interested.
[11:34]
And then public works. Um, if you have
driven at Price, North Price and Olive,
[11:41]
you have seen a lot of work there. Uh,
this happens to be the contractor. They
[11:46]
did some paving overnight. They did a
really um a really nice job on that
[11:52]
work. The work here at the 9201 Olive
site where um the CBDraton building was,
[12:02]
there has been a delay. It is not a
delay related to the city.
[12:07]
It is a delay because a a pipe wasn't
where wasn't as deep as we thought it
[12:12]
was.
That required some changes to storm
[12:16]
water drains that MDOT took a long time
trying to figure out what they wanted.
[12:20]
Um but work is moving forward. In fact,
Spire was on site today moving the gas
[12:25]
line that needed to be moved in order to
accommodate um the storm drain. So,
[12:29]
we're a little bit behind on where we
thought we would be to close out this
[12:33]
project. Um, but it is related to
situations beyond our control. And then
[12:39]
we do have some good news. So, as you
might recall, we um put in for a grant
[12:45]
for
um reconstruction of North Price between
[12:50]
Delmare and Old Bonum um an STPS grant.
And while we have not received the grant
[12:56]
yet, we are on the recommended list. So,
um, East Swiss Gateway meets later this
[13:04]
week to review that recommended list and
hopefully approve that list and
[13:08]
hopefully we will be approved so that we
can um move forward
[13:15]
with reconstruction of that section of
North Price. It is a multi-year project.
[13:20]
So there will be design time and
right-of-way acquisition time and then
[13:24]
construction time. So it's looking
probably a 3 to four year long u process
[13:31]
and that is all I have unless you have
any additional questions for me.

financial reports, please.

All right, I am filling in for our
interim finance director who um she had
[14:10]
a previously scheduled event this
evening. So um you are seeing the report
[14:17]
for the second month of the year. Um
[14:22]
as you can see we are we are on track.
Um general revenue started the year
[14:28]
above expectations by about $37,000.
General fund expenditures are also above
[14:35]
expectations. Um this is normal. We have
a variety of um like all of our
[14:41]
insuranceances are due. So workers comp,
liability, property, all of that is due
[14:47]
um at the very beginning of the year. So
um that's not unexpected.
[14:53]
Um it does result in an unfavorable
variance. But again, we are um this is
[14:58]
the July financial report. So at this
point, we were one month into uh into
[15:03]
the into the into the year.
Um it is not unusual for property taxes
[15:09]
to be slow. Again, we get those in um
December and January.
[15:15]
And um parks and wreck revenues started
the year mixed um and they do um they
[15:22]
exceeded budget projections due to high
soccer enrollments. So soccer is very
[15:26]
very popular. And then the chart of our
month, this is our monthly uh 1% sales
[15:33]
tax, which we took out a bunch of the
noise. If you might remember past
[15:37]
graphs, there were a lot of lines there.
So this is just the last two years. So
[15:43]
fiscal 25, fiscal 26 and then where we
are um for 27. So we are of course
[15:50]
higher than 25 and a little bit below um
of 26.
[15:55]
So if you have any questions, I'm happy
to answer those for you.

» We anticipate a drop off or I don't
remember what the drop off. Yeah,

will say sales tax tends to be cyclical.

So, anything that we uh receive in
September is actually from people buying

things in July because it's always a
two-month lag.

we could it could also be um July is a

is half the year and a quarter of the
year. And so there are certain entities
[16:32]
that only report sales tax half of the
year, half of the way through the year
[16:36]
and a quarter of the way through the
year. So that um drop off could have
[16:40]
been somebody missed the cut off. Um so
there are a variety of of factors that
[16:47]
could um account for that.

just miss the cut off because then you
get to you know you get it the next

reports for each council member to give

an update of kind of activities they've
been up to. Uh council member Clark,

» Uh we had a parks meeting. Um most of
the meeting was the installation of two
[17:27]
new commissioners. So uh was kind of
orient or orienting them to the process.
[17:34]
And it was great going through it again
because u uh they went over all of you
[17:38]
know of city government and uh I know I
was given the training beforehand but
[17:44]
when you hear it the second time it
sinks in a little bit more. So that's
[17:48]
always good. Um, one other thing that's
coming up with uh the parks is going to
[17:52]
be the review of the Indian Meadows uh
pavilions. So, that that's on their
[17:57]
agenda and uh should be moving along.

I attended the PCDC meeting on August
[18:22]
20th and at that meeting an outdoor uh
metal canopy was approved for the brass
[18:30]
tap to help extend the seasons for them
um and extend some seating outside
[18:36]
during the wintertime months. So, that
was approved. Um, and that the roof of
[18:41]
that structure will stay throughout the
year, but then there's a wall kind of
[18:46]
enclosure that's temporary for the uh
months of November through Feb fe
[18:52]
November through February.
Um, we also discussed continued
[18:57]
discussing a text amendment for coin
operated laundromats.
[19:03]
Um and a new single family home was
approved for 1123 Hilltop
[19:10]
and uh also had discussion on a text
amendment to allow for other warehousing
[19:15]
and storage that would be specifically
for car condominiums.
[19:21]
So, these are uh spaces that would be um
condominiums that would be sold to
[19:29]
individuals uh who would likely store
their luxury cars, potentially
[19:35]
um RVs and boats. Um but they would be
individual condominiums. So, kind of a
[19:43]
new thing um coming before the
commission and and so it's um at the
[19:49]
discussion stage at this point. Um and

commerce uh for the state of the city
and it's an opportunity where I get to
[20:03]
go and give a state of the city of how
we're doing from an economic and
[20:07]
residential and development and just how
we're overall you know what is all of
[20:11]
that and get to brag on all of that
which was very exciting and a big thank
[20:15]
you to staff Kiana and uh others for
helping you know draft things put
[20:20]
together a great slideshow and it was
you know really wellreceived and get and
[20:23]
get to meet some people there so that
was really nice and then today I
[20:26]
attended the Olivet housing authority uh
where they had a few procedural items
[20:30]
reviewing the financial audit reports
approving other things talking about
[20:33]
next steps on everything around some of
the policies we're moving forward on the
[20:37]
housing. So that that is progressing as
well. Um and then um yeah those were
[20:44]
things that I got to attend. So uh we'll
move on to item seven items from council
[20:49]
members. So, a chance for us just if
we've been hearing things that you want
[20:53]
to bring up for a future topic, we won't
go deep into them now. And uh just a
[20:57]
open forum.

Indian Meadows Pavilion and as uh
council member Joel mentioned that's
[21:21]
going to come before parks and wreck
where they're going to we asked to go
[21:24]
back to their ask for their assessment
and then it'll come back to the council
[21:27]
at that point um and we'd given the
direction to look at what it would take
[21:31]
to remove and what their thoughts were
and then uh we'll get their feedback on
[21:35]
that. uh previous meeting we'd obviously
discussed block cameras with the uh
[21:39]
chief of police and so that will be on a
future agenda so just calling that out
[21:43]
as well as the NIT policy will be on a
future uh agenda in the future as well
[21:48]
uh and then obvious
[21:52]
uh I imagine people here to speak as
well and so appreciated that we had
[21:56]
committed ID committed back that we're
going to meet with our legal team to
[21:59]
understand what options all of it has
because it is a unique situation and
[22:02]
then uh happy to meet with the concerned
citizens themselves and any council are
[22:06]
welcome to join me to want to hear
everyone's you know concerns in person
[22:09]
and understand everything and then after
that we'll take whatever the appropriate
[22:14]
actions that we can and don't know what
those are right now can't promise
[22:17]
anything but you know want to hear from
everyone and then we'll we'll see what
[22:20]
comes of that so all right uh we're
going to move on to hearing from
[22:25]
citizens so this is a portion of the
agenda where anyone present in person or
[22:28]
virtually may address the city council
regarding any topic including those
[22:32]
later in the agenda each speaker is
allowed up three minutes to address the
[22:35]
mayor and city council. Hearing from
citizens is designed for councils to
[22:39]
receive feedback rather than for a
direct dialogue. We will take speakers

in person first followed by any online.

uh AZZ and a Missouri uh state statute.
Uh, this is concerning AZ galvanizing.

excerpts from the Missouri state chapter
[23:50]
220 nuisance. nuisances. A nuisance is
any act done or committed or suffered to
[23:56]
be done, committed by any person or any
substance or thing kept, maintained,
[24:01]
placed or found in any public or private
property that is injurous to the public
[24:05]
health, safety or welfare. are to permit
premises to become unsightly,
[24:09]
unsanitary, or obnoxious or obl to the
vicini to the vicinity or offensive to
[24:16]
the senses of users of the public way
abudding the premises that depreciates
[24:21]
the enjoyment and the use of the
property in the immediate vicinity to
[24:26]
such an extent that it is harmful to the
community in which the property is
[24:30]
situated or such a condition exists. AZZ
Galvanizing fits every one of these
[24:35]
definitions of a nuisance. It's zoned
light industrial, but it's expanded
[24:39]
several times over the years. It's not
light industrial anymore. We are asking
[24:44]
Alvette to protect its citizens from
this nuisance and use statute title 7
[24:50]
cities, towns, and villages chapter 71.7

nuisances expensive suppression how paid
the noise and toxic emissions are
[25:03]
unbearable and hazardous to our
neighbors health and quality of life and
[25:09]
ours. Uh, we are sleeping in our bedroom
that faces away from ACZ because we
[25:14]
can't sleep in our master bedroom
anymore from the noise. We can't enjoy
[25:18]
our beautiful yard. We've lived in
Olivet for 32 years. It's home. Um,
[25:23]

Um, they're getting worse and worse.
And we're up on Brford High where the
[25:33]
noise really hits us, but our neighbors
in Indian Meadows are just getting
[25:37]
creamed. They're getting gassed. It's

Hi, my name is Jenny Littleton. I live
at 9639 Haron Drive. I just want to ask

my city council if they would please
support and help all of the residents
[26:10]
deal with this do's a galvanizing.
It's to the point where my son who's
[26:16]
seven, he's beginning to have temper
tantrums because he has a trampoline, a
[26:22]
basketball hoop, a soccer net that now
he can't play because when he begins to
[26:28]
play, I have to make him come in. And so
now he's getting upset, stumping yelling
[26:35]
in the house. What's the purpose of me
having this if I can't play? When are
[26:39]
they going to move that company? He's
seven years old. This is the point where
[26:45]
he doesn't have temper tantrums. Now
he's having them because he's not
[26:49]
getting to play outside. And this was
for the summer. So, I had to make fun
[26:55]
activities in my basement. So, I mean,
now the children, it's to the point
[27:00]
where I'm asking the kids and my
subdivision, you you guys got to go home
[27:04]
now. You can't play here. Can we come
back when the smoke is gone? Yes, you
[27:07]
can come back. So, now the kids, it's
just getting to be too much. And then
[27:12]
also, I'm I know you brought up about
you're going to bring it up with the
[27:15]
parks and you guys are going to redisuss
about the pavilion. Please move that
[27:20]
pavilion. There's so much going on that
my son is seven. He said, "There's
[27:24]
always something going on over here at
this pavilion. Problems every day. He's
[27:31]
seven. There was a time he didn't know
anything about that. Now he's seven."
[27:35]
And he's saying these things. And one of
the neighbors, she couldn't be here
[27:38]
today. She did ask me, "Until you guys
decide about how you're going to move
[27:43]
it, would you please at least move the
tables underneath the pavilion while you
[27:47]
guys are trying to figure out how you're
going to move that pavilion?" So until
[27:52]
you have a due date when you're going to
move it, could you please at least move
[27:55]
the tables? Cuz a lot of that buffoonery
that happens in the morning, afternoon,
[28:00]
and night, they won't have anywhere to
sit and lay and do all of that extra
[28:05]
activity that's unwanted and that we
don't need. So I just wanted to ask you
[28:10]
guys, would you please bless our
community to help all the residents
[28:13]
dealing with a galvanizing and the
nuisance unwanted pavilion, please?

first. I'm in agreement with Nancy and
Bob. It is horrible and re lately it's

just roars so loud. 3:00 am, four
o'clock. It wakes you up and then you
[28:49]
can't go back to sleep. They'll turn it
off or turn it down maybe about 7:30, I
[28:54]
guess, when they figure people or
whatever's going on. But it's just been
[28:57]
ridiculous. Just ridiculous. And we
haven't really said a lot because, you
[29:02]
know, that there were attorneys working
on it. So, you know, we want to continue
[29:05]
that. But we need the help of the city.
So, I hope that that uh state statute
[29:09]
will help. I got a couple other things
real quick. Um, one is our park and I
[29:16]
know when they redid the the uh the
trail, but they didn't do anything to
[29:21]
the park. Is that on Olivet? It's kind
of bumpy. You know, it's the asphalt,
[29:25]
the black that's in the actual park in
Indian Meadows. So, it's kind of crumbly
[29:30]
in some areas. So, the other concern is
we have two spaces in uh the new park
[29:37]
area that when it we get heavy rain,
it's full of water. So the kids go out
[29:41]
there and play. Then they muddy muddy up
everything which is by the water park.
[29:46]
And then the other area is by the
playground area around one of the trees
[29:50]
is set real low so if we can get that
build back up so that the water won't
[29:54]
set there. Um the other one is the
trees. We have a lot of dead trees. I
[29:59]
know they've cut some down but when we
get any kind of a rain or wind, I should
[30:03]
say wind, there's branches all over the
park. And I realize it's more than one
[30:08]
park. So sometimes it take them a while.
But then the kids are playing and you
[30:11]
got these big branches that are laying
all over the park trail. Uh, one more
[30:15]
thing. How chickens.
We got the chicken coupoops gone from
[30:21]
the side of the house, but there is a
pin. So, I've asked over and over about
[30:25]
an ordinance to be written so that I
don't care about the chickens, but they
[30:28]
need to be fenced in in the back of the
house and not in the very front.
[30:34]
This these chicken coops were on the
front on the side of the home. and I've
[30:37]
complained for a couple of years. And so
it's my understanding that all of that
[30:42]
has been washed aside. I don't know if
anybody knows if that is true, but I'm
[30:46]
going to I'm going to research it that
that's over. The governor was is the one
[30:50]
that uh approved that, but it's my
understanding that they've been fighting
[30:55]
it. So, I don't know. But if not, can we
get an ordinance where they are are
[31:00]
fenced in in the back? And then I think
that's it. Um Oh. We have another area
[31:08]
in our subdivision and I've complained
about it several times. We need some
[31:11]
help uh with uh enforcement of uh
property upkeep. So, we got a lot of
[31:18]
issues with that, but I understand we
only have one part-time person
[31:23]
and for this city, we could probably use
one or two to just do property upkeep
[31:29]
for the for uh all of the the entire uh

huge papa trees that have grown out into
the street. I've asked you can't even

see the street sign. The the trees were
trimmed back right at the sign, but of

something be done about those trees

because it's really a hindrance. If you
are coming up to the stop sign and
[32:01]
somebody's coming from the other
direction, these trees are huge and they
[32:04]
are actually in the street.
You familiar with that? you know, been

So, we have several areas where the
trees are actually growing into the

street, ground up, not just hanging
over. So, they actually block traffic.

residents um near Indian Meadows and
their complaints about AZZ as an Olivet
[32:49]
resident, but also I'm representing the
Sierra Club and Dark Sky, Missouri who
[32:54]
have who the they have also gotten
involved in these issues. There are
[32:59]
really three issues. Light trespass,
potential air pollution, and noise. The
[33:06]
light trespass that is occurring should
be easy to take care of because St.
[33:10]
Louis County already has an ordinance
against it. So, it'd be really good if
[33:16]
someone from Alvette notified the county
that light trespass from AZ shining into
[33:24]
residents houses, shining off the
property into residents houses and ask
[33:30]
az to shield their lights.
No, air pollution and noise are more
[33:35]
difficult. However, Olivet can do
something about it. The residents have
[33:40]
been complaining about AZ for at least
two years. But they didn't give up. They
[33:45]
found a regulation that cities can
enforce ordinances up to a half mile
[33:51]
outside their boundaries. Alvette needs
to step up and support its citizens. The
[33:57]
county does not have the necessary
equipment to determine if ACC is
[34:02]
emitting pollutants
and to
[34:06]
and and to identify the pollutants.
However, the outside groups that that
[34:13]
they're working with um they're trying
to um install air monitors and analyze
[34:20]
air samples and noise monitors. So, I
encourage you to work with them to get
[34:26]
data to back up their claims.
Um, noise is a harder problem, but put
[34:33]
yourself in these resident shoes. How
would you like to hear a loud bang
[34:38]
several times in the middle of the
night?
[34:41]
I'm asking you to find a way to stop the
loud noise at night and determine if az
[34:46]
is polluting the air and if they are to
try to stop them. These problems should
[34:51]
not be ignored and all of it can and
should do something about them.

of your life in Eloette.

I used to call Alvette when I moved here
sleepy hollow.

Very quiet, very surreal.
[36:26]
That has been stolen.
And
[36:31]
days and days and days have passed by
and all of you all are sleeping
[36:38]
comfortably while we're up in the I walk
the trail three times a day. You hear
[36:44]
it? It's supposed to be surreal on the
um path. It's supposed to be something
[36:50]
great that you all have done for the
community.
[36:58]
I don't think so.
Cuz you're walking, you're smelling that
[37:03]
stuff big
just so much smoke it covers the whole
[37:10]
park. The stench comes in your windows.
[37:15]
You smell it at night.
Not including the noise, but the smoke,
[37:21]
the stench.
[37:25]
So
imagine, close your eyes and imagine
[37:29]
that's how your days are going. Every
day you got to deal with this every day.
[37:37]
Your kids are inhaling this
poison.
[37:43]
We're at 70. They're cutting years off
our lives smelling it. I'm sure cuz it's

chemicals that we're absorbing into our
bodies. the kids are absorbing over at
[37:55]
the park that is so nice to have in the
neighborhood, but it's being blown
[38:00]
straight to hell.
Their lives are being cut short.

when y'all sleep at night, just think
your glory oliveette

is causing suffering
for a lot of of your community and we're

just asking you to really take this to

that site I would assume uh that there
will be some type of reported incident

on Olive or so. But if somebody just
can't find a parking space on a specific

date uh you know they can bring that
information we can try to log it and
[41:26]
record it. But you know it would have to
be something that that's known uh in
[41:32]
there and then the the process that we
had today of the people speaking before
[41:35]
the council noting concerns or issues
gets it on the record. I imagine that
[41:39]
makes

[41:41]
notified we that could be brought
forward to us but I think about
[41:44]
hypothetically a certain parking lot you
know south of us at the end of 170 I
[41:48]
hear people complain about you know all
the time it's like you if we hear about

hopefully it's not an issue and

report back to the council the council

has you know if there's a consensus that
it is an issue I would assume the

council holds the authority to revoke
the permit or push

that they have with the property owner

[42:53]
parcels identified by county but it's
one large site.

» And then this is uh fairly random and I

been any consideration with the little

driveway, not driveway, but
uh right ofway area in the front of that

building where you have a curb cut on
one side, a curve cut on the other side.
[43:20]
Has there been any consideration to
closing that driveway? This obviously is
[43:27]
bigger than this particular special use
permit, but through
[43:32]
» it's it's one of those it's a long-term
discussion. We put together the council
[43:36]
had authorized the uh us to do the
olivet uh boulevard uh conceptual master
[43:43]
plan and it identified uh you know areas
and that that's one of the sides.
[43:47]
Unfortunately with the curvature of the
road is one problem. The intersections
[43:52]
of the opposite streets on the north
side is another problem. and then none
[43:56]
of the aprons align. Um, easy solution
is to place a median. That resolve all
[44:01]
the problems, but I'm sure you'll hear a
lot about that uh in there. Uh, but over
[44:06]
time working with those property owners,
we made them familiar with with the
[44:10]
concept. Uh, ultimately, you know, and
we've had discussions about, you know,
[44:15]
kind of nudging them to think think
ahead of reassessing the whole parking
[44:20]
layout on the the shopping center. It's
a it's tough. It's something I got, you
[44:24]
know, we're, you know, 1963 that was a
determination of how that layout was was
[44:29]
put in place and whether they looked at
the the external factors and what was
[44:33]
across the street. I can't tell you
that. But, uh, it it, you know, I guess
[44:40]
we've made them aware. They know that
there are issues. They're looking at
[44:43]
some formal way that maybe
uh over time that we can kind of like
[44:48]
reshift or consolidate that but it get
becomes expensive and that becomes the
[44:53]
key question. Is it all on their dime or
is it something that we collaborate with
[44:57]
them and partner with uh in that
process? If you go back to the catalyst
[45:01]
tragedy uh another uh you know uh report
that the council funded uh and there why
[45:06]
it didn't go the full extent uh to old
bonum road you know it talked about
[45:11]
creating some type of uh traffic uh uh
uh improvement district or or
[45:17]
transportation improvement district to
look at means of getting that you know
[45:22]
re well it needs to be reassessed in
terms of where are the best points of
[45:27]
entry uh in there and and internal
circulations are going to be also need
[45:32]
to be looked at and of course the
streetscape enhancements. So I hope that
[45:36]
kind of addresses it. I mean it is as
long as I my response to you
[45:40]

>> but I think it can be done within within
[45:46]
you know you know the the plan's
horizon.

9375 Dilman Industrial Drive. The next
[52:17]
slide will kind of show the location.
It's at the corner of Dilman Industrial
[52:21]
Drive and Dilman Industrial Court, which
is on the lower left hand corner of of
[52:25]
the parcel. It's a corner parcel uh in
there. It's about 3 and 12 acres. The
[52:30]
building itself which you see the Lshape
and the white roof there is roughly
[52:34]
31,596
ft. It's a multi-tenant office
[52:38]
warehouse. You might be familiar with
the uh the the artery is located in
[52:43]
there along with uh the USGS uh is
located in that facility. Uh the
[52:48]
proposed uses of medical office and
clinics and since this is light
[52:51]
industrial uh medical offices and
clinics are identified in the permitted
[52:55]
uses but only as a special permit and
that is why SSM health cardinal linen is
[53:00]
here before you. It's zone L light
industrial district and it is authorized
[53:05]
uh as a uh special permit use in the LI
district. Uh the next slide
[53:11]
uh kind of talks about the special
permit procedure where we try to uh
[53:16]
facilitate and then further our vision
and goals with the comprehensive plan
[53:19]
which we hope is reflective of our
ordinances in the CO district but allows
[53:23]
us to look at the potential impact the
the district itself the comp plan sites
[53:28]
uh sustainability the surrounding
impacts and then the council rights to
[53:33]
buffer uh required from additional
improvements and imposed some open space
[53:38]
requirements. ments and to uh consider
uh some limitations like in hours and
[53:43]
and things of that nature. It goes to
our planning and community design
[53:46]
commission for review and a
recommendation and then a council holds
[53:50]
the public hearing and then considers
actions via an ordinance. On the next
[53:55]
slide, just a couple of things regarding
special permit uses. There are some
[53:58]
general conditions that are outlined
with our ordinance. Those are that is it
[54:02]
listed in the district? Does it further
the comprehensive plan? Uh is it the
[54:06]
location the parcel suitable for the
environment surroundings? Is it
[54:09]
complementaryary to the surroundings in
the neighborhood and the improvements?
[54:13]
Uh did they demonstrate mitigation to
any potential spillover effects? And
[54:17]
then of course it gives the city the
authority to grant buffering designate
[54:20]
areas for uh open space limit set
limitations on operations implementation
[54:25]
schedules meaning like over time they
need to do this and consider adequacy of
[54:30]
public services. The next slide we'll
get into the nuts and bolts. This is a
[54:34]
street view of the building facility.
They'll be taking that front corner that
[54:37]
you see there. It's approximately I I
believe it's a little over 4,500 square
[54:42]
f feet. We'll get to that specifically
uh in a second. Uh Dilman Industrial
[54:47]
Drive is on the right hand side. Dilman
Industrial Court is on the left hand
[54:51]
side. Dilman Industrial Court is just a
short street uh that leads directly to a
[54:55]
building that's in the background there.
The next slide,
[54:59]
this is the the uh just the tenant
improvement plans that they're proposing
[55:03]
uh that kind of exist in the existing
site ground. It is a 4500 ft² building I

believe. Um they are when you look at it
in comparison to the overall building
[55:13]
which is about 3200 feet, 3200 32,000
ft². Uh they're a little bit of around
[55:19]
an eighth of the whole building uh in
there. And you can see the corner area
[55:22]
that they'll be taking up their space.
It's kind of proportion to the the size
[55:26]
on on the uh on the plan. The next slide
will identify what are they doing. It's
[55:34]
a 4,566
square foot outpatient physical therapy
[55:37]
clinic, pediatric therapy clinic. Uh the
clinic provides multiddisciplinary
[55:42]
therapy for physical therapy,
occupational therapy, and speech therapy
[55:46]
at their site. Uh they currently operate
in Creve Corore and they're relocating
[55:50]
to etc which is great. Uh the next slide
uh kind of goes over the commission did
[55:55]
review it and they motioned to recommend
to the council that the uh council
[55:59]
consider and approve authorization of
the special permit. They use of course
[56:03]
the comprehensive plan, our community
goals in their review. Uh we look at the
[56:07]
principles for economic development and
our comprehensive update goals which is
[56:10]
environmental sustainability investment,
crime prevention, native plantings and
[56:15]
strategic redevelopment. And you can see
the check boxes as we go through in
[56:19]
there to complete those boxes. Of
course, they are asking uh for some
[56:23]
additional landscaping along the Dealman
Industrial Drive uh component, which is
[56:27]
the west side uh when you enter from the
stop sign area uh to replace exterior
[56:31]
wallpack lights with those compatible
with chapter 428, meaning that they're
[56:34]
cut off facing down uh and there. And
then to limit the hours of operation
[56:38]
from 7:30 a.m. to 6:30 p.m. That's done
in collaboration with the petitioner.
[56:42]
And the concern was because it's a
pediatric facility just to make sure
[56:46]
that uh they're not interrupting or um
throughout the evening or when we have
[56:51]
industrial traffic.
On the next slide, mayor, if I can enter
[56:54]
a couple of items just for the record.
Uh, our 2024 comprehensive plan update,
[56:58]
including the 5-year economic
development plan, the Alvette municipal
[57:02]
code and zoning map, uh, the staff
presentation and memorandum that was
[57:06]
presented to the planning and community
design commission dated July 23rd, 2026,
[57:10]
including the petition and supporting
plans and documents. Our public hearing
[57:14]
notice, this is a public hearing. We
were required to post this 15 days prior
[57:18]
uh to tonight and that was posted in the
the county in St. Louis County on August
[57:24]
10th, 2026. And you have a list of the
properties that were notified. Uh we did
[57:28]
300 ft which is above and beyond the 185
called by code. Uh and then this
[57:33]
presentation before the city council.
So mayor, I'd be glad to answer any
[57:37]
specific questions and then we do have
representatives here I'd like to
[57:40]
introduce.
>> What's what was their current
[57:42]
previously? what was who occupied? Uh it
was an engineering firm I believe was
[57:48]
the last uh firm that was there
>> and it they're going to be if you don't
[57:52]
mind going back to the uh overlay of the
office they're going to be doing
[57:55]
outpatient
um I guess so patients come in and are
[58:00]
seen there or is the expectation but
because these are these cubes I guess
[58:05]
I'm just wondering where where that
occurs

» kind of like shows the internal layout I
think there's going to be some changes
[58:09]
and modifications I think that's what it
looks like right now uh in there so they
[58:13]
haven't applied but but yes they do
one-on-one therapies with uh individual
[58:17]
clients, pediatrics, of course. Uh in
there, probably a question that can
[58:21]
better address than I could on the
description.

pediatric means all the way through 18,

right? So, is the city limiting the
hours or is that something that SSM is

>> We talked with SSM about what hours and

in there and that was within that range.
which I think they they close at 5:30.

Something we can check with them again.

» And then I was just curious, I don't see
a landscape plan here yet, but um want

to be clear about the area that this
business would be working,

» like what part of the parcel they would
be working on to improve the landscaping

and hopefully get some trees out there
and native plants, something other than
[59:09]
just the turf. Um, and then also curious
if there's going to be any signage on
[59:16]
that corner there or that little kind of

» park that pokes out on the corner.

uh, on the right hand side, you'll see
Deman Industrial Drive. That's where

we're asking for some additional
landscaping to be placed in there with
[59:37]
50% of that being native. The one thing
along this corner both going north
[59:42]
[snorts] you know where I'm when you're
looking at that right road you are going
[59:48]
north to south uh on the left you're
going east to west uh on both portions
[59:54]
of the road and you can see some of the
the the fiber indication there's fiber
[59:57]
and underground utilities all running
through uh through there where I have
[1:00:02]
the most excess of rightway believe it
or not is going to be on the western
[1:00:06]
side this used to be an easement and
that's where I believe maybe that's why
[1:00:10]
there was no sidewalk or landscaping uh
in place. When the city took over the
[1:00:13]
roads, we took over just a significant
portion. A lot of times the parking
[1:00:18]
would have been further back, we would
have more area for landscaping and and
[1:00:22]
things of that nature. So, we're looking
here on the right hand side as you can
[1:00:25]
go uh north to south that they do some
uh some additional landscaping uh in
[1:00:30]
their trees to be careful. probably
preference would be more ornamental, but
[1:00:35]
nothing that's going to be deeprooted
because they're going to there's
[1:00:38]
continue a matter of fact uh there was
markings uh this morning again that
[1:00:42]
somebody's running some type of fiber
optics or things uh of that nature. So,
[1:00:46]
it continuously gets torn out, but we'd
like to get them more towards uh on the
[1:00:52]
western or the eastern part of that hump
as you see in the the grading uh in
[1:00:57]
there to kind of hide some of the
parking
[1:01:00]
in there. We didn't look at the north as
they're kind of more facing towards
[1:01:04]
Olive uh in there. But again, I know I
have a lot of uh
[1:01:09]
utility stuff that runs uh underneath
and the sidewalk kind of extends more
[1:01:13]
along that area uh in there, but it
could be discussion we can have with the
[1:01:17]
property owner. In terms of signage, no
signage has been proposed.
[1:01:20]
Traditionally, the signage has been uh
on the wall in there. I anticipate that
[1:01:25]
they will continue to do so. I know
ImageNet, which is also located on that
[1:01:29]
building at the far uh left end uh which
would be the eastern end of the building
[1:01:35]
does have a monument sign at that back
corner. So if they do another one, they
[1:01:39]
have to place it uh towards the other
apron uh in there. So I don't anticipate
[1:01:44]
anything towards the front.
>> Okay. And my questions are twofold. One,
[1:01:50]
obviously to increase our environmental
sustainability and to have plantings
[1:01:54]
along that um area as much as possible
that not only are good for the
[1:02:00]
environment but can also provide shade
um and reduce the heat on that um
[1:02:05]
asphalt parking lot. Um, and then the
other piece with Oh, and safety as well
[1:02:12]
because you're going to have kids in
that parking lot and obviously it's
[1:02:15]
worst case scenario thinking that
somebody's jump going to jump the curb
[1:02:18]
and go over, you know, that's obviously
worst case scenario, but any buffer
[1:02:22]
» uh that we can put in there is a good
one. Um, and the same concern with
[1:02:26]
safety for signage. Um just so that when
we've got parents who are looking for
[1:02:31]
the facility that it's clear and we
don't have kind of that driving around
[1:02:36]
trying to find it because it is you know
somewhat tucked down um
[1:02:42]
back behind there just so that it's it's
clearly clearly seen and visible um for
[1:02:47]
your visitors for your patients and
their families.
[1:02:50]
» It's something we can look at and
discuss with it. And again, I just want
[1:02:53]
to be clear in terms of the the two on
the first comp component of that, the
[1:02:58]
sustainability aspect as we're looking
at some of the the plantings and the
[1:03:03]
native species, the concern would be on
the trees being too too big in there
[1:03:07]
because of the
>> uh because of the utilities that run on
[1:03:12]
that north side. Now, right here where
the bench is set, there is more depth
[1:03:16]
and I think it's the parking stall
length and we can talk with them if
[1:03:19]
that's an area that they could do more
of the shade aspect of it as opposed to
[1:03:23]
the decorative part component of it.
>> Yeah. And even if it was native bushes
[1:03:26]
or something that it would help and put
that barrier
[1:03:30]
» is the you know the white and orange
pole that you can see in the front of
[1:03:35]
the picture but then also on that right
side there is that the marking for the
[1:03:39]
fiber optic cable

they're not big, but they're

approved and then they'll have the full

as they submit some type of landscaping
uh in there and then set the condition

of the 50% native.

sense of what that is as well as what

your layout internally is before the

Clary with Intel. I work with the
[1:08:21]
landlord on this building. I just had a
a quick comment question on the the
[1:08:27]
conditions of the landscaping. Um, so
Carlos mentioned there's some fiber
[1:08:31]
optic optic cables that run on the
inside or just on the outside of the
[1:08:36]
sidewalk. Um, there's there's a very
similar one just on the other side. You
[1:08:41]
can't see it, but it's right there in
front of a manhole. Um, would it be
[1:08:46]
beneficial at all if we did more
landscaping right where that park bench
[1:08:50]
is
instead of along the the western
[1:08:54]
barrier?
My view is more landscaping anywhere is
[1:08:58]
good. Like so as many native or this
council is generally I won't speak for
[1:09:03]
everyone but it's generally in favor of
native plants and beautifying and just
[1:09:06]
adding sustainability. So um there's
many many ways to attack that. So I
[1:09:10]
think um yeah, we have to be sensitive
to the cabling and not get in the way of
[1:09:14]
utilities and trees and things like
that. So we're not in any way saying,
[1:09:17]
"Oh, no, just put trees everywhere."
It's what are the best use of native
[1:09:20]
plants sustainability that are
aesthetically looking that are good
[1:09:24]
maintenance, you know, and see and and I
think it's just seeing what would look
[1:09:28]
like.
>> Yeah. So we and just a couple couple
[1:09:31]
thoughts on what we were planning on
doing to this building. So it's it's
[1:09:34]
been under a new owner since about
October. Um, the building, I don't know
[1:09:38]
if you've driven by it frequently, but
it looks very tired on the outside. So,
[1:09:43]
the signage is all mismatched. Festive
is is on that corner. Their signs about
[1:09:47]
this big, literally. Um, and so we're
trying to make the signage consistent.
[1:09:52]
We trying to make it prettier, channel
cut lettering if available. Um, repaint
[1:09:56]
the exterior of the building. We were
welcoming the light improvements. Um, we
[1:10:00]
were planning on doing that anyway. Uh,
and so I was trying to get to an
[1:10:06]
understanding of is it more
beautifification or is it more safety
[1:10:10]
barrier now that you have a better
understanding of their hours of
[1:10:13]
operation or is it a little bit of both?
Because I could probably do more
[1:10:17]
landscaping
near the park bench, more in front of
[1:10:22]
the building. I guess what I'm getting
at is I want to create the barrier. I
[1:10:26]
want it to be pretty. I don't I I would
love to not do too much because we're
[1:10:29]
going to make the building look a lot
nicer and I would hate for it to be
[1:10:32]
obuscated
>> if we have hedges grow too tall. But
[1:10:36]

» at least from my perspective with the
landscaping you know it's it's
[1:10:42]
addressing sustainability and aesthetic
purposes. Okay.

» Um but with the sustainability piece you
know trees provide benefits a multitude
[1:10:51]
of benefits. storm water control,
cooling, um biodiversity,
[1:10:57]
uh and aesthetics. Yeah. Um as well. So,
and trees give you the biggest bang for
[1:11:03]
your buck over time.
>> Mhm.

» Low low maintenance generally too.
>> That is and it it is a triple net
[1:11:09]
building and so increasing the
maintenance cost does get passed back to
[1:11:12]
the tenants and
>> Yeah.

» So, trying to find that happy medium.
>> I Yeah. And I I think again this is not
[1:11:18]
a dictative. It's just a anywhere we
can, especially when we're approving new
[1:11:22]
things, we're saying let's continue
sustainability goals. I'm less concerned
[1:11:25]
about the safety. It's always a nice
thing, but at least there is also a
[1:11:28]
ridge up, which is nice. It's a very
large area versus just a curb.
[1:11:32]
» Um, but yeah, I think we just like to
see us continuing to grow and get more
[1:11:36]
sustainable. So, but to your point,
>> you don't want to block the signage
[1:11:39]
you're going to put up either. It's a
balance.

page. we'll get you something has a
[1:11:44]
really good sense of I think of

» we've had these conversations in
multiple forms. So, um I think he's

probably well equipped to advise on

Fabricators and PK Construction, but if

you look at the before and after of what
they did, they painted it white and blue
[1:12:25]
accents. It looks incredible. So, it's
it's something that would be tasteful

and nice and and not obnoxious, but if
if you go go look at it sometime this
[1:12:36]
week, I mean, it's it's peeling. It's
just there's a light that's it just
[1:12:39]
needs to be needs to be redone. So,

going to be, you know, what color, what
what what you guys decide before the
[1:12:48]

director of planning and community
development for the city of Alvette. And
[1:14:17]
tonight here I'm uh to discuss bill 3071
which is a special permit request for an
[1:14:23]
enclosed recreational use at 1220 North
Price Road uh suite number four uh in
[1:14:28]
that building. That is the same building
where we have Padel and Pickle uh on on
[1:14:33]
the northern end and underneath Pedell
and Pickle is actually uh u
[1:14:39]
beauty uh auto beauty specialists. I'm
sorry I can think of the name. And then
[1:14:43]
right in the middle you have uh uh
door.com
[1:14:47]
uh that that's located uh that kind of
wraps. And then this is a little corner
[1:14:51]
piece that I'll show you more
specifically in a second. So if you go
[1:14:54]
to the next slide, it is an old uh an
older building that was built uh I
[1:14:58]
believe in the the 1960s. I didn't put
the date uh in there, but it's a 6acre
[1:15:03]
lot with 134,000
uh square foot uh was considered of
[1:15:08]
office manufacturing, warehousing, and
distilling uh that took place at one
[1:15:12]
time. Now we have uh recreational use
with Pedel and Pickle uh storage with
[1:15:17]
auto beauty specialists and then some
distribution and offices with locked uh
[1:15:21]
with uh lock.com
or door.com uh on the site. the there's
[1:15:28]
one more piece uh of the building that
is up for lease uh and it's roughly
[1:15:33]
about 6,700 square ft² and that's where
you see the orange door there at the
[1:15:37]
lower right hand corner uh is where
they're looking to take a a piece of
[1:15:42]
that. It's very oddly configured because
over time as that property was improved
[1:15:47]
they they did it in phases and pieces uh
in there and of course it was the old
[1:15:50]
Southern Comfort Distillery uh that was
operating on that site. property grounds
[1:15:55]
are zone LI light industrial district
and enclosed recreational uses and
[1:16:00]
outdoor recreational uses are permitted
uses in the LI district but subject to a
[1:16:05]
special permit meaning they're not
industrial but they can be compatible
[1:16:08]
with a lot of the industrial uses that
we have there and of course I noted we
[1:16:11]
have Pedel and Pickle on the site uh
just to the left of it you had the
[1:16:15]
bridge uh facility um in there and then
we used to have the old town in tennis
[1:16:19]
just down the block uh not too far from
where SSM was looking at the next slide
[1:16:25]
We have a procedure for special permit
requests. It's a recommend review and
[1:16:29]
recommendation by the council by the
commission. Uh they forward that to the
[1:16:33]
council which holds a public hearing and
then has a action via an ordinance
[1:16:38]
special permit process. We have a
procedure that's outlined within our
[1:16:41]
ordinance that looks about looks at the
impact to it to limitations. Uh but
[1:16:46]
always, you know, trying to see how we
can further our comprehensive plan uh
[1:16:49]
goals and updates. And I'm sorry about
the lower left hand that should have
[1:16:53]
been LI district uh in there on that
side. The next slide will kind of talk
[1:16:57]
about general conditions of a special
permit. So what do we do is that we make
[1:17:01]
sure it's listed in the district that it
first to go a comprehensive plan that
[1:17:05]
the location is suitable to the
environment and surroundings. Sometimes
[1:17:07]
it could be doing topography some
natural features is is the property flat
[1:17:12]
is it hilly or or things of nature. Uh
are the improvements complimentary to
[1:17:17]
the neighboring uses? Did they
demonstrate that they're mitigating any
[1:17:21]
spillover effects that would adversely
impact the addition properties? And then
[1:17:25]
of course the city has the authority to
require whether buffering aesthetic
[1:17:29]
enhancements, designate areas for open
space, set limitations on operations,
[1:17:33]
implement a schedule and that is you
know requiring things to happen over a
[1:17:37]
certain amount of time and consider
adequacy of public services such as fire
[1:17:43]
uh medical police type of services. The
next slide we'll get into the nuts and
[1:17:46]
bolts. This is a corner of the building.
Again, this is 134,000 ft building. It's
[1:17:51]
a big building. Um, they're taking this
uh kind of uh front view here where the
[1:17:58]
orange door is, but not the whole thing.
It's just the on the left hand side, the
[1:18:02]
the first two uh components where you
see the vertical uh things right there
[1:18:08]
and then it kind of L-shapes and goes
back. So, you actually enter the
[1:18:12]
building uh from from that gap between
where the cursor is and to the far left
[1:18:19]
uh in there. There's a little cove
that's a little bit further back. Thank
[1:18:22]
you, Miss Yaki. Uh in there where the
enter entrance is. And I'll show you a
[1:18:26]
little bit more when we get into the
aerial view. The next slide will kind of
[1:18:30]
show how that is set up. And again, uh
sorry, I'm using white on the white
[1:18:35]
background. Uh, but you can see this
L-shaped layout kind of laid out onto
[1:18:39]
the 134,000 foot building. You can see
that cove area in that cove area on the
[1:18:44]
lefth hand side is the layout. There's a
66
[1:18:48]
uh 6,60 ft uh of the building footprint
for uh the Ames indoor uh field hockey
[1:18:56]
projects facility. Who is your your
petitioner? The next slide.
[1:19:02]
What is being proposed? The operations
are it's a 6,600 foot women's indoor
[1:19:06]
field hockey practice facility. In this
facility, the operations will include
[1:19:10]
training, one-on-one coaching, office
operations, and then video productions
[1:19:15]
that they use for uh uh for promoting
purposes for the uh for the individual
[1:19:19]
athletes uh for schools and and things
of that nature. Uh next slide. Uh as we
[1:19:25]
go through the PCDC, they went and they
reviewed it. Again they have a process
[1:19:29]
to review it in accordance with uh our
ordinance in special permit uses and
[1:19:33]
then also our comprehensive plan. Uh
when you look at economic development
[1:19:37]
and investment, it also has its own
specific goals about environmental
[1:19:41]
sustainability, investment, crime
prevention, uh native plantings and
[1:19:45]
strategic redevelopment. So in their
review, the commission uh motioned that
[1:19:49]
the council consider authorizing the
special permit through this ordinance.
[1:19:53]
However, they also laid out the
following conditions. One is to limit
[1:19:56]
the hours of operations from 7:00 a.m.
to 8:00 p.m. How do we get there? Again,
[1:20:00]
that was a discussion with the
petitioner of what their operating hours
[1:20:03]
would be. Uh, and there uh to replace
the exterior wallpack lights with uh
[1:20:07]
those that are cut off and facing down
compatible with chapter 428 to do a tree
[1:20:12]
health assessment and replacement plan
with 50% of those being native. There
[1:20:16]
was several trees along the perimeter of
the the the site as itself. you know,
[1:20:20]
different differentiating it from the
petitioner here. Uh, and there and some
[1:20:25]
of them had been cut down and some of
them uh seemed like they they were not
[1:20:29]
as healthy. And then to replace some of
the deteriorated fencing sections uh
[1:20:33]
that were on the uh south side of the
property uh uh in there the next slide,
[1:20:40]
mayor, if I can just enter a couple of
items into the record. Uh, one is our
[1:20:44]
2024 comprehensive plan update,
including our 5-year economic
[1:20:47]
development plan, the Olivette municipal
code and zoning map, the staff
[1:20:51]
presentation and memorandum presented to
the planning and community design
[1:20:54]
commission dated July 23rd, 2026,
including the petition and supporting
[1:20:58]
plans and documents. The public hearing
notice, of course, this is a public
[1:21:02]
hearing. We're required to post this in
the county and St. Louis County. It was
[1:21:06]
published on August 10th, 2026. And then
you have a list of the properties that
[1:21:09]
were identified or notified uh regarding
that twice. Uh they get a postcard
[1:21:14]
before it goes to the commission and
then they also get a public hearing
[1:21:18]
notice uh prior to our meeting here at
council and then the presentation before
[1:21:22]
council dated August 25th, 2026. I do
have representatives here in attendance,
[1:21:27]
but I'd like be glad to answer uh
specific questions about the building
[1:21:30]
and the operations.
>> I have questions mostly for the
[1:21:33]
petitioner. So before we bring them up,
anyone have any questions for Mr. Tjo.
[1:21:38]
» Yeah. So I uh my daughter actually took
lessons at Padel and Pickle. So I got to
[1:21:41]
see the parking lot when they're when
it's gets a little bit busier.
[1:21:45]
» It does it just want to make sure that
there are enough spots for all the
[1:21:48]
tenants if this goes through. Especially
if you know there's a team or a couple
[1:21:53]
of teams practicing, everyone drives in
their own cars.
[1:21:57]
» End up with an extra with an extra 30
cars. [snorts]
[1:22:00]
» Would that be enough space? And if not,
where would the overflow be?
[1:22:04]
» Well, good question. Uh if you we can go
back to the aerial. I think it's about
[1:22:09]
uh three on on this site. Well, one
[1:22:14]
uh on this site. So you can see um
there's that center parking uh in in
[1:22:20]
that area primarily used by by lock uh
door.com, excuse me. And their pedal and
[1:22:26]
pickle uses part of that and then they
uh expanded their have the uh the
[1:22:30]
parking facility there on the lower left
corner uh in there. and you see that
[1:22:35]
that aisle in there. Uh they've always
wanted to expand in that green space,
[1:22:39]
but then that would trigger MSD review
and and storm water. So, there's always
[1:22:42]
that caveat that we have available
there. But then there's some additional
[1:22:46]
parking on the far right end of the
building uh in there. It's kind of
[1:22:50]
separate and independent, but they also
operate this. Yes.
[1:22:54]

>> that that area where the cursor is at.

» Would would that be another entrance or
would people have to walk around?
[1:23:01]
» They would have to walk around. They're
they're not in the way the in the
[1:23:06]
original building everything was all
within within [snorts] reach. Now that
[1:23:09]
things have been separated, yes, the
parking is all kind of uh disassociated
[1:23:13]
with the with the spaces.
>> But it's always a good question. I mean,
[1:23:18]
I always hear, you know, that's a lot of
parking. You know, do do they really
[1:23:22]
need all that surface area? And you try
to balance that. Do they really have
[1:23:25]
enough parking uh in there? You know,
from a planning perspective, there are
[1:23:30]
in our code, there are some some
minimums. We go by minimums uh in there
[1:23:35]
that they have to have a minimum amount
based on the type of activity that takes
[1:23:39]
place. For recreational uses, it's based
on square footage. There's a simple
[1:23:42]
calculation that we use to calculate
that. For the office, it's based on on a
[1:23:47]
similar weight. Uh but then they're in a
match. And then our code allows us to
[1:23:52]
provide some overlap. So if this use
needs this much parking, this use need
[1:23:56]
needs this much parking, this use needs
this much parking, you can have some
[1:23:59]
overlap that that some may come in at
night, some may come in during the day
[1:24:03]
um in there. So it allows for that
process in there to help try to balance
[1:24:07]
it uh in there. But again, it's, you
know, from a professional view, it's
[1:24:13]
like I
I think if if people are unhappy with
[1:24:18]
the parking, they're going to go
somewhere else to find a better facility
[1:24:21]
that can accommodate them. And it
impacts the user in there. We want to
[1:24:24]
keep these uses viable. We want to keep
our residents and and and the region
[1:24:29]
coming to our our our location uh in
there, but this is a fine balance as
[1:24:34]
opposed to having over parking. We had
the conversation when uh Murthy Health
[1:24:38]
Systems was looking at the pharmacy and
we were asking can we get rid of parking
[1:24:42]
spaces uh back there and it's tough
>> for this area specifically. I just want
[1:24:47]
to make sure people are not parking
along the road or something like that.
[1:24:50]
So, but that sounds plenty sufficient if
we have that lot in the back.
[1:24:55]
» But a good question. I mean it's it's
one of the things we struggle with and
[1:24:59]
finding that right mix, right balance.
Mhm.
[1:25:01]
» Um, related to parking, I'm interested
in kind of hearing your perspective on
[1:25:06]
the traffic flow on this lot. Just
recognizing that it has kind of an
[1:25:10]
unusual
setup with the two entrances. Um, you
[1:25:15]
know, it's not a cir circle drive, but
you know, kind of coming in from both
[1:25:20]
sides. And then the extended part that
I'm assuming when this was more serving
[1:25:26]
an industrial purpose um was set up for
truck loading and unloading. Um and I
[1:25:34]
guess I'm just I'm curious in this
parcel recognizing how the uses have
[1:25:40]
shifted um pretty significantly. Um,
other than Door, perhaps Door still uses
[1:25:47]
the larger trucks for uh deliveries and
loading and unloading. I'm not sure. I'd
[1:25:53]
be curious to know um if this current
traffic configuration
[1:26:00]
is
the best um
[1:26:04]
use of that space
um and or the safest use recognizing
[1:26:11]
that you know for field hockey you'll
have parents driving but you my guess
[1:26:15]
[clears throat] is potentially some of
the clients will be uh older
[1:26:20]
kids young adults who are driving
themselves and aren't necessarily known
[1:26:24]
for being the best drivers. Um, and
trying to trying to make that that
[1:26:31]
particular area work in a way that um
it seems a little the setup as it is now
[1:26:39]
is a little odd for the uses that are
being
[1:26:42]
» No, it's a very good question.
>> Those buildings
[1:26:45]
» in there a good question uh just on the
timing on on here. So, and and this is
[1:26:53]
this is why it's a special permit. I
mean, we have seen our industrial parks.
[1:26:58]
There's not much industrial going on in
those parks uh anymore. Uh we have seen
[1:27:04]
the the the the road and all that. This
used to be all private. So, those dock
[1:27:09]
doors all worked uh in there because
they were not under our jurisdiction uh
[1:27:14]
and in place. Now, we've taken up those
spaces in there. And these buildings
[1:27:18]
still are industrial buildings trying to
be retrofitted for uses that that were
[1:27:24]
or you know that that were not designed
or or built. And that's why we go
[1:27:29]
through these processes. You know, this
is the third time that I've been here
[1:27:33]
just for this building. You know, we did
that for Paddle and Pickle. We did it
[1:27:36]
for uh Auto Beauty to expand underneath
uh in there and then now we're doing it
[1:27:41]
for the Ames indoor hockey uh in there.
You know, I couldn't give you a straight
[1:27:47]
answer of is this, you know,
professionally, is this the ideal
[1:27:51]
parking configuration? No. No, it's not.
This is what what I have to work with
[1:27:56]
and what how it's put in place. uh
things that would I would would be ideal
[1:28:01]
for that parking is to make it more
uniform and and uh
[1:28:07]
you know uh polygono or or so but then
it triggers things because then you get
[1:28:13]
rid of that green space and then MSD
gets involved in all that and then the
[1:28:16]
cost of trying to retrofit these
buildings becomes more difficult um uh
[1:28:21]
in there. I think it's something we have
to kind of look over time uh in there.
[1:28:28]
We I'm not aware that that there's been
any incidents uh in the spaces, but we
[1:28:32]
only have three of the four tenants in
in there right now. Uh with uh auto
[1:28:37]
beauty, that's solely storage and those
are moved from just kind of back and
[1:28:40]
forth uh with them. Pedal and Pickle,
you know, I know they have their their
[1:28:46]
their their operation their times kind
of fluctuate over time and it's just
[1:28:50]
going to be kind of looking at how that
mixture works between the two. The only
[1:28:53]
constant is Door.com. We know who's
there during during the regular hours
[1:28:57]
and then when when they leave uh in
there, it could be something that we
[1:29:01]
could look at, you know, how are the
hours of operating working with with
[1:29:04]
that over time. uh or you know talk
about how do we get more connectivity uh
[1:29:10]
with some of the other spots in there
depends on when I go out there you know
[1:29:14]
it's full and you can see uh to the left
on on the on the slide you know all that
[1:29:20]
parking right there is bridge uh in
there and it was like when we were going
[1:29:26]
through that we didn't anticipate you
know that volume um in that place but
[1:29:30]
we've been fortunate that the mix of
that building has been you know kind of
[1:29:33]
balances pretty well you don't go there
during the bridge time, you're going to
[1:29:37]
get pretty good parking. If it's during
bridge time, yeah, you're you're you're
[1:29:40]
kind of moving around trying to find a
space in there, but then they have a
[1:29:43]
similar pattern where the parking wraps
around the building and then there's a
[1:29:47]
whole another field on the north side uh
of it. So, yeah, I think there's enough
[1:29:52]
spots. It certainly does meet our code.
Is it configured perfectly? No, it is.
[1:29:58]
It it isn't. But I think we have to see
how we, you know, how these buildings
[1:30:02]
kind of transition and how this parking
kind of works over time.

» What the current hours for paddle and
pickle? Do you happen to know?
[1:30:12]
» Not off hand. Uh I believe they do have
an early start like 6:00 a.m.
[1:30:19]
» And paddle pickles where on here with
the curses are
[1:30:22]

» And they do actually use a parking lot.
That's where that blue truck, blue roof
[1:30:31]
» right in that area.
>> Yeah. So that ends up being old parking

now, but people just park there in a row
[1:30:41]
and it's pretty organized.

only take up that wider part of the
parking. They don't even end up much on

hours only because again I feel like it

might be different thinking about my
son's soccer and the private things like

night and so it's you're comfortable

with the hours because it is light
industrial so we have a little bit of
[1:32:07]
give so

um the you know during the day is going
to be just office use for we just have

four of us in there so it's not like a
huge you know for parking or whatever um
[1:32:21]
and then I am comfortable with the hours
it's going to be a lot of small group

and private training and not like loads
of teams coming in that space.

surprised too like your choice field
hockey, but you guys don't ever open it

up to anything else like football or
other, you know, trainings. You just it
[1:32:40]
only dedicates to field.

this 20 years and we just focused on
field hockey, but
[1:32:45]
» it's a win. Okay,

» How many uh players are training at any
one time? Oh, thank you.

» We'll we'll be looking at doing small
group. Well, some will be literally
[1:32:56]
private one-on-one, but we'll be looking
at doing like 8 to 12 kids um training.

>> So, this is kind of a new concept, so

it's a little bit unproved. Lawrence
kind of gone out on a limb here because
[1:33:10]
all these indoor practice facility,
anyone who uses turf, they're all
[1:33:14]
fighting over each other for Veta in the
different turf
[1:33:17]
» areas. So, Lauren's still going to
utilize those spaces. This will be a
[1:33:21]
complimentary facility for her where she
can do smaller group training
[1:33:26]
one-on-one. She does a lot of
recruitment videos for college and
[1:33:29]
things like that. So, it'll have like a
video production room.
[1:33:33]
» Um, so it's not totally unknown. I think
she knows what she's gone through a
[1:33:38]
heavy business plan. So, I think it's
going to be a great facility. And
[1:33:43]
honestly, the um the previous meeting we
went to, they were like, "We think
[1:33:49]
you're going to outgrow this facility
and need to go get a bigger facility."
[1:33:51]
So, it's going to it's a new concept in
the indoor space. There's no one else
[1:33:55]
doing it. We're excited about it. We're
happy to be in Alvette. This is a great
[1:33:59]
location. The property is well lit and
it's a safe neighborhood. At night, the
[1:34:04]
all the other businesses are in the
afternoons, they'll be winding down on
[1:34:07]
their business where she'll be picking
up from when kids get out of school
[1:34:11]
until the evening hours. So I think it's
complimentary and then a lot of the
[1:34:15]
parents when they drop their kids off
they can go support the other businesses
[1:34:19]
in the community or go over to pet pedal
and pickle and make reservations and so
[1:34:23]
maybe that helps from the parking
standoint as well.
[1:34:26]
» Could I address just your question
earlier also um we serve like
[1:34:32]
three-year-olds to 18y olds so 90% of
our clients are are parent drivers. Um,
[1:34:39]
we do have some, you know, the 16, 17,
18 year olds and I do understand your
[1:34:43]
question with that, but it's that's
going to be a small percentage.
[1:34:47]
» I do imagine you will do quite well
because I can imagine a lot of people
[1:34:50]
that's why I asked about other sports
because the recruitment as my son's
[1:34:53]
going through that kind of thing right
now. It's um a space where you could do
[1:34:57]
that privately and get that and have
video. I question do you plan maybe you
[1:35:00]
don't because the size isn't like food.
You're not selling food. We're not No,
[1:35:04]
we don't have like a grillin bar or
anything like that. think like a veta or
[1:35:08]
something like that. Okay.

» Yeah. I think it's a very exciting use.
I love to see the building repurposed um
[1:35:22]
and and especially providing something
that's unique um and sounds like a
[1:35:28]
really great market to address. Um,
and yeah, my my concerns really are more
[1:35:35]
about the building and the kind of weird
driving situation that exists. I don't
[1:35:40]
have any concerns about the business
other than the potential that you will
[1:35:44]
be more successful and uh outgrow this
space too quickly.
[1:35:50]
So, we are in a little bit of a So, when
we negotiated this deal on the building,
[1:35:56]
the there was a new buyer coming in for
the building, which is the Bluepoint or
[1:36:00]
whatever LLC that's on the agenda for
this evening. It is kind of an emergency
[1:36:06]
situation. and Lauren got busy in the
spring and we burned some time and then
[1:36:10]
we realized when we went to permits that
we figured pedal and pickle and it
[1:36:15]
wasn't talked about with the previous
lawn lords on the use that we didn't fit
[1:36:18]
within the light industrial without a
special use permit. So now we're in a
[1:36:22]
situation where construction's been
delayed. So really what we're trying to
[1:36:26]
achieve is to get this thing off center
because it's she's a small business and
[1:36:32]
she's got time burning on at least right
now and we're confident we can get
[1:36:35]
through this with you guys and make the
compromises needed to make sure everyone
[1:36:39]
in the city is happy with the use. But
it's kind of like we need I think what
[1:36:44]
Carlos suggested is that we need to have
it as an emergency so we can get a first
[1:36:48]
and second reading. So whatever
accommodations
[1:36:51]
Yeah. So we we kind of would like to see
if we can move this forward this evening
[1:36:59]
if you guys would be open to that.
>> Don't know from policy how that works in
[1:37:03]
terms of because because we have to post
agendas
[1:37:06]
» start the review of the uh the permit
plans with them uh and then that's
[1:37:10]
something we can offer

plans before the council authorizes. So,
it's a risk we take, but it's something.

they're willing to work, so I think that

authorize until the second reading, but

I think that gets you forward versus
waiting to the second reading then to do
[1:37:32]
that, right? So, it keeps us on track,
if that makes sense. So,

and second reading on one day?

» I don't know how we can do that.
>> Technically, you can. Um, it was not

motion to hold the second reading this

council meeting to adjust our processes.

that in in a council meeting at itself,

concerns from you moving forward on your

>> No, I mean they started off with permit
[1:40:26]
plans. So I think they're they're they
should have the contractor is here uh in
[1:40:31]
» I don't want to put you guys in a bind
either if that's something that you guys
[1:40:34]
can't staff timing or anything like that
either. So that would
[1:40:37]
» correct but I think we can coordinate
and get that that okay you know that
[1:40:40]
first round going
>> if you guys are good we'll have move
[1:40:42]
forward that way. I think it'll end
about the same time either way and I I
[1:40:45]
would agree with Chairman Bam on that.

a tax amendment. So unlike uh having the

site plan and illustrations all the
pretty pictures uh and there we're
[1:45:35]
looking to amend our subdivision code
specifically the section referring to
[1:45:39]
condominiums plats and additional
requirements. The next slide will show
[1:45:42]
the the specific section and the changes
in that is to remove the references to
[1:45:46]
multif family or anything residential.
Uh what this does it gets us more
[1:45:51]
consistent with the condominium act. You
see there reference of chapter 448 the
[1:45:55]
revised statutes of Missouri. They kind
of say that we we really can't hold a uh
[1:46:00]
a distinction in terms of condominiums
whether they're residential or
[1:46:04]
non-residential that they can be applied
to buildings a building replace or the
[1:46:08]
sale of the building uh and they're I'm
hoping I address that correctly with and
[1:46:14]
there and we're just getting our code
more consistent with the state.

transportation block grant agreement
with Missouri Highways and

Transportation Commission for the North
Price Phase One Grant Project.

Again, Bruce McGregor, public works
[1:48:34]
director. Um back in January uh work
session, we discussed our second uh
[1:48:40]
application for a surface transportation
suballocated grant for North Price Road
[1:48:47]
section one or phase one old bottom road
to uh Delmare. It's a little over 2,100
[1:48:53]
linear feet. We had applied the previous
year and and didn't score high enough.
[1:48:58]
So we made some strategic amendments to
our application and uh basically
[1:49:03]
offloaded some of the uh engineering
work out of the grant as the city
[1:49:08]
responsibility to try to meet a
threshold to score more points which is
[1:49:13]
one of the criteria used when the uh
committee is reviewing the uh the grant
[1:49:18]
applications. Uh so we found out a
little bit earlier by looking at the
[1:49:23]
agendas for the uh commission at East
West Gateway that we were on the
[1:49:27]
recommended list and then a couple weeks
ago we got a formal notice from uh MDOT
[1:49:33]
from the local projects uh administrator
that we were on the list for the uh
[1:49:39]
meeting this week for award approval and
that they recommended uh to hit the
[1:49:45]
ground running that we present our uh
the agreement to council for a
[1:49:48]
pre-authorization
uh to uh to uh execute the agreement
[1:49:54]
should the uh board uh go ahead and do
the expected uh you know decision this
[1:50:00]
week. Uh be glad to answer any questions
about the project, the timing, um next
[1:50:06]
steps, what we've already completed,
anything like that.
[1:50:11]
» Excited about it.
>> Yeah.

» Yeah.

» Yeah. And just FYI as well, uh, since
Amron had been so busy there, we've
[1:50:20]
received notice for them that they've
done all of the energizing work on the
[1:50:25]
circuits, uh, they may be coming back
into town over the next few months,
[1:50:30]
removing some obsolete cable uh, from
the runs, but everything is in service
[1:50:35]
uh, for that uh, load balancing or load
relief project uh, for the distribution
[1:50:41]
in University City and Leoo uh, just
since it's in that same area that that
[1:50:45]
project is done. Uh there
>> so if we were to get final approval for
[1:50:50]
this, I think this is question in
everyone's mind. When would this project
[1:50:54]
be realistically done?
>> Well, so that's a a very fair question.
[1:50:59]
What we have done uh last year uh we had
committed to doing the survey. Uh this
[1:51:05]
year what we had began we began in last
budget year which is in the spring was
[1:51:09]
the design work. Uh our intent is to
have our what what they call an RE
[1:51:16]
request for environmental review. So
that is a uh a submitt that goes to
[1:51:21]
Jefferson City to basically clear any
environmental impacts we have and that
[1:51:26]
might be more than just like hazardous
materials but like native people or some
[1:51:31]
other social economic uh impacts uh
along with uh ecology as well. You know
[1:51:37]
are we displacing any bats? The biggest
unknown we have is rightaway
[1:51:42]
acquisition. So, we have a 40-way
rightway width. We want to maximize our
[1:51:48]
existing condition of two sidewalks,
right? One on either side. Uh we want to
[1:51:53]
have a safe roadway for motorists and
for cyclists. And we still want to have
[1:51:59]
that appearance that's, you know, I
think feels softer to us, which is a
[1:52:02]
tree lawn. So to accomplish all that and
relocate utilities and and other things,
[1:52:08]
we need at minimum a temporary
construction easement for grading uh
[1:52:14]
from probably all of the uh property
owners along the alignment. Okay. So um
[1:52:22]
once we start through this process and
get the rear submitted, we'll be
[1:52:26]
planning public meetings. Um we'll be
getting the word out, maybe going
[1:52:31]
doortodoor. Um, every time I walk around
with a vest with the engineer and we're
[1:52:35]
looking at conditions, you know,
interested parties come out. So many
[1:52:39]
folks are quite excited about it. But,
you know, once you start talking about
[1:52:43]
changing, you know, the side of your
house, people, you know, can start to
[1:52:47]
question things. So, um, we always hope
that we don't get to condemnation. We've
[1:52:53]
done it before. And on the old bottom
project, I think we submitted the final
[1:52:58]
court documents 2 or 3 days before our
grant expired uh which was uh almost $2
[1:53:04]
million for that project. So um we hope
we never get there again uh on there. So
[1:53:11]
that's our biggest announcement. So So
the long story short, we would hope to
[1:53:16]
be doing construction for the schedule
in 3 years. Um I'm hoping we can be
[1:53:21]
ahead of that. Um, I'm optimistic that
our residents will be enthusiastic.
[1:53:26]
We'll have a nice design, um, and we'll
be able to start the negotiation sooner
[1:53:31]
in the involvement and, you know, get
everybody signed off on. So any type of
[1:53:36]
um federal grant or grant run through
MODOT requires the city to do a lot more
[1:53:43]
um work and there are a lot more steps
that need to be taken than if we were
[1:53:50]
just doing a regular street project,
right? And so that is why it requires a
[1:53:55]
lot more time. Uh realistically, you
know, I would tell people three to four
[1:53:59]
years. Give yourself a little uh leeway
because it's not just us that has to do
[1:54:04]
the work. Um
when we do rideway acquisition, we do
[1:54:10]
all of that and then MDOT has to go
through and approve all of that and we
[1:54:14]
can't get started on the next step till
we finish right away. And then plans,
[1:54:18]
MDOT has to approve all of that. So
there's a lot of kind of us doing a lot
[1:54:22]
of work and then waiting on others and
then doing a lot of work and waiting on
[1:54:26]
others. So if you want to give um give
your constituents kind of a realistic
[1:54:30]
answer, 3 to four years.
>> We have the same concerns of
[1:54:34]
hypothetically a gas line that isn't
marked where
[1:54:37]
» Yeah. And and and one of the challenges
is like what we ran into on the cost
[1:54:41]
share project is the area team meets
once a week. So and we aren't privy to
[1:54:47]
the meeting. So they meet, they review,
they ask a question. Well, then we have
[1:54:51]
a week to respond and then they ask
another question and then we have
[1:54:55]
another week to respond. So, you know,
it's not like we can make these
[1:54:59]
decisions on the fly. Um, and it so so
so that's exactly right. And and we have
[1:55:06]
we follow and we do everything by the
rules anyway, but we we have extreme
[1:55:11]
oversight on rightway acquisition
following what's called the Uniform Act.
[1:55:15]
Okay. It is uh designed to protect the
property owner, you know, and make sure
[1:55:20]
that everything is done, everything is
properly appraised, every opportunity is
[1:55:25]
given for the the owner to review and
sign off on, you know, without being
[1:55:30]
coerced. So, I mean, I always feel good
that I know we did the right thing. You
[1:55:34]
know, we always appraise everything. We
sometimes we get second opinions. We did
[1:55:38]
that on the cost share project because
we wanted to make sure it was such a big
[1:55:42]
acquisition that we were doing the right
thing and everything was being fair uh
[1:55:47]
you know for oversight.
>> So to answer your question are we going
[1:55:50]
to find something unexpected? Yes.
>> And it could be something positive
[1:55:55]
unexpected. It might not be something
