to say the word problematic but they're

problematic they ride on the sidewalk

they're out on the street they have kids

riding etc etc how will that solve this

problem because that's illegal currently
[7:56]
so how does this help change that which

is already happening

neighbors the neighborhoods that will be

affected uh and said you know this is

the areas that's it's already has golf

carts come through

some of them street legal which is
[8:19]
currently legal if you have a Street

you can drive that currently

so you're adding in what looks like
[8:26]
almost Street Legal golf carts if you
[8:28]
look at the definition of what you need
[8:30]
to have it and then a license from the
[8:32]
city
[8:34]
um if you want to designate certain
[8:35]
areas that are allowed and those areas
[8:37]
want it I'm all for it but that would be
[8:41]
the step to me not
[8:43]
broaden compassing and then trying to
[8:45]
come back and say well these areas don't
[8:47]

Council to approve the submittal of a
[14:32]
Grant application for the Ferd app the
[14:35]
Florida Recreation development uh
[14:39]
I'm not sure on the AP but it's it's a

recreation Grant to the State of Florida
[14:44]
and to authorize a work order with rmpk
[14:47]
funding who is our grant writer for uh
[14:50]
four thousand dollars for the
[14:51]
preparation in the submittal of the
[14:53]
Grant application the Grant application
[14:55]
is for Riverside Park and still new
[14:58]
improvements to the uh multi-purpose
[15:01]
field down below where The Pavilions are
[15:04]
also to bring in picnic areas as well as
[15:07]
create an official dog park which we
[15:09]
know from past history that a lot of
[15:12]
folks use that area as a unofficial doc
[15:15]
Park and so the staff is looking at the
[15:17]
idea of actually creating a smaller
[15:19]
version of the BART card which is up at
[15:21]
Shane Kelly Park uh and then also to do
[15:24]
some resurfacing of the uh of the
[15:27]
parking lot uh Mr Mr Belden is here uh
[15:30]
to answer any questions the city's
[15:33]
policy requires Council approval for us
[15:35]
to be able to submit the application so
[15:37]
that's why we have this on the agenda
[15:39]
tonight we're seeking your approval to
[15:41]
submit the application it is a four
[15:43]
hundred thousand dollar Grant uh the
[15:45]
first grant program requires the city
[15:48]
fund to fund the full 400 000 up front
[15:52]
and then after the Project's done we
[15:54]
would seek reimbursement for two hundred
[15:56]
thousand dollars it's sort of a
[15:57]
one-to-one funding ratio
[16:00]
um Mr Bill is there any other items that
[16:02]
we need have I covered everything

council adopt resolution number 4366-23

medals uh our annual report submittals

after we get the grant okay

that sounds like money well spent is are
[17:22]
we going to need to uh notify our
[17:24]
lobbyists

for any help with this we usually do uh
[17:28]
anytime that we submit a grant we also
[17:29]
let Mr commodity know so that there's
[17:31]
anything that he can assist with okay

basically out of out of our our city

work on these projects this was an area

[17:58]
improvements if something like that were
[18:00]
to happen again with these improvements
[18:02]
be
[18:03]
destroyed
[18:05]
with the improvements to the
[18:07]
multi-purpose field we're not looking to
[18:09]
put Bermuda in there we're trying to
[18:10]
make it a re-leveled surface regrading
[18:13]
new Turf just providing that safe and
[18:17]
more usage of a field for like the
[18:19]
soccer groups our flight football
[18:21]
program lacrosse teams and possibly you
[18:24]
know bring that up a little bit but make
[18:25]
it more level we'll provide that space
[18:27]
since Shane Kelly and osc are a
[18:29]
primarily a shutdown facility for our
[18:31]
contractual youth organizations so then
[18:33]
the dog park we're trying to put
[18:35]
elements within it that aren't going to
[18:37]
be washed away or destroyed through
[18:38]
future flooding you know knock on wood
[18:40]
we're not going to get the storm again
[18:41]
so we're being very cautious with what
[18:44]
we're you're not going to raise the
[18:45]
elevation of the surface okay I thought

I heard that and then with the park
[18:49]
amenities the park amenities within the
[18:51]
or around The Pavilions and around the
[18:54]
facilities they're deteriorated we've

requested it through our CIP program

they're rusted out we feel that this

gives us an opportunity to refurbish
[19:01]
those amenities picnic tables trash
[19:03]
receptacles and park benches with a
[19:06]
multi-purpose field but also Around The
[19:08]
Pavilions surrounding that Park okay so
[19:10]
so for the most part I mean the These
[19:13]
funds are going to something that even
[19:15]
if it was underwater it when the water
[19:17]
water receded that it would still be I
[19:20]
feel that this is uh improving our Parks
[19:22]
infrastructure perfect in addition to
[19:24]
improving the facility okay okay all
[19:26]

asked pre-asked a lot of a lot of my

questions uh so that's one of my
[19:33]
concerns and the other is I like that
[19:35]
that field is just a free-for-all and
[19:38]
that it's not formal and that people can

can use it so I'm a little bit hesitant

to create something that may be rentable
[19:46]
because there's very little space that's
[19:49]
just free play space and and I I like

the idea of keeping that free play space

and if we have to redo our our all the

stuff that's under The Pavilions anyway

this does seem like a sensible thing so

a question though if we do get the 200
[20:05]
thousand dollars and it comes back and
[20:07]
it turns out that getting the parking
[20:09]
lots fixed and the other things besides
[20:12]
formalizing the field and maybe
[20:14]
formalizing a dog area if it comes in
[20:17]
lower are we are we allowed to do the
[20:20]
less than because half off coupon we
[20:22]
still have to pay the half so I'm

hesitant to pay more than what what the
[20:27]
community collectively traditionally if
[20:29]
we do not expend what we sought after

2023-2024 determining that that certain
[22:59]
real property is specially benefited by
[23:02]
Street lighting Services approving the
[23:04]
assessment role providing the method of
[23:07]
collection and providing for
[23:09]
implementing administrative actions
[23:10]
scrivener's errors conflict separability
[23:12]
and effective date
[23:15]
this cop can give us a brief

I ever since we instituted the street
[23:20]
Life program one of the requirements of
[23:22]
the state statute is that every year we
[23:24]
need to recertify the tax roll and the
[23:26]
reason we need to do that is because
[23:28]
every year we have new people moving
[23:30]
into the City and so it is what the
[23:32]
statute says is that you have to provide
[23:34]
notice to anyone who is receiving this
[23:36]
for the first time so any new residents
[23:38]
have to be have to receive a notice and
[23:41]
so what what we have to do is part of
[23:43]
that process is that we have to
[23:45]
recertify the tax roll that's what this
[23:47]
resolution does it re-certifies the tax
[23:49]
roll for the coming year and then it
[23:51]
also maintains the uh
[23:54]
the fee at the 78 dollars and uh
[23:58]
13 cents yeah 78 and 13 cents it
[24:01]
re-adops the the fee as well so there's
[24:04]
no change in the fee this year and uh
[24:06]
but that's what this pretty much is is a
[24:09]
recertification of the tax roll for the
[24:11]
impact for the street light district and
[24:13]
so it's recommended that you conduct a
[24:15]
public hearing and adopt resolution
[24:17]
number 4358-23
[24:20]

light uh

count we set that up to pay the electric
[25:13]
bill and then to do improvements are we
[25:15]
are we on schedule for all the
[25:17]
improvements that we've planned I

believe we are I mean the fee pays for
[25:21]
what the fee does it pays for the
[25:23]
maintenance Leasing and the electricity
[25:26]
for all of our street lights and it also
[25:30]
has some money set aside for Capital
[25:32]
and the city has been very aggressive
[25:34]
over the past few years in getting
[25:36]
retrofitted into the different
[25:38]
neighborhoods uh the most recent one was
[25:40]
where we were operating in Alafaya woods
[25:42]
and Twin Rivers was the big retrofit
[25:44]
there and we also did the we couldn't
[25:47]
install the lighting up on the North
[25:49]
side of Lockwood Boulevard
[25:50]
as far as I know as we mentioned in our
[25:53]
staff report
[25:54]
we still need to do Lockwood South
[25:58]
and that's that's another retrofit on
[26:01]
the Lockwood South and then looking at
[26:03]
doing some
[26:05]
conversions in the Oviedo on the Park
[26:08]
area to go to uh to get every all of the
[26:11]
lights to the
[26:13]
um LED because some of the lights in the
[26:15]
video on the park aren't LEDs we need to
[26:17]
get them get them all to LEDs so those
[26:19]
are two of the projects that we need to
[26:20]
do we're still going to be looking at
[26:21]
areas where we don't have lighting so
[26:24]
that we can fill in and but we're doing
[26:28]
it as the um as we have you know Capital
[26:31]
funds available for us to do it uh
[26:33]
thankfully uh
[26:35]
FPL was great right out of the box they
[26:38]
did the East Side they retrofitted the
[26:39]
east side of town everything went to LED
[26:42]
um and Duke took a little bit longer but
[26:44]
now Duke actually has a program similar
[26:46]
to
[26:48]
um
[26:48]
uh Florida FPL they have a similar
[26:52]
program now and so even though the Duke
[26:55]
retrofits crossed a little bit more they
[26:57]
don't cost as much as with initially was
[26:59]
quoted to us so it's easier for us to do
[27:01]
retrofits in the Duke neighborhoods now
[27:03]
as well so yeah I think we are I think
[27:06]
we're right on schedule in getting
[27:07]
getting the different uh upgrades as
[27:09]
well as doing new new capital items okay
[27:12]
are we
[27:13]
solvent as far as you know I look at my
[27:16]
electric bill every month and it's way
[27:18]
higher than it was last year do we have
[27:19]
enough funds to pay the electric bill oh
[27:21]
yes I mean that that is for that is
[27:23]
first the you know like I said

maintenance Leasing and electricity
[27:27]
those are the very first that's the top
[27:28]
priorities with this fund it's
[27:30]
whatever's left over is how much we have
[27:32]

multi-family residential is not a
[30:27]
permissible use within the current
[30:29]
zoning classification and Madeline can

you pull up the maps for us and so we

can see this is basic the the location
[30:36]
if you only you'll need there we go this

is the location of the property it's
[30:40]
obviously it's located south of Winter
[30:41]
Springs Boulevard West of State Route
[30:43]
426 and north of ovina ball Boulevard

its primary access is the new Sugar Mill
[30:49]
Road that's being currently developed by

by the dwell I don't think we could go

use designation is the newly created

designation and the thing about it is

that when you have a zoning

classification zoning classification the

very first thing you ask is is it

consistent with the future land use
[31:10]
designation the OC zoning designation is
[31:13]
not and so uh one of the requests one of
[31:17]
the reasons that the applicant is
[31:18]
requesting the change to R3 is so the R3
[31:21]
is a zoning classification that is
[31:24]
consistent with the properties future
[31:26]
land use designation
[31:28]
manual because the next one all right
[31:30]
one of the other things that you look at
[31:32]
as well is uh is the zoning
[31:34]
classification compatible with
[31:35]
surrounding area well you can see to the
[31:37]
South you've got PUD you've also got
[31:39]
some OC and you've got commercial C2 are
[31:41]
surrounding uh this property and so one
[31:45]
of the things about the arts for the
[31:46]
examine district is that it can be used
[31:48]
as a buffer area for between residential

and Commercial areas so the the R3
[31:54]
zoning district is compatible Madeleine
[31:56]
if you'll go to the next next map you'll

see the R3 zoning District actually is

compatible with the surrounding area

The third question you ask is is the
[32:06]
permissible use is compatible with the

think about the the applicant is
[32:13]
proposing to construct multi-family on

the property there's multi-family to the
[32:18]
South already that's being constructed
[32:20]
in it's also compatible with the
[32:22]
commercial that is to the East and to
[32:24]
the north and so yes the staff in their
[32:27]
analysis did find that the the proposed
[32:30]
uses within the R3 zoning District are
[32:33]
compatible with the surrounding area
[32:36]
and so those those are the basic when
[32:38]
you're looking at a zoning map Amendment

those are the basic tenets that you look
[32:42]
at are whether or not to recommend
[32:45]
approval obviously the staff they their
[32:47]
findings are presented in the supporting

data inventory and Analysis uh they

recommend approval of ordinance not 1736

uh based on the findings in their report

the local planning agency conducted a

public hearing on Tuesday August 1st and

capacity for these students to go

account of that and we're not saying yes

or no at all today so just as a matter

of procedure for all the people in the

room you're hearing stuff about like hey

should we build allow somebody to build

550-something Apartments well why aren't

we voting on that what we're doing is

voting to have a second hearing to vote

about it at another later time

and we had one person come and speak out

[38:51]
adopt what we call the golf cart
[38:52]
ordinance and what this will do this
[38:55]
ordinance establishes that golf carts
[38:57]
will be permissible forms of
[39:00]
Transportation on on city streets that
[39:04]
um
[39:04]
have a posted speed limit of less than
[39:07]
30 miles per hour or less
[39:10]
I it also establishes that the golf
[39:15]
carts can only be operated on the
[39:17]
roadways that are designated and but
[39:20]
they cannot be performed operated on
[39:22]
state or County roadways unless they are
[39:25]
crossing at a signalized intersection
[39:28]
there are some streets that we did say
[39:30]
yes they can't be used on they're mainly
[39:32]
our primary roadways uh I know it was
[39:36]
mentioned about Chapman Road Chapman
[39:37]
Road East which is a local Street and
[39:40]
has a speed limit of 25 it's eligible
[39:43]
it's Chapman Road West that goes from
[39:45]
434 to 426 which is four lanes and has a
[39:48]
speed limit of 40 that we said no don't
[39:51]
operate on that one so
[39:54]
um
[39:55]
I remember that was mentioned as well
[39:57]
and so we also have requirements that
[40:00]
you need to have a driver's license or a
[40:03]
learner's permit
[40:04]
and that the if you do have a learner's
[40:07]
permit then you have to have somebody
[40:08]
who is 21 or older and has a driver's
[40:11]
license sitting next to you while
[40:13]
operating the um
[40:15]
operating the golf cart golf carts also
[40:17]
if you to be operated on private
[40:19]
property they have to have the owner's
[40:21]
permission to be operated on the private
[40:22]
property and that they are not operate
[40:24]
authorized to be operating on the
[40:26]
sidewalks or the bicycle pass or the
[40:29]
trails our Trails have regulations that
[40:32]
you can't put a motorized vehicle on
[40:33]
them unless it's like the county doing
[40:35]
maintenance on it so tonight is the

first reading of the ordinance and it is

recommended that the city council

what we are doing is any different from

the state level law other than the state

level law did mention that we have to
[41:36]
designate certain roads as safe like it
[41:38]
seems like we can designate additional
[41:40]
roads and safe Beyond
[41:42]
what the state law says and I'm
[41:45]
scrolling through because I asked a
[41:47]
couple of yes no questions related to
[41:49]
this item and I'm scrolling through just
[41:50]
to make sure that I understood some of
[41:52]
the the questions how they were answered
[41:55]
and so Madam mayor I was the one that
[41:58]
that brought this this subject up
[42:00]
initially and the the reason I brought
[42:02]
this up was because it's very difficult
[42:05]
to register a golf cart you have to get
[42:08]
a VIN number
[42:10]
um you you know basically what this
[42:12]
ordinance is doing is
[42:15]
putting all the same state level
[42:18]
standards correct me if I'm wrong Chief
[42:20]
but it's basically putting all the same
[42:22]
state level standards on the golf cart
[42:24]
with the exception of actually having to
[42:26]
get that VIN number and you know to to
[42:29]
get a license tag number so instead of
[42:31]
getting a tag for it you get a you you
[42:34]
get the the city you know permit for it
[42:38]
but it's basically the same thing
[42:41]
without having to spend all the money on
[42:43]
getting the VIN number and everything
[42:45]
we are taking on the city would be taken
[42:48]
on all of the safety checks all of the
[42:49]
everything else it seems like it we're
[42:52]
biting off an awful lot and the state
[42:54]
already
[42:55]
kind of volunteers to do that for us
[42:58]

um
[43:04]
uh councilmember you're pretty close on
[43:07]
that we followed the state statute on
[43:09]
what a low-speed vehicle would be we
[43:11]
added a few things one of them statute
[43:14]
was just changed to require a driver's
[43:16]
license uh for somebody over the age of
[43:20]
our learner's permit we incorporate that
[43:23]
early on because basically we want
[43:25]
somebody to have some Driving Experience
[43:27]
preferably a driver it also prevents
[43:29]
somebody who may have a DUI and not have
[43:32]
a driver's license they they cannot
[43:34]
drive one of these on the city streets
[43:35]
as well
[43:36]
uh uh we incorporated a few more
[43:39]
safety features I would call it uh like
[43:42]
if you have small children we require or
[43:44]
improved child carrier per child animals
[43:48]
should be securely fastened we'll leave
[43:50]
that up to the owner but if we do
[43:52]
require them to be
[43:53]
restrained securely it doesn't require
[43:57]
registration if you're going to drive it
[43:59]
at night you got to have lights
[44:00]
headlamps and things of that nature so
[44:03]
it is very similar to the low speed
[44:05]
vehicle but as you said it does not
[44:07]
require
[44:09]
somebody to have to take it to the DMV
[44:11]
to get it registered and inspect it
[44:14]
we're going to require them to do their
[44:16]
own Inspections just like you do your
[44:17]
own motor vehicle uh you know used to we
[44:21]
did inspections in Florida if you've
[44:22]
been here long enough but we don't do
[44:23]
that anymore you basically ascertain
[44:25]
your vehicle is roadworthy and if it's
[44:28]
not we stop you we could you can be
[44:30]
cited for it as well the same thing here
[44:33]
if you're either there'll be a check off
[44:35]
list that you you'll attest to that you
[44:38]
have this equipment and uh and we'll
[44:42]
we'll go in good faith that that's what
[44:43]
you have and if you're seeing driving
[44:45]
without it you could be cited well
[44:48]
um get prohibited on sidewalks same same
[44:50]
rules apply as the lbv or low speed
[44:53]
Vehicles no sidewalks has to be on the
[44:55]
streets it has to be under 30 miles an
[44:56]
hour
[44:57]
so
[44:59]
do we have a a number in mind for what
[45:02]
we would charge people to get this
[45:04]
thing that lets them not have to get
[45:05]
event that's not my uh area I don't know
[45:09]
I don't have a number no but uh I
[45:11]
figured that would be figured on after
[45:14]
everyone once the ordinance or at a
[45:17]
later time Chief I I see golf carts all
[45:20]
over my neighborhood how are you
[45:22]
enforcing the rules on those
[45:25]
uh we're not we're not going to be we're
[45:27]
not heavy-handed on them because
[45:28]
basically uh you're right most
[45:31]
neighborhoods they're in them I don't
[45:33]
know of a neighborhood that you're not
[45:34]
uh and people a lot of people just
[45:36]
assume they are legal and this makes it
[45:39]
legitimate otherwise right now it's
[45:41]
state statutes and it's actually
[45:42]
criminal in some cases where if you're
[45:44]
letting a 14 year old driver unlicensed
[45:46]
motorized vehicle on a roadway that is a
[45:48]
criminal offense and I don't think any
[45:51]
parent needs to have that you know
[45:53]
allegation to charge to them so we do a
[45:55]
lot of warning a lot of warning but like
[45:57]
most times parents don't always listen
[45:59]
to uh to the direction
[46:01]
this makes it an easier path to get that
[46:03]
done so they don't have the argument
[46:05]
that council member Pollock said where I
[46:08]
don't I don't have time I don't have the
[46:09]
effort to go get it registered at the
[46:11]
DMV I don't know you know get a VIN
[46:13]
number for it so this makes it a much
[46:16]
easier process it's coming through
[46:17]
getting getting the registration and
[46:20]
playing it on but applying it to the
[46:23]
golf cart
[46:26]
and the city gets fees for this as
[46:30]
opposed to if DMV the DMV soon
[46:35]
keep this one last thing in the uh in
[46:38]
the staff report talked about uh the
[46:39]
traffic surveys that were done um we're
[46:41]
here to one resident that was asking
[46:43]
about that is that coming from the
[46:44]
Planning Group in the traffic studies do
[46:47]
you know about the traffic studies
[46:49]
uh the
[46:51]
we don't have a defined traffic study we
[46:53]
looked at traffic studies there's
[46:55]
traffic places that have done the same
[46:58]
thing we've reached out to them in
[46:59]
several of the Cities Stanford's a good
[47:01]
example uh how well is their program
[47:03]
working what do they have problems with
[47:05]
and and several other jurisdictions I
[47:08]
think DeBerry was either looking at it
[47:09]
or now has it and looking at what would
[47:11]
what do they recommend and every one of
[47:14]
them said you know keep them in
[47:16]
basically the neighborhoods are off off
[47:18]
busy thrower Affairs even if you can and
[47:21]
you know nobody's had any major issues
[47:25]
like any other motorized vehicle if you
[47:27]
got the wrong person driving it bad
[47:28]
things can happen but they're generally
[47:30]
a little bit more cognizant of the
[47:32]
vehicles around them because one they're
[47:34]
open air you know and they're not
[47:36]
they're not they're able to hear
[47:37]
everything but they're also know that
[47:39]
they're the smaller it's kind of like
[47:40]
being a bicyclist on the road I think
[47:42]
you could relate to that you pay a lot
[47:44]
more attention to what's going around
[47:45]
you than you do if you're the the the
[47:47]
truck on the road like a Dodge truck or
[47:50]
something you know on the roads
[47:51]
uh and and so they not really had
[47:55]
anywhere we found of any major there's
[47:57]
always going to be the crash there's
[47:59]
always going to be somebody that did
[48:00]
something but as a general rule they
[48:02]
provided a pretty safe Avenue to
[48:05]
transport around town
[48:07]
I guess one last question on on the
[48:10]
and it's a great point about having
[48:11]
underage kids that drive drive the
[48:13]
vehicles I do see it you know in similar
[48:16]
neighborhoods that I go through I guess
[48:17]
my question would be obviously we'll do
[48:19]
whatever you can you know once we get
[48:21]
past a hearing if it does pass us to
[48:23]
communicate it but not everybody sees
[48:25]
the communications those individuals
[48:27]
that are pulled over the first time is
[48:29]
it a warning is it a citation right away
[48:31]
I mean how do you handle the underage
[48:33]
kids that are driving them the underages
[48:36]
have a a conversation with the parents
[48:38]
and say look this is the warning it's
[48:41]
going to get very expensive if you
[48:42]
continue this on we're trying to keep
[48:44]
your kids safe in the neighborhood safe
[48:47]
they're not allowed because most of the
[48:49]
time they're with their friends and
[48:50]
they're driving generally on the
[48:53]
sidewalk right you know what I would
[48:54]
consider recklessly but not maybe you're
[48:56]
a hazard to health but a hazard to
[48:58]
everybody else we're not going to be
[49:00]
tolerant of it I can tell you that we'll
[49:01]
try to get compliance first but if it
[49:04]
shows that we've we've been out with
[49:05]
them before they'll probably get cited
[49:08]
and um and see where it goes from there
[49:10]

back in 2017 we adopted a golf cart
[49:16]
ordinance and my understanding is not a
[49:18]
single person registered so it sends it
[49:20]
automatically what

is different now that we think people

going to push the registering people
[49:31]
will continue just to drive the golf
[49:32]
carts as they have since 2017. we will
[49:35]
probably start an education process
[49:37]
where if we see golf carts on the road
[49:38]
that aren't registered we'll stop them
[49:40]
and inform them they need to be
[49:41]
registered it would be a citable offense
[49:43]
again much a very expensive citation
[49:46]
because that's a state citation
[49:49]
um and to gain the compliance the other
[49:52]
thing is then it was only on the east
[49:55]
side of Lockwood so effectively if you
[49:57]
weren't
[49:58]
uh you didn't live in the golf course
[50:00]
half of Twin Rivers it was not useful to
[50:02]
you but you couldn't you couldn't go go
[50:05]
anywhere but there but if you're in Mead
[50:08]
Manor you can go all of mead Manor you
[50:10]
know your sub like Live Oak as an
[50:12]
example they could go up to Publix are
[50:15]
you saying with a new proposal correct
[50:16]
okay because my understanding is they
[50:18]
can go beyond that you can go as far as
[50:20]
your battery will take you or your I
[50:22]
guess you could get a gas powered golf
[50:23]
cart as far as there's a 30 mile an hour
[50:25]
correct exactly you're like you can't go
[50:27]
down Lockwood so anybody Twin Rivers
[50:29]
going could not drive down the window
[50:30]
but you can Crossroads correct you had a
[50:33]
signalized intersection
[50:35]
so that that's that's okay and the
[50:38]
reason is that's the safest way to cross
[50:39]
the street so there are boundaries so
[50:41]
you can go only within your neighborhood
[50:43]
and then once you hit 419 you're out of
[50:45]
luck correct you can't just go alongside
[50:47]
it unless and until we are able to build
[50:50]
a golf cart so there's a pathway to get
[50:53]
there legally okay we looked at every
[50:56]
subdivision and see how far they could

going so and the goal was kind of look

at Oviedo in the park and see how how
[51:35]
many people could get to there they had
[51:37]
a golf cart like for instance a meat
[51:39]
Manor is a good example they can get
[51:40]
there you can come down Division Street
[51:43]
to Oviedo Boulevard uh you know through
[51:45]
the roundabout crossover 419 at the
[51:47]
light and make it all the way to Oviedo
[51:49]
Boulevard I mean all the way to Oviedo
[51:50]
in the park without
[51:52]
legally if you're in Alafaya Woods you
[51:55]
can get to uh Oviedo on the park because
[51:57]
you can come down Alexandria to clearly
[52:00]
to uh to again crossover and you're in
[52:03]
Oviedo in the park and that's kind of
[52:04]
what the focus point was when we were
[52:06]
looking at it because that's where our
[52:07]
events are and things so they could make
[52:10]
it to there not every subdivision is
[52:12]
going to I mean the majority of
[52:14]
subdivisions can't make it there but as
[52:15]
many as we could make it there is how we
[52:17]
were looking at it
[52:19]

land use plan for the Lockwood Village

shopping center
[53:15]
all the sea sections 2.5 is 7 and 11
[53:19]
state that the city council shall have
[53:22]
final
[53:23]
authority over development agreements in
[53:26]
muscle induce plan
[53:29]
um
[53:29]
if we can move to the next step thank
[53:32]

[53:34]
um this the subject project property is
[53:37]
approximately 7.7 Acres along this side
[53:42]
of Lockwood next to the intersection
[53:45]
with Mitchell hammock
[53:47]
it is uh
[53:50]
part of the Twin Rivers PUD
[53:53]
so the future land use is beauty the
[53:55]
zoning is also PUD and the proposed used
[54:00]
users are in accordance with the C2
[54:03]
zoning District
[54:05]
the idea is to create so this is the
[54:09]
parcel the big part of the shopping
[54:11]
center where where you have the
[54:13]
Winn-Dixie supermarket and the idea is
[54:16]
to create two Lots now
[54:19]
so you have lot one which is the
[54:21]
remaining shopping center at around
[54:23]
seven acres
[54:25]
in log 2 is going to be carved out of
[54:28]
the Big Lot for a proposed restaurant
[54:30]
for the Longhorn Restaurant if you can
[54:33]
move to the next one
[54:35]
so this is the site
[54:38]

[54:44]

yeah so this is the the Longhorn
[54:48]
Restaurant being proposed so it's
[54:51]
carving out from the big parcel
[54:54]
the access points remain the same

and it's just

um a reorganization of the site

so this is the site this is the
[55:09]
um
[55:11]
we can move forward this is the site
[55:13]
plan so you have the longhorn now with
[55:16]
some parking around it so there was just
[55:20]
the rearrangement of the parking area
[55:23]
moving forward the development agreement
[55:27]
um the entitlements are not being
[55:29]
changed so they are within the Pud
[55:32]
parameters that were approved as I said
[55:35]
the permissible uses are going to be the
[55:37]
ones according to the C2 it's just a
[55:39]
single phase project and the development
[55:42]
agreement allows for modifications for
[55:44]
standards to be negotiated while we're
[55:47]
on this slide can you let us know the
[55:48]
year in which the original development
[55:50]
agreement was approved
[55:53]
I do know by 19 like 1990 something yeah
[55:58]
1987. okay thank you I think it's
[56:00]
rounding there
[56:02]

know it's it's been a while but I would
[56:06]
not know exactly the date the
[56:09]
modifications so for the buffer it's we
[56:12]
are just so we're keeping the 20 feet
[56:15]
um buffer around but internally between
[56:18]
the two lots we are excluding the buffer
[56:21]
requirements because that doesn't would
[56:22]
not make sense the open space is not
[56:25]
being reduced so it's still 30 percent
[56:27]
overall in the Pud and actually in this
[56:30]
particular site they are increasing the
[56:32]
open space because they are turning
[56:34]
parking spaces into there is now some
[56:37]
landscape areas so they are increasing
[56:38]
the open space
[56:40]
um there are some deviations for
[56:44]
landscape islands and
[56:47]
these are just really minor deviations
[56:50]
from the code if you can move forward
[56:54]
um
[56:55]
the parking size space for the for the
[56:59]
the whole development is being kept the
[57:02]
same and the parking
[57:06]
counts has been reduced right because
[57:09]
now we are creating this restaurant in
[57:11]
the in the parking lot so what they are
[57:14]
providing now is 272 parking spaces and
[57:17]
there is a slide showing you know this
[57:19]
the the breakdown
[57:21]
the loading the parking space size is
[57:25]
still the same but the parking space
[57:27]
number is less yeah the size is the the
[57:31]
is the footprint the footprint so they
[57:34]
have a weird number which is I think
[57:37]
it's um
[57:38]
um
[57:40]
10 by 18. so our our regular 10 by 20
[57:45]
per code
[57:47]
in their development agreement they
[57:49]
already had a different in a difference
[57:51]
from our code and we are moving because
[57:54]
we are rewriting the code we are moving
[57:56]
to the compact which today what is
[57:58]
considered compact
[58:00]
which actually is the standard in other
[58:02]
jurisdictions which is nine it's nine by
[58:04]
18. so we are keeping the same you know
[58:07]
the the number for the for lot one lot
[58:11]
two is proposing I think a different one
[58:13]
but the packing space is the number of
[58:16]
spaces have been reduced and do they
[58:19]
still meet the space requirement the
[58:22]
parking requirements I will show the
[58:24]
next led the slide will have a a
[58:26]
breakdown of those
[58:29]
um the loading area it's being used for
[58:32]
the parking space so the loading is
[58:35]
going to be off hours we are also
[58:38]
removing the requirement because there
[58:39]
is no spillover from lighting and when
[58:44]
you have Parcels but because they are
[58:46]
internal and they have you know Common
[58:48]
parking spaces and parking lots we a lot
[58:51]
we are removing those and they have the
[58:55]
lot too which is longhorn requested an
[58:58]
allowance of 2.5 square feet of building
[59:00]
signage for each building Frontage
[59:05]
with a maximum of six signs
[59:08]
the lot one which is the remaining
[59:12]
shopping center is going to also have a
[59:15]
tree restoration to kind of restore a
[59:18]
little bit the side because with the
[59:19]
years some trees are are you know bad
[59:24]
and been replaced Etc so they are going
[59:26]
to restore
[59:28]

um well the next steps they have a
[59:35]
non-state story
[59:37]
um subdivision and they're reviewing a
[59:39]
site development order uh already under
[59:42]
the under review and the architecture
[59:45]
has already been approved
[59:46]
there should be a slide for can you move

well this is the land LPA
[59:53]
recommendations we should have one for
[59:55]
the parking count
[59:57]
no so I can explain the parking count we
[1:00:01]
have two numbers we have the number that
[1:00:04]
was originally approved which is 300
[1:00:07]
parking spaces and then with the new so
[1:00:10]
what we're doing is that you're removing
[1:00:12]
parking spaces and putting a restaurant
[1:00:14]
a restaurant demands for more parking
[1:00:16]
right so the new parking account would
[1:00:19]
be
[1:00:19]
350 something uh parking spaces that
[1:00:23]
would be the new one
[1:00:24]
required for the code today
[1:00:27]
we are again we are reviewing the code
[1:00:29]
in the LDC and we are going to be
[1:00:33]
reducing those numbers because
[1:00:36]
usually we over Park you know the the
[1:00:41]
the standard to provide for peak days
[1:00:44]
right for Christmas for days that you
[1:00:47]
know there is a lot of demand for
[1:00:49]
shopping centers so we are kind of now
[1:00:52]
bringing more to reality because you
[1:00:55]
know we did not want to have a lot of
[1:00:57]
parkings a lot of area designated to
[1:01:00]
parking spaces
[1:01:01]
so this what they are providing today
[1:01:05]
which is 273 is a 24 deviation for what
[1:01:09]
the code would require
[1:01:11]
and that is I had a slide there for this
[1:01:14]
breakdown
[1:01:15]
and but it's basically a 24 deviation
[1:01:20]
so that is that is the major you know uh
[1:01:24]
you know in a way deviation that they
[1:01:25]
are requesting from the codes
[1:01:27]
so with this being two separate lots are
[1:01:35]
we going to get into a situation like we
[1:01:36]
have over here at Oviedo on the park
[1:01:38]
where this is their parking and this is
[1:01:41]
their part no it's a shared parking
[1:01:42]
agreement so they have cross access
[1:01:44]
easements in a shared parking agreement
[1:01:46]
that's part of the development agreement
[1:01:48]
so everybody can park anywhere
[1:01:51]
there isn't a longhorn
[1:01:53]
you know specific parking and there
[1:01:56]
isn't the rest you know
[1:02:03]

prioritizing infrastructure over
[1:02:37]
development to allow for the smart and

sustainable growth of Obito it is not a
[1:02:42]
question but a fact that oviedo's
[1:02:44]
roadways are stressed we see over 20 000
[1:02:47]
cars pass through the city every day by
[1:02:49]
fdot reports Lockwood alone has an
[1:02:51]
annual average daily traffic count of
[1:02:53]
over 17 000.
[1:02:55]
we can see all the traffic backups at
[1:02:57]
the Lockwood and Mitchell hammock
[1:02:58]
intersection just as well as the
[1:02:59]
Lockwood and Broadway intersections
[1:03:01]
whether that's a car stopped in the
[1:03:03]
middle of the intersection waiting to
[1:03:04]
turn Northbound onto Lockwood or if it
[1:03:06]
is the inability of a car to turn across
[1:03:09]
the southbound Lanes into the Northbound
[1:03:10]
Lanes the traffic on Lockwood is rough
[1:03:13]
putting some numbers on this claim at
[1:03:16]
the intersection of Lockwood and
[1:03:17]
Mitchell hammock there have been 24
[1:03:18]
traffic crashes in the last 12 months
[1:03:21]
the most recent being less than a month
[1:03:23]
ago
[1:03:24]
even worse the intersection of East
[1:03:26]
Broadway and Lockwood has seen 66
[1:03:28]
traffic crashes in the same time period
[1:03:31]
the most recent being today
[1:03:34]
our roadways are ill-equipped for
[1:03:36]
increased traffic flow is an
[1:03:38]
understatement
[1:03:39]
our roadways can barely withstand our
[1:03:41]
current volume and the addition of a
[1:03:42]
LongHorn Steakhouse on Lockwood
[1:03:43]
Boulevard will undoubtedly exacerbate
[1:03:46]
the issues we are already facing on our
[1:03:48]
streets even if this council is
[1:03:50]
incapable of voting down this Longhorn
[1:03:52]
development it should not go without
[1:03:54]
saying that it is not in the best
[1:03:56]
interest of the community to continue
[1:03:57]
the pace of development in the city I
[1:04:00]
implore you all to stop and reflect on
[1:04:02]
the impact development has beyond the
[1:04:04]
monetary
[1:04:06]
it can damage our community identity our
[1:04:08]
way of life and our safety I further ask
[1:04:11]
that this Council and the city officials
[1:04:13]
gathered here tonight
[1:04:15]
strongly consider hosting public forums
[1:04:17]
and appropriate actionable civil
[1:04:19]
discourse with our local business owners
[1:04:21]
local residents and local groups Beyond
[1:04:23]
those during a city council meeting many
[1:04:26]
individuals are simply unaware or
[1:04:28]
unprepared to voice their concerns in a
[1:04:30]
manner that will be able to Spur change
[1:04:31]
in the community and I truly believe
[1:04:34]
that is unfair in my heart of hearts our
[1:04:37]
role as public servants
[1:04:39]
in the words of the Constitution is to
[1:04:41]
establish justice provide for the common
[1:04:42]
defense and promote the general welfare
[1:04:44]
this comes in many forms and at its core
[1:04:46]
it is ensuring the public is informed
[1:04:48]
enough to be able to make informed
[1:04:50]
decisions and offer direction to its
[1:04:52]
public officials to enact change it
[1:04:54]
deems appropriate I fully recognize the
[1:04:57]
burden you all Face In Your Capacity as
[1:04:59]
council members and I respect you all
[1:05:00]
for putting yourselves in that position
[1:05:01]
to make tough decisions but as we look
[1:05:04]
forward looking towards tomorrow and
[1:05:07]
next week and next year we have to
[1:05:09]
accept that each of the actions and
[1:05:10]
inactions
[1:05:12]
we take will all affect us in one way or
[1:05:14]
another I do not envy you for the
[1:05:16]
decisions you have to make nor do I hold
[1:05:17]
any ill will against any of you for what
[1:05:19]
is at the end of the day just business I
[1:05:21]
do however ask that you listen to the
[1:05:23]
concerns of the citizens to ensure that
[1:05:25]
this kind of commercialization of our
[1:05:26]
great city does not continue beyond
[1:05:29]

speaking to you on behalf of my family's
[1:05:57]
restaurant Cafe panuzos we have been
[1:06:00]
lucky enough to serve our Oviedo
[1:06:01]
community and have proudly done so for
[1:06:03]
the last 15 years we are most definitely
[1:06:06]
a family business my dad is the chef my
[1:06:08]
sister and cousin are servers my baby
[1:06:10]
brother is a host and we think of the
[1:06:12]
rest of our staff as family too
[1:06:14]
as I'm sure you can imagine we are
[1:06:16]
deeply concerned about the proposed
[1:06:18]
Longhorn development while we recognize
[1:06:20]
we cannot stop the development due to
[1:06:22]
the land zoning in the plaza I wanted to
[1:06:24]
present my concerns to you for remedy
[1:06:26]
unfortunately we were not notified of
[1:06:28]
this impending construction with any
[1:06:29]
advance notice so we were incapable of
[1:06:31]
raising our concerns throughout their
[1:06:33]
application and planning process if you
[1:06:36]
refer to tonight's packet under the
[1:06:37]
exhibits for resolution
[1:06:39]
436423 you will notice that the longhorn
[1:06:42]
faces away from panuzos therefore
[1:06:44]
panuzos will be in full view of
[1:06:46]
LongHorn's back facade although we
[1:06:49]
recognize that they will provide some
[1:06:50]
fencing and hedging around the dumpsters
[1:06:52]
and back door this does not mean that it
[1:06:54]
will not affect our own business under
[1:06:55]
its current orientation
[1:06:58]
having been in the restaurant industry
[1:06:59]
for well over a decade we know that no
[1:07:02]
amount of fencing will stop the smell
[1:07:03]
from radiating outward this in
[1:07:06]
conjunction with flies employees on
[1:07:07]
break behind the restaurant and the
[1:07:09]
inevitable influx of Scavenging birds
[1:07:11]
all have the potential to affect our
[1:07:13]
patio business which is very prominent
[1:07:15]
for most of the year in addition to our
[1:07:17]
general foot traffic we know our food
[1:07:19]
simply won't be as appetizing to patrons
[1:07:21]
with the smell of a dumpster at our
[1:07:23]
doorstep to be clear we want to be
[1:07:25]
supportive of a growing Oviedo but we
[1:07:27]
want to ensure that the growth and
[1:07:29]
development is Equitable for all the
[1:07:30]
affected parties that said we would like
[1:07:33]
to please ask for your help and
[1:07:34]
consideration regarding the orientation
[1:07:36]
of the restaurant we are asking that the
[1:07:38]
freestanding development be rotated 90
[1:07:40]
degrees clockwise or counterclockwise to
[1:07:43]
reduce the potential impact on our
[1:07:44]
family business if rotating the business
[1:07:47]
is not an option we would at the very
[1:07:49]
least request the dumpsters be relocated
[1:07:51]
to another part of the proposed lot
[1:07:54]
we know just as well as LongHorn
[1:07:55]
Steakhouse that when it comes to the
[1:07:57]
service industry Impressions matter this
[1:08:00]
includes the quality of the food the
[1:08:01]
quality of the staff and the overall
[1:08:03]
appearance of the restaurant inside and
[1:08:05]
out we feel as though if the tables were
[1:08:08]
turned and we were proposing a
[1:08:09]
restaurant to be constructed in front of
[1:08:11]
a longhorn they wouldn't be happy if our
[1:08:13]
dumpsters fenced or not were at their
[1:08:15]
front entrance likewise we don't believe
[1:08:17]
it's fair that our visibility to and
[1:08:19]
from Lockwood will now be separated by a
[1:08:21]
building with a view of fenced-in
[1:08:22]
dumpsters and hedges
[1:08:24]
we fully recognize that this is a big
[1:08:26]
ask of you but we do truly feel like
[1:08:28]
this is about a big enough issue for our
[1:08:30]
business that it should be considered
[1:08:31]
for resolution my family has loved
[1:08:34]
contributing to Oviedo and we are
[1:08:36]
forever grateful for the opportunities
[1:08:37]
this city has presented us we want to be
[1:08:40]
able to continue that tradition of love
[1:08:41]
and Community for many years to come and
[1:08:43]
we hope that you council members will
[1:08:45]
help maximize our chance to do that
[1:08:47]
alongside our new neighbors thank you

you of your own free will ask the

building owner to think about it I'm

saying the plaza owner again the plaza
[1:10:15]
owner yes or are they open to I don't
[1:10:17]
think they care where it is I mean
[1:10:20]
Longhorn cares where it is in this case
[1:10:21]
I would recommend that they speak with
[1:10:23]
their tenant on their concerns but we
[1:10:26]
have
[1:10:27]
that owner of the Plaza's concern so
[1:10:30]
what's your role in this

um we're with Longhorn the development
[1:10:34]
yes and then the person who is signing
[1:10:37]
this nsda is the owner of the plaza in
[1:10:39]

so are any of those people in the room

we don't have the
[1:10:48]
um the property owner at this time we do
[1:10:50]
have a gentleman here that used to be
[1:10:52]
the property owner um and they're the
[1:10:54]
developer for this as well

um but I mean Harris can speak to it as
[1:10:58]
well they are signing this nsda they
[1:11:00]
have reviewed our site plans they are in
[1:11:02]
full consent of this okay

bizarre situation uh it does look like

to address the extent to which we are
[1:11:19]
required to agree to deviations

the ability to put something of the
[1:11:29]
shape and footprint of Longhorn already
[1:11:31]
existed that is not a dispute at this
[1:11:34]
time it sounds like there is some leeway
[1:11:38]
being suggested from staff
[1:11:41]
with regards to the parking spaces so we
[1:11:43]
don't have to agree to that the
[1:11:45]
developers agreement
[1:11:46]
shifting within that module
[1:11:50]
then this is a question for our attorney
[1:11:52]
we have we do not have discretion to
[1:11:54]
shift within the limits of the
[1:11:57]
developers agreement is that correct
[1:11:58]
because it's a sort of a quasi-judicial
[1:12:00]
thing
[1:12:03]
a question I'd have to do a little
[1:12:04]
research to get you the best answer on
[1:12:06]
that okay so where'd this is going to my
[1:12:09]
brain is we may need to table this until
[1:12:11]
we have more of these answers
[1:12:14]
because I think we've got deviations
[1:12:16]
that we don't have to Grant
[1:12:19]
possibly and if we don't have to grant
[1:12:21]
them and an existing person has made a
[1:12:26]
kind of a reasonable request even if the
[1:12:28]
property owners all agree
[1:12:31]
maybe we could have a discussion about
[1:12:33]
it anyway mayor I'll be honest it's
[1:12:35]
unfortunate that this was not brought to
[1:12:37]
the attention of Staff either like a
[1:12:40]
long time ago because last time you
[1:12:42]
could have just we could have because I
[1:12:44]
think relocating a dumpster it's much
[1:12:47]
easier than
[1:12:49]
um you know shifting Shifting the
[1:12:51]
building right that can happen yeah that
[1:12:53]
would be completely different it would
[1:12:55]
be a different lot it would be a
[1:12:56]
different you know configuration it
[1:12:58]
changed the whole thing changing a
[1:13:01]
dumpster is an easier right I know the
[1:13:04]
architecture was already approved so we
[1:13:06]
already had that being discussed in the
[1:13:08]
previous meeting that was in June but
[1:13:11]
it's an easier you know configuration or
[1:13:14]
change in a plan especially in so in the
[1:13:17]
property owner so this was not
[1:13:20]
advertised to the tenants because we
[1:13:22]
have the property owner authorization he
[1:13:24]
was the one applying right so um and
[1:13:27]
that is the reason why we we would not
[1:13:30]
you know the city is not obligated to to
[1:13:33]
but everything we do is it's on the on
[1:13:35]
public records but um
[1:13:38]

so I mean staff would be willing to to
[1:13:43]
look at the site and see if there is any
[1:13:45]
other proposal for a dumpster location
[1:13:48]

plan we do have a limited lot space and

we don't have the ability to go to that
[1:14:30]
property owner in the rear because we
[1:14:32]
are selling out this prop parcel and
[1:14:34]
having a dumpster shared onto their lot
[1:14:36]
that's something that they wouldn't
[1:14:38]
agree to because then you would have
[1:14:40]
tenants you know walking through to the
[1:14:42]
rear of the other building for the
[1:14:45]
dumpster situation um so we are
[1:14:46]
providing dumpster enclosure meeting
[1:14:49]
oral architectural and legac
[1:14:51]
requirements all of our Landscaping
[1:14:54]
except for two islands which is due to
[1:14:56]
existing lighting fixtures is also
[1:14:58]
meeting Land Development code and then
[1:15:01]
the only deviations is in regards to
[1:15:03]
parking in those small items that she
[1:15:05]
brought up before we did do full parking
[1:15:07]
study as well as a traffic study and we
[1:15:09]
are within ite trip generation and
[1:15:12]
parking generation for this project at
[1:15:13]
maximum hours can you point on this or

dumpsters proposed to be yes

and you can see the gates in front of it

and then the wall on all sides and then

mean and that was horrible if that

that that would that would really be
[1:16:29]
detrimental to to the neighbors so in

concerns in regards to

um that how they care for the dumpster

can also become a Florida department of

adamant about their kitchen safety as

before I got your a conditional use
[1:21:03]
permit which is today's site development
[1:21:05]
order that was done for the shopping
[1:21:06]
center

and so those were done the the
[1:21:10]
the development agreement for Twin
[1:21:12]
Rivers basically says it's C2 it follows
[1:21:14]
C2 and that's really all it says doesn't
[1:21:16]
get into the detail that we get into
[1:21:18]
nowadays with our non-statutorial
[1:21:20]
development agreements when you're doing
[1:21:21]
a non-state 40 development you're
[1:21:23]
establishing minimum standards you're
[1:21:25]
not really doing deviations yes they
[1:21:27]
look like deviations because it's
[1:21:29]
something different from what's in our
[1:21:30]
code but for this property you're
[1:21:32]
actually setting minimum standards for
[1:21:34]
that this applicant did us like with the
[1:21:37]
parking this applicant did a study they
[1:21:40]
said that there was there was capacity
[1:21:42]
to accommodate the lesser of the Lesser
[1:21:45]
thing across the entire property this
[1:21:47]
does encompass the entire the shopping
[1:21:49]
center as well as the long part it
[1:21:50]
encompasses everything they did as
[1:21:52]
parking study the parking study said
[1:21:54]
that there was adequate parking to
[1:21:56]
accommodate the restaurant as well as
[1:21:58]
the shopping center they did a traffic
[1:21:59]
study as well they really didn't have to
[1:22:01]
do a traffic study because that was all
[1:22:02]
taken care of during the approved back
[1:22:05]
in 1987 with the approval of Twin Rivers
[1:22:08]
uh so but you can continue it if you
[1:22:11]
have questions yes that's within your
[1:22:13]
your authority to say we would like to
[1:22:15]
continue this then make sure it's to a
[1:22:17]
date certain so that then we can get we
[1:22:19]
can get the answers to your questions

for you and get that put back in we have

enhance to to

trying to to disguise right or to try to

buffer or like get some fans that have
[1:24:05]
to blow towards Longhorns or something I
[1:24:07]
don't know we we can work on that so I
[1:24:10]
don't know if um because if it's a
[1:24:13]
completely rearrangement of the site
[1:24:16]
then it's going to be very hard to come
[1:24:18]
in September 7th right it feels like
[1:24:21]
it's going to be beautiful can Longhorn
[1:24:23]
agree to put fans blowing any potential
[1:24:27]
smells well
[1:24:28]
that's not it I mean we're not Engineers
[1:24:31]
here but that's something all we're
[1:24:34]
trying to do is we we know that there's
[1:24:36]
a there could be a new sense caused by
[1:24:39]
the dumpsters and we need to find a way
[1:24:40]
a solution to resolve that nuisance but
[1:24:44]
we're allowed to put that in this type
[1:24:46]
of document that's what I'm saying this
[1:24:48]
is such a flexible malleable document we
[1:24:51]
can put these things in it and it could
[1:24:54]
directly address the one concern

that I I think we can probably address

this late in the game which is the smell

yes so the application comes it's an
[1:29:45]
nsga in a conceptual development plan
[1:29:47]
right this document the 21 Pages not the
[1:29:50]
final one but in the final one not but
[1:29:54]
the proposal the application to start
[1:29:56]
the process yes the thought to create a
[1:29:58]
21-page or so document that began in
[1:30:01]
2021. at what point did was there a
[1:30:04]
draft of what we're looking at now the
[1:30:06]
21 pages
[1:30:09]
the the current draft that we have
[1:30:11]
or some something kind of close to it
[1:30:14]
that would have
[1:30:15]
said what the buffers were and all these
[1:30:18]
things
[1:30:19]
the documents changed over time so the
[1:30:23]
most recent where it was close to this
[1:30:26]
version is probably back in May or June
[1:30:28]
of this year okay so three four months
[1:30:30]
maybe yeah and and since then there's
[1:30:33]
been some tweaks in language and back
[1:30:35]
and forth to make sure that the
[1:30:37]
development agreement reported to the
[1:30:39]
Twin Rivers ped and some other issues
[1:30:41]
that we need to go ahead and iron out as
[1:30:43]
far as you know having the proper owner
[1:30:45]
and you know little items that we have
[1:30:48]
to iron out to make sure that it's ready
[1:30:49]
to go to the land planning agency and
[1:30:51]
city council okay
[1:30:55]
mayor if I may that there is no site
[1:30:58]
plan at the moment that's submitted so
[1:31:01]
you it is possible if the council once
[1:31:04]
wishes to put
[1:31:06]
um conditions on the approval of what's
[1:31:09]
before you tonight that's that is an
[1:31:11]
option if you would like to do that and
[1:31:13]
then you can address the further
[1:31:15]
concerns in the site plan approval but
[1:31:17]
would this site plan necessarily come
[1:31:19]
before us they don't have to correct as
[1:31:22]
long as there's no deviations
[1:31:24]
this is back to the thing we already had
[1:31:26]
an issue with so I don't want us to get
[1:31:28]
stuck in a spot where this is our last
[1:31:30]

what would I think is a reasonable

to Outsourcing

concessions operations at Oviedo Sports

Complex and Shane Kelly Park tonight
[1:44:28]
staff is recommending that we amend the
[1:44:30]
existing agreements with Oviedo Babe
[1:44:32]
Ruth and the Florida crazed Crush youth
[1:44:36]
organizations to allow them to operate
[1:44:39]
their own concessions utilizing City
[1:44:40]
facilities with the respective
[1:44:42]
facilities that they use Oviedo Babe
[1:44:44]
Ruth uses a comp Sports Complex creates
[1:44:47]
crushes at Shane Kelly Park
[1:44:49]
secondly staff is recommending that we
[1:44:51]
utilize the net savings from these
[1:44:53]
changes to unfreeze to maintenance
[1:44:56]
worker one positions that would then be
[1:44:59]
utilized within the Park's maintenance
[1:45:00]
division in your packet we had
[1:45:02]
attachment number one that provided
[1:45:04]
those net savings to you
[1:45:06]
to break that down for you from savings
[1:45:09]
and temporary staffing and concession
[1:45:12]
supplies there was approximately overall
[1:45:14]
Savings of 137 thousand dollars
[1:45:17]
on the flip side with us giving up the
[1:45:18]
concession stands to the youth leagues
[1:45:20]
there is obviously a reduction of
[1:45:22]
Revenue so the net revenue loss
[1:45:25]
incorporating the concession stand lease
[1:45:27]
that the leagues would pay the city
[1:45:29]
equates to a little bit over forty six
[1:45:32]
thousand dollar deduction at the end of
[1:45:34]
the day net savings is just shy of
[1:45:37]
ninety one thousand dollars which we
[1:45:39]
staff is requesting to be
[1:45:41]
um
[1:45:42]
recommended to unfreeze those two
[1:45:43]
positions this evening it is recommended
[1:45:47]
that city council provide discussion and
[1:45:49]
direction to staff with regarding the
[1:45:51]
libido concession stand operations and
[1:45:53]

taking on on their role best idea ever

I've been hoping we do this for seven

is there going to be a cost sharing or

is it going to be at least to the the
[1:46:14]
leagues or what so

presently if this is a uh if we get the
[1:46:18]
proper direction this evening we would

do an amendment to their agreement
[1:46:21]
incorporating a concession lease as part
[1:46:23]
of their normal agreement okay with
[1:46:25]
regards to Oviedo Babe Ruth it would
[1:46:27]
basically be twelve thousand dollars how
[1:46:29]
much twelve thousand dollars Revenue a
[1:46:31]
thousand dollars per per month okay uh
[1:46:33]
Florida crazy crust would be a four
[1:46:36]
thousand dollars per year uh broken down
[1:46:38]
you know by monthly
[1:46:39]
so where does the
[1:46:41]
the revenue for the maintenance workers
[1:46:43]
come from
[1:46:44]
there's no revenue for the maintenance
[1:46:46]
workers we're not paying people to sell
[1:46:48]
constructions anymore yeah so so we
[1:46:50]
pulled so we're pulling off City staff
[1:46:52]
that were running the thing and
[1:46:53]
transferring that over to them so labor
[1:46:55]
running these concession stands is one
[1:46:57]
of our key components it took it took up
[1:47:00]
a lot of our uh you know budget uh we're
[1:47:03]
not capturing the full-time hours that
[1:47:05]
are associated with this so full-time
[1:47:07]
staff are just being reallocated we are
[1:47:08]
shifting our model of concessions over
[1:47:11]
to the gymnasium and Aquatics facility
[1:47:13]
the Cantina in Oviedo in the park and
[1:47:16]
Riverside Park which soon will have our
[1:47:18]
new Senior Center as well as a skate
[1:47:20]
park so you weren't making money on
[1:47:21]
these concessions we were they were they
[1:47:24]
were making money
[1:47:26]
um this is the chance that we just did a
[1:47:28]
full review of the operations and we
[1:47:30]
feel that by making these changes we can
[1:47:33]
shift our resources elsewhere without
[1:47:35]
losing the service level to the
[1:47:38]
customers
[1:47:39]
partnering with Oviedo Babe Ruth and
[1:47:41]
crazed Crush will serve as a fundraiser
[1:47:43]
for those programs they can now generate
[1:47:46]
some fundraising activity to now be
[1:47:48]
pumped into their program and
[1:47:49]
potentially be offset and return to the
[1:47:51]
city for maintenance so let me put
[1:47:53]
another way your recommendation is a is
[1:47:55]
a net
[1:47:57]
cost to the city's Net Zero cost of the
[1:47:59]
city
[1:48:02]
there's true savings we are trying to
[1:48:04]
reallocate those savings into the
[1:48:06]
maintenance workers that are truly
[1:48:07]
needed in the Parks division
[1:48:09]
one of them would be stationed at Oviedo
[1:48:11]
Sports Complex there's four individuals
[1:48:13]
that maintain that facility so it's a
[1:48:15]
net zero
[1:48:17]
essentially I mean better cost recovery
[1:48:19]
in our and our efficiency increases by
[1:48:22]
making this transition
[1:48:24]

city can't host everything that we have

going on so the concessions are closed

we have people asking us where they can

get waters and stuff and we have
[1:49:04]
injuries and nobody can get ice and

stuff like that so this allows us to
[1:49:08]
help out everybody that's there at the
[1:49:10]
park to play with us so you guys are in
[1:49:12]
agreement correct yeah we went through
[1:49:13]
our board we've been talking now I think
[1:49:16]
for like six months back and forth
[1:49:19]
um and then we went to our our board and
[1:49:21]
our board approved it I have not
[1:49:23]
mentioned it to all of our players yet
[1:49:25]
until tonight until it was approved or
[1:49:27]
whatever uh then I was gonna go to the
[1:49:30]
all the families to let them know but
[1:49:31]
right now it's just our board members
[1:49:32]
that know okay okay all right some
[1:49:35]
crazies the same way they're
[1:49:38]
was receptive we are still working on

some of the the the details on how to

take that over uh which I'm confident we

would work those details out the uh

Oviedo literally they don't use our
[1:49:49]
facilities do they they're just out did

they use um the sports complex but they

have their own concessions stands at
[1:49:54]
their facility now you're running that

themselves okay we're one of the few
[1:49:59]
municipalities that actually run our own
[1:50:00]
concessions in the state little in the
[1:50:02]
nation a lot of Youth groups operate
[1:50:04]
their own concession stands and we feel
[1:50:07]
um you know there's been discussions in
[1:50:08]
the past about concessions and even the
[1:50:10]
facility for that matter and after
[1:50:12]
further thought and review of Staff I'm
[1:50:15]
open to this opportunity um it's I think
[1:50:17]
it's going to be a benefit for the city
[1:50:18]
but I think it's gonna be a benefit for
[1:50:19]
the community
[1:50:20]
on top of that so so I have a I have a
[1:50:23]
couple questions so the current
[1:50:24]
concession supplies that are in there
[1:50:26]
that were paid for by the city what's
[1:50:28]
going to happen to those supplies are
[1:50:31]
they going to be reallocated together so
[1:50:34]
the the the reduction of supplies is
[1:50:36]
sixty thousand five hundred dollars
[1:50:37]
that's the savings so what's the Forty
[1:50:40]
thousand for
[1:50:42]
are we still putting supplies in the
[1:50:44]
concession stand so yeah the remaining
[1:50:46]
forty thousand is for the three is for
[1:50:48]
the stands that are still open the
[1:50:49]
gymnasium and Aquatics facility okay yes

yeah we're still operating those things
[1:50:52]
so but the the ones that are in the
[1:50:54]
concession stand at at the at Shane
[1:50:59]
Kelly and at
[1:51:00]
um of the Sports Center Sports Complex

those ones are those those con those

supplies are going to be reallocated to

the existence we reduce those completely

from the budget from those four stands

those facilities now we're not going to

have access to the to the concession

provide the opportunity to open

concessions for those events we don't

of our property you know over to them I

but then we're not entitled to use it

we're also going to require that if

there's any usage in the in the complex

that they're going to be responsible for

opening the stands for those groups so

if if a beetle B Ruth is not as complex
[1:52:43]
but literally just using the you know
[1:52:44]
two fields for instance they would have
[1:52:46]
to open up the stand for that practice
[1:52:48]
same for a softball tournament same
[1:52:50]
thing just like for our adult softball
[1:52:52]
teams that are City sponsored if we have
[1:52:54]
a games going on on Monday night out
[1:52:56]
there but there's no other activity in
[1:52:58]
the complex Oviedo Babe Ruth will be
[1:53:00]
required to open up the stand for our
[1:53:01]
city-sponsored program okay okay and

that's that's a revenue generator for
[1:53:06]
for you guys I assuming you're going to

be using volunteers right correct yeah

so the volunteers uh basically of our

they had a couple CNN anchors on there

that we have in our country and maybe

the need to tone it down a little bit

and I'll wait to see that from them

one conversation I had was with a group

vendor for this program called red speed
[2:01:12]
and chief I've I've talked to you about

it uh it's a program that the state
[2:01:18]
legislatures have passed into the law

where they would put speed cameras up in

school zones

and it'll
[2:01:26]
have a sign they're saying you're on

camera any car going over uh 10 miles an

hour over the limit in the school zone

gets a hundred dollar ticket

automatically

I think that's a good idea that there

was a report on the news the other night

that I think Winter Garden has already

implemented it and it's it's pretty easy

to see there's a sign that said you're

think there's some legislation that had

to do with red light ticketing uh red
[2:02:35]
light cameras this last season I know
[2:02:37]
comes up over and over again and and it
[2:02:39]
there's this red light cameras this was
[2:02:41]
school zone I get it the red light in a
[2:02:43]
school zone may be kind of different
[2:02:45]
things but I think there will be some
[2:02:47]
pushback
[2:02:48]
well I hope there is because I go
[2:02:50]
through school zones all the time and I
[2:02:51]
get past like crazy especially on 419.
[2:02:55]
uh I've been hit
[2:02:57]
by a bunch of emails from different
[2:02:59]
vendors on the same thing once once the
[2:03:01]
bill was passed it only specifically
[2:03:03]
governs school zones during school times
[2:03:05]
is effectively a red light camera
[2:03:07]
instead of a camera a red light is for
[2:03:09]
Speed yeah and uh it's a flat rate
[2:03:12]
already already decided to pass by the
[2:03:15]
state legislator for all uh all of
[2:03:18]
Florida
[2:03:19]
I've we had a Chiefs meeting the other
[2:03:21]
day and it doesn't appear to anybody in
[2:03:23]
the county is ready to move forward on
[2:03:25]
it uh any any municipalities or the
[2:03:28]
county itself but we'll start looking
[2:03:30]
into it and see where we go with this
[2:03:33]
for what vendor and what it'll take and
[2:03:35]
what the costs are and all of that so
[2:03:38]
okay I don't
[2:03:41]
try to keep in my mind what what school
[2:03:43]
zones we have in the city and I think
[2:03:45]
there's only uh on 419 maybe on Alafaya
[2:03:49]
Woods Boulevard
[2:03:51]
depending on depending on where they
[2:03:53]
what roads they allow them on and I
[2:03:56]
can't I don't I don't I can't give you
[2:03:57]
that answer Mitchell hammock and uh
[2:03:59]
Alfie Woods Boulevard yeah it's a
[2:04:02]
signalized intersection but still yeah I
[2:04:04]
don't yeah I don't see the sign hanging
[2:04:06]
over the road saying you know 20 miles
[2:04:08]
an hour when the lights flashing like
[2:04:09]
they have correct uh in front of
[2:04:11]
stenstrom uh in front of by just by
[2:04:15]
every Elementary School somewhere
[2:04:16]
there's probably one parking's got one
[2:04:18]
on our street on Twin Rivers Boulevard
[2:04:21]
Alfie Woods Boulevard
[2:04:25]
off the top of my head that's the two
[2:04:26]
Live Oak has one yeah that would
[2:04:31]
probably be yeah I just uh I think it's
[2:04:34]
attractive to me because I I see us
[2:04:37]
every day people driving like
[2:04:39]
Knuckleheads and if anything can keep
[2:04:42]
them aware of their surroundings I think
[2:04:45]

officially been appointed to the

taxation committee and I'm very excited

about that because
[2:05:04]
um part of their wrap up at the league
[2:05:07]
and I was not on that committee I was on
[2:05:08]
land use this last year but the taxation
[2:05:10]
committee uh was they listed as the hot
[2:05:13]
bills to watch the pair bills that were
[2:05:16]
inspired by Oviedo and the once at sales
[2:05:19]
tax and expanding its use to be allowed
[2:05:21]
for maintenance in addition to Capital
[2:05:24]
expenditures so I'm looking forward to
[2:05:26]
digging into that on I think it's
[2:05:28]
September 8th as the first policy
[2:05:30]
meeting
[2:05:31]
and also the original bills that were
[2:05:33]
filed last year are coming back both of
[2:05:36]
those sponsors are open to if we can
[2:05:39]
address some of the concerns that kept
[2:05:41]
them from moving last season they're
[2:05:43]
they're both open to to file them again
[2:05:45]
so I'm really hopeful that we can get
[2:05:47]
this done
[2:05:48]
and are you on a committee yes
[2:05:50]
taxation okay which I have done before
[2:05:53]
and it was not exciting but I'm really
[2:05:55]
excited about this pair of bills so I'm
[2:05:57]
going to power through it because we
[2:05:58]
need all the whole state get excited
[2:06:00]
about it okay I'm on the transportation
[2:06:03]
and uh yeah you're like Transportation
[2:06:06]
guy how many years have you been on that
[2:06:07]

I'm glad you do it maybe yeah that I

poked my head in there and it's not as

exciting as land use oh we have fun

uh and one other thing I wanted to let

you guys know about is there is a guy
[2:06:21]
named Mr Young who noticed a problem a
[2:06:24]
while ago and in one of our
[2:06:25]
neighborhoods and that is that there was
[2:06:27]
no place for the kids who were coming to
[2:06:29]
the bus stop to hang out so he went and
[2:06:31]
he had stalled a bench at his own
[2:06:33]
expense in his house uh you know it's
[2:06:35]
kind of by the sidewalk and then he
[2:06:37]
planted trees
[2:06:38]
and they've been there for a while and I
[2:06:40]
think the city recognized him at the
[2:06:42]
time but this post has gone viral guys
[2:06:44]
everybody uh in the whole country now
[2:06:46]
knows about Mr Young and the really cool
[2:06:49]
thing he did seeing a problem he just
[2:06:51]
saw this so I wanted to give him a shout
[2:06:52]
out because
[2:06:54]
it was just really cool seeing that he's
[2:06:56]
like oh no big deal I know how to do
[2:06:58]
this I'll fix it and and he did so
[2:06:59]
that's an inspiration to all of us too
[2:07:01]
we see a problem just fix it man

being torn down being rebuilt and that

was curious if we could find out how
[2:07:58]
they're doing that what is her plan to
[2:08:00]
do it and how it's being funded Mr Cobbs
[2:08:03]
suggested maybe you could reach out to
[2:08:04]
your counterpart and see if maybe you
[2:08:06]
could find out anything or know somebody
[2:08:07]
down there that could find anything out
[2:08:10]
yeah it looks like they're completely
[2:08:12]
tearing down the building and rebuilding
[2:08:15]
it but they had to fund it somehow I was
[2:08:17]
curious how they were funding it and
[2:08:18]
what was their plan

property taxes property taxes the

highest in the country
