[3:16]
kelly: here

[3:22]
quintanilla: present
[3:23]
>>mayor jan harnik: here.
[3:24]
all present.
[3:26]
thank you so much.
[3:29]
>> we'll have the pledge of
[3:51]
allegiance by staff.
[3:52]
>>council member gina nestande:
[4:02]
thank you.
[4:03]
>> I pledge allegiance to the
[4:05]
flag of the united states of
[4:06]
america and to the republic for
[4:07]
which it stands, one nation,
[4:08]
under god, indivisible, with
[4:09]
liberty and justice for all.
[4:26]
>> thank you so much.
[4:36]
we'll now have a little
[4:48]
inspiration. I thought I would
[4:59]
do a little refresher for us. I
[5:03]
think everybody knows it but
[5:07]
it's our mission statement and
[5:10]
our palm desert community
[5:13]
statement which is a great
[5:17]
product from a wide -- the
[5:30]
mission statement says the city
[5:37]
of palm desert provides
[5:38]
amenities and programs for the
[5:42]
community. Our vision
[5:43]
statement, palm desert is the
[5:47]
heart of california's coachella
[5:50]
valley. Palm desert's quality
[5:55]
of life offers -- residents and
[6:05]
visitors of all ages a wide
[6:16]
array of educational and
[6:19]
opportunities as well as arts
[6:30]
and cultural activities and
[6:32]
world class events in a
[6:36]
uniquely and beautiful desert
[6:43]
environment. This is a thriving
[7:02]
safe and sustainable community
[7:13]
that attracts innovative
[7:19]
employers and synergistic
[7:21]
educational partners.
[7:29]
we rocked that in 2014 and it's
[7:40]
still good.
[7:41]
do we have a report from closed
[7:46]
session?
[7:54]
>> yes, we do. With respect to
[7:57]
the agenda on the first item a
[8:02]
1 on family development, no
[8:10]
action was taken.
[8:15]
no reportable action nor
[8:19]
direction was given.
[8:20]
on the second item, with
[8:23]
respect to the refuge that
[8:28]
council unanimously authorized
[8:32]
the purchase and sale agreement
[8:34]
for the property described on
[8:37]
the agenda and that agreement
[8:38]
will be available to the public
[8:42]
once it is finalized.
[8:46]
that's all. We have. Thank
[8:59]
you very much.
[9:00]
>> thank you so much.
[9:02]
>> we'll go mayor and council
[9:04]
member reports and request for
[9:06]
action. You can do them at
[9:13]
once.
[9:22]
so may I start please with
[9:24]
council member kelly.
[9:28]
>>council member kathleen kelly:
[9:35]
thank you.
[9:38]
I have nothing this evening for
[9:44]
the general --
[9:52]
>> I find that tremendously
[9:55]
hard to believe but okay.
[9:59]
council member nestande?
[10:02]
>>council member gina nestande:
[10:07]
mayor, thank you.
[10:09]
I have nothing this evening to
[10:13]
share as well. I appreciate
[10:18]
your asking.
[10:20]
>> okay.
[10:25]
council member quintanilla?
[10:28]
>>council member karina
[10:30]
quintanilla: thank you mayor.
[10:36]
I luckily have plenty of things
[10:38]
to say so I will fill up that
[10:52]
time.
[10:53]
the mccallam education meeting.
[10:56]
that was wonderful in hearing
[10:59]
how many children have access
[11:01]
to arts and social learning.
[11:04]
they were able to reach 4500
[11:14]
students and 165 classrooms and
[11:18]
hearing the testimonials of
[11:20]
teachers in the classroom was
[11:26]
very rewarding.
[11:34]
they
[11:40]
have called to do. That is
[11:46]
going on the 14. You can apply
[11:58]
by january 19th. Art and public
[12:01]
places will now be cultural
[12:03]
arts committee. We were looking
[12:08]
at the budget. And did convey
[12:16]
to them where we stand with the
[12:18]
discussion of the first
[12:19]
committee. I want to report
[12:20]
that we did have the
[12:23]
resignation of a long standing
[12:26]
member. And my deepest
[12:44]
gratitude. She was on several
[12:47]
commissions. I know she will be
[12:54]
missed. If you are watching, I
[12:59]
send lots of love and you will
[13:02]
be missed.
[13:05]
I have a request. At san pablo,
[13:08]
when I go and visit and
[13:10]
sometimes chat with the
[13:13]
different merchants, I have
[13:14]
seen that we need some sort of
[13:19]
blinking light for pedestrians
[13:21]
to cross from one end to the
[13:25]
other. I have seen cars have a
[13:31]
difficult time making a left
[13:35]
turn. So I have seen drivers
[13:38]
make a u-turn. So looking at
[13:43]
the safety fact of that
[13:49]
particular intersection of san
[13:52]
pablo.
[13:53]
I also want to have a request
[13:54]
of staff to see if we can look
[14:00]
at where the $25 million
[14:13]
that is allocated for community
[14:17]
resilience designated for
[14:18]
agreement heat if we can
[14:22]
capture those for palm desert
[14:27]
given that we get some extreme
[14:34]
heat. With that, I will pass
[14:39]
that on, mayor.
[14:40]
>>
[14:41]
>>mayor jan harnik: thank you.
[14:43]
I think we all owe gratitude to
[14:54]
-- she's given a lot over the
[14:56]
years.
[14:58]
>>mayor pro tem sabby jonathan:
[15:02]
thank you, mayor.
[15:05]
to my colleagues, I also made
[15:20]
meetings and the desert willow
[15:26]
management -- that took place
[15:30]
earlier this week as many of
[15:37]
us recall. We contract with
[15:40]
sports for the management with
[15:46]
desert willow. The 5-year term
[16:00]
is up soon and the city put up
[16:05]
the contract for request for
[16:10]
proposal. And the city
[16:22]
conducted interviews earlier
[16:24]
this week and the process is
[16:26]
moving forward.
[16:27]
I have no request for action.
[16:31]
thank you.
[16:32]
>>
[16:40]
>> great, thank you.
[16:43]
I have a couple of comments I
[16:44]
would like to make.
[16:48]
first, I don't know if anybody
[16:53]
else noticed but we have a
[16:55]
tremendous up tick in graffiti
[16:57]
throughout our city, and I
[17:00]
think our public works
[17:01]
department does a great job at
[17:06]
immediately getting the
[17:10]
graffiti abate mentment team
[17:18]
out there but it is a
[17:21]
significant increase. Please
[17:22]
watch for that. And we do have
[17:28]
the palm desert app that you
[17:35]
can all have on your phone. The
[17:40]
team will get out there and
[17:48]
eradicate graffiti. We need to
[17:51]
make that happen. So please
[17:56]
paying attention to that and
[17:59]
please help to be sure our city
[18:02]
remains clean like it should be.
[18:18]
the other thing I'm going to
[18:23]
remind everybody is
[18:25]
international holocaust
[18:26]
remembrance day is thursday the
[18:31]
27.
[18:38]
at 1:00.
[18:40]
there will be a remembrance
[18:42]
ceremony in our civic center
[18:48]
park here in palm desert.
[19:05]
and it's an important occasion
[19:08]
and something we need to all
[19:11]
think about.
[19:16]
also, january 17th.
[19:20]
martin luther king jr. So there
[19:22]
is another day that is worth
[19:23]
sitting and thinking about what
[19:26]
it takes to be who we are as a
[19:31]
nation.
[19:38]
I also wanted to mention that
[19:42]
at our lasts meeting which was
[19:45]
december 16th, our then mayor
[19:50]
kelly requested that we have a
[19:59]
discussion on this agenda
[20:01]
regarding the districting
[20:02]
issue. I don't mean the census
[20:11]
districting.
[20:19]
but if we should put something
[20:23]
on the ballot. Unfortunately
[20:29]
with the planned vacations and
[20:34]
covid surge, we didn't have
[20:35]
enough time to go about that in
[20:37]
a proper way. It will be on the
[20:45]
agenda january 27th. I want to
[20:48]
be sure for those who want to
[20:51]
weigh in that we'll have that
[20:58]
opportunity on january 27th. It
[21:02]
will be on the agenda.
[21:04]
so I apologize to council
[21:08]
member kelly, who I know it was
[21:16]
important to you, but between
[21:20]
covid and the holidays, that's
[21:21]
what happened. So we will get
[21:24]
that back right on back on the
[21:28]
agenda.
[21:37]
I hope everybody had meaningful
[21:39]
holidays and let's make 2022
[21:44]
healthy and happy and dynamic.
[21:56]
so now we'll go to non-agenda
[21:59]
public comments.
[22:00]
first I would like to give our
[22:03]
clerk an opportunity to talk
[22:07]
about how to participate.
[22:46]
>>clerk: thank you. If you
[22:49]
would like to participate in
[22:52]
public comment, please raise
[22:57]
your hand to speak.
[23:02]
when you are called upon, press
[23:04]
star 6 to unmute your line.
[23:11]
please state your comments and
[23:12]
state your name for the record.
[23:14]
>>mayor jan harnik: I want to
[23:15]
note this is an opportunity to
[23:19]
address issues that are not on
[23:23]
the agenda. If anybody would
[23:26]
like to speak at this time.
[23:35]
I do see a hand raised. I also
[23:37]
want to make note that the
[23:40]
brown act does not allow any of
[23:43]
the bodies that are meeting
[23:47]
today to respond to comments
[23:51]
that are not on the agenda, but
[23:56]
we will refer the matter to
[24:03]
staff or record a
[24:07]
recommendation.
[24:16]
so our first speaker. We have
[24:20]
joanne speer. Would you like to
[24:26]
address the council?
[24:33]
>>clerk: joanne speer, you have
[24:38]
3 minutes.
[24:39]
public speaker: okay, thank
[24:41]
you for taking my comments.
[24:53]
and I'm wondering why we are
[24:55]
spending so much time on
[24:58]
redistricting for two districts
[25:01]
when going to a five district
[25:11]
5th district system now
[25:13]
provides local and fair
[25:16]
representation for all parts of
[25:19]
palm desert. And I do
[25:24]
acknowledge that this is being
[25:38]
put on the agenda for the next
[25:40]
meeting. Thank you very much.
[25:45]
>> thank you.
[25:52]
is there anyone else? I see
[26:08]
luis --
[26:32]
public speaker: being this is
[26:35]
your first public hearing and 2
[26:37]
weeks from tonight is the
[26:40]
second public hearing and we'll
[26:42]
have our chance to review --
[27:28]
and the third public hearing,
[27:32]
the final draft map published
[27:34]
on the 17, and we have the
[27:40]
third.
[27:46]
and fourth public hearing for
[27:50]
the final map to approve that
[27:55]
final map and the deadline for
[28:02]
the final approval is april
[28:04]
17th and we go to november
[28:07]
election.
[28:08]
that concludes my presentation.
[28:10]
it's fairly straight forward.
[28:14]
it is dictated by state law.
[28:32]
there was the question about
[28:38]
this and so I'm happy to answer
[28:40]
any questions about this
[28:41]
process. I would love to take
[28:42]
the input of both public and
[28:45]
the council in this mapping
[28:46]
process. Thank you very much
[28:50]
for your time.
[28:58]
>> thank you so much.
[29:03]
okay. We'll have questions now.
[29:07]
the first question is council
[29:10]
member quintanilla.
[29:27]
>> thank you, mayor.
[29:30]
thank you for the presentation.
[29:32]
I have questions in regards to
[29:35]
the mapping software. Are there
[29:38]
plans to do maybe a tutorial in
[29:44]
advance. The last time it was
[29:46]
not an easy process and I'm
[29:52]
wondering if you can either
[29:54]
[29:59]
for the other systems and if
[30:01]
the map is available. If we can
[30:07]
get that answer.
[30:14]
and my second question would be
[30:16]
what is the proper for the
[30:20]
paper maps because some prefer
[30:23]
drawing their paper maps. Is
[30:28]
that all -- also something that
[30:40]
will be provided at the other
[30:44]
meeting?
[30:45]
>> yes. Thank you for the
[30:48]
question. I have been involved
[30:56]
in districting process and
[30:58]
without software it can be very
[31:02]
difficult to submit draft maps.
[31:13]
so our mapping tool is very
[31:17]
intuitive. There will be
[31:18]
instructions given.
[31:23]
as far as the tutorial goes, I
[31:25]
will have to refer to the clerk
[31:29]
for that, but having used it,
[31:32]
it's very intuitive. I believe
[31:37]
it's available both on a
[31:41]
desktop or laptop as well as
[31:46]
mobile. I will have to come
[31:47]
back to confirm that forks. As
[31:51]
far as paper maps, I will put
[31:57]
that question to the clerk.
[32:27]
>> the question was that some
[32:30]
may not have access to that. Is
[32:34]
there a possibility that we can
[32:47]
have some of the presentations
[32:49]
held at a school and available
[32:55]
to residents. Thank you.
[33:06]
>> from a legal perspective,
[33:09]
there is nothing that holds the
[33:11]
city from making any number of
[33:17]
workshops at any location in
[33:19]
the city.
[33:23]
>> thank you.
[33:26]
>> thank you.
[33:29]
>> council member kelly?
[33:40]
>> it looks like ms. Harnik has
[33:45]
some information to share which
[33:50]
is not why I raised my hand,
[33:58]
but --
[34:00]
>> yeah, that's correct.
[34:01]
there was a couple of questions
[34:02]
in there. I do want to note
[34:08]
that the first work we'll go
[34:13]
over the mapping tool and how
[34:14]
to use that. That is one of the
[34:15]
things that is going to be
[34:19]
discussed there as
[34:20]
demonstrating how to use that.
[34:31]
it is available on a website.
[34:32]
so I have that information
[34:34]
there. I don't have the rest of
[34:37]
the answers.
[34:38]
>> all right. Thank you very
[34:41]
much.
[34:52]
>>council member kathleen
[34:54]
kelly: thank you. I'm glad you
[34:57]
moved back to this slide
[34:58]
because that is what I wanted
[35:02]
to talk about.
[35:05]
this slide issays that at our
[35:14]
next council meeting, we will
[35:20]
review and consider tract maps
[35:31]
and the written staff report as
[35:39]
they schedule which says next
[35:49]
to january 27th, held prior to
[35:57]
the release of tract map.
[36:07]
so I'm confused about what we
[36:11]
will or will not have tract
[36:18]
maps at next council meeting
[36:33]
>> if I can again ask the
[36:39]
clerk, I know that -- if our
[36:50]
process is to review tract maps
[36:52]
at the second public hearing,
[36:55]
but I want to make sure I'm in
[37:00]
line with staff's plan for this
[37:02]
meeting. I will also ask the
[37:04]
clerk to chime in there.
[37:08]
>> the written staff report you
[37:09]
have is consistent with the
[37:13]
first timeline that was
[37:21]
presented at city council.
[37:37]
is that what we are to assume
[37:42]
is the accurate timeline?
[37:48]
>> you know, frankly --
[38:10]
>> so we know that the public
[38:17]
knows what to expect when. So
[38:29]
what is accomplished and
[38:39]
clarity. My way of thinking,
[38:40]
this is for a second
[38:48]
introductory session. So if we
[39:01]
do the tract map, but as I
[39:02]
said, we need to figure out how
[39:08]
to make sure that our
[39:21]
communications are clear.
[39:23]
>> our intent and our practice
[39:28]
is to have the draft maps
[39:35]
available for review at the
[39:40]
second public hearing.
[39:41]
and that is the plan is to have
[39:46]
it a draft map at the second
[39:53]
public hearing.
[39:54]
the public has the ability to
[39:57]
submit draft maps all the way
[39:59]
up to the third public hearing.
[40:11]
there is a longer window to put
[40:16]
together their draft maps to
[40:18]
consider. But you will have a
[40:24]
draft map that complies with
[40:30]
all of the requirements, the
[40:33]
settlement agreements and with
[40:36]
the input we receive tonight
[40:41]
and the intent there is to give
[40:47]
both the council and the public
[40:54]
enough time to mole over that
[40:58]
draft map and make any tweaks
[41:07]
with their own submitted draft
[41:10]
maps to kind of again have more
[41:12]
time for that part of the
[41:15]
process as it really is the
[41:17]
most important part of this
[41:22]
process.
[41:23]
>> thank you. That was clear.
[41:27]
we just might need to scrub
[41:34]
what is out -- to be sure it's
[41:41]
consistent.
[41:45]
>> thank you. Good catch.
[41:51]
council member nestande?
[41:52]
>>council member gina nestande:
[41:57]
thank you, mayor.
[41:58]
mr. Richardson, I just wanted
[42:01]
to say our city of palm desert
[42:09]
is 50,000 population, and doing
[42:18]
like a redistricting of a big
[42:24]
city like los angeles, almost
[42:28]
seems to be an easier job to
[42:42]
do. As palm desert, can we
[42:46]
redraw these maps as some sort
[42:48]
of priority. Should they be
[42:49]
looking at the homes that are
[42:56]
unique in golf courses, that
[42:59]
are gated. We have 55 plus, we
[43:07]
have 55 plus in manufactured
[43:13]
home communities. So we are
[43:15]
somewhat unique in a lot of
[43:16]
work that you are doing in
[43:23]
redistricting.
[43:25]
so, it just seems so wrong and
[43:32]
I would hope that we can give
[43:36]
the public some more fine
[43:38]
tuning tools to more prioritize
[43:40]
this as they draw these maps.
[43:43]
I'm not sure if you are aware
[43:45]
of this or not, but the city of
[43:50]
palm desert, north frank
[44:10]
sinatra drive, is in the desert
[44:15]
sanders school district. That
[44:16]
is one that pops in my mind for
[44:19]
community of interest. Thank
[44:24]
you. Those of my comments.
[44:27]
>> if I can respond briefly to
[44:29]
that. I think you've nailed the
[44:32]
primary issue on the head when
[44:35]
it comes to redistricting.
[44:36]
actually while we certainly
[44:42]
have worked with bigger
[44:44]
jurisdictions, most of our
[44:50]
clients are small to mid-size
[44:53]
cities just like palm desert. I
[44:58]
serve the city attorney as well
[45:02]
and just like palm desert in
[45:06]
terms of being served by
[45:14]
multiple school districts,
[45:15]
having hoa's. Those are pretty
[45:20]
distinct areas in the city.
[45:21]
that is exactly what we want to
[45:25]
look at.
[45:26]
unfortunately the fair maps act
[45:28]
which is the law that informs
[45:32]
what we do isn't that specific
[45:40]
with the criteria. So we know
[45:42]
that the districts have to be
[45:48]
geographically contiguous. It
[45:52]
can't look like an octopus with
[45:57]
tentacles.
[45:58]
we know they have to be
[46:02]
compact, right. But the bulk of
[46:05]
our work is going to be exactly
[46:10]
like you articulated. 55 plus
[46:12]
communities that are clustered
[46:15]
together and gated communities
[46:19]
and hoa's and breaking up those
[46:26]
types of communities up
[46:27]
probably isn't consistent with
[46:29]
the fair maps act.
[46:33]
so the communities job and the
[46:39]
council's job is to articulate
[46:44]
where those boundaries are,
[46:45]
what those communities are that
[46:48]
you don't want to break up as
[46:51]
you redraw the lines between
[46:54]
these two districts.
[46:57]
that school district line -- if
[47:11]
there is specificity what you
[47:18]
just articulated is exactly the
[47:21]
rule that we want to be looking
[47:27]
at. Do you have specific and
[47:34]
distinct communities that
[47:38]
shouldn't be separated.
[47:41]
that's what the fair maps act
[47:44]
wants us to look at when we are
[47:48]
separating those into
[47:50]
boundaries. Sometimes we have
[47:52]
to separate them, but often you
[47:53]
can keep them together because
[47:56]
they should be together. I hope
[47:58]
that answers the question.
[48:02]
>> thank you, mr. Richardson.
[48:06]
>> I think it would be helpful.
[48:19]
although I'm not sure if it's
[48:29]
going to help. That should be
[48:33]
at the next meeting for sure.
[48:43]
>> council member quintanilla?
[48:44]
>>council member karina
[48:46]
quintanilla: thank you, mayor.
[48:47]
from the school district, there
[48:49]
is no possible way that it
[48:55]
could be now away from the
[49:04]
north district issue. Unless
[49:09]
mr. Richardson, I'm mistaken
[49:12]
but with we do get to the
[49:15]
boundary districts to keep that
[49:16]
in mind. Thank you.
[49:18]
>> are there any other
[49:26]
questions? Then we'll open
[49:59]
the public hearing and ask if
[50:03]
there are any comments anyone
[50:06]
would like to make? I don't
[50:12]
see any.
[50:14]
I wonder if our clerk see's
[50:17]
any?
[50:18]
>> I'm not aware of any.
[50:19]
>> I don't see any either.
[50:24]
okay.
[50:25]
then I will close the public
[50:29]
hearing and we will have any
[50:48]
discussion needed at this time
[51:02]
from council? No?
[51:03]
>> I do have the request or the
[51:13]
desire so when we have some of
[51:16]
these sections that the
[51:19]
location is identified to give
[51:22]
residents access to use
[51:28]
computers so we are not worried
[51:31]
about whether or not the access
[51:32]
they have in their home is
[51:35]
equitable for them to
[51:37]
participate. This is democracy
[51:39]
after all. I hope the city will
[51:42]
keep that in mind and create
[51:45]
some of these opportunities
[51:49]
either the middle school or
[51:51]
high school, a place that is
[51:56]
centrally located, if not the
[51:59]
library. Thank you.
[52:04]
>> I see ms. Horning taking
[52:15]
notes.
[52:33]
I will entertain a motion at
[52:34]
this time.
[52:35]
>> one more comment. Basically
[52:40]
as we'll draft the first map
[52:50]
and that is similar and we have
[52:52]
to add the population to
[52:56]
district 1. The one thing to
[52:58]
understand is at the lower end
[53:07]
of the range and the middle end
[53:09]
and the high end.
[53:14]
>> thank you.
[53:15]
I see a hand up.
[53:19]
council member kelly, do you
[53:23]
have a comment?
[53:28]
>>council member kathleen
[53:29]
kelly: yeah. The key objective
[53:36]
should not be a set number.
[53:40]
that would make it easy for
[53:42]
you, but that's not really
[53:47]
helpful.
[53:51]
what I said in december, I will
[53:59]
say again. This is established
[54:04]
to come as close as possible to
[54:17]
the district in palm desert. So
[54:20]
the priority is to receive that
[54:27]
identity. And might come at the
[54:33]
low range and might come at the
[54:43]
high end of range.
[54:53]
>> council member quintanilla?
[54:54]
>>council member karina
[54:55]
quintanilla: I echo the
[54:56]
sentiment that there is no
[55:02]
magic number that should be our
[55:05]
goal. I appreciate that you
[55:07]
want some guidance and aiming
[55:10]
for the middle would be a good
[55:13]
guidance but because we can't
[55:18]
say fix -- I think the
[55:24]
importance of keeping the
[55:27]
contiguous boundaries and
[55:28]
communities of interest is only
[55:29]
the priority and what makes
[55:34]
sense for the community. When I
[55:44]
was canvassing, I was in
[55:55]
monterey and residents didn't
[55:58]
know what was here.
[56:03]
so I echo the previous mayor,
[56:06]
council member and somewhere in
[56:07]
the middle but that we can't
[56:10]
necessarily give a number to
[56:13]
start. I know that's not as
[56:15]
helpful and you came for
[56:19]
direction but I think somewhere
[56:27]
in the middle, but we can't
[56:29]
give an exact number.
[56:31]
>> I think I heard the
[56:32]
direction loud and clear. It's
[56:38]
very very clear.

[56:42]

[56:44]
any other questions or
[56:46]

[56:48]
be helpful, mr. Richardson?
[56:52]
>> I think I'm good. Thank you
[56:53]
very much for your time.
[57:03]

[57:05]
to have a new map to look at.

earliest timeframe.

to follow of the last promotion
[57:50]
that we receive the report and
[57:52]
so forth. I didn't hear that in
[57:54]
the motion. I don't know if
[57:57]
it's legally required, mr.
[58:00]
richardson or is the proposed

[58:05]

legal standpoint.

pointing out that there is this
[1:05:43]
revised staff report with
[1:05:50]
supplemental information this

[1:05:55]
the revised report is intended

the city council as you all

[1:08:28]
the chair, two community
[1:08:39]

[1:09:48]
this also removes the question
[1:09:58]
to include bylaws.

which are incorporated in the
[1:10:08]
staff report for reference and
[1:10:10]
they are on your screen.
[1:10:13]
the request is to wait until

after the homeless task force
[1:10:17]
is able to be established and
[1:10:20]
be able to review the bylaws
[1:10:22]
and all the changes will be
[1:10:24]
brought back to council at the

[1:14:11]
willing to present this? No.
[1:14:13]
there is mr. Bauman.
[1:14:17]
>> thank you, mayor and city
[1:14:23]
council. Audrey prepared this
[1:14:25]
report. Audrey, are you
[1:14:28]
connected?
[1:14:29]
>> I'm here.
[1:14:30]
>> there she is.
[1:14:35]
I'm here to back up audrey as
[1:14:44]
needed.
[1:14:45]
>> okay, I'm going to start
[1:14:46]
this presentation up real
[1:14:49]
quick. Can you see it?
[1:14:53]
>> yes.
[1:15:02]
>> today we are requesting
[1:15:09]
additional budget for
[1:15:10]
engineering to provide
[1:15:13]
additional construction
[1:15:14]
management services to complete
[1:15:17]
the construction for the
[1:15:18]
president plaza the parking
[1:15:25]
renovation project.
[1:15:26]
throughout construction project
[1:15:31]
has experienced numerous
[1:15:32]
challenges and resulted in
[1:15:35]
additional work and overall
[1:15:37]
expended construction schedule.
[1:15:38]
for now, I want to start by
[1:15:52]
summarizing some of the
[1:15:53]
additional work items that have
[1:15:59]
been required during
[1:16:00]
construction. Here is just a
[1:16:11]
few of the bigger examples that
[1:16:16]
we have. As you probably all
[1:16:26]
heard, our construction team
[1:16:29]
has found to date 18 septic
[1:16:36]
tanks throughout the project
[1:16:46]
site. Many of which were
[1:16:51]
properly abandoned and
[1:16:53]
connected the affected
[1:16:55]
businesses to the sewer system.
[1:16:57]
we also had a lot of issues
[1:17:01]
while grading with dealing with
[1:17:07]
wet and dry utilities.
[1:17:18]
dpw has had a lot of delays. So
[1:17:27]
our contractor had to wait and
[1:17:36]
work around the infrastructure
[1:17:37]
around all the bright water
[1:17:40]
lines that should have been
[1:17:42]
vacated and in turn we had the
[1:17:47]
lower a lot of those and we
[1:17:52]
also had to replace a lot of
[1:17:56]
wet and dry utilities because
[1:17:57]
they were shallow and also a
[1:18:03]
lot of them were sewer lines
[1:18:08]
and private lines and aged
[1:18:10]
and/or damaged during
[1:18:19]
construction.
[1:18:20]
as for dry utilities, we had
[1:18:36]
spectrum and sce come out for
[1:18:38]
the lower area that was graded.
[1:18:41]
we also ran into several
[1:18:44]
unmarked system lines that had
[1:18:46]
to be lowered and they were in
[1:18:53]
both in east and west lots.
[1:18:58]
very expensive amount of work.
[1:19:01]
in addition, our contractors
[1:19:04]
refined the ada improvement
[1:19:05]
design. We got a lot of
[1:19:10]
comments from businesses that
[1:19:20]
there weren't enough ada ramps
[1:19:22]
coming from the parking lot. So
[1:19:24]
we added some of those. Also we
[1:19:28]
refined the larger ramps to the
[1:19:31]
businesses that needed them so
[1:19:32]
they really match well with the
[1:19:37]
existing buildings. They were
[1:19:39]
being applied to.
[1:19:44]
due to the cwd delays, we also
[1:19:47]
had some rework for the
[1:19:50]
contractor. They had to leave
[1:19:56]
out some segments of the and
[1:20:46]
make connections so cwd had to
[1:20:51]
redo some work that resulted in
[1:20:54]
this -- for this type of work.
[1:21:10]
we also chose to install
[1:21:14]
temporary light towers
[1:21:21]
throughout project site, as a
[1:21:31]
safety measure until we can get
[1:21:34]
the new lighting put in.
[1:21:39]
the additional sidewalk redesign
[1:21:47]
from the contractor included
[1:21:50]
curb ramp designs to match the
[1:22:00]
existing conditions and
[1:22:01]
additional drainage
[1:22:05]
improvements that work better
[1:22:07]
with the lower profile curb
[1:22:11]
design, and also some redesign
[1:22:13]
around palm trees and sidewalks
[1:22:17]
that are going to remain.
[1:22:28]
this map, we included this. I
[1:22:29]
know it's hard to see but I'm
[1:22:32]
not going to spend a lot of
[1:22:34]
time on it. This just shows all
[1:22:40]
of those improvements
[1:22:45]
throughout the project site. So
[1:22:46]
this is the east lot and you
[1:22:49]
will see this is a spectrum
[1:22:51]
line I was talking about here.
[1:23:07]
and it shows the improvements
[1:23:11]
are not located in individual
[1:23:14]
project site. We have run into
[1:23:17]
issues all over every time we
[1:23:19]
put a shovel in the ground.
[1:23:24]
that was the east lot.
[1:23:30]
this is the west lot and
[1:23:36]
another large spectrum line
[1:23:37]
that we found while we were
[1:23:42]
digging and septic and all the
[1:23:51]
sidewalks and utilities.
[1:23:52]
this shows the severity of the
[1:23:55]
additional work that's been
[1:24:03]
completed.
[1:24:04]
so that has ultimately extended
[1:24:06]
the work schedule for
[1:24:08]
construction. Right now I want
[1:24:09]
to give you a quick update,
[1:24:19]
where we are at.
[1:24:22]
by the site, you will see the
[1:24:25]
east lot was paved on the 23rd.
[1:24:28]
most of the parking lot now
[1:24:31]
open for parking. We do have
[1:24:33]
some staging and the contractor
[1:24:36]
is going to to continue
[1:24:39]
installing other improvements
[1:24:40]
in that lot and they plan to be
[1:24:45]
done with most to the
[1:24:57]
construction and that lot by
[1:25:00]
the end of february. That is
[1:25:05]
club landscaping, lighting,
[1:25:12]
closures, the works.
[1:25:16]
cwd is expected to complete
[1:25:18]
their work next week and should
[1:25:21]
have the sidewalks finished and
[1:25:24]
should look really good. And
[1:25:29]
now the west lot is scheduled
[1:25:33]
for february 23rd and 24. The
[1:25:38]
remaining lots will be closed
[1:25:40]
to vehicle traffic until the
[1:25:42]
lot is paved. The contractor is
[1:25:46]
only required to
[1:25:53]
have 150 spots on the lot and
[1:25:58]
agreed to have spots open in
[1:25:59]
the area as feasible as long as
[1:26:03]
they are safe to provide as
[1:26:09]
much parking as possible to the
[1:26:12]
businesses. We still don't have
[1:26:20]
a solid date to cwd's work
[1:26:23]
schedule yet but they are
[1:26:31]
hoping to be at the lot by the
[1:26:35]
end of this month. That's where
[1:26:36]
we stand now. I wanted to
[1:26:41]
highlight the construction
[1:26:42]
schedule. When we set up the
[1:26:46]
contract, the contractor was
[1:26:47]
getting 125 working days to
[1:26:49]
complete the interim portion of
[1:26:55]
the project.
[1:27:00]
it's primarily getting the lots
[1:27:01]
paid and that was planned for
[1:27:05]
december 1, 2021. And then the
[1:27:10]
completion date for the total
[1:27:14]
project was january 29, 2022.
[1:27:26]
based on the additional work,
[1:27:28]
we have granted 40 extra
[1:27:31]
working days for the
[1:27:35]
contractor. So now the interim
[1:27:39]
completion date is february 8,
[1:27:43]
andth, and the total completion
[1:27:56]
date is april 11th.
[1:27:59]
the interim date is where the
[1:28:05]
lots are primarily open,
[1:28:13]
drivable, usable and the
[1:28:14]
completion date in april will
[1:28:16]
be for all the other
[1:28:22]
improvements that would require
[1:28:29]
-- once the lots are paved, we
[1:28:37]
should see improvement.
[1:28:39]
with that being said, we need
[1:28:48]
the management and on-site
[1:28:59]
during construction and extra
[1:29:05]
management required for the
[1:29:09]
construction for april.
[1:29:10]
I'm happy to answer any
[1:29:12]
questions if you have them.
[1:29:16]
>> okay, we have hands up.
[1:29:28]
council member kelly.
[1:29:33]
>>council member kathleen
[1:29:35]
kelly: yes. I would like to try
[1:29:41]
to understand this correctly
[1:29:42]
and members of the public who
[1:29:48]
are listening.
[1:29:50]
do I understand correctly, we
[1:29:58]
have already approved the
[1:30:01]
additional construction work
[1:30:28]
that is necessary for the work
[1:30:33]
and the contract for the entity
[1:30:43]
that we contracted to over see
[1:30:46]
that work.
[1:30:52]
>> correct.
[1:30:53]
we are still grading. There is
[1:30:56]
still potential for some
[1:31:01]
additional constraints.
[1:31:14]
>> we have identified the
[1:31:17]
additional work and received in
[1:31:25]
the budget if we find any other
[1:31:32]
issues. This is just for
[1:31:35]
management on site to help
[1:31:39]
watch over the contractor, help
[1:31:42]
redesign the field, help
[1:31:47]
resolve issues. Through the
[1:31:52]
construction.
[1:31:55]
>> thank you.
[1:31:57]
>>> thank you.
[1:32:11]
>>mayor pro tem sabby jonathan:
[1:32:13]
thank you.
[1:32:14]
I have to ask again, the
[1:32:17]
original cost estimate was $8.6
[1:32:22]
million. Through no call of
[1:32:33]
staff or our management team,
[1:32:37]
you know the cost has
[1:32:43]
skyrocketed almost $3 million
[1:32:48]
from 8.6 to 11.5. And we've
[1:32:55]
discovered these previously
[1:32:56]
unknown conditions under the
[1:33:04]
ground that has largely caused
[1:33:06]
these increases and they keep
[1:33:08]
rising from the deep.
[1:33:10]
here is the question.
[1:33:16]
are we -- do we have a sense
[1:33:24]
whether there is control and
[1:33:28]
whether there is more monsters
[1:33:29]
down there?
[1:33:30]
>> yes, we are in the last, the
[1:33:33]
north side of the west lot is
[1:33:39]
the west quadrant of the site
[1:33:40]
that has to be graded. The
[1:33:45]
other three -- that have
[1:33:53]
previously been closed, we've
[1:33:57]
already graded them out. They
[1:33:59]
are a finished grade. So this
[1:34:04]
week, we have identified
[1:34:12]
utilities that the contractor
[1:34:13]
has addressed and we have found
[1:34:16]
additional cesspool, but as we
[1:34:23]
get to that final grade, then
[1:34:27]
we feel much more confident
[1:34:31]
that we will not hit anymore
[1:34:35]
surprises. The sooner we can
[1:34:41]
close the ground,
[1:34:46]
the more confident that we
[1:34:49]
feel.
[1:34:50]
>> thank you so much. All of
[1:34:54]
your hard work. Very much
[1:34:57]
appreciated.
[1:34:58]
>> thank you.
[1:34:59]
>> I have a question. By the
[1:35:01]
way, that's why there are
[1:35:04]
surprises because no one knows
[1:35:14]
about it.
[1:35:15]
do you have any idea of the age
[1:35:22]
of the septic systems, the
[1:35:31]
surprise septic systems? Do
[1:35:33]
you have any idea of the age?
[1:35:34]
>> I don't know the exact age,
[1:35:38]
but they haven't been permitted
[1:35:39]
in a very long time. I know the
[1:35:49]
east lot was originally
[1:35:51]
developed in 1970. I wouldn't
[1:35:54]
be surprised if they were 40-50
[1:35:59]
years old.
[1:36:00]
>> I wanted to make the point
[1:36:03]
that a lot of this system,
[1:36:08]
before the city was
[1:36:11]
incorporated. So we don't have,
[1:36:13]
unfortunately, we don't have
[1:36:14]
the plans for some of this. So
[1:36:19]
I know on the level of
[1:36:29]
frustration for staff and I
[1:36:30]
know for the merchants is
[1:36:33]
really difficult.
[1:36:34]
at some point, we had to take
[1:36:36]
this on. And we chose to do it
[1:36:39]
and we are going to get it done
[1:36:40]
and it will be an amazing
[1:36:45]
project when it's finished and
[1:36:51]
it has to be done.
[1:36:57]
so thank you for doing what you
[1:37:04]
are doing. And now cvwd has
[1:37:09]
some problems with the chain
[1:37:12]
and what next. Thanks for
[1:37:14]
hanging in there and trying to
[1:37:20]
keep people informed as you
[1:37:31]
can. I know it's important and
[1:37:33]
difficult for you and difficult
[1:37:35]
for everybody involved. Thank
[1:37:36]
you.
[1:37:37]
>> I see a couple more hands
[1:37:40]
up.
[1:37:41]
council member kelly.
[1:37:48]
>>council member kathleen
[1:37:50]
kelly: if it's time, I would
[1:37:55]
move to approve.
[1:38:06]
council member nestande may
[1:38:07]
have something to express
[1:38:10]
first. I should move we should
[1:38:15]
have one heck of a party but I
[1:38:17]
will leave that to staff.
[1:38:23]
>> we'll have nice lots of nice
[1:38:39]
smooth pavement.
[1:38:40]
>>council member gina nestande:
[1:38:42]
yes, I will second the motion.
[1:38:49]
I just wanted to add if at all
[1:38:52]
possible because staff is not
[1:38:55]
busy enough if we can come up
[1:39:01]
with a plan b or c with the
[1:39:05]
parking. Is what I'm hearing
[1:39:08]
with businesses is that there
[1:39:11]
is no place to park to frequent
[1:39:13]
their business. I have been
[1:39:14]
thinking and thinking about it
[1:39:17]
and I know february 8th is
[1:39:20]
almost here for the interim
[1:39:24]
completion. But I'm just
[1:39:36]
throwing that out there for
[1:39:39]
staff.
[1:39:40]
>> I thought it was very good.
[1:39:50]
>> okay.
[1:39:51]
>> do I give an overview?
[1:40:03]
>> the partners with the
[1:40:08]
development department, tried
[1:40:14]
to secure temporary leases of
[1:40:16]
two existing parking lots. The
[1:40:20]
old union bank site being one
[1:40:26]
of them.
[1:40:36]
and we have been encouraging
[1:40:39]
businesses and customers and
[1:40:44]
business employees to use those
[1:40:51]
lots particularly when we've
[1:40:54]
had to do closures for bathing.
[1:41:01]
in addition, working on
[1:41:04]
temporary timed parking
[1:41:05]
restrictions, for instance, on
[1:41:07]
palm desert drive south to
[1:41:13]
allow for greater customer
[1:41:27]
access to the businesses and
[1:41:30]
there are tweaks we have been
[1:41:33]
making to the parking to add to
[1:41:36]
the growing shifting and
[1:41:38]
phasing of the parking. For
[1:41:42]
instance, we are considering
[1:41:44]
handicap parking for one of the
[1:41:51]
businesses while they are for
[1:42:00]
every department of ada parking
[1:42:03]
was moved. Staff is working
[1:42:04]
with the businesses to make
[1:42:08]
these temporary arrangements so
[1:42:12]
far.
[1:42:13]
>> thank you, randy. I
[1:42:17]
appreciate it.
[1:42:18]
>>mayor jan harnik: we have a
[1:42:23]
motion and second. Unless there
[1:42:25]
is any other discussion, can we
[1:42:28]
have a roll call vote, please.
[1:42:37]
>>clerk: [roll call]
[1:42:38]
>> motion passes unanimously.
[1:43:03]
>> thank you so much.
[1:43:05]
>> okay, we will move to 18.
[1:43:10]
>>
[1:43:25]
18. Request to approve the
[1:43:26]
annual council liaison
[1:43:27]
assignments for calendar year
[1:43:28]
2022
[1:43:29]
we have named on that. It's
[1:43:31]
something that the mayor does
[1:43:33]
and I will give a quick
[1:43:36]
overview if that's okay with
[1:43:40]
you.
[1:43:47]
madam clerk?
[1:43:48]
>> absolutely.
[1:43:49]
>> okay.
[1:43:50]
this is something we just
[1:43:51]
review to make sure that the
[1:43:56]
city is well represented and
[1:44:02]
the council is asked to review
[1:44:05]
and confirm their appointments.
[1:44:06]
and we have gone through this
[1:44:12]
process.
[1:44:14]
are there any comments or
[1:44:22]
questions regarding these
[1:44:23]
appointments? I think we have
[1:44:30]
strong representation in all of
[1:44:33]
the entities that are on this
[1:44:36]
matrix and I thank you for all
[1:44:38]
the extra work you have done
[1:44:44]
with this.
[1:44:51]
can we have a motion, please.
[1:44:53]
>> I motion to approve the
[1:44:55]
committee assignments.
[1:44:57]
>> thank you very much.
[1:44:58]
is there a second.
[1:44:59]
>> second.
[1:45:01]
>>
[1:45:03]
>> roll call, please.
[1:45:08]
>>clerk: [roll call]
[1:45:30]
motion passes 5-0.
[1:45:31]
>> thank you so much.
[1:45:35]
>>19. Request to appoint two
[1:45:47]
(2) city councilmembers to the
[1:45:48]
palm desert ihub advisory board
[1:45:54]
>> good evening mayor and
[1:45:55]
council. I'm the business
[1:45:58]
advocate and also over see the
[1:46:03]
agreement between the city and
[1:46:12]
the coachella valley economic
[1:46:15]
partnership for their oversight
[1:46:20]
of the palm desert hub. Part of
[1:46:21]
the agreement is the advisory
[1:46:23]
committee that has two
[1:46:24]
representatives from the city
[1:46:26]
council as part of it as well
[1:46:33]
as business members and
[1:46:40]
representatives from cal state
[1:46:44]
san bernardino palm desert. So
[1:46:45]
with the staff report, staff is
[1:46:50]
asking for two appointees for
[1:46:55]
that.
[1:46:58]
>> okay. Are there any
[1:47:02]
questions regarding these
[1:47:03]
appointments? I see a hand up.
[1:47:07]
>>council member karina
[1:47:08]
quintanilla: thank you, mayor.
[1:47:11]
my question is what is the
[1:47:14]
projected time that these
[1:47:18]
meetings are scheduled for the
[1:47:24]
I-hub advisory?
[1:47:25]
>> I believe the meetings will
[1:47:29]
be more of an ad hoc schedule.
[1:47:33]
at this point in time it will
[1:47:36]
be through zoom. It will depend
[1:47:43]
on -- this advisory board will
[1:47:46]
be setting up the policies for
[1:47:53]
the I-hub. Most of which is
[1:47:58]
spelled out in the agreement
[1:48:03]
between the city. So I don't
[1:48:05]
anticipate a large period of
[1:48:09]
time. There may be some changes
[1:48:13]
necessary otherwise there would
[1:48:19]
not be a regular standing
[1:48:21]
committee.
[1:48:22]
>> okay.
[1:48:24]
may I offer at this point that
[1:48:28]
I do represent the city on v
[1:48:47]
cva. In my mind, I think it
[1:48:50]
would be best to represent the
[1:48:54]
city in this position.
[1:48:55]
council member kelly?
[1:48:59]
>>council member kathleen kelly:
[1:49:05]
>> yes.
[1:49:20]
I know that the assignment that
[1:49:22]
we just approved included the
[1:49:29]
mayor's continuing appointment
[1:49:39]
as our representative to c
[1:49:50]
back and will council members
[1:49:52]
want to seek a second pointy or
[1:49:56]
go in a different direction?
[1:50:02]
>>
[1:50:13]
>> I'm open to whatever the
[1:50:17]
council decides.
[1:50:19]
>> thank you.
[1:50:20]
>>council member gina nestande:
[1:50:30]
>>council member karina
[1:50:32]
quintanilla: thank you. My
[1:50:35]
question is the point of
[1:50:40]
interests and the city
[1:50:41]
understood and the academy. If
[1:50:43]
the intention is to grow more
[1:50:48]
of the student centered and may
[1:50:56]
work and I feel I have a lot
[1:51:00]
of experience and would serve
[1:51:03]
as a representative should I be
[1:51:05]
selected. Thank you.
[1:51:07]
>> I do want to note and I saw
[1:51:13]
your eyes light up at this
[1:51:20]
agenda item that work with csd
[1:51:26]
and the academy is what we call
[1:51:32]
one future.
[1:51:37]
>> it was actually the post
[1:51:42]
secondary committee to see that
[1:51:44]
I was on the committee.
[1:51:48]
>> that's why and one --
[1:51:57]
>> however, having said that, I
[1:52:01]
wanted to add that clarity. I
[1:52:05]
think it's a great idea if you
[1:52:07]
would like to be on committee
[1:52:11]
that would be great.
[1:52:13]
council member nestande, what's
[1:52:16]
your thought on that?
[1:52:17]
>>council member gina nestande:
[1:52:19]
I defer to you, mayor. It
[1:52:27]
sounds like council member
[1:52:28]
quintanilla has spoken. So I
[1:52:33]
don't need to debate this
[1:52:35]
issue. So congratulations.
[1:52:36]
>> great. I do think we need a
[1:52:41]
motion for that.
[1:52:47]
please.
[1:52:52]
>> so I move that our
[1:53:04]
appointees be mayor harnik and
[1:53:07]
council member quintanilla.
[1:53:08]
>> I second.
[1:53:09]
>> we have a motion and second.
[1:53:10]
>> roll call, please.
[1:53:15]
>>clerk: [roll call] motion
[1:53:41]
passes unanimously.
[1:54:04]
a ¿bicycle rack incentive
[1:54:05]
program½ for private commercial
[1:54:06]
properties
[1:54:10]
>> who will be presenting?
[1:54:15]
>> good evening mayor and
[1:54:19]
council. Eric for development
[1:54:20]
services. We had a request to
[1:54:23]
initiate a bicycle rack
[1:54:39]
incentive program. With the
[1:54:48]
number of bicycle rack
[1:54:53]
improvements on san pablo, we
[1:54:55]
need places to also park the
[1:54:57]
bicycles. The incentive of this
[1:55:00]
program is the city would work
[1:55:06]
with private property owners.
[1:55:12]
the city would purchase bicycle
[1:55:16]
racks and install them on-site
[1:55:19]
with the property owner
[1:55:23]
maintaining them for 10 years.
[1:55:24]
tonight we are looking for
[1:55:27]
direction because we are
[1:55:34]
focused on areas around cv
[1:55:36]
link. And would like to have
[1:55:40]
council provide some feedback
[1:55:42]
onseting a price limit on the
[1:55:50]
bicycle racks.
[1:55:58]
probably some consideration
[1:55:59]
that you may want to go with a
[1:56:03]
different aesthetic. We want to
[1:56:08]
make sure that we
[1:56:22]
are aware of this.
[1:56:25]
I stand for questions and
[1:56:30]
direction.
[1:56:31]
>> we have a question from
[1:56:37]
council member kelly.
[1:56:46]
>>council member kathleen
[1:56:53]
kelly: a couple of questions.
[1:57:04]
first question is if we set up
[1:57:12]
a ceiling for what this city is
[1:57:14]
willing to do by way of
[1:57:17]
incentive, could it also be a
[1:57:20]
part of the program that the
[1:57:26]
site owner would do something
[1:57:34]
more as decor, more compatible
[1:57:39]
with their --
[1:57:45]
>> we would design the program
[1:57:48]
that way.
[1:57:49]
>> the second question is, I
[1:57:52]
see that the staff report
[1:57:55]
requests to us supply three
[1:57:57]
bicycle rack options from the
[1:58:00]
list attached to the report. I
[1:58:03]
didn't come up with how many
[1:58:09]
options there are. And we have
[1:58:23]
100.
[1:58:26]
could it be possible to perhaps
[1:58:37]
for staff to narrow the field
[1:58:42]
space for issues of
[1:58:45]
practicality and design to use
[1:58:46]
palm desert to get some public
[1:58:48]
input because I think we
[1:58:56]
discovered what's around that
[1:58:57]
part that questions around what
[1:59:05]
people are going to see on a
[1:59:10]
continuing basis, really to
[1:59:15]
ignite public interest. So it's
[1:59:17]
a great way to drive people to
[1:59:21]
the palm desert site. Would
[1:59:25]
that be a possible option?
[1:59:30]
>> absolutely. We can do that
[1:59:38]
and take a look at the number
[1:59:44]
of bikes presented and get that
[1:59:50]
communication to you.
[1:59:53]
>> cv links will probably be a
[1:59:56]
great resource also.
[2:00:00]
>>mayor pro tem sabby jonathan:
[2:00:06]
thank you, mayor.
[2:00:07]
so I do have some feedback for
[2:00:11]
staff and I will hold back for
[2:00:13]
the appropriate time as far as
[2:00:19]
questions.
[2:00:21]
number one, good evening to you
[2:00:25]
sir. Thank you.
[2:00:29]
I indicated a cost to about 400
[2:00:40]
to $1,000. In my experience,
[2:00:42]
installation is often equal to
[2:00:49]
a greater cost fof finding it.
[2:00:56]
is your cost estimate for the
[2:01:00]
cost installation?
[2:01:02]
>> that would be for the public
[2:01:08]
works team.
[2:01:09]
>> I'm super ethiopia hear that
[2:01:11]
because that was the second
[2:01:13]
question I had. Can we use our
[2:01:18]
own staff to do the
[2:01:25]
installation on private
[2:01:26]
property and I think you are
[2:01:28]
saying yes?
[2:01:29]
>> yes, we would be drafting an
[2:01:34]
agreement that requests to let
[2:01:38]
us on to their property.
[2:01:47]
>> my other question is whether
[2:01:49]
or not staff has considered
[2:01:52]
allowing the use of a parking
[2:01:59]
space without the owner coming
[2:02:02]
into violation of the zoning
[2:02:03]
ordinance or development
[2:02:04]
agreement or whatever
[2:02:06]
restriction there are on the
[2:02:09]
number of parking spaces. Has
[2:02:11]
staff considered this program
[2:02:12]
to be allowed as a parking
[2:02:14]
space to a bike rack?
[2:02:19]
>> we have appropriate some of
[2:02:34]
our larger regional centers and
[2:02:38]
we will look at that on a case
[2:02:42]
by case basis. We want to work
[2:02:45]
with the property owner for the
[2:02:48]
location of the bicycle rack so
[2:02:51]
they are easily identifiable
[2:02:53]
and people are going to be
[2:02:56]
using these bicycles. We can
[2:02:59]
use this parking space as part
[2:03:02]
of that.
[2:03:04]
>> as part of that question,
[2:03:05]
you want to keep in mind the
[2:03:08]
process with the number of
[2:03:10]
bicycle riders that don't have
[2:03:12]
access to street parking. So
[2:03:15]
they are limited in terms of
[2:03:21]
where they can put this.
[2:03:27]
>>
[2:03:28]
>>council member karina
[2:03:29]
quintanilla: thank you for
[2:03:31]
your very comprehensive list of
[2:03:34]
options here. In thinking of my
[2:03:36]
time in working with higher
[2:03:40]
education the university has
[2:03:44]
the ones that are allowable for
[2:03:47]
extra space. Is there some
[2:03:50]
installation or something that
[2:03:52]
was thrown into the list of
[2:03:55]
options?
[2:03:56]
>> it was a list of options.
[2:04:03]
>>
[2:04:04]
>>council member gina nestande:
[2:04:06]
this might be more of a
[2:04:08]
comment, but I will go for it.
[2:04:13]
for the city link, this is
[2:04:15]
perhaps something that our
[2:04:17]
committee can look at our next
[2:04:19]
meeting as well because looking
[2:04:24]
at -- and maybe just the
[2:04:27]
standard bike rack is the ideal
[2:04:31]
situation that can hold the
[2:04:32]
most bikes. I think we need to
[2:04:41]
look at practicality to staff
[2:04:42]
in my opinion. Thank you.
[2:04:46]
>>mayor jan harnik: council
[2:04:57]
member kelly?
[2:04:58]
>>council member kathleen
[2:04:59]
kelly: what is staff's
[2:05:00]
recommendation?
[2:05:01]
>> we don't have a
[2:05:03]
recommendation. The cost of
[2:05:06]
those will draw the program
[2:05:09]
quicker. You have maximum
[2:05:12]
amount to spend on this.
[2:05:16]
>> thank you.
[2:05:20]
>> council member?
[2:05:22]
>> thank you, mayor.
[2:05:25]
I have another question,
[2:05:28]
something that is very
[2:05:35]
minimalistic and functional and
[2:05:37]
if someone wants to get a
[2:05:42]
little fancier.
[2:05:43]
>> I think we can set up the
[2:05:45]
program that way.
[2:05:46]
>> time for comments?
[2:05:54]
>> due to inadequate needs,
[2:05:55]
this is a great idea and I love
[2:05:58]
it.
[2:06:00]
I think that it occurs to me
[2:06:03]
that this might lend itself to
[2:06:06]
the subcommittee to work with
[2:06:07]
staff to address those details
[2:06:11]
and I would be happy and
[2:06:12]
something like the icon edge or
[2:06:16]
some of the other hedges that
[2:06:18]
are just for a bike rack. Even
[2:06:22]
the artistic ones are very
[2:06:24]
sturdy. There is a lot of good
[2:06:28]
options there and using
[2:06:30]
something with the icon edge
[2:06:34]
with an artistic manner gives
[2:06:36]
the owner the option of
[2:06:44]
installing with.
[2:06:45]
I think this shouldn't be just
[2:06:50]
the high demand areas because
[2:06:52]
there are some areas that is
[2:06:57]
part of the encouraging to go
[2:07:01]
green these days.
[2:07:02]
that covers my feedback for
[2:07:04]
now. Thank you.
[2:07:07]
>>mayor jan harnik: thank you.
[2:07:09]
>>council member karina
[2:07:15]
quintanilla: thank you, mayor.
[2:07:16]
the policy, is that something
[2:07:20]
that could be added to the palm
[2:07:26]
desert --
[2:07:27]
>>council member kathleen
[2:07:30]
kelly: let me take a stab at
[2:07:37]
the motion to establish the
[2:07:47]
subcommittee. As council member
[2:07:50]
stated is using the reservation
[2:07:52]
and motion to give the staff
[2:07:53]
direction is yes, we love the
[2:08:03]
idea, no. 2, is the city, that
[2:08:09]
goes for both, and thirdly, to
[2:08:16]
using the suggested and
[2:08:20]
deferring the issue of the cap
[2:08:27]
on subsidy.
[2:08:30]
>> okay.
[2:08:32]
>>mayor jan harnik: we have a
[2:08:34]
motion and second. I'm going to
[2:08:37]
add a few comments because I do
[2:08:41]
also ride a bike. So let's ask
[2:08:45]
those bicyclist who are out
[2:08:50]
there and council member
[2:08:56]
nestande and uc davis and they
[2:08:57]
have bicyclist and the stands
[2:08:58]
and repairs and of course I
[2:09:00]
have pictures of all of them.
[2:09:13]
>> roll call, please.
[2:09:19]
>>clerk: [roll call]

[2:09:30]
>> thank you.

21. Request for direction on
[2:09:42]
the meeting format for
[2:09:43]
committee, commission and
[2:09:45]
council meetings (
[2:09:46]
this is for the council if you
[2:09:48]
would prefer to have virtual
[2:09:51]
meetings during the pandemic.
[2:09:53]
>>mayor pro tem sabby jonathan:
[2:09:54]
thank you. Yeah, I think
[2:09:57]
staff's recommendation makes
[2:09:58]
sense. I think this is a long
[2:10:00]
time that we are in a surge. We
[2:10:08]
should go to hybrid meetings
[2:10:10]
once the council chamber has
[2:10:15]
been completed and the acr and
[2:10:23]
omicron and some other variant.
[2:10:25]
>>council member gina nestande:
[2:10:26]
I was just going to say is that
[2:10:30]
I don't know if we can give
[2:10:33]
that option to those that want
[2:10:43]
to do that.
[2:10:44]
>>council member karina
[2:10:48]
quintanilla: that's what I
[2:10:50]
have heard from other
[2:10:54]
residents.
[2:10:55]
>> some of the flexibility
[2:10:56]
there. And the key thing is
[2:11:01]
number one keeping people safe,
[2:11:07]
no. 2, we have lived here for
[2:11:10]
decades and we have the zoom
[2:11:11]
format and we have to comply
[2:11:13]
with one or the other. We can
[2:11:17]
kind of modify wherever you are
[2:11:19]
to zoom and that level of
[2:11:23]
participation. So we are really
[2:11:29]
rather constrained.
[2:11:32]
>> does that answer your
[2:11:35]
question?
[2:11:36]
>> yes. It does. Thank you.
[2:11:39]
>>mayor jan harnik: I think we

>>
[2:11:53]
>>council member karina
[2:11:55]
quintanilla: with that, I will
[2:11:57]
add my comment now.
[2:11:59]
I think it's still the safest
[2:12:03]
until the surge has dropped. Is
[2:12:07]
there a threshold that staff
[2:12:09]
has for this committee but I
[2:12:13]
would be in favor to stay
[2:12:18]
virtual to preserve public
[2:12:25]
health.
[2:12:26]
>> it can be virtual and in the
[2:12:30]
conference room. So we have 25
[2:12:32]
days away from the rooms to
[2:12:37]
start to become available. We
[2:12:44]
can reevaluate that climate.
[2:12:46]
>>council member kathleen
[2:12:47]
kelly: which was just clarified
[2:12:49]
to keep our meetings virtual
[2:12:55]
until we are concurrent with
[2:12:58]
many of the comments that are
[2:13:00]
made and our committees need
[2:13:05]
clarity. We need that and
[2:13:10]
staff's recommendation is very

sound.

[2:15:42]
committee concerns. The
[2:15:43]
community engagement intended
[2:15:44]
to have the following. The city
[2:15:48]
supports increasing the public
[2:15:54]
notification of certain
[2:15:55]
developments, broadening the
[2:15:58]
audience and also as part of
[2:16:04]
the application the community
[2:16:05]
engagement plan to be reviewed
[2:16:07]
by staff to adequately closing
[2:16:11]
documents of long-term planning
[2:16:14]
efforts and potential future
[2:16:16]
projects including the
[2:16:20]
disclosures of the city's --
[2:16:21]
respond to public hearing and
[2:16:28]
public notifications.
[2:16:37]
so, our section 25.60.060, with
[2:16:39]
what 300 feet is which is what
[2:16:43]
is required and the new
[2:16:46]
requirement.
[2:16:48]
the developers are required to
[2:16:50]
submit a community engagement
[2:16:52]
plan for projects 5 acres or
[2:16:55]
more. That is done at the time
[2:17:00]
-- a method of communication
[2:17:01]
with the public and locations
[2:17:02]
for the public outreach to take
[2:17:05]
place. It is also a requirement
[2:17:11]
to submit any package.
[2:17:13]
the requirement is one meeting
[2:17:16]
at minimum with follow up
[2:17:19]
meetings as directed by the
[2:17:23]
department of services and
[2:17:24]
project engagement with the
[2:17:28]
public.
[2:17:29]
the notification of the
[2:17:31]
meetings will include a
[2:17:34]
thousand notifications as well
[2:17:37]
and how those concerns are
[2:17:41]
being met.
[2:17:45]
the third ordinance
[2:17:47]
recommendation is any
[2:17:48]
residential property located
[2:17:50]
within our city is to deliver
[2:17:53]
the prospective buyer through
[2:17:57]
closing documents, the real
[2:17:58]
estate tax disclosure, the
[2:18:00]
resale of homes in older
[2:18:03]
subdivisions to benefit from
[2:18:05]
awareness of likely development
[2:18:14]
in the vicinity.
[2:18:16]
this concludes the staff
[2:18:18]
report.
[2:18:19]
>> thank you so much.
[2:18:20]
I see two hands for questions.
[2:18:25]
>>council member karina
[2:18:27]
quintanilla: would anyone like
[2:18:30]
attendance sheets be required
[2:18:33]
or sign in sheets? I believe
[2:18:35]
that was brought up in a
[2:18:39]
previous conversation.
[2:18:41]
>> so part of those meetings,
[2:18:43]
city staff will have to
[2:18:45]
participate. City staff will be
[2:18:47]
there and if it is an in person
[2:18:50]
meeting, there will be those
[2:18:53]
sign in sheets. There is no
[2:18:54]
requirement of the number of
[2:18:56]
people that will show up.
[2:19:09]
>>council member kathleen
[2:19:13]
kelly: we essentially -- is
[2:19:16]
that correct?
[2:19:17]
>> that's correct.
[2:19:18]
>> what I see in the staff
[2:19:29]
requirement that resale of
[2:19:30]
homes would lead to the
[2:19:35]
disclosure called for. It's not
[2:19:41]
the 5 acres issue.
[2:19:44]
what I'm looking at in page 5,
[2:19:52]
clarifying that the new
[2:19:55]
language on disclosures only
[2:19:58]
applies to new.
[2:20:03]
>> also wanted to provide the
[2:20:09]
opportunity to have, for
[2:20:15]
example, for
[2:20:18]
today.
[2:20:19]
>> thank you. That's helpful.
[2:20:30]
>> thank you.
[2:20:31]
>> when this issue came up, of
[2:20:37]
course it was enforcement and
[2:20:42]
when the california real estate
[2:20:53]
disclosure and fire risk, with
[2:20:57]
this issue and directed to the
[2:21:03]
city's website and ends up
[2:21:06]
building their own home. If you
[2:21:10]
follow the state law that
[2:21:14]
already has the format. So
[2:21:15]
that's why it went this way.
[2:21:20]
it's something that is already
[2:21:25]
there and we can develop this
[2:21:31]
straight forward for that to
[2:21:33]
happen.
[2:21:34]
>>mayor pro tem sabby jonathan:
[2:21:38]
thank you.
[2:21:39]
so, item 5. That is under scope
[2:21:44]
of regulations. It says the
[2:21:56]
following.. And something that
[2:22:13]
wouldn't create basically
[2:22:17]
unlimited power.
[2:22:18]
>> how to correct this or
[2:22:19]
revise this if the council
[2:22:22]
wishes. The thought process
[2:22:24]
really was to see what kind
[2:22:30]
those community members are,
[2:22:31]
what are we going to see from
[2:22:35]
our backyard. So they already
[2:22:38]
provide those line of site. So
[2:22:40]
we just wanted to reserve our
[2:22:41]
right to be able to request
[2:22:47]
those various kinds to really
[2:22:51]
help and assist.
[2:22:54]
>> let me help you direct your
[2:22:56]
answer to my question.
[2:22:57]
>> sure.
[2:22:59]
>> I understand what developers
[2:23:01]
provide and what they don't
[2:23:05]
provide. This particular
[2:23:07]
provision -- staff is not cost
[2:23:15]
conscious, right? A
[2:23:18]
3-dimensional plan can cost,
[2:23:19]
has staff considered some kind
[2:23:21]
of limitation on this
[2:23:24]
open-ended authority for staff
[2:23:29]
to request additional items.
[2:23:33]
>> to give me a week or so
[2:23:44]
with staff. To address the
[2:23:47]
concerns that are being
[2:23:48]
generated to the city council
[2:23:49]
this last year. I'm not quite
[2:23:54]
sure how that procedurally
[2:23:55]
require that before we take it
[2:23:58]
to the city council. I tend to
[2:24:01]
agree with you. This is not
[2:24:05]
intended to be a bureaucratic
[2:24:11]
backstop.
[2:24:27]
>>council member kathleen kelly:
[2:24:32]
mayor pro tem jonathan's
[2:24:38]
suggestion, because certainly
[2:24:45]
can -- the rails for the
[2:24:51]
perspective. We'll find the
[2:24:56]
middle ground.
[2:25:00]
>> our next meeting.
[2:25:03]
>> that will end the public
[2:25:06]
hearing.
[2:25:08]
>> good point.
[2:25:11]
>>
[2:25:12]
>>mayor jan harnik: so why --
[2:25:17]
or do we have to open the
[2:25:18]
public hearing if we are going
[2:25:25]
to continue it? Mr. Hargrave?
[2:25:28]
>> if we know we are coming
[2:25:31]
back in 2 weeks, we go to a
[2:25:37]
public hearing. And then
[2:25:42]
continue to a date certain so
[2:25:45]
that way we don't have to
[2:25:47]
renotice it.
[2:25:48]
>> why don't we do that to
[2:25:50]
speak on it at this point.
[2:25:52]
unless there are additional
[2:25:53]
questions of staff, I will open
[2:25:59]
the public hearing.
[2:26:03]
and now why don't we move to
[2:26:05]
continue this to the next
[2:26:10]
meeting.
[2:26:12]
>> second.
[2:26:19]
>> we have a motion and second.
[2:26:22]
can we please have a roll call
[2:26:29]
vote.
[2:26:32]
>>clerk: [roll call]
[2:26:33]
>> motion to continue passes
[2:26:48]
5-0.
[2:26:49]
>> that public hearing remains
[2:26:53]
open at our next meeting.
[2:26:55]
that marks the end of our
[2:26:59]
meeting except for city manager
[2:27:03]
comments.
[2:27:04]
>> I have no comments tonight,
[2:27:06]
mayor.
[2:27:07]
>> thank you. And seeing no
[2:27:12]
unfinished business, this
[2:27:14]
meeting stands adjourned.
