[18:21] has to in 2016 firefighters
[18:22] negotiate for an option to
[18:23] establish a medical veba for
[18:23] its membership a tax exempt
[18:28] trust to provide health care a
[18:28] benefit enjoyed by many groups
[18:29] across the state.
[18:30] We spent thousands of dollars
[18:33] on recognized experts as
[18:34] required by city attorney and
[18:34] risk management to demonstrate
[18:35] both the legality and
[18:36] the viability of such a plan.
[18:39] The city reaffirmed that option
[18:40] by approving it multiple mou
[18:40] cents.
[18:41] Now when firefighters here are
[18:46] ranked 23rd of 23 departments
[18:47] surveyed when firefighters
[18:47] would be going to work for
[18:48] the last 55 days without a
[18:51] contract, the city's
[18:52] negotiating team appears to be
[18:52] holding a new contract hostage
[18:53] on the premise that
[18:54] firefighters must agree to have
[18:58] this benefit stripped.
[18:58] This cost the city nothing.
[18:59] It already exists in our mou.
[19:00] We're no more important than
[19:03] other city employees but
[19:04] sometimes our needs are
[19:04] different.
[19:05] We should be allowed to pursue
[19:06] our needs just as other groups.
[19:06] We're not here to ask for
[19:09] anything more than what you've
[19:10] already approved.

[19:11] preserve the status quo with
[19:12] regard to firefighter medical

[19:51] for San Diego employees.

[20:03] the same thing because you know
[20:04] there are serious budget issues
[20:04] they have They're doing

[20:15] to consider the idea of our
[20:19] city workers taking a 25 to $50
[20:20] pay cut a month That's like
[20:24] $600 a year And that actually
[20:25] brings a budget savings of
[20:25] close to 1 or $2 million.

[20:31] option and keep our benefits?
[20:31] I think benefits are vitally
[20:32] important.

[21:37] fellows that work in the San
[21:42] Diego rescue and lifeguarding
[21:43] and police and public safety.

[22:31] abused in such a way to have
[22:35] their benefits taken kind of
[22:36] force them to sign a contract

[22:43] be forced to sign something.
[22:43] But you know, as we're talking
[22:47] about labor negotiations, it's
[22:47] a little bit interesting to see
[22:48] what's happening with
[22:49] the litigation with that and
[22:49] where you're going to be
[22:53] bringing in you know,
[22:54] discussing labor negotiations
[22:58] And when we have issues like
[22:59] this going on and for such a
[23:00] significant importance position
[23:05] because these guys do work that
[23:05] you know most people won't do
[23:06] but we need them And I feel
[23:11] like they get treated kind of
[23:11] you know, like they get
[23:12] the leftovers Whatever's left
[23:17] over after you know, you give
[23:18] all your employees in the city
[23:18] that are working with you guys
[23:22] all of their money, all of
[23:23] their benefits And then we have
[23:24] people that are on the job that
[23:28] are physically exerting a lot
[23:29] of energy and potentially, you
[23:30] know, getting injuries that
[23:34] nobody else that worked in
[23:35] the city are going to get And
[23:35] then we're cutting their
[23:36] benefits like they should
[23:36] actually have more.
[23:40] And if you do have to take from
[23:41] some of those employees that
[23:42] have been getting, you know,
[23:46] these significant pay raises
[23:47] that potentially, you know,
[23:48] work for the mayor or your
[23:48] guys's staff, I mean I think
[23:52] that these people deserve
[23:53] benefits over that pay raise
[23:54] that those people are getting.
[23:54] So if we have to make some hard
[23:58] choices, that's what needs to
[23:58] be done.
[23:59] And so I hope you guys do
[23:59] the right thing because you
[24:00] know, when they when you need
[24:05] them you're not going to want
[24:05] to, you know, have made a
[24:06] mistake for over a minute on
[24:06] that topic.
[24:10] On to another item There's two
[24:10] labor negotiation or one about
[24:15] fire and lifeguards and one
[24:15] about labor negotiations.
[24:16] So there's two of them in
[24:16] there.

[24:26] and fall in the bike accident
[24:26] you guys need to you're with
[24:27] the way that you were telling

[24:38] that back so it can be
[24:39] transparent just right off

[24:49] saying this this year or this
[24:50] And all time we have spent on
[24:51] litigation for trip and falls
[24:55] for bike accidents for whatever
[24:56] and then show that you have
[24:56] gone into those areas where
[24:57] those accidents occurred and
[25:01] that has been mitigated and how
[25:02] much it cost to do that and
[25:07] what the cost benefit ratio is
[25:08] of you know the litigation and
[25:08] we're just fixing the roads and
[25:09] making sure that this kind of
[25:13] stuff doesn't happen on a
[25:14] continual revolving door basis.

[26:20] So I think it's a powerful way
[26:21] to look at this and to know
[26:25] that we're doing our best, that
[26:26] we are improving Regarding
[26:27] the sidewalks, that's for sure.
[26:33] I like this metaphor and it's
[26:34] just continuing and we need to
[26:34] just keep on top of
[26:38] the discussion We can see as to
[26:39] I'm not quite clear on
[26:40] the details of this item's
[26:43] purpose here and the speakers
[26:44] speak some very powerful words.
[26:49] I really respect and honor our
[26:50] and we'll use the memorandums
[26:51] of understanding.

[27:27] that have the back of our
[27:27] employees and all the labor
[27:31] association.

[50:28] Statement of Budgetary
[50:28] Principles.
[50:32] The documents that staff will
[50:32] be going over are essentially
[50:33] an agreed upon set of reporting
[50:34] and communication
[50:38] responsibilities for both this
[50:38] Council and administration as
[50:42] it actually implement the fy
[50:42] 2027 budget.
[50:43] So the best practice to ensure
[50:43] that both the administration
[50:48] and the Council agree on
[50:49] the communication and roles and
[50:49] responsibilities associated
[50:50] with the budget that are before
[50:53] each of those bodies.

[50:57] the actual statement itself.

[50:59] that this statement of
[50:59] principles essentially covers
[51:03] everything that you saw in
[51:04] the prior statement for fy 2026

[51:30] year 2027 Statement of
[51:31] Budgetary Principles Since
[51:32] the Statement of Budgetary
[51:32] Principles is an annual
[51:35] agreement between Council and
[51:36] the Mayor our office obtain
[51:37] review and input from
[51:37] the Department of Finance as
[51:40] well as the City Attorney's
[51:40] Office.
[51:41] We appreciate their
[51:41] collaboration.
[51:42] We're asking the Council to
[51:46] review and adopt the principles
[51:46] with any desired modifications.
[51:50] By way of background,
[51:51] the Statement of Budgetary
[51:51] Principles represents an
[51:52] agreement between Council and
[51:56] the Mayor for administration of
[51:56] the budget.
[51:57] It clarifies budgetary
[51:57] authority and facilitates
[52:01] communication regarding
[52:01] the budget.
[52:02] The need for the principles
[52:02] came with the transition to
[52:05] the strong mayor strong council
[52:06] form of government.
[52:07] At the time there was a lack of
[52:10] clarity between the executive
[52:11] and legislative branches about
[52:12] budget administration and
[52:12] handling of related fiscal
[52:15] matters.
[52:16] The statement of budgetary
[52:20] principles was put into place
[52:20] in fiscal year 2008 as an
[52:24] accompanying resolution to
[52:24] the fiscal year 2000.
[52:25] The appropriation ordinance
[52:26] since then has been adopted
[52:29] each year and we recommend it
[52:29] to continue for fiscal year
[52:29] 2027.
[52:33] The proposed principles were
[52:34] heard on the JULY 8th Budgeting
[52:38] Government official commit
[52:39] Government Efficiency Committee
[52:39] which forwarded it to council
[52:40] without any additional
[52:43] adjustments.
[52:47] The principles can be broken
[52:48] down into three sections.
[52:49] First the communication on
[52:52] budget programs services.
[52:53] The second is the Appropriation
[52:56] ordinance.
[52:57] And third is the principles for
[52:58] an effective, collaborative and
[53:01] transparent city budget
[53:01] process.
[53:02] I will provide highlights for
[53:03] these functions for these
[53:06] sections later in this
[53:07] presentation.
[53:07] The proposed fiscal year 2027
[53:11] principles largely mirrored
[53:12] those of fiscal year 2026 with
[53:13] most revisions consisting of
[53:16] updated dates and technical
[53:16] adjustments.
[53:17] I do want to note that there is
[53:18] one proposed substantive
[53:21] judgment which is a requirement
[53:21] for an annual update on
[53:22] the city's settlement and
[53:22] judgment payments including
[53:26] related expenses and claim
[53:26] information for the police
[53:27] department.
[53:30] This adjustment stems from a
[53:31] request that came out of
[53:31] the JUNE 17th Budget and
[53:32] Government Efficiency Committee
[53:35] meeting.
[53:39] >> Moving on to the three
[53:40] sections of the proposed
[53:40] principles the first outlines
[53:44] how communications should occur
[53:45] regarding budget to programs
[53:45] and services.
[53:49] The principles require
[53:50] the mayor to provide quarterly
[53:51] reports to the council which
[53:51] are done through the quarterly
[53:54] budget monitoring reports.
[53:55] The mid-year budget process is
[53:56] also included in this
[54:00] requirement under which
[54:00] the Mayor MAY recommend to
[54:01] council how to budget any
[54:02] projected surplus or how to
[54:04] adjust any projected deficit.
[54:05] For the third bullet the mayor
[54:09] must provide written notice to
[54:09] council before implementing any
[54:13] significant reduction or delay
[54:14] to a funded program.
[54:15] This written notice must
[54:18] include justification and a
[54:19] description of service level
[54:20] impacts including potential
[54:23] unintended consequences that
[54:24] create disproportionate
[54:25] inequity for communities of
[54:25] concern.
[54:28] We emphasize the importance of
[54:29] both clear communication and
[54:30] making any reductions
[54:33] thoughtfully.
[54:38] >> The next section sets out a
[54:39] sets of principles for
[54:40] the Appropriation Ordinance or
[54:43] aoe The principles preserve
[54:44] the intent that the aoe is a
[54:45] document to implement adopted
[54:47] budget and does not provide
[54:48] policy direction.
[54:48] The principles also state that
[54:53] neither the mayor nor Council
[54:53] have unilateral authority to
[54:54] make changes to the spending
[54:57] authority in the budget.
[54:58] Accordingly, Council cannot
[55:01] change the budget without first
[55:02] receiving a funding
[55:03] recommendation from the mayor.
[55:07] And finally the mayor must in
[55:07] good faith fulfill
[55:08] the legislative intent
[55:12] reflected in the budget.
[55:12] The principles further include
[55:13] Council's intent that services
[55:14] be implemented equally and
[55:19] equitably.
[55:20] >> The final section in
[55:20] the principles applies to an
[55:23] effective city budget process.
[55:24] This line lists some of
[55:25] the principles for a fiscally
[55:26] responsible budget process
[55:28] including eliminating
[55:29] the structural budget deficit
[55:30] for pursuing service delivery
[55:34] efficiencies, maintaining
[55:34] reserves and planning for
[55:35] deferred capital infrastructure
[55:43] and its maintenance.
[55:44] >> Other principles for an
[55:44] effective city budget process
[55:45] include limiting programmatic
[55:48] supplemental positions.
[55:49] The principles note that
[55:49] programmatic supplemental
[55:53] positions should only be
[55:54] requested after the fiscal
[55:55] year's first quarter unless
[55:58] the need for these positions
[55:59] could not have been anticipated
[55:59] during the budget adoption
[56:03] process and waiting until
[56:03] the end of the first quarter
[56:04] would restrict the city's
[56:05] ability to provide critical
[56:08] services.
[56:08] Other principles include having
[56:09] council committees review key
[56:13] performance indicators or KPIs
[56:13] and ensuring collaboration and
[56:18] carrying out council's policy
[56:18] directives including
[56:19] the Programs Council has
[56:22] included in the adopted budget
[56:23] and the city's labor
[56:23] negotiation policies.
[56:28] The principals also encourage
[56:28] council members to discuss any
[56:29] proposed adjustments with our
[56:32] office before Council's final
[56:33] budget adoption meeting so that
[56:33] we MAY provide feedback.
[56:38] As we noted earlier, there is
[56:38] one proposed substantive change
[56:39] to the principals.
[56:42] This new change would require
[56:42] the risk management department
[56:43] to give City Council an annual
[56:44] presentation on the city's
[56:47] settlement and judgment
[56:48] payments including related
[56:48] expenses and claim details for
[56:52] the city's police department.
[56:53] Again, this proposal reflects a
[56:58] request a request made at
[56:58] the JUNE 17th dng Committee

[1:00:42] to understand why we're making
[1:00:42] these settlements and ways that
[1:00:43] we can avoid them And that goes
[1:00:47] much further to all forms of

[1:00:49] settlements you have on this
[1:00:55] Tomorrow's budget for trip and
[1:00:56] falls and flooding that are
[1:00:57] totaling tens hundreds of
[1:00:59] millions of dollars a year.
[1:01:00] But I wanted to speak most to
[1:01:04] this issue on that aspect of
[1:01:04] effective collaborative and
[1:01:08] transparent communication in a
[1:01:09] mayor council form of
[1:01:13] government as Apple clickable
[1:01:14] to the city's budget process.
[1:01:19] My concern or my example I
[1:01:19] would give about the really
[1:01:24] significant importance of this
[1:01:24] is this complete breakdown that
[1:01:25] we had on the restrooms in
[1:01:29] mission Bay.
[1:01:29] I wasn't the only one to
[1:01:33] express concerns about
[1:01:33] the closure of those restrooms
[1:01:37] in JULY before you went on your
[1:01:38] hiatus.
[1:01:39] The fact that it got past
[1:01:42] the budget approval process
[1:01:43] when at least one of you
[1:01:48] opposed the closure of those
[1:01:49] restrooms and that they
[1:01:49] continued closed for another
[1:01:53] month in the face of
[1:01:57] significant public outcry for
[1:01:58] want of a better word is really
[1:02:02] unacceptable.
[1:02:03] That should not have happened
[1:02:04] And I don't think as members of
[1:02:07] the public we care what
[1:02:08] the reason why they were closed
[1:02:12] and more importantly why it
[1:02:13] took more than a month to open.
[1:02:14] But nobody and I think
[1:02:17] yourselves included wants to
[1:02:18] see that happen again.

[1:08:59] workforce has expanded from
[1:09:03] 11,000 employees in 2005 to
[1:09:07] 13,000 in 2025 a 20% increase.
[1:09:07] Notably during that period
[1:09:08] management level positions
[1:09:12] surged by 461% this year.
[1:09:17] Meantime, along a 10% rise in
[1:09:22] the city's population, I want
[1:09:22] to point out that there is an
[1:09:26] example that the city could
[1:09:27] follow and perhaps collaborate
[1:09:27] with the city of Temecula.
[1:09:35] It became debt free after
[1:09:35] $76.86 million was paid off.
[1:09:36] The officially declared itself
[1:09:39] debt free.
[1:09:40] The city including the city
[1:09:44] manager announced
[1:09:45] the achievement in JULY 2026
[1:09:49] Temecula City Council Under
[1:09:50] the city's definition debt
[1:09:54] included mortgages facility
[1:09:54] loans, unfunded pension
[1:09:55] obligations and long term
[1:09:59] liability.
[1:10:00] If the payoff was the result of
[1:10:04] a multi-year financial strategy
[1:10:05] that addressed facility loans,
[1:10:09] mortgages unfunded pension
[1:10:10] obligations and other long term
[1:10:11] liabilities By resolving these
[1:10:15] obligations the city not only
[1:10:16] removed debt from its balance
[1:10:20] sheet but also reduced future
[1:10:21] interest costs significantly.
[1:10:25] However, this can only be done
[1:10:29] if there is a market solution
[1:10:30] and and dedication to being
[1:10:34] into integrity and and
[1:10:35] the public good.

[1:11:08] It seemed that we were going to
[1:11:09] protect everything related to
[1:11:12] our services for the homeless

[1:11:14] And at the very end it appeared
[1:11:14] that we were going to
[1:11:18] discontinue funding for the Neo
[1:11:19] good day center and now it
[1:11:19] appears that the denial good
[1:11:22] day center is going to be
[1:11:23] permanently closed and licensed
[1:11:24] from operation.
[1:11:27] That is a very different
[1:11:28] outcome from what we expected
[1:11:29] at the beginning and I can
[1:11:32] assure you the community
[1:11:33] response would have been much
[1:11:33] more aggressive had we known
[1:11:37] that a as a decrease in funding
[1:11:38] was going to be an absolute
[1:11:39] shutdown of the neo good day
[1:11:43] center To put that in
[1:11:43] perspective.
[1:11:44] The name of the Day Center has
[1:11:46] either 6 or 8 men's and women's
[1:11:47] stalls four bathrooms.
[1:11:50] That is over 50% of
[1:11:51] the available public bathrooms
[1:11:51] in the city of San Diego for
[1:11:55] people experiencing
[1:11:55] homelessness.
[1:11:56] >> That is an outrageous
[1:11:56] outcome.
[1:12:00] John I'm going to interrupt
[1:12:01] because I have to be fair to
[1:12:01] everyone.
[1:12:02] We're talking about
[1:12:04] the budgetary principles not
[1:12:05] about any facility or any
[1:12:06] budget allocation So understood
[1:12:09] and understood And what I'm
[1:12:10] seeking is more clarity when a
[1:12:14] shift like that is going to
[1:12:14] occur.
[1:12:15] So I and I apologize for
[1:12:19] getting into in depth into that
[1:12:20] I understand.

[1:13:10] the best practices of budget
[1:13:10] austerity to immediately solve
[1:13:11] our budget issues a budget
[1:13:16] deficit issues.
[1:13:17] >> It was a fine that was a
[1:13:18] program that was created kind
[1:13:20] of in the 80s and 90s and it
[1:13:20] was the accepted standard way
[1:13:21] to work.
[1:13:25] But we're trying to understand
[1:13:26] the concepts that human beings
[1:13:30] come first before ledger books
[1:13:31] And that is been a bit of a
[1:13:32] difficult journey for
[1:13:32] ourselves.
[1:13:35] We're learning how to navigate
[1:13:35] it.
[1:13:36] I hope we can continue that
[1:13:37] important journey into next
[1:13:40] year into 2027.
[1:13:41] So you know budget time in MAY
[1:13:47] of next year for 2028 we will
[1:13:47] be much more ready to talk
[1:13:51] about equity and talk about
[1:13:52] best practices so people don't.
[1:13:52] Services don't get cut.
[1:13:57] And then how we learn those
[1:13:57] principles.
[1:13:58] I want to be better prepared
[1:13:59] about how we learn
[1:14:02] the principles that we feel
[1:14:03] that continuing health care
[1:14:08] benefits and retirement
[1:14:08] services for our city
[1:14:09] government workers in times of
[1:14:13] stress is I think an important
[1:14:14] principle and that a pay cut
[1:14:15] MAY actually possibly be a
[1:14:19] little easier than cutting.
[1:14:19] You know, our concerns and our
[1:14:24] and our retirement concern for
[1:14:25] city workers it's learning a
[1:14:26] principle system that we're
[1:14:30] trying to navigate and better
[1:14:30] understand for all of us
[1:14:31] because look how we can do that
[1:14:32] And I think it can make our
[1:14:35] future better decisions better.
[1:14:36] And it has to be based on
[1:14:37] the choices of humanity and not
[1:14:41] serving economic forecasts and
[1:14:41] and ledger books.

[1:15:03] the structural budget deficit.
[1:15:03] You know maybe have and I put
[1:15:08] forward about proposed ballot
[1:15:09] measures that would have gone
[1:15:09] on the NOVEMBER ballot to
[1:15:13] eliminate the structural budget
[1:15:14] deficit.
[1:15:14] But instead of the debate
[1:15:19] giving a written report on why
[1:15:19] they think our numbers were
[1:15:24] incorrect, all we got was a
[1:15:25] verbal thing saying that it
[1:15:30] wouldn't make that much money
[1:15:31] wouldn't solve the structural
[1:15:31] budget deficit.
[1:15:35] But instead of using our
[1:15:36] numbers of about $140 million
[1:15:37] that would have came here that
[1:15:37] would have solved all your
[1:15:38] problems.
[1:15:42] And I just want to I would like
[1:15:43] the idea to actually put
[1:15:48] something in writing instead of
[1:15:49] just have it being verbal.
[1:15:50] You know, this was a plan to
[1:15:54] eliminate the structural budget
[1:15:54] deficit by identifying new
[1:15:55] revenue sources.
[1:16:00] One good thing is that the city
[1:16:00] of Los Angeles in JUNE did
[1:16:01] the same thing where they had
[1:16:06] know this was part of changing
[1:16:07] the municipal code to say
[1:16:11] online travel agencies are
[1:16:12] considered hotel operators and
[1:16:13] that they would have to pay
[1:16:15] the full transit occupancy tax
[1:16:22] instead of only a portion of it
[1:16:23] Pretty soon we'll be getting
[1:16:23] information from Los Angeles
[1:16:24] that will probably show that
[1:16:28] they're going to be making so
[1:16:28] much more money.
[1:16:29] They think that they're only
[1:16:33] going to be making an
[1:16:33] additional $3 million for
[1:16:34] the whole year.
[1:16:38] I bet you they will make $3
[1:16:38] million in a couple of weeks
[1:16:39] and they're going to be making
[1:16:43] so much more money and using
[1:16:44] that information you'll see how
[1:16:45] much you guys totally lost
[1:16:45] the ball on this.
[1:16:50] The other thing about this is
[1:16:51] the idea and I believe also
[1:16:51] the city attorney tried to say
[1:16:56] that we needed a two thirds
[1:16:57] voter approval because of
[1:17:03] the measure c because it's a
[1:17:03] special tax.
[1:17:04] >> How about you're talking
[1:17:04] about concluded that only if
[1:17:11] you complete them you not only
[1:17:16] rushfield experience advisors
[1:17:17] When we talk about principals
[1:17:18] it is it is confusing I'm
[1:17:22] confused on all the principals
[1:17:23] I would have changed my what I
[1:17:28] was going to say when I had my
[1:17:29] two minutes to speak on
[1:17:29] the budget If I would have
[1:17:30] understood what these proposals
[1:17:35] are, what we're going to be on
[1:17:36] there, what we're going to be
[1:17:36] on there, what was already
[1:17:37] decided.
[1:17:40] It's very frustrating because
[1:17:41] I'm passionate about what I do.
[1:17:41] I'm passionate about my family
[1:17:42] and what happens to them and
[1:17:46] what these decisions that are
[1:17:47] made that affect me personally
[1:17:47] and the rest of the community
[1:17:53] and those principles Are we
[1:17:53] going off the air,
[1:17:59] the bathrooms being shut down?
[1:18:00] Are they mayors, principals?
[1:18:04] Are we not having shelter?
[1:18:05] We are having shelters.
[1:18:05] Are they planning on putting us
[1:18:10] on on Break Ranch?
[1:18:11] I think there should be
[1:18:11] clarity.
[1:18:12] There should be What's the word
[1:18:16] transparency because it affects
[1:18:17] me personally my children
[1:18:23] personally and the principles
[1:18:24] that I stand by or live by
[1:18:28] don't seem to be the same as
[1:18:29] anybody else's which is fine.
[1:18:35] But the principles that we're
[1:18:36] who are beating us in this
[1:18:40] administration I don't I don't
[1:18:41] think we should be doing
[1:18:42] anything that goes along with
[1:18:42] those principles.

[1:19:52] Also for transparency just so
[1:19:53] that the public can understand
[1:19:56] where our dollars are are
[1:19:57] going.
[1:20:03] Just quickly just listening to
[1:20:03] public comment.
[1:20:09] Quite frankly, I do have
[1:20:09] concerns about this document,
[1:20:16] this effort as it is a
[1:20:16] resolution.
[1:20:17] It is I say an agreement
[1:20:20] between the council and mayor
[1:20:21] in regards to the simply
[1:20:21] communication.
[1:20:26] It does not have any true teeth
[1:20:27] in regards to when that
[1:20:32] agreement is not adhered to,
[1:20:33] whether it's the mayor or
[1:20:33] the council in regards to that.
[1:20:34] But I think the overall
[1:20:39] frustration quite honestly
[1:20:39] relates to our current system.
[1:20:44] And that's the stronger form of
[1:20:45] government.
[1:20:45] I think you are seeing just
[1:20:46] what was put in place, what
[1:20:50] those impacts are and what it
[1:20:51] means to be in a stronger
[1:20:51] system in that authority that
[1:20:56] the mayor has now.
[1:20:57] And so as we continue to move
[1:20:58] forward, that is one thing that
[1:21:01] will be on my mind as we
[1:21:02] continue to move forward and
[1:21:03] that is a discussion of strong
[1:21:08] mayor versus city manager form
[1:21:08] of government.
[1:21:09] So with that I'll begin.

[1:21:55] the limitations of that as well
[1:21:56] And so I don't come in
[1:21:57] pretending like that's not
[1:21:57] the case but look forward to
[1:22:02] continuing to try to see how we
[1:22:03] can improve our communications
[1:22:03] and efforts across the board as
[1:22:10] we work towards another what I
[1:22:10] think is going to be expected
[1:22:11] to be a challenging budget
[1:22:11] year.

[1:23:00] thousand pages a budget and two
[1:23:01] plus 2 billion plus and all
[1:23:01] the different components of
[1:23:07] what we are as I have I want I
[1:23:08] want to really respond to some
[1:23:08] of the public comments but that
[1:23:13] really is not the item in front
[1:23:13] of us.
[1:23:14] I see the work continuing KPIs.
[1:23:15] I've never been a big fan but
[1:23:19] I'll respect those who do see
[1:23:24] those as valuable and continue
[1:23:25] to make to my commitment with
[1:23:26] my amazing staff to make sure
[1:23:30] that we'll do everything we can
[1:23:30] to dig into the budget,
[1:23:31] understand what
[1:23:31] the implications are.
[1:23:32] But as the budgetary principal
[1:23:36] say that when the Council
[1:23:37] adopts the budget that it is
[1:23:37] the mayor on the operation
[1:23:42] sides to carry it out and
[1:23:42] sometimes we find out things
[1:23:43] that we didn't appreciate or
[1:23:48] did not figure out what
[1:23:49] the implications were going
[1:23:49] forward as we saw happen in
[1:23:54] dramatic fashion this month.
[1:23:55] I'm glad we were able to even
[1:23:55] if it took us six weeks to get
[1:23:56] that taken care of.

[1:26:14] for the repeal of Measure c
[1:26:18] amending a people's ordinance
[1:26:18] and associated amendments to

[1:26:24] Local Coastal Program on
[1:26:31] NOVEMBER seventh, 1972, voters
[1:26:31] approved a citizens initiative
[1:26:32] that established the coastal
[1:26:36] height limit overlay zone.
[1:26:37] This initiative is also known
[1:26:38] as the People's Ordinance
[1:26:42] Number Oh Dash 10960.
[1:26:43] The coastal height limit
[1:26:43] overlay zone limits the height
[1:26:48] of buildings to 30ft for
[1:26:49] the area located generally
[1:26:53] within city limits And west of
[1:26:53] Interstate five on NOVEMBER
[1:26:58] 8th, 2022, Measure c was passed
[1:26:59] by a majority of the city of
[1:27:03] San Diego voters.
[1:27:04] The ballot measure amended
[1:27:05] the People's Ordinance and
[1:27:05] the coastal height limit
[1:27:06] overlay zone.
[1:27:10] The purpose of the measure was
[1:27:11] to exclude the Midway Pacific
[1:27:14] Highway Community Plan area
[1:27:15] from the 30 foot high limit
[1:27:20] Measure c was subsequently
[1:27:24] challenged through a lawsuit on
[1:27:25] OCTOBER 17th of 2025
[1:27:26] the California Court of Appeals
[1:27:31] ruled that the city needed to
[1:27:32] complete additional
[1:27:32] environmental review to study
[1:27:35] the impacts of buildings
[1:27:36] exceeding the 30 foot high
[1:27:37] limit On MARCH 12th of 2026,
[1:27:42] the San Diego Superior Court
[1:27:43] issued a writ of mandate
[1:27:43] directing the city to set aside
[1:27:48] the approvals for Measure c.
[1:27:49] This action is intended to
[1:27:54] comply with the court's writ of
[1:27:54] mandate.
[1:27:55] The action requested and would
[1:27:56] repeal the ordinance which
[1:28:00] submitted Measure c to the city
[1:28:01] voters and the associated
[1:28:01] amendments to the San Diego
[1:28:02] Municipal Code.
[1:28:06] There The repeal of Measure c
[1:28:07] means that the 30 foot high
[1:28:07] limit on buildings in
[1:28:08] the coastal high limit overlay
[1:28:11] zone remains in effect for

[1:29:18] fair housing research and
[1:29:18] advocacy group working to
[1:29:19] expand fair housing access and
[1:29:20] homeownership opportunity
[1:29:23] across San Diego as high as
[1:29:24] three source neighborhoods.
[1:29:25] i know the council has no
[1:29:26] discretion on this item so my
[1:29:29] comments are purely for
[1:29:29] the record.
[1:29:30] In a JULY 15th, 2022 memo your
[1:29:35] own planning department wrote
[1:29:35] that the coastal height limit
[1:29:36] remains as a barrier to
[1:29:37] maximizing construction of
[1:29:40] homes and residential
[1:29:40] developments with restricted
[1:29:41] units.
[1:29:44] The memo sampled 13
[1:29:44] developments both inside
[1:29:48] the overlay zone since 2001 is
[1:29:49] only three stories.
[1:29:49] Just one has been restricted
[1:29:54] homes The Department recorded
[1:29:55] that barrier, never asked where
[1:29:55] the barrier falls or on whom So
[1:29:59] we did in our first report
[1:29:59] Coastal Opportunity and Housing
[1:30:04] Access in San Diego which
[1:30:05] publishes tomorrow.
[1:30:06] The city has had it since
[1:30:06] Friday If you doubt I you
[1:30:10] personally inside the coastal
[1:30:10] height limit 80% of census
[1:30:11] tracts are higher highest
[1:30:15] resource areas versus 54%
[1:30:16] citywide In the current housing
[1:30:20] cycle the overlay has only
[1:30:20] permitted 32.5 homes per
[1:30:21] thousand existing versus
[1:30:26] citywide 62% homes affordable
[1:30:29] below the original median two
[1:30:30] per thousand against 11 for
[1:30:30] the city.
[1:30:35] So that's half the citywide
[1:30:36] rate on housing of every kind
[1:30:36] and a fifth the citywide rate
[1:30:40] on affordable.
[1:30:40] Today a staff report concedes
[1:30:41] that this means less
[1:30:45] development It contains no
[1:30:46] federal housing analysis.
[1:30:47] A cap on building is not in

[1:35:35] He submitted his fees and costs
[1:35:39] recently for his work on
[1:35:45] overturning Measure c.
[1:35:49] I'd like to say that I don't
[1:35:50] keep chipping away at
[1:35:54] Proposition d with issues like
[1:35:55] Measure c If you and your
[1:35:56] colleagues in the building
[1:35:59] industry and the labor unions
[1:36:04] don't like Proposition d, put
[1:36:04] it on the ballot, give
[1:36:08] the voters a chance to agree or
[1:36:13] disagree with your position
[1:36:14] that many of you have That
[1:36:15] measure d should be voided and
[1:36:18] that we should be approving
[1:36:23] items like Measure c do not
[1:36:23] take a piecemeal approach to
[1:36:25] this issue as you did with
[1:36:30] Measure c Most importantly what
[1:36:36] you did with Measure c was you
[1:36:36] put before voters an incomplete
[1:36:40] analysis by any means by a
[1:36:41] unanimous Supreme Court
[1:36:45] decision that by any means of
[1:36:46] interpretation deprived voters
[1:36:50] of the information that they
[1:36:50] needed to know to make a
[1:36:54] decision on measure c And you
[1:36:55] did it twice not you the city
[1:36:59] It wasn't I don't know
[1:37:00] the extent to which the council
[1:37:00] approved a supplemental each
[1:37:04] year but you did have a chance
[1:37:05] to take a position as Raul and
[1:37:08] Vivian did when it came before
[1:37:09] you to take it to the Supreme
[1:37:10] Court and you decided to do it
[1:37:10] anyway.

[1:37:41] sea level is causing inundation

[1:37:54] the Midway area, I don't think
[1:37:59] you hit the mark on this And
[1:38:00] the hazards are many.
[1:38:00] This this area is not just a
[1:38:04] matter of building too high.
[1:38:05] It's a matter of having
[1:38:08] liquefaction underneath it and
[1:38:13] having an unsteady ground to
[1:38:13] build anything upon.
[1:38:14] So I'm sorry you repealing this
[1:38:17] at a time when there are bills
[1:38:18] going through the legislature
[1:38:19] and I know I'll be interrupted
[1:38:22] about that once again but it
[1:38:23] you're an engineer you know
[1:38:23] things are connected.
[1:38:24] You can't have one without
[1:38:27] the other And we can't have a
[1:38:28] repeal at the local level if
[1:38:31] there's push to approve and
[1:38:32] remove the height
[1:38:32] considerations at the state
[1:38:33] level.
[1:38:36] So when this comes before MR.
[1:38:37] Lee's committee in just a few
[1:38:41] weeks there's going to be a
[1:38:42] major contradiction.
[1:38:42] The council is repealed on
[1:38:43] the height but now the state is
[1:38:46] working on saying the height
[1:38:47] shouldn't be considered.
[1:38:51] So you're you're setting
[1:38:51] yourself into quite a quandary
[1:38:52] here And I don't know how
[1:38:56] you're going to figure this out
[1:38:57] But what I do know if you go on
[1:38:58] to another image I've lost
[1:39:01] track of which images I've
[1:39:02] submitted here This is already
[1:39:02] happening in our coastal areas
[1:39:06] The sea level does not respond
[1:39:06] to legislation.
[1:39:07] So MR. Lee, when you look at
[1:39:11] this housing and land use,
[1:39:12] consider water use also because
[1:39:16] that is really what is at stake
[1:39:16] if you're going to build
[1:39:21] anything in these coastal areas

[1:39:47] back against because moving
[1:39:48] forward with this would be
[1:39:48] extremely negligent.
[1:39:52] There is a lot of issues that
[1:39:56] are not being addressed and no
[1:39:57] offense to other speakers but
[1:40:01] it's not that sea level is
[1:40:01] rising.
[1:40:02] It's going back to where it was
[1:40:06] at one time because California
[1:40:06] used to be an island
[1:40:07] technically and the water has
[1:40:11] been, you know, dammed up in
[1:40:12] different things And so it's
[1:40:13] just coming up to where it had
[1:40:16] been prior to all of that.
[1:40:17] And so to build on those types
[1:40:17] of things and have the height
[1:40:21] levels that are going to be
[1:40:22] extremely high and potentially
[1:40:26] I mean these things are going
[1:40:26] to be blocking even just
[1:40:27] the beach for some people but
[1:40:31] it's dangerous to build on
[1:40:32] marshlands like that when
[1:40:32] people claim that they are
[1:40:36] going to be able to, you know,
[1:40:37] deal with the weight of it so
[1:40:37] it wouldn't sink in.
[1:40:38] But I don't think that that's
[1:40:38] really true.
[1:40:40] I believe that these unions
[1:40:41] want the jobs and so they want
[1:40:45] to go in and build but and
[1:40:46] they're doing what their part
[1:40:46] is.
[1:40:47] But these engineers even though
[1:40:50] they're saying they're going to
[1:40:50] be putting posts down, it is
[1:40:51] still putting the potential
[1:40:55] danger of it being in like
[1:40:55] with quicksand.
[1:40:56] And so it's more of a public
[1:41:00] safety issue as opposed to
[1:41:01] anything else When you guys are
[1:41:04] doing stuff like this And I
[1:41:05] understand people want jobs and
[1:41:06] you guys want housing but you
[1:41:09] shouldn't be putting people in
[1:41:10] danger just to do it and
[1:41:10] repealing things that
[1:41:14] the people voted for.

[1:42:08] sea level rise often we've
[1:42:09] already talked about that this
[1:42:12] is just a measure of c and
[1:42:13] whether we should repeal it or
[1:42:14] not write my agenda will give
[1:42:17] you an opportunity to speak on
[1:42:17] it.
[1:42:18] I gave people a little bit of
[1:42:21] leeway but let's just focus on
[1:42:26] Measure c and not on
[1:42:27] liquefaction or the ground
[1:42:27] conditions.

[1:42:36] repeal Measure c is regarding

[1:43:37] what to do in this area is
[1:43:38] the Navy Broadway complex or
[1:43:42] Manchester's Pacific Gateway.
[1:43:43] Another great example that that
[1:43:46] is used in San Diego is
[1:43:47] the County Administration
[1:43:52] Center building that has two
[1:43:52] levels of underground also
[1:43:53] where what you do is you
[1:43:56] actually get rid of
[1:43:56] the liquefaction.
[1:43:57] You guys don't even have any
[1:44:01] type of engineering standards.
[1:44:02] So yes, this is good to get rid
[1:44:03] of but you also have to have
[1:44:06] basic engineering Standard and
[1:44:07] Poor's pavement is not you know
[1:44:11] does not cut it.
[1:44:12] So you guys have a lot of work
[1:44:12] to do.

[1:48:42] determination regarding school
[1:48:46] compliance only where there was
[1:48:46] a prejudicial abuse of
[1:48:50] discretion applying
[1:48:51] the environmental impact
[1:48:51] reports at ground water levels
[1:48:55] which are expected to be near
[1:48:56] sea level throughout most of
[1:48:57] the Midway Pacific Highway area
[1:49:00] can result in response to
[1:49:01] changes in precipitation and
[1:49:01] runoff.
[1:49:05] As a result, the environment
[1:49:06] Impact report recognized most
[1:49:07] of the Midway Pacific Highway
[1:49:10] area has a high potential for
[1:49:11] liquefaction because the area
[1:49:16] has shallow groundwater or
[1:49:16] major drain drainages and
[1:49:20] hydraulic spills.
[1:49:21] I'm really disappointed that
[1:49:22] and again I know we need more
[1:49:25] housing.
[1:49:26] We need more affordable
[1:49:26] housing.
[1:49:27] We don't need any more luxury
[1:49:27] housing.
[1:49:30] We have quite enough of that.
[1:49:31] But I just wanted to say that
[1:49:31] I'm really disappointed that
[1:49:34] this ever got put up for a vote
[1:49:35] and that you guys were
[1:49:36] practicing prejudicial

[1:51:12] of mandate because we believe
[1:51:12] in following the law and
[1:51:16] because of the writ of mandate
[1:51:17] which says we must remove this
[1:51:17] language from the municipal
[1:51:22] code by amending Measure c with
[1:51:22] this amendment the only effect
[1:51:26] our Midwood District we must do
[1:51:27] it and if we don't we will be
[1:51:31] in contempt of court.
[1:51:32] And when we're in contempt of
[1:51:33] court we open the city to
[1:51:36] tremendous numbers of fines
[1:51:37] which we can ill afford and
[1:51:41] besides which is good citizens
[1:51:42] who even disagree with
[1:51:42] the court.
[1:51:47] We still think that we must
[1:51:47] follow the court's orders
[1:51:48] because that is the law And so
[1:51:51] therefore I move the staff
[1:51:52] recommendation to do so as
[1:51:56] ordered by the court and I so

[1:54:28] go an entire shift without them
[1:54:29] showing up and dispatchers can
[1:54:33] get kind of unprofessional at
[1:54:33] times.

[1:54:38] police will send the entire
[1:54:39] squad out to arrest like one
[1:54:39] unarmed person but then they
[1:54:40] don't show up when I call them
[1:54:44] in for something in other
[1:54:45] states sometimes you might only
[1:54:45] need 1 or 2 officers to arrest
[1:54:49] someone.
[1:54:50] Also I think we need a better
[1:54:51] system to report crimes instead
[1:54:56] of your online system to report
[1:54:56] crimes because that's limited.
[1:55:01] So if you don't know the person
[1:55:02] I think San Diego clean and
[1:55:02] safe has a system where you
[1:55:03] know you can take a picture and
[1:55:07] report things maybe the city
[1:55:08] police should adopt something
[1:55:08] like that.

[1:55:14] things.
[1:55:15] I think we need some dui
[1:55:18] checkpoints on Fourth Avenue
[1:55:19] where Gaslamp Quarter is
[1:55:20] especially near large parking

[1:55:26] I think we need to crack down
[1:55:26] on the drugs in the city.
[1:55:31] I mean trolley stops like Fifth
[1:55:32] Avenue and 12 in Imperial even
[1:55:37] here at Civic Center you have
[1:55:37] people hanging out using drugs
[1:55:38] near the trolleys.
[1:55:42] i think the city needs to crack
[1:55:43] down on the drugs in this city
[1:55:44] and we need to also find
[1:55:49] resources to assist and help
[1:55:50] our homeless people so they're
[1:55:51] not getting arrested and then
[1:55:54] coming back out on the streets
[1:55:55] ,find ways to rehabilitate
[1:55:56] them And I am running low on

[1:56:14] People with Disabilities.
[1:56:18] I am the chair and ceo.
[1:56:19] Each OCTOBER our committee
[1:56:19] hosted OCTOBER 1st one of
[1:56:20] the largest disability focused
[1:56:25] job bears in California serving
[1:56:29] up to 1500 job seekers annually
[1:56:30] For the past 27 years this
[1:56:31] event has connected individuals
[1:56:31] with disabilities to employment
[1:56:36] opportunities and economic
[1:56:36] independence which remains
[1:56:37] especially important giving
[1:56:41] the disproportionate high
[1:56:42] unemployment rate with
[1:56:42] the disability community.
[1:56:43] For the last 20 years we have
[1:56:48] been honored to hold you
[1:56:49] OCTOBER 1st at the Balboa Park
[1:56:50] Club and we are deeply grateful
[1:56:54] to the City of San Diego for
[1:56:54] its longstanding partnership
[1:56:55] and generosity in providing
[1:56:55] this venue.
[1:56:56] While we sincerely appreciate
[1:56:59] the city support, we
[1:57:00] respectfully ask the Council to
[1:57:01] consider the intended impact
[1:57:06] that recently implemented
[1:57:06] parking fees in Balboa Park MAY
[1:57:07] have on attendance this event
[1:57:11] this year Many city residents
[1:57:12] with disabilities MAY not have
[1:57:16] had an opportunity or ability
[1:57:17] to register in advance for
[1:57:18] the resident parking waiver
[1:57:18] program.
[1:57:19] I can also share that we have
[1:57:23] received reports from community
[1:57:24] members that the parking waiver
[1:57:24] registration process can be
[1:57:29] difficult to navigate even with
[1:57:29] eligible city residents
[1:57:30] Challenges with obtaining
[1:57:30] information completing
[1:57:35] the process and sharing
[1:57:36] the waiver registration process
[1:57:37] can be difficult to navigate.
[1:57:37] So I see I'm running out of
[1:57:42] time and we have contacted city
[1:57:42] council members.
[1:57:43] We have contacted the mayor's
[1:57:49] office and this is going to be
[1:57:49] a challenge in OCTOBER on
[1:57:50] the seventh for people with
[1:57:50] disabilities.
[1:57:54] So we have typically 75
[1:57:58] employers, 60 volunteers and
[1:57:59] upwards of 1500 job seekers And
[1:58:00] again most of our job seekers
[1:58:00] don't have physical
[1:58:05] disabilities but mental and
[1:58:05] intellectual disabilities which
[1:58:06] will affect them with
[1:58:10] the parking.

[1:58:54] the surface What is happening
[1:58:54] below ground is even more
[1:58:58] troubling and more challenging
[1:58:59] when it comes to adding housing
[1:58:59] to the coastal areas.
[1:59:00] The Storm Stormwater Department
[1:59:05] is aware of this.
[1:59:05] They have gone out and welded
[1:59:06] the storm water covered sheet
[1:59:07] and the pressure of
[1:59:10] the incoming tide is still
[1:59:11] getting out because the sea
[1:59:11] level rise is exceeding
[1:59:17] the height of the storm water
[1:59:17] system.
[1:59:18] And I know you're getting a
[1:59:19] report on that very soon as we
[1:59:22] go on to the next images.
[1:59:22] Saltwater is extremely
[1:59:23] corrosive.
[1:59:29] It is destroying you can see
[1:59:29] the really rough surface of
[1:59:30] the streets.
[1:59:30] This is the end of Mission
[1:59:34] Boulevard And again, this is
[1:59:35] only what you see on
[1:59:35] the surface.
[1:59:36] What's going on below surface
[1:59:40] is in the case of Mission Beach
[1:59:40] their sewage and wastewater
[1:59:41] system is at serious repair or
[1:59:46] needs serious repairs.

[2:01:17] technology like safety has made
[2:01:22] the necessary changes to help
[2:01:22] people feel more comfortable
[2:01:23] and safe as as the people move
[2:01:28] around living their lives.
[2:01:29] Our whole nation is affected by
[2:01:34] these changes and the federal
[2:01:35] government has stated it will
[2:01:35] come forward soon with its
[2:01:40] position on the use of this
[2:01:41] surveillance technology.

[2:05:57] stuck and nobody intended to

[2:06:07] little on our solar panel
[2:06:08] services telling us they tell
[2:06:08] me that they finally found
[2:06:09] the problem but they still
[2:06:12] haven't been able to come out
[2:06:13] and fix it And now they're
[2:06:13] still having issues with
[2:06:14] the water pressure and that is
[2:06:18] changing the bill cycles and
[2:06:19] the amount of the bill that's
[2:06:28] being paid are charged.

[2:06:33] starting to charge me water for

[2:17:00] And in MARCH of this year they
[2:17:01] were able to report that its
[2:17:04] marijuana businesses owe
[2:17:05] approximately 400 million in
[2:17:05] back taxes and fees.
[2:17:09] The city is now considering an
[2:17:10] amnesty program because so much
[2:17:14] money remains uncollected.
[2:17:15] If a city of this size with
[2:17:15] hundreds of pot shops can
[2:17:19] provide this detailed
[2:17:19] information, why can't San
[2:17:20] Diego residents are still
[2:17:24] asking how much marijuana tax
[2:17:25] is actually owed?
[2:17:25] How much was supposed to be
[2:17:29] collected and how much was
[2:17:30] actually collected including
[2:17:30] interest charges and late
[2:17:34] penalty fees.
[2:17:35] The city tells us that
[2:17:35] marijuana businesses are free
[2:17:38] to read to be audited and
[2:17:43] the city's own tax materials
[2:17:43] state that audits can identify
[2:17:44] underreported taxes and that
[2:17:48] penalties and interest can be
[2:17:48] assessed.
[2:17:49] So where's the public
[2:17:50] accounting of those results?
[2:17:53] The city treasurer has a
[2:17:54] delinquent accounts program
[2:17:57] that collects past receivables
[2:17:58] including audit deficiencies
[2:17:58] But the public deserves to know
[2:18:02] specifically what is happening
[2:18:03] with cannabis tax
[2:18:03] delinquencies.
[2:18:07] So I'd like to ask the Council
[2:18:08] to once again direct the City
[2:18:12] Treasurer and City Auditor to
[2:18:12] provide an update publicly

[2:18:59] testified about the widespread
[2:19:00] abuse and the lack of
[2:19:01] standardized cannabis products
[2:19:05] and the absence of rigorous
[2:19:05] scientific evidence necessary
[2:19:10] to establish acceptable cold
[2:19:11] medical use for cannabis under
[2:19:14] the Controlled Substance Act.
[2:19:14] Congress established
[2:19:15] the scientific standard for
[2:19:19] drug scheduling to help ensure
[2:19:19] that these decisions are based
[2:19:24] on evidence rather than
[2:19:24] political pressure.
[2:19:25] If those standards can be
[2:19:29] reinterpreted whenever they
[2:19:29] become politically inconvenient
[2:19:34] scientists scientific integrity
[2:19:34] gives away to political
[2:19:35] expedience.
[2:19:39] We know lowering
[2:19:39] the restrictions will increase
[2:19:40] availability, reduce public
[2:19:43] perception of risk, encourage
[2:19:44] greater use and ultimately
[2:19:48] increase addiction especially
[2:19:49] among vulnerable young people.

[2:19:53] protection when they repeatedly
[2:19:54] hear that marijuana is harmless

[2:24:27] beverages infused with
[2:24:28] the psychoactive compound thc.
[2:24:32] These newer products evolve to
[2:24:37] max to engineer maximum thc to
[2:24:37] be used conveniently and
[2:24:38] discreetly.
[2:24:41] Of course concern is for our
[2:24:42] adolescents whose brains are
[2:24:43] still developing and are more
[2:24:46] vulnerable to the effects of
[2:24:47] repeated exposures to high
[2:24:47] levels of thc.

[2:34:27] evidence based youth education,
[2:34:32] supporting parents and schools
[2:34:32] ,enforcing protections around
[2:34:33] cannabis businesses and making
[2:34:34] sure prevention doesn't get
[2:34:37] treated as an afterthought.
[2:34:38] We spend enormous resources
[2:34:39] helping people recover after
[2:34:43] substance use has caused
[2:34:43] damage.

[2:47:43] most commonly littered consumer

[2:47:57] Also pretty interesting that
[2:47:59] people will the exposure to
[2:47:59] toxic chemicals and increase in
[2:48:00] cleanup costs to cities like

[2:48:18] fans and what it can throw

[2:48:27] people do not realize that
