[20:38]
Welcome everybody.
Let's see.
[20:43]
We have several items under formal
business. Uh item A is uh license 20262.
[20:51]
This a privileged license agent change
request. An owner change beer and wine
[20:56]
retail and package and Sunday sales.
Smyrna Gas Enterprises LLC 540 Concord
[21:02]
Road Southeast Smyrna in ward three with
Shawn Patel Hughes as the agent.
[21:08]
Richard, would you mind taking this one?
>> Uh, Mr. Hughes, if you would please step
[21:12]
to the microphone.
[21:18]
» Good morning, sir. How you doing?
>> Good. How are you? If you don't mind, if
[21:21]
you state your name for the record,
please.
[21:23]
» Sean Patel.
>> And would you tell us what your
[21:25]
association is with um the Smyrna
Gaslight Enterprises?
[21:29]
» Yes, I'm the owner.
>> You're the owner. Okay. Have you been a
[21:33]
licensed agent for Beer and Wine Sales
anywhere else before?
[21:37]
» Uh, no. This is your first time. Can you
explain to the board uh the training
[21:42]
that you went through in order to
receive this license
[21:45]
» in order to be prepared to do this?
>> Yes. Um I used to work in a convenience
[21:51]
store gas station previously when I was
in college at my dad's in city of
[21:56]
Alpharetta and then also city of
Atlanta. And then for this city I did
[22:03]
the alcohol training class. Um I think I
believe it was through Cobb County um
[22:10]
somewhere in East Cobb that we had to go
to and was really I'd say
[22:17]
insight on how
I guess city by city all licenses varies
[22:26]
on how strict they are. So that was eye
opener for sure.
[22:32]
Can you what are the processes that you
that you'll have in place at Smyrna Gas
[22:36]
Enterprises in order to uh check IDs and
verify age?
[22:40]
» So as of right now we do uh implement
scanning all IDs. Um doesn't matter if
[22:47]
you 50 or if you're 10 18 you're getting
IDed. And also we have a date right
[22:56]
behind the I guess employee employee
customers that show today's date with
[23:03]
2020 20 with 21 being the age
verification.
[23:08]
And then we also do
um random checks with um employees.
[23:15]
We'll send a mystery shopper, have them
come pick one thing up, and if they get
[23:22]
IDed, they passed. If not, you get uh I
guess written up, and we take like a
[23:30]
penalty out their pay for not following
uh orders.
[23:35]
» Is that check integrated into your POS
system or is that a manual check
[23:39]
integrated POS system? Okay. Mhm.
>> Now, what type of training do you
[23:43]
provide to your employees to ensure that
they understand that POS system and that
[23:47]
they are doing the checks correctly? So
what we do is we also show them YouTube
[23:52]
videos that I guess our sicko
representative has showed us on how to
[24:01]
um make sure that every single alcohol
items that we do have or tobacco, they
[24:08]
all have to be scanning and before
they're able to bypass it or press
[24:15]
enter, they have to enter the date. So
it tell them automatically if that
[24:19]
person is 21 or not. And there is no way
to bypass it but just by saying okay you
[24:25]
have to enter a date. That's one way.
And then um how I said was just mystery
[24:32]
shoppers will do it once a month. They
might come two times in one day. They
[24:36]
might come
um one week. They might come four times.
[24:41]
It just depends on um what the company
does.
[24:45]
» Okay. How many hours do you spend in the
store now? How many hours do you
[24:49]
anticipate spending in the store?
>> Uh, right now I'm about there about 60
[24:53]
something, 65. I'm planning on staying
around 50.
[24:56]
» Okay. And how many employees?
>> Total of three.
[25:00]
» Okay. All right.
You understand? Um, in the city of
[25:04]
Smyrna, we do take this seriously. As
you uh receive this license this
[25:08]
morning, be aware that the Smyrna Police
Department will be around to do random
[25:11]
checks. They they do that also along
with the whatever system you have in
[25:15]
place. Uh they'll be around to check
also. Um we do um want everybody that
[25:20]
that that serves beer and alcohol, sells
beer alcohol in the city to understand
[25:27]
that uh you know we we do take it
seriously that we want you to follow the
[25:29]
rules the right way. Uh and we will be
checking on you.
[25:33]
» Any other questions?
>> Mr. Chairman,
[25:37]
» entertain a motion on the privilege
license agent change request for uh Mr.
[25:42]
Patel Hughes.
motion.
[25:46]
» I'll second.
>> All right, we got a motion to second.
[25:54]
» And that passes unanimously.
Congratulations.
[25:57]
» Thank you.
>> Thank you.
[26:00]
» Uh the next item on the agenda, the next
three items on the published agenda,
[26:04]
item B, C, and D have all been uh tabled
to the March 11th. So if you're here for
[26:11]
V260012,
V260013
[26:16]
or V26015,
those will be heard on March 11th. U the
[26:22]
next item on the agenda,
>> I think we have to make a motion.
[26:25]
» Oh, do we need to make a motion to table
these? Okay, we'll take them one at a
[26:28]
time then. So V12 uh V2612
U need a motion to table.
[26:33]
» Motion to table.
>> Second. All in favor to table that to
[26:37]
the to March 11th. Motion carries
unanimously. Uh V26013.
[26:43]
Need a motion to table.
>> So moved.
[26:46]
» I second.
>> All in favor.
[26:52]
That one will also be tabled to March
11th. And finally, V2615.
[26:56]
Uh variance request. Need a motion to
table to the 11th.
[26:59]
» So moved.
>> Second.
[27:01]
» All in favor? Okay. Okay, those three
items have now been forwarded to the
[27:05]
March 11th agenda. The item E is V26011.
This is a public hearing on a variance
[27:12]
request to allow a second accessory
structure on land lot 527 at 1272 Hayes
[27:19]
Drive. The request is by Reeves Nuome.
Um,
[27:24]
okay. Let me give us the background.
[27:29]
All right, let me just switch this
around real quick.
[27:36]
Okay. All right. Thank you. Uh, good
morning. Caitlyn Crow, land development
[27:41]
services coordinator for community
development for the city of Smyrna. So,
[27:45]
this variance, as you just read out, is
B26-011
[27:49]
to allow for a second accessory
structure. So, this property is um right
[27:54]
located on the south side of Hayes Drive
um which is off of King Springs Road and
[28:00]
is currently occupied by an existing
two-story home that was recently
[28:04]
completed um back in 2022 as well as a
pergola that is in the rear yard. The
[28:09]
applicant is proposing to add a pool in
addition to this pergola and retain both
[28:14]
on the property. Our ordinance does
require only one accessory structure per
[28:18]
lot. uh the pergola and pool both count
and thus the variance is required.
[28:25]
However, both of these uses are are
different. Uh the pergola and the pool
[28:29]
will be used simultaneously but again
offer different uses for the property.
[28:33]
So the variance is not self-created
due to the size of the lot and the
[28:39]
location of the pool. No other variances
are needed. No setback uh reductions, no
[28:44]
imperous surface area increases. So this
is the minimum variance needed to allow
[28:49]
for both of these to remain on the
property. At the time of this report,
[28:53]
community development has not received
any calls or emails in opposition to
[28:57]
this request. Um and after reviewing the
variance application, we do support the
[29:01]
request and do recommend your approval
with just the standard condition.
[29:05]
Approval of the requested variance is
conditioned upon substantial compliance
[29:09]
with the site plan submitted with the
variance application. And I can answer
[29:12]
any questions.
[29:16]
All right. Thank you.
[29:27]
» Just state your name and if there's
anything you'd like to add to the
[29:30]
presentation.
>> Uh my name is Reeves Newsome, RCS pool
[29:34]
and spa for the owner. I'm not really
here to uh add anything to that. It was
[29:40]
perfectly read.
>> Okay. Are you aware of the conditions?
[29:43]
» Yes.
>> Okay. Okay. And you agree with those?
[29:45]
» Yes.
>> Okay. Um, this is a public hearing on
[29:49]
varants request v26011.
Is there anyone here who wish to speak
[29:54]
either on behalf or or opposed to this
application? Please come forward.
[29:59]
» Chair hearing none. Seeing none, I'll
entertain a motion on V26011.
[30:05]
Motion to approve variance progress
V26-011
[30:08]
allow secondary accessory structure on
land lot 527 at 1272 Haze Drive Reeves
[30:13]
Newsome applicant
>> a second have a motion and a second
[30:18]
all in favor motion passes
[30:25]
see uh item F is also a public hearing a
request V26014
[30:32]
this is to increase the maximum
impervious surface area from 45% to
[30:36]
46.7%
in land lot 596. This is at 3202 Call
[30:42]
Your Gate Court. Allison King is the
applicant. Caitlyn,
[30:51]
» thank you. Um again, Caitlyn Crow,
Community Development. So, this variance
[30:56]
request, as you just said, is to
increase the maximum impervious surface
[30:59]
area from 45% to 46.7%.
Uh so this lot is located on the western
[31:06]
side of Call Your Gate Court which is in
the Collier Yourgate subdivision. Uh the
[31:11]
property is currently own um excuse me
currently occupied by an existing
[31:15]
two-story house as well as a 20ft
private drainage easement at the far uh
[31:20]
back of the property. The applicant is
proposing to just extend an existing um
[31:26]
patio area in the back with a new roof
and that'll have a more of an enclosure
[31:31]
in the back um for a little spa that
will be installed. Uh the existing
[31:36]
property is already over the maximum
imperous surface area by 2%. This
[31:42]
occurred when the house was built um and
the proper variance was not obtained at
[31:47]
that time. However, with this additional
118 square feet, this further brings the
[31:54]
property over the imperous surface area
to 46.7%.
[31:59]
However, even though the property was
already over, our uh section 1102 does
[32:05]
say that no non-conforming building can
be extended without having to bring it
[32:09]
to proper codes. Thus, the variance here
today. Um however since this was an
[32:14]
existing condition on the property this
variance is not self-created.
[32:19]
So after this deck extension the
property again will be over the
[32:23]
allowable imperous surface area by only
1.7%.
[32:28]
Um in fact the applicant had already
installed a French drain and
[32:32]
infiltration system back in 2017 that's
already acting as a water quality for
[32:37]
the property. Um the engineering plans
reviewer has already looked at this and
[32:41]
has supported this variance without the
need for any additional mitigation.
[32:46]
Uh we believe that this is the minimum
variance needed to create any extension
[32:50]
on this property. Um and at the time of
this report, we have received no emails
[32:54]
or phone calls in opposition to this
request. After reviewing the variance
[32:59]
application, staff does support the
request and does recommend your approval
[33:03]
with again just the standard stipulation
that approval of the requested variance
[33:07]
shall be conditioned upon substantial
compliance with the site plan submitted
[33:11]
with the variance application. And
myself or the engineering plans reviewer
[33:15]
Clara Hodgees is here if you have
questions for either of us.
[33:19]
» Just want to confirm. So the city
engineers office is okay with this
[33:23]
request. Yes, I believe the existing
mitigation system that's on the property
[33:27]
is above and beyond what we would ask
them to install um for this deck
[33:31]
extension. So, I don't feel the need for
any further mitigation on the property.
[33:34]
» Okay. Very good. Thank you. Any
questions board? No questions.
[33:38]
» Okay. Uh this is a public hearing. So,
for V2614
[33:43]
Oh, I'm sorry. Let's see. We need to get
the applicant up here. So, is the
[33:46]
applicant uh Miss Allison King present?
Yes. Here she comes. Yeah. If you'll
[33:51]
come up and state your name for the
record, please. And if there's anything
[33:54]
you would like to add to uh Caitlyn's
presentation.
[33:57]
» No. Uh my name is Allison King. Thank
you, Caitlyn. The presentation was very
[34:02]
good. Um and outlines all of the things
that we'd like to be able to do on the
[34:05]
property.
>> Uh being a public hearing, uh I'll uh uh
[34:10]
invite anyone who wishes to come and
speak either on behalf or in opposition
[34:14]
to this variance request, please come
forward.
[34:18]
Chair, hearing none, I'll entertain a
motion on this variance request. Can we
[34:22]
confirm that she understands?
>> Oh, I need Yes, I need you to confirm.
[34:25]
Did you understand the stipulations on
the variance request and you're in
[34:29]
agreeance with those?
>> I am.
[34:30]
» Okay. Thank you. Uh, entertain a motion
on this variance request.
[34:35]
» I motion to approve V26-014
variance request to increase the maximum
[34:40]
impervious surface area from 45% to
46.7% in land lot 596 at 3202 CER gate
[34:47]
court.
>> Second. Have a motion to second on this
[34:51]
variance request. All in favor?
Motion passes unanimously. Um enjoy your
[34:58]
new addition.
>> See, uh we have one final item of
[35:05]
business. This is approval of the
minutes uh from the February 11th, 2026
[35:10]
license and variance board of uh let's
see
[35:15]
committee had an opportunity to review
these minutes and is there a motion to
[35:18]
approve?
>> So moved.
[35:20]
» Second.
>> All in favor?
[35:24]
Okay. The minutes have been approved for
the February 11th license various board
[35:28]
meeting that any other business be
brought before the committee. Chair
[35:32]
hearing none. We will adjourn at five at
10:15.
