[16:39]
>> the add-on.
[16:41]
>> Mayor: oh, the mapsac.
[16:44]
Ped stan safety recommendation.
[16:45]
Presented by the mobility and
[16:46]
pedestrian safety advisory
[16:50]
committee.
[16:51]
You have the floor.
[16:52]
>> thank you.
[16:55]
Good evening, honorable mayor,
[16:57]
vice mayor, commissioners.
[17:00]
My name is pavel, I'm the chair
[17:01]
of the mobility and safety
[17:01]
committee.
[17:04]
For the benefit of the public
[17:05]
here, I'd like to state that the
[17:08]
committee was formed through a
[17:09]
formal application process and
[17:11]
our purpose and mission is to
[17:12]
promote traffic safety in our
[17:14]
beautiful city, as well as
[17:16]
pedestrian safety, and to
[17:18]
generate and discuss ideas for
[17:18]
improving traffic flow in the
[17:20]
city of sunny isles beach.
[17:23]
And we are volunteers,
[17:24]
contributing our time,
[17:26]
contributing our efforts, and
[17:26]
minds, to this very important
[17:32]
initiative.
[17:36]
The mapsecond committee over
[17:41]
past two meetings discussed the
[17:42]
intersections concerning the
[17:44]
protection of pedestrians
[17:46]
crossing from turning vehicles.
[17:47]
And we would like to highlight
[17:48]
the points of automated
[17:50]
enforcement using cameras and/or
[17:51]
other equipment possible in
[17:51]
addition to establishing this
[17:56]
protection.
[17:57]
There's significant evidence to
[17:59]
support the idea that automated
[18:02]
enforcement using traffic
[18:03]
cameras that capture turn
[18:05]
violations lead to safer
[18:06]
crossings for pedestrians.
[18:07]
In the memo that we provided,
[18:09]
there's several studies.
[18:11]
I'm just going to highlight a
[18:11]
few numbers.
[18:12]
The american journal of public
[18:14]
health found that the presence
[18:18]
of red light cameras lead to a
[18:21]
reduction, 21% reduction, in
[18:21]
pedestrian fatalities, and 14%
[18:24]
reduction in pedestrian
[18:25]
injuries.
[18:27]
And this was from the data
[18:30]
collected from 14 cities across
[18:32]
the united states.
[18:33]
General transport and health do
[18:36]
a study of over 200 sections in
[18:37]
the city in chicago found that
[18:39]
these kind of automated
[18:41]
enforcement cameras lead to 25%
[18:41]
reduction in the number of
[18:46]
crashes involving a pedestrian.
[18:47]
And lastly the american journal
[18:49]
of public health did a study on
[18:52]
red light violations, found that
[18:54]
red light violations decreased
[18:56]
by up to 90%, and the number of
[18:57]
crashes at intersections
[18:58]
decreased by up to 30% in the
[19:01]
presence of these automated
[19:08]
enforcement cameras.
[19:08]
So, there's significant evidence
[19:12]
from formal studies, but also
[19:16]
there's support in this kind of
[19:17]
experience, by the residents of
[19:20]
our neighboring city, the city
[19:21]
of aventura, they've been very
[19:22]
supportive in the red light
[19:23]
cameras installed in their city,
[19:25]
and if you drive through the
[19:26]
city of aventura you'll notice
[19:28]
that everyone there is kind of a
[19:29]
model driver.
[19:31]
You know, very careful in
[19:32]
approaching intersections.
[19:33]
Doing their proper red light
[19:33]
stops, and proceeding
[19:38]
thereafter.
[19:40]
And so, I am here presenting
[19:41]
this memo.
[19:43]
If you have any questions,
[19:45]
please let us know.
[19:48]
But, before I conclude I'd like
[19:50]
to thank you for establishing
[19:51]
the mapsac committee.
[19:53]
I'd like to thank the city staff
[19:55]
in facilitating our meetings and
[19:57]
supporting us with all the
[19:58]
information that we need to have
[19:59]
to proceed.
[20:04]
And lastly I'd like to thank our
[20:06]
mapsac committee members,
[20:11]
kenneth percy, anastasia, and
[20:12]
mariana, in contributing and
[20:13]
working really hard.
[20:16]
I know all of us are eager to
[20:20]
continue in the coming year, and
[20:21]
we'll look forward to
[20:22]
volunteering and continuing with
[20:22]
mapsac.
[20:22]
Thank you.
[20:35]
[Applause]
[20:36]
>> Mayor: ready for our zoning
[20:36]
portion?
[20:39]
>> yes, ma'am.
[20:40]
>> Mayor: ladies and gentlemen,
[20:40]
this evening's agenda has one
[20:43]
zoning application.
[20:46]
In these matters, the commission
[20:47]
sits in a quasi-judicial
[20:47]
capacity.
[20:49]
The decision of whether or not
[20:51]
to approve a zoning variance is
[20:53]
not a popularity contest but
[20:54]
must be based upon substantial,
[20:54]
competent evidence, as it
[20:57]
presented tonight.
[20:59]
If you intend to provide
[21:00]
testimony on any zoning
[21:01]
application, you must be sworn
[21:04]
in by the city clerk, and you
[21:06]
should also fill out a public
[21:08]
speakers card and give it to the
[21:09]
city clerk before the item is
[21:10]
called.
[21:11]
We will first hear from city
[21:12]
staff and then from the
[21:12]
applicant.
[21:14]
After this, I will allow anyone
[21:16]
from the audience who has been
[21:17]
sworn in to provide testimony.
[21:18]
The zoning applicant has the
[21:20]
right to cross-examine any
[21:21]
witness, and for rebuttal.
[21:21]
Please make your comments
[21:24]
concisely.
[21:29]
MR. City clerk, please read your
[21:29]
introductory zoning statement.
[21:31]
>> in accordance with the LDRs
[21:32]
of the city of sunny isles beach
[21:33]
all items to be heard today have
[21:35]
been legally advertised in the
[21:36]
newspaper, notices have been
[21:37]
mailed and posted on the
[21:37]
property.
[21:39]
All persons wishing to speak at
[21:40]
this hearing please raise your
[21:43]
right arm to be sworn in.
[21:44]
Do you swear the testimony
[21:45]
you're about to give is the
[21:45]
truth, the whole truth and
[21:46]
nothing but the truth so help
[21:48]
you GOD?
[21:51]
Thank you.
[21:54]
so this is an application for a
[21:55]
minor site plan modification for
[21:57]
the property located at 100,
[22:02]
150, 200 and 300 kings point
[22:02]
drive.
[22:05]
The project known as marina del
[22:06]
mar.
[22:07]
I'm sorry.
[22:09]
Before we continue, are there
[22:13]
any ex parte communications?
[22:14]
>> no.
[22:15]
>> what are they?
[22:23]
We have to disclose who it was?
[22:28]
>> Mayor: I ask questions of --
[22:29]
>> good evening mayor, vice
[22:31]
mayor, commissioners, the zoning
[22:32]
hearing this evening as you
[22:37]
heard is a proposed site plan
[22:38]
modification for marina del mar
[22:42]
at 100, 150, 200 and 300 kings
[22:44]
point drive.
[22:49]
This is application pz 2022-09.
[22:50]
It was approved for two
[22:52]
apartment towers, a new
[22:53]
apartment garage and remodeling
[22:55]
of the existing apartment tower.
[22:56]
The applicant is proposing four
[22:58]
separate minor modifications
[22:59]
which I will walk through now.
[23:00]
And the applicant will also
[23:02]
provide a presentation with
[23:05]
further explanation and will
[23:07]
also be available for questions.
[23:08]
First the applicant is
[23:10]
requesting to eliminate a cable
[23:12]
railing system along the water
[23:16]
front of the property.
[23:17]
The property has two water
[23:22]
frontages at the north and
[23:22]
south.
[23:25]
And it's providing -- they were
[23:27]
highlighted on the screen.
[23:30]
So the property has two water
[23:31]
frontages and is providing
[23:32]
public walk that's highlighted
[23:33]
along the water frontages.
[23:35]
In the original site plan
[23:38]
approval there was a four foot
[23:39]
cable railing proposed between
[23:40]
the bay walk and the seawall,
[23:41]
the detail of which is also
[23:42]
shown on the screen.
[23:44]
And the railing is not required
[23:45]
by the zoning code or the
[23:47]
building code.
[23:48]
So the applicant is requesting
[23:49]
to eliminate the cable railing
[23:52]
from the plan.
[23:54]
Staff does not object to this
[23:54]
modification, as it is
[23:56]
consistent with the city's
[23:57]
comprehensive plan, and the land
[24:02]
development regulations.
[24:06]
Second the applicant is
[24:08]
requesting to modify the
[24:09]
entryway signage for the
[24:10]
property.
[24:11]
It's at the intersection of
[24:13]
kings point drive and collins
[24:13]
avenue.
[24:15]
The approved site plan showed
[24:17]
two blue city monument signs on
[24:19]
the north and south side of
[24:20]
kings point drive.
[24:22]
The proposed modification is to
[24:23]
install one city monument sign
[24:26]
on the south side of kings point
[24:28]
drive, and a development sign on
[24:29]
the north side of kings point
[24:31]
drive.
[24:33]
Staff does not object to this
[24:34]
modification as it's consistent
[24:35]
with the comprehensive plan, and
[24:35]
the city's land development
[24:41]
regulations.
[24:43]
The third request is to modify a
[24:44]
condition of approval from 2017,
[24:44]
with regards to the project
[24:47]
workforce housing.
[24:51]
The project is required to
[24:52]
provide 35 dedicated workforce
[24:55]
housing units in the existing
[24:57]
remodeled apartment building.
[25:02]
Condition 22 of resolution
[25:04]
17-v-161 require the development
[25:05]
to record a restrictive covenant
[25:07]
with the number of units to be
[25:08]
dedicated to the workforce
[25:10]
housing program and their
[25:10]
location.
[25:13]
so, the resulting restrictive
[25:15]
covenant would give 35 specific
[25:15]
unit numbers.
[25:16]
The management company would
[25:17]
like a little bit more
[25:18]
flexibility with regard to
[25:22]
leasing the units.
[25:23]
And would like to amend the
[25:26]
covenant to remove the 35
[25:27]
specific unit numbers, while
[25:30]
maintaining the unit mix, and
[25:33]
maintaining that the units will
[25:35]
be located on multiple floors.
[25:37]
Staff does not object to this
[25:37]
modification.
[25:39]
Subject to the condition that
[25:41]
the applicant must record an
[25:41]
amended covenant in a form
[25:47]
accessible to the city attorney.
[25:49]
The final and fourth
[25:50]
modification, the applicant is
[25:51]
requesting to construct a
[25:53]
residential marina with 18
[25:55]
slips.
[25:59]
The property is zoned rms-2 or
[26:00]
medium high density residential,
[26:02]
and marinas are permitted
[26:05]
accessory use in this zoning
[26:05]
district to residential
[26:06]
development.
[26:08]
Staff has no objection to the
[26:09]
marina if the condition of
[26:10]
approval applies operational
[26:10]
limitations such as the
[26:14]
following.
[26:15]
Vessel movement is to be
[26:17]
restricted to the hours between
[26:19]
6:00 A.M. And 12:00 A.M. But can
[26:21]
be extended in cases of
[26:22]
emergency or weather events.
[26:24]
No fuelling or pump-out services
[26:28]
are to be provided.
[26:31]
There are no live aboards
[26:32]
allowed.
[26:33]
Proof of living in the
[26:34]
development is required for
[26:35]
leasing a slip.
[26:37]
Vessels cannot be rented to any
[26:38]
individual for any amount of
[26:39]
time or used for any commercial
[26:41]
activity including jet ski
[26:42]
rentals.
[26:43]
That the marina must be managed
[26:47]
by a dock moster.
[26:48]
In working with the applicant
[26:50]
and speaking with our legal
[26:51]
department it was determined
[26:55]
that the condition that's listed
[26:56]
in the staff report providing
[26:58]
for a restrictive covenant
[26:59]
concerning the operational
[27:01]
limitations I just described is
[27:02]
not necessary.
[27:03]
As the city can enforce the
[27:04]
limitations that I just
[27:06]
described in conditions through
[27:08]
the site plan approval and
[27:09]
city's code.
[27:11]
With that, the applicant is
[27:11]
present.
[27:21]
I'm available for any questions.
[27:22]
>> good evening, mayor and
[27:28]
members of the commission.
[27:30]
Akerman llp representing the
[27:30]
applicant.
[27:33]
We have a brief presentation, if
[27:41]
we could be put forward.
[27:44]
Thank you.
[27:45]
The planning director's report
[27:47]
was very comprehensive and laid
[27:49]
out all of the reasons for the
[27:51]
changes that are being
[27:51]
requested, and fit well within
[27:57]
the provisions of the city's
[27:57]
code.
[27:58]
But just to briefly repeat, next
[28:02]
slide, please.
[28:03]
The four changes are to
[28:04]
eliminate the cable railing
[28:06]
along the seawalls, to improve
[28:09]
the entryway signage, to modify
[28:11]
the workforce housing covenant
[28:13]
to allow greater flexibility to
[28:14]
evenly distribute the units
[28:15]
throughout the building, without
[28:17]
any change to the number,
[28:20]
quality or type of units
[28:20]
provided.
[28:22]
And to construct a previously
[28:25]
existing 18-slip residential
[28:27]
marina restricted to use by
[28:29]
upland owners only, and subject
[28:32]
to the other voluntarily
[28:34]
proffered conditions, as stated
[28:35]
by the planning director this
[28:35]
evening.
[28:38]
Before I proceed with the rest
[28:41]
of the presentation, I think
[28:44]
it's important to note that the
[28:46]
brunetti family has owned this
[28:47]
property for nearly 40 years.
[28:49]
And this is a long-term hold.
[28:51]
They have redeveloped the
[28:53]
property, as you know, the
[28:55]
existing building, building two
[28:57]
new residential rental
[28:57]
buildings.
[28:58]
And so they are owners.
[29:00]
They are not going to be
[29:01]
building it, selling it, and
[29:01]
leaving town.
[29:05]
They're going to be operating
[29:05]
it.
[29:07]
And so, they are more concerned
[29:09]
than anyone that they have a
[29:10]
quality property that attracts
[29:11]
good tenants.
[29:11]
We can go to the next slide,
[29:15]
please.
[29:17]
You see number one is
[29:18]
eliminating the cable railings
[29:20]
that were in the original
[29:21]
approved plan.
[29:25]
This shows the site behind the
[29:25]
building today.
[29:26]
Next slide, please.
[29:28]
The improved signage, which I
[29:29]
think the planning director has
[29:30]
already explained to you, so we
[29:31]
go to the next slide which also
[29:36]
shows the signage, as well.
[29:38]
And then if we can go to the
[29:41]
next slide, and I think the
[29:43]
planning director again, has
[29:44]
succinctly explained the
[29:45]
modifications to the workforce
[29:46]
housing covenant.
[29:47]
So I won't take your time in
[29:48]
going through that further at
[29:49]
this moment.
[29:53]
next slide, please.
[29:54]
The residential marina.
[29:58]
As was mentioned, or as you MAY
[29:59]
know, there has always been,
[30:00]
historically on this property,
[30:04]
and operating marina, which was
[30:05]
destroyed during a hurricane,
[30:07]
and now they are seeking to
[30:09]
rebuild it.
[30:10]
It is, of course, a permitted
[30:12]
accessory use to a residential
[30:12]
property.
[30:15]
Next slide, please.
[30:17]
And besides if they didn't have
[30:20]
a marina they'd have to change
[30:23]
it from marina del mar to del
[30:23]
mar.
[30:25]
That's one of the attractive
[30:27]
things is that it's a beautiful
[30:27]
waterfront property.
[30:28]
There you see where the marina
[30:28]
will be located.
[30:33]
Next slide, please.
[30:34]
And then the next slide.
[30:37]
This one, as you see, the use is
[30:38]
permitted by-right.
[30:41]
Wet dockage of moorage or
[30:42]
private noncommercial pleasure
[30:44]
craft in connection with any
[30:44]
residential use.
[30:45]
And this is strictly limited to
[30:48]
residential use.
[30:55]
So the proposed marina is
[30:56]
consistent with the definition
[30:58]
and will serve as permitted
[31:00]
by-right accessory use to the
[31:00]
upland residential property.
[31:01]
Next slide.
[31:03]
I won't repeat everything the
[31:04]
planning director said but this
[31:04]
slide sets forth the conditions
[31:08]
that we have agreed to.
[31:09]
And that have been as verbally
[31:12]
stated this evening by the
[31:13]
planning director.
[31:17]
Next slide, please.
[31:18]
As I think you are aware, that
[31:22]
the city's scope of review is
[31:23]
limited to the site plan review
[31:26]
criteria.
[31:28]
city staff has determined that
[31:29]
all of the applicant's
[31:31]
proposals, including the marina,
[31:33]
are minor site plan
[31:34]
modifications, that are in
[31:36]
compliance with the relevant
[31:37]
code criteria, and could have
[31:40]
been approved administratively.
[31:41]
The city manager has elected to
[31:44]
seek your input on this.
[31:47]
And finally, next slide.
[31:49]
Just to repeat some of the
[31:52]
history on this, the proposed
[31:53]
marina replaces what was a
[31:55]
longtime existing marina that
[31:56]
was destroyed by hurricane wilma
[31:59]
in 2005.
[32:01]
This marina fulfills the
[32:05]
complete vision of the wider
[32:09]
recently reinvigorated marina
[32:09]
del mar project.
[32:09]
And, in fact, enhances the
[32:10]
quality of the project and the
[32:13]
quality of the residential
[32:13]
environment at the marina.
[32:15]
The marina was in continuous
[32:17]
operation for nearly 40 years
[32:18]
before it was destroyed by the
[32:21]
hurricane.
[32:22]
Even after the hurricane, the
[32:25]
applicant has paid taxes on the
[32:27]
marina, since it was destroyed.
[32:31]
The applicant has prioritized
[32:32]
upland redevelopment and the
[32:33]
fortified seawall and now seek
[32:35]
to reinvest in the marina, as
[32:36]
well.
[32:39]
And finally, miami-dade county
[32:40]
environmental resources
[32:41]
management has performed a
[32:43]
preliminary review of the
[32:46]
proposed marina, and confirmed
[32:46]
its consistency with key
[32:47]
regulatory provisions.
[32:49]
Next slide.
[32:51]
So with that we ask for your
[32:53]
approval for these minor
[32:54]
modifications.
[32:56]
Wth me this evening, as well, a
[33:00]
representative of the ownership
[33:03]
of the property, don dissinger,
[33:04]
and richard roth.
[33:05]
We're available to answer any
[33:08]
questions you have and if
[33:08]
necessary would request brief
[33:09]
response to any comment.
[33:09]
Thank you very much.
[33:11]
Yes, sir?
[33:12]
>> my first question would be
[33:19]
regarding the railing on the
[33:20]
seawall.
[33:21]
Since it was your idea to have
[33:22]
it originally, what was the
[33:22]
reasoning behind having the
[33:26]
railing?
[33:27]
>> I might ask don to come
[33:32]
forward.
[33:34]
I think, I think, commissioner,
[33:36]
that was before they were really
[33:40]
focusing on the development of
[33:41]
marina.
[33:42]
And when they got to the point
[33:45]
of deciding they were going to
[33:46]
redevelop the previously
[33:48]
existing marina, then that
[33:49]
wouldn't be an appropriate
[33:49]
placement there.
[33:55]
Don?
[33:59]
>> we have some public speakers.
[34:01]
So, we can do the public
[34:01]
speakers --
[34:04]
>> you want to hold off on that?
[34:06]
>> yeah, we can proceed with the
[34:06]
public speakers.
[34:07]
>> sorry, gentlemen.
[34:07]
>> Mayor: we'll ask questions.
[34:11]
We'll ask questions.
[34:13]
Okay, well first public speaker
[34:17]
is don dissinger.
[34:19]
There you go.
[34:20]
You didn't have a long ride
[34:20]
there.
[34:20]
Okay.
[34:25]
>> so I was sworn in earlier.
[34:25]
I did submit my --
[34:26]
>> Mayor: state your name and
[34:30]
address for the record.
[34:31]
>> I'm don dissinger residence
[34:33]
is 100 kings point drive.
[34:37]
In sunny isles beach.
[34:39]
and I am the chief development
[34:41]
officer for the brunetti
[34:45]
organization and have been
[34:46]
involved with this project since
[34:52]
2016, in various iterations of
[34:52]
development.
[34:55]
So, to address your question,
[34:58]
MR. Joseph, so, in the course of
[35:01]
developing the project in the
[35:05]
early submissions, the landscape
[35:07]
architect proposed the railings
[35:08]
as part of the overall design.
[35:10]
By the time we developed both
[35:11]
the towers, and all of the
[35:13]
platforms for the tower, all of
[35:15]
the safety issues that would be
[35:17]
related to the higher level
[35:18]
buildings were built into the
[35:20]
building, so we have glass
[35:21]
railings around all the
[35:22]
buildings, and what we've seen
[35:25]
in the other areas in town is
[35:31]
that there's a lot of use along
[35:33]
the fortified seawalls where
[35:36]
people are enjoying firing and
[35:38]
doing other things, so we saw
[35:39]
that as an amenity to the
[35:41]
community now that we have the
[35:42]
easement for the bay walk around
[35:43]
all our properties.
[35:45]
And we see a lot of dog walking,
[35:46]
fishing, and things like that
[35:48]
already going on.
[35:50]
So our thought was, it's not
[35:53]
being required to enhance the
[35:54]
amenity of the new seawalls,
[35:56]
which are elevated higher than
[35:57]
the other seawalls, and quite
[35:59]
safe in terms of flooding and
[36:01]
everything else, it's just a
[36:01]
better look and feel for the
[36:04]
overall community, we thought.
[36:07]
And that was our reason for not
[36:10]
building that railing.
[36:12]
>> so the original idea of the
[36:14]
railing, it was for fancy rather
[36:15]
than safety?
[36:21]
>> no, I think ultimately, and I
[36:23]
can't speak for our landscape
[36:24]
architect, but I think in
[36:25]
general he felt that it was
[36:28]
required.
[36:30]
And we learned long after that
[36:31]
that it wasn't.
[36:34]
And then when we saw the use of
[36:36]
the bay walk, we felt it would
[36:38]
be better to allow it for
[36:40]
people -- and I will be honest,
[36:44]
fishing is a big thing around
[36:46]
saul of those areas so we see a
[36:47]
lot of people coming to our
[36:48]
property to do those things.
[36:49]
So that's, I think, how it
[36:53]
evolved.
[36:55]
>> okay.
[36:57]
So, how do you plan on keeping
[36:59]
small children away from the
[37:00]
edge of the seawall?
[37:02]
>> well, we have about anywhere
[37:06]
from six to ten inches of rise
[37:09]
there, along the bay walk.
[37:11]
And it seems like all the other
[37:12]
bay walks, even right adjacent
[37:14]
to us, where we have the
[37:16]
children's park, there's a good
[37:18]
10 feet of space, which is used
[37:20]
by families walking dogs and
[37:24]
things, between poinciana and
[37:27]
ours, that have very similar
[37:27]
situation.
[37:29]
So I think it's -- I think it's
[37:32]
a fairly safe environment.
[37:33]
>> so this railing wouldn't in
[37:35]
any way keep children away from
[37:37]
the seawall?
[37:40]
>> it might.
[37:42]
But I think the curb itself
[37:44]
keeps them on the walkway.
[37:48]
The bulkhead itself is too deep.
[37:50]
So, it just seems similar to
[37:54]
what we've seen elsewhere in the
[37:55]
city on sunny isles beach.
[37:56]
And we think it's kind of
[37:59]
compatible with the way people
[38:01]
use the edge, the water edge in
[38:01]
the community.
[38:07]
>> no, I understand that on many
[38:09]
seawalls there is no, you know,
[38:10]
any barrier for children.
[38:12]
But since you already have it
[38:15]
incorporated in your plan, I was
[38:17]
just thinking, you know, if it
[38:19]
is -- if there is any type of
[38:21]
safety involved with it, why
[38:22]
remove it?
[38:24]
>> we discussed that with our
[38:25]
in-house insurance and
[38:25]
everything.
[38:27]
We think it's reasonably safe as
[38:29]
it's currently designed.
[38:31]
Which is why we asked to remove
[38:31]
it.
[38:32]
>> okay.
[38:33]
I appreciate it.
[38:33]
Thank you.
[38:38]
>> thank you.
[38:43]
Any other questions for me?
[38:44]
>> Mayor: you want to -- we'll
[38:45]
continue with the public
[38:45]
speakers.
[38:53]
Thank you.
[38:54]
-- rafael.
[38:55]
Please state your name and
[39:01]
address for the record.
[39:02]
>> I'm a resident of poinciana.
[39:09]
Sunny isles beach.
[39:13]
Rafael masterson.
[39:15]
I'm actually right across the
[39:16]
plan marina.
[39:18]
So maybe one of the questions I
[39:21]
have is obviously very
[39:21]
concerning to have that
[39:23]
construction, so wondering how
[39:24]
long that project will last, if
[39:28]
it is to be approved.
[39:29]
If I could get someone to
[39:29]
comment?
[39:31]
>> Mayor: go ahead.
[39:33]
We've had our seawall under
[39:37]
construction for quite some
[39:37]
time.
[39:38]
>> right.
[39:38]
>> Mayor: perhaps I don't know
[39:41]
if you'd like to address that or
[39:49]
answer that question?
[39:49]
>>.
[39:49]
[Speaker off mic]
[39:50]
>> Mayor: six months.
[39:52]
>> so as you know from my
[39:54]
experience living in the same
[39:55]
place, it took six months just
[39:57]
to get the permit, after permit,
[39:58]
after permit to get it done.
[40:02]
It took basically more than a
[40:03]
year.
[40:03]
And I only moved in this year to
[40:04]
sunny isles.
[40:06]
So that was one, my first
[40:06]
concern.
[40:08]
The second one we only are now
[40:12]
in our island 43 boats.
[40:13]
And the concern is safety.
[40:16]
So how is adding 18 boats will
[40:18]
increase the safety of manatees,
[40:20]
that's clearly not clear to me.
[40:22]
>> Mayor: yeah, I mean for me,
[40:26]
you know, I know this was
[40:27]
articulated, but the 18 slips
[40:28]
were already there.
[40:29]
I mean, this was already a
[40:33]
permitted item.
[40:34]
Right?
[40:35]
So it's not like they just --
[40:37]
they're creating 18 new slips.
[40:41]
Yes, there was a force majeure
[40:43]
event that created that -- that
[40:45]
demolished that or eviscerated
[40:45]
the permit.
[40:51]
But there were pre-existing 18
[40:52]
permitted slips before or when
[40:53]
we had ours.
[40:56]
So, you know, I'm not sure I see
[40:56]
that as a --
[40:59]
>> I mean I'm just concerned, if
[41:01]
I'm being not allowed to put a
[41:03]
boat on my pier, which I have a
[41:05]
permit to have one, and I have
[41:07]
one built, and at the same time
[41:08]
we're hearing about 18 more
[41:10]
boats, much larger than what I'm
[41:12]
planning to get, and that
[41:13]
suddenly is allowed.
[41:14]
>> Mayor: is that boat -- I
[41:16]
guess the -- I guess the
[41:16]
question then is, I mean, is
[41:24]
there any -- I mean is there
[41:26]
any -- what would the poinciana
[41:28]
marine slip permitting is that
[41:29]
related at all to the marina del
[41:29]
mar permitting?
[41:31]
isn't that part of your own --
[41:33]
isn't that part of your own site
[41:33]
plan?
[41:35]
>> I can't speak as to their
[41:35]
permitting.
[41:38]
But mayor, as you pointed out,
[41:39]
"a," there was historically this
[41:41]
marina there for many, many
[41:46]
years, for decades.
[41:48]
"b," remember, derm has already
[41:49]
preliminarily approved that.
[41:50]
And derm is one of the first
[41:52]
things they assessed is if there
[41:55]
would be any impact on manatee
[41:56]
and seagrasses.
[41:58]
So derm has approved it.
[41:58]
It's historically been there.
[42:01]
It's not changing in any way the
[42:03]
intensity of what has been
[42:03]
there.
[42:04]
>> Mayor: for me that was the
[42:07]
first question that I had.
[42:07]
Like, you know, well where do
[42:10]
these marina slips come?
[42:11]
That's why I asked the owner's
[42:12]
rep about that.
[42:13]
Then from at least what the
[42:14]
information that I got was that
[42:15]
these 18 slips were around for a
[42:18]
long time.
[42:20]
>> is there any way to get this
[42:21]
information publicly available
[42:26]
for us so we can actually
[42:28]
somehow study showing us in
[42:30]
addition to the 43 we have,
[42:32]
which is very limited us as a
[42:33]
residence of poinciana island,
[42:35]
and at the same time there's 18
[42:36]
more and that's obviously would
[42:39]
be safe, so just in this isle
[42:41]
which is really where I live,
[42:42]
suddenly adding 18 more boats,
[42:44]
much bigger than what we have in
[42:48]
any one of the residence there,
[42:49]
suddenly this make the safety of
[42:51]
manatees fine, compared to add
[42:53]
one or two boats more in our
[42:54]
island that is completely at the
[42:56]
moment restricted.
[42:58]
So to me, there's a proportion
[43:00]
that would make no sense to me
[43:02]
that 18 larger boats would keep
[43:07]
the manatees safe, which is
[43:08]
definitely an intent, to keep
[43:12]
them safe.
[43:12]
Not very clear to me how that's
[43:13]
being allowed, and what is
[43:13]
available for us as the public
[43:15]
to see and basically comment, or
[43:19]
at least understand better the
[43:19]
information.
[43:20]
The fact, you know, the numbers
[43:21]
which I have not seen anything
[43:22]
like that published.
[43:24]
>> Mayor: again, you can
[43:24]
respond.
[43:25]
But again, I think they're
[43:28]
separate -- I think it's a
[43:29]
separate consideration.
[43:29]
Or no?
[43:29]
I --
[43:33]
>> mayor, also, just for the
[43:34]
record, the derm report and
[43:37]
analysis is a public record.
[43:39]
And their finding is that it is
[43:41]
consistent with the manatee
[43:42]
protection plan.
[43:44]
Those of you, I think mayor
[43:46]
you're well familiar with it,
[43:48]
derm is not an easy agency.
[43:49]
If there were any problem they
[43:51]
would let us know.
[43:51]
It's all public record.
[43:53]
It's all available to you.
[43:54]
It's all consistent with the
[43:54]
manatee protection.
[43:59]
>> and it's online, as well.
[44:01]
>> Mayor: so is there any way --
[44:03]
can you indicate where that can
[44:05]
be obtained, if this gentleman
[44:06]
is interested in that?
[44:08]
>> sure.
[44:08]
If he gives me his contact
[44:09]
information I'll send him the
[44:13]
contact.
[44:16]
>> Mayor: and absolutely
[44:16]
cognizant of your items
[44:21]
presented.
[44:24]
>> -- six months is there any
[44:27]
way, six months rather than --
[44:28]
because obviously I'm going to
[44:30]
live for the next many months to
[44:32]
come, so is there any way to
[44:35]
create some sort of contract, or
[44:38]
the contract that would have a
[44:39]
very significant penalty in
[44:40]
case --
[44:43]
>> Mayor: I can't speak for the
[44:43]
owner.
[44:47]
But I will say that their
[44:49]
construction has been overall,
[44:51]
and their deliverables on a
[44:55]
timely manner, has been
[44:56]
exemplary.
[44:57]
I have to say their experience
[44:59]
has been -- I think they've -- I
[45:01]
think they've really performed
[45:02]
on their time lines.
[45:04]
>> I trust what you're saying.
[45:07]
But is there any way to include
[45:08]
some sort of a, you know, time
[45:10]
limits for them to complete that
[45:14]
within "x" number of months, and
[45:15]
basically make it accountable
[45:16]
for that.
[45:19]
>> if I could say, as with any
[45:20]
construction there's always
[45:21]
unforeseeable -- so that
[45:23]
wouldn't be anything that would
[45:23]
be feasible.
[45:24]
>> Mayor: I don't know if you
[45:25]
want to address that.
[45:27]
It's not really, it's not within
[45:28]
the scope of our inquiry.
[45:32]
I mean, that's beyond, you
[45:32]
know -- the expectations are
[45:33]
when they're going to complete
[45:34]
their construction.
[45:35]
>> precisely, mayor.
[45:37]
You pointed that out.
[45:37]
This is the province of the
[45:38]
building official in the
[45:43]
building department.
[45:44]
Follow their procedures and
[45:45]
such.
[45:47]
You also did point out that a
[45:48]
much larger construction
[45:49]
project, the redevelopment of
[45:51]
the entire site and the two new
[45:53]
buildings was timely,
[45:54]
efficiently and well done.
[45:55]
This is a very small component
[45:56]
of it.
[45:59]
But again, as mayor points out,
[46:01]
this is the thing to discuss now
[46:01]
is not germane to this.
[46:02]
It's a building permitting
[46:05]
issue.
[46:07]
>> Mayor: right.
[46:08]
And I think they're very
[46:14]
accessible.
[46:15]
[Speaker off mic]
[46:16]
Okay.
[46:20]
Do we have another public
[46:21]
speaker?
[46:25]
Eric luca.
[46:26]
Thank you.
[46:26]
No.
[46:27]
Good questions.
[46:30]
And very topical and very
[46:31]
relevant.
[46:32]
We're in poinciana.
[46:34]
>> hi, hello.
[46:35]
>> Mayor: state your name and
[46:36]
address.
[46:37]
>> eric luca.
[46:44]
I live in poinciana island 236
[46:44]
since JUNE '96.
[46:45]
27 years now.
[46:46]
I used to have my boat there.
[46:50]
Then I had to take it out.
[46:53]
So, my concern says that how
[46:57]
would it be that they're
[47:02]
claiming that in OCTOBER 26,
[47:03]
2005, when wind hit all of us,
[47:05]
and I lost my boat, matter of
[47:08]
fact, you lost the marina, and
[47:10]
then now 17 year later, you
[47:11]
haven't done anything, now 17
[47:16]
years later you're saying that
[47:18]
you can have -- so in that same
[47:20]
case when I move in poinciana,
[47:24]
in 2001, 2002, we have access to
[47:26]
everybody, the 100 units, can't
[47:27]
have a boat.
[47:29]
So if we can say that they can
[47:32]
use the permit for the 18
[47:34]
marinas, why don't we have our
[47:34]
own permits to have a boat in
[47:38]
each of our units?
[47:41]
this point, point number one.
[47:44]
So you can please -- or say this
[47:44]
easier.
[47:46]
If they want to provide this,
[47:49]
just give us all of us our
[47:53]
marina -- our access to put the
[47:55]
boat in that's number one.
[47:57]
Second, why the marina you want
[47:57]
to build it?
[47:58]
Now you want to build a marina
[48:05]
on the narrowest part of the
[48:14]
island.
[48:17]
Based on the main, you put a 30
[48:25]
foot boat there, to maneuver,
[48:27]
you're now going to hit my boat
[48:28]
with it's not feasible to do a
[48:29]
marina there to have a boat more
[48:32]
than 40 feet.
[48:35]
So, first of all, I don't think
[48:36]
you are in a situation now to
[48:39]
say yes or no to this will have
[48:41]
to take a month to study.
[48:43]
That's what I'm asking you is I
[48:44]
know that there want to be some
[48:45]
changes in the organization of
[48:49]
the city government, okay.
[48:49]
But this is not something that's
[48:53]
got to be passed now.
[48:57]
And again you want to do the
[48:59]
railing I don't care really.
[49:00]
If there's a marina in front I
[49:02]
don't care, just move it to one
[49:03]
side or the other where the
[49:05]
channel is wider.
[49:06]
Much wider.
[49:08]
On second, each of us we receive
[49:09]
the same permit to have a boat
[49:10]
in front of our unit.
[49:11]
And I tell you what, we cannot
[49:13]
say no.
[49:16]
>> Mayor: eric, that's not --
[49:17]
that's not something that the
[49:18]
commission can arbitrate or
[49:20]
decide.
[49:21]
>> we can try.
[49:23]
>> Mayor: we can't as a
[49:25]
commission body just allow that
[49:29]
every owner can have a boat --
[49:29]
>> with the same situation that
[49:32]
if I have a boat, 20 years ago,
[49:34]
why I cannot have a boat?
[49:36]
And they're saying that I have a
[49:37]
permit 17 years ago.
[49:39]
They never use it, and now they
[49:42]
can get it.
[49:43]
Something is unfair here.
[49:45]
It's basically unfair.
[49:47]
Each of us in poinciana, we have
[49:48]
a way to do it.
[49:50]
Now, okay, you got your boat.
[49:52]
You got your pier and
[49:53]
congratulations.
[49:58]
Even, same to you for yours,
[49:58]
congratulations.
[49:59]
I will be a commissioner next
[50:01]
time to have a pier on my house.
[50:01]
Yes.
[50:01]
It's fair.
[50:07]
It's fair.
[50:09]
I'm not being sarcastic.
[50:10]
>> Mayor: okay, thank you.
[50:11]
>> I don't have a boat or a pier
[50:17]
behind my house.
[50:17]
>> okay.
[50:20]
Now let me say -- MAY I add
[50:21]
something to the people of
[50:22]
marina.
[50:25]
If you want to improve -- my
[50:28]
units are right across the
[50:30]
parking permit, the building,
[50:32]
the parking building.
[50:36]
You know that you're allowing
[50:36]
harley-davidson to park on the
[50:38]
top floor and at 1:00 in the
[50:40]
morning they go around and
[50:42]
around and around eight floors.
[50:44]
One in the morning, six in the
[50:44]
morning.
[50:50]
Don't leave the bikes on the top
[50:57]
with the open going to the
[50:58]
floor.
[51:01]
And -- and I talk to the city.
[51:03]
I talk to the inspectors.
[51:05]
Oe of the inspectors that I'm
[51:10]
going to have, he told me why
[51:12]
don't you -- so in the next
[51:13]
month I'm going to request this
[51:15]
guy to be fired.
[51:17]
But that's not the response to a
[51:18]
person that live here.
[51:21]
we pay the salary of these -- so
[51:27]
please.
[51:27]
You can tell him to come I
[51:29]
believe at 8:30 or 9:00.
[51:30]
>> Mayor: thank you.
[51:31]
Thank you.
[51:32]
>> thank you.
[51:33]
>> Mayor: thank you.
[51:35]
Understood.
[51:35]
Understood.
[51:39]
Okay.
[51:49]
Greg capra.
[51:50]
>> good evening.
[51:52]
Greg capra, 257 poinciana
[51:53]
island.
[51:54]
I'm the PRESIDENT Of the board
[51:54]
there.
[51:57]
And I have quite a bit of
[51:59]
knowledge about dealing with
[52:01]
derm and the concerns of our
[52:02]
residents there.
[52:05]
And, respect to their questions,
[52:06]
this particular marina really
[52:10]
doesn't have anything to do with
[52:11]
poinciana's marina.
[52:13]
Derm's laws, as far as I know,
[52:15]
what they've told us, and why we
[52:18]
have only 43 power boats is
[52:20]
because we have 4300 feet around
[52:21]
the island.
[52:23]
They allow one boat for 100
[52:23]
feet.
[52:25]
So I would assume they have 1800
[52:26]
feet, if they have more, they
[52:27]
probably would be asking for
[52:32]
more slips.
[52:34]
That being said, owners are
[52:35]
concerned with the construction,
[52:37]
how long this is going to take,
[52:37]
and so on.
[52:40]
So they have questions.
[52:41]
So while I'm personally not
[52:43]
against what they're doing, I
[52:45]
would ask that the commission
[52:47]
delay the decision so unit
[52:48]
owners of poinciana could gather
[52:50]
more information, and be
[52:50]
comfortable about this process
[52:53]
and what's going to happen.
[52:55]
Now you say they had a marina
[52:56]
before, and I would say, why
[53:00]
shouldn't they have a marina
[53:00]
now?
[53:01]
Eric's comment about boats being
[53:03]
a certain length is valid.
[53:04]
But that's really not your
[53:08]
decision.
[53:10]
If derm felt it was unsafe, and
[53:12]
they didn't mention army corps
[53:12]
of engineers.
[53:14]
And so was the army corps of
[53:15]
engineers involved with this?
[53:17]
So they had a marina before.
[53:18]
I don't know that they need to
[53:20]
be involved again.
[53:21]
But there's questions that need
[53:23]
to be asked and answered.
[53:26]
And, I don't know that it's so
[53:27]
important to make a decision
[53:30]
tonight versus in JANUARY, where
[53:32]
they could come back, could ask
[53:33]
questions that they want to
[53:35]
bring up, and provide them.
[53:36]
I know people had an opportunity
[53:37]
to be here tonight and could
[53:38]
have asked those questions.
[53:40]
I don't know if anyone else is
[53:40]
here.
[53:45]
But, it does give a little extra
[53:45]
time.
[53:47]
And I'm not against this.
[53:48]
But I think some other questions
[53:52]
need to be answered, and an
[53:54]
extra month really wouldn't be a
[53:56]
big deal to allow that to
[53:57]
happen.
[53:57]
>> Mayor: okay.
[54:00]
We have no other public
[54:00]
speakers.
[54:05]
So again, I'd like to just ask
[54:06]
the question, again, these
[54:08]
marina slips were pre-existing,
[54:08]
correct?
[54:09]
You had a pre-existing --
[54:12]
>> correct.
[54:14]
>> Mayor:-plan where you had 18
[54:14]
marina slips.
[54:15]
Is that correct?
[54:16]
>> that is correct.
[54:18]
>> Mayor: and that you have full
[54:20]
clearance with manatees, and
[54:22]
with wake, and with passage of
[54:24]
boats through that canal.
[54:26]
So any placement of these marina
[54:28]
slips, the quantity, the
[54:30]
ingress, the egress, the
[54:33]
manatee, the environmental, all
[54:35]
of that has been completely
[54:35]
vetted.
[54:35]
Correct?
[54:37]
>> all been reviewed by derm and
[54:38]
preliminarily approved.
[54:39]
>> Mayor: okay.
[54:43]
So derm, and the same way derm
[54:44]
approved that that they approved
[54:45]
with whatever conditions in
[54:46]
poinciana island.
[54:46]
Correct?
[54:47]
>> correct, mayor.
[54:49]
>> Mayor: so there's no issue
[54:52]
whatsoever with the amount of
[54:54]
slips, the clearance, the
[54:55]
ingress, the egress.
[54:58]
>> where they're located, no
[55:00]
variances, all by right within
[55:00]
derm's rules, within the city's
[55:05]
rules.
[55:06]
>> Mayor: and we've had plenty
[55:07]
of opportunity to discuss this
[55:09]
this evening, and there's no --
[55:12]
there are no other lingering
[55:13]
questions or any reason to --
[55:15]
>> oh, I have a few comments.
[55:17]
>> Mayor: other than whatever my
[55:17]
colleagues have here.
[55:22]
But I just, for me, that was the
[55:26]
sine qua non that there were 18
[55:28]
slips in existence and that's
[55:29]
why I felt all along.
[55:30]
It's not like you're creating
[55:31]
something from nothing.
[55:32]
>> correct, mayor.
[55:33]
And it is permitted as a matter
[55:34]
of right.
[55:38]
And it meets all the criteria
[55:38]
for site plan.
[55:40]
>> Mayor: and I think it will be
[55:40]
beautiful.
[55:41]
Just like the building.
[55:41]
So anyway.
[55:48]
go ahead.
[55:49]
Commissioner stuyvesant.
[55:50]
>> number one, about cable
[55:50]
railing.
[55:51]
That sidewalk is a public
[55:52]
sidewalk, right?
[55:54]
>> correct.
[55:57]
>> so, by us accepting to
[55:59]
eliminate that cable railing, if
[56:00]
anything happens there are we
[56:02]
liable for it, the city liable
[56:03]
in any way?
[56:04]
Because I don't know the answer.
[56:06]
>> no, I don't believe we are.
[56:08]
Because those cables aren't
[56:09]
required by the terms of our
[56:12]
land development regulations.
[56:15]
>> it was like an extra layer of
[56:16]
protection.
[56:18]
But again I just wanted to
[56:20]
codify that that's a public
[56:20]
sidewalk.
[56:24]
>> yes, and commissioner as
[56:25]
MR. Dissinger said it is
[56:26]
consistent with the other public
[56:27]
bay walk.
[56:30]
>> in st. Tropez, I just wanted
[56:34]
to make sure that we aren't
[56:35]
liable by saying, you know.
[56:38]
Number two the modification the
[56:41]
entryway signage I have no issue
[56:41]
with.
[56:43]
Number three with the condition,
[56:44]
I have some issues.
[56:48]
Because you have 35 units right
[56:49]
now for workforce housing.
[56:49]
Right?
[56:50]
>> correct.
[56:52]
>> what is the price, kind of,
[56:53]
of those, do you know?
[56:53]
>> well, the way the workforce
[56:59]
housing unit pricing goes is
[57:05]
it's set based upon the median
[57:07]
income for a family or an
[57:09]
individual in dade county.
[57:12]
And it can't be -- that is, it
[57:15]
cannot be higher than what would
[57:18]
be housing for someone at 120%
[57:23]
of ami, adjusted median income.
[57:25]
Which it would be 30% of that
[57:26]
income.
[57:28]
So for instance, if somebody --
[57:31]
and it's scaled also based on
[57:32]
whether it's one person, two
[57:33]
people, three people, four
[57:33]
people.
[57:34]
>> right.
[57:38]
>> so if it's a family of four,
[57:42]
and the person earns 120% of
[57:44]
ami, which would be I think
[57:47]
about $90,000, then I think that
[57:48]
the total rent there couldn't be
[57:50]
more than $27,000.
[57:53]
And that's the very, very high
[57:54]
end.
[57:56]
It was a -- two people, it would
[57:57]
be less.
[57:58]
If their income was $70,000, it
[58:03]
would be 30% of that.
[58:04]
So that's the cap.
[58:05]
They don't actually control the
[58:06]
rent.
[58:06]
The rent is controlled by the
[58:09]
income of the tenant.
[58:09]
>> great.
[58:12]
But I know those 35 units are
[58:13]
all over the building.
[58:15]
>> correct.
[58:18]
>> how you have like per floor,
[58:20]
or and what if you are expecting
[58:22]
to do now, you want to put them
[58:25]
all on the first, second, third
[58:25]
floor?
[58:26]
>> in fact, good question.
[58:27]
And that actually prompted, I
[58:28]
think, the desire of ownership
[58:35]
for the change.
[58:37]
Over time tenants will come,
[58:38]
tenants will go.
[58:39]
In order to be able to make sure
[58:40]
they can accommodate them in
[58:42]
various parts of the building,
[58:43]
they wanted to have a
[58:45]
flexibility to move the units
[58:45]
around.
[58:46]
Whereas if you're locked in
[58:49]
specific units, you know, then
[58:51]
those will always be -- I mean,
[58:53]
these workforce units will be
[58:57]
integrated with all the units
[59:00]
throughout the entire complex.
[59:02]
So it gives them more
[59:03]
flexibility and it works a lot
[59:03]
better.
[59:09]
>> but I'm really concerned with
[59:11]
that item, because people in
[59:12]
sunny isles because everything
[59:13]
is going higher and higher in
[59:14]
the prices.
[59:17]
And if you have the 35 units
[59:21]
right now, very well described
[59:24]
that you have, I don't see what
[59:26]
would be the difference of
[59:29]
changing the numbers of having
[59:30]
it open.
[59:31]
What I'm scared is right now you
[59:33]
might have five units on the top
[59:37]
floor with a very nice view and
[59:37]
then we can move those five
[59:38]
units to the bottom floor with
[59:39]
no view.
[59:40]
I don't know --
[59:42]
>> first of all the covenant
[59:44]
requires, no matter what, there
[59:45]
always must be 35 units.
[59:45]
>> correct.
[59:48]
>> so this is not changing the
[59:51]
number of units whatsoever.
[59:53]
But what it is doing is as we
[59:56]
realize is the flexibility to
[59:59]
say, as to where the units are,
[1:00:04]
because tenants come and go.
[1:00:06]
And, you know, you might want to
[1:00:07]
put a tenant in another unit, a
[1:00:09]
new tenant in another unit.
[1:00:11]
It just -- and that's candidly,
[1:00:13]
the way, I think most of the
[1:00:13]
workforce housing unit
[1:00:20]
allocations go.
[1:00:23]
>> commissioner, just to add to
[1:00:24]
that, as part of our workforce
[1:00:25]
housing ordinance, they're
[1:00:26]
required to submit an annual
[1:00:28]
report every OCTOBER to my
[1:00:29]
department that's going to be
[1:00:30]
reviewed.
[1:00:31]
And in that report it does need
[1:00:33]
to list every unit number.
[1:00:35]
So at that time, you know, if we
[1:00:37]
see that they're all on floor
[1:00:38]
one, well that's in violation of
[1:00:39]
their covenant.
[1:00:40]
They need to be on multiple
[1:00:41]
floors.
[1:00:42]
So we will be monitoring the
[1:00:45]
workforce housing program.
[1:00:46]
>> I understand.
[1:00:47]
I'm just not comfortable with
[1:00:47]
that item.
[1:00:48]
And the last one about the
[1:00:53]
marina, I see my neighbors here
[1:00:54]
in poinciana, and I understand
[1:00:57]
why they're upset, because the
[1:01:00]
way the marina slips are managed
[1:01:04]
in poinciana, is very
[1:01:08]
questionable, to say the least.
[1:01:09]
Some people would even call it
[1:01:11]
fraudulent what they're doing
[1:01:12]
with the marina slips in
[1:01:14]
poinciana island.
[1:01:15]
So I understand their concerns,
[1:01:16]
really.
[1:01:18]
But having said that the numbers
[1:01:18]
don't lie.
[1:01:21]
You have 32.7 units per slip.
[1:01:25]
Because you have a total of 589
[1:01:27]
units between the three
[1:01:27]
buildings.
[1:01:30]
So I want to repeat.
[1:01:33]
You have almost 600 units, and
[1:01:35]
18 slips.
[1:01:35]
So that give you per slip 32.7
[1:01:38]
units.
[1:01:43]
So I don't know how it's going
[1:01:44]
to be the dynamics you are going
[1:01:46]
to be using to ashrine the
[1:01:47]
slips, it's going to be a
[1:01:49]
lottery or whatever.
[1:01:51]
But having said that, I didn't
[1:01:54]
see anywhere, maybe you said but
[1:01:55]
I didn't read it, the limits to
[1:01:59]
the size of the boats.
[1:02:01]
And also, the marina was there
[1:02:01]
you said back almost 20 years
[1:02:06]
ago.
[1:02:08]
I don't feel comfortable right
[1:02:10]
now with bringing this item and
[1:02:13]
approving this item the way it's
[1:02:13]
presented.
[1:02:15]
So I leave it to my colleagues
[1:02:22]
for further comments.
[1:02:25]
>> Mayor: I don't see that, you
[1:02:26]
know, delaying this has any
[1:02:29]
value or merit.
[1:02:31]
I feel that, you know, I'm very
[1:02:34]
comfortable with all four items.
[1:02:38]
The workforce housing covenant
[1:02:39]
has changed to give more
[1:02:40]
flexibility, but it doesn't
[1:02:41]
mitigate the number of units.
[1:02:44]
It just, you know, is how the --
[1:02:46]
how the rentals work.
[1:02:47]
So it's a requirement.
[1:02:50]
It's a covenant.
[1:02:51]
And it's -- they're always going
[1:02:52]
to have those 34 workforce
[1:02:53]
housing units.
[1:02:57]
For me, that's a nonissue.
[1:02:58]
It's just very minor.
[1:03:01]
The signage, obviously, is
[1:03:02]
minor.
[1:03:02]
The cable.
[1:03:04]
And for the marina, again, if
[1:03:09]
it's pre-existing, and you've
[1:03:10]
got the slips, and you can get
[1:03:12]
it permitted, and, you know, I
[1:03:14]
think it will beautify the area
[1:03:15]
and I'm comfortable with that,
[1:03:16]
as well.
[1:03:17]
>> so I have some questions.
[1:03:18]
So, obviously you had a marina
[1:03:22]
there before.
[1:03:24]
That was a long time ago.
[1:03:26]
Things change.
[1:03:27]
So I just want to know if it's
[1:03:30]
comparable, and the size of the
[1:03:32]
boats that it will house.
[1:03:37]
And if it's going to be the same
[1:03:37]
dimensions as before.
[1:03:39]
And if it's going to go in the
[1:03:39]
same place.
[1:03:42]
Because I know that one of the
[1:03:42]
poinciana residents said that
[1:03:44]
it's going to be placed in the
[1:03:45]
narrowest point of that canal,
[1:03:50]
let's say.
[1:03:52]
So that, I have those questions.
[1:03:55]
And yeah, I'll let you answer
[1:03:56]
those.
[1:04:00]
>> commissioner, well, it is
[1:04:02]
where the marina was located
[1:04:03]
before.
[1:04:04]
Remember, derm would only
[1:04:05]
approve it -- is approving it
[1:04:07]
also based on the fact that
[1:04:08]
there were historic 18 slips
[1:04:09]
there.
[1:04:09]
>> okay.
[1:04:16]
>> the length of boats is also
[1:04:19]
regulated by how far out you
[1:04:19]
could put the mooring
[1:04:20]
ing
[1:04:21]
ing poles.
[1:04:24]
Which are regulated by the city,
[1:04:25]
as well as by derm.
[1:04:28]
These are not very -- we are not
[1:04:29]
seeking variances to extend them
[1:04:30]
so that they can be farther out.
[1:04:31]
>> okay.
[1:04:35]
>> so these are -- this is
[1:04:35]
essentially what was
[1:04:37]
historically always there.
[1:04:37]
>> okay.
[1:04:39]
All right.
[1:04:41]
Yeah I'm just a little
[1:04:42]
concerned, you know, with the
[1:04:43]
geography of that canal.
[1:04:44]
Obviously you have people in
[1:04:46]
front of you.
[1:04:48]
There's a lot more that say, you
[1:04:51]
know, possibility of echoes.
[1:04:52]
And regarding the time limits
[1:04:54]
that we're imposing.
[1:04:56]
6:00 A.M. To 12:00 A.M.,
[1:04:56]
correct?
[1:04:59]
Is that a citywide imposition?
[1:05:00]
Or --
[1:05:02]
>> that's something we
[1:05:03]
volunteered.
[1:05:04]
There's no limit.
[1:05:07]
>> how is that even going to be
[1:05:07]
enforced?
[1:05:08]
You're going to tell someone you
[1:05:10]
cannot go out fishing at 4:00 in
[1:05:12]
the morning, you have to wait
[1:05:14]
until 6:00.
[1:05:15]
Or you cannot come back from the
[1:05:16]
beach, you have to wait outside
[1:05:19]
in the middle of the water until
[1:05:20]
6:00 A.M. To come back.
[1:05:21]
i don't see how that's going to
[1:05:22]
be enforced.
[1:05:25]
>> well, you have a series of
[1:05:26]
fines if it's slated.
[1:05:28]
We have the advantage of this
[1:05:29]
not being a condominium
[1:05:32]
property.
[1:05:32]
This is a centrally managed
[1:05:33]
property.
[1:05:34]
These are apartment unit owners
[1:05:35]
and those are the only people
[1:05:37]
who are going to have slips
[1:05:37]
there, apartment dwellers, not
[1:05:38]
owners.
[1:05:42]
And they can be -- they're
[1:05:43]
subject to rules as well not
[1:05:46]
only of the city's rules, but
[1:05:48]
the association, the
[1:05:49]
management's rules for the
[1:05:50]
building.
[1:05:51]
There's more enforcement that
[1:05:53]
you'll be able to have for this
[1:05:55]
than if it was a typical
[1:05:56]
building where a variety of
[1:05:56]
people own the slips.
[1:05:57]
They own the slips.
[1:06:01]
They're responsible.
[1:06:02]
They deal with it.
[1:06:03]
And I would point out, I mean,
[1:06:07]
it is important to point out,
[1:06:10]
because the discussion's
[1:06:11]
beginning to get, you know,
[1:06:13]
somewhat candidly, afield of
[1:06:15]
what really is properly before
[1:06:15]
this.
[1:06:15]
Remember, this marina is a
[1:06:20]
matter of right.
[1:06:21]
And the only thing that it can
[1:06:25]
be judged by is the criteria in
[1:06:25]
your code for site plan
[1:06:29]
approval.
[1:06:30]
And your planning director, and
[1:06:33]
you find that in page 3 of the
[1:06:34]
staff report, we meet all of
[1:06:37]
this criteria.
[1:06:42]
Because we meet all of this
[1:06:42]
criteria, there is no basis for
[1:06:48]
not approving this.
[1:06:50]
That's -- notwithstanding that,
[1:06:51]
the manager and the planning
[1:06:54]
director have asked us to
[1:06:57]
voluntarily -- sought us to
[1:06:58]
voluntarily proffer additional
[1:06:59]
conditions, further restrictions
[1:07:00]
beyond what the law requires.
[1:07:01]
And we have agreed to do that,
[1:07:05]
voluntarily.
[1:07:06]
>> so, okay, I understand that,
[1:07:07]
you know, you have the right for
[1:07:08]
this.
[1:07:10]
But I live in winston towers.
[1:07:10]
Right?
[1:07:12]
We have a marina around there,
[1:07:13]
and we don't have anything in
[1:07:15]
front of it that will bounce off
[1:07:20]
the noise.
[1:07:20]
But still we get complaints, you
[1:07:23]
know, just from resident
[1:07:24]
perspective, obviously, are you
[1:07:26]
suggesting or telling us that
[1:07:29]
you're going to manage the
[1:07:32]
behavior of these residents that
[1:07:34]
have their boats?
[1:07:34]
>> absolutely.
[1:07:35]
>> your management, let's say?
[1:07:40]
>> absolutely.
[1:07:41]
Remember, this property has
[1:07:44]
full-time, 24 hour management.
[1:07:44]
>> okay.
[1:07:54]
>> and security.
[1:07:56]
So, this will have greater
[1:07:58]
control than any private
[1:08:01]
property, any condominium
[1:08:02]
property, because you've got --
[1:08:04]
and they also have the ability,
[1:08:05]
not only your enforcement of the
[1:08:07]
city's code, but they have the
[1:08:08]
ability to yank someone's right
[1:08:08]
to use a slip.
[1:08:12]
As well.
[1:08:17]
So their hands-on management,
[1:08:19]
remember, the brunettis have
[1:08:20]
owned this property for almost
[1:08:21]
40 years, they built this
[1:08:22]
property to own it for the
[1:08:23]
long-term, they have a greater
[1:08:26]
interest in making sure that
[1:08:28]
this is well run than almost
[1:08:29]
anybody would, candidly.
[1:08:30]
Because they don't want to --
[1:08:33]
they're going to have lots of
[1:08:34]
tenants there.
[1:08:35]
They're not going to want their
[1:08:37]
own tenants disturbed.
[1:08:38]
As commissioner stuyvesant
[1:08:39]
pointed out, you know, at most
[1:08:41]
one out of 32 units are going to
[1:08:44]
have a slip.
[1:08:45]
They're not going to want to
[1:08:47]
have the other 31 unit owners
[1:08:49]
per slip inconvenienced.
[1:08:52]
So, you -- this is the best
[1:08:52]
situation you could have
[1:08:55]
candidly for a managed marina.
[1:08:57]
>> Mayor: is there a limitation
[1:08:59]
on the size of the boat that
[1:09:01]
they put in there?
[1:09:05]
Because boats -- there are
[1:09:08]
[Inaudible] Prescribed?
[1:09:09]
>> I appreciate all the
[1:09:12]
concerns.
[1:09:16]
And I'm listening to them,
[1:09:18]
because we, as an ownership,
[1:09:20]
want to protect all the citizens
[1:09:21]
when we have this development.
[1:09:24]
Some we went to derm, and we
[1:09:27]
developed the design, and
[1:09:28]
engineered it within the
[1:09:30]
described dimensions of the
[1:09:30]
waterway.
[1:09:35]
The slips are designed and
[1:09:37]
engineered precisely as told and
[1:09:40]
directed by derm.
[1:09:45]
The lentd of the boat, the slip,
[1:09:48]
the mooring poles, the width of
[1:09:50]
the canal, the channel, the
[1:09:51]
depth and size of every boat on
[1:09:53]
the slip is described precisely
[1:09:55]
in the drawings that we
[1:09:56]
presented so that everybody
[1:09:57]
understands how many boats we
[1:09:58]
have.
[1:09:59]
What the size will be.
[1:10:04]
And what derm would allow.
[1:10:06]
And the width -- everything's
[1:10:07]
engineered within the width of
[1:10:08]
the waterway and prescribed by
[1:10:13]
derm because of the width.
[1:10:16]
>> no my concern is more from a
[1:10:16]
resident perspective.
[1:10:18]
you're sitting there, somebody's
[1:10:19]
taking their boat out at 6:00
[1:10:21]
A.M. And they're going to wake
[1:10:23]
you up, you know, it's just not
[1:10:24]
pleasant.
[1:10:24]
You know.
[1:10:26]
And we're a very crowded city.
[1:10:27]
There's a lot of noise solution
[1:10:27]
around.
[1:10:29]
You know we're talking a few
[1:10:29]
weeks ago.
[1:10:31]
And we've been talking
[1:10:31]
throughout the whole year about
[1:10:35]
noise ordinances.
[1:10:37]
You know, I'm just looking at it
[1:10:38]
from a perspective of having a
[1:10:40]
good night's sleep.
[1:10:42]
Not being, you know, bothered by
[1:10:44]
these boats and all that.
[1:10:46]
So, I know that you have the
[1:10:48]
right to build this.
[1:10:50]
I'm just asking that you manage
[1:10:51]
it well.
[1:10:52]
And that you're considerate, and
[1:10:54]
that you're a good neighbor.
[1:10:55]
Because you have poinciana in
[1:10:56]
front of you.
[1:10:57]
You have other people.
[1:10:58]
Noise is bouncing all around
[1:10:58]
here.
[1:11:00]
I don't know, do you live here
[1:11:00]
in the city?
[1:11:03]
>> I don't, commissioner.
[1:11:03]
But I've come --
[1:11:04]
>> you're well aware.
[1:11:06]
I know you're very familiar with
[1:11:07]
the city.
[1:11:09]
>> my dad had a drug store in
[1:11:12]
this city in the 1950s and 60s.
[1:11:14]
>> you had a drug store here?
[1:11:15]
>> yes.
[1:11:16]
The one that has the was like
[1:11:21]
the watermelon shaped zone.
[1:11:22]
>> that became a restaurant?
[1:11:25]
>> when that shopping center was
[1:11:27]
built by the family in the '50s
[1:11:29]
my dad had a big drug store
[1:11:29]
there.
[1:11:30]
I've been coming to this city
[1:11:32]
since I was a little baby.
[1:11:32]
>> all right.
[1:11:34]
>> commissioner lama, I think
[1:11:35]
it's important to point out that
[1:11:37]
nowhere else in the city are
[1:11:38]
there time limits about boats
[1:11:38]
coming in and going out.
[1:11:41]
Okay?
[1:11:43]
They voluntarily have agreed to
[1:11:46]
the 6:00 to 12:00.
[1:11:48]
It's the only marina in the city
[1:11:49]
where there are time
[1:11:49]
requirements.
[1:11:51]
>> because I know that the one
[1:11:53]
in winston towers, and there's
[1:11:54]
another one that, you know, we
[1:11:55]
get a lot of noise complaints
[1:11:57]
for.
[1:11:59]
>> but you also have our
[1:12:00]
asurance, commissioner, that we
[1:12:02]
will -- this will be heavily
[1:12:03]
managed, well managed.
[1:12:04]
It's a family asset.
[1:12:05]
And they want a good
[1:12:12]
environment.
[1:12:17]
[Speaker off mic]
[1:12:17]
>> it doesn't make sense.
[1:12:18]
>> party boats and all that.
[1:12:30]
>> no.
[1:12:31]
[Speaker off mic]
[1:12:32]
>> just a couple of questions.
[1:12:35]
For me it's pretty clear that
[1:12:36]
you meet the criteria.
[1:12:36]
Whether we love it or we don't,
[1:12:40]
the criteria is the criteria.
[1:12:42]
But I had a question about the
[1:12:44]
length of the lease of the
[1:12:44]
slips.
[1:12:47]
How does it go, per when you
[1:12:50]
rent the unit?
[1:12:53]
And then if you have a weight
[1:12:57]
list and how do you move up that
[1:12:59]
list, do you have to get your
[1:12:59]
neighbor evicted?
[1:13:01]
How does that work?
[1:13:04]
>> so the reason we're
[1:13:05]
proceeding with the project in
[1:13:06]
this is because we weren't
[1:13:07]
certain that there would be
[1:13:11]
interest for all of the slips.
[1:13:12]
We're finding out that there are
[1:13:15]
some tenants now that are coming
[1:13:16]
and are interested in those.
[1:13:19]
So they're one-year leases.
[1:13:21]
And I think one of the things
[1:13:23]
that's very important to us, we
[1:13:24]
developed a whole list of marina
[1:13:27]
rules, which we submitted as
[1:13:30]
part of this application.
[1:13:31]
Our greatest concern is there
[1:13:34]
isn't partying going on on the
[1:13:34]
boats.
[1:13:36]
So we have a very strict list of
[1:13:37]
rules.
[1:13:39]
Because our goal is to protect
[1:13:40]
even the residents who don't
[1:13:41]
rent.
[1:13:41]
But it's a first come, first
[1:13:44]
serve basis.
[1:13:46]
And yes, there would be a wait
[1:13:46]
list.
[1:13:46]
And --
[1:13:49]
>> so if I come in, and I come
[1:13:50]
in with my boat and I move in.
[1:13:51]
>> right.
[1:13:52]
>> so I get my slip.
[1:13:54]
And if I follow all the rules,
[1:13:55]
you don't have any problems with
[1:13:58]
me, as long as I keep renewing
[1:14:00]
my lease, I get to keep renewing
[1:14:00]
the slip?
[1:14:01]
>> absolutely.
[1:14:05]
>> okay.
[1:14:06]
>> absolutely.
[1:14:09]
>> and I had another question.
[1:14:13]
Okay.
[1:14:17]
I saw in the report, you have to
[1:14:19]
be a resident there to rent.
[1:14:19]
Right?
[1:14:20]
>> that's correct.
[1:14:21]
>> but -- so you have to show
[1:14:23]
that you're -- you have to prove
[1:14:24]
that you're a resident.
[1:14:24]
But do you have to prove that
[1:14:26]
it's your boat?
[1:14:26]
>> yes.
[1:14:30]
>> okay.
[1:14:32]
>> you have to not only prove
[1:14:33]
it's your boat.
[1:14:34]
You can't rent somebody else's
[1:14:35]
boat and park it there.
[1:14:36]
>> that's where I'm going.
[1:14:37]
>> none of that.
[1:14:38]
All of that is policed.
[1:14:40]
We have a licensed marine dock
[1:14:41]
master that will serve us in the
[1:14:47]
leasing, and the filing of their
[1:14:47]
requirement to meet our lease
[1:14:48]
and rule requirements.
[1:14:50]
And that will be vetted by
[1:14:50]
management.
[1:14:53]
And then once you have a lease,
[1:14:53]
it's yours.
[1:14:54]
On a renewable basis.
[1:14:54]
>> okay.
[1:14:58]
Okay.
[1:14:59]
Those were my questions.
[1:15:00]
Again, to mitigate the party
[1:15:04]
boat issues, and the other, but
[1:15:09]
it's -- it's to the interest of
[1:15:11]
your property, and your
[1:15:11]
representation, and your
[1:15:12]
property values and all of that
[1:15:14]
to manage it well.
[1:15:14]
Okay.
[1:15:19]
Thank you.
[1:15:19]
>> yes, thank you.
[1:15:27]
So just for the information of
[1:15:28]
the poinciana residents, I've
[1:15:30]
particularly looked at the
[1:15:31]
length of the -- the width of
[1:15:33]
the waterway and it appears to
[1:15:34]
be 178 feet.
[1:15:35]
>> yeah.
[1:15:37]
And it's on our drawings, I
[1:15:38]
would like to answer you yes
[1:15:39]
that's exactly what it is.
[1:15:42]
But I'd have to look at the
[1:15:42]
drawings.
[1:15:44]
But the waterway on our drawings
[1:15:46]
is defined in each location
[1:15:48]
relative to our slip.
[1:15:50]
And derm has reviewed those
[1:15:51]
locations and minimized the
[1:15:53]
length of our slips and mooring
[1:15:55]
positions to reflect the
[1:15:57]
requirements of derm and the
[1:15:57]
channel.
[1:15:59]
>> so your slips are 24 feet
[1:16:00]
currently.
[1:16:02]
And what are they four pilings,
[1:16:06]
right, every six feet you have a
[1:16:06]
piling?
[1:16:08]
So, in temgs of the walkway
[1:16:09]
going down --
[1:16:11]
>> no talking about the t-slip.
[1:16:12]
>> yes.
[1:16:12]
>> so you'd have four pilings.
[1:16:13]
At least.
[1:16:15]
>> yes.
[1:16:16]
>> probably four pilings at
[1:16:16]
each, six feet.
[1:16:25]
So, so, the maximum length of
[1:16:26]
the boat would probably be
[1:16:28]
between 45 and 60?
[1:16:28]
>> no.
[1:16:31]
Our boats are less than 40 feet.
[1:16:31]
>> okay.
[1:16:32]
>> no boat is greater than 40
[1:16:33]
feet.
[1:16:36]
>> okay.
[1:16:38]
>> and we're not allowed to do
[1:16:39]
that because that's a derm
[1:16:40]
requirement with our design.
[1:16:40]
>> okay.
[1:16:41]
So there's no issue with turning
[1:16:45]
in the canal?
[1:16:46]
>> no.
[1:16:47]
All those --
[1:16:49]
>> you have 178 feet, if you
[1:16:50]
have a 40-plus boat, it's not an
[1:16:53]
issue for anyone.
[1:17:01]
>> thank you.
[1:17:03]
>> Mayor: do we have any more
[1:17:04]
comments or questions?
[1:17:06]
Or are we ready to --
[1:17:19]
[Speaker off mic]
[1:17:20]
Okay, so that being said,
[1:17:21]
questions, comments, do we have
[1:17:22]
a motion?
[1:17:25]
>> I'll make a motion.
[1:17:28]
>> Mayor: commissioner joseph.
[1:17:29]
>> I'll second.
[1:17:32]
>> Mayor: second, vice mayor
[1:17:32]
viscarra.
[1:17:33]
Rop call --
[1:17:33]
>> voice vote.
[1:17:34]
>> Mayor: all in favor.
[1:17:36]
[Ayes]
[1:17:36]
>> no.
[1:17:37]
I vote no.
[1:17:40]
>> Mayor: okay.
[1:17:40]
4-1.
[1:17:41]
>> 4-1.
[1:17:43]
>> thank you very much, mayor
[1:17:43]
and commissioners.
[1:17:45]
Look forward to the opening of
[1:17:46]
this project, which will be
[1:17:46]
facilitated by your vote
[1:17:48]
tonight.
[1:17:48]
Thank you.
[1:17:48]
>> good luck.
[1:17:58]
Thank you.
[1:18:00]
>> Mayor: okay.
[1:18:02]
Item 7-a.
[1:18:03]
>> 7-a is an ordinance of the
[1:18:05]
city commission of the city of
[1:18:09]
sunny isles beach, florida,
[1:18:13]
amending ordinance no. 2022-595,
[1:18:14]
approving budget amendment
[1:18:17]
number ba 2223-01 to the city's
[1:18:18]
operating and capital
[1:18:20]
improvement budget for the
[1:18:21]
2022-2023 fiscal year general
[1:18:23]
fund, street maintenance, and
[1:18:24]
construction fund, building
[1:18:26]
fund, capital projects, fund,
[1:18:28]
stormwater operations fund,
[1:18:29]
authorizing the city manager to
[1:18:30]
do all things necessary to
[1:18:32]
implement the terms and
[1:18:33]
conditions of this ordinance,
[1:18:34]
providing for an effective date.
[1:18:36]
And this is first reading.
[1:18:40]
>> honorable mayor, vice mayor
[1:18:42]
and commission, this budget
[1:18:42]
amendment is necessary for the
[1:18:48]
following reasons.
[1:18:49]
To record cost of living
[1:18:52]
adjustments in all the city
[1:18:54]
departments, to modify the risk
[1:18:57]
management budget for the
[1:18:59]
increase in mid 22-23 insurance
[1:19:00]
renewal that was approved.
[1:19:02]
However when we did the budget,
[1:19:02]
we did not have those final
[1:19:04]
numbers.
[1:19:07]
And then the last one is to
[1:19:08]
appropriate additional funds for
[1:19:08]
the golden shores utility
[1:19:18]
undergrounding.
[1:19:19]
>> Mayor: no public speakers.
[1:19:19]
Questions?
[1:19:27]
Or comments?
[1:19:29]
>> -- comfortable when different
[1:19:30]
items together.
[1:19:31]
Some of it has to do with the
[1:19:34]
cost of living, and insurance,
[1:19:37]
and with the golden shores.
[1:19:39]
I would rather have each one and
[1:19:41]
vote each one separately.
[1:19:41]
So that's my suggestion for
[1:19:44]
going forward.
[1:19:45]
>> okay.
[1:19:47]
Generally, budget amendments,
[1:19:50]
when they're determined to be
[1:19:51]
needed, it's for what's
[1:19:52]
determined to be needed at that
[1:19:52]
time.
[1:19:56]
But I understand.
[1:19:58]
>> could you please give us
[1:19:59]
the -- the amount of money for
[1:20:00]
each of the three you just
[1:20:00]
mentioned?
[1:20:04]
>> sure.
[1:20:06]
So the first one in all the city
[1:20:09]
departments that amounts to
[1:20:10]
$520,000.
[1:20:11]
>> that's the C.O.L.A.
[1:20:15]
>> that's the C.O.L.A.
[1:20:15]
The risk management is, hold on
[1:20:24]
one second.
[1:20:28]
That is approximately $260,000.
[1:20:29]
And then the last one is
[1:20:32]
$589,000.
[1:20:33]
>> that's the golden shores.
[1:20:36]
>> that's the golden shores.
[1:20:42]
589.
[1:20:57]
[Speaker off mic]
[1:20:59]
>> the insurance is related to
[1:21:00]
the property insurance renewal.
[1:21:09]
>> okay.
[1:21:21]
[Speaker off mic]
[1:21:23]
>> Mayor: comments, questions?
[1:21:24]
That being said, do we have a
[1:21:27]
motion?
[1:21:28]
>> motion.
[1:21:31]
>> Mayor: so moved.
[1:21:32]
>> second.
[1:21:32]
>> Mayor: second vice mayor
[1:21:33]
viscarra.
[1:21:33]
all in favor.
[1:21:38]
[Ayes]
[1:21:38]
Voice vote?
[1:21:39]
>> roll call, mayor.
[1:21:41]
Sorry.
[1:21:41]
Commissioner joseph?
[1:21:43]
>> yes.
[1:21:43]
>> commissioner lama?
[1:21:43]
>> yes.
[1:21:45]
>> commissioner stuyvesant?
[1:21:47]
>> no.
[1:21:47]
>> vice mayor viscarra?
[1:21:48]
>> yes.
[1:21:49]
>> mayor goldman?
[1:21:50]
>> Mayor: yes.
[1:21:53]
>> the ordinance passes on first
[1:21:54]
reading 4-1.
[1:21:56]
Second reading will be scheduled
[1:21:57]
for JANUARY 19th, 2023.
[1:22:01]
>> thank you.
[1:22:05]
>> Mayor: thank you.
[1:22:07]
Item 10-a.
[1:22:09]
>> 10-a is a resolution
[1:22:10]
approving a first amendment to
[1:22:12]
the project agreement with keith
[1:22:14]
and associates, for civil
[1:22:14]
engineering and landscape
[1:22:15]
architectural services for bella
[1:22:18]
vista park.
[1:22:21]
>> good evening, mayor,
[1:22:23]
commissioners, city staff.
[1:22:29]
This item before you is with our
[1:22:30]
consult and engineer keith and
[1:22:32]
associates at bella vista park.
[1:22:34]
As part of the original proposal
[1:22:36]
we had a design fee for a
[1:22:37]
seawall.
[1:22:38]
Their consultant, their
[1:22:40]
subconsultant for that work had
[1:22:41]
backed out of it because they
[1:22:43]
basically gave them the wrong
[1:22:46]
number.
[1:22:50]
So this budget, or this item
[1:22:52]
allows them to subcontract with
[1:22:53]
another seawall consultant for
[1:22:54]
the seawall design.
[1:22:57]
And it also includes all the
[1:22:58]
construction administration
[1:22:58]
we're going to need on the
[1:22:59]
project, which was not in the
[1:23:07]
original proposals.
[1:23:07]
>> Mayor: we have a public
[1:23:19]
speaker.
[1:23:22]
>> ari steiger 462 atlantic
[1:23:23]
island.
[1:23:25]
Is this going to be a pickleball
[1:23:29]
court?
[1:23:33]
What is it going to be?
[1:23:35]
I have -- to do civil
[1:23:36]
engineering on a small plot like
[1:23:39]
this for $250,000.
[1:23:42]
It's I think way, way overpriced
[1:23:42]
for this --
[1:23:44]
>> ari, I think you are
[1:23:46]
referring to 10-b.
[1:23:49]
This is 10-b bella vista.
[1:23:53]
>> so 10-a is $95,400.
[1:23:58]
That's for what?
[1:24:01]
What is $95,400?
[1:24:06]
>> the project is a marina, and
[1:24:12]
park, at bella vista which is
[1:24:13]
located at 500, the city park
[1:24:15]
property.
[1:24:17]
On the waterfront.
[1:24:21]
Under the bridge.
[1:24:26]
That's what bella vista is.
[1:24:27]
That's for seawall consultant
[1:24:27]
designer and permitting and
[1:24:31]
construction.
[1:24:32]
>> it's way, way --
[1:24:33]
>> it's also for the
[1:24:33]
construction administration for
[1:24:38]
the project.
[1:24:39]
So it's in basically three
[1:24:40]
pieces.
[1:24:43]
The design is about $35,000.
[1:24:45]
The construction admin is about
[1:24:48]
$35,000 for the seawall project.
[1:24:49]
And it's another 30 for the
[1:24:50]
engineer to do his contruction
[1:24:53]
administration for the property,
[1:24:53]
also.
[1:24:55]
>> I'm building a seawall right
[1:24:55]
now.
[1:25:03]
One in boca, and one in fort
[1:25:03]
lauderdale.
[1:25:04]
It's 125 length.
[1:25:05]
And I'm paying $110,000 for
[1:25:10]
everything.
[1:25:12]
We should get a contractor for
[1:25:14]
the seawall, he should design
[1:25:17]
it, including in the price.
[1:25:17]
That's
[1:25:25]
[Speaker off mic]
[1:25:27]
>> well that's a different way
[1:25:28]
to address the project.
[1:25:33]
But we're not doing it that way.
[1:25:34]
>> ari --
[1:25:35]
>> our project is $30,000 for
[1:25:36]
the design.
[1:25:39]
>> ari, $125,000 includes the --
[1:25:40]
>> everything.
[1:25:42]
>> the designer that did the
[1:25:44]
derm work for you, as well?
[1:25:45]
And that was the person that did
[1:25:46]
the derm work, as well?
[1:25:53]
>> everything.
[1:25:56]
And you have my seawall,
[1:26:05]
[Speaker off mic]
[1:26:07]
>> Mayor: thank you.
[1:26:08]
Okay.
[1:26:11]
We're just focused on item 10-a
[1:26:12]
bella vista park, correct?
[1:26:12]
>> yes.
[1:26:13]
>> Mayor: okay any other
[1:26:21]
comments?
[1:26:21]
[Inaudible]
[1:26:22]
Okay do we have a motion?
[1:26:23]
>> motion.
[1:26:24]
>> Mayor: so moved.
[1:26:25]
>> second.
[1:26:25]
>> Mayor: all in favor.
[1:26:27]
[Ayes]
[1:26:28]
Item 10-b.
[1:26:30]
>> 10-b is a resolution
[1:26:31]
approving the project agreement
[1:26:33]
with keith and associates to
[1:26:37]
provide civil engineering and
[1:26:38]
landscape architect services for
[1:26:40]
the intracoastal court sports
[1:26:40]
complex.
[1:26:45]
>> so this is the property on
[1:26:47]
150 8th street going north to
[1:26:51]
159th street where we're adding
[1:26:53]
the additional property from --
[1:26:53]
that's available from the marina
[1:26:56]
one developer to the north of
[1:26:58]
what used to be the ritz sales
[1:26:59]
trailer.
[1:27:04]
So this is a combined total
[1:27:05]
contract for this to basically
[1:27:09]
double the size of the project.
[1:27:10]
>> Mayor: that's a good thing.
[1:27:13]
>> so this will allow us to get
[1:27:14]
back to some conceptuals on what
[1:27:20]
we can do with the whole piece.
[1:27:21]
>> Mayor: okay.
[1:27:23]
We have no other speakers other
[1:27:24]
than ari who has already spoken
[1:27:24]
his piece.
[1:27:28]
You want to speak on that, too?
[1:27:29]
[Speaker off mic]
[1:27:31]
>> ari, can you come up to the
[1:27:32]
microphone, please?
[1:27:34]
>> Mayor: don't we have our
[1:27:35]
own --
[1:27:36]
>> isn't keith --
[1:27:38]
>> to do I don't know what,
[1:27:39]
landscaping architect, design of
[1:27:41]
the property.
[1:27:41]
That's no construction or
[1:27:45]
anything.
[1:27:45]
>> no.
[1:27:50]
This is for the design -- the
[1:27:52]
feasibility and design work to
[1:27:52]
develop the plans to go out to
[1:27:55]
bid to build a park.
[1:27:56]
[Speaker off mic]
[1:27:58]
Overall this is going to be
[1:28:00]
about an acre and a half.
[1:28:03]
>> again should bid it out and
[1:28:06]
not depend on one architect.
[1:28:07]
>> we don't bid out
[1:28:08]
architectural engineering
[1:28:08]
services.
[1:28:09]
>> you should.
[1:28:12]
You'll save a lot of money.
[1:28:13]
>> that's not allowed for city
[1:28:13]
work.
[1:28:15]
>> Mayor: ari we have an
[1:28:15]
approved vendor.
[1:28:18]
We have an approved list.
[1:28:19]
>> we hire --
[1:28:20]
>> Mayor: it's not on that type
[1:28:21]
of bidding process.
[1:28:23]
>> we hire consultants and
[1:28:24]
evaluate them and --
[1:28:26]
>> a waste of money.
[1:28:27]
>> obtain a proposal.
[1:28:29]
>> and that's a maximum, right?
[1:28:31]
it doesn't mean that it's going
[1:28:32]
to be that amount.
[1:28:33]
It can be less than that.
[1:28:37]
It's a maximum of $161,000.
[1:28:44]
>> correct.
[1:28:45]
>> Mayor: okay.
[1:28:47]
We have no other -- everyone, do
[1:28:48]
we have any other comments from
[1:28:50]
the dais, our colleagues?
[1:28:51]
Any other comments?
[1:28:52]
Do I have a motion?
[1:28:53]
>> motion.
[1:28:54]
>> Mayor: so moved.
[1:28:57]
Commissioner stuyvesant.
[1:28:58]
Second?
[1:28:58]
Do I have a second?
[1:28:58]
>> second.
[1:29:00]
>> Mayor: second, commissioner
[1:29:00]
lama.
[1:29:01]
All in favor.
[1:29:08]
[Ayes]
[1:29:09]
>> Mayor: thank you, rick.
[1:29:10]
Item 10-c.
[1:29:12]
>> 10-c is a resolution
[1:29:13]
rejecting all proposals received
[1:29:16]
for request for proposal number
[1:29:17]
22-09-01 for restaurant lease
[1:29:19]
and operations at 18050 collins
[1:29:29]
avenue.
[1:29:31]
>> good evening, honorable
[1:29:35]
mayor, and vice mayor, and
[1:29:36]
commissioners.
[1:29:39]
Tonight I will detail the
[1:29:40]
procurement process for the
[1:29:41]
subject rfp, in addition I will
[1:29:42]
be providing the city manager's
[1:29:47]
recommendation.
[1:29:50]
On SEPTEMBER 9th, 2022, the city
[1:29:53]
released the request for
[1:29:57]
proposals, also known as an rfp
[1:29:58]
was released on demand star.
[1:30:01]
20 vendors registered as a plan
[1:30:03]
holder to receive automatic
[1:30:04]
updates regarding this rfp.
[1:30:06]
For those of you who are not
[1:30:07]
familiar with demand star,
[1:30:10]
demand star is a recognized
[1:30:11]
procurement database platform
[1:30:12]
with thousands of registered
[1:30:13]
vendors according to their
[1:30:17]
commodity code.
[1:30:19]
In addition to demand star, the
[1:30:24]
rfp was e-mailed to over 400
[1:30:25]
restaurants, listed on the
[1:30:29]
florida restaurant and lodging
[1:30:29]
association, and the greater
[1:30:30]
miami convention and visitors
[1:30:33]
database.
[1:30:36]
The rfp was also e-mailed --
[1:30:37]
>> sorry.
[1:30:38]
>> Mayor: thank you.
[1:30:42]
[Laughter]
[1:30:44]
>> the rfp was also e-mailed to
[1:30:45]
approximately 15 interested
[1:30:47]
vendors who contacted the city,
[1:30:49]
requesting to be added to the
[1:30:53]
vendor's list.
[1:30:56]
The city held a non-mandatory
[1:30:57]
sunshine preproposal conference
[1:30:58]
and site visit to the location
[1:31:01]
on SEPTEMBER 20th, 2022.
[1:31:05]
In which seven interested
[1:31:07]
vendors attended the meeting.
[1:31:09]
The two dates for the submittals
[1:31:12]
was OCTOBER 20th, 2022, no later
[1:31:13]
than 11:00 A.M.
[1:31:16]
On OCTOBER 20th, the city
[1:31:18]
clerk's office received two
[1:31:19]
proposals by the said deadline
[1:31:23]
in response to the rfp.
[1:31:28]
The two proposals was one
[1:31:29]
pantheon gastrobarn and prime 29
[1:31:29]
inc.
[1:31:31]
The evaluation committee
[1:31:33]
appointed by the city manager
[1:31:37]
was composed of three city
[1:31:38]
employees, which was the
[1:31:40]
assistant city manager, the
[1:31:42]
planning and zoning director,
[1:31:45]
and our senior accountant.
[1:31:47]
The evaluation committee met to
[1:31:50]
review and rank the two
[1:31:52]
proposals on NOVEMBER 3rd, 2022
[1:31:53]
on the fourth floor conference
[1:31:54]
room.
[1:31:56]
The meeting was posted on the
[1:31:56]
city's website as a sunshine
[1:32:00]
public meeting.
[1:32:02]
Based off the criteria on page
[1:32:04]
31 of the rfp solicitation, the
[1:32:07]
committee evaluated and ranked
[1:32:08]
pantheon gastrobar as the
[1:32:11]
highest ranked firm.
[1:32:12]
After consideration and
[1:32:13]
reviewing the committee's
[1:32:15]
recommendation the city manager
[1:32:16]
finds that it is in the best
[1:32:19]
interest of the city to reject
[1:32:20]
all proposals.
[1:32:21]
Therefore, if you have any
[1:32:22]
questions regarding the
[1:32:23]
procurement process, I'll be
[1:32:25]
more than happy to address them.
[1:32:26]
But if not, I will turn it over
[1:32:27]
to the city manager, if he
[1:32:29]
wishes to expand on his
[1:32:35]
recommendation.
[1:32:36]
>> mayor, vice mayor, members of
[1:32:37]
the commission.
[1:32:37]
I felt that as if, with the
[1:32:41]
number of bids that we had, we
[1:32:44]
only had two viable bids, and I
[1:32:47]
didn't think it in the best
[1:32:48]
interest of the city to put us
[1:32:49]
into a contract for ten years
[1:32:53]
based on only two viable bids.
[1:32:55]
So with that we would ask your
[1:32:58]
guidance in rejecting the bids,
[1:32:59]
and placing the property again
[1:33:00]
out to bid, if that's your
[1:33:01]
desire.
[1:33:08]
Thank you.
[1:33:08]
>> Mayor: we have two public
[1:33:26]
speakers.
[1:33:27]
>> hi.
[1:33:29]
[Inaudible] Cols avenue.
[1:33:31]
We own family business, it's a
[1:33:32]
kosher restaurant.
[1:33:34]
We are rated the number one
[1:33:37]
restaurant in new york city as
[1:33:38]
of now.
[1:33:40]
Located, we have kosher
[1:33:41]
clientele and nonkosher
[1:33:42]
clientele, as well.
[1:33:46]
And I would like the opportunity
[1:33:49]
to proceed across the street.
[1:33:58]
And [Indiscernible].
[1:33:59]
I think sunny isles is an
[1:34:01]
upscale nice for kosher
[1:34:02]
restaurant, and it could be
[1:34:05]
kosher and nonkosher for other
[1:34:07]
clients, as well.
[1:34:07]
>> just to clarify.
[1:34:09]
You're not one of the two
[1:34:09]
vendors?
[1:34:10]
>> no.
[1:34:10]
Yes.
[1:34:13]
>> okay.
[1:34:13]
Just wanted to clarify.
[1:34:14]
Thank you.
[1:34:16]
>> Mayor: so if and when it
[1:34:19]
shows up for rebid you're
[1:34:19]
certainly welcome to participate
[1:34:22]
so that we can have a wider
[1:34:22]
sampling.
[1:34:23]
>> 100%.
[1:34:25]
>> Mayor: -- viable vendors
[1:34:26]
rather than just the two that
[1:34:26]
submitted.
[1:34:31]
>> 100% I would like that.
[1:34:33]
-- spoke to before and I
[1:34:34]
explainedwhat kind of clientele
[1:34:36]
we actually host, commissioners,
[1:34:37]
mayors, the PRESIDENT, and on
[1:34:38]
and on and on.
[1:34:39]
>> Mayor: thank you very much.
[1:34:43]
>> thank you.
[1:34:53]
>> Mayor: alejandra amada.
[1:34:59]
>> hi, good evening.
[1:35:02]
Thank you to all the commission
[1:35:05]
and mayor to introduce myself.
[1:35:09]
My name is alejandro, I'm a real
[1:35:12]
estate advisor for b&e
[1:35:14]
entertainment restaurant group,
[1:35:17]
and I come here to recommend
[1:35:24]
adopt the resolution 22-09-01.
[1:35:28]
To our group to introduce
[1:35:31]
ourselves as well, and for the
[1:35:36]
space for 18050 collins avenue.
[1:35:38]
I see that my client has
[1:35:41]
experience for over 20 years, or
[1:35:43]
25 years in miami beach, in the
[1:35:44]
beach miami location.
[1:35:49]
It's the greatest beach, and
[1:35:49]
going to be a great project for
[1:35:53]
sunny isles beach.
[1:35:53]
>> Mayor: thank you.
[1:35:56]
>> did you bid before?
[1:35:59]
>> no.
[1:36:00]
>> okay.
[1:36:02]
>> and we would like to want to
[1:36:05]
adopt the resolution in order to
[1:36:06]
have the procurement in this
[1:36:07]
case.
[1:36:08]
>> okay.
[1:36:12]
>> Mayor: thank you.
[1:36:13]
>> thank you.
[1:36:16]
>> Mayor: I have another from
[1:36:20]
your group, I guess elva.
[1:36:24]
>> good evening, MADAM Mayor,
[1:36:24]
commissioners.
[1:36:26]
I'm the director of
[1:36:28]
communications for the
[1:36:30]
restaurant group as well as my
[1:36:32]
colleague alejandro for like for
[1:36:34]
you to support the resolution,
[1:36:35]
the adoption of the resolution
[1:36:39]
for the rejection, provided that
[1:36:42]
that happens, our group, 25
[1:36:44]
years in miami beach, received
[1:36:45]
the key of the city of miami
[1:36:47]
beach and soon to reopen the
[1:36:51]
news cafe, our group would like
[1:36:51]
to, I mean we'll definitely --
[1:36:57]
we were not aware of the bid.
[1:36:58]
And but definitely provided you
[1:37:00]
adopt this resolution, we will
[1:37:00]
definitely provide ours.
[1:37:02]
Thank you.
[1:37:03]
>> Mayor: thank you so much.
[1:37:03]
Thank you.
[1:37:06]
Okay.
[1:37:08]
Do we have any other comments,
[1:37:09]
or are we going to take a
[1:37:13]
motion?
[1:37:17]
>> can -- if we decide not to go
[1:37:20]
with the pantheon gastrobar can
[1:37:21]
we get maybe direction to start
[1:37:26]
the bidding process immediately.
[1:37:29]
Now how long -- how does that
[1:37:29]
work?
[1:37:30]
If we get approved?
[1:37:34]
>> mayor, as part of the
[1:37:37]
discussion we'd like some
[1:37:38]
direction on whether we should
[1:37:38]
continue with the current lease
[1:37:42]
that we have of the space right
[1:37:43]
now.
[1:37:43]
>>.
[1:37:44]
>> Mayor: I mean in my
[1:37:45]
understanding part of the
[1:37:47]
impediment or difficulty in this
[1:37:48]
process was because there's
[1:37:50]
construction going on with the
[1:37:50]
garage.
[1:37:50]
Right?
[1:37:55]
And it makes it difficult to
[1:37:56]
really, you know, cars,
[1:37:58]
construction, and, you know,
[1:37:58]
interference.
[1:38:01]
I think that was part of it, to
[1:38:03]
allow to get that -- get that
[1:38:04]
building finally constructed
[1:38:05]
before we --
[1:38:06]
>> that's correct.
[1:38:09]
There's some pre-existing
[1:38:11]
approvals that will take up the
[1:38:13]
west side of the property.
[1:38:14]
Which would encumber the
[1:38:15]
property from the perspective of
[1:38:17]
having a dumpster and things
[1:38:17]
like that.
[1:38:20]
So we currently have an option
[1:38:22]
with our existing tenant to
[1:38:24]
extend the lease for six months
[1:38:27]
up to a year at a rate of
[1:38:30]
$20,000 a month.
[1:38:31]
>> Mayor: which would, you know,
[1:38:32]
more than cover.
[1:38:34]
I think the issue really is
[1:38:35]
while that construction's going
[1:38:36]
on it's difficult for any
[1:38:39]
restaurant to really come in,
[1:38:39]
and, you know, effectively open
[1:38:40]
up.
[1:38:43]
I mean, that's part of it.
[1:38:43]
Is, you know --
[1:38:46]
>> but the fact that we have two
[1:38:48]
residents here that are
[1:38:50]
interested, they know the
[1:38:51]
conditions, as well.
[1:38:53]
And even with the process, it
[1:38:54]
takes time, right?
[1:38:58]
Like you have to announce it,
[1:39:00]
and prepare, et cetera.
[1:39:02]
So, what would be the time frame
[1:39:06]
to start all over again that
[1:39:06]
process?
[1:39:08]
>> to release the solicitation
[1:39:09]
process, at least to advertise
[1:39:10]
and release a minimum of 30
[1:39:10]
days.
[1:39:11]
And that's minimum.
[1:39:15]
>> correct.
[1:39:16]
>> Mayor: when is that garage
[1:39:17]
going to be open?
[1:39:18]
Are we talking six months from
[1:39:18]
now?
[1:39:21]
Or eight months?
[1:39:21]
How long --
[1:39:22]
>> the estimate is a year.
[1:39:24]
So by DECEMBER of next year.
[1:39:27]
If not sooner.
[1:39:30]
>> MR. City manager, when tony
[1:39:32]
roma's was easing the property,
[1:39:32]
what was their rent, do you
[1:39:38]
recall?
[1:39:39]
>> I think it was 20,000 plus a
[1:39:42]
percentage.
[1:39:46]
>> so it's not -- it's not a
[1:39:47]
revenue, it's really more
[1:39:49]
because of the staging and the
[1:39:49]
construction of the garage --
[1:39:50]
>> the city would be at a
[1:39:55]
deficit to -- if we leased it
[1:39:56]
under those conditions, we
[1:39:58]
wouldn't get -- be able to get
[1:40:01]
the maximum amount.
[1:40:02]
>> the other part is that the
[1:40:04]
city would have to pay the
[1:40:06]
taxes, and we're in negotiations
[1:40:07]
with the current tenant that
[1:40:10]
would require them to pay the
[1:40:11]
taxes, depending upon the length
[1:40:17]
of their next lease with us.
[1:40:18]
>> but right now they're --
[1:40:19]
>> correct.
[1:40:20]
They're scheduled to vacate at
[1:40:21]
the end of the month.
[1:40:22]
>> and they're interested in
[1:40:24]
staying for another year?
[1:40:26]
>> yes, they are.
[1:40:27]
In conjunction with the
[1:40:27]
construction.
[1:40:29]
>> I mean, again, that's
[1:40:32]
probably why we didn't get a lot
[1:40:33]
of bids.
[1:40:33]
Right?
[1:40:36]
Because no -- it's unrealistic
[1:40:37]
to think that a restaurant, even
[1:40:40]
if they got in right away, you
[1:40:44]
know, whether they could get in,
[1:40:48]
and get in the construction and
[1:40:49]
interference in that area.
[1:40:52]
>> -- out of the city, as well.
[1:40:53]
>> construction inside and to
[1:40:55]
get ready.
[1:40:56]
>> so really doesn't make sense
[1:40:59]
for us to resubmit it at this
[1:41:00]
point except to the current
[1:41:01]
persons --
[1:41:03]
>> Mayor: that's my thought.
[1:41:04]
>> stay with this situation
[1:41:05]
until --
[1:41:06]
>> Mayor: it's a --
[1:41:07]
>> -- garage construction is
[1:41:08]
complete.
[1:41:09]
>> Mayor: it's a disservice to
[1:41:10]
go immediately into a, you know,
[1:41:11]
a bidding process for that
[1:41:14]
space, given the construction
[1:41:16]
and the impediment that's
[1:41:16]
occurring.
[1:41:19]
>> but remember that the
[1:41:20]
leasing, the bidding process
[1:41:22]
would take like three months.
[1:41:26]
And once we decide who's going
[1:41:27]
to be there they need like four
[1:41:29]
to six months also to get ready
[1:41:33]
for construction themselves.
[1:41:35]
>> yeah, but --
[1:41:37]
>> yeah but it's going to happen
[1:41:37]
regardless.
[1:41:38]
Earlier or later.
[1:41:41]
So they're going to need the
[1:41:42]
time to build.
[1:41:43]
So do we have one construction
[1:41:44]
going on or have two
[1:41:45]
construction.
[1:41:46]
So maybe they can finish at the
[1:41:49]
same time.
[1:41:50]
And at the time that the
[1:41:51]
apartment is ready then the
[1:41:52]
restaurant can be opened.
[1:41:52]
>> right.
[1:41:56]
But in any event this is not the
[1:41:56]
moment to take bids.
[1:41:57]
Because the garage is not that
[1:42:00]
far along.
[1:42:05]
>> Mayor: for me, I think we
[1:42:06]
should, you know, reach out for
[1:42:06]
another six months.
[1:42:10]
We can start the bidding process
[1:42:13]
in six months maybe --
[1:42:14]
>> but why do it --
[1:42:15]
>> the tenant, because they
[1:42:18]
would be responsible for paying
[1:42:21]
the taxes, has requested a
[1:42:22]
minimum of a six month
[1:42:22]
extension.
[1:42:23]
The taxes are approximately
[1:42:25]
$60,000 on the space.
[1:42:28]
So if the tenant vacates then we
[1:42:29]
will be responsible for paying
[1:42:33]
the taxes for this next year.
[1:42:34]
>> but they have no other
[1:42:35]
opportunity to put their offices
[1:42:36]
anywhere.
[1:42:37]
So I think they need us more
[1:42:38]
than we need them.
[1:42:44]
>> Mayor: for me I think we
[1:42:48]
should, you know, I think we
[1:42:52]
should [Inaudible]
[1:42:54]
>> yeah, I would think five
[1:42:55]
months we could reopen the
[1:42:58]
bidding process, and be at a
[1:43:01]
good -- at a good, you know,
[1:43:02]
look-see situation.
[1:43:03]
>> how long does the bidding
[1:43:06]
process take?
[1:43:09]
What you just walked us through,
[1:43:10]
how long did that take?
[1:43:11]
>> I'll give you the schedule on
[1:43:12]
the existing rfp.
[1:43:13]
So the release was SEPTEMBER
[1:43:14]
9th.
[1:43:17]
The release that we released it
[1:43:17]
on demand star to the public.
[1:43:19]
>> so three months.
[1:43:25]
Okay.
[1:43:26]
>> okay I have my thoughts, too.
[1:43:29]
So I think we should desist from
[1:43:30]
making tony roma's or the old
[1:43:32]
tony roma's a restaurant.
[1:43:33]
I think we should use it for
[1:43:34]
office space.
[1:43:35]
We're super crowded on the third
[1:43:35]
floor.
[1:43:38]
And if you look at it from a
[1:43:39]
productivity standpoint, I think
[1:43:42]
that if we move some people
[1:43:44]
there, that that will work
[1:43:44]
better.
[1:43:44]
Okay?
[1:43:46]
We're not in the business of
[1:43:47]
being landlords.
[1:43:47]
Okay?
[1:43:49]
We've had bad experiences with
[1:43:49]
tony roma's.
[1:43:50]
Okay.
[1:43:51]
We only got small percentage on
[1:43:53]
the dollar.
[1:43:55]
For that rent that they owed us.
[1:43:59]
And then look at turnberry sales
[1:43:59]
office.
[1:43:59]
With this administration --
[1:44:01]
>> -- the city's --
[1:44:03]
>> I'm not saying it's the
[1:44:03]
city's fault.
[1:44:05]
But, but we should stay focused
[1:44:06]
on what our mission is.
[1:44:07]
And what our business is.
[1:44:09]
And I think we should move -- we
[1:44:10]
should use that.
[1:44:11]
It's a great space.
[1:44:13]
We should use it as office
[1:44:13]
space.
[1:44:16]
And forget about having a
[1:44:16]
restaurant there.
[1:44:19]
I mean, there's restaurants
[1:44:19]
here.
[1:44:20]
And that's not our business.
[1:44:24]
I mean, if we tie ourselves up
[1:44:26]
for a ten-year lease, I mean
[1:44:27]
right now we're having issues
[1:44:29]
with space.
[1:44:31]
I mean, I don't see why we have
[1:44:35]
to make it a restaurant there.
[1:44:37]
>> Mayor: alex recognizing your
[1:44:46]
comments [Inaudible].
[1:44:47]
>> that's not even the issue.
[1:44:50]
>> it is.
[1:44:53]
>> it's actually both.
[1:44:56]
Because, they would have to
[1:44:57]
leave these premises on or
[1:45:00]
before DECEMBER 31st.
[1:45:03]
So if you want an extension --
[1:45:04]
>> I thought --
[1:45:08]
>> but they need six more months
[1:45:09]
in order to agree to pay the
[1:45:16]
taxes for the coming year.
[1:45:16]
[Inaudible]
[1:45:18]
They're asking for a six-month
[1:45:20]
minimum extension.
[1:45:24]
So if you want to approve this
[1:45:26]
item, and then understand or
[1:45:28]
give the manager the authority
[1:45:29]
to go ahead and negotiate so
[1:45:31]
that it starts on JANUARY the
[1:45:33]
1st, and come back to you in
[1:45:39]
JANUARY to ratify that lease.
[1:45:41]
>> listen, nothing's going to
[1:45:43]
happen before six months and
[1:45:45]
then we get 20k per month
[1:45:46]
correct if not more if they're
[1:45:48]
going to move more people in
[1:45:48]
there.
[1:45:50]
And then they pay our taxes.
[1:45:52]
Why not?
[1:45:53]
And then we decide whether we
[1:45:55]
make it a restaurant or not.
[1:45:57]
My idea is no we make it office
[1:45:58]
space eventually.
[1:46:01]
I mean, why tie ourselves up for
[1:46:03]
ten years with a restaurant
[1:46:03]
contract.
[1:46:04]
So, but anyhow.
[1:46:06]
But for now, short-term, yeah,
[1:46:09]
six month contract, and they pay
[1:46:10]
our taxes.
[1:46:12]
>> six months I feel it's a no
[1:46:12]
brainer.
[1:46:13]
>> what ma'am?
[1:46:28]
[Inaudible]
[1:46:29]
>> Mayor: we can pass a motion
[1:46:35]
to, you know, run out to bid,
[1:46:37]
and then also give the manager
[1:46:39]
direction to enter into a six
[1:46:40]
month lease.
[1:46:42]
>> before we do, I do want to
[1:46:47]
note I think we have to look --
[1:46:50]
and I think right now it's a low
[1:46:52]
risk, it makes sense, I get it.
[1:46:55]
But I do feel that for the
[1:46:56]
businesses to comply, and met
[1:46:57]
the deadlines that jumped
[1:47:00]
through the hoops, and I'm
[1:47:01]
sorry -- I'm sorry if it feels
[1:47:03]
like it's wasted time and
[1:47:04]
effort.
[1:47:06]
So I apologize for that.
[1:47:09]
But this is where we're at.
[1:47:13]
I mean, I -- I think it's -- I
[1:47:15]
think it -- I think it's what
[1:47:17]
makes sense to do.
[1:47:21]
But I'm sorry about the wasted
[1:47:22]
time and resources.
[1:47:26]
For the -- for the bidders.
[1:47:28]
>> I don't actually --
[1:47:30]
>> I'm sock with it.
[1:47:31]
>> because four months we're
[1:47:32]
going to open it up to bidding.
[1:47:35]
>> right, I know.
[1:47:37]
>> -- we haven't said that yet.
[1:47:38]
>> we have to do that.
[1:47:40]
>> Mayor: and we receive the
[1:47:52]
income sometime.
[1:47:53]
>> the whole point in the first
[1:47:55]
place --
[1:47:57]
>> it was to provide --
[1:47:58]
>> I like the idea of keeping
[1:48:02]
the property income producing.
[1:48:04]
We don't have other in taxes
[1:48:07]
other, you know, we have very
[1:48:08]
limited sources of -- the city
[1:48:09]
of revenue.
[1:48:11]
So I like the idea of having a
[1:48:13]
tenant, and right now we do.
[1:48:15]
And that meets our primary
[1:48:18]
purpose, if we brought in a
[1:48:19]
restaurant tomorrow, we would
[1:48:21]
not be receiving that rent right
[1:48:22]
away.
[1:48:22]
Right?
[1:48:22]
Because it would be that period
[1:48:25]
where they're building out or
[1:48:28]
whatever.
[1:48:31]
So we don't lose apparently.
[1:48:33]
We keep what we have.
[1:48:35]
We even get somebody to pay our
[1:48:35]
taxes.
[1:48:36]
To me that makes sense and I'm
[1:48:39]
okay with it.
[1:48:40]
And I would move to, you know,
[1:48:45]
go ahead and reject it, and --
[1:48:48]
>> what's the other part, what
[1:48:49]
do you need?
[1:48:49]
>> I would like to go into a
[1:48:55]
rebid in three months.
[1:48:56]
>> three months.
[1:48:57]
Four months.
[1:48:59]
>> Mayor: if we enter into a six
[1:49:00]
month lease I don't know if we
[1:49:02]
can rebid in three months.
[1:49:05]
Do we need to get into that --
[1:49:09]
>> we are bidding right now and
[1:49:09]
it's leased.
[1:49:13]
>> we could -- we could bid in
[1:49:15]
three months' time but then we
[1:49:17]
would not bring it back to you
[1:49:20]
until the termination of the
[1:49:21]
lease.
[1:49:21]
>> which would be six months.
[1:49:22]
>> which would be six months
[1:49:28]
minimum.
[1:49:30]
>> so --
[1:49:31]
>> Mayor: the garage or
[1:49:33]
whatever, I mean, I just don't
[1:49:35]
want to put people, make people
[1:49:37]
jump through hoops twice.
[1:49:39]
>> yeah, but we can't have this
[1:49:40]
tied --
[1:49:41]
>> but I don't think we can put
[1:49:44]
the three months on it.
[1:49:45]
I think we can do the three
[1:49:47]
month piece when we know what's
[1:49:48]
going on.
[1:49:48]
>> I agree --
[1:49:50]
>> I think as we watch the
[1:49:51]
garage develop, and we'll have a
[1:49:53]
better idea of whether we can
[1:49:54]
actually put it out for bid.
[1:49:56]
>> and it MAY be three months.
[1:49:57]
>> it could be delays, as well,
[1:49:59]
on the garage.
[1:49:59]
>> and then, you know --
[1:50:02]
>> you never know with
[1:50:04]
construction.
[1:50:06]
>> Mayor: -- that was the whole
[1:50:10]
purpose or the rationale for
[1:50:11]
this, you know, leasing out the
[1:50:17]
tony roma space.
[1:50:19]
If we're -- that as well.
[1:50:22]
But again the construction of
[1:50:25]
the garage, which really intends
[1:50:25]
to run into a restaurant
[1:50:32]
operation.
[1:50:33]
>> that's my motion.
[1:50:33]
>> Mayor: so moved.
[1:50:37]
>> to reject, and to proceed
[1:50:37]
with the six month lease with
[1:50:38]
the current tenant.
[1:50:43]
So long as they pay our taxes.
[1:50:44]
>> Mayor: okay.
[1:50:45]
Do I have a second?
[1:50:45]
>> second.
[1:50:45]
>> Mayor: second.
[1:50:47]
All in favor.
[1:50:48]
>> hold on.
[1:50:49]
I have a question.
[1:50:52]
Will this include -- go out to
[1:50:53]
rebid?
[1:50:55]
>> no.
[1:50:58]
>> put an rfp again?
[1:50:58]
So we're just voting on
[1:50:59]
rejecting the current proposal.
[1:51:07]
Correct?
[1:51:08]
We're talking about extending
[1:51:09]
the lease to the current ten
[1:51:10]
and.
[1:51:10]
For six months.
[1:51:11]
And then obviously they will pay
[1:51:18]
the taxes.
[1:51:19]
>> and nothing stops --
[1:51:22]
>> but I don't want to vote
[1:51:23]
on -- I don't think that should
[1:51:23]
be a restaurant.
[1:51:25]
I think that should be office
[1:51:26]
space.
[1:51:26]
Yeah, all right.
[1:51:30]
No I just want to make sure.
[1:51:31]
I'll second if that's the case.
[1:51:31]
>> Mayor: second.
[1:51:33]
All in favor.
[1:51:35]
[Ayes]
[1:51:35]
>> no.
[1:51:35]
I vote no.
[1:51:36]
>> Mayor: okay.
[1:51:36]
4-1.
[1:51:44]
Motion passes.
[1:51:45]
Item 10-e.
[1:51:47]
>> before we continue,
[1:51:48]
commissioners, just to remind
[1:51:50]
you all, please speak into the
[1:51:50]
mic.
[1:51:51]
We have the recording that is
[1:51:53]
having difficulty picking up
[1:51:54]
your voices, and also members of
[1:51:54]
the audience in the back.
[1:51:57]
thank you.
[1:51:59]
10-d is a resolution ratifying
[1:52:00]
the preach and execution of the
[1:52:01]
opioid settlement participation
[1:52:06]
agreement with walmart.
[1:52:15]
>> Mayor: city manager?
[1:52:16]
>> mayor, vice mayor, members of
[1:52:18]
the commission, this is similar
[1:52:19]
to the opioid settlements that
[1:52:20]
we've done in the past and we're
[1:52:21]
starting to see a number of
[1:52:22]
these from different
[1:52:23]
organizations.
[1:52:25]
So as part of this, we're
[1:52:29]
requesting the ability to
[1:52:34]
approve these going forward.
[1:52:37]
>> Mayor: no public speakers.
[1:52:37]
Any comments?
[1:52:40]
Okay.
[1:52:42]
Do we have a motion?
[1:52:42]
>> so moved.
[1:52:42]
>> second.
[1:52:45]
>> Mayor: all in favor.
[1:52:47]
[Ayes]
[1:52:47]
Okay.
[1:52:48]
Item 10-e.
[1:52:50]
>> 10-e is a resolution
[1:52:57]
approving an in-kind donation to
[1:53:00]
iprep academy north.
[1:53:01]
>> Mayor: equal opportunity stop
[1:53:02]
the bleed kit.
[1:53:05]
Commissioner joseph?
[1:53:05]
>> yes.
[1:53:09]
Being that we have 60 students,
[1:53:13]
at iprep north, I requested that
[1:53:15]
the same accommodation be made
[1:53:17]
to iprep north regarding bleed
[1:53:17]
kits.
[1:53:22]
And it was accepted by the city
[1:53:23]
so we have 30 bleed kits going
[1:53:29]
to iprep north.
[1:53:30]
And I appreciate the approval by
[1:53:37]
the city.
[1:53:38]
>> so moved.
[1:53:39]
>> Mayor: so moved?
[1:53:39]
>> second.
[1:53:40]
>> Mayor: all until favor --
[1:53:41]
>> we have some public speakers.
[1:53:47]
>> Mayor: ari steiger.
[1:53:50]
>> ari steiger, 262 atlantic
[1:53:51]
island.
[1:53:52]
I don't think the city should be
[1:53:54]
a charity for any high schools.
[1:53:57]
My two grand daughters are
[1:54:00]
going -- why don't we donate it
[1:54:02]
to them, too?
[1:54:04]
Everybody comes and do
[1:54:04]
donations.
[1:54:06]
There's enough money to pay for
[1:54:07]
whatever they need.
[1:54:09]
Why the city has got to donate
[1:54:15]
money to them?
[1:54:17]
The two ladies from the city of
[1:54:19]
north miami came and want a
[1:54:20]
donation, I don't even remember
[1:54:20]
for what.
[1:54:22]
What is it, every time they need
[1:54:24]
a committee or whatever that
[1:54:26]
comes for a donation for the
[1:54:26]
city?
[1:54:27]
Unacceptable?
[1:54:28]
>> that was turned down.
[1:54:31]
And that was an absolute error.
[1:54:32]
>> there's more schools, dade
[1:54:34]
county has the money to pay for
[1:54:35]
it if they need it.
[1:54:38]
My nephew is the cfo for dade
[1:54:38]
county.
[1:54:39]
Want me to talk to him and
[1:54:42]
donate the money?
[1:54:43]
>> we've already given bleed
[1:54:44]
kits to --
[1:54:46]
>> there's no reason this city
[1:54:47]
should donate to any other
[1:54:49]
school but norman edelcup
[1:54:49]
school.
[1:54:50]
There's no reason for it.
[1:54:51]
It's our money.
[1:54:54]
It's our taxpayer money.
[1:54:55]
>> these are our students that
[1:54:56]
go --
[1:54:58]
>> my grand daughters are going
[1:55:00]
to a school in miami.
[1:55:03]
Why don't we donate to them too?
[1:55:06]
We can't donate to any school in
[1:55:07]
north miami beach or anyone who
[1:55:09]
comes for a donation to the
[1:55:09]
city.
[1:55:10]
It's not your money.
[1:55:10]
It's taxpayers' money.
[1:55:29]
[Applause]
[1:55:29]
This is just for ----
[1:55:31]
>> so I make a motion.
[1:55:31]
>> Mayor: thank you.
[1:55:36]
Thank you.
[1:55:37]
>> I second.
[1:55:40]
>> Mayor: ari you have a grand
[1:55:43]
daughter that went to the school
[1:55:44]
and --
[1:55:45]
>> both grand daughters.
[1:55:47]
>> Mayor: one wasn't even -- the
[1:55:47]
parent lived in aventura.
[1:55:49]
Okay?
[1:55:55]
So anyway.
[1:55:58]
>> I'd just like to comment
[1:55:58]
something.
[1:56:00]
Obviously we've sat here before,
[1:56:01]
ari, I think you were present,
[1:56:07]
and we started with norman s.
[1:56:07]
Edelcup.
[1:56:09]
Then atm is a feeder school of
[1:56:10]
ours.
[1:56:11]
So we thought about our students
[1:56:11]
there.
[1:56:15]
And we donated money, and then
[1:56:15]
obviously commissioner joseph
[1:56:16]
brought up iprep.
[1:56:18]
We do have some students there.
[1:56:20]
I understand your dilemma or
[1:56:21]
your questioning.
[1:56:24]
But, you know, the way I look at
[1:56:27]
it is safety, and we do have
[1:56:29]
students there.
[1:56:30]
We do have sunny isles beach --
[1:56:31]
[Speaker off mic]
[1:56:31]
Not all of them.
[1:56:34]
But some of them do.
[1:56:37]
A good portion of, atm about a
[1:56:37]
third.
[1:56:40]
There's plenty of kids from
[1:56:41]
sunny isles beach there.
[1:56:41]
>> Mayor: there's plenty of kids
[1:56:43]
from sunny isles beach that go
[1:56:43]
there.
[1:56:44]
>> I understand your argument.
[1:56:46]
We had that argument here.
[1:56:47]
>> Mayor: ari we do stop the
[1:56:48]
bleed kits in sunny isles beach.
[1:56:51]
And we know that 30% of the kids
[1:56:53]
probably don't even -- are from
[1:56:54]
parents that don't even live
[1:56:55]
here.
[1:56:56]
Including one of your
[1:56:56]
grandchildren went to that
[1:56:57]
school for years, and her
[1:56:58]
parents didn't even live in the
[1:56:59]
city.
[1:57:01]
So, we give -- we give the stop
[1:57:03]
the bleed kits for the benefit
[1:57:04]
of kids where the parents don't
[1:57:05]
even -- don't even reside in our
[1:57:09]
city.
[1:57:11]
>> -- want to give money to the
[1:57:12]
school --
[1:57:13]
>> we did not.
[1:57:14]
>> Mayor: we didn't give money
[1:57:15]
to any two ladies.
[1:57:19]
You're speaking out of turn.
[1:57:21]
There was two -- ari.
[1:57:23]
It's not exactly the case.
[1:57:24]
But anyway, we recognize your
[1:57:25]
comments.
[1:57:28]
And we appreciate your input.
[1:57:30]
>> that was an error and it was
[1:57:30]
rejected.
[1:57:30]
>> Mayor: okay.
[1:57:33]
And it's not factually correct.
[1:57:34]
But in any event.
[1:57:35]
Okay we have a motion, we have a
[1:57:35]
second.
[1:57:36]
All in favor.
[1:57:43]
[Ayes]
[1:57:44]
Okay.
[1:57:45]
Item 10-f.
[1:57:46]
>> 10-f is a resolution
[1:57:46]
establishing a charter revision
[1:57:51]
commission.
[1:57:53]
Mayor, commissioners, as you all
[1:57:54]
are aware, the charter calls for
[1:57:57]
a revision to be done every ten
[1:57:58]
years.
[1:58:03]
Pursuant to section 7.4 of the
[1:58:04]
charter, the commission, the
[1:58:05]
four members of the commission
[1:58:07]
with the exception of the mayor
[1:58:09]
is entitled to four appointments
[1:58:09]
with the only requirement being
[1:58:11]
that they have to live in the
[1:58:11]
district that I all represent.
[1:58:14]
Each one of you.
[1:58:16]
and the mayor has the ability to
[1:58:18]
appoint one person that can live
[1:58:18]
at-large.
[1:58:19]
Meaning they can live anywhere
[1:58:19]
in the city.
[1:58:22]
And also have the authority to
[1:58:24]
be able to appoint a nonvoting
[1:58:26]
member that's a member of the
[1:58:28]
city commission that's serving a
[1:58:30]
second consecutive term.
[1:58:31]
So this resolution seek to
[1:58:32]
establish that so that they can
[1:58:33]
commence their proceedings as
[1:58:36]
soon as possible.
[1:58:38]
>> Mayor: we have public
[1:58:38]
speakers.
[1:58:39]
Going to announce the
[1:58:41]
appointments or want to have the
[1:58:41]
speakers first?
[1:58:43]
>> I'll mention the
[1:58:44]
appointments.
[1:58:45]
For vice mayor viscarra, it's
[1:58:47]
robert thatcher.
[1:58:52]
For commissioner joseph, henry
[1:58:52]
strong.
[1:59:00]
For commissioner lama, sylvaina.
[1:59:00]
And commissioner stuyvesant is
[1:59:02]
yvette francola.
[1:59:04]
And the mayor's appointment is
[1:59:05]
jody joseph.
[1:59:06]
And the nonvoting commissioner
[1:59:06]
is vice mayor viscarra.
[1:59:08]
>> Mayor: okay.
[1:59:13]
We have public speakers?
[1:59:22]
For 10-f george.
[1:59:25]
>> good evening, MADAM Mayor,
[1:59:27]
commissioners, vice mayor.
[1:59:28]
I would like to address one
[1:59:30]
point and that is the timing.
[1:59:30]
>> sorry.
[1:59:32]
Where do you live, please?
[1:59:34]
>> I apologize.
[1:59:36]
18911 collins avenue, ocean
[1:59:36]
three.
[1:59:41]
My name is george [Inaudible].
[1:59:42]
The only point I would like to
[1:59:44]
address is the timing of all
[1:59:44]
this.
[1:59:49]
As you know, we just had an
[1:59:49]
election.
[1:59:51]
mayor goldman lost.
[1:59:54]
For her being a transitional
[1:59:55]
figure SEPTEMBER and appointing
[2:00:00]
anyone to this commission looks
[2:00:03]
suspicious, looks shady, looks
[2:00:04]
strange.
[2:00:07]
There's no reason why mayor
[2:00:10]
goldman, with all due respect to
[2:00:12]
her, should be appointing anyone
[2:00:13]
to this commission when two
[2:00:15]
weeks from now we will have
[2:00:15]
another mayor.
[2:00:18]
So my recommendation to this
[2:00:20]
council, to this commission is
[2:00:25]
to reject this proposal for two
[2:00:29]
weeks until mayor svechin
[2:00:30]
becomes acting mayor.
[2:00:35]
And the cloud of this suspicion,
[2:00:37]
forgive the repetition, is
[2:00:38]
lifted.
[2:00:43]
Thank you.
[2:00:49]
[Applause]
[2:00:52]
>> Mayor: norman edelcup and dan
[2:00:52]
lynnhighser.
[2:00:54]
>> good evening, honorable mayor
[2:00:55]
and commissioners.
[2:00:58]
My name is normal edelcup,
[2:01:00]
former mayor of this city and
[2:01:05]
resident at 244 atlantic isle.
[2:01:06]
I'm probably one of the few
[2:01:08]
people here that was present
[2:01:11]
when the original charter was
[2:01:21]
put together and dan lenhieser
[2:01:23]
was appointed and when the mayor
[2:01:24]
got sworn in or the
[2:01:27]
commissioners got sworn in
[2:01:29]
within 24 hours from an
[2:01:29]
election.
[2:01:33]
By the time 2001 came along,
[2:01:36]
there were elections and we
[2:01:38]
noticed that there probably
[2:01:40]
needed to be a change in the
[2:01:46]
charter as to the timing
[2:01:47]
primarily because of civility
[2:01:49]
and courtesy we didn't want to
[2:01:51]
be kicking people out of office
[2:01:56]
the day after an election and we
[2:01:58]
timeline for a smooth
[2:01:59]
transition.
[2:02:03]
So in 2003 when the last -- the
[2:02:06]
first charter revision took
[2:02:07]
place, there was a provision
[2:02:10]
made in the charter which is
[2:02:22]
applying today that anyone
[2:02:22]
elected would wait 30 days
[2:02:22]
before coming in, realizing that
[2:02:22]
there could be a situation where
[2:02:24]
there would be a former mayor or
[2:02:25]
former commissioner still in
[2:02:27]
office for 30 days.
[2:02:32]
But we felt the courtesy
[2:02:34]
outweighed the negativity of the
[2:02:37]
situation and that major issues
[2:02:40]
really weren't going to be done
[2:02:42]
during let's call it a lame duck
[2:02:43]
period.
[2:02:46]
And that certainly, a new mayor
[2:02:47]
would be given the opportunity
[2:02:48]
or a new commissioner would be
[2:02:50]
given an opportunity to pick
[2:02:52]
people that would be serving on
[2:02:55]
committees during their time in
[2:02:56]
office.
[2:02:58]
So basically, I have two
[2:03:00]
recommendations.
[2:03:03]
One is change today's meeting to
[2:03:04]
include that the four
[2:03:06]
commissioners can make their
[2:03:07]
appointments today because they
[2:03:09]
will be on the new commission.
[2:03:11]
But reserve the right for the
[2:03:14]
incoming mayor to pick the fifth
[2:03:18]
person at the next JANUARY
[2:03:20]
meeting, or today just pass the
[2:03:22]
resolution that you will have a
[2:03:24]
charter committee and in JANUARY
[2:03:27]
all of you can fill in the five
[2:03:28]
people that you wish to be on
[2:03:31]
the committee.
[2:03:33]
In this way, I think justice
[2:03:34]
would be served.
[2:03:42]
The idea that we are basically
[2:03:44]
providing for civility and
[2:03:45]
common sense would prevail and
[2:03:47]
we wouldn't be sitting here with
[2:03:48]
this very awkward situation.
[2:03:51]
I'd like to now call lynn to
[2:03:53]
speak because my time is running
[2:03:53]
out.
[2:03:55]
And lynn, you can finish up.
[2:04:00]
>> let me just say, norman --
[2:04:00]
>> yes.
[2:04:07]
[Applause]
[2:04:09]
When the situation came up in
[2:04:10]
the federal government with
[2:04:12]
supreme court justices, what was
[2:04:15]
the end result?
[2:04:16]
>> give me the specifics that
[2:04:19]
you are talking about.
[2:04:20]
>> when we were told that trump
[2:04:24]
should not pick the supreme
[2:04:26]
court justice and leave way for
[2:04:28]
biden, what was the end result?
[2:04:30]
>> we are a local municipality.
[2:04:31]
>> I understand.
[2:04:32]
>> and I would hope that we
[2:04:34]
would have civility in our
[2:04:34]
community.
[2:04:38]
And I think what you are
[2:04:41]
suggesting is just running
[2:04:42]
roughshod over the situation.
[2:04:44]
But, you know, all I'm doing is
[2:04:45]
recommending that this be
[2:04:47]
delayed as it relates to the
[2:04:47]
mayor.
[2:04:48]
I'm not saying it should be
[2:04:50]
delayed to anybody else.
[2:04:52]
But if each of you are
[2:04:53]
appointing somebody, that means
[2:04:55]
you are going to be community
[2:04:57]
hitting with that one.
[2:04:57]
>> Mayor: norman, thank you.
[2:04:59]
You made your recommendation.
[2:05:00]
>> when the new mayor comes in,
[2:05:01]
she will be dealing with someone
[2:05:04]
that was appointed by the old
[2:05:07]
mayor, whereas all of you can be
[2:05:08]
dealing with the person that you
[2:05:09]
dealt with, but she won't be
[2:05:12]
able to do that.
[2:05:12]
[Inaudible]
[2:05:13]
I thought I was talking.
[2:05:15]
I didn't know you were going to
[2:05:15]
override me.
[2:05:17]
I would like the same courtesy
[2:05:20]
that I gave you when I was
[2:05:21]
mayor.
[2:05:23]
[Cheers and applause]
[2:05:26]
And I'm not attacking the fact
[2:05:31]
that her appointment would be
[2:05:33]
your [Inaudible].
[2:05:34]
That' certainly permissible
[2:05:36]
under the code but it is very
[2:05:39]
unjust to take a lame duck
[2:05:40]
situation and force upon the
[2:05:42]
future commission and the future
[2:05:43]
mayor a person that she didn't
[2:05:45]
even select and would otherwise
[2:05:47]
vd the right to select if we had
[2:05:49]
left the charter the way it was
[2:05:51]
in the beginning.
[2:05:52]
But because we wanted to be
[2:05:54]
civil with each other, we gave
[2:05:55]
everybody 30 days.
[2:05:56]
And now somebody just wants to
[2:05:58]
take advantage of that, perhaps
[2:06:00]
we will have to go and change
[2:06:02]
the charter again at this next
[2:06:04]
commission to correct what we
[2:06:06]
thought was the right thing to
[2:06:10]
do, but it did have unintended
[2:06:10]
consequences.
[2:06:11]
>> Mayor: you are the one who
[2:06:13]
made the change.
[2:06:18]
[Applause]
[2:06:19]
>> mayor goldman is right.
[2:06:20]
You did make the change.
[2:06:22]
>> Mayor: yeah, you are the one
[2:06:27]
that made the change.
[2:06:27]
[Inaudible]
[2:06:30]
>> MAY it please the commission.
[2:06:32]
I'm here only as an historian
[2:06:39]
and somebody who in 1997 when I
[2:06:42]
was 25 wrote this charter --
[2:06:45]
wrote the charter, and we did
[2:06:47]
provide, as the national civic
[2:06:50]
league recommended, that people
[2:06:55]
get installed the day after they
[2:06:58]
get elected.
[2:07:01]
The situation did arise where it
[2:07:03]
became difficult to throw people
[2:07:05]
physically out of their offices
[2:07:07]
the next day.
[2:07:10]
And so that charter
[2:07:12]
commission -- the revision
[2:07:14]
commission changed it for 30
[2:07:26]
days, at which, of course, I
[2:07:26]
drafted per their request.
[2:07:26]
But it didn't contemplate this
[2:07:27]
situation, obviously.
[2:07:27]
and that MAY be something you
[2:07:27]
want to take up with the new
[2:07:27]
revision commission.
[2:07:30]
But I'd like to remind you, the
[2:07:32]
city was formed -- and the
[2:07:33]
reason the charter was drafted
[2:07:35]
in the first place was because
[2:07:38]
this area was part of the
[2:07:39]
county.
[2:07:42]
And this -- the residents of
[2:07:44]
this city to become wanted
[2:07:45]
autonomy and wanted to be able
[2:07:49]
to be part of the decision
[2:07:49]
making.
[2:07:52]
And they wanted the government
[2:07:53]
close to themselves.
[2:07:55]
So they formed a city and we
[2:07:56]
drafted the charter with every
[2:07:58]
provision with that question in
[2:07:59]
mind.
[2:08:03]
Did it reflect the choice of the
[2:08:03]
people?
[2:08:04]
And that's part of the reason
[2:08:07]
that we had the installation and
[2:08:10]
commencement of office the day
[2:08:13]
after the election.
[2:08:18]
So it is, in fairness, that
[2:08:21]
mayor edelcup is asking to defer
[2:08:23]
the mayor's selection.
[2:08:24]
Constitute the charter revision
[2:08:27]
per the charter as I'm sure your
[2:08:28]
city attorney has told you to
[2:08:31]
do, but give consideration to
[2:08:35]
the unique circumstances in the
[2:08:36]
first instance.
[2:08:40]
And in the second instance, babe
[2:08:42]
with -- maybe with your charter
[2:08:43]
review committee address it and
[2:08:45]
potentially go back to the way
[2:08:46]
it was intended to be.
[2:08:47]
Thank you for your time.
[2:08:49]
>> if I MAY say, lynn --
[2:08:50]
>> yes, sir.
[2:08:52]
>> that I think the election in
[2:08:55]
the city here is a reflection of
[2:08:56]
what's going on in the country.
[2:08:59]
I mean the election was only 20
[2:09:02]
votes, so you can't say --
[2:09:02]
[Boos]
[2:09:07]
You can't say that it is the
[2:09:08]
majority.
[2:09:09]
>> with respect, commissioner,
[2:09:11]
I'm not addressing the politics
[2:09:13]
at all.
[2:09:14]
>> Mayor: listen.
[2:09:16]
>> I am really addressing the
[2:09:17]
structure of the document.
[2:09:29]
That's it.
[2:09:29]
>> Mayor: in my understanding,
[2:09:30]
there's a lot of frustration
[2:09:30]
because norman edelcup wanted to
[2:09:30]
be appointed to the charter
[2:09:30]
review commission.
[2:09:30]
Okay.
[2:09:30]
And so that's a little unfair
[2:09:32]
because he's the reason why we
[2:09:34]
have the law the way it is
[2:09:34]
today.
[2:09:35]
>> well, it wasn't --
[2:09:37]
>> excuse me, I have never asked
[2:09:40]
to be appointed to the charter
[2:09:41]
commission.
[2:09:41]
>> Mayor: well --
[2:09:44]
>> so please stop starting
[2:09:44]
rumors.
[2:09:45]
>> Mayor: that's what I heard.
[2:09:46]
>> the elections are over.
[2:09:47]
>> Mayor: I didn't start it.
[2:09:48]
You're right, well, not
[2:09:49]
necessarily.
[2:09:50]
But let's just --
[2:09:51]
>> I resent the fact that you
[2:09:53]
think I'm trying to get into the
[2:09:56]
charter commission.
[2:09:57]
>> Mayor: okay.
[2:09:57]
>> I don't intend to.
[2:09:58]
>> Mayor: for the record, that's
[2:09:59]
what I heard.
[2:10:00]
I didn't start the rumor, I just
[2:10:01]
heard it.
[2:10:02]
>> you could have asked me but
[2:10:03]
you decided to use it as a
[2:10:04]
broadcast right now.
[2:10:06]
>> Mayor: no, listen.
[2:10:09]
Norman --
[2:10:12]
[Applause]
[2:10:14]
Norman, you came up to speak
[2:10:14]
publicly.
[2:10:16]
So that came back to me that you
[2:10:17]
were frustrated because you
[2:10:19]
wanted to be appointed to the
[2:10:22]
charter review commission.
[2:10:34]
>> MADAM Mayor, if I MAY just
[2:10:34]
say one last thing.
[2:10:34]
One of the reasons the charter
[2:10:34]
was established was to place
[2:10:34]
principles above personalities,
[2:10:35]
so that it doesn't involve any
[2:10:35]
individual, but it really
[2:10:35]
relates to the good of the
[2:10:38]
government as a whole.
[2:10:39]
And commissioners change and
[2:10:40]
it's good.
[2:10:42]
It's part of democracy.
[2:10:44]
But this government should be
[2:10:45]
considered just as a document of
[2:10:48]
the people, not political.
[2:10:48]
Thank you.
[2:10:49]
Thank you so much.
[2:10:50]
>> Mayor: thank you.
[2:10:50]
[Applause]
[2:10:55]
And again I think that -- I
[2:10:57]
think that my recommendations
[2:10:59]
and my appointments to the
[2:11:00]
charter review commission can
[2:11:02]
stand on their own merit.
[2:11:05]
So that's just -- that's what
[2:11:07]
the law is and that's what the
[2:11:08]
resolution states.
[2:11:14]
So I have no problem with that.
[2:11:15]
You'd have to fill out a public
[2:11:17]
speakers card.
[2:11:19]
I'm sorry.
[2:11:19]
[Inaudible]
[2:11:28]
If you have it, that's fine.
[2:11:30]
If it's on a separate topic --
[2:11:33]
is it on this topic or another
[2:11:35]
topic?
[2:11:40]
[Inaudible]
[2:11:42]
>> I don't see a problem with
[2:11:42]
it.
[2:11:43]
>> Mayor: we're just speaking on
[2:11:44]
this particular topic, okay.
[2:11:46]
>> it's the same topic.
[2:11:47]
>> Mayor: no, we are talking
[2:11:50]
about the resolution for
[2:11:51]
establishing the charter review
[2:11:52]
commission.
[2:11:53]
So if you want to speak to the
[2:11:54]
charter review commission,
[2:11:54]
that's fine.
[2:11:56]
>> it's going to be the same
[2:11:57]
topic.
[2:12:01]
You know, like I just want to
[2:12:10]
welcome the [Inaudible].
[2:12:10]
[Applause]
[2:12:12]
You know, I'm here like to
[2:12:12]
represent.
[2:12:14]
I have thousands and thousands
[2:12:16]
and thousands of people behind
[2:12:16]
my back.
[2:12:18]
A lot of people couldn't come
[2:12:19]
today because it's a working
[2:12:20]
day.
[2:12:22]
But a lot of people just wanted
[2:12:26]
to tell huge, huge welcome to
[2:12:27]
larisa.
[2:12:29]
Not only from miami, but from
[2:12:32]
the whole country.
[2:12:33]
And, you know, they are all
[2:12:34]
excited.
[2:12:35]
>> Mayor: please, your name.
[2:12:36]
What is your name?
[2:12:36]
I'm sorry.
[2:12:37]
Your name and your address.
[2:12:42]
>> my name is olga.
[2:12:45]
>> what is your address, please?
[2:12:48]
>> I live in the colony estates.
[2:12:49]
I don't know the address because
[2:12:52]
I just moved in here.
[2:12:52]
>> what?
[2:12:55]
>> what's my address?
[2:12:57]
I lived at ocean.
[2:12:59]
So 1701, but I just moved like a
[2:13:00]
month ago to the new building.
[2:13:02]
But I lived in the united states
[2:13:04]
for 40 years, but it's a new
[2:13:05]
address for me.
[2:13:10]
But we welcome her for a long
[2:13:11]
time.
[2:13:13]
She helped me years ago when she
[2:13:16]
wasn't the mayor.
[2:13:17]
We talked a long time when she
[2:13:20]
wasn't the mayor for years.
[2:13:21]
She has been very supportive in
[2:13:24]
a lot of topics.
[2:13:26]
We are very excited and we are
[2:13:28]
looking forward for the years to
[2:13:28]
come.
[2:13:29]
Thank you so much for
[2:13:29]
supporting.
[2:13:30]
We are looking forward to work
[2:13:34]
with all commissioners.
[2:13:35]
We are planning a lot of events.
[2:13:37]
And actually, it's a huge
[2:13:38]
schedule so be ready to work
[2:13:39]
with us.
[2:13:40]
And we are very excited.
[2:13:41]
Thank you so much.
[2:13:42]
[Applause]
[2:13:43]
>> Mayor: okay.
[2:13:49]
We have the resolution to
[2:13:50]
establish the charter review
[2:13:50]
commission.
[2:13:53]
Do we have a motion?
[2:13:53]
>> motion.
[2:13:55]
>> Mayor: motion to approve
[2:13:55]
commissioner joseph.
[2:13:59]
Do we have a second?
[2:13:59]
>> second.
[2:14:00]
>> commissioner stuyvesant.
[2:14:00]
>> Mayor: all in favor.
[2:14:01]
[Ayes]
[2:14:06]
Motion passes.
[2:14:08]
[Applause]
[2:14:09]
>> Mayor: okay.
[2:14:10]
Item number 10g.
[2:14:12]
>> 10g is a resolution accepting
[2:14:13]
the results of the general
[2:14:18]
runoff election held on tuesday
[2:14:20]
DECEMBER 6th, 2022 declaring
[2:14:22]
larisa svechin to be elected as
[2:14:23]
mayor.
[2:14:25]
Self-explanatory, mayor and
[2:14:26]
commissioners, accepting the
[2:14:27]
results.
[2:14:28]
I'd like to clarify one thing
[2:14:31]
that's on the resolution.
[2:14:33]
It is incorrectly listing the --
[2:14:35]
I'm sorry, let me just pull it
[2:14:38]
up for you really quickly.
[2:14:43]
The total number of votes cast
[2:14:45]
for each candidate.
[2:14:48]
The resolution listed at 3,320,
[2:14:55]
but it's actually 3,318.
[2:14:56]
[Inaudible]
[2:14:56]
Yes, just for the record to
[2:14:59]
clear it up.
[2:14:59]
>> Mayor: okay.
[2:15:03]
We have a public speaker for
[2:15:03]
10g.
[2:15:07]
Do you want to speak or no?
[2:15:10]
>> what was the name?
[2:15:19]
>> Mayor: capra.
[2:15:20]
>> I'm just going to read my
[2:15:21]
comment.
[2:15:23]
Dana, my first experience
[2:15:25]
knowing you created a belief
[2:15:27]
that the little man with the
[2:15:29]
mouth, your husband michael
[2:15:31]
gates, forced the evil from you.
[2:15:33]
In part, that was true, but you
[2:15:38]
proved to be far worse.
[2:15:39]
Your $20 million lawsuit of lies
[2:15:40]
exposed you and you paid the
[2:15:42]
price for your evil act in more
[2:15:44]
ways than money.
[2:15:45]
Your loss today --
[2:15:47]
>> greg, this is totally -- this
[2:15:48]
is so inappropriate.
[2:15:49]
>> it's appropriate, believe me.
[2:15:49]
>> Mayor: it's no, sir,
[2:15:50]
appropriate.
[2:15:51]
And I will ask you --
[2:15:54]
>> it took years to expose you.
[2:15:54]
>> Mayor: I'm sorry.
[2:15:58]
But you're going to --
[2:16:00]
>> you showed your true self to
[2:16:00]
them.
[2:16:01]
>> Mayor: this is not
[2:16:01]
appropriate.
[2:16:06]
This is totally not appropriate.
[2:16:07]
[Cross talking]
[2:16:08]
It's not appropriate.
[2:16:08]
>> okay.
[2:16:10]
Then you declare him out of
[2:16:11]
order.
[2:16:12]
>> Mayor: you're out of order.
[2:16:15]
You ask him to stop.
[2:16:15]
>> Mayor: stop.
[2:16:16]
>> if he doesn't stop --
[2:16:17]
>> Mayor: you will be escorted
[2:16:17]
out.
[2:16:19]
>> you can ask him out.
[2:16:20]
>> Mayor: please leave the room.
[2:16:22]
I'm sorry, please leave the
[2:16:23]
room.
[2:16:25]
Please, leave -- please, can we
[2:16:28]
have the police?
[2:16:29]
Wait.
[2:16:30]
luke, luke, we're going to have
[2:16:32]
you escorted out of the room.
[2:16:36]
We are going to have you
[2:16:37]
escorted out of the room.
[2:16:41]
Get him out of the room.
[2:16:43]
[Crowd noise]
[2:16:55]
[Crowd chanting]
[2:17:10]
[Crowd noise]
[2:17:10]
>> we can't.
[2:17:11]
>> Mayor: we have to be
[2:17:15]
appropriate.
[2:17:19]
[Crowd noise]
[2:17:21]
>> mayor, can you have a motion?
[2:17:27]
>> Mayor: for what?
[2:17:29]
[Crowd noise]
[2:17:31]
What?
[2:17:32]
>> a motion.
[2:17:34]
A motion.
[2:17:41]
Call for order.
[2:17:42]
>> Mayor: I'm sorry.
[2:17:43]
This is not --
[2:17:45]
>> he can stay.
[2:17:46]
>> Mayor: this is so not
[2:17:48]
appropriate, this type of
[2:17:48]
behavior.
[2:17:50]
It's really not appropriate.
[2:18:06]
This is not -- this is not --
[2:18:08]
>> we need a motion.
[2:18:13]
>> Mayor: this is not -- this is
[2:18:15]
not -- this is meant to harass.
[2:18:20]
It's not on topic.
[2:18:21]
[Crowd noise]
[2:18:22]
>> Mayor: I mean what is the
[2:18:23]
purpose of this?
[2:18:25]
Just to harass me?
[2:18:30]
>> yes.
[2:18:33]
[Crowd noise]
[2:18:34]
>> let's unite everybody.
[2:18:39]
Let us celebrate, okay.
[2:18:53]
[Crowd noise]
[2:18:57]
>> thank you, MS. Olga.
[2:19:02]
[Applause]
[2:20:04]
[Crowd noise]
[2:20:06]
>> we have a time at the end of
[2:20:09]
the commission meeting for open
[2:20:09]
discussion.
[2:20:13]
That would be the time for any
[2:20:15]
speeches such as what we just
[2:20:15]
had.
[2:20:18]
And I'll leave it at that.
[2:20:21]
>> let me read from the code if
[2:20:21]
I MAY.
[2:20:24]
Any person making impertinent or
[2:20:28]
slanderous remarks or becomes
[2:20:30]
boisterous while addressing the
[2:20:31]
commission shall be barred from
[2:20:32]
further appearance before the
[2:20:34]
commission by the presiding
[2:20:35]
officer unless permission to
[2:20:36]
continue or again address the
[2:20:38]
commission is granted by the
[2:20:40]
majority vote of the commission
[2:20:42]
members present.
[2:20:46]
In my opinion, that was
[2:20:47]
slanderous.
[2:20:47]
[Crowd noise]
[2:20:50]
>> no, it is true.
[2:20:51]
[Crowd noise]
[2:20:52]
>> and it further says that no
[2:20:56]
clapping, applauding, heckeling
[2:21:01]
or verbal outbursts shall be
[2:21:01]
permitted.
[2:21:03]
Persons exiting the commission
[2:21:05]
chambers shall do so quietly.
[2:21:07]
But it's up to you whether you
[2:21:09]
want to hear the rest of
[2:21:10]
whatever time he had left.
[2:21:12]
I don't know what that is.
[2:21:13]
>> Mayor: so we can take a
[2:21:16]
majority vote?
[2:21:16]
>> yes.
[2:21:18]
>> Mayor: I'll leave it to my
[2:21:19]
colleagues to make the vote.
[2:21:26]
>> I vote no.
[2:21:27]
>> jeniffer.
[2:21:28]
>> no, I agree.
[2:21:30]
I think that was inappropriate.
[2:21:33]
And I mean it's such a horrible
[2:21:35]
way -- I mean this is a vote on
[2:21:37]
an election result.
[2:21:38]
I mean you are just really
[2:21:40]
setting the wrong tone here.
[2:21:41]
I don't think it's appropriate
[2:21:45]
at all.
[2:21:46]
>> Mayor: and you are a
[2:21:48]
supporter and you don't agree.
[2:21:54]
>> okay, all right.
[2:22:00]
Can I see that card, his card?
[2:22:00]
>> Mayor: 10g.
[2:22:03]
>> so it was 10g, obviously it
[2:22:04]
was off topic, okay.
[2:22:05]
And then going back to what the
[2:22:08]
city attorney said and the name
[2:22:11]
calling I think is very
[2:22:11]
inappropriate.
[2:22:14]
So I don't see the point in it.
[2:22:16]
You know, I think it's just name
[2:22:16]
calling.
[2:22:18]
And I don't see that adds to
[2:22:19]
anything if we're looking to
[2:22:22]
move forward.
[2:22:24]
So maybe you're stuck in the
[2:22:26]
past, but I mean we need to move
[2:22:28]
forward.
[2:22:29]
Name calling, you know, is not
[2:22:31]
my cup of tea and I will not
[2:22:32]
allow that.
[2:22:32]
Okay?
[2:22:34]
No matter what the personal
[2:22:36]
issues you have with that
[2:22:37]
person, we are at a commission
[2:22:38]
meeting and we are here to
[2:22:41]
discuss city business, not
[2:22:41]
personal business.
[2:22:43]
So let's keep it at that.
[2:22:45]
Thank you.
[2:22:47]
>> and I'd like to also say,
[2:22:50]
greg, that you --
[2:22:51]
[Applause]
[2:22:55]
You have already aired all of
[2:22:57]
your rhetoric against the mayor,
[2:23:00]
the former mayor on facebook.
[2:23:02]
Everyone has seen it.
[2:23:04]
Everyone has seen it on
[2:23:04]
facebook.
[2:23:06]
I think you have put out
[2:23:07]
everything possibly that could
[2:23:09]
be put out against the mayor.
[2:23:10]
So anyone could go back and look
[2:23:11]
at it.
[2:23:13]
`we don't have to hear it
[2:23:13]
tonight.
[2:23:14]
Thank you.
[2:23:15]
>> mayor, MAY I speak?
[2:23:19]
>> Mayor: no, you're not even --
[2:23:19]
[Cheers and applause]
[2:23:20]
You're not even --
[2:23:22]
you just walk up to the mic?
[2:23:23]
You can't -- you want to fill
[2:23:25]
out a public speaker card.
[2:23:26]
this is not --
[2:23:27]
>> I'll fill it out but you as
[2:23:28]
the chair can allow me to speak
[2:23:31]
a few minutes.
[2:23:32]
>> Mayor: okay.
[2:23:34]
>> so I just want to say that I
[2:23:36]
was hoping that this would not
[2:23:36]
happen.
[2:23:38]
I definitely want the city to be
[2:23:38]
united.
[2:23:40]
I do not in any way support or
[2:23:42]
condone anyone on this dais to
[2:23:44]
be insulted in any way.
[2:23:46]
Although I am a believer in free
[2:23:48]
speech, it has a time and a
[2:23:49]
place.
[2:23:50]
And so this is certainly not how
[2:23:55]
I expected this item to go down
[2:23:56]
because as olga has indicated,
[2:23:58]
we do want to just move on
[2:23:59]
because it's not about
[2:24:00]
personalities, it's about the
[2:24:01]
office of mayor.
[2:24:04]
It's about the office
[2:24:05]
commissioner and we need to
[2:24:06]
respect that office no matter
[2:24:08]
what we think of a person
[2:24:09]
individually because it changes.
[2:24:11]
And that's the reality.
[2:24:12]
So I hope that we can just get
[2:24:14]
past this and get united and
[2:24:15]
just move on, please.
[2:24:16]
Thank you.
[2:24:18]
Thank you for letting me speak.
[2:24:21]
>> so you are a supporter of
[2:24:23]
cabra with his behavior?
[2:24:25]
>> Mayor: you're a supporter?
[2:24:26]
>> I'm asking that we move on.
[2:24:27]
I'm not condemning anyone.
[2:24:30]
I'm not supporting anyone.
[2:24:32]
>> so you're against what he
[2:24:32]
did?
[2:24:33]
No, I'm sorry.
[2:24:35]
So you are against what he did?
[2:24:37]
>> I am not in any support of
[2:24:38]
anyone being insulted.
[2:24:40]
>> specific, so you are a
[2:24:40]
supporter.
[2:24:41]
Are you okay with what he was
[2:24:42]
doing?
[2:24:44]
>> okay, time out.
[2:24:46]
I think, listen, at this
[2:24:46]
point --
[2:24:47]
>> I am not looking to debate
[2:24:48]
with anyone.
[2:24:50]
>> hold on, at this point --
[2:24:51]
[Cross talking]
[2:25:10]
>> thank you.
[2:25:10]
[Inaudible]
[2:25:11]
>> thank you, olga.
[2:25:12]
I don't think this is the time
[2:25:14]
or a place to have this
[2:25:17]
discussion.
[2:25:32]
[Inaudible]
[2:25:34]
>> she can't do anything about
[2:25:35]
this.
[2:25:38]
Dana can't do anything about
[2:25:39]
this.
[2:25:43]
It's not a problem --
[2:25:44]
>> let me just say it's very,
[2:25:46]
very difficult to sit up there.
[2:25:48]
It's very challenging and it is
[2:25:49]
especially hard when someone
[2:25:51]
comes up against whatever it is
[2:25:53]
you are voting on or you
[2:25:54]
personally and I have had that
[2:25:54]
happen to me.
[2:25:56]
It's not pleasant.
[2:25:58]
And yes, fabiola, I do not
[2:26:01]
condone in any way anyone
[2:26:02]
insulting anyone from here to
[2:26:03]
this body because I have the
[2:26:05]
utmost respect for this body.
[2:26:06]
And that is the reason that I
[2:26:08]
ran and I intend to maintain
[2:26:09]
that promise.
[2:26:11]
So that's why I'm just asking
[2:26:12]
that we just move on, please.
[2:26:15]
Thank you.
[2:26:22]
[Applause]
[2:26:23]
>> Mayor: okay.
[2:26:25]
We have no other public
[2:26:25]
speakers.
[2:26:25]
>> yes, we did.
[2:26:26]
We had one more.
[2:26:33]
>> Mayor: we have one more.
[2:26:33]
Felix.
[2:26:36]
[Crowd noise]
[2:26:38]
[Boos]
[2:26:38]
>> wow.
[2:26:39]
>> hold on.
[2:26:42]
Hold on.
[2:26:43]
>> Mayor: did we MISS The
[2:26:44]
comments and the rules?
[2:26:45]
Come on.
[2:26:46]
>> everybody, please, time-out.
[2:26:48]
Let's get our heads straight.
[2:26:50]
Please, let's get our heads
[2:26:51]
straight.
[2:26:52]
We are here to discuss city
[2:26:52]
business.
[2:26:54]
We are not here to heckle.
[2:26:55]
We're not in high school.
[2:26:57]
Okay.
[2:27:09]
So please, seriously, this is
[2:27:09]
getting out of hand.
[2:27:09]
Okay?
[2:27:09]
That's it.
[2:27:09]
Enough.
[2:27:09]
>> thank you.
[2:27:12]
My name is felix kizner, I live
[2:27:15]
at 250 174th street, honorable
[2:27:16]
mayor, honorable vice mayor,
[2:27:20]
members of the commission, as
[2:27:21]
thomas jefferson once said the
[2:27:22]
government that you deserve is
[2:27:24]
the government you elect.
[2:27:25]
And vice versa, the government
[2:27:28]
you elect is the government you
[2:27:28]
deserve.
[2:27:30]
Thank you for the people that
[2:27:32]
volunteered and voted because
[2:27:36]
that's what makes america great.
[2:27:36]
People's participation.
[2:27:46]
But it's done with respect, not
[2:27:46]
with heckling.
[2:27:46]
Not with personal attack and
[2:27:46]
pointing fingers at the city
[2:27:46]
commission.
[2:27:46]
That's not what america is
[2:27:46]
about.
[2:27:49]
That's what russia is about.
[2:27:52]
That's what venezuela is about.
[2:27:54]
But not sunny isles beach.
[2:27:56]
And I don't think we should let
[2:27:59]
anybody make a spectacle out of
[2:27:59]
our city.
[2:28:01]
We have a very nice city up
[2:28:01]
until today.
[2:28:02]
And I don't
[2:28:04]
i don't understand what
[2:28:05]
happened to it.
[2:28:06]
I have been living here since
[2:28:07]
the year 2000.
[2:28:10]
I still thank everyone who
[2:28:11]
volunteered, who were the poll
[2:28:13]
watchers and took the time.
[2:28:16]
And again, now I have a question
[2:28:17]
to the canvassing board.
[2:28:20]
There was a question about
[2:28:23]
district number 3.
[2:28:24]
And that district you had two
[2:28:27]
machines where people voted.
[2:28:29]
One machine was broken most of
[2:28:31]
the time and it had to be reset
[2:28:31]
from what I understand.
[2:28:34]
I know my relatives came to
[2:28:34]
vote.
[2:28:37]
One of them had 415 votes,
[2:28:39]
that's why there was a lot more.
[2:28:42]
One had 185 votes if that's
[2:28:43]
correct, the numbers that I
[2:28:43]
have.
[2:28:44]
The machine that didn't work
[2:28:45]
most of the day or part of the
[2:28:49]
day I guess had no problem with
[2:28:49]
transmission.
[2:28:51]
The machine that didn't work
[2:28:53]
well all the day had a problem
[2:28:56]
with transmission.
[2:28:58]
But in america today, we have
[2:29:02]
great amount of factors to make
[2:29:04]
sure the vote is proper.
[2:29:07]
I'm sorry, this is not poinciana
[2:29:08]
board of directrs, this is city
[2:29:09]
commission board of directors.
[2:29:11]
So please give me the respect
[2:29:12]
that I gave you when you spoke.
[2:29:14]
So bottom line is I know that
[2:29:15]
there's safety factors.
[2:29:18]
One of the things is the drive,
[2:29:20]
which is a machine which was
[2:29:23]
taken to the city because the
[2:29:24]
transmission didn't take place
[2:29:26]
on the machine that worked all
[2:29:28]
day, which is especially coded.
[2:29:33]
And number two, there are other
[2:29:34]
safety factors such as physical
[2:29:34]
count.
[2:29:36]
Because the election is so close
[2:29:37]
that
[2:29:41]
close, did the canvassing board
[2:29:43]
think to physically count from
[2:29:44]
the machine?
[2:29:45]
>> Mayor: can we hear him
[2:29:46]
respectfully like we just went
[2:29:47]
through, please?
[2:29:49]
>> so bottom line, was it ever
[2:29:50]
considered to do a physical
[2:29:52]
count because it's only 600
[2:29:52]
votes?
[2:29:53]
To make sure that the machine
[2:29:54]
where people put in the votes
[2:29:57]
and spit it out and there was no
[2:29:58]
double counting or anything like
[2:29:58]
that.
[2:30:01]
Thank you.
[2:30:10]
I'm done speaking, thank you.
[2:30:11]
>> Mayor: everyone, please
[2:30:12]
observe the decorum, please.
[2:30:14]
This is a little out of hand.
[2:30:16]
It's a little out of hand,
[2:30:19]
everybody.
[2:30:20]
Okay.
[2:30:22]
>> okay.
[2:30:23]
So is it considered ever
[2:30:25]
physically recounting?
[2:30:25]
[Crowd noise]
[2:30:31]
Thank you.
[2:30:32]
>> Mayor: okay.
[2:30:36]
Public speaker comments are
[2:30:37]
done.
[2:30:41]
And I think we -- do we have any
[2:30:45]
comments about this item?
[2:30:49]
Do we have any comments on this?
[2:30:50]
>> mayor, commissioners --
[2:30:54]
>> Mayor: for me, I have some
[2:30:56]
concerns about -- I have some
[2:30:57]
concerns, but I'm willing to,
[2:30:59]
you know, hear from my
[2:31:01]
colleagues.
[2:31:09]
[Crowd noise]
[2:31:11]
Go ahead, commissioner lama,
[2:31:12]
commissioner joseph, does anyone
[2:31:14]
have any comments on this item?
[2:31:16]
Or are we just going to take a
[2:31:16]
motion?
[2:31:17]
>> are you going to answer some
[2:31:18]
of the questions?
[2:31:20]
Or the canvassing board?
[2:31:21]
>> no, we don't -- we don't
[2:31:24]
answer any of those questions.
[2:31:25]
No.
[2:31:26]
>> Mayor: the canvassing board
[2:31:29]
has basically certified and this
[2:31:31]
is a min
[2:31:33]
ministerial vote
[2:31:39]
essentially.
[2:31:40]
>> let's then put it up for a
[2:31:42]
vote.
[2:31:42]
>> Mayor: okay.
[2:31:43]
>> we need a motion.
[2:31:44]
>> Mayor: are you making a
[2:31:45]
motion?
[2:31:48]
>> no.
[2:31:50]
>> okay, hold on.
[2:31:53]
Let's discuss this a little bit.
[2:31:53]
>> Mayor: sure.
[2:31:54]
>> obviously there's some
[2:31:55]
questions here, okay.
[2:31:56]
We could discuss it.
[2:31:57]
Are you going to discuss it with
[2:32:00]
me, both of you on the
[2:32:01]
canvassing board?
[2:32:03]
Tell me a little bit.
[2:32:04]
I know there was a 20-vote
[2:32:05]
difference.
[2:32:08]
I want to understand why it did
[2:32:12]
not go to a recount, okay.
[2:32:14]
Why did it not trigger a
[2:32:14]
recount?
[2:32:15]
I just want to understand.
[2:32:18]
I want to understand for the
[2:32:21]
sake of the public, okay.
[2:32:23]
Because what?
[2:32:27]
>> the percentage was.06.
[2:32:28]
>> I know it did not trigger it
[2:32:30]
but felix posed some guess and I
[2:32:32]
want to be able to air this out.
[2:32:34]
I understand it, but I just want
[2:32:36]
the public to understand this a
[2:32:37]
little bit.
[2:32:38]
>> sure, sure.
[2:32:41]
Under state law, a machine
[2:32:44]
recount is only run in the event
[2:32:48]
that the margin is more than 1/2
[2:32:49]
of 1%.
[2:32:51]
>>.5.
[2:32:52]
>> correct.
[2:32:52]
This was.6.
[2:32:57]
so there's no recount under the
[2:32:57]
machines.
[2:32:58]
And what they do is they just
[2:33:00]
run the ballots
[2:33:01]
ballots back through the
[2:33:02]
machines.
[2:33:03]
You never get to a manual
[2:33:05]
recount unless the difference
[2:33:08]
after that is.25%.
[2:33:11]
So we never got to.25%.
[2:33:13]
And that's why there's no
[2:33:13]
recount.
[2:33:16]
Now, I will tell you that I
[2:33:17]
participated in the canvassing
[2:33:19]
board meeting last friday.
[2:33:20]
And at the end of the day what
[2:33:22]
happens is that the supervisors
[2:33:25]
of elections staff do what they
[2:33:27]
call an audit, a precinct audit.
[2:33:30]
What they do is take all four
[2:33:31]
precincts here and put them on
[2:33:33]
little stickers --
[2:33:33]
>> five.
[2:33:34]
>> five precincts.
[2:33:35]
They put them in a bowl.
[2:33:37]
Somebody picks out a number and
[2:33:38]
that's the number of the
[2:33:38]
precinct.
[2:33:40]
They bring out all of the
[2:33:45]
ballots, both the vote ballots
[2:33:47]
and previously received ballots
[2:33:49]
and they do a manual recount.
[2:33:50]
and when they did that, the
[2:33:52]
numbers were exactly matching
[2:33:53]
what the results were.
[2:33:54]
>> yes.
[2:33:56]
And I happen to have asked the
[2:33:57]
question whether there has ever
[2:33:59]
been a change.
[2:34:02]
And they answered no.
[2:34:02]
>> right.
[2:34:04]
>> so only one precinct was
[2:34:05]
audited.
[2:34:05]
>> yeah.
[2:34:07]
According to state law, right.
[2:34:08]
>> what precinct was that?
[2:34:10]
>> it was 2.
[2:34:11]
>> the church.
[2:34:13]
>> which was the church,
[2:34:14]
correct.
[2:34:15]
>> but it was totally random.
[2:34:16]
You know, it was one out of five
[2:34:19]
and they pulled it out of a
[2:34:19]
fishbowl.
[2:34:20]
>> and is
[2:34:22]
is there any validity to
[2:34:23]
some of the question marks,
[2:34:25]
rumors that we hear about
[2:34:26]
precinct 3?
[2:34:28]
>> I don't have any knowledge of%
[2:34:30]
any of those events.
[2:34:31]
>> it's moot because they
[2:34:34]
randomly selected district 2.
[2:34:36]
>> the supervisor's office and
[2:34:38]
canvassing board have now
[2:34:39]
certified those results.
[2:34:40]
And all you're doing is
[2:34:42]
accepting them.
[2:34:43]
>> okay.
[2:34:44]
>> and if someone has, you
[2:34:45]
know --
[2:34:46]
>> because I want the public to
[2:34:50]
understand and I want people to
[2:34:51]
learn, you know.
[2:34:51]
[Crowd noise]
[2:34:53]
No, I know.
[2:34:54]
But not everybody does.
[2:34:58]
There's a lot of rumors out
[2:34:58]
there.
[2:35:01]
So I think information is key
[2:35:02]
and knowledge is key.
[2:35:04]
So I'm asking --
[2:35:08]
[Crowd noise]
[2:35:09]
Well, I didn't know you had
[2:35:10]
corporate attorneys.
[2:35:12]
I don't know what you are
[2:35:12]
talking about.
[2:35:13]
Yeah, yeah.
[2:35:15]
Yeah, not --
[2:35:15]
[Inaudible]
[2:35:16]
Okay okay, yeah.
[2:35:18]
I just want, you know, to
[2:35:24]
understand and get this --
[2:35:25]
[Inaudible]
[2:35:27]
How do you know?
[2:35:28]
[Laughter]
[2:35:28]
[Inaudible]
[2:35:30]
Are you sure?
[2:35:32]
No, but I just wanted to
[2:35:34]
repeat --
[2:35:35]
[Inaudible]
[2:35:37]
Well, no, no.
[2:35:37]
>> Mayor: okay.
[2:35:37]
>> no.
[2:35:38]
Fair enough.
[2:35:40]
But I think it's always good to
[2:35:42]
impart information and
[2:35:42]
knowledge.
[2:35:44]
So, you know, it is not done in
[2:35:46]
a malicious way.
[2:35:48]
It's just done in a way to
[2:35:49]
understand, for people to
[2:35:51]
understand and be informed.
[2:35:51]
Okay.
[2:35:58]
So yeah.
[2:35:59]
>> Mayor: are we done?
[2:36:01]
>> yeah, anybody have any
[2:36:01]
comments?
[2:36:02]
>> Mayor: yes, I mean obviously
[2:36:07]
there are some concerns raised
[2:36:08]
about the number of ballots and
[2:36:09]
so forth.
[2:36:13]
But this is purely an
[2:36:15]
administerial vote to ratify
[2:36:17]
what are the results of the
[2:36:19]
canvassing board.
[2:36:21]
>> but another authority has
[2:36:22]
already determined.
[2:36:26]
>> okay.
[2:36:29]
>> Mayor: correct.
[2:36:32]
>> I think in the spirit of
[2:36:34]
following the rules -- because I
[2:36:35]
think that's -- I'm sorry, but I
[2:36:37]
don't think we have ever had
[2:36:41]
bullying in this --
[2:36:46]
this is such a poor tone to this
[2:36:47]
transition, right.
[2:36:49]
We have somebody who --
[2:36:50]
>> and it's unnecessary as well
[2:36:52]
I have to say.
[2:36:54]
>> you know, the rules apply to
[2:36:54]
you guys.
[2:36:56]
They apply to us as well.
[2:36:58]
We have to take a vote.
[2:36:59]
It says you shall do it, so
[2:37:00]
we'll do it.
[2:37:02]
I'll make my motion in a moment.
[2:37:04]
But I would ask in the future,
[2:37:10]
it really doesn't help the
[2:37:12]
booing and the screaming and
[2:37:14]
from your seats -- it's not
[2:37:14]
helpful
[2:37:15]
it's not helpful.
[2:37:17]
If you want to express your
[2:37:19]
support and your excitement, do
[2:37:21]
it in an appropriate way.
[2:37:23]
Screaming from your chairs is
[2:37:25]
not an appropriate way.
[2:37:27]
So please.
[2:37:31]
In the future, you know, just
[2:37:34]
hold it or call somebody on the
[2:37:38]
phone outside.
[2:37:40]
Or go vent somewhere else, just
[2:37:42]
not from your seats.
[2:37:43]
Okay.
[2:37:47]
And with that, I would make a
[2:37:48]
motion.
[2:37:51]
>> Mayor: do we have a second?
[2:37:52]
>> second.
[2:37:59]
>> Mayor: all in favor.
[2:37:59]
[Ayes]
[2:38:02]
>> and that's how we follow the
[2:38:05]
rules.
[2:38:07]
[Applause]
[2:38:08]
>> Mayor: okay.
[2:38:09]
We're on discussion items.
[2:38:12]
>> no, mayor, we have the three
[2:38:14]
add-on items.
[2:38:14]
>> Mayor: citizens forum.
[2:38:16]
>> no, we have the three
[2:38:17]
add-ons.
[2:38:21]
>> yes.
[2:38:22]
>> 10h.
[2:38:25]
10h, the add-on.
[2:38:28]
>> Mayor: oh, 10h.
[2:38:29]
>> 10h is a resolution approving
[2:38:31]
a third amendment to the
[2:38:33]
agreement with granicus to
[2:38:36]
provide website redesign
[2:38:38]
services, data management and
[2:38:39]
webcasting services.
[2:38:43]
I'll start this off, mayor, as
[2:38:44]
it's the intermediate manager
[2:38:45]
reporting.
[2:38:47]
Granicus is the company that we
[2:38:50]
use to manage our agenda and
[2:38:54]
publishing it on the website.
[2:38:56]
>> could you just wait like 30
[2:39:01]
seconds, please?
[2:39:28]
[Inaudible]
[2:39:55]
>> thank you.
[2:39:56]
>> okay, I think we're good.
[2:39:58]
Please, thank you.
[2:39:59]
>> okay.
[2:40:01]
So granicus is the provider that
[2:40:05]
we use to manage our agendas and
[2:40:09]
publish them on the city's
[2:40:09]
website.
[2:40:11]
So in light of the fact that we
[2:40:14]
use them already for numerous
[2:40:15]
services, the meeting department
[2:40:19]
decided to also contract them
[2:40:20]
for redesigning the website.
[2:40:22]
And I'll turn that over to leah
[2:40:24]
so she can mention it.
[2:40:25]
>> honorable mayor, vice mayor
[2:40:27]
and commission, we wish to
[2:40:29]
partner with granicus to build a
[2:40:30]
brand-new user-friendly secure
[2:40:33]
A.D.A. Compliant and modern
[2:40:33]
website.
[2:40:35]
After much research and demos
[2:40:37]
with other vendors, we found
[2:40:38]
granicus to be the most suitable
[2:40:41]
for our needs and aleading
[2:40:42]
provider in the government
[2:40:42]
sector.
[2:40:44]
We will be piggybacking the ncpa
[2:40:46]
which is the national
[2:40:47]
cooperative purchasing alliance
[2:40:51]
contract and also peyton owen is
[2:40:53]
the representative from granicus
[2:40:59]
and is here tonight in case you
[2:41:00]
have any questions.
[2:41:02]
>> well then, if I could just
[2:41:03]
say one thing, congratulations
[2:41:04]
to leah.
[2:41:06]
She's no longer the interim
[2:41:07]
media manager.
[2:41:09]
As of million dollars,
[2:41:12]
monday, she'll be our
[2:41:15]
media manager.
[2:41:20]
[Applause]
[2:41:21]
>> a motion.
[2:41:23]
>> motion to approve.
[2:41:25]
>> Mayor: do I have a motion?
[2:41:26]
>> so moved.
[2:41:27]
>> Mayor: second.
[2:41:27]
>> second.
[2:41:28]
>> Mayor: all in favor.
[2:41:29]
[Ayes]
[2:41:29]
>> thank you.
[2:41:30]
>> Mayor: thank you, good night.
[2:41:33]
>> I'd like to see some mocks of
[2:41:34]
the new website eventually.
[2:41:35]
That will be cool.
[2:41:37]
I'm waiting.
[2:41:37]
>> you bet.
[2:41:39]
So excited, by the way, to be
[2:41:41]
able to come to this city and
[2:41:44]
see how beautiful it is and the
[2:41:44]
residents.
[2:41:45]
We're super excited to be able
[2:41:48]
to work with you guys on this
[2:41:49]
new project.
[2:41:51]
Part of our project experience
[2:41:53]
will be sharing a bunch of
[2:41:55]
different design faces, getting
[2:41:57]
the feedback from both the
[2:41:58]
public and the staff members on
[2:42:00]
how you want to create that
[2:42:01]
digital curb appeal.
[2:42:02]
>> all right, thank you.
[2:42:04]
>> thank you.
[2:42:10]
[Applause]
[2:42:12]
>> Mayor: item 10j.
[2:42:14]
>> 10I, mayor, authorizing the
[2:42:15]
city manager or designee to
[2:42:17]
purchase necessary janitorial
[2:42:19]
and sanitation supplies and
[2:42:20]
equipment from imperial dade for
[2:42:25]
fiscal year 2022-2023.
[2:42:26]
>> good evening, mayor, vice
[2:42:30]
mayor and commissioners.
[2:42:31]
The public works department is
[2:42:33]
seeking for the approval of a
[2:42:34]
blanket purchase order with
[2:42:39]
imperial dade for the necessary
[2:42:41]
janitorial, sanitation supplies,
[2:42:42]
equipment and related services
[2:42:46]
for this fiscal year '22-23 in
[2:42:49]
an amount not to exceed
[2:42:55]
$100,000.
[2:42:58]
>> Mayor: do we have comments?
[2:43:00]
We thank you.
[2:43:00]
>> motion.
[2:43:01]
>> Mayor: motion, so moved,
[2:43:03]
anyone.
[2:43:03]
>> second.
[2:43:05]
>> Mayor: who's got the first?
[2:43:06]
>> vice mayor viscarra.
[2:43:08]
>> I won, I won.
[2:43:10]
>> Mayor: okay.
[2:43:10]
Second?
[2:43:12]
All in favor.
[2:43:13]
[Ayes]
[2:43:14]
>> thank you.
[2:43:17]
>> Mayor: it's getting late.
[2:43:19]
Item 10j.
[2:43:20]
>> 10j is a resolution urging
[2:43:21]
members of the florida
[2:43:24]
legislature to support the 2023
[2:43:26]
florida league of cities
[2:43:27]
legislative platform.
[2:43:29]
>> yeah.
[2:43:33]
So this is, you know, nothing
[2:43:33]
new.
[2:43:36]
In fact, commissioner lama, I
[2:43:37]
don't know if you want to
[2:43:39]
co-sponsor this or not given you
[2:43:41]
are the flc rep.
[2:43:42]
I jumped on it when it came
[2:43:44]
through my email to make it an
[2:43:45]
add-on.
[2:43:47]
Basically, this is just to give
[2:43:50]
us an outline provided by the
[2:43:51]
florida league of cities in
[2:43:52]
terms of the kinds of things
[2:43:56]
that we are going to support
[2:43:58]
legislatively this includes -- a
[2:44:01]
lot of it is based around home
[2:44:04]
rule which is cities and
[2:44:06]
legislation that supports us
[2:44:08]
keeping our power.
[2:44:09]
Three of the points are like
[2:44:11]
around different aspects of
[2:44:13]
short-term rentals, workforce
[2:44:14]
housing is one of the things
[2:44:16]
which we heard in the
[2:44:19]
presentation today about the
[2:44:19]
condos.
[2:44:22]
What else?
[2:44:23]
Traditional and alternative
[2:44:24]
modes of transportation.
[2:44:26]
But basically, it's all the
[2:44:28]
preservation of municipal
[2:44:30]
authority and supporting that
[2:44:32]
type of legislation.
[2:44:33]
So I don't know, commissioner
[2:44:34]
lama, if you wanted to add to
[2:44:35]
that.
[2:44:35]
>> yeah.
[2:44:38]
Thank you very much for inviting
[2:44:39]
me to be a co-sponsor.
[2:44:40]
>> sure.
[2:44:41]
>> this is great.
[2:44:42]
Obviously, we know the
[2:44:44]
importance of, you know,
[2:44:47]
advocating, you know, with the
[2:44:49]
miami-dade county league of
[2:44:50]
cities and at the state level
[2:44:51]
with the florida league of
[2:44:52]
cities.
[2:44:53]
And there are many issues that,
[2:44:56]
you know, we keep -- we need to
[2:44:58]
keep advocating, protecting home
[2:45:00]
rule and other issues that
[2:45:01]
affect municipalities.
[2:45:04]
So yeah, this is great, great
[2:45:05]
idea.
[2:45:08]
And yeah, kudos for this.
[2:45:12]
>> okay, awesome.
[2:45:12]
>> Mayor: okay.
[2:45:12]
>> anything else?
[2:45:14]
>> Mayor: is there a motion?
[2:45:15]
>> so moved.
[2:45:16]
>> Mayor: second?
[2:45:16]
>> second.
[2:45:19]
>> Mayor: all in favor.
[2:45:19]
[Ayes]
[2:45:21]
Okay.
[2:45:24]
We're on to discussion.
[2:45:25]
>> yeah.
[2:45:28]
>> Mayor: citizens forum, okay.
[2:45:31]
>> any speakers?
[2:45:32]
[Inaudible]
[2:45:37]
>> Mayor: is somebody here from
[2:45:41]
nina nikoloff.
[2:45:46]
>> I am, I am.
[2:45:47]
>> hello.
[2:45:49]
>> hello, good evening.
[2:45:51]
It's almost night.
[2:45:52]
Yes.
[2:45:57]
And my name is nina nikoloff.
[2:45:59]
>> I'm sorry, where do you live,
[2:45:59]
please?
[2:46:00]
Your address.
[2:46:01]
>> Mayor: name and address for
[2:46:02]
the record.
[2:46:03]
>> okay.
[2:46:11]
My address is 251 74th street
[2:46:12]
unit 1208 sunny isles beach.
[2:46:15]
Yes, I arrived to this apartment
[2:46:21]
in JUNE 2027.
[2:46:22]
[Inaudible] Who is also the
[2:46:25]
PRESIDENT Of the association.
[2:46:29]
Immediately, I was notified of
[2:46:31]
the need to pay a special
[2:46:35]
assessment in the amount of
[2:46:36]
almost 30,000.
[2:46:43]
And in our balance, it was so
[2:46:46]
bad numbers about they showed
[2:46:53]
losses cost 400,000, yes, and it
[2:46:54]
is many, many understandable
[2:46:58]
number when I will need to pay,
[2:46:59]
yet in this situation.
[2:47:02]
In AUGUST, the PRESIDENT
[2:47:04]
Announced that the building
[2:47:09]
could not pass the 50-year
[2:47:11]
certification and was in
[2:47:11]
disrepair.
[2:47:16]
I bought very, very expensive
[2:47:16]
apartment.
[2:47:20]
I need to pay a special
[2:47:21]
assessment.
[2:47:24]
I need to pay many, many money
[2:47:26]
for losses for balance.
[2:47:32]
And I bought an apartment in
[2:47:35]
emergency situation --
[2:47:38]
emergency, yes.
[2:47:41]
And in violence of our bylaws,
[2:47:45]
board members do not report at
[2:47:47]
meeting after approving
[2:47:48]
13 million contribution.
[2:47:51]
The board does not show monthly
[2:47:55]
report even on the debit.
[2:48:00]
From SEPTEMBER I asked them
[2:48:01]
please report to us.
[2:48:08]
They did not report.
[2:48:10]
Only it was [Inaudible].
[2:48:11]
At 8 DECEMBER it was the meeting
[2:48:15]
and on after the meeting could
[2:48:19]
they show the website report
[2:48:21]
from AUGUST, from SEPTEMBER and
[2:48:22]
now more.
[2:48:26]
And we got so, so terrible.
[2:48:31]
They showed only our -- I am
[2:48:31]
sorry.
[2:48:35]
I am so worried, yes.
[2:48:40]
to pay so many for only one
[2:48:43]
month, our debt was for
[2:48:46]
1 million more, for 1 million
[2:48:47]
more.
[2:48:50]
And this is --
[2:48:50]
[Tone]
[2:48:51]
I am sorry.
[2:48:52]
I am sorry.
[2:48:53]
I am sorry, thank you.
[2:48:58]
And I only work, this is the
[2:48:59]
result of working.
[2:49:01]
I am sorry.
[2:49:02]
But this is --
[2:49:09]
>> excuse me
[2:49:09]
[Inaudible]
[2:49:14]
>> he was for the person of the
[2:49:17]
sunny isles beach, how it can
[2:49:20]
be.
[2:49:26]
Everybody knew it is really --
[2:49:29]
building is understandable
[2:49:30]
for -- [Inaudible]
[2:49:31]
>> Mayor: thank you.
[2:49:34]
>> it is emergency.
[2:49:35]
Okay.
[2:49:38]
And now however, the main
[2:49:41]
problem is the threat that more
[2:49:45]
than 400 families live in the
[2:49:50]
building that is in this
[2:49:50]
disrepair.
[2:49:52]
They MAY lost their home and
[2:49:55]
they stay on the street.
[2:50:01]
The complaint filed with dpr was
[2:50:04]
accepted for consideration only
[2:50:07]
for fourth time and now it is in
[2:50:08]
a year if you
[2:50:09]
if you cannot get letter
[2:50:11]
answer from them.
[2:50:17]
However, the most understandable
[2:50:28]
fact for us is that
[2:50:31]
MR. Pissaloff was the citizen of
[2:50:32]
the city hall.
[2:50:33]
>> Mayor: thank you so much for
[2:50:33]
your comments.
[2:50:35]
>> hi, I'd just like to ask
[2:50:36]
you -- I'm sorry.
[2:50:37]
Excuse me.
[2:50:39]
I'd just like -- was the new
[2:50:40]
mayor aware that you were going
[2:50:42]
to speak tonight?
[2:50:44]
Because she should be here to
[2:50:46]
hear your complaint.
[2:50:49]
I'm surprised she left.
[2:50:50]
>> no.
[2:50:50]
Ma'am --
[2:50:51]
>> I arrived here.
[2:50:52]
Can I talk?
[2:50:54]
>> ma'am, I'll tell you one
[2:50:55]
thing.
[2:50:57]
So we, as a city, don't have
[2:50:58]
jurisdiction over some of the
[2:51:01]
items you said, like, you know,
[2:51:03]
assessments and some issues with
[2:51:05]
your association and the
[2:51:06]
association PRESIDENT.
[2:51:08]
You mentioned that you filed a
[2:51:12]
complaint against the wpr.
[2:51:15]
Do you know spencer hennings?
[2:51:20]
He's our rep so he's the
[2:51:22]
ombudsman
[2:51:22]
[Inaudible]
[2:51:23]
>> Mayor: we are aware.
[2:51:27]
There is a personal dispute
[2:51:30]
because the winston terrace 100
[2:51:32]
leveraged a large special
[2:51:33]
assessment for structural and
[2:51:35]
other repairs so there's a group
[2:51:37]
of owners in the winston 100 who
[2:51:39]
are very upset about a special
[2:51:40]
assessment and wants to use this
[2:51:43]
forum as an opportunity to
[2:51:45]
discuss it including the
[2:51:46]
PRESIDENT.
[2:51:47]
>> okay, unfortunately, we don't
[2:51:49]
have jurisdiction on the
[2:51:51]
assessments they can levy.
[2:51:52]
>> Mayor: we are aware of the
[2:51:54]
complaint and we are aware of
[2:51:56]
the special assessment and we
[2:51:58]
are aware of the circumstances.
[2:51:59]
So I know there are a couple of
[2:52:02]
other people that would like to
[2:52:05]
speak, including michael kueko
[2:52:06]
which seems to be the leader of
[2:52:07]
this effort.
[2:52:08]
So perhaps he wants to use his
[2:52:10]
three minutes to discusses
[2:52:13]
special assessment as well.
[2:52:15]
But we are well aware of this.
[2:52:18]
Again, I would like to echo
[2:52:20]
commissioner lama's sentiment
[2:52:23]
which is every building in
[2:52:25]
winston towers right now and
[2:52:27]
every building throughout the
[2:52:31]
city is not only contemplating a
[2:52:32]
multi-million dollar special
[2:52:34]
assessment, but is in the middle
[2:52:36]
of it or will have one due to
[2:52:38]
not only recertification
[2:52:44]
requirements, but also four-year
[2:52:45]
50 recertification and the new
[2:52:46]
milestone inspection
[2:52:47]
requirements that are mandated
[2:52:49]
by 4d, the state law.
[2:52:52]
So we are -- even though I know
[2:52:55]
it's concerning for the winston
[2:52:57]
towers 100, please bear in mind
[2:52:58]
that there are buildings
[2:53:01]
throughout this city that
[2:53:02]
people -- in fact, there's
[2:53:03]
another building in this city
[2:53:06]
where each unit owner is now
[2:53:08]
paying 70,000 or $80,000 a unit,
[2:53:11]
just per unit for one special
[2:53:12]
assessment.
[2:53:13]
So while it MAY not be
[2:53:15]
comforting to you, you're not
[2:53:16]
alone because a lot of buildings
[2:53:18]
are facing this very issue of a
[2:53:19]
special assessment.
[2:53:21]
>> I did not talk about our
[2:53:21]
assessment.
[2:53:27]
I only talked about we are upset
[2:53:31]
about that people who make so
[2:53:35]
bad situation for more than for
[2:53:39]
1,000 people.
[2:53:41]
And they were [Inaudible]
[2:53:43]
>> Mayor: I understand.
[2:53:44]
Okay.
[2:53:45]
>> and, of course, of course,
[2:53:47]
this is the city.
[2:53:49]
They destroyed our building.
[2:53:55]
And he got this very, very --
[2:53:57]
how this can be?
[2:53:58]
>> Mayor: I appreciate your
[2:53:58]
comments.
[2:54:01]
But the idea that he destroyed
[2:54:03]
the building I think is -- I'm
[2:54:05]
not sure that -- I'm not sure
[2:54:08]
that that's something that we
[2:54:09]
can really opine on or really,
[2:54:13]
you know, have a discussion
[2:54:13]
about.
[2:54:17]
But I thank you for your
[2:54:18]
comments.
[2:54:20]
Michael kuekovich, would you
[2:54:22]
like to speak?
[2:54:30]
You have three minutes.
[2:54:30]
>> hello, michael.
[2:54:31]
>> hi, guys.
[2:54:33]
Thank you very much for letting
[2:54:34]
me talking to you.
[2:54:35]
Good evening.
[2:54:45]
My name is michael kuekovich in
[2:54:47]
250 74th street, sunny isles
[2:54:47]
beach.
[2:54:51]
I am resident of this building
[2:54:52]
from 2012.
[2:54:54]
And since now the situation in
[2:54:56]
this building has gotten worsen
[2:54:57]
and worsen.
[2:55:01]
For the last three years, the
[2:55:05]
association collected four
[2:55:06]
special assessment $14 million.
[2:55:09]
You know this, okay.
[2:55:14]
They start asking for 12 years
[2:55:18]
that he should provide financial
[2:55:20]
transparency of all the work in
[2:55:21]
the building.
[2:55:22]
No answer.
[2:55:25]
We sent a letter to the office
[2:55:33]
in DECEMBER 2021 with 51 other
[2:55:33]
owners.
[2:55:35]
This same creation after we sent
[2:55:38]
this letter to dppr.
[2:55:41]
All these people, taxpayers for
[2:55:49]
sunny isles beach.
[2:55:50]
MR. Pissolov sued me and two
[2:55:55]
more people for defamation for
[2:55:56]
giving an answer and
[2:55:56]
explanation.
[2:56:01]
I have been contacted to
[2:56:06]
MR. Joseph and dana goldman.
[2:56:08]
I am suffering emotional and
[2:56:10]
financial for 11 months.
[2:56:13]
The association wasting money
[2:56:18]
for our building [Inaudible] For
[2:56:18]
me and the neighbors.
[2:56:22]
And they make paying emotional
[2:56:23]
distress in addition to other
[2:56:28]
people who live in the winston
[2:56:28]
towers.
[2:56:35]
Our building is not --
[2:56:35]
[Inaudible].
[2:56:38]
And I said you have to know
[2:56:41]
everybody, why we coming to you
[2:56:42]
asking for help.
[2:56:49]
I am asking larisa svechin, new
[2:56:51]
elected mayor to help us stop
[2:56:52]
this nuance.
[2:56:53]
>> where is she?
[2:56:55]
Is she here?
[2:56:56]
>> okay.
[2:56:58]
I live give to her.
[2:56:59]
>> maybe she'll watch it on
[2:57:00]
television.
[2:57:00]
>> maybe.
[2:57:01]
>> Mayor: and how would you
[2:57:04]
expect her to help stop the
[2:57:07]
nonsense?
[2:57:09]
>> I don't know.
[2:57:10]
You probably know.
[2:57:13]
>> Mayor: you asked.
[2:57:14]
>> maybe --
[2:57:14]
>> Mayor: you have to help her
[2:57:16]
stop the nonsense.
[2:57:17]
What nonsense are you referring
[2:57:18]
to?
[2:57:21]
The lawsuit?
[2:57:21]
>> yes.
[2:57:24]
>> Mayor: how can she stop the
[2:57:24]
lawsuit?
[2:57:26]
>> well, you have to stop the
[2:57:31]
lawsuit to people, to neighbors
[2:57:32]
when you can put [Inaudible]
[2:57:33]
>> Mayor: you are asking her to
[2:57:35]
stop a lawsuit between you and
[2:57:37]
the association?
[2:57:40]
>> yes, because the association
[2:57:41]
is not only me.
[2:57:46]
It's a lot of people.
[2:57:46]
[Inaudible]
[2:57:47]
>> Mayor: wait a second.
[2:57:49]
Do you really think she can stop
[2:57:50]
the nonsense, that she'll stop
[2:57:54]
the lawsuit between you and the
[2:57:54]
association?
[2:57:56]
>> no, I not think this.
[2:57:57]
>> Mayor: you said I'm asking
[2:57:59]
her to stop the nonsense.
[2:58:01]
>> nonsense, of course.
[2:58:03]
we have to work with these
[2:58:03]
people.
[2:58:05]
Maybe we have to involve an
[2:58:08]
election, election is not
[2:58:08]
correct.
[2:58:11]
We have a lot of issues with the
[2:58:13]
election if we cannot change
[2:58:15]
this board.
[2:58:15]
>> michael.
[2:58:16]
>> yes.
[2:58:19]
>> you stated that I -- yes.
[2:58:20]
>> did not look to assist you.
[2:58:21]
Is that true?
[2:58:24]
Or did I try to help you to
[2:58:27]
mediate your situation?
[2:58:31]
>> I cannot tell you came to the
[2:58:32]
association.
[2:58:36]
You tried but you couldn't.
[2:58:36]
>> right.
[2:58:38]
>> she also tried but couldn't.
[2:58:39]
>> Mayor: how is larisa going to
[2:58:41]
do what the commissioner and
[2:58:43]
mayor couldn't do?
[2:58:45]
>> I don't know why you --
[2:58:47]
>> Mayor: you want her to stop
[2:58:48]
the nonsense.
[2:58:49]
>> it's the association.
[2:58:54]
It's you, jerry, norman and me.
[2:58:54]
>> correct.
[2:58:57]
>> and you lie in front of
[2:59:01]
[Inaudible] And you not stomp at
[2:59:01]
him.
[2:59:02]
>> Mayor: but the point is --
[2:59:05]
>> he never use a credit card.
[2:59:06]
>> Mayor: michael --
[2:59:07]
>> after I use it.
[2:59:08]
>> Mayor: a public official
[2:59:09]
cannot stop the nonsense.
[2:59:11]
This is a dispute between you
[2:59:13]
and the association.
[2:59:15]
So while it's great to use
[2:59:16]
the --
[2:59:17]
>> winston towers is a private
[2:59:18]
building.
[2:59:18]
>> Mayor: this is not something
[2:59:20]
that a public official can just
[2:59:22]
put some fairy dust over.
[2:59:25]
>> we can only intercede out of
[2:59:25]
courtesy.
[2:59:27]
>> Mayor: so I mean you're
[2:59:28]
welcome to ask anybody to stop
[2:59:30]
the nonsense, but in some ways
[2:59:32]
you have to -- this is a private
[2:59:33]
matter.
[2:59:33]
>> yeah, I know.
[2:59:34]
I understand this.
[2:59:37]
But I come in here wondering
[2:59:38]
what the reason is you have to
[2:59:40]
pay attention to this building.
[2:59:46]
The building is a lot of young
[2:59:49]
people
[2:59:51]
you have to explain to people in
[2:59:54]
the building what you're doing.
[2:59:58]
You have to be peaceful.
[3:00:01]
We come in here.
[3:00:01]
Make peace.
[3:00:03]
New commissioner, new mayor.
[3:00:03]
Everybody.
[3:00:04]
>> michael, you --
[3:00:06]
>> you go to building, when you
[3:00:08]
speak -- when you come into
[3:00:08]
building.
[3:00:13]
>> you said there have been four
[3:00:14]
assessments.
[3:00:16]
Have there been repairs to the
[3:00:16]
building at all?
[3:00:17]
>> no.
[3:00:18]
>> zero repairs?
[3:00:19]
>> no.
[3:00:20]
>> just demolition for six
[3:00:23]
months.
[3:00:25]
>> there have been zero repairs
[3:00:27]
with four assessments?
[3:00:28]
Is that true?
[3:00:43]
>> zero repairs.
[3:00:44]
[Inaudible]
[3:00:44]
>> okay.
[3:00:50]
So these assessments are over
[3:00:52]
how many years the four
[3:00:52]
assessments.
[3:00:54]
These four assessments are over
[3:00:55]
how many years?
[3:00:57]
>> three years.
[3:00:58]
So in three years there hasn't
[3:01:03]
been any repairs done?
[3:01:04]
>> no.
[3:01:06]
>> can you speak to the
[3:01:07]
microphone, so we're not
[3:01:09]
speaking from the seats, please.
[3:01:21]
[Inaudible]
[3:01:21]
Name and address.
[3:01:21]
>> my name is ina and I live in
[3:01:21]
towers 100, apartment 1202.
[3:01:21]
I'm living there for more than
[3:01:23]
three years, for three years,
[3:01:26]
they collect four asisments,
[3:01:28]
they always collect for the same
[3:01:29]
problems, swimming pool,
[3:01:31]
elevator and roof.
[3:01:32]
Every time they're collecting
[3:01:34]
the assessments, it means the
[3:01:44]
job was not done, right?
[3:01:44]
Why?
[3:01:46]
>> how old is your building?
[3:01:48]
>> 50 years.
[3:01:51]
>> have the elevators ever been
[3:01:51]
replaced?
[3:01:58]
These are the original
[3:01:58]
elevators?
[3:01:58]
[Inaudible]
[3:01:59]
>> then the county should look
[3:02:06]
at the elevators --
[3:02:08]
>> well, several elevators are
[3:02:09]
out of service already.
[3:02:11]
>> my suggestion would be to
[3:02:14]
contact the district attorney's
[3:02:16]
office, they will be looking
[3:02:20]
into the hoa's and doing an
[3:02:21]
investigation.
[3:02:22]
If they're collecting the money
[3:02:26]
and not doing what they need to
[3:02:28]
be doing, it will be good to
[3:02:30]
contact the district attorney's
[3:02:33]
office, I'm going to give you my
[3:02:35]
information so I can check --
[3:02:37]
>> and you have my card here as
[3:02:37]
well.
[3:02:38]
>> one second, please.
[3:02:41]
If I can put you in contact with
[3:02:42]
them, we're going to try.
[3:02:43]
>> okay.
[3:02:44]
>> but I think --
[3:02:45]
>> I --
[3:02:47]
>> I never heard about this
[3:02:48]
issue before.
[3:02:49]
>> to your point.
[3:02:51]
They have filed multiple -- you
[3:02:54]
have filed multiple claims with
[3:02:57]
the ombudsman, the attorney
[3:03:01]
general, you have made numerous
[3:03:02]
filings, correct?
[3:03:03]
You have made filings?
[3:03:04]
>> yes, yes.
[3:03:06]
We have --
[3:03:07]
>> I'll help you --
[3:03:09]
>> when it comes to the office,
[3:03:10]
they're not giving any
[3:03:11]
documentation, any --
[3:03:12]
>> by law.
[3:03:14]
>> you know by law, they're
[3:03:16]
required to provide you with
[3:03:17]
official records.
[3:03:18]
>> exactly.
[3:03:20]
>> within 10 day as.
[3:03:23]
>> precisely, yeah.
[3:03:24]
>> mayor: I'm not sure again.
[3:03:27]
I haven't evaluated, in my
[3:03:29]
humble opinion, under state law,
[3:03:31]
they're required to furniture
[3:03:33]
the documents, if I had to
[3:03:34]
guess, you have received some
[3:03:35]
documentation.
[3:03:36]
>> they're supposed to have a
[3:03:37]
website with all the
[3:03:38]
information.
[3:03:41]
>> that's true.
[3:03:42]
>> mayor: they're required to
[3:03:43]
have a website.
[3:03:46]
>> no statement of credit card,
[3:03:47]
no statement of --
[3:03:48]
>> there's not an official
[3:03:49]
record.
[3:03:50]
They have to give it to you by
[3:03:51]
law.
[3:03:52]
>> no, no, no.
[3:03:53]
>> they're not giving it to us.
[3:03:56]
>> contracts, financial reports
[3:03:57]
should be on that website by
[3:03:57]
law.
[3:04:02]
>> by law.
[3:04:03]
>> the security --
[3:04:08]
>> just so you know, the state
[3:04:10]
regulates condos, the dvpr.
[3:04:15]
>> the dvpr has original
[3:04:17]
jurisdiction over official
[3:04:17]
records request.
[3:04:20]
If you're requesting a specific
[3:04:21]
record and you file it, and give
[3:04:23]
a certified letter, you give
[3:04:24]
two, you should be able to get
[3:04:25]
those records.
[3:04:28]
So again, I don't know the
[3:04:30]
particulars, but I know you have
[3:04:33]
an absolute right for access to
[3:04:37]
records, right?
[3:04:40]
But the complaint against you
[3:04:42]
for defamation has nothing to do
[3:04:45]
with the official records,
[3:04:45]
correct?
[3:04:47]
>> that's different.
[3:04:47]
[Inaudible]
[3:04:51]
>> mayor: but again, that's
[3:04:53]
something completely separate?
[3:04:56]
Whatever it is, whatever it
[3:04:57]
is --
[3:04:57]
[Inaudible]
[3:04:59]
>> mayor: but whatever it is,
[3:05:01]
it's a separate matter, your
[3:05:04]
access, your access as a unit
[3:05:07]
owner to records is an absolute
[3:05:07]
right.
[3:05:09]
It's completely within your
[3:05:11]
right to get those records, if
[3:05:12]
you don't within 10 days of
[3:05:13]
request, you have recourse.
[3:05:15]
And you're aware of that, and
[3:05:19]
I'm sure you filed with the dvpr
[3:05:20]
for those records, correct?
[3:05:34]
>> no, no, you know what -- they
[3:05:36]
present one woman, they don't
[3:05:39]
let him come into office.
[3:05:41]
Normally they tell people, you
[3:05:44]
let him -- don't let him --
[3:05:46]
>> mayor: because I what?
[3:05:49]
>> you tell him, don't let him
[3:05:50]
come into the office?
[3:05:51]
>> mayor: I said don't let you
[3:05:53]
come into the office?
[3:05:53]
>> to people.
[3:05:56]
This coming to me.
[3:05:57]
>> mayor --
[3:05:58]
>> mayor: I'm sorry.
[3:05:59]
>> mayor, I'm sorry, this is a
[3:06:02]
civil matter, this is a civil
[3:06:04]
matter that doesn't -- we don't
[3:06:05]
have any jurisdiction.
[3:06:07]
We need to move on to the next
[3:06:07]
person.
[3:06:09]
>> why you don't let him come
[3:06:10]
into the office.
[3:06:11]
>> I -- listen.
[3:06:13]
>> let me enjoy -- I'm all
[3:06:16]
the -- the one who doesn't know
[3:06:16]
what your address is, you
[3:06:20]
already know.
[3:06:23]
List ing, guys, I think that in
[3:06:26]
the -- I work with you, I'm
[3:06:28]
you're consultant, so she works
[3:06:32]
in home care agency, and they
[3:06:33]
consult you because I have huge
[3:06:34]
experience.
[3:06:36]
I work with a lot of people that
[3:06:38]
live in this building.
[3:06:40]
A lot of these people don't know
[3:06:42]
what they're doing, they don't
[3:06:43]
understand what they're doing.
[3:06:45]
People take advantage of them,
[3:06:51]
they don't speak very good
[3:06:52]
english.
[3:06:53]
I think they were taken
[3:06:55]
advantage of for years, she
[3:06:58]
said, he said, it should end.
[3:07:00]
You guys should hire an
[3:07:01]
attorney.
[3:07:03]
Donna said, he said, she said.
[3:07:03]
It should stop.
[3:07:05]
You need to get the legal --
[3:07:07]
what you're saying right now,
[3:07:09]
I'm very sorry, that's nonsense,
[3:07:11]
that's just a kindergarten
[3:07:13]
level, I can't listen to that.
[3:07:17]
What does donna have to do with
[3:07:17]
what's --
[3:07:19]
>> ma'am, ma'am, can you all
[3:07:20]
have the discussion outside?
[3:07:21]
>> yes.
[3:07:24]
>> thank you, we need to move
[3:07:24]
on.
[3:07:26]
It's a civil matter.
[3:07:27]
>> mayor: it seems to me you
[3:07:30]
want to pull the city into this
[3:07:31]
drama, and we're not really
[3:07:32]
involved.
[3:07:35]
>> we have no jurisdiction.
[3:07:36]
There is the state --
[3:07:38]
>> michael, what this lady is
[3:07:40]
saying to you is what I've been
[3:07:41]
saying to you.
[3:07:43]
>> they have nothing to do with
[3:07:45]
it, a lot of seniors, you know,
[3:07:48]
it was when they have -- they
[3:07:50]
have problems, they do
[3:07:51]
complaining, what was happening
[3:07:53]
in the 100 building, some
[3:07:55]
something I would never imagine
[3:07:57]
would happen in the united
[3:07:57]
states of america.
[3:08:02]
>> it happens all along 174th, I
[3:08:03]
live in the 300 and we've gone
[3:08:06]
through the same issues.
[3:08:08]
>> concerns about records, but
[3:08:09]
there's --
[3:08:11]
>> michael, call me tomorrow.
[3:08:14]
>> no, we're not -- we have no
[3:08:16]
jurisdictions over hoa's or
[3:08:17]
condos, that's the state.
[3:08:18]
And you need to get an attorney.
[3:08:21]
>> that's correct, nothing.
[3:08:21]
>> I'd like to add something,
[3:08:24]
though.
[3:08:25]
I'd like to add something, I'm
[3:08:26]
in conversations with the
[3:08:27]
county, okay?
[3:08:30]
And the county does have a
[3:08:32]
special program that they're
[3:08:34]
starting where they'll give you
[3:08:37]
a loan so people can pay for
[3:08:39]
their special assessments, okay?
[3:08:40]
I'm gathering the information,
[3:08:42]
so once I gather all the
[3:08:44]
information, I'll make sure our
[3:08:46]
media department, that we post
[3:08:48]
it, and we spread the
[3:08:49]
information, okay?
[3:08:50]
>> but for me it seems like,
[3:08:52]
that's not about special
[3:08:52]
assessment.
[3:08:54]
>> no, well, the other lady
[3:08:56]
talked about special
[3:08:56]
assessments.
[3:08:57]
>> mayor: but it is about a
[3:08:59]
special assessment, because
[3:08:59]
this --
[3:09:00]
>> yeah.
[3:09:01]
>> they said --
[3:09:03]
>> no, but --
[3:09:07]
>> this all started because
[3:09:09]
there was a multimillion dollar
[3:09:11]
special assessment, that's when
[3:09:13]
the whole thing devolved in that
[3:09:13]
building.
[3:09:15]
It completely relates.
[3:09:17]
If there weren't this 14 million
[3:09:19]
or $12 million special
[3:09:20]
assessment, no one would be
[3:09:23]
upset in that building, it all
[3:09:24]
stems from that special
[3:09:25]
assessment.
[3:09:26]
Their questions are, where is
[3:09:30]
the money going, where is the
[3:09:32]
money being spent, nothing is
[3:09:32]
getting done.
[3:09:36]
We don't have access, we don't
[3:09:36]
have transparency.
[3:09:38]
It's all about the special
[3:09:38]
assessment.
[3:09:39]
Again, every building is going
[3:09:41]
through this in the city or is
[3:09:42]
going to be going through this.
[3:09:44]
And now it's gotten personal.
[3:09:46]
>> the problem is, when you have
[3:09:47]
years with no assessments, and
[3:09:50]
then you have to repair the
[3:09:52]
building, that's where the
[3:09:52]
problem --
[3:09:54]
>> can we move on, please.
[3:09:56]
>> mayor: we've given a lot of
[3:09:57]
time and had a lot of
[3:10:01]
discussion, and we want to be
[3:10:03]
empathetic here, but this is
[3:10:06]
something that is a private
[3:10:07]
matter amongst you and your
[3:10:09]
board of directors.
[3:10:12]
And I think you know that the
[3:10:17]
city officials and the city
[3:10:17]
government --
[3:10:18]
[Inaudible]
[3:10:19]
>> mayor: we can't solve that
[3:10:21]
problem, we can only serve as a
[3:10:24]
resource if you have something
[3:10:25]
that, of course, you take it to
[3:10:27]
this agency or that agency.
[3:10:30]
This is not -- we can't fix a
[3:10:33]
special assessment issue, or any
[3:10:36]
individual lawsuits that are
[3:10:36]
happen
[3:10:37]
happening.
[3:10:41]
>> thank you, I just want to
[3:10:46]
say -- I want to thank you,
[3:10:47]
donna -- we enjoyed the last
[3:10:49]
four years, everything was
[3:10:50]
great.
[3:10:51]
Thank you, everybody.
[3:10:54]
>> appreciate it, thank you very
[3:10:54]
much.
[3:10:57]
>> and I don't know who the guy
[3:11:00]
was, was here.
[3:11:04]
Whoever he was, apologize for
[3:11:04]
whoever he was.
[3:11:04]
Thank you.
[3:11:08]
>> thank you.
[3:11:17]
>> mayor: thank you.
[3:11:20]
Now we have olga.
[3:11:21]
>> she just left.
[3:11:24]
>> and derek conswega is the
[3:11:27]
last one.
[3:11:28]
>> no?
[3:11:28]
Okay.
[3:11:30]
Thank you.
[3:11:35]
>> we have george -- we have
[3:11:36]
pablo.
[3:11:37]
Pablo, you're speaking?
[3:11:39]
>> no, sorry about that.
[3:11:42]
>> mayor: then I have george
[3:11:43]
guardmesser.
[3:11:46]
>> welcome back, george.
[3:11:49]
>> thank you, it's good to be
[3:11:51]
back, members of the commission,
[3:11:52]
mayor goldman.
[3:11:55]
I'd like to speak to the heart,
[3:11:56]
on an issue that's been
[3:11:59]
bothering me a couple months,
[3:12:01]
things have gotten steal on this
[3:12:02]
commission.
[3:12:02]
>> steal?
[3:12:03]
>> members of the commission
[3:12:06]
have an ethical obligation to be
[3:12:06]
independent.
[3:12:09]
What we saw in this election is
[3:12:12]
that essentially you're all
[3:12:13]
marionettes of mayor goldman.
[3:12:19]
You campaign for her actively, I
[3:12:24]
got my -- I got spammed with
[3:12:30]
jennifer advice caro
[3:12:31]
vis kar
[3:12:34]
iffer viscarra campaigning
[3:12:40]
for mayor goldman.
[3:12:42]
Right next to the elections
[3:12:42]
locations.
[3:12:44]
>> does that make us puppets,
[3:12:45]
though?
[3:12:47]
>> please, let him punish.
[3:12:49]
>> jerry, for the record, I've
[3:12:51]
told you, a lot of people feel
[3:12:53]
negatively about you, I'm not
[3:12:54]
one of them.
[3:12:55]
I'm neutral about you.
[3:12:58]
My point is, I have a solution.
[3:13:00]
The solution is a recall.
[3:13:01]
What we need is a recall for all
[3:13:05]
the commissioners.
[3:13:07]
I volunteered to work with the
[3:13:08]
city attorney.
[3:13:11]
We only need 1200 signatures, I
[3:13:13]
can collect 100 at starbucks in
[3:13:15]
the mourning in two days, I
[3:13:17]
promise you.
[3:13:19]
I think we need a recall, we
[3:13:22]
need some fresh blood, new ideas
[3:13:24]
here, too many people it feels
[3:13:25]
like, have groaning into their
[3:13:30]
chairs, so to speak.
[3:13:35]
And the solution is a recall.
[3:13:38]
There's an alternative, if every
[3:13:39]
member of the commission
[3:13:41]
resigns, we can skip the recall
[3:13:42]
and just have an election.
[3:13:45]
So out of the goodness of my
[3:13:46]
heart, I'm offering this idea to
[3:13:48]
everyone here, and I hope you
[3:13:49]
will consider it, and vote on
[3:13:50]
it, thank you.
[3:13:52]
>> yeah, thank you, george.
[3:13:53]
Thank you.
[3:13:53]
>> bravo.
[3:13:55]
>> you know, george, I never met
[3:13:57]
you before, so I don't
[3:14:00]
understand how you could tell me
[3:14:04]
basically to resign if you don't
[3:14:04]
know me.
[3:14:05]
We haven't talked -- I invite
[3:14:07]
you to come and talk to me, we
[3:14:11]
have a meeting, so you could
[3:14:13]
have a better opinion of what --
[3:14:14]
of the work we've done here, and
[3:14:16]
speaking from the heart, to be
[3:14:18]
honest with you, I think that
[3:14:21]
this year, that we've been here
[3:14:25]
sitting at the dais with mayor
[3:14:30]
goldman we've kind of unlocked
[3:14:33]
that stale feeling you have,
[3:14:35]
that's why we've been able to
[3:14:37]
hire 10 new police officers,
[3:14:38]
dispatchers, we've been talking
[3:14:40]
about changing the traffic
[3:14:40]
signals.
[3:14:43]
As you can see, there have been
[3:14:44]
changes, positive changes.
[3:14:45]
>> I don't understand --
[3:14:48]
>> hold on, jerry, I'm speaking.
[3:14:49]
We've had committees where we
[3:14:50]
get --
[3:14:52]
>> you're out of time.
[3:14:54]
>> I'm a commissioner I get ten
[3:14:55]
minutes.
[3:14:57]
>> no.
[3:14:59]
>> we have committees where
[3:15:01]
we're doing more outreach to the
[3:15:01]
residents.
[3:15:03]
She was able -- our vice mayor
[3:15:05]
was able to form, which
[3:15:07]
before -- for some reason, it
[3:15:10]
was very stale and it could not
[3:15:13]
happen, she was able to do the
[3:15:15]
residents academy, which whoever
[3:15:16]
attended that can tell you
[3:15:18]
they're grateful.
[3:15:21]
I've been able to form the
[3:15:21]
senior roundtable.
[3:15:24]
There's been a lot of changes
[3:15:27]
that transpired in the last less
[3:15:28]
than a year to be honest with
[3:15:28]
you.
[3:15:30]
I don't know where you get that
[3:15:33]
word stale from, I think that's
[3:15:35]
what happened before, and that's
[3:15:38]
why -- I invite you to with me
[3:15:40]
and maybe you can see the other
[3:15:42]
side of the story, okay?
[3:15:46]
There's always three sides,
[3:15:46]
right?
[3:15:47]
>> perhaps.
[3:15:49]
>> any how, I offer you to sit
[3:15:52]
with me and we can talk, so you
[3:15:53]
can have a better idea, a more
[3:15:56]
complete idea of what has
[3:15:57]
transpired and what's going on.
[3:15:59]
To be honest with you, this is
[3:16:00]
the first time I've seen you
[3:16:01]
here at the commission meeting.
[3:16:03]
I haven't seen you before.
[3:16:04]
>> this is true, this is the
[3:16:05]
first time I've come here.
[3:16:08]
>> maybe if you come more often
[3:16:09]
you would understand better, and
[3:16:11]
we could meet.
[3:16:14]
Have you met with any of the
[3:16:16]
commissioners before?
[3:16:20]
>> fabiola filmed me at the
[3:16:22]
precinct voting.
[3:16:24]
>> you haven't had a one on one
[3:16:26]
conversation talking about
[3:16:27]
subjects and topics?
[3:16:27]
>> no.
[3:16:29]
>> sign up for the academy.
[3:16:32]
>> sign up for the academy.
[3:16:33]
>> it's a pleasure.
[3:16:35]
>> let's talk in the heart, and
[3:16:38]
be truthful to ourselves, so
[3:16:39]
let's meet, okay?
[3:16:40]
>> mayor: you have to come here,
[3:16:45]
when you haven't met any of us.
[3:16:47]
To say we should have a recall.
[3:16:49]
>> I pay your salaries among
[3:16:51]
many others, why should I not
[3:16:54]
have an opinion about the
[3:16:55]
staleness of the --
[3:16:56]
>> no, I disagree with you.
[3:16:58]
>> if I could have one second.
[3:16:58]
>> yeah.
[3:17:02]
>> it occurs to me that many of
[3:17:04]
the people who ran for office
[3:17:07]
and got elected did so under
[3:17:09]
false pretenses.
[3:17:11]
I'm a republican, many of the
[3:17:13]
people pretend to be republicans
[3:17:17]
or give an impression that
[3:17:18]
somehow they share my values
[3:17:20]
when, in fact, it is not the
[3:17:21]
case.
[3:17:23]
Mayor goldman, with all due
[3:17:25]
respect, I see you as a liberal
[3:17:27]
democrat probably to the left of
[3:17:30]
joe biden, probably somewhere
[3:17:30]
around --
[3:17:31]
>> mayor: that's because number
[3:17:33]
one you don't know me, you've
[3:17:35]
never met me, and this is not a
[3:17:37]
partisan board or a partisan
[3:17:37]
race.
[3:17:39]
There should be absolutely no
[3:17:41]
discussion of party affiliation,
[3:17:44]
it has no relevance to city
[3:17:45]
matters and government platters.
[3:17:47]
>> I disagree, but fine.
[3:17:48]
>> one second, one second.
[3:17:51]
>> it's not -- it's
[3:17:52]
absolutely -- it's just -- this
[3:17:54]
is totally off topic.
[3:17:58]
>> as a clarification about the
[3:17:58]
elections.
[3:18:00]
This FEBRUARY, jerry joseph and
[3:18:02]
I myself, this year, we got
[3:18:04]
elected by the people.
[3:18:08]
And in NOVEMBER, alex lama and
[3:18:10]
jeniffer viscarra got elected by
[3:18:11]
the people.
[3:18:12]
We have four commissioners that
[3:18:14]
got elected by the people this
[3:18:14]
year.
[3:18:16]
So talking about fresh blood, I
[3:18:18]
think you need to be a little
[3:18:19]
more informed.
[3:18:22]
And about the video, the day of
[3:18:25]
the elections, I only started
[3:18:26]
recording when you were being
[3:18:29]
very aggressive and
[3:18:31]
disrespectful, using very bad
[3:18:31]
behavior.
[3:18:33]
>> actually, I didn't know who
[3:18:35]
you were at the time.
[3:18:37]
>> language I'm not going to
[3:18:41]
repeat here, because I'm a lady.
[3:18:44]
>> fabiola has a video of me, I
[3:18:46]
don't know if she watches it or
[3:18:47]
pnot, but --
[3:18:49]
>> we need to make a motion to
[3:18:50]
adjourn.
[3:18:51]
>> mayor: thank you.
[3:18:53]
Before we make a motion to
[3:18:54]
adjourn.
[3:18:55]
Thank you for your time.
[3:18:58]
I wanted to make a couple
[3:19:01]
comments that alex lama started.
[3:19:04]
Mayor goldman, thank you for --
[3:19:07]
truly what I believe is a
[3:19:09]
transformative year for this
[3:19:09]
commission.
[3:19:12]
We haven't always agreed, and
[3:19:14]
yet we -- you know, we were able
[3:19:15]
to come together around your
[3:19:17]
policies and I'm very proud of
[3:19:19]
the changes that we've made.
[3:19:20]
>> yes.
[3:19:21]
>> mayor: and I think the city
[3:19:23]
is better off, I think personnel
[3:19:25]
is better off, our police
[3:19:26]
department is certainly better
[3:19:29]
off, we have a new chief, a new
[3:19:29]
mayor.
[3:19:33]
We have -- I mean, we're just
[3:19:34]
better than we've been since I
[3:19:36]
got here four years ago, and
[3:19:37]
probably since before that.
[3:19:38]
But I can't speak for that.
[3:19:42]
>> and not only that, but I
[3:19:42]
hear --
[3:19:43]
>> mayor: give me one second,
[3:19:44]
please, jerry.
[3:19:47]
I just waneded to tell you that,
[3:19:49]
it's been an amazing year.
[3:19:51]
And it's something you should be
[3:19:52]
very proud of.
[3:19:53]
Regardless of what the noise
[3:19:54]
says.
[3:19:55]
I have no intention of
[3:19:57]
resigning, by the way, for those
[3:19:59]
of you wondering.
[3:19:59]
>> yes.
[3:20:01]
>> mayor: and ed, I know, you
[3:20:03]
are -- this is your last
[3:20:05]
meeting, your ready for
[3:20:07]
retirement, congratulations on
[3:20:08]
your retirement.
[3:20:08]
And thank you so much for
[3:20:11]
working with us.
[3:20:14]
>> thank you, ed.
[3:20:15]
>> mayor: and I'll make a
[3:20:19]
motion, unless someone else has
[3:20:19]
something to say.
[3:20:21]
>> I would like to say also, the
[3:20:25]
mayor and myself, we started off
[3:20:27]
the year a little rough around
[3:20:32]
the edges, but I'm happy for how
[3:20:37]
she progressed with her plans
[3:20:39]
for the city, with the underpark
[3:20:44]
and all, and I hope to move that
[3:20:46]
forward.
[3:20:47]
And I thank you.
[3:20:47]
>> mayor: thank you.
[3:20:49]
Thank you, it's been an honor.
[3:20:51]
>> yes, I want to thank you too,
[3:20:52]
mayor goldman.
[3:20:55]
Everyone obviously, I'm a
[3:20:59]
republican and you're a democrat
[3:21:03]
but -- been republican since
[3:21:04]
1989, I haven't switched ever,
[3:21:05]
ever, ever.
[3:21:08]
Any how, it's been great, some
[3:21:10]
of the changes we've been able
[3:21:11]
to make.
[3:21:13]
Thank you, stan for the reports.
[3:21:14]
We never got reports,
[3:21:16]
information was something of a
[3:21:19]
taboo here before, so that was a
[3:21:21]
big change.
[3:21:25]
The transparency, and, you know,
[3:21:27]
the flow of information is key.
[3:21:28]
I think that the more informed
[3:21:30]
you are, the better decisions
[3:21:32]
you can make.
[3:21:36]
And you can make the right
[3:21:37]
decisions and moving forward
[3:21:39]
with some of the things we were
[3:21:44]
able to accomplish, so it's
[3:21:44]
great.
[3:21:46]
A lot of things.
[3:21:48]
And hopefully we'll be able to
[3:21:50]
move forward and continue some
[3:21:52]
of the ideas that you had and
[3:21:53]
that we've discussed before.
[3:21:57]
Thank you very much.
[3:21:59]
We owe you a lot.
[3:22:00]
>> I want to say thank you,
[3:22:03]
thank you for trusting in me and
[3:22:04]
appointing me last year.
[3:22:07]
It's been an honor, a pleasure,
[3:22:09]
a learning experience that isn't
[3:22:12]
going to end.
[3:22:14]
And I look forward for
[3:22:16]
continuous guidance about the
[3:22:17]
future.
[3:22:19]
And I think we are going to MISS
[3:22:20]
You.
[3:22:22]
Having said that, I want to give
[3:22:23]
you --
[3:22:31]
>> yes, and --
[3:22:32]
>> mayor: motion to adjourn.
[3:22:34]
>> I'd like to say I'm proud to
[3:22:37]
be a part of this commission,
[3:22:39]
and everyone who composes it.
[3:22:39]
Yes.
[3:22:41]
>> we're already adjourned.
