[0:09] August meeting of the uh Tory plane board will come to order. Would you
[0:12] please stand? And uh Tony, will you lead us in the pledge, please?
[0:15] » Sure.
[0:19] To the flag, United States of America and to the republic for which it stands.
[0:25] One nation under God, indivisible, with liberty and justice for all.
[0:59] We'll call the role here. Member Scully >> present.
[1:02] » Member Dickinson >> present.
[1:03] » Member Shufeld >> present.
[1:05] » Member York >> present.
[1:07] » Um member Kho. All board members present. Uh we have a quorum of course.
[1:13] So, the first order of business would be to adopt the meeting minutes from the
[1:18] previous meeting, the June meeting of the board. Is there a motion? Has
[1:21] everyone had an opportunity to see them, review them?
[1:24] » Yes. >> Is there a motion?
[1:25] » Yes. I make a motion that we adopt the uh meeting minutes from
[1:31] » June >> 16 was it?
[1:39] » I second. >> Discussion. All in favor say I.
[1:43] » I. >> Post say no. And the motion carries
[1:45] unanimously. Thank you. >> For those of you who are here for the u
[1:54] Lancingberg Gateway project, it's not on the agenda tonight. It's been removed, I
[1:58] believe, at the request of the applicant. Is there anybody who was here
[2:01] for that? If so, we're not will we will not be addressing that at all tonight.
[2:07] Well, the first item uh we will consider is uh PLB 202600485
[2:15] Earl Street.
[2:28] do this. Come back. >> Hi, how are you folks?
[2:36] » No, it's on the bottom.
[2:51] [clears throat] >> Good evening everyone. My name is
[2:52] Courtney Davis. I'm a civil engineer with Labella Associates. I'm joined
[2:55] tonight by Kristen KG with Unity House of Troy and we're here tonight to
[2:58] continue our discussion of the proposed lot line adjustment between Unity houses
[3:03] 185 rail street and 2428 Fth Avenue parcels. So since we were last here,
[3:07] nothing has changed planetrically with proposed lot line adjustment, but we did
[3:11] go before the zoning board and we were able to obtain the three necessary
[3:14] variances for the project. So on our end, those are the only updates we
[3:17] really have. So we'll turn it back over to you all for discussion, questions,
[3:20] and comments. Okay, thank you. >> [clears throat]
[3:26] » So, we have a public hearing, I think. Do you have any questions before we have
[3:30] public hearing? >> I do not.
[3:32] » Defer. Okay. All right. So, thank you. You can have a seat. We'll see if
[3:35] there's any member of the public who wants to comment on this and is there
[3:39] anyone here to comment on this application?
[3:45] If not, we'll close the public hearing and uh Zoom.
[3:49] » Pardon me. >> Zoom.
[3:52] » On Zoom. >> No. Okay.
[3:56] » And open it up to board questions and discussion. So, you may want to come
[4:00] back up. We may have some questions. I'm not sure. Sorry about that. But you
[4:04] exercise is good. Uh, any questions?
[4:10] » Well, again,
[4:13] » stay right there. >> Sorry about that. Okay. Uh, all no
[4:18] questions. All right. Then we'll entertain a motion. Is there
[4:22] » go ahead motion? >> Motion to approve the application.
[4:25] » I'd like to make a motion to approve this application.
[4:28] » I second. >> Any discussion?
[4:32] » I would just like to um wish you good luck with your two nuns and a frier.
[4:36] » Thank you. >> Great. Thank you all.
[4:39] » Good luck. >> Thank you.
[4:41] » Good luck. So, we'll take all in favor uh please say I. I.
[4:45] » Any oppose say no. And motion carries unanimously. Now, good luck.
[4:50] » [laughter]
[4:57] » The next item is uh Andrew uh bricks going to
[5:03] » Sure. Hi. Good good evening. Um a couple administrative items uh that um I've
[5:08] been working on since since I came back on board and it's great to be back. Very
[5:12] excited to be here. Thank you for having me.
[5:14] » Welcome. Happy to have you. Thank you. Um the first is there was an extens
[5:20] there was a request for an extension of time for a pending application uh for PL
[5:25] PB 20260023. It's 1584th Street. It's pork store. Um
[5:32] I believe they're waiting on archaeology. Um and and so they just
[5:36] requested additional time before they time lapsed. Um and they had made that
[5:40] request for last month's meeting which was uh postponed. So, um, they'd be
[5:45] seeking a a resolution from you to grant them a six-month extension.
[5:50] » Right. Is there a motion to that effect? >> I make a motion that we give them their
[5:54] six months extension. The park's >> discussion. All in favor say I.
[6:00] » Oppose say no. >> And the motion carries unanimously.
[6:03] » Cool. And and then the second item um is relates to Eddie's Lane apartment
[6:09] project which you approved in, I believe, late 2025. Mhm.
[6:13] » Um they are currently uh applying for benefits to the city IDA and part of the
[6:20] city IDA application process is uh them providing an a fully completed
[6:26] environmental assessment form. Um when we went to go complete that, we realized
[6:32] that technically when you approved that project, you never approved a secret NEG
[6:37] deck resolution. Um, clearly if you approve a project, you you meant the NE
[6:43] deck. There's there's no question. And all they need is the form completed and
[6:48] signed by city staff. So, I just wanted to confirm with all of you that your
[6:53] intention at the time was to neg it and then we can have Eric sign it and
[6:57] provide it to them so they can move along with the IDA.
[7:00] » So, Andy, do we need a motion to that or just authorization for? to do it as
[7:04] motion, but if we have conf and and that's probably more formal confirmation
[7:08] uh and that way if they have any questions then we can provide the
[7:11] resolution. So yeah, a motion resolution >> motion would be to provide a resolution
[7:17] uh signed by uh Eric. Correct. >> I think it would be a motion to
[7:22] authorize Eric as the city planner to sign the environmental assessment form
[7:27] for the Eddie Lane project. I'd like to make a motion to authorize Eric, our
[7:31] city planner, to sign the seeker form for Eddie's Lane, the Eddie's Lane
[7:36] project. >> I second.
[7:39] » Discussion. >> All in favor say I.
[7:42] » Oppose say no. >> And the motion carries unanimously.
[7:46] » Great. Thank you.
[7:50] » How did we miss that? Next item is PLPB 202260049
[7:56] 272 Kuzix Street. Are the applicants present or representative?
[8:07] » Hello. >> My name is Adam Patella. I'm an
[8:09] architect and one of the design professionals for this project. Uh the
[8:13] freetore project on Husk Street, if you recall, is uh a redevelopment of the
[8:17] former Wraid site on the corner of Bdett and Husk Street. Um, we presented last
[8:22] at the June meeting. Excuse me. There we go. At the June meeting, uh,
[8:28] most of the discussion then was about kind of the operations and the nature of
[8:31] the project itself. Uh, the ver, uh, excuse me, the majority of kind
[8:36] of public comments and comments from you guys, uh, circled around preventing site
[8:41] access during close of business hours, uh, to prevent people from leaving
[8:46] unwanted items and things like that on site. Uh as such we responded by
[8:50] providing a retractable gate along the um Berdett Street entrance and after
[8:56] speaking with the fire department uh they noted that in the event of an
[8:59] emergency they would only use the Berdett entrance. So uh to close off the
[9:03] Hoosi street entrance there'd be a fence would be put across the Hoosi street
[9:07] entrance instead of um we had offered retractable ballards and things like
[9:11] that but the fire department did not want those to be installed. So we'd be
[9:14] providing a fence over there. Did you say then you're just going to close it
[9:17] off completely? >> Yeah, it would be closed off completely.
[9:20] Um the the amount of traffic is not we don't need two entrances for that. Uh
[9:26] there were another there were a number of other items and the staff
[9:28] recommendations that were addressed on the site plan. Uh this included um
[9:32] excuse me this included uh adding bike uh bike
[9:38] racks. Um there was a discussion about kind of the detailed nature of
[9:42] deliveries and when those are happening during our previous discussions. So we
[9:45] took care of that. Uh we provided an updated complete streets form. Um I
[9:50] discussed the nature of the BDET entrance as well. We revised and
[9:53] provided sto uh excuse me snow storage locations. Um, we also had an extensive
[9:59] discussion about the logistics behind um, unwanted items being disposed and
[10:06] how there's kind of someone that will always be managing what is dropped off
[10:09] through appointments and things like that. So, there won't be uh, unwanted or
[10:14] um, large items that would not be able to be disposed of other than just kind
[10:17] of a traditional dumpster. So, no like large couches or anything like that.
[10:21] That was a previous concern. So, we discussed that at the previous meeting.
[10:24] Um we also discussed the gate. Uh there were two items uh related to um the
[10:32] parking lot redevelopment that we sought area variances for. One was uh providing
[10:38] the required number of shade trees on the site and the other one was related
[10:42] to pedestrian circulation in the form of extending the sidewalk um across the
[10:47] berdett street entrance. At last month's ZBA, we presented our case and they
[10:52] granted us area variances for um I believe it's four shade trees and
[10:57] appropriate kind of landscape islands in the parking lot instead of the required
[11:00] 10 trees. And uh we're going to be we got a variance to do striping across the
[11:05] Bdett Street entrance instead of building a new sidewalk there. Um both
[11:10] of those were related to kind of just like feasibility questions.
[11:14] Um there was another note about security cameras. Security cameras are noted on
[11:18] the site plan as well to be installed. >> Well, I'm sorry. Security cameras, what?
[11:22] » They they're noted on the site plan to be installed just kind of as normal
[11:25] operation. >> Um
[11:28] the staff comments for tonight's meeting, um there didn't seem to be any
[11:33] kind of actionable items on our part. Um just notes about the variances that
[11:38] we've previously received
[11:44] and that's all. >> Great. Thank you. Got to clarify. Uh,
[11:48] drop off is going to be by appointment only. Is that correct? Drop off of items
[11:52] for sale. Yes. For the store. And is pickup
[11:57] » Well, shopping is also an appointment related kind of uh thing. So, you you
[12:02] show up, you sign in, you do your shopping, and then you you sign out.
[12:05] » But do they do they make an appointment before they show up to sign up? Yes.
[12:09] » Sign in.
[12:13] » Questions. And what was your days of operation again? Tuesday, Wednesday,
[12:18] Friday, Saturday. Was that
[12:22] » um And during Well, when you're closed, uh you're going to have a gate that goes
[12:27] across the the entrance and be locked. Yeah, the gate would be um
[12:34] locked in such a way that in the event of an emergency would be able to be
[12:36] opened by the fire department, but yeah, it would be closed off so someone can't
[12:40] just drive a truck in and dump a bunch of stuff, which
[12:42] » seemed to be the biggest um >> fear, if that's the right word.
[12:46] » And the entire perimeter is going to be basically fenced when the gates close.
[12:51] » Correct. There's already an existing fence around access though.
[12:56] » No.
[13:05] Oh, and uh we're requesting a three-month window to install these
[13:08] different kind of uh infrastructure pieces um such as the gates and um the
[13:13] the parking improvements as well as part of our uh as a condition of approval for
[13:19] from this case. Maybe you can just >> Yeah, specifically with respect to the
[13:22] gates, uh we estimate it'll take about 3 months to get the gates installed. So we
[13:26] would secure it with a chain initially subject to the obligation to get the
[13:30] gate operational within 3 months. That was reflected on the site plan that went
[13:33] in last month.
[13:38] » Do I understand also that your um dumpster is going to be in the far
[13:45] souththeast corner of your parking? Is that where I saw it? And is that also
[13:51] going to be fenced and locked? >> Uh yep. So, we've got a note to replace
[13:56] andor restore the existing dumpster corral. So, um the dumpster corral would
[14:01] have uh you know a chain link fence with a lock around it.
[14:04] » Okay. And your security cameras will be poised on those too so that we can see
[14:10] the whole sidewalks, driveways,
[14:15] parking area. >> Yes. Okay.
[14:22] » Other questions? Okay, thank you. We'll see what the
[14:27] public has to say. Thank you. Any member of the public here to speak
[14:31] on this application?
[14:41] » Okay. >> Anybody?
[14:46] » No one online, right? Eric and Zoom. >> Yeah. Okay. All right. All right, then
[14:50] we'll close the public hearing and we'll open it up again for public for board
[14:53] comment question. >> Okay,
[14:56] » this question. >> Uh, have you looked into the trespass
[15:01] affidavit program? One thing you want to make sure is
[15:05] Berdetta Avenue is known for a great university. Uh, in May, people leave
[15:10] that great university and tend to get rid of the stuff. Um, so you know,
[15:17] without us incurring more costs to the city to look at your property, have you
[15:22] looked into this program >> at all?
[15:25] » No.
[15:32] » Might be something that you might want to look into. If the [clears throat]
[15:35] community police are there or whatever could be called or happen to be going
[15:40] by, they would have the authority to deal with whatever trespassers or
[15:49] you have might be something. You know, you can coordinate it with a community
[15:53] police if you wanted to. >> Okay.
[15:56] » Um, we also [clears throat] would like to suggest an operation and maintenance
[16:01] plan for the site. um like to know uh provide 247 point of
[16:10] contact
[16:13] in case anything goes wrong, somebody needs to be called.
[16:17] Um are you going to have an alarm system on
[16:21] your building? Will there be an alarm system in the
[16:24] doors or windows or anything?
[16:31] Would
[16:36] you identify yourself please for the record?
[16:38] » Sarah Brillier. Um, we're working with Alex Security right now to come up with
[16:44] a good system. >> Alarm system.
[16:47] » Yes. And and camera system is going to be tied in with that also. And also the
[16:52] gate system will probably be tied in with the alarm system and the camera
[16:55] system. >> That's great.
[16:57] » Thank you. So, would you agree to some of the
[17:03] following conditions if we were to approve tonight? Uh, no outdoor goods
[17:09] displays. >> Yes. Is that a yes?
[17:17] » Yes. >> No outdoor storage of goods?
[17:20] » No. None. >> Gates closed the night to prevent
[17:23] dumping. >> Yes.
[17:27] That would would that be um anytime that you're not open the gates will be
[17:32] closed. Is that correct? Locked. Anytime you're not open for business, the gates
[17:35] will be closed. >> Um
[17:37] » yeah. Yes. >> The the distinction is theoretically in
[17:42] the winter you may be open at night, but the gate would need to be open if you're
[17:47] open. So rather than tying closing the gate at night, closing it closing the
[17:52] gate when you are no longer operating. So when you close the gate closes?
[17:58] » Well, listen. >> Would I be able to leave it open if a
[18:02] snowstorm was coming and needed to be plowed?
[18:08] » Well, whoever's controlling your security won't have the ability to open
[18:12] it for the snow plows. >> I I hope so. I'm still working on that.
[18:17] » We could address that in the operations and maintenance plan.
[18:22] » Describe how that >> Okay. I think it's a the sense of the
[18:26] board that they would like to make sure that it's if you're not there, the gate
[18:31] should be closed. If somebody is there plowing for you, then uh obviously that
[18:36] would be understood. >> I I think it's safe to assume that the
[18:39] site is unattended, the gates would be closed.
[18:42] » Pardon me. >> If the site is unattended, the gates
[18:44] would be closed. >> Good.
[18:47] » I'm sorry. >> Do you have anything further?
[18:52] just that you'd agree to if there are any dump goods, a prompt removal of
[18:57] those goods. >> So, for example, somebody dumps
[19:00] something that you don't feel like it's going to be suitable for whatever you're
[19:05] you're doing with these >> products. Um, you know, it wouldn't just
[19:11] lay around.
[19:15] » We would agree to that. >> People People don't come and dump stuff.
[19:18] That's the whole point is that it's an appointment based thing. So if something
[19:21] is not approved, it would not be left there.
[19:23] » I mean, I could see somebody throwing a couch over the fence. I mean, you know,
[19:27] this is >> I mean, if they're going to throw it
[19:28] over that fence, they'll throw it over any fence, wouldn't they?
[19:31] » But this is the implication is that they think they're donating.
[19:35] » Okay. >> So, if you could just agree to it.
[19:38] » Yes. >> Okay.
[19:40] » Yeah. And you can figure out what you're going to do with all those mattresses
[19:43] and box springs that are be coming over the fence because I'm sure it's going to
[19:47] happen. >> [clears throat]
[19:49] » I think also um for 20 247 point of contact if you're not open on Sunday,
[19:57] Monday,
[20:00] Thursday, someone has to be going by there to make
[20:06] sure that there is nothing that is being dumped.
[20:12] » We can provide that in the operations and management narrative.
[20:17] Okay. And you also will have to be taking care of some some grass, some
[20:24] landscaping. You think you have a bush on the corner or something and you have
[20:29] grass around the around the perimeter on the other side of the sidewalk. So, you
[20:34] need somebody that will be taking care of that.
[20:40] » Yes.
[20:43] that will go into your operation and maintenance plan.
[20:46] » Yes.
[20:51] » I have a question about the uh appointment system. Is it done online or
[20:54] by telephone? >> I uh just got a website up and going and
[21:01] I'm going to provide an online portal. Um I don't know when that'll open up.
[21:07] Until then, it will be by telephone, by phone number that is for the store.
[21:13] » Okay. So you'll be able to track essentially have a log of who's making
[21:18] appointments and you know I guess it would be a way to help not have the
[21:24] issue of people dumping stuff or being at least you'll know who's responsible
[21:28] if you're tracking keeping an appointment tracker so to speak because
[21:33] I think again back to their point people may just dump stuff anyway.
[21:40] So suggestion I guess would be uh once you
[21:45] get that portal up and running um make sure you're able to or at least try to
[21:49] to be able to track who these appointments are. Um that way maybe you
[21:53] can look back and see >> the the appointments would not be
[21:56] anonymous appointments. There would be a name attached to them and we're
[22:01] currently using Oasis insight for that. >> Got it. Okay. Yeah, that's my point.
[22:06] Thank you. Could you I think you've told us this
[22:10] before, but could you just refresh my recollection, what are your days of
[22:13] operation and your hour anticipated hours of operation?
[22:17] » Tuesday and Wednesday, Friday and Saturday
[22:22] for customers and donations will be open from 9:00
[22:26] a.m. to 3 p.m. >> And how will your um donors know that
[22:31] you're accepting donations? >> Because they'll make an appointment.
[22:36] Well, how will they know to make an appointment? Are you going to promote
[22:39] this to the public in some way? I don't >> Um, I don't foresee having to advertise
[22:46] this. A word will get out and we'll probably put it on our website. A phone
[22:53] number will be attached or an email and things are going to evolve because the
[22:58] website's brand new. >> Okay. Thank you.
[23:03] Do you expect that when you do open for the first day, you probably would be
[23:07] fully stocked by then or have lots? >> I um suspect
[23:13] that no, probably not. It will probably be half to 3/4 stocked.
[23:24] » Other questions? Um I I think you had said before that whatever they bring in
[23:29] and you do not accept as a donation that person is responsible for taking it back
[23:36] home with them. Are you going to allow them to dump it?
[23:39] » Um I will not be allowing people to dump. It will be a pre-con conversation
[23:46] of donation that they will understand what is not accepted will leave with
[23:52] them and donations will be accepted upon inspection.
[23:58] » Thank you.
[24:02] » Anything further? No further questions. Any further
[24:05] discussion? Is there a motion?
[24:10] I make a motion to approve this project. >> Is there a second?
[24:16] » Um, we're making a motion to approve this project along with the stipulation
[24:20] that they have to have an operation and maintenance agreement.
[24:24] » Yes, I think the the motion would be to approve this project subject to all of
[24:29] the conditions that they've agreed to here this evening, uh, including the
[24:33] submission of an operation and and management plan uh, to the city. Is
[24:38] there able to you motion? >> Yes.
[24:40] » Yes. >> Second.
[24:42] » Second. >> Discussion. All in favor say I.
[24:46] » I. >> Oppose say no. The motion carries
[24:49] unanimously. Good luck.
[24:51] » Thank you.
[25:03] » Under new business. PLB 2026 0056 100 Gillette Avenue. Is the applicant
[25:11] present or representative? Would you come down please and uh tell us about
[25:15] this?
[25:21] » Well, how about
[25:24] » Hi. Hi. >> Hello. So, I I just have a large um lot
[25:29] of land and I wanted to subdivide about a half acre.
[25:33] » Could you give us your name and address for the applica for the uh record,
[25:37] please? >> Ava Fain's and it's 100 Gillette Avenue
[25:40] here in Troy. >> Okay. Thank you. Go ahead. Is that
[25:45] That's it. >> That's it.
[25:46] » Okay. All right. Uh well, unless the board has any preliminary questions,
[25:52] we'll see if there's any public comment. Anybody? Anybody ever have a question?
[25:57] » We have to see. >> Yeah. What was Before we started
[26:01] talking, you were saying what you wanted to do with this land or
[26:05] » I just want to subdivide and sell off that second lot.
[26:11] » So, have you already done a survey showing us what
[26:15] » I have the survey and I I do want to make sure I I gave you the right one
[26:19] when I dropped off the paper. >> This updated.
[26:21] » This is updated. >> Okay.
[26:23] Eric, do you have this? >> So,
[26:28] » okay. >> But as far as
[26:33] » I know you were looking for some utilities.
[26:35] » Could you speak closer to the mic, please?
[26:36] » I'm sorry. So, um, >> you can take it off there or pull it
[26:39] closer to you. >> Um, I spoke with the surveyor because
[26:45] Eric said he would be able to provide the lines, the water lines and the waist
[26:51] lines. He said, "As a surveyor, I can only survey what I see." He said that if
[26:58] you will have maps, he'll add it to the survey, but other than that, he doesn't
[27:04] know where those lines are. He did mark on the survey where the water is and
[27:09] where the waste cap is. So, I don't know where those maps are. I looked online
[27:16] myself. There is none utility maps as far as those lines.
[27:33] Yeah. >> You You're not going to develop this
[27:38] second lot yourself? >> Not at all.
[27:40] » You're planning to sell it? >> Yes.
[27:43] Just just so surveyors will often locate and and place approximate lines
[27:51] on plans using numerous you know things such as contacting the city asking us
[27:58] for what information we have uh contacting other utility agencies such
[28:05] as Verizon or Spectrum or National Grid >> existing existing util For existing
[28:12] utilities, they'll they'll use various uh manners to approximate the lines,
[28:17] which again, one of the primary ones is reaching out to the city and asking for
[28:21] or >> information. But of course, they can
[28:24] also look at uh structures that are visible during the surveys. You know,
[28:28] » almost any line has cleanouts, valves, manholes, catch basins to help ident,
[28:36] you know, they usually in a in a straight line between the two, right?
[28:40] You would think the city could provide locations for the sewer and the water.
[28:45] » Yeah, but usually the surveyor reaches out and asks us so they can actually
[28:48] place it um not to them >> even. So like uh the surveyor a survey
[28:54] is going to have a stamp to it. So putting you know that stamp on that
[28:58] paper with the location of those utilities in concert with one another.
[29:01] That would be something that would >> I mean as far as the homeowner being
[29:04] able to where the so the surveyor being able to locate where the I mean
[29:11] who does the >> Yeah. I wouldn't put on a homeowner.
[29:14] » No, I'm just saying. You know what I mean? Who's the surveyor's job to
[29:19] contact a city to get a location? >> Yeah. Yeah. The survey is going to use
[29:22] multiple layers in order to create like a final product. Um, maybe this one's
[29:27] just not familiar, but >> Troy actually gave me this surveyor. He
[29:32] came from he was came from Troy because originally I was going to do an ADU, so
[29:38] he was >> excellent.
[29:39] » Given to me. Um, I also understand that the um the zoning was was not correct,
[29:46] the zoning regulations, but um I did look on the site and it's the the oldest
[29:52] one is or the newest one is for 2023. So, is that the most recent regulations
[29:57] you want on the survey? >> Yeah, I think the original uh some of
[30:01] the original paperwork just had information from our old zoning code.
[30:04] » Okay. So, the I can tell them the 2023 is the accurate one. Yes. Okay.
[30:14] » Our questions? No, I don't
[30:20] have any questions for me. No.
[30:26] » Um, for the record, uh, this updated survey differs slightly from the one
[30:30] that was previously provided. Um, >> it's a it's a little less.
[30:35] » Specifically, the square footage >> is about uh 1,00
[30:40] uh
[30:44] oh, right off the top of my head, um, >> 1600 feet, 1600 square feet.
[30:51] » It still produces a conforming lot. It does.
[30:54] » Even with >> I'm sorry.
[30:57] » Even with
[31:03] » the the the the question I think that also needs to be investigated is the
[31:09] survey shows the existing home to be on a septic system. And while the proposed
[31:14] lot number two may be a conforming lot under the zoning code, um I think it's
[31:21] still important for the applicant to show if there is not sewer service
[31:26] available to that lot and there may be sewer service available. We don't know
[31:30] because the utilities aren't shown, then it should show a building envelope with
[31:35] a septic system in place to make sure that it remains a conforming lot.
[31:39] Sometimes the the size of a septic system and and the leech field renders
[31:44] an otherwise conforming lot non-conforming because you can't build
[31:47] the house and the septic. So also another reason why you should seek
[31:52] confirmation on whether or not where the sewer lines are and whether or not this
[31:55] proposed lot would be served by sewer. It would be because when I originally
[31:59] was doing the ADU, um the they came down and they did say
[32:06] that air because that's where I was going to put the ADU on that second lot
[32:09] and they said it it is accessible to the sewer system.
[32:13] » Then I guess that's great news because if your surveyor contacts that
[32:17] department, he'll receive the same information.
[32:19] » All right. So I, you know, I I'm like in the middle with him because, you know, I
[32:24] don't I've never done this and I'm only saying what he said. He only does what's
[32:28] on the visible and >> Yeah. So I think that, you know, that
[32:33] [clears throat] would be in your interest to to get that updated,
[32:36] » right? So So I'm you're you're telling me I I need to tell Mr. Haley to contact
[32:42] the city. >> You know, Mr. Rick's point is is that
[32:45] let's say it was not accessible by uh city water and sewer, right?
[32:50] » And you did have to have a septic, but your soils are no good anywhere on the
[32:54] 20,000 square foot lot. >> Um that would turn into a non-conforming
[32:58] lot. >> Correct.
[32:59] » So, we need to, you know, we need to need to make sure that we see that and
[33:04] it goes into the file with Eric and and then the next meeting when Eric says,
[33:09] "Oh, yeah, we've got that." And >> all right. So, I I need to know what to
[33:12] do next. >> Yeah. because obviously he's not
[33:15] » basically you need your utility overlays on your existing subdivision map.
[33:22] » Yeah, I'm I'm surpris I mean a utility survey is one of the basic things off of
[33:26] a surveyor's menu. I I don't know if there's a miscommunication
[33:32] um at some point because yeah, I think any registered land surveyor knows
[33:38] » he's done this better than I would even know it honestly.
[33:42] just a map, but it's not stamped either. So, like when he goes to file a stamped
[33:47] plan, >> right, right,
[33:49] » those overlays need to be on it. So, utility overlays.
[33:53] » Okay. >> And again, they're not going to be
[33:56] exact, but there's there's certainly a way to do a
[33:59] » first of what's out there subdivision
[34:03] conforming. Hold on. And if he if he notes on the survey
[34:08] that's based upon information provided by others, i.e. the city, that's
[34:12] acceptable as well. Sure. >> Okay.
[34:19] » Okay. So, should we >> Okay.
[34:22] Maybe just stand by. We'll see if any member of the public wants to speak on
[34:25] this. Is there anyone here to speak on this application?
[34:35] Yeah. Uh, we're not getting that on the record.
[34:40] So, and I couldn't hear you either anyway. So, do you want to do you want
[34:44] to come down and speak? Yeah.
[34:52] » My name is Kevin Fantenber. I live 439th Avenue in North Troy. I can give you
[34:57] some names and numbers people that will >> get you straightened out because this I
[35:02] my lack of [laughter]
[35:07] » this poor surveyor is going to bad name and that's [laughter]
[35:12] » sure it's a miscommunication. >> All right. Anybody else want to speak?
[35:19] Okay. Uh we need to do lead agency. >> It's unlisted.
[35:26] » It's it's an unlisted action. Uh you can pass a resolution adopting the
[35:29] recommendation of staff that it be unlisted and you can
[35:33] » so no need >> schedule a public hearing. Uh the
[35:35] application is complete. >> Okay. So we entertain a motion to
[35:38] declare uh accept staff finding that it is an unlisted action.
[35:46] » I second >> motion.
[35:48] » You just made it. I'll make a motion to declare it as an unlisted action under
[35:52] secret. >> Second.
[35:54] » Second >> discussion. All in favor say I.
[35:58] » I. >> Say no.
[36:00] » And the motion carries unanimously. >> Do you think you you'd be able to
[36:05] accomplish this by the next meeting for the new survey?
[36:08] » Um I will call him tomorrow. >> Okay.
[36:12] » So do we schedule a hearing? Are are you going to take an action on uh the
[36:19] » the unlisted action >> like a determination declaration
[36:23] » application completeness? >> Uh no negative declaration there.
[36:29] » You you may want to hold off until you receive the utility information because
[36:33] that may change your opinion. >> The soils are no good.
[36:37] » No, but there we are. So,
[36:41] » so can we we can determine the application complete. Can we not?
[36:45] » Absolutely. >> Motion make a motion to determine that
[36:48] the application is complete. >> I second.
[36:51] » Discussion. All in favor say I. >> I. Oppose say no.
[36:56] » And the motion carries unanimously. Next up is to schedule public hearing.
[37:00] Is that correct? >> Yes. Um I'll make a motion that we
[37:04] schedule the uh public hearing for September 15th. I would I would probably
[37:09] just not sure how readily available uh surveyor is to update everything by
[37:14] Monday, but Monday is the cut off for September. So I I
[37:19] probably would would think that October is more likely when it's
[37:23] » October just say you could schedule September. They
[37:28] can always or >> it can always show next
[37:31] » or use the language of when the applicant is ready to return or
[37:34] something of that nature. Okay. Well, it's up to you. But
[37:39] » well, we can make a motion to set the public hearing for September 15th. And
[37:43] if the information is not in by Monday, you will have to go the following month.
[37:49] Okay. >> And you can just call us and let us know
[37:50] that it's not available, we'll schedule you for October.
[37:54] » Okay. >> Good.
[37:56] » Second. >> I'll second. Discussion.
[38:00] » All in favor say I. >> Post say no.
[38:03] » Motion carries unanimously. So to so to have by Monday the rev
[38:10] revised um so one copy >> the yeah submission requirements for
[38:16] September due Monday. Um I mean if the surveyor is able if the surveyor is able
[38:21] to get it then he could just email it to us and that would be that would be
[38:26] » stamp. >> Okay. Yeah
[38:27] » that would be sufficient. So, um, have a talk with them and, um, if it doesn't
[38:34] work out, we'll have you on for October. >> All right. Very good. And then could I
[38:37] ask you a question about the soil to make it which would make it
[38:42] non-conforming? What do I What how does that apply to me?
[38:47] » No. No. Soil soil wouldn't factor. >> So, so it's not something you have to
[38:53] worry about for the subdivision. Um, but you do have to worry and again this all
[38:58] depends upon whether or not there's sewer access and you indicated that
[39:01] there may be. So, this is a non-issue. >> But because your property is showing as
[39:06] being on septic, >> if the second lot has to be on septic,
[39:11] then the soils have to be conducive to allowing a septic system and be approved
[39:16] by the county department of health. >> Okay?
[39:18] » But that would be subsequent to the subdivision.
[39:20] » Okay? And there would have to be enough room
[39:23] for both the house and the septic system lot. Is is your current septic system
[39:29] all on the what will remain as your lot? >> Yes, it's um north of my house. So the
[39:36] second lot is on the other side of the house.
[39:39] » Okay. Thank you. >> Thank you.
[39:42] » Thank you. >> Thank you. Thank you so much.
[39:44] » Thank you. Next item, uh, PLPB 2026006475
[39:51] Water Plant Road.
[39:57] » Good evening, chair and members of the board. My name is Rob Goldman. I'm chief
[40:01] operating officer for New York State Marine Highway Transportation Company.
[40:05] Um, thank you for the opportunity to present this application. 75 Water Plant
[40:09] Road. By way of background, New York State Marine Highway Transportation is a
[40:14] Troybased marine transportation company founded in 2004. Our business offices
[40:19] are located at 427 River Street. Our maintenance yard and dispatch operations
[40:22] are at 391 Second Avenue. The proposed facility at 75 Water Plant would be
[40:27] supplemental, not replace these locations, and it would be used to
[40:30] provide warehouse space for our marine equipment, parts, and supplies along
[40:34] with limited secure crew parking. project is low impact use of an existing
[40:39] building and developed site. No building expansion, major exterior alteration or
[40:43] significant site development is proposed. Existing footprint and
[40:47] circulation pattern remain unchanged. Pros warehouse use is compatible with
[40:51] the immediate area except for the residents across the street. Properties
[40:54] along water plant road are commercial and municipal.
[40:58] Um we note we realize that a use variance is required. The ZBA review is
[41:02] scheduled for September 2nd next meeting.
[41:06] No new parking spaces or seg grading are proposed. The building will be used
[41:10] primary for storage and not regularly occupied employees. Any limited secure
[41:14] crew parking will be used existing developed areas. Um on my site plan, I
[41:20] showed a security gate, but we have not yet finalized location design. We've
[41:23] only actually been to the site a couple times. We don't we do not own the site
[41:26] yet. Um proposed signage would be replace
[41:30] existing Shriner sign with New York State Marine Highway sign subject to
[41:33] required permits and approvals. uh that is detailed on the um site plan.
[41:40] No new lighting is or landscape is proposed and no bulk liquid storage is
[41:44] proposed also. In summary, the project reactivate an existing building and
[41:48] property without expanding the develop footprint. It supports an established
[41:52] Troy business while avoiding impacts of new construction. We respectfully ask
[41:56] the board to advance the site plan application subject to required use
[41:59] variance. Thank you for your consideration. We're prepared to answer
[42:03] any questions. Any
[42:07] preliminary questions, board? >> Yeah. Um, so
[42:11] you say you're going to put a security gate across with just the driveway
[42:14] » potentially. >> So there's no no fenced in area, no
[42:18] secure area. So that being said, you don't plan on doing any outside storage,
[42:24] no equipment, no strictly for parking. That's it.
[42:27] » Correct. The reason is our at our 391 location, we've had employee vehicles
[42:31] stolen and trailers stolen. We need to find something a little more secure.
[42:37] » So everything will be in inside the building itself.
[42:40] » Mostly except for we have crew change every other week. There are vehicles
[42:44] maybe five vehicles would get parked up there. Got
[42:48] » so no conex boxes. No >> at this time. No.
[42:55] » Have you uh applied for your variance yet? It's on the next meeting. We apply.
[42:59] Yes. Yes. >> Correct.
[43:03] » Yeah. I see it's existing zoning is parks and conservation.
[43:07] » Doesn't make much sense. >> Right.
[43:10] » Yeah. >> I've been on that road.
[43:14] » Everything on the >> There are some geese up there. So,
[43:17] » yes. Yeah. >> But everything in the lo in the is
[43:20] either municipal or business industrial. >> Yeah. Everything else, right?
[43:25] » Yeah.
[43:29] We don't have the bouncy bounce.
[43:34] » So are you're not going to store it's mainly for storage for the things that
[43:38] you use on your tugboats, right? >> Paper towels.
[43:42] » Store paper towels. >> Yeah. Uh engine parts,
[43:47] » right?
[43:53] So looking at the letter uh from DPU
[44:00] requesting a spill prevention plan. Have you discussed that with them?
[44:06] » We have >> or anybody?
[44:09] » We have in place all kinds of we work on the water. We have all kinds of spill
[44:14] plans already. Um but nothing's really there's
[44:17] no bulk uh petroleum products being stored here.
[44:22] No different than a a car, you know, vehicles.
[44:28] » We have hydraulic equipment on the site. >> No,
[44:32] forklift would be indoors, I guess. >> What if we have a forklift?
[44:39] So basically you're saying no outdoor storage of equipment, materials,
[44:43] containers, trailers might have vessels, >> trailers definitely.
[44:49] » What What do you mean? >> A flatbed trailer, equipment trailer,
[44:55] » with a motor or >> we have a we have a two axle trailer.
[45:00] We have a um a empty boat trailer maybe would be there from time to time.
[45:07] Any
[45:12] questions?
[45:16] Well, let's see if the if there's any public comment here, I guess.
[45:25] » Anybody want to comment? Yes. Come on down. Come
[45:34] » again. My My name is Kevin Vandenberg. I live at 439th Avenue, North Troy.
[45:40] I certainly am not against this project and I don't want to stand in the way of
[45:43] anybody running the business, but we all know how these things take a life of
[45:48] their own on it on the exterior. I already heard him say tonight that not
[45:53] at this time when he's talking about conics, trailer storage outside,
[45:57] we're talking about a forklift now. I don't believe there's a garage door on
[46:01] the building, is there? So, you're going to drive a forklift
[46:04] through a doorway. >> Okay.
[46:08] » Door. >> So, I'm more I This is a gateway to the
[46:12] city as far as I'm concerned. It's an entrance point at the north at the
[46:17] furthest north end and probably has one of the nicest views. I think I'm the
[46:21] only guy in Troy that builds houses in North Troy and I still try to want to
[46:25] see North Troy survive. I think there's a lot of missing details on the exterior
[46:31] of what they're going what their intentions are to use the exterior for.
[46:36] The next thing you know, a ConX trailer shows up. Then another one shows up.
[46:41] Then we're putting a roof over the two of them and storing stuff inside. We're
[46:44] stacking stuff on top of things. I think there needs to be a lot more
[46:49] detail about what's going to happen outside this this place and how we're
[46:54] going to handle everything outside. We're already talking about two trailers
[46:59] that that they mentioned nothing in the in the report on that. The exterior, all
[47:04] they're going to do is take one sign down and put a put a gate up and they
[47:08] add an EV charging station. I I I just coming down. There's already a guy
[47:15] across the street from here that's running a masonry business out of it.
[47:19] It's a mess. It is an industrial spot, but there are residences across the
[47:23] street. I just want to see more
[47:27] feet to the fire on what's going to happen exterior. And if there's going to
[47:32] be things like that, there should be screening. There should be a lot a lot
[47:37] of things. There shouldn't be 55gallon drums outside or anything like that. You
[47:42] know, it should be it should be clearly defined what their anticipation is.
[47:51] » Thank you. >> Okay. Thank you, Kevin. Thank you.
[47:54] » Is there anyone else to speak?
[47:59] » Anyone else to speak? >> Comment on what I'm just saying?
[48:03] » All right. So, you want to respond to any of that, sir?
[48:07] » Um, trailers are mobile. It's a two axle trailer that we use to remove, say, we
[48:13] have a propeller, it's got to go to Manhattan or New Jersey for repair. We
[48:17] put it on the trailer and it goes. We don't store any barrels like that at
[48:21] this location. We're not proposing to um it's f it's I don't know it's like 5,000
[48:26] foot building. There's no reason to put anything outside like that.
[48:31] » What is is this to the to the north? Um so here's your site. Can what is the
[48:37] facility to the just to the north? What is that?
[48:40] » City. >> Is that the water
[48:43] » over here? >> Yes.
[48:44] » Yes. >> That's the water part of the water
[48:47] plant. >> Yeah. DPU land. All the buildings along
[48:52] here are either the water plant or Time Warner has a facility,
[48:55] » right? Time Warner, right? >> And we spoke to the woman that has
[49:11] » Can you can you talk to the mic, please? >> Um, I believe it's the one directly
[49:15] across the street we spoke to. We also spoke to Gordy Hughes. He has was in
[49:19] favor of the project also. >> Okay. The one across the street is that
[49:23] Kasowski? >> I don't I don't remember her name.
[49:31] » Any other questions? >> So, I mean like uh to Rob references the
[49:37] indoor storage and and crew parking on the application. Can the uh can Rob
[49:41] confirm can you confirm for the record that no outdoor storage contractor yard
[49:47] container storage equipment layown area or marine equipment staging area is
[49:53] proposed as part of this application. >> I can confirm that we'll have vehicles
[49:58] and trailers. I'm not sure how they fit into those definitions.
[50:03] » We own two trailers. One is a boat trailer and one is a two axle flatbed
[50:08] trailer. Well, I mean that's mobile equipment.
[50:13] So, >> yeah, but it's not fuel oil or grease or
[50:17] there's no no moving parts that going to spill or
[50:27] » he's trying to define the scope of approval so we don't have any issues
[50:31] going forward. You know what I mean?
[50:41] May I say something? >> I'm on Zoom.
[50:46] » Oh, hello. Uh, >> yeah. Yes, Deborah, go ahead. Sorry, I
[50:52] didn't see your hand raised. >> Please identify yourself first, please.
[50:54] And your >> Sure. My name is Deborah Spence and I
[50:59] live right on Second Avenue and I agree with the gentleman. and I think his
[51:04] name's Kevin Vandenberg that everything should be
[51:09] really detailed on the plan or at least as Kevin was saying there should be some
[51:17] definitive because some of the answers didn't seem definitive to me and when I
[51:22] passed by that location their location on Second Avenue I still see equipment
[51:27] outside that I thought was supposed to be behind the barrier
[51:33] » as as opposed to on the side where we all can see it on Second Avenue. So
[51:40] I agree with the the Troy resident as well, Kevin, when he was saying it
[51:45] should be truly clarifi clarified so there aren't any issues going forward if
[51:51] it were to be approved. Thank you. >> Thank you.
[51:57] » Welcome. Anything
[52:02] further from the board? >> Chris, do you have any issues with?
[52:10] » Yeah, I mean I think addressing the uh spill
[52:17] prevention plan is appropriate. whether you know quite frankly I I don't
[52:25] know the level of uh documentation or what needs to be done to address
[52:29] something when your site is upstream of a water treatment plant. Believe they're
[52:36] like directly upstream of the lagoons where I think DPU uses that that's like
[52:41] the discharge of when they're treating the water. So, but it's monitored by DEC
[52:46] and all that because it's a discharge. So that should at least be addressed uh
[52:53] yeah through a spill prevention report which maybe is something that could be
[52:58] pretty simple honestly if it's if it's limited to that amount of equipment um
[53:03] » could be you know points of contact and who to call if uh there is a spill and
[53:08] having you know absorbent or cleanup materials on site or something of that
[53:12] nature but I'd like yeah I'd like to at least see it addressed or responded too.
[53:19] » Well, the I mean the applicant saying that he's not going to store any kind of
[53:23] hazardous chemicals there whether it be I don't know
[53:29] whatever if I could respond to that we'll be
[53:34] happy to provide what you're asking for. >> Thank you.
[53:37] » I already have it in place.
[53:41] » Did Did you see the staff recommendations
[53:44] in this in the report? Do you have issue with any of those?
[53:54] » Yeah, the parking lot condition. We're not even sure we're going to use the
[53:56] parking lot. >> I'm sorry.
[53:58] » The parking lot condition. We don't plan on repaving the parking lot.
[54:03] Uh the existing parking lot will remain in service with no expansion proposed.
[54:07] New MS Marine will continue routine maintenance of the property and restripe
[54:10] faded parking spaces and complete localized repairs or pavement
[54:14] deterioration affects safe site circulation. Full construction of the
[54:17] parking lot in the area is not proposed part of this proposal.
[54:26] » But you would have to provide a snow storage location. Was that
[54:38] » so bra? We're not really changing anything out, correct? You know, to the
[54:43] building. There's no modifications to the building. They're not building a new
[54:46] parking lot. We're not doing any of that. There's no manufacturing
[54:50] activities. >> Um but the biggest thing is the zoning
[54:55] change. >> Correct. Um, and then a lot of these
[54:59] items are, I think, easy for you to comply with at some rights,
[55:04] » correct? >> Um,
[55:06] so your schedule? >> Um, well, we have to close on the
[55:10] building and we're very busy now. We probably wouldn't be occupying it.
[55:13] » Could you get zoning approval before you close on the building?
[55:16] » Hopefully. It's the day before it's supposed to close.
[55:20] » Hopefully. >> All right. So, that's that's where
[55:23] you're at. >> Yes. And and Jim, we're we've only been
[55:26] to the site twice. This is an ongoing developing idea.
[55:30] » Oh, I >> we know we've outgrown our location,
[55:32] » right? >> I mean, I've known you for a really long
[55:36] time. You had a couple boats, >> big ones,
[55:40] » correct? >> Pretty amazing.
[55:43] » So, so that's where you're at. This is kind
[55:46] of fast moving, >> correct?
[55:48] » Um, you're working with Eric. We're going to get the a plan in for the spell
[55:52] just, you know, >> absolutely. You'll have it tomorrow
[55:55] » and then uh and then you're uh already in the agenda for ZBA or now.
[55:59] » Correct. >> You are. Okay.
[56:03] » For next month for September >> September 2nd.
[56:06] » September 2nd. I
[56:08] » I if I may, in relation to your closing date,
[56:15] you may want to consult with your attorney. I don't represent you. I
[56:19] represent the board. But there are ramifications
[56:25] to the use variance test that you have to present to the zoning board
[56:30] based upon whether or not you are the owner of the property.
[56:35] So I would urge you to consult with your attorney as to the timing of seeking the
[56:41] use variance versus closing on the property.
[56:44] » Our closing is the day after the zoning board of appeals.
[56:47] » Then that theoretically could work for you. Yes.
[56:50] » So you when you apply to the zoning board of appeals, you won't be the
[56:54] owner. Correct. Correct. That makes a a big difference.
[56:56] » Yes. Understood. >> Okay.
[56:58] » Great. You're you're already on top of it. Excellent.
[57:04] » Anything further? >> No.
[57:07] » So, uh, we have a motion accepting recognizing
[57:15] this as unlisted action. I'd like to make a motion to declare this an
[57:19] unlisted action under seeker. >> A second.
[57:22] » Discussion. All in favor say I. I. >> Post say no. And the motion carries
[57:27] unanimously.
[57:33] Um I don't think there's any other action. Is that correct? Till after the
[57:38] zone, >> right, he's got to go to ZBA. So
[57:43] um you know I don't know if we could say the application is complete with with
[57:48] that. >> I think uh
[57:50] » that's an unknown. I
[57:52] » think that the engineer do you want to hold off on that
[58:00] » or should we make a recommendation to the ZBA? I mean
[58:05] » your pleasure. So, in terms of determining the
[58:09] application complete, um that that's a a paperwork review
[58:14] process, not do you have all your variances in place. Um but we do have a
[58:20] request from the city engineer for the spill prevention plan. Yeah.
[58:24] » Which the applicant has said that he'll provide.
[58:26] » Um to my mind, I don't think the application would be complete if we have
[58:31] the city engineers office requesting additional information and you don't
[58:34] have it yet. >> I see. So, kind of hyper technicality,
[58:38] but I I I would think you don't you'd want to hold off on declaring it
[58:41] complete until that spill prevention plan is provided.
[58:44] » Okay. >> So, is there any other [clears throat]
[58:48] action on this application at this time? I think not. So, we'll see you back next
[58:54] time. >> Thank you very much for your time.
[58:56] Appreciate it.
[59:00] » Is there any other business to come before the planning board?
[59:04] If not, we'd entertain a motion to adjurnn.
[59:07] » Make a motion to adjurnn. This >> second
[59:10] » discussion. All in favor say I. >> Post say no.
[59:15] » Motion carries. Uh the meeting's adjourned. Thank you folks.
[59:20] That's
