[8:06] of conditional use permits CUP 20265 to allow the rental of small boats and
[8:14] personal watercraft located at 13 or 13885 Lakeshore Drive in Clear Lake,
[8:21] California. Uh, recommended actions would be to adopt the resolution
[8:25] PC202607. Uh staff, will you please proceed with
[8:30] the report?

[8:42] 2020605 for watercraft rentals located at 13885
[8:48] Lakeshore Drive. The name of the business is Clear
[8:53] Cottages and Marina. Just
[8:57] just a quick update on the staff report. Couple of changes here and in addition
[9:02] to the conditions of approval as you can see there on the screen. So project
[9:06] summary and the parking um packet page nine paragraph two uh change
[9:12] approximately seven additional uh vehicles will be changed to as eight
[9:16] additional vehicles. staff actually went out there and did a count and took some
[9:21] pictures and confirmed that it was eight eight vehicles
[9:25] um additional vehicles and what is an area that's um what we could call
[9:30] overflow parking but it's actually striped parking. So
[9:35] then for the conditions of approval um section A general conditions packet page
[9:41] 14 would like to add item eight. Um and I had a discussion with the applicant on
[9:47] this and he signed with it. Um the public watercraft rental operation shall
[9:51] be limited to a maximum of seven simultaneous rental parties during peak
[9:56] period operating operating periods. A rental party shall mean an individual
[10:01] renter or group of renters using utilizing a single rental watercraft
[10:05] under one rental agreement. Reason why we're doing this, this is tied to
[10:09] parking. Okay. This limitation is established based on the maximum proof
[10:13] of rental fleet and that the existing on-site parking supply is adequate to
[10:17] accommodate the approval of an amendment to this conditional use or other
[10:22] entitlement as determined by the director.
[10:28] So let's move on to the location here. Um so everybody I think knows where this
[10:36] is located. It is zone mixed use. Um site size is approximately 2 2.06
[10:44] acres. It's of an existing use with lodging, you know, small marina, and
[10:50] they currently um rent watercrafts
[10:55] to registered guest only. So, this kind of plays into how the rental to the
[11:01] public and how that um determines peak period use.
[11:09] So the applicant is requesting approval of CUP 202605
[11:15] C 20265. It's categorical exempt. We're in a
[11:19] categorically exempt project from this because it is a existing use with no
[11:25] expansion. U the purpose is to allow the rental of
[11:29] small boats and personal watercraft to members of the general public. Now keep
[11:33] in mind this is in conjunction with the existing
[11:38] uh rentals to guest and how that relates to parking. Okay. No new no new
[11:44] construction onsite or or expansion is approved.
[11:48] So they have an existing um lodge with lodge which includes
[11:55] cottage. It's about 18 cottages. Well actually there are 18 cottages. Um
[12:00] they've currently the current owner own has owned it since 2016 and they've been
[12:05] renting only to guest the watercraft since 2017.
[12:10] Uh they're proposing operating hours of 8 a.m. to 6 p.m. for watercraft rentals
[12:14] and they have approximately five employees as stated in their
[12:18] application. No changes proposed to the buildings,
[12:22] docks, slips, parking areas and rental fleet size.
[12:27] So the rental fleet is uh this is what they currently have. Um they have two
[12:34] jet skis, a bassboat and two pontoons and then some kayaks. One is a single
[12:39] person kayak and one is a double person kayak. And actually um in their
[12:46] actual uh well their second proposal to us, we asked them to do an actual um
[12:52] write up on it. They only included in that the um jet skis,
[13:00] um the bass boat and the pontoons, but we went ahead and included the kayaks in
[13:05] there also in terms of um parking as it relates to
[13:11] parking. So this particular slides um as in their
[13:17] application talk about safety requirements
[13:21] doing SE pre-safety rental inspections and they've been doing this for several
[13:25] years now. So renting to their guest so I'm guessing they pretty much have some
[13:30] sense of what they need to do to be compliant. Um California voter card
[13:35] verification. These are all things they're going to be doing. Minimum
[13:38] operated age 21 years. uh liability and waivers in the rental agreements. Um
[13:45] life jackets and they will be doing orientations and
[13:50] competency reviews for those who are renting the the watercraft.
[13:56] Uh they will have GPS tracking devices on the on the um watercraft.
[14:03] Propellar guards obviously that would only be for the pal uh pontoon boats.
[14:10] and the bass boat, the jet skiis typically have an impeller, so um that
[14:16] probably doesn't need a propeller guard. Um
[14:23] uh building things full spill prevention procedures, that was all spelled out in
[14:26] the um the staff report how they would take care of that with sponges.
[14:32] uh invasive species inspections. They pretty much um have that noted all over
[14:38] the property for boats. Um post-rontal inspections and ma
[14:44] maintenance. So this kind um the next slide kind of
[14:49] leads up to kind of the gut of this you know whether this can work or not for
[14:54] them. So existing so there's two parking analysis going on here. Uh lodging. So
[15:00] there's one for lodging. Um so the code requirement they have 18 guests rooms
[15:06] and one manager's unit. So per our code there's one parking space required for
[15:12] each guest cottage plus two additional for every 10. So that's four parking
[15:18] spaces. Then the manager's unit we you know that would be two consider that
[15:24] kind of a dwelling or housing. So two spaces for that. So they would be
[15:28] required to have a total of 24 um existing they have potentially 35. If
[15:35] you're looking at the map there on the screen,
[15:39] the yellow is existing parking spaces that are actually striped. Now the area
[15:45] where you see the red dot, that's kind of hard packed dirt or gravel. And then
[15:51] the red dot there, um I didn't measure the distance across. It's about 62 ft
[15:56] which could accommodate double row parking. Um and in the end rows down by
[16:02] the park they would you know we would it would make sure that that there were
[16:07] some room for back out for the cars on the end down towards the the lake. So
[16:12] with the red dot, there's a potential for six additional vehicles,
[16:17] which aren't striped, but that's just a demonstration to show how potentially
[16:22] you can get up to 41 parking spaces in this particular site. Um,
[16:28] you would have to consider trailers obviously, but I spoke with the um
[16:35] actually the applicant this afternoon uh in terms of how busy they are during the
[16:41] week. They said 50% you know the rooms would be occupied dur
[16:45] over the weekend would be 90%. You would have to consider also that they would
[16:50] get first dibs to the rentals to the guest and then anything that's left over
[16:54] would be for public general public rental.
[17:00] Yeah. Um so um parking seats minimum code. So
[17:05] essentially they exceed parking code based on just
[17:10] the striped parking spaces.
[17:16] Um so here's just the next slide is just a quick watercraft
[17:21] um analysis by staff based on additional parking and what how many parties
[17:31] rental agreement um one bass boat. So you'd have one party, so one vehicle. So
[17:36] that's saying one space for one party, one parking space for one party. Okay.
[17:43] Um, two pontoon boats, two parties. So two
[17:47] vehicle parking spaces, two jet skiis, two vehicle parking spaces. Now, the
[17:51] kayaks, that wasn't actually in their final proposal, but we went ahead and
[17:56] added it anyway. So we would assume two additional parking spaces, so a total of
[18:01] seven parking spaces. um for the watercraft.
[18:08] Next slide is just um there's some pictures. So the first picture is of the
[18:16] we'll call it overflow parking. That's where you would have seven additional
[18:21] plus the potential of six. And then he they also do park trailers there. So,
[18:27] um, that would literally, you know, um, get you up to 41 parking spaces. The
[18:34] next slide is where it doesn't really tell a p tell the story here, but
[18:39] that's where, uh, they launch their boats. So, there's some pull in and
[18:43] backup room in there to launch boats down the ramp. Um, next picture is they
[18:48] have do have two, uh, handicap parking spaces.
[18:54] Um next slide is uh zoning consistency. So this area is again zone mixed use
[19:00] visitor serving um which you know includes housing um
[19:05] commercial I mean this isn't existing it's been there for a long time uh
[19:09] recreational activities. So the main um from analysis standpoint
[19:17] um so expansion only allows public assets to existing rental services.
[19:24] That that's it. I mean we're not doing anything structurally. No more slips no
[19:29] docks not being expanded. Um no physical expansion proposed.
[19:36] So the staff finding is the project is consistent with the intent of the mixed
[19:40] use district.
[19:45] Um so with looking at our code there really is no category of land use that
[19:53] you could fit watercraft in. So staff made the closest and best guess on that
[20:00] which would be other outdoor commercial amusement
[20:04] which that could potentially fit in. And if you actually look at the
[20:11] definition of that it says allincclusive but you're talking about baseball
[20:16] parks. These are really high demand traffic type uses. Baseball
[20:21] um mini golf those sorts of things. So um
[20:28] so with that with that type of use a use permit is required
[20:34] to use appropriately is um a conditional use permit
[20:43] because there's no expansion um staff determined that it would be
[20:48] categorically exempt from SQA
[20:54] And next slide is uh agency review. So these are the
[21:01] agencies we uh sent the application to. We did not get any responses back and we
[21:07] public publicly noticed it you know to the uh neighbors around within 300 ft.
[21:14] So quick summary existing lodging marina use no expansions
[21:19] um staff feels adequate parking and consistence with the mixeduse zoning
[21:24] seek to exempt no agency objections that we have received. Um so um with motions
[21:31] I mean we move to adopt number one move to adopt two move to deny the resolution
[21:37] or send staff with directions to re-evaluate project
[21:44] that concludes presentation

[22:08] comes up. Um part of our job is to imagine worst case scenarios like the
[22:15] overcrowding and stuff like that. And the one obvious thing was the parking.
[22:18] That's why you spent a lot of time with that. How you got to determine that it
[22:21] was adequate. Um but uh if indeed um that street in that area is the overflow
[22:28] parking, are there clearly marked places? Number one, just let me get them
[22:33] all out and then you can answer. Um I have a concern full of a like a car full
[22:37] of people visiting Clear Lake with eight kids in the car deep dear debarking not
[22:43] debarking getting out getting out of their cars um and and and walking out on
[22:48] that. So, it'd be nice if there was some procedure in place that would tell them
[22:52] about that. It sounds like it might, if on a really busy day, require more
[22:57] monitoring. Um, and maybe something specific. Um,
[23:04] yeah. How many street parking spaces? Did you say five additional?
[23:10] » No street parking. This is all on site. >> Okay. So, the overflow is all on site.
[23:14] » There's no street parking. Yeah. seems pretty tight.

[24:19] full-time, the more people that are selling their boats and starting to
[24:22] rent, and I love the fact that the economy is showing the ability to just
[24:26] stay in the rental, and I'm all for this,
[24:28] » but and we we did kind of look at it a peak a peak period. And
[24:33] » you know, I talked to the applicant today. They said they're really 50% full
[24:37] during the week and then on the weekends 90% maybe. And then you'd have guests
[24:41] who were actually renting who would you know.
[24:44] » So yeah, that was what I got. The vigilance should definitely um
[24:49] » definitely apply to the week to the weekends and holidays and peak periods.
[24:53] » Yeah, >> I I don't know. It's maybe over
[24:55] alarming, but it can. We're here to kind of evaluate the worst case scenario. We
[25:00] don't have to deal with the reality that you do. We can imagine anything. So um
[25:06] no, that's pretty much about it. Um, on that, I know that that the one street
[25:12] limit is 72 hours, and I don't think that would apply or be of any kind of
[25:16] concern. That's the only city rule I could find that would affect that.
[25:20] » Yeah. The uh parking code is is geared around off streetet. So, you know, any
[25:26] use, it would be off streetet parking. >> Yeah.
[25:29] » And I don't see anybody staying for three days off street unless their car
[25:32] broke down. So, that was it.

[26:15] And and uh I think the amount of parking that they have in there right now uh
[26:20] depending on how they orient u if they need to to park trailers or anything
[26:26] like that, they got a lot of room there. So um it's a real clean site. I was

[27:26] parking included. So single places. So if you actually have boats in there,
[27:31] trailers in there, it's not going to be 41, right?

[27:46] they if you look in the picture, you can see a few trailers parking there.

[28:10] rental that um you can have even if you have a requirement for only one vehicle

[28:24] we're saying that um and we've spoke to the applicant about that. Um so, per
[28:31] like for instance, if someone wanted to come in and rent the
[28:37] um mass boat, one parking space for the

[28:50] random or >> that's because usually, you know, I get
[28:55] it, but you can't have a if a full family is coming up here, say there's

[29:22] just making sure that that was not knowing where people were going to
[29:25] actually park the other vehicles or anything. U like I said, there's going
[29:29] to probably most likely 100% be more than one vehicle showing up for Pontoon
[29:34] B on occasions. Even if you have the requirement, they'll still be coming
[29:38] into town with more than one vehicle. So, where they parked the other vehicle,
[29:41] I have no idea. That was all all I was saying.

[29:52] thing. I I kind of agree with that and that's why I thought there has to be
[29:56] some kind of procedure in place whether shuttle from Austin Park overflow strict
[30:01] like off off streetet compliance. There will be a time when they when they hit
[30:06] peak and there's going to be three cars showing up for a pontoon boat at the
[30:10] same, you know, that's gonna happen. So, it' be nice if they had procedures in
[30:14] place. So, when people call for the rental, you can give them a sheet that
[30:18] says if there's overflow parking, please park here. Don't bring five vehicles,
[30:22] you get one. I mean, I get told that even when I bring my car in to get work
[30:27] done, you know, I can't park my wife can't just park our other car there. Um,
[30:32] bad analogy, but I mean there are limits to parking spaces. So, I thought perhaps
[30:37] some some simple procedure could avoid that peak problem that Mr. Dandridge was
[30:42] talking about. And I hope I got your name right.

[31:10] public yet, but what I was what I would think is that they're either

[31:20] we would instruct them like so they're probably so they're staying somewhere
[31:24] else. I'd instruct them to come in one car. Um, so they wouldn't be I I don't
[31:30] see that people I guess people could be coming to town just for the day to rent
[31:33] the place and then, you know, have to figure out, you know, where to park, but
[31:36] I think most people are going to be here, you know, either on vacation or
[31:39] living here. I don't know for sure, but that's that's

[31:48] to avoid any chance of overlock on some of those big days, that would seem

[33:02] doing like construction that are staying there for work during the week

[35:05] and typically it's usually fishermen um, uh, coming for a tournament.
[35:13] We may get three. Um, and so there's there's quite a bit of parking there.
[35:20] Our watercraft sit in the slips in all the other slips
[35:25] at the location. Um, and so you know, our guests, uh, and
[35:32] also we're going to set this up on our website.
[35:36] And so we'll have a the same reservation system as we do for our cottages.
[35:44] So when someone wants to book one of our watercraft, one of the locals,
[35:51] um, they're going to be getting information from us in advance. they're
[35:55] going to be told to minimize and carpool. Um, and so we're we're trust me
[36:02] when I tell you it is way to our benefit to ensure that our parking never maxes.
[36:08] Um, we can always park our employees off site. Um, and so we've we're pretty
[36:15] adept at at making sure that cuz we do have people come and rent half our
[36:23] cottages or actually all of our cottages. Um, and so managing through
[36:28] the parking, it's something that Jerome has to do on a on a daily basis. Um,

[37:21] » Mr. Chair, maybe before you get into that, I guess make a couple of comments
[37:24] about I mean, there's a lot of discussion about the parking, which I
[37:27] think >> is appropriate. Um,
[37:31] a couple of things. I mean, we have, um, you know, our parking standards in
[37:37] the zoning ordinance, which are in designed and intended to sort of cover
[37:43] the most likely scenarios for different uses. Um, you know, as an example, just
[37:48] a a u a restaurant, we normally don't um, you know, figure out like what the
[37:56] maximum occupancy is and like how many cars that like if three people show up
[38:01] for one of those tables or whatever, but it's based on that type of use and how
[38:07] many cars that generally generates, right? So, this is a similar type of
[38:11] thing. Um, but the main goal in in my view of the
[38:17] commission is to make sure that this expanded use doesn't cause broader
[38:23] negative impacts to the community around this facility, right? Um, and you know,
[38:30] it would be our hope at you know, similar to the property owners that I'm
[38:33] sure as many days as possible in a year there would be 100% occupancy and
[38:38] parking would be very difficult around there, right? Um
[38:44] however um with the parking standards that we have I mean you know we've
[38:49] permitted them based on that but we that calculation doesn't specifically include
[38:55] um okay we have 18 units what happens if uh the occupants each show up with two
[39:02] cars for each of those units right um that would cause a tight issue but our
[39:08] standards say that each unit has to have one space And then for each 10 units,
[39:13] you have to have an additional space, right? So they have those in an
[39:16] additional four spaces. Correct. Um just for the units and that's not including
[39:24] the overflow parking. So it seems like there would be very few times when
[39:30] parking would be at such a premium on the site
[39:35] um that it would cause some significant
[39:39] conflicts. Now, as the owner kind of alluded to, it's kind of a business
[39:43] problem for them if their operations create that type of problem on site.
[39:49] What I think we care about more is does that then begin to overflow into the
[39:54] community? Are people parking their cars and boat trailers out on the street on a
[39:59] corner where maybe it's not safe? And that's something that we may then um
[40:03] need to get involved in. Um, so you know, uh, I guess one other thing
[40:09] I wanted to point out is essentially the way the conditions are laid out,
[40:14] they are restricted to having the five um
[40:21] um, like motorized watercraft, right? And so
[40:26] they can't suddenly come in next month and add five more because then that is
[40:31] very clearly going to cause a parking problem. However, having said all that,
[40:35] if the commission is still concerned about the parking situation, you could
[40:40] um direct us to add an additional uh question or direct them to provide some
[40:46] uh you know, say a parking overflow parking plan or something like that.
[40:51] Sounds like they've already thought about a number of solutions,
[40:54] but you could um request that that applicant do that and and have it um
[40:59] reviewed and approved by staff. for I mean you could ask that it come back to
[41:03] the commission if you want as well but just wanted to kind of give a little bit
[41:07] of background and throw out a couple of options if you feel like there needs to
[41:11] be more um you know conditions put into place to
[41:16] make sure that it doesn't this problem doesn't overflow into the larger
[41:20] neighborhood. My feeling on that is if indeed you can
[41:26] talk to each person that's going to rent and tell them bring one car or drop
[41:31] somebody off or however you limited that. If that's already part of your
[41:35] practice then I think that question is at least for me is answered.
[41:39] I drive by there all the time. If it isn't answered we'll see. So

[41:53] like I said, I drove down in there and uh um I can't see there being a problem,
[42:00] but if there were, I would I would assume that it would be in the best
[42:05] interest of the people who are on duty there to uh figure out a way to make
[42:10] things as easy as possible for everyone involved. Otherwise, you get a traffic
[42:16] jam, boats coming in, uh trailers coming out, it would be a nightmare. So, I
[42:22] think that they'll probably if they have a problem, they'll address it post

[43:44] it, we'll make sure that you get the the link to that. So, this opens the um
[43:49] initial 45day um comment period on that draft and um
[43:56] we'll be receiving comments hopefully um incorporating those and then at some
[44:02] point hopefully sooner rather than later bringing that to the commission for
[44:06] review. Um we have also considered actually just
[44:11] having a um no recommended action just kind of a public hearing type of thing
[44:17] and doing it here in front of the commission to kind of give an initial
[44:22] presentation to the commission about the project. allow the community to come and
[44:27] get questions answered while there's um uh you know kind of a a first bite at it
[44:34] because you know obviously it's a very lengthy document with a lot of studies
[44:38] and then bring it back for actual hopefully recommended approval at a
[44:43] later time. So um I think that's the the most significant update I had since the
[44:48] last meeting. >> Thank you. question and I know my my
[44:55] colleague Commissioner Counts asked this last week but my boss my wife asked me
[44:59] to ask about writing. Okay. Um I don't remember what I told
[45:04] you last time but we have been coordinating with the owner and working
[45:07] with them and our um retail specialists to try and um help identify some tenants
[45:16] for them. Um, so, you know, I haven't heard any um, you know, deals are in
[45:23] place yet, but we're trying to to push folks towards them and and the owner's
[45:27] been been pretty engaged uh, with us on that. So, he's seems very open to um,
[45:35] you know, doing his best to accommodate something that the community really
