[0:24] >> Good morning everyone hearing for Wednesday September 2nd
[0:28] commencing at 9 a.m..
[0:30] M a special magistrate I'm a special officer
[0:34] at authorized pursuant to state law and City Code
[0:37] chapter 13 my job is to hear your case today,
[0:39] to consider any relevant facts and evidence
[0:41] coming to determine whether or not there was
[0:43] a violation of the city code.
[0:46] Relevant evidence is evidence that tends to prove or disprove
[0:51] a matter.
[0:52] Items that are specifically related
[0:54] to the violation of which you were cited for today
[0:57] and which is being heard today I have subpoena power
[1:00] as to witnesses and evidence and all witnesses will be sworn in
[1:05] and it'll be under oath but formal rules will not apply.
[1:09] The city attorney will present the city's case.
[1:11] You have the right to cross examine anyone who
[1:13] speaks on behalf of the city.
[1:15] You can then present your case.
[1:19] Members of the public are permitted to speak
[1:22] and you can cross-examine anyone who speaks during your case.
[1:27] After all the testimony is completed
[1:28] and the evidence is presented I'll
[1:30] make a finding as to whether or not a violation exists.
[1:33] If I find there is a violation, I
[1:36] will give it time for that violation.
[1:42] I'll also show a daily fine.
[1:45] If the fines ordered are not paid
[1:47] an order setting fine may be recorded
[1:48] in the official public records and it will become
[1:51] a lien on your real property.
[1:52] When your case is called please come up to the podium
[1:55] and state your name for the record,
[1:56] state your relationship or interest in the property,
[1:59] let me know if the violation has already been complied,
[2:01] if you're working towards compliance and need
[2:04] additional time or if there's any other facts you want
[2:08] me to consider in the case.
[2:10] If we can please stand and say the Pledge of Allegiance
[2:12] this morning.
[2:18] I pledge allegiance to the flag of the United States of America
[2:21] and to the Republic for which it stands, one nation under God,
[2:21] indivisible, with liberty and justice for all.
[2:25] thank you.
[2:26] Please stay standing so that you can be sworn in.
[2:35] Thank you.
[2:36] You can be seated.
[2:48] >> Case number 12 on the docket.
[2:50] Okay K 7434 Violation description 187.
[3:03] >> Good morning.
[3:05] I'm the owner of 5837 southwest 118 Avenue
[3:09] in Cooper City Florida.
[3:12] The reason that I'm here today is
[3:15] because I received a citation about a year ago
[3:19] and I was in contact with the city and the police department
[3:23] and they told me not to worry about it that it
[3:26] was going to be left as a Warning,
[3:28] not to touch the trees any more.
[3:30] And then about three weeks later or ago.
[3:33] I received two letters in the mail one certified one regular.
[3:37] Citing me for today.
[3:39] I called the city they told me that I had to show up today
[3:43] there was nothing I could do.
[3:46] I was very confused why I was being cited.
[3:56] And I'm citation issued the amount
[4:01] of $250 you either need to pay the fine
[4:03] or appeal it within ten days.
[4:05] So there's instructions how to handle
[4:06] the actual citation itself at the time it was issued.
[4:09] Someone let the city present and see
[4:11] if there's anything they need to say and we will go from there.
[4:19] >> Code Inspector.
[4:20] She is correct, she was originally
[4:22] cited for improper trimming of the tree,
[4:26] but there was lightning that struck the tree.
[4:29] So, I did change it to a Warning,
[4:32] maybe I forgot to notify miss reason but she is correct,
[4:38] I did tell her that it would be changed
[4:41] due to the tree being taken down by the lightning and not by her.
[4:47] >> Okay.
[4:50] So Brian is any specific procedure
[4:52] because it really should be a Warning
[4:54] and it was a citation issued in the system?
[4:57] As far as me putting in the record
[4:58] that it's changed to a Warning?
[5:01] I haven't given the testimony and it was on the record
[5:05] as far as there's no particular language of it
[5:08] should be a Warning that will dismiss the ticket
[5:10] and consider it a Warning.
[5:12] >> I know typically once the citations written
[5:14] and there's not really a way to withdraw it unless you
[5:17] technically file an appeal or end up entering that it's not.
[5:20] Based on the officer's testimony that it's changed to a Warning
[5:23] we're going to note in the system
[5:24] the case number 7434 is changed to a Warning.
[5:28] Are you going to say something else?
[5:32] >> I was just gonna say also for the record again the Warning
[5:34] being the legal requirement.
[5:35] So as far as the basis for the underlying ticket
[5:39] we know there was an error or a confession of error
[5:42] that we're going to take the appropriate steps.
[5:45] >> So we're going to be dismissing citation 743
[5:47] for noting it as being solely a Warning so there won't be a fine
[5:51] assessed okay?
[5:52] So just note moving forward you know not to touch the tree
[5:56] and do a proper trimming okay?
[5:58] That's all.
[5:59] You're good.
[5:59] Thank you.
[6:02] >> Case number 15 on the docket, case CODE26-302 Jose M
[6:08] Villarreal property address 2900 Zailer Drive violation section
[6:13] 6-9 building permit required cement driveway installed
[6:17] without a permit.
[6:23] >> Good morning please state your name for the record.
[6:25] >> Jose,
[6:26] >> You're the owner?
[6:28] >> Yes Ma'am.
[6:30] >> Okay we will just wait and then we'll have the city present
[6:33] and you can tell me anything you want to let me know if you're
[6:35] >> Good morning magistrate this is just a continuance from
[6:38] the last hearing.
[6:40] The respondent was supposed to comply by this date,
[6:44] I did check with the building department on nine one,
[6:48] there hasn't been a permit applied,
[6:50] I know he's been working with the HOA,
[6:52] but as far as applying for the permit he has not done so.
[6:56] >> Okay so my notes say that you were going to check with the HOA
[6:59] to see whether or not artificial grass or Pebbles are allowed
[7:02] so what did you find out?
[7:04] >> They don't want any of that so we're covering it com I have
[7:07] a letter here from the company that's doing the permitting.
[7:09] They're going to hire somebody.
[7:12] This is from them asking for an extension for 30 days.
[7:16] This is the receipt that I paid them already.
[7:19] >> Who is that and is there a date on it?
[7:23] >> Can I -- >> Show it to the city attorney.
[7:36] >> I have the letter of approval for the HOA to approve finally.
[7:41] It's crazy.
[7:45] And then the document is dated September 1st.
[7:55] >> You entered into a contract for them to do the work?
[7:57] >> Yeah I have a contract it says I paid them it says
[7:59] their license number and I hired them to do all the paperwork.
[8:03] Can I respectfully ask for a 30 day extension
[8:06] to allow sufficient time for the plans
[8:08] to get completed and submitted for the permit?
[8:13] Because they have to look at a survey
[8:16] now and do all the plans and everything.
[8:18] >> Okay.
[8:19] The last time we were still checking information
[8:21] I'm going to give you one more bite at the apple to see
[8:24] before I actually certify.
[8:29] October 2nd is our next hearing.
[8:33] So that's 30 days if your plans are not already in and I
[8:38] don't see this moving along it shouldn't take it forever
[8:41] to at least submit if it's not submitted at least I'm going
[8:46] to certify the fine on October 2nd which is 10 to 26 at 9 a.m..
[8:52] No com October 2nd it's more than 30 days.
[8:56] October 7th is the date of the hearing,
[8:59] and more than 30 days you're getting five days more of.
[9:03] So October 2nd is the hearing.
[9:08] >> Were supposed to have it done by then hopefully.
[9:10] Maybe I'm just to clarify the fines have
[9:12] been running since June so this is just a continuance not
[9:15] an extension.
[9:16] May right so this is I'm not certifying the fine whatever it
[9:19] is the fine you were supposed to comply by June 24th.
[9:22] On June 25th a fine in the amount of $100 per day
[9:26] an administrative fee you already paid on June 9th
[9:30] so the fines are technically started running as of June 25th
[9:33] because it wasn't done.
[9:34] But we have that hearing on that date
[9:36] you can let us know the status then.
[9:39] You can seek to try to reduce the fines depending
[9:42] on what's going on,
[9:53] >> I still have to pay it?
[9:54] >> They're still outstanding there's a process you can apply
[9:56] to do a reduction of the lien, so you don't have that amount
[9:59] of money.
[10:00] You can call Ruth and find out about that process.
[10:03] If you want to do reduction of fine
[10:06] you can have it at that time.
[10:09] But the fine didn't start running $100 a day.
[10:14] >> That's not what I understood.
[10:16] >> But that's what the order was back on June 3rd
[10:18] so we're talking already three months ago.
[10:23] >> It's almost impossible to get a company to do the A permit
[10:25] if they don't do the work but I've got somebody now.
[10:28] >> Right so stay on them to make sure they're doing it and they
[10:31] contact her so you can find out the process so you can come back
[10:34] on October 2nd seventh and ask for a reduction of the fine.
[10:37] The faster you do it the more percentage
[10:40] I can reduce you have a smaller fine.
[10:42] The quicker you do it the better.
[10:43] Okay?
[10:43] So October 7th at 9 a.m..
[10:48] >> Case number 16 on the docket case number Six two 513.
[11:05] No building permit issued.
[11:11] >> What number is this?
[11:13] >> 16.
[12:02] >> New documentation was submitted and corrections needed
[12:04] to be done for this, the fire approved it and plumbing.
[12:14] Fire sprinkler engineering
[12:17] >> Use advisement Clear engineering and who else
[12:19] disapproved?
[12:20] Plumbing.
[12:22] >> They're looking at a plumbing permit also.
[12:29] But fire and engineering disapproved it.
[12:34] So they resubmitted that's what I was told.
[12:38] >> Okay Missy John tell me anything that you want to add.
[12:45] >> We got the permanent 624 then on 819 they asked for correction
[12:47] two months after so we submitted the correction and then we
[12:53] waited.
[12:54] The problem is I've been in this process
[12:57] for almost a year and a half, every time I
[13:01] submit to do the correction we submit
[13:05] the request at their request and when we submit correction
[13:10] they made no correction.
[13:11] So to be honest I don't think it's going to be finished.
[13:17] >> On August 19th they asked you for more corrections did you
[13:19] already submit those?
[13:20] Or not yet?
[13:21] When did you submit the additional corrections?
[13:24] >> It was a week after.
[13:33] >> I mean that's the way the process goes if you don't submit
[13:36] what's required it's going to go back and forth.
[13:39] >> I understand, it's common sense.
[13:43] If I submit some corrections right?
[13:46] And you tell me after those corrections another corrections
[13:51] the ones going to be the end of the process.
[13:53] >> When you get it right.
[13:54] You're going to have to keep going.
[13:55] That's what I'm saying.
[13:57] It's a normal routine.
[13:57] If it's a technical component, even if you make a change
[14:01] it still needs to meet the technical requirements.
[14:03] It's not unusual to have to go back and forth
[14:05] but you need to make sure that you're complying quickly
[14:08] so that they can keep going.
[14:09] >> We do.
[14:10] Every time they ask me for any correction I do
[14:13] and I try to be compliant.
[14:16] I've been hiring Kelvin no lie like maybe 20 engineers.
[14:22] There's a lot of professionals on my case.
[14:24] And to be honest everybody tells me
[14:27] that they don't understand why the process has
[14:30] been taking so long.
[14:32] >> Did you find in your notes when you submitted the last
[14:35] corrections to your knowledge?
[14:36] Let me know what that date is so I can note that.
[14:52] They have a May 19th we submitted the correction.
[14:59] >> That's what he said but they told you then that you needed
[15:01] additional.
[15:04] We submitted was a plan that they wanted that was done
[15:08] but for some reason they don't have it.
[15:10] So we just submitted everything on the same day.
[15:13] >> So you're saying on the same day you replied.
[15:16] >> Yes.
[15:18] And the fire sprinkler was submitted on 624.
[15:25] We have it right he was saying that was disapproved
[15:28] that they still needed changes so you
[15:29] don't know the status is now?
[15:33] >> Yeah they're reviewing all the corrections that they had
[15:36] requested at this time.
[15:41] They don't have any answer yet?
[15:46] >> Not that I'm aware of.
[15:51] I'm calling every day to try to follow up
[15:55] to do it as fast as I can.
[15:58] But it's hard.
[16:01] >> Okay.
[16:02] On your situation back from April is when the fine was
[16:05] already imposed so again it's kind of a similar situation like
[16:08] we talked about before, the fine was already assessed at $100
[16:11] a day starting on May 2nd 2026 until compliance.
[16:16] Is that fine is still accruing your administrative fees shows
[16:20] that was already paid on April 28th 2026 today was the date
[16:24] for the certification of fine hearing,
[16:26] I will still set your doctor for seventh but it's the same
[16:29] situation.
[16:30] If you're still not done and you still don't seek the reduction
[16:33] of find that fine does start accruing as of May 2nd CF fines
[16:36] that are already running and accruing.
[16:38] I'm not going to technically certify it to file it as a lien
[16:41] yet.
[16:41] But come October 7th, you know I know they can't keeps getting
[16:45] pushed down the road and if you're trying to make
[16:47] your attempts to stay on it, and if you do in fact get it done
[16:50] and it's completed then contact Ruth so that you can find out
[16:53] about the process to get that reduction of fine.
[16:55] Because the sooner you comply it the better
[16:57] we can do as far as reduction goes.
[16:59] If it's out of your hands because you're
[17:00] making good attempts I will take that into consideration
[17:02] when I do the reduction of fine okay?
[17:04] But October 7th at 9 a.m.
[17:06] But like I'm saying those fines are still already accruing $100
[17:09] a day starting on May 2nd 2026.
[17:12] All right we will see you back on the seventh hopefully you
[17:15] will be moved along by then.
[17:25] >> Cases number four through 11.
[17:28] If there was anyone else here for the 9 a.m.
[17:32] Other than SPG and Zoltan Connor?
[17:36] Anyone else?
[17:38] No?
[17:38] Okay let's go through if there's anyone else real fast
[17:40] then we'll come back to this.
[17:43] Is there anyone else?
[17:45] SPG is one three.
[17:49] >> Do we want to do SPG everyone's here for that?
[18:02] >> The others are a couple of citations so -- two citations.
[18:05] Let me just do these real fast because these are nothing.
[18:08] I'll just read it case number 137445 this is a citation
[18:12] violation section 18-8 Trey James two Wu Shu and Yong ping,
[18:18] property address 1193 South West 55th Street this was converted
[18:23] to a Warning only so noting for the record that that citation
[18:26] was converted to a Warning only.
[18:28] Case number 14 agenda item number 14 case number 7480 Randy
[18:34] Ortega property just 5048 southwest 92nd terrace violation
[18:38] of 25 Dash ten parking commercial vehicle RVs
[18:41] and boats.
[18:42] Assigned to Lin Duval.
[18:44] Officer Duval?
[18:46] Citation number 7480 anything changed on that citation?
[18:51] >> This case was actually paid.
[18:53] Citation was paid on August 25th.
[18:56] >> Okay we're gonna note for the record that the citation was
[18:59] paid on August 25th 2026, and then the case will be closed.
[19:03] Okay we can go ahead and call.
[19:05] SPG.
[19:10] >> Okay.
[19:13] >> Let him read it all out because there's a whole bunch
[19:15] of.
[19:16] >> I'll put everything into the record.
[19:18] Brian Sherman assistant attorney,
[19:20] I'm going to call a number of cases for SB g Cooper City.
[19:24] They are all generally located in the same property they all
[19:27] have slightly different addresses,
[19:29] they are both on the building docket as well as the code
[19:35] enforcement docket so it's 220077SPG Cooper City 123
[19:41] Southwest third Street for business tax receipt,
[19:45] 220169 at 12260 violation is nine one business Tax Receipt
[19:51] 22-704SPG super Cooper City 123 southwest 53rd Street.
[19:57] This one is for commercial vehicles being parked.
[20:00] And on the building docket understanding the repeat
[20:03] for the 145 hearing is EN230015 for work done without permits.
[20:11] EN0017 for various fire code safety violations,
[20:18] E 250029 Kemp code violations then 129 southwest 53rd Street.
[20:26] The other one earlier was 12323 southwest 55th Street.
[20:31] Unit 1006.
[20:33] Then we have EN2600112240 southwest 53rd Street.
[20:39] For work done without permit.
[20:43] >> One second Brian the only one I don't see in the stipulation
[20:45] or on the docket, you read a case as 0017.
[20:52] And I don't show that on my docket or my stipulation.
[20:57] >> Did I say it wrong?
[21:00] Three seven.
[21:00] My apologies.
[21:01] >> That's okay I just want to make sure we're not reading it
[21:03] wrong.
[21:19] I believe they have their client here also Ed Stacker
[21:21] legal counsel for the tenant in one case on the building
[21:26] code violations is also here.
[21:29] I believe that one is EN0037.
[21:36] So what we have is a global stipulation
[21:39] with SB G Cooper City for the resolution
[21:43] resolution of all these cases.
[21:45] We'll start in code enforcement code enforcement cases are
[21:48] all in compliance we are in the process for submitting
[21:50] for reductions of fine, we then came to a negotiated resolution
[21:54] where under the city code we gave a 90% reduction
[21:57] where applicable, we also gave an additional reduction
[22:02] the first case 220077.
[22:06] We agreed to reduce fine from 108,000 and change to 25000
[22:11] given the nature of the violation so we are agreeing
[22:16] to good cause on that one.
[22:18] >> Not to make you lose your train of thought but I just want
[22:20] to confirm.
[22:21] Because on the stipulation that code case number
[22:24] is different come on the code docket it's case 220077.
[22:28] On the stipulation it says 220777.
[22:34] So is it 0077?
[22:39] >> We will amend that then should be 0077 if anything all
[22:42] men that.
[22:43] That's a clerical error on my part.
[22:46] >> Is fine I'm just going to go ahead and note it and initially
[22:48] on the stipulation.
[22:50] >> I can change it on the official document.
[22:52] That was my error.
[22:54] So that takes care of the code cases.
[22:56] Now understanding there might be some issues between SPG Cooper
[23:00] City and Mr. Stafford's client.
[23:03] This is a global resolution with SPG Cooper City
[23:07] that the city endorses because again the violations are
[23:11] SPG Cooper City.
[23:12] When it comes to the building code violations essentially
[23:16] there are four violations.
[23:19] One is pending fines as of today, the other two,
[23:26] one is compliant.
[23:28] We then agreed to a 75% reduction
[23:30] of that particular fine.
[23:32] 12,000 down to about 7000.
[23:34] And again, the city's fees and costs
[23:37] are added and noted on the stipulated agreement.
[23:39] For each of these particular matters.
[23:44] Now the two pending fines for the building code violations,
[23:47] they roughly amount to as of today $65,000, those $9,100.
[23:53] Part of our global resolution for all of them
[23:55] because we want to bring up all these cases
[23:57] and again we are moving forward with foreclosure
[23:59] with the cases that could be moving forward for understanding
[24:05] that there not all certified but they're on the docket
[24:09] today that's when the resolution comes into play.
[24:11] Those fines are going to be paid in full so we are agreeing
[24:16] to give all three of the pending cases
[24:17] an additional 180 days to comply.
[24:20] For the payment of a total amount of $101,000 to the city.
[24:24] So we are in favor of the agreement,
[24:27] administration has approved the agreement,
[24:29] they want to move forward with the agreement,
[24:32] that Mr. Lockhart say anything if you would like.
[24:37] And I know Mr. Stacker has some additional comments
[24:40] as well so we'll give him the opportunity to speak again
[24:42] he represents one of the >> Okay we'll hear from you first
[24:48] and then I'll make my comments.
[24:55] Good morning good morning Felix the start by visiting SPG
[25:01] my office is at 3250 Northeast First Avenue Miami Florida.
[25:04] We agree with the city attorney on the record we've
[25:08] tried to work with the city to resolve
[25:10] these matters in the last week and a half or so,
[25:16] and I think we've come to a settlement agreement.
[25:19] There is a pending issue which is ongoing
[25:23] on one of the building code cases,
[25:26] and we are working with the tenant
[25:28] and their lawyer at Stacker to resolve the issue.
[25:33] And address at.
[25:35] >> Is that the 25-00371 it still shows open and pending with no
[25:40] fine noting?
[25:43] >> Is the one that's a fire violation.
[25:47] Am I misstated again come unfortunately 250039
[25:51] my apologies.
[25:55] >> Okay that one does show an amount of fine but it's still
[25:58] showing an extended compliance date.
[26:00] There's three that show extended compliance
[26:03] dates until March of 27.
[26:06] Two are showing some partial fine amounts
[26:08] even though they're not complied yet.
[26:12] >> Correct what we're agreeing to is those fines as of today
[26:15] so for payment of those fines in full we are then agreeing to not
[26:19] foreclose and extend the compliance date out six months.
[26:28] We have just some understanding there's one
[26:31] that's showing noncompliance.
[26:34] >> I had some disturbing news I just came to me so my misquotes
[26:37] on the numbers.
[26:38] I apologize.
[26:39] That's fine but on number 37 is not complied still right?
[26:43] So are there no fines showing calculated on that one?
[26:48] Because the others still aren't complied but
[26:51] you're showing fines.
[26:55] >> That one we are continuing because no fines have occurred.
[26:57] If I look correctly at the docket
[26:59] it appears that the fines actually would start this week.
[27:04] >> Okay.
[27:05] The date hasn't come yet.
[27:06] >> Correct the date hasn't come yet.
[27:08] That's why I stated all of them are on there for foreclosure
[27:10] come I acknowledge that there's no certified lien amount.
[27:21] It does start tomorrow, but we do believe the other pending
[27:25] violations should be applied fairly quickly given the one
[27:28] from Mr. Stafford's case which is again for the record
[27:32] and clarification 0039 it's a little bit more complicated,
[27:38] it's basically the installation of fire sprinkler systems
[27:41] so the best of the information we have there's been no permits
[27:44] applied for, but they are trying to find alternative resolutions
[27:48] to the installation of the sprinkler system or issue again
[27:53] as no movement has been made since earlier this year
[27:55] and if they can find an alternative, that's fine.
[27:58] I know they recently engaged Mr. Stacker
[28:00] and we're happy to work with him and I
[28:02] provided all the information to him and the fire Marshal
[28:07] and they can come up with an alternative phenomenal.
[28:11] But at this point something needs to be done.
[28:14] >> Okay.
[28:15] I got it I just wanted clarification
[28:16] as to why those were a little funky.
[28:19] >> Basically the agreement with the city is proposed and we are
[28:23] here to finalize this item and hopefully resolve this and close
[28:28] everything out.
[28:36] 27 and 26-0001 is still getting an extension come you
[28:42] don't anticipate that those are going to be problematic
[28:45] in getting those concluded before that extension time?
[28:49] >> I don't believe so.
[28:50] No.
[28:54] >> Okay if you have anything else to add then let me know
[28:56] and Mr. Stacker if you want to add anything that's fine.
[28:59] And I'll put each of these individually on the record.
[29:12] >> Good morning Your Honor Edgar J Stacker,
[29:14] I'm here on behalf of -- as was indicated the tenant serious
[29:20] Instrument Management services.
[29:25] We have reached out, the operation has been there
[29:30] for a number of years, and to make a long story short
[29:33] we've reached out to the fire Marshal's office actually
[29:41] I think Lori Hastings is here today.
[29:44] But we are engaging the services of fire protection,
[29:48] prevention, engineering, has spoken to the client contact
[29:58] this morning.
[30:00] And he said that they've already spoken
[30:05] and they've got some good alternatives
[30:07] and they'll get plugged in with the fire
[30:09] Marshal's office fairly quickly.
[30:12] We appreciate your consideration of this.
[30:16] >> Right everyone seems to be in agreement in terms
[30:18] of the stipulation I'm going to go ahead and go case by case
[30:21] to note on the record which each one is so that it's entered
[30:24] clearly in the record.
[30:25] And I'm going to go the order of how our docket is.
[30:28] For the first case it's agenda number one case number 220077
[30:32] which is a typo on the stipulation and will be
[30:37] corrected, the particular one is going to be a reduction from
[30:45] $108,500 plus $304 in fees and costs.
[30:54] For case number two, 20169.
[30:59] That is going to be a 95% reduction from the original
[31:02] amount $22,500 and that's going to be reduced to a principal
[31:06] amount of $1,125 plus $304 in fees and costs.
[31:12] For case number three on the docket which is 220704
[31:19] the stipulation is agreeing to a 95% reduction from the original
[31:23] amount of $12,750 to a principal amount of $637 plus $304
[31:30] in costs and fees.
[31:34] And that concludes the items that
[31:37] are on the code enforcement document from purposes
[31:41] and just keeping it clear.
[31:42] I'm going to reference this now but I'll open it again
[31:45] on my building docket I never one on the building docket Z
[31:48] and 230015 because that's not noticed until 9:45 a.m..
[31:52] That case is going to be a 75% reduction from the original
[31:58] principal amount of $14,250 to a new principal amount of $3,562
[32:05] and $0.50 with $304 in fees and costs.
[32:13] Item number 225-0037 is still an active violation that's still
[32:20] continuing to exist and has not yet been complied.
[32:24] We're going to extend the compliance date to March 1st
[32:26] 2027.
[32:27] Item number three on my building docket 2500 three nine is still
[32:36] actively in violation, we're going to extend the compliance
[32:39] date to March 1st of 2027, however as part
[32:42] of the stipulation the fines accrued to date in the amount
[32:46] of $60,500 will be the principal amount to be paid,
[32:50] plus fees and costs of $304.
[32:53] If the violation is not complied actually
[32:56] I should step back on that last one to.
[32:59] If the violation is not complied by March 1st I'm still going
[33:02] to be on 2539 for you.
[33:03] But if the violation is not completed by March 1st 2027,
[33:07] a fine in the amount of $250 per day is going to continue
[33:12] to accrue.
[33:22] As soon as agenda item four on the building docket EN260001,
[33:29] again violation continues to exist we are continuing
[33:32] the compliance date until March 1st 2027.
[33:35] We are continuing the fines have appeared to date.
[33:40] Those fines are to be paid as part of the stipulation.
[33:43] If the violation is not paid by March 1st 2027 finds the amount
[33:49] of $250 will begin to accrue as of March 2nd 2027 so I need
[33:53] to go back to the one prior case where I didn't state --
[34:02] item number two again item two, again if that compliance date is
[34:07] not met on March 1st 2027 finds the amount $250 per day will
[34:11] accrue.
[34:12] Starting on three two.
[34:15] 2027.
[34:16] These reduced fines in this stipulation total $101,000
[34:21] $444.50.
[34:23] That reduced fine amount must be paid within 30 days.
[34:29] If it's not paid in full within 30 days
[34:32] it will revert back to all the original amounts due.
[34:35] And I will approve the stipulation as of today 9226.
[34:45] >> Thank you.
[34:54] This one was signed, change to the code case but on page one
[35:00] if you want to replace that.
[35:01] Brian you're more than welcome to do so it doesn't
[35:03] affect the signature pages.
[35:09] Okay great.
[35:38] We're noting on the record the payment is
[35:40] going to be made today.
[35:43] I just want to check that.
[35:46] >> If I may finish the code docket?
[35:54] The remaining cases are all for resulting Connor.
[36:09] And this is the wrong version of that
[36:13] that's like a faxed version.
[36:32] You can go ahead on Zoltan.
[36:35] >> Thank you Mr. Connor is not present is anyone here
[36:37] for the Connor matters?
[36:39] No one is present we do have the sign stipulated
[36:41] agreement presented to you, I know he's out of the state,
[36:45] we've been in connection, I know I
[36:48] can represent to you Miss Rosenberg that they
[36:49] are in agreement given the signature.
[36:51] Resulting in Connor 25 case number
[36:54] four on the docket 251866.
[36:56] Property address hundred 406 South West 52nd Street,
[37:01] and all the cases 24-236 Zoltan Connor.
[37:05] The first one is for residential maintenance standards,
[37:09] same thing for 6-34A for exterior premises.
[37:13] Next case six on the docket 242622 same address for again
[37:21] exterior maintenance standards.
[37:22] Seven two 732405 for overgrown trees and stagnant pool.
[37:32] Eight on the docket case 6631 as for a misplaced garbage
[37:41] receptacles not being obscured from view.
[37:45] 7367 for excessive undergrowth and accumulation of trash.
[37:49] 7368 for failure to maintain premises.
[37:56] We also put on the docket for number 11 Mr. Connor reached out
[38:03] to us they're selling the property within the next two
[38:07] weeks it was actually going to be done
[38:08] earlier when these came up.
[38:11] At that point we came to this negotiated resolution.
[38:15] The citations are being paid in full
[38:18] we gave the reductions available we
[38:21] agreed to the maximum reductions available under the city code.
[38:27] 50% for one of the violations for roughly about $60,000
[38:31] in settlement of the code enforcement fines,
[38:33] and then the $26,000 utility lien is going to be paid
[38:37] in full.
[38:37] The reason we're also giving 30 days to pay Mr. Connor
[38:40] has said that should be plenty because the closing is
[38:42] going to happen within the next two weeks.
[38:44] They're going to sell the property
[38:45] and pay the city out of the closing.
[38:48] So we would ask that you approve the stipulated agreement
[38:51] to absolve the outstanding matters between the city and Mr.
[38:56] Connor.
[39:00] Okay I'm going to take your representation that Mr.
[39:04] Connor agreed I do see his signature on the proposed
[39:07] stipulation dated August 20th 2026.
[39:09] So despite the fact that the record will show that he's not
[39:12] present, his signature does indicate that he
[39:14] agreed to the stipulation.
[39:15] I'm going to go case by case I have reviewed the stipulation I
[39:18] already did the calculations myself as well for case number
[39:21] four on the code docket 251866, there's
[39:25] going to be a reduction of fines from the principal amount
[39:30] are you listening for this?
[39:35] Hold on one second did the total not add up?
[39:41] Okay.
[39:41] Okay.
[39:45] Did you note it for the record?
[39:48] It's the official number of fines on the docket so case
[39:51] number four is reduced from the principal amount of $1,100 to be
[39:54] reduced to the new principal amount of $110 plus 150
[39:59] administrative fee 54 recording release fees and 100 staff time
[40:03] for a total of $414.
[40:05] In case number five on the docket,
[40:10] citation 242636 it's going to be reduced,
[40:15] let's see the violation was already complied,
[40:17] it says the only amounts that are
[40:19] going to be due is $150 administrative fee
[40:22] and $54 recording fee $100 staff time for a total of $304 due.
[40:27] Case number six on the docket 242622,
[40:32] again, complied, the only amounts that are due
[40:36] are the $150 administrative fee, $54 recording and release fee
[40:41] and $100 staff time for a total of $304.
[40:43] Case number seven on the docket 212405.
[40:51] Principal amount hold on one second.
[40:56] Okay, the principal amount the original lien in the amount
[41:01] of $79,350 is being reduced to $59,512.50 plus $150
[41:10] administrative fee for plus 6250 recording and release fee
[41:14] for a total due of $59,825.
[41:16] Case number eight on the docket 6631.
[41:24] Showing complied and showing $100 fine.
[41:28] $150 administrative fee and $28.50 recording and release
[41:33] for $100 staff time for a total value of $378.50.
[41:38] Item number nine on the code agenda case 7367.
[41:42] A $100 fine, $150 -- this was for a citation.
[41:48] $150 administrative fee 2850 reporting and release fee.
[41:52] $100 staff time for a total due of $378.50.
[41:57] Item number ten on the agenda.
[42:00] Citation 7368.
[42:02] So showing $250 fine $150 administrative fee,
[42:08] $28.50 recording and release fee,
[42:10] $100 staff time for a total of $528.50.
[42:15] The unpaid utility account which showed the amount due for August
[42:19] 19th 2026 excuse me.
[42:26] Is $26,797.94.
[42:29] The total for all of the fines and utilities are showing
[42:37] calculated as $88,930.44.
[42:39] That is manually correcting a typo the calculation
[42:44] on the stipulation.
[42:46] There was a dollar figure showing 88.933.44,
[42:49] so the amount was corrected by hand in the amount
[42:54] of $88,930.44.
[42:56] Those amounts due are to be paid within 30 days
[43:03] of the date of the stipulation.
[43:04] If all of those amounts in the amount of $88,930.44 are not
[43:08] paid in full then all the amounts will revert back
[43:11] to the original figures.
[43:12] I approve the stipulation agreement dated today
[43:15] on September 2nd 2026 as stated on the record by City Attorney
[43:20] and myself.
[43:21] And that will conclude all of the Zoltan Connor cases
[43:25] and I believe that concludes all the code violations right?
[43:30] Okay.
[43:31] Of the code hearings will be concluded as of 951.
[43:34] This morning.
[43:35] So we are closing our code hearings.
[43:38] And then we will proceed to building.
[44:17] Somebody had to change it and I double checked it.
[44:20] So I just initialed it.
[44:22] Just You'll just have to notarize it.
[44:35] Sorry.
[45:12] I'm just looking at signature pages
[45:14] some are fax version so I'm just trying
[45:17] to make sure she has original signatures.
[45:19] Sometimes when you send it for recording they'll send it back.
[45:21] Do you have the original?
[45:24] >> The agreement does say electronic signatures --
[45:26] >> Yeah just depends on who you get it recording.
[45:30] >> Yeah that's also very >> Yeah this came together very quickly.
[45:38] Okay 953 I'm going to call together the Cooper City

[47:56] >> (Indistinct) thank you Mr. Rosenberg.
[47:59] >> Okay number seven.
[48:11] >> 226-0011 Lord Holdings LLC property address 44996 southwest
[48:14] 95 Avenue, violation description Broward County Amendments
[48:18] 2023FBC ET the addition effective date December 31st
[48:24] 2023, section 105 permit section four six of the code adoption
[48:30] of the Florida Building Code which provides that a permit is
[48:33] required, new fencing installed new pergolas installed with new
[48:38] aluminum roofs and sheds installed all without required
[48:42] permits.
[48:43] More permits also required for removal of exterior walls.
[48:49] >> Hi.
[48:49] Please state your name for the record.
[48:52] And what is your relationship to the property?
[48:55] >> Owner.
[48:57] >> Okay.
[48:58] Thank you.
[48:59] If you want to wait just one moment
[49:00] we'll let the city present and then
[49:02] you can tell me anything you need to tell me.
[49:09] >> The violation was posted on April 9th 2026.
[49:11] Plans were received by the admin five 2026
[49:16] he was sent to the plan review on 526
[49:22] and plan review corrections were required on six 1426.
[49:36] Corrections were again required on 723
[49:41] we're currently still waiting for those corrections from 723.
[49:55] Okay what you have to tell me Mr. Miller.
[49:58] >> Good morning madam I understand and acknowledge
[50:01] the violations that were going through on the property.
[50:03] We had a contractor, which I should
[50:06] have known better because I'm a roofing contractor.
[50:08] The gentleman told me it's like a trailer
[50:13] park you could put an awning up it doesn't mean anything
[50:16] it's a pergola on the back of the home
[50:18] we're going to go through proof structures
[50:20] we're going to do six by six posts,
[50:22] we're going to do it all to code compliance,
[50:25] you'll have no issues.
[50:26] The most you'll ever need is a structural engineer
[50:29] to sign off on it.
[50:30] I got a structural engineer to sign off on it,
[50:33] this gentleman over here Ralph came over and explained
[50:35] that I am in violation.
[50:37] And I do need to fix everything.
[50:40] Like I told the permit for the roofing project
[50:42] that we did on the home, I want to pull all these permits
[50:45] and I want to be code compliant.
[50:47] We are going to live here for the rest of our lives,
[50:51] and we love everything about this city.
[50:54] We just ran into an issue with a gentleman
[50:57] that I believe he said we didn't need permits for the pergola.
[51:01] We fixed some fence in the front,
[51:04] I didn't replace the fence, I fixed an area of the fence
[51:08] because it was dropping.
[51:10] I didn't know that I should just fix pickets
[51:15] but I shouldn't replace one section of the fence
[51:18] because it was falling over so I am getting a permit for that.
[51:21] But I ran into a lady at Express Plans
[51:24] and she said she could fix everything for me
[51:27] and she kept bumping me off and bumping me off
[51:31] and then my general contractor that has a license
[51:35] was helping me and he recommended her.
[51:37] But she's really not doing what she's supposed to do.
[51:40] So as of two weeks ago I fired her and I have a new company.
[51:45] That helps me do my permitting when it comes to roofing.
[51:49] She's completing everything for us.
[51:52] My thing is magistrate I would like
[51:54] to just have some more time for me to figure out
[51:57] and fix everything on the property.
[51:59] I would really appreciate that.
[52:01] That favor.
[52:03] Thank you.
[52:08] >> Ralph how many permits in other words if I do October 7th
[52:11] is that really not even giving you enough time for them to be
[52:12] pulling what he needs to do and giving you time to look
[52:14] and review?
[52:20] >> If I heard you correct you said there was one pergola
[52:22] but there's actually two?
[52:22] There's one as the carport and then one is the pergola.
[52:24] >> But they're both considered pergolas.
[52:26] The one on the side of your house and then one I
[52:29] believe on the north side of your house.
[52:31] >> Yes sir and then there's one on the back.
[52:40] >> Both of those have to be permitted.
[52:41] They're all in the front needs to be removed.
[52:43] That's a separate thing.
[52:48] That's why I'm firing this lady because the lady told me
[52:51] I should have said that before I said this.
[52:54] I filled out all the paperwork for the fencing
[52:58] I even got the NOAA numbers the Florida property approved
[53:01] numbers for the property I did all the due diligence on myself.
[53:05] I filled out every permit application that your city has
[53:09] and she has only submitted one of them.
[53:12] I asked her what happened to all of these?
[53:14] And she said we want to fix this one first
[53:16] and I said wouldn't you think it would
[53:17] be better if I went into the city on my violation date
[53:21] that I had corrected at least one
[53:23] and that way the city thinks they don't think I'm
[53:26] not doing anything?
[53:28] >> It sounds like you need four is what I'm hearing.
[53:31] >> But I would have been a lot nicer today if I would have came
[53:33] in with one of them completed.
[53:34] At least the demo permit or something but I
[53:36] signed off on every one that I have
[53:38] I have papers that I signed all this paperwork
[53:41] and she didn't submit them.
[53:43] She said let's fix the first one and then we'll keep on going.
[53:47] So the next time I come into your court,
[53:49] I'm going to have a lot of these permits
[53:55] >> I just want to make sure it's clear there's four total coming
[53:58] back two sheds come on demo permit for the fence,
[54:00] and the shed.
[54:10] >> There's a demo wall up front.
[54:10] There's no reason why she couldn't support all of it
[54:12] at the same time.
[54:13] >> I just want to make sure that he's clear that there's four
[54:16] that he needs not just one.
[54:17] >> Yes because I filled out four applications,
[54:19] she had me fill everything out but she didn't submit them.
[54:23] She only submitted one.
[54:24] So now this new lady Rebecca Pastrana
[54:27] she's going to submit everything at once.
[54:30] >> Okay what I'm going to do is extend you to the November 4th
[54:33] date so it's giving you two months to get it hopefully
[54:35] you'll already be moved along you'll have some of this already
[54:38] complied before you even get to this date but it's giving you
[54:40] time because you've got four that you're going to go through
[54:42] and you may need revisions back and forth so I want to see that
[54:45] the work is done and hopefully you're moved along.
[54:47] So just know that you have four, it's going to be reset
[54:50] to November 4th, which is a Wednesday at 9:45 a.m..
[54:54] And if I don't see movements in filings or whatnot
[54:58] then I will start to assess fines per day as of that date.
[55:01] So I'm giving you until November 4th at 9:45 p.m.
[55:04] I can like you said, four permits
[55:07] are what are necessary so make sure that
[55:09] gets submitted get the ball rolling
[55:10] and get that work done okay?
[55:13] >> Thank you so much.
[55:14] I appreciate it.
[55:27] >> number eight on the case number EN260015.
[55:29] Avila insurance court, property address 9710 Sterling Road.
[55:35] Space number 104 and 105.
[55:40] Violation description Broward County Amendments to the 2023
[55:44] FPC eighth edition Effective Date December 31st 2023.
[55:48] Section 105 permits, section 6-4 of the code entitled adoption
[55:53] of the Florida Building Code which provides that a permit is
[55:56] required for interior renovations completed without
[55:59] the required approved plans documents or required permits.
[56:03] The last interior renovation permit was in 2004,
[56:07] the layout has been changed doors converted from wood
[56:11] to glass etc.
[56:13] Possible mechanical electrical work completed as well
[56:15] with new layout.
[56:17] >> Good morning.
[56:18] >> Good morning.
[56:19] Please state your name for the record.
[56:21] >> My name is Adrian >> do you spell your name?
[56:29] CHIRINOS.
[56:29] >> Okay and what is your relationship to the property
[56:32] Adrian?
[56:33] >> I'm the owner of the property.
[56:35] >> Okay and who do you have with you?
[56:37] >> I have a general contractor.
[56:40] >> Good morning I'm a general contractor.
[56:43] >> How do you spell your >> Helena HELNA last name is
[56:51] NEFIODOW.
[56:59] >> Okay hold one second we'll have the city present and then
[57:01] you can tell me.
[57:02] >> Went out for an inspection on June 18th and I noticed all
[57:05] the renovations that were done on this space.
[57:07] They had just taken possession prior to that.
[57:11] The layout was reconfigured, all new glass walls were put up,
[57:17] glass doors, there might have been
[57:20] some electrical and mechanical.
[57:21] So I could not do the letter.
[57:27] Right now they're in the space because it's not
[57:34] issued because the alterations need permits.
[57:45] >> Okay.
[57:46] And they haven't filed any types of permits or anything yet?
[57:48] >> As of this morning I have not received anything.
[57:58] Your honor I don't know how to say it, I'm a Spanish speaker.
[58:04] Sorry come I'm kind of nervous.
[58:06] Thank you as soon as he hired me I sent him a letter,
[58:15] I have you here.
[58:17] Okay?
[58:18] Notifying him that I was hired to fix the violation okay?
[58:22] Also come we are working with the architectural office they're
[58:27] finishing the draw it takes time.
[58:31] There's electricity, we need the electricity plans
[58:34] mechanical was not touched.
[58:40] And in here while the architects are working
[58:44] I'm also working with Association who asks me
[58:47] one month for the approval letter before pulling the permit
[58:50] I have to have the association approval.
[58:52] Is going to take me one month from the association okay?
[58:57] The architect gave me the electrical plan.
[59:02] Meanwhile not only working I'm also
[59:09] working with the notice of commencement
[59:11] I'm pulling the permits I'm trying to do everything
[59:13] at the same time as fast as I can,
[59:18] I call here to the city to expedite
[59:21] and they say they don't expedite.
[59:30] I got put all the documents together to pull the permit.
[59:39] >> Have you started the process?
[59:40] >> I'm showing you.
[59:40] I have the building application come on but I also
[59:43] submitted to the association.
[59:49] I'm trying to say that I'm working
[59:50] with the architect the association myself we're all
[59:52] working together but it's going to take time
[59:54] while they pull the permit because it doesn't depend on me.
[59:57] It depends on other people okay?
[1:00:00] >> But you said August was when you first wrote the letter.
[1:00:11] >> You said it's going to take a month, you already asked them,
[1:00:14] but you can't submit to them until you have the architectural
[1:00:16] right?
[1:00:24] In order to get the approval letter from the HOA
[1:00:27] you have to get the architect's drawings first?
[1:00:38] I just gave him the plan because the client has it okay?
[1:00:41] I hope with this, they can review
[1:00:47] try to go forward a little bit.
[1:00:49] I'm trying to go fast.
[1:00:50] >> Let me ask you one thing she said she's doing electrical,
[1:00:52] you don't know if she needs more than that?
[1:00:55] You don't really know everything that's in there right?
[1:00:58] >> I know the back corner of the office was reconfigured.
[1:01:01] That's why new electrical needs to be done.
[1:01:05] >> She said no but you don't know.
[1:01:08] >> If that's the case then I'm okay with that.
[1:01:11] >> I just want to know if there's more she needs to do
[1:01:15] then you can tell her up front.
[1:01:16] >> When I get the plans I'll start doing inspections.
[1:01:19] >> Okay so he'll let you know if there's more you need to do
[1:01:22] right now I'll reset you to October 2nd at 945 --
[1:01:25] October 7th.
[1:01:25] Hopefully you'll be moved along you'll have your plan submitted
[1:01:28] and you'll at least be going back and forth with conditions
[1:01:30] and then we'll check the status then and see what's going on
[1:01:33] hopefully you can show me that you're moving along so hopefully
[1:01:36] I don't have to start assessing fines at that time.
[1:01:38] So October 7th 2026 at 9:45 a.m.
[1:01:41] We're set let me know the status just try to stay on
[1:01:43] them keep contacting them obviously
[1:01:45] you know if you let them go they're going to take the time
[1:01:47] to come up but if you stay on them
[1:01:48] the squeaky wheel gets the oil right?
[1:02:00] >> Thank you.
[1:02:01] Thank you very much.
[1:02:04] Is anyone else here for the 9:45 a.m.
[1:02:06] That's not for reduction of fines?
[1:02:09] You're here not for reduction of fine?
[1:02:13] What's your name?
[1:02:21] Okay come if you want to go ahead and come up then.
[1:02:26] Number six.
[1:02:26] If you want to go ahead and read that?
[1:02:28] Number six on the docket case number EN26-0010.
[1:02:32] G and G bright Properties LLC.
[1:02:38] Property address 9620 Stirling Road number 109.
[1:02:46] Violation description Broward County Amendments 23FBC eighth
[1:02:50] edition effective date December 31st 2023,
[1:02:54] section 105 permit section 6-4 of the code entitled Adoption
[1:03:00] of Florida Building Code which provides that a permit is
[1:03:03] required for notice of unpermitted work and required
[1:03:07] compliance.
[1:03:08] >> Please state your name for the record.
[1:03:10] >> Sure Javier Medina?
[1:03:13] >> And you're the property manager correct?
[1:03:15] >> Correct yes Ma'am.
[1:03:16] >> Okay hold on one moment let's hear from the city and then you
[1:03:19] can give us your update.
[1:03:21] >> The violation was posted on April 13th 2026.
[1:03:24] We received plans on July 22nd 26,
[1:03:29] additional information was required,
[1:03:35] it did not go through plan review has to go to admin first
[1:03:39] additional info was requested for different times.
[1:03:41] They finally got everything we needed in the plans
[1:03:45] and they were just sent to plan review yesterday.
[1:03:49] Yesterday electrical approved and mechanical disapproved.
[1:03:57] The structure still has to look at it
[1:03:59] as the other disciplines do.
[1:04:04] Electrical approved mechanical disapproved
[1:04:07] and other disciplines have not yet seen it.
[1:04:10] >> It was just submitted yesterday.
[1:04:13] >> Right..
[1:04:15] So Mr. Medina you've heard that do you have anything
[1:04:19] you want to add?
[1:04:22] >> Basically last night our general contractor received like
[1:04:25] an invoice to pay for the permits.
[1:04:27] He paid them already last night he sent me a screenshot of it.
[1:04:32] And we're just waiting to see what
[1:04:34] else the city needs to ask from us so we can start doing this.
[1:04:41] Doing everything we need to do to have
[1:04:43] everything in compliance.
[1:04:46] >> Reminding myself what this was.
[1:04:47] Let's see.
[1:04:49] We didn't have a local business tax
[1:04:52] receipt because of the work the space was vacated,
[1:04:55] they moved out.
[1:04:56] What is the work?
[1:04:58] Remind me Ralph what's the work that's being done?
[1:05:02] I know this is the one where the tenant moved out right?
[1:05:06] The tenant did move out so what's
[1:05:07] the work and the permit that needs to be done?
[1:05:11] >> It's a beauty salon, wall was added, plumbing, electrical,
[1:05:14] couple sinks, chairs.
[1:05:15] I went there for the same thing for an LTR.
[1:05:20] And I noticed all that work.
[1:05:23] >> So you're keeping everything that they put in call me
[1:05:26] or trying to get the permits now for the modifications that were
[1:05:28] done?
[1:05:29] >> Correct to demolish everything.
[1:05:30] And have it in compliance.
[1:05:36] Yeah we're taking everything she bounded the property.
[1:05:41] >> So it's just a demo?
[1:05:42] >> Yeah they're trying to put it back to the way that it was.
[1:05:45] >> Correct.
[1:05:46] That's why I'm curious like why would they disapprove
[1:05:48] if they're just taking it down?
[1:05:50] Mama we just got the plans yesterday
[1:05:52] we've had two disciplines in one day.
[1:05:55] >> No I don't mean that we were slow or bad on why we did it,
[1:05:58] but I'm just saying if they were moving it and putting it back
[1:06:00] to what it was,
[1:06:07] >> You still need demo, plumbing has to go and look at it.
[1:06:10] Electrical has to go out and make sure.
[1:06:11] Structural as well make sure the wall was removed.
[1:06:16] Is up against the firewall.
[1:06:19] >> Did you already have the work done?
[1:06:20] I tried to do --
[1:06:22] I know you're rolling the permits
[1:06:24] but some of the work already being done with removing
[1:06:25] some of this stuff?
[1:06:26] Or not yet?
[1:06:28] >> We haven't started it's just a plan for what we're going
[1:06:31] to do.
[1:06:32] All right.
[1:06:33] Let's see, where were we at?
[1:06:38] All right.
[1:06:39] Didn't start assessing any fines.
[1:06:43] So I'm going to start assessing to apply some heat for you guys
[1:06:47] so maybe we'll start to get it done because I've been kicking
[1:06:49] the can down the road.
[1:06:51] I'm still going to give you -- where's the mayor?
[1:06:55] 30 days gets you to October 2nd 2026.
[1:07:02] So compliance is going to be October 2nd 2026.
[1:07:05] If you don't comply by that date finds the amount of $100
[1:07:08] we're going to start per day.
[1:07:10] $185 administrative fee.
[1:07:13] No, $150.
[1:07:16] Well -- 785.
[1:07:18] I just made up a new number. $150 administrative fee.
[1:07:24] That's due within 30 days that's due by October 2nd 2620 26
[1:07:29] as well.
[1:07:29] You can pay today as well for $150 is due regardless.
[1:07:33] If you get the violation done, and completed before October 2nd
[1:07:36] you won't have any fines today. $150 administrative fee is due
[1:07:39] though and that's not going to be waived.
[1:07:41] That is due regardless.
[1:07:42] Okay?
[1:07:43] We will reset the case to October 7th.
[1:07:47] 2026 to make sure that if you're complying whatnot.
[1:07:50] If not then I'll certify the fine as of that time.
[1:07:53] That's it.
[1:07:54] You'll be reset at 945 on October 7th okay?
[1:07:58] >> Okay.
[1:07:58] Perfect.
[1:07:59] Thank you so much.
[1:08:00] >> Make sure you keep the heat on if they need modification
[1:08:02] make sure you get it done quickly so you get that demo
[1:08:04] done you want to be done by October 2nd so that you
[1:08:07] don't start getting fines.
[1:08:09] >> Miss Rosenberg if I may?
[1:08:12] We responded here on your agenda item number five and ten.
[1:08:16] Also responded here for case not on the docket
[1:08:18] I don't know if we want to look that up.
[1:08:23] >> 510 and which one eight?
[1:08:24] >> Five and ten and then we have someone here who's not
[1:08:27] on the docket.
[1:08:27] I don't know why.
[1:09:04] And then we have case number EN26008.
[1:09:15] The letter says it's supposed to be under certification of fine.
[1:09:26] Already certified the fines last time.
[1:09:29] >> Let me look.
[1:09:37] >> Here we'll add it to the docket if it's just the docket
[1:09:39] issue with the notice for today.
[1:09:41] >> The notice is correct?
[1:09:55] Okay I had it on June 3rd just so I can see what the case >>
[1:10:04] Actually the last one was July.
[1:10:05] >> Is fine I just wanted to find one where I found it.
[1:10:08] Go ahead.
[1:10:12] >> Case number 26-008 Donald Hagen property address 11930
[1:10:15] southwest 56th Street.
[1:10:16] Violation description Broward County amendments
[1:10:19] to the 2023FBC8 edition effective date December 31st
[1:10:25] 2023 section 105 permit section 6-4 of the code.
[1:10:31] Adoption of Florida Building Code
[1:10:33] which provides that a permit is required for backyard
[1:10:36] improvements to the residence including the installation
[1:10:39] of the newly poured concrete slab and construction
[1:10:42] of a new pergola with an aluminum roof.
[1:10:44] Electrical work was completed in connection
[1:10:48] with these improvements including the installation
[1:10:50] of ceiling fans.
[1:10:52] Electrical receptacles and lighting fixtures.
[1:10:57] Additionally a wood framed bar area was constructed
[1:11:00] and all the foregoing work was performed
[1:11:02] without any approved fans or permits issued by the Community
[1:11:05] Development Department.
[1:11:16] >> Okay Ma'am state your name for the record.
[1:11:28] >> (Indistinct) Waiting for the engineer to give me
[1:12:02] the impervious gowns for under the 230ft² of roof covered come
[1:12:07] around 163ft².
[1:12:09] And the bar area we've already moved that
[1:12:12] into the garage combo that had wheels on it, that's gone.
[1:12:18] Everything will be approved in probably less
[1:12:22] than a week period will probably be submitted today.
[1:12:24] I have a meeting with a company who's
[1:12:26] going to do a grant calculation to verify it for the engineer.
[1:12:32] I've already spoke to Trevor, our setbacks
[1:12:35] are sufficient to take the wall off the pergola
[1:12:38] where the television is at.
[1:12:40] Because that makes us have to have a 13 foot setback.
[1:12:43] And because we have a six books shadow six foot shadow
[1:12:47] box fence to the neighbor then we can have a five foot setback.
[1:12:59] >> Okay.
[1:13:00] So you look like you still need a week?
[1:13:00] No?
[1:13:00] Based on my last notes if you can you can check.
[1:13:01] >> Really what was hard was the engineer record.
[1:13:04] >> I had fines $250 a day starting on July 31st 2026.
[1:13:10] >> I can give you an update on the project?
[1:13:19] >> I want to make sure my notes were correct.
[1:13:21] Go ahead Ralph.
[1:13:24] >> Even though I wasn't ready for this I do have notes from
[1:13:26] before.
[1:13:26] I'm not sure when the violation was posted.
[1:13:29] It was March 30th.
[1:13:32] Which was six months ago.
[1:13:37] We just received plans on hundred 19.
[1:13:41] Which was sent to admin.
[1:13:44] Additional info was requested on 722.
[1:13:50] And it was finally sent to review on 730.
[1:13:54] We disapproved the corrections on 81826.
[1:13:59] And we're still awaiting the corrections as of now.
[1:14:03] Speaking of zoning there was a lot of serious issues with this.
[1:14:07] Pervious versus impervious.
[1:14:11] There's a huge pergola in the back,
[1:14:14] they poured a concrete slab.
[1:14:18] I understand what she's saying if it's on wheels,
[1:14:21] but I've got pictures and you can look at it.
[1:14:23] You've got a four foot fence.
[1:14:25] How are you going to get that bar through a four foot fence?
[1:14:32] That's another issue I have with this two.
[1:14:38] That's not fit through a four foot fence.
[1:14:52] Look at, that's an L-shaped bar.
[1:14:54] Actually it's a U-shaped.
[1:15:01] >> For the record, I want to first note that this is case
[1:15:04] EN260008 Donald Hagan, it's not appearing on the physical agenda
[1:15:06] that was printed for today.
[1:15:07] But it was properly noticed for today
[1:15:10] and permit Clerk Kristen Costa is present,
[1:15:13] so we've added it to the agenda to be heard just so that it's
[1:15:17] on the lecture on the record.
[1:15:19] I've heard testimony from Miss Costa and from Ralph Sara,
[1:15:22] it does sound like works needs to be done,
[1:15:27] I still need to reply as information
[1:15:29] that's been requested.
[1:15:32] Within the time frame that Ralph says he's 100% right.
[1:15:35] But we are at the mercy of the engineer.
[1:15:37] Can the engineer is not that responsive.
[1:15:41] Not that you guys care, but I have three code enforcement
[1:15:45] cases for fences and awnings and I'm
[1:15:49] in the same predicament with engineering.
[1:15:50] I hire one engineer and plantation
[1:15:53] and he promised me 3 to 4 weeks and I'm at 16 weeks
[1:15:56] and I haven't gotten them and I had to ask for an extension.
[1:15:59] We literally found this engineer that
[1:16:03] was recommended from the guy who installed
[1:16:05] it and I'm at the mercy of George Castelo.
[1:16:09] Actually put Jorge Castelo in an email with Trevor
[1:16:11] and he ignored him for three weeks.
[1:16:13] End up having to get really firm with Jorge and say listen,
[1:16:16] this is what Trevor wants, this is what Ralph wants.
[1:16:19] I said you gave me piecework, and this
[1:16:22] is what I need to finish.
[1:16:24] I cannot accommodate Ralph until I accommodate Trevor.
[1:16:26] I can't upload it it has to be done.
[1:16:28] You have to agree with that Ralph.
[1:16:30] I can't upload and give Ralph's comments
[1:16:32] and then fail zoning again.
[1:16:34] And then he yelled at me and said I don't do that part.
[1:16:39] That's your part.
[1:16:40] So I did.
[1:16:41] I went in Thursday com I had a meeting.
[1:16:43] Me and Trevor laid it all out.
[1:16:45] Explained what I can do for setbacks, we went down there
[1:16:49] and we marked the existing concrete,
[1:16:51] and yes, my paver company, they're not pavers.
[1:16:54] But they're doing me a favor because they
[1:16:57] have a system on their computer which calculates and scans
[1:17:00] the survey for the impervious calculations.
[1:17:03] So say it was existing for them to add pavers later.
[1:17:06] So she's doing it for me so that I can take that impervious
[1:17:09] calculation and give it to George because George will not
[1:17:12] come to the property and do it for me.
[1:17:17] You won't.
[1:17:18] I'm doing all the legwork for George
[1:17:19] and I can only do it on the mercy for George.
[1:17:22] I apologize that it went from August 18th to September 3rd.
[1:17:25] That clearly wasn't by my choice.
[1:17:27] If it was up to me I would have had that permit out the day
[1:17:29] after you saw me in July.
[1:17:31] But I've been at the mercy of George.
[1:17:36] >> Miss Rosenberg may I?
[1:17:40] The issue here is entirely self-imposed.
[1:17:42] This work requires permit before construction
[1:17:45] If you're gonna understand these that the respondent is in,
[1:17:48] at this point it's up to them what compliance is.
[1:17:51] If they choose compliance that's their choice.
[1:17:53] If they want to remove the structure
[1:17:56] and get the proper demolition permits that's their choice.
[1:17:59] So as far as any delays it originated
[1:18:02] from the fact from the finding of violation
[1:18:04] the fact that this was installed without permits.
[1:18:13] >> That's correct they wouldn't even be here today if they had
[1:18:15] permitted it.
[1:18:15] >> Understood.
[1:18:15] Understand is frustrating you hire people coming
[1:18:17] but unfortunately that's the way it works period you
[1:18:19] know that's the way it works.
[1:18:23] He's 150,000,000% wrong he knows he's in this predicament up here
[1:18:27] and right the reality was today it was for certifications
[1:18:30] to find the fines already started recruiting effective
[1:18:32] July 21st at $250 a day.
[1:18:36] The reality is that's still accruing.
[1:18:38] So this is a certification to state
[1:18:40] that's the amount of fines that are accruing.
[1:18:44] Until and unless he gets complied
[1:18:47] it can't address it any way.
[1:18:52] If I inserted running well that was the compliance I guess it
[1:18:55] started the next day I think that was the compliance day
[1:18:57] period so on August 1st they'll start running for 250 a day.
[1:19:02] If and when he gets compliant he can
[1:19:04] contact Ruth to find out the method
[1:19:07] to do a reduction of fines.
[1:19:10] The sooner he can get compliance the sooner
[1:19:13] we can reduce it period the more we can reduce it.
[1:19:15] The longer it takes unless we can reduce.
[1:19:18] So it's on him.
[1:19:19] Apply the heat to the engineer and whatever
[1:19:21] you need to come unfortunately that's the world
[1:19:23] we live in with it.
[1:19:33] >> I'm at the tail end.
[1:19:34] Pretty much just need everything signed and sealed
[1:19:34] by the engineer, I need the square footage
[1:19:36] of the existing roof installed.
[1:19:37] Am I right you go through that and there may still be issues
[1:19:40] so if they still come back and say
[1:19:42] their calculation on everything impervious
[1:19:44] is not the same as what's going on then
[1:19:46] you have to go back and forth with that.
[1:19:47] So work out what you need two.
[1:19:52] >> The structural side he wants two comments he wants the square
[1:19:55] footage and Jerry had one other comment that's already been
[1:19:58] addressed there's two small notes and the rest is on Trevor.
[1:20:03] We had a transparent conversation of what he wanted
[1:20:05] and what would be legal for the setbacks.
[1:20:07] If we remove the wall in the back of the pergola where
[1:20:09] the television is it's counted as a pergola which
[1:20:12] can have a five foot setback.
[1:20:14] >> One other thing for the record then I need to clarify
[1:20:17] was the administrative fee paid?
[1:20:18] Because that was due on 731.
[1:20:22] >> Yep I came in the same day I was here the first day.
[1:20:30] >> I just to make sure because that was due on July 31st.
[1:20:33] So if the administrative fee was not
[1:20:33] paid then that's going to be certified
[1:20:33] as well if it's already paid then
[1:20:35] she will note it in the record.
[1:20:38] Okay.
[1:20:39] If it's paid is paid if it's not then
[1:20:42] it's uncertified along with the fine.
[1:20:45] It was due on July 31st and you were here on July 1st was
[1:20:49] the date of the hearing.
[1:20:51] That's when you said you hired a new engineer.
[1:20:53] The first hearing was July 5th six but on July 1st they said
[1:20:59] they hired a new hearing and that's when I assessed
[1:21:01] the fines.
[1:21:02] July 1st was when I imposed the administrative fee by 731.
[1:21:08] He should have paid it on July 1st if he paid it when he was
[1:21:13] here.
[1:21:14] >> He did.
[1:21:15] As soon as we're done here he walked over there.
[1:21:18] >> Confirmed that it's paid if it's not certified it's fine
[1:21:21] either way.
[1:21:21] Just if it wasn't paid it still do.
[1:21:24] Okay.
[1:21:25] Like I said, I'm certifying it.
[1:21:30] That's it.
[1:21:32] I'm not setting a date, once you know you're complied,
[1:21:37] you can contact her.
[1:21:40] That was an extra add on.
[1:21:42] And now let's go to five.
[1:21:52] >> Case number five on the docket case EN260009 Colin Corby
[1:21:54] property address 8878 southwest 59th Street.
[1:21:56] Violation Broward County amendments to the 2023 eighth
[1:22:01] edition effective date December 31st 2023 section 105 permits
[1:22:05] section 6-4 of the code entitled Adoption of Florida Building
[1:22:08] Code which requires the building code for renovations with no
[1:22:13] permits.
[1:22:13] All bathrooms new kitchen framing
[1:22:15] come drywall come exterior accessory building as well.
[1:22:20] Architectural structural mechanical electrical plumbing
[1:22:23] plans required to be submitted.
[1:22:26] Signed and sealed drawings by licensed professional
[1:22:30] are required.
[1:22:37] >> Good morning please state your name for the record.
[1:22:39] >> Good morning my name is Maria Rodriguez.
[1:22:39] >> You're the permit Expediter?
[1:22:40] >> Yes.
[1:22:41] All right hold on Miss Rodriguez we'll let the city present
[1:22:43] and then you can let me know anything
[1:22:45] you want me to hear okay?
[1:22:47] Mr. Sara?
[1:22:49] >> This is a little long.
[1:22:51] Violation was posted on April 9th,
[1:22:54] we received plans to admin on May 15th,
[1:22:59] additional info is requested six different times by admin ,
[1:23:07] we finally got sent to plan review on July the 8th.
[1:23:11] Corrections are required on July the 9th.
[1:23:17] We received those corrections back on August 11th.
[1:23:22] And there's two permits here.
[1:23:25] The permit for the interior renovations was issued on August
[1:23:29] 25th.
[1:23:29] But no inspections have taken place.
[1:23:33] >> On August what date?
[1:23:35] 25?
[1:23:37] >> Was issued on the 25th but no inspections have taken place
[1:23:39] since it was issued.
[1:23:41] There's a separate permit for an accessory building,
[1:23:44] any plans that they submitted was not in fact what is their.
[1:23:48] And you can see the photos.
[1:23:51] This is an actual enclosed building with a tiki hut type
[1:23:55] roof on top.
[1:23:56] And as a full bar there.
[1:23:59] It's enclosed on all four sides to the exterior walls.
[1:24:02] Two glass walls, there's a sink inside there
[1:24:10] come a refrigerator, electrical, so what they submitted
[1:24:14] was a tiki hut.
[1:24:16] And it's not accurate to what is there.
[1:24:18] So they didn't submit electrical permit applications
[1:24:23] and they didn't submit plumbing.
[1:24:25] They only submitted a structural -- so I got involved with it.
[1:24:33] Because these plans need to be re sent,
[1:24:36] and they need to show if they are going to in fact demo
[1:24:41] that tiki hut, they need to show all the demo plumbing that's
[1:24:45] underground and all the demo electric that's underground.
[1:24:48] Show up being completely removed from where
[1:24:52] it's tied into the house and it's
[1:24:54] being capped off there as well.
[1:24:57] So the Tiki Hut is nowhere near ready
[1:24:59] because they need to resubmit all of that.
[1:25:02] The house has been issued, we're just
[1:25:05] waiting for inspections on that.
[1:25:08] >> Okay, your response?
[1:25:10] >> Okay.
[1:25:11] So we are planning to request inspections
[1:25:12] for the permit for the house that has been issued
[1:25:15] next week starting next week.
[1:25:17] For the tiki, we submitted as a tiki
[1:25:21] because we were planning to demolish everything,
[1:25:23] we're just going to leave the roof.
[1:25:25] And yes, we are submitting the application
[1:25:28] for electrical and plumbing.
[1:25:30] And we're going to show the demo.
[1:25:34] Those are the comments that we need to resubmit.
[1:25:38] We also have a permit for a change
[1:25:40] out we submit corrections.
[1:25:43] I would like to request at least one more
[1:25:46] month so that we can request those inspections
[1:25:49] and finish with the corrections.
[1:26:00] >> Okay.
[1:26:00] The last time on July 1st we had the hearing,
[1:26:00] I had continued it to today and I said I was going to start
[1:26:03] assessing fines today if it was not complied by now.
[1:26:06] So I'm going to give you some time to get it done,
[1:26:08] but I am going to start assessing the fines.
[1:26:10] So if they're not done by that time
[1:26:12] then the fines are going to start accruing.
[1:26:15] It sounds like you still have some things to get completed
[1:26:17] so I think you need to make sure you're staying on it
[1:26:20] and prompt it, obviously the inspections next week
[1:26:23] for the interior one it sounds like that'll be wrapped up
[1:26:26] quickly make sure you address like you
[1:26:27] said the electrical and plumbing underground if you're
[1:26:30] demolishing make sure you're getting everything done that you
[1:26:31] need so that you don't waste the time with going back
[1:26:34] and forth with corrections.
[1:26:35] So, I'm going to give another 30 days which means your compliance
[1:26:39] date is October 2nd 2026, if you're not complied by October
[1:26:44] 2nd 2026 then finds will start occurring at $250 a day.
[1:26:48] I'm assessing $150 administrative fee that's
[1:26:52] also due within 30 days, you can pay it today
[1:26:54] if you want to, by the latest it is due on ten two 2026.
[1:26:57] The case will be reset for ten seven 2026
[1:27:02] and we will determine the status then
[1:27:03] if it's not complied I will certify the fines at that time.
[1:27:06] Will be set at 9:45 a.m.
[1:27:08] On October 7th.
[1:27:11] Okay?
[1:27:13] >> So we have to $150?
[1:27:15] >> $150 administrative that will not be waived it needs to be
[1:27:18] paid by October 2nd.
[1:27:20] You can pay it today, but as long as it's paid by October
[1:27:22] 2nd.
[1:27:23] >> And then we're going to start assessing fines today?
[1:27:27] >> Your compliance date is October 2nd which means
[1:27:29] as of October 3rd it'll start at $250 a day.
[1:27:32] If you want to pay the administrative fee you can come
[1:27:34] up here she'll give you a slip and you can go to the office
[1:27:37] and pay that today.
[1:27:38] And then the case is reset for October 7th at 945
[1:27:41] to redetermine that status if it's not complied at that time I
[1:27:44] will certify those fines which then can become a lien
[1:27:46] on the property.
[1:27:47] But the fines won't start accruing until October 3rd
[1:27:50] at $250 a day.
[1:27:52] Okay?
[1:27:54] We can do number ten on the docket.
[1:28:06] Number ten on the docket case number EN260018.
[1:28:12] Noel Jose Megan.
[1:28:16] Property address 8946 South West 52nd Court.
[1:28:21] Violation description Broward County amendments to the 2023
[1:28:25] FBC eighth Edition effective date December 31st 2023 section
[1:28:30] 105 permits.
[1:28:31] Section 6-4 of the code entitled Adoption of Florida Building
[1:28:36] Code which provides that a permit is required for seven
[1:28:42] 2026.
[1:28:42] Has been determined that a detached accessory structure has
[1:28:46] been constructed within the rear yard of the subject property
[1:28:51] without the benefit of approved construction documents.
[1:28:55] Required building permits are mandatory inspections as
[1:28:59] prescribed.
[1:29:00] By the Florida Building Code.
[1:29:02] The home was listed for sale at the time of violation.
[1:29:05] And the structure was listed as a one bedroom one bathroom guest
[1:29:09] house.
[1:29:10] New interior renovations to primary house
[1:29:13] as well from listing signed and sealed
[1:29:16] plans and documents from a design professional
[1:29:18] will be required to be submitted by the building
[1:29:21] department for review, inclusive of structural plans, details,
[1:29:27] electrical plans, plumbing plans, and mechanical plans,
[1:29:30] and provide all required documents for the structure
[1:29:34] as well.
[1:29:34] Obtain all required permits after plan review
[1:29:38] is approved and then complete all the required inspections.
[1:29:42] >> Good morning.
[1:29:43] My name is Christine this is my husband Noel
[1:29:45] and this is the company that we hired.
[1:29:49] >> Christine what's your last name?
[1:29:59] >>.
[1:29:59] >> Okay and then we have Noel your concern right Christine?
[1:29:59] Co owner with your husband?
[1:30:00] And then what's your name sir?
[1:30:07] >> I work on behalf of South Florida permits.
[1:30:09] >> How do you spell your >> DOST in the last name is RAJ.
[1:30:23] I notice the complete structure built in the backyard detached
[1:30:27] from the house.
[1:30:28] And on the Zillow ad it's listed as a one bedroom one bath in-law
[1:30:35] quarters or whatever you want to call it like guest house.
[1:30:39] So I went back and I looked there was no permit.
[1:30:44] It's got a complete roof, four walls, has a glass front.
[1:30:50] Can also, from the ad on Zillow you
[1:30:54] can see the whole inside of the house
[1:30:57] has been completely renovated.
[1:30:59] There's no record history of any interior renovations
[1:31:03] of the house.
[1:31:07] So after noting all of that I went back
[1:31:10] and posted the violation.
[1:31:11] As of today I have not received any plans or documentation
[1:31:16] to move forward on this.
[1:31:30] >> I'm sorry May 20th you said it was?
[1:31:37] >> July 20th.
[1:31:41] >> Okay.
[1:31:42] What do you have to tell me?
[1:31:42] >> Right now we have our engineer coming he's getting
[1:31:42] the drawings done and also we're working on the MEP.
[1:31:44] We were asking if we could get an extension so
[1:31:46] that we can get these permits in order for the violations.
[1:32:00] >> She's showing you some photos these are the interior
[1:32:02] renovations?
[1:32:03] Are you aware of what permits you need?
[1:32:05] I don't know if you've had any conversations at all
[1:32:08] to make sure they know.
[1:32:21] >> There's going to be two permits required one
[1:32:23] for the interior and one a separate permit for everything
[1:32:23] that was done to the exterior of the house.
[1:32:25] So there'll be two separate permits.
[1:32:26] >> Gotcha.
[1:32:27] Thank you.
[1:32:37] >> Yeah so they did hire us and we are currently working
[1:32:39] on getting the permits for both the interior redesign and also
[1:32:40] the in-law house, and that would be for the mechanical,
[1:32:44] electrical and plumbing.
[1:32:46] >> Okay.
[1:32:47] Just want to make sure you know so that you're
[1:32:49] aware of what you need to pull.
[1:32:51] >> Does that in-law house have a full kitchen?
[1:32:54] I haven't seen it, that's why I'm asking.
[1:32:57] >> Because then he can tell you what exact permits you need
[1:32:59] so then you know so you don't waste time and end up taking
[1:33:02] longer.
[1:33:06] Go to the office twice but I know
[1:33:08] you've been busy with meetings.
[1:33:20] >> I haven't been inside either home.
[1:33:23] >> The violations that we have now I want to make sure --
[1:33:25] >> If I may, I understand that she's looking for the exact
[1:33:26] information, and of course based on the information Mr.
[1:33:30] Search is given to the best of his knowledge.
[1:33:34] If you want direct information I suggest you schedule a meeting
[1:33:38] and let them inspect the property because again based
[1:33:40] on the information there might be more there that you need
[1:33:43] or don't need, there's no way at this particular moment
[1:33:47] this particular hearing that we can tell you
[1:33:49] exactly what's needed.
[1:33:52] It really would be on your contractor
[1:33:54] to do that the city is happy to go out and inspect if you want
[1:33:56] to schedule that with them.
[1:33:58] But again com would be remiss of me
[1:34:01] to allow him to say here's exactly what you need
[1:34:03] and we've only seen the exterior of the property.
[1:34:06] So at this point if you want to give time
[1:34:09] to comply we can do that, but as far as exactly what's needed,
[1:34:11] once the paperwork is submitted and the inspections take place,
[1:34:15] then the city would be better able to assess instead of just
[1:34:19] being able to review some of the pictures and talk to you today.
[1:34:28] Realistically common with the testimony
[1:34:31] shows, the structure itself once you
[1:34:33] have a detached structure you need permits for the structure
[1:34:37] itself.
[1:34:38] The electrical, plumbing, structural at the very least.
[1:34:41] I'm not here to give you legal advice.
[1:34:43] If there's additional, if there's a bathroom
[1:34:45] then you need additional information.
[1:34:46] If there's a shower, sinks, whatever else it is
[1:34:50] there are requirements for each of those types of things.
[1:34:53] So it would be remiss to go through all of that here
[1:34:55] today and say that's the final dispositive list.
[1:34:58] So at that particular point because normally
[1:35:00] once you see the plans at that point everything
[1:35:02] goes along with the plans.
[1:35:03] This was done in the opposite through your admissions,
[1:35:06] this was done kind of you built and now you're
[1:35:08] getting the permits after the fact.
[1:35:12] The inspectors might need the engineering certifications
[1:35:15] you might need to open up the wall
[1:35:16] so that we can see the studs are done correctly.
[1:35:18] I don't know.
[1:35:19] Neither does Mr. Sara, but we can give you
[1:35:21] the best information that we can now
[1:35:23] and once the plans are submitted and we make sure that it
[1:35:25] meets Florida building code.
[1:35:28] >> You know the very least you're going to need one
[1:35:30] for the main interior that was done,
[1:35:32] and then one for the separate building.
[1:35:40] And then when I purchased this house
[1:35:43] I've had it for about eight years that building was there.
[1:35:46] I've just updated it.
[1:35:50] My friend owned it for like 7 or 8 years
[1:35:53] and that building was still there.
[1:35:55] >> And we have no record of any permits ever being filled
[1:35:57] for it?
[1:35:58] >> He says in Cooper City there's no records but when you
[1:36:01] look on Broward County it's there.
[1:36:48] Registered owner of the process I get hit with that.
[1:37:00] So maybe you can address that when
[1:37:02] you're looking at it what's more beneficial to you,
[1:37:05] if you have stuff that needs to bring it up to code
[1:37:08] it's too expensive you can find out exactly
[1:37:13] once you know once you get into a little bit more.
[1:37:16] >> If the permits are with Broward County we'll be happy
[1:37:18] to look at that as well.
[1:37:28] If you're in incorporated area it's
[1:37:31] not that might be what happens so it's not
[1:37:33] that you're necessarily grandfathered
[1:37:34] in but you can find out what those permits show
[1:37:36] and that would help them.
[1:37:43] Might help you with some stuff along the way
[1:37:46] because it could help you come up
[1:37:48] so I'll check with Broward County
[1:37:49] because if there are permits done with Broward County
[1:37:51] that you and you want to get those.
[1:37:52] So check.
[1:37:53] I'm just gonna reset it to October 7th so we can find out
[1:37:55] what's going on and kind of get a better update.
[1:37:58] You need to keep moving along, like I'm
[1:37:59] saying you can check with that you
[1:38:01] can check with the departments, just get more information as you
[1:38:04] go along.
[1:38:05] They're going to help to work with you to let you know.
[1:38:07] But obviously they can't tell you the details
[1:38:09] until they see exactly what's there and what's been changed.
[1:38:12] But yeah if you're an area, that does affect it.
[1:38:15] So I would look and see if Broward County has
[1:38:18] permits find them and get them.
[1:38:29] >> Okay.
[1:38:29] As far as the daily violation?
[1:38:29] >> I'm not assigning any daily fine yet I'm resetting you
[1:38:29] to October 7th at 945 and we'll see where we are there.
[1:38:30] So keep moving along cause you don't want me to start assessing
[1:38:31] the fines that run per day.
[1:38:33] So I'm not giving you any fines yet.
[1:38:35] Okay?
[1:38:45] >> Okay.
[1:38:46] Have a good day thank you guys.
[1:38:46] >> Case number 11 on the docket EN190145 Joseph A Barreto.
[1:38:46] Property address 11374 South West 55th Street,
[1:38:50] violation description SB 167 adoption of Florida Building
[1:38:55] Code which provides that a permit to enclose their rear
[1:39:00] porch is required.
[1:39:09] And then we'll give this to her okay?
[1:39:12] >> Just come on up to the podium and put your name on the record
[1:39:15] okay?
[1:39:16] To the podium?
[1:39:16] The microphone?
[1:39:18] You can pull that microphone down
[1:39:19] so we can hear you and just state your name for the record.
[1:39:22] You want to pull the microphone down?
[1:39:24] Grab it and pull it down?
[1:39:35] >> Okay.
[1:39:35] Thank you.
[1:39:35] >> Just state your name.
[1:39:36] >> My name is Anna Moak and I am here about representing
[1:39:39] my brother.
[1:39:43] I am 83 years old and I'm a resident of Texas.
[1:39:49] And I come here only to solve this problem.
[1:39:53] There is a fine for a wall that he built,
[1:40:03] and I didn't have any idea about it.
[1:40:07] Because my brother was very sick,
[1:40:11] he didn't have his mind in the right place.
[1:40:16] So, he couldn't see.
[1:40:22] He was very ill.
[1:40:24] And, he also was not able to read
[1:40:33] anything that came in his mail.
[1:40:36] Okay?
[1:40:37] So there is a fine about this wall.
[1:40:41] Well it wasn't a wall, it was kind of
[1:40:44] like a little fence like three feet.
[1:40:47] And I wanted to see if you can reduce the fine,
[1:40:53] because I don't have that kind of money to pay for that amount
[1:40:58] that they're asking for.
[1:41:05] As low as you can do it.
[1:41:14] >> I see your letter come I was reading your letter as you were
[1:41:17] speaking.
[1:41:17] It indicates that it was your brother, that he was disabled,
[1:41:18] he was nearly blind and suffered from some serious illness,
[1:41:21] he had a three foot high wall built at the back of his house
[1:41:26] which bordered a lake to contain potential flooding from the lake
[1:41:29] and keep out dangerous animals.
[1:41:31] It was erected without a permit, and the fine was issued
[1:41:37] on August 3rd of 2020.
[1:41:39] He never -- >> At least it says on the docket the violation was
[1:41:47] for a rear porch enclosure?
[1:41:51] Mhm says permit to enclose the rear porch.
[1:41:55] They're writing about a three foot wall.
[1:42:06] >> I can speak a little on that.
[1:42:08] Mark Young was the chief at that time.
[1:42:09] He noted the violation was complied on one 2125.
[1:42:13] I actually was the inspector I went out
[1:42:15] inspected it was in fact a three foot wall
[1:42:18] around the slab out back of the porch area.
[1:42:21] And we told him just to remove all of it.
[1:42:24] They did remove it on one 2025.
[1:42:27] But there was still a pile of debris
[1:42:29] on the side of the house from when they demolished it.
[1:42:33] I just asked that they have that removed within ten days.
[1:42:37] And I approved the permit to remove it.
[1:42:40] Back on 121.
[1:42:44] >> So the citation was issued on August 3rd of 2020.
[1:42:48] Your brother passed away of March 5th of 2024.
[1:42:50] Four years later.
[1:42:52] It was never addressed during his lifetime,
[1:42:56] and you were notified in January of 2025 ten months after
[1:43:01] your brother passed away your neighbor contacted you
[1:43:05] and helped to remove that wall which wasn't done until January
[1:43:09] 21st of 25 as Mr. Sara indicated.
[1:43:12] So the fines accrued for 1632 days
[1:43:16] because it wasn't resolved basically for almost five years
[1:43:20] or for four and a half years.
[1:43:24] >> Miss Rosenberg I'm just looking at the property notes,
[1:43:26] the property is currently owned by the trust and it does list
[1:43:31] Miss Mohlke as the trustee but it's not a hosted property.
[1:43:36] So that's the information that I can provide.
[1:43:47] >> And you'll be hearing appearing on behalf
[1:43:49] of your brother like you said and you're listed as the trustee
[1:43:49] on the trust.
[1:43:52] So, just so you understand the way reductions work,
[1:43:56] typically the city code provides an amount
[1:43:59] of percentage reduction that you're
[1:44:00] allowed to do based on how long it takes
[1:44:02] you to comply the property.
[1:44:03] The problem is obviously it took more than a year,
[1:44:07] and when it takes more than 18 months it's only 25% reduction.
[1:44:12] 25% reduction year fines had had occurred to $123,000 and it was
[1:44:19] $100 a day and as I said it ran for a four and a half years.
[1:44:23] So the 25% reduction brings it down to $122,
[1:44:28] and for $122,400 plus the recording fees plus the staff
[1:44:32] time brings it down to $122,544.
[1:44:34] My guess is that that's still more
[1:44:38] than you're going to indicate that you have to be able to pay.
[1:44:42] It seems to be because it was ignored
[1:44:45] during all that time you know for the four years
[1:44:48] when your brother was there.
[1:44:49] He never addressed the issue and that's a long time.
[1:44:52] You didn't find out or didn't address it until another ten
[1:44:55] months after that.
[1:44:58] >> Miss Rosenberg may I make a suggestion?
[1:45:00] Miss more, the way that reductions work is you
[1:45:04] have whatever time frame come usually
[1:45:06] 30 days to pay whatever the reduction is.
[1:45:09] How do you intend to pay the reduced fine if the
[1:45:13] is the property set for sale?
[1:45:15] Do you live there?
[1:45:16] Just want to get some additional information.
[1:45:18] What do you tend to do?
[1:45:21] >> I'm planning to live in the property.
[1:45:25] But I don't have the money to pay this amount of money.
[1:45:30] What's the lowest that you can go on that?
[1:45:35] >> Are you working?
[1:45:36] Are you on disability?
[1:45:37] What's your income?
[1:45:38] What's your financial situation?
[1:45:41] I need to be able to establish some other factors to be
[1:45:47] able to do anything altering from what
[1:45:49] is stated in the city code.
[1:46:01] >> I don't work.
[1:46:01] I'm a widow.
[1:46:01] From a veteran.
[1:46:02] And, I mean, I don't know how low you can go into this fine.
[1:46:12] Unfortunately it wasn't complied,
[1:46:14] so it makes it difficult, because it's not
[1:46:16] like I can't just waive it away.
[1:46:20] So let me see.
[1:46:26] And you said you intend to live there?
[1:46:30] You intend to reside at the house?
[1:46:34] You're gonna live here and stay and reside in the house?
[1:46:36] Are you going to sell it?
[1:46:46] >> Yes, eventually because right now I live in Texas.
[1:46:48] >> You're gonna sell your house in Texas and try and live
[1:46:48] in this house?
[1:46:48] What's the value of your house in Texas?
[1:46:57] Okay.
[1:46:57] Do you have your house in Texas listed for sale?
[1:47:02] I have no.
[1:47:03] >> When do you intend to do that?
[1:47:05] Or you don't know?
[1:47:14] >> Is there anyone living at the house now?
[1:47:16] Is there anybody living in the Cooper City house now?
[1:47:18] Do you have a renter there?
[1:47:23] If you live in Texas come while you live in Texas
[1:47:26] what's going on with the house here in Cooper City?
[1:47:38] >> I live in Texas for a long time.
[1:47:40] >> But when you're in Texas who stays at the house here?
[1:47:42] >> Is he renting?
[1:47:43] Is he paying you rent for staying at that house?
[1:47:46] You're letting someone stay there for free?
[1:47:54] Is this a friend or a family member?
[1:47:58] >> Just to be able to look over the house.
[1:48:01] >> He was a friend of my brother.
[1:48:20] And when your house in Texas is worth value.
[1:48:22] If you sell your house in Texas you would have some money
[1:48:24] to be able to pay towards this, I
[1:48:26] don't know when you're planning on doing that.
[1:48:28] Typically when we do a reduction I'm
[1:48:30] usually only keeping it open for 30 days.
[1:48:33] So if you're coming to try to request a reduction now,
[1:48:37] I don't know that it even makes sense
[1:48:39] to do a request for reduction now.
[1:48:51] >> What's the reduction?
[1:48:52] What's the lowest you can go?
[1:48:52] >> What I'm saying in the code is it only allows 25%.
[1:48:52] So what you're entitled to is reducing it from 163,200
[1:48:54] to 122,000 hundred 44.
[1:48:57] It's not a huge amount of reduction because of the time
[1:49:00] it took for you to comply at.
[1:49:01] What would probably make more sense for you is if in fact you
[1:49:04] are going to sell your Texas house,
[1:49:06] and come and live here come when you have
[1:49:08] actual figures and actual numbers
[1:49:10] that you know you can work with and you can show me
[1:49:14] some actual dollar amounts then maybe we
[1:49:16] can work with those numbers to be able to actually do
[1:49:18] a physical reduction that may work for you,
[1:49:20] but you're only going to have 30 days to pay it.
[1:49:22] If you're not having a house that you're selling and have
[1:49:24] proceeds to be able to make the payment
[1:49:26] it doesn't make sense for you to try
[1:49:27] to get a reduction right now.
[1:49:28] Because once I do that reduction then you have 30 days to pay it,
[1:49:31] and then it goes back to the full amount
[1:49:33] you can't come back to ask for another reduction.
[1:49:36] >> How much would be the reduction?
[1:49:38] >> I can't tell you that until you actually have moneys to tell
[1:49:40] me what you're doing and then we can try to do more than 25%.
[1:49:43] I can tell you right now it's only 25%.
[1:49:46] I can't really do more than that.
[1:49:47] Right that's all it is right now without knowing that you really
[1:49:50] have money, I can't put on a record or say.
[1:49:52] I mean I can try to work with you more
[1:49:54] if I saw that you actually have tangible money that can actually
[1:49:57] be applied and what could actually be used.
[1:49:59] You know I could try to go up to a higher percentage,
[1:50:01] but it doesn't really make sense to order a reduction right
[1:50:04] now when you're no physical means
[1:50:06] to be able to pay it within 30 days.
[1:50:08] So what I'm saying is it may behoove
[1:50:10] you to wait, hold off, and actually
[1:50:12] come back for reduction when you're really in a situation
[1:50:15] where you're ready to sell this property
[1:50:17] or sell your Texas property and move into this property.
[1:50:20] >> So you cannot do 50%?
[1:50:23] >> Maybe, but do you have the money to be able to pay 50%
[1:50:26] in 30 days?
[1:50:27] If you if I order that right now?
[1:50:30] >> It'll be roughly $60,000.
[1:50:37] Can you pay that in 30 days?
[1:50:53] >> You want me to do a reduction now or do you want to come back
[1:50:55] later?
[1:50:55] And see if you can get a bigger reduction?
[1:50:55] I don't want to do one where you're not
[1:50:55] gonna be able to pay it.
[1:50:55] I can do a reduction of 50% today
[1:50:57] if you think you can pay it in 30 days.
[1:51:15] And I'll take the 50%.
[1:51:17] >> All right let me do the calculation for you.
[1:51:21] It's going to be a reduction of $81,600 off of one 6200 plus we
[1:51:26] have to do your hard costs, so it's 81 plus 44.
[1:51:32] Plus was 100.
[1:51:34] Was the administrative fee paid?
[1:51:37] Yes.
[1:51:38] 25 2020 the administrative P was fee was already paid.
[1:51:44] So, 44 total is going to come to $81,744. $81,744.
[1:51:52] That's 50%.
[1:51:55] So, like I'm saying, if you're not sure
[1:52:00] you're going to be able to pay that in 30 days
[1:52:02] I would not recommend that you ask
[1:52:03] me to do the reduction today.
[1:52:20] >> If this is lowest you're going to go I have no other
[1:52:22] choice I could go and put a loan on my house.
[1:52:22] >> But you don't even know if you can do that within the 30
[1:52:22] days.
[1:52:22] Do you know that you can get a loan within the 30 days either?
[1:52:25] I feel like you should be in a better situation where
[1:52:30] you know what you're doing, because honestly the amounts are
[1:52:33] not going to change this is the amount of what the figure is.
[1:52:35] So it's in your interest to wait.
[1:52:41] Right, sometimes when you have a lien
[1:52:42] they won't give you a loan because they know
[1:52:44] the outstanding lien is there.
[1:52:46] You know until it's paid off.
[1:52:48] So that's what I'm saying I think
[1:52:50] it's in your best interest, I can't give you legal advice
[1:52:53] so it's totally up to you.
[1:52:55] But, it would probably behoove you to either
[1:52:57] have a property listed either the Texas one or this one
[1:53:01] and or at least look into your financing
[1:53:03] to see if you can get a loan until you're in a situation
[1:53:06] to be able to pay it.
[1:53:29] >> I'll take the 50%.
[1:53:29] >> 744 is the total so the principal amount is $81,600,
[1:53:29] the principal amount plus $44 recording and release fee plus
[1:53:30] $100 staff time a total of $81,744.
[1:53:32] I'm going to give you 60 days to pay okay?
[1:53:37] So that's longer.
[1:53:40] >> No objection.
[1:53:41] >> I'm giving you 60 days to try to make sure you can get
[1:53:43] your loan and see what you need to do.
[1:53:45] 60 days is going to be November 1st.
[1:53:48] So you have until November 1st 2026 to pay that in full.
[1:53:51] If you don't pay the $81,744 in full it will revert back
[1:53:55] to the original amount.
[1:53:56] Okay?
[1:53:59] >> Can you give me a print out of that?
[1:54:01] >> It's going to be in an order, but if you want to just jot down
[1:54:04] the number for her?
[1:54:05] 81,700 total.
[1:54:11] And it's due by 111 2026.
[1:54:19] Okay.
[1:54:34] I'm going to agree to that higher percentage based
[1:54:37] on the circumstances that the brother has passed away,
[1:54:41] unfortunately it still wasn't compliant in a timely manner.
[1:54:44] All right.
[1:54:46] Have we done all the ones on the list?
[1:54:52] Okay.
[1:54:52] You're finished Ma'am.
[1:54:54] She's going to give you a piece of paper to tell you the amount
[1:54:57] and the date, you've just got to make sure you take care of it
[1:54:59] by November 1st so you don't have to go back to that original
[1:55:02] amount due.
[1:55:02] She's going to give you a paper to tell you
[1:55:05] how much is due okay?
[1:55:07] All right.
[1:55:08] Number 13.
[1:55:13] Okay.
[1:55:14] Good luck.
[1:55:16] All right Ian?
[1:55:20] >> Do we go no matter what's been brought up first?
[1:55:23] >> Case number EN-0017.
[1:55:27] >> Hold on one second.
[1:55:29] Brian O'farrell, hold on she's still reading the case.
[1:55:32] >> It's not them anymore.
[1:55:34] >> It's not?
[1:55:35] Oh the house was sold with an open lien, as Rhaenyra Castanada
[1:55:39] and nullius Vazquez.
[1:55:42] Okay.
[1:55:45] >> Property address 5820 southwest hundred and two
[1:55:47] Avenue.
[1:55:48] Violation description Broward County amendments to the 2023FBC
[1:55:52] ET edition effective date December 31st 2023,
[1:55:56] FBC section 105.1 permits required in Fppc section 110
[1:56:02] point one inspections, section 6-4 of the code.
[1:56:09] Entitled Adoption of Florida Building Code
[1:56:12] which requires pool modification pool deck and extension
[1:56:16] of patio roof.
[1:56:26] >> Hi.
[1:56:27] State your name for the record.
[1:56:27] >> Julie qualm law firm, with me I have Miss Castaneda Miss
[1:56:29] Vasquez who are now the current owners of the property.
[1:56:35] Hold on one second we'll let the city do the presentation then
[1:56:39] you can tell me whatever you need to tell me go ahead.
[1:56:42] >> There was two permits one for the roof one for the pool,
[1:56:44] the structural was approved on July 9th 2026,
[1:56:47] this was on the roof.
[1:56:49] The electric portion of the roof was approved on July 10th,
[1:56:54] the pool permit the structural was approved on August 10th,
[1:57:00] the electrical was approved on August 3rd,
[1:57:04] the plumbing was approved on August 4th.
[1:57:11] So those permits have been closed out as of those dates.
[1:57:15] >> Okay and this is for reduction of fine and this is
[1:57:18] showing that the fines that started to accrue on October 1st
[1:57:21] 2025, and this actually shows that they gave you a compliance
[1:57:25] date of August 4th which actually sounds like it's kind
[1:57:28] of in between the ones the pool dates you just gave me
[1:57:30] because he gave me 8384 and 810.
[1:57:32] So they complied as of the fourth which showed
[1:57:35] 307 days until compliance.
[1:57:39] That calculation at 250 a day comes out to a principal amount
[1:57:42] of $76,750.
[1:57:44] As administrative fee of $150 that was due and does not
[1:57:48] show that it was paid yet.
[1:57:53] Bring it to a total of $77,050.
[1:57:56] So again, they note you has complied
[1:58:00] in full as of eight four which was the later date of the pool
[1:58:03] permit.
[1:58:05] >> What happened here this was a very unfortunate situation.
[1:58:07] The current owners went into contract
[1:58:10] with Mr. Farrell, who apparently had
[1:58:12] made all sorts of unapproved changes
[1:58:14] to the home that weren't disclosed.
[1:58:18] Oline search prior to closing showed a code enforcement memo
[1:58:21] for pool modifications so the realtor entered into an escrow
[1:58:26] agreement trying to hold back a small amount,
[1:58:28] and it gave the owner 60 days that prior owner continues
[1:58:39] to say he was doing things I'll handle the hearings he even told
[1:58:42] me to stand down I've got this under control,
[1:58:44] I've hired everyone come and come to find out he hadn't.
[1:58:47] My client is now $27,000 in the hole for this matter,
[1:58:51] they've had to hire their own contractor,
[1:58:54] they've done everything they could to bring the property that
[1:58:56] they already thought was in compliance up to speed.
[1:59:00] And they've worked tirelessly to do it
[1:59:02] while dealing with construction professionals who
[1:59:05] take a long long time.
[1:59:07] There's a lot of different like trying to get the pool after it
[1:59:11] was already built, for someone else to go off and put
[1:59:13] their license on it and sign was very difficult,
[1:59:16] but they moved mountains and spent $27,000 to get this up
[1:59:21] to speed.
[1:59:21] Through no fault of their own.
[1:59:23] They've been diligently working ever since the closing
[1:59:28] really when the prior owner was supposed to take care of it.
[1:59:32] So they are really innocent victims in this situation that
[1:59:35] are already out a lot of money and they don't have
[1:59:37] that kind of money to spend.
[1:59:39] >> How much money was set aside in the prior escrow
[1:59:42] in the escrow for the prior owners?
[1:59:45] >> Only $5,000 that doesn't even cover my fees.
[1:59:48] >> So they knew there was a pool issue going on when they
[1:59:50] purchased the property, what was the roof situation?
[1:59:55] >> They knew there was a code memo that popped up in the lien,
[1:59:58] and they were placated by the prior owner and they said
[2:00:00] we'll take care of it.
[2:00:01] And then I think what happened was
[2:00:03] after getting a Gestapo letter the homeowner said
[2:00:07] we have to fix the driveway because they came here
[2:00:10] to talk about it and they said wait
[2:00:10] a minute there's all these other violations they
[2:00:12] didn't know about.
[2:00:13] So it continued to pile on and pile on on top of >> Okay it
[2:00:23] says here that the new owners were sent a notice of violation
[2:00:26] on November 5th of 2025.
[2:00:26] >>, so that was also presented to the prior owner who assured
[2:00:28] everyone that he was going to fix it as he was required to do
[2:00:31] under the terms of the escrow agreement.
[2:00:35] >> Okay.
[2:00:36] Assuming your owners knew about it,
[2:00:39] when did they first find out?
[2:00:41] Like they knew these violations were going on
[2:00:43] and they thought the prior owners were doing it,
[2:00:45] when did that start?
[2:00:48] >> They only knew of the one dealing with a pool
[2:00:52] modification, that was supposed to be handled by escrow,
[2:00:54] that's why they only put $5,000 thinking I was told by the prior
[2:01:01] owner it was all done he had the paperwork just needed to be
[2:01:03] stamped and signed off on.
[2:01:05] >> When did they buy it?
[2:01:07] >> August 21st.
[2:01:09] Of 2025.
[2:01:10] And then they came to fix the driveway violation
[2:01:14] even though they got an estoppel letter
[2:01:16] from the association the property was
[2:01:17] a mess when they got it.
[2:01:18] They then learned that there was all these other violations.
[2:01:21] And even up until a couple months ago the prior owner
[2:01:25] told me no no, stand down, we already have it under control,
[2:01:28] he's sending me these letters, we've handled it.
[2:01:30] Apparently they were trying to handle it at the same time
[2:01:33] we were, and finally we just said
[2:01:34] we don't believe you we're taking over
[2:01:36] my client has completely come out of pocket to do that.
[2:01:40] >> Okay.
[2:01:40] So according to these notes that I see here,
[2:01:43] it looks like the permit was sent
[2:01:45] to plan review on 3226 for the new driveway which
[2:01:48] is what you're saying that's when they found out
[2:01:51] that these issues were going on.
[2:01:53] So sounds like it was in March.
[2:01:55] >> Yeah they found out that some of them were going on..
[2:01:57] And then the issues continued to arise
[2:01:59] as the contractor got involved and then they
[2:02:01] found out that there was electrical, it's just blossomed.
[2:02:04] And I know Mr. Sara has been very helpful
[2:02:06] going out there and giving them ideas on what needed to be done.
[2:02:11] >> Do you have any documentation showing me when they started
[2:02:16] addressing the pool issues?
[2:02:18] And trying to get the engineer and the licensure
[2:02:20] and everything to show that they were trying to take
[2:02:22] the steps to comply the pool?
[2:02:25] >> Yeah we have stacks of messages with the prior >> I
[2:02:34] mean I'm looking for timeframes because I'm trying to see when I
[2:02:37] think might be a reasonable time frame to help with some
[2:02:37] compliance days is what I'm getting at.
[2:02:41] >> Can I add one of the notice of violation certified mail
[2:02:43] to the prior owner June 19th.
[2:02:46] 2025.
[2:02:47] So the prior owner knew about this prior to them
[2:02:52] agreeing to some escrow.
[2:02:54] >> I know the prior owner knew I'm talking about the current
[2:02:56] owner now.
[2:03:07] >> We did send a violation June 19th 2025.
[2:03:08] >> Right, I know it's ongoing, I just know that they're asking
[2:03:08] if they're putting in 27,000 to try to get it fixed,
[2:03:09] I'm also looking to see as far as how promptly they acted
[2:03:12] and what they did to try to do from their end to look
[2:03:15] at compliance date times period because that's how I can look
[2:03:18] at my percentages and my calculations.
[2:03:21] >> This is Miss Vazquez the owner of the property.
[2:03:25] >> Good morning.
[2:03:27] I came to know what happened to my house because I have no idea,
[2:03:31] I just came to ask what was the deal about the driveway
[2:03:33] because the HOA told me everything looks good,
[2:03:38] so when I come she told me do you know
[2:03:42] what's going on in your house?
[2:03:43] I said no come I don't have any idea if you could sit down
[2:03:46] she showed me the paper and said look every day is a new fee,
[2:03:50] this is not done, this is not done.
[2:03:53] So I'm going crazy, because I asked him from the moment that
[2:03:57] we buy the house come a month later I asked him,
[2:04:03] because we don't have a number for the owner before they talk
[2:04:08] to him through --
[2:04:09] I have him on paper, the messages and everything.
[2:04:13] They said don't worry we're working on it,
[2:04:17] they sent me papers so they can process
[2:04:18] all the permits that were here.
[2:04:20] So I signed the paper that they asked how I gave them
[2:04:23] everything they asked of me.
[2:04:24] So then a month after they're asking
[2:04:27] >> When was that came at give me time frames?
[2:04:30] >> For example we bought the house on August 21st,
[2:04:33] I asked them in September come I don't know the specific date.
[2:04:39] And they told me that they were working on that,
[2:04:42] so later I asked in the next month.
[2:04:47] In November they said we're still working on
[2:04:50] that the holiday is coming you gotta
[2:04:52] take it easy you gotta work on we're
[2:04:55] working on that it's nothing.
[2:04:56] Then in January I received a letter.
[2:04:58] I sent a message again and said hey, everything's under control?
[2:05:04] He says yes everything's under control,
[2:05:06] but the city was closed with the holiday and everything,
[2:05:10] they're working the paperwork don't worry this takes time.
[2:05:13] Don't worry it's going to be done
[2:05:14] remember you signed a contract with them
[2:05:16] and they're going to work on that.
[2:05:18] So we trusted them because that was the only communication
[2:05:21] that we had with them.
[2:05:22] So when I came in March early March 15th or March 20th,
[2:05:27] root told me Natalie, this is the situation.
[2:05:31] Because how are you going to open another permit
[2:05:36] when you guys aren't working on that one?
[2:05:40] So I got really mad with the owner and I said hey,
[2:05:46] they're playing games with us they're not
[2:05:49] doing anything I'm going to the city, I went to the city
[2:05:52] they told me this there's a fee every day on the house
[2:05:54] and it's linked to the house, I said
[2:05:57] no way I'm going to talk to the owner actually
[2:05:59] I have the message here I can show you.
[2:06:01] They talk to the owner, oh no don't
[2:06:05] worry we were working on that.
[2:06:07] >> Look at the dates and when that is.
[2:06:09] >> March.
[2:06:10] >> Miss Rosenberg may I ask a question?
[2:06:12] Thank you, and for Council.
[2:06:13] Please next time let me know you're here
[2:06:15] and you can try to call Council.
[2:06:19] >> I apologize.
[2:06:20] Are there any other like one if anything
[2:06:22] you want to submit and make sure you have copies
[2:06:24] of everything you submit for evidence
[2:06:25] will become part of the public record.
[2:06:27] The second part is, do you have any intention
[2:06:30] or is there any litigation or anticipated lawsuits?
[2:06:33] Or any title insurance claims or anything else that's going
[2:06:46] >> There are no pending claims.
[2:06:47] No.
[2:06:47] We've sent letters to the former owners
[2:06:47] saying you're responsible for this, what's going on?
[2:06:47] Can they continue to say well we are
[2:06:47] allowed to have an extension under the escrow agreement.
[2:06:49] They didn't do it properly but it wasn't done in writing,
[2:06:52] it was one of those things where they kept telling me clearly
[2:06:54] using ChatGPT that they've done everything they need to do
[2:06:57] and they've been on top of it and they've
[2:06:58] hired this person and that person,
[2:07:00] but then they were trying to get the client to sign off
[2:07:03] on an owner's permit.
[2:07:04] They said hold on we're not going
[2:07:06] to sign off and take responsibility,
[2:07:07] we need real contractors.
[2:07:10] >> I invite you next time if you can reach out to our office we
[2:07:13] do work with these types of situations a lot,
[2:07:17] there are other alternatives that we have available to us.
[2:07:20] >> I think I've spoken to Ruth.
[2:07:23] >> Before the sale.
[2:07:24] This is all presale stipulated agreements and things
[2:07:26] that we can do.
[2:07:28] >> Yeah I wasn't involved in this until after.
[2:07:30] >> Yeah I'm just putting it back there for your edification.
[2:07:32] But these people are still telling
[2:07:34] us yeah we're handling it.
[2:07:35] >> Look at the date for when that is I want him to see
[2:07:38] the date.
[2:07:39] >> This is the letter that I got from you guys at the city.
[2:07:41] And I always take a picture and send it the letters.
[2:07:47] Actually on the second page you can see the letter.
[2:07:51] >> He's like I'm a little blind.
[2:07:53] >> No it's over here.
[2:07:54] I'm sorry.
[2:07:54] I have the papers over there.
[2:07:55] I take a picture every time I get a letter in the mail.
[2:07:59] I gave his name to the pool guy and he gave it to them
[2:08:04] because it's the only house that we bought.
[2:08:09] >> What's the date?
[2:08:10] I mean for me -- >> Over here come on November 19th
[2:08:13] that's when I received a letter from you guys.
[2:08:16] >> That's a while back keep going I want to get to when you
[2:08:18] got to the March date when you found out in March from the city
[2:08:21] that there was still issues pending you addressed the prior
[2:08:24] owner.
[2:08:26] March 27th is the paper that you gave to me, this is that.
[2:08:31] And this is the message before that I
[2:08:34] sent to him I said you guys are playing with us.
[2:08:36] You guys are doing nothing.
[2:08:39] This is the letter that you gave to me.
[2:08:42] About the charges every day.
[2:08:45] >> One second.
[2:08:45] So it says Friday March 27th no year,
[2:08:49] and what the picture is is a picture of the dock at.
[2:08:54] Understood.
[2:08:56] >> No he's just telling it.
[2:08:58] >> I'm just reading it.
[2:08:59] That's all I'm doing.
[2:09:00] So what did the owner say when you told him?
[2:09:13] >> He continued to lie.
[2:09:14] >> What type of reduction are you looking for?
[2:09:14] >> We're looking for reduction in all the fines.
[2:09:14] They have done everything they possibly can.
[2:09:18] >> I understand the reduction, you're going to receive
[2:09:21] reduction right?
[2:09:22] You're entitled to 50%.
[2:09:24] So you're asking for zero?
[2:09:27] I'm not going to do zero.
[2:09:29] But let me just -- >> I just want something at least
[2:09:32] on the record.
[2:09:32] >> What I'm trying to look at is what I feel is reasonable date
[2:09:35] for when you started to try to do something now,
[2:09:37] because you realize they're not doing something.
[2:09:40] >> So when they realized what was going on
[2:09:51] [Cross-Talk]
[2:09:52] >> Okay it's fine it's fine sending me things come
[2:09:54] here's what we did, the process the prior owner was
[2:09:54] in the process of doing things coming but I don't know what
[2:09:54] happened or where it fell apart because they just repaid
[2:09:55] and redid everything that he had done.
[2:09:57] >> When did you end up ultimately hiring your own
[2:09:59] person to actually get the engineering and getting that
[2:10:02] stuff done.
[2:10:04] >> 0525 20.
[2:10:07] And then May 25th.
[2:10:19] >> So from March 27th to May he was still hemming and hawing
[2:10:21] with you and you were still relying on him to do >> Still
[2:10:27] to this day he has.
[2:10:28] And I said stand down.
[2:10:28] I'm handling it.
[2:10:28] He said I'm disregarding you, we are
[2:10:28] allowed under the contract we disagree
[2:10:28] with your interpretation, we're remedying it we're handling it.
[2:10:31] So he still thinks he's handling it.
[2:11:07] >> I just want to say one more thing thank you to Sherry,
[2:11:09] you guys have a really great working team.
[2:11:09] The city almost forced me to not sign the paperwork she told me
[2:11:12] not only if you sign this paperwork everything's on you.
[2:11:15] You go behind them if you need to go behind them.
[2:11:18] I appreciate what she did.
[2:11:21] This is our first house.
[2:11:24] Like I explained to everybody we've never had the opportunity
[2:11:30] to buy before.
[2:11:39] I just want to tell you that we really didn't know.
[2:11:41] >> So what I'm going to try to do is I'm going to try to assume
[2:11:44] it in the best light that I can for you okay?
[2:11:47] So in March it sounds like when you might have first found out
[2:11:50] about it, but I'm going to actually give you the benefit
[2:11:52] of the doubt calculating the number of days that I can get
[2:11:55] to a higher percentage of reduction amount it looks like
[2:11:58] from good faith on May 5th is when you finally came in to try
[2:12:02] to get it complied, and from May 5th it took you from August 4th
[2:12:06] to get it done.
[2:12:07] So that's your compliance date which
[2:12:09] gives you percent of reduction.
[2:12:10] The shorter your compliance date the bigger your percentage
[2:12:14] reduction and you want a bigger percentage reduction.
[2:12:16] And then also for the dates of compliance,
[2:12:19] the fine is running $250 a day from the first compliance date.
[2:12:24] Now the compliance date was ordered October 1st of 2025,
[2:12:28] but I understand that that was the other guy,
[2:12:31] you thought he was doing it, he's not doing it,
[2:12:34] could be wishy washy I could say starting from 27 so I'm going
[2:12:40] to give you the benefit of the doubt which is still a lot more
[2:12:43] 250 a day for two months is a lot of money.
[2:12:46] So I'm gonna recalculate the fine starting with the date
[2:12:48] of May 5th 26.
[2:12:51] The date you actually hire the person to start doing the work.
[2:12:54] Just hold on a second.
[2:12:55] Let's do a calculation at 250 a day.
[2:12:58] Calculate it from May 5th 2026 do it through eight for 2026
[2:13:03] where we showed full compliance and tell me how many days that
[2:13:06] is and tell me what that new fine amount is.
[2:13:10] It's going to get you a 95% reduction
[2:13:14] because I'm giving you a shorter time frame.
[2:13:28] Still complied?
[2:13:31] >> Yeah everything's done now.
[2:13:34] We just don't know what to do because we've never
[2:13:37] been in this situation.
[2:13:38] >> I think the prior owner was trying to get them to do
[2:13:40] owner's permits and try to do things at the same time which
[2:13:43] also delayed us, because he by chance happened to hire the same
[2:13:46] contractor they ended up hiring.
[2:13:48] And that guy ended up ghosting me even.
[2:13:52] Despite me pretending I was going
[2:13:53] to use him as an expert witness to try to get him to respond.
[2:13:56] And then they paid someone else.
[2:14:02] They've been through a lot.
[2:14:09] Just went from 75% to 95% it's kind of a big deal.
[2:14:37] By date calculation we don't count the first day of May 6th.
[2:14:53] >> I'm giving you benefit of the doubt.
[2:14:53] All right.
[2:14:53] So come I'm recalculating it based on the date that you first
[2:14:54] attempted to make the effort.
[2:14:55] So despite what you went through the prior owner and the fact
[2:15:00] that you were relying on his misrepresentations,
[2:15:02] and basically indicating that your compliance
[2:15:05] date is modified to the 5526 so starting on 5526.
[2:15:11] The $250 a You calculation through eight for 26,
[2:15:15] is that's the date they previously gave you
[2:15:17] even though technically we've had some testimony showing
[2:15:19] technically the violation was until 810
[2:15:21] but we're leaving it as eight for which equals 91 days.
[2:15:24] I'm still going to give you the benefit of the doubt give you
[2:15:28] 95% reduction which is the highest reduction that I can.
[2:15:30] The new find about 250 a day comes out to $22,750
[2:15:36] as your principal amount that's instead of $76,750.
[2:15:41] So principal would have been $22,750,
[2:15:43] I'm giving you a 95% reduction which reduces it by $21,612.50
[2:15:49] your new principal amount instead is $1,137.50.
[2:15:55] Still hundred and $50 administration fee,
[2:16:00] a $54 recording fee and $100 in staff time.
[2:16:03] So your new total which of course
[2:16:06] I just deleted off my calculator is 1137 50
[2:16:10] plus 150 54 plus one one is yes.
[2:16:17] $1,441.50.
[2:16:19] Instead of >> Don't go by my math apparently it's off by $3.
[2:16:33] That's a significant reduction there's
[2:16:34] nothing more I can do I'm giving it
[2:16:35] to you with the benefit of the doubt with everything
[2:16:37] you stated.
[2:16:38] Understand you had money out of pocket
[2:16:39] dealing with the pool and this other guy.
[2:16:45] Right.
[2:16:46] I just saved you $76,000.
[2:16:48] So $1,441.50 it is due within 30 days.
[2:16:54] So you have to make sure that it was paid by October 2nd I think
[2:17:00] it is.
[2:17:01] You can pay it right now.
[2:17:03] She'll give you a slip and you can pay it
[2:17:05] up front so it's just done.
[2:17:06] They can pay it on a credit card right?
[2:17:09] You can pay it on a credit card.
[2:17:11] It is due just for the record it's due by October 2nd 2026.
[2:17:15] If you don't pay the reduced balance of $1,441.50 by October
[2:17:19] 2nd it will revert to the full amount due and you won't be
[2:17:23] allowed to come and request an additional reduction.
[2:18:01] >> You're doing everything you can.
[2:18:03] So hopefully this helps.
[2:18:03] Just make sure like I said, she will give you the paper it shows
[2:18:03] your case number of EN250017, again 1441 and $0.50.
[2:18:07] Thank you.
[2:18:14] I will continue to be a good resident okay?
[2:18:23] All right for the record I do want
[2:18:24] to put we address some of the building code
[2:18:26] cases on the prior docket during our code meeting,
[2:18:29] we had some stipulations.
[2:18:30] So for case number 1EN230015SPG Cooper City for case number
[2:18:40] 2EN250037 SPC Cooper City, I guess I'll write what it is.
[2:18:44] For the first case number we did a 75% reduction from $14,250
[2:18:48] to $3,562.50.
[2:18:50] You're welcome.
[2:18:52] And $304 cost and fees.
[2:18:54] For case number 2EN25-0037 we heard this earlier on the code
[2:19:00] case, this is part of a stipulation agreement,
[2:19:02] we agreed to extend compliance to March 1st 2027,
[2:19:07] we assessed to fine of $250 per day if it is not paid.
[2:19:13] 250 per day.
[2:19:16] >> Even though it was 100 prior?
[2:19:18] >> Yes the stipulation modified it so it's changing a new
[2:19:20] compliance date from March 1st 27 and a new amount starting
[2:19:24] at 250 per day starting on March 2nd 2027.
[2:19:28] For case number three, it's case number EN2539,
[2:19:33] this was part of a stipulation agreement heard during the code
[2:19:36] meeting.
[2:19:37] >> If I may we still have number 12.
[2:19:40] >> Okay let me just finish SB two right now because I'm almost
[2:19:42] done.
[2:19:43] We extended the compliance to March 1st 2027,
[2:19:45] payment the amount of $60,000 $60,500 plus 304 in cost
[2:19:50] and fees.
[2:19:51] It was ordered to be made payable within 30 days.
[2:19:55] If it is not paid then the original amount will revert,
[2:19:58] also the fine would be $250 per day it wasn't found by March
[2:20:05] 1st.
[2:20:07] EN26001 extending the compliance date to March 1st 2027.
[2:20:12] Fines in the amount of $9,100 were ordered to be paid
[2:20:16] as a reduced fine within 30 days.
[2:20:18] And the violation amount would be $250 per day.
[2:20:22] If it's not complied by March 1st that would start to commence
[2:20:25] as of March 2nd 2026.
[2:20:27] And that concludes that.
[2:20:29] I'm sorry which number do we have still?
[2:20:45] >> 12.
[2:20:46] Sorry.
[2:20:48] >> Sir can you just come up and sign the sign in sheet?
[2:20:51] I'm sorry about that.
[2:20:53] You weren't on the list.
[2:21:01] Going to get here either but there's no one here
[2:21:04] so we'll do that last.
[2:21:05] We'll wait for him because he's here.
[2:21:16] My name is Valentina Scrivano I'm the property manager.
[2:21:21] This project has been over three years,
[2:21:24] we're finally done we're compliant with everything.
[2:21:27] We submitted everything to building,
[2:21:29] I'm just here to reduce -- they wanted us to have the 40 year
[2:21:35] or I mean three years.
[2:21:36] When I started the engineers were already on site
[2:21:40] they did all the work and then they put an engineer
[2:21:44] to do monthly inspections.
[2:21:46] We did all of that we just finished painting right now
[2:21:49] so everything's compliant.
[2:21:51] >> Okay what was your name again for the record?
[2:21:53] How do you spell your last name?
[2:21:56] >> ESCRIBNAO.
[2:22:01] >> Okay so this is a reduction of fine,
[2:22:04] >> I went to get the 40 year with the building they told me
[2:22:07] there was like a lien?
[2:22:10] >> Yeah you have to address this first before you can do it.
[2:22:13] Maybe I have to pay.
[2:22:15] >> If I may madam Magistrate I'm looking at some of the history
[2:22:18] here I know there's this case, this is the only case
[2:22:25] that's on the docket, there's case 22-102.
[2:22:36] There's another case for the 40 year
[2:22:40] there's one for the balcony.
[2:22:53] >> I did that three years >> But I still have that the fine
[2:22:56] amount is outstanding.
[2:22:56] 102?
[2:22:56] >> The engineer submitted a report and close that out a long
[2:22:58] time ago.
[2:23:10] >> There was a code case and I believe that code case was
[2:23:13] complied.
[2:23:18] >> The only reason why I bring it up is
[2:23:20] because if we're reducing it in this case there's another.
[2:23:20] >> You're still not gonna be able to get your 40 year if you
[2:23:20] still have something outstanding.
[2:23:21] >> Exactly the thing I show another case from fines separate
[2:23:24] from this one because that case might be closed out.
[2:23:32] It looks like it might be as of last year but the fines 170 000.
[2:23:38] >> That was way worse.
[2:23:53] >> Nobody's gonna pay any fines.
[2:23:54] I'm gonna go ahead and address this one,
[2:23:54] but you're gonna have to -- >> That's not fair because this
[2:23:54] engineer's meeting with the city on a monthly basis.
[2:23:56] Those fines are illegal and unauthorized.
[2:23:58] >> He's just letting you know there's another case to look
[2:24:00] into so I'm going to address the one that's here today.
[2:24:03] >> What are the cases we get into combat because we did
[2:24:05] everything?
[2:24:06] We did the final report there's no other case.
[2:24:08] Everything is closed.
[2:24:10] We met with the city every month on the property
[2:24:12] with the engineer and the city.
[2:24:14] Everything costs money.
[2:24:15] >> Just don't worry about it if he comes back he says there's no
[2:24:17] case open -- >> Until you come back if you go for your 40
[2:24:23] and they say there's still another case pending then you
[2:24:25] have to going to have to address it that's all we're saying here
[2:24:28] I'm going to address this one.
[2:24:29] >> They can't say that when they say everything was done
[2:24:30] in compliance.
[2:24:31] >> You'll find out when you go.
[2:24:32] So he sees one.
[2:24:33] >> They can't say one thing and come back with another thing
[2:24:36] that's illegal.
[2:24:37] >> It's not illegal, he's telling you that he notices
[2:24:39] something and he's letting you know that it's out there.
[2:24:41] So you need to make sure whether it's out there or not.
[2:24:43] If it is there then it's there.
[2:24:46] >> It closed three years ago Ma'am.
[2:24:47] >> He's not saying it's not closed,
[2:24:49] he's saying that there's amounts due.
[2:24:52] >> They just care about getting money for this I understand.
[2:24:54] >> Fines are showing oh then they're still owed.
[2:24:57] >> You don't even care that people went through $500,000
[2:24:59] in the last three years that's irrelevant to you.
[2:25:02] >> This case is closed.
[2:25:03] But it's showing liens owing.
[2:25:05] He's saying that he shows another one showing that.
[2:25:07] So if it's the same situation and there's still a case
[2:25:11] closed that shows money owing.
[2:25:12] I am addressing EN220027.
[2:25:15] Which shows that you had a case completed and closed,
[2:25:21] but it shows fines owing in the amount of $20,850 as a principal
[2:25:26] fine plus 54 plus $100 for a total of $21,004.
[2:25:31] The case was closed on March 27th of 2024.
[2:25:36] So this case has been closed for over two years.
[2:25:39] But there is an amount due of $21,004.
[2:25:43] Now today you requested a reduction of fine.
[2:25:46] This shows that the compliance date was due on March 4th
[2:25:48] or I'm sorry February 4th of 2023,
[2:25:51] it was completed on March 27th and 24.
[2:25:53] That shows it took 417 days to comply.
[2:25:57] Based on city code violation that takes between 12 and 18
[2:26:02] months which is this timeframe, 417 days
[2:26:05] could get you a 50% reduction.
[2:26:07] So I've looked at the amount, 2850 I did a 50% reduction,
[2:26:12] that reduces your principal to $10,425.
[2:26:14] You still have the recording fee of 54, the staff time of 100,
[2:26:19] so it reduces your total amount due to $10,579.
[2:26:22] That would be the reduction of fine under the statute
[2:26:26] and you have 30 days to pay it.
[2:26:28] As long as the reduced fine of 10,000 579 is paid within 30
[2:26:32] days, then you're fine.
[2:26:33] If you don't pay it within 30 days which is October 2nd
[2:26:36] of 2026, then it reverts back to the full amount of $21,004.
[2:26:43] >> I can pay that.
[2:26:44] Do you have a little paper I can get the numbers?
[2:26:46] And where to send it to?
[2:26:48] >> Yes can you write that down 10,000 579 is his total.
[2:26:52] Principal amount was ten 425.
[2:26:54] There was a $54 recording fee, and you
[2:26:59] can do staff time if you need it again the total is ten 5792
[2:27:02] by ten two 2026.
[2:27:05] And that's your reduction of fine
[2:27:07] and that's for case number EN22-0027.
[2:27:13] Mhm yeah 220102.
[2:27:18] >> Okay so that completes number 12. -- case number 12.
[2:27:22] Let me just make sure we hit everything else
[2:27:24] before we get to nine.
[2:27:26] I think we did.
[2:27:28] Okay.
[2:27:28] So let's go to case number nine.
[2:27:32] The total was ten 5792 by ten 226.
[2:27:51] >> Yeah so that one should be on here two.
[2:27:53] >> So we're at number nine.
[2:27:53] I'll just read it.
[2:27:53] EEN260016 David.
[2:27:54] County amendments to the 23FBC eighth edition effective
[2:27:57] December 20th sorry come in December 31st 2023 section 105
[2:28:02] permit section 6-4 of the code adoption of Florida Building
[2:28:05] Code permit required for 7-7-26 unsafe structure caused by fire.
[2:28:10] Sign submit plans, document plans,
[2:28:14] obtaining permits after approval and permitting
[2:28:17] is issued the inspection listed plans to include structural,
[2:28:22] note for the record no one is present.
[2:28:24] Ruth can you advise how notice was provided?
[2:28:37] >> Notice with certified regular mail to the address
[2:28:39] on the website.
[2:28:40] >> Ralph would you like to present the case please?
[2:28:49] Of the fire the very next day I went out
[2:28:52] and posted unsafe structure violation on the home.
[2:28:55] And the violation of what was required to be done.
[2:29:01] To make the home safe again.
[2:29:03] As of today I have not received any plans or anything
[2:29:08] to correct.
[2:29:09] I know that the fire happened like a month or two
[2:29:14] after this after Mr. Parameter purchased the home he bought it
[2:29:20] at auction I believe.
[2:29:24] There was a tenant that was occupying the house that he
[2:29:27] was trying to get evicted.
[2:29:30] They eventually left after the fire.
[2:29:35] I could find out since the fire he tried to put it
[2:29:38] back on the market as is.
[2:29:40] I thought he had a buyer.
[2:29:47] I like to pay this morning he still listed it as the owner.
[2:29:54] I don't know where that's at I haven't received anything
[2:29:57] from the building department.
[2:29:58] What's the condition coming back is
[2:30:00] it an unsafe structure meaning is at risk of collapsing?
[2:30:03] Or there's a hurricane then there's risk?
[2:30:06] >> It's smoke from a fire come the smell come to the fire
[2:30:09] department broke out windows coming tore out ceilings come
[2:30:11] and tore down walls, just to try to contain that fire.
[2:30:16] >> But it's not a hazard to surrounding neighbors?
[2:30:19] >> No.
[2:30:20] All right so then I'm going to
[2:30:24] >> I'm going to go ahead and assess fines.
[2:30:29] Who keeps taking my little list of dates.
[2:30:40] I don't know if he was tend to.
[2:30:45] I'll just do my 30 because I know that was in my head.
[2:30:48] So we'll do compliance date of ten two
[2:30:50] which gives 30 days, ten 226.
[2:30:53] Fined in the amount of $250 per day.
[2:30:58] Administrative fee of $150.
[2:31:00] Due by ten two.
[2:31:03] So fines will start to accrue starting ten three
[2:31:06] if not complied.
[2:31:13] And that's it.
[2:31:15] That's the last case.
[2:31:17] So that will conclude the building meeting at 1139.
[2:31:22] Sure.
[2:31:23] Let me just --
[2:31:26] 30 days to comply $250 per day.
[2:31:30] So the compliance date is ten two 2026.
[2:31:34] And the administrative fee of $150
[2:31:37] do the same day so the fine will start to accrue on ten three.
[2:31:43] Yeah, put it on the October 7th meeting at 945.
[2:31:48] So we will certify the fine then.
[2:31:57] And then I concluded the meeting at 1139.
[2:32:03] Thank you Ralph.
