[0:47] We've had some passings in our community and some anniversaries of some passings in our community.

[0:53] I wanted to recognize the passing of our teacher and here at the county, Mr. Derek Moore,

[1:00] who passed the other week, saving a life in Florida.

[1:03] We also have the anniversary of Mr. Gary Bernard with the City of Decatur, and I know we have

[1:09] some Decatur Firemen with us here today I believe.

[1:12] And then we have also recently had some members of the BLC family who have had passings in

[1:18] their family as well.

[1:20] So we want to take a moment to pause for them, and then we're coming, we just have the anniversary

[1:25] of the passing of Officer Rose and Master Firefighter Fans' anniversary is coming up soon.

[1:32] So, if this time, if we could just take a moment to pause and reflect on the losses that we have experienced into Cap County,

[2:41] operations. She is committed to excellence and continuous development. Lauren began

[2:46] singing at the age of five with the encouragement of her parents. Her gift has

[2:51] allowed her to sing Gailas and alongside artists including the Nointed Paste

[2:55] Sisters and Kira Shard. Through both her career and music Lauren strives to inspire others

[7:40] Lorraine Cochrane Johnson, welcome and thank you for joining us as we recognize the

[7:46] extraordinary contributions of the Cab County's Hispanic and Latino communities.

[7:51] Although National Hesperic Heritage Month officially begins September 15, Madame CEO wanted

[7:57] to take this opportunity to celebrate a little early and recognize the community leaders

[8:03] and partners who helped make the cab county such a bright vibrant and welcoming place.

[8:11] Today we also honor Mexican Council Rafael Lavega for his outstanding leadership and

[8:17] partnership with the cab county.

[8:19] We are pleased to welcome Deputy Council General Oswaldo A. Conto, who will accept this

[8:25] on the Council's behalf.

[8:28] We also extend a warm welcome to our distinguished guests

[8:31] Veronica Maldon, Maldonato Torres, Carlos Pagolga.

[10:05] We're as Hispanic Heritage Month is an annual celebration of the history and culture of the U.S.

[10:12] Hispanic and Latino communities. Hispanic Heritage Month 2026 is observed from Tuesday, September 15th through Thursday, October 15th.

[10:23] This event commemorates the ways these communities have influenced and contributed to society

[10:29] at large, whereas the Cap County is home to a vibrant and diverse Hispanic and Latino community,

[10:37] whose rich cultures, traditions, languages and histories have strengthened the social, cultural,

[10:43] and economic fabric of our county, and whereas residents of Mexican origin constitute one

[10:51] the most significant and longstanding Hispanic and Latino communities.

[10:55] And to Cap County, contributing to the county's cultural

[10:59] vibrancy, entrepreneurial landscape, and economic growth

[11:03] for a thriving community of Hispanic and Latino owned businesses

[11:07] throughout the county.

[11:09] And whereas to Cap County proudly recognizes the leadership

[11:13] and diplomatic service of Mexican council,

[11:17] Raphael LeBagod, whose work strengthens cultural exchange, community trust, economic development,

[11:25] and access to Councillor Services, along with collaboration, collaboration between

[11:31] the Cap County and the Council of Mexico in Atlanta.

[11:37] And whereas the Mexican Council has consistently partnered with the Cap County to an

[11:42] and its cultural programming, advanced Hispanic and Latino entrepreneurship, and brought

[11:48] on community engagement, thereby demonstrating a shared commitment to the well-being

[12:28] half of the Gap County, Georgia, together with the Gap County Board of Commissioners

[15:00] We had an opportunity not only to celebrate businesses but the people behind them. The people who took a chance, stepped out on faith, created opportunities, and then reached back to help others. Again, great morning. I have the pleasure to serve as your to cab county commissioner district three.

[15:19] And I am here to celebrate Dr. Valencia Vow, Prince Littleton, because she is one of those

[15:27] people that created opportunities here in the cab county.

[15:32] Listen to this, for decades, Dr. Littleton has been an entrepreneur, an advocate and

[15:40] a servant to this community.

[15:43] She has built businesses, helped owners facing poor closure, vet families, provided toys,

[15:48] the children and use her own experiences to advocate for others. She has consistently used

[15:58] what she has built to strengthen families and to give back again to the communities around her.

[16:04] This is the kind of entrepreneurship we want to recognize Indicab County. Businesses that create

[16:10] opportunity, leaders who invest in their neighborhoods and people who show the next generation

[16:16] what is possible. And sometimes we all need to see what is possible. She already

[16:22] all way down here. She's always a diva. I absolutely love my girl. I love it.

[16:41] Vice-Littleton is a beacon of excellence during National Black Business Month and to thank

[16:49] her for the many years of leadership and service to the Cab County and District 3 and Memorial

[16:57] Drive and all throughout and I'm going to tell y'all those turn up greens are something you

[17:02] got to go have them if you had it.

[17:06] This vow, congratulations, and thank you for continuing to serve our community.

[17:22] Whose life and career reflect a deep commitment to faith, entrepreneurship, service,

[17:28] and the empowerment of others, and where as a graduate of South West High School and

[17:33] Fort Valley State College, now Fort Valley State University, that's a little

[17:38] built a successful career in corporate America, before stepping out on faith in 1997, to pursue

[17:46] her entrepreneurship and create opportunities for herself, her family, and her community.

[17:53] And where is that the little bit has demonstrated the spirit of Black Entrepreneurship through

[17:59] several successful dentures, including Price, Littleton, and Associates, Madea, Soul, Food, and

[18:06] talk of the town's soul food.

[18:08] Establishing herself as a business woman, community leader, and role model for a sparring

[18:13] aspiring entrepreneurs, and where is Dr. Littleton founded ACCS advocates in 2010, and

[18:22] use her knowledge and experience to have thousands of homeowners facing financial hardship and

[18:27] possible foreclosure.

[18:29] Welcome to working to have families preserve their homes, financial stability, and a critical

[18:35] part of the American Dream. And whereas her commitment to the Cap County extends far beyond

[18:42] business as she has devoted decades to serving families and children through faith based

[18:48] outreach holiday assistance and annual Turkey giveaway that has distributed and estimated

[18:54] 2,000 turkeys and a toy drive spanning more than two decades. And that's a little bit

[19:00] continues to use her life experiences to serve others, including becoming an advocate for Alzheimer's

[19:07] awareness, after caring for her mother for nearly five years. And Dr. Belensia Valle,

[19:13] Price Littleton, embodies that tradition of excellence through her entrepreneurship spirit,

[19:19] her commitment to the Cat County and her unwavering ability that success carries with it a responsibility

[19:26] to lift others.

[19:28] Now, therefore, be it resolved that I, Commission and Nicole Messiah, and the DeCAP County Board

[19:34] of the Missioners and is more than 780,000 citizens, do year by-recognized Dr. Vale

[19:41] Price Littleton for her outstanding contributions to DeCAP County, her decades of service to

You got to wear some boozey shoes to them, redding. We'll tend to shoes. I think we have more issues in our county to worry about blowers or electric. So let's talk about that before you start voting on stuff.

[30:32] I got issues. I was so frustrated last week, but let's talk about it now. We have done

[30:37] housed in our county. There's a building at 85 and 25 to 0 hotel. This county needs to do

[30:45] whatever it can to acquire that building. We could have the medical offices in the basement,

[30:52] psychiatrists, psychologists, it's on the bus line. It's near the grocery store. It would work so

[30:59] beautiful Michelle Spears. I love the commissioner for the Brookhaven Chamble area. I have

[31:08] questions with unhoused every day and I call her on a cell and I bug heck I'll ever. But

[31:13] she has helped me for many times. I want this county commission. Y'all talk and not listen

[31:20] to me. We have been paying on a library bond for 25 years. This is the last year we're

[31:29] on it. We still don't have a new library in Brookhaven. Somebody has stolen my six million dollars.

[31:39] We want it at what we call what the old is the VA hospital used to be. They did a stroll like

[31:46] a road on it but the reason the people voted against it having it at what we call the dog park

[31:52] is they didn't want the city manager from the city of Brookhaven

[31:57] to have his hands on the old building.

[32:00] The EPA, the county came forward to do the development of that old library.

[32:05] And we'd have to close it for a year and a half as we build it.

[32:09] If we build a new one at a park, it will work.

[32:13] Have a library at a park walk outside, read your book.

[32:17] I was playing on reading books 25 years ago to my kids.

[32:23] Now, my kids are having kids.

[32:26] Twenty-five years we've been paying on this bond.

[32:28] God, y'all got to wake up.

[32:30] Get your head out of the sand and let's get this thing done.

[32:52] but if somebody in their family gets raped or shot or murdered,

[32:58] look on your cameras and tell me who killed somebody.

[33:01] So we need to keep those cameras in the Cal.

[33:12] Russell McIntyre, the cab county.

[33:14] Board of Commissioner members, the citizens of the CAB County demand that you honor and I quote that is governing authority of the CAB County is task with protecting the health, safety, and general welfare of the citizens of the CAB County Georgia.

[33:32] Be very clear about this. The CAB citizens want a data center text amendment, specifically one that protects the health, safety and general welfare of the CAB citizens.

[33:43] We want a tax amendment that is written using data glean from a professional health and environmental impacts study.

[33:51] A major reason the previous tax amendments failed citizen approval was because they appear to be written

[33:57] to support specific vendors, not for the health safety and general welfare of the cap citizens.

[34:03] We implore you to approve and fund and independent third-party data center health and environmental impacts study,

[34:10] Only in the areas in which the proposed data centers will be constructed.

[34:15] Not a general study that includes all of the cab county which would dilute and skew the results of the communities that will be affected.

[34:23] The moratorium was extended to March 30, 2027 to provide sufficient time to allow for further study to gain factual information to write an appropriate text amendment.

[34:34] Communities who saw legal action after the fact to protect public health from AI data centers

[34:41] include low Massachusetts. The court issued a state to halt the installation of massive

[34:47] industrial diesel backup generators, Canton, Mississippi, an Amazon AI data center open and

[34:55] and it's quickly reported, acute long irritation, respiratory distress.

[35:00] However, as in pervasive construction does,

[35:04] the public outrage triggered a class action lawsuit

[35:06] alleging clean water acts violations. Memphis 10 is C. The EPA stepped in against the X-A-I facility,

[35:15] because of toxic air caused by methane gas turbines. An increase in health problems and deaths,

[35:22] Memphis City officials, commission an independent laboratory study. We are asking that a cab water

[35:28] Commission is to be proactive in ordering an independent third party health and environmental

[35:33] impacts study during this moratorium to get the data and information that should be employed

[35:38] to guide their decisions and to write an appropriate text amendment that will protect the

[35:43] health, safety, and general welfare of the citizens of the camp counting.

[35:48] A task that a camp counting board of commissioners has been sworn to provide to people

[35:53] whom they represent and serve.

[36:06] My name is Lane Flynn and I live at 3127 Blerodrive Commission District 1 Super Commission District 7.

[36:13] I'm here today with one simple request and the flock contract.

[36:17] This contract was put in place with zero public input or comment.

[36:21] Since we weren't asked in advance, I'll share our opinion now.

[36:24] We hate the surveillance networks.

[36:25] It's easy to prove, just look at any article anywhere talking about flock.

[36:30] You'll see it gets hundreds, thousands of comments, they're virtually all negative.

[36:34] Why?

[36:35] Because contrary to flock marketing claims, the system absolutely does crack everybody.

[36:39] That is, it's basic design.

[36:41] Anyone in this room who drives by a flock vehicle camera will have their vehicle recorded

[36:46] in log and anyone who walks by a flock con-door camera will be recorded and logged themselves.

[36:51] It's not just one scan, but the fact that this info is then uploaded to a flock AI database which maintains a comprehensive record of everywhere you've gone and when and even who you're with.

[37:02] This isn't just a snapshot in time. It's hundreds of scans per month creating a comprehensive constantly updated map of your entire life accessible at any time by anyone with access to the system.

[37:13] We know for a fact the system cracks innocent people, because dozens, if not hundreds of police officers nationwide, have been caught using the system to track innocent people.

[37:23] As I'm sure you all know, just a few weeks ago, eight the cab officers were caught illicitly using the system.

[37:28] week before that, it was a sheriff's deputy, make it Savannah Habersham Brazzleton, all over

[37:34] Georgia and the U.S. the abuses are nonstop and they're only increasing. And it's

[37:39] not just illegal searches, numerous innocent people have been dragged out of their cars

[37:43] at gunpoint or even jail because flock made mistakes. It's been used to target people for

[37:48] their political beliefs, which is terrifying because DeCab has deployed mobile flock units

[37:53] to political protests. A whistleblower who used to work for flock has documented that surveillance

[37:59] data has been shared with ICE for immigration enforcement even from departments that didn't

[38:03] agree to that shared. The misuse of this dangerous and unregulated system is perhaps going

[38:09] to be the biggest police scandal in U.S. history if it's not already. The cab frankly can't

[38:13] afford to lose any officers and I'm not here because I want them fire. I'm pro-police. Instead,

[38:20] I want to see the system shut down not just to protect our citizens, but to avoid the obvious

[38:25] temptation for otherwise good cops to commit serious crimes just because we've made it

[38:30] incredibly easy for them to do so.

[38:32] Oh, and on top of all that, FBI staff showed that over the past four years when Atlanta

[38:37] installed war-flock cameras in anywhere else in the world, crime didn't even fall, in fact

[38:41] it rose in some categories.

[38:43] Flock wants you to focus on anecdotes, but serious policy has to be based on data and the data

[38:49] show that flock isn't even helping solve crimes.

[38:52] Over 100 municipalities have ended their flock contract after seeing for themselves the level

[38:56] of abuse, the lack of impact on crime statistics and the massive public opposition.

[39:01] I'm just asking the commission to do what all those cities and towns have already done.

[39:05] Listen to their citizens, protect both the public and the officers of cab and terminate

[39:09] the flock contract.

[39:19] I'm at 1865 Mercedes Court,

[39:22] and I'm here as a member of the Greater Towers Community Association.

[39:29] First things first, there are grants I understand.

[39:32] There might be purbuteification.

[39:34] Once as it's urban area, security initiative,

[39:38] another for high intensity drug trafficking. If you could just take the microcosm of greater

[39:45] towers community association in 303-2. If you want to apply some grant money and see it at work

[39:52] with good stewardship, initiative, and some empowerment behind it, it's good place to start.

[40:00] Kind of got the idea in my head was when I first heard in January, this year called the Glenwood Sweep, and I heard about it, sounded like it could be done as a multi-departmental, amazing effort to put rules and standards in place that might could be enforced over a period of time, sounded good, but as I understand here in August, there is no such thing right now as an active initiative for a Glenwood Sweep.

[40:27] So, why a Glenwood sweet? Well, if it can be done empathetically for the people involved and done with some rules and standards for the commercial owners,

[40:38] it seemed like a really good place to start into Cap County Glenwood.

[40:44] I'll bring it back to a street in Medinale, part of the Greater Towers Community Association.

[40:51] It's called Lark Spartares.

[40:53] It's two streets north of Blindwood.

[40:57] And over a period of the past few months,

[41:00] there's been so many cases of vandalism,

[41:02] so many cases of vagrancy, so many cases of squatting,

[41:06] so many cases of gosh, we've had just terrible

[41:10] reckless driving on that one little street,

[41:12] including the loss of a male carrier

[41:15] to a reckless driver in that street.

[41:17] Now, all that grant money and all that sounds

[43:23] However, as I stated, we need community and not cages.

[43:28] The services that we offer here in the cab county are not comprehensive enough to make sure that

[43:33] we completely remedy our issue of unhoused individuals.

[43:37] We are making some strides. We need to do more. We need to really look holistically at how it is that we work with compassion with sympathy with empathy with people who don't have a place to live.

[43:51] Deciding to piggyback off of useless legislation introduced by the city of Atlanta because they want to capitulate to Trump is not governance. This is not legislation. It's not helpful for the community.

[44:06] Perhaps, if you had taken the time to really talk to people about issues of houselessness,

[44:13] what drives it, look at the root causes, and think about getting resources into communities

[44:20] that don't leave people without a home, you could have been doing that before you decided

[44:30] It would have been so much more helpful if you had come along during the count that happens

[44:37] early in the year when we go to hot spots where unhoused people are because you wouldn't

[46:57] Texas to talk to two decayed county commissioners about how they could get this done without

[47:02] permission they started building their data center and now have filed a 30 million dollar lawsuit

[47:07] to bully the cab county into letting them do so. How did this happen? As always, let's follow the money.

[47:15] On March 31st, 2025, Shadowbox Studio gave a $1,000 contribution to Commissioner Robert Patrick.

[47:23] The address given for the donation was 335 Epington Drive. Remember this address, it will not be the last time you hear it.

[47:31] On February 26th, 2025, a Mr. John Bean from 335 that been to drive made a $3300 contribution

[47:40] to Mr. Patrick's campaign fund. Mr. Bean also made a contribution of $3300 on January 26th,

[47:49] 2023, and the person named Julia Cruz well from 335 that been to drive made an additional contribution

[47:55] of $3,300, also on June 26, 2023, that there's $11,000 in list in two years.

[48:03] How much access does $11,000 allow someone?

[48:06] Shadowbox Studios is not even in your district.

[48:13] Commissioner Marita Davis Johnson received a $3,300 campaign contribution from a Mr.

[48:29] contribution of $258.32 was made by Mr. John B. How much access does $3,600 buy or do

[48:39] you just work cheaper than Mr. Patrick? Is Shadowbox studios in your district? How about

[48:45] step into drive, even Commissioner Nicole Messiah received the $3,300 campaign contribution

[48:51] for Mr. John Bean on October 8, 2024, followed by a contribution of $1,800 on November

[48:59] 18, 2024 by the same person for a total of $1,500.

[49:10] racist con man Ryan Milsef and shadow box studios and total that is nearly $20,000 a shadow box

[50:26] their commitment to ensure that all decisions are guided by sound analysis, meaningful public

[50:39] Commissioner Baltimore, denying the text amendment brings several important benefits, a

[50:45] stronger case for extending the moratorium, a clean slate to restart the process with transparency

[50:54] An opportunity to explore other options allowing us to evaluate alternative approaches, gather additional data, and work collaboratively, toward a framework that better aligns with community priorities.

[58:31] I'm speaking in my personal capacity as a resident, a housing stability professional, a public

[58:38] policy and real estate student, and someone would live experience in housing instability.

[58:43] I respectfully ask the board to defer ordinance 2026-05504 substantial revision and collaborative

[58:52] of stakeholder review. I recognize that the county has a legitimate responsibility to keep

[58:58] sidewalks, parks, businesses, and public infrastructure safe and accessible. However, we must

[59:04] distinguish between conduct that creates an actional public safety obstruction and the condition

[59:09] of having nowhere else to go. Through my work supporting families, experience, and homelessness,

[59:14] my policy research and my only experience, I have learned that homelessness is not simply a matter

[59:19] of refusing services. People often face shelter shortages, coordinated entry, weightless, documentation

[59:26] requirements, income verification barriers, limited affordable units, prior evictions, and

[59:32] landlords unwilling to accept available assistance. A warning and verbal offer of services are

[59:38] not meaningful protections if transportation, appropriate shelter, storage or an actual housing

[59:43] pathway is unavailable. Refusing an option does not accommodate a family, that does not accommodate

[59:50] a family, their disability, unemployment schedule, belongings or other legitimate needs should

[59:55] not automatically placed someone on a pathway towards a risk.

[1:00:00] The proposed ordinance raised a serious implementation question. What written protocol will

[1:00:06] govern enforcement? What qualifies as a meaningful offer of services? How would a county verify that appropriate

[1:00:12] shelters actually even available? How would personal property, identification, medication,

[1:00:18] and documents protected and reclaimed? What agency will track these outcomes and assure that people

[1:00:23] are being connected to services rather than merely displaced to another location? These questions matter

[1:00:29] because losing identification and court documents, medication, or contact with the case manager

[1:00:34] can make an already difficult housing placement even more challenging.

[1:00:38] The county's previously adopted policy calls for diversion, coordinated assistance,

[1:00:43] wraparound services, and alternatives to arrests.

[1:00:47] This new ordinance to strengthen that commitment not create big and potentially contradict

[1:00:51] the rate enforcement practices.

[1:00:53] before adoption, I asked the board to require a written enforcement,

[1:00:58] property storage protocols, documented service capacity,

[1:01:02] measurable diversion outcomes, and direct participation from service provider

[1:01:06] and residents would live experience.

[1:01:08] I will welcome the opportunity to participate in a stakeholder review process

[1:01:12] and contribute both my leave and professional experience.

[1:01:42] I'm here today representing House ATL and DeCab housing roundtable to similarly speak against

[1:01:48] the prior ordinance. Homelessness is a housing problem and not a failure of enforcement.

[1:01:56] Your prior resolution, we want to commend to approach homelessness through the housing

[1:02:01] first approach and to work to develop a coordinated plan for the unhoused, those are proven

[1:02:07] best practices. The current ordinance before you is not. It is inconsistent with that approach.

[1:02:12] Rents and the CAB County have increased about 30% over the past five years much faster than income

[1:02:19] have grown, which is resulted in more than 50% of the CAB County Render's being housing cost burdened.

[1:02:27] Research from the U.S. Government Accountability Office shows that for every $100 increase in rent results in a 9% increase in homelessness.

[1:02:36] To prevent homelessness, we need to stay focused on increasing housing opportunities and

[1:02:41] options.

[1:02:43] Arresting and jailing people who are homeless for trying to survive can worsen rather

[1:02:48] than solve unsheltered homelessness, arrest records create barriers to housing.

[1:02:55] The arrest as previously noted by the prior speaker, arrest also result in the loss of important

[1:03:02] identification documents, social security cards, medical prescriptions, and this also makes

[1:03:08] finding future housing very difficult.

[1:03:11] Jailing people for being homeless waste taxpayer dollars, public costs are incurred when

[1:03:17] law enforcement make the arrest and costs grow as the individual is incarcerated.

[1:03:23] Cab County Sheriff Maddox has already told us that the cab county has already stated

[1:03:27] that the cab county commission that the jail is overcrowded, with few resources to address

[1:03:32] potential mental health and substance abuse issues.

[1:03:36] Tax funds are wasted without resulting in a long-term solution.

[1:03:40] The daily cost to house at the DeCab County Jails

[1:03:43] approximately $1,150, or a monthly cost of $3,450 to $4,500.

[1:03:52] This is less than the cost of a studio apartment into CAB County,

[1:03:56] which is approximately $1,400 to $1,500 a month.

[1:04:00] Once the person's time is served in jail, the individual is returned to the street, still in unhoused at a waste of taxpayer dollars.

[1:04:09] Nationally, the development of ordinances like this are being bankrolled by a tech billionaire named Joe Longstale,

[1:04:16] who created a think tank called the Cicero Institute.

[1:04:19] I think you should be aware that there are 10 plate ordinances being circulated around the country from the Cicero Institute.

[1:04:27] These ordinances encourage incarceration rather than housing and services, we should not be part of this handcuffs trend.

[2:07:23] I would like to request that in the spirit of consensus building

[2:07:29] and compromise and also I think the intent of these real changes to remove the, I guess, the three vote rule is what we're calling it from this real change.

[2:07:47] And the main reason is why I'm requesting this is number one, well, a couple of things I'll start with.

[2:07:55] One, just the general consensus and understanding that each commissioner is elected.

[2:08:02] For district commissioners, it's over 150,000 residents, if you're a super commissioner,

[2:08:06] it's 350,000 residents, and presumably when folks elected us, they thought that we would

[2:08:12] be able to introduce legislation to represent them.

[2:08:16] It has been the policy of the Board of Commissioners that any single commissioner can introduce

[2:08:21] legislation to begin that public discussion about policies, issues, funding items, anything

[2:08:27] really germane to what their constituents want.

[2:08:31] My concern with this three vote rule is that it basically turns what would be an open

[2:08:36] democratic process into an unrecorded pocket veto, because what the rules are saying is that

[2:08:41] a commissioner needs two other sponsors, he three commissioners, which is 43% of this body

[2:08:48] before an item can even be brought to the public.

[2:08:52] But even in the rules that are being considered now,

[2:08:54] it says that before the law department or central staff

[2:08:58] can do their work, you need three commissioners.

[2:09:01] And so I would say just on the grounds

[2:09:03] that if a commissioner wants the law department or central staff

[2:09:07] to help us work on ideas, it shouldn't take three commissioners

[2:09:11] just to even get to the point of deciding

[2:09:13] whether we want to discuss an item.

[2:09:16] The committee system, I think, is designed for those discussions to happen.

[2:09:23] I'm actually aware that the committee itself can discuss items at the leisure of the chair.

[2:09:30] So there is a way actually for there to be three votes to bring items to the agenda that would be

[2:09:35] the committee could simply ask the committee members to bring that legislation forward and discuss in that committee beforehand.

[2:09:43] And there were discussions about the legality of the rule change, and I think we've heard

[2:09:49] that legally the Commission can enact its own rules, but just because you can, doesn't

[2:09:53] mean that you should.

[2:09:55] We have acknowledged that there are some Board of Commissioners bodies in the cap cap.

[2:10:00] In Georgia, excuse me, that have a higher threshold, I believe it was referenced, Bartow County requiring

[2:10:07] four commissioners before an item can be introduced, although their chair can introduce items to the

[2:10:12] agenda whenever they want. The rule change also is still preserving the ability of the CEO to

[2:10:20] introduce an agenda item whenever she wants. And then, I guess, the presiding officer also can still

[2:10:27] in the latterly place items on the agenda.

[2:10:30] So while the CEO and the person who over the presiding officer is can't add an item to

[2:10:33] the agenda, you know, latterly, it takes three of us under this rule change to introduce

[2:10:39] any items to the agenda.

[2:10:41] This is sort of like a multi-member pre-clearance situation, and it could be a good thing

[2:10:50] if tailored in the right way, maybe through a quarterly retreat process where the boards

[2:10:56] committees work on ideas and hopefully through that retreat process and a work plan we can get

[2:11:01] to, you know, two commissioners, three commissioners, but it could be abused. There could

[2:11:06] be a support in the future where two commissioners, a district commissioner, and a super commissioner,

[2:11:11] decide there's something really important to their districts, but the other five commissioners say,

[2:11:17] we don't want to deal with it. And so it basically prevents any one or two commissioners from bringing

[2:11:23] items to the board for considering consideration.

[2:11:27] I think also forcing the three commissioners to negotiate

[2:11:29] behind the scenes before anything can be brought to the public

[2:11:32] light basically creates this danger of horse trading,

[2:11:40] where by the time you all see anything that comes to our agenda,

[2:11:43] it's already basically been worked out.

[2:11:45] And even more concerning is if three of the commissioners

[2:11:49] are on the same committee, then now we have just

[2:11:52] bypass the whole committee process.

[2:11:54] The committee process was designed for deliberation.

[2:11:58] And finally, I think the other concern with this rule change

[2:12:01] is that the Robertsville's order still preserves the right

[2:12:05] for a motion in a second to add an item to the agenda.

[2:12:10] And so what might end up happening is,

[2:13:20] And most of us spend a good part of our Mondays getting prepared for today's meetings, plural, this one plus the committee meetings.

[2:13:28] My question to you, sir, is something that Commissioner Terry brought up about the presiding officer being able to add an item without the three sponsor rule.

[2:13:39] I just kind of glanced at our presiding officer, and I think she's potentially not an agreement on that.

[2:13:46] Could you just expand? Is that something we're done that memo that maybe we didn't fully read into?

[2:15:36] last year and there I believe was some commentary through email about this new rule so it's

[2:15:44] don't recall when it was but I believe it's taken a full year to kind of advance it forward

[2:15:48] and my feeling on this is that the purpose of this committee structure we have five committees. Each committee

[2:15:56] has three standing members on those committees and then other commissioners are able to participate

[2:16:03] in attend those committee meetings and after the committee member's feet that then they are

[2:16:09] able to also speak or deliberate debate, open, on each agenda item that's being discussed within

[2:16:16] that particular committee meeting. So to me, the structure was already designed to have a

[2:16:24] may be not necessarily a vote, but a recommendation from three commissioners.

[2:16:31] So this new rule, in effect, has the pre-three sponsor rule, then it goes once you get

[2:16:38] those three sponsors, as commissioner Terry pointed out, 43%, then it comes to a cow meeting

[2:16:45] and determine which committee, then it goes to a business meeting and at that point I know

[2:16:50] The presiding officer asks us not to debate or deliberate too much during the business meeting,

[2:16:56] but for it to actually go to the committee meeting for that deliberation at which three

[2:17:01] commissioners make a recommendation, and that recommendation could be for approval, for denial,

[2:17:07] for withdrawal, it can also be tabled within committee if you don't get to that item or if

[2:17:13] the committee chair really just feels like there needs to be more due diligence on the back end.

[2:17:18] So I am of the opinion that the structure we currently have in place is sufficient to deal with them.

[2:17:25] So my substitute motion and Mr. County attorney now, if you can make sure I make this correctly,

[2:17:34] is if we could please remove the three sponsor.

[2:17:38] So my motion is to remove the three sponsor rule from the overall vote of our blue book, our procedural rules,

[2:26:46] So, to the extent since we have a responsibility as commissioners, as long as we're not doing it like some of my colleagues here, in adverse open meetings, if there is a socialization and a brief discussion, and you get support and garnish support, that just allows an opportunity for collaborative leadership and discussion around how we can make it better.

[2:27:21] more efficient legislation before we deliver it with the rest of our colleagues and then vote.

[2:32:52] So there has been considerable dialogue about this item, and I wanted to address a couple of issues that have been brought to my attention.

[2:33:07] The first thing is that I get all my papers organized, a huge stack all relates to this.

[2:33:15] Okay, this item has been active now since the spring, so it's been ongoing now for many, many months.

[2:33:24] The date of the previous version was dated June 9th and I just had my office confirm that.

[2:33:33] On June 8th we did receive considerable feedback from Dr. Allen Ferguson, our housing officer,

[2:33:42] and that was a email that was sent to me and then distributed to all of the commissioners making

[2:33:49] several recommendations for the urban camping ordinance. I have limited time so I'm going to

[2:33:56] read very quickly and I will request a second time to speak. So the very first thing he requested

[2:34:02] is a title change to what you currently read on the agenda to read an ordinance to amend the

[2:34:12] in camping, in camp management, public access, and public safety, and for other purposes.

[2:34:19] He've been also added to extra warehouse statements that I wholeheartedly believe and agree

[2:34:25] with both of them, whereas the Commission recognizes that homelessness is fundamentally

[2:34:30] a housing and service delivery challenge that is best to dress through access to housing

[2:34:34] shelter, behavioral health services, supportive services, employment, opportunities and coordinated

[2:34:39] community resources and whereas the purpose of this ordinance is not to criminalize homelessness

[2:34:44] or poverty but to preserve public health and safety while connecting individuals to available

[2:34:50] services and housing resources whenever possible. The reason I elevate the addition of these two

[2:34:56] as statements. I believe that it is fair.

[2:35:00] And all of our desire to ensure that our unhouse plan really sinks with our overall housing

[2:35:07] complaint, and that it is a compassionate solution to the homelessness crisis that we're dealing

[2:35:15] with right now here in DeCab County. He further goes on to revise the definition of camp. Camp

[2:35:22] means using public property for living accommodation purposes, including sleeping, storing personal

[2:35:28] alongings, erecting temporary shelters or structures, cooking, maintaining bedding materials,

[2:35:32] or otherwise residing in a location not intended for human habitation, and currently not

[2:35:38] of the above is in the substitute ordinance that is in front of us right now.

[2:35:46] The next thing that he brought up was resat revising the prohibitive conduct section, and again

[2:35:53] This came from the administration, it did come from our chief housing officer, Dr. Ferguson.

[2:35:59] He suggested we revise the language to read.

[2:36:02] It should shall be unlawful for any person to establish a maintain a cap site on public

[2:36:06] property in a manner that materially obstructs public access public infrastructure or the

[2:36:11] intended use of public property.

[2:36:14] Shall be unlawful for any person to erect or maintain temporary structures that obstruct sidewalks

[2:36:18] roadways, public ride-aways, trails, parks or public facilities.

[2:36:21] Thirdly camp within designated Shelby Unlawful to camp within designated environmentally sensitive

[2:36:28] areas, utility easements, flood-prone areas, transportation corridors, bridges, tunnels,

[2:36:35] active construction sites or other locations designated by the county as presenting

[2:36:40] a significant health or safety risk.

[2:36:44] He has several other sections I don't have time within the eight minutes we'll have total,

[2:36:48] But the topics of exploration, which I don't believe we have fully explored yet, are strengthening

[2:36:55] our outreach requirements, adding vulnerable population protections, extending personal

[2:37:02] property notice requirements, and I will elevate that.

[2:37:06] These states here written notice shall be post at least 72 hours prior to the removal of

[2:37:10] personal property except where a media action is required to address a threat to public health

[2:37:15] public safety or environmental hazards.

[2:37:17] So 72 hours of the next section is personal property storage procedures, just ensuring that we do give at least a period of 30 days for those to be recovered from the owner.

[2:37:29] And then also around a progressive enforcement framework, which is really focused on outreach and engagement opportunity for voluntary compliance citation or civil enforcement action.

[2:37:41] And arrest only went authorized by law and after repeated refusal to comply.

[2:37:45] I bring this up because I do want to make a substitute motion to defer this item for 90 days to be heard in the second call of water.

[2:38:02] I will allow her to make the substitute motion outside of her time as I would allow any commissioner to do.

[2:39:21] motivated as my colleague is here sending several emails or having folks post on social media

[2:39:29] and calling this a ordinance to arrest the on-house.

[2:39:33] I reiterate, this is not a housing ordinance, so it would be great and it would be a appropriate

[2:39:39] for Dr. Ferguson and others that are focused on housing to weigh in specifically in and around

[2:39:47] housing if that's what it was about, but what it is specifically about is vacancy and particular

[2:39:53] behaviors that are concerning to specific areas I would say.

[2:40:00] You know, inundated in District 3, in and around, you know, South Decab County. And so, it is about that in public safety way. I have seniors that are concerned, trying to go in and out of house, I mean, in and out of grocery stores and gas stations that have a challenge with being able to do so. Additionally, we have laws that have come down when it comes to 2.95, where we have to do so.

[2:40:30] to address some of these concerns, where it is difficult for folks to get into the right

[2:40:36] away, cross streets. I don't know what it looks like in North to Cab and certain areas

[2:40:42] where you are, but I will say, because that's where a lot of the emails actually came from,

[2:40:47] opposed to South, but it is ongoing issue. Additionally, we have individuals that have two

[2:40:59] in Atlanta. And so to ignore that and not be proactive and pre-emptive in our work, I think

[2:41:09] is to not necessarily do our job. This isn't about a political gang. You've missed, we actually

[2:41:17] had public safety, which someone from the sheriff's office, and from our police departments

[2:41:21] spoke, you are absent. You actually deferred this already for 60 days. You were absent in

[2:41:29] last discussion at the PEX meeting, so you're repeatedly absent for these conversations yet

[2:41:35] you want it deferred for 90 days. You know, I are going to appreciate comments to improve

[2:41:42] and to the extent that was your motive opposed to just trying to kill it and make it into

[2:41:48] something that you want it to be to create a platform for yourself, then that would have been fine.

[2:41:54] to send in, you know, comments and hey, suggestive language language, which by the way we did

[2:42:00] add during our last peck meeting, when we talked about trespassing, that language was particularly

[2:42:07] asked, not all people that are unhoused want to be housed. And some folks are sending up in

[2:42:13] campments in unsafe areas. What we want to do is regulate and protect those individuals in

[2:42:19] addition to people that are trying to affect the buy. I think the commissioner, Mr.

[2:42:53] There is a concern with the homelessness, even up in District 1.

[2:42:57] Of course we can remember some of the events that happened in Atlanta over the summer.

[2:43:04] At the Crowger at Shanley Tucker Road, there is homeless folks that are coming up and engaging with people when they're coming back with their groceries.

[2:43:16] Again, Pleasantdale Road has a phenomenal amount of people that are panhandling, seemingly homeless in the area.

[2:43:24] We have tried cleaning up UPS, the property across the street is where everyone moved, we tried clean that up and then they've moved down towards

[2:43:34] Evan's road is another area that we're having a lot of activity, hearing reports of activities

[2:43:39] around Mercer's campus, hearing reports again around activity around shallowford

[2:43:43] road.

[2:43:44] So, there is a concern.

[2:43:48] I too, or I should say back, I guess, back in 23, 24, put forward a resolution saying

[2:43:54] that we should find other ways besides arresting people.

[2:43:57] And I think that everyone up here agrees with the notion that jail does not fix mental health

[2:44:02] problems.

[2:44:02] And so that is a concern, I think, we all share universally.

[2:44:10] If you were comfortable with your motion to the October 27 BOC, with the prior stop or

[2:44:21] stop at the PECS committee, I think that might be something because I do like what was suggested

[2:44:28] by the director.

[2:44:32] But I recognize also we have what's happened at the state legislature, which is this notion

[2:44:36] that residents are empowered to sue the local authority and that'll be to cab county who's

[2:44:42] responsible for human services as my understanding goes and I just want to make sure

[2:44:46] that the county does have some level of protection to be able to present to a court that says

[2:44:51] we have done something that suggests homelessness is a challenge that we're trying to address.

[2:44:59] we also

[2:45:00] So I have, of course, the HIV that was recently approved that I think is a phenomenal step going towards addressing that, but I would be comfortable with a shorter time frame, but a little more in-depth conversation on that topic.

[2:45:14] And one more thing to add since I got my two minutes and 17 seconds.

[2:45:18] You know, it would be ideal also if we could bring back the joint statement that was prepared,

[2:45:24] I guess, from the CEO, as well as the commission in this ongoing conversation, you'll

[2:47:20] get out of the car, go into the store and I went back into the store and bought a six-pack

[2:47:28] be it. And that is not the norm, but it happens where individuals are harassed, taking advantage

[2:47:41] of manipulated. And so I think that something needs to be in place. Now, is it a compromise

[2:47:53] on calling what Dr. Ferguson stated, I don't know because it's compromised and really looked

[2:48:05] at it, but I think that, you know, I don't see about 30 day at the most of 30 day

[2:48:17] for all, could not achieve what we're trying to do and that is to make sure that we are

[2:48:26] not from housing to make sure that we are not compromising the homeless at the same time

[2:48:40] not risked in the safety of the public, so can I give a substitute that we got a first?

[2:48:50] So I would give a friendly amendment, a second friendly amendment, for a 30 day deferral, rather than...

[2:51:15] But at the same time, we know that a lot of individuals

[2:51:17] are really struggling out there.

[2:51:20] And so, visits by the outreach team, visit by the crisis team,

[2:51:25] and then also visits by the police, are our ways to interact

[2:51:28] with individuals where the public is not equipped to deal with that situation other than maybe

[2:51:34] buy them some gas or get them some water. Really what they're needing is a level of service

[2:51:40] and wrap around treatment that hopefully addresses the root issue that's involved. The

[2:51:49] fat committee has been discussing this issue in particular and I'll just throw out three numbers

[2:51:54] for everyone's consideration. I had brought this up before to the Board of Commissioners, but

[2:52:00] 700 people, 400 days, and $28 million. 700 people at any one time throughout a calendar year

[2:52:11] are in the DeCab County jail for a criminal trespass arrest, which means they were arrested on

[2:52:18] private property, not public private property, private property, that also have a diagnosis

[2:52:25] of a mental health condition or a substance abuse issue.

[2:52:31] Because the State Department, DVHDD, has been behind on their evaluations, those individuals

[2:52:37] are in the Cap County jail for an average of 400 days.

[2:52:41] So earlier, when we heard public comment about the cost, the Sheriff's Department through

[2:52:46] Director Karim Martin, the Chief Health Officer, has provided a number of $28 million that we

[2:52:53] provide to the Sheriff's budget to basically fund that census and that demographic.

[2:53:01] I think the reason why the SOP is so important is that one, we already know that homeless individuals

[2:53:08] are being arrested for being homeless on private property.

[2:53:11] And it is resulting in during a calendar year, 700 people that are in our care.

[2:53:19] We heard from Judge Jacobs, who actually shared with us that he's received these cases

[2:53:23] in state court and has given bail under state law, cash bail is required for a whole host

[2:53:31] of new offenses, including this one, which would be like a trespass, and even when he

[2:53:39] the bail at $1 individuals are not able to fulfill that $1 and of course, even if they could,

[2:53:48] once they're released where they go, as also as mentioned. I have been advocating for a new and

[2:53:56] expanded crisis center for going on six years now, Zach. We made the decision a couple months back

[2:54:03] to take the 15 million for mental health facilities

[2:54:06] and dispersant to other programs, not in the crisis center.

[2:54:10] So we're kind of at square one.

[2:54:12] But I think we have an opportunity to create a hybrid approach

[2:54:16] where we could have a crisis and diversion center

[2:54:20] that would allow 10, 13s and 10, 14s to be received.

[2:54:24] And so in other words, an officer that might respond to an urban camp

[2:54:30] on a public, you know, right away or in a park would have the discretion to say, I will detain

[2:54:38] this person under a 10, 13, 10, 10, 14, but instead of taking them to be booked into the

[2:54:43] Cap County jail, which then begins the whole thing that I just talked about. They're going to

[2:54:47] the diversion center, and hopefully through that diversion center, they're getting treatment,

[2:54:51] they're getting temporary housing, and then as all of us up here have supported, we're trying to

[2:55:00] The report of housing and just more housing of affordable varieties moving forward.

[2:55:06] So I think those few things are going to be important before we move forward on this.

[2:55:22] I do want to express to two of my colleagues Commissioner Patrick Commissioner Davis, Johnson, for recognizing the complexity of this issue and that we just need more time.

[2:55:35] All right, we, I was provided an analysis of the current urban camping ordinance, or at least the one prior to the substitute, which was sent to us by email yesterday.

[2:55:46] And there are several points that I wanted to elevate to the community I am limited on time, so I will be brief and move quickly.

[2:55:54] The very first item does relate to the resolution for effective response to homelessness.

[2:56:01] A 24-1233 that was adopted in January of 2026.

[2:56:07] I believe that the substitute that was distributed may be addressing that piece,

[2:56:14] piece, or that's the substitute piece, the addition to the substitute that was distributed

[2:56:20] to us today, and then previously last night.

[2:56:23] The concerns there were recommending, actually, let me just skip through and I'll come

[2:56:27] back if I have more time.

[2:56:29] The second suggestion we'd like for the sponsor and this board to consider over the next 30

[2:56:34] days is to cap public safety capacity to enforce this legislation as severely limited, including

[2:56:41] space at the jail as been previously noted by our sheriff. Point 3 to cab county and its

[2:56:47] unhouse service partners are currently dedicating numerous resources via the unhouse plan

[2:56:52] to follow through on the joint policy statement, resolution by designing coordinating and launching

[2:56:58] a collaborative systemic service-based approach to reduce the number of unhoused families

[2:57:03] and individuals into cab county. This ordinance will undermine the work being done before it can

[2:57:08] be implemented, wasting the substantial county and service partner resources being allocated to it,

[2:57:15] by replacing it with explicit criminalization and little accountability for our diversionary

[2:57:21] priority area already established by the Board of Commissioners.

[2:57:26] Point four, the version of the legislation that has been in front of us since June again,

[2:57:31] the substitute received last night distributed today. This is the legislation before the commission

[2:57:37] has no substantial modification since being introduced, despite clear desire from county departments

[2:57:43] and stakeholders to do so, I did read comments from Dr. Ferguson. I also have comments

[2:57:48] from Director Mitchell as well. The result of adopting this ordinance will be a fully

[2:57:53] contradictory set of vague and unaccountable directives, forcing law enforcement to interpret

[2:57:58] and navigate competing goals.

[2:58:01] Number four, proposed legislation does not consider the real life impact of its enforcement

[2:58:06] on unhoused persons, or how it could exacerbate conditions causing people to be unhoused.

[2:58:12] I'd like to leave you guys with this.

[2:58:16] Director Mitchell did stated in email that, in his opinion, the current urban campaign

[2:58:21] ordinance, which was received on June 8.

[2:58:25] Thank you very much.

[2:58:51] over the last 60 days, most of the pegs meeting that my colleague here in opposition has missed.

[2:58:59] There's been plenty of opportunity to make suggestions for changes that, and to discuss and accept the fact that this is not focusing on jailing the un-house.

[2:59:13] As with any issue related to trespassing and the like, our officers are afforded opportunity to use discretion.

[2:59:24] It doesn't mean that people have to go from zero to 60 and go to jail or that they have to go to jail at all.

[2:59:32] So this idea that it's jailing the un-house is grossly misleading and incorrect.

[2:59:39] There is a difference between panhandling and vagrancy.

[2:59:45] So some people do panhandle as Commissioner Davis Johnson had suggested.

[2:59:50] Sometimes people are down on their look and at the gas station just need a couple of dollars.

[2:59:56] However, and they will ask.

[2:59:58] And accept a note.

[3:00:00] However, there are some people that will stay at a particular location and harass individuals and make it difficult for them to just go into their local gas station to get gas in the morning.

[3:00:13] And to that, what we want to do is make sure we are addressing the opportunity for our officers who realize that in the folks that have an issue with it to say, it is creating a safety challenge for me.

[3:00:26] And I need it to stop police.

[3:00:30] Again, this is not an attack on the House.

[3:00:33] I wish that my colleague here to,

[3:00:36] that's an opposition was at our last peck meeting

[3:00:38] because that joint statement

[3:00:41] was included in paragraph four.

[3:00:44] And that comes specifically based on the conversations

[3:00:48] that have been had with our,

[3:00:50] the folks from our sheriff's department

[3:00:52] from our police department

[3:00:55] and also being present in our PEX meeting.

[3:00:59] And so not participating in just standing on the idea

[3:01:03] that is attacking the unhoused and trying to jail the unhoused

[3:01:07] is misrepresenting the situation

[3:01:09] and I think that it should stop.

[3:01:12] We have to address this concern.

[3:01:15] We don't want what happened in Atlanta

[3:01:17] to unfortunately happen to another person

[3:01:19] and we want to be in compliance with what's being requested

[3:01:23] and mandated to be quite frank from HB-295. This is a footing, our officers, to use discretion

[3:02:34] So in other words, it's not treated as a crime, it's treated as a, we're responding to

[3:02:38] situation that someone has concerned about, right?

[3:02:41] Someone is acting erratically on the sidewalk.

[3:02:44] Or maybe they put up a tent on the sidewalk.

[3:02:46] And we don't know what's going on.

[3:02:48] Officers might respond.

[3:02:50] But then, you know, is the backup there to say,

[3:02:53] actually, we don't need to send someone to jail

[3:02:55] or rest them.

[3:02:55] We have the day center.

[3:02:56] We have front lawn.

[3:02:58] We have other things that are working on that can intercede.

[3:03:03] So it's a co-responder model.

[3:03:05] So that's kind of what I'm looking for from the administration in response to this ordinance

[3:03:12] is if this past, would there have to be an expanded co-responder system,

[3:03:17] but we have to have more outreach team members?

[3:03:20] Because I assume right now if someone wants to report an incantment,

[3:03:26] is it your advice that they call 911?

[3:03:28] Do they call 311?

[3:03:31] Do they email commissioners?

[3:03:32] How would the members person, I think 3-1-1 or we have an outreach number, I couldn't

[3:03:39] recite off top of my head, but between our team and community development and frontline,

[3:03:46] I think those would be more appropriate for the encampments or the person who looks as if

[3:03:52] they need help in our system is designed fairly well for that and we do have our staff will go out

[3:04:01] front line staff and offer assistance. That works well when one accepts the assistance.

[3:04:08] When they don't accept the assistance, it's more complicated.

[3:04:13] I think that's where I think a lot of folks, including myself, have concern with the

[3:04:17] ordinance, is that other jurisdictions that have implemented similar laws, my research shows

[3:04:25] that they do in fact incarcerate more individuals. And so we're just trying to follow the data

[3:04:30] and the evidence, when urban camping law bans are passed,

[3:04:35] more people are arrested,

[3:04:36] and that's exactly what we've all agreed

[3:04:38] that we don't want to see happen.

[3:05:22] and the local governments are having to deal with it so it's not fair to put that

[3:05:30] problem on one person or even this commission. But this commission must deal

[3:05:38] with it as an effect to cap County and that's what we are trying to do. Take the

[3:05:50] take side of it, take the publicity out of it, and let's deal with it. You know, middle

[3:05:58] health. If you don't, and I do family law, if you don't take your medication that you

[3:06:10] describe, to take, you can't force it. I have it in my family. If you don't take your

[3:06:20] medication, you can injure someone. You can kill someone. You can main someone. Now, you

[3:06:30] can talk about it in the abstract until an episode, or your family member. So, like I said,

[3:06:38] is complex, is something that we ought to deal with, is something that was put upon us with

[3:06:47] no funds. In fact the federal funds that they had for both housing and mental health is taken

[3:06:56] away, has been taken away for months. So this is not a district problem. This is a national

[3:07:05] problem, and if we treat it like we should treat it with compassion,

[3:07:13] with humbleness, with

[3:07:16] understanding, then we should be able to come to a resolution that is going to keep the public

[3:07:28] And also is not going to jail the homeless for being homeless, you know, so that's my final thoughts.
