[7:54]
for being a good partner with the school board on the
[7:55]
council side for the last year as chair.
[7:58]
I think we made some great strides toward better working
[8:00]
together by opening lines of communication,
[8:01]
continuing meetings at the legislative task force
[8:04]
and our first joint meeting in quite some time.
[8:07]
So congratulations, Councillor Spencer on your election
[8:09]

[8:50]

[8:53]
I want to thank you for your 48 years in counting. 46.
[8:58]
46, yes. Oh, 46 years in counting.
[9:02]
And I wanted to thank you for your service.
[9:04]
Thank you very much appreciate.
[9:05]
And I want thank you for bringing the canine units back.
[9:10]

[9:13]
Thank you very much your Honor. Thank you. That's all.
[9:16]
Thank you very much. You're gonna have
[9:19]
to come back in two years again
[9:21]
because you said 48 already now.
[9:25]
Alright, Owen, is there anyone online?
[9:28]
Madam Chair, seeing none rise online,
[9:32]
we got someone in the audience.
[9:34]
No.
[9:47]
Good evening. My name's Jim Foley.
[9:50]
I live at 1 78 Hamstead Road here in Derry.
[9:54]
And my neighbors and I are here tonight
[9:57]
because departments that this council oversee
[10:00]
and have direction, the town administrator
[10:02]
and the court enforcement are not doing their jobs
[10:06]
and it has and will cost the town money.
[10:10]
Now in April of 2025, Byrd Enterprise LLC, the owners
[10:15]
of 180 7 Hampstead Road, the old Holy Cross Catholic Church
[10:21]
applied for a permit to erect an oversized commercial sign
[10:24]
with an electronic me board and a residential area.
[10:28]
Therefore they need to get a variance for it.
[10:31]
They applied for the variance and after two hearings
[10:34]
before the ZBA in June of 2025
[10:38]
and a decision that only five people have ever thought was
[10:41]
proper, the applicant, the three members that voted for it
[10:45]
and bought Robert Mackey the then code enforcement office,
[10:49]
the variance was granted.
[10:52]
The reason I mentioned Mr.
[10:53]
Mackey and what we do find disturbing is that Mr.
[10:57]
Mackey on town time
[10:59]
and on town email was working closely with Bird Enterprises
[11:03]
to get the variance.
[11:05]
The applicant actually thanked Mr.
[11:07]
Mackey for shepherding us. Through this process, Mr.
[11:11]
Mackey insisted on staying on at the code enforcement office
[11:14]
and that the variance was actually granted.
[11:16]
We've had concerns which we've expressed
[11:18]
before about the undue influence on the ZBA by Mr.
[11:22]
Mackey. After the variance was granted, the Abutters
[11:26]
and the neighbors moved for reconsideration.
[11:29]
And after the denial appeal to the Superior Court,
[11:33]
despite knowledge of the appeal,
[11:36]
Byrd Enterprise went ahead with erecting the sign.
[11:38]
The Bork began and was almost completed
[11:41]
before any permits were granted.
[11:44]
After numerous complaints, the code enforcement office,
[11:47]
the town attorney, whom at this time we're not exactly sure
[11:50]
represents, told the code enforcement
[11:53]
office to issue the permit.
[11:55]
Even the sign that was erected was significantly different
[11:58]
than the one that was applied for in April of 2025.
[12:04]
A hearing was held early in November, 2025
[12:07]
before the Hillsborough Superior Court,
[12:09]
which Burt Enterprising had not inter having not intervened,
[12:12]
did not attend again,
[12:14]
relying on the town's attorney to present his case.
[12:18]
And a ruling handed down on the 31st of December,
[12:21]
the court overturned the ZBA a's decision
[12:23]
and vacated the variance.
[12:25]
No motion we would consider was made by the town
[12:27]
and no appeals made to the Superior Court.
[12:31]
On 30th January, I met
[12:32]
with the current code enforcement office.
[12:34]
Carrie Owens about the sign was told that the, was told
[12:38]
that the town on
[12:39]
or about the 13th of January of 2026
[12:42]
had sent Bird Enterprise a certified letter
[12:44]
that the silences violation that had 30 days to remove it.
[12:49]
That time I expressed my understanding
[12:51]
that this was a difficult situation
[12:53]
and that all we asked was
[12:54]
that the town show due diligence in getting the signing
[12:56]
moved and keeping this informed of progress.
[12:59]
Mr. Foley, if I can just interrupt you for one moment.
[13:01]
You are out of your time. I, I chair I move to extend.
[13:05]
Okay. Is there a second? I
[13:06]
Second. Thank you.
[13:06]
All those in favor? Aye.
[13:08]
Aye. And I have very short left to go. Yep, go ahead.
[13:10]
No, that's fine. No, I certainly appreciate that.
[13:13]
It's on my understanding that since that time,
[13:15]
my personal understanding and from the other neighbors
[13:17]
and butters that the town has taken no action against
[13:20]
Bird Enterprises.
[13:22]
Even though the code zoning board, the zoning code
[13:25]
and legislation allows for fines
[13:27]
and other requests for relief.
[13:29]
And not only that, they've had limited contact with us
[13:32]
and have been very difficult to contact.
[13:35]
Yesterday when one of my neighbors was finally able to speak
[13:38]
to Ms. Owens, she finally agreed
[13:40]
to send another letter giving Bird Enterprise another 20
[13:43]
days to remove the sign.
[13:46]
Today we find out that Bird Enterprise has again applied
[13:49]
for variance to have an oversized back lit commercial sign
[13:52]
in residential area and the town, based on the advice
[13:56]
of the town's attorney is refusing
[13:58]
to place any sanctions on Byrd's Enterprise
[14:01]
until another ZBA hearing is held more than anyone.
[14:05]
The town attorney having lost that appeal should know
[14:09]
that no variance can be granted.
[14:12]
And if one would and one was, it would not stand in appeal.
[14:16]
The only that was filed is Bird
[14:18]
Enterprises is waiting to hear us out.
[14:20]
The sign is still there.
[14:22]
In fact, today, bird Enterprises was landscaping
[14:26]
around the sign, the backlight sign shine to her house.
[14:30]
Despite the promise they'd be off
[14:31]
by 9:00 PM They're on from dawn to dusk
[14:34]
saying here these are agencies,
[14:36]
these are departments you oversee.
[14:38]
Enough is enough today, the Abutters
[14:41]
and the Neighbors mail Bird Enterprise, a private ceased
[14:44]
and desist order requiring the lights be turned off
[14:47]
upon receipt of the letter and the sign be removed within
[14:49]
10 days of the receipt.
[14:51]
If these demands are not met, we are fully prepared
[14:54]
to take further action against both Bird Enterprises
[14:57]
and the town of Dairy for the interference
[14:59]
with our preschool enjoyment of our properties.
[15:02]
I appreciate you listening to me
[15:03]
today and extending my time.
[15:05]
Thank you.
[15:11]
All right. Anyone else?
[15:12]
Madam Chair None. Rising online, move to close. Second.
[15:16]
All right, we have a motion to close
[15:18]
public forum and a second.
[15:19]
All those in favor? Aye. A. Aye. Opposed or abstention?
[15:22]
All right. Thank you all. We have the consent agenda.
[15:27]
I'm gonna read it all out,
[15:28]
but I know we're gonna pull at least a couple things
[15:30]
out or at least one thing out.
[15:32]
So we have on the consent agenda, item 26 21,
[15:35]
approve non-public minutes for March 3rd, 2026.
[15:39]
Those minutes are sealed. 26 22 is approved.
[15:42]
The minutes from the March 3rd, 2026, public meeting.
[15:45]
26 23 is approved.
[15:47]
The non-public minutes from the March 12th, 2026 meeting
[15:51]
26, 24 is approved.
[15:53]
The minutes from the March 12th, 2026, public meeting,
[15:56]
26, 25, accept, accept zoning, board member resignation.
[16:00]
26 26 accept planning board member resignation
[16:04]
and item 26 27 is resolution
[16:08]
20 26 0 1 4 to authorize the acquisition
[16:11]
of property at 17 South Avenue
[16:14]
LMG Master Agreement for Abbott Court.
[16:16]
And that will have a hearing at our,
[16:20]
the first hearing at our April 7th meeting.
[16:26]
I would like to ask that we vote on,
[16:30]
we take out the 26 20 22,
[16:33]
the minutes from the public meeting.
[16:35]
I would like to vote on that separate as I was not at that,
[16:37]
I was at the non-public, but I was not
[16:39]
at the public part of the meeting.
[16:41]
And I will be honest,
[16:42]
I did not watch the whole meeting. Okay.
[16:45]
I watched Pieces of it so far.
[16:47]
Alright. Madam Chair, I move.
[16:51]
Could I, are there any others?
[16:52]
Yeah, before you do that, Madam Chair, could it,
[16:54]
you pulled 26 26 as that's my resignation.
[16:57]
Sure.
[17:00]
We can do those separate.
[17:02]
Okay. Madam Chair, I move
[17:04]
to accept item 26 dash 21
[17:09]
approved non-public minutes from March 3rd.
[17:11]
Those are sealed. I also 26 dash 23 approved non-public
[17:15]
minutes from March 12th, 2026.
[17:18]
Item number 26 24 approved minutes from March 12th, 2020
[17:21]
6, 26 dash 25, accept zoning,
[17:25]
board member resignation and 26 27 resolution.
[17:29]
2026 dash four to authorize the acquisition
[17:32]
of property at 17 South Avenue LMG Master Agreement
[17:35]
for AB Court State.
[17:37]
Alright, so motion to accept all
[17:42]
of those on the consent agenda. Second
[17:44]
That Second by Councillor Mills on the motion.
[17:46]
Councillor Mills? Yes. Council Webb? Yes. Council Foot? Yes.
[17:50]
Councilor Chase? Yes. Councilor Webb.
[17:53]
I abstain Here. Abstain. Okay. And councilor Heal? Yes.
[17:57]
And chair votes? Yes. A motion passes for that one.
[18:00]
6 0 1 and then we'll do the other two separately.
[18:05]
So is there motion for 26, 22 and or 26. 26.
[18:09]
So moved. Well, actually we need to do those separate
[18:12]
All separately.
[18:13]

[18:14]

last one is item 26. 26.
[18:38]
Okay, I move to accept 26.
[18:39]
26 I Plaintiff board member resignation.

Oh, alright. Yes. Okay. Yes. Sorry. Council Kelly,
[19:03]
I'm gonna abstain on this
[19:04]
as this was my resignation from the planning board
[19:07]
as being elected to the town council,
[19:09]
I couldn't serve on both
[19:10]
Excellent and chair votes.
[19:12]
Yes. That meant motion passes.
[19:14]
6 0 1 con consent agenda usually isn't that complicated.
[19:18]
Okay, moving on to Chair's report before.
[19:23]
We're gonna do a few things tonight, but
[19:25]
before we get into what's on here, there's something else.
[19:28]
So we have a ex,
[19:33]
a very involved member of our town who's starting out young.
[19:37]
And we wanted to recognize
[19:41]
Kaylee Styles this evening.
[19:43]
So I'm gonna read a proclamation,
[19:45]
which will tell you why we're honoring Kaylee this evening.
[19:48]
And then have Kaylee come up and take a picture.
[19:51]
Owen, are you ready for pictures? Ready. Alright.
[19:55]
Whereas the vision of Girl Scouts is
[19:57]
to prepare every eligible youth in America
[19:59]
to become responsible, participating citizens
[20:02]
and leaders who are guided by the Scout Oath and law.
[20:05]
And whereas the Gold Award is the highest
[20:07]
and most prestigious award in Girl Scouts earned
[20:09]
by girls in grades nine to 12,
[20:10]
and where only 5.4% of Girl Scouts earn the gold award.
[20:14]
I never did. And whereas Kaylee Styles is a 10th grade
[20:17]
student at Pinkerton Academy,
[20:18]
where she is on the student council, a member
[20:20]
of the authors club, suicide prevention group, stage crew
[20:24]
and clarinet choir.
[20:25]
And where she grew up in Belgium and England
[20:27]
before moving to New Hampshire about six years ago
[20:30]
and began in Girl Scouts as part
[20:31]
of the USA overseas on a military base
[20:34]
and is now a member of Girl Scout Troop 1 2 1 3 0 earning
[20:37]
her gold award at a younger age than usual.
[20:40]
And whereas having a soft spot for animals,
[20:42]
Kaylee created a pet donation box
[20:44]
to help the greater Dairy Humane Society.
[20:46]
She has placed it outside a high traffic pet store
[20:48]
and has involved Pinkerton Academy Student Council
[20:51]
to help with the upkeep.
[20:52]
And whereas Kaylee has also created a website
[20:54]
for her project Paw Print explaining her efforts in helping
[20:57]
animals, promoting the need for donations
[21:00]
and why adoption is so important.
[21:02]
And now therefore, we,
[21:03]
the Dairy Town Council applaud Kaylee Styles
[21:06]
for her commitment to the community in scouting.
[21:08]
Rewarded by achieving your Gold Award recognition.
[21:11]
Please accept our sincere appreciation for a job well done.
[21:14]
You are a shining example for the youth in dairy. Thank you.
[21:26]
You guys all have to be in a picture too.
[21:27]
It's just me.
[21:41]
Thank you, sir.
[22:05]
Okay, thank you.
[22:19]
All right. Just a little more on that.
[22:22]
I, I'm sure nobody that knows me is surprised
[22:25]
that I was very excited
[22:26]
to honor someone doing something for animals.
[22:28]
But having gone through, I knew of what the Gold Award was.
[22:31]
I was in Girl Scouts for a long time
[22:33]
and I never made it that far.
[22:34]
And that was, I'm gonna be quite honest, part
[22:37]
of why I didn't continue what that project was at
[22:40]
that time was it was too much work.
[22:41]
So I really want to congratulate you on doing all that work
[22:45]
and picking a project that,
[22:48]
you know isn't probably the most obvious thing
[22:51]
for a Girl Scout to pick to do.
[22:52]
And really helping animals in town
[22:53]
because a lot of work I do has,
[22:58]
it focuses on access to care
[23:00]
and when you help animals, you help people.
[23:02]
And so you helped not just animals in
[23:04]
that project, but a lot of people too.
[23:05]
So thank you. Anyone else have anything before we
[23:10]
Okay.
[23:11]
Just that I was doing hiring and recruiting
[23:14]
and every time that for Dairy Fire
[23:16]
and always found great success with people
[23:20]
who were involved in scouting
[23:21]
and achieved the highest level of scouting.
[23:24]
And Thank you.
[23:27]
You're exactly what we wanna see our youth doing in dairy.
[23:30]
So thank you very much. Okay, now we get
[23:34]
to the less fun stuff.
[23:36]
All right, so tonight we have to do a bunch of, oh,
[23:41]
we have the liaison stuff first.
[23:44]
Our appointments to the various councils and committees
[23:49]
and whatnot and boards through town.
[23:51]
So, so I'm gonna go through the list
[23:55]
and just kind of talk through the list.
[23:57]
And I know some of them are open
[23:59]
because the counselor that had it is no longer here.
[24:01]
And some of it, if, you know, if you wanna keep it, keep it,
[24:05]
if you wanna put it up for adoption,
[24:08]
then you can do that too.
[24:10]
Adoption by another counselor.
[24:12]
So Highway Safety Liaison Counselor.
[24:14]
Chase, you're currently in that role.
[24:15]
Would you like to keep that? Yes. Okay.
[24:19]
Conservation Commission Counselor Foot? Yes. Yes.
[24:23]
You want that? Dairy Housing and Redevelopment authority.
[24:28]
Councilor Webb? Yes. Would you like to stay in that role?
[24:30]
Yes. Don't worry. You two, there's plenty coming.
[24:36]
Dairy Public library I serve on that.
[24:39]
And I would like to keep that one
[24:43]
fiscal committee that is open.
[24:45]
Is there anyone that would like to serve on that?
[24:47]
If no one else is interested, I'd,
[24:49]
I'd be interested in that one. Okay.
[24:51]
I actually think we often recommend a new,
[24:53]
like a new counselor coming on serves on that one.
[24:55]
So that would be, that would be a good one.
[24:57]
Is everyone okay with that? No one
[24:58]
else jump in for that one.
[25:00]
Okay. Heritage Commission Councilor Chase?
[25:05]
Yes. Okay. Legislative committee.
[25:09]
Councillor Webb. Do you wanna stay on that? Yes.
[25:12]
I would also like to stay on that.
[25:13]
And there is one other seat open.
[25:15]
Is there anybody that would like to take that one?
[25:19]
Don't see your foot. I'm already on it as well.
[25:23]
I If it should be one of those where I'm a rep pretty,
[25:26]
So Yeah, I can, I can take that.
[25:28]
Okay. When, when does that typically meet
[25:33]
or is it the, the call the chair. We
[25:35]
Put it, I put it out to try to get a night that we can
[25:38]
Okay.
[25:39]
All get together. But we meet quarterly.
[25:41]
Okay. Yeah. That, that should work.
[25:43]
I think we've been meeting on Wednesdays mostly.
[25:46]
We've been meeting mostly Wednesdays
[25:47]
Because we're in here for planning board and, but
[25:49]
We're all gonna be new people potentially coming in.
[25:52]
I don't know if it would be all the same or not. Okay.
[25:54]
Awesome. Net zero Task force is also open.
[25:58]
That was Councillor Moje.
[26:03]
Anyone wanna take that one?
[26:04]
I, I am open to taking it, but I cannot Yeah,
[26:07]
because it meets at the same time
[26:08]
as something else. I think I can,
[26:10]
That I have do it if no one else wants it.
[26:12]
Okay. Thank you.
[26:17]
Pinkerton Academy, that's also open.
[26:22]
Sign up for something.
[26:23]
You wanna take that one? Okay. Me
[26:25]
Very much.
[26:26]
But
[26:29]
Why do I have these on Planning Board Counselor.
[26:33]
Chase, do you wanna keep that? Yes. Okay.
[26:35]
And counselor, although we have had an
[26:38]
alternate, if someone wants that,
[26:39]
I was the alternate. Hmm. I'll
[26:41]
The alternate.
[26:42]
You'll be the alternate.
[26:45]
Okay. Public Works.
[26:49]
Counselor Mills, do you wanna
[26:51]
Stay with that?
[26:52]
I'll stay on that. Yeah.
[26:55]
Safety Departments. Counselor Webb? Yes.
[27:00]
School Board. I have that now.
[27:03]
I would like to keep it, unless someone
[27:04]
else is dying to have it.
[27:05]
I will. Okay. Great.
[27:10]
Councilor Mills, you were the alternate
[27:11]
on there. Do you wanna stay there? Yes.
[27:12]
Okay. Southern New Hampshire,
[27:17]
hazardous Materials.
[27:19]
Mutual Aid District. Councillor Webb? Yes.
[27:22]
Okay. Taylor Library Council.
[27:26]

[27:31]

TIFF Advisory. The DCC TIFF Advisory. Sorry.
[27:36]
Councilor Chase? Yes.
[27:38]

[27:43]

[27:48]
And record retention Counselor Webb? Yes. Keep that.
[27:53]

[27:57]
Okay. And we have now we have
[28:02]
to do some board and committee appointments.
[28:05]
So we'll do the ones in the packet here first.
[28:10]
Are you okay if for ones that are the exact same sentence,
[28:13]
I bunched them together for some of them?
[28:15]
Or do you wanna do everybody individually?
[28:19]

[29:32]

[29:33]
in the works for that one. Yeah, absolutely.

Oh, that's a a good point. I didn't ask.
[35:31]
Do we kind of,
[35:34]
usually the assumption is there an alternate with the,
[35:38]
with the desire to move forward?
[35:42]
Is Mr. Wood here? I dunno,
[35:45]
I can't see that far. You can see
[35:47]
Him out there.
[35:48]

Sometimes, you know, people join the board as an alternate
[36:08]
and they want a little bit to, to learn.

Yep. So I just wanna make sure
[36:12]
that I'm putting him in that position.
[36:13]

[36:56]
Yes. Council. What?
[36:59]
I'm not gonna be voting to support him. Ms. Morin.
[37:03]
I just would like to see the planning board. Zoning Board.
[37:07]
Zoning board. I'm sorry about that.
[37:10]
I've looked at some of the, it's not,
[37:13]
I support our volunteers,
[37:14]
but I don't always agree with them.
[37:16]
And by looking at some of the minutes
[37:18]
and some of the votes, I just don't feel
[37:19]
that I could support Ms. Morin on the zoning board.
[37:24]
Thank you. Anyone else?
[37:30]
All right on the motion. Councilor Mills?
[37:33]
No. Councilor Webb?

[38:15]
her Mr.
[38:17]
Trip. And it has to do again with some of the votes
[38:20]
that he made on the zoning Board of Adjustment.
[38:23]
It's the only time that we can,
[38:25]
where it's a quasi-judicial board.
[38:27]
The only time that we can show the direction that we wanted
[38:30]
to go is in the appointment of members and
[38:34]
therefore I'm not going to vote to support Mr.
[38:37]
Trip.
[38:40]
Any other discussion? Alright, on the motion.
[38:44]
Councilor Mills? Yes. Councillor Webb? No. Councillor Foote?
[38:48]
Yes. Councilor Chase? Yes. Councilor Flood? Yes.
[38:54]
Councillor Healy? Yes. And Chair Votes? Yes. Motion passes.
[38:58]
6 1 0. I move to appoint Gaspar o Bimba as a member
[39:03]
of the zoning Board of Adjustment for a term
[39:04]
to expire March 31st, 2028.
[39:07]
Second discussion. Council Webb,
[39:11]
Again, referring to some of my previous comments,
[39:15]
I'm going vote no on this.
[39:18]
Okay. Any other discussion?
[39:20]
Alright, on the motion. Councilor Mills?
[39:24]
No. Councilor Webb? No. Councilor Foot? Yes.
[39:27]
Councilor Chase? No. Councilor Flood? No.
[39:32]
Councilor Healy? No. And chair votes? Yes.
[39:35]
Motion does not pass With a 2 5 0 vote.
[39:40]
I move to appoint Michael Donlin as an alternate member
[39:42]
of the zoning Board of Adjustment for a term to expire.
[39:45]
March 31st, 2029. Second.
[39:50]
All right. Did I say alternate member? It is.
[39:52]
Alternate member, but I don't know if I actually said that.
[39:54]
All right. Sorry. All right.
[39:56]
So we have motion to second. Any discussion?
[39:59]
Would he be promoted to, should he be promoted
[40:02]
to member or?
[40:03]
I believe that we have or vacancy
[40:07]
or member since Crystal Morin did not get reappointed,
[40:12]
Nor did he.
[40:13]
I believe they have to request it. Yeah, I
[40:14]
Think he would have to.
[40:16]
I don't have, I don't really have much from
[40:21]
him like the page that says like what you're requesting.
[40:24]
So I think he would have to resubmit for that. Okay.
[40:27]
But he, Yes he can according for it.
[40:28]
Because we'll have two openings. Alright.
[40:32]
Any other discussion? Okay. On the motion, councilor Mills?
[40:36]
Yes. Councilor Webb? Yes. Councilor Foot? Yes.
[40:39]
Councilor Chase? Yes. Councilor Flood? Yes.
[40:42]
Councillor Healy? Yes. And Chair votes? Yes. Motion passes.
[40:46]
Seven zero. We agreed on something.
[40:50]
I moved to appoint Jim Dietzel as an alternate member
[40:52]
of the zoning board of Adjustment for a term
[40:54]
to expire March 31st, 2029. Second
[40:57]
Point of order.
[40:58]
I believe he's seeking full member the red
[41:03]
underneath his name.
[41:05]
He's looking to become a full member.
[41:08]
Oh, okay. That's right.
[41:10]
He did actually put in for that there. Okay.
[41:13]
I will amend my motion to move to appoint Jim Dietzel
[41:17]
as a member of the zoning board of Adjustment for a term
[41:20]
to expire March 31st.
[41:24]
2020. Wait, there's two here. 2029.
[41:29]
I amend my second. Okay,
[41:31]
so we still have a motion and a second.
[41:32]
Any further discussion? Okay.
[41:36]
On the motion, councilor Mills? Yes. Councilor Webb? Yes.
[41:39]
Councilor Foot? Yes. Councilor Chase? Yes. Councilor Foot?
[41:42]
Yes. Councilor Healy? Yes. And chair votes? Yes.
[41:45]
Motion passes. Seven zero. All right. That is all for those.
[41:50]
Thank you for everyone that does come out to
[41:53]
join those committees and boards.
[41:55]
You are what keeps the town moving along,
[41:57]
so we appreciate your participation in that.
[42:00]
We have a few more appointments. Thank you.
[42:04]
Just these three, the last ones,
[42:06]
these were separate from our book for some reason.
[42:08]
So our dairy public library,
[42:10]
we have three alternate appointments.
[42:13]
So the full members are elected,
[42:17]
but the alternates get appointed.
[42:18]
So I move to appoint Monica Cataldo as an alternate member
[42:21]
of the Derry Public Library Board of Trustees for a term
[42:24]
to expire March 31st, 2027.
[42:26]
Second. Any discussion
[42:30]
although on the motion, councilor Mills?
[42:33]
Yes. Councilor Webb? Yes. Councilor Foot? Yes.
[42:35]
Councilor Chase? Yes. Councilor Flood? Yes.
[42:37]
Councillor Healy? Yes. And Chair votes? Yes. Motion passes.
[42:40]
Seven zero. I move to appoint Maureen Shanahan
[42:43]
as an alternate member of the Dairy Public Library Board
[42:45]
of Trustees for a term to expire March 31st, 2027.
[42:49]
Second. Any discussion on the motion?
[42:53]
Councilor Mills? Yes. Council Webb? Yes. Councilor Foot?
[42:57]
Yes. Councilor Chase? Yes. Councillor Flood. Yes.
[42:59]
Councillor Healy? Yes. And Chair votes? Yes. Motion passes.
[43:02]
Seven zero. And last one is I move to appoint Sam Shriner
[43:06]
as an alternate member of the DER Public Library Board
[43:08]
of Trustees for term to expire March 31st, 2027.
[43:11]
Second discussion On the motion. Councilor Mills? Yes.
[43:16]
Councilor Webb. Yes. Councillor Foot? Yes. Councillor Chase?
[43:20]
Yes. Councillor Foot? Yes. Councilor Healy. Yes.
[43:22]
And Chair votes? Yes. Motion passes. Seven zero. All right.
[43:27]
We got through all that. All right.
[43:29]
And then we have our report on our 2026 Town
[43:33]
and School elections with our town clerk, Tina Guilford
[43:37]
and our town moderator Dave Nelson.
[43:39]
Presenting.
[43:52]
Thank you Mayor Care Chair that one.
[43:54]
Members of the council, I would first like
[43:57]
to give some thank yous, particularly to the council.
[44:01]
Many of you have spent a large portion of of the day with us
[44:04]
and and we certainly appreciate that.
[44:06]
We would like to thank the administration
[44:09]
and the public works department
[44:10]
who provide invaluable support and service.
[44:12]
Public works, carries all the equipment to
[44:15]
and fro sets it up, tears it down.
[44:17]
We couldn't do it without them.
[44:19]
We'd like to thank the staff at Pinkerton Academy
[44:23]
who are always very accommodating of, of our needs.
[44:27]
I would like to thank Mr.
[44:29]
Preventer and his crew at at Dairy Community Access Media
[44:32]
who televised the results.
[44:34]
We really appreciate that.
[44:36]
I'd like to thank the members of the town clerk staff
[44:39]
and the supervisors of the checklist.
[44:41]
Again, we could not do the work without them.
[44:44]
And additionally, all of the poll workers, both volunteer
[44:48]
and paid, who make the day work very, very smoothly.
[44:53]
And finally, all the voters who come and cast their votes
[44:56]
because that's really what it's all about.
[45:01]
I would like to thank our Town moderator.
[45:03]
Congratulations on your reelection.
[45:07]
Just for numbers, in case anyone was wondering,
[45:10]
we started the day with 20,482 voters.
[45:14]
We had 33 same day registrations
[45:18]
and we had 1,809 voters.
[45:21]
So we were short of my 2000 voter goal.
[45:26]
There's always next year, right?
[45:28]
So turning our attention to the next election,
[45:30]
it will be our state primary election,
[45:32]
September 8th, 2026 at Pinkerton Academy.
[45:36]
Everyone votes at Pinkerton next.
[45:40]
After that will be our state general election.
[45:42]
November 3rd, 2026. Again at Pinkerton Academy.
[45:47]
I expect that we'll have a great turnout that day.
[45:51]
And then, just
[45:52]
because I wanna make sure everybody knows,
[45:55]
save the date March 9th, 2027 for the next town
[45:59]
and school election.
[46:01]
I'd like to thank the council for all your support.
[46:05]
Public works, the administration, everyone in this building
[46:09]
who puts up with all my election crazy police, fire,
[46:14]
everyone who supports Pinkerton, the poll workers.
[46:19]
'cause we cannot do it alone.
[46:21]
And just everyone who actually comes out to vote,
[46:25]
even if they only came out for the kids vote
[46:28]
and Girl Scout cookies
[46:30]
because I watched adults do that on election day.
[46:34]
Hmm. That's it.
[46:37]
Thank you. Any questions or comments? Council?
[46:42]
Just thank you. Yeah. Great job as always.
[46:47]
Yes, thank you. It was a, it was a very smooth day even
[46:51]
with our small turnout.
[46:54]
Okay. Town administrator's report.
[46:56]
I will turn it over to Mr. Fowler.
[46:58]
Alright, good evening. I have a couple of items tonight.
[47:02]
I think the first item that I'd like to tackle this evening
[47:06]
is the confirmation of our fire chief.
[47:09]
So for everybody that's in the audience today, the town
[47:14]
has had an interim fire chief for several months
[47:17]
based on the retirement of the last chief.
[47:20]
We've gone through a, an exhaustive process to try to find
[47:25]
our next fire chief.
[47:26]
I want to thank a number of people going through the process
[47:29]
where we started with a public advertisement
[47:32]
through New Hampshire Municipal, mass Municipal.
[47:35]
And that was all spearheaded by Catherine St.
[47:38]
Ledger of the Human Resources Department.
[47:40]
Did a great job at bringing in as many candidates
[47:43]
as we could get, prepped some materials
[47:46]
and then handed it over to a committee comprised
[47:51]
of four members, one standing chief, a member
[47:54]
of our current IAFF, a member of the public
[47:58]
and one of our town councilors, Jack Webb.
[48:00]
And they did an exhaustive search
[48:03]
and got some great responses from all
[48:06]
of the candidates conducted interviews
[48:08]
and then brought that to me for final disposition.
[48:14]
With that, we were looking for somebody
[48:17]
of the highest integrity, who had a great level of expertise
[48:21]
and who could lead the Dairy Fire Department
[48:24]
into its future.
[48:26]
And I am pleased to announce that we have found that person.
[48:30]
And that person is Greg Laro,
[48:33]
who is your interim fire chief.
[48:35]
And at this tonight I'm asking the town council
[48:37]
to confirm my recommendation through a resolution to make
[48:43]
Greg the permanent fire chief,
[48:45]
effective March 26th, 2026.
[48:48]
And the resolution is in your packet for our reading.
[48:52]
But I do want to say I see Greg is here
[48:54]
with his family tonight.
[48:56]
I have the utmost confidence that you'll carry through
[48:59]
with all the duties
[49:00]
and roles that everybody in this community
[49:04]
is looking forward to.
[49:05]
You have a brand new fire station
[49:07]
that you were deeply involved with and,
[49:09]
and really luged that thing through to the end.
[49:11]
And, and I have a lot of gratitude
[49:14]
for you for, for doing that.
[49:15]
So congratulations Greg.
[49:18]
Obviously we have the, you know, the resolution to read,
[49:21]
but I do want to, to pass along.
[49:23]
I have the highest faith and confidence in in your future
[49:28]
Councillor Webb.
[49:29]
All right. Before I read the resolution is with the
[49:32]
great pride that I do this, I get to sit on the
[49:37]
interview board that hired firefighter Greg Aero.
[49:42]
I remember vividly having a conversation
[49:45]
with Firefighter Greg Aero
[49:46]
and asking Why haven't you taken the lieutenant's exam?
[49:51]
Because I see great things in you.
[49:53]
I get to sit in on his Fire Chief's interview
[49:57]
and now I get to read
[49:59]
and make a motion that we adopt a resolution number
[50:02]
2 0 2 6 0 1 6
[50:06]
to confirm the appointment of the fire chief.
[50:08]
Whereas Section 8.8 A
[50:12]
of the town charter requires
[50:13]
that the Town Council confirm the appointment
[50:16]
of certain appointive officers
[50:18]
and whereas there is a vacancy in the office of Fire Chief
[50:22]
and whereas town Administrator has identified a candidate
[50:27]
who possesses the necessary skills
[50:29]
and experience to succeed in the position.
[50:33]
Now therefore be it resolved in counsel that the appointment
[50:36]
of Greg Laro as fire chief is hereby confirmed this
[50:41]
resolution shall take effect on March 26th, 2026.
[50:46]
Second that
[50:48]
It's their discussion.
[50:52]
Alright, on what time we have you, you don't get to talk.
[50:56]
Alright, on the motion Councillor Mills. Yes.
[51:00]
Council two thumbs up
[51:04]
With pride and expectation. Yes.
[51:06]
Councilor Foot. Yes. Councilor Chase. Yes.
[51:09]
Councilor Flood. Yes. Councilor Healy.
[51:12]
When I got my packet, this is one
[51:14]
of the first things I was looking at
[51:16]
and hoping that this was the selection
[51:18]
the committee was going to make.
[51:20]
So I'm very, very pleased with this.
[51:22]
Very pleased that we had an internal candidate, you know,
[51:25]
the next in line rise up
[51:27]
and is gonna fill the the responsibilities. So yes,
[51:31]
And I am very, I agree this was
[51:34]
where I hope we would land.
[51:35]
So I very enthusiastically vote yes as well.
[51:37]
So congratulations Chief Laro. No.
[51:58]
Would you like to come up and say a few words?
[52:01]
I mean you probably don't want to
[52:02]
but prepared you knew that would be odd piece of paper.
[52:07]
So first of all, to the members of the council count
[52:10]
as administrator Mike Fowler
[52:12]
and the community of Dairy, I sincerely appreciate faith
[52:16]
and trust your placing in me
[52:18]
to lead the department in the future.
[52:21]
I'm privileged and excited by this opportunity
[52:23]
because I know the talent
[52:25]
that we have within our organization.
[52:28]
I can't wait to see what the future holds for us
[52:32]
to the members of the department, some
[52:33]
of whom are here tonight in the back of the room.
[52:36]
I want to thank you for the support you've shown throughout
[52:39]
the, the leadership transition.
[52:41]
And I ask that you continue to provide that support
[52:44]
as we work together to serve the community.
[52:48]
I would also like to thank the executive board
[52:50]
and membership of Local 49 43 92
[52:53]
for their support and confidence.
[52:57]
Probably should do that. Where were we?
[53:02]
I know we'll continue to enjoy a productive relationship.
[53:06]
Lastly, I owe the biggest thank you of all
[53:09]
to my wife Ashley, two daughters, Abigail and Samantha.
[53:13]
The last few months have been a wild, unpredictable ride
[53:17]
and I know it's taken an undeserved toll on all of you,
[53:21]
so thank you for standing by me.
[53:24]
That is,
[53:37]
Thank you.
[54:24]
Thank you. Oh, would you mind if I grab one with my family?
[54:28]
Absolutely. Let's, let's,
[54:51]
good point.
[54:56]
Weak session
[55:09]
Owen.
[55:10]
Owen, maybe get the on duty crew with him. Yes.
[55:14]
Yeah, absolutely. Did
[55:17]
you? Sorry.
[55:20]
No, that's good.
[56:10]
All right. And back over to Mr. Fowler.
[56:14]
And so I do have some other items
[56:16]
just of general interest.
[56:17]
I'll be very brief 'cause I know we've had a lot
[56:19]
of items still to go tonight.
[56:22]
So I just want to alert the council that staff, primarily
[56:27]
finance staff, myself
[56:28]
and department heads, have been working
[56:30]
through the final pieces of the FY 27 budget.
[56:34]
We're gonna be bringing in a budget that meets the statutory
[56:39]
tax cap of 3.3%.
[56:42]
So right now everything's being put together and compiled.
[56:45]
Counselors, you should be getting your packet by Monday
[56:48]
or Tuesday of next week.
[56:50]
So we'll let everybody know relative to that.
[56:52]
But that segues into, as a reminder,
[56:56]
this is maybe more for the public.
[56:57]
We have a number of sessions coming up.
[57:00]
April 7th is our first, it's a regular council meeting.
[57:03]
There'll be an overview of the FY 27 budget.
[57:07]
April 9th is a work session that starts at 6:00 PM
[57:11]
and that's gonna be the Fire Police
[57:14]
and Public Works Department presentations
[57:18]
on April 16th at 6:00 PM as well.
[57:21]
We'll be doing our second budget workshop at 6:00 PM That
[57:24]
will be on all of the other departments, finance libraries,
[57:28]
all the administrative departments.
[57:30]
Those will all be conducted on that date.
[57:33]
On April 21st, we'll have another regular town council
[57:36]
meeting and if there are any cleanup items for the budget,
[57:39]
those will be taken care of at that point.
[57:42]
And then finally, April 23rd, we'll be having a,
[57:46]
the fiscal 27 budget
[57:48]
and capital improvement plans public hearing.
[57:51]
And that will be the final presentation on the budget in
[57:54]
lining up for a vote on or anticipated vote on May 5th.
[57:59]
So keep everybody in the loop.
[58:01]
This is information's in your packet
[58:03]
and we'll obviously distribute distributing the
[58:05]
public notices in advance.
[58:07]
Last item that I wanted to put out to the council today was
[58:12]
House Bill 1469, which is dealing with Asian spas
[58:17]
that passed through the house resoundingly at a vote
[58:20]
of 3 23 to 28.
[58:22]
Now that will be brought over to the Senate
[58:26]
and so that will be anticipating the crossover with that.
[58:29]
But a lot of good work by a lot
[58:32]
of people in our legislative group, particularly
[58:35]
Councilor Foot or Rep Foot,
[58:37]
but many others have been pulling the ship on this and,
[58:40]
and that will certainly help out the town of dairy
[58:42]
in its current and future endeavors relative to
[58:46]
eradicating the issues
[58:47]
with the Asian spas that we had gone through.
[58:49]
So that's all good news on that front.
[58:52]
And other than that, the last piece of items that I have is
[58:56]
just a reminder that next Saturday
[58:59]
there'll be the Millennium Annual Cheap Marathon.
[59:03]
A little bit different route this year that's on April 4th.
[59:06]
They used to start and finish in the area of Abbott Court.
[59:10]
But obviously with the construction going on,
[59:13]
our staff has reached out
[59:14]
and they're gonna be doing an alternate route this year.
[59:17]
They'll be starting in Wyndham working their
[59:19]
way north through dairy.
[59:20]
So they'll be still using the rail trail on a couple
[59:23]
of adjacent roads,
[59:24]
but there won't be the same start finish location that used
[59:27]
to end in beginning downtown.
[59:29]
We do have hopes that in two years time when the Abbot Court
[59:32]
development is done, that can be brought back
[59:35]
to downtown dairy because it does bring a lot of traffic
[59:37]
and business to those areas.
[59:39]
So that's all I have this evening.
[59:42]
Thank you. And thank you to Councilor Foote
[59:45]
for all his work on that bill for the spas.
[59:48]
That has been huge and I know it's been a lot of work.
[59:52]
Thank you for sticking with that.
[59:54]
Can I speak to that real quick? You may, yes.
[59:56]
So team Effort, councilor Mills as a co-sponsor as well,
[59:58]
and representative Nelson from dairy, also co-sponsor.
[1:00:04]
So we got it this far. It's not, it's not done yet.
[1:00:08]
So I'm encouraging everybody to reach out
[1:00:10]
to the state senators.
[1:00:13]
Our senator for here is Senator Birdsell
[1:00:16]
and you can reach out to all the centers.
[1:00:17]
There's 24 of 'em, please reach out to their office,
[1:00:20]
email them, whatnot, tell 'em
[1:00:22]
how important this bill is and that you want this passed.
[1:00:25]
There's, there's actually another bill for 1458 as well,
[1:00:29]
but it's gonna take a, a village to put this through
[1:00:32]
to get it through the, the finish line.
[1:00:33]
So please reach out to your senators
[1:00:37]
and let them know that this is an important bill for dairy
[1:00:39]
and for the community in general. Thank you.
[1:00:41]
Excellent. Any other questions
[1:00:43]
for the town administrator before we move on?
[1:00:45]
I just have one comment. I was also a co-sponsor on this,
[1:00:48]
but some of us just wrote Charlie's coattails.
[1:00:51]
Let's face it. Charlie did the yeoman's work on all on all
[1:00:56]
of this Charlie Town counselor,
[1:00:58]
Charlie Foot slash State Representative Charlie Foot,
[1:01:01]
and he's put over eight years
[1:01:03]
of his life into this bill trying
[1:01:05]
to get these massage parlors cleaned up here in dairy.
[1:01:09]
And I take absolutely no credit for this whatsoever.
[1:01:12]
I just threw my weight around it.
[1:01:14]
Charlie did it. And we are seeing that.
[1:01:15]
We are seeing the changes.
[1:01:17]
I was telling the council when I got here this evening,
[1:01:19]
I drove by one of the former locations
[1:01:23]
and I happened to look in the window of that building
[1:01:26]
and it was very clearly in office
[1:01:27]
and there was a woman at the, you know,
[1:01:29]
copy machine or something.
[1:01:31]
And it just made me so happy to see that I don't have
[1:01:33]
to drive by there and be embarrassed
[1:01:37]
or feel, feel uncomfortable
[1:01:40]
that that was in my neighborhood. And so thank you.
[1:01:42]
So also Chief Fi
[1:01:44]
and to Administrative Fowler were very instrumental in this.
[1:01:46]
They, yes, they, they really did a lot of
[1:01:48]
behind the scenes work as well, which we, you know,
[1:01:51]
the Chief's Association
[1:01:53]
and Mr. Fowler wrote a nice letter to the, the committee
[1:01:57]
to help get it over the, that next hump
[1:02:00]
and they're on the commission, the IMB Commission,
[1:02:03]
illicit Massage Business Commission.
[1:02:05]
So they're very instrumental in this.
[1:02:07]
So again, a lot of, a lot of teamwork, a lot of, a lot
[1:02:10]
of part involved.
[1:02:11]
So Council,
[1:02:12]
What Again, I just want to thank Councilor Foot for
[1:02:17]
not all the work you're doing,
[1:02:18]
but educating people like me
[1:02:19]
that the severity of the problem.
[1:02:22]
But the beautiful part of this bill, if it gets
[1:02:24]
to the governor's desk and then we need to need to get
[1:02:28]
through the Senate, is that it takes some successes
[1:02:31]
that we have in dairy and it pushes it out to the rest
[1:02:33]
of the state so that we're not just pushing out of dairy
[1:02:36]
for them to go to one dairy.
[1:02:38]
Hopefully now the state can now push 'em out of this state
[1:02:41]
and have them go away forever.
[1:02:44]
And Bev Donovan is very instrumental in this as well. Yes.
[1:02:46]
Here in town. So definitely I probably,
[1:02:49]
but there's a lot of people, there's so much
[1:02:50]
teamwork involved in it.
[1:02:51]
So I apologize if I missed anybody, but thank
[1:02:56]
You.
[1:02:57]
Thank you. Okay, we have one public hearing this evening.
[1:03:01]
It is item 26 19,
[1:03:04]
resolution 2026 dash zero 12 to accept a Department
[1:03:07]
of Justice assistance grant
[1:03:09]
for FY 2026 cops Technology and Equipment grant.
[1:03:13]
Grant Police Chief George Oli presenting. Good evening.
[1:03:18]
Thank you Madam Chair. Good evening Counselors.
[1:03:22]
If you'll indulge me for just a moment, a bit of history.
[1:03:25]
First the town
[1:03:27]
of police department has been using a records management
[1:03:31]
and a CAD computer, computer-aided dispatch
[1:03:34]
software package since 2001.
[1:03:37]
And if you know anything about technology
[1:03:39]
and software 2001, that's practically prehistoric
[1:03:43]
in the terms of, of software development.
[1:03:47]
So I recognized that we needed to
[1:03:52]
make some effort into modernize
[1:03:54]
and update our software system.
[1:03:57]
Now also say that our current vendor is no longer building
[1:04:02]
or supporting the software system we are using today.
[1:04:06]
So there will be no further improvements
[1:04:08]
or enhancements in that, in that software.
[1:04:12]
So recognizing that it's very difficult
[1:04:16]
to take on a project of this magnitude
[1:04:18]
with a tax cap budget.
[1:04:21]
I I, I met with the police chief in London Dairy
[1:04:25]
and the police chief in Windham
[1:04:27]
and I proposed a joint venture to apply
[1:04:31]
for congressionally direct spending funds from Senator
[1:04:35]
Shaheen and Congressman Pappas through their offices.
[1:04:39]
We put together a plan to do just that.
[1:04:43]
In March of 2025, we submitted a request
[1:04:47]
Congressional direct spending request through their offices.
[1:04:51]
Over the past year it was moved
[1:04:54]
through the appropriations committee in Congress
[1:04:56]
and was funded to the amount
[1:05:01]
of $1,039,000.
[1:05:05]
Now that's a little less than we had applied for,
[1:05:08]
I should say submitted a request for I,
[1:05:12]
we actually sought $1.75 million for the three communities.
[1:05:17]
And the reason for that is when we first started discussions
[1:05:21]
in 2024 about this project, it involved
[1:05:26]
local servers in each one of our communities tied together
[1:05:29]
with a master server tied together over a
[1:05:32]
dedicated fiber optic network.
[1:05:34]
All of those things carry some pretty significant costs.
[1:05:38]
So we were, matter of fact,
[1:05:41]
it was the day we opened the fire department,
[1:05:42]
the new fire station in town, we were notified by the
[1:05:45]
Congressman Pappas's office that our application was
[1:05:47]
favorably considered and we were, were funded to the tune
[1:05:50]
of $1,039,000.
[1:05:53]
So that brings us to tonight, the
[1:05:56]
process once funded requires
[1:05:59]
that a federal agency contact us
[1:06:01]
and tell us that this is the grant
[1:06:03]
application you need to file.
[1:06:05]
That's through the cop's office, the Department of Justice.
[1:06:09]
It's not a competitive grant.
[1:06:10]
The money's already there waiting for us to apply.
[1:06:13]
So I seek your approval tonight to apply for those funds
[1:06:17]
to allow us to move forward with acquiring new software CAD
[1:06:21]
and RMS for the towns of Derry, London Dairy
[1:06:24]
and Windham on a joint project that we've developed.
[1:06:28]
Happy to answer any questions about that
[1:06:30]
Madam Chair?
[1:06:31]
I move to open public hearing.
[1:06:32]
Second that. Alright,
[1:06:34]
all those in favor a Aye Aye Your abstentions?
[1:06:37]
Alright. Public hearing is open on this issue.
[1:06:40]
If you wish to speak on this topic,
[1:06:43]
feel free to come up to the microphone.
[1:06:46]
Madam Chair. Seeing none rise online,
[1:06:48]
I move to close public Hearing. Second that.
[1:06:50]
Alright, all those in favor? Aye. Aye. Aye.
[1:06:54]
Any opposed or absent? Okay, counselors, any questions?
[1:06:58]
Madam Chair, I'd like to make a resolution,
[1:07:02]
resolution 2026 dash zero 12 to accept the Department
[1:07:07]
of Justice Assistance grant for records management
[1:07:10]
and dispatch software upgrades
[1:07:13]
whereas Section nine point 15
[1:07:15]
of the Town Charter authorizes the town Council
[1:07:18]
to accept grant funding
[1:07:19]
and whereas the police department seeks
[1:07:21]
to upgrade antiquated software to provide prompt emergency
[1:07:26]
response and whereas Senator Shaheen
[1:07:29]
and Congressman Pappas submitted a Bureau
[1:07:32]
of Justice assistant grant request on behalf
[1:07:35]
of Dairy London Dairy
[1:07:37]
and Windham in the federal FY 26 budget
[1:07:41]
for a regional software enhancement.
[1:07:44]
And whereas funding
[1:07:45]
for the grant was approved in the federal FY 26 budget
[1:07:50]
and the grant will cover 100% of costs now
[1:07:54]
therefore be it resolved in counsel pursuant
[1:07:57]
to RSA 31 35 dash B,
[1:08:01]
that the town administrator is hereby authorized to apply
[1:08:05]
for, accept
[1:08:06]
and expend up
[1:08:07]
to $1,039,000 from the US Department of Justice,
[1:08:13]
office of Community Oriented Police Services,
[1:08:17]
FY 2026 COPS Technology
[1:08:21]
and Equipment grant to support Theder Police Department.
[1:08:25]
This resolution shall take effect
[1:08:27]
immediately upon its passage.
[1:08:30]
Second Motion
[1:08:32]
by Councillor Millisecond by Councillor Foot.
[1:08:35]
Any further discussion on the motion? Councilor Mills? Yes.
[1:08:39]
Councillor Webb? Yes. Councillor Foote? Yes.
[1:08:42]
Councillor Chase? Yes. Councillor Flood? Yes.
[1:08:45]
Councillor Haley? Yes. And Chair Votes? Yes. Motion passes.
[1:08:48]
Seven zero. Thank you very much, council. All right.
[1:08:53]
New business. We have item 26 28,
[1:08:57]
resolution 2026 dash zero three to set the compensation
[1:09:00]
of the Town Clerk, town
[1:09:01]
Administrator, Mike Fowler presenting.
[1:09:03]
Alright, so tonight I've got a little bit of housekeeping.
[1:09:06]
As you're aware, the town clerk is an elected position.
[1:09:09]
The Town Council is responsible for setting
[1:09:12]
that annual salary.
[1:09:15]
Last year, the salary was set at $66,053.
[1:09:21]
One of the philosophies is to make that
[1:09:24]
increase follow along
[1:09:25]
with the non-represented group within our employee group.
[1:09:31]
And typically that trends with what the tax cap approval,
[1:09:35]
which in this case we know the number at 3.3%.
[1:09:39]
So what I'm recommending today is that the increase
[1:09:42]
of the town clerk salary would be
[1:09:44]
to $68,233.
[1:09:48]
And that would be effective July 1st, 2026.
[1:09:53]
Thank you. Any questions or comments from council?
[1:09:58]
That seems pretty straightforward.
[1:10:00]
Motion to open the Do we need a public hearing?
[1:10:02]
No, not public business. Don't need a hearing.
[1:10:04]
Just need a motion. Madam Chair, I'd like
[1:10:07]
to move resolution number 2026 dash 0 1 3
[1:10:12]
to set the compensation of the town clerk FY 2027.
[1:10:16]
Whereas Section 5.1
[1:10:19]
of the Town Charter designates the Town council
[1:10:21]
as the governing and legislative body of the town.
[1:10:24]
And whereas Section eight C
[1:10:28]
eight dash six Alright,
[1:10:31]
8.6 parentheses C
[1:10:35]
of the charter empowers the town administrator
[1:10:38]
to fix the compensation of all town officers
[1:10:41]
and employees appointed by the town administrator.
[1:10:44]
And whereas the town clerk is an elected official whose
[1:10:46]
compensation is not fixed by the town administrator, doing
[1:10:50]
so is therefore legislative action
[1:10:52]
and a duty of the town council.
[1:10:54]
Now therefore be resolved in council
[1:10:57]
that the town clerk's base annual compensation is
[1:11:00]
established at $68,233
[1:11:04]
for FY 27
[1:11:06]
and further be it resolved that the town clerk is hereby
[1:11:09]
provided with access to the full range
[1:11:12]
of employee benefits available to non-represented employees.
[1:11:16]
This resolution shall take effect immediately on
[1:11:18]
July 1st, 2026.
[1:11:22]
Second motion. And second, any further discussion?
[1:11:28]
So I agree with this resolution.
[1:11:31]
Foley, I'm going to abstain as my full-time job,
[1:11:36]
I believe would be in conflict
[1:11:39]
with approving a salary for another clerk.
[1:11:41]
We often share salary surveys throughout the state,
[1:11:46]
throughout our association.
[1:11:47]
So I don't want to vote on an increase
[1:11:49]
for another community when that same survey is then passed
[1:11:53]
around through, you know, the Clerk's Association
[1:11:56]
with other, with my community as well.
[1:11:59]
But I do agree with the premise of the resolution.
[1:12:01]
I'm just gonna abstain for that reason.
[1:12:05]
Anyone else? Alright on the motion. Councilor Mills?
[1:12:09]
Yes. Council Webb? Yes. Councilor Foot? Yes.
[1:12:13]
Councilor Chase? Yes. Councilor Flood? Yes. Council Haley
[1:12:16]
Abstain And Chair votes?
[1:12:18]
Yes. Motion passes. 6 0 1.
[1:12:21]
And last item of business item 26 29.
[1:12:26]
Excuse me, I almost spit out my cough.
[1:12:28]
Drop resolution 2026 dash zero 15 To authorize an extension
[1:12:32]
of the Master Development Agreement
[1:12:34]
with Lansing Melbourne Incorporated.
[1:12:36]
Again, town Administrator Mike Fowler presenting.
[1:12:39]
Alright, another housekeeping item.
[1:12:41]
As everybody is aware, the town has engaged
[1:12:45]
with LMG New Hampshire
[1:12:48]
and as part you're starting
[1:12:50]
to see some real construction going on at the
[1:12:52]
Abbott Court site.
[1:12:54]
One of the key features of the agreement
[1:12:57]
between the two parties is that there was going
[1:12:59]
to be a land transfer from town property
[1:13:03]
into a condo document style.
[1:13:06]
And there's been a few items
[1:13:08]
that took a little bit longer than anticipated.
[1:13:11]
However, Lansing Melbourne Group had reached out
[1:13:15]
and they're simply requesting an extension.
[1:13:17]
The closing date was identified previously
[1:13:19]
as March 30th, 2026.
[1:13:21]
They're seeking to extend that until six months
[1:13:24]
until September 30th, 2026.
[1:13:27]
No other changes to the document are notated.
[1:13:30]
It's just an extension of the time to complete the closing
[1:13:33]
and, and meet that condition.
[1:13:37]
Thank you. Any questions or comments?
[1:13:40]
Seeing no questions or comments?
[1:13:42]
Madam Chair, I move resolution number 2026 dash zero 15
[1:13:47]
to authorize an amendment
[1:13:48]
to the Master Development agreement with LMG New Hampshire,
[1:13:52]
LLC for the redevelopment of Abbott Court.
[1:13:56]
Whereas Section five, one
[1:13:58]
of the Town Charter designates the Town Council
[1:14:01]
as the governing and legislative body of the town.
[1:14:03]
And whereas the Master Plan
[1:14:05]
and Town Council goals have identified the redevelopment
[1:14:08]
of Abbott Court as an economic development priority,
[1:14:12]
and whereas the town has been in discussions with LMG
[1:14:15]
and HLLC,
[1:14:17]
which has experienced transforming underutilized assets into
[1:14:22]
a catalyst for downtown redevelopment.
[1:14:24]
And whereas the Town Council pursuant
[1:14:26]
to resolutions 2021 dash 75
[1:14:31]
and 2024 dash
[1:14:33]
six six authorized a memorandum memorandum of understanding
[1:14:37]
for the redevelopment of Abbott Court
[1:14:40]
with the Lansing Melbourne Group and whereas the town
[1:14:43]
and LMG have successfully partnered to redevelopment
[1:14:47]
to redevelop Abbott Court.
[1:14:50]
Now therefore be it resolved in counsel
[1:14:52]
that the town administrator is hereby authorized
[1:14:55]
to execute an amendment to the Master Development Agreement
[1:14:59]
and all other associated documents
[1:15:02]
with L-M-G-N-G-L-L-C for the redevelopment
[1:15:05]
of Abbott Court.
[1:15:07]
This resolution shall take effect
[1:15:10]
immediately upon its passage.
[1:15:13]
Second, The motion
[1:15:15]
by Council Mills second by Councilor Foot.
[1:15:17]
Any further discussion on the motion? Councilor Mills?
[1:15:21]
Yes. Council Webb? Yes. Councilor Foot? Yes.
[1:15:25]
Councilor Chase? Yes. Councilor Flood? Yes. Councilor Healy?
[1:15:29]
Yes. And Chair votes? Yes. Motion passes. Seven zero.
[1:15:33]
Any councilor comments or liaison reports? Councilor Foote.
[1:15:38]
Thank you Madam Chair. Again,
[1:15:40]
I just wanna congratulate the new councilors, number one.
[1:15:42]
Number two, congratulations on your step up.
[1:15:46]
And then last night, the conservation committee
[1:15:50]
wasn't the committee directly,
[1:15:51]
but they have a, a subgroup that had some
[1:15:56]
wildfire experts come in from the state
[1:15:58]
and they had a little presentation on that.
[1:16:00]
Council Webb has been on that panel,
[1:16:03]
so I'm gonna let him speak to it.
[1:16:04]
But before everyone leaves tonight on the back table back
[1:16:07]
there, there Austin brochure is about fire safety
[1:16:10]
and it's about the wild
[1:16:14]
Wildfire and brochure Wildfire protection plan.
[1:16:16]
I couldn't think of the word. It's been a long day.
[1:16:18]
So Council Webb was on that and,
[1:16:21]
and instrumental in helping with that program last night.
[1:16:24]
And I know Council Chase also came to the event.
[1:16:26]
So please take those brochures and re look into it
[1:16:29]
and I'll pass it off to my colleague.
[1:16:32]
I'll just spend a, a couple of minutes.
[1:16:34]
So what the subcommittee, which is made up of Beth Carver,
[1:16:38]
who is the land manager, Val Conway, who's a member
[1:16:41]
of the conservation committee.
[1:16:43]
John Neely, who's the state
[1:16:48]
works with Division Forest
[1:16:49]
and Lands as a state wildfire expert
[1:16:51]
and battalion chief fry bump from the
[1:16:54]
fire department and myself.
[1:16:56]
And what we're doing is developing a community
[1:16:59]
wildfire protection plan.
[1:17:01]
And what this will do with, among other things provide help,
[1:17:06]
provide safety to the community, it'll also provide access
[1:17:11]
to some grant funds that'll help mitigate
[1:17:13]
and improve our forest lands to make 'em more fire safe.
[1:17:19]
In short, the environment is changing.
[1:17:22]
Our woods are being threatened by different
[1:17:25]
invasive species, both insects
[1:17:27]
and flora that are changing how
[1:17:33]
our brush fire risk is developing dairy is actually
[1:17:38]
considered by the state of New Hampshire
[1:17:39]
to be at the highest risk for a se more serious,
[1:17:42]
not a California style
[1:17:44]
brush fire, let me get away from that.
[1:17:46]
But a more serious fire that could threaten property.
[1:17:50]
So we want to educate, develop this plan
[1:17:52]
and educate people on how to
[1:17:56]
mitigate the risks around their home.
[1:17:59]
And Chief Laro was that last line on the panel as well.
[1:18:02]
So if it's,
[1:18:04]
and I I believe Owen, that's, is
[1:18:06]
that currently showing right now on Dairy Cam? Is that
[1:18:08]
Accessible?
[1:18:09]
It could. It's, it's on the channel
[1:18:11]
and also available@dairycam.org. Tune in. Okay.
[1:18:14]
It's well On demand.
[1:18:17]
One of the things that was discussed
[1:18:18]
after the panel, which I think is gonna be kind of cool
[1:18:21]
with Owen, was this gentleman John Neely is
[1:18:26]
when you get him out in the woods,
[1:18:27]
he's actually really fascinating
[1:18:28]
and you can learn a lot from them.
[1:18:30]
And one of the next times that we do a tour
[1:18:33]
of the conservation land, we're gonna be bringing Dairy Cam
[1:18:35]
with us so that they can capture John
[1:18:38]
and as he identifies and talks about the woods, the floor,
[1:18:43]
and the fauna that we see here in Derry.
[1:18:46]
Excellent. Thank you.
[1:18:48]
Council again. Yep.
[1:18:50]
I would just like to publicly thank the voters
[1:18:54]
in District three for electing me to this position
[1:18:57]
and I hope to serve them well and,
[1:19:00]
and do a good job up here.
[1:19:01]
And I'm looking forward to working
[1:19:02]
with the rest of the council.
[1:19:03]
Thank you.
[1:19:08]
All right. No, don't do
[1:19:09]
it. I have two things. It's, it's
[1:19:13]
My favorite motion.
[1:19:14]
I know two things that I wanted to bring up.
[1:19:17]
One in addition to a marathon on the fourth in town,
[1:19:21]
there is also our rabies clinic.
[1:19:22]
Just a reminder from one
[1:19:23]
to four on the first floor here in the municipal center,
[1:19:28]
there are still appointments available
[1:19:31]
if you wanna call the town clerk's
[1:19:32]
office to sign up for one of those.
[1:19:33]
We will also squeeze in walk-ins as we're able.
[1:19:36]
But if you schedule an appointment
[1:19:38]
that makes our lives much easier.
[1:19:39]
We know who's coming when.
[1:19:41]
And just a reminder, if you do come,
[1:19:43]
please make sure all dogs are on a leash
[1:19:45]
and all cats are in carriers.
[1:19:47]
And if your animal is not good with others, come in
[1:19:52]
and talk to us before just bringing them into the building.
[1:19:54]
'cause we can sometimes work around that.
[1:19:56]
And the other thing I wanted to bring up,
[1:19:58]
we talked about earlier, Mr. Fowler read off all the dates
[1:20:01]
for our budget workshops and our, our budget hearings
[1:20:06]
and all of that coming up.
[1:20:09]
If you're someone who ends up emailing us right
[1:20:12]
around tax time to tell us you wanna know everything
[1:20:14]
that's going on, this is your time
[1:20:16]
to learn about what's going on.
[1:20:17]
We go through the budget, every department
[1:20:19]
is gonna present on the budget.
[1:20:21]
You'll hear why there's a expense here, why there isn't,
[1:20:24]
there's a public hearing for you to comment, express
[1:20:28]
how you feel about that budget as well for us to hear that
[1:20:31]
we, we welcome people to be more involved in that process.
[1:20:34]
So again, we have on April 7th,
[1:20:38]
we will have the budget presentation for FY 27
[1:20:40]
during our council meeting, April 9th
[1:20:43]
and April 16th,
[1:20:44]
both at 6:00 PM There will be budget workshops.
[1:20:47]
April 21st is a regular council meeting,
[1:20:49]
but if there's anything we need
[1:20:51]
to address on the council on the budget, we will.
[1:20:52]
And then finally on April 23rd will be
[1:20:56]
the FY 27 budget and CIP public hearing.
[1:20:59]
Just as another reminder. Yes.
[1:21:03]
Motion to adjourn. Second. All those in favor? Aye. Aye.
[1:21:07]
Aye. Thank you everybody. Have a good night.
