[6:26] whereas destin water users is the water service provider for our area
[6:31] now therefore be resolved by that virtue of the authority vested in me as mayor

[8:24] transportation networks storm water infrastructure public buildings and
[8:29] natural resources essential for and to our citizens
[8:33] and whereas it is in the public interest of for our citizens civic leaders and
[8:37] children in the city of destin to gain knowledge of and to maintain an ongoing
[8:41] interest and understanding of the importance of public works and the
[8:45] public works programs in our community and whereas the year 2022 marks the 62nd
[8:51] annual national public works week sponsored by the american public works
[8:56] association now therefore be it proclaimed that i
[9:00] gary jarvis mayor of deaths in florida on behalf of the city council do hereby
[9:04] designate the week of may 15th through the 21st two weeks from now
[9:09] as national public works week in the city of destin energy all citizens to
[9:13] join with representatives of the american public works association and
[9:16] other governmental agencies and paying tribute to our public works
[9:19] professionals recognizing the substantial contributions they make to
[9:23] protect our health safety and quality of life here in destin so done this second

[11:12] thanks for allowing us to come in i just wanted to take a few minutes to kind of
[11:15] briefly update you with with your project where it's at in the stages and
[11:19] wanted to kind of share with you real quick some some projects throughout the
[11:21] state just kind of give you an idea as you're progressing and moving forward
[11:25] with your projects some things that's that's taking place in other areas of
[11:28] the state so basically where we're at right now
[11:32] we've already submitted the f the fpl engineering deposit so it started
[11:37] they're moving forward with that you're probably
[11:39] noticed over the last month survey data collection has been taking place you
[11:43] will see crews probably um you know this afternoon tomorrow possibly into
[11:47] wednesday just data collected the last few points we just wanted to verify a
[11:51] couple of endpoints match up some manholes things like that so that's all
[11:54] progressive as soon as that data is complete we get it over to the
[11:57] engineering department with fpl and we're already working with them to try
[12:01] to get that as soon as we get that back we'll start probably within 60 to 90
[12:06] days start finding out exactly where some of the critical infrastructure
[12:10] locations are going to be and basically what that is where we've got the
[12:13] transformers and some of the switches where they might fall in the corridor
[12:17] so we'll quickly start looking at those locations see what we can do to adjust
[12:21] them make sure that they kind of fit well for the city and you know
[12:24] unfortunately you know they've got to go somewhere we're just going to try to
[12:26] find the best place that we can we can put those we're also working with the
[12:30] carriers as well to make sure that they're in line with
[12:33] that so that's typically on projects sometimes the carers can fall behind so
[12:37] with that we wanted to kind of share with you some ongoing projects um
[12:41] throughout the state so i know you guys are familiar with longboat key it's a
[12:46] 50 million dollar underground project so it's a little bit smaller but it's
[12:50] interesting that their um island in general has a lot of same similarities
[12:55] as yours does so where we are right now we're close to
[12:58] completing the entire project it was originally seven years it condensed it
[13:02] down to three we're actually ahead of schedule quite a bit so just wanted to
[13:05] kind of share as you see things that in the industry are kind of sliding
[13:10] behind schedule this one is significantly ahead of schedule more
[13:14] importantly it's well under budget um significantly on the power side and then
[13:18] the contingencies that were set aside there's two million that was set aside
[13:22] zero's been used today so all the boring activities will be done this week so
[13:26] it's a pretty big accomplishment to have all of the boring activities which is
[13:29] your biggest risk typically in a project done so i know when we're we're right
[13:35] now dealing with inflationary pressures construct you know contractors timing
[13:39] these are projects that are ongoing during these current conditions that are
[13:42] performing well this is another project we um
[13:47] you know i don't say it to to brag but just so you know this project here in
[13:51] bradenton beach we our firm just received the consultant of the year
[13:54] award through apwa it was because of the complexity it's a cra district it's
[13:59] extremely heavy corridor it's got a lot of businesses as you can see i've got a
[14:03] quick little video on it but you know it had everything that would that could be
[14:07] a potential problem for a project it was ahead of schedule under budget and the
[14:12] businesses were extremely pleased so we just wanted to that one was actually
[14:16] done in the last year so it's fully complete at this stage um
[14:20] so we did encounter some of the same thing that you're seeing with inflation
[14:24] stuff like that really didn't impact the project to a large degree and like i
[14:27] said we're under budget and never use the contingency so just wanted to kind
[14:31] of report that so you can see some projects that are actually wrapping up
[14:34] they're actually going well the procurement that's pretty much the
[14:39] process moving forward on this one so once we get the engineering deposit back
[14:43] from fpl we'll start moving forward we'll get the binding cost estimate from
[14:46] fpl basically that's a convoluted math equation that follows a tariff and the
[14:51] tearful basically this is what your credit will look like that gets applied
[14:54] to the project so we've already got some we've got some calculations that we do
[14:58] to kind of predict that modeling but when we get it back we'll be presenting
[15:02] it quick um you know to council to be able to look at those numbers and see
[15:05] what the actual credit would be we have seen they've they've generally increased
[15:10] over time because the um you know there's just been a
[15:13] it's been determined that the undergrounding projects have some
[15:16] significant cost savings to the utility companies therefore those credits are
[15:20] applied to the project the um
[15:23] when we get those binding call assessments we're also trying to have
[15:25] the same ones from the utility carriers so since they're attached to those lines
[15:28] we'll make sure that we have that information the same thing
[15:32] we'll also be looking to make sure that we have the right qualified contractors
[15:37] fortunately for this type of work it does require that these contractors are
[15:41] you know they understand that um that type of work that that's a kind of
[15:45] lowers that pool of contractors by a significant amount but what that does is
[15:49] it ensures you and what we're looking for is that the contractors that are
[15:52] working on your island they're familiar with this type of work they've worked
[15:55] within these communities it's very important it's different than boring out
[15:59] you know in other areas so we just want to make sure that we bring that to you
[16:02] so we'll be kind of working with you and sharing that as we go
[16:06] the city of bradenton beach project that i talked about i know that you guys have
[16:10] the two cra districts so just coincidentally we just wrapped that
[16:13] project up so one of what i wanted to share was this um
[16:17] video real quick and just kind of shows the
[16:20] corridor you can see the polls are still up as you're looking down the street
[16:24] this is the event um you know the big event that everybody waits for is when
[16:27] all the lines and powers and poles come out so it's just kind of a
[16:31] quick view of that evening
[16:34] kind of a long night and then fast forward twelve and a half hours so the
[16:38] following morning this is probably about six five thirty six in the morning
[16:43] the corridor just the significance of of all that stuff coming down does make a
[16:47] huge impact like you can see as you're going through the video there's a it's
[16:51] just all businesses it's an extremely extremely um limited right-of-way tons
[16:57] of pedestrian traffic so as you can imagine with this that's why it was
[17:01] significant with the award because projects like these typically run behind
[17:04] schedule not as a result of anything on the project team
[17:08] they're just they have their challenges so i think if you're partnering well
[17:11] with everybody you're working you can kind of achieve this same goal so that's
[17:14] that's our goal for the city but just wanted to kind of share a quick video
[17:18] with you to kind of see sun's just now coming up but it it i
[17:22] mean the impact is you know everybody at the end of the job of course it
[17:27] says you know the video kind of says more than the words itself
[17:30] so with that i just like i said just wanted to share with you where we are in
[17:34] the process things are moving well the projects that are you know wrapping up
[17:38] or fully um almost wrapped up or going well so we
[17:42] just wanted to kind of share that with you and if you know by all means if you
[17:45] have questions i'd love to hear through the process we're here to answer that at
[17:49] any given time anybody have any questions for mark go

[17:55] the status of the other utilities the communication the other things are on
[17:58] the polls we asked that question a few months ago is
[18:01] are they obliged to take their stuff down when we
[18:04] bury the power lines and did we ever get an answer to that question
[18:08] we are we're working with them right now what we're doing is we part of the trip
[18:12] here too was to try to just make sure what what we try to do is we don't want
[18:16] to just assume that what the carriers are giving us is what they actually have
[18:19] to the pool because we're really we want to avoid for lack of about we just don't
[18:23] want to this city to absorb any betterment right so we want to make sure
[18:27] that what we're providing in the ground is adequate for what's in the air and
[18:31] not more than that we just don't really want to expand that infrastructure so
[18:34] it's a little bit of a process as we're working with fpl right now we're working
[18:38] with them to try to get their pieces and and the cost estimates for that to tie
[18:41] into our earlier conversations with them so i would imagine during these the
[18:46] survey is kind of critical too because a lot of them are asking for that survey
[18:50] because it's got the cad format that they like to go back to their systems
[18:53] and start plugging in some exact numbers so when we get that survey we'll be able
[18:57] to forward that information to them quick but yeah we're definitely wanting
[19:00] to make sure that we don't
[19:03] here's what i can share with you on all of the ongoing projects of those two
[19:06] that we just said are near completion of the bradenton being complete we've not
[19:10] had any issues with the cures being attached to the polls when we're ready
[19:13] to take them down that's usually a major major issue a lot of these projects
[19:17] yeah i'm just you know a little concerned because that's pretty critical
[19:20] if we bury one and the others are still there we haven't really accomplished
[19:24] anything yeah we're doing something pinellas and that was a big issue for
[19:28] some previous projects you know they what we don't ever want to see it's it's
[19:31] kind of a personal pet peeve i don't want to see the power company done the
[19:34] polls getting cut and topped off and those care lines we want the polls out
[19:38] at the same time so we'll i can promise you we'll be pushing hard to make sure
[19:41] that the carers are kind of in that same pattern okay thanks thank you on that

[19:54] what type of pushback do you have sometimes with with the cable company
[19:58] and telephone and that kind of stuff and how do you remediate those issues is

[20:10] might be you know um us not not performing well on our side of things i
[20:15] mean that's our our job we feel is to kind of reign that in and and
[20:19] make sure that it's it's handled like i said we just we don't have that issue
[20:22] doesn't mean that something um might not come up that you can't avoid but i think
[20:26] it's just building relationships with them working with them we just try to
[20:30] you know help them out as much as we can i think that goes a long way so it's
[20:33] just it's a partnership we just have to develop so we're working with them
[20:36] closely to make sure that they feel comfortable that we're here to help them
[20:39] not just demand a bunch of information and and rely on that so

[21:54] on other than public hearings and then there will be an opportunity on each one
[21:59] of the three public hearings we're having to make public comment as well so
[22:03] with that being said i'm going to start at the center of the
[22:07] room and work that way just throw a wrench

[23:04] get the rates raised for the sheriff and highway patrol toes and the
[23:08] private property tows the rates as far as i know haven't been
[23:12] raised since 2015
[23:16] and it's my understanding i don't really know how this works but luther rhodes
[23:19] told me that to bring it before the city council the city council approves it
[23:23] then they take it to the county and so on and so on i'm not 100 sure if that's
[23:28] the right way but that's what i was told so like great what's the rate real quick
[23:32] so currently um well he does more stuff than i do but
[23:38] for what i do is mostly accidents abandoned vehicles or rests
[23:42] stuff like that currently it's 150 for the tow
[23:46] and then it's 50 a day storage which it's been that since 2015. then he
[23:52] also does private property which is what 125 for the tow
[23:56] and 25 a day storage yeah um and to be honest with you the
[24:02] private property toes the
[24:05] the backlash that we get on the back end is like oh my god it's ridiculous
[24:12] yeah i don't even do that like people i'm like call scott i'm not doing it
[24:16] he's way bigger than me he can he's not i'm not doing it but
[24:21] the price of fuel is going up i mean today i spent 1800 to fill up my big
[24:26] record it's getting ridiculous it's getting out
[24:30] of hand and people believe it or not with the private property telling stuff
[24:36] the people that give us the most problems
[24:38] is not the tourist it's the locals
[24:42] i mean honestly it truly is the locals that gives us the most problems

[24:51] say for instance we go out and we work a wreck scene for somebody that's
[24:55] drinking and driving we get out there and spend
[24:58] an hour out there cleaning up a mess in the blazing sun on the asphalt it's like
[25:04] 150 ducks is it worth it can we get it up a little bit higher
[25:08] because i mean we
[25:11] cleaning up a mess in a hurry yeah and us just like public works are on call
[25:16] 365's a day or 365 days a year 24 hours a day it doesn't matter if you're eating
[25:22] christmas breakfast with your kids fhp calls you gotta go now it doesn't matter
[25:26] if it's three in the morning it doesn't matter when it is and it's the same with
[25:29] the sheriff's department i mean and without fail i mean we got 30 minutes to
[25:34] get from wherever we're at whatever we're doing
[25:37] to them in 30 minutes
[25:40] regardless and it's
[25:42] it's one of them things where
[25:45] times are changing times are definitely changing cars are
[25:49] getting bigger trucks are getting bigger messes are getting a lot better our
[25:52] trucks are getting bigger like in 2015 you could buy a flatbed record for 70
[25:56] 000. i just bought a brand new one last year and it was 106.
[26:00] the same way with me so when somebody says why is it total
[26:03] 150 dollars well the trucks 106 grand it gets eight miles to the gown at five
[26:07] dollars a gallon the insurance is i looked up my insurance so i told kevin
[26:12] i said i need some numbers because i am a numbers guy but in 2017 our entire
[26:16] operation insurance package was 17 000. this year it's 22.
[26:21] fuel is double the trucks are close to double
[26:25] yeah and salaries are up you're paying guys
[26:28] 30 35 bucks an hour now instead of 25. i got i got the biggest truck in the
[26:32] county the biggest tow truck in this county
[26:36] my insurance for the year 75 000
[26:40] for the year that's for my whole fleet i bought a brand new rollback peterbilt
[26:45] just like his 106 thousand dollars five miles to a gallon
[26:50] the big record we're four miles to the gallon

[28:53] florida i wanted to talk about my concerns for
[28:57] the ever-growing presence of illegal charters coming out of destin florida
[29:02] on any given weekend you can go to joe's bayou and watch it's like a show you
[29:08] just get to watch illegal charters drop off at our city parks
[29:12] i was there for about 20 minutes on saturday and i recorded
[29:17] two boat charters dropping off
[29:20] while the city park attendant quite literally looked the other way the
[29:24] entire time he didn't go up and give any warnings
[29:28] he didn't ask any questions or take any pictures
[29:32] which i'm not sure why it's very obvious i can spot them from a mile away
[29:37] anywhere i go i've been at dewey dustin's like two weeks ago and i saw
[29:42] charters getting dropped off um at dewey dustin i know it's hard to
[29:46] regulate but they're very easy to spot um and it just kind of seems like a
[29:50] broken system because i've called sheriffs over to my boat before and
[29:55] pointed them out at crab island and they've told me to take a picture send
[29:59] it in it doesn't seem like it's a law that's
[30:03] being enforced in any way and i wanted to know what you guys were doing about
[30:07] it and ways i can work with you guys to point out these illegal charters because
[30:13] i'm in a charter company i've had to jump through hoops to do
[30:16] everything the right way i pay my three percent to the national parks my 400
[30:21] dollars to the county every month and
[30:25] have my btr a place to pick up and i'm watching
[30:29] all these other boats just take advantage of the system and work it and
[30:34] i don't know why nobody wants to do anything about it when i when i point it
[30:38] out to them

[31:05] at the boat ramp to to police it's code enforcement co-compliance are they doing

[31:16] lisa firth the parks director to work with her staff at the launch to try to
[31:21] educate them on this problem and what to look for so that they can get in contact
[31:26] with code enforcement who has the ability um to do some enforcement of our
[31:31] codes our code is trying to respond now
[31:36] more because they're aware of it thanks to folks like you
[31:40] because i wasn't i wasn't aware of it until a couple weeks ago when i when i
[31:43] heard some of the comments so um our code is is working hard to get over
[31:48] there and i will say not as an excuse but just as a fact that our code is
[31:52] short right now a couple of people so a few people so please bear with us and we
[31:58] will get this problem taken care of as she said it is a challenge um to
[32:02] identify some of the votes um and some of them it's not i mean it's
[32:07] a dime a dozen if you count 12 pontoon boats out there 10 of them are illegal
[32:12] yeah and and just to address this madison it's not just in the uh livery
[32:17] vessel business it's
[32:19] rampant and the state licensed guide boats it's rampant and the federally
[32:24] chartered for hire business and now it's actually becoming
[32:28] an issue with private yacht charters and
[32:32] about two weeks ago three weeks ago we had the united states coast guard here
[32:36] briefing this council on what constitutes a charter what constitutes a
[32:41] bear boat contract and in the issues my dealings with national marine
[32:47] fisheries with the coast guard fwc and our sheriff's office that has a marine
[32:53] unit is you have to make a case
[32:57] and you have to make a case that's going to stand up in a court of law and so

[33:29] given tickets and he was out there on sunday he was
[33:32] one of the ones dropping off at joe's bayou i know exactly who you're talking
[33:36] about and he was dropping off at joe's bayou on sunday using the city
[33:39] permanently he hasn't had his day in court yet and that may
[33:43] change when he gets his fine but but so all we can do is like it's not that
[33:48] people are ignorant to the problem but it's going to take an entire community
[33:53] and it's like what we do in the charter industry is we are the policemen because
[33:57] we are the eyes and ears of what's going on in our community and so you just got
[34:01] to keep turning them in and keep putting the pressure up delivery vessel
[34:05] organization now that represents all you guys is totally aware of it they're
[34:10] doing the same thing we recognize it we'll do the best we can
[34:14] on the code enforcement side of things but you just got to catch the bad guys
[34:18] you know we can't legislate morality unfortunately we can do it through
[34:23] ordinances and in our code enforcement stuff but this council and myself being
[34:27] a licensed captain we're not blind to the problem and we're going to try and
[34:32] do a better job the season is just about to begin but nobody
[34:37] um nobody you know there's a couple of my friends they got me on speed dial
[34:41] they're sending me pictures all the time come on mayor this is an illegal
[34:45] operator the one you and i are just talking about
[34:48] you know sooner or later the price gets the point where
[34:52] they'll have their day in court that's all i can tell you right now but but
[34:55] don't assume that we're not caring don't assume that we're not doing anything
[34:59] about it and don't assume that those people are going to pay the price at

[35:33] that's where the city of destin can step in and say you're not allowed to pick up
[35:37] at our rants and even just stopping them right there in the process while they're
[35:41] picking up at joe's bayou or dewey dustin's or anywhere else that they're
[35:44] doing it stopping them in the process is enough to scare them if you go on to any
[35:49] of the apps that they're using they're advertising joe's by you um all these
[35:54] different spots like right there making a call that's something that i
[35:59] feel like this even the sheriffs could enforce because it's a city law
[36:03] so how do we so to answer your evidentiary
[36:07] question it can be done either way if we get pictures
[36:11] then staff takes that as a complaint and goes and investigates themselves um but
[36:17] when they come out there they're already gone
[36:19] right no longer but
[36:22] if it's ongoing they should be able to catch them if
[36:26] it's ongoing yeah next time theoretically if they're in and out in
[36:29] 10 20 minutes we never can respond quick enough due to
[36:32] staff shortages or whatever else
[36:37] if a member of the public that took pictures wants to testify though then
[36:41] that could be used as evidence as well if they were willing to they don't have
[36:44] to staff can also go out and witness it themselves so i'm not trying to put
[36:48] anything on the public at all but if they chose to they could and then the
[36:52] other method would just be to regularly monitor
[36:55] certain areas but you know the director of code enforcement management would
[36:59] have to decide where to put those resources
[37:01] just my two cents and i appreciate it but
[37:04] maybe if citizens are submitting stuff we have some type of database just to
[37:10] just ship just to see if repeat offenders so we can tell the attendant
[37:14] you know you did it once you did it twice you did it three times
[37:18] now the fourth time this particular person has come through here now we can
[37:22] potentially go to our employee or your you know your
[37:26] employee and kind of crack the whip a little bit just

[37:41] our employees don't know that they should help with that because they have

[38:49] using a btr city so we do have a level of responsibility to protect you
[38:54] and the other liberty vessels that are operating under that moratorium john

[39:55] speeding um other offenses buis so
[39:59] that's some of the discussion that's brought up in fact um
[40:02] there is a meeting the next i'm not sure if it's the next
[40:05] one or the second meeting in may for the
[40:08] accounting they're supposed to be talking about how to enforce it in fact
[40:13] i recommend having someone from the city of destin attend that meeting
[40:17] because i believe the fort walton beach that city manager is going to be
[40:20] attending again too i have a question on that very subject
[40:25] what was brought up to me via text the other day is that there's
[40:30] also boats that not only are they operating illegally they got two more
[40:34] than 12 people on their boats but they're dropping people off at crab
[40:37] island and leaving
[40:40] and yeah i'm sure they got some type of arrangements to come back and pick them
[40:43] up but as you and i both know we've lived here long enough and been on the
[40:46] water long enough it only takes about 15 minutes
[40:49] for a blue norther especially in july and august to build up over the the
[40:53] crest view and be through here at 60 mile an hour winds and stuff like that
[40:57] and those people are going to be stuck in a lightning storm so this is not just
[41:02] a an illegal operator issue this is going to be
[41:06] this is a huge safety issue
[41:09] and so i guess
[41:12] we need to have lance or webb at that meeting if
[41:16] possible i think and so just so we could stay on the same page
[41:20] with the county commissioners we know it's a problem now and it's going to be

[42:39] can go online in five minutes and come up with a dozen boat rentals and they're
[42:43] all advertising either picking up somewhere in the harbor
[42:48] illegally or launching at joe's bayou you meet me at joe's bayou or we'll
[42:53] we'll launch at joe's buyer and go pick you up there are city ordinances about i
[42:57] realize that there's a difference between operating a
[43:01] business or launching commercial vessels i'll launch my paracel boats and drive
[43:05] around to my ground up around my docks but i'm not allowed to go pick up
[43:09] passengers and fly amount of joes by you and that's what these technically what
[43:13] these people are doing they're picking up they're meeting their passengers
[43:16] there they might have paid them online so
[43:18] they're not actually conducting business collecting money
[43:22] there but it's operating a business out of joe's bayou which is illegal by city
[43:26] code from what i understand we've had this dialogue going on for
[43:30] quite some time and and i think one thing that we haven't done and i went to
[43:34] the livery vessel meeting you know that we had with the sheriff's office and
[43:37] coast guard and all that and that was very enlightening is uh i know you guys
[43:41] are fine you have a good strong organization um
[43:44] what i would like out of you guys if you could and you could send them to lance
[43:48] is give us some basic uh enforcement ideas
[43:52] from our perspective so we can help facilitate the coast guard fwc
[43:58] and stuff like that just because you guys are the pros you know what your
[44:01] challenges are who your cheaters are and and i think you would be the the folks
[44:07] that we would look to for the most professional opinion on how to address
[44:10] this problem and that keeps you guys engaged with us we it keeps us engaged
[44:14] with you and we could try to come up with some solutions prior to the
[44:19] hundred days of summer this year you can go online and find a dozen illegal
[44:22] operators in in 10 minutes another thing the county's going to do is and i'm sure
[44:28] some way the city does it do you have to have a brick and mortar location right
[44:32] to operate you may want to incorporate that in your code if it's not in this
[44:35] already that's something they just instituted in their ordinance at the
[44:38] county level correct yes all right so that's an idea for us dewey go ahead

[44:47] you know we we're having a fit with them down at the restaurant on the bay we run
[44:51] them out i'm having to hire a guy to be there every day just to chase them off

[45:01] but to operate that boat commercially you're supposed to have a state of
[45:04] florida commercial sticker as you know it's a different color
[45:08] if you don't have that you're in violation of that law the other thing i
[45:11] want to just check on when we first took over the joe's bio boat ramp and started
[45:16] charging we had a special rate for commercial boats because after all there
[45:20] are a lot of commercial boats that operate in in the uh area
[45:24] does that no longer apply it was a thousand dollars back then which was
[45:28] very high it was it was a lot of money and if if
[45:31] that's if that's the case and they don't have that commercial
[45:36] boat launch sticker on their boat then it should be easily enforced are we
[45:41] not doing that anymore has that been struck from the ordinance
[45:44] that is still available but a previous council also voted to allow launch and
[45:51] recovery of uh commercial vehicles on a daily basis too so they're paying the
[45:56] daily fee well perhaps we need to modify that as our first step and if you're
[46:01] going to operate commercially out of that ramp it could be a thousand a month
[46:05] much like it is out on crab island and when they're
[46:08] having to pay the national park service i don't think that would be unreasonable
[46:12] and if they didn't have that sticker they can't launch
[46:15] and that you know the folks that are doing this they're very few of them are
[46:19] going to pay that and that's uh
[46:21] something we need to have the land user attorney or the city attorney look into
[46:25] that we can modify the ordinance and use that as an enforcement tool anyway if
[46:29] you don't have the sticker you can't launch and that that's exactly how it
[46:33] was prior to this this last change that's right but we definitely have some
[46:37] ideas and we'd be happy to meet with whoever you
[46:40] you would like us to meet with to share those ideas and just give us a call um

[58:57] thanks for allowing us to come in i just wanted to take a few minutes kind of
[59:00] briefly update you with with your product where it's at in the stages and
[59:03] wanted to kind of share with you real quick some some projects throughout the
[59:06] state just kind of give you an idea as you're progressing and moving forward
[59:09] with your projects some things that's that's taking place in other areas of
[59:12] the state so basically where we're at right now
[59:17] we've already submitted the f the fpl engineering deposit so it started
[59:21] they're moving forward with that you're probably
[59:24] noticed over the last months survey data collection has been taking place you
[59:27] will see crews probably um you know this afternoon tomorrow possibly into
[59:32] wednesday just data collected the last few points we just wanted to verify a
[59:36] couple of endpoints match up some manholes things like that so that's all
[59:39] progressive as soon as that data is complete we get it over to the
[59:42] engineering department with fpl and we're already working with them to try
[59:46] to get that as soon as we get that back we'll start probably within 60 to 90
[59:50] days start finding out exactly where some of the critical infrastructure
[59:54] locations are going to be and basically what that is where we've got the
[59:58] transformers and some of the switches where they might fall in the corridor
[1:00:01] so we'll quickly start looking at those locations see what we can do to adjust
[1:00:05] to make sure that they kind of fit well for the city and you know unfortunately
[1:00:09] you know they've got to go somewhere we're just going to try to find the best
[1:00:11] place that we can we can put those we're also working with the carriers as well
[1:00:16] to make sure that they're in line with that so that's typically on projects
[1:00:19] sometimes the cares can fall behind so with that we wanted to kind of share
[1:00:23] with you some ongoing projects throughout the state so i know you guys
[1:00:28] are familiar with longboat key it's a 50 million dollar undergrounding project
[1:00:32] so it's a little bit smaller but it's interesting that their
[1:00:36] island in general has a lot of same similarities as yours does so
[1:00:41] where we are right now we're close to completing the entire project it was
[1:00:45] originally seven years it condensed it down to three we're actually ahead of
[1:00:48] schedule quite a bit so just wanted to kind of share as you see things that
[1:00:52] in the industry are kind of sliding behind schedule this one is
[1:00:56] significantly ahead of schedule more importantly it's well under budget um
[1:01:01] significantly on the power side and then the contingencies that were set aside
[1:01:04] there's two million that was set aside zero's been used today so all the boring
[1:01:09] activities will be done this week so it's a pretty big accomplishment to have
[1:01:12] all of the boring activities which is your biggest risk typically in a project
[1:01:16] um done so i know when we're we're right
[1:01:19] now dealing with inflationary pressures construct you know contractors timing
[1:01:23] these are projects that are ongoing during these current conditions that are
[1:01:27] performing well this is another project we um i don't
[1:01:32] say it to to brag but just so you know this project here in bradenton beach we
[1:01:36] our firm just received the consultant of the year award through apwa it was
[1:01:41] because of the complexity it's a cra district it's extremely heavy corridor
[1:01:46] it's got a lot of businesses as you can see i've got a quick little video on it
[1:01:49] but you know it had everything that would it could be a potential problem
[1:01:53] for a project it was ahead of schedule under budget and the businesses were
[1:01:57] extremely pleased so we just wanted to that one was actually done in the last
[1:02:01] year so it's fully complete at this stage um
[1:02:05] so we did encounter some of the same thing that you're seeing with inflation
[1:02:09] stuff like that really didn't impact the project to a large degree and like i
[1:02:12] said we're under budget and never used the contingency so just wanted to kind
[1:02:15] of report that so you can see some projects that are actually wrapping up
[1:02:19] they're actually going well the procurement that's pretty much the
[1:02:23] process moving forward on this one so once we get the engineering deposit back
[1:02:27] from fpl we'll start moving forward we'll get the binding cost estimate from
[1:02:31] fpl basically that's a convoluted math equation that follows a tariff and the
[1:02:35] tariff will basically this is what your credit will look like that gets applied
[1:02:38] to the project so we've already got some we've got some calculations that we do
[1:02:43] to kind of predict that modeling but when we get it back we'll be presenting
[1:02:47] it quick um you know to council to be able to look at those numbers and see
[1:02:50] what the actual credit would be we have seen they've they've generally increased
[1:02:54] over time because the um you know there's just been a um it's been
[1:02:59] determined that the underground projects have some significant cost savings to
[1:03:02] the utility companies therefore those credits are applied to the project
[1:03:06] the um when we get those binding call
[1:03:08] assessments we're also trying to have the same ones from the utility carriers
[1:03:11] so since they're attached to those lines we'll make sure that we have that
[1:03:14] information the same thing um we'll also be looking to make sure that we have the
[1:03:20] right qualified contractors fortunately for this type of work it does require
[1:03:23] that these contractors are you know they understand that
[1:03:27] that type of work that's a kind of lowers that pool of contractors by a
[1:03:32] significant amount but what that does is it ensures you and what we're looking
[1:03:35] for is that the contractors that are working on your island they're familiar
[1:03:38] with this type of work they've worked within these communities it's very
[1:03:42] important it's different than boring out you know in other areas so we just want
[1:03:45] to make sure that we bring that to you so we'll be kind of working with you and
[1:03:48] sharing that as we go the city of bradenton beach project that
[1:03:53] i talked about i know that you guys have the two cra districts so just
[1:03:56] coincidentally we just wrapped that project up so one of what i wanted to
[1:03:59] share was this um video
[1:04:03] real quick and just kind of shows the corridor you can see the polls are still
[1:04:07] up as you're looking down the street this is the event um you know the big
[1:04:10] event that everybody waits for is when all the lines and powers and poles come
[1:04:14] out so it's just kind of a a quick um view of that evening
[1:04:19] kind of a long night and then fast forward twelve and a half
[1:04:22] hours so the following morning this is probably about six 5 36 in the morning
[1:04:27] the corridor just the significance of of all that stuff coming down does make a
[1:04:32] huge impact like you can see as you're going through the video there's a it's
[1:04:36] just all businesses it's an extremely extremely
[1:04:40] limited right away tons of pedestrian traffic so as you can imagine with this
[1:04:45] that's why it was significant with the award because projects like these
[1:04:47] typically run behind schedule not as a result of anything on the project team
[1:04:52] they're just they have their challenges so i think if you're partnering well
[1:04:55] with everybody you're working you can kind of achieve the same goal so that's
[1:04:59] that's our goal for the city but just wanted to kind of share a quick video
[1:05:03] with you to kind of see sun's just now coming up but it it i
[1:05:07] mean the impact is you know everybody at the end of the job of course it
[1:05:11] says you know the video kind of says more than the words itself so
[1:05:16] with that i just like i said just wanted to share with you where we are in the
[1:05:19] process things are moving well the projects that are you know wrapping up
[1:05:22] or fully um almost wrapped up or going well so we
[1:05:26] just wanted to kind of share that with you and if you know by all means if you
[1:05:29] have questions i'd love to hear through the process we're here to answer that at

[1:05:46] are they obliged to take their stuff down when we

[1:05:57] trip here too was to try to just make sure what what we try to do is we don't
[1:06:01] want to just assume that what the carriers are giving us is what they
[1:06:03] actually have to the pole because we're really we want to avoid for lack of
[1:06:07] about we just don't want to this city to absorb any betterment right so we want
[1:06:11] to make sure that what we're providing in the ground is adequate for what's in
[1:06:15] the air and not more than that we just don't really want to expand that
[1:06:18] infrastructure so it's a little bit of a process as we're working with fpl right
[1:06:22] now we're working with them to try to get their pieces and and the cost
[1:06:25] estimates for that to tie into our earlier conversations with them so i
[1:06:28] would imagine during these the survey is kind of critical too because a lot of
[1:06:32] them are asking for that survey because it's got the cad format that they like
[1:06:36] to go back to their systems and start plugging in some exact numbers so when
[1:06:40] we get that survey we'll be able to forward that information to them quick
[1:06:43] but yeah we're definitely wanting to make sure that
[1:06:46] we don't here's what i can share with you on all
[1:06:49] of the ongoing projects of those two that we just said are near completion of
[1:06:52] bradenton being complete we've not had any issues with the cures being attached
[1:06:56] to the polls and we're ready to take them down that's usually a major major
[1:07:00] issue a lot of these projects yeah i'm just you know a little
[1:07:03] concerned because that's pretty critical if we bury one and the others are still
[1:07:07] there we haven't really accomplished anything yeah we're doing something
[1:07:10] pinellas and that was a big issue for some previous projects you know they
[1:07:14] what we don't ever want to see it's it's kind of a personal pet peeve i don't
[1:07:17] want to see the power company done the polls getting cut and topped off and
[1:07:20] those care lines we want the polls out at the same time so
[1:07:24] i can promise you we'll be pushing hard to make sure that the carers are kind of

[1:11:05] council the city council approves it then they take it to the county and so
[1:11:10] on and so on not 100 percent sure if that's the right way but that's what i
[1:11:14] was told what's the rate real quick so currently

[1:11:22] what i do is mostly accidents abandoned vehicles or rests
[1:11:27] stuff like that currently it's 150 for the tow
[1:11:30] and then it's 50 a day storage which it's been that since 2015. and he
[1:11:36] also does private property which is what 125 for the tow
[1:11:40] and 25 a day storage yeah um and to be honest with you the

[1:11:49] the backlash that we get on the back end it's like oh my god it's ridiculous

[1:14:01] operation insurance package was 17 000. this year it's 22.
[1:14:06] fuel is double the trucks are close to double
[1:14:09] and salaries are up you're paying guys 30 35 bucks an hour now instead of 25. i

[1:16:41] the ever-growing presence of illegal charters coming out of destin florida
[1:16:47] on any given weekend you can go to joe's bayou and watch it's like a show you
[1:16:52] just get to watch illegal charters drop off at our city parks
[1:16:57] i was there for about 20 minutes on saturday and i recorded
[1:17:01] two boat charters dropping off
[1:17:05] while the city park attendant quite literally looked the other way the
[1:17:08] entire time he didn't go up and give any warnings
[1:17:12] he didn't ask any questions or take any pictures
[1:17:16] which i'm not sure why it's very obvious i can spot them from a mile away
[1:17:22] anywhere i go i've been at dewey dustin's like two weeks ago and i saw
[1:17:26] charters getting dropped off at dewey dustin i know it's hard to
[1:17:30] regulate but they're very easy to spot um and it just kind of seems like a
[1:17:35] broken system because i've called sheriffs over to my boat before and
[1:17:39] pointed them out at crab island and they've told me to take a picture send
[1:17:43] it in it doesn't seem like it's a law that's
[1:17:47] being enforced in any way and i wanted to know what you guys were doing about
[1:17:52] it and ways i can work with you guys to point out these illegal charters because
[1:17:57] i own a charter company i've had to jump through hoops to do
[1:18:01] everything the right way i pay my three percent to the national parks my 400
[1:18:06] dollars to the county every month and
[1:18:09] have my btr a place to pick up and i'm watching
[1:18:14] all these other boats just take advantage of the system and
[1:18:18] work it and i don't know why nobody wants to do anything about it when i

[1:19:26] until a couple weeks ago when i when i heard some of the comments so
[1:19:30] our code is is working hard to get over there and i will say not as an excuse
[1:19:35] but just as a fact that our code is short right now a couple of people so a

[1:19:44] and as she said it is a challenge to identify some of the votes
[1:19:49] and some of them it's not i mean it's a dime a dozen if you count 12 pontoon
[1:19:54] boats out there 10 of them are illegal yeah and

[1:20:03] it's rampant in the state licensed guide
[1:20:06] boats it's rampant in the federally chartered for hire
[1:20:10] business and now it's actually becoming an issue with private yacht charters
[1:20:15] and about two weeks ago three weeks ago we
[1:20:18] had the united states coast guard here briefing this council on what
[1:20:23] constitutes a charter what constitutes a bear boat contract and in the issues
[1:20:30] my dealings with national marine fisheries with the coast guard fwc and
[1:20:35] our sheriff's office that has a marine unit is
[1:20:40] you have to make a case and you have to make a case that's going
[1:20:43] to stand up in a court of law and so when they tell you to take pictures and
[1:20:47] you hand it over to them and it doesn't seem like anything's being done
[1:20:52] things are being done but it takes time to do an investigation and make a case
[1:20:56] lots of times we'll turn people in and we don't see nothing for five or six
[1:21:00] months and that but when they get them they get them really really good because
[1:21:05] now fines are up to sixty thousand dollars and just last week an illegal
[1:21:11] pontoon operator was arrested given tickets
[1:21:15] and he was out there on sunday he was one of the ones dropping off at joe's
[1:21:18] bayou i know exactly who you're talking about and he was dropping off at joe's
[1:21:22] bayou on sunday using the city permanently he hasn't
[1:21:26] stayed in court yet and that may change when he gets his fine but but so all we
[1:21:30] can do is like it's not that people are ignorant to the problem but it's going
[1:21:35] to take an entire community and it's like what we do in the charter industry
[1:21:39] is we are the policeman because we are the eyes and ears of what's going on in
[1:21:44] our community and so you just got to keep turning them in and keep putting
[1:21:47] the pressure up delivery vessel organization now that represents all you
[1:21:52] guys is totally aware of it they're doing the same thing we recognize it
[1:21:57] we'll do the best we can on the code enforcement side of things but you just
[1:22:01] got to catch the bad guys you know we can't legislate morality unfortunately
[1:22:06] we can do it through ordinances and in our code enforcement stuff but this
[1:22:10] council and myself being a licensed captain we're not blind to the problem
[1:22:15] and we're going to try and do a better job the season is just about to begin
[1:22:20] but nobody um nobody you know there's a couple of
[1:22:24] my friends they got me on speed dial they're sending me pictures all the time
[1:22:27] come on mayor this is an illegal operator

[1:23:18] where the city of destin can step in and say you're not allowed to pick up at our

[1:23:25] picking up at joe's bayou or dewey dustin's or anywhere else that they're
[1:23:29] doing it stopping them in the process is enough to scare them if you go on to any
[1:23:33] of the apps that they're using they're advertising joe's by you um all these
[1:23:39] different spots like right there making a call that's something that i
[1:23:43] feel like this even the sheriffs could enforce because it's a city law so
[1:23:48] how do we so to answer your evidentiary question it can be done
[1:23:53] either way if we get pictures then staff takes that as a complaint and
[1:23:58] goes and investigates themselves but when they come out there they're
[1:24:02] already gone right no longer but but
[1:24:06] if it's ongoing they should be able to catch them if
[1:24:10] it's ongoing yeah next time theoretically if they're in and out in
[1:24:13] 10 20 minutes and we never can respond quick enough
[1:24:17] due to staff shortages or whatever else
[1:24:21] if a member of the public that took pictures wants to testify though then
[1:24:25] that could be used as evidence as well if they were willing to they don't have
[1:24:29] to staff can also go out and witness it themselves so i'm not trying to put
[1:24:33] anything on the public at all but if they chose to they could and then the
[1:24:36] other method would just be to regularly monitor
[1:24:39] certain areas but you know the director of code enforcement management would
[1:24:43] have to decide where to put those resources just uh my two cents and i
[1:24:47] appreciate it but maybe if citizens are submitting stuff
[1:24:52] we have some type of databases to just to ship just to see a repeat offender so
[1:24:56] we can tell the attendant you know you did it once you did it
[1:25:00] twice you did it three times now the fourth time this particular
[1:25:04] person has come through here now we can potentially
[1:25:09] go to our employee or your you know your employee and

[1:27:38] focus on um speeding um other offenses buis
[1:27:43] so that's some of the discussion that's
[1:27:45] brought up in fact um there is a meeting
[1:27:48] the next i'm not sure if it's the next one or
[1:27:51] the second meeting in may um for the accounting um they're supposed to be
[1:27:55] talking about how to enforce it in fact i recommend having someone from the city
[1:28:00] of destin attend that meeting because i believe the fort walton beach
[1:28:03] that city manager is going to be attending again too
[1:28:07] my question on that very subject what was brought up to me
[1:28:11] via text the other day is that there's also boats that not only are they
[1:28:16] operating illegally they got two more than 12 people on their boats but
[1:28:20] they're dropping people off at crab island
[1:28:23] and leaving and yeah i'm sure they got some type of
[1:28:26] arrangements to come back pick them up but as you and i both know we've lived
[1:28:29] here long enough and been on the water long enough it only takes about 15
[1:28:33] minutes for a blue norther especially in july
[1:28:36] and august to build up over the the crest view and be through here at 60
[1:28:40] mile an hour winds and stuff like that and those people are going to be stuck
[1:28:44] in a lightning storm so this is not just a an illegal operator issue this is
[1:28:49] going to be this is a huge
[1:28:52] safety issue and so
[1:28:55] i guess we need to have
[1:28:58] lance or webb at that meeting if possible i think and so
[1:29:03] just so we could stay on the same page with the county commissioners we know
[1:29:06] it's a problem now and it's going to be a real big problem in 20 days so

[1:30:23] can go online in five minutes and come up with a dozen boat rentals and they
[1:30:27] were all advertising either picking up somewhere in the harbor
[1:30:32] illegally are launching at joe's bayou you meet me at joe's bayou oh we'll
[1:30:37] we'll launch at joe's buy and go pick you up there are city ordinances about i
[1:30:42] realize that there's a difference between operating a
[1:30:45] business or launching commercial vessels i'll launch my paracel boats and drive
[1:30:49] around to my ground up around to my docks but i'm not allowed to go pick up
[1:30:54] passengers and fly amount of joes by you and that's what these technically what
[1:30:57] these people are doing they're picking up they're meeting their passengers
[1:31:00] there they might have paid them online so
[1:31:03] they're not actually conducting business collecting money
[1:31:07] there but it's operating a business out of joe's bayou which is illegal by city
[1:31:11] code from what i understand we've had this dialogue going on for quite some
[1:31:15] time and and i think one thing that we haven't done and i went to the livery
[1:31:19] vessel meeting you know that we had with the sheriff's office and coast guard and
[1:31:22] all that and that was very enlightening is uh i know you guys are fine you have
[1:31:26] a good strong organization um what i would like out of you guys if you
[1:31:30] could and you could send them to lance is give us some basic
[1:31:34] uh enforcement ideas from our perspective so we can help
[1:31:39] facilitate the coast guard fwc and stuff like that just because you
[1:31:44] guys are the pros you know what your challenges are who your cheaters are and
[1:31:49] and i think you would be the the folks that we would look to for the most
[1:31:53] professional opinion on how to address this problem and that keeps you guys
[1:31:57] engaged with us we it keeps us engaged with you and we could try to
[1:32:01] come up with some solutions prior to the hundred days of summer this year you can
[1:32:05] go online and find a dozen illegal operators in in 10 minutes another thing
[1:32:10] the company's going to do is and i'm sure if some way the city does it do you
[1:32:14] have to have a brick and mortar location right to operate you may want to
[1:32:18] incorporate that in your code if it's not in this already that's something
[1:32:21] they just instituted in their ordinance at the county level correct yes all
[1:32:24] right so that's an idea for us dewey go ahead thanks mayor and just for point of
[1:32:29] clarification you know we we're having a fit with them
[1:32:33] down at at the restaurant on the bay we run them out i'm having to hire a guy to
[1:32:37] be there every day just to chase them off if you can
[1:32:41] but you know we're faced with the waterborne version of vrbo now
[1:32:46] but to operate that boat commercially you're supposed to have a state of
[1:32:49] florida commercial sticker as you know it's a different color
[1:32:53] if you don't have that you're in violation of that law the other thing i
[1:32:56] want to just check on when we first took over the joe's bio boat ramp and started
[1:33:01] charging we had a special rate for commercial
[1:33:03] boats because after all there are a lot of commercial boats that operate in the
[1:33:07] uh area does that no longer apply it was a
[1:33:10] thousand dollars back then which was very high
[1:33:13] it was it was a lot of money and if if that's if that's the case
[1:33:18] and they don't have that commercial um launch sticker on their boat
[1:33:23] then it should be easily enforced are we not doing that anymore has that been
[1:33:27] struck from the ordinance that is still available but a previous
[1:33:32] council also voted to allow launch and recovery of
[1:33:37] commercial vehicles on a daily basis too so they're paying the daily fee well
[1:33:42] perhaps we need to modify that as our first step and if you're going to
[1:33:46] operate commercially out of that ramp it could be a thousand a month much like it
[1:33:50] is out on crab island and when they're
[1:33:52] having to pay the national park service i don't think that would be unreasonable
[1:33:56] and if they didn't have that sticker they can't launch
[1:34:00] and that you know the folks that are doing this they're very few of them are
[1:34:03] going to pay that and that's uh
[1:34:06] something we need to have the land user attorney or the city attorney look into
[1:34:09] that we can modify the ordinance and use that as an enforcement tool anyway if
[1:34:13] you don't have the sticker you can't launch and that that's exactly how it
[1:34:17] was prior to this this last change that's right but we definitely have some
[1:34:21] ideas and we'd be happy to meet with whoever you
[1:34:24] you would like us to meet with to share those ideas plans just give us a call um

[1:40:27] council had asked staff to reach out to waste management see if we could
[1:40:32] enter into some negotiations for an upcoming contract and uh waste
[1:40:37] management has come back and given us a proposal that we believe
[1:40:42] is a fair proposal it keeps the level of service at the same
[1:40:47] level as a
[1:40:49] customer of theirs personally i think i mean i've i've got zero complaints with
[1:40:54] the level of service that i've been getting from them in years and i hear
[1:40:57] the same from other residents around town
[1:41:01] um there is a basic flat rate of approximately 10 percent increase that
[1:41:06] they're recommending which in today's day and age does not seem unreasonable
[1:41:11] they're all also outlined three different franchise fee percentages that
[1:41:16] we could utilize one three and six percent and i believe
[1:41:21] even at six percent um the total increase quarterly for someone
[1:41:25] like myself on residential um use would only be around an additional ten dollars
[1:41:31] a quarter i know it is different for the business rates but we do have
[1:41:36] members of the waste management here and we have mr warren here if you have
[1:41:42] additional questions about this item i have a few questions up
[1:41:47] uh lined up and uh if need be to answer those questions i'll ask one of the
[1:41:52] gentlemen here to come up and answer them for us mr destin you're first
[1:41:57] thank you mayor um the franchise agreement if memory
[1:42:02] serves me correctly is in the form of an ordinance that we
[1:42:05] pass last time i remember doing one it was 20

[1:42:53] missed it uh the re the commercial rates are in
[1:42:57] the agenda item it is immediately after the day and what the future costs will
[1:43:02] be i believe that was actually the proposed
[1:43:05] cost i did not believe we had the uh original the current costs in there i

[1:43:16] there's a lot of questions that i have in my mind
[1:43:18] and this is pretty important decision and it's one that we have a lot of
[1:43:24] responsibility to know what in the world we're doing
[1:43:27] and without those answers that's that's a uh
[1:43:32] that's a problem the other thing i would point out is
[1:43:35] what are the total amounts of revenue that the change
[1:43:39] of one percent to three percent to six percent and franchise fees
[1:43:44] will bring to the city is it in there yes it's about forty
[1:43:48] thousand per percent we currently are one percent forty thousand
[1:43:53] so if we went from one to six that's 240 thousand dollars more
[1:44:01] right again okay
[1:44:04] well you know this is
[1:44:06] any way you look around this is a tax they collected for us but it's a tax
[1:44:11] and uh before i would be prepared i hope we're not making a decision on that

[1:47:29] for beach purchase just like we were having
[1:47:32] a dedicated stream of income for the undergrounding of utilities
[1:47:36] we need to have something you know and just like we have gas tax for sidewalks
[1:47:40] and road striping and road paving and stuff
[1:47:44] dedicated for that purpose the
[1:47:47] we need to have something where we can say
[1:47:51] this is at least how much storm water improvements or how much park
[1:47:54] improvements we're going to do and we've got a lot of you know maintaining all
[1:47:58] these parks that we're adding that that's revenue we've got to come
[1:48:02] from somewhere to to cover those expenses and this is and i will when we
[1:48:08] get into the half penny you'll see that
[1:48:12] uh right now the staff i think has 10 percent going to public works public
[1:48:17] safety projects a million two a year
[1:48:21] for unnamed public works public safety projects i i kind of flipped that
[1:48:27] and put the ten percent or uh i'm going to recommend
[1:48:31] we flip that and put the 10 percent in storm water and then the 5
[1:48:35] in the public works public safety because when i
[1:48:38] met with the staff today they couldn't tell me you know what those projects are
[1:48:42] now i know they have a meeting tomorrow and michael's going to ask them but
[1:48:47] we've got to figure out our our funding our funding streams with our projected
[1:48:52] expenses and so that's that's where this is coming from we have some known
[1:48:57] expected expenses in stormwater and in the parks and so that's that's
[1:49:02] why i want to a funding source for that
[1:49:08] i'd like to make it a substantive motion along the vein of
[1:49:12] what mr braden said and i to agree to go forward with the uh
[1:49:16] let the franchise be be brought forth i strongly disagree with the six percent

[1:49:25] doesn't pay that six percent florida power light doesn't pay our
[1:49:29] eight percent the citizens of destin pay those motion to uh go forward with all

[1:51:31] uh what we do have in the pipeline um are two grants
[1:51:36] we have the american rescue plan act funding that we would like to apply
[1:51:41] towards stormwater and and those projects need to be brought before
[1:51:44] council for you to review before we dedicate the
[1:51:48] american rescue plan act money to those projects we also have this um
[1:51:53] okaloosa half penny which the the next item on our agenda will be looking at
[1:51:58] the okaloosa half penny infrastructure surtax that will be coming in over this
[1:52:02] 10-year period from 2019 to 2029 and i'm proposing that we use some of that
[1:52:08] in the next agenda item i'm proposing that we use some of that to address
[1:52:11] stormwater issues as well but we do not have
[1:52:14] a particular dedicated funding source to address stormwater issues okay thank you
[1:52:18] so much and if we did um if we
[1:52:22] incorporated the six percent franchise fee
[1:52:25] would we still not be the cheapest in oculus county
[1:52:32] i believe we are the cheapest in occlusa county with that increase
[1:52:38] the rates are in the agenda packet yeah i just wanted to bring that

[1:53:46] i don't want to put that six percent franchise fee on anything right now

[1:54:04] of minimal tax on our citizens comparison with the other franchise fees

[1:54:21] is a very smart idea but
[1:54:25] doing that at the six percent franchise fee yes it's it's a tax it's a liminal
[1:54:30] tax but it's got huge returns for our citizens quality of
[1:54:34] life mr dest and i both made a living with
[1:54:38] the natural resources of this land and as we well know we've got issues in
[1:54:43] destin harbor that still have to be rectified we've got storm water issues
[1:54:47] on the west side of destin and i think adding that six percent
[1:54:52] would provide a stream outside of our normal trying to get with the federal
[1:54:57] government or with uh
[1:55:01] triumph money or or relying on the county it would allow us to have a
[1:55:06] little more skin in the game deciding on some of these projects so
[1:55:10] i'd be in favor of that i do agree with mr destin and mr smith
[1:55:14] as far as you need to have all the documentation in front of you especially
[1:55:18] if you're going to raise a tax even if it's only ten dollars a quarter
[1:55:22] but uh um so you know
[1:55:26] there's good parts to the original motion and there's a good
[1:55:29] part to mr destin i just think that in the end i hope that the council will see
[1:55:34] that sometimes especially when we do have some of the lowest taxes in in the
[1:55:39] state not just here in oakland county uh thankfully because of our
[1:55:44] tourism industry that we do provide ourselves and our citizens steady
[1:55:48] streams of income this city has repeatedly not done things that helps it
[1:55:53] make money and it's not money just that we throw
[1:55:56] away it's money that we need to provide essential services to our community and
[1:56:02] i think it's a mindset that needs to change at some point where we start
[1:56:06] thinking about doing things that are going to generate revenue sources for
[1:56:10] the betterment of the community in you know i sound like a
[1:56:17] someone that's a little more moderate than my conservative values but i
[1:56:20] understand i also i also appreciate
[1:56:24] getting bang for my buck and i don't mind spending money or or paying a fee
[1:56:28] or a thing that's going to benefit not just me but everybody around me so
[1:56:34] that's why i'd be real in favor of what mr bagby's doing by creating the
[1:56:38] constant the source of revenue
[1:56:42] um and i think that this particular franchise fee is six percent would
[1:56:46] actually cost individual people uh i think it's more than uh fair
[1:56:52] so next up is uh

[1:59:56] enjoyed over the last two years the property appraiser is raising our
[2:00:02] property taxes that are 15 to 20 a year i came up to around 800 000 last year
[2:00:09] the new franchise fee that we up on power
[2:00:12] company raises about eight hundred thousand dollars or somewhere there
[2:00:16] they're about the half cent utility
[2:00:19] tax that the county appealing us are part of
[2:00:22] crystal what does that come out to over 10 years
[2:00:26] uh which one i couldn't hear you the half cent tax that the
[2:00:31] county is reimbursing us our part we're bringing in approximately 1.6
[2:00:36] million dollars a year for 10 years okay so that's
[2:00:41] 1.6 that's correct 1.6 million a year 16
[2:00:44] million thereabouts um
[2:00:47] the revenue sharing that the tdc is giving us i think comes out to over a
[2:00:52] million a year at what point
[2:00:56] do we not have enough money and uh
[2:01:01] you know we have people here believe it or not they're on fixed incomes and as
[2:01:05] we they pay that half cent every time they
[2:01:09] go to the store they pay their property taxes at some
[2:01:12] point you know folks we just taxes are going to be too high what
[2:01:17] point do we say we've got enough that's a pile of money
[2:01:21] we can address most of our needs with that
[2:01:24] and it's just one more one more tax that we have acquired and
[2:01:28] as as my substitute does not stop us from considering that over the next few
[2:01:33] months we certainly can
[2:01:36] there's supposed to be a nexus between what you charge for these franchise fees

[2:09:03] history approximately two to three years ago
[2:09:07] council had divided up our proceeds from that tax
[2:09:12] into four categories and what we're asking tonight is to look
[2:09:17] at those four categories and reallocate the funds amongst those categories and
[2:09:22] add some stormwater to it perhaps because we have additional funding
[2:09:26] sources now that two years ago we did not have so i'll turn it over to mrs
[2:09:31] strickland good evening mayor and council members
[2:09:36] uh so as you might recall back in january of 2020 uh council decided to
[2:09:42] allocate the okaloosa half penny infrastructure surtax
[2:09:47] which we were then estimating would be about 1.2 million dollars a year over 10
[2:09:52] years so about approximately 12 million dollars we chose to allocate it at that
[2:09:57] time 75 percent towards beach acquisitions
[2:10:01] 10 percent to undergrounding uh 10
[2:10:04] to public works and public safety committee identified projects and 5
[2:10:10] percent was left to be discretionary and this is over the total life of the 10
[2:10:14] years not per year um just the total life of the 10-year
[2:10:18] period so what i'm proposing tonight
[2:10:23] is a reallocation the largest one is instead of sending 75 spending 75
[2:10:28] percent of the the funds on beach acquisition
[2:10:33] i'm recommending that we lower that amount because we now have an a new
[2:10:37] interlocal agreement with the tourist development council
[2:10:41] that i feel is a better fit for beach acquisition
[2:10:46] and we are trying to fund the undergrounding of the utilities in
[2:10:50] particular in our
[2:10:53] primary areas along highway 98 which is the main ingress and egress for the city
[2:10:58] and is also along highway 98 we have most of our
[2:11:02] crucial businesses uh grocery stores restaurants hotels and so these areas i
[2:11:08] find it would benefit the city greatly if we
[2:11:12] could get those areas of the city undergrounded
[2:11:16] so what i'm proposing here well there's another little piece here
[2:11:23] so instead of the 1.2 million dollars a year coming in it's actually been closer
[2:11:28] to 1.6 so we have more funds coming in i'm
[2:11:32] estimating 16 million dollars over this 10-year period
[2:11:36] so my primary proposal is that we reduce the amount towards beach acquisition
[2:11:41] from 75 percent down to 25 so we're still keeping 4
[2:11:46] million dollars that helps with the beach acquisitions
[2:11:50] as you recall i dedicated some of it last year to purchase two parcels in
[2:11:54] crystal beach this would also help us
[2:11:59] come through the finish line on some other beach parcels that we'd like to
[2:12:03] purchase this fiscal year and then to increase the amount dedicated to
[2:12:08] undergrounding from 1.2 million at 10 up to 60 percent which would equate to
[2:12:14] 9.6 million that would go a great ways towards helping us underground
[2:12:19] the highway 98 corridor in addition
[2:12:23] i'm leaving untouched the amount that was dedicated to public works and safety
[2:12:27] committee that 1.6 million dollars and i'll be
[2:12:31] meeting with the public works and safety committee
[2:12:36] this month to show them how much we've accumulated to date so that they can
[2:12:41] consider projects that they'd like to recommend that would
[2:12:45] go into next year's budget or maybe they want to hold out a little
[2:12:49] more and watch it increase and propose projects in the
[2:12:53] following year the last piece that i'm recommending is
[2:12:57] we had five percent set to a
[2:13:01] council approved projects so basically it was a discretionary fund um back in
[2:13:06] early 2020 we estimated that five percent would be about six hundred and
[2:13:10] forty thousand dollars um but now we're estimating that that
[2:13:13] would be eight hundred thousand dollars and over this um
[2:13:19] this this past year especially this past fall uh with all of the rain events that
[2:13:24] we had a lot of storm water issues uh became front face readily apparent so
[2:13:32] michael and our storm water team have been looking at how to address these
[2:13:37] items and so eight hundred thousand dollars if we could dedicate it towards
[2:13:41] addressing some of these issues would go a great way
[2:13:45] so that's what i have here proposed for you
[2:13:49] i'll move to allocate portions of the oklahoma half
[2:13:52] penny infrastructure search tax revenues as follows i need to read each one 60
[2:13:58] towards underground utilities 25 towards beach acquisition
[2:14:02] 10 towards public works and safety committee initiated projects and 5
[2:14:07] towards stormwater projects second i have a motion a second mr bagby
[2:14:12] and i'll make a substitute motion mr mayor uh to flip
[2:14:16] ten percent towards stormwater projects and five percent toward the public works
[2:14:22] public safety committee initiated projects and the reason is real simple
[2:14:25] when i tried to drill down on staff on what those projects were and what they
[2:14:30] were considering what would be available the the answer was zero and the reason
[2:14:36] they told me that the this was even in here in the first places and you'll
[2:14:40] probably remember this because it took them a couple of minutes to remember
[2:14:44] when this was initiated we had to have a committee or we had to
[2:14:48] have a body that oversaw the expenditure of
[2:14:53] this money and initially the council said
[2:14:58] we'll give it to the public works public safety which is why they were identified
[2:15:02] out of all our committees to be to have the 10 percent
[2:15:07] but then subsequently the council brought became the committee that
[2:15:12] decided how this half penny was going to be spent
[2:15:15] and uh
[2:15:17] so i'm not i'm a big believer in committees but i'm not a big believer in
[2:15:22] just allocating
[2:15:25] you know 1.6 million dollars to a committee that already gets gas tax
[2:15:30] money for sidewalks roads and things i mean they already have dedicated streams
[2:15:34] they already have funding in the budget for pretty much everything they want to
[2:15:38] see so to give them a 1.6 million
[2:15:42] dollar bucket for whatever idea they might come up with
[2:15:48] just seems a little
[2:15:53] out of the ordinary and i would think it would be better if
[2:15:57] we spent that 1.6 million on storm water and
[2:16:00] either leave the five percent in there for the public works public safety
[2:16:04] committee or the public works safety committee and the council since we're
[2:16:08] now the committee that's overseeing this so that's it's the same as the base
[2:16:13] motion except it flips those last two bullets i'll second that okay so we have
[2:16:18] substitute motion in a second mr destin
[2:16:24] um our reallocation brings some questions to mind and crystal you can
[2:16:28] help me the undergrounding of the 98th quarter
[2:16:33] we have a cost estimate on that yes uh so to get from the marlar bridge
[2:16:38] all the way to the walton county line we've broken it out into three major
[2:16:44] phases and each phase is estimated at
[2:16:47] approximately 13 million dollars so we're at 36 is that what you're
[2:16:51] telling me that's correct and we currently have
[2:16:56] the franchise free increase which was approximately 1 800
[2:17:00] correct which would do a bond issue of
[2:17:04] approximately uh well with the rates going the way
[2:17:08] they are now i'm i'm gonna reduce my my estimate down um i think the we could
[2:17:14] bond approximately um
[2:17:18] 18 million dollars on the 2
[2:17:22] franchise electric franchise fee which is half
[2:17:27] and so we have to come up with another 800 000 in order to finish
[2:17:32] that quarter that's correct now by quarter do we mean just 98 or how far
[2:17:38] inland does that go uh that is just highway 98. okay
[2:17:42] so 800 000 a year is going to eat up the majority of that half cent
[2:17:48] yes and i'm also going to be i have the the underground people coming to talk to
[2:17:53] the the two cra district committees and then i'd like them to talk to you
[2:17:58] also about potentially committing
[2:18:01] in our new master plans for the two cras committing some of the cra excess funds
[2:18:05] that'll be coming out in future years i'm working on those finishing up those
[2:18:10] long-term projections and so we're dedicating
[2:18:14] what part of our half cent towards
[2:18:18] actual infrastructure needs like resurfacing all the roads in destin that
[2:18:22] we're gonna have to be done before very long
[2:18:27] currently we've been using gas tax one and two money to
[2:18:33] sorry we've been using gas tax one and two
[2:18:37] money for milling and resurfacing the the roads and also maintaining the
[2:18:41] sidewalks and that comes in uh that's
[2:18:44] approximately six hundred thousand dollars a year that we receive from
[2:18:47] those two gas taxes and then i've been supplementing with uh general fund money
[2:18:53] um what would we do to increase right yeah
[2:18:57] so the general fund money that i've been supplementing with is approximately uh
[2:19:02] 300 000 a year do we have an approximation on what it
[2:19:06] will cost to do all this resurfacing because if you go and drive the roads
[2:19:11] after a rainstorm you'll see that they are on the verge of being not good
[2:19:15] at all yeah um actually my michael does have
[2:19:20] estimates he's been working hard on this that's such an easy question we'll let
[2:19:23] mike lane sweat huh mike now this is going to take a few minutes
[2:19:27] this is uh kind of out of the blue you're going to have to bear with me on
[2:19:30] this one but i want to say that number was
[2:19:33] somewhere around 15 million to do if we were to to snap our fingers
[2:19:39] and pay for every mile of our 62 and a half miles of
[2:19:44] streets to be resurfaced milled and resurfaced
[2:19:47] and those that require striping to be striped today i think it was somewhere
[2:19:51] right around 15 million and i think i thought that's the number i probably
[2:19:55] remember so we're coming up a little short quite a bit here and and we're
[2:20:01] we're dedicating our accent
[2:20:04] undergrounding rather than fixing the streets unless we can come up with
[2:20:08] another revenue stream as mr bagley says so i'm you know
[2:20:13] we can change this at the next meeting if we want to
[2:20:17] i take it but i'm not satisfied with plowing all
[2:20:21] of our half cent gas tax which rightfully should go to fixing
[2:20:25] the streets and the other infrastructure

[2:20:37] 13 000 residential units well close to 14 000 residential units
[2:20:43] and the gas taxes are allocated based on population uh and yet we're maintaining

[2:20:51] day with all of our tourists so yes we are uh
[2:20:56] it makes for a difficult yeah that uphill climb has
[2:20:59] been mars to live with for a very long time

[2:24:08] condominiums are the town homes there we're going to do a project there and

[2:24:22] pumps out there pumping water a couple years ago
[2:24:25] on down past a double curve towards the end

[2:24:36] there is no storm sewer infrastructure really to speak of right there
[2:24:41] it's just a relatively flat area with the exception of that one bowl and

[2:24:50] the most recent storm water management stormwater master plan there are no
[2:24:54] projects identified on holiday aisle that would be correct but those pilot

[2:25:11] mentioned just now in holiday hell it's just crazy that something flooded
[2:25:17] out there and there's there's no mention of it if i if i can make one correction

[2:25:25] city-wide swale installation initiative and those two projects i mentioned

[2:27:04] at this time we have purchased two of those parcels and those two city-owned
[2:27:08] parcels the structures have been removed and are being used by the public
[2:27:15] since then for that last um that third parcel at 29.68

[2:27:25] was a purchase agreement on that parcel and at the very low at the last uh
[2:27:30] moment uh the 11th hour the uh the owner did back out of that agreement so at
[2:27:34] this time i'd like to see attorney uh to uh brief us on where we're at on that
[2:27:39] process thank you
[2:27:42] yeah uh the process that we've agreed to with the
[2:27:46] county is to essentially file a imminent domain uh case against
[2:27:51] the property uh there's uh as you know we're basically a 50 50 partnership with
[2:27:57] the county on this project this is the middle parcel between the two parcels
[2:28:01] that have closed so it's pretty important parcel
[2:28:05] the before we can file the the action for
[2:28:09] eminent domain there's some steps that have to be taken i think as i understand
[2:28:14] it uh the the uh
[2:28:17] the council has already passed a motion of necessity so we don't have to revisit
[2:28:22] that this evening that steps been taken but
[2:28:25] the county is going to
[2:28:29] for instance has to get an updated appraisal
[2:28:32] and so they're in the process of doing that
[2:28:36] and the really the other major step that we
[2:28:40] have to take is draft and file the complaint
[2:28:43] so once once those steps are completed
[2:28:48] kyle and or i or our firm will draft the the complaint permanent domain bring it
[2:28:54] to the to the council
[2:28:58] for approval to file that complaint and then
[2:29:01] we'll serve it and and we'll be on that track
[2:29:07] and you know we obviously expect to be successful but we
[2:29:11] obviously can't hesitate to
[2:29:14] discuss specific details of that
[2:29:19] in the public forum obviously sabre
[2:29:27] i was going to make the motion to move i move the city manager be authorized to
[2:29:31] execute the city's 41 percent of the portion of the county's design service
[2:29:35] contract c19 2748 pw

[2:30:18] and determine you know which appraiser it's going to
[2:30:21] go with basically i mean that's the boiling down and then so if they if they
[2:30:26] favor of us then they decide which appraisal then we ultimately would still
[2:30:30] buy it just at this new appraisal that the judge tells us that we have to use
[2:30:34] right and is there a possibility that that we would not be in favor that we
[2:30:39] would not win well is that possible there's always
[2:30:42] a possibility of not prevailing but on public purpose i don't see much of a
[2:30:46] chance so if uh if we didn't win
[2:30:51] for one reason or another what what happens to the fees that we paid at
[2:30:55] baskerville and donovan and all these other people for the designs
[2:31:01] just like worst case scenario that's if we didn't win that's a that's a risk of
[2:31:04] litigation right webb would you like to address that a
[2:31:08] little bit because county's taking some of this cost too on
[2:31:11] the design of the park yeah because this is the park this is a park public it
[2:31:15] would be all on us that is correct the current interlocal is 59 county or
[2:31:20] should i say tdc uh 41 city of destin as part of that interlocal uh and then also
[2:31:25] with the agreement to um i'm sorry i'm drawing a blank on the name of the
[2:31:29] resolution there on the notice to basically proceed on that um
[2:31:35] the necessity to right yes thank you um so uh
[2:31:40] we do split the cost of 59.41 and as part of that interlocal the county uh is
[2:31:45] moving forward as part of that interlocal on the design services for
[2:31:48] those three parcels and we have been uh as part of that process but like if we
[2:31:53] ended up losing down
[2:32:00] and then uh come back to the drawing board of redesigning stuff that is
[2:32:04] correct so why can't we wait to do uh the process of eminent domain first and
[2:32:08] then come back and vote on continuing the 40 uh for this
[2:32:15] plans that we're at 30 design plans
[2:32:20] the intent of this process has been to try to get this through this
[2:32:24] where basically uh the possibility of constructing the park could be uh as
[2:32:29] soon as this next offseason and if we did delay that would not be a
[2:32:33] possibility right but we could wait if we wanted to we would need to work
[2:32:38] with the county on that to put this off sure
[2:32:42] i mean just a simple question i mean we can wait you know it's just you know
[2:32:46] like we we've been down not similar because it's not public
[2:32:49] domain but you know like we wasted uh the city wasted a lot of money on the
[2:32:54] crosstown connector you know that we paid that firm again to do and you know
[2:32:59] i have full i think we would win and we public domain and all that we i'm sure
[2:33:03] we'll probably win but we probably we maybe we wouldn't and then we're wasting
[2:33:07] 111 000 uh if we could just wait
[2:33:11] until the process is over and then come back and
[2:33:14] do it then this is my thought but
[2:33:17] i don't know six figures of just throwing out there
[2:33:20] can i mention one other thing uh i i think there's a chance that some of
[2:33:24] these costs will exceed lance's authority of 15 000
[2:33:29] is that correct webb that is correct so i think uh
[2:33:32] they were looking for authority uh
[2:33:36] to give lance the authority to exceed that spending limit we're not talking
[2:33:39] about hundreds of thousands of dollars but
[2:33:42] so we don't have to keep coming back to council
[2:33:44] and i think the idea has always been to put it on the fast track as much as
[2:33:48] possible and if we don't start doing that we just
[2:33:52] delay it and delay it play it and we do have a partnership with the county i
[2:33:56] agree but what we have done in my opinion is created in somewhat of an
[2:34:00] embarrassing situation with this process not pointing fingers at any particular
[2:34:05] people or person but we we we announced the gateway to crystal beach and the
[2:34:10] gateway to the area and now we now we're possibly going to imminent domain on
[2:34:14] somebody which i know i voted for and we're supporting that but
[2:34:18] now we're trying to say we gotta rush and give a 30 design plan for something
[2:34:22] that we don't even own yet you know it just
[2:34:26] may we will own it and i get that but who cares today about finishing a 30
[2:34:32] design plans why don't we just wait six more months
[2:34:35] if it's not ready then it's not ready i mean it's just
[2:34:38] i i'd rather go on the side of
[2:34:42] we don't win and we we're not wasting 111 000 and the county's not wasting
[2:34:46] their money either but um i just i'd rather take a little bit more time
[2:34:50] before we start just designing something that we don't even
[2:34:53] own yet it's my fault and just to be clear as the county took the the front
[2:34:58] seat role on driving this design uh and they are the ones who contracted with
[2:35:03] baskerville donovan and they're the ones who are have been pushing the the design
[2:35:08] process forward not the city so we're we're just uh requesting permission to
[2:35:13] um pay the pay as per the contract uh the
[2:35:18] inner local agreement what we've agreed to pay is our portion but yes i i can't
[2:35:22] say but yeah i i agree with you i wish that
[2:35:26] we had slowed it down a little bit but we're
[2:35:29] not the drivers in this particular instance well we're the drivers that we
[2:35:32] say we don't want to do it we don't have to pay them no we can we can delay it
[2:35:36] right we signed an interlocal agreement with the county promising that we would
[2:35:39] pay our share of 41 but when design and they're already invoicing us for
[2:35:46] that well let's just tell them if we if not people agree with me which they
[2:35:49] probably won't we would just put that invoice to the side
[2:35:52] and pay it later when we actually approve lance yeah that's okay so
[2:35:56] there's also the florida prompt payment act which uh precludes us from catching
[2:36:01] on yeah from holding i heard well i just think it's silly that we're paying for
[2:36:05] something that we don't even own yet so you know and if there are partners in
[2:36:08] these things you know if enough of us agreed maybe they would
[2:36:12] work with us on that but i'm probably a minority so i'm just rambling so thank
[2:36:16] you yeah it's just going to bring a couple
[2:36:18] of things that were already brought up um mr schmidt
[2:36:22] first and foremost this is something that we've made a commitment to early in
[2:36:25] the game this interlocal is an interlocal agreement which is basically
[2:36:29] a contract we have certain things we have to live up to
[2:36:33] responsibility-wise we're going through this route of eminent domain because the
[2:36:37] city has acted in good faith with the lands of public trust and unfortunately
[2:36:44] this is how we're going to try to resolve the issue with the present owner
[2:36:49] the intent of the county the intent of our city is still to finish this project
[2:36:55] and and this is just part of it you don't want
[2:36:58] to throw any wrenches in the spokes of the wheel
[2:37:03] to slow the process down in a process that is
[2:37:07] agonizing slow in the first place and and
[2:37:11] so i highly recommend that we not only
[2:37:16] support this motion but that we also give lance and our staff and the lands
[2:37:21] of public trust and the legal firms and everybody involved with this
[2:37:26] because this beach acquisition project especially this one which is our first
[2:37:30] one it's critical that we get it done get it done on time and not delay under
[2:37:36] a supposition that we may or may not fail if we failed a whole different ball
[2:37:40] of wax anyways and a 30 plan doesn't cost
[2:37:45] as much as a hundred percent plan but the process to get to sixty percent and
[2:37:50] to ninety percent which each one of those will come back
[2:37:54] before us to prove or to agree with with the county but
[2:37:57] we're not doing this alone so
[2:38:00] it's easy to say well let's just wait and see if we win but
[2:38:04] the county's part of this process too the county's position is let's
[2:38:08] go forward in a timely manner so that's that's the horror game behind that
[2:38:13] crystal was being really nice and polite when she was talking about the local
[2:38:16] agreement we have to understand in this particular
[2:38:20] case especially when we're talking about millions of dollars that we do have to
[2:38:25] hold our partnership with the county in this particular position in high regard
[2:38:30] and work with them and and when they say they would like to continue and they're
[2:38:34] responsible for the majority of this cost then we should support them in that
[2:38:38] that effort so that's i just recommend that we we support this motion

[2:40:54] coming from uh this is from the okaloosa half penny that uh was dedicated

[3:00:42] urban and regional planning and recently relocated back to
[3:00:47] this wonderful area with my family
[3:00:51] i'm involved in the real estate business all aspects brokerage development
[3:00:56] the whole nine yards and in coming back um
[3:01:00] i've kind of taken an interest in in some of the some of the different things
[3:01:04] happen in different municipalities and really chasing opportunities and chasing
[3:01:08] projects um in doing so modern you know checking
[3:01:12] tracking these zoning changes that are proposed for the site
[3:01:16] and uh and looking at this amendment you know it's my humble opinion that the
[3:01:21] added layer of a 20 commercial requirement
[3:01:25] to an existing zone zoning ordinance is is a little short-sighted i think it uh
[3:01:31] that there may be some unintended consequences
[3:01:34] that probably need to be considered before just jumping into this and
[3:01:38] it's also my understanding that it was initially previously proposed for was it
[3:01:41] 10 percent which i believe to be a much more
[3:01:45] reasonable uh
[3:01:48] allocation of commercial use for percentage-wise
[3:01:52] you know i've been involved in a lot of mixed-use projects so i think i
[3:01:56] understand the intent i think but i haven't spoken with anyone about
[3:02:02] that and quite frankly i'm late to the game and i'll acknowledge that um
[3:02:05] and and and they're they're great projects when you
[3:02:09] do a mixed-use project i've also been involved in some mixed use projects that
[3:02:12] have vacant retail for 10 12 plus years thankfully those projects had economic
[3:02:17] incentives tied to the retail and there was reasons that it was built
[3:02:21] didn't work out as planned and sometimes it does sometimes it doesn't
[3:02:25] uh with that said i just i make you know i request that the the council consider
[3:02:31] uh revisiting the 20 requirement on this particular
[3:02:36] what i call an added layer to the existing zoning
[3:02:39] so i appreciate your consideration

[3:02:55] what could that be well it's it's certain projects are
[3:02:59] being forced to be built or certain projects are potentially not built and

[3:03:08] drastically different so i mean you know you guys are talking
[3:03:11] about property taxes going up in oklahoma county the reason property
[3:03:15] taxes are going up is real estate prices are going up
[3:03:18] generally speaking when a property trades it's reassessed
[3:03:23] not not every municipality or every county does that this isn't destined
[3:03:27] it's an okaloosa county issue but generally speaking that's how it happens
[3:03:31] um you know i believe that there's property
[3:03:34] rights that are associated with this as well um and so
[3:03:38] the highest and best use for a site was previously
[3:03:42] x and with this added layer of zoning it
[3:03:45] becomes why and it's all it all comes down to
[3:03:48] economics and how certain projects underwrite i know that's a very vague
[3:03:53] statement but generally speaking that's how it
[3:03:56] works so one of the unintended consequences
[3:04:00] could be you know the the property taxes that the property generates
[3:04:05] just depends on what the use is though yep

[3:04:17] little bit on that i was just going to clarify something it's still ten percent
[3:04:23] for the zoning district and this ordinance is not site specific it's for
[3:04:26] the entire tcmu and it is still ten percent the only areas that are twenty
[3:04:30] percent are the city's commercial corridor of us-98 and now we added a
[3:04:36] main street at the request of council so those two major thoroughfares are the
[3:04:40] only ones with the slightly increased percentage of 20 instead of 10.
[3:04:46] i have a question because i wasn't here and i think mr destin you were the one
[3:04:50] that raised it to 20. it was proposed
[3:04:54] with 10 and 20 from the get-go oh from staff it was pr yeah it was proposed by
[3:05:00] staff to be 10 everywhere except 98 which was 20.
[3:05:04] and then at the last meeting what was added um at the direction of council was
[3:05:09] main street to the 20 that's always how it was proposed and the reason i'm
[3:05:13] asking that you know what what was i should be asking staff what was the
[3:05:18] reason for going from 10 to 20. i just got back i i went to atlanta monday and
[3:05:24] tuesday on my own on my own time and i stayed at
[3:05:29] alpharetta city center and i went to avalon and i went to silver springs and
[3:05:33] drove from midtown from downtown north of alpharetta and it was to see
[3:05:40] how new smart growth was being done in the most
[3:05:45] impressive ones along those especially the first three properties i want to see
[3:05:49] was the development of lifestyle centers which all had

[3:06:00] multi-family is because if you go bigger and that you have to start making out of

[3:06:14] retail is all underneath so when you lay out your street on a 10 or 15 acre piece
[3:06:19] of property you can create your own miniature city you utilizing that type
[3:06:24] of requirement where you have to have 20 percent so um
[3:06:30] you know we're talking about dustin everything in destin's 40 50 years old
[3:06:34] and we were talking about redevelopment our cras and stuff like this this is not
[3:06:39] just the trend in atlanta this is how all communities are starting to
[3:06:43] redevelop themselves it's basically a grand boulevard which is mainly all
[3:06:49] office buildings and retail but it becomes a residential
[3:06:54] city within the city so i think this is uh i think the requirement it does have
[3:06:58] unintended consequences and i hope one of them is that when people come here to
[3:07:02] do multi-family is they create a new community within our community by having
[3:07:06] these type of developments i think that's the trend i
[3:07:11] would hope that all of you city council members would look into
[3:07:14] that you could see some lifestyle centers up in 30a they kind of already
[3:07:19] doing that in pensacola if you don't want to go all the way to atlanta but
[3:07:22] it's really uh you know our biggest thing is we want to people to quit
[3:07:27] driving through destin we want them to stay here well the only way they're
[3:07:31] going to stay is you've got to give them a reason to stay and i think this
[3:07:33] ordinance lines up with that mr mcv yeah i was just going to agree with you
[3:07:38] mr mayor my experience is rosemary beach and it
[3:07:42] is 25 to 33 because all the buildings in the town center are either four-story
[3:07:47] there's a couple that are three-story but the ground floor they're all
[3:07:51] commercial and uh if you read uh you know the book i gave you or suburban
[3:07:56] nation or some other things on on planning um you this is the town center
[3:08:01] this isn't the you know first ring or second ring this
[3:08:05] is the town center so you want to build that energy you want that shopping you
[3:08:09] want those people coming there uh you want them living there but you want them
[3:08:13] to have something to do this is not throwing in you know four stories of
[3:08:17] apartments and oh by the way on an out parcel we'll put in a starbucks or
[3:08:21] something so i you know if it were me i would make it higher but i know where

[3:15:44] recommend that we also add some of the stuff that the county has adopted in

[3:15:52] coordinating with the county they're taking a lot of our ordinance we may
[3:15:56] take some of what they put in so we will definitely bring that all to council at
[3:16:01] one time with the with the harbor capacity study results okay and then one

[3:16:07] if we're all focused on safety um i kind of showed some of you all the um the no
[3:16:11] wake zone alarm system that i had that i have
[3:16:14] um i chatted with the county about it unfortunately the county cannot require
[3:16:18] us to modify any equipment they said what they can do

[3:16:26] to maybe offer some kind of discount or
[3:16:29] some kind of rebate for anybody that has it installed i don't know if that's
[3:16:33] something that the county wants to look or i'm sorry the city wants to look at
[3:16:35] possibly adopting also to promote more safety

[3:17:28] this ordinance which is the proposed extension for uh
[3:17:31] the moratorium i'd like to have a quick scenario and
[3:17:35] i'd like to use mr braden if he doesn't mind as a guinea pig mr braden you are a
[3:17:41] building contractor and as a contractor you have many tools of the trade
[3:17:45] power equipment hand tools etc and the materials in which you do your
[3:17:48] business and that provides for your family now
[3:17:52] let's say for whatever reason the city decided to put a temporary moratorium
[3:17:56] not on your business as in a building moratorium but instead a temporary
[3:18:00] moratorium on your tools you were restricted from buying any new
[3:18:04] tools such as the latest power tools or new hand tools on the market
[3:18:08] you would be allowed to replace a broken tool but only with the same type
[3:18:12] with no upgrades and it would violate the bars would violate the moratorium
[3:18:16] and i'm sure you would be outraged and you would want to do everything you
[3:18:19] could to have it repealed as that takes away from you making the livelihood
[3:18:23] now my point that is exactly what the extension keeps
[3:18:26] doing you're limiting the amount of
[3:18:31] tools that the livery businesses can use i say this because when i originally was
[3:18:37] on council in 2017 and i originally voted for this
[3:18:42] moratorium it was for a water quality and capacity study for the harbor which
[3:18:48] which unfortunately was not started until 2019
[3:18:51] three and a half years later we still have no report and at least to my
[3:18:54] knowledge and now almost five and a half years
[3:18:57] restrictions on delivery businesses you punish them for something that's not
[3:19:01] all totally their responsibility responsibility we do not restrict our
[3:19:05] citizens our visitors and our and to my knowledge we are wonderful charter fleet
[3:19:09] yet we continue to restrict the library vessel business
[3:19:13] if as and i think if i were on the council today
[3:19:16] i would vote no simply because i don't want it to be another crosstown
[3:19:21] connector 22 years and i still don't see a
[3:19:24] crosstown connector and i feel this is going to continue to
[3:19:27] get kicked down the road each year there'll be some reason in december that
[3:19:31] the the study's not done
[3:19:33] and i think that it's time now to let the
[3:19:36] uh liberty people get you know do what they need to do there should be
[3:19:40] restrictions and since i'm supposed to address the council i hope they'll hear
[3:19:44] me in the back but delivery people need to step up to the plate too they need to
[3:19:47] do a better job of watching what's going on and i'll be
[3:19:51] glad to talk to them about a couple of suggestions i have anytime they want
[3:19:55] but i do believe that this i do believe that the moratorium just needs to stop

[3:21:19] that's fine too yeah i've been i've gone to some of the committee meetings
[3:21:23] because it's not just the army corps you've got your harbor boards part of
[3:21:27] that there's jim green's on there and and it's an overall evaluation
[3:21:32] of what the status of the harbor is today
[3:21:37] what it can be tomorrow and to get a feel for what the community wants the
[3:21:42] harbor to be so
[3:21:45] there's discussion kind of ironic seeing how on the very one of the very first
[3:21:50] meetings we tried to get a free dredging down the middle of
[3:21:54] the channel and change the channel that's one of the committee's
[3:21:57] recommendations ironically when we turn turn that free channel down but it's
[3:22:04] it's to uh evaluate
[3:22:06] accessibility development there's still private lots on the harbor and on some
[3:22:10] of the canals and all that's been taken into account and and so i don't think
[3:22:14] they're gonna come out and say you can't have any more of these kind of
[3:22:18] boats or you can't you know that kind of stuff is like
[3:22:21] it's more of an evaluation of how how can the harbor be maintained in
[3:22:25] a healthy condition be navigated safely and
[3:22:30] enhance where the harbor is today that's what i've gotten out of the meetings
[3:22:34] that i've attended up to this point and they'll do that in a more definitive
[3:22:41] result when they give it to us and then leave
[3:22:44] us with a bunch of different options you know to consider
[3:22:48] so that's what's coming out of it it's not like
[3:22:51] there's too many boats you can't have any more boats they're going to address
[3:22:54] everything and including storm water runoff is one of the things they look at
[3:22:57] as well so
[3:23:01] is there a chance they could come back and say
[3:23:07] you got too many pontoon boats why do you have too many charter boats
[3:23:12] um no no i think they leave that kind of
[3:23:15] decision making up to the communities i think the moratorium started in the
[3:23:19] first place because people on this council and the harbor board thought
[3:23:21] that we had enough of those kind but nobody's addressed maybe some other type
[3:23:27] of vessels i think there was an attempt to moratorium to put a moratorium on
[3:23:32] private dock development in the harbor and that didn't
[3:23:35] set too well with this council at that particular time so those are all issues
[3:23:39] that'll be brought up kim would you like to add to that yeah i will just say i
[3:23:43] think they are looking at the congestion issue though in general and whether
[3:23:48] yeah as part of safety and environmental review they are looking at the
[3:23:52] congestion in the harbor and if i may add one little bit to that
[3:23:57] it's it's going to be more of a if this situation if you see this in the harbor
[3:24:02] and we're seeing this we would recommend that if you want to go to x we would
[3:24:07] recommend this so it's it's more it's more
[3:24:10] going to be an if then if this than that type of recommendation so it's going to
[3:24:15] be based on community values visioning
[3:24:18] um and and so in their understanding of uh
[3:24:23] previous recommendations from prior studies and and conditions that they've
[3:24:27] seen in in similar situations
[3:24:31] thank you thank you um so after that
[3:24:35] study we could the council could say um
[3:24:40] we want to k we want to go to a medallion or whatever with
[3:24:44] livery vessels and what we've got that's all we want
[3:24:50] even though we're getting hundreds from fo alton and the bar or
[3:24:53] whatever coming into our harbor just not we can't expect
[3:24:58] them to say that you know you got so many vessels in your harbor
[3:25:02] you need to put a gate at the front of it and have somebody monitor 24 7 and
[3:25:05] patrol who's coming and who's going like say if you want
[3:25:12] i don't know more high-end lauderdale look you need
[3:25:17] to restrict your harbor to nothing but 70-foot vikings
[3:25:22] or hatteras or something um if that's the look you're going for
[3:25:27] so with i mean i guess just just wondering where we're headed
[3:25:30] with it you know i've been thinking about a lot what the what the council is
[3:25:33] going to be able to do at the end of it what kind of ordinances
[3:25:37] we can come up with or we're not putting ourselves in a lawsuit
[3:25:42] you know am i saying we're going to only have
[3:25:44] each home waterfront home can only have one
[3:25:47] private boat or you know
[3:25:50] i just don't know just kind of thinking about it a lot
[3:25:53] lately just kind of curious of one what what can i expect out of this
[3:25:58] and that's kind of what i thought was going to get a lot of recommendations
[3:26:01] and um from the core and then i was trying
[3:26:05] to you know think of what is this council
[3:26:11] what can we do with those recommendations
[3:26:16] um no i don't know just um just tough i i know
[3:26:21] that and and then i think about well the i think the livery vessels we have
[3:26:26] i think most of them had a hard time getting approved because of parking
[3:26:32] um so i don't know that they you know we could double if we left this more time
[3:26:35] that we could double our vessels in the harbor because
[3:26:39] these they can't immediately don't have the
[3:26:41] the parking but then we have literally vessels or
[3:26:44] delivery companies that have been operating for a couple years now
[3:26:49] and don't have a permit or nothing um at all so
[3:26:56] are we stopping them are we not i i'm gonna i'm requesting to speak to and i'm
[3:27:01] gonna answer to some of that in my personal opinion but mr bagby you were
[3:27:05] up first all right
[3:27:07] uh i've made it clear especially my livery vessel partners because i
[3:27:11] consider all citizens partners you know we're up here to represent them and
[3:27:16] and being a charter boat guy and part of the
[3:27:18] heritage just a
[3:27:22] portion of the heritage that mr destin's part of because of his family name you
[3:27:26] know that sign on the west end of the bridge there says welcome to destin the
[3:27:31] luckiest fishing village in the world and uh that's been the moniker here
[3:27:36] uh for a long long time uh not as long as the destin family's been here and the
[3:27:40] other founding families of our community but for me being a legacy fisherman i
[3:27:45] always you know we don't have a real fancy
[3:27:47] building you know historical buildings found you know by the spaniards or or
[3:27:52] you know pre-civil war development of our main street or
[3:27:56] anything like that what we have the only the really thing that makes us special
[3:28:00] is we have a heritage that most communities don't have and that's our
[3:28:03] fishing heritage and that's where we got started and so that's real important to
[3:28:06] me i've been
[3:28:09] pushing our attorneys to take more proactive uh actions and come
[3:28:15] up with some ordinances to protect our heritage i think the the
[3:28:20] the harbor board in 2015 i think when this first came up
[3:28:25] they that was kind of i think their feelings too is like you know
[3:28:29] things are changing rapidly and this is this is something
[3:28:34] that's really concerning is because all of a sudden places that had a fishing
[3:28:37] boat in it or a charter boat or a commercial boat
[3:28:41] of course cca put dewey and his folks out of
[3:28:45] business would ban the nets but also they're being replaced with livery
[3:28:50] vessels and um and so that's where the moratorium came
[3:28:53] from and this council as it's tried to get a handle on it some of what you just
[3:28:57] spoke of we've keep extending that moratorium i
[3:29:01] wanted to change that moratorium from temporary
[3:29:06] but we've been waiting for the capacity study to where you evaluate the whole
[3:29:10] harbor so if we do restrict
[3:29:14] what takes place on the harbor that we have a legal standing in that because
[3:29:19] we'll have the corps of engineers study we have our citizen community and then
[3:29:22] we'll take we have to take all these issues up as a as a council and have
[3:29:28] discussion hear from the public and make some of these decisions
[3:29:33] i think the moratorium has as much as it's been
[3:29:37] a pain in the butt for them trying to operate it's also has preserved them to
[3:29:43] a certain extent with what's going on in other parts of the county
[3:29:47] and that that makes their business and their position in the harbor more
[3:29:52] valuable than it was in 2015 and so i think as
[3:29:56] you you know in the last 18 months there's been more dialogue with the
[3:30:00] industry itself to how to approve it we just heard from from from an owner
[3:30:07] asking for this council to help protect their industry and so that's the
[3:30:12] route i i think myself personally want to take
[3:30:18] i want to make sure that our heritage remains intact
[3:30:22] that our ecology remains intact that we still
[3:30:26] have these people that do have 70 70-foot
[3:30:29] vikings in a multi-million dollar second home paying 100 percent of the property
[3:30:34] taxes i want them to stay intact because we all feed off that
[3:30:40] the energy the history the legacy that this community has in
[3:30:44] that harbor which sets us apart from everyone else so that's that's that's
[3:30:48] where i'm coming from rodney and and i'm only going to be mayor till
[3:30:53] this november 1st so i'm hoping this council
[3:30:57] this comes back in this we get this study and this council makes some
[3:31:00] decisions before my times that end otherwise i'm going to be on the other
[3:31:03] side of that podium wearing you all out trying to to encourage you to to do the
[3:31:08] right thing for our community so i think i hope that answers a little bit of your
[3:31:12] discussion i i don't think that that capacity study is going to handcuff us
[3:31:18] or prevent us from doing anything that we think is best for our community it
[3:31:22] but it will give us a guide it will give us some direction and it will def i
[3:31:26] think i feel confident it's going to put us in
[3:31:28] a defendable position for the decisions that we make
[3:31:32] right and i agree with you 100 and i've been i've been on board you know with
[3:31:36] the moratorium and the liver vessels since 100 since day one because that has
[3:31:41] been our biggest complaints of um you know pontoon boats cutting captains off
[3:31:46] and just running all over you know creation and don't know what they're
[3:31:50] doing a lot of them haven't never driven a
[3:31:53] boat but and it's been a problem for us because
[3:31:55] that's where we get a lot of our complaints from um
[3:31:58] i guess it i'm just realizing now that
[3:32:04] that that decision no matter what that study comes back
[3:32:07] whatever court tells us that decision is still going to allow on
[3:32:11] this council to do something so
[3:32:15] i don't know i don't know i don't know if the
[3:32:17] study is going to help me or hurt me
[3:32:21] as far as you know making that decision because
[3:32:24] the ultimate decisions is going to be on this council to you know
[3:32:28] what we're going to do we've got enough rental boats no matter what it is
[3:32:32] in the harbor now we've got the problem with
[3:32:35] these rogue operators coming into town you know it's like a dime a dozen
[3:32:39] everywhere this is adding to the problem so well i
[3:32:44] think what we're seeing and i think john and mike would agree is
[3:32:48] their industry's becoming more professional because they've seen the
[3:32:51] need themselves to be good operators in our city now now we're in a position we
[3:32:55] need to help them maintain that and protect that and
[3:32:59] if that if that's the if we make this moratorium permanent and and then that
[3:33:04] even puts a little bit more burden on us but at the same time it's going to make
[3:33:07] identifying the people that aren't good operators
[3:33:11] easier to find a lot of i believe if i was on the
[3:33:15] business if i was little john or whoever i would want the moratorium yeah i keep
[3:33:19] all my competition out i've i've operated under moratorium industry since
[3:33:24] uh 2000 well since 1998 and there's value in
[3:33:29] that okay because it does give you certain
[3:33:33] aspects to make a living off natural resources of our community and and but
[3:33:37] it also encourages you to be a good steward i think the industry's
[3:33:40] understood that and they're becoming good stewards the ones that get to
[3:33:44] operate here so it's a privilege and an honor and a benefit i think long term
[3:33:50] to go down that route i think
[3:33:54] i personally hope and believe that this council and the representation on it
[3:33:59] understands the value of destin harbor in our heritage and i think i i don't
[3:34:04] think the study is going to hamper us from making the decisions to maintain
[3:34:11] that level of excellence i really have full confidence in everybody sitting
[3:34:17] here i have full confidence in the industry themselves that we're having be
[3:34:20] talking about them but we have other industries that are operating out of the
[3:34:24] harbor and i i think it's a i think it's a good discussion
[3:34:28] i just been
[3:34:30] listening to our city and land use attorneys and saying let's let them
[3:34:34] finish the study so we can make the most informed decisions based on not only
[3:34:40] protecting our community but also that's defendable
[3:34:45] because everything we do up here you can never ever forget
[3:34:48] that you could always end up in court so we've got to make we dodge your eyes
[3:34:53] cross your t's and make good legislative decisions and it's really going to work
[3:34:58] jim

[3:35:05] ask a question of the staff uh that karen brought the way i read section 4

[3:36:18] guessed things from a financial perspective see i'm i'm more of the if
[3:36:22] you're not a local you're not launching from joe's by you but if you do
[3:36:28] it's only two thousand dollars today you know
[3:36:31] and uh that that's how
[3:36:34] that that would be jim bagby's solution problem but there's probably a better
[3:36:38] solution that we you know at least four of us can agree on uh i just always
[3:36:43] think you incentivize uh behavior that you want to see repeated and you
[3:36:48] dis-incentivize behavior you don't want to see repeated and you and financially
[3:36:53] that there's the best way is the best way i found to do that for business
[3:36:57] people but no i agree i just want to make sure
[3:37:01] that we weren't being owners i'm not a big fan of
[3:37:05] moratoriums i'm glad you've worked up but
[3:37:08] i believe let the market work but we've got to fix
[3:37:12] the underlying pinnings of that market for it to work efficiently
[3:37:17] but one more thing there um i wanted to say was it i don't want to
[3:37:22] not only use the word handcuff these guys
[3:37:27] but we basically have and then we've let the rogue operators just run rampant
[3:37:32] run like wildfire and it's like we're not doing a thing about that
[3:37:37] and that yeah that's that's not right um at all

[3:38:00] they met with coast guard they met with fwc
[3:38:04] um all those agencies those enforcement agencies are on
[3:38:09] full alert and i've already had some discussions
[3:38:13] one of their most effective tools they ever do is they'll come in here they'll
[3:38:16] bring units in from all over the place and for two or three days they'll
[3:38:21] they'll stop everybody and they write a tremendous amount of tickets whether
[3:38:25] it's fisheries delivery vessels of private recreational voters that's
[3:38:30] that's how that works and and so for them to do that you just got to keep
[3:38:36] ringing the bell long enough and i think we've rung the bell enough and and we're
[3:38:40] already starting to see results the good news is we'll try to come up with some
[3:38:44] ideas that this city and this council can do to enhance
[3:38:50] those other agencies and in that and it's it's a total part partnership
[3:38:54] because you can't catch them all a bad guy is going to be a bad guy no matter
[3:38:58] what so
[3:38:59] that that's where we're at there johnny thank you sir yeah i just want to say i
[3:39:03] i i share the same feelings about the uh one the heritage of destin two i don't
[3:39:09] see the um mr bagby i'd share the same what you
[3:39:13] were talking about the the tools it's not it's not the same thing you know if
[3:39:16] that's mr marlar but it's a totally different thing um
[3:39:20] you know and one of my one of my main questions about this whole thing is
[3:39:25] mr mayor you were talking about the moratorium on federally permanent
[3:39:28] charter boats those guys don't feel that anymore they don't feel like they're
[3:39:32] hand they don't feel like they're handcuffed they have
[3:39:36] they got the keys to the kingdom you know and i think the guys in the livery
[3:39:41] vessel business we've talked about this and the ones who
[3:39:44] are doing it the right way it seems like to me i don't put words in anybody's
[3:39:48] mouth but it seems like the ones who are doing it the right way are okay with
[3:39:52] this i saw something on facebook the other day it was somebody
[3:39:55] saying just
[3:39:58] somebody was charging an astronomical amount of money for a pontoon but people
[3:40:01] are up in arms and i'm over there like yeah you know like that's that's what
[3:40:05] this moratorium should do this is an elite place this is an exclusive place
[3:40:10] we should we should there should be an element of
[3:40:13] exclusivity when it comes to these kind of things
[3:40:16] and maybe that's that's my opinion um
[3:40:20] but the joe's buy you thing great example that i was talking to lance
[3:40:23] about that today you know i don't know i mean we would we would
[3:40:28] hold these things we would we would hold these things in
[3:40:32] very high regard as people who have put all our eggs in this basket to be
[3:40:38] here um
[3:40:40] but i don't i think it seems like to me just from the
[3:40:45] as far as delivery vessel this this uh moratorium goes
[3:40:50] um you know we've got
[3:40:52] one a very large portion of our water sports industry the charter
[3:40:57] business they are handcuffed by a moratorium they're not they don't feel
[3:41:01] that way but that's if you want to put it in those terms that's what so it is
[3:41:04] while we have if we were to lift this moratorium i
[3:41:08] think we go so many steps backwards uh in the wrong
[3:41:13] direction
[3:41:16] i think this is uh
[3:41:20] i had a really good thought here um
[3:41:24] the yeah i think it's a good course i think
[3:41:26] it's a i think we're on the right track and if we if we pull this before the
[3:41:31] this harbor capacity study is over i think we're i think we're backing up
[3:41:35] yeah we shoot ourselves in the foot everybody's wasting a bunch of time and
[3:41:38] money i i agree johnny and and just so uh and lance i'll give you a shot here
[3:41:43] real quick before we take a vote um what what the charter fishing fleet is
[3:41:48] under is under a limited access privilege program it's called a lap
[3:41:52] and the reason they did that was the we're we're dealing with a limited
[3:41:55] resource and we can take so much out of the gulf of
[3:41:59] mexico and so part of to to constrain effort
[3:42:03] they they started this limited access privilege program
[3:42:08] you hear the words limited access privilege program and over the years now
[3:42:14] that we've developed some good fishery management plans it is truly a privilege
[3:42:19] to be able to make a living fishing as a professional fisherman
[3:42:24] and and and still achieve sustainability for the resource
[3:42:29] itself so you can not only take pride in the fact that you're good at what you do
[3:42:33] but you can also take pride the fact that you're contributing to the
[3:42:36] well-being of the ecology that helps you make profit and really livery vessels
[3:42:42] are no different um a good ecology and in a good experience
[3:42:49] is is a is is what their customers seek above all and the more they in
[3:42:56] enhanced are enhanced by that because it isn't crazy and overcrowded stuff like
[3:43:01] that more money these guys can make and and
[3:43:05] we've all seen that so i i just uh agree with you that uh we're
[3:43:10] on the right track we'll we'll see what the final track is after we get that
[3:43:14] report lance would you like to add something to it yes thank you mayor um
[3:43:18] just real quick i just want to remind everyone that we have
[3:43:24] invested a quarter million dollars worth of destin's money along with the quarter
[3:43:28] million dollars of the federal money to get this survey to take place
[3:43:33] we're the only reason we're doing this is to provide information they're going
[3:43:37] to give us information data statistically significant data data that
[3:43:43] matters data that's been proven it's not just me on the corner drinking a beer
[3:43:48] with somebody saying this is the way i think it should be this is the real deal
[3:43:51] they're they're studying and they're going to study rogue boats they're going
[3:43:54] to study parking but i don't know what the answers are going
[3:43:58] to be but we will find out this fall so my point is on this we just need to stay
[3:44:03] the course on the moratorium until the the survey period is over and they are
[3:44:08] they've already started the survey period it's not going to end until just
[3:44:11] after labor day and then they're going to have to have time to summarize and
[3:44:15] get the data back to us then it's back to you guys but at least this time you
[3:44:20] will have true data to make decisions on of how you want the harbor to look for
[3:44:25] in 5 years 10 years 20 years and beyond so i just i just want to
[3:44:30] throw that out there the it's very important that we maintain the
[3:44:34] moratorium until they finish their survey

[3:48:29] enforcement goes they too only have the ability to s they
[3:48:34] can cite someone they can request that someone does something
[3:48:37] if they if the individuals do not want to cooperate i mean the only choice they
[3:48:42] have at that point is to try to call the sheriff in to see if we can trespass
[3:48:46] them because we have a standing trespass order with the sheriff's office but i'm

[3:53:09] hopefully in the 6 to 12 months it's a wide range but
[3:53:13] i i assume that they're they're coming close to being finished i think lance
[3:53:18] said something about june or july they're going to have their
[3:53:21] survey done or may well they want to perform the survey this summer when
[3:53:26] during the height of the season so they anticipate giving us the results in the
[3:53:30] fall so i would say september-ish that's pretty okay good
[3:53:35] what what's the uh what's the update on our harbor park observation deck um
[3:53:41] with the contractor out there are we still
[3:53:44] moving along are we happy with them right now
[3:53:47] somewhat it's still moving along okay so uh
[3:53:53] i think we've got a solution to the problems and
[3:53:56] and and then it's gonna get it's gonna get finished okay

[3:58:02] to present that i would present on her behalf all of the updates that are
[3:58:06] absolutely fantastic for our area for the destin fort walton tdc
[3:58:11] so with that um catherine you're going to run the
[3:58:14] slides for me thank you um the first slide in destination effort
[3:58:19] plan destination stewardship it continues to be successful and they're
[3:58:22] expanding this program this summer so there's going to be more moms involved
[3:58:26] more programs and more little outlets um they've created what they call ads in
[3:58:33] the sand it's these big stamps that they stamp into the sand and it sort of helps
[3:58:37] create what um is available everything from you
[3:58:41] know golf cart rides that are going to be right there in crystal beach shores
[3:58:45] popsicles and store fronts down at destin commons they're going to have
[3:58:48] those clings on a lot of the windows that speak to
[3:58:52] the programs for little adventures this was a success last year they're
[3:58:57] going to bring it back this year we've got a couple of council members
[3:59:00] that have volunteered to be golf cart drivers we've also had some
[3:59:04] some other members that have volunteered to do
[3:59:07] golf cart driving to show some some uh
[3:59:12] hospitality from the destin side of the house
[3:59:15] um storefront signage destin commons all
[3:59:18] the way to fort walton beach uh the next thing you'll see is on the
[3:59:22] little adventures takeover of mid bay bridge toll so as people are coming
[3:59:26] through the mid bay bridge now there are
[3:59:30] rap booths and the toll workers are going to be handing out the little
[3:59:33] adventure maps which tells the moms all the programs and things the kids get to
[3:59:37] do that are free and low cost and where they can go on the website to find them
[3:59:41] and they'll also get what they call push notifications as they go through the
[3:59:46] booth for their um text options while they're in destin
[3:59:50] so that they'll be able to see everything from beach safety to flag
[3:59:54] alerts to where to go get things for your kids
[3:59:59] the next thing you'll see is the little adventures map this is what they're
[4:00:03] being handed this shows all the little adventures in one place it shows how
[4:00:07] close mom is to an adventure and what adventures they can do there's also a qr
[4:00:11] code so that they can scan it into their phone gives their mom
[4:00:15] more engagement with local moms um that have done these little adventures with
[4:00:19] their own kids and can help them feel comfortable with them
[4:00:22] the map is going to be also handed out at the toll booth the lodging partners
[4:00:27] mr wampler's here he can speak to that restaurants welcome center state parks
[4:00:32] and on the golf cart rides and at the popsicle carts the other thing that
[4:00:36] we're very proud of is the water safety campaign
[4:00:40] we've talked about this for the last two years and here's something that i
[4:00:43] spearheaded and i'm very proud to say that destin is part of the push
[4:00:48] here's the example of the new water safety brochure designed to align with
[4:00:51] the little adventures and it has what the flags mean
[4:00:55] on that color code on one side and as you flip it over it shows how
[4:01:00] that person if they've caught in rip current how they need to swim out and
[4:01:04] swim away and come back into the shore so these are also going to be on the
[4:01:09] golf carts and down there in the lifeguard stands as well
[4:01:13] then the next thing you'll see is finally there's an installation monument
[4:01:17] markers on the beach for public safety these are all aligned with the fdep's r
[4:01:22] system which are placed every 500 feet they're starting on okaloosa island and
[4:01:26] they're working this way because a lot of times when people are on the beach
[4:01:30] and they have an accident or they need somebody they look around and they're
[4:01:33] like well there's this big white building here and i think there's a pink
[4:01:35] building there so these are now going to make it easy
[4:01:39] because there's going to be a sign there and the sheriff and the all the safety
[4:01:43] they know what these codes and numbers are they're gps coordinates and they're
[4:01:48] currently being fed into the 911 dispatch system so that r signed number
[4:01:52] at the top of the dune it'll allow for the accurate location i did ask jennifer
[4:01:57] about putting on these signs since they're on the beach leave no trace
[4:02:02] and since they can't commit to that i told her if they didn't have them on
[4:02:06] them when they got to the destin beach i would get a pile of stickers and i'll be
[4:02:10] putting one on every one of our signs and destiny so that that's our logo
[4:02:16] next the trash cans i know we've all talked about we need more trash cans
[4:02:20] they were going to try and encourage put beach cleanups in parks by adding these
[4:02:24] little adventure trash cans they can't really use them where the big ones are
[4:02:28] that are picked up by the trucks because when the claws come around they scrape
[4:02:32] off the plastic so we found that's not going to work so they're going to
[4:02:35] probably post them in places like at the commons and under other areas where they
[4:02:38] are handled by a person versus a big truck pickup
[4:02:43] the next thing you're going to see is the adventures in close signage there's
[4:02:47] going to be permanent signage to be strategically placed to promote little
[4:02:51] adventures like this one right here is at beasley
[4:02:54] park and it promotes the gulf area which is right up the road
[4:02:57] and it offers families and more things to do and supports the tourism industry
[4:03:01] here in the area and then the other thing next slide is
[4:03:06] um they're going to do these in some of the condos it's the um little several

[4:03:38] this is something that's really cool they did this down at the commons at the
[4:03:41] adventure crosswalks and it's in all of the areas around in the commons and some
[4:03:46] of the others are in some of the other areas um that they're
[4:03:50] looking at is some of the condos and the walk across but right now these are down
[4:03:54] all around in the commons um the next one
[4:03:58] these are just some of the um visuals i think
[4:04:02] yeah i don't know if there's any more it's like yeah there there's the these
[4:04:05] are the other um
[4:04:08] in destination cars
[4:04:10] people sort of online calendar for locals to
[4:04:14] enjoy and then let's see
[4:04:16] these are some of the moms that work these ladies have done basically the
[4:04:20] online chat so when somebody clicks on the destin fort walton beach clicks on
[4:04:25] little adventure clicks on i have a five to seven year old immediately it pops up
[4:04:30] and says reach out to abby click here she has a five and a seven year old and
[4:04:34] then she can coach them on hey this is a really cool thing do the paddle boards
[4:04:38] or do the pin fishing this is also for our locals so whenever you're out
[4:04:43] shopping with your family and you're at the destin commons and you see this this
[4:04:47] is for everybody so we want moms that live here that haven't seen this that
[4:04:52] haven't done this kevin your wife's got some little people
[4:04:55] i'm sure this would be right up her alley she'd probably love to you know
[4:04:58] reach out and either connect with moms that have already done it or just
[4:05:01] because she lives here get the kids out and enjoy some of our own fun stuff
[4:05:06] then the next thing is what we have is our adventure packs it's kind of hard to
[4:05:09] see up here but the pax pair the water-based partners with local
[4:05:13] restaurants the tdc pays the local pac partner 50 of the total cost that keeps
[4:05:18] the cost down for the mom's dads or whoever's bringing the kids into town to
[4:05:22] do these events that it's a very low cost because tdc is offsetting the bulk
[4:05:27] of it this promotes our local economy and offers little adventures to the moms
[4:05:31] who may not know about all the great things there are to do than other just
[4:05:34] to go to the beach um then the next page is the local
[4:05:39] partners that we're working with this summer we've done our best to work with
[4:05:42] local partners there's been several that have been contacted that are just not
[4:05:46] really interested but we do have some really awesome ones
[4:05:50] um swell pops gulfarium lulu's destin paddle company smiling wave salt water
[4:05:55] hey baby charters fast signs east pass wet
[4:05:58] and every day another partner sees another way to become part of it so
[4:06:04] we're always looking for anybody that wants to help
[4:06:06] our adventures whether it's a local family or a visiting to have a good time

[4:07:27] have not been able to make meetings i talked to both of them today
[4:07:31] one of them my public works public safety committee
[4:07:35] representative mark brown lieutenant colonel mark brown
[4:07:39] is changing command up at 3rd battalion 7th
[4:07:43] and june 16th and he's being reassigned down to homestead so i will
[4:07:49] he's going to be at the meeting tomorrow but i will be bringing at the next
[4:07:53] meeting another appointment my other one on the
[4:07:57] parks and recs we had a great conversation and he understands and he
[4:08:01] will do much better
[4:08:05] this next quarter in attending and i appreciate that
[4:08:09] the
[4:08:11] second thing i have is on joe's bayou i mean
[4:08:17] i share your frustration i think everybody in this room shares your
[4:08:21] frustration you know i would just ask the city manager sheriff's office code
[4:08:25] enforcement we know where the problem is it's at
[4:08:28] joe's bayou we know when it is nine o'clock to eleven o'clock on
[4:08:33] saturday mornings surely for two hours
[4:08:37] we can have a code person down because i agree 100 with you
[4:08:41] it is not a park attendance responsibility to do anything other than
[4:08:46] maybe call code enforcement or call the sheriff they're they're trying to keep
[4:08:51] it safe down there they're trying to collect money they're not
[4:08:54] a law enforcement or a code enforcement entity but we have
[4:09:00] people who are that we are paying or paying their contract
[4:09:05] for two hours you know
[4:09:08] this saturday and maybe two hours on sunday at another location whatever the
[4:09:12] second worst location down on the harbor is or wherever it is
[4:09:16] have somebody down there because people learn
[4:09:21] you know you write six citations saturday morning
[4:09:26] you that's half of those won't be back there now they may be someplace else you
[4:09:31] may chase them somewhere into the harbor but they learn uh once they start paying
[4:09:36] those fines and finally the only thing i would say
[4:09:39] great presentation i thought they were going to put those
[4:09:42] trash balls on the beach and i was just going to say they need to have lids
[4:09:46] because our experience when i ran the tdc in walton county is
[4:09:50] people just pile stuff in there until they overflow
[4:09:54] and on certain times of the year middle of the summer you cannot keep up with
[4:09:58] emptying those trash against you just unless you put somebody there
[4:10:02] the whole time and so if you have some kind of lid because
[4:10:06] varmints varmints get into them you know raccoons and stuff it's just
[4:10:11] something think about thank you mr mr destin
[4:10:17] mayor i appreciate it i'm on the i'm briefly speaking on the joe's bible
[4:10:21] issue we need to ascertain if the council at some point in the past
[4:10:26] stops the commercial fees if they did we need to put that
[4:10:30] back in and then i think city manager you
[4:10:34] have gotten pretty good feedback forward putting some extra
[4:10:38] concentration of our code enforcement folks down there once we ascertain the
[4:10:42] answer to that so we can address that one the other
[4:10:46] issue and i'll briefly speak on it since i had the joy of rejoining this council
[4:10:51] we have struggled mightily to try to hold these meetings where they don't go
[4:10:55] late into the night i think tonight is a fine example about our inability to do
[4:10:59] that so far i want to bring in my experience on the
[4:11:04] school board and what the county commission does and what a number of
[4:11:07] municipalities do they have a workshop like on the thursday for the meeting
[4:11:11] where most of this gets hashed out into three hours and the meetings end up in
[4:11:15] most cases to be an hour or less the official meetings at night we need to
[4:11:19] consider thinking about that if if that's going to lead us toward meetings
[4:11:22] that don't go between nine and ten o'clock at night
[4:11:25] and uh you know i used to say that was a dumb idea because you were spending the
[4:11:29] same amount of money same amount of time
[4:11:33] but it wasn't late at night if you do your workshops you know earlier in the
[4:11:38] day so we need to be considering that so we can make these meetings not go to 9
[4:11:42] or 10 o'clock at night that's it mayor thanks
[4:11:45] yeah it's just one of the casualties of the florida sunshine laws is you can't
[4:11:50] have open debate discussions prior to these kind of meetings you know it's
[4:11:53] just again unless you have a workshop so

[4:12:04] the big pay raise that they got to spend more time here in this room but
[4:12:10] anyways uh you know i i agree with you there uh some nights we've been pretty

[4:13:48] thursday um
[4:13:51] it was a question i brought forward to them and it was it was kind of
[4:13:53] disturbing i kind of knew most of it but i really didn't know how it worked
[4:13:59] and nothing on staff they're only using the
[4:14:01] tools that this council has adopted and gave them to work with
[4:14:06] so staff's not doing anything wrong um but
[4:14:12] we've sat up here and bitched about parking
[4:14:15] and livery vessels um for quite some time parking since
[4:14:19] i've been here eight years parking so anyway
[4:14:26] if if i want to buy a
[4:14:29] piece of property on the destin harbor and i want to put a restaurant on it i
[4:14:34] have to get a development order and if i submit my plans
[4:14:41] to the city and i'm one parking place short of what
[4:14:44] i'm required to have for this restaurant to serve lunch and dinner
[4:14:49] i'm denied i have to go back to my engineering architect whatever redesign
[4:14:54] it squeeze another parking spot in there somewhere
[4:14:59] so i resubmit it
[4:15:03] and i'm approved now i have enough parking
[4:15:06] so i i get my building permit i build my restaurant
[4:15:12] next week i come back in and say you know what i want 15 pontoon boats behind
[4:15:18] my restaurant that requires i don't know 2.3 parking places per boat on the rough
[4:15:23] stage to say 30 parking places
[4:15:27] so then staff says no problem i got this neat little formula back here
[4:15:31] that the council has approved i get my calculator out and calculate it
[4:15:36] voila there you go all of a sudden you got enough parking now for your pontoon
[4:15:41] boats and your restaurant i know i told you a month or a week ago or a month ago
[4:15:45] it was one short for your restaurant and you had to go back and spend a bunch
[4:15:49] of time and money to get you won't get me one more parking place
[4:15:53] now that i got this nifty little formula all of a sudden
[4:15:58] no problem you got enough now to run two businesses
[4:16:03] and then
[4:16:06] you want to get you want to get a
[4:16:10] dolphin cruise boat stick it behind there it carries 30 people
[4:16:16] somehow i've got enough parking for that too
[4:16:20] but 30 days ago i was one short for just my restaurant
[4:16:25] now i want to build me a bar open bar that accommodate 200 people
[4:16:31] well guess what that that allows
[4:16:36] that has zero parking requirements for that
[4:16:41] but just 30 days ago i had a development order i had to get one parking place
[4:16:46] somehow somewhere to get my just my restaurant going
[4:16:54] we got a problem but we're the ones breeding it
[4:16:59] we're the ones allowing it and i get the i get the
[4:17:04] i get the shared parking i get that
[4:17:08] just like marina cafe they they open for dinner
[4:17:12] they have a parking they have literary vessels and they use
[4:17:16] that parking all day long until five o'clock and then the restaurant opens up
[4:17:20] and that's i get that i understand it what i don't
[4:17:24] understand is is why the council has adopted a comp plan ldc or whatever that
[4:17:29] says i've got to have so many parking places in my restaurant
[4:17:33] and then all of a sudden i've got 15 pontoon booths and i can come to whip a
[4:17:37] parking study out so why didn't a pencil whip that parking
[4:17:40] study out to start with
[4:17:44] it says you know you don't you only need so many parking places you don't need a
[4:17:48] hundred for your restaurant you only really only need about 60.
[4:17:54] so jimmy got something to add i'd love to
[4:17:57] hear it sure uh if you remember i think you were here uh the night we voted on
[4:18:03] point mezzanine and lewis committed to this council that
[4:18:07] when he brings back the changes because the point that night
[4:18:12] that we brought up was that wait you just added
[4:18:17] all these boats and you didn't add a single parking spot and and you're right
[4:18:22] it's it's on the council he committed to us
[4:18:26] that no when they bring it back the revision and
[4:18:29] maybe miss kopp will or lance will confirm
[4:18:34] that it's going to be in there that if you add a use
[4:18:38] okay you're going to add parking spaces because we're not going to allow another
[4:18:41] condominium or another restaurant or another whatever to be
[4:18:45] built that
[4:18:48] does exactly what you said because what they did is they have the parking spaces
[4:18:52] for that condominium and they had zero for those boats and then and we talked
[4:18:57] about deck cans and we talked about captains and we talked about and he made
[4:19:02] us a promise and i i assume we're all going to hold him
[4:19:07] to the promise he made that night because i know i am
[4:19:11] so i think i sure i think everybody shares your thing but i think i hope
[4:19:16] louis is working hard on that because i'm looking for it it is a part of the
[4:19:21] ldc rewrite that is being taken up yes because they wanted to take up parking
[4:19:26] as a whole and i i appreciate that i knew that the
[4:19:30] outdoor seating was going to be addressed somehow some way
[4:19:33] i didn't know the rest of it but i'm just
[4:19:36] it's beyond me how the council in the past
[4:19:40] approved something like that that it proved one thing and it gave you another
[4:19:44] another option or
[4:19:46] formula to get around it and then they gave you something else
[4:19:50] that just didn't require any parking whatsoever
[4:19:54] but they've always been complaining about parking ain't got enough parking
[4:19:58] you know um
[4:20:00] yeah i'm just i just wanted to share that with the council what i i i want to
[4:20:04] know what's happening and found out and just make sure we were
[4:20:07] we were heading to a solution or trying to i wanted to close those loopholes
[4:20:12] somehow somewhere what's the magic formula i i want to add to what you're
[4:20:16] talking about rodney because you know when uh the city
[4:20:21] did the harbor walk the boardwalk
[4:20:26] they were supposed to provide all the landowners that gave up that 24 feet
[4:20:30] they were they were told that the city was going to provide
[4:20:35] 1650 additional parking spaces now all of us sitting here know that means a
[4:20:40] multi-level parking garage across the street as a minimum which we've never
[4:20:46] built and i think that was made back in 2005 2006 right before the grand housing
[4:20:53] collapse and all that become not feasible
[4:20:56] so some of that is generated
[4:21:00] by i don't think anybody intended not to
[4:21:02] live up to that requirements but
[4:21:06] in the meantime what you're talking about is
[4:21:09] probably the biggest problem that since i've been on here and i know
[4:21:13] you've been on here four years longer than me
[4:21:16] that that that has been the issue um our code
[4:21:21] joey that's one of the things he was trying to combat you know for the last
[4:21:25] two years and we still don't have an answer to that and then of course kim i
[4:21:29] guess you could address the issue if we're going to try to go retrospect
[4:21:34] and start holding these original do's to the fire
[4:21:39] where you get where does grandfather coming in where the lawsuits become
[4:21:43] available and what's the city's responsibility for not providing the
[4:21:47] park and they they told those people who gave up those
[4:21:51] part of their land to create the harbor walk how's that all play i mean you know
[4:21:56] if you and lewis come up with some decisions to kind of
[4:22:00] answer rodney's concerns because i think it's it's not just rodney's concern
[4:22:03] everybody on this it seems like that's the moratorium we
[4:22:07] need to come up with
[4:22:10] so would you like to
[4:22:16] that that's a big question and what i'll say is this we're going to
[4:22:20] take up the entire issue of parking when we do the ldc rewrite
[4:22:25] for that section of the code all of this at once in a comprehensive manner is the
[4:22:29] way lewis wanted to approach it with you because if you piecemeal it one thing
[4:22:32] can affect another so why don't we wait till
[4:22:36] we get that it's coming to you in like within 60 days maybe less
[4:22:40] rodney you in your scenarios you were laying out
[4:22:43] um what tools does staff have
[4:22:48] you said that they're only doing what y'all give we have given them
[4:22:52] what are you talking about that that allows them to then open up the pontoon
[4:22:56] and then the um i care so what are you talking about i
[4:22:59] guess lewis referred to some formula for i think steve o'connor can wave it wait
[4:23:06] i can step in a little bit so there's there's multiple ways that you can park
[4:23:10] for multiple uses you have like like stated the shared use or shared parking
[4:23:15] agreement which takes into consideration different
[4:23:18] operating hours of different entities so so like councilman braden said if you
[4:23:23] have a restaurant that opens up at 6 00 p.m and it requires 60 spaces
[4:23:28] you know and you're not utilizing that those 60 spaces
[4:23:31] from you know 8 a.m to 6 p.m
[4:23:35] then they're just sitting there vacant right
[4:23:38] so why not allow another use that operates
[4:23:42] outside of the hours of the restaurant there's also in the in the
[4:23:47] the old town mmtd
[4:23:50] a reduction in parking by 20
[4:23:54] that's written into the mmtd so and then you have your maximum so your
[4:23:59] maximum is in the mnftd is the minimum so say if you're required to have 100
[4:24:04] per the table that's your maximum but you can reduce
[4:24:08] down 20 percent to 80. you know just kind of break that down
[4:24:12] and steve where does the shared parking application come to
[4:24:17] who who's looking over that approving it and reviewing it city
[4:24:20] city staff looks at it and we look for sufficiency and compliance so like
[4:24:26] building department planning planning yeah planning division
[4:24:29] um building divisions part of that review
[4:24:33] engineering is heavily part of that review as well do we have anything to go
[4:24:37] review that every so many years is that i just no is there anything like
[4:24:42] that to go check it out no there's there's nothing that that would really
[4:24:46] require or prompt us to go back and review those shared parking agreements
[4:24:51] unless there's a change of use that happens and there was recently a a
[4:24:55] change of use that came forward to city council with a shared use agreement
[4:24:59] that was approved and it was because the three operations that happened there all
[4:25:05] operated at different hours and they're already over parked but because of the
[4:25:10] the complexity of each use we required them
[4:25:14] to bring that shared but if a restaurant decided to change their hours of
[4:25:16] operation they're not going to come to the city and say here's my change of use
[4:25:19] application right you run that risk so then we potentially need to give you all
[4:25:22] the tools to check into these things every so many months or years just to
[4:25:26] make sure that what you said three years ago is still actually happening down
[4:25:30] there absolutely and there's we run to that rit that's that's just a
[4:25:34] risk of the game so yeah
[4:25:40] i think that's another one that's been brought to everybody's attention
[4:25:44] multiple times with nothing being done whatsoever
[4:25:54] all right been a lively

[4:26:01] look to our land use attorney city attorney um
[4:26:04] we're getting a lot done i know there's been some issues brought
[4:26:08] up it seemed like we're not but if you really take a a look at what's happened
[4:26:12] over the last 24 months especially we really have done a lot as a city uh
[4:26:18] we've done it with value we've i think some of the things we've
[4:26:22] accomplished we've got pretty good bang for our buck uh we we start talking
[4:26:26] about we're renewing contracts and stuff with our our uh
[4:26:31] you know sheriff and and with waste management stuff like
[4:26:34] that so you know we still got some more work to do but
[4:26:38] the encouraging thing to me that in spite of some of these challenges like
[4:26:42] what mr brain bought up mr schmidt is this city's really moving forward i mean
[4:26:46] at a really good pace we've accomplished a lot we've gone paperless we've started
[4:26:51] a whole bunch of new things we've got beach buyback initiatives crosstown
[4:26:55] connector we're underground and i mean we are moving in the right direction
[4:27:00] it's just a matter with just we just got to stay a little we we got to stay
[4:27:05] focused with passion to to make this better um some people
[4:27:09] complain about the traffic and tourism and they want to talk about all the
[4:27:13] things that we did wrong over the years but the rabbit's out the whole
[4:27:18] so i think this council myself personally i think a lot of people in
[4:27:21] the community now we just need to focus on putting a tuxedo on the rabbit
[4:27:26] and and i think if if that's our goal on a daily basis that we're going to make
[4:27:31] this a better town a better city a better place to live and we're going to
[4:27:34] accomplish some of the things that we all would like to see a a
[4:27:38] good high quality of life for our residents
[4:27:42] a good experience for our vacationers good successful
[4:27:46] profitable businesses in every industry in this community the ones that me and
[4:27:52] dewey participate in the ones that all the support industries destin's
[4:27:58] moving and growing good and and i think as long as we stay
[4:28:02] focused on good growth smart growth if we make that our
[4:28:05] priority and we're fixing all these it's kind of neat that we are talking about
[4:28:10] some of these file these little you know
[4:28:14] sores in our our legislation or our enforcement deal because
[4:28:20] we've really accomplished some of the really big stuff and so now we can start
[4:28:24] fine-tuning and i think you know our city manager and our staff i i think
[4:28:28] they're willing to we sure do need to get a new code enforcement guy
[4:28:33] and that's going to help us we're talking about a problem with joe's bayou
[4:28:36] and we don't even have a director of code enforcement so
[4:28:39] that's going to be kind of tough so i just want to i just wanted to end
[4:28:43] tonight's meeting an encouraging word that i think
[4:28:46] that that we're moving in a really good direction and it just seems to me as an
[4:28:51] observer to the council here that you all are focused on the right things and
[4:28:55] and we're going to make this place a better place to live so you know we had
[4:28:59] a great experience at arbor day you know the season's right around the corner
[4:29:04] we're rewriting our ldc i mean this city's been in effect for almost 36
[4:29:08] years and we're rewriting our ldc we got a zoning map a flume and a
[4:29:13] a new comprehensive plan that's all geared towards what i'm
[4:29:17] talking about is making this a better place to live and that's it's it's it's
[4:29:22] an honor to sit up here with the people that have made that happen and we're not
[4:29:26] done the ldc is being rewrote right now so any any more of these good changes
[4:29:30] that we want to make the next six months is going to be big
[4:29:36] and and our land use attorney and our community development staff is going to
[4:29:40] be very instrumental for us to getting to
[4:29:43] where our visioning sessions want to want to take us so
[4:29:47] anyways i just want to end up on a positive note and we will close with our
[4:29:51] land use attorney and then our city i have nothing thank you

[4:30:54] walton county you name it the demand's there i think we all know
[4:30:58] that supply is not place is growing florida's
[4:31:01] the got the 15th largest economy in the
[4:31:05] world projected population growth from 22 million to 26 million by 2030.
[4:31:10] they're coming like it or not but
[4:31:14] back to this particular adding a different layer to the zoning so
[4:31:18] let's take a 10 acre multifamily site for example 240
[4:31:24] units in this particular zoning right so you're telling me that at a 240 units
[4:31:29] you have to have 60 000 square feet of retail

[4:31:58] that the palm shopping center that went dixie's anchored by does
[4:32:02] that's the unintended consequence in my opinion i mean that's that's just
[4:32:06] context i was sitting back here thinking about it and
[4:32:10] quite frankly didn't leave because this i'm like wait this is like to understand
[4:32:13] it to put it into perspective that's a lot of retail who's gonna fill it
[4:32:18] it's gonna cost twice as much to build it that means your rents are going to be
[4:32:21] twice as high so who's going to come in and pay rosemary beach rents which i can
[4:32:25] tell you are ninety dollars a square foot or fifty
[4:32:28] dollars a square foot destin doesn't have those rents they'll they might we
[4:32:32] might get there but they're not there today
[4:32:35] so these are the things that you got to think about so this this this decision
[4:32:39] was made based on
[4:32:42] a dream of some really good projects
[4:32:46] but the fact of the matter is that the town centers are
[4:32:49] destined commons and the likes not not a 10 15 acre parcel that's my opinion

[4:33:31] little late on this but it's about the uh
[4:33:36] the short crystal beach i'm
[4:33:40] i've been looking at the plans and the on-site productions of
[4:33:45] what's going on there it's a over a 10 million dollar venture 4.4
[4:33:50] million and that's coming from the city of dustin the interlock agreement states
[4:33:54] that tourist development and tax
[4:33:58] is only partially funding it and it's not guaranteed in accordance with 9b and
[4:34:02] 9c there's two handicapped place
[4:34:06] parking places 27 golf cart parking places and 40 public i'm respectfully
[4:34:11] requesting the city of destin uh consider putting either local or
[4:34:17] florida tag only parking with the good comes the bad obviously
[4:34:22] there's benefits of tourism and then there's burdens of tourism one of the
[4:34:25] burdens a lot of locals have no beach access no beach
[4:34:29] uh vacationing positions or anywhere to go to enjoy
[4:34:32] and i realize henderson park uh
[4:34:35] is out there as a first-come first-served situation but if
[4:34:40] we're making this investment i respectfully request you consider at
[4:34:43] least dedicating a percentage of those parking places to either destin locals
[4:34:49] or florida tag only because i realize
[4:34:52] okaloosa county is also a 60 contributor of the funding
[4:34:57] but or at least consider that percentage
[4:34:59] whatever parking places you decide if you decide to dedicate make it a 60 40.
[4:35:04] 60 florida tag 40 dustin destin local that's all i have
[4:35:10] that's a great idea more
[4:35:14] as a recommendation for mr schmidt which is off a different subject
[4:35:18] the sheriff's okalusa county sheriff's department has a posse program where
[4:35:21] they get a uniform a badge and they can have a firearm they have authority to
[4:35:25] detain and transport maybe you make that a
[4:35:28] prerequisite for the position that that uh chose bayou

[4:35:46] talk to staff i'm like around all the time i'm just not here at this place
[4:35:51] um i just had a couple of things to mention marcy bell three gulf breeze
[4:35:53] court uh i just wanted to me i wanted to state
[4:35:57] that while you haven't seen me here i have definitely been in the buildings
[4:36:01] and i have definitely been sharing my information with everyone by
[4:36:07] email that kind of started back in february
[4:36:11] i was here at a meeting with staff and other members of holiday isle
[4:36:16] and i had asked the question about uh permitting
[4:36:20] and why one of the properties on my street was required to have four permits
[4:36:23] but yeah i had all this other construction going on with no permits
[4:36:27] for other people and at that time i was asked if i could
[4:36:30] give addresses and i did not give addresses at that time
[4:36:33] so that has led me to when there's
[4:36:36] construction i am i'm reporting it because
[4:36:41] the bottom line is is if you see something say something
[4:36:45] what's happening around destin or at least in my purview is that we have
[4:36:50] building going on the building department doesn't know
[4:36:53] about it because they don't come and get building permits and my biggest concern
[4:36:58] is in the town homes and of course i live in one people are going in they're
[4:37:02] doing electrical work they're doing water work uh plumbing work and they are
[4:37:07] possibly removing structural walls and when i'm in a building that i share with
[4:37:11] two other owners if they take out a structural
[4:37:15] wall it could affect my whole building
[4:37:19] i don't want to go to the extent of surfside but i certainly don't want to
[4:37:23] be in my bed sleeping one night when the building decides to fall in on me uh so
[4:37:27] that was one of the reasons that you guys haven't seen me but you hear a lot
[4:37:30] from me um
[4:37:33] i also want to state for the record that i am guilty of the conspiracy theories
[4:37:38] that go around town about this that and the other
[4:37:42] about staff about council about myself about other people like i just want the
[4:37:47] citizens who are watching to know that i am doing everything i can to educate
[4:37:53] myself to know what goes on inside these walls and the only way that i'm figuring
[4:37:57] out what's going on is by having meetings with people
[4:37:59] at the staff level and one of the staff members had made a
[4:38:03] comment to me the other day and they had said that ninety percent of the work
[4:38:06] that goes on at the city goes on outside these chambers meaning it goes
[4:38:12] on in the day-to-day business and if you don't know what's going on in there it's
[4:38:16] really hard to not jump to conclusions that
[4:38:20] somebody doesn't want to do their job or they're not interested or they don't
[4:38:24] care there might be that going on but we also have to give everybody their due
[4:38:28] respect that they're all here to do a job
[4:38:33] and i own it i own my own conspiracy theories about what i have considered in
[4:38:38] the past seven years of my participation like i've i've i own it and the only
[4:38:43] last thing i want to say as you saw me barrel in the door in the middle of this
[4:38:47] meeting was i was at home watching this meeting and you guys were talking about
[4:38:51] the waste management and there was a conversation about
[4:38:55] dedicating those and listen
[4:38:58] i'm not real good at regurgitating a lot of that stuff and i missed part of it
[4:39:01] because i was driving over here so with that being said i just want you
[4:39:05] to know that while you were discussing that this was a tax could be seen as a
[4:39:10] tax that storm water management at this time
[4:39:14] is not included holiday aisle is not included
[4:39:18] not any part of holiday isle from the gulf shore drive i call a holiday aisle
[4:39:22] from the sign behind it the city considers holiday aisle from
[4:39:26] the gulf shore drive 98 cross back
[4:39:30] none of that is included in storm water in the next five to ten year plan
[4:39:35] i voted for that to go through at lpa on thursday night i don't have a problem
[4:39:39] with that but when you start talking about how it's going to be a tax and
[4:39:43] everybody will get the benefit of it not none of holiday iowa will get the
[4:39:47] benefit of anything that's a tax that would go to storm water management in
[4:39:50] that particular case as a side note mr burgess also mentioned
[4:39:56] that they had talked about the swale program so at lpa i also had brought
[4:40:00] this same issue up and was told about the swale situation
[4:40:06] swale program and we talked about that being something
[4:40:09] that would be done out there but that is not storm water management so if you
[4:40:14] want to consider it a tax where that would go across for storm water
[4:40:17] management that does not include holiday aisle
