[0:22] A.C.U.I. have a question for you.
[16:30] Anybody? Just want to do a sound check and video check before we start. If you can hear me, or I should say, if you can't hear me, either raise or say something or maybe say something to chat or whatever, so that we know that you have some technical challenges. I would, I'm going to try to speak as loud as I can keeping the mask on. Also, if you can mute yourself.
[17:00] during the course of the meeting the entire time and that only unmute yourself before you want to say something
[17:08] when when allowed so by the chair and also please say your name before saying anything for the
[17:15] court reporter that's in the in the council chamber. So here with us is the chair,
[17:21] J. Cox, we have a court reporter, myself, Demir and then we have some staff members of a video crew
[17:28] and then there's some public here in the audience as well.
[17:32] So we will start shortly, the chairman will make some announcements at the beginning and we'll
[17:39] probably say the same thing to keep your mic muted until you have to say something.
[17:45] So we would appreciate your cooperation.
[17:46] This is our first one where we have quite a lot of people on, understandably, but we've
[17:51] done the Zoom meetings quite a few times, so hopefully we'll go find it.
[17:57] Thank you, thank you very much.
[21:57] All right. Good evening, everyone. The time is 7 o'clock. Like to call to order the January 10th, 2020, 2020, 2022, it's a tongue twister, session of the City
[22:15] of
[22:34] all this?
[22:36] Yeah.
[22:37] Commissioner, will there move?
[22:38] Can you guys hear me?
[22:39] Yes.
[22:42] Thank you.
[22:43] Commissioner, will there move?
[22:46] Here.
[22:47] And Chairman Cox.
[22:48] Present.
[22:49] We have four.
[22:50] Thank you, and as you say, we can check out
[22:52] with Commissioner Lopez.
[22:56] All right.
[22:57] First item on the agenda for this first agenda of 2022 is the approval
[23:02] of the meeting minutes from the December 6th, 2021 session.
[23:06] Are there any comments?
[23:08] If so, please state them now, or if not, the chair will entertain
[23:11] emotion for the approval of those meeting minutes.
[23:16] The minute, it says, Karen, it's Jones.
[23:20] Thank you.
[23:20] Second, this is Nancy.
[23:23] Excellent.
[23:24] We appreciate the first, the second, and the names with that.
[23:28] So staff, please call the roll.
[23:30] Commissioner Jones?
[23:33] Commissioner Abwali?
[23:36] Yes.
[23:37] Commissioner Magala? Yes. Commissioner Valdez? Yes. Commissioner Brilder
[23:44] Move? Yes. And Chairman Cox? Yes. Minister Approved, 60-0. All right, thank you.
[23:54] Right, next item on the agenda is the Chairman's opening statement. I want to
[23:59] take the opportunity to welcome all of you to this session. There are a few
[24:05] Well, five now, people who have joined us this evening in the council chambers, city staff,
[24:13] even the AV crew looks a little light tonight with just one person on will be relying on
[24:18] and you more so tonight than ever probably to make Zoom work, a court reporter, and then myself.
[24:26] So we're kind of light here in the council chambers, but we know we're joined by a lot of you on Zoom
[24:31] and we're glad that although COVID is appearing to rear its ugly head that we've got this
[24:39] technology that we can continue to do business in the city and that we actually have five items
[24:46] on the agenda tonight. So that's exciting. We're keeping things moving and this isn't going to keep
[24:52] us down. As I said, we get five items in the agenda and we'll hear more about each of those coming
[24:59] sometimes we...
[25:00] A little summary, but I think just moving on for the sake of time is probably good.
[25:06] As we kind of hinted at the start with a few of us here, this meeting will be run primarily via Zoom.
[25:14] So, if maybe you were on a few minutes ago, you might have already heard Demir say this, but if you're not speaking, please make sure your mics are muted, whether you're on the computer, on the phone, whatever it may be.
[25:25] I think at this point in time, we're choosing not to mute you because we don't want to make it difficult for you to unmute yourself when it's your time.
[25:33] So if you can keep your mic muted until you're recognized, so we call your name to go ahead and speak.
[25:41] We will ask for your patience, especially when it comes to the public hearing portion of these petitions, when we may say,
[25:48] you know, who member would like to comment now as your opportunity. If we've got a couple
[25:53] people speaking at the same time, we'll do our best to try to figure out, you know, who to
[25:58] recognize and hopefully everyone can just get along and do this in an orderly fashion, we'd
[26:03] appreciate it. I think the next thing to focus on, just to talk about the procedure is,
[26:12] although the media is different tonight,
[26:16] the procedure remains the same.
[26:18] That is, with these five petitions,
[26:21] we will look to city staff to open the petition
[26:24] to go through the staff report.
[26:26] Anything they'd like to highlight for us,
[26:28] as a commission will take the opportunity
[26:30] to ask questions of staff.
[26:32] At that point in time,
[26:33] we'll either call the petition or team up to the lectern
[26:36] or demirial introduce those parties.
[26:40] and the petitioner team can work out who's speaking, what order, and go through any
[26:47] comments they'd like to add. Again, as a commission, we will take the opportunity to ask
[26:51] questions of the petitioner team. And then we open the each petition up to public comment.
[27:00] And not knowing who is on each petition, or we'll like to comment for each petition, we'll
[27:06] start with the council chambers, and then we'll move to Zoom.
[27:12] Then once all the comments are heard, if there's anything that needs to be answered by the
[27:15] petitioner team, we'll give them an opportunity to answer those questions.
[27:19] And then as a commission, we will deliberate and make a motion to approve or deny.
[27:27] And the app following that, those will be our recommendations to City Council, following
[27:31] with that, there's typically two meetings for City Council and staff can direct you as to what
[27:38] those dates may be. This part applies more to the petitioner team. Tonight, as far as the commission,
[27:45] I think it again for the sake of order. I'm going to call the same order as we consider each motion.
[27:54] So, it starts with Commissioner Abwali, then Jones, Lopez, Megala, and Feldez and the World
[27:59] move. So if you commissioners can kind of be ready in turn, that would be helpful. I believe
[28:07] at this point in time then we can move on to the next item and that will be again a challenging
[28:13] one. But we will turn this over to the court reporter and I believe she has a fire in order
[28:18] how she would like those of you who would like to be, who member would like to speak tonight
[28:41] to
[28:46] We know everyone's going to do their best and tell the truth anyway, but it's an important
[28:50] part of the procedure, so we appreciate everyone jumping on board to run along with that.
[28:56] All right, we're going to move on now to item F, where we have our five items.
[29:00] The first is a conditional use at 10, 20 summit street, and do me a take it away.
[29:07] Thank you, Chairman Cox, and for the record, we do have proof of proper notice for this
[29:13] point.
[29:13] Good evening, everybody, here in the audience and at home.
[29:18] The first application is the application by David Schafer's Applicants and EREP
[29:23] cobblercrossing to LLC is property owner, who are requesting a conditionally used to establish
[29:29] a physical fitness facility of the property commonly referred to as 1020 Summary Street units
[29:35] A and B.
[29:41] So, the subject property is a 6,000 square foot tenant space within the multi-tent and
[29:50] multi-building cobbler processing shopping center, which is zone A, B area business district,
[29:57] and it's also part of the office.
[30:00] Our territorial road corridor overlay district. The shopping center is outlined in yellow on the slide. The subject tenant space is outlined in red. It's on the on the west end of the property. As you can see the properties to the west and to the south are also zone the same red shade and those are also zone commercial AB.
[30:24] The property to the west is vacant, but was recently approved for a mixed-use development
[30:29] known as the Bellicasa Square that will have 151 dwelling units and about 13,000 square feet of commercial space.
[30:39] And then to the south, our couple properties, one being vacant, the other one will improve with a medical office building.
[30:45] To the east and to the north are residential properties zone PRC plan residence conservation and those are improved with multifamily buildings.
[30:56] Here's a bird's eye view of the subject property in question. Again, the tenant spaces on the west end. There are two multi tenant buildings part of the shopping center. The tenant space are units A and D at 1020 summit building.
[31:11] The shopping center also includes the total of 517 parking spaces that are shared amongst
[31:17] all tenants.
[31:18] There are also three outlots along Summit Street to improve the bank buildings and one
[31:25] is the restaurant Taco Bell.
[31:28] Here are a couple of photos of the subject building.
[31:31] This was the space and the top left that was formerly occupied by a restaurant.
[31:36] So, the applicant is proposing to establish a physical fitness facility, any time fitness, within the
[31:44] 680 square foot space, those are the units A and B again.
[31:49] The proposed fitness facility would be open 24 hours a day to the members, staff would be present
[31:55] on site Monday for Friday from approximately 10 a.m. to 7 p.m., the facility would offer
[32:01] different types of exercise equipment and the variety of classes on the slide here is the area
[32:08] of the space that where the classes would take place, that it's known as the purple turf,
[32:13] that the classes held there would max out at 10 participants per class.
[32:20] The space is primarily open space. The applicant would create three individual changing rooms
[32:25] two of which would have shower facilities. There would also be two office, two office private
[32:31] offices for staff.
[32:34] The proposal is required to meet the standards for conditional use.
[32:39] Staff has provided our analysis of the standards in the packet, and we do believe that all
[32:44] applicable standards have been satisfied. Therefore staff recommends approval subject to the
[32:49] conditions outlined in the packet. We would that at the happy to answer any questions. The applicant is
[32:55] So here's his team that can address the commission.
[32:58] Thank you, we look forward to that.
[33:00] Starting with Commissioner Abwali,
[33:02] do you have questions for our staff?
[33:04] No, no questions.
[33:06] Commissioner Jones?
[33:08] No questions, thanks to you.
[33:10] Commissioner Lopez, are you with us?
[33:14] No, OK.
[33:15] All right, Commissioner Magala, questions for staff.
[33:19] No questions, thanks.
[33:21] Commissioner Valdez.
[33:25] Commissioner Willemuth.
[33:27] Questions?
[33:29] All right.
[33:29] Thank you.
[33:31] Then we'll invite the petitioner team to come on up to the
[33:36] lectern and tell us your thoughts.
[33:39] And although we made the request of those who are remote to
[33:42] state your name and give the address and everything if you could
[33:45] do that in turn, we would also appreciate it.
[33:48] Yes, please.
[33:52] It's my name is David Shaffer, it's 10, 20 Summer Street, Unit A and B in Belgium here.
[33:59] Sorry, first time a little nervous.
[34:00] We always say that's don't be nervous.
[34:03] I'm a person, you're a person.
[34:05] We're here to work through this, so take a breath and just tell us who thoughts.
[34:12] I mean, having my architect here today has helped all the lot, you know, going over the,
[34:17] What you guys had sent us, you know, the plans and everything and the reviews so far on it has made me at ease and everybody feels comfortable so far
[34:24] None of the committee have any questions for us right now. Makes me feel more comfortable.
[34:30] We're here to better the community, you know, if anything, that's what we're trying to do.
[34:34] So as at this point, I feel very happy right now.
[34:37] So other than that, I don't know how to express anything else.
[34:43] I have my manager here too, Amanda is here with us, so if there wasn't any questions,
[34:49] she's very knowledge in the business event with any time for seven years, so look forward
[34:54] to working with her too as well.
[34:57] Well we may have questions for you though, that initial round.
[35:00] On was just for city staff. Oh, okay, great. But I mean, whatever, yeah, no problem. Sorry, sorry.
[35:07] No, no, we're all good. It's like it's a little more difficult, so I think we all just got to work together.
[35:13] But definitely wanted to give all three of you the opportunity to talk about the project, anything that you want to add before we move to commission questions.
[35:21] Oh, so my name's Ben Paschitz,
[35:25] 91.36 May field and old blonde on the architect of record on the project.
[35:29] And I just want to say back up with David Satis,
[35:32] we view this project as a benefit to the community.
[35:35] It's not one of your big boxchains.
[35:36] It's a smaller, tight-knit group, a creates community.
[35:40] And given the state of the world, the state of the world,
[35:43] as everybody says, health and fitness is extremely important.
[35:47] And with the new residential that makes use
[35:48] going up next door. I think it's just a great advantage to great benefit to not only that,
[35:55] but you know, just the city of Elgin in general.
[35:59] All right, I think it was a man, right? Did you want to add anything?
[36:05] No, I think he said it perfect. Yeah, so perfect.
[36:10] Okay, I want to give all of you your fair opportunities.
[36:13] So,
[36:16] all right. Well, if you're concluded, then we'll ask the commission. So if you want to hold on one second, just in case there's questions from the commission Commissioner Abwali, do you have questions for the petitioners?
[36:28] I have 15 questions. No, I'm just kidding. You did great. I have no questions. Thank you. Thank you. Commissioner Jones.
[36:38] Now, this is right over in my neck and it was something looking forward to it.
[36:41] I hope everything goes smoothly for you while during the process.
[36:45] No questions.
[36:46] Thank you.
[36:46] Thank you.
[36:47] Commissioner McGell.
[36:51] Well, we can't let him off bad.
[36:52] Easy.
[36:52] I'll provide a question.
[36:54] So I see in the campsite gear from the franchise or corporate gear.
[37:02] There's slides here about security.
[37:03] You know, this is going to be open 24 hours.
[37:05] So can you tell us how you plan on keeping your customers safe and are you implementing any or I'll be security measures here in the slides provided?
[37:17] Amanda is very familiar with this. Can I have her incident?
[37:22] So yeah, none of that information was provided in the slides, but basically I'm one in the center of the facility. There will be an emergency. Sorry.
[37:33] They'll be an emergency wall, it'll have an emergency push button, it'll have an AEDD, and then there's personal security devices that work like life alerts.
[37:44] So if a member is alone inside of the facility, they can wear it around their neck, whether they're alone, have some kind of medical condition or something along those lines.
[37:54] And in addition to our security system is 24-7, it is reported, we can go back on it and search things if need be, but it also we have a tailgating system.
[38:05] Let us know, alert our phones if more than one person walks in without swiping their key five.
[38:11] So then we can take a look and see if there's a problem or if, like I guess, it's just coming in.
[38:19] So I hope that answers your question.
[38:22] And you said the entrance was key card, right?
[38:25] Correct.
[38:26] It's a key file, yeah.
[38:29] And how many cameras possibly do you have in the unit?
[38:33] That's to be provision security is going to have to figure that out once they get involved.
[38:39] We haven't got them involved yet, but for one of the other gyms we're working on,
[38:43] I think we had station three or outside, which actually added a fourth,
[38:47] And then we have some 360 angle cameras
[38:51] you can see from the center of the facility,
[38:55] usually going to put, well, the two are going
[38:57] in the other gym we're doing, but could be one or two
[39:00] in this one, but usually from every corner,
[39:02] I want to say 12 is what we had.
[39:04] We're going to say about 12.
[39:05] There's anywhere from like 12 to 25
[39:07] and locations.
[39:09] Now with the newer cameras, what are you talking about?
[39:11] It's more of like a bird's eye view.
[39:13] Right, yeah.
[39:14] And it gives you much more view of the gym
[39:16] in a single camera. So those are newer, so newer clubs don't need as many cameras.
[39:21] It's before correct.
[39:25] I know the fire department has some comments about the visual notifications.
[39:31] So that can get kind of a red light green light in terms of whether the bathrooms are occupied
[39:36] or how is that going to work?
[39:39] The bathrooms?
[39:40] I'm not sure.
[39:41] Oh, I don't know.
[39:42] The bathrooms change the rooms.
[39:44] the fight apartment and it's common so they wanted to have some sort of individual
[39:49] indicators, just describe those.
[39:52] I was going to say the bathrooms.
[39:55] Just like a hoard of potty per se.
[39:58] The lock will turn it on the outside.
[40:00] I think the fire department was looking for was they want the visuals, the visual arms, so the fire department wanted the visual arms, the strokes in the restrooms, which will provide a during program review.
[40:14] I think I think we've already addressed it.
[40:18] Good. Great, nothing further for me. Thank you. Thank you.
[40:22] Commissioner Valdez.
[40:25] No question.
[40:26] Can Mr. Walter move?
[40:29] Yeah.
[40:30] Just one quick question.
[40:32] How many, what do you expect is the kind of capacity during peak hours?
[40:39] And do you expect most of that traffic to enter in off of the wave relief?
[40:44] Drive line.
[40:45] I know there's a couple of busy intersections there.
[40:48] And with Joel there's trying to get a better sense of kind of the flow of traffic in there.
[40:53] I would, I would imagine it would probably be the waiver because it would close to that street with the lightly in there as well.
[41:02] As far as peak times, it's for clients who probably have the peak times that my previous facility was like five to seven a.m.
[41:11] And same thing in the evening pretty much like five to seven five to eight.
[41:14] But then again we're not like this huge facility.
[41:18] I would say our peak times we had anywhere from 15 to 25 people just kind of depends
[41:25] on when the class times are and every gym is going to be a little different as far as
[41:31] the traffic flow, but there's definitely no more than I would say 25 people in the facility
[41:38] at once. Yeah for my experience working out at any time I've noticed that it picks up pretty
[41:44] good around 4.35 in the morning and then by 7 o'clock pretty much everybody's out so it
[41:49] might even just be right before that morning rush or anything you know with school buses
[41:54] well give or take depends on the area but as far as leaving and then you're after school you
[41:59] know so that won't be a problem for any buses it starts around I'll see about the same time yeah
[42:04] five five yeah five seven so yeah but she's right I never had any more problem about 2025 max you know
[42:10] Yeah. And you work the busy place too. So yeah.
[42:15] Yeah. Thank you. Yeah. Welcome.
[42:18] I do not have any questions for you. So we appreciate you coming on up.
[42:23] If you take your seats now. Okay. Excellent. Thank you.
[42:29] And then at this point in time we'll open the petition up to the public hearing portion.
[42:35] So if there are those of you in the council chambers who would like to address this petition
[42:40] And now is your opportunity.
[42:43] Seeing head shake, no.
[42:45] For those of you online, is there anyone who would like to comment, now is your opportunity?
[43:00] Trying to give enough time here for people to hardly find their mouse on mute themselves
[43:05] and turn them on the cameras, but I'm not seeing that activity.
[43:11] So I believe we can safely close the public hearing portion of this petition then, and move
[43:16] on to staff for any final comments.
[43:21] Nothing further to add.
[43:23] Again, applications for conditional use.
[43:25] Staff believes that all applicable standards are met
[43:27] and staff recommends approval, subject to conditions
[43:30] outlined in the staff report.
[43:32] OK, thank you.
[43:34] So then at this point in time,
[43:35] the Chair will entertain a motion for petition 59-21.
[43:41] I move to recommend that city council
[43:43] approved petition number 59-21.
[43:47] on subject to the conditions outlined with our packet.
[43:50] And to adopt the findings of the commission,
[43:52] those findings also provided with the NAR packet.
[43:55] Thank you, sir. Second.
[43:57] Hi, thank you, Mac.
[43:59] All right, staff, please call the roll.
[44:02] Commissioner Willer-Muth?
[44:05] Yes.
[44:06] Commissioner Valdez?
[44:08] Yeah.
[44:09] Commissioner Abwali?
[44:11] Yes.
[44:12] Commissioner Jones?
[44:14] Yes.
[44:15] Commissioner Megala?
[44:17] Yes.
[44:18] And Chairman Cox?
[44:20] Yes.
[44:20] The motion is approved.
[44:22] 6 to 0.
[44:23] All right.
[44:24] Thank you for coming this evening.
[44:25] That'll be a recommendation to City Council.
[44:35] All right.
[44:36] We will do a reset here.
[44:38] Let's staff get the next petition pulled up.
[44:41] That is for 1,300 avidry.
[44:44] Petition number 660-2160-21.
[44:57] Okay.
[44:58] again for
[45:00] The record, we do have proof of proper notice on this one as well. Thank you.
[45:05] So, the second petition before you is the application by 1300 Abbott LLC as applicant, and Sunstar Pharmaceutical Incorporated as property owner,
[45:15] who are requesting a conditional use to establish an adult use cannabis craft grower,
[45:19] at the property commonly referred to as 1,300 habit drive.
[45:27] So the subject property outlined here in red is a 3 acre property
[45:32] on the north side of Abbott Drive.
[45:34] Approximately one quarter mile east of North McLean, Boulevard.
[45:38] The property is zone GI, generally industrial district,
[45:41] and as you can see, it is surrounded by industrial property zone GI
[45:48] on both west, north, and east sides, all surrounding properties are improved light industrial
[45:55] buildings.
[45:56] To the south across Abbott Drive is a residential community zone and that far multiple
[46:01] family residents district, which is improved with a number of two and a half story multifamily
[46:08] buildings.
[46:08] Those were built around 1960s.
[46:14] Here is a bird's eye view of the subject property again.
[46:16] It is improved with a 51,000 square foot light industrial building and includes an accessory
[46:23] parking lot with 56 parking stalls.
[46:27] The access to the property is provided with one full access driveway from added drive.
[46:35] As you can see, the property on the north butts railroad tracks, the Metro Railroad tracks
[46:40] to the north, the building is set kind of on the northern portion of the property and
[46:46] It has a 173 foot setback from the south, which is the front property line along Avidry.
[46:54] These are, here's an image of the building and how it's set far from the street as seen
[47:04] from Avidry.
[47:08] So the applicant is proposing to establish a don't use cannabis craft grower within the existing
[47:13] building.
[47:14] Just as a quick background, you may recall the state of Illinois first initially adopted
[47:21] rules to allow medical cannabis production and consumption within the state, and then
[47:27] follow that up.
[47:28] I believe in 2018 or 2019, allowing recreational cannabis consumption in the state.
[47:34] Subsequently, the city of Elgin adopted our own rules and regulations for what we call
[47:39] I don't use cannabis or recreational cannabis,
[47:42] both cultivation and for the spensories for sales.
[47:47] Those were adopted in December of 2019.
[47:51] Then in early 2020, the city received the number
[47:55] of applications for conditional use.
[47:59] I forgot to mention that all cannabis types of businesses
[48:03] are allowed as a conditional use in various zoning districts.
[48:07] the dispensaries are allowed in commercial districts along our
[48:11] territorial roads and downtown and come more cultivation centers.
[48:17] Those organizations are allowed in the industrial district of G.I. and ORIP.
[48:22] But they're all allowed as a conditionally use.
[48:24] So in the early 2020 as the state started receiving applications for these
[48:29] cultivation centers, craft growers, et cetera, the city also received several
[48:35] conditionally use applications to establish those businesses,
[48:41] however, then obviously
[48:43] COVID hit and the state of Illinois put their selection process on pause.
[48:49] That kind of dragged out until the end of 2020 and in 2021, and to this date, we've heard
[48:57] only from one applicant, which is the applicant tonight, that has received a license from
[49:03] state of Illinois. They initially applied to establish the craft rover with at 925
[49:09] Tolgate Road. However, because of the state of Illinois selection process took much
[49:13] longer than anticipated that property is no longer available. However, the applicant received
[49:19] the license and can now use the license to establish the craft rover anywhere else. So they
[49:24] have applied to establish the business at 1,300 avid drive.
[49:35] So the craft grower is a smaller production facility
[49:39] or a cultivation facility for growing cannabis.
[49:43] The applicant is proposing to establish a craft grower
[49:46] within the existing building.
[49:48] All operations would be within the existing building,
[49:50] nothing on the exterior.
[49:53] They're not proposing any significant changes to the site.
[49:55] In fact, they're only proposing to install a security fence, a six foot height.
[50:00] I fence around the perimeter of the building. The fence will end where the front of the building is. We'll kind of loop around from the east and west sides on this slide.
[50:12] The north is to the left, so the side property lines are on the top and on the bottom.
[50:19] They will also install new light poles and security cameras surrounding the building and a new monument sign along the street.
[50:28] Both are all three things defense, the lighting and the new sign will all comply with the zoning ordinance requirements.
[50:38] These are the details of the proposed fence.
[50:41] It's going to be a security fence, six feet high, sort of open design with the pickets bending outward.
[50:47] The light poles are on the top right, and then the proposed sign, the lower left.
[50:57] This is the proposed floor plan of the building.
[51:00] The applicant is going to complete substantial improvements on the interior to accommodate
[51:04] the new use.
[51:06] They have provided a motor control plan and an administrative that they will not emit any
[51:11] notches of odors.
[51:14] The applicant can initially have up to 5,000 square feet of cannabis plants growing canopy.
[51:22] The state allows that canopy to be increased and three increments per 3,000 square feet each.
[51:31] Up to the next one permitted 14,000 square feet of the canopy area.
[51:35] The applicant doesn't anticipate requesting these expanses in the future.
[51:39] all of that, however, will be within the existing building
[51:42] and they've indicated on the floor plan their phase expansion.
[51:48] The proposed hours of operation would be 8 a.m. to 6 p.m. Monday through Friday
[51:51] the applicant anticipates having 10 employees.
[51:56] The cannabis product pickup would occur once a week and it would be done by a state
[52:02] approved transportation company. No onsite consumption is allowed or proposed
[52:08] and no retail sales can take place on site.
[52:12] The city's regulations do not allow a dispensary
[52:17] to co-locate within the same building
[52:19] or the same property with other cannabis type businesses.
[52:22] So this facility can never become a dispensary
[52:27] for retail sales.
[52:31] The city also is part of our rules for cannabis businesses
[52:34] has adopted a restriction that these types of facilities
[52:37] have to be at least 250 feet from what's called a sensitive land use. The sensitive land
[52:43] uses our parks, schools, daycare, those types of facilities. And in this case the facility
[52:50] or the property is approximately or over 900 feet from the closest sensitive land use that
[52:56] being the wing park wing park that is to the east down at the dry.
[53:03] The properties required or the
[53:08] six on sites so the business will continue to comply with the Zoning Ordnance.
[53:14] The applicant has submitted safety and security plan as required by the city's cannabis
[53:20] ordnance, which was reviewed by our police department.
[53:24] They have recommended approval with a couple minor suggestions.
[53:27] First one being that the guards that they will be on site, which I've got to mention, and
[53:32] I'm sure the applicant will talk about that.
[53:34] They will have two security guards during the hours of operation and then one security guard when the facility is closed.
[53:41] The police department is recommending that those guards wear uniforms so that they can be identified in case of emergencies and if the police were to enter the facility.
[53:54] Police department also recommend that integrating surveillance video with the police department's video platform.
[54:01] The proposal is required to meet the standards for conditional use.
[54:06] Staff has provided our overview in the packet.
[54:09] We do find that all Apple Dispandors are satisfied,
[54:13] and therefore staff recommends approval subject
[54:15] to the conditions outlined in the packet.
[54:20] And all of those I'll just mention that the applicant will have
[54:24] to provide a state approval prior to getting a certificate
[54:27] of occupancy from the city.
[54:30] with that. Happy to take any questions. Thank you, Demir. Starting with a commission again
[54:36] questions for staff would start off with Commissioner Abwali.
[54:44] I don't have questions more.
[54:46] I run through all this information carefully. It seems like this whole operation is super
[54:52] super discrete. There's no any kind of signs or any kind of anything that says what's
[55:00] There, and there's no distribution whatsoever. Am I to understand all of that correctly?
[55:07] It is a very good assumption, and a summary sort of of their operations per code, all operations
[55:13] are required to be on the inside. And the applicant can speak further about their activities and business operations.
[55:29] Do you have any additional questions?
[55:32] No additional questions.
[55:34] Okay. Commissioner Jones, you're up.
[55:36] No questions. Thank you.
[55:38] Commissioner Magala, questions for staff.
[55:42] No questions, thank you.
[55:44] Commissioner Valdez, your turn.
[55:48] Excuse me.
[55:49] Why two guards during business hours and only one guard during that business hours?
[55:57] Seems like a more question for our applicant.
[55:59] I'll let them make a note of that.
[56:01] Hopefully they can answer that when the applicant comes up.
[56:05] Sounds like we have that question as well as one from Commissioner Boali.
[56:08] All right, Commissioner Valdez, do you have any additional questions?
[56:13] No.
[56:14] I could see the head shake.
[56:16] Commissioner Wilder moved.
[56:19] No, no.
[56:20] No questions.
[56:21] All right, I don't have any questions for staff.
[56:24] So we will now turn this over to the petitioner team for this item.
[56:32] So, whomever would like to lead that off, please,
[56:35] Again, State your name, give us your address and tell us your thoughts.
[56:41] My name is Anthony Carpino, I'm a 1,300 Abbott Drive in Elgin.
[56:50] I'm the owner of 1,300 Abbott LLC as well as Florida Arbor LLC, which is the license holder.
[56:58] 1,300 Abbott is the real estate owner of the property.
[57:03] Wilvee, which once the purchase has been concluded, with me today I have my team, which
[57:09] is Christopher Balln was my architect, Sean Panja, was my MEP engineer, Eric Pollin, who
[57:16] is our consultant, Riley Zelller, who was one of the executives of Floor Arbor, Andrew
[57:22] Volk, also an executive of Floor Arbor and owner of 1,300, Abadalse, Pat White, was a security
[57:30] consultant and Paul Canarty who is our attorney.
[57:35] We'll let them answer any questions that you may have regarding anything that you may
[57:43] want to ask.
[57:45] In order to answer the question that you initially post about whether or not our business
[57:50] is going to be discrete, you will not know that we are even there, we're going to operate
[57:55] And essentially, privately, we're there just to grow cannabis and produce products that are going to be sold to dispensaries for distribution to customers.
[58:11] We do not sell to the public directly.
[58:17] You know, and the other question regarding security, I'll let Pat White go into more detail on that, but the thought process of having the number of guards being too during the day when there's employees present is the fact that, you know, they're there to protect the individuals that are working within the facility at night, they will not be any individuals in the facility.
[58:41] And so that's why we had one guard on site keeping the lookout and patrolling the internal part of the facility and exterior part of the facility and reviewing the cameras at night when there's nobody on duty there.
[58:59] We'll open the floor to staff any questions or just like to also tell the staff you did a great job putting together the summary.
[59:10] And like I said, any questions where we're willing to open and what really the answer.
[59:15] And we can certainly move into questions from the commission to the petitioner team, but it's also wanted to ensure that anyone on the petitioner team,
[59:24] who wanted to tell us your thoughts now and that was a great time for that.
[59:34] The operators of various dispensary processors and cultivation facilities in nine states.
[59:44] I let Andrew Go was my partner going in a little bit more depth there, but we're just looking
[59:49] to be a good steward, you know, building an environment-friendly building and get back to the community.
[59:58] I'm talking a part of our plan.
[1:00:00] This is to have a community garden within the facility where we go for roll fruits and vegetables, and then we donate those fruits and vegetables to show local community shelters and or also give them a way to the public in any way that the village feels is the right method to do that.
[1:00:23] as well as we also are looking to hire individuals from the local community, especially those that live in social and impact areas.
[1:00:38] And if you want to give your thoughts, please go ahead.
[1:00:43] Yes, in addition, I guess I really kind of highlight the tax revenue that the city gets with our presence on operating.
[1:00:56] as an approved operator as well, and to kind of further, and these additional comment
[1:01:03] earlier, it's absolutely, you know, our prior, our number one priority to make sure that
[1:01:10] we are to screen. I own several Canada's businesses throughout the country and the number
[1:01:18] one, the number one feedback that we always get from various mayors, and our city council
[1:01:24] or the trustees is, there's no complaints, there's no issues, it's very, very quiet and
[1:01:30] when random people come by for inspection. The comment that we always loved to hear is
[1:01:35] no one knew that this existed and nobody knew that what our business is. So, I can, you know,
[1:01:43] I'm behalf of all of us, committed to that level of privacy and the lack of promotion,
[1:01:51] and we're not trying to draw any more attention to ourselves.
[1:01:59] All right.
[1:02:00] I would like to have one further comment on the security aspects
[1:02:05] regarding this business.
[1:02:06] And the operators is that I've worked with these operators in the past
[1:02:12] at different locations both in the cannabis growing space
[1:02:17] and the cannabis retail space.
[1:02:20] And no instances of their business in the last five years
[1:02:24] in the state of Illinois, nor in any of the other states have they ever received any complaints whatsoever regarding security procedures or incidents after properties.
[1:02:35] In fact, at the one retail location that I was involved with the planning of and five years in operation, it was used as a standard for the state of Illinois for their security processes procedures.
[1:02:51] and new operators were brought to that location as an example of how an operation should be
[1:02:59] run.
[1:03:00] There's nothing but the highest standards of security and compliance with any rules, regulations,
[1:03:08] both the villages and cities that the operations have been in contact with or in the states
[1:03:16] that the operations have had businesses in.
[1:03:23] And as to the question about the security guards,
[1:03:26] the reason for two guards during the day
[1:03:28] is that that's when most of the activity will occur
[1:03:32] for either career movements in and out of the building
[1:03:35] as well as employees in the building
[1:03:40] and to secure outside and inside parameters
[1:03:43] where, as during the evening hours, the electronic systems within the building, which is laid out in the security plan,
[1:03:51] are utilized for one operating, one security person to be able to monitor the entire situation.
[1:03:59] And also have availability of panic situations.
[1:04:02] Should there be some type of outside threat that would occur in the property?
[1:04:08] Thank you.
[1:04:09] All right, we appreciate the testimony of that last settlement, but it's also important
[1:04:14] to remember as we request that the start of you could please state your name and give it
[1:04:18] your address for that. So for the court reporter that was Patrick White for that last part
[1:04:24] of the Petitioner's testimony. All right, did you have anything else?
[1:04:33] No, I could supply it with my address. My address for my company is 2106 Seminole Drive Huntsville,
[1:04:41] Okay, to the core reporter. I'm sorry. There was something else.
[1:04:47] Andrew's last name is is ho. H-O. Yes,
[1:04:54] understood. All right, sorry. We're a little sidebar conversation here with a
[1:04:58] core reporter trying to get everything in the-
[1:05:00] Transcript for counsel and for future records. All right. Moving on now, anyone else on the petitioner team
[1:05:07] that wanted to add to the testimony before we move on to the commission questions?
[1:05:19] All right. Anthony, you're you're good with the testimony given thus far?
[1:05:26] Yes, sir. All right. So then we will move on to the commission and give questions, the
[1:05:34] opportunity for questions to be asked again, starting with Commissioner Abwale.
[1:05:40] You answered my question. Thank you. No other questions. All right. Commissioner Jones.
[1:05:48] No, sounds like the pan I was going to ask you and I think Anthony spoke a little bit to the
[1:05:56] And you spoke a little bit about the fire me, so thank you for addressing those excited, I'm excited to have you in town, hopefully.
[1:06:08] Great, thank you.
[1:06:10] Right, Commissioner McGala, questions for the e-partitioner team.
[1:06:14] One, we're related to security in terms of what I saw on the plan.
[1:06:19] Um, those will be a secured gates, whether it be a guard station at the gate, or I was
[1:06:24] the traffic, especially in the courier is regulated, a flow of that.
[1:06:29] And again, when you answer, uh, whoever that's going to be, please state your name, um, before
[1:06:33] you start.
[1:06:34] You don't have to go through the address again, but please just state your name.
[1:06:40] Patrick White, there will not be a guard at the gate.
[1:06:45] Um, it's a electronically controlled from the command post and with a video camera and, uh,
[1:06:52] communication systems to the gate?
[1:06:57] Okay, and then in terms of deliveries, what's
[1:07:00] anticipated delivery schedule in terms of numbers per week and hours during the
[1:07:05] day, you can kind of provide that.
[1:07:16] This is Anthony Carpino. The deliveries are
[1:07:19] going to be random, no more than one or two deliveries, typically per week, and
[1:07:26] they're going to be a random hours, and that's for a purpose of security.
[1:07:32] And they're
[1:07:32] during the business hours only.
[1:07:35] That was my follow-up question was, was the business hours after hours.
[1:07:38] Thank you.
[1:07:39] Nothing further.
[1:07:41] Thank you.
[1:07:42] Any questions from Commissioner Valdez for the team?
[1:07:49] Commissioner Weldermooth.
[1:07:51] Questions?
[1:07:53] All right.
[1:07:53] I do not have any questions for the petitioner team.
[1:07:57] So at this point in time, then we will open this petition up to public comment.
[1:08:06] So, see staff moving to check a sign-in sheet, probably just for due process, but we're
[1:08:12] just looking at this point in time for anyone who's on Zoom to take the opportunity to
[1:08:20] speak.
[1:08:21] So, if we can do this in order to be fashion, I'm not sure who's, who maybe, like, looking
[1:08:27] to speak at this point in time, but now is your opportunity.
[1:08:35] We've got a Kate, a Mark, Jeff, Harold, and I know some of these are on the Commissioner
[1:08:41] team or maybe for future of for another petition, David, Andrew, Atole, Palina, Jolene,
[1:08:50] Sean, and then a calling number.
[1:09:02] I'd like to do the joking going once, going twice,
[1:09:08] all right, I will say sold, we'll close
[1:09:11] the public hearing portion of this petition then and look back to staff for any final
[1:09:18] comments you'd like to offer.
[1:09:21] Nothing further to add staff has provided our overview of the application, but the findings
[1:09:26] effect.
[1:09:27] We do believe that all applicable standards are satisfied, so staff recommends approval
[1:09:31] subject to the conditions in the staff report.
[1:09:35] Okay.
[1:09:36] Then at this point in time, the chair will entertain a motion for petition 60-21.
[1:09:41] I'm sorry 60-21.
[1:09:45] We'll to recommend that city council approve petition number 60-21 subject to the conditions
[1:09:51] outlined within our packet and to adopt as the findings of the commission those findings
[1:09:57] also provided within our packet.
[1:10:00] This is Nancy of Wally. Thank you, is there a second?
[1:10:06] A second. This is Karen.
[1:10:09] Thank you. Staff, please call the roll.
[1:10:13] Commissioner of Wally?
[1:10:15] Yes.
[1:10:15] Commissioner Jones?
[1:10:17] Yes.
[1:10:18] Commissioner Megala?
[1:10:20] Yes.
[1:10:21] Commissioner Valdez?
[1:10:24] Yeah.
[1:10:25] Commissioner Wildermooth?
[1:10:27] Yes.
[1:10:28] And Chairman Cox?
[1:10:29] Yes.
[1:10:30] That motion has approved, 60.
[1:10:34] All right.
[1:10:35] Thank you.
[1:10:36] And to the petitioner team again,
[1:10:38] that'll be our recommendation to City Council.
[1:10:40] And work with staff as to what the next dates are for that part of this petition to move forward.
[1:10:49] All right.
[1:10:49] We're going to reset here again.
[1:10:51] Move on to the first condition that used in text amendment.
[1:10:55] This is for 107 East Highland Avenue.
[1:10:57] There's a couple of petitioner and petition numbers associated with this.
[1:11:01] But to my fellow commissioners, you may have noticed my architecture permit provided the petitioner and city council.
[1:11:08] I'm sorry city staff with a code analysis letter for the subject space.
[1:11:13] So I will need to recuse myself from this petition.
[1:11:16] So at this point in time, I'd like the commission to appoint a chairperson.
[1:11:23] To appoint Commissioner Magala, this chairperson for this petition.
[1:11:29] Thank you, sir.
[1:11:29] Is there a second?
[1:11:33] Second mission of Eldez, staff, please call the roll.
[1:11:40] The fourth time for this upcoming petition,
[1:11:44] 52 and 21 and 60, 21 regarding 107 East Highland.
[1:11:48] Commissioner Jones?
[1:11:51] Yes.
[1:11:51] Commissioner of Eldez?
[1:11:54] Yes.
[1:11:55] Commissioner of Wally?
[1:11:57] Yes.
[1:11:58] Commissioner of Magala?
[1:12:00] Austin.
[1:12:02] Commissioner of Wildermouth?
[1:12:04] Yes.
[1:12:05] And Chairman Cox?
[1:12:07] Yes.
[1:12:08] The motion is approved five to zero, but one abstention.
[1:12:16] Thank you, Chairman Cox.
[1:12:18] And thank you, fellow commissioners.
[1:12:21] All right.
[1:12:22] So first up, we have the city presenting the petition.
[1:12:25] Do we have
[1:12:32] proper notice as well?
[1:12:33] We do have a proper notice for the record.
[1:12:38] So this next petition is the application by Amy Porter Art Incorporated.
[1:12:42] As applicant and coming holdings LLC is property owner who are requesting to amend title 19 zoning of the
[1:12:50] Elgian Municipal Code to modify the zoning ordinance regulations for tattooed parlors within the art arterial road corridor or
[1:12:56] Relay District and a conditional use to establish a tattooed parlour on art gallery and a commercial event space for activities pertaining to the assembly of people at the property
[1:13:08] commonly referred to as 107 East Highland Avenue.
[1:13:14] So here is the subject property.
[1:13:19] Again, we'll start at the map.
[1:13:21] This property outlined in red is located downtown Elgin
[1:13:25] at the southeast quarter corner of East Highland Avenue
[1:13:29] and north-growth Avenue.
[1:13:31] The subject tenants base is the 2200 square foot space
[1:13:35] on the second floor of the existing two-story building.
[1:13:41] As you can see, the properties, the properties on CC1
[1:13:44] center city district, as well as it falls under ARC,
[1:13:49] arterial road corridor or related district,
[1:13:51] being that East Highland Avenue is arterial roadway.
[1:13:56] As you can see, the properties to the west, south, and east
[1:14:00] are also zone CC1 in the same shade of sort of reddish color.
[1:14:03] To the west is the former two-story P&C bank building that recently was approved for the adaptive reuse of that building as a dormitory for Jesse University.
[1:14:15] To the south is a parking lot also owned by the same property owner as the subject property.
[1:14:21] And then to the east is a two-story building that is currently vacant.
[1:14:26] To the north is the surface parking lot owned by the city zone CF Community Facility District.
[1:14:31] Here are a couple photos of the existing building.
[1:14:35] The building is considered contributing to the downtown historic district.
[1:14:40] It was constructed in 1885.
[1:14:43] It is built to the lotlines and is known as the Be Hagelow building.
[1:14:48] Who at the time was the boiler and the distributor for the PAPs Brewing Company.
[1:14:54] So the ground floor of the building was used as a tavern for many years.
[1:15:00] Most recently, as a few days ago, I believe the ground floor was occupied by the red poppy beast for a restaurant. The second floor is vacant.
[1:15:12] So the opening is proposing, first to amend the regulations within the arc corridor, the arc arterial overlay districts, and then requesting a conditionally use for the tattoo parlor.
[1:15:23] First, regarding the text amendments, so all properties adjacent to arterial roadways are subject to the restrictions within the arc, and there are a number of land uses that are not allowed on properties that are affronting on these roadways.
[1:15:45] So one of those land uses that is not allowed is a tattoo parlor.
[1:15:50] So you may recall that we have three other tattoo parlor's downtown because tattoo
[1:15:54] parlor's are allowed as a conditionally used in the CC1 district as well as the CC2 district.
[1:16:01] So the applicant is proposing to amend those regulations within the arch to allow tattoo
[1:16:06] parlor's to establish above the ground floor essentially east of the river.
[1:16:13] So the East Highland Avenue corridor east of the river.
[1:16:18] And then in combination with that,
[1:16:19] they're requesting, initially, you
[1:16:21] should approval to establish the tattoo
[1:16:23] parlor with the art gallery and event space.
[1:16:31] This is the proposed second floor plan with the proposed improvements.
[1:16:38] The tattoo parlor would have four separate artists studios.
[1:16:41] It would be a woman-owned and woman-operated tattoo parlor and business.
[1:16:50] It would provide services only by appointment, Monday through Saturday from 10 AM, approximately
[1:16:56] to APM, they would not do walk-in service.
[1:17:03] They would also not provide any body piercing services.
[1:17:07] The proposed tattoo parlor would comply with all requirements of the Illuminant Department
[1:17:11] of Public Health.
[1:17:12] In addition to the tattoo parlor, the applicant is proposing to also have a art gallery space that would organize different art exhibitions throughout the year, initially they would start with four such exhibitions at the beginning of each season with the hopes to increase those the ones per month in the subsequent years.
[1:17:34] In addition to those art exhibitions, the applicant is also hoping to organize our focused
[1:17:41] events, only a select few type of events, such as paint and draw nights and fundraisers,
[1:17:49] different types of creative workshops, essentially the ideas to invite artists into the space
[1:17:55] to create ARC together. Due to the space limitations, the events can only have up to 20 participants
[1:18:03] that will be the maximum of occupancy. And the applicant has indicated they have no plans
[1:18:08] to serve any food or drinks, including alcohol, at these types of events. The applicant
[1:18:16] is not proposing any interior change, or I'm sorry, exterior change that are building and
[1:18:20] minor interior build-out to accommodate the new use. The proposal for
[1:18:26] conditionally use is required to meet the standards for conditionally use. We've
[1:18:30] provided our overview of the standards in the packet and staff believes that all
[1:18:34] applicable standards are satisfied, therefore staff recommends approval, subject to
[1:18:39] the conditions outlined in your packet. Did that open to any questions?
[1:18:47] Thanks, Tamir.
[1:18:48] We'll take it from the top off a bit of quarter.
[1:18:50] We'll continue that trend.
[1:18:52] So first up, Commissioner Boile any questions for the city?
[1:18:55] No questions from me. Thank you.
[1:18:58] Commissioner Jones.
[1:19:03] Did you say the building to the east of this is vacant?
[1:19:08] And the west is the Judson remodeled building that they're doing, right?
[1:19:12] That's correct.
[1:19:13] Across the alley to the east, the two-story commercial building that I believe is vacant.
[1:19:17] Okay.
[1:19:19] Okay.
[1:19:20] Thank you.
[1:19:21] You're welcome.
[1:19:23] Anything else?
[1:19:25] No, nothing else.
[1:19:26] Thank you.
[1:19:28] All right.
[1:19:28] Commissioner Lopez
[1:19:34] is not present.
[1:19:36] He didn't indicate that he's not going to.
[1:19:39] Okay.
[1:19:40] Commissioner palace.
[1:19:43] No question.
[1:19:45] Thank you.
[1:19:46] Commissioner Wilbur.
[1:19:47] I have questions.
[1:19:50] I do have a question.
[1:19:52] And in terms of the negative spread more from the positioner,
[1:19:56] between all where the space is going to be and what it's going to be.
[1:20:05] Yes, if you can see the slide show, the floor plan of the space shows four artists studios and in the middle would be the sitting area. That sitting area would be sort of the multipurpose space that would be used for art exhibits and then various types of events.
[1:20:25] I've got it.
[1:20:28] I've got nothing further from the city.
[1:20:30] The wall on the right up the petitioner.
[1:20:32] And then they can maybe follow up and just confirm that question.
[1:20:36] And then offering you the thoughts on the petition.
[1:20:50] I can't see council chambers to the petitioner president.
[1:20:53] Oh yes.
[1:20:54] I'm here.
[1:20:54] Sorry.
[1:20:56] I mean.
[1:20:57] Yes.
[1:20:59] Thank you.
[1:20:59] Thank you.
[1:21:03] I am Amy Porter, a 2,500 Candle Cancer Field Park Bait East, West Sunday.
[1:21:10] I am the founder of Elkney Tattoo and Gallery.
[1:21:13] We opened in 2020.
[1:21:16] We are currently located in Arlington Heights.
[1:21:19] At this point, we do have two artists,
[1:21:23] and we're hoping to expand to work professional artists at our establishment.
[1:21:27] And we're wanting to relocate to Elgin on just because of the artistic hub.
[1:21:33] that it is. I have experience with Elgen. I was a previous art space president for four years.
[1:21:42] And in that time, I was able to participate in various art events,
[1:21:46] had high-street studios, art space, I did life painting events,
[1:21:52] and I was also, I also vended at Nightmare on the Chicago Street.
[1:21:59] So it was really an amazing opportunity for me as an artist
[1:22:03] to really get involved and enjoy the community events
[1:22:06] that are out there for us.
[1:22:08] So I feel like my establishment
[1:22:10] can add to just the elements of Elgin
[1:22:13] and that artistic hub that it's really become.
[1:22:20] Do you have any other members of your team
[1:22:21] or is it just to talk about the petition?
[1:22:26] So I'm here, and then the building owner is also here.
[1:22:30] So Andrew coming.
[1:22:35] Any other comments before we open it up to questions from the question?
[1:22:44] Did you ask a question?
[1:22:45] No, no, no, no.
[1:22:46] I was asking the supporters.
[1:22:47] She had any questions.
[1:22:48] I'll open it up to you.
[1:22:56] Do I have to start other questions then?
[1:22:58] Can you share your body?
[1:22:59] No questions, thank you.
[1:23:02] Mr. Mayor Jones.
[1:23:08] Can you share about that?
[1:23:10] No questions.
[1:23:12] Can you share all of them?
[1:23:14] No questions.
[1:23:18] That's the same question that I asked the city.
[1:23:20] to confirm the location of like the exhibit space and how you'll convert the space that's in the
[1:23:25] site plan, which is, you're kind of really dictated more for, you know, the tattoo used into the
[1:23:31] yard and the exhibit space. So the exhibit space would be in that seating area. So for example,
[1:23:39] if we're going to have an artwork shop or a drawing and painting night, we would just bring out
[1:23:44] holding tables that there's up with holding chairs.
[1:23:47] So we can work at tables together, so.
[1:23:53] Great.
[1:23:54] I'd nothing further.
[1:23:55] So at this time, we can open it up to the public.
[1:23:59] Does anybody assigned in the mirror?
[1:24:02] Nobody's back to.
[1:24:03] Yeah, nobody's come on this position.
[1:24:06] Sorry, nobody signed in.
[1:24:07] And nobody's here in the Calth Chambers with us.
[1:24:12] OK.
[1:24:13] Great, good.
[1:24:14] The mirror, if you can provide the city summary then.
[1:24:19] staff has nothing else to add on this petition. We provided our overview in the packet. It's a dual type of
[1:24:27] application. First part is for the text amendment. The second part is for conditional use.
[1:24:32] We found that the applicable fairness are satisfied and therefore staff recommends approval
[1:24:37] subject to the conditions in the packet. And we can't, we can take the one motion for both
[1:24:43] that would be great.
[1:24:46] Okay, yes.
[1:24:46] So just as a reminder,
[1:24:48] the petition is to amend the zoning,
[1:24:53] as well as the conditional use credit.
[1:25:00] Is that correct? That's correct. Any discussion from a commission? Otherwise, I'll entertain a motion as to approval of the petition,
[1:25:15] decisions in this case.
[1:25:21] Anybody other commission want to make a motion?
[1:25:22] I can
[1:25:26] make a motion, this is Jordan.
[1:25:31] I know you're recommending that City Council approve,
[1:25:33] petitions, 52, 21 and 62, 21,
[1:25:38] that subject of the conditions outlined within our packet
[1:25:40] and to adapt as the findings of the commission
[1:25:42] of the findings also provided with our packet.
[1:25:46] Great, thank you, is there a second?
[1:25:48] Are you seconded?
[1:25:51] Great, seconded by the commission of rural.
[1:25:54] All right, any discussion on the motion?
[1:26:05] The Mayor, please call for the vote.
[1:26:10] Commissioner Willermuth?
[1:26:13] Commissioner Valdez?
[1:26:16] Commissioner Abwali?
[1:26:18] Yes.
[1:26:20] Commissioner Jones?
[1:26:21] Yes.
[1:26:23] And Chairman Pro Tem Negala?
[1:26:26] Yes.
[1:26:27] The motion is approved five to zero.
[1:26:30] Gradulations of your recommendation to City Council.
[1:26:34] Thank you so much.
[1:26:36] Welcome.
[1:26:49] So, Mr. Chair and Cox, we'll be joining us today for Zoom.
[1:26:54] Absolutely. Looking forward to it.
[1:26:56] But thank you for, for walking us through that one.
[1:26:59] It's double done.
[1:27:01] Chair, thank you.
[1:27:03] All right. We can now move on to the next petition.
[1:27:07] We're already at the number four for the evening.
[1:27:10] At 640 Ville Street, petition 56-21.
[1:27:14] The Mayor, take us away when you're ready.
[1:27:24] For the record, we do have proof of proper notice on this one as well.
[1:27:28] Thank you, sir.
[1:27:30] This petition is the application by Andy Patel and Kona Incorporated.
[1:27:38] Beeping Patel as property owner, who are requesting approval of a plan development as a conditional use with
[1:27:44] departures from the Elgin Municipal Code requirements for a fence and any other departures
[1:27:49] as Navy S-Siri or desirable for adaptive reuse of the existing motor vehicle service station
[1:27:54] as a package, liquor sales establishment, at the property commonly referred to as 640
[1:27:59] Villa Street.
[1:28:04] So, the subject properties located on the east side of Elgin, outlined here in red, it is approximately
[1:28:12] 1600 square feet in area located in the north west corner ofville
[1:28:18] Street and Illinois Avenue. It is improved with a gas station with this small
[1:28:23] convenience store. As you can see, all properties of the northeast west
[1:28:28] and south are shaded in the same colors. They're all zone the same. This
[1:28:31] is the NB neighborhood business district. The properties alongville
[1:28:35] Street are also part of the arc, arterial road corridor, or
[1:28:38] district to the north and to the west or two single family homes to the east is a two
[1:28:45] story building that is home to Iglesia apostolic at the Christoph church and to the south is a single
[1:28:54] family home and a one story commercial building home to a food store. Here are a couple this is the
[1:29:03] The bird's eye view of the properties looking to the north, as you can see, the property is mostly improved with the vehicle use area servicing the gas station.
[1:29:14] Gas station includes a canopy over fuel islands close to the villa street and the existing 12 on the square foot convenience store.
[1:29:24] A couple photos of the sites, what it looks like today, the property, does have access to both
[1:29:31] Illinois Avenue on the east and access to villice street, as you can see, the majority of
[1:29:38] that front-age along villice street is all the press curb full access into the gas station.
[1:29:45] So, the applicant is proposing adaptive reuse of the existing property as a package liquor store establishment.
[1:29:55] The applicant would remove the canopy, the pump, the islands and the underp-
[1:30:00] Ground tanks, clean up any contaminated soil, and then renovate the existing building for a package
[1:30:07] liquor sales establishment. The parking lot would be reconstructed entirely, and the vehicle use
[1:30:13] area would be reduced slightly. There would be five parking spaces for employees and customers,
[1:30:20] and then one loading space in the back of the building.
[1:30:26] In addition to the reducing the
[1:30:27] In pervious vehicle use area, on site the applicant would install permeable pavers, primarily on the west north and east sides of the building to further reduce the stormwater runoff.
[1:30:43] The applicant would keep the existing full access driveway to Illinois Avenue, but they would completely reconstruct the access to villas street.
[1:30:51] All that depressed curve would be removed and instead a normal full access drive wave would be constructed.
[1:30:59] The applicant also reconstruct the existing public sidewalk that goes along villas street through the driveway and across the entire front page along villas street.
[1:31:10] The connections from the building to the sidewalks would be constructed on both sides to both sidewalk along villas and the one along Illinois Avenue.
[1:31:20] New landscaping will be installed throughout the site and compliance with the zoning ordinance.
[1:31:26] That includes five street trees as you can see.
[1:31:30] Three along the east side along Illinois Avenue and two along Villa Street.
[1:31:36] The applicant would also install a new code compliant monument sign in the southeast corner of the property.
[1:31:43] The building improvements include all new brick masonry on the exterior.
[1:31:48] The Upton would also install a new storefront windows on the south side of the building, with the main entrance to the
[1:31:55] liquor sales establishment would be, and then one new window on the east side of the building.
[1:32:02] A new masonry enclosure would be constructed in the back of the building, for refuse, and that enclosure would match the masonry of the building.
[1:32:12] This is another view of the closed building, as seen from below street.
[1:32:19] The applicant is required to obtain a liquor license, if the zoning approval is, or the
[1:32:27] zoning application is approved, and that liquor license must be obtained prior to start of
[1:32:32] any alcohol sales on the property.
[1:32:34] The proposal has one departure from the zoning ordinance, and I'll try to show that's the best on this landscape plan.
[1:32:45] The applicant has agreed to install a six-foot solid fence that essentially is going to be on the west property line.
[1:32:55] from if you can see my cursor from generally this point northward it's going to be installed
[1:33:02] on top of the existing retaining wall. Six foot solid fence to screen the property from the
[1:33:08] adjacent single family home that is to the west. And then similarly a six foot high fence would
[1:33:13] be installed along the north property line and that fence extends a little bit past the building.
[1:33:19] So it's the portion of the fence that is east of the building that requires the departure
[1:33:24] and similarly portion of the fence that is south of the building that requires the departure.
[1:33:30] In those areas east and south of the building, those are street yards for only a four foot
[1:33:36] high open design fence is allowed and obviously they are proposing six foot height fence.
[1:33:44] That's the only departure. The proposal is required to meet the standards for planned
[1:33:48] developments and standards for conditional use.
[1:33:53] We provide our findings of fact for the standards in the report.
[1:33:57] We do believe that all applicable standards are satisfied and therefore staff recommends
[1:34:01] approval, subject to the conditions outlined in your packet and of those conditions.
[1:34:07] I'll note a couple that no consumption of alcohol will be permitted on site and that the
[1:34:12] applicant would not be able to sell individual containers of beer and malt beverages that
[1:34:18] less than 750 milliliters with that I would open up to any questions.
[1:34:24] Thank you.
[1:34:25] We appreciate that even highlighting those last couple items and to my recollection those
[1:34:30] are pretty standard for maybe those of you listening at home or for this is if this is new for you.
[1:34:37] So they're being quite fairly applied so appreciate that description.
[1:34:42] questions now from the commission for city staff. We'll starting with Commissioner Abwale.
[1:34:50] No questions. Thank you. Commissioner Jones.
[1:34:56] Thank you.
[1:34:58] Commissioner Jones.
[1:35:02] We're moving right online here, so thanks to me.
[1:35:06] You're welcome.
[1:35:08] Commissioner Magala, you're out.
[1:35:11] But do you come on I'm parking.
[1:35:13] I know there's only five stalls, and there are parking study done.
[1:35:18] Or in terms of the safety and sense of the use.
[1:35:21] And the car is coming and going, and respect to the clerk.
[1:35:24] Yeah, they're only required.
[1:35:25] I mean, it's a very small building.
[1:35:26] It's 1200 square feet, and it's like,
[1:35:28] and leaders sales have us going to like any other retail stores required to provide one parking space
[1:35:33] for 250 square feet of floor area. So they're only required to provide five parking stalls and that's
[1:35:38] how many they're proposing. They have space to add more if necessary but building of this size and
[1:35:46] type of this business generally does not have a large peak parking demand based on other comparable
[1:35:53] facilities and so five parking stalls with one employee are more than sufficient to satisfy
[1:36:00] the needs of this facility. Okay, and then in terms of the sense, we have a division of that,
[1:36:07] what pages that I have in our PDA. There are images of the fence part of the the rendering's
[1:36:14] provided. It's just noted as a six for high solid fence on the plans. This probably are the plans
[1:36:22] that showed the best in here, yeah, it's a simple six-foot solid sense.
[1:36:31] Okay.
[1:36:32] I'll be right up for the city.
[1:36:35] Okay.
[1:36:36] So moving on, Commissioner Valdez.
[1:36:40] Thank you.
[1:36:42] Thank you.
[1:36:42] And Commissioner Willemuth.
[1:36:44] Good luck, please.
[1:36:46] All right.
[1:36:48] I only have one question for staff.
[1:36:50] is the to your knowledge or maybe this is for the petitioner is the the fence for what is the fence for is it for light noise sight lines yeah typically yeah
[1:37:05] typically the fence is required to separate commercial and residential areas in this case uh
[1:37:11] the properties both north and west are zone commercial but they are improved residential uses so the
[1:37:16] as a degree to install the fence as a sort of a good practice to be good neighbor considering
[1:37:22] that this is a commercial property, you know, activity from a commercial property is not,
[1:37:28] you know, it's sometimes more than a residential property, so they've agreed to provide the fence
[1:37:34] to neutralize any noise in any type of a commercial activity that takes place.
[1:37:39] Okay, was there any photometric done for this or are thought about?
[1:37:45] Yes, they have submitted a photometric plan, everything is in compliance, they will maintain
[1:37:51] the same, the light fixtures that are out there in the parking lot right now, they will
[1:37:56] not be stolen any new parking lot light fixtures.
[1:37:59] Okay, and if that was in the packet, I apologize if I missed it.
[1:38:03] So, those are my only questions, so we can move on now and look for the petitioner team
[1:38:09] to tell us your thoughts. So again, when you come on, please give us your name and address and
[1:38:18] what you hear from me.
[1:38:23] Keep me cracking. I'm the attorney for the petitioner. My address is
[1:38:28] 1-001. It's mainstream in St. Charles that's sweet G60174. I'm here with the potential
[1:38:38] purchaser of this property, along with our architect. And quite frankly, we're just here
[1:38:47] that you have to answer any questions you have and address any issues as they might arise.
[1:38:55] Well, we appreciate that. If you're good with that, we can certainly jump into questions from the commission.
[1:39:02] So we'll start with Commissioner Abwahali. No questions, thank you.
[1:39:08] Commissioner Jones, you're up next.
[1:39:11] Looks like a great repurposed reuse of that property.
[1:39:16] Looks like it'll be very attractive when it's all done.
[1:39:19] Thank you for that.
[1:39:20] I have no questions for you.
[1:39:23] Commissioner McGowan.
[1:39:26] To the petition for writing more details on the fancy.
[1:39:30] In terms of, you know, I know to be six feet high, but anything in terms of a design or anything.
[1:39:36] Sure, now is the Fnows the opportunity.
[1:39:41] My name is Andy Ketel.
[1:39:43] The 3W series here, 1D or 1L in length.
[1:39:47] The Fnows is actually requested by staff and we agreed to putting the Fnows.
[1:39:54] I'm okay with any kind of Fnows that you would think would enhance the property.
[1:40:00] Are you making them properly look beautiful? I don't think we have any objections to any kind of fence that you would recommend, but it was recommended by staff that they wanted the fence added and we certainly said it should no problem.
[1:40:17] Okay. Nothing further further for the petitioner. Thank you.
[1:40:21] Okay. Commissioner Valdez. Question for the petitioner.
[1:40:25] Thank you.
[1:40:26] Commissioner Woodemouth.
[1:40:28] Questions?
[1:40:31] All right.
[1:40:32] I have really just one question for the petitioner team.
[1:40:37] That is in our packet.
[1:40:39] I believe there were two.
[1:40:41] Forgive me if the numbers are not exactly correct.
[1:40:44] Response forms.
[1:40:48] I don't want to characterize it necessarily.
[1:40:50] I just want to say if you if you've seen them.
[1:40:53] or it I think actually it's just one. I missed the front and back for two for two items.
[1:41:00] Have you seen that and would you like to comment on that public response form?
[1:41:08] Not seen it. I'd be happy to comment on it as soon as I've looked at it, but I have not seen it at this point.
[1:41:19] Staff would have be appropriate if I just lead it to them. Okay, just for the sake of, you know,
[1:41:29] of this comment came from Kezimiro Gomez at 330 Illinois Avenue, it's as I believe it will
[1:41:42] cause more disruption in the neighborhood, not sure how parking would work in such a small
[1:41:47] area as well. So it looks like a two-prong comment. So if you could give us your thoughts on that,
[1:41:55] appreciate it but again knowing that we're kind of putting on the spot we also understand if you
[1:42:00] choose to decline. No, that's fine. We're happy to respond and appropriately indicated we have
[1:42:10] provided sufficient parking parking for the area. This is a very small facility as a result of
[1:42:19] parking is sufficient,
[1:42:24] and the overall perspective is, and the objective is to substantially improve the site.
[1:42:33] So I think within the context of access and parking and aesthetics, there's a substantial improvement on all aspects.
[1:42:46] And so I think that actually I respect his concerns, but I think he's going to be pleasantly surprised at the improvements that are being made to the site such that each one of those items are going to be addressed and minimized.
[1:43:06] Okay. Well that was my only comment for you. So, a question I should say. So, this point
[1:43:13] in time then we will turn this petition over to public hearing. So, for those of you who
[1:43:21] remain, which looks like Mark, Jeff, David, a tool and Joe Lean, if any of you are here for
[1:43:33] petition to comment on it now is your opportunity. Mr. Chairman, I am Mark Schoestrad here
[1:43:39] here with Mr. Tools. I'm at an attorney. My address is 1, 2, 5, 0, lock and avenue,
[1:43:47] Elgin, Illinois. Who care to speak in opposition to the petition? Because we don't think that
[1:43:57] serves the purposes of a neighborhood business district.
[1:44:03] The purposes of that district are to provide daily convenience items and commodities to a neighborhood.
[1:44:09] And in fact, the petitioner notes that he would provide a location for the purchase of alcoholic
[1:44:14] liquors in this neighborhood for his petition to be granted.
[1:44:19] However, there are already two liquor sales and establishments in this neighborhood business
[1:44:26] District 1, 2 blocks to the west, the Walgreens, and 1, 2 blocks to the east, the Villa
[1:44:32] Lickers store.
[1:44:34] We think that would be an oversaturage in this neighborhood with Lickers sales and
[1:44:41] establishments, and therefore, it doesn't really serve the purposes of a neighborhood of
[1:44:48] this neighborhood business district to approve another Lickers sales and establishments.
[1:44:54] the neighborhood as well served by the existing business, it's in it.
[1:45:00] Depth of reuse, but in fact, there's a going business on the site, the sickle gas station, and to have more sales of liquors in this neighborhood business district, it's just not needed. So there is no convenience, no more need for that commodity in this neighborhood.
[1:45:23] Okay, my question for you is you referenced your representing a tool and what is that relationship and what is that?
[1:45:34] I'm his attorney. He runs the bill. He runs the bill of liquor's business at 695 bill of street to block to the east of this location.
[1:45:44] Thank you. I understand everyone's perspective and this will appreciate that.
[1:45:51] All right, moving on.
[1:45:53] A tool would you like to comment as well since you're on?
[1:45:56] Well, thank you for the opportunity.
[1:46:00] Mark just mentioned.
[1:46:03] Let me start out by saying this.
[1:46:06] This current business that I own of the Law Libbers,
[1:46:08] which is located at 65.
[1:46:10] The last week, Belgium.
[1:46:12] It's been in my family since 1988.
[1:46:16] And I would like to say, ever since 1988,
[1:46:20] three years I have not opposed any new regulations in the city but this is
[1:46:28] absolutely made too close in my opinion so that's the reason I'm here tonight
[1:46:34] this was a mile or two away I would not be here tonight I believe that everyone
[1:46:39] deserves to be in a business and but like Mark and I just mentioned this is
[1:46:45] within a locker to close anything.
[1:46:51] Thank you.
[1:46:52] Okay, we appreciate that.
[1:46:54] And for the court reporter, I apologize.
[1:46:56] I didn't remind him to say his name spell it,
[1:46:58] but it's ATU-L, S-U-V-A-G-I-A.
[1:47:02] And I believe in his testimony he gave his address.
[1:47:07] All right.
[1:47:08] Did you get that in the 6.95, though?
[1:47:12] And Mr. Chairman, just one last comment.
[1:47:13] I have represented other applicants for zoning and liquor licensing only to find that the city
[1:47:23] is mindful of the concentration of that type of use in a particular sector of the city and have been denied.
[1:47:37] So that's more of the reason that we're here tonight.
[1:47:43] Okay, we appreciate that.
[1:47:45] I'm just going again through the list on my screen in the only, in the order that I see it.
[1:47:50] That's why I'm looking at it this way as we've got Jeff,
[1:47:55] David, Jolene,
[1:47:57] are the remaining names that we haven't heard from.
[1:48:00] If any of you would like to speak tonight,
[1:48:05] getting ahead shake from staff.
[1:48:06] They're probably part of the next petitions.
[1:48:09] But I just wanted for the sake of keeping everything open and transparent.
[1:48:13] give those people opportunity speak, but I believe we can safely close the public hearing portion
[1:48:19] of this petition and look to staff for closing comments. Perhaps the applicant can address the
[1:48:29] concerns from the public? You know I apologize yes we definitely like for that thank you for
[1:48:35] reminder, Demir.
[1:48:37] That's OK.
[1:48:39] I appreciate Mr. Schuster's comments.
[1:48:43] I too have represented a liquor store
[1:48:49] owners who are not enthusiastic about the competition.
[1:48:55] That is allowed.
[1:48:58] I understand the concerns about the distance.
[1:49:03] But I think the area contemplates the redevelopment and the adaptive reuse of the site.
[1:49:18] And I think this use substantially improves what is currently located on that site.
[1:49:24] And I recognize that sometimes competition is not pleasant, but it is what we're here to
[1:49:35] request approval of and is what is allowed under the existing ordinance.
[1:49:43] So I think that there is a bigger picture here and that is what makes more sense.
[1:49:50] And the fact of the matter is, this is a substantial improvement over what is currently existing, and therefore, while I respect this.
[1:50:00] She's just comments. I think that competition should be encouraged and not disinsentivized.
[1:50:16] Thank you for that. So then at this point in time, we can turn this back to city staff for any final comments.
[1:50:29] Thank you Chairman Cox. Staff really doesn't have anything else to add.
[1:50:32] We provided our overview of the application and the,
[1:50:35] I guess the standards were approval.
[1:50:37] We do believe that all applicable standards are satisfied
[1:50:40] and therefore staff recommends approval
[1:50:43] subject to the conditions out on the packet.
[1:50:47] OK, if there's any discussion amongst the commission
[1:50:51] now is the opportunity, but if not,
[1:50:53] chair will entertain a motion for petition 56-21.
[1:50:58] dash 21. Actually, before we do it, but move to motions on my
[1:51:04] do I have a question for the city? Does the existing
[1:51:08] zip-go currently sell package locker? I do not believe so.
[1:51:15] All right, thank you. You're welcome. That's my question. All right, any other questions from
[1:51:19] the commission? Chairman Capsis is here and I had just a comment. Go ahead.
[1:51:26] that may. Yes. Thank you for bringing up these points with the additional liquor stores.
[1:51:35] I, in preparation of this meeting, I could ask, Demir graciously sent me the strategic
[1:51:40] principles and priorities for the city of Belgium. It looks like it's coming up for review
[1:51:45] here pretty soon. It was from 2018 to 2022. And part of the reason that I asked was
[1:51:52] touches on the things that you're mentioning here, but the, the, the petition before you for the tattoo artist, that will make the fourth tattoo parlor, tattoo artist and art venue that includes tattoos in the, within a three black radius, three or four black radius,
[1:52:13] downtown Elgin where she's locating as well. And so I was looking at that document to see
[1:52:20] if there was any type of plan for that type of saturation and they don't seem to address it in here
[1:52:30] but it was the same issue for that petition and it was that was before that there was there
[1:52:35] our three other tattoo parlors in a very close proximity so I appreciate you bringing
[1:52:40] bringing that up but maybe that's something that the City Council can look to as far as
[1:52:47] that density and multiple businesses when they start reviewing strategic planning for
[1:52:54] 2023.
[1:52:55] Hope they'll be a four year process moving forward but thank you very much for your comments
[1:53:00] and observations.
[1:53:04] I've heard from Commissioner Jones, Commissioner McGala, just go through the list here
[1:53:09] Commissioner Aubwala, do you have any questions or comments before we make a motion?
[1:53:17] I do not have any additional questions.
[1:53:19] Thank you.
[1:53:20] Commissioner Valdez.
[1:53:23] Commissioner Wildermouth.
[1:53:26] No questions.
[1:53:28] All right.
[1:53:30] City staff, I do have one question since it was referenced in Mr. Schuster's comments.
[1:53:37] There was a question about license as being denied because of distance or set
[1:53:42] by the city and only because he said city, I thought I would check with you to see if you have any
[1:53:48] knowledge that can corroborate his comment.
[1:53:52] I do not. I know it is, it is, once if disowning is approved, then the applicant has to obtain a liquor license.
[1:54:02] And so the city council
[1:54:05] can
[1:54:06] choose to approve another liquor license or deny it.
[1:54:10] I don't have any data on how many of such licenses have been denied in the past.
[1:54:18] We have not had an application for a so liquor store or liquor sales establishment in
[1:54:24] a quite a while.
[1:54:25] We've had a lot of these accessory package, liquor sales, which are essentially convenience stores
[1:54:31] of sometimes part of gas stations other times not.
[1:54:35] So as far as I know in the last five years, so not of those have been denied, but they do consider obviously many aspects of these applications.
[1:54:47] Yeah, it was probably our minetti, so it was probably the last one.
[1:54:50] Well, that one's an operation.
[1:54:51] Right. Right. Right.
[1:54:54] Okay.
[1:54:55] All right.
[1:54:56] So then at this point in time, the cheer will entertain emotion.
[1:55:00] For this petition again, 56-21.
[1:55:45] Commissioner Jones? Yes. Commissioner Abwali? No. Commissioner Valdez?
[1:55:54] Okay. Commissioner Wilgrimuth?
[1:56:00] Yes. Chairman Cox? No. The motion is approved
[1:56:05] for 20. Excuse me, four to two. All right. And just realizing there were a couple of
[1:56:13] We talked about this, do we need to enumerate that or were we satisfied?
[1:56:19] All right.
[1:56:19] Thank you.
[1:56:20] It's trying to, again, keep everything great for the record.
[1:56:23] All right.
[1:56:25] So, to the petitioner team, that'll be our recommendation to City Council.
[1:56:28] And again, as we said before, work with staff for the dates for these.
[1:56:34] This item to be heard in front of City Council.
[1:56:38] Thank you very much.
[1:56:40] Thank you.
[1:56:40] Thanks for coming.
[1:56:41] Have a great evening.
[1:56:41] on.
[1:56:45] All right. Moving on then the last petition on our agenda for tonight. That is for 1460
[1:56:51] Sheldon Drive petition 49-21.
[1:56:58] Thank you Chairman Cox and again for this petition. We do have
[1:57:01] proof of proper notice. Thank you. This is the so school district you 46 has applicant property owners
[1:57:07] requesting a pool of a planned development as an app amendment. With the purchase from the
[1:57:16] dispensing motor fuel, transition landscape AR, vehicle use
[1:57:20] area interior landscape AR, vehicle use area interior
[1:57:25] set back and any other departures, as maybe necessary or
[1:57:28] desirable, to expand the existing parking lot at
[1:57:31] school district to 46 plant operations facility, the
[1:57:35] property commonly referred to as 1460 Sheldon Drive.
[1:57:39] So, the subject property is approximately five acres
[1:57:44] in size outline here in yellow. It is on the north side of Sheldon Drive that is approximately
[1:57:53] 600 feet east of Shales Parkway. As you can see, Zone GI, General Industrial, and the properties
[1:58:00] to the east west and to the south are also Zone GI or PGI. Both properties that are east
[1:58:07] and west are improved by industrial buildings. The one to the west is home to a building
[1:58:12] supply company, whereas one on the east is general contractor and a truck repair shop.
[1:58:19] And into the south is the PGI's own property that was approved for a 475,000 square foot
[1:58:26] light industrial building back in 2018 that building that project is currently under construction.
[1:58:34] Here is the bird's eye view of the subject property and the area of parking lot expansion
[1:58:41] that's indicated on the north side of the existing building. As you can see, the property
[1:58:45] includes a 63,000 square foot, one story building, an accessory parking that is generally
[1:58:51] east, south, and west of the existing building. There is a total of 54 parking spaces for staff
[1:58:58] on the east and in the south parking lot, and then 103 parking spaces in the west parking lot.
[1:59:05] That area west of the building, the west parking lot, is used solely by service vehicles
[1:59:10] for U46. The property also includes a salt dome within the west parking lot and a
[1:59:19] an above ground tank for fueling surface vehicles in the southwest area of the property.
[1:59:26] In general, the property is enclosed in the six foot high solid fence that also wraps around the fueling equipment in the southwest corner.
[1:59:37] So the applicant is proposing to expand the existing parking lot by constructing a new parking
[1:59:43] lot on the north side of the building and on this site plan, the north is on your right,
[1:59:50] Sheldon Drive, the entrance to the properties on the left.
[1:59:54] So the north parking lot is on the right hand side of the existing building.
[2:00:00] The new parking lot would have 47 stalls. All those parking spaces would be designated for staff. The facility has approximately 100 employees on a daily basis and the only 54 stalls for staff does not have enough parking for employees. So with the proposed 47 stalls, it would have 101 parking spaces for staff, which could satisfy the needs of the facility.
[2:00:25] with the other 103 parking spaces in the west parking lot that brings the total of 204 parking spaces on site and that far exceeds the regulatory requirement of 607 parking spaces for this facility.
[2:00:42] Now, the new parking line would be located 28.8 feet from the north property line, and then
[2:00:48] at the far north west corner, the turnaround driveway is actually up to 10.2 feet from
[2:00:56] the north property line that's the closest point and gets to the north property line.
[2:01:02] The applicant would remove nine existing Evergreen trees to accommodate the new parking
[2:01:07] lot of expansion.
[2:01:11] However, they would preserve all existing, all 14 existing, deciduous trees,
[2:01:18] and they would also install 43 new Evergreen trees to fill in the space in between the existing
[2:01:24] trees to provide additional screening for the residences to the north.
[2:01:30] The existing six
[2:01:31] for high fence would remain. Also, for that mention, the 43 new evergreen trees would be
[2:01:37] eight feet tall at the time of installation. Typically, we see these trees at six feet high
[2:01:42] of the time of installation. They have agreed to upsize these trees so that they are above the
[2:01:48] existing fence and to enhance that screaming for the neighbors to the north. In addition,
[2:01:56] additional landscaping will be provided on the south side of the south parking lot, and
[2:02:02] then additional arborivities will be installed to soften the fence that currently exists and wraps
[2:02:08] around the fueling equipment in the southwest corner of the property. The applicant would construct
[2:02:14] a five-foot public sidewalk along Sheldon Drive with a connection to the building.
[2:02:23] The proposal
[2:02:23] So it requires several of the partners from the zoning ordinance.
[2:02:26] The first one is essentially to make it a compliant, that equipment for dispensing motor
[2:02:32] fuel that already exists in the street yard, it's not allowed.
[2:02:37] This ordinance would make it conforming and compliant.
[2:02:42] The six for high solid fence, again, the same thing that already exists that wraps around
[2:02:46] the fueling equipment, the applicant is proposing to maintain that in the street yard
[2:02:51] where six feet high fences are not allowed.
[2:02:55] Transition landscape yard of minimum 52 feet is required
[2:02:58] because the property to the north is residential.
[2:03:01] As I mentioned, the parking lot that's closest point
[2:03:04] gets to about 10 feet from the north property line,
[2:03:07] but the majority of the rest of the parking lot
[2:03:09] is approximately 28.8 feet from the north property line.
[2:03:17] The applicant is proposing to install 57 shape trees
[2:03:21] And every increase in total, instead of, you know, in addition to what's required, and then instead of 100 shrubs, they're proposing 70 shrubs along the North property line.
[2:03:34] The vehicle use area, interior landscape yard requirement is essentially 5% of the total area that that's 6,179 with 25 trees and 25 shrubs, they're proposing only 2,300 square feet to maximize the number of parking spaces on site.
[2:03:52] That's about 2% of the vehicle use area.
[2:03:55] They are also proposing two trees within that area, south of the building.
[2:04:00] And approximately 30 shrubs.
[2:04:03] I mentioned earlier that they are far exceeding the number of required trees within the
[2:04:08] Transition landscape yard.
[2:04:10] Instead of the 12 shade and every green trees, they are proposing total of 57.
[2:04:16] And then finally, the parking lot expansion is required to be 7 feet from the side
[2:04:23] lot line.
[2:04:24] The access to that north parking lot east of the building would be 3.8 feet at its closest
[2:04:30] point to the east property line.
[2:04:35] The proposal is required to meet the standards for map amendments and for plan
[2:04:41] developments. We provided our overview of the standards in the packet and we do believe that
[2:04:46] all standards have been satisfied. With that, staff would recommend approval, subject to the
[2:04:52] conditions outlined in your packet. I will note a couple of those of one is that the building
[2:05:00] Wanted light fixtures on the north side of the building for that parking lot, have a shield on the north side of those light fixtures so that the light source is not visible from the residences.
[2:05:11] The photometric plan submitted in the packet is compliant with the zoning ordinance, but this would be a one step further so that the light source is not visible.
[2:05:20] And then the other one is that the two existing non-conforming directional signs along
[2:05:24] Sheldon Drive be removed, which the applicant has agreed to.
[2:05:28] So, with that, I'm happy to answer any questions.
[2:05:32] Appreciate it.
[2:05:33] Looking to commission again, starting with Commissioner Abwali, questions for staff.
[2:05:39] No questions for staff.
[2:05:41] Thank you.
[2:05:42] Commissioner Jones.
[2:05:44] No questions.
[2:05:44] Thank you.
[2:05:46] Commissioner Magala.
[2:05:48] the
[2:05:49] the mayor is going to be a burn on the
[2:05:50] north side as it just be the
[2:05:51] screening provided by the evergreen
[2:05:53] trees are over what else can talk to
[2:05:56] me about the photography and features
[2:05:57] of the north side. Yeah, they're not
[2:05:59] proposing any ever any burn because of the
[2:06:02] existing trees. There's a there are what I
[2:06:06] say 14 existing the situous trees that are
[2:06:11] pretty mature. There's pretty tight
[2:06:15] space between the curb and those trees to create a meaningful berm. There is already a six foot fence
[2:06:21] there that's going to remain. So instead of the berm we ask them to upsize the trees instead
[2:06:27] of a six foot high evergreen. They're installing eight foot high evergreen at the time of installation.
[2:06:33] So so we felt that was a good compromise considering the, you know, the small space that's going to be there
[2:06:37] between. Very good. Thank you. Thank you for your welcome.
[2:06:44] All right Commissioner Valdez questions for staff.
[2:06:47] No question.
[2:06:50] Commissioner Wildermuth.
[2:06:52] No questions.
[2:06:54] All right, I don't know any questions for staff.
[2:06:57] So I'm moving on to the petitioner team.
[2:07:01] I think I see some faces that we've seen before,
[2:07:04] but although one change, I think we see the full face
[2:07:07] where last time we saw you was partly obscured.
[2:07:12] So welcome back.
[2:07:14] I have again following the procedures requested if you can state your name, spell it, give us your address and then tell us your thoughts.
[2:07:25] My name is Jolane Lenniman. I'm a project,
[2:07:31] a special project coordinator for the District of New 46.
[2:07:36] Coming to you once again, 1460 Sheldon Drive in Eljun.
[2:07:42] Really, it's a combination that we bring this petition before you to give us more parking space for our staff and visitors that come to visit us quite often.
[2:07:57] It's plan operations.
[2:07:59] We do business services out of the same building, which is the distribution center for our district.
[2:08:05] So any school books or textbooks that come in, supplies, things like that, we'll come into the Distribution Center, and then we bring it out to all the schools.
[2:08:18] So you can understand the traffic that we have. The other portion of this is to give a emergency access lane all the way around our building, which we currently do not have.
[2:08:31] So if we would ever have emergency vehicles they would have to pull in and then back up and as you know with big vehicles that is pretty unsafe.
[2:08:46] So those would be the two main reasons for resurfacing this parking lot and adding the additional lane and parking spaces.
[2:08:56] Jeff from HLR is also here. You usually see us both together. I don't know if he has anything to add on it.
[2:09:06] Well, he does, certainly. Now is the opportunity. So.
[2:09:11] Here are all a few things. Jeff Mindel, the civil engineer with Hampton, the Zenian Rennwick.
[2:09:18] Just I think the mirror and Julian covered pretty much everything, but I'll just reiterate that.
[2:09:25] I believe there was at least one concern for a resident about possible noise for the adjacent town homes on the north.
[2:09:36] Really, that area in the back, even though it's parking, that's staff parking, so it's just cars.
[2:09:43] It's the mere point out there will be a lot of trees there.
[2:09:46] It'll be a solid wall of green trees in addition to the existing deciduous trees and the solid wood fence.
[2:09:56] The turnaround area at the northwest corner in the back.
[2:10:00] Really won't get you as much. That's there mainly, if a fire truck or large truck went back there and didn't go around the west side of the building that they could turn around there.
[2:10:10] So, and then from a traffic standpoint, really nothing's changing. The traffic's still coming in and out of the same driveway is on children drive. So, really not a significant change. It's pretty consistent to with the other adjacent sites to the eastern west. So, it's a good fit for the area.
[2:10:33] Right? We appreciate that. I believe that is the extent the petitioner team, right? Just two of you tonight.
[2:10:43] All right. Sorry. I'm shifting back between the big screen. Those of you here in my computer screen as well.
[2:10:52] So, appreciate again the patience. So, at this point in time, then we'll give the commission the opportunity to ask questions of you.
[2:11:01] So I'll start with Commissioner Abwali.
[2:11:04] No questions, thank you.
[2:11:07] Commissioner Jones.
[2:11:13] In the property to the east of this location,
[2:11:18] are those tractor trailer semis that are parked behind that?
[2:11:23] The building that would be adjacent to where
[2:11:26] you're going to have cars parked, right?
[2:11:29] Right.
[2:11:29] That's currently half of that building
[2:11:32] is a truck repair.
[2:11:34] And that's where you're seeing the tractor trailers.
[2:11:38] The other half is a countertop manufacturer.
[2:11:46] I'm really impressed with the improvements and investment
[2:11:48] that the district has been making in so many properties
[2:11:52] over the last couple of years.
[2:11:54] Thank you for your question.
[2:11:56] Yeah, thank you.
[2:12:00] Commissioner Megala.
[2:12:04] I have no questions for the district.
[2:12:06] Thank you.
[2:12:07] Commissioner Valdez.
[2:12:12] Commissioner Weldermuth.
[2:12:14] questions. All right, I do not have any questions for you. So we will open this up to
[2:12:21] you public comment.
[2:12:24] I see two names with us still who are people who may qualify
[2:12:30] likely from previous petitions but since they are here, there's no one in the
[2:12:34] chambers but now it was the time of Harold or Amy would like to comment and I was
[2:12:40] opportunity.
[2:12:47] All right, believe we've given ample time for the unmuting of the cameras to turn on.
[2:12:52] So we look back to staff for any final comments.
[2:12:58] Nothing else to add.
[2:12:59] Uh, staff leaves at all.
[2:13:00] Apocalypse standards are satisfied and staff recommends approval subject conditions.
[2:13:05] All right.
[2:13:06] Thank you. So at this point in time, then the chair will entertain a motion for petition 49-21.
[2:13:13] This is Nancy. I move to recommend that city council.
[2:13:16] Protection 49 dash 21 subject to the conditions outlined within our packet.
[2:13:22] And to adopt as the findings of the commission.
[2:13:24] Those findings also provided within our packet.
[2:13:27] Thank you very much. Is there a second?
[2:13:30] I second. Karen.
[2:13:33] All right. Staff, please call the roll.
[2:13:35] Commissioner of Wally.
[2:13:37] Yes.
[2:13:38] Commissioner Jones.
[2:13:39] Yes.
[2:13:40] Commissioner Megala. Yes. Commissioner Valdez.
[2:13:47] Commissioner Wilzermuth. Yes.
[2:13:50] And Chairman Cox. Yes. Motion is approved. Six to zero. All right. Thank you.
[2:13:58] That'll be a recommendation to city council. And as we said a few times tonight, you're very familiar with.
[2:14:03] Work with staff on those dates and go look for the project.
[2:14:09] Thank you.
[2:14:12] Very much.
[2:14:13] All right.
[2:14:14] Moving on to item G, other business.
[2:14:17] Any business from my fellow commissioners at this point.
[2:14:26] Hearing none and seeing a couple of head shaking no.
[2:14:28] Moving on to item H public comment.
[2:14:31] Again, no one's in the chamber and I see people falling off the zoom call.
[2:14:40] So we can safely move on to the summary of pending development applications, which as exciting as all these petitions are is also highlighted the evening, so Demir take us away.
[2:14:51] The only thing I'll highlight is that the items that we're at the planning is on the commission last month are all moving to council.
[2:14:57] This Wednesday for consideration.
[2:15:00] That includes the new Starbucks in front of Russo and the deltire, deltire store at north of the Meyers store.
[2:15:09] In terms of any new applications, nothing of substance.
[2:15:14] We have a package, liquor sales, establishments, or I should say, an application is part of the 711 on at 1570 North Randall that's just north of the Subaru dealership.
[2:15:27] So the next meeting is on on the 7th of February, we'll probably have two or three items for that meeting as well.
[2:15:36] So, there's any questions?
[2:15:37] I'm happy to answer.
[2:15:39] So if it's only two or three, that would be a late evening.
[2:15:42] Not yet, we'll think.
[2:15:44] All right, any questions for staff?
[2:15:45] If not, we'll entertain a motion for adjournment.
[2:15:49] Yeah, I have a question in some of my neighbors have asked,
[2:15:53] It's a mirror where we get with the planned gas station on 20 just I guess it would be west of
[2:16:02] Cumes and Plank.
[2:16:06] I think you're out of gas station there and then it's been.
[2:16:10] There's been no activity out there for for many, many months.
[2:16:13] So we've received two.
[2:16:16] We've been made aware of plans for two gas stations.
[2:16:19] One of the northeast corner, one of the northwest corner of Cumes and Route 20.
[2:16:24] In terms of their design, the one at the North East corner is kind of further along, but neither of those properties are continuous to the city.
[2:16:36] So they would have to go through the approval process with the King County, but they feel that there's a benefit to them being in the city and going through the process of annexation and all that.
[2:16:48] So they're trying to find ways to become
[2:16:52] continuous to the city and then ultimately file the application for petition to annex along with the zoning approvals for those gas stations.
[2:17:00] Like I said, the north east corner properties further along the design process.
[2:17:05] The north west is only at the beginning, so it's probably going to be a while if that one moves forward.
[2:17:12] the one of the northeast corner, the thing of their agreements with the adjacent properties that can give them
[2:17:19] continued, you know, continuity, you know, that could happen sooner maybe a while. So we'll see.
[2:17:26] There's an interesting, because it's the northwest corner that has a signage on there, and you know, feature almost, you know, some guests, they should have something good.
[2:17:34] And they may have switched their conversations and they thought and they may decide to just do
[2:17:43] permitting through Cain County, in which case we have no information about those, but if they opt
[2:17:52] to, you know, find a way to annex into the city, then they'll have to go through here, obviously, and we'll go through there.
[2:18:00] Thank you. You're welcome.
[2:18:02] All right, any other questions for staff?
[2:18:06] Otherwise, again, we'll be pointing to a motion for adjournment.
[2:18:15] So moved.
[2:18:16] All right, is there a second?
[2:18:20] Thank you.
[2:18:21] Staff, please call the roll.
[2:18:22] Commissioner McGala?
[2:18:24] Yes.
[2:18:25] Commissioner Abwali?
[2:18:26] Yes.
[2:18:27] Commissioner Jones?
[2:18:29] Yes.
[2:18:29] Commissioner Valdez?
[2:18:32] Yes.
[2:18:33] Commissioner Wildermooth?
[2:18:35] Yes.
[2:18:36] Yeah, and Chairman Cox?
[2:18:37] Yes
[2:18:40] All right, thank you everyone have a great evening. Thank you everybody. Thank you. Thank you. Thank you everybody. Thank you. Good night
