[33:45] traffic or no through traffic things like that um temporary closure seems to
[33:50] be the the the cleanest way it it'll stay right where it is
[33:57] but because it's owned and maintained by town of Elon the statute's clear that
[34:04] you have the authority to make the decision to close it permanently that's
[34:09] how I read the statute not an attorney but that's how I
[34:13] read the statute closing it permanently is a
[34:18] different step that abandons the right of
[34:23] weight and the property then reverts to the ownership on side of the

[35:06] we are um back on the agenda tonight to hopefully close out some old business uh
[35:13] pertaining to the revision of our chapter six animal ordinance um you all
[35:18] have the paperwork in front of you but as part of the history the town had an
[35:23] ongoing issue uh with an inocence and dangerous dog in the in por Creek
[35:28] neighborhood starting around October 2022 the dog bit two different people
[35:34] within a four month time frame made residents in the subdivision feeling um
[35:39] very unsafe in their own uh Community the owners were hostile and
[35:43] uncooperative with law enforcement's efforts to mitigate the situation
[35:47] quarantine the dog Etc um we we were also not successful
[35:53] because of their U uncooperative manner to seize them the dog for the quarantine
[35:58] or to make appropriate charges um the state statute as we were
[36:02] delving into this because again we don't have uh dedicated animal control so was
[36:07] a learning experience for us we realized that there were very specific details
[36:11] that the statute laid out before us after talking to our district attorney
[36:16] uh or assistant district attorney on the matter uh like with everything the state
[36:19] can be BR and ordinances can make better restrictions and as we kind of our way
[36:27] through or Traverse this situation we realized that there are some issues with
[36:30] our ordinances that we would like to clean up um the incidents obviously
[36:35] proped us to to look at revising our current animal ordinance to enhance the
[36:40] Safety and Security of our surrounding um communities specifically when dealing
[36:46] with vicious or dangerous dogs while the proposed changes that I that I have in
[36:51] this chapter six may not have impacted all of the nuances as we we faced with
[36:58] this particular incident I think it certainly would have provided our our
[37:01] officers the ability to be a little bit more responsive and proactive should
[37:06] similar circumstances arise the proposed changes today and I can go through them
[37:11] if you want but it's a little tedious uh you guys let me know what you would like
[37:16] to hear but the changes proposed today include new language that gives officers
[37:19] the authority to be more proactive in impounding any dogs running at large
[37:23] without first issuing a warning that was the biggest issue that we that we face
[37:27] with that particular situation uh the new language also allows officers to
[37:31] impound a dog if the dog is in question of being deemed dangerous allowing us to
[37:37] then pursue our investigation to figure out if this dog is truly a nuisance or a
[37:41] danger to the community um it also makes it specifically
[37:47] unlawful printing person to refuse or fail to surrender an animal for
[37:51] quarantine the revised ordinance provides um provided today Incorporation
[37:56] more detail more robust detail in what is considered a nuisance animal our
[38:02] previous uh definition did not really go into a lot of detail and some other
[38:06] minor changes to clean up Senate structure and provide some uh free
[38:10] freestanding penalty sections the town attorney our our
[38:14] specific Town attorney did was consulted with these changes he was um he had no
[38:21] issue with the language being presented he had which we'll talk about later he
[38:25] had some other suggestions but what I'm asking you today is to approve the
[38:30] language that um that I've provided to you for chapter six um obviously you can
[38:36] look it over give me some rebuttal some revisions that you would like to see and
[38:40] I can come back with another draft um or vote to maintain the ordinance as we
[38:45] have it today I can answer any questions I have
[38:49] a a couple question um so looking through it I remember the when it first
[38:54] got brought to us there is something about um officers having the power to
[38:59] put down an animal and I didn't see any of that in here so that was so when we
[39:08] when we looked at this we looked at what we don't need to reinvent the will what
[39:11] other uh municipalities doing that was something that came that we wanted to
[39:16] present to you all to see how much Authority do you want us to have I rich
[39:22] and I talked together and we're both animal lovers so uh we weren't sold on
[39:27] that idea but I didn't want you to to think we didn't look under every Rock
[39:30] and present every option that Elon could take on it was more of a a an extended
[39:35] or for exent circumstances for emergency situations and it's one that was adopted
[39:39] by Alamance County um the Alamance County so we were looking at what they
[39:44] had and it and they do have something in there a provision for emergency
[39:47] situations I did not um the feedback I got that it was not well received so I
[39:52] did not put that back in here um so then let me ask then if would the town be
[39:58] protected let's say get a call and there there's a dog physically in the act
[40:05] of and you would be able to put it down um and be protected even though it's not
[40:10] correct that that is that dog is it falls within the guidelines of not only
[40:15] the statute but our current ordinance now that it is
[40:19] actively in in it's actively presenting Behavior that's dangerous it's it's it's
[40:24] no different than the authority that they invested us uh should we have to
[40:29] have to use deadly force to protect you or a third party or ourselves um this
[40:35] was in one of those cases where the dog is bending
[40:39] dangerous it's loose and it's not actively uh attacking anybody but we
[40:45] need to maintain that it does it maybe it's headed toward Elon Elementary
[40:49] School uh and we're trying we can't necessarily catch it and do other things
[40:55] um but no we we would still have that ability to act if it's in the process of
[41:00] attacking or engaging to attack that you know we don't have to be reactive in
[41:06] those situations have a couple more um so it also said you know if you have to
[41:11] quarantine a dog or an animal during an investigation that the owner then would
[41:16] be responsible for paying any of the quarantine
[41:19] fees how does that work in the case of just a disgruntled neighbor constantly
[41:25] calling on somebody's dog and then you take the dog quarantine it
[41:29] for investigation and you that the investigation that that's just a
[41:33] disgruntled neighbor calling on another one is that person still then
[41:37] responsible for quarantine people I know that's a hypothetical yeah quarantine
[41:42] only applies to a situation where a dog has bitten someone and has to be
[41:46] quarantined for fees a nuisance dog they're they're barking they're running
[41:49] at large um there has to be a a there would be an investigation unless there
[41:55] was something that says like in this this particular case we had multi
[41:59] complaints that the dog had charged folks that had chased people down the
[42:04] street um rather than having to wait for that dog to actually act on those
[42:11] instincts this would allow us to then seize the dog conduct the investigation
[42:16] but because the dog is running at large the owner would still be liable for that
[42:22] and and the county also supports that it's in their um their ordinance as well
[42:26] that BR me to my last question so in here I
[42:31] saw I've understood that uh we pay the county for animal control um but then I
[42:38] also saw in here that we have a partnership with the Burlington Animal
[42:42] Shelter we pay Burlington we pay Burlington we don't actually and those
[42:47] fees are to support the shelter it's not actually for animal control or any
[42:52] services that they provide it's to have a place to take
[42:57] Strays um and different things for them to
[43:00] hold and that's the $75,000 a year we pay and it's to
[43:07] Burlington and okay thought that was the county so when we say we the count is
[43:12] gonna help us get a nuisance dog and take it to
[43:17] Burlington we actually do all the work so the
[43:22] county Alamance County has an overarching ordinance that pertains to
[43:27] all unincorporated uh parts of of Alamance
[43:31] County um and because we work in Partnership sometimes with the county
[43:36] they did come out on this particular incident to help us round up as a mutual
[43:39] Aid they actually have no real responsibility to the animals
[43:45] inside of Elon the town of Elon um so I think it's just a blanket term we use
[43:50] you know the County's going to help us or we're we're referencing um county
[43:55] code because they do have probably the largest animal control um but our our
[44:00] funds go to Burlington Animal Shelter who also works with Alamance County um
[44:05] all the other municipalities are in Partnership and and get a little they
[44:10] have to pay a piece of the pie to to be able to access the shelter um and that's
[44:14] all a part of that 75 7 something thousand dolls we pay
[44:19] in so does that do you have the equipment to
[44:23] handle no we have a catch B well
[44:28] we have some small animal traps like for cats and squirrels and fun stuff like
[44:32] that but no we're not we're ill equipped for the process so that was my question
[44:36] asking our employees Law Enforcement Officers to take on a task that can be
[44:41] dangerous you have dog who's vicious the ability to to surround a
[44:47] dog they have ability to tase a dog uh technically yes it's hard uh for
[44:53] a fast moving animal that's dodging um me in earlier years I've tried that
[45:01] it it's not successful right and and Animal Control
[45:06] has different things such as darts uh tranquilizers things like that we just
[45:10] don't have the volume of animal CS um we don't deal with it this was a this was a
[45:15] big deal for us and it was a I can admit this was a very uh steep learning curve
[45:20] for us we we had to kind of flirt on the Fly about what the state statute
[45:24] requires and didn't require and and to your point do we have the equipment for
[45:27] it no you put a dog in the back of the B which we don't have a truck I guess to
[45:33] do that we dangerous for we have prisoner confines I mean we use the same
[45:39] thing that we would use if we arrested someone else and and a a dangerous dog
[45:43] is a dangerous dog but it's the most dangerous mammal that we deal with are
[45:47] human so um we we have the means we just don't necessarily have the training or
[45:52] the tools which is something that that we've started to broaden our Horizons on
[45:57] a little bit go and this may be a question for you or
[46:02] may be who built the agenda why is the removal of chapter 13 after the LMO um
[46:11] is this would it not be natural that if we had no objections and we wanted to go
[46:16] ahead and and pass um chapter six that would take care of everything you need
[46:23] to get rid of 13 just an error it was just yeah I mean
[46:28] could we we can we can change that change that I was just going to say to
[46:32] take care okay I just that was a little confusing to me that's why I just
[46:38] because me this afternoon as well Rand I just went with it I better than I
[46:45] do I was missing um I have one question so in chapter six now this is from the
[46:53] 20 recodification but does it not make sense at this point to change mentions
[46:59] of the board of alderman to the Town Council within this document and that
[47:04] would have been on that that would have been my error but yes it does make more
[47:08] sense to do that while we're making the changes already to go ahead and do that
[47:11] I was more focused on the the content so I didn't make that change already you
[47:17] can do that I I was as I read through it I
[47:21] thought it was very very well done I thought seem to cover things had talked
[47:26] about and I was glad to see that even though they still have the right to put
[47:29] an animal down it's not so explicitly a part of it and things like um other
[47:36] question maybe I just missed it but you listed every animal but chickens I guess
[47:41] so have chickens in there yet I didn't even approach
[47:49] that I've heard other uh other municipalities get into a really heated
[47:54] debate about chck lot of people have chick feral kids it
[48:00] is it is currently allowed it is allowed okay that's why I
[48:03] was they just can't be like running loose right they can be like in a fenced
[48:09] yard or something of that nature one
[48:18] more thank with with this updated orance woke us through the
[48:26] scenario that we had in Forest Creek how this
[48:30] would help that situation the steps of being
[48:34] different yes um the way the way our ordinance was written left a few things
[48:40] to be desired in that the state specifically and implicitly defines a
[48:46] potentially dangerous and dangerous call and a potentially dangerous is one that
[48:51] um I as chief of police can deem dangerous but I have to to post it to
[48:56] the owner first if it's running at large I we have to issue a warning we can't
[49:01] just seize the dog um and and to be potentially dangerous
[49:07] there has to be that act of aggression dangerous dog means that you've been
[49:12] inflicted with serious injury you've been hospitalized you've been disfigured
[49:16] or something to that effect um the biggest change in here is that animals
[49:20] running at large that could be deemed nuisance uh and and we Define that
[49:26] is that we before had to give that warning and then again if if if there
[49:31] was if I deemed it dangerous potentially dangerous I had to physically serve
[49:36] notice to that owner telling them that they had to they had to turn in the dog
[49:41] and a set number of days for alamt County or Burlington Animal Services to
[49:49] deem that dog dangerous then they get a hearing and all that stuff kind of
[49:53] starts taking place all the legality that's that's put out in State Statute
[49:59] um this allows us to if we get someone calling saying hey this dog is running
[50:03] at large he's growed at us um he's appro approached us in a in a posture that
[50:09] seems vicious we can be proactive we don't have to warn anybody if the dog is
[50:13] out there we can take our little catch pole catch him up take him do all the
[50:17] investigation that needs to be done while that dog is safely secured at the
[50:22] as an impound um now when do impound it then I'll give notice saying hey this is
[50:28] why we took your dog uh the hearing process starts much quicker than having
[50:33] to go through the steps of giving the warning giving the notice um and in that
[50:37] time as we're learning this you know that second person did get bit um and
[50:41] this just gives us the ability to be a little bit more proactive again it
[50:44] doesn't help us with uncooperative pet owners and that's why I said it it may
[50:49] not have had a a huge impact on the end result of this last case because if we
[50:54] can't get to the dog we can't kick a door in and go take it um if we don't
[50:59] know what's in there um that said dog I mean they had three different dogs so we
[51:03] have to have more evidence to enter a home um but it gives us a little bit
[51:08] more advantage to to be proactive on that front end and not maybe I would say
[51:15] U it's a little bit in the instance of where the first bite happened would you
[51:22] be able to then serve the papers right then we could done it before the first
[51:26] bik okay as because as information came there you know we got calls about this
[51:31] dog running but it wasn't doing anything and we had to give warning first um
[51:37] they're like well it's approaching aggressively well for our statute okay
[51:42] we can warn them and then we can site them for having a dog running at large
[51:46] but it it would have given us more ability to be proactive before that
[51:49] first fight even happened thank
[51:53] you question um as you know there's an individual
[52:00] close to my house that a lot of my neighbors are calling me about the dog
[52:05] has an invisible fence but the dog is left out all the time and that's not
[52:10] considered tethering but I mean they they leave for days at a time and the
[52:17] dog is just outside and the the electric fence and it's barking
[52:23] and it wants to go in because it was like freezing rain one time and so how
[52:28] is this addressed at all in the ordinance that would be a nuisance The
[52:32] Barking the howling um even though it's contained in its Shard uh it is
[52:38] unsupervised there could be a neglect piece to that and I would say it merits
[52:42] an investigation and a nuisance can be a citable offense that's issued that that
[52:47] is covered in this ordinance as it stands before you yeah because there was
[52:51] a whole section in there about neglect as well and
[52:54] yeah yeah it's been M yeah I get lots of calls on those weekends we'd be happy I
[53:00] I haven't received any so I know I just think you're you're far more
[53:05] approachable so if you want to pass that on to us we'll be happy to investigate
[53:09] that and see what we can do
[53:13] there so um just knowing that there's at least one change that needs to be made

[53:23] bring that back at another session and with that should we then also postpone
[53:29] removing chapter 13 since that would remove all of our animal ordinance

[55:31] to um thank everyone that has been a part of this process it's been a four or
[55:36] five year process I know it long predated me um but to Pam and Kirk and
[55:42] Paul our Consultants who got us here um the committee members all the the hours
[55:48] spent reviewing this um everyone involved in that process to the staff
[55:53] folks who reread it um and lastly I would just like to thank
[55:57] my planner Jenna who's been absolutely godson and helping me update all of
[56:02] these chapters and all of this weird formatting in here that I look forward
[56:06] to um this is Jenna's last week with the town she will be leaving us um and I
[56:11] wish her well but she has been super helpful in this LMO and hopefully
[56:15] everything you had before you looks correct and all of the changes were made
[56:20] if not again I'd be happy to answer any questions any questions comments for
[56:26] Lori I I want to reiterate what you just said there a lot of sweat and tears and
[56:31] a lot of hours put into this and some of those folks who participated are here
[56:35] tonight and I appreciate their faithfulness to stick with it this
[56:39] project got off a great start and it got kind of sidetracked but you know to the
[56:44] credit of Pam and Kurt and assistance from them we were able to get this
[56:51] back I want to thank everyone's participation in this and um I think
[56:56] we're going to find this is going to help us to move forward um we're going
[56:59] to have better development better smart growth that's one of the things we've
[57:04] talked about as a as a need so to
[57:12] you I just want to reiterate that but uh the other part of it for me is is that
[57:18] you know I think you've made it very clear
[57:21] that some times these documents are never completely perfect and if there is
[57:27] a chance we don't just throw everything out waiting to make it perfect go ahead
[57:33] and pass it because it's definitely a large improvement over what we have now
[57:37] and uh with that said if there is if we start as we live into it we start to see
[57:42] there's some issues we can make those changes absolutely I've even already got
[57:46] the list started and it hasn't been adopted very minor very very minor but
[57:51] I'm already seeing small very small changes but yes I will bring you a
[57:56] grouping at one time when we get to that point I think the illustrations were
[58:00] really helpful um yes and thank youit
[58:04] for kind of what some of it looks like not to just like think about it and try
[58:11] to conceptualize it but to see in the
[58:16] illustrations it absolutely was and I failed to thank them Benchmark did the
[58:20] downtown master plan and we contacted them with do the illustrations in here
[58:24] and Absol abolutely I think it answers a lot of questions having the visual
[58:28] graphics for you to see i' like to thank everybody for all
[58:32] their work on this I wasn't a part of that part of it but I heard the back end
[58:36] and just hearing the back end that's a lot of work
[58:40] so it seems to be very detailed and again as Randy said we can always if
[58:47] there's a major change but I think pretty much covered it so great

[59:22] in the public interest because it's support several goals outlined in the
[59:26] 2040 Envision Elon comprehensive plan including having a zoning ordinance that
[59:32] aligns with the comprehensive law thank you I have a motion to approve the text
[59:37] Amendment do I have a second second it second all in favor I
[59:44] any opposed carries um do we have a motion
[59:50] regarding the
[59:53] rezoning
[59:57] no one else wants to read I'll I'll do it

[1:05:20] everybody so I am here tonight to talk about our Downtown Plaza
[1:05:25] rental component for our public use uh we rich and I discussed that we probably
[1:05:31] would need some sort of policy because we we might have some interest and we
[1:05:35] already have our first request so I just wanted to share that happens to be a
[1:05:39] downtown business so I want to make sure that they are they do have an
[1:05:42] opportunity to utilize the plaza um it's actually Pandora and they're doing their
[1:05:50] anniversary I thought or 12 so that's our first re Quest I'm not saying we're
[1:05:54] not going to get others but that kind of prompted us to kind of speed this along
[1:05:58] a little bit so um you have attached in your packet um a rental a proposed
[1:06:05] rental policy agreement uh for the plaza you know as you know this is kind of a
[1:06:10] unique venue it's not um you know a park not a picnic structure it's not it's
[1:06:16] kind of a different type of thing and so I really felt that this should um you
[1:06:20] know mostly be used for an outdoor space but that we would have limited public
[1:06:26] use maybe once a month was was my suggestion as a part of this process I
[1:06:31] really felt that we should still go through the special event per permit
[1:06:35] process which you all are familiar with that would lead all the applications you
[1:06:39] know to go to all the department heads we would all review it see what it is
[1:06:43] what's required of it um if we have any additional staff those types of
[1:06:47] processes and in addition they would fill out this Plaza application that
[1:06:52] they wouldn't have a a separate fee structure attached to it um and one of
[1:06:57] the components I felt important was that it has to be a public event because I
[1:07:01] don't really see a way that you could block that off and and have it a private
[1:07:05] event in such a public setting so when I say public event that anybody in the
[1:07:11] public would come to like it's a craft show or it's a a fundraiser of some sort
[1:07:15] or in this case Pandora wants to do a celebration B that anybody could come
[1:07:19] it's not you know just quarantine to to a certain group of people so the plaza
[1:07:26] uh fee structure is attached to to your packet there is one additional change
[1:07:31] that Lori asked me to add because she needed an addition on page two at the
[1:07:35] very very bottom um I put highlighted in red um she wanted to include the cost of
[1:07:40] the legal ad would go to the applicant rather than town of Elon paying that I
[1:07:45] think she well exceeded her her budget this year as ads are quite costly and so
[1:07:51] she had that change and then all of my fees for for the plaza are located on
[1:07:57] page 11 in your packet and if you notice in that component I did put a resident
[1:08:02] and non-resident uh rate in there um I just I feel strongly we should always
[1:08:08] take care of our residents first and give them some sort of a discount for
[1:08:12] using facilities within their town and that also would the give our
[1:08:19] businesses an opportunity to get um their resident rate as a business in
[1:08:23] Elon so I'm requesting for you to well for
[1:08:26] one thing to open it up for discussion I know um Randy and I did have a
[1:08:30] discussion earlier today so he has a point to bring up but have you all
[1:08:34] review the the concept um if you have some questions or you know some have
[1:08:38] some conversation on how you feel about what was presented to you and hopefully
[1:08:42] come up with some sign of uh sort of proposal that's agreeable to everybody
[1:08:46] to to put this into place for us we got start with something really nitpicky
[1:08:52] okay all of the te's were questioned marks oh yep TI anywhere there's a TI
[1:08:57] what happened I don't know the document shows it must be something in something
[1:09:03] in Translation right no I don't if is it something in when you convert from one

[1:09:51] Plaza um as a as we are the as the Green Space and again I'm speaking both as a
[1:09:58] council person but also as a property own not an owner but a steward of the
[1:10:03] property um or the church um we have we have tried to be good partners as best
[1:10:09] we can and uh and as public Gatherings go we have students that come over and
[1:10:14] use the green space we have other people who come over and use it and we've we've
[1:10:18] tried our best to to to work with that to to try to be hospitable but when it's
[1:10:23] now come to private usage uh you're actually paying rental
[1:10:28] on the Plaza not on the Green Space and so there e there's going to have to be
[1:10:34] one of two things that are going to have to happen there's G to have to be a
[1:10:38] secondary process by which people would rent the green space and I'm not crazy
[1:10:44] about that because that's not what we're in the business for or making sure that
[1:10:49] it's clear to people that the green space is not
[1:10:52] available um so this is a concern that I have and how would we do that if it's a
[1:10:57] public event it's not a they're all private events even though they're open
[1:11:01] to the public well you know even like when the restaurant would were to do
[1:11:05] something like that if they were using our Green Space they should be asking us
[1:11:10] permission to do that I think if it goes through a Rental process it's almost
[1:11:14] easier to control that in that we can add wordage to this it says you your
[1:11:19] rental is inside the plaza only you can utilize the tables there but nothing
[1:11:24] actually happens they're not allowed to use the green space for the event and
[1:11:28] also limit the number of people um I did put in there that we have exceeding
[1:11:32] capacity of 40 to 50 but I didn't put that the maximum capacity of the rental
[1:11:38] could potentially be 50 or whatever it is we determine it should be and that's
[1:11:41] where I had a question because how do you regulate it is open to the public
[1:11:47] Indo event right you be far more than 50 people you can't regulate it in the
[1:11:52] green space is part of our social distance I'm I'm indifferent in general
[1:11:58] with um renting it out I saying the initial thought of it um and having
[1:12:05] people come but I would like them to talk to the town because I mean I can
[1:12:09] see Pandora's events and we're we're I'm singling out that because that's the
[1:12:13] only one that's coming right like hey I want to do this they SPO they pull a
[1:12:17] special use permit right and have a special event and that's like this
[1:12:23] partner with the town and then the Green Space could be used like the music to D
[1:12:26] to because it's just a it's not a noice paying a rental fee it's the public
[1:12:31] Plaza to I mean the other option is to just you do the special event perent
[1:12:37] process like we do now and we pick and choose them individually it's it won't
[1:12:41] be you won't be making any money and I don't think that that's not really the
[1:12:45] purpose of this per se although I did put a fee structure that's more than $50
[1:12:49] per event but if you stay with just a special event permit
[1:12:53] it doesn't preclude say Pandora from doing
[1:12:57] that I don't know that's just Rich's brain is turn churning over there yeah I
[1:13:04] mean and again it's just we we've allowed for you know kind of a
[1:13:08] partnership it's different when trying to be open to the community and and
[1:13:13] again that's that's okay when people are actually paying for an event they may
[1:13:17] feel like they have a right to do something that's different than if
[1:13:21] they're here as part of a partnership or something like that well the other thing
[1:13:25] is we are not going to be Staffing it you know like you do some
[1:13:29] facilities bment Park they have part-time staff that works those and
[1:13:33] enforces that I don't have the ability to do that with with the Staffing that I
[1:13:37] have so so I'm trying to think of what what could happen obviously if 30 people
[1:13:43] say we want go use the plaza today it's our group we go there and use
[1:13:50] it they have a right to do that um they don't have a
[1:13:55] permit what they expect to you know they can stay there two hours they can stay
[1:14:00] there seven hours whose responsibility would be you
[1:14:05] said I walk with the B Park I see people using Pavilion using tables I don't know
[1:14:12] if they pay for for a birthday party for their kids probably they did who's and
[1:14:17] obviously there's people out there during the week maybe weekends they're
[1:14:21] out there just to make sure doors locked but I don't know that you want to try to
[1:14:27] how do you police that how do you keep people from using a public space just
[1:14:32] for that and I I understand why you're you're doing this I think we've got to
[1:14:36] be mindful how do you allow people do the space but like you said the church
[1:14:41] has been most generous but during the week people go out there in the Green
[1:14:45] Space they sit out there and right e Dy whatever on their
[1:14:50] own are you against some a group deciding hey we want to go down there
[1:14:55] taking their chances oh the tables were available we want to gather are you you
[1:14:59] know if are you opposed to that idea I mean I think Gathering is different than
[1:15:04] a special use permit it is things I mean it's one thing if like we a busker goes
[1:15:10] downtown or if a b tries to set up right I mean we're gonna get calls and that's
[1:15:14] something we can talk about well right now we we have we will get approached
[1:15:19] and people will use our our our yard oh yeah
[1:15:23] CNR he does it a lot you know when when there's a student event they will rent
[1:15:29] they'll put a little tent up and they'll sell some of their stuff there um there
[1:15:33] was a time when we were doing some bookstore stuff and boy poor Earl Daniel
[1:15:39] about had a stroke um because he didn't want it to compete with the bookstore
[1:15:44] the official bookstore so he said no problem we just we won't regret to that
[1:15:48] so I mean so it's not like we don't and I'm not not ruling out the idea that we
[1:15:53] but if that way we maybe would make some money to uh mitigate you know having to
[1:15:57] keep grass planted and stuff like that but uh that's what I was looking at I
[1:16:02] was like it just it just didn't sound right it didn't sound that a group could
[1:16:06] have a private use even though it's in a public setting but a private use and
[1:16:10] then maybe have expectations that's what I was really looking it's a good point
[1:16:13] it's a it's a unique situation yeah and I'm going to get requests I don't know
[1:16:18] how you know how we which direction we go and maybe the first question
[1:16:24] is do we want to allow private groups to take over the
[1:16:30] plaza for for a private event even if it's open to the
[1:16:34] public or answer maybe that leave that as the
[1:16:39] first question one I had was we have specific times for the social
[1:16:45] district and why would we not have specific time for example if somebody
[1:16:49] wanted to rent it at Sunday morning at 10 o'clock
[1:16:54] and they're competing with his congregation who needs to park there and
[1:16:58] access there me that's not being very considerate to them so that's I guess
[1:17:05] that's my concern is what would be we also we could leave it for town events
[1:17:13] and very special situations I mean what if the university wanted to do something
[1:17:17] in partnership with us the church we already partner and do events and if
[1:17:22] that's the way exles that you put in there that could be rented like a chili
[1:17:26] cook off why wouldn't a town want to be involved in a chil committee right um
[1:17:32] one of our businesses like Pandora like right my big thing is to not prude our
[1:17:37] downtown businesses for being able to utilize it for special occasions and
[1:17:43] well they're right next to it they'll probably utilizing it quite a bit I
[1:17:45] would imagine they're gonna get a lot of their customers going to be out there
[1:17:48] well and then part of the especially Pandoras more more than any without
[1:17:53] without having a public restroom if they want to do
[1:17:57] something for their 12th you know the least we I feel like we can do as a town
[1:18:02] is if we have some staff IT staff that a bit because we're going to have all the
[1:18:06] people going to their bathroom that is an issue there are no
[1:18:10] public bathrooms so you know to me it is first and foremost a public gathering
[1:18:16] and dining space but now that it's so beautiful and I think it has turned out
[1:18:20] really well we're going to get these requests and I mean if it's we don't
[1:18:24] rent it for public use it's only for special events then you know we go that
[1:18:29] route but I mean I I don't have buying one way or the other I don't want to see
[1:18:33] it to where it's rented every single weekend and every time somebody wants
[1:18:37] just to come hang out and with the computer up and get food different
[1:18:40] restaurants oh we can't sit there we can't sit there we can't sit there I
[1:18:43] don't want to see that I knew personally if I've been to a a public park come
[1:18:47] there not knowing that the space has been rented it's a big disappointment
[1:18:52] you think this is public space someone had the ability to take that away from
[1:18:56] me as a taxpayer to go use it that's a concern I guess I have I just think it's
[1:19:02] an opportunity that you know this is a member of the downtown organization is
[1:19:08] there not a way to just partner as the downtown organization and the town of
[1:19:13] Elon to celebrate this occasion and not have a formal
[1:19:19] rental policy and I'm sure they're going to foot the bill yes they've already
[1:19:23] filled out a special event uh application which is a $50 application
[1:19:28] they've already done that and turn I don't know if we've got insurance yet
[1:19:31] she's just kind of waiting to see what I said well we we're trying to figure out
[1:19:34] what to do with this Plaza but I'm fine with that too and that's what I'm gonna
[1:19:38] get back to is what is her expectation of having that special event that she
[1:19:43] has exclusive use of the of the plaza and well then why does she need it to
[1:19:49] begin with she wants the van to be in the plaza itself not up on her her patio
[1:19:53] actually in the plaza using our power so she would use the special event for that
[1:19:57] right it would correct well that goes back to the insurance and the green
[1:20:01] space so the insurance is this is it just the plaza piece that the insurance
[1:20:06] is covering because it's under the social District so they don't need to
[1:20:10] pull a liquor for it and then we we know without a shadow of a doubt people are
[1:20:15] going to be on the Green Space it just I it's just going to happen and especially
[1:20:19] if it's public so how does that insurance and I'll say specifically
[1:20:23] Pandora doesn't break my heart I mean and I don't think the church would
[1:20:26] either because they've been partners with us and other things in the past I
[1:20:29] mean it's not a problem that it wasn't that particular event it was the idea of
[1:20:35] having private usage well maybe it's working with our partners and we're okay
[1:20:39] and and that that I would come to you and say by the way they would like to
[1:20:42] have this you know it's potential they could flow over onto the grass and we
[1:20:46] work as what we are Partners yeah are they responsible for cleanup are they
[1:20:51] responsible for making sure there's extra waste basket
[1:20:55] that's what we tried to put in here yeah but even in there it didn't really
[1:21:00] specify enough for the clean up that they're responsible to clean up there's
[1:21:04] trash cans that are around that they're responsible for clean up does that mean
[1:21:08] they have to empty the town's trash cans and take we have trash service five days
[1:21:12] a week so he only have events the only day they don't pick up
[1:21:18] a downtown right you want to add something rich
[1:21:29] well a restaurant downtown wants to put a band on the
[1:21:36] plot somehow we would need to authorize that whether it's this way um you know
[1:21:45] if we say well okay if they get a special event
[1:21:48] permit that's fine you folks aren't involved in any of that that
[1:21:55] um is I recognize your need that oh well
[1:22:03] that's that's a private public event rather than a public public event they
[1:22:08] the right to be sitting on on the lawn at the
[1:22:11] church maybe we figure out a way to demarcate where the edge of the plaza is
[1:22:16] and say you know you can't go beyond there although still part of the social
[1:22:21] District so could go that I mean that that's that's that's a point of
[1:22:26] confusion I'm not sure how to address I think I think Monty also named it those
[1:22:31] that when the church decides is having an event out there and you've and you've
[1:22:35] now rented the space and we're having our event you're having your event and
[1:22:39] we're not coordinating together and we're not coordinating uh I mean that
[1:22:44] and and it doesn't preclude you to have to coordinate with us that's the thing
[1:22:47] so coordination I think is a separate issue that we can certainly address it's
[1:22:53] if it's if it's something that we typically do when somebody else is doing
[1:22:56] it is that a big problem
[1:23:01] versus you mentioned a craft fair so a group wants to use the plaza to set up a
[1:23:07] craft show and they take up all the dining
[1:23:10] space during lunch hour or at dinner time somehow we need to have some way to
[1:23:20] either authorize it control it that way
[1:23:25] or prohibit it so that you know some doesn't just show up
[1:23:31] say hey let's take up all these tables and you know sell our
[1:23:35] candles they won't be moving the tables right who's going to move the tables if
[1:23:40] things need need to happen like that then well on our special event permit
[1:23:43] which is part would be part of this process if anything like that has to be
[1:23:46] done then they have to pay for our staff to do those things okay well that's I'm
[1:23:50] GL I'm speaking as a council person I'm overhearing just if I can summarize that
[1:23:55] you stuff now what's that that can somebody just go s their candles on the
[1:24:01] side of the street they have to give have a so we we could we could stop that
[1:24:06] if somebody just wanted to go down there and just set up their art to give away
[1:24:09] or to look it's not considered a bigger part of the sidewalk then no well you
[1:24:16] know or you have a dance troop that goes down there wants to perform I'm just I'm
[1:24:19] envisioning what a great place we could set up and we could spend three hours
[1:24:23] dancing here let's you know push all the tables out of the way it will happen
[1:24:27] just from my own experience in previous jurisdictions we have to have something
[1:24:31] in place and if if it's not this complicated that's you want to do a
[1:24:36] public EV an event in the space you have to go through the special event process
[1:24:39] and then we decide and some of that might be oh I better call Randy on this
[1:24:44] because this is sounding larger than I think we can decide without and that
[1:24:48] leaves it every department head sees that
[1:24:51] pery and inside the permit it says about trash and clean up and removing and all
[1:24:57] that that has to be agreed in the special events especially and it would
[1:25:01] be nice if you could just call me but you're actually calling my trustees
[1:25:05] you're saying you know the trustees of the building they'd have to come up with
[1:25:08] find two months notice right two months notice should be fair fair amount of
[1:25:13] time for us coordinate coordinate do for example if Randy's got scheduled
[1:25:17] something on a Saturday or wedding he may be opposed allow to be
[1:25:23] used during that time period or if we have a CLC event that's
[1:25:27] going to fill the parking lot the current special use permit special event
[1:25:32] permit special event two months it's two months just or not just specifically for
[1:25:36] this for anything and it's $50 plus the cost of town Services exactly to be
[1:25:41] honest I think anything in the plaza I would probably just come to you as as an
[1:25:45] automatic we're almost going to have to yeah because I'm just thinking now
[1:25:48] there's a parking altern there's a parking situation now well I just think
[1:25:51] it should be be limited I age I don't think it should be a private event space
[1:25:56] I think it should be open for people to come and sit and you know if they want
[1:26:01] to have a little p two person meeting or if like a family of 10 wants to gather
[1:26:05] and eat pizza or have coffee I think it should be fluid and open and not
[1:26:13] like like you would the park facility yeah I agree so in this case with
[1:26:17] Pandora they have filled out the special event permit I can then go to Randy and
[1:26:23] listen this is what they're proposing get an idea of how many people she's
[1:26:27] thinking and handle it that way it goes to all the department heads but I just
[1:26:31] think it has to be very clear this is not a private event and I I think in
[1:26:36] this case you've already discussed that but it's not a private event so if
[1:26:39] people were to to whomever right you know somebody can go and get a drink at
[1:26:44] Oak House Coffee or otherwise and down and sit you know I that's the way that I
[1:26:51] see I see as a public space they could so if somebody were to call to inquire
[1:26:57] and say I want to hold my kids birthday party can I reserve four tables the
[1:27:01] answer is definitely I would say there shelters
[1:27:05] available at the park or they can contact Pandora is about reserving for
[1:27:10] tables or it's you know come at your own rest you're welcome to to use the
[1:27:13] facility abut order your pizzas and venues that at slave
[1:27:19] Park so somebody wants a t with bathrooms too with bathroom facilities
[1:27:24] that's a big factor yeah that that would be unless might just wanted to have
[1:27:29] something not ideal I think we're in consensus that we're trying to
[1:27:35] Envision what could happen here and so we might be revisiting this at a couple
[1:27:40] other times um the truth is is that you're absolutely right that's a
[1:27:44] beautiful setting and I think it's when it's all said and done um you're talking
[1:27:49] about doing T dancing though on that seal once it's p painted that's what me
[1:27:54] yeah it's gonna have to be something we're G have to figure out too so doing
[1:27:57] the soft shoot Randy the record I've never been a part
[1:28:00] of any dance entity that just shows up randomly like that they always have but
[1:28:08] but but if they wanted to use it that precludes anybody else from using it
[1:28:13] yeah see that's the problem so you know if you if you don't allow people to move
[1:28:16] the tables and and you know then then they're going to find some other venue
[1:28:23] so so I'm hearing no rentals
[1:28:27] with we're sticking to the special event process that's what great and kind of
[1:28:34] work there and that with we have strong coordination and yes and special events
[1:28:39] kick in when they're doing music um what are some of the other
[1:28:44] things that trigger special events um the the the amplif amplification
[1:28:52] okay right Mass Gathering anything that would
[1:28:59] gather so so obviously if the university wanted to use that property they made
[1:29:05] sizable investment in that property um like for a parents weekend or something
[1:29:09] like that would we allow special event use for that $400 rental
[1:29:16] feed figure I mean I feel like the university has plenty of space that they
[1:29:20] can host an event yeah but if we want to I mean and then they have um Phoenix
[1:29:25] Friday night in Burlington not Elon so would love to see some Elon events in
[1:29:31] our downtown I think again that goes back to they are partner that's the
[1:29:36] partner partner special events what if a class you know you envisioning a class
[1:29:41] coming over there and doing something I would I'm just saying they might not ask
[1:29:46] for a special they might just come over and's Atomic
[1:29:49] ccope we atomic
[1:29:59] it's not there it's not it's it's on it's on property but it's on it's on the
[1:30:06] RightWay so I I agree with the mayor in the sense that I really think this was
[1:30:11] made to be a public area for folks to come and I do appreciate you know all
[1:30:17] the thought that went into trying to make sure that it was accessible for
[1:30:21] these type of events and I certainly want to support our downtown folks but I
[1:30:25] think probably the best route to go is what everybody's I wasn't completely
[1:30:30] sold on this idea either I just was to present the the option of it because I
[1:30:35] kind of had that little feeling too what this is a public space but how do we
[1:30:39] know these requests are going to come and if they it's not even done yet we
[1:30:41] have people asking for it right so we have to have something in place and if
[1:30:45] our in places you can follow the special sent process it's a public space for
[1:30:52] anybody to come you're welcome to sit there but we don't move tables and that
[1:30:55] type of thing that's that is a policy when is Pandora want to do theirs
[1:31:01] January I don't Rec the date January yes yeah it's gonna be cold you I could see
[1:31:08] something how we do those music down to where they just hey we would like to
[1:31:13] advertise our 12th anniversary they pay for the band that you right the town
[1:31:18] doesn't put the the bill on the band and just moves in the same direction as it

[1:31:30] this isn't a pavilion this isn't a even the like downtown Burlington rents out
[1:31:35] the depot yeah but it's private they can tell people not to come in off the
[1:31:41] nature of where it is and how could we use that space during the farmers market
[1:31:46] yes ours right so we could it wouldn't be a conflict it's event we it's
[1:31:51] adjacent the Town Farmers Market yeah so we we could obviously use that space
[1:31:58] would be consistently using it for the same purpose and it's a public yes
[1:32:05] public space we it's a a vendor Cass set okay even the quilt show I know
[1:32:11] we've talked about art committee they wanted to put up quilts on this new yeah
[1:32:17] Part Town just put up town partner right they don't need to pay 50 I mean I don't

[1:33:14] still public property is it considered a big giant wide part of the sidewalk then
[1:33:19] no but it's public property still yes so and
[1:33:22] could do whatever they want on I think that's really important too I
[1:33:28] I would I'll verify that with our attorney okay I that would I think that
[1:33:32] would be helpful we have I recall we were looking you know
[1:33:38] set up the Christmas tree and the manora it was all right we have you by doing
[1:33:42] that we designate space as a place for public speech so if
[1:33:50] somebody were standing on the sidewalk we have no we don't have any rules
[1:33:53] against it right if they're on the Plaza I'll verify but I I I I'm doubtful
[1:34:00] that we'd have a lot of Lee that throw somebody out because they're saying
[1:34:03] something that you know we don't like and for the record I would love to
[1:34:09] do a big block party with the university and the town of Elon downtown I think
[1:34:14] that would be fabulous that's on

[1:34:21] what if this all night long well and that's what we were doing is um we're
[1:34:26] going to go with the special event permit for now let's test it out let's
[1:34:30] see how it goes however there is another change in the speed schedule that I
[1:34:35] believe we want to get through tonight and that is on page two with the street
[1:34:41] rway abandonment um to add the cost of legal advertisement to the fee schedule
[1:34:48] so um I would like to entertain a motion that we make um that change only to
[1:34:57] our um Town fee schedule for 2023 24 at this time um and without the other items
[1:35:05] that were in addition that we're adding on the Downtown Plaza fees so the only
[1:35:12] change that we would be making to that fee schedule is at the bottom of page
[1:35:16] two your street rideway abandonment and cost of legal advertisement do I have a
[1:35:23] motion what is that fee it's a $700 fee and the cost of
[1:35:29] legal advertisement because what does it cost legal advertisement to give you an
[1:35:34] example I had to run the resolution I actually had to print the resolution
[1:35:38] that was signed by the mayor for four consecutive weeks and that cost me $600
[1:35:44] $1,600 my budget for the year was 1,500 talk about the LMO advertisement I
[1:35:50] had to get $ back so what I'm proposing is they still pay the $700 for the staff
[1:35:56] review and the TRC review but the applicant has to pick up the cost of
[1:35:59] whatever the legal ad is they're getting property out of it I
[1:36:04] mean obviously we have to spend time doing that I mean if it's $100 we charge
[1:36:09] $120 I don't know what it costs to do that but I mean if we're just passing on
[1:36:13] the cost we're curing the effort to do that the the application fee of 700
[1:36:19] cover staff time so that would be cover preparing the resolution and everything
[1:36:24] like that send into the newspaper being for that for the advertising that uh was
[1:36:30] the K to advertis in one publication four consecutive weeks four
[1:36:36] weeks prior to the public
[1:36:43] hearing make that motion there I'll make that motion I have a
[1:36:48] motion do I have a second I'll second that mayor all in
[1:36:53] favor say I I any
[1:37:00] opposed all right moving on to consideration And discussing of naming
[1:37:06] policy
[1:37:12] facilities um we have uh as a community we have we
[1:37:18] have named things in the past uh without any guidelines or parameters or
[1:37:27] suggestions as to why or any protocols kind of been done at the
[1:37:32] mayor's discretion whatever whatever drove that
[1:37:38] decision talking with mayor sharp we thought that it was important that if
[1:37:44] we're going to do that uh that in the future that there be some reasonable
[1:37:51] policy in place would would provide guidance so you've got the draft in
[1:37:57] front of you uh that was cobbled together from three or four different
[1:38:03] communities uh and their language and as you can see we you know
[1:38:08] just Define what the purpose is lay the framework for how we're going to do this
[1:38:14] um and what the goals are and uh you know what it is that we're going to use
[1:38:19] to make those decisions
[1:38:24] naming it you know Community Plaza Centennial
[1:38:29] Hall Bob Smith Plaza Bob Smith Hall making those decisions as to what what
[1:38:36] what's appropriate what what triggers those criteria for uh someone to be
[1:38:41] eligible to have something named in their
[1:38:44] honor what types of things will we will be
[1:38:48] naming and perhaps even as important what types of things will not
[1:38:53] name U we won't have under this we wouldn't have Bob Smith Station
[1:38:59] 8 remain station eight there may be Bob Smith Fitness room within station eight
[1:39:07] um so the so features of the town that would be
[1:39:12] eligible par playgrounds uh ancillary buildings uh
[1:39:17] other facilities like that would not include things such as the town hall
[1:39:23] would not include departmental buildings um those would remain you know
[1:39:28] the name of the department if you
[1:39:33] will question really quick in place that named by
[1:39:39] the I don't believe so neighbor okay so I just want to make
[1:39:44] sure it's kind of like fireplace like hempton or what those and we're not
[1:39:49] proposing to change anything that's already been done and well I was looking
[1:39:52] that's I was looking carefully at that because there was some stuff in here
[1:39:55] about renaming and but it didn't look like you made it that easy so that was
[1:39:58] good I want to make sure that there would be no and we did confirm that
[1:40:03] everything that is currently named for a person already does meet this criteria
[1:40:07] as well so that was another reason why we went
[1:40:11] with the recommendations that we did is
[1:40:17] that Mark would you like to amend it to go down to 16
[1:40:22] not gonna do that well you know so just a little bit additional background is
[1:40:29] that it is it has really always just been the the mayor wanted to name
[1:40:34] something essentially and I said to Rich I
[1:40:38] said I've on I've been on this Council for six years in my opinion there
[1:40:42] shouldn't be anything named after me you know like it six years is nothing you
[1:40:48] know and but if we went by the the current policy hey I'm the mayor we're
[1:40:53] going to name it after me right like that's not I don't think that that
[1:40:57] should be the case I think that there should be a policy in place
[1:41:01] and probably what a year ago the fire department reached out to me well they
[1:41:07] reached out to you and then it came to me and they're like um hey we want to
[1:41:11] name this room after this person and I'm like well that needs to go to council
[1:41:16] well they they had already done it and so it kind of brought this all up like
[1:41:23] what's the policy and I think that there just needed to be something in place
[1:41:27] that made sense based off of what we already have in place you're right we
[1:41:33] wouldn't be looking to rename things unless there was
[1:41:37] some so somebody want to donate a million dollars to buy a new lad
[1:41:43] truck would we allow them your rights under this we wouldn't because the lad
[1:41:49] truck not considered I know that's what I'm saying but it's
[1:41:52] an asset it's a 20y year asset or
[1:41:56] longer no because be lad a it well it still has
[1:42:01] been a significant financial contributor to the
[1:42:05] town then we could name something after him other than the ladder truck yes well
[1:42:09] I will say when ala retired his truck it's still engine engine
[1:42:18] 8 dedicated a window to him if you will or I mean the decal was put on the truck
[1:42:24] but that's still engine a um a manhole cover off to them I'll show them so I
[1:42:30] mean I guess technically if if someone made a 51% Financial contribution to the
[1:42:37] said ladder truck then we would certainly put a little marker on that
[1:42:42] ladder truck on the pain for them that's what I was thinking Elon
[1:42:47] University fighting Phoenix fighting fire

[1:43:07] D um an e is I think also could be um somebody that has added significant
[1:43:14] Community involvement even not with the town and an example that I have just

[1:43:23] Omega Wilson and his wife um out of me yes they have they worked on the west
[1:43:32] revitalization like they just took that under their wing and they just so I
[1:43:36] guess it's kind of in partnership with the town but for over 20 years like
[1:43:41] they've just contributed to that community and just help you know give
[1:43:45] people rides and just make West in you know Revitalize the the West area and
[1:43:51] that is somebody who has contributed to the community they didn't volunteer you
[1:43:57] know they weren't working the the Christmas parades or the the lightings
[1:44:01] of the tree they weren't an official and they weren't somebody who worked with
[1:44:05] the town I just I don't know heroes yes it's somebody I don't I might not know
[1:44:11] what they could do they have and again I think it should
[1:44:15] be a council um I think there needs to be some would you word it um so I looked
[1:44:23] up one and I meant to email it to myself it was I saw it from
[1:44:29] towns um but it was a significant Community involvement or
[1:44:36] contribution and I think it has to be sold that way I don't think it can just
[1:44:39] be anybody um and I kind of you know I
[1:44:43] don't think it should be necessarily famous person when we go into
[1:44:45] Gibsonville right you see home of Tory Holk uh something like but that's not
[1:44:50] named after somebody but I don't I don't know I just I feel I can go with this if
[1:44:55] it can be somebody come to us and you know amended something just imagine that
[1:45:02] person who comes to Elon every day and just walks the street and picks up all
[1:45:06] the trash and that person has done that for 30
[1:45:10] years right you know I mean it's just something there and then it's like man
[1:45:14] he he doesn't get that kind of the Town mascot person hasn't really volunteered
[1:45:20] with us hasn't really worked for us I just would hate to exclude people in
[1:45:25] that that regard why don't we just change has served as a
[1:45:31] volunteer with the town or within the town or has contributed significantly to
[1:45:38] the town yeah contributed significant I think I
[1:45:44] think the thing about this at least the way that I see the way that I see it is
[1:45:50] you know we're trying to especially in the diversity equity and belonging
[1:45:54] committee we're trying to reach out to different communities that we might not
[1:45:58] necessarily know among ourselves and so I think this is a great way for us to
[1:46:04] reach out to other communities and say who are some of those families or who
[1:46:08] are some of those individuals that have really made a difference and this would
[1:46:12] allow them to participate not saying that that's necessarily going to be you
[1:46:17] know the end all be all but at least it gives a form for which people can say
[1:46:22] you know so in for doing this as you said for 20 or 30 years it would be
[1:46:27] really great if we name such and such after them obviously they would still
[1:46:31] have to apply like anybody else but this gives them the opportunity to use well I
[1:46:36] don't know about applications okay well well whatever the form whatever the
[1:46:41] referal referral excuse me referral we do application no I'm sorry I meant I
[1:46:46] meant so I added a letter letter D just to
[1:46:53] adft um so I bumped e down has contributed significantly to the town
[1:46:59] for a period of 20 years or more so how do we def do we need to Define
[1:47:06] that like my definition of contributed significantly would be served in a
[1:47:13] formal manner but what what are you all defining it as well you put you're also
[1:47:17] putting it on place of done these other ones I'm just trying to figure out what
[1:47:24] if it's some kind of a special thing that we want the council may want to do
[1:47:29] whether it is someone who's done a sign made a significant
[1:47:32] contribution nonfinancial contribution of time and effort to the
[1:47:43] town Years Part would that follow under the
[1:47:46] volunteer um contribution somebody gave a bunch of
[1:47:51] time and contribution to the town that' be a
[1:47:54] volunteer well but your your person your person
[1:47:59] didn't I was just trying to figure outy to
[1:48:03] wordi you're about started a comment earlier about volunteering with the town
[1:48:11] implies formal somewhat formal Arrangement um because on behalf of the
[1:48:17] with or be on behalf of the town get addresses your issu somebody who
[1:48:22] picks up the trash every day for 30 years um that they're not volunteering
[1:48:29] with us they're doing it on behalf of us for their own
[1:48:36] aition there's a lot of ways you could give recognition to people I think give
[1:48:40] example University does a great job they have benches around campus in honor of
[1:48:45] or memory of P employees doesn't have to be naming a building right there's ways
[1:48:51] you want to recognize families or
[1:48:55] people there multiple ways doing it space of we don't have 30 buildings that
[1:49:00] need naming rights so we're gonna be selective if we have a new building if
[1:49:06] that's what we decide to do if someone was worthy of doing
[1:49:11] that and that was my thought process and I mean and some municipalities have over
[1:49:16] 20 years on theirs um and my thought is is
[1:49:23] that if they are getting something named for them think that they should have a
[1:49:30] significant contribution to the town that affects the people that are paying
[1:49:37] for it the taxpayers yeah that was the way that I was looking at it but I agree
[1:49:41] I mean there's other ways to recognize people well can we just leave it that
[1:49:45] broad right you know we have this rubric but we can just say that they have
[1:49:50] contributed significantly to the town and whoever that person is there's going
[1:49:56] to be an argument made and then it's up to the current board to deem if that's
[1:50:01] significant enough think on there the more it's
[1:50:07] gonna have to check all these boxes but if it has just significant amount of
[1:50:14] this to the T I don't know I I just would hate to like what if there's This
[1:50:21] brilliant person who figured out how to engineer and conserve our water B what
[1:50:28] we're doing and we just man they just
[1:50:33] contributed said I'll give you a billion dollars name this building s's already
[1:50:39] named after it though right
[1:50:45] the my that's just not the way I look at it
[1:50:50] I I tend to agree with you mayor is it someone who's made a significant
[1:50:53] contribution not necessarily Financial but who's who's been an advocate who's
[1:50:56] worked hard for the town and made Elon a better place right I just think you know
[1:51:01] when you look at what we have named for people right right you have the hallway
[1:51:06] is Mike Doula he was our town manager forever um you have the Ron clap State
[1:51:14] playground he was sitting on this Council for 20 over 20 years you have
[1:51:20] the front of the building was dedicated to Mayor tally almost 40 years in
[1:51:25] service we have Lawrence Slade which is our longest standing olderman at the
[1:51:31] time named after him you have Beth Schmidt town clerk Town manager mayor
[1:51:37] council person more than 20 years of contributions I just feel like if you're
[1:51:43] going to name some if you're going to name everything else off of people who
[1:51:48] made such significant contributions to the town then that should be what your
[1:51:52] rot work is otherwise if let's say that there's six
[1:51:59] other people sitting up here and you make it a broad policy at the end of the
[1:52:05] day 6on students could be sitting up here and if this policy is not well done
[1:52:12] it can be any
[1:52:15] joeo four years from now ultimately students we don't like this policy we're
[1:52:21] gonna that's true let me ask you this um if you just if you just went back to the
[1:52:26] C that's in there right now and I think it's already been mentioned has served
[1:52:31] as a volunteer slash on behalf of the town of
[1:52:37] of the town for a period of 20 or more years I think you've covered it then
[1:52:42] that way leaves the door open for a significant something that happened like
[1:52:46] that family like you're talking about that couple you're talking about would
[1:52:50] include them because they're not official capacity having volunteered or
[1:52:54] as a volunteer like on one of the committees or something like
[1:52:57] that your suggestion is to change letter C has served as a volunteer with or on
[1:53:04] behalf of the town for a period of 20 years or more I take that
[1:53:08] convers kind of to the rubric of who's our Main Street star every year that

[1:57:42] that be handled and we said we don't want to do it in a naving policy we
[1:57:46] think it should instead be something something that's established by whatever
[1:57:51] campaign or whatever well we did it out at theith playground benches with people
[1:57:57] made donations yeah those kind of things we
[1:58:00] want to encourage people people may be encouraged to do that if they knew we
[1:58:04] would allow that well we have we have bricks out in front of town hall down at
[1:58:09] the corner of hagard and Williamson we went and built a playground and did the
[1:58:13] whole thing made the contribution it was all put up then they redid the
[1:58:16] playground and it's no longer there our name is no longer there but up in
[1:58:21] Virginia that's time comes and goes so that's so so to answer your question I
[1:58:27] think the change of function it's going to happen whether we like it or not

[2:03:15] the catch bases in Williamson need some touch-up work so there's still a little
[2:03:17] bit of work to take place uh not assured that that'll happen this

[2:03:29] weekend um that Tak out the plaza work is
[2:03:33] ongoing at Haggard and O Kelly on the waterline uh
[2:03:41] installation uh they've got another week of work at that intersection before they
[2:03:45] start moving down east Haggard it's coming Tuesday evening is the
[2:03:53] festival lights on campus and The Luminaries
[2:03:56] downtown um Friday the 1 is the tree lighting in Christmas celebration at
[2:04:01] Beth Schmid Park Saturday the 2nd is Hometown Christmas event downtown
[2:04:08] lighting the tree downtown next week December 7th is the
[2:04:14] lighting of the manora for Hanukkah and December 9th is a new event in Elon and
[2:04:22] that'll be a celebration of lights uh throughout slay uh or slate Park and uh
[2:04:28] there will at the same time the Baptist Church there will be doing a food drive
[2:04:33] uh to help Supply the the food pantry that they
[2:04:36] operate and for the non non-sp special things of the next week and half I
[2:04:42] direct everybody to head to our website uh the calendar of events under the
[2:04:46] Community section uh
[2:04:49] and I would like to take a real brief moment just to take a couple comments
[2:04:55] about say's last meeting with us um you you had made the comment mayor
[2:05:01] and I had it written as well that um when I saw the advertisement for Town
[2:05:07] manager Elon and and uh called down here um I talked to
[2:05:13] Diane when uh you folks decided you wanted to interview me Dian was one who
[2:05:19] called me and invited me to come down made the arrangements for me to stay
[2:05:24] down here um when I came down from the interview she was one to met me at the
[2:05:29] building to welcome me to Elon and escort me up to arrived late mind you uh
[2:05:35] and escorted me up to the room for my interview um and after you hired me and
[2:05:40] I came to work here and I spent I think I spent the first day or two pretty much
[2:05:45] just with Diane is learning the ropes of where things were and
[2:05:49] uh what we had um that transition was remarkably easy
[2:05:56] and uh I thank you for making it so easy for
[2:06:06] um she obviously is is the one who uh uh coordinates has been
[2:06:12] coordinating uh your meetings um making them go smoothly uh in the face of some
[2:06:19] significant hurdles at times uh Co comes to
[2:06:24] mind and you know when when we figured out we had to do something different and
[2:06:30] kind of looked at Diane and then didn't worry about it after that and you know
[2:06:37] she figured out how to get it done we got it done and like most of the towns
[2:06:42] in this country we had mistakes and we learned from them and we got them fixed
[2:06:48] next um because of her dedication
[2:06:54] um so and that took place during the good days and the bad days and times of
[2:07:00] good health and Times of not so good health um you know whether it's you know
[2:07:06] running things from home or what have you um so I want to say thank you to
[2:07:11] Diane for the warm welcome I got when I came here
[2:07:16] um friendship she's given me
[2:07:22] the support the dedication that she shows to her job every day um she puts
[2:07:27] the interests of our residents first um puts the interest of the
[2:07:32] council ahead of that and and our employees uh that's what she works
[2:07:37] toward every day whether it's finding that odd answer or answer to an odd
[2:07:43] question or piece of information that's missing um
[2:07:49] your service has been remarkable really appreciate it and uh it will be
[2:07:55] remembered thank you very
[2:08:05] much C enough got warm in here all of a sudden
[2:08:11] too so Bethy hope please don't make me
[2:08:16] follow that we love you Diane I hope you know
[2:08:20] that and um much I can't follow that so thank you so

[2:08:40] um also a question D Jill is there a rain contingency plan if Saturday is
[2:08:46] just raining we're we're what will we call it off will there be
[2:08:52] an announcement of calling it off or are we rain or shine event we're coming
[2:08:56] downtown um I think it would depends depend on the severity unfortunately
[2:09:00] because a lot of it is going to be up on the grass that would probably be a
[2:09:04] little bit um more concerned but I come from the school of thought
[2:09:09] you don't worry about it till that morning because the weather can change
[2:09:11] in a dime you're right question yeah if it's you know if
[2:09:17] it's a Down for then even if you try to have an event and that people don't come
[2:09:22] and Things become you're not unable to do things
[2:09:26] and I don't even think about it too much until about the day
[2:09:30] before um other than that I I look forward to uh all the happenings of of
[2:09:35] Elon and I think we have a great holiday season and I look forward to seeing
[2:09:41] everybody out experien at all it's part of what makes Elon feel
[2:09:47] like Randy um just to speak around for the
[2:09:52] church around the Christmas events um the Moravian love Feast which has been
[2:09:56] going on now for many many years uh unites the UN university community and
[2:10:02] church together to kind of get into the Christmas spirit it's five o'clock on
[2:10:08] this Sunday and I I want you all that you're all invited want to be a part and
[2:10:13] uh thing I love about the rabian love Feast is it's a welcome for everybody
[2:10:18] there's no there's no exclusion so that's what I really think makes it the
[2:10:22] best so so anyway I just wanted to make sure people knew about that our
[2:10:26] sustainability committee will meet uh this Wednesday as well and uh now that
[2:10:31] we have things like the LMO and other things there's we're we're basically
[2:10:35] working toward um toward a possibility of of an audit energy audit and see what
[2:10:42] that might look like we're so excited to have Kelly uh harar coming on uh to to
[2:10:48] be a part with us and that will I think strengthen some of our
[2:10:52] Partnerships I hope that goes well with along with this um and again I just want
[2:11:00] to reiterate that uh um you know the partnership that we that we try to
[2:11:06] express um you know as a community church and in the center of the of the
[2:11:11] of the town is is a genuine one we we've we've had a long history of that we want
[2:11:16] to try to continue that um Town Hall meetings that have taken
[2:11:21] place in our Sanctuary to all the different things that have come over the
[2:11:24] years so we want to continue that process and so I'm just glad that we can
[2:11:29] also be a presence through at least this just happens to be me right now but uh
[2:11:34] just to have some kind of a correlation Mak it
[2:11:39] important thank you that's what I have yeah just a couple things I I want to
[2:11:44] thank Lori for taking the proverbial football and dragging it across Ross the
[2:11:48] goal
[2:11:51] line came off the bench and we appreciate it a lot of lot of great
[2:11:55] volunteers I was amazed the people that stuck with the the project and and help
[2:12:01] contribute meaningfully support from Brad
[2:12:05] moity the people who didn't even live in our town that volunteered to step up and
[2:12:10] we're we're grateful for their participation and uh and you like I said
[2:12:14] there's a lot of things happen in December it's a great time of year um
[2:12:18] it's also a sad time because we're losing a lot of great people we're
[2:12:21] losing a federal councilman staff members phis is leaving
[2:12:26] so you I'm just hoping it's going to give opportunity for other people to
[2:12:29] step up and those voids it's going to be important until we fill those voids the
[2:12:34] rest of Staff has got to carry that keep things going
[2:12:38] so you know encourage you to continue on and you know that we're going we're
[2:12:42] going to start new year and it's going to be positive and in the council it's
[2:12:46] going to be it's going to be a lot of challenges out of us but
[2:12:55] we're well d i you know go back to Diane because she and I only ones in this room
[2:13:01] that've been here the whole time so uh 16 years and um it's been a pleasure
[2:13:07] working with you Diane and I had no idea we'd be going out the same time of
[2:13:11] course you started I did but U you've been great and uh just reiterate what
[2:13:18] rich said and you've been a very uh very important part of our team here in the
[2:13:23] town and very much appreciate it and hope you enjoy your retirement well
[2:13:28] deserved thank you very much bye thank you question about the love Feast do you

[2:14:05] be lighting the tree for us um on Friday so um if yall could be there even Satur
[2:14:11] for that Friday that's at FID Friday at F you got more than one tree so
[2:14:18] it's from 6 to 8 so I think we light it pretty early we get there early yeah I
[2:14:26] would get I would I will be there around five you don't have to get there by five
[2:14:32] but you'll be walking very far I'm walking you're not you know I'll park at
[2:14:38] Monty's house and walk I'll park at your
[2:14:44] house um I had planned to attend the devb meeting on December 4th
[2:14:49] unfortunately I now have to be in Charlotte for work on December 4th so I
[2:14:52] will not be there um but I will try my best to be at the first one in
[2:14:57] January um and then downtown Thursday I'll be in Charlotte on Thursday of this
[2:15:02] week so I won't be there either so I apologize um I did send out some
[2:15:08] requests around committees and assignments for next year so um if you
[2:15:14] have any edits please let me know otherwise we will be firming that up at
[2:15:19] our next meeting
[2:15:23] um and I think that is it I already said what I had to say to Diane and I'll be
[2:15:31] here on Wednesday to celebrate you and we'll be celebrating you at our next
