establishing the residential rental

some of the changes that I was
[2:53]
explaining to the council
um that we were making, the majority of
[2:57]
which were changes that we arrived at
with uh working with the attorney for
[3:03]
the Indiana Apartment Association.
That copy didn't get printed for you, so
[3:08]
those changes are in there now. All all
of the those pieces. So, we discussed a
[3:13]
lot of those changes. A lot of it was
clarification just to make sure that it
[3:16]
was clear with what's allowed under the
law not only in how
[3:22]
um multifamily rental units are treated,
also making adjustments to if you have
[3:29]
um
you know, a a multifamily or rental unit
[3:32]
that has a an LLC with multiple owners
listing one owner, still having to list
[3:38]
the, you know, a human being and an
actual address, but
[3:44]
making it more workable uh for those
type of situations, also clarifying
[3:50]
difference between registration and
permit um
[3:55]
and
the changes that we made as discussed in
[3:59]
the public meeting with the interested
parties about providing a grace period
[4:03]
or a cure period. That was in the last
months and this as well. 30-day grace
[4:07]
period if um the inspector comes out and
finds something
[4:11]
issues a notice that the property owner
would have 30 days to bring the property
[4:15]
into compliance before
a violation with any sort of penalty
[4:20]
would attach. Um and then one other item
to just draw your attention to that we
[4:27]
will need to if you choose to move
forward and adopt this tonight on the
[4:31]
third page of the signature copy under
157
[4:36]
.04 registration required
and the first section there A
[4:42]
when we had drafted this um it was you
know all rental you know all existing
[4:48]
rental units shall be registered with
the town between August 1st, 2026 and
[4:52]
November 1st, 2026. We're beyond August
1st, so
[4:57]
perhaps change that. My suggestion would
be if you move forward and adopt it
[5:01]
tonight, September 1st and then December
31st, you know, get it all done before
[5:06]
the end of the year or
however you'd like to discuss, but that
[5:09]
is one uh change that we would need to
add to this.

Similarly, if you wanted to in 157.06
we had a $5 registration fee that was
[5:25]
waived until November 1st, 2026. If you
wanted to move that to
[5:30]
whatever that second date um that you
picked in

15704 to to make that consistent, you

the registration fee is waived until
[5:42]

So, that is the other side of the rental

business. It's not all profit. And And
we're all You know, and I don't live

high. I live in a simple little house,
and the rest of it I give away to help
[15:46]
people. And that's where I'm coming
from, and you all And they good money,
[15:51]
you live off of our tax money, a lot of
you. And that's where we're at.

that's what I got to say about this.

you're trying to put on us now.

got to either railroad out of town or

whatever.

But, just think twice before you jump
because, like he said, we try to be to

the renters, try to make a decent income
ourselves, but you also know there's a

lot of people that are really
struggling. And

I I think you just have to think about
it. It's going to just fall back on the

renters.
It always does, unfortunately, poor poor
[17:30]
folks.
And and that's not good. So, thanks

twice for your job. It's nice to be able
to have a hand in things. Sometimes

sometimes it's not good for people to
have a hand in having a situation. We've

gone I see 1865 there. We're at this
point we say the four blocks this has

complain about things that really just

contact you guys first like he always

does. Our problem is is that we don't
have information to contact those
[18:56]
people. There's so many of them that he
can't do that. Then he's knocking on the
[19:00]
door with the tenants. Then it becomes a
whole different situation, you know,
[19:04]
because we can't get a hold of a
property owner. But
[19:07]
And and that really does exclude a lot
of our local people. So, but we can't
[19:11]
just you can't exclude people. We have
to include everybody in this. But,
[19:15]
you'll have the opportunity, like I
said, to register these things at no
[19:18]
cost to you. There'll be no burden on
you. Nothing will really change for you,
[19:22]
as long as you continue to take care of
your property. And And obviously, you
[19:26]
guys do. So, nobody's trying to to
change that for you. So, I just want you
[19:30]
to know that that's not our intention.

I try to keep my rent cheap.

had the same people for years. They

leave the apartments to my girls, and

hopefully they will sell them. Now,
say, "Why don't you sell them yourself?"

There's so many ands, ifs, and buts, and
so much trouble. I I can't afford to

because I live in one of them,

do appreciate those that have taken time

So as as we always do, I've met with all

earlier this month with the there was a

public meeting um just to sort of go
over everything again and then made some

additional changes after that. So I'm
just going to go over some of the final
[29:22]
things that we made.
Um
[29:26]
so based on the salaries, we've
increased everyone's salary in the
[29:30]
budget for 3%. Um the longevity pay is
changed as usual. We did have a couple
[29:36]
price um adjustments based on their
positions um that are pre-proposed ones
[29:42]
for the park manager and the others for
the town manager.
[29:45]
Um on both of those, obviously none of
these these are all allowable in the
[29:50]
budget. It's then obviously got to be
approved in the salary resolution or
[29:54]
salary ordinance that you have. So
those are you know, it's just but it's
[29:57]
been put and allowed in the budget. Um
then we've added a full-time officer
[30:03]
under the um general fund. Um we've also
added a few positions because we're
[30:08]
trying to
get everything in order
[30:12]
in case the day comes that Joe wants to
retire.

Um we're adding a civil engineer and
then an assistant town manager. We've
[30:22]
added those positions. We've also added
a deputy planner, but in that we've also

eliminated the building inspector

rehired. And one of the reasons we're
adding that deputy planner is when I
[30:36]
looked at the fees that we've received,
they're up 450%
[30:40]
over last year. So I mean, it's
definitely justifiable as far as where
[30:45]
that's at. So, that's why we've added
that position.

and then
[30:53]
the benefits we've added a 20% So, we've
not gotten to receive the information on
[30:58]
that yet.
Um as our far as our supplies, we've
[31:01]
done a 3%.
Um we did increase the police fuel to
[31:06]
reflect the higher gas prices and then
also for the additional officer. Um we
[31:11]
have added $10,000 for police vests. Um
we he's applied for a $10,000 grant,
[31:18]
which is also in that which will cover
that. If we don't receive that, we still
[31:22]
have the funds to accommodate that, but
hopefully we'll have a grant to cover
[31:25]
those.
Um and then we've um added 3% basically
[31:30]
for the rest of those.
For our other services, um again,
[31:34]
basically overall, it's 3%
um for most expenses related to that. Um
[31:40]
we did add a little additional monies
for some planned um IT cost um as far as
[31:46]
that. We've got um
some increases in the trash contract
[31:52]
based off of the contract. We've
increased that, but then the offset is
[31:55]
the revenue, which is so it offsets each
other.
[31:58]
Because we had such a liability
insurance went up last year so much, we
[32:03]
did include another 30% for that cuz we
don't know exactly where that's going to
[32:06]
come in yet. Um we're hoping it'll be
lower, but we just want to make sure we
[32:10]
accommodated that.
And then we also added $2,500 additional
[32:15]
for fireworks for next year.
Um and then our utilities, um which we
[32:19]
normally always do, is at 10%.
Um capital outlays for the township town
[32:25]
portion of it, we've added um
for the cloud-based computing um versus
[32:31]
on our server cuz we're moving that to
cloud-based this year.
[32:34]
And then the vehicles, we will don't
have any police vehicles in this budget.
[32:39]
Um we're hoping to do a geo bond and
then a lot of times we take some as the
[32:43]
continuing education. Um so we don't
have any in this year's budget um
[32:48]
for that.
Um local road and street, we're keeping
[32:52]
the same
um which we've not really changed. It's
[32:55]
always at the 50,000. We just kept that
the same. Um MBH, um again we did the
[33:00]
same for the um personal services.
And then um there weren't really much
[33:06]
changes in the supplies other than the
3%. We had a little bit added for some
[33:11]
clothing and boots that's increased to
the current spending.
[33:14]
Um and then our other services
we have added monies for some
[33:20]
projects.

» So the MBH funds that come in are split
part of it has to have 50% of it has to

be set aside for
capital projects and we've been letting

that build up. Well, this year we're
going to budget 350,000

um of that. So part of that money's

going to be using that restricted money.
So um
[33:42]
200,000 of that's going to be used for
that. So um which is for the repairs of
[33:46]
streets cuz it's for construction,
reconstruction, preservation. So we'll
[33:49]
be using that for paving projects.
Um and then we're going to increase
[33:54]
signs in our capital outlays $10,000.
And then some of the other requests for
[33:59]
equipment and things from Brian we're
going to be doing in the geo bond.

And then under the park
we will be um
[34:09]
increasing again fuel um for higher
prices for about 10%.

Um
we'll be adding um
[34:18]
trees. We're going to add trees. We're
adding a line for that for $20,000.

And um our pest control's been a little
bit higher, so we've increased that as
[34:27]
um as well.
We have some equipment repairs we're
[34:30]
adding um for the dump truck for 22,000.
And again, our liability insurance.

Um
as far as capital outlays, we will be
[34:40]
doing um 75,000 for the
planned um restroom renovations. Um we
[34:46]
got some fence replacements. We're
adding $25,000 for trails.

And then, you know, some things for the
buildings. We will also be doing some
[34:54]
some of the things that are going to be
coming through this year, which we have
[34:57]
been as I've mentioned in the past, we
we've been trying to save her money for
[35:01]
that. So, we've got some build-up cash
in the park. So, we'll be doing
[35:04]
additional appropriation at the same
time we do the public hearing. So, it'll
[35:06]
be a public hearing and then a
resolution that you can adopt right
[35:09]
after that. So, I'm going to have that
exact amount. We'll have that at the
[35:12]
next meeting.
Um as far as um the rest of the money
[35:18]
that we need for the paving, we will be
taking out of the CCD, the capital
[35:23]
cumulative capital development. So, that
one's going to be higher than what we
[35:26]
normally do. We'll be adding um 100,000
there.

And overall, that's pretty much it. The
um circuit breakers, they did finally
[35:35]
come out and they they actually did
decrease a little bit. Um but they
[35:39]
finally just came out, so I got those
numbers. I'm still waiting for
[35:43]
miscellaneous revenues. They're supposed
to come out this week, so we'll see.

being here. I was anticipating being
here the 1st of the month, but we ran

into a little concern about the ADA
compliance to the north side of the new

pedestrian bridge.
Got all that figured out and worked out,
[40:30]
so
um I think over the last couple of weeks
[40:34]
we've had a couple of improvements.
Memorial Park added to the project on
[40:38]
some restroom renovations. So, we worked
with Heath in order to come up with
[40:42]
those numbers. Um
Alex has given us a redline version of
[40:47]
the agreement, which we gave a couple of
weeks ago, and we've accepted all of
[40:51]
those.
We had to add the exhibits, which goes
[40:54]
through the pricing and some of the
GMP reports, guaranteed maximum price
[40:59]
reports, and some other exhibits that'll
be filled in or at a later date, more
[41:02]
towards the end of the project. So,
really at at at this point in time
[41:08]
our original number on just Landmark, if
you remember, was a million 941 408.
[41:15]
And working with Heath on the Memorial
Park upgrades,
[41:20]
that was an additional 243, so we're
currently at 2.184 million.
[41:26]
And I think we're asking for approval of
the agreement tonight, so we can get to
[41:30]

Uh next we have the MOU water agreement
with McCordsville. Joe?

we've been talking about with

McCordsville for a while and brought it
up with the council several times um
[44:00]
over the year.
This is a an MOU between the town of
[44:04]
Fortville and the town of McCordsville
to service water
[44:08]
into the territory
that will eventually become McCordsville
[44:13]
or
should be McCordsville before the
[44:17]
service is ever provided. And just to
refresh your memory, we've got an MOU
[44:21]
with uh
McCordville that 400 will be our
[44:25]
boundary as far as annexation. So, we
will not annex beyond 400 and they won't
[44:30]
come this direction. Um a big part of
this MOU and I know part of their
[44:34]
concern is
we we for one, we just wanted to make
[44:37]
sure that
they were good with us
[44:41]
getting into that territory
and then giving us a territory that we
[44:45]
could plan to to make sure that we could
size the mains properly and make sure
[44:49]
that we'll be able to service the area
correctly. And then their part of the
[44:54]
agreement was uh more of a concern that
we don't try to annex across that
[45:00]
original agreed upon 400 boundary
um just because we are servicing the
[45:05]
water to that area. So, that's pretty
much what this agreement spells out. And
[45:09]
if you look at the very last page,
there's a an exhibit there. It's got the
[45:13]
drawing.
400 West
[45:16]
is where the town of Fortville's limits
are. Um our sewer territory ends at 400
[45:21]
West. McCordsville comes up to uh 400
West on the west side of the road. Um
[45:27]
there's about a square mile, roughly,
that's kind of marked out there that
[45:32]
makes more sense for
Fortville to service them. Um
[45:37]
we stopped we didn't go any further
south because I think uh
[45:41]
there's some development that they're
proposing along 234 that will more than
[45:45]
likely have citizens in the area. Makes
more sense for citizens to serve them
[45:49]
than it would for us. So,
and they this was kind of a uh
[45:53]
you know, a a mutual agreed upon
territory that
[45:57]
worked for McCordsville, worked for us
that we could serve and it would allow
[46:02]
them to continue to grow because as of
right now citizens uh
[46:07]
is not prepared to service part of this
territory.

And and we can
So.

rates lower, and keeps it

In fact, let me go back to the water
um prior to our last rate increase,

and we had to do the water treatment
plant, which we're going to do a water
[47:17]
treatment plant anyway,
we hadn't raised our rates for over
[47:21]
what, 16 or 17 years.
And that was a lot of that was based on
[47:26]
extending our utilities out, and being
able to pick up more users. Was able to
[47:30]
keep our rates down for everybody here.

someone comes to the town and would like

um have their name on a public facility,
this outlines the process that
[50:52]
they would go through doing that.

this that there'll be opportunities such

understanding of it is is the plan for

back through the parks and or schools.
And so that's something he wants to

continue to do, but it'll be something
um that he's looking for just kind of

patrol the trails,

things like that. And with the recent
floods,
[1:02:17]
um
I know a lot of
[1:02:19]
departments have used them for that type
stuff. Knock on wood,
[1:02:24]
we hadn't had any of that, but I think
Penn kind of got hit a little bit and
[1:02:28]
Camber City was underwater and a lot of
the Southeast communities were
[1:02:31]
underwater.
Um so, I have the money in my budget
[1:02:37]
that's been basically fully refunded by
some over payments and by insurance.
[1:02:43]
Um and I reached out and got three
quotes, which you guys all have.
[1:02:48]
Here's a summary of the quote um with
all the specs. Everything's the exact
[1:02:53]
same except from Indy Power Sports. They
did not have
[1:02:57]
what I was looking for, so they quoted a
higher-end model, which I'm really not
[1:03:02]
interested in.
Um
[1:03:05]
but I'd like to get approval to go ahead
and
[1:03:09]
make that purchase for the from Fear
Power Sports in Berne, Indiana
[1:03:16]
uh for 26,725.
That covers everything that we would
[1:03:21]
need um
to have some off-road capability and to

be able to to patrol the trails a little
bit easier.

And with the town growing and it just
and we're putting in more trails and
[1:03:33]
parks and things like that, it just
gives us that a different advantage

um than what we currently have with a a
truck or a patrol vehicle.

We don't have any off-road capable
vehicles even though they're all-wheel
[1:03:46]
drive or four-wheel drive, they just
they're not going to go through water or

The trails plan is coming along um

pretty good right now as far as the
section two. We're still

uh looking to let that project November
5th. Uh seem like everything's lining up

with all of our permits and all the
INDOT stuff that we need. So, looking
[1:06:10]
forward to to getting moving on that
project. Um INDOT has uh given us the
[1:06:16]
approval for the intersection at 13th
and uh Broadway for the South um Madison
[1:06:22]
Boulevard project that we're working on.
We had uh talked to INDOT about
[1:06:26]
expediting that permit just due to some
of the other intersections that INDOT's
[1:06:31]
going to be working on the next few
years. Um we can try to get our project
[1:06:35]
done
before
[1:06:38]
um they start closing down some of these
other intersections and causing detour
[1:06:42]
issues.
Um and then we've got a uh
[1:06:46]
300 ft of 10-in storm pipe that's on
McCarty Street north of Church.
[1:06:51]
Um we've been having a lot of issues and
I think a lot of you probably gone
[1:06:55]
through the standing water on State
Street there at McCarty when we get a
[1:06:59]
good rain.
The uh the pipe we tried to get a video
[1:07:03]
through it. The only thing we could get
a video through the pipe was busted and
[1:07:06]
collapsed and
pretty bad shape and it's it's packed
[1:07:10]
full of stones. So,
we're going to be getting some price
[1:07:13]
quotes to set one manhole and run about
300 ft of storm pipe so we can fix that
[1:07:18]
and get that drain flowing again.
Um just an update on the alley there on
[1:07:23]
Main Street. All the concrete's in, the
dirt's in, the electrical's ran, the
[1:07:27]
water's ran.
Um
[1:07:29]
our goal is we got a patch on the
west side where they had to dig up the
[1:07:33]
water main.
Uh we're going to get that patched, try
[1:07:36]
to get all the plantings in there and
get it opened up for the uh
[1:07:40]
uh
the Blazer 88 ride this weekend and
[1:07:44]
definitely before Christmas.

we I know Heath has picked up all the
plants and if the weather holds off,

they'll be getting those put in the
ground on Wednesday.

report on was to follow up on the senior

planner position. So,
um really quickly

for the public's benefit too is we had a
um there's myself, and there's Jerry in
[1:11:49]
the department, and then we had a
part-time
[1:11:51]
um administrative assistant, uh Sarah.
She did a wonderful job, but she went
[1:11:55]
ahead and took um full-time employment
elsewhere.
[1:11:58]
So, rather than refilling that position,
we actually eliminated it.
[1:12:04]
And then converted it to a planner. Just
have an additional planner so that this
[1:12:08]
way that this person
um has the ability to review items and
[1:12:12]
also approve items,
um and it'll hopefully make things more
[1:12:16]
efficient for the residents. Like I had
mentioned I think maybe at a previous
[1:12:20]
meeting,
ultimately what we'd like to get to is
[1:12:23]
some over-the-counter approvals for some
simple things, whether that's easement
[1:12:27]
encroachments, electrical permits, shed,
um really
[1:12:32]
um routine type items. So, um
[1:12:37]
So, in order to do that,
um we we interviewed probably about
[1:12:43]
I I think we interviewed seven people,
and we had probably
[1:12:48]
maybe about 40 45
um applicants in one fashion or another.
[1:12:53]
So, we had a really good amount of
qualified people that were interested in
[1:12:57]
the position.
And it was originally going to be an
[1:13:01]
assistant planner,
[1:13:05]
a lower-tier entry-level position.
However,
[1:13:11]
we ended up offering the job to her. Her
name is Hannah Rose Urbanski. She was
[1:13:16]
the planning director and she was an
interim planning director and then
[1:13:20]
became planning director in Pendleton.
She's got her
[1:13:24]
undergraduate degree in planning,
master's in planning.
[1:13:27]
So, she's got great experience,
especially in a small town like ours.
[1:13:32]
So, very personable, very knowledgeable.
Definitely looking forward to having her
[1:13:39]
start. She's going to start on Monday,
October 5th.
[1:13:44]
So, that's where we're at with that and

she she wants to get back in the

municipal planning and and
um

she's familiar with Fortville, so
I think certainly with with any
[1:15:34]
applicant, there's always a degree of of
risk that that person
[1:15:39]
may move on, but um you know, at the end
of the day, I think given the the
[1:15:45]
applicant pool that we had, it was a
strong pool, um there's no doubt that
[1:15:50]
she was the most qualified and and also
had the best
[1:15:54]
experience um for a town like like
Fortville, so
[1:15:59]
we'll see. Looking forward to it.
