members. Thank you staff for having me
[3:39]
this evening. I'm Kristen Pollock and
I'm running for Circuit Court Judge
[3:42]
Division 2. I'm actually in a runoff. Um
the non office election will be the
[3:47]
runoff election will be held November
3rd with the the rest of all of the
[3:51]
candidates on the general ballot. Um
it's a nonpartisan position. So judges
[3:57]
do not run aligned with either party.
And in fact we'll do a really uh tricky
[4:02]
job trying not to tell you or give you
an indication of what party we might
[4:06]
have aligned with in the past or or
where we might vote on certain issues or
[4:10]
decide on certain issues. And that's
important for everyone because wants you
[4:14]
to walk into a courtroom and not feel
that you would be judged based on your
[4:18]
political party or affiliation or what
the judge might think of you. Um, I am a
[4:23]
trial lawyer. I have been practicing
since 1999.
[4:27]
My law firm is Miller Butler. We have
offices in downtown Rogers in downtown
[4:32]
Fagatville. I'm born and bred in
Northwest Arkansas. Lived my whole life
[4:36]
here. I was originally raised in
Bittenville and have lived here in
[4:40]
Washington County since 1997. I have
three children. Um, attend school here.
[4:46]
Um, I attend church at St. Joseph
Catholic Church, which is which is on
[4:50]
this side of Fateville. And, um, I'm
running for this position because the
[4:54]
judge that holds it is retiring and he
was a very fine judge and I want to
[4:58]
follow in his footsteps. I think that I
would ask for each of you who are sort
[5:03]
of investigating the candidates in this
race to look at trial experience,
[5:09]
leadership experience, and community
involvement. I think that I will will
[5:14]
meet all of your satisfaction in those
areas as I have been trying cases for
[5:18]
more than 27 years. I've been involved
in this community since I graduated from
[5:23]
law school. right out of the gate and
started giving my time back to the heart
[5:27]
association, the Junior League of
Northwest Arkansas, our schools, um the
[5:31]
the food pantry, and various community
efforts. My husband has coached youth
[5:36]
sports in this area for 20 years. And um
I I have been appointed to some really
[5:42]
impressive leadership positions by the
governors of the state of Arkansas. And
[5:46]
that meant a lot to me because as a
lawyer, I believe that integrity um and
[5:51]
and uh leadership are important pieces
of our profession. It's an honorable
[5:55]
profession and I want to continue to
serve you as circuit judge of Washington
[6:00]
and Madison counties. So, thank you very
much for these two and a half minutes
[6:04]
and I look forward to visit with you

we paid the stage one of the park

improvements uh which was like 135
$136,000 that came out. We will be

on file was 297

$17,000 I think was the difference. And

so we ended up having to contact AR dot
and then show them minutes from the
[9:23]
meeting on the alternative deductions
that we had actually um approved and
[9:29]
then that the total amount was 313744.
So that's why I know that number so well
[9:34]
is we've been talking about that that
wasn't before act on their part of the
[9:38]
paperwork that they received initially
and so we're editing that but we should
[9:42]
get reimbursement within the next I
would say within the next month and a
[9:46]
half.

you notice that we don't have anything

budgeted for interest expense we will

CDs um pretty straightforward we're
actually on schedule with our revenue
[11:50]
expense projections
um we're running just slightly under at
[11:55]
this point in time because we haven't
done our improvement monies from the uh
[11:59]
state for general register as usually
comes in. So we should see that but we
[12:05]
should balance according to schedule
where we thought we would be. So any

I think that the when we hire a new

employee, whether it be city hall or
police department, that they should come

that we had that we have after they've

been hired to introduce them.

not going to request that of them to

come to a meeting just after they've
been hired. Um, this takes time away
[14:29]
from their family. That's not really
part of the job description.

and beyond measure is of their their

and they have the option to purchase
their duty rifle and their duty shotgun

have to worry his retirement batch.

So for July 2026, City Park, they
replace the water faucet and park
[15:44]
entrance. For some reason,
it's this number three for frost

rehydrants. I not worked there, but I
guess we got a couple of duds and
[15:55]
they've had to pull them up or replace
them because they were leaky.

whatever reason, the actual mechanisms

dehydrant. The irrigation system on the
south park. There was some sprinkler
[16:22]
heads that need to be fixed. They fixed
those. Continued mowing at city parks
[16:28]
along Highway 45
trails. Uh brush performed vertical
[16:34]
trimming along city streets. Uh sprayed
roundup around city street signs.
[16:39]
repaired washed out ground radio ground
entrance on the way Spring Park Lane
[16:45]
after the rain damage and then uh they
did surface Spring Park Lane this last
[16:51]
week. So it is now paved. So that is
complete. cleaned up city streets after
[16:55]
the storm. Installed a note truck sign
on fire tower and then maintenance. and
[17:01]
cleared dirt work behind the new city
street part shop and large rocks filled
[17:05]
with uh low areas leveled the ground
spread seed uh painted the outdoor dog
[17:11]
kennels continued mowing weedings the
all community building
[17:15]
the pond in the field beside the
community building installed a new
[17:20]
dumping sign continued improving the
street department shop by installing
[17:24]
cabinets purchased uniforms for their uh
street department staff performed
[17:28]
general maintenance at community
building reinstalled the uh doors stop.
[17:34]
We needed the rain guards out of trash
bags. Place brake pads and Ford
[17:39]
Explorer. Inspected the community
building roof in preparation for
[17:43]
repairing the framework.
Future projects build an information
[17:48]
kiosk at the community building. Uh
install an ice maker at city hall.
[17:53]
Complete the creek access point and park
entrance. Repair the community building
[17:56]
roof. and then level the ground at the
north park entrance where the stops will
[18:01]
ground. They've actually done that.

finish. There were some missing doc
document pieces that were needed for
[19:22]
them to be able to make decision so
they're going to bring it back to the
[19:25]
next next planning commission.

spent a few days talking with them and
figured it out and get my iPad back up

committee worked on updates to the city

pavilion the south entrance and the new
[20:40]
additional acreage as well as the
expansion expanding and trail system. We
[20:46]
anticipate having the map finalized at
our August meeting. Uh Mike continues to
[20:50]
work on improving the trail system
throughout the park, helping enhance
[20:53]
accessibility and overall appearance for

is referring to is that at the last

meeting, for those that weren't in

we would like to surface Watson Circle,
but when I got a bid estimate on what it
[35:30]
would cost to surface it, it's right at
$62,000.
[35:35]
That would put us right at either
our limit, the street fund, or maybe
[35:41]
even a few thousand over. Um and that is
without being able to utilize even more
[35:46]
money for tree removal. My concern is if
we do need more larger tree removal then
[35:54]
we wouldn't have money to do that by the
end of the year without you know going
[35:59]
to some of our reserve. Uh, so my
request was before I go out and get bids
[36:05]
and bring those back, wouldn't you guys
be okay with allocating that extra
[36:10]
possible $20,000
for that so that if we needed tree
[36:16]
removal for the end of the year, we
still would be able to have money to do
[36:20]
that without, you know,

this rough estimate to begin with, uh,
did that include them doing some grading

on that road because there are some
pretty serious humps on that road that

beginning and hire someone to come in
[42:26]
and actually spread the gravel. We can't
do it as a city staff. We actually have

to hire a crew that comes in with a

down there to be quite honest with the

canopy. It's one of those roads that
needs to be paved because it gets pretty

rough at times and it's hard on units

I will say that, you know, my plan was
to have Eddie Mashburn fill in as zoning

official and Eddie has been now with us
for

months now.

» So, um, he's done a lot of the training
and permitting. Um what we quickly
[48:42]
realized is Abby because she's in the
office 100% of the time and she's been
[48:47]
acting as permit coordinator zoning
official. Um technically I'm zoning
[48:52]
official because there's not been one
appointed since uh Lacy's uhation.
[48:57]
So uh but she's been working with me. We
do plan on having her go to it's called
[49:02]
a city planner class that certification
for city planning. But she's done a
[49:07]
great job with that. She's had questions
along the way which I've been there to
[49:10]
help field and we also make phone calls
to North Arkansas Region Planning. Um
[49:15]
and then we reference our own ordinances
because that's where we always refer
[49:18]
back to. So but um at this point
she's also going to be doing our
[49:25]
permitting in
[49:28]
» Oh what is

» so he's our director of facilities
management now. So he's moved more into
[49:37]
that. Well, we realized after Lacy's
termination that it did not take the
[49:42]
entire full-time to do what she was
doing. And so a lot of those duties
[49:47]
ended up being done by Abby. So at that
point when he came in, we knew we were
[49:51]
going to help get him in with permitting
because of his construction background.
[49:55]
And he still comes in and helps Abby
look at like a building permit. Someone
[49:59]
brings a building permit in, he come in
and look at it, say, "Yep, this all
[50:03]
looks kosher." uh they look at it
together and then they go through it.
[50:07]
Then they can move it on to either
approval or to landing commission at
[50:12]
that point.

>> So that's been a big help for her and

for him. Um, and we really spent
probably the best part of two months in
[50:24]
the beginning of Eddie's employment just
in the office doing permitting,

planning, zoning, looking at ordinances,
and then we started moving in towards

infrastructure facilities. What I needed
was I needed somebody who could be
[50:37]
charge of that department because every
single day I was calling and saying,
[50:41]
"What's on your agenda today? What what
are you guys doing? What's your next
[50:44]
steps?"
Eddie's somebody who I can say, "We need
[50:48]
these things done." and then he can go
get all the things and then bring it
[50:52]
back to me. Like the kiosk, we texted me
this morning about the kiosk. He had
[50:56]
gotten good on all the lumber prices,
how to put it together. He has the
[51:00]
knowledge and skill to do that without
me having to go down there or hire
[51:03]
somebody else to do it. And so him in
that role has been hugely beneficial to
[51:09]
all of us. I think Abby can attest to
that. Anybody at city hall can attest to
[51:14]
that. Um, so that's why Abby is now in
the role of being more zoning official
[51:20]
because she's at city hall 247. Well,
during open business hours,
[51:26]
» you'd be surprised at how many phone
calls we get for building planning. So,
[51:30]
» and JD, you may want to speak about
Aby's performance and how she's been
[51:35]
doing.

» I'll speak on Aby's behalf. She's since
she's taken over in that role, filled in
[51:42]
that role, things have ran smoothly. Um,
she's not afraid to reach out and ask

questions. She'll research and come up
with the right answer or collectively

I'm out in the field and I have a
[51:54]
question, she's quick to jump in the
Jeep and come meet me meet with the

versed on on all that. She's she's done
an excellent job since she's been in

within the 10 acres that is not part of

the park. So it's not park property. So
to call it park property is just a

misnomer. park property is just the two
acres is behind beauty building. Just

for point of clarification,

guess not the park, but children would

play there because it's right next to
the park. Um, and it's it's in a pretty

visible location. It's where we have the
bike race and the farmers market. Um,

pretty unsightly. I'd recommend that we
[54:54]
find a more discreet location that we
could use to create a brush pile if we
[55:01]
need to. That's what would be most
typical. U and then the other item uh
[55:07]
lesser concern, but still wanted to
bring it up just because I can I can see
[55:12]
my own children falling into this. It's
a concrete cylinder that was left by the
[55:17]
water company when they fixed that water
line on fire tower. Um,
[55:25]
you can see the location of it. It's
pretty pretty dead center in and where
[55:29]
the park is and it's kind of where that
step is at. And I if you have kids, you
[55:34]
know what happens when they're at a
park. They're both in each other. And
[55:37]
that uh concrete barrier is just the
right height to to really do some damage
[55:42]
if they're pushed into that. So, this uh
resolution is to remedy these two
[55:49]
issues. Um, I'll open it up for
discussion.

concrete cylinder that's there was left

there on purpose. I was asked by
families and kids that were there for

the kids to play on. My goal was to
always ground the edges down because I

felt like it was and I will take
responsibility that

um it has been ground down. It has been
painted now. um that's been there for
[56:19]
kids to play on because kids do play on
it. They enjoy walking on it. Um my kids
[56:24]
play on it or neighbors kids play on it.
So that's why that's there. If you like
[56:29]
it moves somewhere not so close to that
uh playground, we can do that. But I
[56:34]
think it's at least worthwhile to keep
it for kids to be able to play on. Um,
[56:38]
as far as the pond, we don't have any
other city property by which for us to
[56:44]
be able to be able to put recreation. We
cannot put it in the park because the
[56:50]
money that we accepted for the park, it
is park property and we cannot use that
[56:54]
for a place to take and
the site. The city doesn't own any other
[57:01]
property by which to be able to dispose
of those
[57:08]
green that we've had to remove from
streets and roads.
[57:12]
So, if you could think of another place
that the city has property that we own
[57:16]
that we could dispose of those, then I'd
be happy to entertain that. But at this
[57:21]
point, we don't.

engineering which I think it was like
$60,000 of engineering fees and then any
[1:19:01]
other next steps beyond that just
waiting for AR to get back to us. Now

that email this week. They had reached

out to them and they confirmed that Luke
Jo will be the

on the project and that's where we're

front pillars as well on the pavilion.

Um, something else that was another uh

update that I wanted to bring to
everybody's attention. Uh,

USPS. So, we finally did hear back from
them on our request. And just so
[1:20:24]
everybody's aware, this has been going
on since 2019.

Um, and we have actively continued. This
is the all the communication that we've
[1:20:34]
had with you USPS since my
administration. And this is back and
[1:20:39]
forth with emails, Congressman
Warmarmac's office, Chad Purer's office,
[1:20:44]
but what they essentially came back and
said was, "We're denying your request
[1:20:48]
for a zip code for your entire city."
But what they did say is that we can now
[1:20:53]
start using go since they're going to
say
[1:21:00]
» so we can start using goan as the name
designation and the zip that you
[1:21:05]
currently have but the last four would
remain the same. So that is what they
[1:21:10]
authorized now. Now, we still have the
ability to um
[1:21:18]
appeal this
>> the and and their concern and and again,

this may actually be something in your
wheelhouse if it's something that you
[1:21:27]
could do is that the the Goan Post
Office building consists of
[1:21:31]
approximately 324 square ft, which is
insufficient to support the delivery
[1:21:36]
volume associated with the proposed
service area. So the facility includes a
[1:21:41]
2x2 vestibule dock configuration allow
for rolling te Amazon drop shipments.
[1:21:48]
The building also has 9 foot canopy uh
without a lift and limited employee
[1:21:53]
parking space which further limits
operational viability. So what they're
[1:21:57]
essentially saying is if we really want
our own zip code we have to improve the
[1:22:02]
post office. we would have to enlarge
it, make it more accessible and
[1:22:06]
compatible with all those things that we
required. So
[1:22:11]
essentially what I'm saying is do you
want to appeal this?

some buy in from the owner of the

building for potential
renovation.

time there uh just kind of evaluating

the demographic, what's go what goes on

of a stop and go place anyway. Even when

the bank was there, it was designed for
folks to come in, op right back out, or

"Oh, Favville." And actually 124 North

Church Street is supposed to be Ger

If it pulled up from USPS as go, then
even though the zip code may be 72703-
[1:26:04]
whatever it is, 872, whatever, um, then
at that point, it's still going to come
[1:26:10]
up under Goian, we're going to get our
sales tax revenue. Right now, there's no
[1:26:14]
pick list for someone. If they're going
into those systems right now, it's not
[1:26:17]
even there. So, you put in goan, there's
only two addresses in them. One will
[1:26:22]
only pull up. Post office is the only
one that pulls up. I know this because
[1:26:25]
when I'm at city hall, I'm trying to
order something and I'm trying to have
[1:26:28]
it shipped to city hall. A lot of places
you put I put that address in, it won't
[1:26:33]
accept it. Like it literally won't
accept it as an address because it
[1:26:37]
doesn't even register. So once USPS gets
go as its own main well then at that
[1:26:43]
point it is going to have those pick
lists come in hopefully where 7273
[1:26:48]
whether it's you know a payil zip code
it still would have a go name to be able
[1:26:54]
to identify that it's in the city. I do
think it's a sort of a win, but it's not
[1:27:00]
a win getting our own zip code, but
again, I don't think we're going to get
[1:27:05]
our own zip code unless we do an
expansion of the post office. And I
[1:27:09]
don't know how feasible that is. I I
don't know that it is. I mean just
[1:27:13]
because of the cost of that and what it

requiring us requiring us to do with

encourage them to look at the St. Paul

there and they've got their own zip

improvement on those post offices. I

are going to mandate that we end up with
a larger post office. Now, we can still

appeal and they can deny it. And then I
guess we still get to keep go as the
[1:28:57]

going to do our part to bring up to

see what happens with that bill and then

submit a a a new request if that bill
does go through. I mean, that might help

Arkansas Code 1442107
[1:35:09]
is applicable to this situation,
which says that a council member,
[1:35:14]
official or municipal employee shall not
be interested directly or indirectly in
[1:35:21]
uh
profits of any contract for furniture,
[1:35:27]
supplies, equipment, services to the
city. U and it's been determined that
[1:35:33]
employment
by the city is a form of a contract. Uh
[1:35:39]
and so
my answer to calling and I recognize
[1:35:44]
it's just the parks commission which is
essentially an advisory board for but
[1:35:49]
Erin on the side of caution I would in
answering his question uh point you all
[1:35:55]
to that statute and that statute does
allow
[1:35:59]
uh employee
to also serve on a city board or in some
[1:36:05]
official capacity if the city council
has adopted ordinance specifically
[1:36:10]
allowing them to occur.

say that the Riverside Estates Board of
Directors is fulfilling the requirement

of the of the council.
Roughly eight months ago or so, you may
[1:38:18]
remember probably the last time we
talked about this. Um, you had required
[1:38:23]
that I secure a letter uh with
signatures from the board expressing our
[1:38:29]
interest in pursuing a conversation with
the council about the prospect of street
[1:38:36]
ownership in Riverside Estates and what
that may look like or what possibilities
[1:38:43]
might be there. And it took longer than
I expected or would have liked, but here
[1:38:48]
we are. And here is the letter and it's
signed. So, I know this is last session.
[1:38:53]
Um, I don't expect any resolution or or
action item or anything like that
[1:38:58]
tonight, but it's a it's uh I'm happy
that we were able to get it onto the
[1:39:03]
agenda because now I'll be there and
give you some time to think about it.
[1:39:08]
But our position is pretty
straightforward. As you can imagine, the
[1:39:12]
board of directors is responsible for
the maintenance and the upkeep, every
[1:39:16]
aspect of the street. So they're owned
by the residents equally. So this is not
[1:39:20]
you know uh what happens with those
streets would still have to go before
[1:39:23]
our residents but as a first step and in
satisfying your requirement. This is the
[1:39:28]
letter and the board is interested in
any dialogue about the prospect of I
[1:39:36]
don't know legally speaking I don't know
if it's deed you probably know Brian
[1:39:39]
deeding uh the have to dedicate the
roads to the city and then the city
[1:39:44]
would have to accept it.

that I think would be the board's
intended outcome, but um no question in
[1:39:55]
my mind that this is not [clears throat]
an easy sell. Um probably especially to
[1:40:00]

in this document. And I'm hoping that uh

of the city if you said that you would

never got resolved and then I was not

take care of all these new streets that
we've not been maintaining. And then

what do we do if we don't have the
finances to be able to to fix those? At

what point is it I mean, I'm having a
hard time even fixing the ones we have.

and I'm getting $400,000 grants that
we're waiting a year to get so that we
[1:42:26]
can resurface streets that, you know, we
don't have money to maintain. So,

» I like the idea. I do. I think it's a I
think it's a great idea. I I don't know

how we've not adopted these, you know,
when we build subdivisions, but
[1:42:41]
» Well, and part of it is that whenever
you build a street, you want a secondary
[1:42:47]
engineering firm. You know, this is what
most cities do that they have a
[1:42:50]
secondary independent engineering firm
that is confirming that street
[1:42:55]
construction and that's going on in that
subdivision. Something that has ever not
[1:43:01]
happened in Goan ever. And so without
having that history of knowing the
[1:43:06]
street conditions,
it you know puts everybody in difficult
[1:43:10]
position to know that that street is
going to maintain integrity.

» Understood. Um, I've tried to reach out
to ESI and been unsuccessful, but I will

continue to try. I'm trying to get
anything they're willing to give me
[1:43:24]
about the original construction. I don't
think anything is filed. I don't think

the county tells me they have nothing. I
[1:43:32]
think city hall, I'm not sure if it was
you or Lacy that I spoke to, but told me
[1:43:38]
they had they had nothing of record. Um,

ensure that any type of subdivision

one that made it planning process. We've

been in touch with three different
companies that have come out and given

us assessments and there's been almost
there's been no there's no line items in

the bids for any repair work at all. So,
I mean, we've got some, you know,
[1:47:12]
there's some gouges, but we're talking
about minimal, you know, very minimal.

Our streets are in great shape. Nothing
like you know Walker and Noles or any
[1:47:23]
other random subdivision like
