[0:00] All right. So, it's uh 6:31. We'll go ahead and call the meeting to order.
[0:04] [clears throat]
[0:08] » Okay. John Mort here. [clears throat]
[0:13] » Paul Anderson >> present.
[0:14] » Colton Martin here. >> Mr. Wright
[0:20] present. And >> Shawn Mayfield here. Okay. All right.
[0:34] I pledge to the flag of the United States of America and to the republic
[0:39] for it stands one nation under God indivisible with liberty and justice for
[0:44] all
[0:51] » the >> um I think that we need to add something
[0:56] to the agenda. Okay.
[0:58] » Okay. Uh last meeting we tabled until this meeting
[1:05] the box and circle discussion. >> It's on the agenda.
[1:11] » Huh? >> It's on the agenda.
[1:13] » It's already >> it's been added then.
[1:15] » No, it's under there allocation for street fund reserve balance. That's what
[1:19] that is. >> Oh, okay.
[1:22] » Yeah. So, it's already on the agenda. >> I wasn't sure whether
[1:24] » that's what that is. I I had the same question John because I do remember it
[1:28] was table and I didn't >> sorry I put I should have put Watson
[1:32] circle as part of that but that is what that is that allocation from reserve for
[1:36] that table diode >> uh under new city business could we add
[1:43] uh discussion on conflict of interest
[1:48] » under just a >> F
[1:52] » yeah that'd be good and that'll be Brian who's going to talk about that.
[1:59] » And then uh we've also been uh giving uh this statement by Riverside Estates
[2:09] that they would like to just have a general discussion on that. So I think
[2:13] uh if we wouldn't mind having that.
[2:19] Okay.
[2:32] For some reason, we're having a hard time.
[2:35] It's very uh hard to hear you guys tonight.
[2:39] » Are you coming through the mic? It's just being to speak up. If I turn it up
[2:43] any
[2:47] » All right. So, we've added that conflicted interest. I guess Brian's
[2:51] going to speak about that. Uh G Riverside, which I think Dan had
[2:56] asked for that, so we'll let him speak about that or John.
[3:00] And then any other adjustments or additions to the agenda?
[3:07] » I'll make a motion to approve the agenda with the additions of F and G under new
[3:13] business. >> All right, we have a motion and a
[3:17] second. public comments. All right, in favor.
[3:22] » All right, we'll move on to our public input time.
[3:26] So, anybody that wants to come up and speak. We got two minutes for anybody.
[3:35] » Good evening, Mr. Mayor, council members. Thank you staff for having me
[3:39] this evening. I'm Kristen Pollock and I'm running for Circuit Court Judge
[3:42] Division 2. I'm actually in a runoff. Um the non office election will be the
[3:47] runoff election will be held November 3rd with the the rest of all of the
[3:51] candidates on the general ballot. Um it's a nonpartisan position. So judges
[3:57] do not run aligned with either party. And in fact we'll do a really uh tricky
[4:02] job trying not to tell you or give you an indication of what party we might
[4:06] have aligned with in the past or or where we might vote on certain issues or
[4:10] decide on certain issues. And that's important for everyone because wants you
[4:14] to walk into a courtroom and not feel that you would be judged based on your
[4:18] political party or affiliation or what the judge might think of you. Um, I am a
[4:23] trial lawyer. I have been practicing since 1999.
[4:27] My law firm is Miller Butler. We have offices in downtown Rogers in downtown
[4:32] Fagatville. I'm born and bred in Northwest Arkansas. Lived my whole life
[4:36] here. I was originally raised in Bittenville and have lived here in
[4:40] Washington County since 1997. I have three children. Um, attend school here.
[4:46] Um, I attend church at St. Joseph Catholic Church, which is which is on
[4:50] this side of Fateville. And, um, I'm running for this position because the
[4:54] judge that holds it is retiring and he was a very fine judge and I want to
[4:58] follow in his footsteps. I think that I would ask for each of you who are sort
[5:03] of investigating the candidates in this race to look at trial experience,
[5:09] leadership experience, and community involvement. I think that I will will
[5:14] meet all of your satisfaction in those areas as I have been trying cases for
[5:18] more than 27 years. I've been involved in this community since I graduated from
[5:23] law school. right out of the gate and started giving my time back to the heart
[5:27] association, the Junior League of Northwest Arkansas, our schools, um the
[5:31] the food pantry, and various community efforts. My husband has coached youth
[5:36] sports in this area for 20 years. And um I I have been appointed to some really
[5:42] impressive leadership positions by the governors of the state of Arkansas. And
[5:46] that meant a lot to me because as a lawyer, I believe that integrity um and
[5:51] and uh leadership are important pieces of our profession. It's an honorable
[5:55] profession and I want to continue to serve you as circuit judge of Washington
[6:00] and Madison counties. So, thank you very much for these two and a half minutes
[6:04] and I look forward to visit with you afterwards. I'll stay for questions.
[6:07] Thank you. >> Thank you. Thank you very much.
[6:12] » We move on to approval of the minutes. Any other public comments?
[6:22] Have you guys had a chance to look over those?
[6:28] » You want to meeting?
[6:31] » Has anybody else had a chance? >> Over, but I wasn't here at the last
[6:34] meeting, so I don't feel like I can vouch to the correctness, what have you.
[6:40] » I'm good with them.
[6:46] What' you say? I said I'm good with them. I was good with them.
[6:49] » Yeah, I was good with them.
[6:57] » I wasn't here. >> It was just the three and Chris.
[7:03] » It's not a problem to table. You want to table?
[7:06] » I would like to if that's okay. [clears throat]
[7:11] like I make a motion to table the minutes from the previous meeting.
[7:15] » Second it. >> All right. So, we have a motion and a
[7:17] second. Any public comment before we vote?
[7:21] Those in favor
[7:26] report
[7:29] Jerry's gonna go over.
[7:43] » Good evening everybody. um
[7:47] general fund July 31st 4858390. If you guys notice that was a
[7:53] significant drop for the prior month. Um we paid the stage one of the park
[8:01] improvements uh which was like 135 $136,000 that came out. We will be
[8:07] getting reimbursed for that from um the grant
[8:12] probably mayor 220 225 >> no 26
[8:17] » 216,000 >> no 269,000
[8:20] » 269,000 >> yeah we spent 315 313,744
[8:25] I think was exactly what we spent on the actual uh phase one of the AR dot trail
[8:31] » and that's a 2080 match. Yeah. >> So we get 80% of that back. So, we'll
[8:36] get most of that money back to the account and then we will disperse the
[8:40] rest of that in 2027. >> No, it's it's all been paid. We've paid
[8:47] everything's been paid.
[8:49] » Okay. My mistake timing of that Norton timing of the of
[8:55] getting paid back from >> so that's the Abby and I discovered that
[8:59] there was an error that when Kashana sent over the big tabulation to ARD dot
[9:04] it was the incorrect alternative deduction. So the amount that they had
[9:09] on file was 297 297
[9:13] » 297 but it was really 313. It was $17,000 I think was the difference. And
[9:19] so we ended up having to contact AR dot and then show them minutes from the
[9:23] meeting on the alternative deductions that we had actually um approved and
[9:29] then that the total amount was 313744. So that's why I know that number so well
[9:34] is we've been talking about that that wasn't before act on their part of the
[9:38] paperwork that they received initially and so we're editing that but we should
[9:42] get reimbursement within the next I would say within the next month and a
[9:46] half. >> It just depends on our those, but
[9:49] usually >> they're pretty quick about they've been
[9:51] quick about reimbursing us in the past when we finally get all the work done.
[9:54] So, I would say probably within a month and a half to two months tops
[9:57] » and I think that the correction was just in the last 30 days that we don't
[10:04] so my number is all about that. >> Um, but anyway, we should be getting
[10:10] those funds back into the general fund and back to the normal balance that we
[10:14] normally maintain. Uh street fund 267262
[10:20] farmers market 5,13022 uh 988 funds 372708
[10:27] R dot grant,193 state park grant, 11193 and HUD
[10:33] grant,5912 which those just basically improved just
[10:38] with all the interest on those accounts. I will want you guys will all need to
[10:42] know that because those accounts have been inactive for so long said that we
[10:48] were going to have to deposit something or make something happen.
[10:51] » So that's right. >> So we're going to deposit a trivial
[10:54] amount dollar $2 something just to keep them accurate.
[10:58] » So you may see that transfer on next month's statement. That's what that is.
[11:02] So >> right
[11:04] » and the reason we have those accounts the only reason we even have those is
[11:07] when we get the funds back from grants it needs to go into that account because
[11:12] they wire it directly to that dot account and then we move that from our
[11:17] account back into the general fund. >> Same thing with how things take part how
[11:21] that works.
[11:25] Um on the statement of revenues again you notice that we don't have anything
[11:29] budgeted for interest expense we will take interest income we'll we'll take
[11:34] make that correction when we do the budget for 207
[11:38] we'll allocate an amount for estimated interest expense uh best maybe from the
[11:43] CDs um pretty straightforward we're actually on schedule with our revenue
[11:50] expense projections um we're running just slightly under at
[11:55] this point in time because we haven't done our improvement monies from the uh
[11:59] state for general register as usually comes in. So we should see that but we
[12:05] should balance according to schedule where we thought we would be. So any
[12:09] questions
[12:15] right I'll entertain a motion to >> second
[12:22] motion. >> Oh I'm I'm sorry. [laughter]
[12:25] Make a motion to approve mental second. >> All right. So motion and a second. Any
[12:31] public comment before we vote in favor?
[12:35] » I will move on to our report. Travis for
[12:42] you. >> All right. For the month of July, we had
[12:44] seven citations, 56 warnings, one warrant for a total of 60. Yeah. 64
[12:50] documents completed from that. Calls for service. We had 125 with 142 unit total.
[12:57] So any questions on that?
[13:06] » Thanks, Jason.
[13:10] » I do want to uh commend Brian. We're actually starting to see some changes in
[13:17] our stuff. So >> wonderful. It's kind of nice to have
[13:22] somebody who actually prosecute stuff. [laughter]
[13:25] » He's got to pay his salary.
[13:30] » Thank you, Chief Travis. >> I want to department. We have a new
[13:36] police officer that started um they doing such a great job and uh even after
[13:41] Jesse [clears throat] retired, Doug has picked up doing a lot of the things that
[13:44] Jesse have been doing uh far as like some of our step grant stuff. So we've
[13:50] seen that growth with all of them. Thank you, Chief Travis. All right. I think on
[13:56] that note, I think that the when we hire a new
[14:03] employee, whether it be city hall or police department, that they should come
[14:09] to the first meeting that we had that we have after they've
[14:15] been hired to introduce them.
[14:22] I mean, you can request that, but I'm not going to request that of them to
[14:24] come to a meeting just after they've been hired. Um, this takes time away
[14:29] from their family. That's not really part of the job description.
[14:32] » I'm not saying they have to stay in the whole meeting.
[14:36] » I think requiring that is it goes above and beyond measure is of their their
[14:41] position. Right. >> So,
[14:44] you guys >> Well, I was just going to comment on the
[14:46] retirement. Was it any type of a retirement type of
[14:51] party so to speak for him? >> Yeah, he was he actually so when one of
[14:55] us retires from the department of course he gets his retirement plus he gets his
[14:59] sick time his vacation time but we also allow them to keep their service weapon
[15:04] and they have the option to purchase their duty rifle and their duty shotgun
[15:09] so fair market price. >> I just didn't know from a community
[15:12] standpoint a way to thank him for his his service. You'll get we have still
[15:16] have to worry his retirement batch. You'll get that as well. But as far as
[15:19] like a party or anything like that, we pretty much just keep as a symbol
[15:23] between us. [clears throat]
[15:30] We'll move on to the infrastructure facilities report.
[15:40] So for July 2026, City Park, they replace the water faucet and park
[15:44] entrance. For some reason, it's this number three for frost
[15:50] rehydrants. I not worked there, but I guess we got a couple of duds and
[15:55] they've had to pull them up or replace them because they were leaky.
[15:59] » So, >> they can be tricky sometimes.
[16:01] » Yeah. >> Is is there do you guys are have you
[16:05] back filled around them with gravel? >> Oh, yeah. Put in right. But just for
[16:10] whatever reason, the actual mechanisms we even had come out look at it. thought
[16:14] [clears throat] maybe we could replace some stuff, but it was just a bad
[16:17] dehydrant. The irrigation system on the south park. There was some sprinkler
[16:22] heads that need to be fixed. They fixed those. Continued mowing at city parks
[16:28] along Highway 45 trails. Uh brush performed vertical
[16:34] trimming along city streets. Uh sprayed roundup around city street signs.
[16:39] repaired washed out ground radio ground entrance on the way Spring Park Lane
[16:45] after the rain damage and then uh they did surface Spring Park Lane this last
[16:51] week. So it is now paved. So that is complete. cleaned up city streets after
[16:55] the storm. Installed a note truck sign on fire tower and then maintenance. and
[17:01] cleared dirt work behind the new city street part shop and large rocks filled
[17:05] with uh low areas leveled the ground spread seed uh painted the outdoor dog
[17:11] kennels continued mowing weedings the all community building
[17:15] the pond in the field beside the community building installed a new
[17:20] dumping sign continued improving the street department shop by installing
[17:24] cabinets purchased uniforms for their uh street department staff performed
[17:28] general maintenance at community building reinstalled the uh doors stop.
[17:34] We needed the rain guards out of trash bags. Place brake pads and Ford
[17:39] Explorer. Inspected the community building roof in preparation for
[17:43] repairing the framework. Future projects build an information
[17:48] kiosk at the community building. Uh install an ice maker at city hall.
[17:53] Complete the creek access point and park entrance. Repair the community building
[17:56] roof. and then level the ground at the north park entrance where the stops will
[18:01] ground. They've actually done that. Questions?
[18:09] We'll move on to the fire district report.
[18:21] See here like there were
[18:26] eight calls for service
[18:33] questions about those.
[18:39] All right, we'll move on to our planning commission
[18:43] report.
[18:53] So, there were uh this month uh there were actually two
[19:01] items on the uh planning commission and one was
[19:06] just a lot adjustment. the fee and it was approved. And then there was another
[19:12] one that was on the agenda that ended up getting sent back for the person to um
[19:18] finish. There were some missing doc document pieces that were needed for
[19:22] them to be able to make decision so they're going to bring it back to the
[19:25] next next planning commission.
[19:30] That's it.
[19:35] building inspection report.
[19:41] » Good evening. It appears I did 20 field inspections during the month of July. Um
[19:48] on my report there it does have some incomplete information on completed
[19:52] dates, some of the inspection types and inspection status. My iPad needed some
[19:56] updates would communicate with the uh reporting system. Appreciate Abby. She
[20:01] spent a few days talking with them and figured it out and get my iPad back up
[20:06] hopefully next month. Everything.
[20:13] » Thank [clears throat] you, J.
[20:17] All right.
[20:21] » Uh during the July meeting, the committee worked on updates to the city
[20:25] uh map for the city's website as long as as well as the plans to replace the
[20:29] kiosk on the north entrance. Uh the updated map will include the R dot maze
[20:34] 2 trail future R dot maze 2 trail the pavilion the south entrance and the new
[20:40] additional acreage as well as the expansion expanding and trail system. We
[20:46] anticipate having the map finalized at our August meeting. Uh Mike continues to
[20:50] work on improving the trail system throughout the park, helping enhance
[20:53] accessibility and overall appearance for park users. Any questions?
[21:01] » Thanks, Daniel. All right, we'll move on to our old city
[21:06] business item a the TDSOP meeting ordinance.
[21:13] We did a first reading of the ordinance at last meeting, but we were not able to
[21:17] approve it or the uh emergency clause because we didn't have at least four
[21:22] council persons present to vote on it. So, if we want to go ahead and the
[21:28] second reading and then to the emergency clause, we could go ahead and
[21:33] if >> y'all want to adopt it tonight, we would
[21:35] need to suspend the rules and wave the third reading.
[21:37] » Yeah. >> Uh
[21:40] pass it tonight.
[21:47] » You need this passed tonight, Chief? >> Yeah. especially the ACIC policy because
[21:53] we're out of compliance right now until it gets passed.
[21:56] » So all uh
[22:02] there's three of them, isn't there? >> Yep.
[22:04] » No, it's just one ordinance. >> Three, correct?
[22:07] » S need a motion to
[22:11] suspend the ROS and read title only. >> Wave third reading
[22:15] » and wave the third reading. >> Yes, sir.
[22:17] » I'll make that motion. >> Second. So, we have a motion and a
[22:21] second to spend rules in my third reading. Second and third reading.
[22:26] [clears throat] Any public comment before roll call vote? All right. Roll
[22:31] call vote.
[22:35] » Paul Anderson. >> Yes.
[22:38] » Yes. >> Bond.
[22:40] » Yes. >> Court.
[22:42] » Yes. >> Mayfield.
[22:44] » Yes. an ordinance amending the standard
[22:47] operating procedure manual which was adopted by ordinance number 189 and as
[22:53] amended by ordinance number 195 and 228. >> Motion to adopt.
[23:02] » Second. >> A motion to adopt and a second public
[23:05] comment before we vote. All right. Roll call vote.
[23:10] » Anderson. >> Yes.
[23:12] » Martin. >> Yes.
[23:13] » Curtis Bond. Yes. >> John Bartford.
[23:16] » Yes. >> Yes.
[23:24] » Motion to adopt the emergency clause. >> Second.
[23:28] » A motion to adopt the emergency clause and second. Any public comment before we
[23:33] vote? Roll call vote.
[23:40] » Okay. Paul Anderson. >> Yes. Martin,
[23:44] » yes. >> Yes.
[23:47] » John Bell, >> yes.
[23:50] » Yes. >> Right.
[23:56] » So, we'll move on to the next item on the agenda, which is the L land
[24:00] annexation ordinance. Uh, it's the same thing that we read it for first reading.
[24:06] If we want to adopt it, we need to do clause. I would say that this is
[24:12] probably a good idea to adopt the emergency clause because there's two
[24:15] families in that area that able to change their voting rights within Goan.
[24:19] One of those residents expressed a desire to be able to vote in Go
[24:27] if uh >> we're missing a DM I'm guessing ant
[24:33] after the and the first whereas
[24:39] I think we are unless we
[24:45] Yes. Yeah.
[24:57] » Billy never.
[25:01] » You know what I did? [laughter] >> And
[25:06] on you know what it means. >> I know. [laughter]
[25:16] We can make sure that's fixed before it printed out. So [laughter]
[25:22] [clears throat]
[25:27] I talk. So that's up to the council. But you guys want
[25:31] to do a second reading. You want to do the suspend the rule. Wait a second
[25:35] reading.
[25:42] I'm for suspending the rules. >> You did.
[25:47] » It doesn't matter. >> Whatever you guys want to do.
[25:51] » Well, I'm trying to put myself in there for shoes.
[25:53] » Yeah. >> Well, I understand that, but at the same
[25:56] time, this could have shown up anytime in the past multiple years, too. So, to
[26:03] me to say it, I'm not sure that it truly qualifies as emergency. Yes,
[26:11] » we do maintain this trip of road that goes right through there
[26:15] » and we've been maintaining it for the last,
[26:18] » you know, 20 years. Even though it's county,
[26:21] » even though there's a sign that says it's county,
[26:24] » but they don't maintain it. So, >> there's a lot of roads, the county
[26:28] doesn't maintain that county. >> It's clearly within our city.
[26:33] Yeah.
[26:38] » And even if we approve it next time, next meeting,
[26:43] » I just I can still vote. >> Well, you have to do the emergency
[26:47] class. >> It'll you'll only second reading
[26:50] tonight, the 3 next month, and it passed, then it it waits 90 days to be
[26:57] updated without the emergency. That's the significance of that. And it still
[27:03] has to get filed at the county too. So we still have to file all this with
[27:06] Northwest planning and the names to change our so it takes a little bit of
[27:12] time to get all that through. >> And we have we talked to everybody
[27:15] that's going to be impacted by this.
[27:19] There's really only three residents. So it's the gentleman that has the little
[27:24] tiny house, the old Kennedy house. It's Greg's old house there. And then
[27:29] Charles, which Charles, it's all just land.
[27:33] That's nice. Good question. >> What is the benefit of waiting?
[27:39] » I mean, >> it it's not about benefit, it's about
[27:43] process. >> Yeah.
[27:45] » Kind of following due process as far as if somebody did decide to have some sort
[27:51] of objection, if they rush it through on something that's not an emergency, they
[27:56] have lost the ability to have the opportunity to have their say. But I
[28:00] will say this has already gone planning commission. It's been discussed in
[28:03] planning commission and it's been discussed here now at least once now
[28:06] twice. >> Mr. Lang was in attendance last time.
[28:09] » He was. Yeah. >> Why would there
[28:15] » not for you vote on that pull one vote? >> Yeah.
[28:20] » I don't care. You guys decide. I don't know which direction you guys want to
[28:24] take with it. Just let it take its normal course.
[28:27] Okay. Are you guys discussing?
[28:32] How many you want? How many you want to go?
[28:35] » Somebody can make a motion for reading. >> Okay. I'll make a motion to read in to
[28:41] title only the ordinance accepting the annexation.
[28:46] » Second reading. >> This be a second reading.
[28:49] » Yes. without emergency clause or without the third
[28:52] » emergency clause in way of this second.
[28:58] Okay, >> a motion a second. Any public comment?
[29:04] » Sean was a second. >> All right, roll call vote.
[29:12] » Holly Anderson, >> yes.
[29:13] » Martin, >> yes.
[29:14] » Curtis Von, >> yes.
[29:16] » Bordial, >> yes.
[29:20] An ordinance accepting the annexation of certain territory to the city of Gan,
[29:24] approving the schedule of services to be extended to set area and assigning such
[29:29] area to a ward
[29:38] reading. >> Oh,
[29:40] you have to approve the reading. Make a motion to approve the reading as read.
[29:45] Second. We have a motion by John and a second by John Mayfield. The public
[29:50] comment. All right. Public actually one question in the public comment section
[29:55] and this just goes back to the citizens question. I don't know if we gave her a
[29:59] proper answer but she said what harm would they going to be and we just said
[30:03] due process but did they have a chance to anybody that wanted to object to it
[30:08] have a previous chance as before? So I don't know if that was a sufficient
[30:14] answer. Historically, we have had people that
[30:19] miss the first or second type meetings that
[30:23] happened with something like this and then they have come back and been upset
[30:27] with us because we passed it through when they did want to have something to
[30:32] say on something that they see as something that's not an emergency.
[30:37] » How often has that happened? >> It has happened. But if that is you know
[30:40] if people do again you know it has happened probably three or four times
[30:48] but for those individuals that if we didn't follow the due process um you
[30:53] know that has an impact to them too it's again
[30:57] » I guess I just failed to understand why annexation of somebody's property is
[31:04] going to affect anybody else in the city of goan negatively.
[31:08] that they would have an objection to it when it's only affecting this one
[31:13] family. >> Well, there's three
[31:15] » or three families. Sorry. >> We had an opportunity to talk about this
[31:20] before and then we I hear you, John. Then we made it and it was time to vote.
[31:29] Am I correct? >> Sorry, I don't understand the question.
[31:35] He's just saying that um he's saying we've gone through this process or we've
[31:42] made the motions. >> We made the motions. We moved ahead
[31:47] and we voted and we moved ahead
[31:51] and it was time for Gina to >> Yeah, we are at roll call. This was that
[31:56] public comment section before you vote. That's this section. So every time
[32:00] before we vote on something I have to ask if there's any public comment and
[32:03] there was. So that's why I asked. Now we're it's still up for the same vote,
[32:08] this roll call vote for this item of the second reading.
[32:13] » So do we have do we have do we have standards
[32:17] um that determines whether when we use emergency clause for issues that may
[32:22] come up? We don't have any >> I mean it's
[32:25] » it's basically it's how we determine it or the board city council and it is
[32:31] of of that nature. I mean there's >> I'm just asking questions because I
[32:36] don't know how you apply those to where there have been instances where um most
[32:42] of the time something comes up and I've never seen it be an issue with extending
[32:48] the emergency clause but with this one issue just seems like it's just
[32:53] a matter of time you're approving it. Uh, and I understand the process. I
[32:58] understand that totally. But on every other issue that's we've come up with um
[33:04] exord ordinances or other things that we approve, you've done the emergency
[33:09] clause without even batting an eye. And then this situation, it seems like
[33:15] there's really no reason for you not to besides just process. So I'm just trying
[33:21] to figure out what standards are you applying to when to do it and when not
[33:24] to do it. But the the issue right now, Jerry, is not as to the eerence clause.
[33:29] The issue is whether or not the third reading was being waved to have this.
[33:34] » I understand. It's just that I was following up on her question to make
[33:37] sure she got a sufficient uh response to her question. I didn't think that it was
[33:42] » appropriately answered for her in the first part. So I
[33:48] mean my view of an emergency clause is that if there's something that we
[33:54] pressing you know that would be something that we would be concerned
[33:58] about as a city without doing the emergency clause then
[34:02] at that point it would be very imperative to en enact the emergency
[34:05] clause. In this scenario I don't know that it does or doesn't affect anything.
[34:10] I mean, the only reason I would see that we would want to do the emergency
[34:14] clause, it's because we've been maintaining a road that's within this
[34:17] jurisdiction that we're annexing for many years and there's people there that
[34:22] would like to vote in the upcoming election within the city. I don't know
[34:27] that it matters. You know, do people that that would be my only reason for
[34:32] why >> want to enact it. The council has chosen
[34:34] not to do that. So we are not voting on the emergency clause or the waving of
[34:39] the second and third reading. Right now just voting on the second reading. So
[34:43] we've moved on from that. >> I was just I was giving her
[34:48] clarification. >> Does that help?
[34:50] » That does help me. Thank you very much. >> All right. Uh
[34:55] okay. Paul Anderson. >> Yes. Martin.
[34:58] » Yes. Bond. >> Yes. Valent.
[35:00] » Yes. >> I may be.
[35:01] » Yes. >> Okay.
[35:06] We'll bring that back for a third meeting next meeting.
[35:12] All right. Now, we can move on to item C of the old agenda, the allocation from
[35:16] street fund reserve balance. What that is referring to is that at the last
[35:22] meeting, for those that weren't in attendance,
[35:25] we would like to surface Watson Circle, but when I got a bid estimate on what it
[35:30] would cost to surface it, it's right at $62,000.
[35:35] That would put us right at either our limit, the street fund, or maybe
[35:41] even a few thousand over. Um and that is without being able to utilize even more
[35:46] money for tree removal. My concern is if we do need more larger tree removal then
[35:54] we wouldn't have money to do that by the end of the year without you know going
[35:59] to some of our reserve. Uh, so my request was before I go out and get bids
[36:05] and bring those back, wouldn't you guys be okay with allocating that extra
[36:10] possible $20,000 for that so that if we needed tree
[36:16] removal for the end of the year, we still would be able to have money to do
[36:20] that without, you know, >> when you were asking them, you know,
[36:24] this rough estimate to begin with, uh, did that include them doing some grading
[36:30] on that road because there are some pretty serious humps on that road that
[36:34] » it's leveling and grading and then >> I just want to make sure.
[36:37] » Yeah. Putting in the asphalt and that's 3 in of asphalt. That's what I asked
[36:40] for. >> How wide is that? Uh
[36:43] » so they're not going to they're I think the bid includes 16 ft which is about
[36:48] what the road width is. Now there's not a lot of room to widen it past that
[36:53] because of the way that it's designed. There's trees that are in the way. We
[36:56] would have to take out >> old road.
[36:58] » It is. I mean, I would tell you that the people that live on that road would
[37:02] probably be pleased with 16 feet of asphalt, you know, paved road.
[37:07] » Um, >> how do we change
[37:10] at that point? >> You can still get by 16 ft.
[37:14] » Well, >> so
[37:15] » we have several roads in the city, city streets. It it doesn't get a lot of
[37:20] traffic on it because there are just a few roads on it. What what happens with
[37:25] the egress and ingress? Um
[37:31] » those are not white either. Do we have to bring those up to standards with what
[37:37] the county is saying for entrances?
[37:43] » What are you talking about? >> The county or the state?
[37:46] » I don't know what you're talking about. Are you talking about the driveways?
[37:49] You're talking about the from 45.
[37:53] » Well, those are existing. That highway 45 entrance is already asphalted.
[37:58] » There's a 25 or 30 foot apron on Highway 45 on the easement already. We're not
[38:04] talking about doing anything with that. This is just asphalt from there all the
[38:08] way around Watson Circle is where the the bid takes place. I mean, that's
[38:13] where we would put it out for bid is that area. But you're you're looking at
[38:21] you're not sure whether that $20,000 is going to be
[38:26] » I don't know if we'll need it cuz if we have a storm come through and I have to
[38:30] have trees taken out, we're going to have to get into that $20,000 set aside
[38:35] for tree removal. >> Okay, that's good. But then then you
[38:40] have a fact of what were you cut for bid a verbal bid
[38:47] » a verbal bid >> uh
[38:48] » 62,000 >> a month ago month and a half ago
[38:51] remember that was >> yeah I mean we may put it out for bid it
[38:54] may come in you know I may get a bid less than that I may get all bids that
[38:58] are over that I don't know >> I would say that all bids just from
[39:03] what's going on in the world okay oil prices have skyrocketed and may
[39:10] still skyrocket more and I think that the bids are going to come in
[39:17] much higher than what you recorded a month and a half ago.
[39:21] » I'm going to disagree with that. That's just not what I've seen with the bids
[39:24] we've been getting on. >> But the Spring Park, you said it was
[39:28] paid how did the >> that we actually got it decreased from
[39:31] what the bid was. Okay. So the bid was for 67,000 and we ended up getting it
[39:35] paid for 663 I think is what we ended up um paying in
[39:41] total. >> I mean is this something that we really
[39:44] have to decide tonight or can we get the bids in and see those through them and
[39:48] move them out there and asking companies to give me bids from five different
[39:53] companies if I'm not going to be able to allocate the funds. I think that's a
[39:56] waste. I think it's it's it it doesn't improve relationships that I have with
[39:59] all of those contractors. Um, so >> well it's the first time that we've had
[40:05] to as a city that we've had to back out because bids come in way higher than
[40:09] what we expect. That's all I understand. >> But I also think that before I go out
[40:14] and allocate money for that kind of a project, I need to know what council
[40:19] » we do have. >> We've got other projects we can do.
[40:21] » We do have the $20,000 that we can allocate from capital funds. Okay. For
[40:26] this year, we still got plenty of capital funds.
[40:28] » Well, I mean, it's in the street fund. Yeah. No, I'm sorry.
[40:33] » Our street fun reserve is 200. >> So you're just saying from So it's not
[40:38] coming out of the general fun. >> No, it's
[40:41] » I I don't have a she doing that. The rest of you guys feel
[40:49] » Yeah. I just need to know which direction I need to I need to mobilize
[40:54] to get bits there or do I need to get bids on something else that we're
[40:56] planning to do with other streets? That's that's all.
[41:02] » My main concern is driving through there. It's just very very narrow.
[41:06] » It [clears throat] is very narrow. >> You know, my parents now, my brother
[41:10] also live on that street, that road. Um, and when I'm in and out of there on a
[41:15] regular basis, it is narrow, but um, typically you're not running into, you
[41:20] know, there are few enough people that live on that street that it's very, very
[41:24] rare that you run into somebody that's coming out at the same time as you. So,
[41:28] » and just be aware that Spring Park Lane is 14 and 16 ft.
[41:32] » Mhm. >> And that's because that's how wide they
[41:34] were. >> That's Yeah. Yeah. You just can't
[41:37] » Well, the other thing Yeah. Sorry. The other thing about um you know, Watson
[41:43] Circle is that it's a circle. So, like that helps a lot as far as it needing to
[41:49] be wide enough to accommodate two vehicles comfortably. It's really not an
[41:52] issue because, you know, because it is a circle and there's plenty of driveways
[41:57] along there, too. So, they can move aside to accommodate other traffic.
[42:01] » Fairly flat, >> you know, through there. You can get out
[42:04] easily on the edge.
[42:09] » It's one of the last roads that the city has that the city maintains that's not
[42:14] asphalted. The difficulty we have with maintaining that with gravel is because
[42:18] the overhead canopy of trees, you can't go in there and tailgate that and you
[42:22] have to dump piles of gravel at the beginning and hire someone to come in
[42:26] and actually spread the gravel. We can't do it as a city staff. We actually have
[42:29] to hire a crew that comes in with a greater.
[42:32] » That was my concern with getting fired down there to be quite honest with the
[42:36] canopy. It's one of those roads that needs to be paved because it gets pretty
[42:41] rough at times and it's hard on units too, especially the ingresses. It's
[42:49] time. >> I'm okay with it.
[42:55] » I just need a motion and a second. You guys vote.
[43:00] I'll make a motion to allocate $20,000
[43:06] potentially out of the um reserve funds of the city street
[43:13] account to pay circle.
[43:17] » Second. >> Any other public comment before we vote?
[43:22] All right. All those in favor? I I
[43:26] » Let's do roll call.
[43:32] Anderson. Yes. Colton Martin. >> Yes.
[43:34] » Bruce Bond. >> Yes.
[43:35] » Don Balanc Court. >> Yes.
[43:37] » Mayfield. >> Yes.
[43:39] » Okay. >> Let me let me ask one question on that.
[43:45] We've approved it to be moved, but will we move it now
[43:51] till we get the bids and decide whether we want to move ahead? Oh, well, you
[43:56] have to decide on the bids when we get them.
[43:58] » All we all you allocate for me is that we could go over a little bit if we
[44:02] needed to to be able to get the weight. So, we wouldn't move that now.
[44:07] We we >> No, now I go out and get bits and bring
[44:09] them hopefully back in the beginning. Then you guys can be good.
[44:14] » That was my question. >> Then the ones we got an estimate for.
[44:18] » Yeah. Now we move to I go out and do the work to get the the bids back to you
[44:23] guys and then you guys open them and you decide whether you want to do them or
[44:26] not. So >> Okay.
[44:28] » All right. Uh new city business. We'll move on to that. So um for those of you
[44:32] that were not aware, Birch Wright has resigned from the city council secondary
[44:37] to some uh work issues uh with his uh searching employment. So um because of
[44:44] that we are at a point where we need to appoint somebody to fill that position.
[44:49] So appointing somebody would fill the position for the duration of Burchie's
[44:53] term which would expire in uh 1.8 December 31st 2028. So, um, I contacted
[45:03] Ken Hanley, who lives in Waterford, who's here tonight, uh, and he has
[45:08] graciously agreed to accept that position should the council want
[45:13] anything pointing him to that position. So, um,
[45:19] [clears throat] I sent out a little information about
[45:22] Ken to all of you guys. I don't know if you've had a chance to read it. And
[45:26] then, you want to say anything? >> Yes, absolutely. U thanks again mayor
[45:32] for uh reaching out and asking if I'd be interested lived in go since uh 2013 for
[45:37] 13 years. So uh love it out here. Plan on opening a store uh next to the Dollar
[45:44] General store. Haven't quite lined out exactly what we're going to do there,
[45:47] but for now I'm going to office out of there. A landscape contractor in Norris
[45:51] Arkansas. Live in Gan and spend a lot of time in Genan. So uh working in Goan
[45:56] building houses here. So, uh, happy to serve. Um, glad I didn't have to politic
[46:01] to to get the spot, but something that I felt like was coming. Uh, as I got
[46:06] older, uh, spend a little bit more time in the community to see what I can do to
[46:10] help grow it. So, appreciate the opportunity.
[46:14] » Appreciate you being here. You're welcome.
[46:19] » So, that brings us to item number two, which is the appointment of new city
[46:22] council member. I will make a motion to read the resolution
[46:27] electing Kim Hanley um in total.
[46:32] » We need to accept Burch's resolation first or no?
[46:36] » He's resigning. >> He's resigning.
[46:43] » I'll second.
[46:46] » I uh I did some background research on you and your neighbors only had good
[46:51] things to say. Thank you. I appreciate it. [laughter]
[46:54] » I got the same. >> I actually had an extensive conversation
[46:59] with B [laughter] and he spoke very highly. Thank you.
[47:03] » Yep. I only had two people I knew that might be interested and you were one.
[47:07] Bur recommended you very highly. So that's why I made the phone call. So um
[47:14] so we have a resolution and with a motion and a second on the table. Any
[47:19] other public comment before we move? All right. All those in favor?
[47:23] » I. >> Resolution electing Ken Hanley to serve
[47:27] on the city council for the unexpired term of Birch. Wright.
[47:34] » Thank you. >> Make a motion to approve the resol.
[47:39] » Second. >> Have a motion to approve the resolution
[47:42] and a second. Any public comment board? All those in favor?
[47:47] » All right. So, >> welcome. Welcome.
[47:53] » Now, all you got to do is get sworn in.
[47:58] » Maybe just warn if uh you have yet. [laughter]
[48:06] » I can find it just yet. >> So, we'll move on to the next item on
[48:11] the agenda, which is appointing new zoning official Abby Bryan.
[48:18] Originally,
[48:24] I will say that, you know, my plan was to have Eddie Mashburn fill in as zoning
[48:30] official and Eddie has been now with us for
[48:35] months now. >> Correct.
[48:37] » So, um, he's done a lot of the training and permitting. Um what we quickly
[48:42] realized is Abby because she's in the office 100% of the time and she's been
[48:47] acting as permit coordinator zoning official. Um technically I'm zoning
[48:52] official because there's not been one appointed since uh Lacy's uhation.
[48:57] So uh but she's been working with me. We do plan on having her go to it's called
[49:02] a city planner class that certification for city planning. But she's done a
[49:07] great job with that. She's had questions along the way which I've been there to
[49:10] help field and we also make phone calls to North Arkansas Region Planning. Um
[49:15] and then we reference our own ordinances because that's where we always refer
[49:18] back to. So but um at this point she's also going to be doing our
[49:25] permitting in
[49:28] » Oh what is
[49:33] » so he's our director of facilities management now. So he's moved more into
[49:37] that. Well, we realized after Lacy's termination that it did not take the
[49:42] entire full-time to do what she was doing. And so a lot of those duties
[49:47] ended up being done by Abby. So at that point when he came in, we knew we were
[49:51] going to help get him in with permitting because of his construction background.
[49:55] And he still comes in and helps Abby look at like a building permit. Someone
[49:59] brings a building permit in, he come in and look at it, say, "Yep, this all
[50:03] looks kosher." uh they look at it together and then they go through it.
[50:07] Then they can move it on to either approval or to landing commission at
[50:12] that point. >> Looking at the plans that
[50:15] » looking at the plans. >> So that's been a big help for her and
[50:20] for him. Um, and we really spent probably the best part of two months in
[50:24] the beginning of Eddie's employment just in the office doing permitting,
[50:28] planning, zoning, looking at ordinances, and then we started moving in towards
[50:33] infrastructure facilities. What I needed was I needed somebody who could be
[50:37] charge of that department because every single day I was calling and saying,
[50:41] "What's on your agenda today? What what are you guys doing? What's your next
[50:44] steps?" Eddie's somebody who I can say, "We need
[50:48] these things done." and then he can go get all the things and then bring it
[50:52] back to me. Like the kiosk, we texted me this morning about the kiosk. He had
[50:56] gotten good on all the lumber prices, how to put it together. He has the
[51:00] knowledge and skill to do that without me having to go down there or hire
[51:03] somebody else to do it. And so him in that role has been hugely beneficial to
[51:09] all of us. I think Abby can attest to that. Anybody at city hall can attest to
[51:14] that. Um, so that's why Abby is now in the role of being more zoning official
[51:20] because she's at city hall 247. Well, during open business hours,
[51:26] » you'd be surprised at how many phone calls we get for building planning. So,
[51:30] » and JD, you may want to speak about Aby's performance and how she's been
[51:35] doing.
[51:38] » I'll speak on Aby's behalf. She's since she's taken over in that role, filled in
[51:42] that role, things have ran smoothly. Um, she's not afraid to reach out and ask
[51:46] questions. She'll research and come up with the right answer or collectively
[51:51] will come up with the right answer. If I'm out in the field and I have a
[51:54] question, she's quick to jump in the Jeep and come meet me meet with the
[51:57] customers. We did this last week on a on a driveway out of the rural area because
[52:01] there's difference in the driveways in the in the city and I'm not that
[52:06] versed on on all that. She's she's done an excellent job since she's been in
[52:10] that role. Any questions?
[52:12] » Thanks. She did. Okay.
[52:17] » To read the resolution on title only. >> Second.
[52:20] » All right. So, I have a motion in a second to read title only res. All those
[52:25] in favor? >> I
[52:29] » resolution confirming the appointment of Abby Bryan as zoning official.
[52:47] Make a motion to approve the resolution. >> Second.
[52:50] » Motion to approve the resolution. Second. Public comment before we vote.
[52:54] » All right. All those in favor. I >> All right. So,
[53:01] it congratulations.
[53:07] I do really have to commend Abby because she has
[53:11] really taken on a lot and it's been a huge benefit to us at city hall and to
[53:16] the citizens all that she's taking on. All right, next on the agenda is the
[53:23] removal of same unsightly items called Martin it.
[53:28] » Yeah, thank you. Uh there should be some photos in your packet.
[53:34] Um, >> speak up, please.
[53:36] » The two items that I would like to see resolved, um, that I've gotten some
[53:43] feedback from citizens on the I think it maybe used to be a pond. It didn't hold
[53:49] water though, and we're currently using it to, I guess, dump material from other
[53:56] areas. >> We currently use it because we have no
[54:00] other place to put refuge for the city. >> Yeah. Yeah, for when we clean up trees
[54:04] and uh brush. >> Yeah. And this is a pretty visible
[54:07] location. It's right off of fire tower and it's one of the more trafficked
[54:11] areas of the park. This is where our >> It's not part of the park property. That
[54:16] is actually city property. I just want to clarify the city has 10 acres and
[54:20] it's not part of the park. So that is within the 10 acres that is not part of
[54:24] the park. So it's not park property. So to call it park property is just a
[54:28] misnomer. park property is just the two acres is behind beauty building. Just
[54:33] for point of clarification, [clears throat] so
[54:36] » thank you for that. Um, so this is I guess not the park, but children would
[54:41] play there because it's right next to the park. Um, and it's it's in a pretty
[54:46] visible location. It's where we have the bike race and the farmers market. Um,
[54:50] you can see it from fire tower. It's pretty unsightly. I'd recommend that we
[54:54] find a more discreet location that we could use to create a brush pile if we
[55:01] need to. That's what would be most typical. U and then the other item uh
[55:07] lesser concern, but still wanted to bring it up just because I can I can see
[55:12] my own children falling into this. It's a concrete cylinder that was left by the
[55:17] water company when they fixed that water line on fire tower. Um,
[55:25] you can see the location of it. It's pretty pretty dead center in and where
[55:29] the park is and it's kind of where that step is at. And I if you have kids, you
[55:34] know what happens when they're at a park. They're both in each other. And
[55:37] that uh concrete barrier is just the right height to to really do some damage
[55:42] if they're pushed into that. So, this uh resolution is to remedy these two
[55:49] issues. Um, I'll open it up for discussion.
[55:55] » I'd like to discuss that the the concrete cylinder that's there was left
[55:59] there on purpose. I was asked by families and kids that were there for
[56:05] the kids to play on. My goal was to always ground the edges down because I
[56:09] felt like it was and I will take responsibility that
[56:14] um it has been ground down. It has been painted now. um that's been there for
[56:19] kids to play on because kids do play on it. They enjoy walking on it. Um my kids
[56:24] play on it or neighbors kids play on it. So that's why that's there. If you like
[56:29] it moves somewhere not so close to that uh playground, we can do that. But I
[56:34] think it's at least worthwhile to keep it for kids to be able to play on. Um,
[56:38] as far as the pond, we don't have any other city property by which for us to
[56:44] be able to be able to put recreation. We cannot put it in the park because the
[56:50] money that we accepted for the park, it is park property and we cannot use that
[56:54] for a place to take and the site. The city doesn't own any other
[57:01] property by which to be able to dispose of those
[57:08] green that we've had to remove from streets and roads.
[57:12] So, if you could think of another place that the city has property that we own
[57:16] that we could dispose of those, then I'd be happy to entertain that. But at this
[57:21] point, we don't. >> Yeah. I mean, we've got 150 acres now.
[57:27] We cannot put that in the park. It's not something that we can do. So, by
[57:31] statute, by by law, we can't do that. >> Well, we can't we can't keep a it's
[57:36] essentially a city dump in such a visible place. I think it's embarrassing
[57:39] to have as the entrance of our bike races. It it doesn't look good. I've got
[57:44] complaints. It's unsightly. So, I would uh make a motion that we read in title
[57:51] only.
[57:55] question. >> Where do we I have to ask the council
[57:58] where am I supposed to tell our street department to take limbs and and debris.
[58:03] » That's what my question was. Okay. >> With the acorage that we have out here.
[58:10] » We cannot use the park for dumping debris.
[58:14] » I I heard you. >> Yeah.
[58:17] » Now listen to me. >> Yeah.
[58:19] » Okay. We have 100 acres over here. >> No, we have 10 acres. 10 acres
[58:24] » behind here. Correct. >> Okay.
[58:29] Why can't it go back
[58:36] away from here, away from the street? There's plenty of land going back. So,
[58:43] you could do the same thing and it wouldn't be visible to the streets.
[58:50] I would I would argue to say that that entire 10 acres is visible from both
[58:55] Ocean Tuttle and Fire Tower. >> Um what are our thoughts on getting a
[59:00] larger wood chipper to be able to wood chip all of the limbs?
[59:04] » Would love to be able to put that in the budget. They're about $30,000.
[59:08] » Yeah. >> And that's only for up to about five
[59:11] inches. I guess, you know, really just need to figure out
[59:16] what we can do with this rather than just putting it in a pile and leaving
[59:18] it. >> I can burn and that would be, you know,
[59:22] and try to maintain it a little bit. >> I mean,
[59:28] it's it's in a bad location. It's very visible. Um,
[59:36] » it is right next to the park and it's right where we have farmers market.
[59:40] What's typical is not a pit that you would dump in around here. Typically,
[59:44] you would stack a brush pile somewhere in a discrete location.
[59:48] » Well, I would argue that before I came on the council, the four years before
[59:52] me, the council had that pond that they dumped stuff in continually and it never
[59:57] was a problem. >> Well, Max had talked to the water
[1:00:01] company about that and from my understanding, the water company was
[1:00:06] supposed to fill that in when they put that line in. I don't know what
[1:00:09] happened. Maybe that was lost somewhere along the way, but that was discussed.
[1:00:14] Um, but to your point, I mean, it's it's
[1:00:19] been a long time and it's been unsightly for a long time, but I don't think that
[1:00:22] gives us an excuse just that it needs to be cleaned up.
[1:00:28] » I could lease a strip of land that I have on 13 acres for the city to
[1:00:33] » if we moved it to the back of the property and created some sort of
[1:00:38] Yeah, using some drink giants or something to
[1:00:43] » to try to block that. >> Yeah, I mean there there's options, but
[1:00:47] I think that this gives you two months to decide what you're going to do. Uh I
[1:00:53] think there's plenty of options out there. I wouldn't want to get involved
[1:00:57] with where you decide to end up leaving it, but where it's at, it needs to be in
[1:01:01] a discrete location. >> I agree.
[1:01:06] It can help you. It can be moved further back where it
[1:01:13] isn't [clears throat] right here where everybody is.
[1:01:17] And as far as the cylinder, I don't know
[1:01:23] how many feet exactly that cylinder is from
[1:01:28] the curb to the >> It's 18 in tall. It's 18 in tall. I know
[1:01:35] I'm not talking about distance from the playground boundary.
[1:01:41] » Playground. >> Yeah, we can move it.
[1:01:44] » That's what >> you know.
[1:01:47] I don't know what the distance is there. >> Yeah, it's right there.
[1:01:51] I think it needs if at worst it needs to be moved
[1:01:58] so that it's not close to where a lot of kids play and run around and jump off
[1:02:06] from, you know, that that filled area, etc.,
[1:02:11] and could fall and hit their face, their chin, their
[1:02:16] their teeth, you name it. on the it doesn't matter whether it's
[1:02:21] rounded or squared, >> that's still gonna do a lot of damage.
[1:02:27] » So, go ahead, Chief.
[1:02:30] » I was just going to say, so and would it not be cheaper instead of wasting the
[1:02:34] manpower and the overtime that you're going to have to do to dig a hole
[1:02:37] further out in the field? Why not just put a fence around it?
[1:02:39] » That's, you know, literally do a six foot privacy fence. That takes away your
[1:02:43] unsightly. It takes away your unsafe. And as far as the cylinder, I have a
[1:02:48] three-year-old grandbaby that loves that thing. My grandid absolutely love it.
[1:02:52] And I mean, I'm not the one to say that I'm not going to let my grandbaby play
[1:02:56] on something she likes. She can get if she gets hurt, she gets hurt. That's
[1:03:01] part of the playground, too. >> I mean, get hurt just as easy or worse
[1:03:04] on that. >> They can fall off the top of the monkey
[1:03:09] bars. >> Yeah. I mean, I'd say grind it down like
[1:03:12] he said, clear the edges off, paint it. >> It's already down.
[1:03:15] » Yeah. still paint it and paint it a bunch of different colors and let the
[1:03:18] kids play on them. It's a free playground equipment right there.
[1:03:22] » That's right. >> The only reason I kept it. I mean, my
[1:03:25] kids loved it and you know, Andrew Eden, >> my grandkids love it. My
[1:03:29] » grand It's not any different than the concrete playgrounds in front of the
[1:03:33] Jones Center in Springdale. >> That's right.
[1:03:36] » And we did I had Eddie and Ivan come grind it down. It's smooth. They've
[1:03:39] painted it and we plan on painting a sun on it, some stars and stuff for the
[1:03:44] kids, you know, to >> and at some point the parents have to
[1:03:46] take responsibility for watching their kids and decide.
[1:03:51] » Yeah, I mean way a little bit because these days
[1:03:56] » I just know the kids like balance theme and yeah,
[1:03:59] » we can move it further away from where the playground is.
[1:04:01] » I don't know about you guys, but I came from a generation with jungle gyms that
[1:04:04] were way taller than that, >> right? And I don't mind
[1:04:09] » chief drivers. I don't mind putting a privacy fence around there. Again, we'll
[1:04:13] have to figure out how to adjust the budget because it's not allocated. I
[1:04:18] mean, it's fine with me. Any of these options that you guys are talking about,
[1:04:22] we cannot do it until you amend the budget because we don't have the budget
[1:04:25] to do it. So, moving that at this moment, we don't have the budget and
[1:04:29] it's not been set in the budget to even be able to do it. So spending the money
[1:04:34] to put up a big fence around that, that's going to be a lot of that's going
[1:04:37] to be a big budgetary um outlay of of money, number one. And
[1:04:42] and I would contend that it will draw more attention to that area than it does
[1:04:48] now. People can see what's down there. They don't want to go down there in the
[1:04:51] first place because it's kind of, you know, people don't just don't want to go
[1:04:55] down there because it's either muddy or if it's, you know, got brush down there,
[1:05:00] they don't want to go down there and play anyway. So, um, they can see what's
[1:05:04] there. We're slowly filling it up. We We probably should burn it more often than
[1:05:08] we do. Obviously, not now. I don't think there's a burn ban, but we don't want
[1:05:13] to, but
[1:05:16] » but if we, you know, if we spend a little more time pushing it in and, you
[1:05:20] know, collapsing that the hole size a little bit more and smoothing it out, I
[1:05:25] don't think it'll be as much of an eyes. U, but we can take care of the
[1:05:28] vegetation around the edges as well. So, I mean, I'm committed to us making it
[1:05:33] look a little better than it does. And I don't even mind using which we've done.
[1:05:36] We've used my dozer for all of the work on that farm.
[1:05:40] » The one that went in there after I took office and pushed all the trees out
[1:05:43] because it was such an eyesore to me and all of this vegetation that had been
[1:05:47] left over here for years that we cleaned up over the last 3 years. It It looks a
[1:05:52] lot better now than it ever has. I agree. It's still an eyesore. Part of
[1:05:56] the problem I saw was they're having people dump debris there that wasn't
[1:05:59] cities, you know, and it was refuge from their, you know, lawns and their yards.
[1:06:06] And that's not what the intent was. The goal is to fill it in. Goal is to fill
[1:06:10] it in. But we do as a city need to think about what are we going to do. And one
[1:06:13] of the things Paula, like you said, I've looked at the Vermeier, you know,
[1:06:17] multure grinders because we are going to have to have we're going to have to have
[1:06:20] an option. >> We have to have something in the future.
[1:06:22] And >> it's not just the it's not just the
[1:06:24] vulture either. You have to have a trailer to put that stuff in and dump it
[1:06:27] and all that stuff. So it's a it's it's pretty big.
[1:06:31] » I mean I understand you know if you can you know I know you have to have
[1:06:37] you can bring the brush to it. Um you know there's options there but anyhow I
[1:06:42] just was again trying to think of long-term solutions rather than just
[1:06:47] » Can I make one more point on the on the fence out there? If we put a fence out
[1:06:51] there, it's probably going to limit us to only one or two access points right
[1:06:55] now. And it's nice to be able to back up on wherever we fill it to be able to
[1:07:00] come in on whatever side we need to and dump that debris in there from wherever
[1:07:05] it's most accessible. And if we put a fence up there, that's going to really
[1:07:09] sever limit that ability to be able to do that.
[1:07:12] » I don't think anybody's really considered a fence on the on the sky.
[1:07:16] Wouldn't consider a fence. Um, but when you're from this area, you know what
[1:07:21] needs to be done with brush. You pile it up in a discrete location. You don't dig
[1:07:25] a pit in a public view and you know, leave it there for years.
[1:07:30] » This wasn't a pit that was a pond that was there. It's been there for decades.
[1:07:35] » Yeah. >> That has been not holding water. that
[1:07:38] the goal has always been to fill it in, but the goal has been to utilize it for
[1:07:43] the city so that we can actually do our own tree removal instead of hiring to
[1:07:47] the tune of 20 to $40,000. We spent $40,000 two years in a row on tree
[1:07:53] removal. Then we got our bucket truck. We've been doing our own tree removal
[1:07:56] and limbs and you know, we have to have a place to take that and we don't have
[1:08:01] another place to take it at this point. I I think that we could find another
[1:08:05] place and I would encourage us to do the right thing here. Our our citizens don't
[1:08:11] want to look at this. >> I suggest that we fill it in.
[1:08:15] » Now, where do you suggest all of the debris that we have?
[1:08:19] » Find a more discreet place. That's the most visible place. Cheryl,
[1:08:24] » I think before we can pass this resolution, we're going to have to find
[1:08:27] out what the cost is going to be to fill it in. And it's not going to be done by
[1:08:31] our city staff. you're going to have to hire somebody to do it. So, we need to
[1:08:34] find out what the cost is. We need to bring that back to council and we need
[1:08:39] to have a set location for where debris and refuge that the city street
[1:08:45] department has to take, where it's going to go. I I don't think we can pass this
[1:08:51] resolution in the way that it's written at this time.
[1:08:53] » I think that this >> I think that this gives you two months
[1:08:59] to find a solution. I think that's ample amount of time. I'm going to do what my
[1:09:04] citizens have asked me to do and I'm going to keep this motion active. I've
[1:09:08] made a motion. I hope that somebody seconds it can vote.
[1:09:10] » I'll second it. >> Make a comment here. Why don't we take
[1:09:15] the two? >> We've got a motion and a second.
[1:09:18] » A motion and a second on our table. >> I'm going to call the question. I'm
[1:09:23] going to call the question. >> Before we vote, it's public comment. Uh
[1:09:27] point of order, Brian, if we have a if we call this question on a resolution
[1:09:32] uh by by ordinance, I think that only our ordinances require
[1:09:37] » and this is >> it's fine if we want to do public
[1:09:39] comment. >> The motion is just to read this entitle
[1:09:41] only. There will be discussion about that after we do that.
[1:09:44] » Yeah, >> it's not to approve the the resolution.
[1:09:48] » I understand. But before we vote, we always ask for public comment. We have
[1:09:52] somebody that has public >> I was just waiting my turn for everybody
[1:09:55] else to speak and then I was going but he kind of jumped to gun there.
[1:09:59] [laughter] >> But the public comment is after you read
[1:10:01] it, right? What you said? >> There will be discussion after we read
[1:10:07] this. >> It's fine.
[1:10:12] So, just a few minutes ago, you were talking about not having enough money in
[1:10:17] the budget for a street pavement, and now you're wanting to spend more money
[1:10:23] to cover up a pond that one council member thinks is unsightly.
[1:10:31] That just does not make sense and it doesn't seem physically responsible.
[1:10:36] many members many members of the public. I think that if you have a chance to go
[1:10:39] out there and look at it, most people are going to agree that that's unsightly
[1:10:42] » did just now. >> And you don't think that that's an
[1:10:44] unsightly thing, Cheryl? >> All right. Um, all those in favor?
[1:10:52] » I
[1:10:56] read it. Right. >> All right. Can we get a roll call? Two
[1:11:01] eyes to do. Is this just to read it? It's just to read it. Ready?
[1:11:08] » Yeah. >> Paul Anderson,
[1:11:10] » no. Certain. >> Yes.
[1:11:13] » I'm sorry. Curtis Bond, >> yes.
[1:11:15] » Don Valancort, >> yes.
[1:11:17] » Mayfield, >> the resolution authorizing the
[1:11:21] remediation of mun municipal park grounds adjacent to the community
[1:11:26] building, including the filling and seating of an existing pit and the
[1:11:31] removal of a concrete cylinder from the premises.
[1:11:42] I'll make a motion to adopt.
[1:11:46] » I'll second. >> So, we have a motion and a second public
[1:11:51] comment at this time. >> What I was going to suggest, since we
[1:11:55] are looking at a two-month window, why don't we take that two-month window and
[1:11:59] see what we can do to improve it, get more information, and bring it back for
[1:12:03] discussion.
[1:12:06] I mean, yeah, if you want to come back next month and
[1:12:11] take the two months time frame to I will uh take a lead on
[1:12:17] » because I think we need cost estimates of what it's going to cost to actually
[1:12:19] fill it in because we're going to have to have a contractor do that. I would
[1:12:23] take the lead on on bidding the information, working with the our
[1:12:26] infrastructure department and seeing what improvements we can make to uh
[1:12:30] maybe remy some of the situation without going down an expensive line of doing
[1:12:35] this and see if we can bring that back in a couple of months according to also
[1:12:40] get >> that's what I meant and get cost
[1:12:42] estimates and then bring it back where we have more information.
[1:12:47] So realistically, what property doesn't city have this best to be put on?
[1:12:52] » There's 10 acres. That's the only dig on the city hall and put there.
[1:12:57] » I don't know what would prevent you from putting it on any of the 150 acres.
[1:13:01] » You can't by statute because we received federal park and you cannot use that.
[1:13:07] » I would like to see that. >> It's in our It's in our actual
[1:13:11] » because I don't know what would prevent us for doing that cuz I mean if
[1:13:13] something >> Have you read our city park nature plan?
[1:13:16] cuz it's in there. It's part of the master plan. We cannot use it for that.
[1:13:21] We can take the we can take the brush and debris that's in the park and
[1:13:24] there's specific ways that we're supposed to actually structure those for
[1:13:29] habitat. That's what's in our master plan. But we cannot take city street
[1:13:34] department refuge from trees that we are trimming leaves that we're trimming off
[1:13:40] of the streets and take it to the park and dump it. We can't do that. Only
[1:13:45] what's generated in the park. >> Only what's generated in the park.
[1:13:49] » Yeah. I mean, and the new property is land trust. So, you can't really do
[1:13:52] anything, >> right? The new 50 acres is land trust.
[1:13:54] » 50 acres up there is completely unusable. That
[1:13:58] » Well, I know we got by a long time without even owning that property.
[1:14:03] So, I think that >> got by I'm sorry. Got by with what?
[1:14:07] » I mean, it's recent that we own that property and we've turned it into a city
[1:14:11] dump. That's not the intention I had when we purchased this property. You
[1:14:14] talking about the 10 acres? The 10 acres was purchased uh five years ago,
[1:14:19] » right? >> So, yeah,
[1:14:21] » that's recent. >> It is, but I mean it's still for 5 years
[1:14:25] for for three years it sat there, you know,
[1:14:28] » nobody's complained. >> People have complained. And you know,
[1:14:33] there's there's if you ever watched Parks and Wreck, everybody needs to go
[1:14:37] watch Parks and Wreck. This is a this is a comedy that we can't fill in a pit as
[1:14:41] a city. It's a pit, a dump. We need to fill it
[1:14:45] in. >> I've never heard anybody complain about
[1:14:47] it. >> We have other public comments.
[1:14:50] » So, for that cylinder, uh, what if you just repurposed it, uh, like all the
[1:14:57] bags of concrete, put a flag, pull, run up an American flag, and then the ocean
[1:15:02] flag. Kids can still play on it. And like the concern is safety. They can't
[1:15:08] fall in. And then uh for a little chipper I talk to my Chinese suppliers.
[1:15:14] Guess one thousand bucks. >> No, those don't work. They just don't
[1:15:19] work for a city. >> All of my equipment and everything in
[1:15:24] this room is made in China. >> I'm not going to deny that.
[1:15:29] We need an industrial size. >> I understand that.
[1:15:33] » Yeah. >> You go straight to the supplier. Speak
[1:15:36] Chinese. just got a great resident expert now on
[1:15:40] the on the council. >> You're the expert. Yeah.
[1:15:45] » Yeah. On this, >> Pardon me.
[1:15:48] » You're the expert about >> Yes, absolutely. Well, I have enough
[1:15:51] byproduct that could probably just fill in the blonde for free. So, definitely
[1:15:55] something we can talk about. So,
[1:16:00] » well, I I know that our citizens would see this cleaned up. What is your
[1:16:05] suggestion to get on Jordan? >> Where we take city refuge?
[1:16:09] » I think probably the 10 acres is big enough that he said arbor is I think
[1:16:14] just maybe couple trees or something to diffuse it or I mean a fence wouldn't be
[1:16:19] really attractive just on the part by the park but if a fence would work just
[1:16:23] there that was just a freestanding fence that skewed that 10 acres. I haven't
[1:16:27] been out there and looked at it, but like his idea, if it's out in the field,
[1:16:31] you kind of got to get to it several different ways when you go to unload
[1:16:36] kind of boxing it in. But >> would you be willing to work with Jerry
[1:16:39] and kind of >> absolutely brainstorm some of that for
[1:16:42] it back to the council? >> Absolutely.
[1:16:44] » I would be happy to come back to himself.
[1:16:52] » Okay. So, >> so there is a motion and a second on the
[1:16:57] table and we've had public comments and now it's time for a vote. Let's do a
[1:17:01] roll call vote.
[1:17:05] [clears throat] >> Paul Anderson,
[1:17:06] » no. Martin, >> yes.
[1:17:09] » No. >> John Valancort.
[1:17:11] » Yes. >> Sean Mayfield
[1:17:16] » that did not pass.
[1:17:20] So I'll be happy to hear from you guys. >> Well, we'll get together with that.
[1:17:25] » It is an isore. It's been an isore for years. We should find a better plan. Um
[1:17:29] that's kind of how we feel whether >> you know I feel like the resolution as
[1:17:35] it was read is not in our best interest um as a city but we do need to do
[1:17:42] something about the isore that I don't disagree that we need to do better job
[1:17:46] and it is an eyesore. I'm not going to disagree with that. I think we need to
[1:17:49] come up with alternatives and I think that we need to figure those out before
[1:17:52] we pass a resolution. >> You know, Ken brought up point because
[1:17:55] there is field that you can bring in that may not be a top soil type field,
[1:18:00] right? That's that's how a lot of people >> That's right.
[1:18:03] » take a a ravine or such >> and are able to turn that ravine into
[1:18:07] something that's workable. That's right. >> And that's essentially what we're doing
[1:18:10] right now. Uh and I will point out that it looks a lot better than it did 5
[1:18:14] years ago. >> Yeah, it does.
[1:18:16] » Absolutely. 11.
[1:18:18] » I I feel pressed by the 60 days. >> Yeah.
[1:18:24] » So, you'll bring that back. I'd like to request that we get a solution back next
[1:18:28] month. >> Bring it back next month.
[1:18:30] » Okay. >> Sounds good.
[1:18:35] » Okay. So, we move on to the next item of the agenda, which is city project
[1:18:40] update. So, ARDOT trail uh progress phase two. So we are still in talks with
[1:18:47] ARDOT. We have signed everything for them to move forward with the
[1:18:51] engineering. Um we had to allocate that [clears throat] we would allow the
[1:18:55] engineering which I think it was like $60,000 of engineering fees and then any
[1:19:01] other next steps beyond that just waiting for AR to get back to us. Now
[1:19:04] » they contacted and told about we got that email this week. They had reached
[1:19:09] out to them and they confirmed that Luke Jo will be the
[1:19:15] on the project and that's where we're at.
[1:19:19] » And now let's wait and see what design puts forward and then for us to hear
[1:19:23] back from our >> I don't know if you guys have got the
[1:19:26] gist of it but our is a little slow so this may take another six months. Um and
[1:19:33] then as far as the pavilion update I spoke with Chad today and I reached out
[1:19:38] to bookout construction. We're going to coordinate a meeting on Monday or
[1:19:41] Tuesday of next week. Um it is coming along. We're about I don't know 10 12 14
[1:19:48] feet out of the ground now with the the uh fireplace. Uh the goal is and I
[1:19:54] talked to Chad that the goal is to get the fireplace almost uh complete by
[1:19:59] midepptember. Um but we're going to coordinate with
[1:20:02] book out on when to start the actual front pillars as well on the pavilion.
[1:20:07] So that's also in the works right now. Um, something else that was another uh
[1:20:13] update that I wanted to bring to everybody's attention. Uh,
[1:20:18] USPS. So, we finally did hear back from them on our request. And just so
[1:20:24] everybody's aware, this has been going on since 2019.
[1:20:29] Um, and we have actively continued. This is the all the communication that we've
[1:20:34] had with you USPS since my administration. And this is back and
[1:20:39] forth with emails, Congressman Warmarmac's office, Chad Purer's office,
[1:20:44] but what they essentially came back and said was, "We're denying your request
[1:20:48] for a zip code for your entire city." But what they did say is that we can now
[1:20:53] start using go since they're going to say
[1:21:00] » so we can start using goan as the name designation and the zip that you
[1:21:05] currently have but the last four would remain the same. So that is what they
[1:21:10] authorized now. Now, we still have the ability to um
[1:21:18] appeal this >> the and and their concern and and again,
[1:21:23] this may actually be something in your wheelhouse if it's something that you
[1:21:27] could do is that the the Goan Post Office building consists of
[1:21:31] approximately 324 square ft, which is insufficient to support the delivery
[1:21:36] volume associated with the proposed service area. So the facility includes a
[1:21:41] 2x2 vestibule dock configuration allow for rolling te Amazon drop shipments.
[1:21:48] The building also has 9 foot canopy uh without a lift and limited employee
[1:21:53] parking space which further limits operational viability. So what they're
[1:21:57] essentially saying is if we really want our own zip code we have to improve the
[1:22:02] post office. we would have to enlarge it, make it more accessible and
[1:22:06] compatible with all those things that we required. So
[1:22:11] essentially what I'm saying is do you want to appeal this?
[1:22:16] » And if we do appeal it, we have to have some buy in from the owner of the
[1:22:22] building for potential renovation.
[1:22:26] » I believe Kevin still owns that particular building, doesn't he?
[1:22:31] » I'm here. I didn't hear what you say. I think uh Kevin still owns the actual
[1:22:35] post office, does he not? >> I'm I'm purchasing both of the
[1:22:39] properties from him. It's an owner finance deal. Okay. Known Kevin for many
[1:22:44] years. And we talked about this uh prior to me person that that there was going
[1:22:50] to come a time that uh the post office would either have to be updated or a new
[1:22:55] one built here to I'm I'm not sure without doing a study
[1:23:00] if that building could even ever even be built to satisfy what that
[1:23:07] tell anyway. I
[1:23:10] haven't in there, but I've spent some time there uh just kind of evaluating
[1:23:14] the property and the traffic, kind of the demographic, what's go what goes on
[1:23:18] there. And it's really just not it's not conducive for any kind of anything the
[1:23:22] way the parking all is. It's almost kind of a stop and go place anyway. Even when
[1:23:27] the bank was there, it was designed for folks to come in, op right back out, or
[1:23:31] use the drive-thru. So, >> I don't know that there's actually
[1:23:35] enough room on those lots on what those lot sizes are for being able to upgrade
[1:23:40] to what will be required there. >> Probably be a total reconfiguration for
[1:23:44] sure that would kind of go into the lawn
[1:23:49] at the post office. I will say that
[1:23:55] [clears throat]
[1:23:57] before you could even think about enlarging the post office
[1:24:04] as a landlord, you have to get buy in from postal service.
[1:24:11] » Correct. >> Okay. Etc.
[1:24:13] and and agree upon a a rental about for I mean I'm my dad
[1:24:21] built the post office and rented it to the US post office and you have to go by
[1:24:29] their specifications and what they're looking for in order to
[1:24:36] fulfill their need. Okay, that's and it's a 100y year lease.
[1:24:43] » So I think the the point of of priority was to ensure that we were
[1:24:49] getting our sales tax revenue right was one one of the reasons
[1:24:52] » part of it. Yeah. >> Safety as well.
[1:24:55] » So within that as an example the 72703 is was Fatville. It changed now mind you
[1:25:03] say it's 7273 336 whatever that four digit is. What would be the new I guess
[1:25:11] uh >> so the big difference
[1:25:13] » of that money right yeah go may not be the
[1:25:18] » no the big difference is that if you go to like let's say you go to a vendor um
[1:25:23] and this happened to me early in my administration I went up to one of the
[1:25:26] auto places in Springdale and we were buying a bunch of hydraulic fluid for
[1:25:30] the tractor right >> and I said well you know I wanted I
[1:25:33] wanted us to get the money so I was like you can ship it if they ship it to our
[1:25:36] address they have to pay the zip code has,
[1:25:40] » but I said, "Uh, ship it to 124 North Church Street." And he's like, "Oh,
[1:25:46] okay." And he pulls it up and he's like, "Oh, Favville." And actually 124 North
[1:25:51] Church Street is supposed to be Ger pulled up as Fyville at their location.
[1:25:56] If it pulled up from USPS as go, then even though the zip code may be 72703-
[1:26:04] whatever it is, 872, whatever, um, then at that point, it's still going to come
[1:26:10] up under Goian, we're going to get our sales tax revenue. Right now, there's no
[1:26:14] pick list for someone. If they're going into those systems right now, it's not
[1:26:17] even there. So, you put in goan, there's only two addresses in them. One will
[1:26:22] only pull up. Post office is the only one that pulls up. I know this because
[1:26:25] when I'm at city hall, I'm trying to order something and I'm trying to have
[1:26:28] it shipped to city hall. A lot of places you put I put that address in, it won't
[1:26:33] accept it. Like it literally won't accept it as an address because it
[1:26:37] doesn't even register. So once USPS gets go as its own main well then at that
[1:26:43] point it is going to have those pick lists come in hopefully where 7273
[1:26:48] whether it's you know a payil zip code it still would have a go name to be able
[1:26:54] to identify that it's in the city. I do think it's a sort of a win, but it's not
[1:27:00] a win getting our own zip code, but again, I don't think we're going to get
[1:27:05] our own zip code unless we do an expansion of the post office. And I
[1:27:09] don't know how feasible that is. I I don't know that it is. I mean just
[1:27:13] because of the cost of that and what it would be Mike
[1:27:18] » um along those lines of improving the post office or whatever they're
[1:27:22] requiring us requiring us to do with regard to an appeal. Uh I would
[1:27:27] encourage them to look at the St. Paul uh post office. I would encourage them
[1:27:32] to look at the uh homes uh post office. I mean, they're just
[1:27:38] little small tiny uh one room things out there and they've got their own zip
[1:27:44] code. So, and there hasn't been any improvement on those post offices. I
[1:27:48] guarantee you 50 years. So, yeah. >> I think the point though is if they
[1:27:53] brought those additional in, could that current in or something
[1:27:59] go by the population density? So, those are smaller. So, they're little spaces
[1:28:04] that population density. >> That's John. our density is higher than
[1:28:08] what we have by
[1:28:11] » bigger facility. So they're looking at the population density, not just the
[1:28:15] building. Um but like the mayor said, we have we have the appeal there. Um we
[1:28:22] have the ability to appeal, >> right? And and when I reached out to
[1:28:25] Congressman WACK's office, his aid sent me an email. It's ent attached here and
[1:28:29] you guys got this sent to you today or it's in the packet. But, you know, his
[1:28:34] response was he needs to know if we're planning on appealing because if we're
[1:28:39] planning on appealing, he will get Congressman Wmack involved to write a
[1:28:43] letter of support for us for the USPS. But if we appeal, I am afraid that they
[1:28:48] are going to mandate that we end up with a larger post office. Now, we can still
[1:28:53] appeal and they can deny it. And then I guess we still get to keep go as the
[1:28:57] first >> Well, that's what we need to find out.
[1:28:59] If we appeal, can we reserve the the option that they put on the
[1:29:04] table for us? Is that still a viable option if we appeal or do we forward it
[1:29:08] that if we appeal? So, I would hope >> I think that we need to get it clear
[1:29:14] though instead of just assuming but there is no there is nobody to contact.
[1:29:18] This is all >> there is no like email address or number
[1:29:25] that you can call. It is an formal appeal process. You send it into the
[1:29:29] address and then they go through it. >> Well, and you've got to have um some
[1:29:34] plan to appeal. You got to have some action plan presented to appeal. Now,
[1:29:39] granted, the appeal is due September the third. You know, we have a very short
[1:29:43] window. So, that's why we're asked this evening. That's why I want to know
[1:29:48] council wish for me to go through this appeal process and try to get
[1:29:51] Congressman Wike to help try to support that appeal. But then, what is our
[1:29:56] action plan if we do appeal it? that you know that that's my only
[1:30:00] concern. I don't mind appealing it, but then I I don't want to appeal it and
[1:30:04] then we have no action plan of how we're going to do our part to bring up to
[1:30:08] standard what the USPS is that you have you have people who are in
[1:30:16] the city of Goan. Okay. That have an Elkins address.
[1:30:20] » Me >> I know that's what I'm saying. I mean
[1:30:23] even here >> yes it's an Elkins address. this
[1:30:26] American's address >> and people get confused when they're
[1:30:29] looking for people that have fable addresses and
[1:30:32] then they tell everybody they live in East Favville.
[1:30:35] » I I would like us to appeal. Um >> I know that there was a House bill that
[1:30:42] other communities are having the same issue. They're rural. They want their
[1:30:45] own zip codes. They've gone through this. They've appealed. It's still a no.
[1:30:50] they they somehow got on a House bill to create what we want. Um so it's it's
[1:30:59] actually so his aid actually said yes that did pass Congress. It's in Senate
[1:31:03] hearings now, >> right? He says that I mean this is
[1:31:08] according to Wax aid is that those typically don't get pushed through at
[1:31:14] the Senate level because they don't like to interfere with USPS. Um so I don't
[1:31:21] know that it will pass. It's already for us to add on to that bill because the
[1:31:26] bill's already gone through Congress. So we can't add our name to it. But it is a
[1:31:31] precedent. I mean, we we could wait and see what happens with that bill and then
[1:31:35] submit a a a new request if that bill does go through. I mean, that might help
[1:31:43] to solidify >> to get approved
[1:31:46] » with the Senate right now. We might one of our senators and just let them
[1:31:52] know that, hey, this has been on our radar. Wouldn't hurt.
[1:31:56] They're aware of it. >> We can try to.
[1:31:59] » Yeah. I haven't had much luck. That's with our senators.
[1:32:05] » Well, with with with the plan we have now uh to appeal, I
[1:32:10] think it would be I think we would be um premature to put forth a ballot appeal
[1:32:17] without an action plan. action plan would have to include the ability to say
[1:32:23] that we do have the means of ability to facilitate what they're requiring.
[1:32:31] I don't think that's the case. Um I think we accept what they have and then
[1:32:38] we come back later and ask for it again if we have the
[1:32:44] facilities what they're saying we need to do. I think if we appeal uh the pill
[1:32:49] is going to fail because we're not going to be able to satisfy the requirements
[1:32:53] of the appeal. Not in two weeks. I'd just like to vote
[1:32:59] from the council. How many of you want me to file an appeal? And how many of
[1:33:03] you want me to be okay with this for now and then we'll
[1:33:07] wait and see how this turns out in the Senate. Let's have a vote. So, John, yes
[1:33:13] or no? File appeal. Don't file an appeal.
[1:33:19] I don't think that uh we're going to get any place by following an appeal.
[1:33:26] » I don't think we need to >> get through our options some more before
[1:33:33] we >> see what happens in the
[1:33:37] » accept the go option. >> Yeah, definitely. Yeah.
[1:33:41] » Except the go option, but >> don't file the appeal.
[1:33:47] » Okay. >> All right.
[1:33:51] We won't file the appeal, but we will move forward with using go and I do
[1:33:55] think we need to put on our website. We probably need to do a mailer
[1:33:58] » so everybody go is aware so they can start using
[1:34:01] » address changes would have to be. >> Yes.
[1:34:03] » Can I get a verbal? I assume Colton, he would have voted yes.
[1:34:08] » Yeah, he won. Okay. And Curtis, >> no.
[1:34:11] » I'm asking Curtis. Yeah. Okay. >> Will the USPS be sending out
[1:34:16] notifications of the changing changes of the addresses?
[1:34:21] » Probably. >> I can email if you want. We'll find that
[1:34:24] out once we send the paperwork accepting the compromise.
[1:34:27] » And then we'll see what the uh logistics of that will be.
[1:34:31] » Okay. All right. So that brings us to the next
[1:34:35] item which is uh item F which is conflict of interest. What that is I
[1:34:40] guess Brian. >> Yeah. So Colton had reached with a
[1:34:44] question for me. U he was stating to me that the city had
[1:34:50] hired a parks commissioner to work part time on maintenance of the park. He
[1:34:56] wanted to know whether or not this was a conflict of interest. Uh,
[1:35:01] best I can tell Arkansas Code 1442107
[1:35:09] is applicable to this situation, which says that a council member,
[1:35:14] official or municipal employee shall not be interested directly or indirectly in
[1:35:21] uh profits of any contract for furniture,
[1:35:27] supplies, equipment, services to the city. U and it's been determined that
[1:35:33] employment by the city is a form of a contract. Uh
[1:35:39] and so my answer to calling and I recognize
[1:35:44] it's just the parks commission which is essentially an advisory board for but
[1:35:49] Erin on the side of caution I would in answering his question uh point you all
[1:35:55] to that statute and that statute does allow
[1:35:59] uh employee to also serve on a city board or in some
[1:36:05] official capacity if the city council has adopted ordinance specifically
[1:36:10] allowing them to occur. So
[1:36:14] » we have two employees. We have Nathan Snipes that's on the parks commission
[1:36:18] and he's also a city police officer >> and we have Mike Nemo who works
[1:36:24] part-time for us doing you know >> okay
[1:36:28] » some park stuff some stuff just for the infrastructure department. Well,
[1:36:32] [clears throat] that was that was the question from Colton and that was the
[1:36:35] answer to that inquiry. Um, so I again to if that is the case then the
[1:36:47] I think to stay in line with this the council needs to adopt an ordinance to
[1:36:50] allow that.
[1:36:54] » We're not that big of a town. >> Yeah. [laughter]
[1:36:58] » So we just need to bring that back. >> Yeah. If y'all want me to bring an
[1:37:00] ordinance back next month, I can do so. >> Limited number of people in town that
[1:37:05] are work to do the city. >> Yep.
[1:37:08] » So, I'll I'll bring an ordinance back uh that is in line with the statute
[1:37:13] » because that would literally twothirds of our parks department. Our parks
[1:37:17] commission >> and Linda is going to be term expiring
[1:37:20] at the end of this year and she's not going to be able to be reappointed
[1:37:23] because she lives outside the city. So, that would leave parks commissioners.
[1:37:27] Those are very active parks commissioners, too.
[1:37:30] » Yeah. >> So, I'll bring I'll bring an ordinance
[1:37:33] back next month and y'all can consider that.
[1:37:36] » Okay, that's good. >> All right. And then the next item on the
[1:37:40] agenda is item G, Riverside. Dan, do you mind coming out and talk to
[1:37:45] me? I think we have some clear. >> I know it's last
[1:37:50] u so I can summarize it for you, but I think you have a copy. Thanks to Miss
[1:37:55] Abby for the last second assist in getting this in front of you. Thank you
[1:37:59] for the council or mayor both for putting it on the agenda for discussion.
[1:38:03] In your two bullets on this, it's a lot of words to simply
[1:38:08] say that the Riverside Estates Board of Directors is fulfilling the requirement
[1:38:13] of the of the council. Roughly eight months ago or so, you may
[1:38:18] remember probably the last time we talked about this. Um, you had required
[1:38:23] that I secure a letter uh with signatures from the board expressing our
[1:38:29] interest in pursuing a conversation with the council about the prospect of street
[1:38:36] ownership in Riverside Estates and what that may look like or what possibilities
[1:38:43] might be there. And it took longer than I expected or would have liked, but here
[1:38:48] we are. And here is the letter and it's signed. So, I know this is last session.
[1:38:53] Um, I don't expect any resolution or or action item or anything like that
[1:38:58] tonight, but it's a it's uh I'm happy that we were able to get it onto the
[1:39:03] agenda because now I'll be there and give you some time to think about it.
[1:39:08] But our position is pretty straightforward. As you can imagine, the
[1:39:12] board of directors is responsible for the maintenance and the upkeep, every
[1:39:16] aspect of the street. So they're owned by the residents equally. So this is not
[1:39:20] you know uh what happens with those streets would still have to go before
[1:39:23] our residents but as a first step and in satisfying your requirement. This is the
[1:39:28] letter and the board is interested in any dialogue about the prospect of I
[1:39:36] don't know legally speaking I don't know if it's deed you probably know Brian
[1:39:39] deeding uh the have to dedicate the roads to the city and then the city
[1:39:44] would have to accept it. >> Perfect. dedicate and accept. So that
[1:39:48] that I think would be the board's intended outcome, but um no question in
[1:39:55] my mind that this is not [clears throat] an easy sell. Um probably especially to
[1:40:00] the finance folks [laughter] like Mr. But uh nevertheless, that's the purpose
[1:40:08] in this document. And I'm hoping that uh if you have any questions or any
[1:40:13] comments, you're not going to hurt my feelings if you say this is there's no
[1:40:17] business interest or advantage whatsoever. The city council on behalf
[1:40:21] of the city if you said that you would hurt my feelings at all. John, John,
[1:40:25] never disappoint. Um I get that. I do. But in any case, I'd like to uh it was
[1:40:32] always the point to I don't want to say force the conversation, but at least to
[1:40:36] exhaust all the options because this is actually a hold over topic from my first
[1:40:42] firm as president of that board that never got resolved and then I was not
[1:40:46] and now I am again. So just trying to close this out however it closes out. So
[1:40:54] if you have any questions or any comments or statements that you want to
[1:40:57] make now time, that's great. If not, I'm hoping that we can figure out a way to
[1:41:03] u continue the conversation. >> I I just question a when was the street
[1:41:09] when was the street initially put in? When was it serviced? What were the
[1:41:13] engineering designs standards that were in the actual design standard of the
[1:41:19] street? And then is there any current damage to any of the streets?
[1:41:23] » Great questions. all that comes out on that will be I think further discusses
[1:41:29] the council does things I'd really want to know
[1:41:32] » not just in this particular situation it's no different for others are not
[1:41:37] good at all but I think it brings about dialogue to
[1:41:42] say >> if X Y and Z are done and they would be
[1:41:49] eligible to present to the city to >> that's my concern is we adopt up yours.
[1:41:54] And I mean, I'm not opposed to it. I just think we drop yours, they have to
[1:41:58] drop the NLES, and we have to drop down your ranch. And then then, you know,
[1:42:02] they take down their gate. Now we have Waterford, and the city gets $200,000 to
[1:42:07] take care of all these new streets that we've not been maintaining. And then
[1:42:12] what do we do if we don't have the finances to be able to to fix those? At
[1:42:18] what point is it I mean, I'm having a hard time even fixing the ones we have.
[1:42:23] and I'm getting $400,000 grants that we're waiting a year to get so that we
[1:42:26] can resurface streets that, you know, we don't have money to maintain. So,
[1:42:32] » I like the idea. I do. I think it's a I think it's a great idea. I I don't know
[1:42:36] how we've not adopted these, you know, when we build subdivisions, but
[1:42:41] » Well, and part of it is that whenever you build a street, you want a secondary
[1:42:47] engineering firm. You know, this is what most cities do that they have a
[1:42:50] secondary independent engineering firm that is confirming that street
[1:42:55] construction and that's going on in that subdivision. Something that has ever not
[1:43:01] happened in Goan ever. And so without having that history of knowing the
[1:43:06] street conditions, it you know puts everybody in difficult
[1:43:10] position to know that that street is going to maintain integrity.
[1:43:15] » Understood. Um, I've tried to reach out to ESI and been unsuccessful, but I will
[1:43:21] continue to try. I'm trying to get anything they're willing to give me
[1:43:24] about the original construction. I don't think anything is filed. I don't think
[1:43:28] I'm not sure if that happens or not, but the county tells me they have nothing. I
[1:43:32] think city hall, I'm not sure if it was you or Lacy that I spoke to, but told me
[1:43:38] they had they had nothing of record. Um, >> but if it's not in our code, then do we
[1:43:43] need to look at establishing that to ensure that any type of subdivision
[1:43:47] comes in meets these standards? Period. >> Oh, definitely.
[1:43:52] » If you're going to be if you're going to be accepting them, you definitely have
[1:43:56] to have >> right something as a code
[1:44:00] » for the city. >> Agree. No, no doubt about it. I mean,
[1:44:07] » you take water for Example, cat. Huh?
[1:44:11] » Nobody allowed it. >> Exactly.
[1:44:13] » I don't know how many times those streets have been cut up, dug up
[1:44:22] » to fix the water lines. >> That's partly bay of build water and we
[1:44:27] even we have frustrations with that. I mean, they cut J Street over here.
[1:44:31] That's a great terrible >> times in the last two years historical.
[1:44:37] It's just going to cost water for presidents a lot once all these cuts
[1:44:41] have started to fail. We're already kind of going through speed bumps now on some
[1:44:45] of those. So, >> you need something to some of those kids
[1:44:48] down on that. [laughter] >> Maybe this is a question maybe you can
[1:44:53] answer. Bville doesn't even notify us when they come and cut a street city.
[1:44:59] Now, I know that we have something written in our ordinances that they're
[1:45:02] supposed to, but they don't. They just come and cut the street. They cut Hail
[1:45:07] Road up here and never contacted city hall at all and then did a terrible job
[1:45:12] patching it up and I had to send the guys back up there to fix it because you
[1:45:15] know >> Well, I know we have they come in they
[1:45:19] used to, you know, cut >> is there any repercussions on city
[1:45:22] streets that they're cutting? >> Probably not. They've got an easement
[1:45:28] the right to maintain whatever utility they have there.
[1:45:31] » What they do what they do in water. Okay.
[1:45:35] They have to >> have to
[1:45:39] » and put it back >> exactly like it was.
[1:45:44] » Is it ever? >> Yes.
[1:45:45] » So they they would have the same obligation on a road.
[1:45:49] » Yeah. >> Whether they do that or not is another
[1:45:52] » Well, question. >> Yeah.
[1:45:55] » They have not been maintaining the road cuts the way that they should.
[1:45:59] » That's right. on any of the ones that I've seen and there's been several since
[1:46:03] I've been in office. >> They have too many road cuts going. They
[1:46:06] can't keep up with it. >> Obviously with the road cuts that allows
[1:46:10] more water to get in the bills that >> anyway
[1:46:16] » coming back around though. >> But I I I'm glad that you're you know
[1:46:19] bring it back. You've got your signatures. We can look at it more and
[1:46:23] discuss it. figure out maybe standards on what we would accept
[1:46:28] about that. >> I'll promise you're done that they're
[1:46:32] willing to get >> I can't
[1:46:37] do a core test or something of that nature in several different locations to
[1:46:40] try to predict on how that compaction was done and how much actual asphalt
[1:46:46] material was used and things of that nature. But at least we can start
[1:46:50] thinking that direction. Is there any damage to the road?
[1:46:54] » Almost none. Um, we have a uh one that made it planning process. We've
[1:47:00] been in touch with three different companies that have come out and given
[1:47:02] us assessments and there's been almost there's been no there's no line items in
[1:47:07] the bids for any repair work at all. So, I mean, we've got some, you know,
[1:47:12] there's some gouges, but we're talking about minimal, you know, very minimal.
[1:47:16] Our streets are in great shape. Nothing like you know Walker and Noles or any
[1:47:23] other random subdivision like >> I mean we've we've put down a char
[1:47:32] » anyway I'll try to bring back more information
[1:47:37] next time. >> Thank you.
[1:47:40] » All right brings us to uh kind of the end here. We got comments for alderman
[1:47:45] city attorney. You guys have any other comments?
[1:47:53] » Well, we have to have public input. [laughter]
[1:47:55] » Well, I thought we did that just now. >> Well, no. At the end of the meeting, we
[1:47:59] have a time for public input again. So, okay.
[1:48:01] » There's a public input time for anybody that's wanting to come up and talk. Got
[1:48:06] two minutes up here at the podium. >> You had it earlier in the meeting, but
[1:48:10] the the audio quality in the, you know, gallery is terrible.
[1:48:14] » Yeah. Uh, I would say if I graded it, it I would maybe give it an F+. It's I
[1:48:19] would say I probably heard about 15% of the meeting. And it just seems to me
[1:48:23] like there's a continuous feedback like all mics are open, all speakers are
[1:48:27] open. And I think we you spent about 10 grand or so to upgrade this. This is not
[1:48:33] just this meeting. The last I mean, ever since I've probably been to five or six
[1:48:37] meetings since the new stuff got installed, and it's always bad. It's as
[1:48:41] bad tonight as it's ever been. And it seems like I mean especially we spent
[1:48:45] 10k on it. This is a small room with not that many people and if these people
[1:48:50] can't hear to me that's the biggest failure. Um it's supposed to be for
[1:48:55] these people right >> so um
[1:48:57] » get back out here >> whatever it takes. I think uh
[1:49:02] » I agree it's reality 100%. Yeah, I do not have a background in AB otherwise it
[1:49:10] [clears throat] was I can fix this. >> Any other
[1:49:20] » make a motion to adjurnn. >> All right, Mr.
[1:49:23] » Second. All those in favor? >> I I
[1:49:33] made without go to St. Paul. It's way smaller.
