[0:05] All right, everyone. I'm going to bring this regular Hermosa Town Board meeting
[0:10] to order on September 8th, 2026 at 6 PM. Starting with roll call. Trusty Ferguson
[0:17] » here. >> Trusty Kramer
[0:19] » here. >> Trusty Mathem.
[0:21] » Trusty Miller >> here.
[0:23] » Trusty Service here. Uh, thank you everyone else for coming. Um,
[0:28] we'll move into the pledge of allegiance.
[0:35] I aliance to the flag of the United States of America.
[1:07] I don't know if this is the time, but we're here to ask a couple questions. Is
[1:11] there time at a later later in the meeting?
[1:14] » Um, yeah. If it's not attached to an item on the agenda, then this would be
[1:17] the time. >> Hold up.
[1:21] Okay. >> Yeah.
[1:21] » So, um, we'd like to purchase some land on the other side of the highway.
[1:26] » Okay. and we're hoping to get approval on the board um and promise to get water
[1:32] and that the supply will be good and um uh
[1:38] so we'd like to develop starting on the north side of the theater
[1:43] in two or three different phases. So I I brought uh my partner Trent with
[1:50] me and an engineer. So, I don't even know where to begin, but that's before I
[1:55] go buy land, um, I need to get a commitment from city.
[2:01] All right. Um, this sounds like a planning and zoning discussion. Um,
[2:07] we can add a discussion item when we get into it. We can add a discussion item
[2:13] under planning and zoning to the agenda. Uh, anybody else have anything they'd
[2:18] like to say before we get moving?
[2:22] All right. Um, call for changes. Here we go. Review current agenda items. Motions
[2:28] to accept as presented are amended. So with that, uh, public input, I would say
[2:37] Oh, we go. ABCDE D. All right. So what's item F? Uh
[2:45] » uh >> Hermosa Hills is what that uh
[2:53] » development's called. Herosa Hills discussion of further development.
[2:58] » If that sounds good.
[3:07] Okay. Um,
[3:12] anybody else have anything to tweak? Anything? Uh,
[3:23] I feel like we're going to be tableabling some of these things, you
[3:26] know, these floating items again, but I guess we'll see.
[3:31] Nothing else to tweak, add, or anything. All right, I'll entertain a motion.
[3:36] Entertain a motion. Who's got a motion? Just
[3:42] » I'll make a m a motion to accept the agenda with the little changes.
[3:47] » Motion made. Do we have a second? >> Second.
[3:49] » Made and seconded. Further discussion? Seeing none, all those in favor?
[3:53] » I >> All right. We have an agenda.
[3:59] Consent calendar approval of August 17, 2026
[4:06] special meeting. I was Oh, that was
[4:11] budget meetings. Did we approve these already?
[4:16] This was >> this was the last regular meeting and
[4:20] the special meeting right before that. >> Yeah,
[4:23] » it was Monday and a Tuesday night because I missed them both.
[4:27] » Oh. Oh, right, right, right. All right. I'm thinking the budget meetings.
[4:30] » Yeah, we are. All right. >> All right.
[4:34] » I'll make a motion to approve the 1726 special meeting minutes.
[4:39] » Motion made. Do you have a second? >> Second.
[4:42] » Made and seconded. Further discussion? Seeing none. All those in favor?
[4:47] » I >> I
[4:48] » abstain. I will abain also. >> All right. That's right. You are both
[4:51] absent for that meeting. >> Very good. Um,
[5:00] moving on. August 18th, regular meeting minutes.
[5:07] [snorts]
[5:13] This concluded the adjustment to the water rates.
[5:29] Make a motion that we approve the August 18th meeting minutes.
[5:35] » Motion made. Do we have a second? >> All made and seconded. Further
[5:39] discussion. Seeing none. All those in favor? I
[5:42] » I. >> All right.
[5:44] » I will abstain again. >> Very good. Okay. Conflict of interest
[5:50] declaration. Roll call voting for any agenda item where a conflict of interest
[5:53] is formally identified and right into legal or
[6:01] we need we should all the agenda >> they have the flexibility does brown
[6:07] agenda >> like we want to do town updates
[6:12] » I mean you should amend it every time you're doing the
[6:16] » changes probably to move it just because the idea is to give public you Y
[6:20] » if they wanted to leave and come back when that item dropped or whatever they
[6:23] had to do that
[6:27] » yeah I don't think you'll be super >> no
[6:34] Mr. James your floor >> uh yeah this one's not as long as the
[6:37] last meeting. So um just a few things that I worked on uh
[6:43] pursuant to the last meeting. So, one of those is um I do have a draft of the
[6:49] Preston uh family agreement that is for review. We can do that in executive
[6:54] today. We could do it in the next executive. Whatever works for board on
[6:58] that, but there's a draft ready to kind of review and go over on that. Um the um
[7:06] the last meeting we decided to uh report the issue of the um FEMA brick grant. um
[7:14] being subcontracted without going through competitive bidding and um I did
[7:19] make that report to the OIG for FEMA. Um just to say that yeah, we didn't have
[7:27] any knowledge that it was being subcontracted and that um but as soon as
[7:31] we became aware of it, we're letting you know that it was. Um I've not had
[7:35] anybody um reach out to me on it yet. I did put both your name Marin and your
[7:41] name Bay on the U. I think I put their name on it too as as contacts for
[7:45] people. So they somebody might reach out to you and ask what's going on with that
[7:50] situation. But um that is uh that we've done from our due diligence standpoint.
[7:56] We've done what we should do to make them aware of that and kind of their
[8:01] decision of what happens from there, I guess.
[8:04] Um [sighs] and then I did um send off a dispute letter on claims from last week
[8:11] from ATAC uh for the board's vote on that. And so that starts the 30-day
[8:17] period of where they can informally uh come to an agreement with us or they
[8:21] could again wait out that time frame and then would have to be arbitrated or
[8:26] mediated. Um but that that was done and
[8:33] What day? >> I did that today actually.
[8:36] » Thank you. >> Yeah. So that was when it's sent out
[8:38] certified mail. >> Um
[8:42] there's one more thing. Um
[8:50] that's all I can think of that I was working on for the last meeting. So
[8:55] if you guys have any questions, I'd be happy to answer them.
[8:59] That's all I got. >> All righty. Anyone have anything for Mr.
[9:03] D?
[9:07] Sweet. Very good. All righty. [clears throat]
[9:11] And now on toformational presentation for text my gov.
[9:15] » Um yes. So the town is actually excited. We're launching a text my gov. Um it's
[9:22] going to be a communication form. No app is needed to download, but what we're
[9:26] going to be able to do is reach out to the community with events, weather, any
[9:30] kind of emergencies. um that we can share with you guys just to bring more
[9:34] awareness. So on August 31st the mass packs did go out. Now the numbers we
[9:39] have and if you didn't receive one it's it might be because we have a landline
[9:43] not a cell phone for you. So um I'm Terry and I were here if you guys can
[9:47] come in and update your number with us we would love to add you get you on the
[9:51] list. If not you can come in and we'd be happy just sit down and help you also
[9:55] get signed up on it. Um, it's just as simple as sending a text message to a
[9:59] number with Fromosa South Dakota. Um, you'll get a, you know, reply yes to
[10:04] join with us. That's all you do and then you're opted in. You can get out of it
[10:08] just as quickly as reply and stop and then you won't hear from us again. You
[10:12] want to get back in, just jump back in the office. Let us know again. If you're
[10:15] not receiving it, it's probably just because we don't have an updated cell
[10:18] phone. There any questions you can answer for
[10:22] that? >> And what's that number again? The number
[10:24] is going to be 91896 and you're going to text Hermosa SD all
[10:30] one word all caps. And then also on the bulletin board over
[10:35] here, you'll see the the town notification we sent out. You'll also
[10:38] see this flyer with a QR code that you can scan as well if you don't want to
[10:41] text the numbers. There's a couple of options. And then you can also jump on
[10:44] the town of Promosa website and get all the information as well. You'll see all
[10:48] of us, all the flyers.
[10:53] » Very good. >> I got mine. Thank you.
[10:57] » Good, good, good. So, yeah. >> Thank you.
[11:02] » So, just to elaborate a bit on this, I think part of this kind of came at the
[11:06] right timing with u things like notifying people about water being
[11:09] turned off. um talking about people getting notified for road closures,
[11:14] construction that will affect their road, their street. Um all that
[11:18] will be able to flow out now and be a lot more efficient. Um we're going
[11:24] to look at other possibilities of what we can use this for, but just trying to
[11:28] make it a little closer to absolute transparency
[11:32] through modern the technology that's stuck with all of us or what's we're
[11:37] stuck with it makes sense. >> [clears throat]
[11:40] » Um, all righty. Very good. Anybody else on uh text my bill?
[11:49] » Thank you very much. >> You're welcome.
[11:52] » Citizen stakeholder items. Um, don't think Well, I guess technically we did,
[11:57] but we moved that put it under planning and zoning. So, it looks like we're
[12:01] right into the planning and zoning section of the meeting. So, I'll
[12:04] entertain a motion to adjurnn. And we can do
[12:08] » I'll make that motion. >> All right. Motion made. We have a
[12:11] second. >> Made and seconded. Further discussion.
[12:15] Seeing none. All those in favor? >> I.
[12:19] » All right. We are now the planning and zoning commission.
[12:21] » Thank you, Morgan. >> Okay. Approved. Final plot of track and
[12:27] Fairfield tract. >> Thanks. Do you want to be
[12:32] fellow?
[13:01] Do you have a map that goes up there? We can see.
[13:05] Hey Peggy, it's Terry at townosa. >> Terry,
[13:09] » hi. So, we are just at your plat on the planning and zoning part of the agenda
[13:14] and so I do have you on speaker phone. Okay.
[13:17] » Okay. >> All right.
[13:36] » [clears throat]
[13:41] » When this was brought up last time, we were concerned about the sewer
[13:46] and we're no longer concerned about the sewer.
[13:50] » And the question now is about annexation or horses.
[13:56] Am I understanding that correctly? Uh, I think, yeah, there's, um, there's
[14:01] confusion, misinformation been flying around over annexation for years. Um, I
[14:05] think part of that stems from the period of time where there was some aggressive
[14:09] efforts toward involuntary annexation that just put a really bad taste to it's
[14:13] everybody bordering the city. Um, we do have uh residential agricultural that
[14:20] allows for animals. We looked it up. It's up to uh
[14:27] » three horses. >> Yeah.
[14:29] » Four. >> Three.
[14:32] » It was three. >> Up to three.
[14:34] » On what acreage? >> It doesn't actually specify.
[14:39] Or did it? No, you know what? Let me pull it up.
[14:41] » It did say something about that, didn't it?
[14:43] » Oh, say I think it did. >> But it was weird. That's right. It was
[14:46] weird because it's it it was like a number of heads per acre up to a maximum
[14:52] of four and it was like Yeah. The way it's worded basically makes it
[14:57] » Yeah. >> redundant.
[14:59] Um
[15:04] it's somewhere in here.
[15:12] No, please tell me that it's logged in. Oh, it's about to kick us out of
[15:27] should be 90.07.
[15:31] » Thank you.
[15:38] » The wrong book. >> Yeah, the wrong book.
[15:46] Oh, right at the top. Isn't that something?
[15:50] » Yeah. Then the RA1 stuff starts in sub C.
[15:58] » Okay,
[16:04] there. Yeah. All right.
[16:13] Number of lots coming limited to two head or two mother offspring combination
[16:18] for the first city lot and one head or one mother offspring combination for
[16:22] each lot thereafter.
[16:26] That's
[16:39] Oh, down here. Um, the actual number of livestock shall have be limited to three
[16:44] head or three mother offspring combinations for each one acre of
[16:47] property not to exceed a total of four head or four mother offspring
[16:51] combinations. Equality limitation only such time as
[16:56] there need
[17:00] um
[17:03] » so it has to be an acre then
[17:13] » at least an
[17:16] » yeah both of these are well more than >> right
[17:21] » um so there's really no consequence. Uh the pro process of annexation involves a
[17:27] resolution. So does resoning and all reality making sense at all. You use the
[17:34] same resolution when you annex and zone the park you're annexing at the time. So
[17:39] there's no reason that uh there can't be livestock up to
[17:48] three head or three mother. I I don't want to do this.
[17:55] » Um but anyway, yeah. So, just to just kind of squash the idea that uh annexing
[17:59] is bad for having horses. That's that's unequivocally false.
[18:04] » But we're not annexing this property. They don't want it.
[18:08] » They're just platting. >> Yeah.
[18:10] » Um >> extra territorial.
[18:13] » Yeah. >> Yeah.
[18:15] Um they're already on the >> water but not sewer.
[18:22] Um I can give them the sewer and uh water
[18:28] when I do anything, you know, with that with my other lot.
[18:34] I don't have a problem with that. I just don't want to annex.
[18:41] But on that one partial that she's got here, it says 160 Ferguson place.
[18:47] » Can you hear me? >> Yep, we hear you.
[18:49] » Okay, thank you. >> What's that?
[18:52] » It's not They got Ferguson place instead of
[18:57] the address. Oh, >> so that has on the chat.
[19:08] » It's on page 25.
[19:13] » Wow.
[19:19] » Oh, yeah. That's just Yeah, >> I think
[19:24] » somebody put it because on the bottom it's you see it says 160 fair ground
[19:28] slice. >> Oh wow. This is our whole safety system.
[19:33] » Wow. >> That's
[19:37] appreciated information. >> Can we can we uh make sure these get
[19:41] printed and put in the parcels file on extra ter?
[19:45] » Yes. Everything should be kept in a file.
[19:47] » Yeah. So, >> thank you provided that information.
[19:51] » Very good. >> Is it in our ordinance that if you plant
[19:57] that you have to be um have to voluntarily
[20:04] annex him? >> Um
[20:07] » well, we did that um the plat south of the Ferguson edition behind Vickiy's
[20:14] house. we in Kuster County and we just looked at
[20:18] the plat because it was all done through them and they just wanted us to be
[20:23] aware, >> right?
[20:24] » So I would think this is the same thing. >> Yeah, that was a well good thing that
[20:29] precedents don't actually apply, but that that was that was could have
[20:32] potentially been a really bad precedent to set.
[20:35] » Um because the whole story was uh it was very much painted that well we're just
[20:39] platting we're never going to build there. Let's don't make us annex because
[20:43] we're flatting. We're never going to build there. And the next thing you
[20:45] know, it's oh well, we want to build there now.
[20:48] » What changed in six months? >> Um my my only interest, so they're
[20:54] already on water. The one part the home is already on town water and it's on a
[20:59] septic. >> Um so there's nothing changing in that
[21:04] respect that would trigger an annexation.
[21:07] Um now if that septic system fails and they're required to connect to town
[21:11] sewer at that time we would be under the new ordinances that are getting another
[21:16] first reading tonight required to force their
[21:20] in order to get that sewer hookup done >> because the um the maze
[21:25] bad bad business it comes down to
[21:30] people who are annex have say in how our water and sewer is handled what they pay
[21:35] they're they're voters they're they're citizens they can run for the they can
[21:37] get on the board if they want to, >> but right now all these customers that
[21:42] are outside of town, their customers don't get to have much say. Um,
[21:49] » yeah, thank you. >> And they're okay with that.
[21:55] » Um, so as far as annexation, is there any just my curiosity, the board's
[21:59] curiosity, is there a specific reason that you oppose annexation?
[22:05] just just try to understand where you're coming from because I imagine other
[22:08] people are probably coming from the same place because annexation is the key to
[22:12] growth for a town. >> I don't mind ever going on the sewer. I
[22:19] don't mind ever going underwater. I do have a well on my property, too, by the
[22:22] way. And I choose not to activate it, and so do other people on that street,
[22:29] and they choose not to activate it. Um, so I'm fine with that with doing the
[22:34] water. So you guys can, you know, I can add to that add to the financial part,
[22:41] you know, of of the town in one way or the other. But um
[22:46] my religion, my spirituality, what I do for a living
[22:52] is all is country and it's spatial and it's individual and it's liberty and
[23:00] it's what I want and I don't want to be part of the town. I I have an
[23:06] opportunity to live in all these other spaces in the United States and I've
[23:11] never lived in a town. It's not who I am.
[23:16] » Okay. Personal preference then. Fair enough.
[23:18] » Right. >> For sure.
[23:20] » All right. Just curious. Um All right. Uh I don't know if anybody has any
[23:26] » I'll make a motion to approve this. >> Motion made or motion made. Do we have a
[23:33] second? >> Second.
[23:37] » Made and seconded. Um
[23:42] further discussion
[23:47] seriously. [laughter]
[23:51] » Um no further discussion on this and we are approving the final this is
[23:57] the final flat >> you know final.
[24:02] » Um Scott do you have any concern any interest?
[24:06] » No this is extra territorial. is just again in our ability to add comments to
[24:11] the process. You can they still got to go to the county too. Wrap it up and I
[24:16] don't have any nothing jumps off the page with me as concern. Okay, sounds
[24:23] good to me. All right, any further discussion? Seeing none, all those in
[24:26] favor? >> I
[24:28] » I >> All right, for eyes one extension.
[24:33] Okay. Um, Peggy, looks like your plan is approved as far as we're concerned.
[24:39] » Thank you very much. Thank you for listening.
[24:41] » All righty. Good luck with the county and good luck moving forward.
[24:45] » Okay. Appreciate it. Good night. >> Good night. [clears throat]
[24:50] All right. Um,
[24:56] good. >> Um, we'll see. 9C or what page is it on?
[25:01] » 31. 31.
[25:10] » Okay, thank you.
[25:17] Okay. Um, let's see. Approve residential building
[25:22] permit 195 Fth Street.
[25:37] All right. [snorts]
[25:44] Single
[25:50] family
[25:54] and half
[26:17] This is like the most um information we have ever gotten
[26:25] » or not ever but in a long time. >> And I I appreciate that a lot.
[26:54] The only issue that I have with this at all is that u it
[27:02] that lot has had some water on it in the
[27:11] Three bed, two and a half bath, walk-in closet, mastering mastery.
[27:21] » Outside of that, I have no problem. >> No, it's not in the flood plane. But
[27:33] » I may ask, is this stick built for plans or is
[27:37] this
[27:47] Yeah, that's the one that in the springtime it's really wet over there.
[27:51] » Mhm. >> Yeah.
[27:59] » Not so much where the house is located at though. the behind where the house is
[28:04] at is where there's been more water as I recall.
[28:09] But they may want
[28:13] » Do you know if these contractors are registered with
[28:30] again
[28:37] approved But
[28:45] » it looks like it's going to be a nice addition to the town.
[28:49] » Make a motion that we approve it, but we need the contact as all to be licensed.
[28:58] » I will second that. >> Made and seconded. Um, there's one other
[29:04] thing I would like to point to is that we don't as of this
[29:08] moment have a building inspector on call. Um,
[29:16] I think uh we need need to be aware of that. Builders need to be aware that
[29:20] they're going to have to give us some grace. Um, so you know, I mean, if we if
[29:25] we approve the building and then we get uh
[29:31] any situation where we're, you know, up the creek with no power,
[29:36] then we put ourselves there by approving it. I don't know.
[29:42] » Was that I can't remember. Was that decision um to call one as needed or
[29:50] were we going to do further investigation?
[29:54] » Right now, Terry has the authority to if we need somebody, she can call.
[29:58] I've been working with somebody at this time got up from the and I've got
[30:03] another one.
[30:06] So hopefully we'll have all right. Um
[30:14] is the builder for this here? That's your this is yours?
[30:19] » No, not this. >> This is the one on This is the new house
[30:22] on Fifth Street. You guys are No, we didn't want too busy, but
[30:26] » Okay.
[30:31] This is a packet. This is an impressive packet. Come to us with this and it
[30:35] makes everything easier. Yes. >> Yes. Very good. Um All right. Any
[30:39] further discussion? Seeing none, all those in favor?
[30:43] » I motion pass. Okay.
[30:49] Um,
[30:53] we have >> D and E areformational permits.
[30:57] » Move and tear down of sheds. >> It's just there's no motion required.
[31:02] Just >> soformational permits. I've never seen
[31:05] anything in the ordinances point to theformational permits. Do they exist in
[31:09] ordinances? >> I don't know.
[31:17] Yes, I see it.
[31:21] [laughter]
[31:23] » Ask my assistant quick. >> Um,
[31:28] yeah, just curious because yeah, that's that's a thing.
[31:33] Um, anyway. All right. So, it's moving sheds,
[31:39] 120 square feet.
[31:47] 160 is the minimum.
[31:59] » It seems arbitrary.
[32:19] I guess the only question we need to care about really is uh is it in the
[32:22] flood plane? No. And no and no.
[32:30] » Right. Is there any other questions we ever have about jets?
[32:33] » Where's I I must have brought the wrong packet.
[32:38] I don't have >> the only other question is that it's
[32:43] located in
[32:46] » on the property and place that we don't need to access, but it's not.
[32:52] » I think the only um >> the only thing I can think of that would
[32:57] maybe possibly need to be noted is that um ridiculous ordinance that we need to
[33:02] change where you can't put anything in the front yard.
[33:06] We're going to change that. >> I think we need to change that because
[33:08] it's hamstringing everybody in the Ferguson development from building
[33:11] sheds. And that's cool. >> I think
[33:15] » it's my opinion. >> Everybody on a certain side of the
[33:19] street. >> Everybody on a certain side of the
[33:21] street, right? Because they can't put the fed in the in the draft of the
[33:24] house. They can't build a shed because the draft is the front of the house. So
[33:31] ordinances are structured so that there's one particular development keep
[33:34] just
[33:38] yeah anyway >> I make a motion to approve it
[33:42] » or if we have to have a motion >> informationational yeah
[33:46] » very good thank you for the information >> I guess the only thing I would say yeah
[33:50] since we don't have to make a motion or anything is just to um just to put in
[33:54] the record that uh to to um that the ordinance is considered on locations of
[33:59] sheds within the property and that buyer agents, you know,
[34:06] estimated. So we >> the biggest thing that people have to
[34:09] know when they put something on their property that is under the the building
[34:16] permit process is that if they put it on wiring, plumbing, any of those things
[34:24] that go to the home and those companies need to get to those wires or pipes or
[34:29] whatever that it would be at their expense, not at the company's expense to
[34:35] move it. and >> and and locate. Right.
[34:39] » So that's the that's the biggest thing that needs to be explained.
[34:43] » Very good. So I guess we can call thatformational permit dually
[34:46] considered.
[34:50] » Yeah, that's we kind of hit once, right? >> Okay. F Hermosa Hills discussion of
[34:57] further development. Uh if you if somebody would like to get
[35:01] out to the podium and elaborate a little bit on
[35:08] Okay. Well, first of all, I'd like to introduce myself. My name is Mike Shine
[35:12] and I'm in Rapid City now and uh we've made lots of contributions to Kos
[35:18] already by uh we got two under contract right now and my father's been in this
[35:24] business a long time and building home owns the area. So, we'd like to continue
[35:28] that and uh we're looking at the theater and the surrounding donut of land that
[35:35] um is adjacent. So, um our first plan was to build a road going north,
[35:44] I'm sorry, west from the uh from the east side. Um that would be 24 lots. And
[35:52] uh I brought in Sean from for engineering advice. Uh we got the team
[35:57] and equipment that can do the work. Um we know there's going to be a lot of
[36:01] ground that has to be um prepared and filled, dirt that has to be put in. We
[36:06] be installing sewer and water and um we just would like to have
[36:12] approval from the city to move forward because I don't want to own that land.
[36:17] We cannot develop it. So we need to know what we should do
[36:21] next. Oh. Um, approval from the city. We need
[36:27] a lot of paperwork really.
[36:32] » So, a a straight street just like um
[36:37] » Murray Street. So, it the houses will go back to back from Murray Street. What
[36:43] would the new street name be? >> Don't know.
[36:45] » Name it after you. >> Oh, please don't. Please don't.
[36:51] No, I I will disapprove it all then.
[36:56] [laughter] Okay. So, um
[37:00] uh so 24 homes and are you thinking governor's homes or
[37:07] » Well, probably yes because they are affordable and um I think that's a
[37:13] necessity. >> People need affordable housing. It's
[37:17] gotten out of control. But we will do a mixed um development because you can
[37:22] only get so many of those governor songs.
[37:24] » Yeah. >> I mean, I can probably get 24 per year,
[37:26] but there's a 18month wait once I've applied for it, right?
[37:30] » So, yeah, we put a few of those in there and there are apparently six different
[37:33] floor plans. So, they're not cookie cutter and they are high quality. I'd be
[37:37] glad to give you all a tour. Do we have them with you now?
[37:41] » The windows are top shelf. The efficiency is top shelf. It's a great
[37:46] structure for young family or some people on social security. So, I'm all
[37:51] in favor of doing more of those governor's houses. Um, but we probably
[37:55] need to find a half dozen or so affordable, attractive,
[38:00] new designs we can put in there as well. >> And lot sizes will be all approximately
[38:07] the same or different? >> Mostly the same. Maybe some bigger ones.
[38:11] We'd like to see if maybe we'd have interest in barnuminiums. A lot of guys
[38:16] need a shop to work on their equipment. There's
[38:19] » a lot of traffic going north south here. There's businesses that need welding and
[38:25] to live where their work is. There's different We haven't decided all what
[38:30] the sizes will be, but mostly the same size. Yeah.
[38:33] » Okay. And are you buying that entire piece of
[38:38] property or just a portion of it? Well, the preons have two parcels. I don't
[38:43] think we need the second parcel that goes up that hill, but the um the
[38:48] theater is encircled by I cannot tell you why adjacent land all
[38:55] the way around it. So, yeah, we need to have that piece that goes around and the
[39:00] theater. Um just because if I have I could put 12 blocks on one side, but
[39:06] then my building cost is expensive. So, I want us to do a house on both sides of
[39:11] the street. >> I I understand that.
[39:13] » So, just to cut in, this uh the same exact discussion happened several times
[39:18] over the years. >> Um very much the same exact discussion.
[39:24] Uh so,
[39:29] we've got this row of houses. The re [laughter]
[39:33] [clears throat] pass cannot stay in the path. Anyway,
[39:36] we've got this row of houses. Cool. ready to build, but can't really make a
[39:39] profit just building one row of houses along that street. You got to build two
[39:44] rows of houses. Okay. Um, you've got floodway right here.
[39:50] This is Floodway. >> Flood plane.
[39:53] » Yeah, >> it can be built on.
[39:55] » It can be. And are you planning on building up bringing in dirt?
[39:59] » As of right now, from what I've seen out there, I got verified that I tied into
[40:04] this benchmark four or five years ago when I started surveying out there.
[40:07] Uhhuh. >> But it looks like I haven't surveyed the
[40:12] theaters lot per se, but I surveyed all the way around it.
[40:16] » The north side right now is anywhere from a foot to two foot above the base
[40:23] flood elevation right now. So when they built the theater, they already built
[40:29] it. >> Uh it's not not exactly correct. that
[40:34] came in kind of a ways before the theater, but um it is not.
[40:37] » Um >> well, at some point they could
[40:41] » Okay. >> I just got to verify that
[40:45] » touch base with the core. There's some wetland stuff. We got to but yeah.
[40:51] » Okay. >> I'll be in touch with FEMA and the
[40:53] » Great. You got my approval. Talk to everybody else. [laughter]
[40:59] » I think it's a good idea. it look more like a neighborhood that
[41:05] would and it offers protection for those people in
[41:08] » I think it's absolutely wonderful. >> Yeah.
[41:14] » Oh, >> and the water and the sewer line are
[41:19] right there anyway, so it wouldn't cost that much.
[41:23] » So, um that's another part of the problem is your uh utilities are going
[41:26] to be running through flood plane, right?
[41:30] » Which there I'll seal.
[41:34] That's legal. >> That is legal.
[41:38] » That'll be something that we'll have to take take special notes of when we're
[41:42] actually doing the platting and the each individual lot, you know, the platt when
[41:51] they get when they're running the lines up and down. So there your your only
[41:56] viable location to run your so there's a you can't see it on these not but the
[42:00] easement comes down and then cuts over this way a little bit past the street
[42:04] the rest of Walter Street. Now you need to run your utilities from here down
[42:08] here and over here. What you may or may not know is there was um there was some
[42:13] effort uh to run the sewer and water manes directly
[42:19] in between these lots up here. And uh I have the letter from the engineer who
[42:23] approved that plat and said I'll approve this plat as long as you agree that
[42:26] you're never ever going to try to develop because this is a terrible idea,
[42:29] but that was like 10 years ago. Um so you've got wetlands all here,
[42:37] you've got cattails all here. Um I mean what's the plan for the for the wetlands
[42:43] mitigation? Are you are you >> since you did excuse me since since this
[42:48] has been done there has been a whole lot of dirt put in right here
[42:52] » north of there. Yeah. >> Yeah.
[42:55] » North of your panel. >> Right here.
[42:56] » Okay. Yeah. So >> put in right here.
[42:59] » Correct. >> You know how much it takes? You know how
[43:01] much it costs to do something here in the wetlands?
[43:05] » Well, I know it's expensive and I know >> 50 to $300,000 an acre just to disturb
[43:09] the wetlands. That's not building. That's not bringing the engineers
[43:12] building. That area will not be. >> Yeah, that's not part of your
[43:17] » I got that. >> You've got more over here.
[43:20] » You got more over here. This is all wet lands.
[43:23] » Yeah, we'll address that. >> Great.
[43:27] It can be done. It is is, you know, I mean,
[43:31] if you have enough money, anything. >> There you go. See, I mean,
[43:35] » but you're not here to spend money. You're here to make.
[43:38] » They built they built in New Orleans. If they can build in New Orleans, if these
[43:42] gentlemen want to put the money into it and want to put a housing development in
[43:46] there and make sure there's enough drainage, I would think that it would be
[43:49] an approval situation. >> I will I'll follow up with
[43:55] » Yes, >> I've got I've got like 40ome pages from
[43:59] the core on this property, too. It's It's got a heck of a history. There was
[44:02] some >> There was some sketchy things done.
[44:04] » A lot of hand slapping going on from water.
[44:07] » Yeah. >> Yeah. Um, there's utility lines that
[44:09] were ran through here. I guess there was some issues with that being done a
[44:12] little fast and loose. Yeah. >> Yeah. As of right now, as far as I can
[44:18] see, it's all approved and fine now. >> Yeah. Yeah. It's they're they they're
[44:22] like it's old enough now we're just washing our hands on it.
[44:25] But moving forward subdivision that had wetland
[44:31] we can run through the port.
[44:36] » I do have a question about your boable water situation.
[44:43] You know five years ago we were building pretty steady on Marie Street and uh
[44:48] fire protection was minimal to non-existent.
[44:54] Are we making any headway on improving the water flows over there?
[44:59] » So there's um there's a whole history of weird decisions with that too. So maybe
[45:03] it was around that time when the booster station thing was going on.
[45:07] » Um so there was a time when there was a demand for pressure. So these this
[45:10] booster station was put in. The booster station's throughput is about 60 gpm.
[45:14] Obviously not enough for fire flow. That ended up getting shut down and switched
[45:18] back over to gravity. So right now we're on gravity. You should have no problem
[45:21] getting fire slow anywhere on our circuit. You're just going to have
[45:24] places where you're sub 30 PSI. >> Back then it was sub at the east end of
[45:30] Marie. They didn't have pressure. >> We know what the firefls were
[45:36] and they were very minimal.
[45:42] » Yes. >> Yeah. Then they weren't
[45:46] I've asked for that water study when you put in the new tank up on the hill. Have
[45:51] we been able to get that yet? >> Water study.
[45:55] » Um I did hear from DNR and they they put them out on the website. I just need to
[46:01] go look at that and try to find which one you're looking for.
[46:04] » The new new dank. Yes. >> Yeah.
[46:06] » Because that is going to be key to making that that whole side of the road
[46:11] work. if that tank never gets filled. >> Um that's
[46:15] » and that study should explain how it's going to change the water flow.
[46:19] » So that that tank is 31 ft shorter >> lower. Yeah.
[46:24] » 31 ft lower than our current tanks. You're never going to get anywhere near
[46:28] as much pressure out of that new tank as we're getting out of our current tanks.
[46:32] » Okay. unless we raise it another
[46:38] level out. So, we'll have good hours. >> Um, but as far as that goes, so I had a
[46:44] really good conversation with the ANR and they both
[46:47] » they were pretty candid about it. Um, how it's it's this town is has had a
[46:52] tendency to make bad decisions when it comes to development and providing water
[46:55] and making promises about what water we're going to provide. If you want to
[46:59] develop, we'll supply the volume. the pressure is your problem.
[47:05] » That's that's really if if if you're not getting the pressure in the development,
[47:09] you don't think you're going to get the pressure you need and you think it's
[47:12] going to need a booster, that's on the developer to put in the booster.
[47:18] We get 20 pounds. That's what the ANR requires us to get is 20 pounds. If you
[47:23] expect more, it's >> if we test those five again and it's
[47:27] less than 20, then you fix it. This one is that the theory
[47:32] » at fire flow 20 psi at fire flow. >> Is there not even 1,00 gallons per
[47:37] minute at those fire hydrants as of 2022?
[47:42] » That is a 6 in line. When's it turn or is that a 10inch line?
[47:47] Because we do have 10inch line on the other side of the highway. But does that
[47:50] run all the way down? 10inch line runs from the well not from
[47:56] the new tank because it never made it all the way there but it is 10inch water
[47:59] line there.
[48:03] » Yeah. Um anyh who uh >> but it should be
[48:07] » what's that? >> That line should be fixed and hooked up
[48:12] » to the new tank >> and Yeah, sure. If we're getting 24 new
[48:16] homes. Are you kidding? >> Well, we need the volume if we're
[48:19] putting in a boo. That's that's the opposite of what we should be doing
[48:23] because that wouldn't make it would not make any sense to connect that new tank
[48:28] the expense of filling and c and using that tank. Okay. So, it's 31 ft shorter
[48:32] than the current tank. Which means if we want to fill it, we need to have a
[48:35] system in place to where it stops filling before it overfills. Right. We
[48:39] need that in place. >> Wasn't the idea to have a booster at
[48:44] that tank? >> Yeah.
[48:45] » And that would improve all the pressure on that side of the highway.
[48:50] » Yeah. feasible tank to all. >> Yes, it would.
[48:55] » Um, we we basically spent a long time being sold massively overengineered
[49:00] plants. >> You have to pay their own.
[49:03] » Yeah. >> Okay.
[49:04] » Gravity's free gift from the univer
[49:10] to the same. There's your pressure and you gain volume.
[49:15] » But the Marie Street um >> you have to pay to pump it.
[49:18] » We shouldn't have pressure issues. I want to run one of the gauges out there.
[49:21] And I Who do we know down in the street? >> I have someone.
[49:26] » You know someone want to run a gauge over there?
[49:30] » Yeah. >> Terry, would you send when you send that
[49:33] water study, would you send it to the whole board, too?
[49:47] » Um, yeah. I don't know how much more we really need to get into this discussion
[49:50] only. We obviously can't agree to anything without a lot of paper.
[49:55] » Yeah, >> agree is based on paperwork, not what we
[49:58] want. There was a time when it was agre things were agreed upon based on what
[50:02] people want. We've got $600,000 worth of pipe going after nowhere to show how
[50:06] it's a bad idea to do business that way. >> So,
[50:11] um >> it's exciting.
[50:15] » Running four new homes. Wonderful. >> Yeah,
[50:20] » it's expensive. >> We have we have the capacity in the
[50:24] sewer >> and uh
[50:27] » I I think it's wonderful >> and we are still over we're
[50:32] overproducing on water right now and we're going to pay another well off.
[50:35] » Yes. >> So I I would say you're good to go. Uh
[50:40] there will be like I said there will be work to be done in
[50:46] » No, I can say my opinion is just like I said it before my opinion is you're good
[50:52] to go. Yes, there's going to be there's going to be a lot of talk when it comes
[50:56] to flats and it's going to be a lot of talk when it comes to each building
[51:00] permit. But I you've been here, you've done this. Um
[51:06] » there's a lot to consider. I I think it's wonderful.
[51:10] » There's just to be clear, don't make any decisions based on any one of us board
[51:14] members. >> It's not an action from the board.
[51:17] » That is true. >> It's paperiermâché hopes and dreams.
[51:21] » Yep. >> We've had that too where letters were
[51:23] sent and it was like, "Oh, this letter is a cont." No, that's a letter from one
[51:25] board member. That's not contract. >> So, just Yeah. trying to do things
[51:31] right. >> Well, let me ask you this. Do you want
[51:33] 24 new homes in town? Um, yeah, but I I've seen
[51:40] where this kind of dough out ultimately goes long term and I don't like it. I
[51:44] like bigger plats. I like bigger lots. I like stick built homes. I like value
[51:49] homes. I don't like the you want to build the lowinccome entry grade homes.
[51:54] There are an abundance of those in Rapid City sitting vacant. I don't like that.
[51:59] I want to bring give me give me four acre plats with 2,00 to 2400 square foot
[52:05] home. I want to bring in the people that are
[52:08] that are really >> I disagree with you about the abundance
[52:11] of >> me too.
[52:14] » If I were to go do a MLS pull on what you could buy for less than $300,000
[52:20] be like four to five houses in the entire town. No one would want to live
[52:24] there. So, um I can't say anything bad about the Governor's House program. They
[52:29] um are working hard to get young families and people in social security
[52:33] to quality home and that's what we want to do. We're nonprofit and we um are
[52:39] working hard for the community. So, I'm not opposed to larger class, but I think
[52:44] there's definitely a need for things that people can afford. Working class is
[52:49] what I would try to help. So,
[52:52] » but people on social security, their checks could be a lot bigger. My check
[52:56] couldn't afford a house.
[53:01] [clears throat] >> And I don't think I would even consider
[53:04] buying a new house at this point. >> But yeah, I would say um
[53:10] you know, what's the first step to development? You start doing a
[53:13] preliminary plat, right? >> That's that's the first step. Start down
[53:18] that road. And >> is there a way or is there current data
[53:23] fire to data on those fire hydrants on that?
[53:26] » Not that I'm aware of.
[53:30] » We uh if it exists, I think I know who called fire
[53:37] because he probably would have been the one who was here when the test was done.
[53:40] » Yeah. Yeah. Yeah. Yeah. We can look into that
[53:45] a little bit later. Um, all right. Any further on uh on this
[53:51] one here? >> Did you have any more questions or
[53:56] » I have a preliminary plan? >> You do have a preliminary plan. Well, I
[53:59] would love to see that.
[54:05] » You can show them what you have.
[54:09] » So, it's not 100% >> right. We're not confirming this. You're
[54:13] not confirming it. So these exist over here. This is Marie
[54:17] Street. So this is the preliminary cost we had. You know, you can see the roads
[54:22] coming in here. We know the utilities are there. So we bring it over to this
[54:25] and then bring water and sewer up the street.
[54:28] » It's got the topography. So >> y
[54:32] these ones are already here. This is going to be built lots and back here and
[54:38] it's on this side too. 24.
[54:51] » So I don't know how this stuff works. So what do they have to do before the town
[54:57] say >> yes, we'll do the sewer?
[55:02] » They have to have >> the town will do the sewer
[55:07] » plat. They have to get the >> the preliminary flat will be applied for
[55:12] and on that approved then we can move forward with development.
[55:16] » And then we start finalizing plats as they get done.
[55:23] » All the legal measurements will be in that plat and
[55:26] » oh okay >> jet of pipes and so on and so forth.
[55:32] Okay.
[55:43] that down by the highway stop on the highways
[55:49] of it. >> All right. Um
[55:55] » what's funny is the part of one of the brick grant plans was to turn that all
[55:58] back into a lake. I don't know if you all heard that. Mitigate the flood risk.
[56:07] It was one thought process. There was a lot of them
[56:14] onward though. >> Mhm.
[56:27] » Just one one thing that I wanted to we have budget sheets. One thing I like to
[56:32] just as developers people here to develop
[56:38] revenue.
[56:41] What we've got are this huge number here, right?
[56:48] Just just just an idea that I think about that I wish more people in town
[56:52] would think about. So, all our roads are built with general funds, right? Our
[56:56] attorneys paid with general funds. Our office staff are paid with general
[56:59] funds. Everything other than water and sewer happens under general funds. So,
[57:03] here's here's our revenue sheet. Property taxes 20 26 expected about
[57:10] $75,000 in property taxes from the whole town.
[57:14] Um sales and use tax 280,000 expected.
[57:22] So, our meat and potatoes as a town to fund what we need to fund isn't housing.
[57:27] It's commercial. It's businesses. and you go out there and you talk to people,
[57:31] they they're not begging for more houses and they're begging for businesses. So,
[57:36] I'm waiting for a developer to be brave enough to come in and say, "I'm going to
[57:39] I'm going to I'm going to build some businesses. I'm going to I'm going to
[57:42] help you do a tiff district correctly without a grease plant or any other pipe
[57:46] dreams. We're going to do it correctly and we're going to instigate the growth
[57:48] of commercial development. We're going to bring in sales tax and help your city
[57:54] actually grow, not just look physically larger, which is what more houses do. So
[57:59] I just I I I really am waiting for the day when a developer comes in here brave
[58:03] enough to to put up some commercial structures aggressively restaurants,
[58:07] auto parts stores. >> The problem requires moreies,
[58:10] » more consumers to be in the area. >> No, it actually doesn't because there's
[58:16] already demand all the way down to Hot Springs.
[58:18] » There's a lot of people who pass through this town. There's a a money pipe
[58:22] running from Hot Springs to Rapid City. And we could we could tap that line to
[58:26] put it in water terms. There's a lot of money to be made
[58:30] commercially. We just I don't know. I don't know why we never seen anybody do
[58:34] it. >> That's an offline discussion for sure. I
[58:38] would like to make a motion that we adjourn as the planning and zoning.
[58:45] » Motion made. >> I'll second that.
[58:48] » Motion seconded. Further discussion? Seeing none, all those in favor? I
[58:54] » All right. We are back to the board of trustees.
[58:58] Do we need to make a motion to >> Didn't we do it in one or do we do it
[59:02] separate this time?
[59:06] » Do we have to make a motion to start the meeting
[59:10] » as a board of directors as the board >> to
[59:15] do one to reconvene at the board of trustees?
[59:19] » Thank you guys very much. >> Motion to reconvene.
[59:25] » Motion made. Do we have a second? >> Second.
[59:27] » Made and seconded. Further discussion? Seeing none, all those in favor?
[59:32] » I >> I All right.
[59:45] Dr. Another first reading of our two ordinances.
[59:54] » When will this go into effect? >> The 20 days after the second read.
[1:00:00] » Second grade. >> Yep.
[1:00:02] » If we don't have what we have. Okay. Very good.
[1:00:12] » Okay.
[1:00:23] This is
[1:00:27] there is
[1:00:39] I did have a question across the way. Whatever happened with
[1:00:42] still waiting on that? >> Yeah, that just they haven't got a final
[1:00:46] plan still there. So, they met with DOT on some approaches.
[1:00:50] » Okay. Because Dan was asking that earlier.
[1:00:52] » They um redone. Haven't gotten anything back.
[1:00:58] Show that. >> No worries. Okay. Um sewer regulation. I
[1:01:02] guess I'll just read it this time. Or do you want to read it again?
[1:01:08] An ordinance to amend town of Hermosa ordinance chapter 51 sewer regulations
[1:01:13] by amending chapter 51 there too to ensure concise and equitable regulation
[1:01:17] of the municipal sewer system in accordance with and limited to those
[1:01:21] powers granted by the state of South Dakota and the United States of America.
[1:01:25] Be it ordained by the board of trustees for the town of Hermosa that the town of
[1:01:29] Hermosa ordinance chapter 51 sewer regulations be enacted as follows.
[1:01:33] Chapter 51, sewer regulations.
[1:01:38] » So this change >> first reading last change recommended by
[1:01:42] Mr. James is I'm very bad penalty.
[1:01:47] » Yeah, the prior one did not really have a
[1:01:51] penalty. So >> yeah, it was very vague.
[1:01:53] » Yeah. So just I think having something specific with
[1:01:57] the prior ordinance did have it. So I just if you don't have a way to enforce
[1:02:03] it then it was going to be kind of problematic.
[1:02:06] » Good. Thank you. >> I just went with the state maximum.
[1:02:09] » Sure. >> $500 fine 30 days.
[1:02:12] » Yeah. >> I mean people think twice about dumping
[1:02:15] sewer in the road. >> Right. Hopefully.
[1:02:19] » Do we need a motion to approve the first reading?
[1:02:22] » No. >> Thank you.
[1:02:23] » Okay. >> All right. Anything on this? Anybody?
[1:02:27] We got two weeks to look it over and always revisit.
[1:02:35] All right. First reading chapter that's in business A. Okay. B. New tank
[1:02:41] approved some responsibility. Okay. This isn't uh
[1:02:45] probably having any documentation in it. Um all right. So the new tank is 350
[1:02:51] some feet from our water line. We can't reasonably fill it. If we do if we do
[1:02:54] fill it, we can't reasonably train it because it doesn't actually have a drain
[1:02:58] line. Um the corners that would cut when building
[1:03:03] that tank are mindboggling. Um but anyway, good thing is we did get
[1:03:10] confirmation from the manufacturer that they engineered it for worst case
[1:03:13] scenario so it can sit empty and still be tolerant of whatever uh South Dakota
[1:03:18] can throw at it. So we can leave it empty. um Quinn Construction filled it
[1:03:23] to cover their the sealant that they were responsible for on the lower
[1:03:27] section of the tank, checked it for leaks, and then drained it. Um we're at
[1:03:31] the point now where the expectation is that the whole tank would be filled and
[1:03:34] leak check. But if we fill it with 170,000 gallons water that we can't
[1:03:40] actually drain and then it gets into winter and then so they they pumped what
[1:03:46] they had put in back out so it's completely empty again. So what they
[1:03:50] were saying and I guess is how it would work out is if we decide not to fill it,
[1:03:54] we essentially need to weigh their responsibility and the manufacturer's
[1:03:58] responsibility for any leaks should they arise
[1:04:04] » and we still owe them the same amount? >> We still we owe them like $54,000 right
[1:04:10] now. >> But if they're not going to do that
[1:04:12] work, can't that uh >> Well, it's not like See, that's the
[1:04:16] thing. It's not work and it's actually in the manufacturer's requirement that
[1:04:19] we provide the water charge. So the only thing they still have to do is going to
[1:04:24] cost them anything to filling the tank
[1:04:27] » time. A little bit of time. And then if they're supposed to empty it, too.
[1:04:32] » They're not required to do that. >> They're not required to do that. Okay.
[1:04:35] » They're required to leak check it. >> Okay. And I think at the last meeting
[1:04:40] that I was at, we discussed the fact that we would ask them if they would be
[1:04:44] willing to wait till next year to do that filling and emptying. Did that
[1:04:50] question get asked of them? >> They've got they've got to pay their
[1:04:53] subcontractors um is really where it's at. That 10% is
[1:04:58] the the holding the expectations, right? We hold this until you fulfill the
[1:05:03] expectations we have for you. So,
[1:05:17] » I'd make a motion we tabled this particular conversation to the next
[1:05:21] meeting or the one after that. >> Motion made. Do we have a second?
[1:05:33] » Okay. in motion fail for lack of second. Kathy, you had something to say?
[1:05:37] » Yeah, I was just wondering how the water pressure sometimes triples. It doesn't
[1:05:40] We don't have much hardly any water pressure at all.
[1:05:45] » When When are you noticed recently like within the past few days?
[1:05:50] » Last week it started >> last week, but it goes up and down.
[1:05:56] » There's times that I can just turn it on and just come back.
[1:06:00] So, we have this ongoing issue with low
[1:06:05] pressure in town. And right now, it's cycling
[1:06:09] the welded tank instead of the bolted tank. So, it cycles faster because the
[1:06:13] the the larger tank hold 340,000 gallons. This one we're running on now
[1:06:18] is about 130. So, the cycling up and down is happening a lot quicker. So, the
[1:06:23] pressure fluctuations are happening a lot more frequently. Um, I don't know
[1:06:27] why your place would be a trickle, but um,
[1:06:33] because what I do, I monitor one of the duplexes up on the hill and it stays the
[1:06:38] minimum up there I see is 24 pounds. The maximum is about 32. I would figure
[1:06:42] you're probably getting three to four more relatively in both places. So, you
[1:06:47] should be like 28 29 minimum 35 around there. So, four,
[1:06:54] » right? Mark, is your pressure bad?
[1:06:58] » Did you Yeah. Did you gauge it? >> Yeah, my pressure is poor, but there's a
[1:07:04] couple things I I need to check just to make sure my group stops all the way
[1:07:09] open. And I I don't know. It It is It low. It is low.
[1:07:17] » We were at the wellhouse last night and it was at 40, which is the bottom end.
[1:07:21] That's when that's it kicks on at 38 PSI at the wellhouse. case off of 48 PSI.
[1:07:27] Um,
[1:07:33] » and this is not something you've experienced in the past.
[1:07:40] » Not like this.
[1:07:49] » Yeah. I mean, we did have a lot of shifts in direction and flow and
[1:07:53] pressure for a period of time there. Strains, filters may have had an
[1:07:58] opportunity to catch more than they usually would.
[1:08:04] » There's a check. >> So, we're at 40. I'll go check the Tower
[1:08:10] Hill tonight again.
[1:08:17] But that is that is a near >> I think near future plan that shouldn't
[1:08:23] be that hard to implement to get the pressure statewise.
[1:08:29] » Yeah. Um >> so right now we're talking about giving
[1:08:35] the contractor a waiver on his testing of the whole thing.
[1:08:42] » Yeah. essentially saying that we're not expecting them, we're not holding them
[1:08:46] to a a final leaf test on the entire tank.
[1:08:50] » And it benefits us because we can close out our contract with them, but it might
[1:08:56] bite us in the butt if we problem down. So, alternatively, we
[1:09:02] would have to um bid out and build a drain line at the
[1:09:08] very least because there isn't one now.
[1:09:13] » How does that happen?
[1:09:20] » It was I I believe the term used was bid engineering.
[1:09:23] » Value engineering. >> Value engineering. When the tank was
[1:09:26] deal when the tank was first uh first first put out it the the bid came back
[1:09:33] like 840,000
[1:09:36] I think some like 840,000 and then it was value engineered down to 535 which
[1:09:42] essentially meant the line connecting it to the town was removed the drain line
[1:09:47] was removed um when the tank was first built there were actually open pipe
[1:09:51] underground missing valves so the contractor did go in and put that valve
[1:09:54] in so they could at least fill it but yeah it got value engineered to the
[1:09:58] point where it doesn't actually function
[1:10:03] » [snorts]
[1:10:05] » We'll find our way to that. >> Yeah, I don't know. Other than going out
[1:10:10] and checking tonight, I haven't I don't see pressure variations, but I'm
[1:10:15] at the bottom. I think I'm one of the lowest altitude houses in town.
[1:10:20] » So, even if it did fluctuate a fair bit, I wouldn't really
[1:10:23] » You haven't noticed anything here? >> I don't notice it.
[1:10:26] » You don't notice it? And you're pretty much level with him. Well,
[1:10:30] » I don't even know where he live. >> A little higher even,
[1:10:33] » but you haven't noticed anything.
[1:10:38] » I think I noticed it once, just slower, you know, but it was not a
[1:10:47] problem, you know, the next time. >> You should be minimum 4550.
[1:10:53] » But I did notice it once and it was probably last week sometime. I noticed
[1:10:58] it twice last week, but it was shortlived.
[1:11:01] » Yeah, very shortlived. So, yes, if you would check into that, that would be
[1:11:06] beneficial,
[1:11:09] but that has nothing to do with the new tank and the discussion we're
[1:11:13] » like today. Was yours good, Kathy? >> I haven't been home much today.
[1:11:23] » All right. Um, did we don't have any motion, I think.
[1:11:28] I don't even know if we really have enough detail. Um,
[1:11:31] » Scott, >> yeah, I would be a little concerned if
[1:11:33] this affects our insurance on the tank. That's the only concern I have. I don't
[1:11:38] know. I don't know how that >> I would have to review the coverage and
[1:11:42] see if, you know, it's basically intentionally sort of ignore. I'm
[1:11:48] assuming this is the contractor's recommendation to do this work,
[1:11:52] » right? So, we're >> Yes. group are saying we want to ignore
[1:11:55] that. And so I I just that that's my only thought is that it might be worth
[1:12:01] looking at that. >> So I'd make another motion that we table
[1:12:04] this and have the attorney look it over and come back to it next meeting or
[1:12:09] whenever he is at the time and has finished looking at it.
[1:12:14] » Second >> made and seconded. Further discussion?
[1:12:18] » Seeing none. All those in favor? >> I
[1:12:21] » Okay. >> Thank you.
[1:12:23] Um,
[1:12:29] could we take five minutes to recess? >> I think we're about half.
[1:12:35] » Yeah. >> Shouldn't we finish out this
[1:12:38] » section? >> This section.
[1:12:41] I mean, one thing left on on old business and then we can flip the page.
[1:12:49] » Um,
[1:12:52] It's still uh 7:18.
[1:13:05] You better car.
[1:13:24] » How are you? >> I'm good. How about you?
[1:13:27] » Good. >> Another long day.
[1:13:30] » Yeah.
[1:13:37] Are we going into an executive session tonight?
[1:13:41] » Yeah. >> Yeah.
[1:13:59] » Yeah. I don't know what actually happened.
[1:14:02] Well, we just kind of walk through, you know, all garbage bags. People want to
[1:14:07] walk through and pick up flowers around your garbage.
[1:14:14] » Okay. Well, that sounds like doable.
[1:14:26] » Yeah. Yeah. It's a It's not real pretty up
[1:14:30] there right now because we have >> Yeah.
[1:14:36] Let's see what
[1:14:47] there again. They looked into the hands.
[1:14:52] So I took my sugar up there and I back. It was almost dark and I stood over that
[1:14:59] shot. [laughter] >> This is like
[1:15:10] Yeah.
[1:15:15] Okay. be there playing anyway. Okay,
[1:15:21] that'll be good. We don't get a whole bunch
[1:15:40] rain.
[1:15:49] We have a big
[1:15:55] » I never did
[1:16:04] » I have these little attacks I get where zombie and diarrhea sick for 40, you
[1:16:10] know, 24 hours and then I'm better. >> Okay, just got to go through it now.
[1:16:16] Yeah, >> I am so allergic to so many foods
[1:16:23] » that that can do that to me. So, I never know if it's going to be just a quick,
[1:16:27] » you know, 24-hour thing or going to continue, you know,
[1:16:32] » I see you now.
[1:16:37] » So, you've done allergy testing. >> Did you get my message earlier, Terry?
[1:16:45] early about calling back >> and do
[1:16:49] » they actually find anything
[1:17:03] » so she's
[1:17:06] » we have to captain though with a few >> million things
[1:17:09] » mess it up Seems like that's
[1:17:15] » one. It's me.
[1:17:24] » He keeps like likes to run. >> Is the mudb
[1:17:29] Thank you. I thought I just was
[1:17:34] » Yeah, I know.
[1:17:38] » already
[1:17:43] Don't play the rain till later. >> I know. My foot doctor.
[1:17:51] » How much did you get out of this last
[1:18:02] » Oh, man. >> It sounded like a winter blizzard
[1:18:08] » with pounds. Yes. It was so funny.
[1:18:18] » Three minutes, you know, four minutes to get them in there.
[1:18:24] » Yeah, exactly.
[1:18:44] These are really good. >> Did you take them?
[1:18:48] » They're really good. >> What are they called?
[1:19:03] Okay, >> we are
[1:19:08] reconvening at 7:19 and we are into uh item C old business affirmed town board
[1:19:14] position 315 Manning Street Pilates.
[1:19:33] So my understanding is that this work we we did approve digging permit, right?
[1:19:42] » No, we haven't done it and then they decided they didn't need there. sign.
[1:19:49] » So, where's this private at? Anybody wants
[1:19:53] » across the street and one house down from me?
[1:19:56] » No, I mean like where's that? Is it getting done or
[1:20:02] » Mr. So that's why we turned in a digging permit and a rideway permit and waited
[1:20:08] the last three weeks so we'd be approved. So, we had to go into the
[1:20:12] rightway and that was the last statement was
[1:20:16] you can work on your own private, but if you're going to go into the rightway,
[1:20:20] you need a digging permit. So, that's what we waited for and disappointed that
[1:20:25] there's no digging permit or rightway permit that were turned in that are on
[1:20:31] this agenda to be approved that we've been waiting for. So, we were legal and
[1:20:36] not have something come back upon us because we dug in the rightway. Did Did
[1:20:41] we have the permits come in? >> Well, they did, but then you said you
[1:20:45] guys said they could do their side. They didn't need a digging permit for that is
[1:20:49] my understanding. And then if it was going to be the rightway that the town
[1:20:53] was going to do that. >> I never heard that.
[1:20:56] » That's what was discussed at the meeting.
[1:21:00] » Yeah. And trust the input. >> So,
[1:21:04] we're still waiting on the private the issues in the private line to be fixed.
[1:21:08] I guess >> I thought we Yeah, I mean that's what
[1:21:11] the new ordinance says, right? So, we were enforcing the new ordinance even
[1:21:18] though that's not approved yet >> instead of Okay.
[1:21:22] » No, there's there was issues there. So, the the we watched the camera the so it
[1:21:28] dips the line dips in like two places. >> And that's not the code that has to be
[1:21:33] fixed. >> Yeah. But we had rotor router saying
[1:21:38] and they you know they have a few years of experience saying that the dip was
[1:21:44] not the issue that the connector was the issue and then and then that's
[1:21:49] » do we have that on paper of them saying the dips aren't an issue?
[1:21:52] » Uh yes >> in the
[1:21:54] » we do estimate that we got Yeah. >> that they're not concerned with the
[1:21:57] dips. >> No, it just said that the cause was the
[1:22:00] » the connection. >> The connection. Yeah.
[1:22:04] Yeah. Yeah. No, there's definitely a problem with the connection.
[1:22:07] » Yeah. >> We also have the issue of the the bits
[1:22:10] and the lines. My memory of the last when we addressed
[1:22:14] this the last meeting was that we just said that maybe we could agree with the
[1:22:20] homes that if they took care of that privately then we would take care of the
[1:22:24] public the public. That's what >> their private you weren't here. though
[1:22:31] it was discussed uh later in the meeting. So, we wanted to present that
[1:22:35] to you as my >> and I'd sure like to know where this
[1:22:38] code is. It says there's no dips allowed in a sewer line.
[1:22:41] » Yeah. >> I'd love to see that written
[1:22:45] » on a private line. There is no such thing. You know, it occurs and it's
[1:22:49] occurred all over this community. But our biggest patience level has been
[1:22:55] fully and solely. I said, if you're going to get a contractor, fine. then do
[1:23:00] it because you've done it on two other precedented situations with half the
[1:23:04] problems. Otherwise, if we're going to get a contractor to get a fix so we can
[1:23:09] continue not to call Rotorooer to come in and fix her line that has three kids
[1:23:14] and have this continuation, then I guess we need to go to another level.
[1:23:19] » Mr. Herro, my memory of when you were in the room the last time we talked about
[1:23:24] this was that you guys were agreeing to do that. So you would you would
[1:23:27] certainly and I never got approval without a digging permit and a rightway
[1:23:31] permit that I can go in there and do that.
[1:23:34] » You don't have to have a dig in the rightway. They have to. That's
[1:23:38] where the problem comes in. >> They're in on their own property. They
[1:23:41] don't have to have a digging >> but they need to be on the rightway is
[1:23:45] the point, >> right?
[1:23:54] » Who are we going to hire? And when are we gonna
[1:24:03] go?
[1:24:19] [clears throat]
[1:24:28] Is it all certified? >> Slope shall comply with state plumbing
[1:24:33] code requirements. There are state codes requiring slope in a sewer line.
[1:24:39] » Dips violate the slope of the sewer line. It needs to slope.
[1:24:44] » Wow. >> To the main.
[1:24:46] » It has to slope. Not roller coaster. It has to slope.
[1:24:50] » State code. Yeah. Well, >> this is already in the ground. It's been
[1:24:55] in the ground for 30 years or 20 years or I can't even remember how long that
[1:25:00] trailer has been there. And and
[1:25:07] they've been waiting a long time and we need to give them whatever they got
[1:25:14] going needs to be done tonight. I mean, I've heard and heard and heard about how
[1:25:20] this town slows down the building process um because of all of our
[1:25:25] ordinances and our this and our that and it takes so long to get it. What about
[1:25:30] helping out a citizen that's already here and is having problems? Let's get
[1:25:34] this situation decided upon and so they can go on about their business and have
[1:25:40] and have what they need as a homeowner in our town.
[1:25:46] I feel like we we've done the previous two. I'm not sure why we're not doing
[1:25:52] this one, but if if we're doing this one,
[1:25:56] » we have not done we have approved the previous two
[1:26:02] somehow. They're different. That's fine. But if the town is actually serious
[1:26:09] about repairing the connection, we haven't even, as far as I know, looked
[1:26:15] into who's going to do that and get that quoted and approved,
[1:26:20] right? Because that's our next step, right?
[1:26:23] if if we're serious that we are going to take care of the connection
[1:26:30] and we talked about it. >> What was the connection?
[1:26:35] » Yeah, we have we have video and we have roar telling us that they have a heck of
[1:26:42] a >> we have two different two different
[1:26:44] supplies telling us this. So
[1:26:50] » yeah, so >> we need to make it a priority. Yeah. Get
[1:26:54] it fixed as a board if that's what we're going to do or we need to tell them that
[1:26:58] they can have their contractor do it because they already have it all set up
[1:27:03] and ready to go >> and get it done and paid for and pay
[1:27:07] that contractor. >> I mean surely we can do one of those two
[1:27:13] things tonight, right? >> Yeah. haven't seen.
[1:27:17] » Why wouldn't you be able to? There should be no reason why.
[1:27:21] » This has been on the agenda how many weeks?
[1:27:24] » Oh, >> and how many times? And and we we need
[1:27:28] to >> get this done. I mean, if we as a board
[1:27:32] are going to um be say that the city is responsible or the town is responsible
[1:27:38] for that connector, we should approve a certain
[1:27:43] » not to exceed budget. So that um you know, if I'm the sewer committee and not
[1:27:50] that that seems to matter on this board or or other boards too, I don't know.
[1:27:55] This is my first board, but uh [laughter]
[1:27:58] » I think this is all of our first boards. Yeah. Well, not quite, but um
[1:28:03] [clears throat] >> except
[1:28:05] » anyway. Uh yeah, not to exceed a certain amount.
[1:28:10] And then I as the sewer uh chairman, I'd be happy to find
[1:28:16] somebody to do it for the not to exceed amount.
[1:28:22] Um, so if we go that route, I can find the
[1:28:28] uh contractor >> who did the other two.
[1:28:31] » Action mechanical. >> Action pricey.
[1:28:35] » Well, they are pricey. Yeah. >> Let me take some citizen input.
[1:28:38] Mechanical.
[1:28:41] » It's a home. >> So, it's in service.
[1:28:45] » It is an issue because of our because of our ordinance. Our ordinance says
[1:28:52] from the homeowner's property >> property line
[1:28:55] » not from the main or from the connection of the main
[1:28:59] » and so that is why there's a little issue here it the problem is where it
[1:29:05] connects which is on in our ordinances on city property
[1:29:12] now the ordinances are going to be changed and uh but they aren't yet this
[1:29:19] is what this says I I mean, are you are are you trying to delay this so that the
[1:29:23] ordinance goes into effect so he has to pay it? I mean, he's been waiting. He's
[1:29:27] been waiting. He she and her three children have been waiting now. I think
[1:29:33] it's been two months since we first heard about this situation.
[1:29:37] » I don't think you can affect this situation with the newborn. It's a post
[1:29:41] talk law. It would be basically declaring it after the fact.
[1:29:44] » It's not hard.
[1:29:47] » No. you can't change the rules, >> right?
[1:29:50] » The situation happens. >> So, I make an I would like to make a
[1:29:55] motion that we uh get it fixed and somebody can do some price calling and
[1:30:02] and um I think that the houseworth have every
[1:30:07] right to know what's going to be happening by as soon as this Friday.
[1:30:13] They've been waiting long enough.
[1:30:20] Uh, if my memory is right, I believe that you made a motion in the past after
[1:30:27] they turned in their dip permit and stuff that as long as they fixed their
[1:30:34] service line, made sure there was no dips in it or it's up to code and they
[1:30:39] still had problems where it hooks to the main, then the town would go ahead and
[1:30:47] dig that main, but private people can't go digging.
[1:30:51] » No. >> By that main,
[1:30:52] » right? Exactly. >> No, but you already gave them permission
[1:30:55] to fix their service line >> and get the dips and stuff out of it
[1:30:59] because you got to have that, like you say, a down to get to the main. So, fix
[1:31:05] that first and if there's still a problem, then the town can go and fix
[1:31:10] the main where it cooks on because that's what Alexander did. They made
[1:31:16] sure that theirs was okay on their property, their service line and
[1:31:20] everything, but here it was on the main where the sat.
[1:31:24] » Okay. >> So, that's uh this is um this is an
[1:31:28] interesting conversation and it points right back to just how strange it is to
[1:31:32] have this this ordinance set up to where there's this arbitrary point in space
[1:31:38] where the trans the responsibility shifts from the homeowner to the town.
[1:31:43] And um it's really important that we actually understand why that is a thing.
[1:31:50] So we it isn't state code. It must be sloped correct. That's that's a state
[1:31:54] code requirement. So if you have an incorrect slope, let's let's get a
[1:31:58] circle. I need a circle. Can this give me a circle? Let's say that's the main,
[1:32:02] right? Let's say this is the edge of the house,
[1:32:06] right? If you want a slope and you want that
[1:32:12] slope to be correct, how much digging do you have to do? You have to dig from the
[1:32:18] connection to the main in one straight shot.
[1:32:23] So if you have this arbitrary point in space here where the territory the the
[1:32:27] jurisdiction changes, how do you make this properly? How do you fix this
[1:32:31] properly? How do you get a proper slope from the house all the way to the mate
[1:32:35] when you have this arbitrary point in space where the responsibility shifts
[1:32:39] from the homeowner to the town? >> You you you don't
[1:32:43] » this homeowner did not have a problem until there was until it the main come
[1:32:48] apart. They didn't have a problem before. It wasn't because of the the
[1:32:54] slope or the inaccurate slope or whatever in their line. It's because
[1:33:00] it's not hooked up to the main. The connection is not there. It failed like
[1:33:05] the other two have failed. Has absolutely nothing to do. You don't know
[1:33:09] that, >> Linda. I blocked the video. It's It's
[1:33:11] pretty obvious what's going on there. It's a piece of pipe stuck in the top of
[1:33:14] the meat. >> You're disagreeing with action.
[1:33:18] » I'm talking about the video. I block I'm not talking about disagreeing. This
[1:33:22] isn't a This isn't a disagreement contest.
[1:33:25] » Watch the video. The pipe sticks down into the main and the brutes have
[1:33:29] protruded in through that hole. The reason it's happened is because there's
[1:33:32] no saddle on that main. It's just a hole in the top of the pipe. Hole in the top
[1:33:36] of the main and a pipe stuck in it. That's why that happened. That's
[1:33:39] obviously an issue. There's a bad connection there. It didn't have a
[1:33:42] saddle. It was probably done 20, 30 years ago. They didn't use a saddle.
[1:33:46] They punched a hole in the top of the pipe and stuck stuck the service line
[1:33:49] in. It doesn't change the fact that the slope is no good. So what is the correct
[1:33:55] maybe the only correct way to do it under the ordinances as they are
[1:33:58] structured now and actually have this be a permanent fix legitimate permanent
[1:34:03] correct fix to state plumbing code. You have to run and correct the service line
[1:34:09] from the house to the main. You have to you have to get rid of those dips.
[1:34:13] They're not going to tell me that it's that's going to be perfectly fine once
[1:34:15] the main is changed because if water runs downhill and builds, everything
[1:34:21] coming behind it is going to keep backing up into the house. So, you're
[1:34:23] not just going to fix the tap and all of a sudden everybody everything will be
[1:34:26] perfect. As long as those dips in are in the line, you are al always going to
[1:34:30] have sewer back up into these people's houses. You have to fix both the slope
[1:34:34] and the main connection. So, how do we do that under our current ordinances
[1:34:37] that has this weird arbitrary location in space where it goes from being the
[1:34:41] homeowner's responsibility to being the town's responsibility? How do we do
[1:34:45] that? Logically, measure the diff distance,
[1:34:49] right? All right. So, what's the distance? Let's look at let's look at
[1:34:53] back uh let's look back at Silver Smith. Now, I'm
[1:34:58] kind of actively trying to get us to where we can understand why the
[1:35:02] ordinances were so broken. Okay. Simple.
[1:35:07] What's the distance from the main to the connection? Because that whole length
[1:35:11] needs to be dug up and fixed. All of it does. It has to. Those dips
[1:35:18] are not going to it's not just going to the problem's not just going to
[1:35:21] magically go away when you change the saddle. When you have the camera diving
[1:35:24] down into a hole and then swimming back up. It's not going to work like that.
[1:35:28] So, what percentage of this distance is the town responsible? What percentage is
[1:35:34] the property owner responsible? >> Same as the ordinance says from the
[1:35:38] property line >> to the main
[1:35:40] » to the main is our responsibility and that's the part that we need to get
[1:35:44] fixed. >> And the part they need to get fixed is
[1:35:48] the service line from the home to the property line. Right.
[1:35:54] » If it needs fixing, if they want to fix it, I don't think there's
[1:35:57] » if it needs fixing to be compliant with state code, then they need to fix it.
[1:36:03] and what all this money into it and then it fails
[1:36:07] anyway. >> Well,
[1:36:12] I mean, we we acknowledge that we have an issue.
[1:36:15] » I just say to your question, Fay, I mean, if we do fix it and still has a
[1:36:20] problem >> and it's theirs,
[1:36:22] » then it's a point by that point, we get a new ordinance and now we get a
[1:36:25] different request, right, under the new ordinance where it's not a problem.
[1:36:30] » Yeah. So, so I think that the whole thing becomes a moot point maybe at that
[1:36:34] point. >> I don't know.
[1:36:36] » Yeah, it's true. >> Fix it.
[1:36:39] » So, this problem they're having is under >> Yes.
[1:36:41] » old ordinance. But if they have a another problem that should be under the
[1:36:45] new ordinance, >> right,
[1:36:46] » then it's not our problem. Right. >> Right.
[1:36:49] » Exactly. >> I guess we want to deal with it.
[1:36:55] So we can get quotes for just installing a saddle essentially
[1:37:00] is all that job would be is installing a saddle.
[1:37:04] » Well, if we need to change the piping from the saddle to the property line,
[1:37:08] then we better do that. >> So that's our property. That's not
[1:37:12] » and then at that point then they take over. Mhm.
[1:37:16] » So let's let's run that visually because you have to have you have to you have to
[1:37:21] understand what you're saying that you want to do.
[1:37:24] » Yeah. >> I think we understand.
[1:37:25] » No, I don't I don't >> No, that No. So, all right. So there,
[1:37:30] let's say this is their pipe now. It goes up, right? Then it comes up, right?
[1:37:37] Then it comes over here, right? Then it goes down here, right? Then it goes to
[1:37:41] the main. Then it saddles it. So, we're going to replace this length
[1:37:47] because let's say imaginarily there's the property line
[1:37:51] when what really should have been happened
[1:37:54] is that when I did mine, I did it to the
[1:37:58] property line. Chuck came over and and he hooked it up and fixed, you know, and
[1:38:06] okayed it and and inspected it and signed off on it. That was it. Do the
[1:38:12] property line. I dug it up by hand from my house to my property line.
[1:38:21] I'm just saying this this has got to be taken care of. I don't care. I don't
[1:38:27] really care what they do on their property.
[1:38:31] » If if if I am if I am I am taxed right now. I was I am on this
[1:38:41] board to make decisions about the town and the town's property and the town's
[1:38:48] property is where it connects and it is the town's responsibility by this
[1:38:55] ordinance that we are under right now to fix it.
[1:38:59] » Now, if he is smart, which he's got enough properties and he doesn't just
[1:39:05] love digging up sewer lines. if he's smart, he'll fix it properly so that he
[1:39:11] don't have any issues. But that's his deal. That's not mine.
[1:39:16] » I don't think the owner of this property delivered right now.
[1:39:20] » Well, >> I don't I don't care whose it is. I do
[1:39:23] not care whose it is. I don't care if it's mine, yours, Donna's,
[1:39:29] Margie's. The ordinance says that we will fix it from the main to the
[1:39:36] property line and that's what we need to do. Now, if you want to put regulations
[1:39:41] on the way he hooks up to it when that is finished,
[1:39:45] » go for it. Try it. >> There already is a state
[1:39:50] » well. There's already code.
[1:39:54] See, I I I guess what what what you're not really understanding is I want to
[1:39:58] make sure that if the town spends money fixing this, it is actually fixed
[1:40:01] correctly and permanently. >> Okay? So, put it in there.
[1:40:04] » It's not your business. >> It's not your business. Put it in there
[1:40:08] that we have fixed it at this line. >> We fixed it on this date at this
[1:40:13] expense. If it goes bad again, it's because of you and you can then fix it
[1:40:19] the next time. >> All right. Just You said it, not me.
[1:40:22] » I did say it. Yes. Yeah. I mean, our job is to follow the current ordinance, fix
[1:40:29] what we're responsible for, and exactly what Scott said. If they still have an
[1:40:35] issue, it's on their side or if it is on our side, we've just paid them to fix
[1:40:41] it. It's under warranty. >> Um, so
[1:40:46] I don't know why. Yeah. Well, you made clear why it's an issue, but um we have
[1:40:54] a responsibility to follow our ordinance and pay.
[1:40:58] » Is it state code? I want to know. Is it state code? If we know that a a
[1:41:04] resident's pipe is crooked that we force them to fix it, is that state code?
[1:41:08] » No, we can't do that. >> No, that has nothing that's not in
[1:41:12] there. It's their problem, not ours. Our problem is what we own and we have to
[1:41:17] make sure that is up to stakeholders and that we are fixing and and giving our
[1:41:24] » citizens spent too much time on this. >> Yeah. How many times go ahead and do
[1:41:29] whatever we're going to do right or wrong get on it. But
[1:41:34] » yeah, this is how many meetings and how many minutes and how how long? A hell of
[1:41:38] a lot. So,
[1:41:42] my motion is for us to fix from our main to the homeowner's
[1:41:50] property line and try to work with whoever the homeowner is to make sure
[1:41:57] that it is connected properly at at that time.
[1:42:04] And and I would hope that the homeowner with having that issue could uh be there
[1:42:09] for that hour or whatever the time frame is to make sure it is hooked up properly
[1:42:14] along alongside of our action mechanical or whoever we are hiring to do so
[1:42:26] fixing the issue. Then she added from the town main to the
[1:42:31] homeowner property line. and work with the homeowner to make sure
[1:42:36] there's the proper connection.
[1:42:44] » Yeah, it's it's the saddle. >> Do we know that for sure?
[1:42:49] » Yes. >> Excuse me. I don't mean to use that
[1:42:52] voice. Yes, ma'am. We do >> it. We have it documented twice by by
[1:42:59] Action Mechanical. No, by >> Rotorooer and by our
[1:43:05] » show >> videos
[1:43:06] » that we already have. >> Okay. So, uh did we have a motion and
[1:43:11] did we have a second? >> Yes.
[1:43:13] » Okay. Motion made and seconded. >> Okay, Mr. Holdsworth.
[1:43:20] » Thank you. Finally. Um the whole aspect with your state code is on new
[1:43:25] construction. Number one. Number two, like I say, with the amount of
[1:43:30] properties that are in this community, you're going to find that everywhere.
[1:43:34] And number three, when they came it, the flow was fine all the way to the tap.
[1:43:39] Even with the imperfections of any dips or anything else going into the tap is
[1:43:44] where the whole problem was very evident. You're very aware of that. I
[1:43:49] mean, to dramatize this out to the levels that
[1:43:53] it has is ridiculous. And it's an aspect where quality of life for them has been
[1:44:00] the most difficult. I get it. Let's poke the bear. Let's go
[1:44:06] from there. But I would like where the other contractors were just hired and do
[1:44:12] it. We didn't have to go probe for costs and till they got done with the job. You
[1:44:17] have no clue. >> Yep. So, I'd appreciate it that the
[1:44:23] contractor has either called and made arrangements to get over there, that you
[1:44:29] have an inspector, that you have cameras, that you have 811, somebody
[1:44:35] that's going to be able to do the locates
[1:44:37] and get it done. Otherwise, as I said, you can't put a contractor there and you
[1:44:43] give me permission and approve digging and rideway permits that I turned in
[1:44:49] that never got considered. We'll hire the contractor and you
[1:44:53] reimburse us. >> I have no problem either way.
[1:44:58] But I'm tired of them not having their qualities of life have to worry about
[1:45:02] this. That's going to happen. Yes. >> On a weekend when they have family
[1:45:06] gathering. Terry, did we have a a quote from Rotorooer on on this property?
[1:45:15] » No. >> Action Mechanical
[1:45:19] Twitter doesn't do it. >> Sorry, I keep getting back. John had
[1:45:24] hired Action. He's the one that had gotten Action Mechanical,000.
[1:45:30] » Yeah, it was 500 bucks or No, 5,000 5,000.
[1:45:35] » I think something that the board should consider is that in my
[1:45:40] opinion, and I am no attorney, but in my opinion, whoever owns this house has the
[1:45:46] right to sue this city because it has not been handled.
[1:45:48] » Well, let's not go there. Come on, let's get it over with. We've had the truth.
[1:45:54] » Yes, we have. It's time to vote and shut up.
[1:46:05] I'll call for the vote then. >> You need to do a super majority to call
[1:46:10] for a vote. Anyway, um yeah. So, this is it's good. It's good that the ordinances
[1:46:14] are going to change and we won't have to well hopefully the ordinances change and
[1:46:19] we won't have to have discussions like this anymore. It'll be black and white.
[1:46:23] It'll be super smooth, super easy, super straightforward. There's a lot of other
[1:46:28] places. >> One thing about we have to figure out it
[1:46:31] wasn't us that made the ordinance, not this board. It was previous board
[1:46:35] members and they should have been thinking about this stuff.
[1:46:39] » Well, the thing about Joan property, she was complaining about that years ago
[1:46:43] when there was a different board >> and they denied her.
[1:46:47] » So, riddle me that. >> It never got denied.
[1:46:53] » It never got done. >> It never got done.
[1:46:58] » Yeah. >> And that has nothing to do with this.
[1:47:00] » Yeah. >> Okay. Um, so what's this motion?
[1:47:05] » Supply is going to drive me. >> Issue.
[1:47:08] » It is confusing. >> And from the town main to the
[1:47:12] homeowner's property line and working with the homeowner to make sure there's
[1:47:16] a proper connection.
[1:47:22] » Working with the homeowner to make sure there's a proper connection.
[1:47:30] » We just need to dig it up and put a saddle on there. That's all the town has
[1:47:33] to do. >> Yeah. Doesn't need to go all the way to
[1:47:36] the property line. >> Yes, it does. According to our current,
[1:47:39] » we don't need We only need to do work on what's broken.
[1:47:43] » That's true. >> And it's just the saddle connection
[1:47:44] that's broken. Right. >> That's what we've been looking at.
[1:47:47] » All right. So, I'll make a motion to amend.
[1:47:57] » I hope that's all.
[1:48:03] to the following.
[1:48:09] Approve the sourcing of a contractor
[1:48:18] to replace and or install a proper saddle for the connection to the main
[1:48:22] sewer at 15 Street. I
[1:48:28] » second that. to replace andor install proper saddle
[1:48:40] the
[1:49:02] seconded. >> Yep.
[1:49:04] » Further discussion on this amendment. Are you sure you don't want to take it
[1:49:08] all the way to the property line so that it I mean a while ago you said if you're
[1:49:13] touching anything we need to redo all the piping in the step that was out of
[1:49:17] your mouth. >> Everybody else says the only thing
[1:49:20] that's wrong is the connection to the main. So why would you send to us fix
[1:49:23] anything other than the connection to the
[1:49:25] » because you're in there already and we own it. That's why
[1:49:29] » if we're worried about being in there already, we would just come up with an
[1:49:33] agreement between us and the property owner to fix the whole room and share
[1:49:36] the cost proportionally based on who's responsible for what.
[1:49:39] » Well, wouldn't that be? >> We could.
[1:49:44] There's no reason we couldn't. >> Is that what the homeowner wants?
[1:49:47] » And that's what I talked about a long time ago. If we were going to come in
[1:49:50] with my contractor, you're going to reimburse it. We take pictures.
[1:49:55] reinspected three weeks ago that we could look at that aspect other than the
[1:50:01] tape showed that pipe isn't what's causing the problem. They dig that main
[1:50:06] out. They repair that saddle and there's a problem with that part of the pipe.
[1:50:11] When they repair the saddle and they have to redo that part of the pipe to
[1:50:15] fit it to the saddle, then the town's responsible for that. If that happens to
[1:50:20] where they've got to go back farther to you make that connection because of the
[1:50:24] saddle that's being applied on there, then that is your responsibility.
[1:50:30] » But you're not willing to negotiate for a correction tire
[1:50:34] » two months ago. >> Um
[1:50:38] » because that's that was never considered. Um the difference between
[1:50:42] that one and this one is who is choosing which which company to come in and do
[1:50:48] it. Right. It does make more sense if the company
[1:50:54] comes in and does the whole line at once.
[1:50:57] » Yep. >> And that was the original ask from the
[1:51:03] homeowner. Now now we're considering doing that again. Are we considering
[1:51:08] that as a board only if we uh pick who the contractor is or
[1:51:15] can we just >> I don't recall ever any consideration at
[1:51:20] all of anything beyond just me. Right. If there was if there was an
[1:51:26] agreement that the work needed to be done on the private line, it would have
[1:51:28] been done because that was approved weeks ago or considered acceptable weeks
[1:51:32] ago, but none of that works. >> Well, I'm not sure how flat I'm not
[1:51:37] sure. I mean, we didn't motion as a board that. So, it was never approved
[1:51:44] for them to go ahead and do that. They don't need our appro approval to repair
[1:51:48] their >> well, but they didn't want to do
[1:51:51] anything against what we wanted because they didn't want to hinder the process
[1:51:58] or >> Why would they dig it up and have that
[1:52:01] ditch until 3 weeks later or a month later when we approved to do what we're
[1:52:06] supposed to do? I mean, seriously,
[1:52:11] you can't expect them to have done that waiting for us to then hire a contractor
[1:52:17] to do our part. >> Yeah, cuz you really want them done.
[1:52:20] » I mean, they got kids. They don't want them ditches open.
[1:52:23] » Well, it makes a lot more sense to just do it
[1:52:27] all at once and share the cost of the port that
[1:52:29] » Dan, are you willing to do that at this point in time?
[1:52:33] » Like I said, we have applied for a daily grant to go the right way. do the thing
[1:52:37] the right way and the rightway permit in case we had to go that far and we got
[1:52:42] nothing but stall >> the whole time.
[1:52:46] » Now, we were told at one point that there wasn't going to be danger.
[1:52:51] » Yeah, we were we we had somebody stand right there and tell us that there was
[1:52:54] no digging that was going to happen in the rightway. Somebody stand there right
[1:52:57] right there and say that that there was no digging was going to occur in the
[1:53:01] rightway. We had somebody the contractor stand stood there and said there's no
[1:53:05] digging that's going to happen in the rightway.
[1:53:08] » Said that >> I missed that meeting.
[1:53:11] » He said that and then we're like if you're not digging in the rightway then
[1:53:14] why do you need a permit? >> It was said right there. We've got
[1:53:19] » Okay. So beyond that
[1:53:24] » the contractor who chose to do the work told us this.
[1:53:28] » Okay. >> Your agent. So, should we consider um
[1:53:33] voting down the current motion and then doing the let's do the whole pipe and
[1:53:39] portion out the bill? But who's >> we haven't gotten an okay from Dan yet
[1:53:44] on that >> or from whoever?
[1:53:47] » We get an okay from the property owner in in our ordinances that we have to get
[1:53:51] direct uh agreement with the property owner.
[1:53:55] » I assume that's funny. >> Depends on the contract. Oh.
[1:54:02] Yeah. Um I don't know. I mean, we could get the saddle fixed and say, "All
[1:54:05] right, we fix what we're responsible for. Good luck. Hope it works out."
[1:54:09] » That was the lawyer suggestion. >> Good. And that's what's uh
[1:54:13] » we're still on the amendment, right? >> Any further discussion on this
[1:54:17] amendment? Seeing none, all those in favor? I I
[1:54:23] » All right. Amendment passed. Back to the >> Thank you very much. motion.
[1:54:36] Now it reads
[1:54:41] » 15 sewer issue
[1:54:45] property work with the home to make sure proper
[1:54:49] option and then we amended it to approve um something
[1:54:58] can writing the sort of thing I've contracted to replace andor install
[1:55:02] proper saddle connect connection to the at 3:15.
[1:55:08] » Sounds good. So, we fix the saddle and then if it's if it's fine, then it's
[1:55:15] fine. If not, then it's not our problem, right? Is that that's where we're at
[1:55:20] after the other ordinance passes? Yeah. >> Very good.
[1:55:24] » All right. [clears throat] Um, any further discussion, Mr. So, as I
[1:55:29] express, you get in there, you dig that thing back, and that pipe's got to be
[1:55:34] changed to fit that saddle. The town is responsible to do that.
[1:55:41] » You're not going to get by with just a tap fixed with a saddle with that pipe
[1:55:48] coming in. If they've stuffed it in there and what you're referencing to,
[1:55:52] we've all seen the tape. So on them circumstances,
[1:55:57] the talent is responsible back to the property own line to be able to make
[1:56:01] sure that is attached and not obstructing the problems.
[1:56:07] But it's only the connection at the main that's the problem.
[1:56:10] » And the connection of the pipe to the main
[1:56:14] to the house problem, >> the bad d because at some point it was
[1:56:20] not inspected properly from the public works department to allow that to happen
[1:56:26] as it did the other two and however many more. And it's going to be a tough
[1:56:32] circumstances. Even though you change the ordinance, the town is still
[1:56:36] responsible for its mains. And if there's a bad tap in that main and the
[1:56:40] owner comes back after the town as a citizen, as a taxpayer, the situation
[1:56:46] you're going to have another battle, especially just changing this and the
[1:56:51] precedences of >> president doesn't mean anything really.
[1:56:56] That's that's a term that's used in here all the time. The ordinances are what
[1:57:00] need what have value. the ordinances carry weight. Precedent when there's um
[1:57:04] you may or you may not or you shall or worse when you deviate from ordinances
[1:57:07] and do something you ought not be doing and ignore ordinances or ignore state
[1:57:11] plumbing codes. That that's not precedent. That's we did that wrong. Now
[1:57:15] we're not going to do it wrong anymore. It's
[1:57:19] » my second question is who's the contractor going to be?
[1:57:23] » I guess we'll see. So it's the town's responsibility, right? So it's the
[1:57:27] town's choice who the contractor is. It's the K's job to make sure they've
[1:57:30] got the proper insurance and that they're actually going to
[1:57:32] photographically document the work they do because that seems to be such a hard
[1:57:36] thing to get is just take a lot of pictures and we have proof of what you
[1:57:40] did and how you did it and so that we can have files on this stuff, right? And
[1:57:45] as far as the public works, not expecting that. I saw um minutes I think
[1:57:48] it was 2010 that sewer line was worked on um without any oversight or approval
[1:57:53] at all from the town. It's in the minutes and absolutely no oversight. So,
[1:57:58] as far as we know, this is the result of somebody just deciding they're going to
[1:58:01] do it on their own without going to the public works department
[1:58:04] » and that was a cleanup, not express. >> So, um anyway, further discussion on
[1:58:09] this? Seeing none, all those in favor?
[1:58:14] I >> I
[1:58:18] » All right.
[1:58:24] » One more. Oh, when the when they're going to come
[1:58:29] out and do it the word Well, according to Do you mind me talking?
[1:58:35] » Go ahead. [laughter]
[1:58:38] » Uh, according to what we just voted on the
[1:58:43] next meeting, we'll have to approve uh the the contractor to be the next step.
[1:58:51] » No, we've already approved it. Yeah. >> Sourcing
[1:58:56] » when we don't have to approve the cost of it already.
[1:58:59] » Okay, good. Well, that makes it a deal matter.
[1:59:03] » Yeah, I'm glad that's over.
[1:59:07] » Good question. We'll have to call >> because if we're going to work with the
[1:59:12] contractor, then we would like to know.
[1:59:17] » Oh, that's not a part of the motion. >> Who who who is uh
[1:59:21] » it's the town's responsibility. It's the town's authority. We're going to do it.
[1:59:24] We're not going to ask questions. We're not going to get permission. We're going
[1:59:27] to do it. >> Well, that's not what he's asking. I
[1:59:29] think what he's asking, I'm not to put words in your mouth, but I think what
[1:59:33] he's asking is let me know who it is so that I can coordinate
[1:59:37] the the >> coordinate what?
[1:59:40] » Coordinate the repair of the pro uh pipe on on the private property.
[1:59:46] » Well, no, he didn't say that, but I'm thinking a citizen has the right to know
[1:59:51] who's going to come when and and make when their water's turned off and all of
[1:59:55] that. >> Okay, we voted. Let's go on. I'm tired
[1:59:59] of this one. >> Right there with you. All right,
[2:00:05] » approve mowing of town property. Buses long hair.
[2:00:09] » I do not think property needs to be mowed.
[2:00:13] » No spots that need to be done. >> That needs to be sprayed. Those are too
[2:00:18] thick to even mow now. >> Well, I'm not talking about the weeds.
[2:00:21] I'm just talking about the mowing. >> Well, Mark has been running around town
[2:00:25] mowing here. >> I didn't notice that.
[2:00:28] » Huh? >> I noticed that.
[2:00:29] » And it's my lawn mower, so his time my mower. So, I guess we got it handled.
[2:00:36] And if you want to mow it, if you want to do those weeds over the lagoon, you
[2:00:40] need to spray them. There is no way >> with that riff wrap on there to be able
[2:00:46] to >> the rip wrap. Yeah. You can't get any
[2:00:49] more lost. So, I suggest that we need to call one chemical and have them come
[2:00:55] down and look at that as they decide what kind of spray we need to use for
[2:01:01] that and have them spray it.
[2:01:07] » Yeah, that's definitely high priority. Um,
[2:01:11] so you guys don't think we need to do another round of
[2:01:14] » No, >> but we So the only area that really
[2:01:17] needs to be hammered on is the lagoon. >> Yeah.
[2:01:20] » Everything else is pretty much set except
[2:01:22] » I don't see I haven't seen any spots that are bad.
[2:01:25] » No, I think Kathy and I are going to weedy out here next week when we both
[2:01:30] have some tide >> because I know Mark did mow some here.
[2:01:34] » Yep. So, if the risk of mowing near, well, the risk of mowing near the
[2:01:38] lagoons is, you know, it's obvious. Um, we need to get the town I think, yeah, I
[2:01:43] want to bring the town mower over the >> and Mark City would help us with that,
[2:01:47] too. >> Wastewater treatment plant and that
[2:01:49] would be the waste mower essentially. And we can mow what can be mowed and
[2:01:54] then spray what has to be sprayed. But, you know, nobody needs to be going
[2:01:59] anywhere near that with your help. That's just
[2:02:02] » Yeah, I wasn't about that. Um um
[2:02:07] » we're responsible all inside the fence. Do we have any responsibility outside
[2:02:11] the fence or is that pretty hard over to the
[2:02:14] » neighbor?
[2:02:17] I don't >> I would think we would need to handle it
[2:02:20] on the edge of our road >> to get in there
[2:02:25] fairly because we don't want to take any hay or
[2:02:29] whatever that they cut. But I would think that the first swath or whatever
[2:02:35] next on each side of the road would be >> edit whatever. Yes.
[2:02:41] » Yeah. >> So we we do not need any mowing from
[2:02:47] Charlie then. >> Not this round.
[2:02:49] » Okay. >> Sounds like
[2:02:51] » he contacted me and he would have had time this weekend if we needed him. But
[2:02:55] I will contact him and tell him that >> he called me in. I said we would be on
[2:03:00] the agenda and then we'd let them know. >> Sounds like the volunteer crew's been
[2:03:03] running around. >> Yes.
[2:03:05] » Not going to complain about that. >> I just have a question. Is it town
[2:03:09] property or is it property of the homeowner where you turn to come north
[2:03:15] into our court? That's where the
[2:03:19] » So the where the big ditch is >> where the mailboxes are. Not where the
[2:03:24] mailboxes are. No. back on the main highway because the weeds are tall on
[2:03:28] that corner >> and I didn't know if that's my you know
[2:03:33] I talked to Crystal and asking about it
[2:03:38] » cuz you that's his property. >> Oh in in Yeah. No, we don't touch
[2:03:44] anything. >> We've never touched anything down there.
[2:03:47] » That's all. >> That's what I wondered. I didn't know.
[2:03:50] » Yeah.
[2:03:55] Um, >> do we need a courtesy letter to him that
[2:03:58] there's been a complaint uh about that the weeds in that property and we'd like
[2:04:04] him to >> handle that
[2:04:08] tomorrow? I'll mention >> we have a store code enforcement.
[2:04:12] » I don't know. >> I didn't say we were enforcing anything.
[2:04:16] Yeah, just a nice little letter saying, you know,
[2:04:22] » but if you'll talk to him, that'd be great.
[2:04:25] » So, I'll just It's probably more so on his
[2:04:32] rather than >> Yeah, probably.
[2:04:35] » Thank you, Donna. >> Get the mower to the
[2:04:39] » I think it'll fit. I think it'll park in the uh
[2:04:42] east side of the wastewater treatment plant. I think it just inside the door
[2:04:46] there. Maybe
[2:04:53] » just so it doesn't have because if that's where it's going to be if that's
[2:04:56] the only place it'll be responsible for mowing, then that's
[2:04:59] » measure it. >> Yeah, I measure it where I took it down
[2:05:03] there. >> Well, I need to take it down anyway.
[2:05:06] » Okay. Yeah. >> Oh, to mow.
[2:05:07] » Yeah. whether but just because it'd be easy if that's where it's going to be
[2:05:11] mowing all the time or that's its only >> humidated location then to leave it
[2:05:15] there kind of thing. >> I'd like to say thank you to the
[2:05:19] volunteers whoever is doing that. >> That's very nice.
[2:05:22] » Yeah. >> Yeah. Very good.
[2:05:24] » It is uh a lot of time out of your days and I appreciate that.
[2:05:30] » Okay, we've got u 55 minutes to get through all the legos.
[2:05:36] Power Hill Road drainage up plan discussion. Any news on that, Trina?
[2:05:41] » I think I said at the last meeting, I have not had any luck finding somebody
[2:05:47] that's willing to give us a quote. So, if anybody else could um look into it,
[2:05:54] that would be great. >> Yeah.
[2:05:58] » So, we'll just leave that one on hold for now.
[2:06:01] Um discussion on pursuing contract and animal control services. Oh, that's me.
[2:06:07] Um, yes, I talked to the executive director at the Black Sea Society. Um,
[2:06:14] but they only have one animal control employee,
[2:06:19] so they can't really help us out, but when they hire another one, which might
[2:06:23] be in the near future, um, we can talk to them again about it.
[2:06:29] That's all I got. >> So, we're still in a holding pattern.
[2:06:33] What you have to do? All right. Approved flood plane administrator and
[2:06:39] liaison appointment that we have.
[2:06:46] » Did did the contract end up in here?
[2:07:02] » Mr. Ben, did you get a chance to look?
[2:07:09] » I don't see it. >> No,
[2:07:12] » I don't have mine.
[2:07:17] long
[2:07:21] group
[2:07:27] is >> um
[2:07:32] » did we what did we have one person wanting to do it? only one person that
[2:07:36] we really found. But um so uh Dan Fe has kind of been keeping an eye on things
[2:07:43] » going on, paying attention to the town and he really wants to be able to help
[2:07:46] and we find ourselves in need of flood plane administrator who knows
[2:07:49] » because >> yeah [clears throat] because um I guess
[2:07:53] Elmer really is I guess we could say retired
[2:07:57] » at this point is fair to say and we have to have a flood plane administrator. We
[2:08:01] saw several discussions tonight >> that become
[2:08:05] » a nasty nightmare without a flood plane administrator.
[2:08:08] » Yep. >> So he's willing to do it.
[2:08:10] » Um and on the other side of things, we want
[2:08:14] to see if it's possible to get the brick ramp back on rails. And we need somebody
[2:08:19] who can bridge the gap between where things kind of came apart and where they
[2:08:24] need to go. Um we're going to need a new RFQ.
[2:08:29] » Yeah, a new RFQ. We're going to need to have somebody who can look at what's
[2:08:33] been done and tell us what value we've gotten from it. We're going to we're
[2:08:37] going to need somebody who can get us to the point where we know what we have and
[2:08:41] can ask another engineering firm to pick up where they left off.
[2:08:47] » And point in that line,
[2:08:51] » yeah, he's familiar with our town. He's got a
[2:08:56] vested interest now. Um,
[2:09:01] » how does he have a vested interest? >> He's he ca he came out. He saw the town.
[2:09:06] He looked I showed him around. I showed him
[2:09:07] » Okay. >> under the bridge. He's he actually got
[2:09:10] to be boots on the ground and see the railroad trust that people talk about.
[2:09:13] He got to see Ferguson subdivision and he got he got to see all this and
[2:09:18] actually see how it all plays out. >> And did did anybody else get that was
[2:09:23] interested in that job >> get that? Uh, did we did we put it out
[2:09:28] there? I mean, have we publicized it? >> No, we didn't really publish publicize
[2:09:33] it or publish it or anything. I mean, it's a professional services
[2:09:46] » and I don't know, but I don't know. >> Just pick up and go. I mean,
[2:09:50] » it's just a big decision to not have any paperwork and that this paperwork was
[2:09:56] done and given to him. Why the hell did it not happen to get into our mailboxes,
[2:10:03] our emails? What the heck's going on? >> So, I I would just like to make a motion
[2:10:08] that we uh make pend this till the next meeting so we can all go through the
[2:10:13] paperwork and see if there's anybody else interested in this position.
[2:10:19] because that's that's how we would do that's how we would normally do
[2:10:23] anything. We would advertise it or make phone calls and and so that we would
[2:10:28] have a a fair um competition, a fair uh >> my my last impression was that
[2:10:39] everybody's really scared that we aren't going to get the Brit picked up again
[2:10:42] and moving again. >> And that's true. and he's
[2:10:48] brave enough, crazy enough. >> Well, I'm I'm glad he is. I'm glad we
[2:10:54] found somebody, but that doesn't mean we won't find somebody else.
[2:10:59] » What's God's impression of the >> I don't have any issues with the
[2:11:02] contract. It has a very good uh provisions for if there's a default or
[2:11:07] if we need to draw out pull out or whatever, it's pretty easy to do so. So,
[2:11:12] um I like that about it. Uh I will I will just so the board's aware of like
[2:11:17] the history there with Mr. F. This was an issue in my brick review. He was one
[2:11:24] of the >> um subcontractors originally. Of course,
[2:11:29] one of the issues in that review was that he said he wasn't paid, right? Um
[2:11:34] and >> yes,
[2:11:35] » and he sort of told us three different things about whether he wasn't paid,
[2:11:37] wasn't paid. um in theory he may have a claim, you
[2:11:40] know, for I don't know, but um I just want to remind everybody that sort of
[2:11:46] did come up before. >> Yes. And that's that has nothing to do
[2:11:49] with the town either. That is between the two of them. Um yes, he worked for
[2:11:55] us. He helped. He put in information, um whatever, but it was not our job to pay
[2:12:01] him. It was >> Anony's job to pay him. And so that
[2:12:06] matters really not in our decision.
[2:12:33] I I have just heard so many times, well, you just picked somebody. You didn't put
[2:12:37] it out bit. You just picked who you wanted to pick from the previous boards
[2:12:43] that I've heard this board say those kind of things. And
[2:12:51] so, uh, let it be fair and offer it out there.
[2:13:01] It does concern me if he has a financial issue with the previous work that he
[2:13:08] submitted to someone else that we might end up paying.
[2:13:14] » Want me to call? >> No.
[2:13:16] » No. I have the time. >> I want to read this.
[2:13:19] » Yeah. Anybody want half a bottle of water that I have
[2:13:23] not?
[2:13:31] » There's no agreement ceiling. >> What's that?
[2:13:36] » No agreement ceiling on 5.3.
[2:13:54] I think it's great news. I think it's great news that that this work was done.
[2:13:59] I think it's um inappropriate that it didn't come to the whole board like it
[2:14:04] should have. Um, and I'd like to read the whole thing.
[2:14:11] I mean, at first glance, I'm in here for 3 minutes and I can see that that 53
[2:14:17] needs to be filled in. There's other things. So, I'd like to have time to
[2:14:23] review it and make an intelligent decision. So, I ask that we table this
[2:14:27] until next meeting. I do see the rates on the back, so that's nice.
[2:14:37] So, I'm making a motion that we table to the next meeting.
[2:14:40] » I'll second that motion. >> It's only a week away, right? Are we
[2:14:44] » Are we changing that? That's finance offic.
[2:14:48] » I would hope you would change it because otherwise it's been
[2:14:51] » Yes. >> Thank you.
[2:14:53] » I mean, it's >> two two weeks away.
[2:14:55] » I'm all good with the more review time. I just feel like this is this is a kind
[2:14:58] of a change in change in sentiment from the we have to absolutely get the brick
[2:15:03] grant going again. It's not we have to have a grant going again.
[2:15:07] » We absolutely >> Well, surely we have to.
[2:15:09] » But I also have to make a wise decision. >> Correct.
[2:15:12] » On what this is. >> And if for some reason it would have
[2:15:17] just been emailed to me uh at the same time it was emailed to Scott the thing
[2:15:22] that was this discussion. So there is that.
[2:15:32] I do find that that's happening a lot. >> All those in favor?
[2:15:38] » I mean, come on. Let's >> What are we voting on? All in favor?
[2:15:44] » That's No, you're fine, honey. It wasn't not you at all.
[2:15:47] » Yeah. To table the um approval of the >> flood plan administrator. administrator
[2:15:53] and >> so that we can look at the paperwork and
[2:15:58] maybe call a few other people and see if there's anybody else interested and then
[2:16:02] deal with it at the next meeting on the 22nd.
[2:16:06] » Let's just hope we don't get any anybody trying to absolutely do absolutely
[2:16:10] anything luckily. >> Yeah. Yeah.
[2:16:18] I don't even I don't know what kind of trouble we could get into for approving
[2:16:21] stuff without having blood.
[2:16:25] » Yeah. Well, we should have thought about that before we fired our guy, too. But
[2:16:30] » flood plane administrator. We didn't fight.
[2:16:33] » We didn't lose everything else. >> We
[2:16:37] voluntarily retire that we didn't need to do anyway.
[2:16:42] » Yeah. Um so motion on the floor is to table. Any further discussion?
[2:16:48] Seeing none, all those in favor? >> I I
[2:16:54] » Okay, >> thank you.
[2:16:56] » Uh approve RFU infrastructure remediation strategic approach. Okay, so
[2:17:01] this is another size. I don't I was going to have something ready, but I
[2:17:04] don't have something ready because I've been sick for almost a week and a half.
[2:17:09] » My brain just wasn't at capacity. So, here's here's what we go out, though. We
[2:17:12] know there are very limited number of things that do need engineering
[2:17:16] attention. >> Very limited. Um, I think the majority
[2:17:20] of people in town don't want us to do that thing again where we put our all
[2:17:24] our eggs in one basket because, yeah, none of those chickens hatch. Um,
[2:17:32] and we want to uh make sure that we're finding someone who's going to be
[2:17:38] efficient and highly technical and less wanting to get
[2:17:44] involved in the politics and go on campaigns and all that, right? We want
[2:17:47] we want an engineer who's going to engineer
[2:17:50] » really, right? Not >> who's going to engineer things, not try
[2:17:53] to engineer people. >> Yeah. So, uh, three major issues. North
[2:17:58] Water Sewer, right? We want the Preston project. We want them to be able to
[2:18:01] develop. So, we do need to get that sewer line fixed. We also do need to
[2:18:04] consider hooking the tank up, right? Even if it's not really particularly
[2:18:08] useful, we should look at if we're going to dig up and work on that sewer line,
[2:18:12] do that connection on the main at the same to the tank at the same time. So,
[2:18:15] that's one project. A proposal from an engineering firm of
[2:18:20] how would you approach this issue? We have we have these issues with these
[2:18:23] lines that need to be corrected. We have this tank that's not hooked up. And as
[2:18:28] we heard discussed tonight, the tank isn't even going to be useful when it is
[2:18:31] hooked up. Engineers, how would you approach this
[2:18:35] problem technically? Don't give us a resume of the 37 people in your
[2:18:39] partnership network. Tell us technically how you would solve this problem. Um,
[2:18:45] another big one, the treatment, right? We got to revisit the treatment. We got
[2:18:48] to know that um we're going to treat both our wells because treating one well
[2:18:52] doesn't make any sense at all if they both have radium in them, right? So
[2:18:56] we've got to redesign the treatment. So that would be another how would you
[2:18:59] technically approach this problem? We have these two bells. Do we want to
[2:19:02] treat them both? How would you approach that? And then
[2:19:06] the pressure issue that we heard again tonight. Pressure issue over and over
[2:19:10] again. I want to challenge an engineering company to see if they can
[2:19:12] solve that using what we have without building anything new because I I am
[2:19:18] certain it can be done and I want to see if an engineering company's brave enough
[2:19:23] to explain how they would do it. Um, so essentially it's not um not a not
[2:19:30] a a request for proposals in the sense of how much would you charge us to do
[2:19:34] it, but actually technically how would you approach this problem?
[2:19:38] Let's let's let's look for engineers that let's start by testing an engineer
[2:19:43] for their ability to to to logically problem solve. Really,
[2:19:50] not have not figure out ways to get us to spend money, but figure out ways to
[2:19:54] solve our problems. But we want the price at the same time.
[2:19:58] Of course, >> this would be purely conceptual. Like
[2:20:00] conceptually, how would you solve this problem?
[2:20:03] » Okay. >> Like really, you get you get in a room
[2:20:07] with five engineers and just have a conversation. This is basically that but
[2:20:10] on paper. You know, if you talk to an engineer, say, "We got this issue. How
[2:20:14] would you fix it?" I want that on paper. >> And they'll do that without charging
[2:20:19] them. >> Yep. They absolutely will.
[2:20:24] That's how they get work. >> Okay.
[2:20:29] » Yeah. >> So,
[2:20:39] I mean, I had a conversation in this room. Was it last week?
[2:20:42] » No, with the engineering intern.
[2:20:51] Let's put it on paper. They didn't have they didn't have their structural
[2:20:54] engineers, their hydraulic engineers with them. Tell me, how would you solve
[2:21:00] this?
[2:21:04] So, I'll uh get it written up and send it out to everybody and everybody can
[2:21:07] have a look. Um, it doesn't really fall into any of the
[2:21:12] typical uh statutory pathways for RFQS, RFPs, because you're
[2:21:19] not really sending something out to bid per se.
[2:21:27] » So, we're just you have to you have to get this written up and then we have to
[2:21:31] approve that.
[2:21:35] » Yeah, I guess it's I guess so. I still got to look into how how if there is
[2:21:40] even
[2:21:43] yeah to make sure it's in the stack through pathways for doing sort of thing
[2:21:47] seeking professional services. >> Okay.
[2:21:52] » So then we don't need any more discussion on that. We can move to E.
[2:21:55] » Yeah. >> This is a simple one. Meters broke. Need
[2:22:01] new meters.
[2:22:04] » What's the cost?
[2:22:12] » 2646.90. >> How much is it?
[2:22:15] » $2,646.90. >> Oh, no. I'm hoping that we approve the
[2:22:22] meter for
[2:22:26] this pump house to be repaired, replaced.
[2:22:35] not to not to exceed the cost of $2,647.
[2:22:43] » Motion made. Do we have a second? >> I'll second that.
[2:22:46] » Made and seconded. Further discussion.
[2:22:50] Um yeah. So Allan, this was probably going to be a week ago. Called me. He's
[2:22:55] like, "Your meter's dead, man." He's like, "I can't get nothing out of it."
[2:22:58] Um kind of unfortunate randomness. The meter we have is a mechanical meter.
[2:23:03] basically has an impeller. He's gonna He wants us to use a ultrasonic meter and
[2:23:08] we actually have a water operator. What's your opinion on the ultrasonics?
[2:23:13] » They're far more accurate. >> Yeah, that was basically his moving
[2:23:18] parts. >> There's no moving parts
[2:23:21] off
[2:23:25] the course of the lifetime of the year. >> Yeah. And the one we've got is hold.
[2:23:30] » Yep. Okay, sounds good to me.
[2:23:34] » Sound like a good price to you?
[2:23:38] » 3 in. >> 3 in. Yeah, probably.
[2:23:41] » Yeah. All right. No further discussion. Seeing none, all those in favor?
[2:23:47] » I >> Okay.
[2:23:58] 2500 budget for gravel maintenance. This is just to have some uh
[2:24:04] » have any base force at all. >> Our stockpile disappeared during my
[2:24:08] hiatus from the streets committee. We lost yards and yards and yards of base
[2:24:13] force disappeared and I nowhere I have no idea where in town they ended up. But
[2:24:17] » where are we storing it? >> Down at the
[2:24:20] » Where are we going to store it now? >> Should we place
[2:24:25] » what if it got stolen the first time? Why would you do it? Why would you do it
[2:24:29] » do it again? >> Lock it up.
[2:24:32] » I mean, >> shouldn't we?
[2:24:34] » We can't really >> sure we can. We can put it down at the
[2:24:37] pump house down there. >> That's gated.
[2:24:41] Fenced and gated. >> That was my first
[2:24:44] » Then we're going down the highway with >> buckets. Yes, you are. But I mean, but
[2:24:49] then you have bucket loads of gravel to go and get right now. You have them
[2:24:55] because it was gone. Wonder
[2:25:00] got swept out from under our feet. >> Yeah, this happens. This is why we
[2:25:04] locked stuff up. >> We've moved the cameras from the north
[2:25:07] wellhouse and put them down to this owl pipe.
[2:25:10] » How much ice do we need for it? How much space do we need to the gravity?
[2:25:16] » Not much. >> Can we put it there?
[2:25:23] Put it right here.
[2:25:29] I mean here >> right next
[2:25:35] » or on the side in the main >> there's still a pile of rip wrap there.
[2:25:42] » So that wasn't misdirected.
[2:25:49] » Well, this is just to improve the budget where it goes.
[2:25:54] I just I don't want it to disappear again.
[2:25:57] » Yeah. >> I mean, that's
[2:26:01] » I'm not saying it I'm not saying that its use wasn't approved by the
[2:26:06] former street committee person. >> We don't have any evidence that any
[2:26:11] repairs were done this summer yet. >> That's that's the thing is like it's it
[2:26:16] is all gone and there's no evidence to indicate that's
[2:26:19] which Which seems like we should lock it up.
[2:26:24] » Rock, >> lock it up. It sounds like we should
[2:26:28] lock it up. >> Lock up our supply.
[2:26:31] » Behind the fence. The rock should be behind a fence. We
[2:26:37] got a fence down there. How about we put it down there? Is that closer?
[2:26:41] » I think the idea of people stealing rock is ludicrous to me.
[2:26:45] » Oh god. You know how expensive it can get if you're doing a repair?
[2:26:51] » The the expensive part is moving it. If you go with your own truck, it's like 40
[2:26:55] bucks. >> So, so then we're going to put it down
[2:26:57] there and we're going to okay people to use it then.
[2:27:00] » I mean, that's kind of what you're saying. That's kind of sort of what you
[2:27:04] said there. Sorry, buddy. >> I don't do the whole put words in my
[2:27:07] mouth. >> Not even close.
[2:27:09] » Okay. I will make a motion to approve this gravel as long as we store it
[2:27:16] behind lock and key.
[2:27:21] » How's that? >> What motion made? Do we have a second?
[2:27:24] » I'll second that.
[2:27:29] » I mean, think
[2:27:33] » Oh, I don't think it was random people who just stole it without permission. I
[2:27:36] think the previous administration let it go.
[2:27:40] » But I don't I don't have you know it's it's neither here nor there.
[2:27:44] » So why do you mention it? >> It's taking up time.
[2:27:47] » It was there and now it's not here. >> Well, you're taking up time. I know. But
[2:27:51] so here we are. >> We need more. That's the whole point of
[2:27:54] this. We need >> I just gave you approval. You can put it
[2:27:57] behind a fence. I gave you approval to get it.
[2:28:01] » Can we put it in the lagoon? Still, we got Yeah, we got three fenced areas.
[2:28:08] » Yeah, >> there's got to be somewhere in those
[2:28:12] areas that we can put it. And I guess if you're wanting it as close as possible,
[2:28:18] is there somewhere up there to put it? >> Tower Hill.
[2:28:21] » Tower Hill. Is there any place on Tower Hill to put it? And I know it'll be in
[2:28:26] the way when we do our construction up there, but when are we doing our
[2:28:29] construction up there? How long does a a truckload of gravel usually last?
[2:28:36] Depends how it's used. >> Well,
[2:28:41] let's make sure we document it. >> Yeah, let's document it.
[2:28:47] » Oh gosh, >> this is absurd.
[2:28:50] » I agree. Let's move on. Let's get this handled and move on.
[2:28:54] » It's 8:30.
[2:28:58] » Um, I don't see any reason for it to be under locking key.
[2:29:04] There was no issue with us having a reliable source.
[2:29:07] » I have a motion and a second with that. So,
[2:29:09] » yeah. Okay. All those in favor? >> I.
[2:29:15] » All those opposed? >> I
[2:29:19] » All right. I will entertain a motion to approve a budget of $2,500 for
[2:29:25] gravel maintenance.
[2:29:28] » Motion made. Do we have a second? I second down.
[2:29:33] » Motion made and seconded. Further discussion.
[2:29:37] » Where are you putting it? >> Where it's been?
[2:29:41] » At the park. >> Okay. I would like to add to that motion
[2:29:44] that I never ever hear another word about rock being stolen
[2:29:50] in this in this boardroom. >> I don't expect it to ever happen.
[2:29:54] » I think we need to bear down to business and twist it.
[2:29:59] » Yeah. I I don't know about anybody else, but I'm ready to get out of here.
[2:30:04] » Yeah, me too. That's the point. >> Y um yeah, good points all around. We'll
[2:30:10] uh work on our security, our critical infrastructure. Um any any
[2:30:16] we have mo made and seconded, right? Any further? Seeing none, all those in
[2:30:21] favor? >> I
[2:30:25] [clears throat] It's not critical. It's not critical if it costs $2,500 and
[2:30:29] you're not putting it on block and key.
[2:30:34] » G. First reading of an ordinance appropriating funds for the fiscal year.
[2:30:41] » Is that in there? >> Yes.
[2:30:43] » Kind of got mixed up. It is page 81.
[2:30:50] » So, I have a question about this or do I have to wait until the first reading?
[2:30:56] What's what's technically proper here?
[2:31:09] » Well, thank you.
[2:31:16] » This has been a fun meeting.
[2:31:20] » We didn't read the heading.
[2:31:24] Can I do it? Go ahead. >> Town of Formosa ordinance 2.079. An
[2:31:29] ordinance appropriating funds for the fiscal year 2027. Section one. Be
[2:31:33] ordained by the town of Formosa that the following sums
[2:31:36] » 27 >> are appropriated to meet the financial
[2:31:39] needs of the municipality for the fiscal year 2027.
[2:31:43] Um, >> how much more?
[2:31:47] » Yeah. I mean, do I need to read? >> General is 495. I would just do
[2:31:52] generalist and that's >> okay. Under general government
[2:32:02] » 495 >> $495,650
[2:32:07] for water funds. We have $210,600 for sewer funds. We have $211,600
[2:32:15] for BBB funds. We have $20,000 for FEMA funds. We have $250,000.
[2:32:20] for a total of $1,187,850.
[2:32:25] » That's the revenue and then the expense of the
[2:32:28] » section two. The following designates the fund or funds to which the money
[2:32:31] derived from the following sources is applied. General,
[2:32:35] we have $495,650.
[2:32:39] Water, we have $210,600. Sewer, we have $211,600.
[2:32:47] BBB funds we have $20,000. FEMA funds we have $250,000 for a total
[2:32:55] of $1,187,850.
[2:33:02] Section three that there is hereby levied upon all taxable property within
[2:33:05] the town of Hermosa for the fiscal year 2025 a tax sufficient
[2:33:10] » sorry fiscal year 2027 a tax sufficient to raise the following funds to it for
[2:33:15] the general fund $76,000 total levy $76,000
[2:33:20] section four the town finance officer is hereby authorized and directed to
[2:33:23] certify said tax levy to the Kuster County auditor of Kuster County state of
[2:33:28] South Dakota to the end to the end that the same may be spread in assessed as
[2:33:32] provided by law dated this first day of September 2027.
[2:33:36] » The eth day of >> this 8th day of September 2020
[2:33:42] » six >> under section four.
[2:33:45] Oh yeah. Okay. >> Dated this 8th day of September 2026.
[2:33:51] » There we go. >> Yep.
[2:33:53] » Okay. >> I have a couple questions about the
[2:33:56] budget. Um, so I guess you can technically say this is a memory issue.
[2:34:02] So when we were doing the budget, um, I did recall a few days afterwards that
[2:34:08] there was nothing in there for the meter reader
[2:34:10] » and and you did cl you did fix that. Thank you very much, Terry. I I
[2:34:15] appreciate that. >> I'm glad it's printed for you guys.
[2:34:17] » Okay. And what about um what was ever was it ever put in there about the
[2:34:24] newsletter and the printing of the newsletter and is that
[2:34:28] » is that happening?
[2:34:46] That's why we have 20,000 >> committed BBB funds.
[2:34:53] We have a we have a supply there. We can change it to
[2:35:00] they're going to use that to do with some improvements and but the paper will
[2:35:03] come out too. >> Yes.
[2:35:05] » Right. Okay. Thank you. Thank you very much.
[2:35:09] » All right. So that was the first reading which means that's all we had to do.
[2:35:14] » All right. Question also please >> Mr. Hworth. So, how are you going to
[2:35:20] then carry levy that said tax levy to pester county
[2:35:26] for the town? And >> what do you mean
[2:35:29] » where are your funds going to be put that you're going to
[2:35:32] » the 76,000 comes out of the general fund >> and it's just levy straight across back
[2:35:37] in >> Yeah, there's one levy for the whole
[2:35:39] account. [laughter] >> So, no percentages will be affecting our
[2:35:43] » No, how they Well, how they get their levy is they take the value and divide
[2:35:46] it by levy. correct >> amount and then that gives us and that's
[2:35:49] what the levy is and it's distributed >> to change that levy
[2:35:54] » what's that >> and then the levy itself we have to
[2:35:57] change it countywide municipal wide >> you'd have to opt out you'd have to opt
[2:36:01] out if you want to change and that's pretty you got to start that process
[2:36:04] pretty early >> so that's why I wanted to make sure
[2:36:07] » so that's the maximum that I got that we could levy for for Pester County
[2:36:12] » so 76,000 and we always just do the max >> and we there's a few dollars we get from
[2:36:17] Pennington County. >> That's just on that. It doesn't amount
[2:36:20] to much that the president's >> y
[2:36:27] » Okay. Um, first reading done. H approve building inspection code enforcement
[2:36:32] agreement. Uh, I don't think we have anything ready for that.
[2:36:36] » They didn't get back to that. >> But we do have somebody who's willing to
[2:36:40] do uh building inspections and code enforcement as well.
[2:36:44] » So, >> cool. We can wash our hands of code
[2:36:49] enforcement and let somebody else engage in the battle of
[2:36:52] » and do we have a proposal that I can look at?
[2:36:56] » That's why >> so we can table wise this.
[2:36:59] » Okay, thank you. >> Wonderful.
[2:37:03] » Um but yeah, no I I we were talking to him about building inspection. He's
[2:37:06] like, "Oh, I do code enforcement also." So
[2:37:09] » cool. >> Yeah. Um through weld the tank
[2:37:13] maintenance agreement. This is probably one of the
[2:37:16] few really great things on this agenda. >> The wrong card in the
[2:37:21] » It's actually page 51. >> So, this is the company that um that
[2:37:26] clean the uh the welded tank, skinny tank, old reliable um and they can put
[2:37:33] this under this program essentially where we pay X dollars per year and they
[2:37:38] guarantee that that tank is as new condition on a perpetual basis. So,
[2:37:43] there's repairs that need to be made to to the roof. Um, it's pretty rusty,
[2:37:48] pretty nasty. Um, hasn't been painted in a long time. They would strip it inside
[2:37:52] and out and completely repaint everything. They would put all new stuff
[2:37:57] in there, bring it to brand new condition. And one of the cool things
[2:37:59] she talked to me about um did a short phone conference to kind of get some
[2:38:05] thoughts, but see if I'm sure she put it in here. I know she did. Um,
[2:38:11] very interesting thing. I don't know, maybe Scott, you might actually weigh in
[2:38:15] on this, but there's something called um,
[2:38:19] what was that?
[2:38:22] » Basically, once the tank is under this kind of a contract to the point where we
[2:38:26] can claim that it is in as new condition on a permanent basis, that tank becomes
[2:38:31] a non a hard non-depreciable asset. So its value becomes something we can
[2:38:35] borrow against as a as a like a >> and what is this monthly charge?
[2:38:41] » Uh it's yearly. So um the first few years
[2:38:46] are pretty heavy. >> I think
[2:38:49] » I don't have it. I don't have it now. >> Sorry about that.
[2:38:55] » What was that?
[2:39:00] » Yeah. So 37,000 a year for for first four years and then it drops to roughly
[2:39:07] 8,000 and then just rises with interest or with um inflation basically. Um
[2:39:15] so yeah, what you really could say is we're getting $160,000
[2:39:19] repair upfront spread out over the course of four years.
[2:39:23] Um >> can I interrupt? Didn't Didn't we just
[2:39:28] pay to have the inside all cleaned and done or
[2:39:34] » cleaned? >> But not painted.
[2:39:36] » But not paint or sealed or whatever they call it. Yeah.
[2:39:40] » Okay. We haven't gotten that far. >> Yeah.
[2:39:44] » Yeah. >> But yeah, no full repaint in and out. Um
[2:39:49] any 100% of everything would be covered. >> Yeah. The whole the whole goal is for
[2:39:54] them to get it to the point where we can treat it as if it was a brand new tank.
[2:39:59] » They did an amazing job. >> 37,000
[2:40:03] time 4 is the first four years and then it it goes down to something reasonable.
[2:40:09] Huh. >> 145,000.
[2:40:12] » There's a list. Where was that list of all the initial? So the whole ladder
[2:40:16] system essentially to be redone. problems.
[2:40:20] » And are we asking for approval for this for next year's budget or are we
[2:40:25] starting now? And how are we budgeting that in? And how much did we have left
[2:40:31] of our I mean, I know we we had money left over that we
[2:40:37] » had a Oh, yeah. >> And do we have enough for that in the
[2:40:42] next year's budget? >> That's a great question.
[2:40:47] Yeah, we had that vote where we approved the emergency money.
[2:40:52] » Yeah, was like 49%.
[2:40:59] » Oh, right. Right. >> I'm just looking at unexpended looking
[2:41:03] for unexpended for this year
[2:41:08] » because this starts this year. So, they're going to do something before
[2:41:12] Christmas. Oops.
[2:41:15] Maybe
[2:41:21] » budgeted for 2026 238,000
[2:41:26] spent 59 but what is that that's
[2:41:34] right
[2:41:39] » capital improvements yeah 97,000 so far.
[2:41:52] I'm just trying to see if we have these. We almost double
[2:42:05] the I guess that's the
[2:42:10] » Well, and you can still change the emergency for next year.
[2:42:15] » No, I mean this year to get it, >> but I mean if you're thinking about
[2:42:18] doing it, you're probably have to add up to next year.
[2:42:24] » So, how about if we make this pending to the next meeting and you have all those
[2:42:27] figures out for us at that time?
[2:42:33] » Thank you. >> Do anything nudes?
[2:42:39] Are you taking any questions? Uh yeah, go ahead. So to me, rather than spending
[2:42:46] quarter of a million dollars over this period, for a tank that does no good for
[2:42:51] no pressure and all it is is a backup tank, I would rather see money spent on
[2:42:57] raising towers, putting in boosters or figuring out how we get it all out by
[2:43:03] the tower to make our infrastructure work backwards to help Hills and the
[2:43:09] others. for that kind of money
[2:43:13] » rather than throwing it at an old tank underground. I would rather see a new
[2:43:17] tank developed. >> So this is for this is not for the tank.
[2:43:22] » This is for the welded tank that is proven to be the most reliable tank the
[2:43:26] town has >> money. My goodness, you can almost build
[2:43:31] a new tank >> building tank like that. What do you
[2:43:35] think? What do you think, Joe? How much do you think it cost to build a welded
[2:43:38] tank these days? Like that 1.3 million >> easy.
[2:43:43] » That's why they're willing to do this. The the bolted tanks are not good at
[2:43:49] all. >> Yeah. They don't want No. No. No. Nobody
[2:43:52] wants anything. >> This is our best tank.
[2:43:55] » Yeah. By a lot. And wasn't this the one that was used?
[2:43:59] » Yeah. >> Yeah. Right. Was this it was the weld
[2:44:03] the tank was used brought near use >> before
[2:44:06] » that's the theory is why it's got those fuller holes in the top of it when it
[2:44:09] was moved >> right
[2:44:12] » but yeah I mean I mean we could we could theoretically waste $1.1 million on a
[2:44:17] new well or we could theoretically waste $350,000 making a new tank into 31 feet
[2:44:23] tall. There's a lot of other ways we could waste money or we can take a tank
[2:44:26] that's been reliable for a hundred years and make it so it's going to reli be
[2:44:29] reliable for another hundred years.
[2:44:34] That's inspections, everything for >> every you just walk away from.
[2:44:38] » Yeah, they >> they clean it the whole anyway.
[2:44:42] » Every year they come out >> emergency services.
[2:44:47] » Uh every divers in clean water, right?
[2:44:52] » Yeah. Yeah. >> Right. [laughter] Yeah. More.
[2:44:58] » Oh, that's real bad. There aren't many welded around there,
[2:45:03] are there?
[2:45:10] » Opinion is we don't do things that last. >> Well, right. We don't
[2:45:16] » throw it away so you can pay somebody to make money.
[2:45:20] » Yeah.
[2:45:24] » Yeah. >> This is like paying the dive team every
[2:45:27] year. It's $10,000 a year after the initial
[2:45:31] » and then any repair. >> Yeah.
[2:45:37] » Well, it's >> do they
[2:45:40] other tank too or not? >> No, nobody nobody does any sort of
[2:45:45] guarantees like this on this tank. >> Glass this one glass.
[2:45:50] » The steel tank. No, it's just steel a welded tank. It's just
[2:45:53] » not not the welded one. >> This Ours is glass lined, right?
[2:45:56] » Yeah. Mhm.
[2:45:58] » Yeah. >> And then they basically epoxy it is what
[2:46:01] they do for sealer. >> Nice.
[2:46:07] » Makes much more sense. >> Fix it.
[2:46:11] » Underground too. >> Oh yeah. The underground one they did
[2:46:14] put in there like >> an
[2:46:16] » something very trivial. Is it even in this?
[2:46:19] » Yes.
[2:46:22] » I didn't know if they were talking about that one too.
[2:46:25] » The underground. >> No. interior wash out. Um,
[2:46:29] » no fee until 2029. $4,000 that year, $4,000 some dollars in 2038. 5,000
[2:46:37] something in 20 No, wait. 2029 >> 32
[2:46:42] » 2032 2035 and 2038. Like every once in a while, five grand to recondition the
[2:46:47] underground. >> Why did I think that we were not going
[2:46:50] to be allowed to use the underground tank for drinking water? But
[2:46:56] » we can use it, but it just doesn't generate any pressure.
[2:46:58] » Oh, it's too low. >> Yeah,
[2:47:00] » but bulk water. And I did find out that it has really you have to have it. You
[2:47:04] have to air gap it, but we can use it for bulk water.
[2:47:07] » This was just something they threw they threw in there in case you wanted to
[2:47:12] » use the ingground. >> It's concrete. So, they're like, "Oh,
[2:47:16] yeah, that definitely maintain that. That'll last centuries."
[2:47:21] » You have a lot of water. There's going to be a lot of places that don't have
[2:47:24] any. >> Yeah, there are right now
[2:47:28] » produce water. >> A lot of places showing up.
[2:47:32] » The shallow wells are hurting right now.
[2:47:38] » Yeah. >> Okay. What's up?
[2:47:40] » Well, it's a swimming pool. Yeah. Anyway, so we're tableabling this
[2:47:46] motion on the floor. >> No, I didn't have a motion.
[2:47:50] » We need a motion. I know we didn't have a motion.
[2:47:52] » Yeah, if we could wait just one more meeting.
[2:47:55] » Yeah. >> Okay. Motion to table till the next
[2:47:57] meeting. >> Motion.
[2:48:00] » I'll make that motion. >> Trina's making it. Do we have a second?
[2:48:03] » Sure. >> Made and seconded. Further discussion?
[2:48:07] Seeing none, all those in favor? >> I.
[2:48:11] » Okay. Um
[2:48:16] that was
[2:48:20] another claims
[2:48:27] motions to approve or amend or whatever for claims.
[2:48:36] » I make a motion that we pay the claims as presented. Motion made. We have a
[2:48:42] second. >> Yes.
[2:48:45] » Make second. Further discussion.
[2:48:50] » Now, I did put the ones from last. So, that we need to those back ones.
[2:48:56] » They were kind of pended last time. >> No, we disputed them. So,
[2:49:01] » okay. So, they wouldn't be not even on here.
[2:49:04] » All right. >> Right.
[2:49:06] So, what you're approving, what your motion was was for the $23,91047.
[2:49:14] Is that correct? >> Well, okay.
[2:49:18] Um,
[2:49:23] I thought the dispute was that there was an overcharging
[2:49:28] or potential overcharging of of the bill, but now that we see that it's
[2:49:34] broken out into six different um
[2:49:43] water operations contracts. The contract in itself explicitly states not to
[2:49:47] exceed 3,000 something
[2:49:52] explicitly time and materials not to exceed and it's what 3,000 some dollar
[2:49:58] and this show water operations contract July hours
[2:50:01] » is that for normal for normal work when this was not normal work because wasn't
[2:50:06] this when um
[2:50:08] » the emergency >> the emergency
[2:50:11] » all the extra >> Yes.
[2:50:15] Um >> I mean not to exceed is not to exceed
[2:50:20] the tough. That's why I think why it's insp.
[2:50:32] » Yeah, because they defrauded us the money earlier.
[2:50:35] » So >> they what?
[2:50:36] » Defra us the money. They charged us for double time for people who
[2:50:42] » Oh, that's right. the $14 bonus.
[2:50:46] » So if we've already paid them broadly >> invoices, I don't think we should pay
[2:50:51] them. >> Is that what
[2:50:53] » that's what we discussed during the meeting?
[2:50:56] » Yes. >> Yeah, that's right. That's some
[2:51:00] contractor 14,000 some dollar bonus.
[2:51:05] Well, I recall that being mentioned, but I didn't uh recall that this we were
[2:51:10] holding back on this payment because of that page.
[2:51:18] » Um >> all the rest of it looks good to me. So
[2:51:22] » yeah. Yeah. >> Um
[2:51:27] any further discussion? Seeing none, all those in favor? Hi.
[2:51:32] » And how much are we actually paying? >> 23,910
[2:51:36] on 47. >> I
[2:51:40] » Okay. Um, please, we got 10 minutes. Water
[2:51:46] department report. Do we have water?
[2:51:57] » Is this the extra testing that we had asked for? This is just our um regularly
[2:52:05] scheduled testing. I mean, when I read it, I thought it was
[2:52:09] our regularly scheduled testing, but I wondered if it was our
[2:52:15] you had uh Erin, you had said that you were going to have some additional
[2:52:20] testing done. >> Um yeah. So, uh I don't think they've
[2:52:27] gone with that. They've done the copper uh the lead and coppers. They've done
[2:52:32] the the routine ones. I don't think she's
[2:52:34] » I haven't heard anything about common ions. That's what they call this ion is
[2:52:38] basically what is ionized into your water.
[2:52:43] » Yeah, I haven't heard anything about that yet.
[2:52:45] » Okay. >> Um but yeah, next time I'll talk to next
[2:52:47] time I talk to Ellen, I'll ask him. And did somebody from the office contact
[2:52:51] them um and change this 2020 Ferguson Street to a a different location for
[2:52:58] them?
[2:53:02] Uh I'm aware of but one thing that one thing that I found
[2:53:07] strange is that all the I think it was all the night and poppers were done
[2:53:11] along one street and it just so happens to be the one street in town I would not
[2:53:15] want taking water samples and that's Manning.
[2:53:19] » So there's talk of a ground water in Manning.
[2:53:23] » So check it out. It's kind of not funny. So, we've got uh
[2:53:31] this loop here. >> Yeah.
[2:53:34] » Right. >> So, the water comes down from the tower
[2:53:36] and it splits right here and goes downhill and then comes back up and
[2:53:40] reconnects. >> So, the main, this is a loop in the
[2:53:44] main. So, [snorts] this section of the main is obviously going to be prone to
[2:53:48] sediment buildup. >> And every time we get reports of brown
[2:53:52] water, it's a house on the street every single time. So, it just so happens that
[2:53:56] our infrastructure is designed so that this one little section gets dirty
[2:54:00] water. Um, I don't know other than purging of hydrant down here on a
[2:54:05] regular basis, which could potentially in some cases make it worse. Is that
[2:54:09] » worse? >> Yeah.
[2:54:11] » So, um I feel like I don't know, maybe the better thing would be to deadend it
[2:54:15] somehow rather than have it be a loop to dead end it. I don't know.
[2:54:21] » I think we like dead ends. That's a problem, too.
[2:54:25] » You know what that is, >> right?
[2:54:28] » We are going to have the fire hydrants blown out this fall.
[2:54:34] We I better get that scheduled so that we can put it in the newsletter. People
[2:54:40] know that they're going to have brown water.
[2:54:43] » Oh, I know. That's small.
[2:54:49] » Yeah. Please let me know cuz last time you learned that I was washy.
[2:54:52] » Right. >> It will.
[2:54:54] » Yeah. >> I've had that happen.
[2:54:57] » But it'll help after years of doing it like that problem down there. It will
[2:55:01] start to clean. >> It's supposed to be done once a year,
[2:55:06] right? >> Yeah.
[2:55:09] » A lot of it too is for your insurance. all that IO.
[2:55:14] » So you turn it into insurance that you have.
[2:55:18] » But yeah, so that's that's our brownwater culprit is this
[2:55:22] loop right here. And there's no easy solution.
[2:55:29] » Um they may be particularly upset right now because of how quickly our pressure
[2:55:34] is varying, how >> frequently it's varying. And
[2:55:39] » we can talk we can we can solve that. Yeah.
[2:55:47] » Anyway, oh that was a tangent. What were we actually talking about? Water
[2:55:51] department report. Oh, so Allan's uh yeah, the meter is getting replaced. Um
[2:55:57] other than that, samples are getting taken. Everything on that front seems to
[2:56:00] be running smooth, right? >> Good.
[2:56:07] » Uh uh strobe light on the water tower hill.
[2:56:09] » Oh yeah. >> Yeah.
[2:56:11] Yeah. Um, so me and Fay went up there. I put the uh I disabled the photo sensor
[2:56:16] and the light came on and stayed on. So whatever is going on, it's because of
[2:56:19] the photo sensor. I'm not sure if it's the photo sensor is bad or there's
[2:56:23] something else causing it to misbehave. But it was set at lowest possible lumen
[2:56:28] setting. So basically didn't want to turn that light on until it was
[2:56:31] absolutely pitch black, which makes me feel like it's dithering on and off
[2:56:34] thing. May have been because it was kind of in that gray area. So I took it up to
[2:56:38] a slightly higher notch. So, it should come up. It should come on a little
[2:56:42] earlier, but hopefully stay on. >> Stay on.
[2:56:44] » It strobed for a a little bit last night, but then it didn't last very
[2:56:50] long. >> Did it stop again? Yeah.
[2:56:51] » And that's why I'm thinking it's kind of in that
[2:56:54] » hours. Yesterday [snorts] or day before? >> Last night.
[2:56:58] » And it was set to only kick on with I think
[2:57:01] » 10 lux, which is like really that's really dark. So, I set it to 25. So
[2:57:06] it'll get down a little bit earlier and hopefully not scrobe people out as
[2:57:10] they're going down the highway. [laughter]
[2:57:12] If if it does keep going, we're gonna have to get it to change colors so it
[2:57:15] actually looks like we're
[2:57:20] » LED [clears throat] anything water.
[2:57:25] » Okay. Sewer. >> I don't have anything.
[2:57:31] » It's uneventful infrastructure, right? People just
[2:57:35] It's good. >> Well, we got to deal with the weeds, but
[2:57:38] I don't have anything >> um there. We do need to um
[2:57:43] there are some things that need to be checked though on some inspections,
[2:57:47] samples, and things. We need to identify someone and get [clears throat] get them
[2:57:52] in touch with the ANR. I don't know if we want to ask Allan to do that.
[2:57:55] » Probably the easiest thing. Um, and we can figure
[2:58:01] out, you know, what what the added cost will be. It's not much without the
[2:58:07] wastewater treatment plant running. It's an exceptionally small amount.
[2:58:11] » Since you mentioned that, I was going to ask if Allan would be willing to um go
[2:58:18] around with the fire department when they do the blowout of the fire
[2:58:22] hydrants. I think it would be good for him and for them to have all the same
[2:58:28] information. >> So anyway, I was going to find out how
[2:58:34] much time that's going to take and then present that to the board.
[2:58:38] Just FYI, since we're talking about Allen's pay here.
[2:58:42] » So did you what did you decide on leads over the lagoon? I would call them water
[2:58:48] and have them come down or what? Um, we didn't really have anything in
[2:58:53] here to make a motion about that or anything.
[2:58:54] » Yeah, I know. But it must be addressed. >> Well, that's Yeah. And I don't honestly
[2:59:00] with considering that it is like a requirement, an infrastructure
[2:59:03] requirement, I think we just need to figure out how to do it and get it done.
[2:59:08] It's jeopardizing ours. >> Well, yeah. And it needs to be need to
[2:59:14] be sprayed. So, >> yeah.
[2:59:17] What kind of chemicals you use? >> You know, you know, contacts.
[2:59:22] » I I got Yeah, I the numbers in Chuck's home so I can call them and talk to
[2:59:27] them, you know, looking at
[2:59:32] » and at the very least if you know we decided something to approve, then the
[2:59:36] next meeting we have to be ready to do. >> It's probably something that's going to
[2:59:40] be have to be have have to be done a few times before the end of the year. Well,
[2:59:46] that should be done every year. >> Yeah.
[2:59:48] » Spring and fall. >> Just chemically wipe them out,
[2:59:52] » you know, because anything. >> I figure it's probably use something
[2:59:56] similar. You would find them using near golf courses or places like that.
[3:00:00] » Yeah. >> Well, we got to Right. Be careful of the
[3:00:05] bacteria, of course. >> Yeah. Yeah.
[3:00:07] » Which is why we're doing >> near water near bodies of water. Yeah.
[3:00:11] » All right. Um, sewer is good. street department main street repair. Oh yeah,
[3:00:16] we did that main street repair plan. So we took what
[3:00:20] we had left of UPM and we fixed all the potholes over on the asphalt and
[3:00:24] concrete on West Main. So we've got asphalt surface over there. Um not all
[3:00:30] but most. Um, but anything really is just a band-aid that all that concrete
[3:00:36] needs to be completely redone if we're going to do anything
[3:00:41] really that that road should be concrete all the way back to the propane station.
[3:00:45] And that's a huge expense. That's probably million and a quarter. We're
[3:00:49] close to it these days. We just got to wait for the market to change and then
[3:00:54] construction will get cheap again. Um,
[3:01:00] what else do we do? Did we do anything else yet?
[3:01:02] » Oh, a little bit on Second Street, too. >> Yeah. Oh, yeah. Second Street. Yeah. Hot
[3:01:07] balls down by the bridge. >> And then right by the church, the
[3:01:10] corner. >> Yeah, there was that.
[3:01:12] » There's a big >> big one.
[3:01:16] » Very cool. >> That spent
[3:01:20] all pretty much all the UPM we had. Um,
[3:01:25] I don't know if we want to go with bags again or if I want to take another look
[3:01:28] at the Hulk options. Even if it's totes, that would be good,
[3:01:33] too. >> As long as it's locked up.
[3:01:36] » But yeah, that's a pallet. So, it's not like
[3:01:39] » Yeah, you laugh.
[3:01:42] » Easier to lock up a pallet than a big pile of rock.
[3:01:51] They put red red paint all over the broth. So at least if somebody seals it,
[3:01:55] we'll be walking around town with red hands.
[3:01:57] » Exploding red paint.
[3:02:02] » That's a thing.
[3:02:06] [laughter] >> Like on the clothes there's those ink
[3:02:09] things that if you close they pop and spray you with ink.
[3:02:17] » Discussion of the school zone road repair.
[3:02:21] grand opportunity. I
[3:02:23] » I think that was on there. I just just got this print out. You guys can see it
[3:02:29] and be working towards that. >> I think that's great. That's I mean
[3:02:34] we've talked about that. So good. >> Okay.
[3:02:37] » Thank you. >> Um
[3:02:42] um just want to thank Matt Steam for pushing down the yard upstairs.
[3:02:47] » I think Donna contacted him. I did. >> Thank you, Matt.
[3:02:53] » There you go. The school grant was applied for
[3:02:58] the new >> for next July.
[3:03:01] » Oh, next July. >> It was supposed to
[3:03:04] » We missed this one. >> Yeah, supposed to be done. This is a
[3:03:06] really good
[3:03:10] » There's a lot of those that were small enough that, you know, people know we're
[3:03:14] poor because we're small. >> Yeah,
[3:03:16] » it fits us pretty well. law enforcement.
[3:03:26] » I didn't know. >> Uh there's a light down on Ferguson
[3:03:31] Street that uh needs to have some new wiring done to it. McKenna Parker said
[3:03:37] that once we contact our electrician that he could contact him and he would
[3:03:43] tell him what needs to be done. It's right there just kind of right titty
[3:03:49] corner from the lift station >> on the front corner that you turn to go
[3:03:54] into the fairgrounds off has been out for a while
[3:03:59] » and but uh the electric company can't fix it. It needs some new wire.
[3:04:06] So >> who who normally does that for us?
[3:04:09] » Who normally does that for us? >> Mike Shorb's been doing the electrical.
[3:04:14] Well, can we contact him and ask him if he can do it?
[3:04:18] » Yeah, he needs to contact him and tell him what he needs to do.
[3:04:23] » He said like maybe like 30 ft of wire or something.
[3:04:28] » Okay. >> All right. Um, anything else on law
[3:04:31] enforcement? >> No, just the Well, there is water in
[3:04:35] there, but it's modern extra stuff. I didn't see anything in
[3:04:42] here. So >> what is the total number?
[3:04:45] » 61 time still.
[3:04:50] » Okay.
[3:04:56] » All right. Um abatements and complaints. I don't know
[3:05:01] of anything. Anybody?
[3:05:13] Yeah, but
[3:05:18] » now they've left and >> Oh, I mean, somebody's still there, but
[3:05:22] yeah. >> So, not an issue anymore.
[3:05:24] » I mean,
[3:05:28] I don't know what we're doing about those. This is one we've dealt with
[3:05:31] before
[3:05:36] second here.
[3:05:45] All right, that was a quiet. >> Was it about dogs or was it about
[3:05:49] » About about the dogs barking early in the morning
[3:05:53] 3:00 a.m. to 5 and they're gone. Somebody's still there
[3:05:59] cuz then they let the dogs in about 5:00 a.m.
[3:06:07] » Well, if we're going to have a >> complete person, let's wait till we have
[3:06:13] that person.
[3:06:17] » Okay. Economic development. >> Economic development.
[3:06:22] » I have no report. The sour seems to be doing good.
[3:06:28] » They seem to be doing very well and they put up some new lights to shine on their
[3:06:33] sign. Um, and they've done a few other beautififications of the building. So,
[3:06:41] that's good. >> Very good.
[3:06:43] » And they are open seven days a week, which is amazing. I hope they can
[3:06:49] maintain that. >> Cool.
[3:06:54] » All righty. Um, finance office anything to report?
[3:06:59] » There was a
[3:07:05] so the rural the western Dakota Rural Water System member appreciation event
[3:07:10] evening social and annual meeting is October 21st. It's in Pedmont.
[3:07:18] Registration begins at 8 a.m.
[3:07:24] I don't know if anybody >> I would
[3:07:28] forward this to everybody take a look at it.
[3:07:31] » And do we have to by what time frame do we have to say or nay?
[3:07:39] » Deadline October 1st. >> Okay,
[3:07:47] » that's all featured. All righty. And we're at the scrap code
[3:07:53] and comments for the public.
[3:07:58] » So I have a few things I know talking about your
[3:08:04] four or five properties have been mowed all year that I feel need to be
[3:08:08] addressed and would be nice if you guys would drive by. I mean, several of them
[3:08:15] are within eyes sight, of course, and and behind us on lots that are for sale
[3:08:22] um that haven't been touched over by the school is
[3:08:27] that's probably one of the worst. And then um
[3:08:32] who is doing our water test? You can tell us how safe the water is right now
[3:08:38] and what the elements are.
[3:08:44] company name. >> Sage Waterworks.
[3:08:47] » Sage Waterworks. >> So, are they giving you a report here
[3:08:52] that we get to see then? >> I have them. I get them from Midland or
[3:08:57] whatever. >> The lab gives us reports. They just take
[3:09:00] the sample. >> They take the sample lab. They send
[3:09:02] » and everything's been good >> on that side of it. So, that's a good
[3:09:07] thing on that side of it. Are you still posting those like out there and on the
[3:09:12] board and >> told to do that?
[3:09:17] » Never told me to do that.
[3:09:25] » The annual >> that's right there on the
[3:09:33] » that's on the website. >> And then also I never did hear
[3:09:38] how the inspections ever went on our taps that got done without any permits.
[3:09:45] » Oh yeah. Um so that was that was some some false information, right? So he had
[3:09:50] uh he had done the water tap but he was licensed installer. The sewer tap he
[3:09:55] hadn't done. He waited for us to get uh our inspector inspector inspection in
[3:09:59] place. >> It was in the water
[3:10:03] » and on Walter Street. >> Yep. But he's done them before the
[3:10:08] permit. >> The water he buried it
[3:10:13] » and you got to bury it. >> And so what was the consequence?
[3:10:20] » Nothing. >> Consequence of somebody tapping our
[3:10:25] water without >> So what are we talking about?
[3:10:28] » Walter Street construction.
[3:10:33] » Okay. He took pictures. and he turned him in. He is legal.
[3:10:43] » So that's all we got to do then to dig it is just take pictures. And
[3:10:46] » when you don't have a water inspector, that is legal with the county.
[3:10:51] » That is legal with the county because the county did not have an inspector for
[3:10:55] a while and they were telling people to just take and do the work and make sure
[3:11:01] they take appropriate pictures. But we have different ordinances in the
[3:11:06] city than the county.
[3:11:11] » Thank you. That's the answer I need. So appreciate it.
[3:11:20] » Okay. Anybody else in the public? All good. Everybody's happy
[3:11:27] other than your bottle water. No.
[3:11:34] We should should have
[3:11:40] this morning. This was yesterday
[3:11:46] after my daughter took a bath in a brand new tub.
[3:11:54] [clears throat] That was the wipe down >> inside the tub.
[3:12:00] Then you have Manny. >> So how long?
[3:12:08] How long?
[3:12:14] » And it's oily. >> 30 years.
[3:12:16] » Oily. >> Yeah. It's like a film.
[3:12:20] » And they've never had any problems other than the last year.
[3:12:24] » Well, to be honest, it's nothing to do with you, Donna. But once that that
[3:12:28] Chuck put that first house in, she has had problem. So say anything Chuck did,
[3:12:35] » but I'm wondering if >> the lines over there have no connection
[3:12:39] with those over where you're at. >> No connection.
[3:12:46] » All brand new lines. >> I didn't see I didn't.
[3:12:50] » But they tie in the Manny. >> Yeah.
[3:12:54] Well, that's what we were just talking.
[3:12:59] » Well, you might as well.
[3:13:10] » Yeah. I figure this problem's probably been here for 40 years, right? I don't
[3:13:14] know. How long have those mains been in place?
[3:13:16] » Long time. They're tile, aren't they? >> No, the water.
[3:13:21] assume means >> are they duct tile or they plastic?
[3:13:24] » A lot of duct tiles. >> Every bit of its
[3:13:28] brand new plastic. >> Oh,
[3:13:31] » no. But throughout all >> Yeah. When we sold
[3:13:36] » redo everything back in the day. >> That was even before my time.
[3:13:43] » Um when >> that 20 years ago,
[3:13:46] » well, further than that. I I was I was here but I was not on the
[3:13:52] board or anything when that happened. And so I moved in here in ' 88.
[3:13:57] » So it could have been any time after that.
[3:14:03] » It just as it would have occurred this last
[3:14:07] » year has been never has she had any other issues.
[3:14:12] » Yeah. And the people in the place down below that built the first one
[3:14:18] » said that they came to her and said, "You had problems with brown water,
[3:14:23] too." >> No, the one in the greenhouse.
[3:14:26] » It's a system under pressure. New construction can't. It's not how it
[3:14:31] works. You don't build a new house and tap a new tap and now all of a sudden
[3:14:37] bad stuff's getting into the lines. >> No,
[3:14:39] » that's not how they broke. So, what's that? broke something or started it up
[3:14:44] when they did it. Well, they come out alive unless you lose pressure.
[3:14:49] » Yeah. Something broke down there and you're dropping the pressure and it's
[3:14:55] » I mean, you just go from hydrant with a gauge.
[3:14:58] » Yeah. >> Yeah. We're going to get we're going to
[3:15:00] get uh we're gonna get Mike to get a female here.
[3:15:06] » Pressure check everything. >> Yeah. Everything.
[3:15:09] » Okay. Good. >> Check. Can you say thank you
[3:15:16] » they do everything really good really good and really cheap
[3:15:27] » okay um
[3:15:31] » I guess we're trusty input trusty Kramer you can start
[3:15:36] » oh thank you for uh for holding down the fort while fell sick and and uh
[3:15:45] informational meeting was good. Little longer than I would have hoped, but
[3:15:50] [laughter] >> we'll deal with it.
[3:15:55] » That's all that's all I got. >> Very good. Trusty Ferguson, how about
[3:15:59] you? >> Well, I think it was a very disruptive
[3:16:03] meeting. I think there was two board members that spoke out of turn quite a
[3:16:07] bit without raising a hand. I am facilitated a couple times, but I think
[3:16:13] the meeting was a little disruptive and backbiting.
[3:16:19] » That's all I have to say. >> Trusty Miller.
[3:16:24] » Um,
[3:16:28] no. >> Trust me.
[3:16:32] » I thought it was a really good meeting. I um I think there's been a lot of work
[3:16:36] done the last three weeks and it shows. And um one thing we didn't mention that
[3:16:44] I hope we can talk about next time is the erosion on Tower Hill. All that dirt
[3:16:50] that's coming down. >> See if
[3:16:54] um maybe I'll find something, but maybe uh the vote members could
[3:17:00] think about that as well. >> Okay. But um yeah, I thought it was a
[3:17:05] excellent meeting. I appreciate all the work that was done so far and I'm
[3:17:10] looking forward to reading this contract. Again, I just wish it'd gotten
[3:17:14] to to me before the meeting. Otherwise, awesome.
[3:17:22] » Very good. Um, you know, we got we got things we got things being resolved. And
[3:17:29] um, yeah, growing pains growing pains are
[3:17:34] going to happen. You know, this saying I've come up with, I've been using a lot
[3:17:37] recently, is that a beautiful [clears throat] thing cannot grow in
[3:17:40] undisturbed soil. You need a little bit of shaking things up to make the town
[3:17:46] grow. We really do. um this long very long- winded discussion we had about the
[3:17:52] sewer problem really I can I can dilute that all down to ordinances need to be a
[3:17:58] little less ambiguous and then we won't have to have those big discussions about
[3:18:02] I think we can work through the ordinances and get them get them kind of
[3:18:05] to the point where we don't have to decide what to do because the ordinance
[3:18:09] spells that out extremely plainly and extremely clearly and fairly unimas
[3:18:16] unanimously fairly across the door to every citizen. Right. That's
[3:18:20] interesting. >> Yeah.
[3:18:23] » May I say one thing? I'm not from the area. I don't want bad histories. All I
[3:18:28] can say is for everyone who attends these meetings, we need to extend grace
[3:18:33] to each other. >> Yeah. I mean, grace for today, grace for
[3:18:38] who was here before us, grace for the people that were here 50 years before
[3:18:42] us. We all are here trying to do the best we can and we're going to make
[3:18:47] mistakes. >> True.
[3:18:50] » Thank you. >> It's our nature. It's our nature.
[3:18:57] » Yeah. >> Um but yeah, I think overall it's not 10
[3:19:02] o'clock, so I'm happy about that. >> Um okay. U Mr. James uh I think to the
[3:19:10] board whether they want to review that Preston settlement draft this meeting or
[3:19:15] go to the next one after you look but got the Terry's got the draft of it. So
[3:19:21] » up to the board whether you've had enough tonight or you want
[3:19:24] » and and this is something we have to do in private. We can't
[3:19:28] » I I think it's doesn't have to be, but they're probably
[3:19:33] going to review it with their attorney that discussion.
[3:19:37] » I don't know. >> Oh, my point is can I take it home and
[3:19:41] look at it and we can discuss it at the next meeting or can I not?
[3:19:45] » I don't have any reason as long as we're not discussing it. I open up to the
[3:19:50] board. Here's the issue or um Wendon. Um the issue is that um if we discuss it at
[3:19:59] the meeting the draft becomes a public document
[3:20:02] » correct >> it's an executive it's not a public do
[3:20:04] that's probably the only reason I ask for it to be an executive so the draft
[3:20:07] itself is not public document >> but other than that I don't care if you
[3:20:11] take it home and look at it or that's fine
[3:20:14] I'm just trying to avoid that it was just open to members of public in draft
[3:20:18] form especially >> in draft
[3:20:19] » well I think that's the key is it's it's draft
[3:20:21] » it's in draft >> yeah I I caught Like it's it's I think
[3:20:25] of a board as like where there's five of us, but sometimes we have to think as an
[3:20:29] individual >> and like you don't just walk around
[3:20:32] saying everything you think >> out loud in public. Sometimes you have
[3:20:36] to have a private thought for a little while.
[3:20:40] » Uh I'm I'm okay with going to executive. >> I'd make a motion to enter executive
[3:20:46] session at 9:20 for legal >> or legal. I'll second that. Second.
[3:20:52] Further discussion? Seeing none, all those in favor?
[3:20:56] » I >> I
[3:21:00] » Thank you everybody. Anybody going to wait?
[3:32:05] We're back in recording.
[3:32:14] » Motion to come out of the executive session at 9:32.
[3:32:19] We have a motion second. >> Motion seconded. Further discussion?
[3:32:23] » Seeing none, all those in favor? I >> All right. Um I do believe we have an
[3:32:28] action to take out of this executive session. Um I would entertain a motion
[3:32:34] authorizing the city attorney to transfer the settlement proposal to the
[3:32:39] attorney representing the Preston's and to provide a uh 30day response window.
[3:32:47] I will make that motion. >> Motion made.
[3:32:50] » You will second it. >> Made and seconded. Further discussion?
[3:32:55] Seeing none, all those in favor? >> I motion passed. Okay. Um
[3:33:01] [clears throat] and that's I guess who wants to make the the final motion.
[3:33:05] » I'll make a motion adjourn. >> 9:33.
[3:33:10] » Motion made. We have a second. >> Sure.
[3:33:13] » Made and seconded. Further discussion? Seeing none. All those in favor?
[3:33:17] » I >> I meeting.
[3:33:19] » Great. >> I thought it was a good meeting.
[3:33:21] » It was a good meeting.
