[0:02] okay my watch says four o'clock i see we
[0:06] have a quorum i will call a meeting
[0:08] of the city council city of hillsboro to
[0:10] order
[0:12] first item on our agenda is approval of
[0:14] minutes from our 9 21
[0:17] 2021 meeting did everyone receive a copy
[0:20] of the minutes
[0:21] were there any questions or corrections
[0:23] to the minutes
[0:24] we actually did have a correction we
[0:26] spelled blake bay's name incorrectly we
[0:28] forgot any yes so
[0:30] we will
[0:32] make that change in a minute i apologize
[0:35] [Music]
[0:39] get that thing turned off i'm sorry
[0:43] okay so we have a correction to uh to
[0:46] blake blake
[0:48] or
[0:49] craig
[0:50] no blake base yeah like bay bay bay
[0:53] sorry i always want to say it wrong
[0:55] because we forgot the es at the end so
[0:57] okay
[0:58] so
[0:59] with that uh with that correction would
[1:01] somebody care to make a motion to
[1:02] approve the minutes
[1:04] well
[1:05] councilman mccarty moves is there a
[1:07] second second
[1:08] councilman drake her uh
[1:10] not triggers councilman lowell in
[1:12] seconds
[1:15] any further discussion
[1:17] hearing none all those in favor say aye
[1:21] those opposed motion is carried four
[1:24] zero
[1:26] next item is approval of vouchers
[1:28] totaling four hundred and forty thousand
[1:30] seven hundred seventy five dollars
[1:32] twenty four cents
[1:33] did everyone receive copies of the
[1:35] vouchers
[1:36] were there any questions regarding the
[1:38] vouchers
[1:40] hearing none i'd accept a motion to
[1:42] approve the vouchers for payment
[1:47] councilman triggers moves is there a
[1:48] second
[1:51] councilman low in seconds
[1:53] any further discussion
[1:56] bearing none all those in favor say aye opposed
[2:01] motion carries
[2:02] or zero
[2:05] we now have a service recognition mr
[2:08] stiles
[2:09] yes so we had service recognition a
[2:12] couple weeks couple meetings ago three
[2:14] or four meetings ago and jen couldn't
[2:16] attend but we definitely want to make
[2:17] sure we recognize jan for all of her
[2:19] service
[2:20] um and so we've got a certificate
[2:23] appreciation which comes from the league
[2:25] of municipalities and it happens at the
[2:27] 40-year mark and unfortunately we're a
[2:29] little behind
[2:30] so sorry about that it was actually 42
[2:32] years when you're retired from here so
[2:35] we're playing catch up a little bit
[2:37] there sir
[2:38] but we're happy to have jan here today
[2:40] to receive her
[2:42] uh recognition and
[2:45] that is what jan is here for today
[2:47] that's great yep jan retirement looks
[2:49] good i think you're getting younger you
[2:50] know
[2:52] [Music]
[2:54] shucking all that responsibility off and
[2:56] then just enjoying life
[2:58] well come on over here and let's
[3:00] get you awarded here young
[3:02] lady give you that first and then shake
[3:06] your hand
[3:10] i got the camera
[3:13] all right
[3:15] thank you jan thank you
[3:26] some minutes for yourself
[3:28] okay
[3:30] she found me
[3:36] okay it looks like we have uh someone
[3:39] from the public in attendance
[3:41] so this is the time of our meeting where
[3:43] we allow for public comments so mr
[3:45] styles i will give you the floor and let
[3:48] you uh
[3:49] emcee that part of this this meeting
[3:52] okay so we've got uh one uh mr myers
[3:55] wants to make a comment he's on the zoom
[3:57] meeting but i think we'll probably go
[3:58] with mr olmsted's first since you're in
[4:00] the room and
[4:03] i don't know what normal policy is on
[4:06] speaking to you so
[4:08] uh
[4:09] but thanks for let me come
[4:11] i want to speak as with regards to uh
[4:14] an action you took at your month ago
[4:16] meeting
[4:17] september 7th
[4:21] so i will speak to that
[4:23] when i received my city bill last week
[4:26] included with it in it was a letter from
[4:29] hillsborough
[4:31] specifically written i guess by our
[4:32] administrator
[4:34] explaining that the city wants to
[4:36] abandon the
[4:39] it's called the renewable energy net
[4:41] metering parallel generation rate rider
[4:45] which was presented to me when
[4:47] a year ago i was
[4:49] hoping to
[4:51] construct a solar array
[4:54] and uh and it was
[4:57] part of the basis on which i invested uh
[5:01] thirty thousand dollars in building a
[5:02] solar array
[5:04] uh
[5:06] went into production
[5:09] months ago nine months ago something
[5:11] like that
[5:13] and in the term
[5:14] on the name of this
[5:16] rate writer
[5:17] you use the term net metering
[5:20] as part of the name
[5:22] and it seemed odd to me that that i
[5:24] would be told that the
[5:26] net metering was not the intent
[5:29] of the city
[5:31] especially when
[5:33] it was in the name and
[5:34] three-fourths of
[5:36] the document was explaining how net
[5:38] metering worked
[5:40] and just a reminder net metering means
[5:43] that
[5:45] i can buy electricity when the sun does
[5:48] not shine
[5:49] and then when the sun does shine i can
[5:51] use my solar array to repay the city for the electricity that i purchase when
[5:57] the sun does not shine
[6:00] along with that i pay
[6:01] the same amount everybody else does for
[6:03] the right to hook up on hook on to the
[6:05] city
[6:06] the city's power grid
[6:09] and if i
[6:11] do not produce enough electricity to
[6:16] offset
[6:17] what i use
[6:19] then i pay the same rate as everybody
[6:21] else does for that electricity and but
[6:23] if i produce extra
[6:26] those months that i do that
[6:28] i actually get paid a significantly
[6:30] lower amount so that's that's a lot
[6:33] shorter
[6:34] version of what net metering is than the
[6:37] four page document that we signed
[6:42] anyway the rate rider that was presented
[6:44] to us when
[6:46] we were anticipating building
[6:48] uh the solar array
[6:51] has suggested to me that the city wished
[6:53] to encourage maybe the reduction in
[6:55] production of greenhouse gases
[6:58] however it appears now that uh
[7:02] that is not the case
[7:04] and uh to put it in a not very
[7:08] good way i suppose i would say that
[7:11] it looks like
[7:14] it is a political decision to to
[7:17] recognize that in kansas
[7:19] recognizing
[7:21] uh climate change for global warming is
[7:24] kind of political suicide i realize that
[7:28] but legally i guess it's your choice to
[7:32] change your rate writer
[7:34] even though
[7:35] the document i was given sure looked
[7:37] like a contract that we saw
[7:41] technically i guess it is not
[7:44] but
[7:46] it seems unethical to me
[7:49] to have the decision to back out of that
[7:52] agreement
[7:53] less than a year after it was agreed to
[7:59] and in fact it was an agreement that
[8:02] i counted on when i invested
[8:05] in the solar array
[8:07] so i guess i would
[8:08] request that
[8:12] maybe some adjustment was made would be
[8:14] made
[8:17] the rate
[8:18] writer as it was written recognized that
[8:21] if a lot of people did this
[8:24] it would affect how the city's
[8:26] electricity program would be run and it
[8:29] was written into that agreement that
[8:31] you had the right to restrict it to less
[8:33] than five percent of the electricity
[8:36] that the city sells
[8:39] but you have three
[8:41] individuals
[8:42] with this that are
[8:44] producing electricity
[8:46] parallel to the city
[8:49] and that's nowhere near the five percent
[8:51] so it makes me think
[8:55] oh as i said that there are other
[8:57] reasons for the decisions
[9:03] that's my request is that that's some
[9:05] adjustment
[9:09] if you want to change the policy for new
[9:11] people that want to build solar arrays
[9:16] can we who have done it and invested a
[9:19] significant amount in that
[9:21] program
[9:22] could you give us
[9:24] a number of years
[9:26] to at least recoup some of that
[9:27] investment
[9:32] five six ten i don't know it's be my
[9:34] request
[9:37] is it unfair to the rest of the city
[9:42] i suppose it depends how you look at
[9:43] that if if you're trying to recoup your
[9:46] investment
[9:47] in in your grid
[9:49] not by sign up costs but rather by
[9:54] i use the words overpricing your
[9:55] electricity to cover those things
[9:58] uh
[9:59] maybe that's the part that's unfair
[10:01] rather than me being able to offset my
[10:06] electric bill by producing
[10:09] electricity during daylight hours i in
[10:12] fact
[10:15] have purchased a car to be charged
[10:18] by electricity
[10:20] and uh
[10:21] i will change it if if i have to but
[10:24] i've
[10:24] programmed it after i figured out how to
[10:26] do it
[10:27] to only recharge the car between 11 at
[10:30] night and six in the morning when
[10:31] hopefully it's your lower lower use
[10:37] but if i if i can't get i benefit from
[10:40] that or from
[10:42] producing electricity i i
[10:45] have to change it to recharge hopefully
[10:47] during the daytime
[10:49] when your higher use is
[10:51] and not being able to produce
[10:53] electricity to offset some of that so that's my request
[11:00] have you run numbers
[11:03] i mean do you have numbers that would
[11:05] show the difference
[11:08] uh
[11:11] yeah
[11:13] well uh
[11:16] if i can reimburse the city with
[11:18] electricity rather than just with
[11:20] dollars
[11:21] how much would you pay me
[11:24] for electricity
[11:26] i don't think that that's not i was
[11:28] driving as much as
[11:29] like if
[11:31] this policy how much did it affect the
[11:33] actual dollars that you were having to
[11:36] pay
[11:37] i have not tried to figure that out
[11:39] specifically except that
[11:42] right now
[11:43] since we've gotten the car
[11:45] and
[11:46] once we do use some of some
[11:48] air conditioning
[11:50] i'm just about to balance out my
[11:52] electric use
[11:53] with what i produce
[11:58] and the city has
[11:59] installed a meter
[12:02] that measures
[12:04] everything coming in in a separate
[12:06] greeting for everything that i produce
[12:08] and goes out back into the city
[12:12] so those those numbers are pretty close
[12:14] right now
[12:18] that doesn't answer your question
[12:19] probably well i'm just i've always
[12:21] struggled understanding exactly what the
[12:23] differences would do
[12:25] in the way though
[12:27] well you know what you charge me
[12:29] probably about 13 cents
[12:31] a kilowatt hour
[12:33] and if you would pay me
[12:35] only 4 cents per kilowatt hour
[12:39] that would be
[12:40] a two-thirds difference
[12:43] now i can adjust that by
[12:46] only using
[12:48] most of my electricity during when the
[12:50] sun shines
[12:51] so it would be less of that and i do
[12:53] have some adjustment in that
[12:55] but the way i'm doing it now
[12:58] especially by charging the car at night
[13:02] i think is a benefit for the city
[13:08] but i guess my my major argument is that
[13:10] i was presented
[13:12] one
[13:13] policy
[13:15] and less than a year later we're
[13:16] changing that which would be
[13:18] significant
[13:20] to my bottom line
[13:26] daryl when you say that i mean i if i
[13:29] understood what you were trying to get
[13:30] at is can you help us understand
[13:33] when you say it's significant to your
[13:34] bottom line i think we're just trying to
[13:36] get our hands around you made a
[13:39] significant investment thirty thousand
[13:40] dollars is a pretty significant
[13:42] investment i thought well it is in my
[13:45] opinion
[13:46] um so you know help
[13:48] i guess it might help us to understand
[13:50] you know what the change in policy
[13:52] did did to your investment financially
[13:55] do you have any kind of a
[13:57] an order of magnitude of what we might
[14:00] have done you know with that action in
[14:02] terms of the negative impact to you
[14:04] [Music]
[14:05] from a dollar's sense standpoint
[14:08] like hey you did this and now it's cost
[14:10] me x whatever that
[14:13] number is it hasn't gone into effect i
[14:15] guess
[14:16] or just has by one bill right uh not yet
[14:21] half of it yeah
[14:22] well even maybe anticipated i mean
[14:25] do you have factor that
[14:27] um so the retail price of uh energy is eleven and a half cents
[14:33] a kilowatt hour
[14:34] and then uh what we do when we
[14:37] you know it's a one-to-one on a net
[14:39] metering situation it's a one-to-one
[14:40] offset so
[14:42] eleven eleven and a half cents per
[14:44] kilowatt hour
[14:45] uh in the
[14:46] and then anything that he goes above
[14:48] what he's consuming would be um at 150
[14:52] of the cost of energy
[14:54] uh which is
[14:56] four it depends on the month four and a
[14:58] half five six cents just kind of depends
[15:01] so i mean the difference there is the 11
[15:03] and a half on the direct payback versus the six and
[15:07] a half which is what's in the parallel
[15:09] generation so
[15:10] you know when you talk about how much
[15:12] you consume i don't know how much you
[15:13] can
[15:14] i don't know barrel but it's i guess i
[15:17] mean we could yeah it's gonna that's
[15:18] gonna depend too but i mean it is a
[15:20] significant darryl's got a he's got a
[15:22] legitimate point um
[15:24] you know it was what what was signed is
[15:26] uh interconnection standards it's an
[15:28] agreement we signed
[15:30] for everybody who has a solar thing and
[15:33] it really is about
[15:34] it's not so much about the rate it is
[15:36] about how it's set up and how things get
[15:38] eaten and things like that so i guess
[15:40] where i'm confused still is like say
[15:42] july where you have fairly high electric
[15:44] but you also have fairly high sun
[15:46] if he is
[15:48] using the same amount he's generating in
[15:50] that
[15:51] joy the way he described that would it
[15:54] be
[15:56] washing out pretty much watching well
[15:58] actually
[15:58] with daryl's system he's got a pretty
[16:00] big one um and so we've we've paid him
[16:03] for some of that energy
[16:04] he's done because it's been bright so
[16:06] that's what that lesson is quite a
[16:08] that's where you see it yeah that's
[16:10] where you would see it you'd wash out
[16:12] these zero essentially on your bill but
[16:14] you would get less
[16:16] money returning back yeah that's kind of how
[16:20] the change ends up being but um
[16:24] yeah i mean that that's in essence correct um
[16:30] so yeah i mean
[16:32] daryl's got a perfectly legitimate point
[16:34] you know we did change it on them so
[16:37] and i don't think you know just from an
[16:38] intense standpoint that the intent was
[16:40] to bait and switch anyone daryl i mean
[16:43] you know it's sometimes you know you
[16:44] make decisions and things
[16:46] happen that are unintended you know as
[16:48] well so uh there's that but there's also
[16:52] some
[16:53] with some direction relative to state
[16:55] law and where the state was going with
[16:57] this
[16:58] you know so
[17:00] if we were to take some action you know
[17:02] that that would satisfy
[17:05] uh daryl and the other two people that
[17:08] have you know by going back to the
[17:11] original agreement for some period of
[17:12] time are we going to put them or the
[17:15] city in in conflict with state law
[17:19] to anybody's knowledge no i you know the
[17:21] state laws is less generous than the
[17:24] policy that you would be referring to
[17:26] and so you'd be grandfathering them in
[17:28] for five whatever many years you wanted
[17:31] to choose um from our perspective it's
[17:33] just you know we have to configure the same
[17:37] but we have to figure the solar pills by
[17:39] hand anyway every year and so i don't
[17:41] think you'd be in any
[17:45] legal issue now
[17:48] so i think legally the state
[17:50] requires you to do a certain amount
[17:53] and
[17:55] if you want but net metering is also
[17:57] used by other places and that is
[18:01] the state does not require that
[18:03] but it does require to you to
[18:05] reimburse me a certain amount for 100
[18:08] right and i think that's
[18:09] yeah there's a baseline we're going back
[18:11] yeah
[18:12] that's
[18:14] yeah got it
[18:15] okay
[18:17] you know if if the council wanted to do
[18:19] some kind of grandfathering thing i
[18:20] think you'd be you'd be well within your
[18:22] ability to do that it would just be a
[18:24] matter of
[18:26] how long and how what you want us to do
[18:28] with it so i don't think i'd be
[18:29] comfortable doing anything today i think
[18:31] i guess i'd ask would you look into that
[18:33] yeah you know yeah yeah i mean i i was
[18:36] going to ask of what what would the
[18:38] nature of the action look like i mean is
[18:41] it is it a uh is it an ordinance is it be an ordinance
[18:47] for these three customers specifically
[18:49] is that correct
[18:51] kimberlyn's nodding her head
[18:53] okay yeah yeah
[18:55] well i think
[18:57] if i could ask the council i think it's
[19:00] is the council uh comfortable giving
[19:02] that direction to our city administrator
[19:04] to come up
[19:05] with a proposal to address
[19:08] mr olmsted's issues and and come back to
[19:11] the council with a with some type of
[19:14] recommended ordinance to it
[19:16] to address that
[19:18] well i don't have a problem with it he
[19:20] put in quite a big solar panel system
[19:22] every
[19:23] and then
[19:24] i saw that he
[19:26] brought that car i saw his cory box so
[19:28] he intended to
[19:31] do the right thing so i think we should
[19:32] do the right thing too yeah
[19:37] he came he he did this under an
[19:39] understanding that would be
[19:40] a certain way and it didn't turn out
[19:42] that way and i think some kind of grandfather in
[19:45] clause would be very
[19:47] appropriate here yeah
[19:50] i would say also the policy i was
[19:53] originally given said that a residential
[19:56] array could not be more than 25
[19:59] kw
[20:00] and and my
[20:03] array is 10.
[20:06] the label says 12 but it's it's
[20:09] toned down to 10 maximum
[20:11] so i'm only at 40
[20:13] even though it seems like a big system
[20:15] that's 40 of what your original policy
[20:17] sure would have allowed so
[20:20] i have another question i mean we've
[20:22] bantered about
[20:23] several uh
[20:25] years of term and i guess i'd like to hear
[20:29] from you daryl i mean three three
[20:31] different possible
[20:33] scenarios were were thrown out there in
[20:35] terms of how long this grandfathering
[20:37] should be
[20:38] so i guess if we're going to look at it
[20:40] i want to hear from you what would you
[20:42] if you're asking what are you asking for
[20:45] i guess i'm asking for 10 which is
[20:46] theoretically with just about pay for my
[20:49] system but
[20:53] i can somewhat understand if you want to
[20:55] go somewhat less than that but i can
[20:58] just complain if you don't
[21:01] i probably will yeah well
[21:05] let me ask you this if if we if we if it
[21:08] was 10
[21:09] would you feel like you were hurt and
[21:11] you were in the in your issue was
[21:13] addressed
[21:14] uh
[21:15] that compared to the the way the letter
[21:19] implied that it was happening right now
[21:21] uh
[21:22] i feel i was greatly heard yes okay
[21:25] all right thanks
[21:26] i appreciate you bringing it to our
[21:28] intention because thank you i guarantee
[21:30] you it wasn't the intent of anybody
[21:32] sitting around this table to
[21:34] stick it to anybody that that you know
[21:36] went out and made that kind of an
[21:38] investment so yeah i think i think my
[21:40] assumption was largely that most people
[21:42] would be zeroing not
[21:44] seeing the net
[21:46] pay anyway right at this point with like a tens like a 10 system like you're
[21:52] talking about
[21:54] so i may be still a misconception of
[21:56] that but
[21:58] we could please invade it
[22:00] right yeah if it even
[22:01] i mean
[22:03] even though there's three there might
[22:04] only be he might be the only one that
[22:06] matters
[22:07] well
[22:08] daryl's is certainly the most
[22:09] significant right and if it's not as
[22:11] significant it wouldn't seem like it
[22:13] would
[22:13] matter i mean like if you don't get
[22:16] above that zero it doesn't it doesn't
[22:18] kick in right right
[22:21] well no it kicks in right away
[22:24] anytime the meter says
[22:26] that i purchased
[22:28] electricity from from the city
[22:32] if i
[22:33] even those if they can't balance a
[22:35] certain amount of that off
[22:38] with electricity they produced they
[22:40] would be paying
[22:43] more for each of those than if
[22:45] and if they could balance them off
[22:48] i'm not making any sense
[22:51] well i think again my understanding
[22:52] would be that if you
[22:54] were balanced
[22:55] every month it would be zero
[22:58] well yeah you still have to pay the base
[22:59] charge the base charge but the charge
[23:01] election
[23:02] will be zero
[23:04] but it's the consumption part i just
[23:06] looked on my bills
[23:07] and like i said i can adjust that
[23:09] somewhat depending on how i use
[23:10] electricity
[23:12] but i've been
[23:14] basically buying a thousand kilowatt
[23:16] hours a month
[23:17] and producing or selling that i produce
[23:19] more than that because part of what i
[23:21] produced during the day i'm using
[23:25] somebody with a smaller system if they
[23:29] purchase a thousand from the city and
[23:31] only produce 200
[23:34] that would
[23:36] the
[23:37] current policy or the previous policy
[23:39] would allow them to subtract 200 off
[23:42] of that a thousand that they purchased
[23:45] from the city
[23:46] but if we change it to the new policy
[23:49] they would only get
[23:50] they get credited back because it's not
[23:52] a subtraction they like a third
[23:55] yeah 150
[23:57] [Music]
[24:01] anyway they
[24:02] those were investments also even though
[24:04] they were absolutely fine well i really
[24:06] prefer not to have you do anything that
[24:08] uh that goes against what you'd already
[24:10] planned which is to use
[24:12] to produce and use power in a smart way
[24:14] and
[24:15] i just assume not uh not have to have
[24:18] you go another way you know and then i'd
[24:21] rather address the issue and i just want
[24:24] to make sure that when we take it up
[24:26] that
[24:27] to me it doesn't do a lot of good to
[24:28] come back to you and try to see how low
[24:31] we can go
[24:42] together let's just put it together
[24:43] right the first time
[24:45] i appreciate that so
[24:48] again i appreciate you coming in here
[24:50] and explaining it to us and again i'm sorry that you know that wasn't the
[24:54] intent i don't want you to feel like it
[24:56] was and uh
[24:57] and appreciate your making that
[24:59] investment because it's not only an
[25:00] investment for you but ultimately it's
[25:02] an investment in the community so we
[25:04] appreciate it
[25:05] yeah
[25:06] [Music]
[25:08] any other comments or questions on this
[25:10] topic
[25:11] i'm glad it came in yeah me too
[25:14] [Music]
[25:19] thank you daryl
[25:20] [Music]
[25:21] no i love to stay now you can stay as
[25:24] long as you want
[25:26] and you can come back any time you want
[25:28] you don't have to have an issue either
[25:30] you're welcome to join us
[25:36] okay mr styles you have another yeah mr
[25:39] meyer wants to make a comment so i ask
[25:41] you to
[25:43] unmute
[25:45] yeah i i feel like i'm back in my
[25:47] teaching days from last year because
[25:49] this is this is where i taught my
[25:50] classes this this computer and this
[25:53] headset uh first of all i'm sorry that
[25:55] jan i think left looking at that because
[25:57] we worked with her for many many years
[25:59] and wanted to congratulate her on that
[26:01] as well and i want to start off just by
[26:03] apologizing that i really wish i would
[26:05] have been there a couple of weeks ago to
[26:07] talk about this at the time
[26:09] so that we could
[26:11] so that i wouldn't have to come to you
[26:12] today with and request that you rescind
[26:15] something you've already passed
[26:17] but i'm talking about charter ordinance
[26:19] 22 and i appreciate those who've taken
[26:21] the time to read my very long note about
[26:23] it but just to hit a few highlights i
[26:25] think any problems that were mentioned
[26:27] last week we can we can address we can
[26:30] deal with things we're still putting out
[26:31] the paper right now and and we can
[26:34] accommodate truly urgent things that the
[26:36] council might pass on even on a
[26:39] even a later tuesday night meeting we've
[26:41] done it we we can figure out how to do
[26:43] that we talked a little bit about rates
[26:46] and how the in traits aren't there but
[26:47] the real concern that i have is
[26:50] there's a purpose for publishing notices
[26:52] and it's not just to you know
[26:55] uh
[26:56] tend to some legal mumbo jumbo of
[26:58] dotting eyes and crossing t's it's to
[27:01] inform people and the first primary
[27:04] thing is although there are people out
[27:06] there like my 96 year old mother who
[27:08] sits on the internet all the time and
[27:10] uses their computer the census bureau
[27:12] tells us that between one-third and
[27:14] three-eighths of the people in marion
[27:16] county don't have access to the internet
[27:18] by choice it's not that they don't have
[27:20] broadband or something else this didn't
[27:22] want to have a computer they don't they
[27:23] don't see that it's important so we're
[27:25] right there
[27:26] disconnecting anybody by going to a to
[27:29] an online publishing format we also
[27:32] disconnect one of the really most
[27:33] important things which is people
[27:35] discovering things you know yes it's
[27:37] there if you know to go look for it on a
[27:40] website and can find it on the website
[27:43] but the idea of publications by putting
[27:46] them in newspapers particularly
[27:48] subscription-based newspapers which is
[27:50] what the state law
[27:51] specifies uh is that people will stumble
[27:54] across them while they're doing other
[27:56] things if you buy a paper you're
[27:57] probably going to read it otherwise you
[27:59] wouldn't buy it
[28:00] and if you read it you're going to run
[28:02] across these different notices that
[28:03] we've had those are i think the main
[28:06] points around this the others kind of
[28:08] get into legalities yes it's been done
[28:10] other places has it ever been challenged
[28:12] in court no
[28:14] will it be if this continues yes uh and
[28:17] i don't say that as a threat it's just
[28:19] that this is an important issue
[28:21] that we feel strongly about it's not a
[28:24] huge dollar amount uh it's much less
[28:27] than than the previous speaker has
[28:29] invested in his electrical system about
[28:32] a sixth what he is for for an annual fee it's also more secure we it's allowing something to be published
[28:40] in a in a separate venue by a separate
[28:42] place i can go back
[28:44] you know 105 years ago this was
[28:47] published here it is this is exactly the
[28:49] way the council gave it to to the
[28:51] newspaper to be published nobody's been
[28:53] able to change it during that time
[28:57] a good friend of mine at the university
[28:59] of illinois
[29:00] uh who is uh
[29:02] i'm getting an internet is unstable
[29:04] message which means i might have freaked
[29:06] out a little bit on you um
[29:09] sorry about that but a good friend of
[29:10] mine is a medieval historian
[29:12] and she points out that the best records
[29:14] that we have for medieval times are all
[29:16] the printed documents and she doesn't
[29:18] like the internet she doesn't like the
[29:20] other things going on because as she
[29:22] points out you know okay go read your
[29:24] floppy disk that you'd saved every all
[29:26] your pictures on or how about your zip
[29:29] drive or
[29:31] some other things of that nature there's
[29:33] also vulnerability there's
[29:34] accountability there's a range of issues
[29:37] that i think
[29:38] rise up to the point in addition to the
[29:40] fact that there's a lot of legality
[29:43] about areas of state law that mention
[29:45] newspapers that clearly distinguish
[29:48] between newspapers and websites that the
[29:50] technique of just trying to override
[29:52] that by saying that a website is a
[29:54] newspaper
[29:56] is challengeable the home rule aspect of
[29:59] it is challengeable there's just a
[30:01] variety of things out there i don't want
[30:03] to get this into a big long fight over trifling amounts of money that that
[30:09] we'd end up all spending more money
[30:10] challenging than than we'd ever make
[30:12] back
[30:13] uh and i certainly don't want to go to
[30:17] produce an election which also would
[30:18] cost more money to do it i'm here just
[30:21] to urge you to consider rescinding
[30:23] charter ordinance 22 and to answer any
[30:25] questions that you might have about it
[30:27] and to thank you for
[30:28] reading my very very long
[30:30] thing and realize that that's what you
[30:32] get when you have a retired college
[30:34] professor writing for you he likes to
[30:36] write long so
[30:38] any questions anyone might have i'd be
[30:39] happy to answer them
[30:44] any questions for mr meyer
[30:52] i guess we don't have any questions eric
[30:54] and we appreciate you uh coming in and
[30:57] sharing with us and uh
[31:00] we'll uh we'll take it under advisement
[31:03] well i my the only thing i would add is
[31:05] that just because something hasn't been
[31:08] challenged legally doesn't make it legal
[31:10] i i drove over to
[31:12] pueblo viejo the other night and picked
[31:14] up some food and and noticed as i was
[31:17] passing grace church that i hadn't put
[31:19] my seatbelt on that doesn't mean it's
[31:21] legal to not wear seat belts it just
[31:23] means i hadn't done it and i hadn't
[31:24] gotten caught
[31:26] john hubert i think was on duty that
[31:28] time hadn't pulled me over if he had i
[31:29] would have been guilty of it i got away
[31:31] with it some people are getting away
[31:33] with some things right now uh and it's aggressive it's an aggressive way
[31:38] to save a little bit of money and
[31:42] in the process hurt a local business
[31:44] uh and
[31:46] i don't know that that's something that
[31:48] i would encourage you to do so i would
[31:51] encourage everyone to think about this
[31:53] and ponder whether whether you want to
[31:56] re reconsider the
[31:58] charter ordinance 22 uh or we will you
[32:02] know let the chips fall where they may
[32:03] and we will end up being there it would
[32:06] i will just point out
[32:07] the earliest you could save anything on
[32:09] would be july 1st of this coming summer
[32:12] because
[32:14] official newspapers are required to
[32:16] register on july 1st and you didn't
[32:18] register your website so
[32:21] it would be a long time coming even
[32:22] before this would happen so appreciate
[32:25] your time and if anyone has any
[32:27] questions uh or other things please let
[32:29] me know we stand ready to to serve at
[32:32] any time we can
[32:33] okay thank you very much
[32:36] uh
[32:37] now moving on in the agenda we have uh
[32:40] fire department annual report mr chief
[32:43] stephanie
[32:45] yeah here council members there's
[32:48] not a whole lot to report not nearly as
[32:50] exciting as last year when we got all
[32:51] those grants
[32:53] with the exception of our membership our
[32:55] membership is up we've got uh one new
[32:57] member uh nathan shaffer he's uh
[33:00] official he's meeting me here tonight to
[33:03] get his gear and his radio and he'll be
[33:06] answering calls after tonight
[33:09] um mitch d fiesta and rusty walter also
[33:12] as soon as they get their paperwork
[33:14] turned into danielle they as well will
[33:17] be members um
[33:19] rusty is going to not be so much an
[33:22] active firefighter as he is going to be
[33:25] an assistant to me to help me with
[33:27] report writing
[33:28] um
[33:29] organizational things that i'm not
[33:30] particularly good at he's going to help
[33:32] me out with some of those things so um
[33:35] i'm very fortunate to have him uh come
[33:38] aboard
[33:40] we have two more prospects
[33:43] which are prospective firefighters that
[33:45] are coming to meetings and training with
[33:47] us um jesse dirks who is an employee of
[33:49] the city and blake boddington and he was
[33:52] a member of the valley center uh
[33:54] volunteer fire department um so a very
[33:57] good couple of uh prospects there we did
[34:00] lose one member jesse campbell we
[34:02] unfortunately lost into suicide
[34:04] last year
[34:05] um as for apparatus update um you all
[34:08] were good enough to
[34:10] grant us the purchase of the heavy brush
[34:12] truck and it has been ordered but the
[34:14] delivery date is uncertain
[34:17] um new equipment
[34:19] new radios uh i ordered there's three uh
[34:22] for the for the three prospective
[34:24] firefighters um one i have ready to give
[34:27] nathan tonight and two are on the way um
[34:29] they've been ordered
[34:31] you know
[34:32] again
[34:33] who knows um i've been told that the
[34:35] that the
[34:37] timeline has been moved up so hopefully
[34:39] we'll get those pretty soon
[34:41] in the area of training uh the
[34:44] scafa school which is an annual school
[34:46] in topeka that we go to
[34:48] um was
[34:50] postponed in 2020 but they so they kind
[34:53] of forced it in uh 2021
[34:56] in august it's usually in march so
[34:59] myself um ignacio acevedo dave lockwood
[35:02] and weston geesbrick attended that
[35:04] school
[35:05] um and it was
[35:07] for the most part pretty good but there
[35:09] was some unorganized um
[35:16] things going on one class i went to the
[35:18] instructor never showed up
[35:20] you know
[35:21] so but then there was a couple of things
[35:23] like that but anyway um it was still uh
[35:25] the class i really did enjoy was the
[35:27] wildland firefighting class a lot of
[35:30] wildland firefighting classes refer to
[35:32] forestry
[35:34] and you get to get your red card which
[35:36] you're you're an official wildland
[35:37] firefighter and you can go to these
[35:40] federal wildland fires
[35:42] they that training um is mostly forest
[35:46] firefighting and so you learn techniques
[35:48] for that type of firefighting but we
[35:50] fight fire wildland fire here in kansas
[35:53] much differently and so i really
[35:55] appreciated a class that the kansas
[35:57] forestry service put on for fighting
[36:00] wildland fires here in kansas a wealth
[36:02] of information it was a great class
[36:05] um as for
[36:07] um runs and other training i'll have a
[36:10] full report at the close of the year
[36:12] um but as you may know last week tuesday
[36:14] night and into wednesday morning we
[36:16] fought two back-to-back
[36:18] house fires both of them were involved
[36:21] fully involved when we got there and uh
[36:24] they're still standing you know but the
[36:26] damage was heavy on both of them
[36:28] one was uh on washington street
[36:31] and assisting us on that one were durham
[36:33] fire and marion fire departments
[36:35] and the other one was on schmidt lane in
[36:37] lehi and assisting us there were lehigh
[36:39] fire department durham fire department
[36:41] and gossip fire departments
[36:43] so that was uh that was a long night
[36:46] so um that's about all i have for a
[36:48] report any questions anything you guys
[36:50] would like to know about the fire
[36:51] department the uh you mentioned the uh
[36:54] the grants and some of the the the
[36:56] equipment that you received last year i
[36:59] know that you've had opportunities to
[37:00] put some of that to use already yeah in
[37:03] the past year yeah almost all of it i
[37:05] wore my new bunker gear on these flyers
[37:07] you know we did we had to wait a while
[37:09] for because when we got our new coats
[37:11] the sleeves i'm not kidding you my
[37:13] sleeves were that much too long
[37:16] so we had to send them back and you know
[37:19] get them re-you know refit and that
[37:21] there was quite a delay but we do we
[37:23] have them now and they're in service
[37:26] i'm thinking too about your boats the
[37:27] boats we've used the boats yep
[37:29] also we helped with the water rescue and
[37:32] peabody we helped with some water we
[37:34] didn't do a rescue there peabody uh
[37:36] affected the rescue before we got there
[37:38] using their
[37:40] heavy brush truck right and um
[37:42] which was effective uh so we helped with
[37:44] some reconnaissance and you know making
[37:46] sure that there because there were some
[37:48] people that were staying in their homes
[37:51] and we're encouraging them to come out
[37:53] and they elected not to but we had that
[37:56] means to get them out here right
[38:00] it's good stuff yeah we're really blessed here yeah we
[38:04] really are you know we've got a great
[38:07] membership it's it's really working well
[38:12] okay any any challenges uh coming up
[38:15] that uh
[38:16] we need
[38:25] i know that that's on the forefront of
[38:27] this uh council and so
[38:29] we applaud that um and we are we are
[38:32] ready and we stand ready you know to do
[38:34] whatever you know you never know what
[38:36] the call is right you never know what
[38:38] that call is going to be
[38:39] last night at 11 45 it was
[38:42] tapered town houses
[38:44] and i and firefighters still show up in
[38:47] their bunker gear wearing a pack in the
[38:49] fire truck i mean ready to fight fire
[38:51] even though
[38:53] we probably know that someone burns
[38:56] something on the stove you know but but they still respond the way they're
[39:01] supposed to got to call the airport
[39:03] that's unusual for you that wasn't
[39:06] it's happened before though
[39:09] same kind of airplane too as a matter of
[39:10] fact
[39:12] yeah bonanza yeah yeah the v-wing the
[39:15] v-tail
[39:16] yeah
[39:18] so um
[39:19] it will
[39:21] what it what are your plans to do with
[39:23] that with that bay that the when the
[39:25] ambulance moves up
[39:27] have you got plans for what you're going
[39:29] to put in that bay we'll probably put
[39:31] the boats there
[39:32] you know that way we can because right
[39:34] now we have to go there to get them and
[39:37] that takes quite a bit of time and when
[39:38] there's a water rescue you know
[39:40] emergency charms of the yes right so
[39:43] we'll back the boats in there because
[39:44] the rescue truck is what typically hauls
[39:46] them my truck can haul them too
[39:48] and that way just move move over a
[39:50] couple of bays hook them up and go got
[39:52] it so that's more likely what will
[39:53] happen
[39:55] and they'll fit nicely in that space
[39:56] super
[39:58] any other comments or questions for
[40:00] chief
[40:03] thank you very much you're welcome glad
[40:05] to bring on this new firefighter will
[40:06] you oh yeah
[40:11] [Music]
[40:17] it takes a good leader and and you've
[40:19] provided excellent leadership for our department and we appreciate it
[40:23] very much i think what i've done the
[40:24] best is just not messed it up there you
[40:26] go sometimes sometimes that's the best
[40:29] yeah
[40:30] thanks again all right thank y'all
[40:31] [Music]
[40:34] okay we're now into believe it or not
[40:37] our business section
[40:38] and uh
[40:39] first item up is ordinance 1336-2021
[40:44] series a refunding bonds
[40:48] mr styles yes uh so we've got greg
[40:51] varnberg here from uh raymond james and
[40:54] to talk a little bit about kind of how
[40:55] the bond sale went the ordinance and the
[40:57] resolution are related to the final sale
[40:59] and um the rate are
[41:01] basically the final sale uh so i will
[41:04] actually let greg
[41:06] talk about
[41:08] how things went
[41:12] i think you're on mute greg
[41:18] i can't hear you
[41:20] let me see if i got something going on
[41:22] he's off now should be
[41:24] oh
[41:30] still can't hear you i'm sorry greg we
[41:32] can't hear you we're not getting
[41:34] audio
[41:39] well this mute did go away though
[41:41] yeah
[41:44] technical difficulties
[41:50] he's gonna come back yeah come back in
[41:52] and yeah i believe so so
[41:54] uh what we have
[41:58] what was included in the pack it was of
[41:59] course the ordinance for you to take a
[42:01] look at and
[42:03] what that does is just give you the the
[42:04] final amounts on all that
[42:06] uh what ended up happening and kind of
[42:08] how those things are going to be done
[42:11] with the refunding portion of the bonds
[42:14] and then also the resolution there is
[42:16] for the sale final authorization and
[42:18] sale of those bonds
[42:21] uh and then
[42:23] greg also put in a refinancing analysis
[42:26] right here so hopefully
[42:28] we can hear him this time
[42:32] i want to steal any of his thunder on
[42:33] this
[42:49] we can see you greg
[42:54] we can't hear you greg
[42:56] i'm not getting anything
[43:02] okay
[43:04] well we'll uh
[43:05] can we call in
[43:06] yeah actually we couldn't you call in
[43:08] greg if you wanted to do that
[43:12] let me get i will send you a number for
[43:14] that and um
[43:16] you can we can maybe come back to it
[43:19] here a sec if that's something
[43:39] sent you an email greg it'll have that
[43:40] call-in number you can get us into that
[43:43] so
[43:45] um let's see here
[43:49] so the actual actions here today the
[43:51] authorization
[43:58] all right greg
[44:02] [Music]
[45:07] sorry greg hold on a second
[45:09] okay
[45:11] they're not able to hear you on the
[45:13] recording
[45:23] i can hear you okay okay
[47:07] thank you have it in the agenda let's
[50:55] so let's recap a little bit what greg
[50:57] was saying sorry about the feed on that
[50:59] so no none of the audio greg was getting
[51:02] was coming out so we got a lot of
[51:03] feedback but what greg was saying was we
[51:05] had uh enterprise bank was the local
[51:08] bank to bid on the uh bid on the bonds
[51:11] and they came back with a rate of one
[51:13] and a half percent which was a little
[51:15] bit higher than what we initially
[51:16] thought but we were able to adjust their
[51:18] uh
[51:19] their rate in order to bring back a
[51:21] savings of thirty three thousand and
[51:22] sixty three dollars
[51:24] so that's that is the content of what greg was
[51:28] saying as far as what happened there so
[51:30] apologies for the issue with the sound i don't know
[51:34] greg's microphone wasn't working or
[51:36] something there but
[51:38] um
[51:39] unfortunately i don't think uh our folks
[51:41] on the zoom got to hear what was going
[51:43] on with that but
[51:44] um so you're correct what what also greg
[51:47] was saying was that the bond is share
[51:49] the bond ordinance and bond resolution
[51:51] will lock in those rates and allow us to
[51:53] move forward with those purchases so
[51:56] that's kind of the just sorry about the
[51:58] issues with that
[52:01] okay
[52:02] are there any questions for mr styles
[52:07] hearing none the first order of business
[52:09] is to address ordinance 1336-2021
[52:13] series a refunding bonds
[52:16] and accept a motion to
[52:19] adopt
[52:20] ordinance
[52:22] 1336-2021 series a refunding bonds and
[52:25] allow the mayor to sign
[52:27] so moved
[52:29] councilman triggers moves
[52:32] councilman lowen seconds any further
[52:34] discussion
[52:37] hearing none we'll pull the council
[52:39] councilman gearing
[52:41] councilman mccarty yes
[52:43] councilman lowen yes councilman driggers
[52:46] yes
[52:47] the
[52:48] ordinance
[52:49] 1336-2021 series a refunding bonds
[52:53] is adopted and approved
[52:55] and the mayor will sign thank you very
[52:57] much
[53:00] now we have resolution 2021-08
[53:04] final sale documents any comments mr
[53:07] styles now this this um is passed once
[53:10] you've authorized the bond
[53:12] excuse me the ordinance and so this is
[53:14] for the final actual sale of those stock
[53:16] for the actual sale and transfer those
[53:18] payments
[53:19] okay
[53:20] would somebody care to make a motion to
[53:22] approve resolution 2021-08
[53:27] councilman mccarty moves okay second
[53:30] councilman lowens seconds
[53:33] any further discussion
[53:35] hearing none will pull the council
[53:37] councilman driggers yes councilman lowen
[53:40] yes councilman mccarty councilman
[53:42] gearing yes
[53:44] okay resolution
[53:46] 2021-08 final sale documents are adopted
[53:52] okay
[53:53] moving on to back to our strategic plan
[53:56] mr styles
[53:57] sir so uh
[53:59] the strategic plan that we've been
[54:00] reviewing i think we're ready for final
[54:02] approval um i put it in the dropbox
[54:05] because this is a huge file so hopefully
[54:07] we're all able to navigate to that we
[54:10] did make a small
[54:12] couple small changes to it i did add tim
[54:14] blodgett's contributions in the
[54:16] procedure section uh and we removed the
[54:18] special acknowledgements because you
[54:19] didn't really have anything under that
[54:21] special acknowledgement section but um
[54:24] we did do a few tweaks on some of the
[54:26] layout stuff but by and large everything
[54:28] in there is exactly the same as what you
[54:30] saw before except for that note on tim
[54:31] blodget's contribution so
[54:34] unless there's something you guys would
[54:36] like to make an adjustment on i think
[54:38] we're ready to
[54:39] uh do a final approval and then get down the road putting it on the website
[54:43] and making paper copies for folks and
[54:47] getting going on doing the work
[54:50] hey
[54:52] any
[54:53] questions
[54:56] hearing none i'd accept a motion to
[54:59] approve the strategic plan
[55:01] for the city of hillsboro
[55:04] i'd like to make that motion
[55:06] councilman lowen moves is there a second
[55:11] councilman gearing seconds
[55:14] any further discussion
[55:16] hearing none all those in favor say i
[55:20] opposed motion carries
[55:22] we now move on to adam's brown
[55:25] engagement letter mr styles thank you
[55:28] sir so adam's brown's been our auditing
[55:30] service now for several of the last
[55:32] fiscal years and we've actually had
[55:34] finished our we normally do a three-year
[55:36] engagement with them
[55:37] um and so
[55:39] 2020 marked the end of that and so they
[55:41] proposed another three-year
[55:44] engagement letter for that
[55:46] auditing services for the three years
[55:48] are uh 17 750 18 275 and 18 830 which is
[55:55] uh three percent per year increase
[55:57] essentially
[55:58] um and that totals out to fifty four
[56:00] thousand eight hundred and fifty five
[56:03] thousand dollars there
[56:05] for the total package on that uh it's
[56:08] actually a slight reduction in fee from
[56:10] what we paid this year because as
[56:13] danielle hollings was talking about when
[56:15] she presented the audit they're
[56:16] adjusting how they look at the cvb in
[56:18] the library uh and then a couple of the
[56:21] rec commission
[56:23] they're moving them to what they call uh
[56:26] they're just a governmental unit versus
[56:28] going through a full audit
[56:30] they're we don't they're not required to
[56:32] have a full audit and so they've made
[56:33] that suggestion and that that will save
[56:35] us a little bit of money 150 not a ton
[56:37] but uh it's it's always nice when the
[56:39] fee stays that stays the same or goes
[56:41] down a little bit
[56:42] um we could always have an option if we
[56:45] wanted to go out for auditing services
[56:46] you could you could put that out for bid
[56:49] um we've been satisfied with the way
[56:51] they've done it i can tell you having
[56:52] switched auditors before it can be can
[56:55] be a little bit of a headache as far as
[56:57] you kind of get used to somebody's
[56:58] process and kind of how you submit
[57:00] documentation to them
[57:02] so getting a new person can be a little
[57:04] bit tricky
[57:05] we did i did talk to
[57:08] similar size cities and then the fee
[57:10] that we've been seeing or we got back
[57:12] was around somewhere between 16 and 20
[57:14] 000 a year so they're not
[57:16] completely out of whack
[57:18] so it seems like it's something that
[57:21] we we don't have any as staff don't have
[57:24] any issue with moving forward with
[57:26] another three year engagement patterns
[57:27] around
[57:29] the reason we're doing it you know
[57:31] reason we do the uh audit every year is
[57:33] we're prior to because of our bond
[57:35] covenants is but it's also
[57:37] about being able to provide adequate and
[57:39] clear financial information to the
[57:41] public to let them know that we're
[57:42] spending their money appropriately so
[57:46] that is kind of how we do it and the
[57:47] cost of that is always divided up we
[57:49] divide it between the general fund
[57:51] and our utility funds so utility funds
[57:53] pay a little bit the general fund pays
[57:55] for it too so that's kind of how it gets
[57:57] paid
[58:00] okay any questions
[58:03] comments
[58:07] hearing none i'd accept a motion to
[58:09] approve uh the engagement letter for
[58:12] adam's brown
[58:15] uh as our
[58:16] city auditing firm
[58:18] and
[58:20] is that something i'm to sign you're
[58:21] going to sign yeah you can sign that one
[58:23] okay and authorize the mayor to sign
[58:26] a move
[58:27] okay
[58:28] so
[58:30] what's that
[58:33] councilman mccarty moves second second
[58:35] by councilman triggers
[58:37] any further discussion
[58:40] hearing none all those in favor say aye
[58:43] okay all those opposed
[58:46] motion carries
[58:47] we are now to agenda item five in the
[58:50] business section kpp voting member
[58:53] selection mr styles okay so the kpp
[58:56] annual meeting is coming up in december
[58:58] on seven tenths of wichita and so we as
[59:01] a city get one vote as as but in order
[59:03] to do that we have to officially
[59:05] designate the representative for the
[59:06] city
[59:07] uh and then we can name alternates if we
[59:09] need more than one
[59:11] but one is recommended at least you can
[59:13] have more than one
[59:14] um i'm planning on attending but you
[59:16] know mayor thurston is actually on the
[59:17] board for kpp so it makes sense to make
[59:19] him the authorized voter for the city of
[59:22] hillsborough and i'll be happy to be the
[59:24] um
[59:25] you know alternative if that's what what
[59:28] you want to do so
[59:29] uh we're
[59:31] know
[59:32] recommending approving uh designated
[59:35] mayor lutheran as the kpb voting
[59:37] delegate and myself as the alternate
[59:42] questions
[59:45] the only thing i would say is i don't
[59:47] know that
[59:48] being on the board means that i have to
[59:50] be the voting member
[59:52] no i don't think so and i know that uh
[59:55] councilman lowen in the past has shown
[59:57] interest in kpp and
[59:59] been our voting member before
[1:00:01] and so i guess i want to put it out
[1:00:04] there david if that's something you
[1:00:06] would like to continue
[1:00:07] doing you know i
[1:00:09] i'm fine not doing it this time around
[1:00:12] okay
[1:00:13] well that's fine i think i can attend
[1:00:15] the meeting anyway
[1:00:17] that's fine i just didn't want you to
[1:00:19] feel like we were
[1:00:21] pushing you pushing you aside that
[1:00:23] wasn't that wasn't the case
[1:00:26] i'll let you know when i feel pushed
[1:00:27] here okay thank you
[1:00:28] yeah
[1:00:30] very good
[1:00:32] okay any other questions or comments
[1:00:35] hearing none i'll accept a motion to
[1:00:38] approve mayor lou thurston this kpp
[1:00:40] voting delegate and matt styles as
[1:00:42] voting alternate
[1:00:44] councilman gearing moves is there a
[1:00:46] second
[1:00:48] councilman triggers seconds any further
[1:00:50] discussion
[1:00:52] hearing none all those in favor say i
[1:00:56] opposed
[1:00:57] motion carries
[1:00:59] agenda item
[1:01:01] g6 amendment to personnel policy
[1:01:03] employee appeals process
[1:01:06] mr stiles thank you sir uh so our
[1:01:08] current employee handbook doesn't have
[1:01:10] an appeals process regarding
[1:01:12] disciplinary action so if
[1:01:14] uh an employee has any kind of
[1:01:15] disciplinary action up to and including
[1:01:17] termination there's no actual formal way
[1:01:19] for them to appeal that
[1:01:21] um that kansas is an at will employment
[1:01:23] state and you can be let go for any
[1:01:26] reason at any time but uh public specter
[1:01:28] employees do have a right or have an
[1:01:31] opportunity have to have an opportunity
[1:01:32] for public for due process and so
[1:01:35] um attaching you know putting in a
[1:01:38] disciplinary
[1:01:39] appeals process which serves to fill
[1:01:42] that
[1:01:43] fulfill that obligation to public
[1:01:45] employees and it's the right thing to do
[1:01:47] honestly i was a little surprised to
[1:01:48] find we didn't have one but
[1:01:50] we were able to to draft one and
[1:01:53] kimberlyn helped put that draft together
[1:01:55] we modeled it off another uh another
[1:01:57] community's policy but
[1:01:59] um so what would happen in this proposed
[1:02:02] situation is if somebody
[1:02:05] has a departure has a disciplinary
[1:02:07] action
[1:02:08] the process would go that the city clerk
[1:02:10] would collect all the information
[1:02:12] regarding that and then set up a hearing
[1:02:14] i would be with the city administrator
[1:02:16] unless it was a complaint against
[1:02:18] something that i have done and then it
[1:02:20] would go to the mayor or his destiny
[1:02:23] they would have the ability to present
[1:02:25] that there wouldn't be any attorneys
[1:02:26] present for the city or for the person
[1:02:29] issuing the discipline or for the person
[1:02:30] who's appealing
[1:02:32] and then you know they would have an
[1:02:33] opportunity to be heard and then the
[1:02:36] person would have to issue an opinion on
[1:02:38] what what the disciplinary action was to
[1:02:40] be upheld or changed modified or uh to
[1:02:42] be dismissed so
[1:02:45] that's kind of the process that we're suggesting are we're
[1:02:49] moving forward for approval recommending
[1:02:51] for approval i don't know if you have
[1:02:53] anything to add to that camera at all
[1:02:57] okay
[1:02:58] so what would happen if you guys did
[1:03:00] choose to add this to personal policies
[1:03:02] everybody would be given a copy of it
[1:03:04] and anytime we make a change to the
[1:03:05] personal policy require that all
[1:03:07] employees have signed an acknowledgement
[1:03:09] sheet saying that they got it and that
[1:03:10] they've read it so
[1:03:12] that's what would happen with this
[1:03:14] particular case
[1:03:17] any questions
[1:03:22] hearing none
[1:03:24] i'd accept a motion to approve the
[1:03:26] proposed appeals process and add it to
[1:03:29] the personnel policy
[1:03:33] councilman driger's moves
[1:03:35] is there a second
[1:03:37] councilman mccarty seconds
[1:03:39] any further discussion
[1:03:43] hearing none all those in favor say aye
[1:03:46] opposed
[1:03:47] motion carries
[1:03:50] we are now on to item seven november
[1:03:52] through january meeting schedule mr
[1:03:55] styles thank you sir so uh at the last
[1:03:57] meeting councilman
[1:03:59] uh lowen requested that we look at uh
[1:04:02] moving middle school basketball because
[1:04:03] the middle school basketball practice
[1:04:04] movement are sliding our meeting time a
[1:04:06] little later into the evening uh
[1:04:08] dave and i had gotten together and
[1:04:10] talked about that we looked at
[1:04:12] just
[1:04:13] there's some specific dates in there
[1:04:14] that maybe didn't need to be changed but
[1:04:16] just for simplicity's sake we're saying
[1:04:17] november to january so that would be
[1:04:20] november 2 and 16 december 7 and 21 and
[1:04:23] january 4 and 18.
[1:04:25] moving the start time to 6 30 unless you
[1:04:27] wanted to say something else on that one
[1:04:29] day we talk 6 30 but
[1:04:31] if it works better for someone later
[1:04:34] that's fine too i don't
[1:04:36] i'm not upset on that but 6 30 is fine
[1:04:38] with me
[1:04:41] well that should give you time to get
[1:04:44] wrapped up i know
[1:04:45] in the past had we done six and that was
[1:04:48] maybe a bit of a challenge so
[1:04:50] yeah 6 30 sounds better
[1:04:53] any other
[1:04:55] questions or comments
[1:04:56] so to do this you have to make an
[1:04:58] official action because you are moving
[1:05:00] your meeting time so
[1:05:05] okay
[1:05:07] i'd accept a motion to approve moving
[1:05:09] the regular city council meeting start
[1:05:10] time for the months of november
[1:05:13] december 2021 and january 2022
[1:05:17] to 6 30 p.m
[1:05:20] somebody care to make that motion
[1:05:25] councilman gearing moves is there a
[1:05:27] second
[1:05:30] councilman drinkers this is a second any
[1:05:32] further discussion
[1:05:35] hearing none all those in favor say aye
[1:05:38] opposed
[1:05:40] motion carries
[1:05:41] uh we now are agenda item eight
[1:05:44] which is
[1:05:46] job description for its chief of police
[1:05:51] mr styles thank you sir
[1:05:53] just looking through the packet and i
[1:05:55] didn't see the actual description in
[1:05:56] there
[1:05:59] so what what you've got
[1:06:01] on the screen here and i can it's
[1:06:02] actually
[1:06:06] okay got put in there in the wrong spot
[1:06:09] my mistake
[1:06:10] um so with chief dan's uh chief kenny's
[1:06:14] retirement
[1:06:16] that's kind of distracting um
[1:06:18] i'd like to take an opportunity to
[1:06:20] review and revise any job descriptions
[1:06:21] that we have when somebody retires
[1:06:23] especially dan who's been with us for 26
[1:06:25] years um
[1:06:26] there's a few things in there we needed
[1:06:28] to kind of tweak a little bit
[1:06:30] so what we did was we provided you with
[1:06:33] the job descript with the job
[1:06:34] description as it currently is written
[1:06:36] and then also kind of look at
[1:06:40] what i did on there any changes that we
[1:06:41] made we highlighted
[1:06:43] um we honestly didn't make a whole lot
[1:06:45] of changes there we did add performs and
[1:06:48] manages code enforcement tasks at the
[1:06:50] direction of the city administrator
[1:06:52] they do do some code enforcement for us
[1:06:55] and i felt like it was probably
[1:06:56] important that we put it in there for
[1:06:57] them to note that
[1:06:58] um and then we added other duties as
[1:07:01] deemed necessary or assigned which ends
[1:07:02] up in all of the other marginal function uh job
[1:07:07] descriptions
[1:07:08] we also changed the
[1:07:11] education requirement to a bachelor's
[1:07:13] degree or higher in a related field
[1:07:14] preferred it didn't have any kind of
[1:07:17] requirement on education other than to
[1:07:18] have a
[1:07:20] high school diploma so
[1:07:22] we put that in there and
[1:07:25] i think that's that's probably an
[1:07:26] appropriate thing to have in the police
[1:07:28] chief position considering
[1:07:30] the level of
[1:07:31] knowledge that one needs to do that the
[1:07:33] ability to kind of process information
[1:07:36] those are the main things that we
[1:07:37] changed uh i would note that this
[1:07:39] position is an exempt position um
[1:07:42] dan when he started as police chief had worked out to deal with the councils
[1:07:46] where it would be an hourly position for
[1:07:49] him
[1:07:50] my intention would be go back to an
[1:07:53] exempt position because that's what it
[1:07:54] states here
[1:07:56] i don't know
[1:07:58] you know it fall definitely falls under
[1:08:00] the
[1:08:01] flsa
[1:08:02] category for an exempt position
[1:08:04] for whatever reason
[1:08:06] hasn't been done that way in the past
[1:08:08] but
[1:08:09] i think that that's probably an
[1:08:10] appropriate choice for the police chief
[1:08:13] position
[1:08:14] they are managing people they are indeed
[1:08:17] yes says
[1:08:18] so a good chunk of the job
[1:08:23] okay
[1:08:26] any questions
[1:08:37] the police as amended
[1:08:40] okay councilman mccarty moves
[1:08:43] is there a second announcement low in seconds any
[1:08:47] further discussion
[1:08:50] hearing none all those in favor say aye
[1:08:53] opposed
[1:08:54] motion carries
[1:08:56] and uh believe we have an executive
[1:08:59] session
[1:09:00] on the agenda mr stiles yeah i would ask
[1:09:03] for
[1:09:04] uh for 20 minutes i think we can get it
[1:09:06] done in 20 minutes and i'm going to ask
[1:09:08] to invite kimberlyn gilchriston to also
[1:09:11] discuss
[1:09:14] okay
[1:09:15] does
[1:09:15] someone have the motion in front of them
[1:09:19] and would they care to read it please
[1:09:22] i moved at the city council recess
[1:09:26] session for the purpose of discussing
[1:09:29] personnel matters of non-elected
[1:09:30] personnel pursuant of ksa 75-4319
[1:09:36] b-1 for a period of 20 minutes the
[1:09:39] meeting will include the city
[1:09:40] administrator and city attorney
[1:09:42] the open meeting will resume at 6 30 6
[1:09:46] 30 or 5 30.
[1:09:51] i had 6 30 on the brain from your from
[1:09:54] our previous action sorry
[1:09:57] hey we have a motion is there a second okay we have a second by
[1:10:02] counseling triggers
[1:10:03] any further discussion
[1:10:06] hearing down all those in favor say aye
[1:10:10] motion carries we are now an executive
[1:10:29] back live on the video okay well we are
[1:10:31] back in in open session and i'd like the
[1:10:34] record to state that no action was taken
[1:10:36] during executive session
[1:10:40] we do have a need to uh to go back in
[1:10:44] and finish up
[1:10:46] the conversations so uh
[1:10:51] would somebody care to make a motion
[1:10:54] yeah i moved at the city council recess
[1:10:56] into executive session for the purpose
[1:10:58] of discussing personnel matters
[1:11:00] of non-select non-elected personnel
[1:11:03] pursuant of to case sa75-4319
[1:11:09] be one
[1:11:10] for a period of 15 minutes
[1:11:13] the meeting will include the city
[1:11:15] administrator and city attorney
[1:11:17] the open meeting will resume at 5 45 45.
[1:11:23] okay would somebody uh care to second
[1:11:25] that motion exactly
[1:11:26] councilman mccarty seconds any further
[1:11:29] discussion
[1:11:30] hearing none all those in favor say aye
[1:11:32] all right
[1:11:34] motion carries we're back in executive
[1:11:36] set
[1:11:44] okay
[1:11:46] we're now back in open session and again
[1:11:49] would like the record to reflect that no
[1:11:51] action was taken during executive
[1:11:54] session
[1:11:56] at this time
[1:11:58] on our agenda
[1:12:01] we would like to go back to
[1:12:05] talking about the
[1:12:08] replacing our chief of police with chief
[1:12:10] kenning's retirement
[1:12:12] and
[1:12:14] we have uh
[1:12:16] we have asked that
[1:12:19] board members
[1:12:21] city council members assist mr stiles in
[1:12:24] the interview process of candidates for
[1:12:26] the position of chief of police
[1:12:29] and
[1:12:30] those two uh council members will be
[1:12:33] councilman mccarty and councilman lowen
[1:12:36] will assist city administrator styles
[1:12:39] in the interview process for candidates
[1:12:41] for chief of police city of hillsborough
[1:12:47] okay
[1:12:49] now we're on to uh item h board
[1:12:51] appointments
[1:12:52] there are no board appointments today
[1:12:55] and so we are on to sydney
[1:12:57] administrator's report mr stiles
[1:13:00] okay uh so a couple things kind of
[1:13:03] interesting things to talk about uh arpa
[1:13:05] money uh we talked about that we're
[1:13:07] receiving four hundred and twenty seven
[1:13:08] thousand two hundred and five eighty uh
[1:13:11] split over two payments so we've got in
[1:13:13] the first half of that uh the clearest
[1:13:15] use of those funds and you know probably
[1:13:17] the most direct uses for water and sewer
[1:13:20] but another category is revenue
[1:13:22] replacement
[1:13:23] and the league of municipalities and gfo
[1:13:25] a which is government finance officers
[1:13:27] association released some worksheets to
[1:13:29] help determine what else revenues may be
[1:13:31] eligible i haven't done the gfoa one yet
[1:13:34] but i have done the lkm1
[1:13:37] and they're showing a revenue loss we
[1:13:39] could claim a revenue loss of up to 143
[1:13:42] 645 dollars
[1:13:46] get that gfoa one to finish as well so
[1:13:49] what that means is you know we talked i
[1:13:51] talked a little bit with kimberlyn about
[1:13:53] this and um it would be appropriate to
[1:13:55] use this football obviously the most
[1:13:57] direct is still today for water and
[1:13:58] sewer projects but
[1:14:00] if you wanted to look at using that as
[1:14:02] revenue replacement those those funds
[1:14:04] could be taken and used
[1:14:06] as revenue replacement so they could go
[1:14:07] into the general fund and do other
[1:14:09] things
[1:14:10] like taking down our building that we're
[1:14:12] talking about purchasing or
[1:14:14] the spray park or you know whatever
[1:14:16] other projects you find worthy
[1:14:18] for that revenue replacement so no need
[1:14:20] to make a decision at this point we
[1:14:22] still have a bit of time
[1:14:24] several years before we actually have to
[1:14:26] finish it but just wanted to let
[1:14:28] everyone know that that is an option
[1:14:29] based on what we've seen and the
[1:14:31] guidance that we've got out of the
[1:14:32] treasury so
[1:14:35] that is that is an option
[1:14:37] for the money
[1:14:39] you said received in two payments
[1:14:41] there's nothing with having to have
[1:14:43] spent some of this before you receive
[1:14:46] the second payment now you have to have
[1:14:48] it uh spent for uh two years after you
[1:14:51] receive the last payment so
[1:14:53] there are reporting requirements and
[1:14:54] those actually just got deferred for
[1:14:56] non-government non-entitlement entities
[1:14:58] um to the end of this year so
[1:15:02] or into next year excuse me so you know
[1:15:04] there's no requirement to having spent
[1:15:08] it by the time you get the second half
[1:15:14] uh 128 south main uh ongoing bankruptcy
[1:15:17] case on that building and so it's being
[1:15:19] reviewed
[1:15:21] kimberly's been monitoring that and it
[1:15:23] sounds like it's gone to another
[1:15:24] bankruptcy person kimberlyn actually
[1:15:27] left me a message today so i don't know
[1:15:29] all the details having a chance to put
[1:15:31] up people
[1:15:32] yeah please too
[1:15:34] the there's a new bankruptcy proceeding
[1:15:36] went from my chapter 7 to chapter 13
[1:15:38] which means we have a new trustee that
[1:15:40] we're working with um i spoke with the
[1:15:42] trustee today and he is going to look
[1:15:44] over all the documents that
[1:15:47] the enforcement officer provided
[1:15:49] regarding 128 south main and
[1:15:53] also
[1:15:54] the
[1:15:55] just just the transaction as a whole and
[1:15:57] see if the bankruptcy court will allow
[1:15:59] the city to purchase the property
[1:16:01] on what they will allow um so we're
[1:16:03] hopeful i'm hopeful to hear back in the
[1:16:05] next week
[1:16:08] okay
[1:16:10] excellent
[1:16:11] uh another code enforcement issue we've
[1:16:13] got is one on one south mains the radio
[1:16:15] shack quickbooks building uh there's an
[1:16:17] open case on that it was supposed to be
[1:16:19] heard uh we actually had to postpone
[1:16:21] municipal court because uh uh kova
[1:16:24] there's a code issue
[1:16:26] with some of the folks involved and so
[1:16:28] we had to postpone court so it'll be
[1:16:29] picked back up in november again on that
[1:16:33] the judge municipal judge asked us the
[1:16:35] city to solicit bids to correct all the
[1:16:37] code issues that were noted on the
[1:16:38] commission are important so we're in the
[1:16:40] process of doing that
[1:16:42] housing resource commission
[1:16:44] we had a grant application we were
[1:16:45] putting together for that and that
[1:16:47] determined when we were doing that that
[1:16:48] we're really not a strong candidate for
[1:16:50] this year's round
[1:16:52] they're really focusing on rural housing
[1:16:54] incentive districts this round and then
[1:16:56] partnerships which we don't we have we
[1:16:59] have kind of a loose partnership with a
[1:17:00] potential developer but we don't have it
[1:17:02] nailed down to the fact
[1:17:04] to the point where i felt like we had a
[1:17:05] really strong application
[1:17:08] and sometimes it matters if you're a
[1:17:10] first time applicant or not
[1:17:13] and so made to make the decision not to
[1:17:15] submit that as it was written because it
[1:17:17] just didn't feel like we'd be super
[1:17:19] competitive on this round but we will
[1:17:22] retool that and develop it a little bit
[1:17:24] more and then go to another grant round
[1:17:26] and there's another grant coming up in
[1:17:27] the next few months that we can actually
[1:17:29] participate in too so
[1:17:31] hopefully we'll get some of that moving
[1:17:33] forward
[1:17:34] uh sales tax receipts you got the sales
[1:17:36] tax receipts there for you to take a
[1:17:38] look at
[1:17:40] august sales we're back up to seven
[1:17:43] thousand nine hundred seventy six
[1:17:44] dollars and sixty two uh sixty two cents
[1:17:47] it's the highest year so far um total
[1:17:49] for the year is over six hundred and
[1:17:51] twenty four thousand uh which is higher
[1:17:54] twenty one percent higher than it was
[1:17:56] last year and then when you look at the five year average before that it's
[1:18:00] 30 higher so it continues to stay in
[1:18:02] pretty healthy range which is always a
[1:18:04] good thing um
[1:18:07] so we're going to continue to monitor
[1:18:08] that continuing report back out on it so
[1:18:11] um also wanted to report on the dates
[1:18:14] for uh retirement parties for
[1:18:17] uh both chief ken chief kenning and ed
[1:18:19] rickert another street department um
[1:18:23] chief kenning is gonna be on the 15th
[1:18:25] and that usually those usually happen
[1:18:27] from 4 to 6 p.m um we'll have a formal
[1:18:30] announcement that goes out on that one
[1:18:32] and then ed was we're looking at the
[1:18:34] 22nd
[1:18:35] same kind of situation we'll let you all
[1:18:36] know when when those happen so
[1:18:39] always good to celebrate those and of
[1:18:40] course gary gary andrews will be coming
[1:18:42] up here too um and then we may have
[1:18:44] another one actually on the horizon as
[1:18:46] well but
[1:18:49] just part of the turnover here in the
[1:18:50] city everybody's getting to that point
[1:18:52] where they can retire so never fault
[1:18:54] them when they can do it baby boomers
[1:18:58] like the front office
[1:19:01] we are making our way through that one
[1:19:03] barney
[1:19:04] i heard uh it uh had a kpp function uh i
[1:19:08] heard what we've experienced referred to
[1:19:11] as the silver tsunami
[1:19:15] yeah
[1:19:16] that might be right all right yeah
[1:19:18] okay
[1:19:19] any questions for mr styles
[1:19:23] okay
[1:19:24] council comments councilman gearing
[1:19:27] i'm just happy to see that um
[1:19:29] constituents are spending their tax
[1:19:31] dollars in hillsboro
[1:19:33] it's a good
[1:19:34] thing yeah
[1:19:36] true
[1:19:37] councilman mccarty uh
[1:19:39] i uh
[1:19:40] listened to mr meyer's comments and
[1:19:43] i'm gonna do some research i wrote his
[1:19:46] editorial to marion paper and he said
[1:19:48] some things in there i never really
[1:19:50] thought about the time so
[1:19:51] i'm going to do a little research and i
[1:19:53] would like to readdress that sometime
[1:19:55] what we did if that's okay okay
[1:20:00] councilman
[1:20:03] just no comment at this point
[1:20:05] okay
[1:20:06] nothing today for me okay
[1:20:09] all right is there any other business
[1:20:10] that needs to come before the council
[1:20:15] hearing none
[1:20:16] meeting is adjourned
[1:20:23] thank you everybody for your
[1:20:25] participation
