[0:00]
Well, good afternoon everybody, and welcome to the Holiday City Planning Commission work meeting.
[0:05]
Tuesday, May 29th, 2026 It's 5:32 PM and we have all commissioners in attendance except for Commissioner Font.
[0:14]
And we have city staff and legal council president and we have two items on our agenda, well, three.
[0:22]
Correct me if I'm wrong.
[0:23]
There were no minutes to read.
[0:26]
Nobody had any minutes to read, so we will.
[0:29]
Table that one until.
[0:32]
We get a chance to look at them.
[0:36]
They're they're out there and we will look at them at some point. Tonight was not the night.
[0:41]
So.
[0:44]
That's it. Oh, and Commissioner fonts coming in right now. Hey.
[0:48]
So full team. All right, here we go. And the first one is the continued.
[0:54]
Item we had from last time, which was the Lewin accessory building and I believe we left the public comment on that open. Is that
[0:58]
right?
[1:04]
And continued, OK.
[1:07]
Yes, he did. So John, if you want to give us.
[1:09]
Refresher or carry?
[1:11]
Yeah.
[1:14]
So for conditional use permits for accessory buildings you've seen.
[1:18]
These types of applications before.
[1:21]
Essentially.
[1:24]
There's a.
[1:25]
Table of allowed uses.
[1:27]
They can build an accessory building.
[1:30]
Up to a certain size that can be approved by staff.
[1:34]
They can't exceed.
[1:35]
That footprint size, if they have a large piece of property or whatever.
[1:38]
Conditions they may present.
[1:41]
But.
[1:42]
There may be conditions that need to be applied by the Planning Commission.
[1:47]
Based upon type of architecture, buffering, landscaping.
[1:51]
Those types of things. Lighting.
[1:53]
That may.
[1:54]
Cause problems when you're.
[1:55]
Building footprint large.
[1:57]
Than what's permitted.
[1:59]
In this case.
[2:00]
The building's already built.
[2:03]
You have some non conforming setbacks on the South side.
[2:06]
And I like to convert this building into an AD.
[2:10]
Last year, maybe it was a.
[2:12]
Year before.
[2:14]
You approved some external accessory dwelling unit standards that allows for this type of situation to occur if there's non
[2:18]
conformities.
[2:22]
They can.
[2:23]
Elect to have some conditions that buffer that or mitigate that.
[2:29]
The applicant has provided you a narrative of what they plan to do.
[2:33]
To make sure that.
[2:34]
Sound buffering and some landscaping.
[2:37]
Lighting things.
[2:39]
They were here.
[2:40]
Presented reasons.
[2:41]
Behind the external.
[2:45]
I'm pretty sure they'll come again.
[2:47]
Tonight.
[2:48]
But that's pretty much the extent of the application is.
[2:52]
Applying conditions so that it mitigates any adverse impact.
[2:56]
On the especially the neighborhood.
[2:57]
So that's where the non conforming set back is.
[3:01]
The use itself is not the condition.
[3:03]
It's the. It's the size of the building.
[3:06]
And its proximity to the South property line.
[3:10]
And there were.
[3:11]
Buffering requirement.
[3:12]
Requirements or.
[3:14]
Internal insulation requirements that were required as they.
[3:18]
Prepared that structure for dwelling, is that right?
[3:22]
No windows or doors on that South side.
[3:25]
Everything will be accessed from the opposite side.
[3:29]
So other than that, if there's any.
[3:31]
Other landscaping or other.
[3:34]
Fencing wall details that you deem appropriate.
[3:37]
Those are the type of conditions that could be applied.
[3:40]
And this is one of those cases where?
[3:43]
It's not so much that the building.
[3:46]
Is bigger than that. The structure is bigger than it should be.
[3:50]
It's that the set back is too small.
[3:53]
In this case.
[3:56]
And is it also non conforming for the lot size?
[4:00]
That would be.
[4:01]
That relationship is to the set back.
[4:04]
The lot size controls the set back, yes. OK.
[4:07]
Well, I if I memory serves, don't you have to have like a minimum of half acre in order to have?
[4:13]
And Adu on the property or am I dreaming that was a guest house?
[4:17]
Adus are allowed on.
[4:19]
All properties now. OK, yeah.
[4:21]
So even an R.
[4:22]
28 could have an Adu if it was small enough and work with setbacks only limited to single family home.
[4:29]
Take that back so single family house is on.
[4:32]
Whatever lot size.
[4:33]
Internal Adus.
[4:35]
Are allowed anywhere.
[4:37]
OK.
[4:39]
So is there a?
[4:42]
With the conversion from a garage to a.
[4:44]
Dwelling in it.
[4:46]
The structures in the set back.
[4:48]
Is there a fire code requirement that?
[4:51]
They have to rebuild that wall so that it meets fire code.
[4:54]
I appreciate the fire department being here just for this.
[4:57]
Great question.
[4:59]
During the review of the building permit, if the condition unit is, is.
[5:03]
Approved, Uh.
[5:04]
The building permit review.
[5:06]
From the fire department and the building.
[5:08]
Official will definitely have to require.
[5:11]
Fire separations to occur, so they can't have any openings in there if it's in.
[5:15]
Within the three foot set back correct?
[5:18]
I think it's.
[5:19]
5 Is it five or three?
[5:26]
Yeah, I think it's, I think it's fine. But yeah that that would be a requirement. OK. So it is in the set back. So that is a
[5:29]
question.
[5:33]
OK. All right. Thank you.
[5:36]
And for that same sort of.
[5:38]
Down that same line.
[5:39]
It is going.
[5:40]
Through getting a building permit so.
[5:44]
It makes me nervous that they've got a.
[5:46]
They're parking cars and grandma in the same building.
[5:49]
Which?
[5:50]
Was not designed for either.
[5:53]
So I mean I assume that.
[5:55]
It it would be have to be built to code I guess is the question.
[6:00]
That's what.
[6:01]
They are going for a building permit. That's what started this.
[6:06]
That's what starting is, converging from a utility use.
[6:09]
To a residential use.
[6:11]
So but.
[6:13]
In order to get there.
[6:14]
They have to get requests.
[6:15]
During the Planning Commission to exceed the size of it.
[6:18]
So you do approve it or you don't approve it tonight? They're still going to have to figure out how to architecturally.
[6:24]
Get compatibility with the building code to convert it from utility.
[6:27]
To residential.
[6:29]
OK, then I'll stop worrying about that. That's none of my damn business is a planting fish, but it's good to know this is this is
[6:34]
just their first step to get to a building permit.
[6:40]
OK, what about?
[6:42]
The driveway access itself, like I'm looking at the schematic up in front of us. Is there enough room for?
[6:49]
Do they have to have enough room for two cars to be able to get in and out?
[6:54]
No, not with.
[6:55]
There isn't a standard width for a driveway.
[6:57]
There is however a requirement in your.
[7:00]
Ordinance that requires a.
[7:01]
Garage so you can't.
[7:03]
Remove a garage without replacing one.
[7:05]
So they're.
[7:06]
This whole I think the whole building was a shop into two car garage.
[7:10]
So that reducing that down to a single car.
[7:13]
Which technically still complies.
[7:15]
But no, there's no width requirement for the driveway.
[7:17]
Gotcha. I was thinking.
[7:20]
Extra carbon monoxide detectors in there, right?
[7:25]
I'm a little bit troubled I.
[7:27]
If if they were building another building there.
[7:31]
They'd have to comply with the setbacks.
[7:34]
But because we're letting him convert it to an Adu.
[7:37]
The fact that they didn't comply with the setbacks.
[7:40]
Is ignored.
[7:42]
What was in order to begin with?
[7:45]
The the property owner moved into a situation that they have no history of.
[7:50]
Frankly, when we have that aerials pulled.
[7:53]
It was about the time when we incorporated this area.
[7:56]
Into the city.
[7:58]
So there's a lot of.
[8:00]
Masonry and other garage type structures within the city that have one foot.
[8:06]
2 foot setbacks that you were allowed by the county at the time.
[8:10]
And those were the specific types of scenarios that the Council and the Planning Commission, we were looking at conversions of
[8:13]
Adus.
[8:17]
We're considering.
[8:18]
In order to keep it.
[8:20]
Affordable.
[8:20]
Rather than having to tear the entire thing down just to gain 3 feet.
[8:24]
What can you do to mitigate that?
[8:26]
Three feet, so there's a table.
[8:28]
I saw Kerry bring it over once.
[8:31]
A table of allowed.
[8:33]
Situations to reduce.
[8:35]
A non conforming set back by certain percentages.
[8:39]
And I I think this is a section that.
[8:43]
The council specifically wanted so I'm not sure if.
[8:47]
Use the Planning Commission review this section. So that's why your.
[8:51]
Probably less familiar with it, or feels less familiar because.
[8:55]
You'd hadn't.
[8:57]
Seen that the portion where they were doing a conversion?
[9:01]
So specifically, it's this 0.8 conversion of existing accessory buildings.
[9:06]
Including nonconforming structures.
[9:09]
Is allowed with standards.
[9:11]
So it has to meet the same design standards.
[9:14]
So they'd have to modify things to make sure it meets those design standards for any detached accessory dwelling unit.
[9:20]
Here's your footprint size structures that don't conform to the footprint size.
[9:24]
Have to go to the Planning Commission, same as.
[9:27]
Any other non standard accessory building?
[9:30]
Structures that don't conform to setbacks.
[9:33]
Shall select set back reduction measures.
[9:36]
In this chart.
[9:39]
And then they can't add a second.
[9:41]
Story above. 12 beats.
[9:44]
So this is the chart.
[9:46]
So we were looking at this and.
[9:48]
Specifically.
[9:50]
As to assessing impacts.
[9:53]
So that was the logic behind this chart or what are the, what are the impacts?
[9:58]
From.
[9:58]
Now switching a building that is already there.
[10:01]
So the physicality of a of a structure already exists.
[10:05]
How can?
[10:06]
How can that?
[10:08]
Impacts from.
[10:09]
Now having that be.
[10:11]
Lived in.
[10:12]
Accessory dwelling unit.
[10:14]
How can those impacts be mitigated?
[10:16]
So.
[10:18]
And it's designed as.
[10:21]
We know that they have a non compliance set back.
[10:23]
So how much?
[10:25]
Reduction. Do they have to have? In this case they have to reduce by.
[10:30]
Like 0.75 feet or is it a full foot?
[10:34]
It's no, it's a full foot.
[10:36]
Of wholefoot, so they're looking for reducing a foot of their setbacks so that they can.
[10:43]
Be compliant.
[10:44]
So it's, it already exists. It already has an.
[10:47]
Client set back.
[10:48]
So they have to do some extra stuff.
[10:51]
To get that.
[10:53]
The impact of that close set back.
[10:56]
Reduced.
[10:58]
So they were proposing this upgraded.
[11:01]
Energy efficient materials and constructions.
[11:05]
Or construction materials.
[11:06]
To reduce sound specifically on that wall.
[11:10]
Which theoretically could allow them to reduce.
[11:13]
100% of their setback, but that's not what they're going right. So that's looking at we looked at.
[11:19]
The masonry type of construction that that John was referring to were some of those have 0 setbacks, so.
[11:26]
If you're.
[11:27]
Going to the.
[11:29]
Sometimes substantial cost of doing those energy efficient upgrades and sound reducing upgrades.
[11:37]
Because converting an existing structure sometimes is more costly than.
[11:41]
Tearing it down and building new in some cases so.
[11:44]
It's it was a.
[11:47]
Something that was assessed to be.
[11:49]
High impact.
[11:50]
To reduce.
[11:51]
Some of the the major concerns with.
[11:54]
Having an accessory dwelling unit that close.
[11:57]
And in this case, I think their garage is on.
[12:00]
One size, so they're retaining the garage on the.
[12:03]
Close side for the front part of it and then on the back part is where they have living space.
[12:09]
So is there only one garage?
[12:12]
A2 car garage for the.
[12:14]
Both homes.
[12:16]
There's a garage and I don't know that it has a car in it, but there's a garage in the front building also.
[12:22]
A single car garage. Or at least there's a single car garage door on the front building.
[12:28]
OK.
[12:30]
Yeah, that dimension on that on the floor plan on your screens.
[12:33]
I think is only as wide as the first single car garage.
[12:39]
You know, Carrie made a really great point. This is this chart when when it was adopted.
[12:43]
Was something that we counted toward.
[12:46]
Our state requirement for moderate income housing.
[12:49]
Allowances.
[12:52]
In order to reduce that.
[12:53]
That cost of getting an accessory dwelling unit on the property.
[12:59]
And we have carte blanche to.
[13:01]
Impose what's necessary to.
[13:03]
Mitigate.
[13:05]
Yeah, if you find.
[13:07]
Conditions that need to be mitigated.
[13:09]
Then you can.
[13:10]
Impose the conditions. Nothing less than two inch granite will be acceptable.
[13:18]
I'm just kidding.
[13:19]
I know, Brad. Just to be clear, it's not carte blanche.
[13:24]
Reasonably.
[13:25]
Read all that, man. Reasonably anticipated.
[13:29]
Detrimental effects can mitigated.
[13:31]
Reasonably.
[13:32]
Give me an inch, I take a mile. What can I say?
[13:34]
So our biggest issue is sound.
[13:38]
Your biggest issue is.
[13:40]
How to mitigate the?
[13:43]
It can be any one of those.
[13:45]
What they're selecting sound.
[13:49]
And they said down there.
[13:50]
Back while they were going to put in a window, but it was going to be on the like larger.
[13:56]
Part of it is that right? Like not right up against the fence part of it.
[14:01]
Yeah.
[14:05]
OK. Other questions on this one.
[14:09]
I just I wasn't here last time. Why was this continued?
[14:13]
We had a.
[14:14]
Oh, OK.
[14:16]
Yeah, yeah.
[14:18]
All right. And then.
[14:19]
Wasatch Waldorf amended site plan.
[14:24]
Which this is a school and if.
[14:26]
I read the packet right.
[14:27]
We really don't get to say anything at all to schools.
[14:31]
You can.
[14:33]
But they can still do it anyway.
[14:35]
Well, yeah, I mean.
[14:38]
So.
[14:40]
As you just as an overview you do.
[14:42]
Are well municipalities are empowered with certain regulatory powers.
[14:48]
And those regulatory powers can be.
[14:51]
Extended to certain applications.
[14:54]
Except when it's another subdivision of the state.
[14:57]
Schools and charter schools.
[15:00]
State code has some provisions that are very.
[15:03]
Very specific, in particular as to how you act.
[15:07]
As a land use body.
[15:09]
Regulatory body when these types of things are.
[15:11]
Being brought to you.
[15:13]
We went through this.
[15:16]
Exercise in 2016 when the when the school was placed.
[15:21]
And I've included the approval letters from that meeting.
[15:25]
In your packet.
[15:27]
They have received approval from the state.
[15:30]
Increase their student body.
[15:32]
From 5.
[15:34]
Numbers aren't in my head. 520 here to like 600.
[15:39]
And in doing so, they want to add a gymnasium to the back of the school.
[15:42]
Construction.
[15:43]
Is reviewed by the State Building authority.
[15:47]
With State Building officials and inspections, so we will not be involved in the.
[15:51]
The construction inspection process.
[15:54]
We can look at.
[15:55]
Things like set back and massing.
[15:58]
Which?
[15:58]
Because of the placement of the of.
[16:01]
The addition to the school does meet the P zone setbacks anyway.
[16:06]
Really what we're looking at.
[16:08]
Are things that we can regulate.
[16:10]
Health and safety, Traffic circulation.
[16:13]
And parking requirements.
[16:16]
They are increasing the student body, which they're going to be adding.
[16:19]
Teachers. Faculty.
[16:20]
So that increases the parking requirement.
[16:23]
One of the TRC requirements for that.
[16:26]
Was to solidify a pre arranged parking agreement with the LDS church.
[16:31]
Located.
[16:32]
North across the street.
[16:35]
They are supposed to come to you tonight with.
[16:39]
That written agreement?
[16:41]
I was told that they were reviewing that agreement.
[16:44]
I'm expecting them to have it.
[16:47]
Tonight if they don't.
[16:48]
I'll get to that in a minute.
[16:51]
The second scenario, so that deals with.
[16:54]
On site.
[16:55]
Requirements.
[16:57]
Yes.
[16:58]
You mean the church?
[17:00]
Not directly across the street, but is.
[17:04]
Like across the street and then an island and then a street, yeah.
[17:08]
OK. Just making sure.
[17:10]
Maybe it was before.
[17:11]
Summer before last, we constructed a pedestrian.
[17:14]
Active pedestrian activated crosswalk.
[17:18]
Specifically for the situation, they had so much parking and they were.
[17:22]
Walking, jaywalking essentially. So we tried to help them with that situation.
[17:26]
And I think the school was very appreciative.
[17:29]
Of that.
[17:31]
So what we were requiring is ensuring that there's still parking.
[17:35]
That is being provided off site.
[17:37]
And not.
[17:38]
In the streets or in the neighborhoods or in the in the.
[17:40]
Park itself the Creekside.
[17:42]
Park Regional Park.
[17:45]
The other situation would be traffic circulation.
[17:48]
Pick up and drop off times.
[17:50]
Were something that we reviewed extensively in 2016.
[17:55]
And modified over.
[17:57]
Several months after they opened.
[18:00]
Because of the if you've been up Murray Holiday Road at the time.
[18:04]
That school starts and then when school ends.
[18:08]
There was a problem with cars backing up all the way to almost to the intersection.
[18:13]
In the travel lanes.
[18:15]
So through UPD.
[18:17]
And their.
[18:20]
Principal who I think will definitely be here tonight.
[18:24]
They modified their pickup and drop off locations to shorten that.
[18:28]
Queuing line.
[18:29]
It's been working great the past few years.
[18:32]
But adding faculty and student body want to make sure that that doesn't get exasperated.
[18:38]
So in order to accommodate the.
[18:41]
Is the.
[18:43]
Pick up and drop off lanes that runs around the backside of the property that also serves an emergency access.
[18:48]
Road. We reviewed this road.
[18:52]
Because of its proximity to the Big Cotwood Creek.
[18:55]
We related that.
[18:56]
The review of that road to the Creek based upon.
[19:00]
Integrity of.
[19:01]
Have become a Creeks bank.
[19:03]
And flood control.
[19:05]
We want we are ensuring that through this site plan that no.
[19:09]
The curbside doesn't get any closer to the Creek than it actually is.
[19:13]
And you'll see in the drawings it just gets lengthened.
[19:16]
It goes in line with the existing driveway back further on the site so.
[19:20]
TRC is satisfied that we're not getting any closer to Big Conway Creek than has already previously approved.
[19:27]
However.
[19:28]
Because it's also emergency access Rd.
[19:31]
The width of that road.
[19:32]
Needs to be wider than what this originally.
[19:36]
Built and in this situation is one of the reasons why.
[19:41]
I've invited our.
[19:43]
Fire Marshall Area Fire Marshall David Bradley to join us to give.
[19:47]
An overview of what specific?
[19:50]
Concerns that.
[19:51]
UFA has, especially with the state Fire Marshall office.
[19:55]
So.
[20:02]
Good evening.
[20:04]
With this road.
[20:06]
With the proposed plans that they're asking to put on a gymnasium.
[20:09]
On the backside of the building.
[20:11]
The size of the structure is going to be 13,000 square feet.
[20:15]
More than likely, because it's a gymnasium, it's going to be over 40 feet tall.
[20:19]
With our aerial apparatus we need at least a 26 foot wide Rd.
[20:23]
In order to be able to set up our aerial apparatus.
[20:27]
They are proposing only.
[20:29]
20 feet.
[20:30]
Which would put our outriggers for our emergency vehicles.
[20:34]
In the dirt, which would not.
[20:36]
Help us be able to do that.
[20:38]
And also.
[20:40]
With it being that far back.
[20:42]
They are proposing to move a hydrant.
[20:45]
Further away from that new.
[20:47]
Construction.
[20:48]
I've been in contact with the state Fire Marshall's office.
[20:53]
Because all schools.
[20:55]
Go through their jurisdiction.
[20:56]
And they want to have final say on what's going on.
[21:00]
I've talked with Reed Thompson.
[21:02]
He didn't know about.
[21:04]
These plants, they said that Wasatch has communicated with them.
[21:07]
But hasn't presented anything.
[21:09]
To them for review.
[21:12]
So when I got this information, they're saying, well, what do you feel? How do you feel about it?
[21:17]
We just don't want to have.
[21:18]
Them playing mom against dad.
[21:20]
Saying well, the authority having jurisdiction said that this.
[21:24]
State Farm Marshall.
[21:25]
You're saying that?
[21:26]
We want to make sure that we are on board.
[21:29]
With the State Farm Marshall's office and not crossing any.
[21:32]
Jurisdictional.
[21:35]
The other issue that we have is where they want to move some of their.
[21:39]
Outbuildings further up along the side of the building would also reduce.
[21:43]
That emergency access.
[21:45]
On the West side of the building.
[21:47]
That has been presented.
[21:50]
To the TRC.
[21:51]
I've also relayed that to the State Fire Marshall's office.
[21:55]
And before they go any further, they want to make sure.
[21:58]
State Fire Marshall's office has stated that.
[22:01]
They want Wasatch to understand.
[22:03]
Before they go any further.
[22:04]
They need to meet with the State Farmers Office to make sure that.
[22:07]
Everything is in line.
[22:09]
Before any kind of construction happens.
[22:12]
With the road or with the building?
[22:14]
Is it safe to say that?
[22:17]
Your office and the State Fire Marshall's office are aligned.
[22:22]
In our in the.
[22:24]
The needs and.
[22:25]
That is 100% requirements OK.
[22:28]
Thank you for making that effort.
[22:30]
Get all the ducks in a row ways.
[22:32]
There's there's been many times that.
[22:35]
We've seen.
[22:37]
Well, this person has said this, this person has said that and their odds to the code.
[22:41]
And with.
[22:43]
Building with these many people.
[22:45]
We want to make sure that we.
[22:47]
Are protecting the citizens that we serve.
[22:50]
Thank you. Thank you. I'm just.
[22:53]
Say it again. You said that.
[22:54]
The for that height.
[22:56]
The minimum Rd. width is 252626.
[22:59]
Thank you. I know that they.
[23:01]
Put their scale on on the bottom of.
[23:03]
Plans and so it's close.
[23:05]
But that's also including the.
[23:08]
So when we start putting out our outriggers, we would crush the curb or be.
[23:12]
Slipping off the curb.
[23:13]
OK. Thank you.
[23:14]
Is there a danger to the?
[23:16]
Creek if you were to put your outriggers out in the dirt.
[23:20]
For example.
[23:22]
No, it just puts our apparatus.
[23:24]
And our personnel at risk.
[23:26]
Which is even worse than than the Creek.
[23:30]
OK.
[23:31]
So.
[23:32]
Yes, Sir, along that line.
[23:36]
We wouldn't.
[23:38]
You wouldn't want to see us approve a.
[23:42]
A site plan that didn't include a 26 foot clear.
[23:46]
Rodeway around the entire.
[23:49]
Building his act.
[23:50]
Am I understanding correctly that is correct?
[23:53]
But before.
[23:54]
And this is something that I think is.
[23:56]
Vital for them to understand is that needs to come from the state Fire Marshall's office.
[24:01]
Not just unified fire authority.
[24:04]
So that way.
[24:05]
When they present everything to you.
[24:09]
It's just not well. The city planners agreed to doing this.
[24:13]
But yet they're not meeting the codes and I want to make sure that the state fire marshals.
[24:18]
Have an opportunity to make their comments.
[24:20]
And they're reviews.
[24:22]
To the school so that they completely understand.
[24:25]
What is?
[24:26]
Their responsibilities.
[24:28]
For protecting the property and.
[24:30]
Makes sense?
[24:33]
In terms of moving a fire hydrant, that sounds.
[24:36]
Drastic. I wouldn't think moving a hydrant away from a structure would be a good idea.
[24:41]
It depends on.
[24:43]
Where the hydrant is placed.
[24:46]
Looking at what they're wanting to do is they want to move it.
[24:48]
Further up the side of the building, away from the construction a little bit, that gives.
[24:53]
More access.
[24:55]
When we start laying out our hoes.
[24:57]
But what we're looking at is we don't want to lay out that much house most of our.
[25:02]
High velocity of.
[25:03]
For high volume hoses.
[25:05]
Or five inches in diameter and once they get full you can't move them.
[25:09]
So instead of moving it.
[25:11]
Further to the north and on the.
[25:13]
Other side, we'd like to have at least moved back closer.
[25:17]
To where we could set up and actually work the fire a little bit better.
[25:20]
On the structure.
[25:23]
And one more question just trying to think through.
[25:26]
What their options might be?
[25:28]
Is it possible that sections of the road could be?
[25:31]
You know, 26 feet or wider and there are narrower sections or.
[25:35]
Or logistically, actually, the whole Rd. needs to be.
[25:40]
Wider, I have seen both.
[25:42]
And yes.
[25:43]
The minimum would be 20 feet wide.
[25:46]
But the issue that we see.
[25:48]
Is.
[25:49]
The road is 20 feet here and then widened to 26 feet.
[25:53]
But that 20 foot section?
[25:55]
Falls into disrepair.
[25:57]
And so now that 20 feet now becomes 15 feet and as we drive through that area.
[26:03]
Now it is unstable. Or if we do have to set up.
[26:05]
In that location.
[26:07]
We have to move our apparatus to a different location.
[26:10]
Further away from where we might need to be so having it all.
[26:14]
26 feet wide makes it.
[26:19]
For apparatus usage along the whole side of the building.
[26:23]
Thank you.
[26:23]
Unless they know which part of the buildings ablaze. Right, Exactly.
[26:28]
Only light fires.
[26:32]
Any other questions?
[26:35]
I just had one other thought.
[26:37]
So we have two key issues.
[26:40]
The fire issue and the agreement neither which we have.
[26:44]
At 6:00.
[26:45]
Before the meeting.
[26:46]
So that was one of the the amendments when I send the packet to you.
[26:50]
To amend the site plan.
[26:52]
These comments were sent to the applicant.
[26:56]
Three weeks ago.
[26:58]
And presuming when we received back these new drawings.
[27:01]
It would have the 26 foot white Rd. on there. They do not.
[27:05]
And they still don't have an agreement, so they're going to ask to defer.
[27:10]
These items that are high of high level review for the TRC.
[27:15]
It's up to you.
[27:16]
But I think as we learn from UFA, we'd rather have.
[27:19]
Those agreements in place and.
[27:23]
Very, very clearly shown on site plans that we're reviewing.
[27:26]
Rather than leaving it to staff.
[27:29]
Which we can definitely bird dog for you, absolutely.
[27:32]
But umm.
[27:34]
I think there's some steps that the staff took to ensure that this application is before you in a timely matter.
[27:40]
They're going to mention that they need to have this gymnasium.
[27:44]
Built and constructed for a next school year.
[27:48]
So that's one of the reasons why you were here in front of it. It's in front of you now.
[27:53]
But I think it's prudent to ensure safety and welfare just for the very small sections of.
[27:58]
State codes were allowed purview.
[28:01]
That we do our.
[28:01]
Response Her due diligence.
[28:04]
I don't want to speak on behalf of the Commission, but it wouldn't hurt my feelings to.
[28:08]
Continue it and.
[28:09]
Have everything come back?
[28:11]
Fully in order before we.
[28:13]
Put a signature on anything.
[28:16]
Just my train of thought though.
[28:19]
So I know our attorney would love to read the agreement and that and someone will want to analyze their final plan and that.
[28:30]
Let's see what they bring but.
[28:32]
Right. Yeah. We'll see what the applicant has for us here in a couple minutes.
[28:37]
One quick question if I may. As far as fencing requirements, I mean this is up adjacent to the Frisbee park.
[28:43]
Right. Umm.
[28:46]
Is there any kind of?
[28:47]
With schools in general.
[28:51]
Security.
[28:53]
That needs to be in place along.
[28:55]
That east or.
[28:57]
Southern.
[28:58]
Part of it.
[28:58]
Because it looks like.
[29:00]
The I don't know whatever a whole of the Frisbee park is right where they're planning to put the gym.
[29:06]
Yes, however.
[29:09]
We kind of.
[29:11]
Bridge, so to speak.
[29:12]
And 10 years ago.
[29:15]
State code uses the word.
[29:17]
Municipality may not impose requirements for landscaping, fencing, aesthetic consideration that goes on and.
[29:24]
Unless you have a very specific.
[29:26]
Objective.
[29:27]
Tie to health and safety.
[29:31]
It's very difficult, it would be very difficult to impose that regulation.
[29:35]
I have had conversations with the principals over the years and the interaction with the Frisbee Park players.
[29:41]
She says.
[29:42]
Other than.
[29:43]
Couple of students being hit by a stray frisbee.
[29:46]
And those that land on the roof.
[29:47]
There really hasn't been any.
[29:48]
Problems.
[29:50]
OK, I just.
[29:52]
My my wife's a principal.
[29:53]
For not a charter school, but one of the you know.
[29:57]
State districts and.
[29:59]
Like.
[30:00]
Security is a big deal in fencing is a big deal, so that's why I just.
[30:05]
Kind of curious on that when I look at this big open space where any rando can just walk right in.
[30:10]
Yeah, but OK.
[30:12]
If that's if that's them, that's them, they'll figure it out.
[30:18]
All right, great. And other questions about this one?
[30:22]
OK. All right.
[30:25]
Well, with that.
[30:28]
We will conclude the work meeting and.
[30:32]
Do we want?
[30:33]
Anyone need a quick break or we get to just roll right into the regular?
[30:38]
All right, ready.
[30:40]
Carrie, we're ready.
[30:41]
All right, here we go. Well, good evening, everyone. Welcome to the Holiday City Planning Commission.
[30:46]
Meeting Tuesday, May 19th.
[30:48]
2026.
[30:50]
We have two items on the agenda and the third is going to be moved for a future meeting because we did not get the meeting
[30:54]
minutes.
[30:59]
And so with that.
[31:02]
It looks like we might have a couple members of the public that are here tonight and I have asked.
[31:08]
Vice Chair Prince, if she would go ahead and read that for us now.
[31:12]
The City of Holiday Planning Commission is a volunteer citizen board.
[31:16]
Whose function is to review land use plans and other special studies.
[31:21]
Make recommendations to the City Council on proposed zoning map and ordinance changes.
[31:26]
And approve conditional uses and subdivisions.
[31:30]
The Planning Commission does not initiate land use applications.
[31:34]
Rather, acts on applications as they are submitted.
[31:37]
Commissioners do not meet with applicants except at publicly noticed meetings.
[31:43]
Commissioners attempt to visit each property on the agenda.
[31:46]
Where the location? The nature of the neighborhood?
[31:49]
Existing structures and uses related to the proposed change are noted.
[31:54]
Decisions are based on observations, recommendations from the professional planning staff.
[32:00]
The city's general plan.
[32:02]
Zoning ordinance and other reports.
[32:04]
By all verbal and written comments and by evidence submitted.
[32:08]
All of which are part of the public record.
[32:11]
Thank you very much, Vice Chair.
[32:13]
And with that, we will roll into the.
[32:18]
First item that we have on our agenda, which is a continued.
[32:22]
Public hearing for the Lewin Accessory Building.
[32:26]
And if city staff wants to give us a quick overview of that.
[32:37]
Thank you, Chair Roach.
[32:39]
Yeah, As you mentioned, this is a continued public hearing and I do want to publicly apologize for the the applicants for delaying
[32:43]
this for them.
[32:47]
We did have an issue with.
[32:49]
Noticing.
[32:50]
We want to ensure that we have give proper notice the state requires.
[32:55]
So that necessitated.
[32:56]
Continuing this application.
[32:59]
The first item.
[33:01]
For consideration as a request for conditional use permit at.
[33:04]
5755 E Minden Drive.
[33:07]
The conditional use relates to.
[33:10]
The building's footprint?
[33:13]
There are permitted footprint sizes that are allowed by city ordinance.
[33:17]
Alternatively, if an applicant is looking to exceed those permitted footprint sizes, that conditional use permit can be sought.
[33:24]
And approved by the Planning Commission.
[33:26]
In this situation, the building under review is already constructed.
[33:31]
It does have some non conforming setbacks on the South side.
[33:34]
Which?
[33:36]
One of the other.
[33:37]
Considerations that the.
[33:38]
Planning Commission has requested a review tonight.
[33:42]
Other than the comments that I provided.
[33:44]
Our work meeting.
[33:45]
I'll be able to detect and take any other additional questions that the Planning Commission might have.
[33:52]
Questions for city staff.
[33:55]
All righty. And I don't think we need to invite the applicant up because they were here last time.
[34:01]
For members of the public, this is a continued hearing.
[34:05]
And if you did not get a chance to speak on it then the last meeting and wish to speak on it tonight, you're welcome to come to
[34:08]
the podium.
[34:11]
We just ask that you state your name and address for the record.
[34:15]
And that you try and keep comments to 3 minutes or less.
[34:18]
And with that, are there any members of the public that wish to speak on this item tonight?
[34:25]
All right, looks like.
[34:27]
Not tonight.
[34:28]
With that, we'll go ahead and close the.
[34:31]
Public hearing for this and commissioners.
[34:35]
Any additional?
[34:37]
Questions for staff, the applicant or discussion points before a motion is entertained on this.
[34:46]
On this footprint.
[34:47]
Is there different sizes that we're considering?
[34:50]
Maybe I'm confused.
[34:52]
Because I see in the motion.
[34:53]
That you have to give a footprint size.
[34:57]
So, John, maybe?
[34:59]
You can help us because there's a lot of blanks on the.
[35:01]
The motion.
[35:02]
Let's see, Hang on one second.
[35:16]
So you're talking about.
[35:18]
Yeah. So if I can help you fill in those blanks, I.
[35:22]
The the first one.
[35:24]
I obviously as the applicant itself.
[35:26]
The footprint is your.
[35:30]
Hang on, let me get through the staff report here.
[35:37]
So 850 square feet.
[35:41]
Would be the the footprint that you're looking to review?
[35:44]
And then the non conforming set back would be the four point.
[35:48]
I think 7 five feet on the South side.
[35:51]
In the R110 zone. Sorry, I didn't realize that those were not filled in for you.
[35:55]
It's OK, I just thought.
[36:02]
All right. Great question.
[36:04]
And.
[36:05]
With that, do we have anyone that?
[36:07]
Has the motion up in front of them. I did not get a cough.
[36:32]
The square footage and just.
[36:34]
To clarify that on the the missing blanks there John, it was 850 square feet and then 4 foot setbacks.
[36:46]
Isn't the building.
[36:47]
Over the.
[36:48]
For the 850 square foot Mac.
[36:51]
So that's part of it.
[36:54]
Because it's at 1350, right?
[36:56]
It's here, 975 square feet.
[37:01]
Says that's the living space. You might want to clarify the size with the applicant specifically, I don't know if it's noted.
[37:09]
Anywhere in the staff report.
[37:11]
The applicant here tonight.
[37:13]
If you want to come up to the podium real quick, if you could help clarify for us on the square footage so we don't.
[37:19]
Hold YouTube.
[37:20]
The wrong size or?
[37:22]
Give you an unnecessarily large amount.
[37:25]
OK, yes, the existing structure is 13.
[37:29]
I have a 1300 and.
[37:31]
13 square feet.
[37:33]
And the reason we have 975 on the.
[37:37]
Plan is, that's the living space, because there's no.
[37:40]
Small one car garage in there as well.
[37:43]
And so it is over the end of.
[37:46]
Square foot maximum allowed.
[37:48]
But.
[37:50]
To use it as an Adu.
[37:52]
We have to.
[37:53]
Get the conditional use permit for that.
[37:56]
And I'll just ask you a question simply because you're still up here and I was not at the last meeting you as the owner or?
[38:04]
Comfortable with the mitigations that.
[38:07]
Are detailed in the staff report.
[38:10]
Builder. The owners are builder owner.
[38:13]
The whole gang is.
[38:15]
Comfortable with the yes.
[38:17]
The findings and.
[38:18]
The mitigations as described in the packet.
[38:22]
Yes, as long as I understand it correctly in the in the report, OK.
[38:26]
Thank you And question to city staff the.
[38:30]
The conditional use.
[38:32]
Only applies to the residential because the.
[38:35]
Garage cars already.
[38:37]
Permitted use.
[38:38]
It would be all together.
[38:40]
Yeah, it would be a building. So the 13.
[38:42]
Yes, 1313, so 13.
[38:44]
30 or 1350 is in staff report, Yeah.
[38:48]
850 square feet.
[38:51]
Is what's required to be permitted, and then it's over by 500.
[38:57]
But it's currently a 1313 is what you have it measured, 1313 is the number we're going with.
[39:04]
That's the question.
[39:06]
How big is this?
[39:07]
The structure is 1313 and then there is a four foot set back somewhere on there, right? Yes, OK.
[39:14]
I got the important numbers.
[39:16]
All right, perfect. Thank you very much.
[39:19]
I have a question for staff. So do we need to include any?
[39:23]
Like fire department?
[39:26]
Requirements or they? I know that's will be a part of the review.
[39:29]
But that they would have to up.
[39:32]
Date or.
[39:34]
Make modifications to.
[39:36]
Be able to meet that code because.
[39:37]
I don't think we're.
[39:39]
In the business of allowing variances on the building.
[39:42]
For the fire code.
[39:44]
You are not.
[39:45]
But if they could not.
[39:46]
Receive a building permit and the passing fire review, then the CUP would not be approved.
[39:51]
Yeah, OK.
[39:53]
So do we need to mention that in the approval or?
[39:56]
Is that already kind of?
[39:59]
It's implied. Implied.
[40:00]
When you when you look at like home based businesses, they need to go get a business license.
[40:05]
So if you're going to approve a conditioning permit for construction, they still need to get a construction permit.
[40:10]
So you can definitely put that in your conditions.
[40:13]
OK. Thank you.
[40:19]
It's got it all in one play.
[40:21]
OK, let me let me take a shot at this, all right? Yes. You're going, girl.
[40:25]
OK, I approved I I move to approve the conditional use permit application.
[40:30]
By the applicant.
[40:35]
By John Collier.
[40:38]
Umm.
[40:42]
For an accessory building footprint of.
[40:45]
1313.
[40:47]
Square feet.
[40:48]
Located at.
[40:50]
5755.
[40:51]
South Midland Drive.
[40:53]
Is that right?
[40:58]
In the R110 zone.
[41:01]
Based on the findings.
[41:02]
In the.
[41:03]
Staff report.
[41:05]
And.
[41:06]
Additionally, making explicit that all.
[41:08]
Fire code and building code.
[41:11]
Requirements would need to be followed.
[41:13]
In the future development of this.
[41:15]
Building.
[41:16]
And condition. We need conditions and the conditions. Oh yes.
[41:20]
Along with the.
[41:24]
Conditions.
[41:25]
For the conditional use permit.
[41:29]
That would allow the reduction of.
[41:32]
Set back.
[41:33]
Listed in the staff report.
[41:37]
This is Commissioner Prince IF.
[41:39]
Legal counsel gives me the nod that we got all the parts right. I will second that motion.
[41:45]
All right, well, let's call for a vote then.
[41:47]
Commissioner Cunningham.
[41:48]
Ay, Mr. Giovanni.
[41:50]
Aye, Mr. Font.
[41:51]
Commissioner Prince.
[41:53]
Aye, and Commissioner, Baron.
[41:55]
Aye, and Chair Roach votes aye. So with that.
[42:00]
Hopefully it turns out great.
[42:02]
And your mom has a wonderful place to live.
[42:06]
All right. And then moving right along.
[42:10]
We have the Wasatch Waldorf amended site plan.
[42:14]
And if city staff would like to.
[42:17]
Walk us through the recap of this one.
[42:24]
Thank you, Chair Roach.
[42:26]
Review for.
[42:27]
The amended site plan at 1458 E Murray Holiday Road for Wasatch Welller Charter School.
[42:34]
Is essentially.
[42:36]
Administrative.
[42:37]
Review of a permitted use site plan.
[42:40]
The amendment comes from a 2016 approval.
[42:44]
Yeah, 2016 approval.
[42:46]
That allowed the placement of the building and a parking requirements.
[42:51]
Access Rd. and other.
[42:53]
Physical emplacements on the site.
[42:56]
The amendment specifically for this application is to extend.
[43:01]
The the drive access Rd. around the backside.
[43:04]
To accommodate.
[43:05]
A new addition to the school gymnasium and some additional classrooms.
[43:09]
I'll let the applicant go through.
[43:11]
There's specific specificities as to.
[43:13]
What the actual building addition is and et cetera.
[43:17]
The review from the technical review committee.
[43:20]
Is really based upon two things.
[43:23]
One, what's allowed for the permitted?
[43:25]
Zone, which is the public zone.
[43:27]
Where schools are and.
[43:29]
What is afforded us?
[43:30]
Both the Planning Commission and the Technical Review committee by the state.
[43:35]
As far as how far we can take reviews of school sites.
[43:39]
Those conditions are listed in your staff report. I think we went through with them.
[43:43]
Pretty thoroughly.
[43:44]
With during the work session.
[43:47]
But essentially what we're looking for because of the addition.
[43:50]
Of the school space and the modification of the emergency access area.
[43:54]
Our offsite parking requirements ensuring that.
[43:58]
The stability of the bank in Big Combo Creek is.
[44:01]
Kept in in place.
[44:03]
And also the width and the design parameters of the Access Rd. running around the backside.
[44:10]
The technical review committees.
[44:13]
Specifically, the fire department department has looked at this situation and as requiring.
[44:18]
A dimension which is not shown on your site plan.
[44:22]
The dimension that needs to be.
[44:25]
Modified is from.
[44:27]
I think is around a 20 foot to a 26 foot wide Rd.
[44:31]
We're waiting on.
[44:32]
A design that actually shows that in the drawings that you're seeing here.
[44:37]
And then also an additional parking agreement.
[44:40]
Which is in place.
[44:42]
Pending to be in place through the LDS Church on the North.
[44:45]
To the north of this site.
[44:46]
Across the street.
[44:48]
That is intended to accommodate.
[44:50]
Additional student body.
[44:52]
Faculty, et cetera.
[44:54]
The addition itself really is going to be reviewed by.
[44:57]
The the state billing.
[44:59]
Official.
[44:59]
And, umm.
[45:01]
And the inspections?
[45:04]
A company that.
[45:05]
City quality? Really.
[45:06]
Be involved in.
[45:07]
Many of the construction there.
[45:09]
It's really health, safety, traffic circulation.
[45:12]
And offsite parking is what we're intending to review as an amendment.
[45:16]
Pipeline.
[45:18]
I can just ask a quick clarifying question on the.
[45:23]
Solidifying of the parking agreement with the church.
[45:26]
Is that something that needs to come from?
[45:29]
The Church of Jesus Christ of Latter Day Saints headquarters or is that something that can come from.
[45:35]
Like a.
[45:37]
Within or the.
[45:39]
Lay ministry like.
[45:41]
Who does that actually have to come through? Because the church is a pretty large entity.
[45:45]
They do have a properties division.
[45:47]
Which we deal with.
[45:48]
Routinely.
[45:49]
OK, umm.
[45:50]
That's who I was expecting it to come from.
[45:52]
OK. Just wanted to clarify that. Thank you.
[45:55]
So they're adding another 500 students, or I mean 50 students.
[46:00]
Was that what you're approximately? Yeah, the student body is growing by that much, yes, so.
[46:06]
I I've only been through here when it is.
[46:09]
The start of school and that is kind of chaotic.
[46:12]
So the church parking.
[46:15]
Is for daytime parking or is it for drop off?
[46:19]
Can you explain how both those?
[46:21]
It's used to pick up and drop off.
[46:23]
OK.
[46:24]
So is there a need for any traffic or?
[46:28]
Some type of.
[46:31]
I'm not even sure a crossing guard, but just.
[46:34]
So that we can see how it lays out, so that.
[46:37]
You're proving something in another piece of property.
[46:41]
That could.
[46:41]
Have some ramifications if.
[46:44]
People aren't cooperating and.
[46:46]
Following some type of.
[46:49]
Again, I'm.
[46:50]
Kind of stretching here because I'm not exactly sure how it works in the church parking.
[46:54]
Or if that is indeed what happens at all, so.
[46:58]
That's why I'm asking based upon over the years of reviewing.
[47:01]
Traffic circulation at this site.
[47:03]
And the.
[47:04]
New constructed.
[47:05]
Pedestrian activated crosswalk that's there.
[47:09]
And it's being widely used.
[47:10]
For the pick up and drop off, his parents walk their kids across the street.
[47:15]
That is the location that is.
[47:17]
Definitely being used.
[47:19]
As parents drop off or pick up.
[47:21]
And drop off students while.
[47:24]
Navigating Murray holiday.
[47:27]
Previously, I think there was a time when they were.
[47:30]
Parking all the way over in the park space.
[47:33]
At the Creekside Park and walking with the sidewalk across.
[47:36]
Obviously a closer location.
[47:39]
But you can definitely ask the applicants as to how that's working out.
[47:44]
I guess I'm just asking, is a self governing on the church property?
[47:48]
And you park wherever you want and.
[47:51]
I I haven't seen the actual agreement to say the 1st 152030 stalls are being written.
[47:56]
To be leased, but I'm.
[47:58]
Appreciate it. Thank you.
[48:00]
OK, Other questions for city staff?
[48:05]
All right, let's hear from the applicant.
[48:17]
Hello, I'm Heather Campbell.
[48:19]
I'm the executive director at Wasatch Waldorf Charter School.
[48:22]
And 1st I want to say thank you for the crosswalk.
[48:26]
It's wonderful.
[48:27]
Our parents really appreciate it.
[48:30]
I was over there today just to kind of get a feel for how much it's being used and.
[48:35]
We have about 20 to 30 parents dropping off and picking up over there three times throughout the day.
[48:40]
So that reduces our traffic line.
[48:42]
By at least that much.
[48:43]
If we can work on.
[48:45]
Maybe more parents using that? That might also help alleviate.
[48:48]
Traffic that's on the main Rd.
[48:52]
And so I just wanted to speak to that because you were asking what does that look like?
[48:56]
That parking lot since the crosswalk.
[48:58]
Was there and some parents used it prior to that too.
[49:02]
But what I'm trying to do right now is have a lease agreement in writing with the church so that we have a.
[49:06]
Clear agreement on what that looks like as far as our use of that and that during construction.
[49:12]
That we could put.
[49:14]
Faculty over there as an option for parking.
[49:18]
So that we're not.
[49:19]
In the wrong places.
[49:22]
Or blocking the fire lane.
[49:24]
So that's in process and being reviewed right now and that came from I.
[49:29]
Reached out to the stake president, who then.
[49:32]
Brought me over to a legal.
[49:34]
Office and they've been the ones drafting that document for us.
[49:39]
OK. So that just to clarify that's not.
[49:42]
Done yet? You're still waiting.
[49:43]
It's not completed. I have a draft and I have one of our.
[49:47]
Board members reviewing the draft right now.
[49:49]
OK, and just for my.
[49:52]
Enlightenment.
[49:53]
Parents park there and then walk their children across the street, where they.
[49:58]
Park there and say.
[49:59]
Go for it. I'll watch you go.
[50:02]
How does it work both depending on age.
[50:05]
Uh-huh. A lot of parents enjoy the walk.
[50:07]
With their child.
[50:08]
And.
[50:10]
And then some are old enough where they get dropped off and walk across and it has the stop light.
[50:14]
The button on it and.
[50:16]
And then when school's out, they're able to the.
[50:19]
Children can many just push the button and walk across.
[50:23]
Thank you.
[50:23]
Yeah. And I think if we have a higher use of it and an agreement maybe.
[50:28]
I need to look into the.
[50:29]
Liability and the insurance coverage, but.
[50:31]
Having someone over there to monitor.
[50:34]
Monitor the use.
[50:35]
I think will be something we put on our agenda for August when we do staff duties.
[50:40]
On pickup and drop off.
[50:41]
Get someone over there.
[50:43]
I found a sweatshirt.
[50:44]
Today so.
[50:46]
Probably need to monitor that a little better.
[50:50]
Her other issue is going to be the.
[50:52]
State Fire Marshall's requirements.
[50:55]
Which we don't see on any of the plans that have been submitted so far.
[50:59]
Is it accurate to?
[51:01]
Say that the plans have not yet been approved by the.
[51:05]
State Fire Marshall.
[51:08]
I think that's in process. I know there's we were trying to reach out today.
[51:12]
Because there are most of the.
[51:14]
Fireland is at 26 feet.
[51:16]
And then there's two spots I think that are at 24.
[51:19]
Feet on two sides of the building.
[51:22]
West, am I correct?
[51:24]
OK. And so?
[51:27]
Our architect and design team are trying to reach out.
[51:30]
Today we just found out.
[51:31]
About that this morning. So they're trying to reach out to.
[51:33]
Work through those.
[51:35]
That dimension and that issue and.
[51:38]
What can we do?
[51:39]
And what do we need to do?
[51:40]
To fix that.
[51:42]
And absolutely will.
[51:44]
Find a way to get approval.
[51:45]
Yeah, in the.
[51:46]
In the diagram, particularly the one that is on the screen right now, it shows that the width of the road is 20 feet.
[51:53]
So which part would be a problem?
[51:56]
I think I think W needs to explain it.
[51:58]
OK.
[52:01]
Thank you. I have a little bit more information on this. What's your name and?
[52:05]
My name is Wes Baker and I'm from Babcock Design Group, the architect for the project.
[52:13]
We are aware of the 26 foot.
[52:15]
Requirement. We were aware of it for a while.
[52:17]
And that inside curb that's there.
[52:19]
Was intended to be a rolled.
[52:21]
That A.
[52:22]
Fire response vehicle can pull up on to make sure they maintain that entire width.
[52:27]
We've been preparing a diagram that we can send back to the city and and to.
[52:31]
The the Unified Fire Authority, but also the state fire Marshall to kind of demonstrate that compliance.
[52:37]
The area that we're trying to get some clarification on is some of the existing areas that we weren't planning on touching.
[52:42]
Are currently less than 26 feet. So what is the requirement for what has to be adjusted that that we weren't planning to touch
[52:46]
that has nothing to do with with the.
[52:51]
Area where they proposed.
[52:52]
Future edition is going to go. So those are some of the things that we're working through trying to get.
[52:58]
Clarification on and then ultimately our goal is to get.
[53:01]
For compliance with what? With what is required as part of the approval process with the state, we are required to coordinate with
[53:05]
the city. We're required to coordinate with the state fire Marshall, who always wants to coordinate with the local responding
[53:09]
authority.
[53:14]
And so part of part of that process is.
[53:16]
We can't get our permit until.
[53:18]
We finished that coordination or at least it's it's mostly finished.
[53:21]
And so to do that, we have to demonstrate both to to unified fire, but also the state fire Marshall.
[53:26]
That we are meeting that 20 states.
[53:28]
Excuse me, a 26 foot.
[53:29]
Width requirement that is there.
[53:32]
So when do you expect that?
[53:34]
We would see documents that reflected.
[53:38]
That 26 feet.
[53:39]
Of the street.
[53:42]
What you see up there?
[53:43]
Does meet that?
[53:44]
But we need to clarify how we're reading that because.
[53:46]
Again, that inside curb is not a full kind of.
[53:50]
Sharp curve, it's it's a rolled curve so that a vehicle can can go up on the top of it and there were some Ballers that were
[53:53]
around there to help.
[53:56]
Kind of make sure that the vehicles never came too close to the building. So we have a diagram that we just received.
[54:04]
An hour ago that that tomorrow will start fording to to to.
[54:09]
Others at the city and and the fire authorities to make sure that we can continue that discussion.
[54:14]
So the.
[54:15]
And just I don't remember.
[54:17]
Recall if you were in here but the fire.
[54:20]
What was his title?
[54:24]
Area Fire Marshall Area Fire Marshall. Thank you. Didn't want to.
[54:27]
Misrepresent there.
[54:29]
He spoke to the need and requirement of 26 foot.
[54:34]
Consistently on all parts of the lane in order to.
[54:38]
Safely, uh.
[54:39]
Mitigate fire problems.
[54:41]
Using.
[54:43]
Whatever apparatus or mechanisms involved that don't involve putting.
[54:47]
Those machines.
[54:49]
Over curbs or.
[54:51]
Landscape, uh.
[54:52]
Sure. And and that's good to know. We, we tried to reach out to probably him.
[54:56]
Earlier today and he was probably occupied trying to talk to you guys, so.
[55:00]
Yeah, we'll make sure that we talk to him. And again, our goal and intent is to fully comply with with what they require.
[55:09]
He also mentioned the.
[55:11]
Possible issue of.
[55:12]
Moving a hydrant.
[55:14]
And some concerns that.
[55:17]
He and the fire department had in terms of.
[55:20]
How that would affect their hoses and hose deployment and movement and things and?
[55:26]
Is that do you want to speak to that?
[55:29]
Issue I I've read the comment, it's probably not as much information as you were given earlier.
[55:33]
There's an existing fire hydrant that happens to just be kind of where.
[55:37]
The new extension of the road is going to go, so it has to move anyway.
[55:40]
And our civil engineer had just kind of moved it.
[55:43]
Straight East.
[55:44]
To get it out of the way.
[55:46]
But the comment that I read was that the Fire Marshall preferred it to be further to the South.
[55:50]
Which we don't have any concerns with that. It's it's just a matter of.
[55:53]
Of determining where that final location.
[55:56]
Location is that everyone's going to be happy with?
[55:58]
OK, OK. All right.
[56:00]
Additional questions.
[56:02]
For the architect or the applicant at this time.
[56:05]
OK. We'll go ahead and have you sit down.
[56:06]
Thank you.
[56:08]
Are you with the?
[56:13]
OK. Then hang on just a second because we're about to open open the public hearing here.
[56:17]
So, umm.
[56:18]
With that, we will open the public hearing. Any members of the public that wish to make comment tonight may do so. We ask that you
[56:24]
state your name and address for the record and please talk into the microphone so our recorder can capture everything.
[56:31]
And try and keep your comments to 3 minutes or less if you would.
[56:41]
My name is Holly Christiansen.
[56:45]
I live directly adjacent to the school across the Creek. I think my home is the most directly impacted by school activities. I'm
[56:50]
at 4795 S.
[56:56]
Yorktown Dr.
[56:58]
And I am unclear on exactly where the driveway is being extended. Is it the back?
[57:05]
To the back of the school.
[57:07]
So how much further into the microphone, if you would?
[57:11]
They'll get a chance to answer any question like how far is it being extended?
[57:17]
No, just make your comment and then we'll invite them up.
[57:20]
OK, OK.
[57:22]
Yeah. So I'd like to know how far it's being.
[57:24]
Extended.
[57:26]
If that's if it's going to affect.
[57:29]
The yurts that are Creekside, if they're going to be moved at all.
[57:34]
If any trees anywhere will be removed.
[57:37]
I have emailed with Mr. Tearling just today and I appreciate your time and efforts.
[57:43]
I did make some comments to him and.
[57:46]
I would like to just.
[57:49]
Read my comments to you and my thoughts as.
[57:52]
Someone who has lived next to the school since.
[57:56]
Since it was built, I was there many years before it was built.
[58:01]
Sounds like the school is seeking to amend its site footprint to accommodate growth.
[58:06]
However, the site's current physical layout is already failing to contain extreme repetitive noise nuisances.
[58:14]
Like daily outdoor drumming.
[58:16]
While the school is a permitted.
[58:18]
Utah code allows this Commission to impose restrictions to mitigate unreasonable risks to health and safety.
[58:25]
The ongoing high decibel outdoor percussion is an unmitigated health hazard to surrounding homes.
[58:31]
Homeowners by altering the layout and expanding students.
[58:35]
Capacity without including physical noise mitigation structures.
[58:40]
This amendment actively aggravates the negative impact.
[58:43]
On the surrounding residential properties.
[58:46]
Violating the core intent of holiday land use approval standards.
[58:51]
Allowing an amendment that increases student capacity without conditioning that approval on a total.
[58:57]
Indoor only policy.
[58:59]
Or percussion or sound dampening acoustic wall.
[59:02]
Fails the city's duty to protect neighborhood health.
[59:06]
I request that the Commission table this site plan.
[59:09]
Amendment until the school submits a certified noise mitigation plan.
[59:14]
Or condition any final approval.
[59:16]
On a strict requirement that all percussion be moved entirely indoors.
[59:20]
Or behind a professional sound dampening acoustic barrier.
[59:24]
Holiday's noise ordinance exempts occasional school events.
[59:29]
But it does not ground a blanket license for continuous daily outdoor auditory nuisances.
[59:35]
By adding more students, the school is scaling up a disruptive operation.
[59:40]
That bleeds across property lines.
[59:42]
I request that this site plan amendment be tabled.
[59:46]
Until the school adjusts its outdoor layout to move these.
[59:49]
High noise zones away from residential property lines.
[59:53]
Thank you for your consideration.
[59:56]
Thank you.
[1:00:02]
And did we have any other public comment tonight?
[1:00:08]
No, OK.
[1:00:11]
And with that, we can.
[1:00:14]
Close the public hearing for now.
[1:00:16]
We can give the applicant just a moment to come up and address any other comments that have been made if she'd like.
[1:00:25]
Yes. Umm.
[1:00:26]
I think one of the things that is included in that new addition to the building is another music room.
[1:00:32]
And right now we have a wonderful teacher from Kenya.
[1:00:36]
Who teaches African drumming?
[1:00:38]
It's quite beautiful and obviously a little loud.
[1:00:42]
So good to know that that's bothersome.
[1:00:44]
It's a few times a week.
[1:00:46]
That he teaches the class.
[1:00:47]
So anyway.
[1:00:48]
That would be going inside.
[1:00:50]
So I feel like.
[1:00:51]
The and the larger gym would allow for more of our children who are playing games outside to also play those games inside.
[1:00:58]
So I'm hopeful that that sounds like a reasonable.
[1:01:02]
Reason that we're outside right now.
[1:01:04]
We are outside a lot, it's true.
[1:01:07]
OK. Thank you very much.
[1:01:09]
And I think.
[1:01:10]
West can speak to.
[1:01:12]
The road and how far we're moving it up.
[1:01:20]
I think if you go to page 24.
[1:01:22]
Of the.
[1:01:23]
Packet. It shows the original site plan that that is currently there.
[1:01:27]
Go down.
[1:01:28]
One more.
[1:01:30]
That's the the current.
[1:01:31]
Layout of the road towards the South.
[1:01:33]
Those darker circular.
[1:01:36]
As items are the yurts.
[1:01:39]
That were referred to.
[1:01:42]
The road is intended to be extended all the way to that South property line that abuts the park.
[1:01:47]
And so in that.
[1:01:48]
The the yurts have to move.
[1:01:50]
There are half of them are currently on.
[1:01:52]
The park property.
[1:01:55]
And so the intention is to relocate them.
[1:01:58]
Elsewhere and allow for that road to extend all the way South towards that property line.
[1:02:02]
So if you go forward a couple pages, you'll see the new site plan.
[1:02:06]
Where you can see that?
[1:02:08]
Whatever's there right now has has been moved and relocated in that road.
[1:02:13]
Is right along the edge of the property line there.
[1:02:18]
So the answer to that is that the yurts and the trees are going away to replace with the lane.
[1:02:23]
Correct. OK.
[1:02:24]
Correct.
[1:02:25]
All right. Thank you.
[1:02:29]
All right, um.
[1:02:32]
Commissioners.
[1:02:34]
So as.
[1:02:36]
Discussed in our work meeting.
[1:02:38]
Oh, you can talk to the applicant after.
[1:02:46]
Well, we've already taken your public comment.
[1:02:48]
And.
[1:03:07]
OK, so I'll make note of it that there will be more.
[1:03:10]
Comment was concerned.
[1:03:12]
There will be more traffic from the Earth's being moved.
[1:03:15]
As added to the record.
[1:03:19]
So.
[1:03:21]
With that, there are the two points that were brought up during the work session.
[1:03:25]
Which the applicant answered.
[1:03:28]
They're still in progress.
[1:03:30]
And during the work discussion, we kind of talked about.
[1:03:34]
For this body to sign off on the health and safety for all these kids and everyone involved.
[1:03:40]
Everyone would feel a lot better to have those things finalized before anything else is approved or move forward or deferred to
[1:03:45]
someone else to have to do that.
[1:03:51]
So unless anybody has opposition, I would make a motion that we continue this until those things can be achieved by the applicant
[1:03:55]
and brought back.
[1:03:59]
For final review by this Commission.
[1:04:01]
This is Commissioner Prince. I'll second that motion.
[1:04:05]
OK. And a motion and a second, we'll call for vote.
[1:04:08]
Commissioner Baron.
[1:04:09]
Hi, Mr. McGowan, Hi.
[1:04:11]
Commissioner Prince Aye.
[1:04:12]
Mr. Font.
[1:04:13]
Mr.
[1:04:14]
Aye, and Commissioner Cunningham.
[1:04:16]
Aye, and Chair Roach votes aye. So with that, it will be tabled until those things are completed and brought back to us.
[1:04:22]
And that could be as early as the next meeting if you get those already then.
[1:04:27]
Otherwise you can work with city staff and once those are.
[1:04:31]
Secured.
[1:04:32]
Then we will see you soon.
[1:04:35]
All right, and.
[1:04:37]
With that.
[1:04:39]
There are no minutes.
[1:04:40]
Dress.
[1:04:41]
Because we did not get those, so those are moved. So I will make a motion to adjourn all in favor.
[1:04:45]
Aye, anyone to stay?
