» Good evening. Uh much in the same vein
[1:37]
as the contract that was presented for
[1:40]
tourism and promotional materials at the
[1:42]
last meeting, this item was also
[1:44]
included in the operational budget with
[1:47]
funding to come from the $2 hospitality
[1:50]
room tax that is levied and that the
[1:52]
city originally pledged to go towards
[1:54]
developing further tourism activities in
[1:57]
the community. This professional
[1:58]
services contract uh is uh starting in
[2:02]
fe February running through the end of
[2:04]
the year rate of $5,000 per month
[2:06]
non-renewing uh unless consented to by
[2:09]
the council. So this obligation is only
[2:11]
for this fiscal year and there are
[2:13]
sufficient funds in the operating budget
[2:15]
to cover this expense.

» Yes, sir. So, the NAROM contract is
[2:36]
largely uh video, audio, and photography
[2:40]
based, like sort of like the videos that
[2:42]
we've used in some of our development
[2:44]
efforts recently and on our social
[2:46]
media. They're helping on that side of
[2:48]
things. This professional services
[2:49]
contract is to support Miss Lynch's
[2:52]
efforts to interface mostly with Aldrich
[2:55]
Gardens uh and the Hoover Randall House
[2:57]
and to help develop uh relationships
[3:00]
there as far as pursuing grants,
[3:02]
operational planning and promotion of
[3:04]
those two uh facilities specifically.

authorizing the mayor execute a third
[3:44]
amendment to lease agreement with RMC
[3:46]
Investments uh for certain premises
[3:49]
located at Hoover Commons. Mr. Mer, you
[3:52]
sat down too quickly.
[3:55]
It was very comfortable seat. So this
[3:58]
agreement uh pertains to the police
[4:01]
operations building on Laura Road. Uh
[4:04]
that agreement runs only through the end
[4:06]
of February. And we've been engaged both
[4:09]
Chief Morris and I uh as well as Mr.
[4:11]
Grimes uh with meeting with those owners
[4:14]
about some redevelopment plans that they
[4:16]
have for that center overall. And that
[4:19]
allowed us to speak with them about the
[4:20]
terms of our lease and basically
[4:23]
entertain uh some different options in
[4:25]
the future. And as we continue to
[4:27]
negotiate a longer term lease, the
[4:29]
original term of this was uh 10 years in
[4:32]
duration with it was a five and a five.
[4:35]
uh and the owner has agreed to a
[4:37]
six-month extension at the same rate as
[4:40]
what we're paying now, which is 45,852
[4:44]
uh annually.
[4:46]
So, that would uh extend uh from March
[4:49]
onward for 6 months. And that would
[4:51]
allow us to basically complete that
[4:53]
negotiation, including some of the
[4:56]
security enhancements that the police
[4:57]
department would like to see to help
[4:59]
secure their parking area at that
[5:01]
facility and allow us some time to
[5:03]
basically evaluate our future with that
[5:04]
property as well.

do I understand that the owners of the
[5:14]
ops building
[5:17]
is also the owner for the Hoover
[5:19]
Commons?

» Yes, sir. That's correct.

» Okay. I thought that that the ops
[5:23]
building had a different owner than the
[5:25]
commons itself.
[5:27]
» So I have not checked title on the
[5:29]
property, only the GIS as it pertains to
[5:33]
property tax records, but uh when we met
[5:35]
with them, they did indicate that they
[5:38]
were owners of both. It may be held in a
[5:40]
separate LLC, but the same owner uh is
[5:45]
the principal of both. So it may be a
[5:48]
separate corporation owns the ops
[5:50]
property.

» I don't recall that it was, but I can
[5:53]
certainly research that to you and get
[5:55]
it to you before the meeting on Monday.

» With this only being a six month

is owners

saying that there's possibility that we

» The owner, the owner very much wants to
[6:18]
retain uh the police department
[6:20]
specifically as a tenant. Uh they view
[6:23]
the police department's presence there
[6:24]
as a huge enhancement to their retail
[6:26]
operation. Uh the response time is
[6:28]
probably phenomenal to any events that
[6:30]
they have there. Uh they were extremely
[6:33]
positive about that open uh in the past.
[6:37]
I believe it the department had been
[6:40]
turned down uh when asking to be close
[6:42]
their parking area and some things like
[6:44]
that. Uh the owner is now completely
[6:46]
receptive to that. Uh they have asked or
[6:49]
they've given us preliminary terms for a
[6:52]
full-term renewal. Um those require some
[6:55]
negotiation and we asked for some more
[6:57]
time to consider that. Uh but I believe
[7:00]
both the owner and the department are
[7:02]
both both very favorable towards
[7:04]
retaining uh this asset under terms to
[7:08]
be uh fleshed out over the next six
[7:11]
months.

any thoughts about maybe selling the

city the property in the foreseeable

» That was something that was uh
[7:26]
discussed. I think they would entertain
[7:29]
it.

Um they were they were very open to a
[7:34]
variety of things. Uh and really they're
[7:37]
that is a very um limited use building.
[7:42]
I believe it was a theater originally
[7:44]
before it was converted. The city has
[7:46]
invested substantially in it. It is very
[7:48]
much a police facility now. And so I
[7:51]
think the owner recognizes uh the value
[7:55]
in it and I think they are open to
[7:57]
discussing that. But uh at present lease
[8:00]
only is what's been discussed.

and we've got more favorable terms.

The current terms are very favorable.

the next three items all pertain to very
[8:26]
similar

» Sure. Let me reading agreements. Uh the
[8:29]
first uh one that is mentioned um is the
[8:34]
only one that differentiates and that is
[8:37]
because uh this grant was originally
[8:39]
awarded in 2023 to the city as part of
[8:43]
the city's pursuit of a large covered
[8:46]
pickle ball facility. Um, and there were
[8:49]
several uh legislative measures of
[8:51]
support that is are now converted to
[8:53]
grant funding as well as a agreement
[8:55]
with the county commission uh that
[8:57]
brought another $350,000
[8:59]
towards this effort. U none of that came
[9:03]
within it was probably 15% of the
[9:06]
funding necessary to actually build the
[9:08]
facility at current pricing levels and
[9:11]
ADCA has been rolling these grants
[9:13]
forward over the years. Um we do have
[9:15]
the flexibility as confirmed with ADCA
[9:17]
uh to reobligate the funds towards
[9:20]
qualifying recreational improvements and
[9:23]
they've given us a deadline of the end
[9:24]
of this fiscal year to expend those
[9:26]
funds which limits greatly what scope we
[9:30]
have to put towards it. So, what we have
[9:32]
proposed here is to uh put this $500,000
[9:36]
award, the second $500,000 award, and
[9:39]
the final $100,000 award, and to
[9:42]
allocate those funds towards paying for
[9:44]
the reelectrification of Hoover East. Uh
[9:47]
that is an ongoing project properly bid
[9:50]
under the competitive bid law. It's
[9:52]
satisfactory to ADCA and that allows us
[9:54]
to fully utilize and capture those funds
[9:57]
for a very necessary purpose. And then
[10:00]
also the council would have the ability
[10:02]
to uh maybe have more latitude in
[10:04]
considering other improvements as a
[10:05]
consequence.

and 876026.

ADCA funds?

» So these funds are available on a
[10:21]
reimburseable basis. So once these grant
[10:23]
agreements are approved by council, uh

they'll be executed by the mayor. will
[10:27]
return those to ADCA next week and
[10:30]
because we have been paying uh steadily
[10:33]
we would basically take our pay request
[10:35]
and begin sending them draw down
[10:37]
requests and uh this is a very expensive
[10:40]
project as you all know so my hope is
[10:42]
that we would be able to draw down these
[10:44]
funds probably over the course of the
[10:46]
next two to three months.

uh for traffic signal and its upgrades

on I65 and related roadways in within

the city of Hoover. Mr. Promer.

ALDOT's going to complete all the work.

It's on Valley Dale Road the two exits
[11:16]
associated with 65 both the on-ramp and
[11:18]
offramps there. Item to note, we are

already controlling these at this time
[11:22]
along with the cameras. So, it's just
[11:24]
simply upgrade to the signals,
[11:26]
associated cameras and mounts. So, all
[11:29]
work will be performed by ALDOT. And
[11:31]
they outlined a very specific detail of
[11:34]
how it's work's going to be done and
[11:36]
everything's performed by them. So,
[11:38]
there's nothing that the city's going to
[11:39]
do for this. So,
[11:40]

that's kind of towards the bottom of the

location of the uh Rossbridge extension
[13:01]
uh as it connects to what you're seeing
[13:03]
the acquired routeway that's running on
[13:04]
the bottom kind of running northeast u
[13:07]
that would be South Shades Crest Road.

So just for your reference in there. So
[13:12]
Hoover owns that tract of land. Um so we
[13:14]
are asking for dedication of a 20 foot
[13:18]
easement permanent easement for
[13:20]
utilities mainly for the water service
[13:23]
uh to be connected and come under
[13:26]
bore under the interstate to re get
[13:28]
reconnected back to uh to South Shades
[13:31]
Crest area.

under South Shades Crest Road or another

location. So who again would be

responsible for funding the uh
[14:14]
the movement of utilities?

Program and authorizing the mayor to

with the state of Alabama office of
[14:40]
information technology and Auburn
[14:43]
University's McCra Institute. Miss

Uh basically the city of Hoover we
[14:52]
applied for and we've been accepted into
[14:54]
the Alabama state and local cyber
[14:56]
security grant program. Uh this is a
[15:00]
grant that's going to be uh one-time
[15:02]
services in lie of getting direct
[15:05]
monies. Uh and so they're going to help
[15:10]
improve the civ city's cyber security
[15:13]
readiness and these agenda items and
[15:15]
these documents are going basically used
[15:18]
to further that process. We do have
[15:19]
Jonathan Scherk here tonight with
[15:22]
McCreary Institute if you had any
[15:24]
specific questions uh that he can answer
[15:26]
those as well.

adopting an updated investment policy
[15:52]
for the city of Hoover.

» Uh yes. So uh in preparing to uh call
[15:59]
our first investment committee of the
[16:01]
calendar year uh in reviewing this
[16:03]
policy we realized there were just a few
[16:05]
small changes that we wanted to make
[16:08]
with the understanding that after
[16:10]
reviewing it I realized this is kind of
[16:11]
written that in the from the standpoint
[16:13]
the city treasuring these things but we
[16:15]
actually kind of outsource that now
[16:17]
Raymond James is our current investment
[16:18]
adviser so we're going to do a more
[16:20]
complete revamping uh probably April May
[16:24]
June of this
[16:25]
But this the main thing that this
[16:27]
particular update changes is the
[16:29]
structure of the investment committee
[16:31]
that instead of naming specific
[16:33]
positions on the city council that are
[16:35]
on there, it gives a little bit more
[16:37]
flexibility and the council president
[16:39]
can choose three members from the
[16:42]
council that are on there and then it
[16:43]
would maintain the mayor and the city
[16:45]
administrator as the other two members
[16:46]
of that committee. Uh and then the other
[16:49]
changes are slight changes uh just
[16:52]
updating terminology that needed to be
[16:54]
in place. So
[16:55]

[16:57]
background. So in the past the council
[17:00]
president was an automatic member of
[17:02]
this committee. And look I recognize my
[17:05]
strengths and weak weaknesses. Uh as a
[17:08]
school teacher I may not be the best
[17:11]
candidate for this committee when others
[17:14]
up here have much more valuable
[17:15]
experience than I do. So, I ask for this
[17:18]
change in this committee structure. Any

resolution 876626
[17:30]
authorizing the mayor of the city of
[17:31]
Hoover to execute a license agreement
[17:34]
with Richard Shirley. Mr. Martin,
[17:43]
good evening. Uh the resolution before
[17:46]
you uh would uh enact a an agreement
[17:51]
with Mr. Shirley who is a property owner
[17:54]
adjacent to the end the dead end of
[17:58]
Lebell Lane. Uh you go past, if you're
[18:01]
familiar with that street, you go past
[18:03]
the garden home development uh heading
[18:06]
out Leel Lane. It is on your left and as
[18:10]
soon as you pass the last turnout for
[18:13]
the garden home development, uh the
[18:17]
public right ofway comes to an end
[18:19]
shortly thereafter and transitions over
[18:22]
into private property um uh dead ends
[18:25]
into Mr. Shirley's property. Um Mr.
[18:28]
Shirley has requested this agreement in
[18:32]
order to make certain improvements
[18:34]
within the dead end of the public right
[18:37]
ofway but before exiting the public
[18:39]
right of way there. Uh the purpose as
[18:42]
stated by Mr. Shirley is that with the
[18:44]
dead end in place it has attracted a
[18:47]
number of folks uh to the end of the
[18:49]
street dumping their refues garbage and
[18:53]
otherwise making for a nuisance
[18:55]
situation that Mr. Shirley would like to
[18:58]
avoid and certainly we would like to
[19:00]
avoid um dumping there as well. Uh Mr.
[19:05]
Shirley's long-term plans are to
[19:07]
construct his forever home on the
[19:09]
property just beyond. And so he has
[19:12]
asked that we enter into this
[19:14]
arrangement whereby he can construct a
[19:17]
gate and a couple of columns uh to
[19:21]
secure the end of the public rideway. Uh
[19:24]
in reviewing this particular matter, uh
[19:27]
it does not appear that there would be
[19:29]
others injured by Mr. Shirley slightly
[19:33]
encroaching in the dead end of that ride
[19:35]
ofway. And um again, you have the
[19:38]
benefits of closing off the the private
[19:41]
drive just beyond and the tail end of
[19:43]
the rideway to dumping illicitly that
[19:46]
has been taking place.
[19:48]
I will note that if at any point in time
[19:52]
the city determines that this needs to
[19:55]
be terminated that we can uh let Mr.
[19:58]
Shirley or his successors and assigns
[20:00]
know that we are terminating the
[20:02]
agreement for whatever reason deemed
[20:05]
worthy by the council and whatever
[20:07]
improvements are placed in the public
[20:09]
rightway uh Mr. Shirley or his
[20:12]
successors in the signs will need to
[20:13]
remove those and return the rightway to
[20:16]
its uh previous state.
[20:19]

[20:21]
Murphy wrote out and met with Mr.
[20:23]
Shirley on his property and viewed it
[20:24]
and uh Mr. Shirley is here as well
[20:27]
tonight. I understand he can't be here
[20:29]
Monday night. Uh so is there any

to Mr. Shirley regarding this item?

» Mr. Martin. Um, did this go before
[20:41]
planning and zoning or was there no need
[20:43]
for that?

» No, sir. We did not determine there was
[20:46]
a need to go before them. This is
[20:48]
strictly as uh as caretakers of the
[20:52]
public rightway, a council issue.
[20:54]
» And this would allow him to also create
[20:57]
a gated
[20:59]
even though it's one dwelling, he would
[21:01]
have a gated community of his own of
[21:04]
sorts.
[21:05]
uh the the gate would cut off the drive
[21:08]
to his private residence.
[21:10]
» How would trash service be affected?
[21:13]
» Uh he would have to move and locate any
[21:16]
kind of garbage service for pickup
[21:18]
outside of the gate.

» Just for clarity too, um this is a dead
[21:24]
end site is a very large piece of u
[21:27]
estate property. Uh so one way in one
[21:30]
way out on the end of the cod basically
[21:33]
uh and the way the trash is set most
[21:38]
individuals is set it on the main strip.

So they'll be parking outside. Uh if it
[21:43]
wasn't for the ability for him to kind
[21:46]
of uh have a gate, that's the only
[21:48]
reason why we're here is like a very
[21:50]
tight spot. Uh it doesn't prevent uh any
[21:54]
other properties from getting access. uh
[21:57]
the city doesn't have a uh need or any
[22:01]
assets behind the property that requires
[22:03]
access to through property. Uh so no
[22:06]
need for the city at all. Uh although
[22:09]
utilities uh sit right there on the
[22:13]
property lines. Uh so it's uh very
[22:16]
straightforward and I think as uh the
[22:18]
mayor stated earlier when he was
[22:21]
campaigning you know our ability to try
[22:23]
to uh look at everyone and make a
[22:27]
educated decision to improve you know
[22:30]
quality of life for folks versus just
[22:32]
making it difficult for them to be able
[22:34]
to do the things they need to do. So um
[22:36]
it's a straightforward process on that
[22:38]
end.

» Garbage will be on the outside, but if
[22:45]
public safety needs to get in on the
[22:47]
inside, police or fire, how does that
[22:49]
happen?

» Uh, construction of the gate is going to

have to they're going to have to acquire

a permit from the building department
[22:56]
and coordinate with fire marshall as far
[22:59]
as access for emergency services.

your exhibit A, line one is basically
[25:24]
those items that are in that proposed
[25:25]
capital request. And then there's uh
[25:28]
several pages of more detail behind
[25:30]
that. Uh line two though, in addition to
[25:34]
that, we had several other items we've
[25:36]
gone ahead and added on here as well
[25:38]
that will be part of the final original
[25:40]
budget for fiscal 26. Line two being an
[25:43]
additional $450,000 for the Hoover Board
[25:46]
of Education.

Uh this will

allow the the total front door fees to

be 1.1 million which is the estimate on
[25:56]
the revenue side and then the grand
[25:58]
total of contribution estimated for the
[26:01]
school board in fiscal 26 to be about

$6.1 million.

Uh then lines four through

six are items related to the police
[26:12]
department using uh various special
[26:15]
revenue funds. Uh, I can go into those

» Yes sir. Uh this was a case that the
[28:53]
council declared a nuisance uh and had
[28:56]
us pursue remedy uh with the circuit
[29:00]
court. uh circuit court found in our
[29:02]
favor and allow enabled us to go clean
[29:06]
the property of the nuisance. We had a
[29:08]
hoarding situation in the rear of the
[29:10]
yard that was really out of control and
[29:13]
uh so we did have a contractor go and um
[29:17]
remedy that situation and I believe this
[29:20]
is a reporting of those costs and we're
[29:22]
seeking uh lean on the property to
[29:25]
recover them.
[29:26]

been handling code enforcement items,
[30:14]
this was the first uh hoarding situation
[30:17]
that we've gone and cleaned up.

time for the taxes with the taxes. So, I

go I give the items to the taxes tax

collector and the tax assessor
[31:04]
and they place it on that. So the next

time that it rolls around for them to

pay taxes, there's uh one cut off a
[31:11]
year. So everything from last year will
[31:14]
pretty much be on the next year's taxes.

blocks away. Um some of these situations
[32:01]
are not just grass or trees. Some of
[32:03]
them are hoarding to the point where I
[32:07]
think some of them we've been out there
[32:08]
before. I I know we have a judicial
[32:11]
system we have to, you know, follow
[32:13]
course. In those circumstance, how do
[32:16]
you how do we deal with that reoccurring
[32:19]
situations, especially when residents
[32:21]
are having so many challenges with being
[32:24]
able to sell their home?
[32:26]
» Well, that would be a nuisance and
[32:28]
noxious fumes are covered by the
[32:31]
statute. So whatever steps that Max
[32:34]
department feels like we need to do,
[32:36]
that's why they have code enforcement
[32:37]
and as Wendy's pointed out, we can go in
[32:40]
there and and abate whatever that
[32:42]
nuisance is and whatever our cost are,
[32:45]
she puts the lean on the property and we
[32:48]
collect it. So if there's any uh any of
[32:51]
the properties that if it's just a
[32:53]
problem with odor, you know, we can go
[32:55]
in there and do something about that,
[32:56]
Mac. So that's just be something that
[32:58]
once it's cleaned up, you have to
[32:59]
continue to just follow the same
[33:01]
protocol. But outside of that, there's
[33:03]
nothing really other than going through
[33:05]
because I think this some of these
[33:06]
things take four, five, six months.

» Well, we see quite a bit of this in
[33:12]
municipal court and what we we try to
[33:16]
work with the residents and if they'll
[33:18]
clean it up and they're within the the

code, then we dismiss it. If there is,

while ago. If they come back in, then
[33:28]
the next time they have to pay a fine
[33:30]
and you have a graduated fine schedule

um and we tell them the next time that

every day that it allows to go unabated

is a separate and distinct charge. And

that

so far that's us I start to say usually
[33:48]
that's really gotten their attention.

are rather nominal. I think we have a

$100 cap on going from memory mac, but

the court costs are there and when you

do that on a daily basis, you run up a

right where we left off with the last

abatement. Uh circuit court decided that

they did not consider that ruling a
[34:54]
standing order. So, uh, if we do pursue
[34:57]
remedy through circuit court for this
[34:59]
particular property again, we'll have to
[35:01]
start over.

there's any queuing that backs on to

highway 31, the operator will be
[35:46]
required to amend the ingress and egress
[35:48]
to the satisfaction of the city
[35:49]
engineer. Just a quick note, they did
[35:51]
have a traffic engineer examine the plan
[35:55]
and produce a synopsis. Um the the
[36:00]
operator will have uh believe
[36:05]
um was it 60 60 spaces um stacking
[36:09]
spaces in the drive-thru considerable
[36:12]
number and amount of space for patrons
[36:15]
to go on site into the drive-thru lane.
[36:18]
Uh so the traffic engineer was of the
[36:21]
opinion that this would not have any
[36:22]
adverse impacts uh on Highway 31, but
[36:26]
out of an abundance of caution, we
[36:27]
recommended to the planning commission
[36:29]
to at least give us a uh a condition
[36:32]
there that if we do run into a situation
[36:34]
where there are any conflicts on 31 or
[36:37]
the main access drive into the shopping
[36:39]
center that we'll have some recourse to
[36:41]
go to the operator. So that's why you'll
[36:44]
see that condition in the
[36:45]
recommendation. Um secondly, if there's
[36:48]
any new lighting uh or any new lighting
[36:51]
that added to the site would match the
[36:52]
existing shopping center as closely as
[36:54]
possible. Uh third, the sign or sign
[36:58]
package would need to be applied for
[37:00]
separately and meet the requirements of
[37:02]
the Riverchase plan unit development. Uh
[37:05]
next, that the site and building to be
[37:07]
planned and constructed in substantial
[37:08]
conformity to the plan submitted as part
[37:11]
of the conditional use application. Uh
[37:14]
next that the property would be
[37:16]
subdivided prior to permitting. Uh they
[37:19]
are looking to do a an out parcel in the
[37:22]
existing parking field that is on the
[37:24]
site uh under utilized sector of the
[37:26]
parking field. Um next that the
[37:29]
landscaping on the master site would be
[37:31]
restored uh at the time of the
[37:34]
subdivision plat being considered and
[37:36]
then finally that the operator would
[37:38]
obtain a business license prior to
