Charlie and Sherry, I would say that
they're probably as close to me as

family. I've been neighbors with them
ever since I was born and we farm next

still farm with next not with them but

next to them. Um Charlie and Sherry have
over the past few years realized they're
[4:19]
not as young as they used to be. Um
[clears throat] their mobility is
[4:23]
changing as we all are dealing with it.
And they approached me and said, "Hey,
[4:26]
could you look at building us a home
that has zero entry, no steps, and so
[4:31]
on." and they address that issue that as
we get older, if we can move into a
[4:36]
place that does not have stairs, it
might be able to prolong the ability for
[4:40]
them to live independently versus going
into an assisted living and so on. And
[4:44]
and we all will deal with that at some
point. Fortunately, Charlie and Sherry
[4:49]
have a beautiful farmhouse. It's two
stories, lots of steps, just not
[4:52]
conducive as they age. So, we looked at
different locations and and you know, a
[4:57]
lot of their property is close to the
city limits or right on the edge. Um
[5:01]
yeah, pretty much all of it. Yeah, they
uh you know, their family is their three
[5:05]
generations of farming. They've very
very good stewards of the land and and
[5:10]
the community. Um looking at the
different parcels that they own, the
[5:15]
location that has been presented to you
guys suits their needs the best. Um they
[5:21]
do understand there's other quarter
quarter sections that they could build
[5:24]
on that would not have the resistance
and and [clears throat] of course the
[5:27]
guidelines the county is requiring. The
reason they've chosen this area, I just
[5:31]
got some notes, but basically it's a lot
of things. Um,
[5:36]
their safety just coming out onto the
highway. County One once you turn and
[5:42]
and you take 76 out of town, uh, 76 is a
busy road. Their concern is going out on
[5:49]
76, getting on and off that highway.
That's going to be a challenge for them.
[5:54]
Second thing is they take care of their
grandkids substantially and future great
[5:58]
grandkids. So by [clears throat] having
their property where it's located with
[6:05]
some of the rumors of possibly a bike
trail and things like that, their kids
[6:10]
or their their children and then their
grandchildren and great grandchildren
[6:14]
will have an easier path to get to and
from the school, especially the high
[6:17]
school. And this is going to be a 20 to
30 year process because of their their
[6:21]
grandkids. So that's a big factor that
they're looking at. And even if the bike
[6:25]
path from Beaver supposedly has been
talked about, that doesn't happen. It's
[6:29]
still going to be much safer for their
grandkids to ride bike to the the
[6:32]
schools, especially when I think Warrior
Drive is established. Um 76, you know,
[6:38]
that's where the the two quarter quarter
properties that they could build upon.
[6:42]
That also is I think we've always seen
that that can be just a monster of a an
[6:47]
issue regarding snow. And I think that's
a concern of theirs as well. Um the
[6:52]
county has approached Charlie and Sherry
over the years to ask if they can
[6:56]
utilize their land to push snow off of
76 just because it just tunnels through
[7:00]
there. Um

could happen. Then once they annex that
in, now you got two miles again from the

city limit after they annex it in. What
I'm getting at here is we're the

ordinance is trying to protect the prime
angle. That's what they're trying to
[10:18]
protect. I'm not trying to discourage
you trying that you can't get a building
[10:23]
per that the residential, but if we
start where are we going to stop and
[10:29]

move that far. So this would be an
option to have kind of a similar

development to what you'd see within the

The age factor and the safety for them

Um, I'll just read through them quick.
So, one, goal 1.3 of the goals and
[22:35]
policy section in the comprehensive land
use plan encourages location of urban
[22:38]
development near the major cities where
services can easily be provided and
[22:42]
extended. This property runs to the
middle of the of county 1, which is also
[22:46]
the northern extent of city limits. At
this point, city services do not extend
[22:50]
the property. Number two, policy one
under agricultural goals and policies
[22:54]
calls for protection of prime
agricultural land by limiting
[22:56]
development in agricultural areas.
Allowing this reszone will keep
[22:59]
development closer to existing
development and the public road which
[23:02]
will minimize impact on the land. Number
three, this parcel is currently 40
[23:06]
acres, but the applicants have chosen to
only reszone 2 acres in an effort to
[23:10]
restrict future development. If
additional lots are desired, another
[23:13]
reszone will need to be completed along
with a plat approved under section 36 of
[23:17]
the ordinance. Number four, policy one
of goal 3.2 of the comprehensive land
[23:22]
use plan discourages development in
areas where on-site sewer systems are
[23:26]
likely to malfunction due to poor soil
characteristics. Preliminary soils work
[23:30]
has been completed for this proposal and
meets state requirements for septic
[23:33]
systems. And number five, that the this
the parcel meets buildable lot and lot
[23:37]
area standards identified in the Houston
County zoning ordinance. [clears throat]

Well, those are the findings. Um, yeah,
I

they look fine to me. I I just want to
reiterate number one there. That is
[24:03]
a goal to keep within our comprehensive
land use plan to encourage development

from close to our cities and out.
In my opinion, if this was two miles
[24:17]
out, it wouldn't happen. Even if it was
two miles or 1.9,
[24:23]
especially if there was another quarter
quarter that was open. But seeing as how
[24:27]
it's right across the highway from the
city limits
[24:32]
and it's near a development area,
um I think this is this complies with
[24:41]
our comp plan.

Realistically thinking I mean hopefully
well depends on but you know the next 40
[24:53]
over from the development
leads right into make sense to be
[24:57]
development at some point and then
trader house is directly across from I
[25:01]
mean you're right next to city at that
point you know kind of already are but
[25:04]
even then even more right

How much weight does the townships
carry? And I have this question proposed

to me quite often.
If an applicant doesn't go to the

township and gets approval,
if the town before they come to you or
[58:39]
after they talk to you, whichever the
case may be, if the township denies a
[58:46]
building permit, per se, um does that
carry any weight with you? Um or you
[58:52]
just go ahead and give them the building
permit? Um well it's a little more
[58:57]
complicated than
[clears throat] maybe what your question
[59:02]
is. Uh so ultimately the county has a
zoning authority. Um the area where the
[59:08]
township where we would go to them for
sure for a yes or no is any driveway
[59:13]
access onto a township road. So we would
verify that with them. And if if the
[59:18]
applicant's not meeting what the
township's asking for us, maybe as far
[59:22]
as location or um like culverts or
whatever is needed, um then the town we
[59:30]
would um heavily lean on the township's
opinion there. Uh but ultimately, if
[59:35]
it's zoning related, the county is the
authority. If there's a problem with it,
[59:40]
I also want to hear about it. Um, and
then hopefully we can work through
[59:45]
whatever that is. But I can't say that
just cuz the township doesn't or
[59:49]
disagrees with it that we ultimately
will deny anything.

um an applicant uh uh an applicant would

go to the township and ask them
like I said before and um the township
[1:00:13]
didn't have a problem as far as the
culbert for the driveway or what have

didn't want it. Whether they didn't like
[1:00:27]
them, they didn't want the building
there that even though they they said
[1:00:32]
they wouldn't, you still give them the
permit.
