[1:20] Uh, please take notice that an application was ma has been made by
[1:23] Charles and Sharon Wager revocable trust at 15626 state 76 in Calonia to reszone
[1:29] an area from the agricultural protection district to the residential district in
[1:33] Calonia Township on the following premises. It's part of the west half of
[1:37] the east half of the southeast quarter in section 11 township [clears throat]
[1:40] 102 range 6 in the county set applicant standing and making application RSV
[1:44] owner of said described lands. A hearing on this application will be held at the
[1:48] Houston County Commissioner's Room in Calonia at 5:00 PM on Thursday, August

[2:18] Are the applicants here? Would you want to come forward?
[2:28] Have a seat up there if you would.
[2:44] » Hi. >> Hi. I understand you want to build a
[2:47] house on on the same quarter quarter as there's already a house
[2:53] which I'm just informing you of what the zoning rules are
[2:59] um and our comp plan um you can build a house on quarter quarter which is 40
[3:06] acres um on an open quarter quarter and you can build it on prime egg land
[3:13] [clears throat] what it says. is now um um
[3:21] you have two I think two way I see it here you have two open quarter quarters
[3:26] on your property to build on two 40s that are not are buildable.
[3:32] » That's right. Yeah. >> Okay. Well, you go ahead and explain
[3:36] what say what you want to say. Okay. You mind if I and I did just ask me to kind
[3:40] of speak on their behalf and then they can answer questions, too. Or would you
[3:43] rather? It's up to you guys. >> All right. So, um, so my name is Andy
[3:49] Allen. I've sat in you guys room here many times, it seems like. Thankfully,
[3:53] we're not talking solar this time. [laughter] Um,
[3:56] » thought you look familiar. >> Yeah, you go figure. Um, so fortunately,
[4:00] Charlie and Sherry, I would say that they're probably as close to me as
[4:04] family. I've been neighbors with them ever since I was born and we farm next
[4:08] to each other and we are blessed to still farm with next not with them but
[4:12] next to them. Um Charlie and Sherry have over the past few years realized they're
[4:19] not as young as they used to be. Um [clears throat] their mobility is
[4:23] changing as we all are dealing with it. And they approached me and said, "Hey,
[4:26] could you look at building us a home that has zero entry, no steps, and so
[4:31] on." and they address that issue that as we get older, if we can move into a
[4:36] place that does not have stairs, it might be able to prolong the ability for
[4:40] them to live independently versus going into an assisted living and so on. And
[4:44] and we all will deal with that at some point. Fortunately, Charlie and Sherry
[4:49] have a beautiful farmhouse. It's two stories, lots of steps, just not
[4:52] conducive as they age. So, we looked at different locations and and you know, a
[4:57] lot of their property is close to the city limits or right on the edge. Um
[5:01] yeah, pretty much all of it. Yeah, they uh you know, their family is their three
[5:05] generations of farming. They've very very good stewards of the land and and
[5:10] the community. Um looking at the different parcels that they own, the
[5:15] location that has been presented to you guys suits their needs the best. Um they
[5:21] do understand there's other quarter quarter sections that they could build
[5:24] on that would not have the resistance and and [clears throat] of course the
[5:27] guidelines the county is requiring. The reason they've chosen this area, I just
[5:31] got some notes, but basically it's a lot of things. Um,
[5:36] their safety just coming out onto the highway. County One once you turn and
[5:42] and you take 76 out of town, uh, 76 is a busy road. Their concern is going out on
[5:49] 76, getting on and off that highway. That's going to be a challenge for them.
[5:54] Second thing is they take care of their grandkids substantially and future great
[5:58] grandkids. So by [clears throat] having their property where it's located with
[6:05] some of the rumors of possibly a bike trail and things like that, their kids
[6:10] or their their children and then their grandchildren and great grandchildren
[6:14] will have an easier path to get to and from the school, especially the high
[6:17] school. And this is going to be a 20 to 30 year process because of their their
[6:21] grandkids. So that's a big factor that they're looking at. And even if the bike
[6:25] path from Beaver supposedly has been talked about, that doesn't happen. It's
[6:29] still going to be much safer for their grandkids to ride bike to the the
[6:32] schools, especially when I think Warrior Drive is established. Um 76, you know,
[6:38] that's where the the two quarter quarter properties that they could build upon.
[6:42] That also is I think we've always seen that that can be just a monster of a an
[6:47] issue regarding snow. And I think that's a concern of theirs as well. Um the
[6:52] county has approached Charlie and Sherry over the years to ask if they can
[6:56] utilize their land to push snow off of 76 just because it just tunnels through
[7:00] there. Um >> the state it
[7:03] » or state, I'm sorry, not the county. Thank you. State. So those are I guess
[7:08] some of the things that that has pushed them to look at the spot on county 1. We
[7:12] understand, you know, we understand there's another quarter or there's
[7:15] another residence on that quarter quarter, which is why we're here.
[7:18] They're literally right across the road is city limits and we understand because
[7:22] they're within that 2-m uh location of the city limits of
[7:26] Calonia that gives them this opportunity to at least file an option. Okay. So,
[7:31] any other questions or would you guys like to say anything else?
[7:34] » Maybe you should think, and I'm not telling you, but uh if you're thinking
[7:39] about getting old like me, maybe you should think about building in town.
[7:44] » No, I'm not trying to be smart. No, >> I don't want to.
[7:48] » She don't want to and wherever. [laughter]
[7:52] » You're close enough to town. >> Huh?
[7:55] » You're close enough to town. >> Exactly. Exactly. [clears throat]
[7:59] » If I might >> I don't want neighbors.
[8:01] » I'm sorry. [laughter] >> I want to Yeah. I want to be close to
[8:04] town, but I don't want to be in town. >> We hear a lot about the two miles
[8:11] from the city limits and not just in Calonia, all over. Um there is uh
[8:18] correct me if I'm wrong but I think there's six is there six towns in
[8:23] Houston County or is it seven whatever six or seven
[8:28] if you take for example now >> seven
[8:31] » two miles seven you take for example 2 miles from the
[8:37] city limit yeah we'll use Calonia and you go west
[8:44] as a crow ply guys, you're that prime egg land is buildable
[8:52] if this board approves it all the way to Beaver Park. You go
[8:59] go uh northwest, it goes all the way over to where Bob Allens and and Mike
[9:06] Engles got their dairy. >> Mhm.
[9:08] » Then [clears throat] if you go north, it's out where the old sail barn. What
[9:13] I'm getting at here is if you take and I'm not not trying to put put things in
[9:19] your mind. I'm just telling you the facts. You take from Springrove
[9:25] to [clears throat] Calonia, the city limits, it's 10 miles.
[9:30] So now if if you can build if if you can build on prime egg land two miles from
[9:39] Springrove and two miles from California,
[9:43] you got six miles left. If you get enough houses
[9:49] built in that two mile radius, the city looking at all that revenue,
[9:57] they'll annex some of that in. And I'm just bringing these facts out of what
[10:02] could happen. Then once they annex that in, now you got two miles again from the
[10:09] city limit after they annex it in. What I'm getting at here is we're the
[10:14] ordinance is trying to protect the prime angle. That's what they're trying to
[10:18] protect. I'm not trying to discourage you trying that you can't get a building
[10:23] per that the residential, but if we start where are we going to stop and
[10:29] I'll let some the rest board members comment.
[10:33] » Yeah, I think the nice part with this scenario, right, we're not two miles. We
[10:36] don't have to worry about we're talking 10 feet through the city of Calonia,
[10:38] right? I can hit a golf ball down to a 40 uh house development not in city
[10:43] limits right down the road. Right. So I think the nice part it's essentially the
[10:48] city of Calonia. So it should probably be treated in a very similar manner.
[10:55] [clears throat] >> Yeah. In a perfect world
[10:59] uh a development this close would be annexed to the city. But we all know
[11:03] that cities are strapped too for extending services and um Calonia
[11:10] is looking to move kind of northward um above the I think it's the dearing
[11:15] estates to to 76 and I've heard talk of maybe something just to the west of
[11:20] there but it can it's probably not in any of our lifetimes that it might even
[11:25] move that far. So this would be an option to have kind of a similar
[11:29] development to what you'd see within the city. Um but right on the edge of it
[11:42] » maybe your lifetime I suppose [laughter] >> he's the youngest one here. So
[11:48] » can I one other thing I did want to say and I might have made note of it in your
[11:52] packet maybe not but they they surveyed out you know so they paid for the perk
[11:56] test they paid for the survey and so they've got a lot of money already
[11:59] invested in this. I'm not saying that should sway you one way or another, but
[12:04] they're not intending to take any more land, you know, so they understand the
[12:08] value of acknowledging, you know, prime egg land. Um, ideally when when we are
[12:14] done with the build, it's just going to be the structure and then the the septic
[12:19] field. There might be a garden shed down the road, but the survey, you know, and
[12:23] per Amelia and I, we talked about, you know, well, we're just going to start
[12:26] with two acres, but realistically, it's probably going to be between an acre and
[12:30] an acre and a quarter is what we're we're expecting it to be. So, so
[12:33] [clears throat] be very minor. And I mean, if if and it's not an option, it's
[12:38] not on the table, but sadly, if they said, well, you know what, fine. We will
[12:41] go and we'll build on one of those other quarter quarters. Well, then we're still
[12:45] taking up to two acres or whatever, you know. So, it's I understand I understand
[12:50] it's it's a it's a muddy area. Um, but they would have that right. So, then
[12:54] they could say, "Yep, well, we're going to take those two acres out of
[12:56] production." Blah, blah, blah. So be it. But I guess I would just ask for some
[13:01] grace on your part. The age factor and the safety for them
[13:06] and their their grandkids, that's that's kind of one of the biggest reasons why
[13:09] we're looking at that spot.
[13:14] So, Ailia, you you got down here as a recommendation
[13:19] that this were to be approved,
[13:25] the reszone to residential
[13:29] that there could be no other building going on in that plat or that
[13:35] quarter unless it's platted. Right. >> Correct. Yep.
[13:40] » Yep. >> A single. We've been handling single lot
[13:42] [clears throat] subdivisions. We could just reszone. No plats required.
[13:46] » Um but as soon as you would make it a two lot subdivision, then you would
[13:50] require plat. >> Yep. So they would have to go through
[13:52] the expense and work of platting it. >> You know, as if you wanted to sell off
[13:59] some more land to do, you know, >> I don't want
[14:02] » you don't want to do I'm [laughter] I'm guessing you don't want that to happen.
[14:05] So >> I mean if there is a you know a
[14:08] protection from this becoming a development
[14:12] » you know by this >> next owner
[14:14] » and that that review would go in front of you guys then too. Sorry Franklin to
[14:17] interrupt >> and it would go on to the next owner if
[14:19] someone were to buy their place that still would be in place that they could
[14:23] not so that would be adopted with the buy the bylaw of that property. Yep.
[14:29] » So who who's uh oversees that? So that's in there.
[14:36] You have to put that in the abstract then if it's going to be binding that
[14:42] » that no other buildings could be built on that 40. Isn't that what you're
[14:47] getting at? >> Mhm.
[14:48] » No other houses without a sub without a >> it would have to be subdivided. You have
[14:52] to create a subdivision, right? So that would go ahead. You can answer. when you
[14:58] when you guys adopt your conditions on permits, those get um put on the orders
[15:04] that then get recorded. So that's how they're memorialized.
[15:10] » So that's with it.
[15:14] » So they find that like a title search then.
[15:16] » Yep.
[15:22] And I'm pretty sure I covered this, but if they still owned the house that you
[15:26] guys sold to >> Kevin, right, trader
[15:29] » Kevin? Yeah. >> Yeah. If they still own that,
[15:33] » we wouldn't even be sitting here. >> Well, exactly.
[15:35] » That's why Yes. That's why we're here because Okay. I just wanted to clear
[15:39] that. Make sure that >> Well, I mean, we couldn't they couldn't
[15:43] own that and then permit another one. But yeah, if they were living
[15:46] » correct, they could get a permit to build one. Yeah. Easily enough. Yeah.
[15:51] » Yeah.
[15:55] » You sold that a long time ago, didn't you?
[15:57] » What's that? >> That that house. You sold that a long
[16:01] time ago. >> Where Kevin is?
[16:03] » Yep. >> Yeah. Or no, Kevin. That's you bought
[16:07] the house. >> Well, how long ago did you guys sell
[16:08] that to Kevin? You remember? >> What did you sell the the the house just
[16:12] the house to Kevin and Char? >> Oh, god.
[16:16] » Long time ago. must be about I'd say 17 years or something like that.
[16:21] » Yeah. [clears throat and cough]
[16:24] » 2011. >> Does he have he doesn't have he never
[16:27] submitted a comment or have any? Okay. >> We didn't get any comments.
[16:31] » Okay. Well, I will say
[16:35] um Don and Margie Fairing did something that
[16:39] » you know most people wouldn't do and Sherry informed me of this and she
[16:43] actually approached um >> Yeah. Margie and her
[16:48] » I'll let you say you can say it better than I can.
[16:49] » Margie and her husband, what's his Don? >> Don.
[16:53] » So they're the neighbors directly to the west. Oh,
[16:55] » okay. Yep. >> They came up to me at the fair and said,
[17:00] "Uh, we didn't even know we had a feed lot
[17:04] permit." She goes, "We have 10 cattle." And she said, "We were informed that we
[17:11] don't need that feed lot permit." And >> and that's one of the reasons probably
[17:17] why you're not being able to build out there. So they went up Monday morning
[17:22] and dropped their feed lot permit >> in assistance for them
[17:26] » for us. So >> So she's
[17:29] » and that's why it's not in the packet. Is that right?
[17:33] » Correct. [clears throat] Oh, >> they would have had to get a variance.
[17:34] Is that what you're >> Oh, yeah. It would have required just an
[17:37] additional step for him. >> So yes,
[17:40] » that's kind of cool that the neighbors that supportive.
[17:43] » When she found that out, she went they went up and he was I got the paperwork
[17:46] if you need it. [laughter] So,
[17:50] » we would all love neighbors like that. >> Yes.
[17:55] » So, is there any public comments from the public that's here tonight?
[18:00] » Positive. >> Everybody thinks it's a good idea on our
[18:03] part. [laughter] >> Well, we'll let them say that if if it's
[18:09] public, [laughter] you're the applicant.
[18:13] [screaming] got any more questions of the board or
[18:19] » I think you know if you're going to do it somewhere here's a spot to do it at
[18:22] borders city property there's a big development down the street not in city
[18:27] property lines with the area makes a lot of sense
[18:35] I think I do agree that one's a better approach for many different reasons
[18:40] [clears throat] snow traffic I agree with
[18:47] How far off road is the house? I see the stakes out there.
[18:51] » Yeah. Um, boy. And I should know my setbacks. Um, I think we pulled 300
[18:58] foot. You know, >> that's a ways out there.
[19:00] » Well, and that's the the stakes are the very farthest because that's a that's
[19:03] the survey. You know, the house clearly we're not going to we're going to be
[19:07] closer to the road there. >> Yeah. Yeah. The requirement's 100 feet,
[19:11] isn't it? >> Yeah, I think so. Yeah. So, I mean,
[19:13] we're going to be in that 120 foot, you know, off of one, but that's but the
[19:20] stakes are I mean, they're there, but they're not. So, don't let that cloud
[19:23] your your image of that. It's just we had to start somewhere. So, but that's
[19:28] you can see where the stakes are. And that's a general um location. It's I
[19:32] think we talked about it's most likely going to be an east facing garage. Yeah.
[19:37] Um, so it'll be a side, you know, come in off of one and then they'll turn, you
[19:41] know, towards the west, there'll be an end load. Um,
[19:46] pretty modest house. Nothing too spectacular. So, it's great for you
[19:49] guys. Don't take that the wrong way, [laughter] but it's
[19:53] » it's a slab on grade. >> Slab on grade. Yes, sir. Yeah. Slab on
[19:56] grade. Yeah. We'll be able to manipulate the the soils. I mean, everything. It's
[19:59] It's going to work out really nice, you know, compared to a lot of the homes we
[20:03] build in the Crescent where people should not build it. This is wonderful.
[20:09] So,
[20:13] we've zoned different ones uh from [clears throat] agricultural
[20:20] land to residential in the Lacrescent area while I've been on the board, but
[20:26] they all been on marginal land. None of them have never been on prime prime
[20:30] eggland down there. They could have done it before I was on the board. I I can't
[20:35] speak for that. >> That's just because they don't have
[20:38] prime eggand over there. >> That's why the zoning ordinance says
[20:42] we're going to [laughter] protect our prime.
[20:45] » Yeah. I think one wasn't farmed and one was farmed, but it was the soil types
[20:50] considered it marginal. So, >> right.
[20:53] » Yes. >> Yep. Yep.
[20:56] And that's just where we've seen the pressure lately is around the crescent.
[21:02] » Any other questions?
[21:06] » We can ask questions. >> The big question we got now is there's
[21:11] another house on that same quarter. >> Mhm.
[21:15] » If there wasn't be no problem, [snorts] >> correct?
[21:19] » No.
[21:23] » Yeah. just cuz I had this is probably the most common question I had on this.
[21:27] Um the rule is one dwelling per quarter quarter in the egg district. So
[21:32] currently the Shrader's dwelling occupies that dis that um quarter
[21:36] quarter and so that's why they're here today to um make the reszone request so
[21:41] that they could add >> that's why
[21:44] residential
[21:49] » not the whole >> No just the two just the two just two
[21:54] acres whatever. >> Yep.
[21:56] » That's a good point. It was advertised with the whole one just cuz that's what
[21:58] the existing parcel is. But as soon as things are fi uh finalized with this
[22:03] then that 2acre parcel would be created.
[22:09] » Anything else? [snorts]
[22:14] » Not we'll go to the proposed findings. We can ask questions after the findings.
[22:23] Um, so staff drafted five findings here for you, but you guys can always add
[22:27] additional or remove any of these as you see fit. [clears throat]
[22:31] Um, I'll just read through them quick. So, one, goal 1.3 of the goals and
[22:35] policy section in the comprehensive land use plan encourages location of urban
[22:38] development near the major cities where services can easily be provided and
[22:42] extended. This property runs to the middle of the of county 1, which is also
[22:46] the northern extent of city limits. At this point, city services do not extend
[22:50] the property. Number two, policy one under agricultural goals and policies
[22:54] calls for protection of prime agricultural land by limiting
[22:56] development in agricultural areas. Allowing this reszone will keep
[22:59] development closer to existing development and the public road which
[23:02] will minimize impact on the land. Number three, this parcel is currently 40
[23:06] acres, but the applicants have chosen to only reszone 2 acres in an effort to
[23:10] restrict future development. If additional lots are desired, another
[23:13] reszone will need to be completed along with a plat approved under section 36 of
[23:17] the ordinance. Number four, policy one of goal 3.2 of the comprehensive land
[23:22] use plan discourages development in areas where on-site sewer systems are
[23:26] likely to malfunction due to poor soil characteristics. Preliminary soils work
[23:30] has been completed for this proposal and meets state requirements for septic
[23:33] systems. And number five, that the this the parcel meets buildable lot and lot
[23:37] area standards identified in the Houston County zoning ordinance. [clears throat]
[23:43] » Does any of the board want to add anything to it?
[23:51] Well, those are the findings. Um, yeah, I
[23:57] they look fine to me. I I just want to reiterate number one there. That is
[24:03] a goal to keep within our comprehensive land use plan to encourage development
[24:10] from close to our cities and out. In my opinion, if this was two miles
[24:17] out, it wouldn't happen. Even if it was two miles or 1.9,
[24:23] especially if there was another quarter quarter that was open. But seeing as how
[24:27] it's right across the highway from the city limits
[24:32] and it's near a development area, um I think this is this complies with
[24:41] our comp plan.
[24:47] Realistically thinking I mean hopefully well depends on but you know the next 40
[24:53] over from the development leads right into make sense to be
[24:57] development at some point and then trader house is directly across from I
[25:01] mean you're right next to city at that point you know kind of already are but
[25:04] even then even more right >> that other one's now filled up and it
[25:08] only makes sense one day to do that so >> well as Amelia pointed out dear estates
[25:14] want they want to develop that. >> Yep.
[25:16] » The next one next one would be Gavins there along the high school
[25:21] » then right across from Gavins and then >> Yep.
[25:25] » I get the idea what you're saying Franklin about protecting farmland. That
[25:29] is very important in our comp plan. That's what we need to do. Um
[25:35] [clears throat] this is 2 acres. If they were ever building the other parcel,
[25:40] they'd be taking up prime farmland too. But
[25:48] » I think to the comment you made earlier, Franklin, and your point to that's why
[25:53] these are reviewed site specifically. So you can
[25:55] » right sight specific and different
[25:59] circumstances for different sites and different act, you know, inquiries. So
[26:04] not they're not all the same. So,
[26:11] » anything else board?
[26:20] I know you talk about the air site going towards Houston there. There 40
[26:26] acres like you said, it really drifts there.
[26:31] Snow is really bad. Mhm. >> It's not a good place to come out on a
[26:36] driveway. >> No. No.
[26:39] » No. Not. Yeah. >> Not at all.
[26:41] » Across from the other building site there. That That's a bad area for
[26:45] drifting. >> It seems like from Shirley Klein, even
[26:49] beyond Shirley Klein, but >> Oh, yeah. Or Darlene, sorry. From
[26:52] Darlene Klein all the way and the the building site where Kevin and Charrader
[26:57] live, that's blocked. So then a lot of the snow is dumped there. But man, it's
[27:00] just And you don't have to have a horrific snowstorm. It just can be wind,
[27:05] you know, picking up all that snow westbound and
[27:08] » Yeah. >> and so on. It's
[27:09] » Well, there's sometimes in the winter I go across Angus Drive to hit
[27:13] » Oh, >> yeah.
[27:14] » coming to the highway cuz it's not safe. >> Yeah. [snorts]
[27:18] » The other way.
[27:22] » Anything else?
[27:28] So, do you want to read the proposed motion?
[27:32] » Um, do you want a motion on the findings?
[27:35] » Oh, yeah. We got to have a we got to have a motion to accept the findings.
[27:39] I'm sorry. >> I'll make a motion to accept the
[27:41] findings. >> Is there a second?
[27:42] » We'll second. >> All in favor? Second by saying I.
[27:46] » I. >> Opposed. Motion carried.
[27:52] » All right. So, um, the motion could be to recommend the Houston County Board
[27:57] approve an amendment to the zoning map for the two acres identified by GCU
[28:01] survey number 26-217 of parcel ID 0301190000
[28:07] from egg protection to residential with one condition. That's that the reszoned
[28:12] area shall contain one buildable lot unless a plat is approved under section
[28:16] 36 of the Houston County zoning ordinance.
[28:22] » [snorts]
[28:25] » We even have it in writing that they do not ever intend to develop. [laughter]
[28:33] » I was just in your letter here. Yeah. [laughter] Okay.
[28:38] » It was do not. It was in big letters. >> That's right. [laughter]
[28:43] » 50 years, 60 years from now, it'll never be developed on the rest of that. Is
[28:48] that what you're saying? [clears throat] Yeah.
[28:53] » Well, there's a proposed motion. What is >> I'll make a motion to recommend approval
[28:58] based on the one condition.
[29:03] » Is there a second? >> Second it.
[29:06] » Is there any more discussion?
[29:10] » A roll call vote. >> Larry,
[29:12] » yes. >> John,
[29:14] » yes. >> Josh,
[29:15] » yes. Franklin. >> Um, I have to say no for the simple
[29:20] reason is I I hope you get it, but for the simple reason is I'm a stickler on
[29:26] the zoning ordinance. And by going with two houses per quarter
[29:31] quarter or two houses on the same quarter quarter,
[29:36] we could be setting a precedence against what's going to happen in the
[29:41] county. The other thing is the prime prime land prime land.
[29:48] [clears throat] Okay. Uh Eric.
[29:53] » Yes. And it basically because it it does comply with our comp plan on where we
[29:59] want to see order redevelopment. It's close to the city limits. Um
[30:08] and you know I get what Franklin's talking about.
[30:11] the second house and a quarter quarter that's in place to help
[30:17] density in the egg district and it should we should adhere to that and
[30:23] that's what we try to do is adhere to that but this is a different situation
[30:28] being close to the city and uh and this is what you know our exception
[30:34] for that >> [cough and clears throat]
[30:41] » Chase, >> yes.
[30:43] » And Rich, >> yes.
[30:49] » Motion is carried. Good luck. >> Thank you.
[30:52] » Thank you guys. Appreciate it. Appreciate all your time.
[30:55] » Um, these guys are just a recommending body. It'll go to the board of
[30:58] commissioners then on September 15th for final decision.
[31:02] » All right. Thank you again, everybody. Thank you. Thank you.
[31:05] » That's an easy one. We can all agree. [laughter]
[31:10] » There's got to be one stick in the mud. [laughter]
[31:16] » Thank you, guys. Yeah. >> Yep. Thank you.
[31:24] I'm >> glad we could all have a little humor
[31:26] with it. [laughter] >> Well, we all got our own opinion as we
[31:29] have a board. >> Yes, we do. see if [laughter] I will
[31:33] » um >> compared to when you use
[31:35] » okay took too long. >> I will read that. I forgot to mention
[31:38] before we started and maybe you guys noticed that, but Michelle is still here
[31:42] clerking. However, she has taken a different position with our office and
[31:46] [snorts] um so she is going to help start helping
[31:50] with some of the uh more technical work I guess on the zoning side. So, she
[31:55] wrote the staff report today. So, she's just going to come up and
[31:58] » Oh, >> she did all the research and um
[32:00] » not leaving the office. >> Oh, good. She just moved to a different
[32:05] part. >> Yeah.
[32:06] » Took a cut and tape. I told [laughter] everybody.
[32:13] » Let's see. >> So, this is your first running and I'm
[32:15] sure it'll be just fine. So, >> I hope so.
[32:19] » All right. So, please take notice that an application has been made by David
[32:22] Kingsley at 3784 Christensen Hill Road in Houston for conditional use permit to
[32:27] operate a wedding and event venue in the agricultural protection district in
[32:30] Money Creek Township and it's on part of the southeast quarter and part southwest
[32:34] quarter of section 22 township 104 range 7. said applicant standing and making
[32:39] application is as vowner said described lands and a hearing on this application
[32:43] will be held at the Houston County Commissioner's room in Calonia at 5:20
[32:46] p.m. on Thursday August 27th. All persons having an interest in the matter
[32:51] may attend the hearing or submit comments relative to the granting or
[32:54] denying of set application. Comments should be mailed to the Environmental
[32:58] Services Department or emailed and must be received by Tuesday, August 18th of
[33:02] 2026 to be included for review prior to the hearing. All comments are considered
[33:06] public record and this was advertised on August 12th of 2026.
[33:13] » You're ahead of the game. You're already up here. [laughter]
[33:17] » That's good. >> We weren't sure what we were supposed to
[33:19] do. >> You're fine. You're fine. [laughter]
[33:21] You're all right. >> Don't go back.
[33:24] » Go ahead. Uh, whoever's tell us what you're going to do.
[33:30] » Uh, I'm Dave Kingsley anyway on Christensen Hill Road up there. We had
[33:35] uh in 2022 the old barn blew down on the foundation
[33:42] and we rebuilt a structure back on top of it and it was kind of sitting idle
[33:50] there. I mean we we had didn't really build it like an old barn, but it was a
[33:56] place to store stuff and everything again. old dairy barn that was
[34:00] underneath. We had converted it to a horse barn afterwards and all that was
[34:06] fine. So it was like, well, why should we tear it all? It's super foundation
[34:12] yet. So anyway, we rebuilt it and um [snorts]
[34:17] decided to try and make something out of it rather than
[34:23] just sitting idle or whatever. You know what I
[34:25] » Yep. I'll say basically otherwise it fills up with storage. We don't bail any
[34:31] hay anymore or whatnot. So we just thought we'd try and make a venue out of
[34:36] it and [clears throat] >> we went ahead and done the remodeling in
[34:40] it and you know put a deck and a ramp on it and then whatever the county and
[34:46] state been complying with whatever they want and make it happen and
[34:51] » Mhm. Is that cement then? A cement floor or
[34:55] is it wood floor? >> Wood floor.
[34:57] » Wood floor. Yep. >> So you got a twotory or you got a one
[35:00] story? >> It's a dairy barn underneath and then
[35:02] basically it's twotory. So it's like where an old hay barn was.
[35:06] » So you just built on the walls. >> Yep. We just built on the old exist
[35:10] » wood joist and made a wood floor and then
[35:14] » Yep. >> Yep.
[35:14] » I think there may be pictures in your packets.
[35:17] » Yeah, we got them here. >> What it looks like and it's a steel
[35:20] building basically. I'm Tammy Adcock. I'm the neigh the neighbor lady.
[35:24] [laughter] >> Okay.
[35:25] » The neighbor lady that that >> she's the one that takes care of me.
[35:30] » Terrible at all this stuff. >> So So basically steel building, right,
[35:36] with with wooden floor and >> well the reason
[35:41] » all new construction and >> reason I asked them questions because I
[35:46] know where the where it is. So, I just wanted wanted you to explain it.
[35:52] » I didn't mean to interrupt. >> No, that's okay.
[35:55] » Um, so your proposal is that you are going to have weddings
[36:03] » and maybe other [clears throat] >> parties. Not necessarily parties, but
[36:10] whatever is that. That's >> Yeah. Um, birthday party, whatever.
[36:14] graduation celebrations, um class reunions.
[36:19] » Yep. >> So when you say uh you have to have to
[36:25] abide by the state uh when it's for recreational I don't know if it would be
[36:31] called recreational and there's state and I'm trying to
[36:35] learn something here that's why I'm asking
[36:37] » me too. Uh there's state guidelines different for something like that then
[36:43] is that >> what we had to do is to apply for an LLC
[36:48] through the state and we did that and we had to post it in the newspaper for two
[36:54] consecutive weeks and did that and so um they don't require lensure per se for
[37:04] a wedding venue but we had to set up the LLC and then go through the county for
[37:09] the conditional use permit. And so we did do that and Dave went to the Money
[37:16] Creek Township on August 6th and presented all of the information and it
[37:20] was approved at the Money Creek Township meeting.
[37:24] » So Money Creek Township didn't have any issues or problems with it?
[37:28] » No. Not at all. >> Yep.
[37:29] » No, I I was there at that meeting. Yeah. There were no issues at all.
[37:34] » Yeah. But yeah, so I mean I've just kind of talked to I think I've talked to you
[37:42] on the phone, haven't I? Haven't I? >> To both of them. [laughter]
[37:46] » Okay. Tammy's done most of it, but
[37:50] » And so at this point in time, it is Dave rents
[37:56] portaotties from a company in Iowa and handwashing
[38:01] stations. So there's no septic involved or anything like that at this point.
[38:06] Maybe in the future at some point. Um uh we have the handicapped ramp and
[38:16] um so
[38:20] we're complying with that and pretty much whatever we needed to do is what
[38:25] we've done so far and I believe all of that is in your packets.
[38:31] on the note with um ADA can explain that a little bit more. So we are a non code
[38:36] enforced county meaning we don't actually enforce the building code here.
[38:40] However, the one thing the county is obligated to do is ensure that um the
[38:45] disability uh or accessibility co code is met. And
[38:49] so we don't employ anybody to do that. So we [clears throat] like put that back
[38:53] on the applicants to make sure they're meeting those.
[38:57] And I believe all of that was discussed at the township meeting.
[39:01] » Yeah, I think there was um I think the only issue was maybe put some signs up
[39:08] as cuz there would be people crossing the road. Um that's the only thing I
[39:12] remember. >> Right.
[39:14] » Byers know there's an event going on. >> Yeah. Because in addition to the
[39:18] building, what he has is right across the road, probably a hundred yards, is a
[39:23] beautiful area >> that overlooks the Rut River Valley and
[39:28] the the Bluff Country and that's where the weddings will actually take place
[39:33] where people can overlook the valley >> during the ceremony
[39:39] » or to have their reception.
[39:44] » Yeah. So, you have plenty of places for people to park.
[39:47] » Yes. >> Yep.
[39:49] » You have parking for what? At least 200 cars
[39:53] » at least. >> Yep. Looks like you'll have enough space
[39:56] for that. I I notic in the uh one of the recommendations is no
[40:02] parking on the road. Yeah, >> we'll discuss that at the meeting, too.
[40:07] » Yep. And then the um decibel part of it been being
[40:13] addressed here. And I know I talked to Michelle about that a little bit that
[40:16] that it might be a possible concern. So we've because we
[40:21] got these in other places in the county. So
[40:25] » you know, sheriff always gets calls in the middle of the night saying they're
[40:29] too damn loud. You know, [clears throat] >> it's kind of out in the middle of
[40:33] nowhere. >> Yeah, I know. You're kind of
[40:36] » very well insulated and >> Yep. You're isolated.
[40:39] » There would be no no music outdoors that I can foresee. So
[40:44] » yeah, and there is only one dwelling and it's like 1,200 ft away from the
[40:48] property line, I think is what I measured.
[40:50] » Yeah.
[40:53] » Some of the other venues they have a time frame that they cut people off. Are
[40:57] you guys I didn't read that. Are you guys going to or not? Or I'm just
[41:01] asking. It it it like >> we have a contract
[41:05] » contract set up with it and it does it say midnight or
[41:09] » um I believe >> parties go but I mean
[41:12] » yeah I think that's what we have in here is that it's midnight and
[41:17] um it kind of lays everything out. Let me look and see exactly what it
[41:23] says. But I think that that's what it is is midnight.
[41:27] » And then Dave, you live at on site correct? So you in theory would be there
[41:30] if there for events and then [clears throat] you're not far down the
[41:33] road. >> I'm a half a mile down the road.
[41:35] » So >> So one of you two is probably available
[41:38] for any events that are >> Yes.
[41:43] » Yeah, we are.
[41:50] We didn't receive any comments. >> No. And I don't think there's too many
[41:56] left in the audience for [laughter]
[42:04] portaotties from way I understand it that solves a lot of problems for
[42:13] you than having sewer system and then
[42:17] » right >> I mean other ones uh
[42:22] that have the same type of things. [snorts] They they like the portaotties.
[42:30] » Simpler. I mean, for me anyway. >> Yeah. Yeah.
[42:38] » So, in the future down the road, Michelle, if they needed to do a sew
[42:42] system, they would have a spot for it. >> Yeah. I think they'd have room there to
[42:47] » Okay. >> meet the standards and show all the
[42:49] locations. >> Yep. You always got to plan for the
[42:51] future in case. >> Well, we do. Yeah.
[42:55] » Uh if that comes about or whatever, does a person got to come to the county first
[43:00] or the township first or I mean >> it would require a permit through the
[43:06] county. >> Okay. You'd have to get a designer out
[43:09] there, right? >> And that's on Would they have to have
[43:12] two or one? >> They'd only have to have one site for
[43:15] that, wouldn't they? Because it's not new.
[43:18] » Yeah, probably. But the tough part is you're a other dwelling. So how many
[43:22] people do you think you would encompass completely? 100 200 how many?
[43:27] » Yeah, the capacity is set at 175. >> 175 and that's based on um
[43:33] » the square footage >> the square footage per the state's
[43:36] recommendations >> and that's seated. That's 175 people
[43:40] seated. >> You go into an I'm just telling you
[43:43] because I'm in the sewer business. You go into other establishment. So
[43:46] unfortunately and that you guys are going to be
[43:51] this is where a house is on price. You guys are going to be up here for a
[43:55] full-blown sewer probably. >> It's going to be more money
[43:58] » cuz they can I'm just guessing between 8 and 16 gallons a person they're going to
[44:03] figure. >> So what I was thinking
[44:06] » so if you do that times 170 >> that's a lot of juice in one
[44:10] » Mhm. >> day. I take care of a couple other
[44:12] wedding venues >> especially at a wedding party with a lot
[44:14] of beer. >> Yeah. Yeah, [laughter]
[44:17] » I used to be in the wedding world with my restroom trailers and
[44:21] » on a perfect day like this, it fills up fast because nobody's sweating and
[44:25] everybody in a hot day, you sweat it out. On a cold day, they don't drink.
[44:29] It's the weather actually really has >> dictates that a very big part in it that
[44:34] we don't think about till you're into it. But um just
[44:39] other places have done just holding tanks and no drain field because the
[44:43] drain field is going to be >> and then pump them.
[44:46] » Yeah. >> Yep.
[44:47] » Yeah. Holding tank might be a better option.
[44:49] » We just >> That's kind of what you were thinking
[44:51] about my mind. I mean
[44:53] » we just switched a different venue over to that this year and they fill it up
[44:57] about every four weddings. Two big tanks.
[45:00] » Mhm. >> Yeah.
[45:02] » Thank for the info. Well, [laughter] wait for the bridezillaas.
[45:09] » You're giving away advice here, Chase. [laughter]
[45:11] » Catch. >> We like free advice.
[45:15] » So do I.
[45:18] » But yeah, a sewer system, a full-blown one gets expensive, but
[45:22] » right, >> you're you're already twothirds of the
[45:26] way there with your facility. Anything
[45:36] else from the board?
[45:41] If not, we'll go to the findings. There's a couple on there that we could
[45:46] have a motion on to eliminate five and 13. Or is there one more that I
[45:52] missed? Make a motion to scratch number five and number 13.
[45:58] » Is there a second? >> Second.
[46:00] » I'll second it. >> All in favor say I.
[46:02] » I carried.
[46:06] Okay. Go ahead.
[46:11] » Okay. So, finding number one that the proposed use conforms to the county land
[46:16] use plan. Um staff analysis states that goal 1.4 Four of the comprehensive land
[46:21] use plan encourages the implementation of economic development strategies that
[46:25] reflect local values and supports agriculture while attracting compatible
[46:29] new businesses. The Lazy K wedding and event venue will bring guests to the
[46:32] area who will utilize local services, accommodations, and businesses thereby
[46:37] contributing to the economic vitality of the county.
[46:41] » All in favor signify by saying I. >> I opposed.
[46:46] » Go ahead. number two that the applicant demonstrates a need for the proposed
[46:51] use. Staff analysis states this wedding and event venue will act as a secondary
[46:55] income for the applicant and their family while also allowing the applicant
[46:58] to stimulate local commerce within the within Houston County.
[47:03] » All in favor signify by saying I >> opposed. Go ahead.
[47:08] » Number three, that the proposed use will not degrade the water quality of the
[47:12] county. Staff analysis states, "While septic is a potential threat to
[47:15] groundwater, the applicants intend to provide portable toilets and hash
[47:19] handwashing stations for guests during events."
[47:22] » All in favor say I. >> I opposed.
[47:26] » Go ahead. >> Number four, that the proposed use will
[47:29] not adversely increase the quantity of water runoff. Staff analysis states the
[47:33] quantity of water runoff will not increase as the modifications to the
[47:36] existing structure will not substantially increase the site's
[47:39] impermeial surface area. All in favor say I. I.
[47:43] » I. >> Opposed.
[47:45] » Go ahead. >> Um, number five is not applicable. So,
[47:49] six, that potential pollution hazards have been addressed and that standards
[47:52] have been met. Staff analysis states that the applicant has implied that the
[47:56] proposed venue will operate as a low impact event space as there will be no
[48:00] industrial industrial processes, hazardous materials, or waste disposal
[48:04] activities associated with hosting weddings and events. All
[48:08] » in favor say I. >> I. I
[48:10] » opposed. Go ahead. >> Number seven, that adequate utilities,
[48:15] access roads, drainage, and other necessary facilities have been or are
[48:18] being provided. Staff analysis states the venue will provide portable toilets
[48:22] and h handwashing stations with the goal of installing a bathroom in the future.
[48:26] The proposed parking lot has access to the public road and ADA requirements
[48:30] will be implemented for parking and access.
[48:33] » All in favor of seven say I. >> I.
[48:36] » Opposed? >> Eight. Number eight, that adequate
[48:40] measures have been or will be taken to provide sufficient off- streetet parking
[48:44] and loading space to serve the proposed use. Staff analysis states the large
[48:48] parking lot will provide sufficient off- streetet parking space for guest parking
[48:52] which will ensure convenient access for all visitors and designated handicap
[48:56] accessible parking will [snorts] be provided. All
[48:58] » in favor signify by saying I >> opposed. Go ahead. Number nine, that
[49:04] facilities are provided to eliminate any traffic congestion or traffic hazard
[49:08] which may result from the proposed use. Staff analysis states there is an area
[49:12] designated for parking that will provide sufficient off- streetet parking to
[49:15] eliminate any potential traffic congestion. In addition, the applicants
[49:19] have identified an area on the east side of Christensen Hill Road that can be
[49:23] utilized for overflow parking. >> All in favor say
[49:27] » I. >> Opposed.
[49:31] Number 10, [clears throat] that the conditional use will not be injurious to
[49:34] the use and enjoyment of other property in the immediate vicinity for the
[49:37] purposes already permitted. Staff analysis states the primary use of the
[49:40] surrounding acreage is agriculture and recreational in nature. There is one
[49:44] dwelling in the vicinity which is approximately 1,200 ft to the southwest
[49:48] of the proposed venue site. >> All in favor say I.
[49:52] » I opposed. >> Go ahead.
[49:56] » Number 11. that the establishment of the conditional use will not impede the
[49:59] normal and orderly development and improvement of surrounding vacant
[50:02] property for predominant uses in the area. Staff analysis states the
[50:07] establishment of a wedding and event venue should not impede orderly
[50:10] development in the agricultural district. The surrounding properties are
[50:13] primarily agricultural and recreational with wooded hillsides and steep slopes.
[50:18] All >> in favor say I.
[50:20] » I opposed. 12.
[50:23] » Number 12, that adequate measures have been or will be taken to prevent or
[50:27] control offensive odor, fumes, dust, noise, and vibration so that none of
[50:31] these will constitute a nuisance, and to control lighted signs and other lights
[50:34] in such a manner that no disturbance to neighboring properties will result.
[50:38] Staff analysis states, "The wedding and event venue will not generate any
[50:41] offensive odors, fumes, or dust. The applicant has indicated that noise
[50:45] levels will be kept to a minimum and lighting will be managed to to ensure no
[50:49] disturbance to neighboring properties will occur. The business plan indicates
[50:52] that the venue will be available to rent 6 months out of the year um May to
[50:56] October with venue occupation time starting at 9:00 a.m. and ending at
[51:00] midnight. >> Um on the dust
[51:06] um why is the dust in there? Because of the road. Is that why you got
[51:11] » um Yeah. So it I mean having the wedding event venue dust could be concerned with
[51:17] the gravel road there, but it shouldn't generate more than what normal traffic
[51:21] would. >> Okay. Well, I just wanted to
[51:24] clarification. All in favor 12 signify by saying I.
[51:29] » I. >> Opposed. Go ahead.
[51:32] » Um [clears throat] 13 is not applicable. 14 that the intensity of any proposed
[51:37] commercial or industrial development is not greater than the intensity of the
[51:40] surrounding uses or not greater than the intensity characteristic of the
[51:43] applicable zoning district. Staff analysis states the proposed use of the
[51:47] property is limited in scope as there are no intentions for future development
[51:51] or expansion to ensure that the site remains consistent with its current
[51:54] footprint and existing land use pattern. >> All in favor say I.
[51:59] » I opposed ahead. number 15 that sight specific conditions and such other
[52:05] conditions are established as required for the protection of the public's
[52:08] health, safety, morals, and general welfare.
[52:12] Staff analysis states the applicant is required to follow all county, state,
[52:15] and federal guidelines for the operation of their wedding and event venue, which
[52:19] should result in the protection of the public's health, safety, morals, and
[52:22] general welfare. All >> in favor signify by saying I.
[52:26] » I [clears throat] opposed.
[52:31] Uh motion to accept the findings. I'll >> make a motion to accept the findings.
[52:37] » I'll second it. >> All in favor say I.
[52:40] » I. >> Oppos. Same sign. Motion is carried.
[52:45] Any more discussion before we move on to the recommended
[52:52] motion? If not, uh Millia, go ahead.
[52:57] » [snorts] >> Um, so if you guys do choose to approve
[53:01] it or recommend approval, it would be to recommend granting a conditional use
[53:05] permit to operate a wedding and event venue in the agricultural protection
[53:09] district. Um, and then there's four conditions proposed. So one would be the
[53:14] permitty shall comply with all federal, state, and local laws and regulations.
[53:19] to the county may enter onto the premises at reasonable times and in a
[53:22] reasonable manner to ensure the permit holder is in compliance with the
[53:25] conditions and all other applicable statutes, rules, and ordinances.
[53:30] Three, no parking is allowed on Christensen Hill Road. And four, maximum
[53:34] amplified music or speaking volume shall be 100 dB outside of the venue, reducing
[53:40] to 80 dB at midnight, with music ending no later than um midnight on Fridays and
[53:46] Saturdays or 1000 p.m. on Sundays through Thursdays.
[53:52] » Just curious, how did that them hours come up? I mean, how
[53:56] » I [clears throat] I based it on the conditions that were on other venues in
[54:01] the county. All right. Um, and I guess obviously if you don't
[54:05] think that they need it, then you can >> No, that that's fine. I was just curious
[54:08] why the different hours, but that just curious.
[54:14] » You're okay with that?
[54:18] » Yeah. Yeah. I mean, [laughter] I don't know how loud 100 dB is, but
[54:23] » Well, that's pretty loud, but yeah, >> you know, keep it within reason. That's
[54:28] awesome. >> He's measuring it on their phone. I
[54:30] don't think anybody's >> [laughter]
[54:32] » The thing [snorts] is it if there are complaints it gives us a threshold to
[54:36] actually test. >> Yeah.
[54:38] » So test >> 100 dB is extremely loud and can cause
[54:42] permanent hearing damage. [laughter] >> So we're talking real loud.
[54:47] » Is that why I'm deaf on one ear? >> Yeah. [laughter]
[54:51] » For the no parking on the road. Do is there got to be some signage for that?
[54:56] Like cuz obviously they can't tell everybody.
[54:59] » We have barricades. that uh >> he's purchased barricades.
[55:03] » Oh, that we >> we've had a wedding there.
[55:07] » Okay. >> Already done.
[55:08] » The neighbors, the friends >> got married there last fall before we
[55:11] [snorts] >> private started this whole thing. But um
[55:16] » we put up barricades just off the >> I mean it's we leave them set back off
[55:21] the road, but they're close enough that no, you can't park here. So parking
[55:26] signs going to >> Yeah. You'll have to police that. So I
[55:29] mean be your baby. Yeah. >> Yeah. And I I understand that and get
[55:34] it. >> So, you have heard the heard the
[55:39] proposed motion. Does anybody want to want to make this a motion?
[55:44] » I was just going to correct something quick that I didn't catch before. So, on
[55:48] number four, we can probably remove the section that says reducing to 80 dB at
[55:51] midnight. Um, just because >> it ends
[55:56] » it ends at midnight.
[56:00] Oh,
[56:04] okay. That makes sense. Whatever. >> Yeah, if it's over at midnight, then
[56:10] » that's fine. We'll delete that part.
[56:20] » Everybody understand that? >> Yep.
[56:26] » Okay. Is there a motion one way or the other?
[56:29] » I'll move to approve it. >> Is there a second?
[56:32] » A second. [clears throat] >> Any more discussion?
[56:37] » Roll call aboard. >> Um Larry,
[56:41] » yes. >> Um John,
[56:43] » yes. >> Josh,
[56:44] » yep. >> Franklin,
[56:45] » hi. >> Eric,
[56:47] » I. >> Chase,
[56:49] » hi. >> And Rich,
[56:50] » yes. >> Motion is carried. Good luck.
[56:55] » Thank you. Yeah. Good luck to you. >> UM
[56:58] » I DON'T REGRET IT. [laughter] >> WELL, YOU CAN ALWAYS quit it, too.
[57:02] That's your call. >> Have you guys heard is Laura sold her
[57:06] place? Is anybody going to the people that bought it? Are they going to do
[57:09] them there anymore or not? >> Who's that?
[57:11] » Laura Craig Brickill. >> Oh, yeah.
[57:13] » Um I have not heard >> I've heard rumors that somebody might be
[57:19] running a wedding venue there, but I don't, you know, in the future.
[57:22] » She sold it back to the family that she bought it.
[57:24] » Yeah. I don't know. >> I heard it was going to keep going, but
[57:28] who knows? >> Don't know for sure.
[57:32] » Did they Sorry, this is off topic. Did you guys have to deal with She fought
[57:37] the sprinkler system thing at first and then they ended up
[57:40] » fire marshal >> to do it. Yeah, you did.
[57:42] » Fire department was up and >> they said, "Put your fire extinguishers
[57:47] here, here, and fire exit signs." >> Yeah, I read that. But they've never
[57:52] said >> Well, she it was a battle hermit. She
[57:55] didn't have to do it anymore. >> That's probably because it's an old
[57:57] barn. >> Yeah, they're small enough, too. I think
[58:01] it's 300. >> Oh, is that
[58:04] » Oh, okay. [snorts] >> They never [clears throat] said enough.
[58:06] » And that's that's Winona County. Well, that's why they didn't bring it up cuz
[58:10] it's a different >> That is Winona County.
[58:16] » Well, thank you. Um, I have a question for Amelia.
[58:21] How much weight does the townships carry? And I have this question proposed
[58:27] to me quite often. If an applicant doesn't go to the
[58:32] township and gets approval, if the town before they come to you or
[58:39] after they talk to you, whichever the case may be, if the township denies a
[58:46] building permit, per se, um does that carry any weight with you? Um or you
[58:52] just go ahead and give them the building permit? Um well it's a little more
[58:57] complicated than [clears throat] maybe what your question
[59:02] is. Uh so ultimately the county has a zoning authority. Um the area where the
[59:08] township where we would go to them for sure for a yes or no is any driveway
[59:13] access onto a township road. So we would verify that with them. And if if the
[59:18] applicant's not meeting what the township's asking for us, maybe as far
[59:22] as location or um like culverts or whatever is needed, um then the town we
[59:30] would um heavily lean on the township's opinion there. Uh but ultimately, if
[59:35] it's zoning related, the county is the authority. If there's a problem with it,
[59:40] I also want to hear about it. Um, and then hopefully we can work through
[59:45] whatever that is. But I can't say that just cuz the township doesn't or
[59:49] disagrees with it that we ultimately will deny anything.
[59:54] » Okay. So, let me ask you this then. if um an applicant uh uh an applicant would
[1:00:04] go to the township and ask them like I said before and um the township
[1:00:13] didn't have a problem as far as the culbert for the driveway or what have
[1:00:18] you. um they just didn't particularly didn't want it. Whether they didn't like
[1:00:27] them, they didn't want the building there that even though they they said
[1:00:32] they wouldn't, you still give them the permit.
[1:00:37] » Yes. If it if it meets all the requirements of the ordinance, my job is
[1:00:40] to enforce the ordinance and not just do what the townships want.
[1:00:44] » Well, I can answer that question. [laughter] Anything [clears throat] else
[1:00:49] anybody got to talk about before we adjourn?
[1:00:54] » I give kudos to Michelle and her first run here. It was pretty good. Good job.
[1:00:59] » Yeah. >> Thank you to both of you for helping
[1:01:04] » and you guys. >> Yep.
[1:01:06] » Welcome. >> Make a motion we adjourn.
[1:01:11] » Second it. >> All in favor say I.
[1:01:14] » I. Opposed meetings adjourned and thank you folks
[1:01:18] for coming.
