[2:48] dilapidated, or discarded shall be stored outside. Inspection,
[2:53] verifies the property does not meet the standard set forth in the code, therefore the

[5:25] pertaining to many miscellaneous items stored throughout the yard.
[5:31] there is also substantial trimming of vegetation needed.
[5:35] the house is unoccupied and apparently visited on rare occasions by the owner
[5:39] who now lives elsewhere. This has been a nuisance property for years.
[5:44] it has previously been before this board section
[5:48] 13, 13 0 4 states. All permissible items stored
[5:52] outside must be in good condition and usable as intended by the
[5:56] manufacturer. New as such. Items that are broken, dilapidated
[6:01] or discarded shall be stored outside inspection
[6:05] verifies the property does not meet the standard set forth in the code. Therefore the
[6:09] property is in violation. Your attached case review illustrates the

[8:23] enough's enough where, you know, we're not even looking to see if the,
[8:27] the garden tools that are being stored outside our
[8:31] serviceable or not. We're taking everything that's not bolted down.
[8:36] is that including the bags of soil I saw on the picture as well, sir. Is
[8:40] that including the bags of soil? Soil I saw on the pictures? Yep. Because you're not supposed to
[8:44] store anything in the front yard according to our outdoor storage and use
[8:49] code, regardless of what it is or what is intended to use sis.

[10:54] wayne town za, is in violation of city code as it pertains
[10:58] to sign maintenance. The south facade of the old
[11:03] troy pike multi-tenant sign that's a large one out by the road
[11:07] is so deteriorated that the wayne town letters have actually peeled away from
[11:11] the facade. They're also birds living in it. So, uh, section
[11:15] 11 89 0 4 states every sign whether
[11:19] requiring a sign permit or not, shall be maintained in a safe, presentable,
[11:24] and good structural condition at all times, including replacement
[11:28] of a defective part, painting, cleaning, and other acts
[11:32] required for the maintenance of the sign. Inspection verifies
[11:36] the property does not meet the standards set forth in the code, therefore the property is
[11:41] in violation. Your attached case review illustrates the violation
[11:45] process and non-compliance of the property. The attached photo shows
[11:49] the deterioration city's own letters mailed to the owner
[11:53] of record have not been returned. There has been recent communication
[11:57] from the owner of the code enforcement office. The owner's
[12:02] representative states they have contracted with a signed company to make repairs,
[12:06] but this is after months of no communication nor
[12:10] action regarding this violation. The tax record shows
[12:14] property taxes are traditionally paid. If declared a nuisance by the
[12:18] board, the property will be abated by the city staff. Recommendation
[12:23] is as follows. The board declare the property a nuisance. The board orders
[12:27] staff to have the city abate the property. If so ordered,
[12:31] the city will bring the property into compliance by removal of the nuisance. This
[12:35] will involve obtaining quotes from signed vendors to determine the price
[12:40] for making the needed repair and moving forward with repairs. Now
[12:44] this report was written for last month's meeting. I
[12:48] have an update. Uh, the sign face that was there has been removed,
[12:53] completely removed. The uh, owner
[12:58] has contracted with fast signs, a signed company in
[13:02] huber heights. Spoke with them today because I
[13:06] had issued a permit for it. And they currently have the production
[13:11] done in their, uh, in their building.
[13:15] but they have to attach clips because they have to reattach
[13:19] the sign panel. So it's ready to go back up as soon as they, everything's
[13:24] fastened. And it will be a nicer sign 'cause it'll have led lighting in inside.
[13:28] so, uh, what if you would look at it today, you would see
[13:32] that panel is gone. The one that says wayne town, it's empty and that's the reason
[13:37] why. So there, there in my report.
[13:41] so you're saying it's in the midst of being repaired? Yes.
[13:45] I talked, talked to the sales rep at, uh, fast signs who I deal with on
[13:49] a regular basis. She went back to their manufacturing area and said
[13:54] yes, it's back there. We're just waiting for the tip, the clips to
[13:58] be attached so we can reattach it to the sign
[14:02] once we have the led lighting in place. So
[14:07] she's telling me by the end of october it should be in place.
[14:13] um, and so my question is, you still want to, your recommendation
[14:17] is still declare a nuisance and have it abated when it's in the process or
[14:22] do we yes. Would you recommend no? Yes.
[14:26] so she told me today we are gonna finish this up when we get
[14:30] paid by the, by the customer. She was going to
[14:34] contact the customer and verify that the check's in the mail,
[14:38] for lack of a better word, I have not heard back from her. So I'm going to go on the
[14:42] premise. This is still a violation. This is still in the work. So

[14:51] abatement with the signed contractor. 'cause I'm quite certain it's

[16:24] of the house. The vacant house has several issues that are abundantly
[16:28] clear, falling, softening, deteriorated, garage
[16:33] door molding, loose downspouts and mold on the siding
[16:37] section 13 13 0 4 states. The exterior of a structure
[16:42] shall be maintained at good repair, structurally sound, and san
[16:46] sanitary. So as not to pose a threat to the public health, safety, or welfare,
[16:51] the owner shall keep the exterior of all premises and every structure there
[16:55] on in good repair. All exterior surfaces shall be maintained
[17:00] free of conditions, reflective of deterioration or inadequate maintenance.
[17:04] maintenance inspection verifies the property does
[17:08] not meet the standards set forth in the code. Therefore, the property is in violation.

[22:21] the property owner, danny caldwell, is in violation of section
[22:26] 1313 of the property maintenance code located at property.
[22:30] uh, look property located at 62 19 apache street. The
[22:34] picture does tell the story here.
[22:39] the property at 62 19 apache street is a violation of the city's outdoor
[22:43] storage code. Numerous junk and discarded
[22:47] items have accumulated on this property. The property has
[22:51] been a nuisance for years and has appeared before this board. Previously.
[22:57] we've also done numerous trash abatements at the property, which don't require
[23:01] board hearings. Uh, there are, uh,
[23:05] as stated, uh, section 13 13 0 4 states.
[23:09] any items a user stored outside of an enclosed building or structure
[23:13] shall be limited to items manufactured for, intended for
[23:18] or customarily used in outboard environments. No items
[23:22] manufactured for, intended for or customarily stored or used
[23:26] indoors may be placed or stored outside. Lawn
[23:30] and power equipment must be kept in the backyard even when used on a regular
[23:34] basis. All permissible items stored outside must be in
[23:38] good condition and usable is intended by the manufacturer.
[23:43] no such items that are broken, dilapidated or discarded shall be
[23:47] stored outside. Investigate, inspection, verifies the
[23:52] property does not meet the standards set forth in the code. Therefore the property is in
[23:56] violation. You attach case review illustrates the violation process
[24:00] and noncompliance of the property. The attached photo shows
[24:04] the items stored on the property as of august 19th, 2025.
[24:10] it has been, reinspected has not gotten any better. City
[24:14] zoning later made. The owner of record have not been returned.
[24:18] there has been no communication from the owner occupant to the code enforcement
[24:23] officer. While the listed owner has been deceased for several years,
[24:27] his son occupies their property and has been spoken to by an
[24:31] officer and is well aware of the violation. His normal
[24:35] practice is let the city clean up the property as he knows fees will be
[24:39] accessed to property taxes. The tax record
[24:44] shows property taxes are not traditionally paid. They are years in
[24:48] arrears. If declared a nuisance by the board, the property will be
[24:52] abed by the city. Any costs incurred by the city will be invoiced
[24:56] to the property. Enter staff recommendation is as follows, the board
[25:00] declare their property a nuisance. The board orders staff to have the city
[25:05] abate the property. If so ordered, the city will bring their property in compliance
[25:09] by removal of the nuisance.
[25:14] so I think you may have partially answered this already, but I know this has been before our board several times before
[25:18] the both the name and the address sound familiar to my years. Yes. Um,
[25:22] essentially the same thing keeps happening. It is, it is picked up and then trash is new. Trash
[25:27] is thrown out there essentially. He, so it's a, it is an unfortunate
[25:31] situation. The, the person who lives there is the son of the owner. He is disabled
[25:36] in a couple of different ways now physically as well.
[25:41] um, he will go to
[25:45] properties. This is in the miami villa's development, which is down off rip
[25:49] rap road. Yep. He'll go around the development cleaning people's yards
[25:53] up for remuneration. Um,
[25:58] and then just brings it home and dumps it on his property. And
[26:02] he knows at some point we will come by and say,
[26:07] I'm gonna get it cleaned up. Nothing ever happens. It's, it's a repeat.
[26:11] he's lived there before with no electricity in that area. That means no water
[26:15] because they're on wells. So we've had issues before at
[26:19] that property,
[26:23] um, where there were five gallon buckets being used
[26:28] for purposes that they're not
[26:32] intended to. That had to be removed. And we have been notifications from the board of health at
[26:37] that time. So this, as long as this man is living
[26:41] there, we'll be dealing with this property. We have to go in occasionally
[26:45] and just clean it up. And that's where we are at this time.
[26:50] and he knows we will. And he's, he knows that we will send a bill
[26:55] and he knows he has no money to pay it. So it'll go onto the property taxes. And
[26:59] because of where this is and the net worth of that property
[27:03] to begin with, the taxes are probably already
[27:08] owed on it or more than what the property's worth in all likelihood. Yes. So,
[27:12] and we don't want, that's not a property that I'm interested in
[27:16] the city taking possession of and tearing down because of what I'm afraid
[27:21] we might find inside as far as the condition of the
[27:25] property and the sanitary conditions and so forth. So we're going to continue to
[27:30] clean it up until such a time as is goes away naturally,
[27:34] if, if you understand what I mean. Mm-hmm . And giving the amount back
[27:38] property taxes is, is any likelihood the county might foreclose on it eventually?
[27:43] um, I, we could probably have it reevaluated on though. I'm
[27:47] guessing the property since it's been in this relative condition for years,
[27:51] as long as I've worked here that it's probably,
[27:55] I would imagine the taxes at least equal or outweigh.
[28:00] I'd have to look through the folder here. The, the tax records are in your, in
[28:04] your reports. But, uh, it, it may be something we wanna look
[28:08] at in the future. So there about 10 k less than the auditor's value looks like.
[28:13] yeah. So my guess is that the auditor went by there and looked
[28:17] at it right now, I don't know if the condition on the outside would make a difference.
[28:21] probably the clutter probably would not make a difference at the property value. It would
[28:26] be a matter of if it had, you know, if the, if it had been partially burned,
[28:30] something like that, that really made it unlivable.
[28:36] you don't do anything with like, uh, I know you as far as evading
[28:40] the property, you go and remove all the junk and stuff that's in the yard.
[28:44] do anything about cleaning the house, the front of the house, washing it down from
[28:48] the mold or anything like that? Or is that the owner's responsibility? I mean as far as
[28:52] I'm concerned, that's the owner's responsibility. Um,
[28:57] at this point in this situation, getting the yard cleaned
[29:01] up and getting all the junk removed,
[29:05] uh, is I think what a priority should be. It's
[29:09] not saying we couldn't spray down the house with, um, a
[29:14] deterrent that would kill it. Sim you know, something that will just eventually
[29:18] cause all the stuff to die. But, but cleaning or
[29:22] spraying a house is something I'm not sure the city's I got. It is,
[29:26] you know what I mean? Yeah, yeah. I was just curious if never been
[29:31] done, but not to my knowledge. Okay. I noticed one of the, uh, gutters
[29:35] like it's hanging. Is that included in this or is this just the junk? Um,
[29:39] I think that we better leave that. At least there's a gutter.
[29:44] so yeah, it's hanging down. That's certainly not the worst of the problems

[31:17] 13 13 0 4 states the exterior of a structure shall
[31:21] be maintained in good repair, structurally sound and sanitary. So as not
[31:25] to pose a threat to the public health, safety or welfare.
[31:29] the owner shall keep the exterior of all premises and every structure there on in good
[31:34] repair. All exterior surfaces shall be maintained free
[31:38] of conditions, reflective of deterioration or inadequate
[31:42] maintenance inspection. Verifies the property does not meet the
[31:46] standards set forth in the code. Therefore the property is in violation.
[31:50] you attach case review illustrates the violation process and non-compliance
[31:55] of the property. The attached photo shows negligence and deterioration.
[31:59] city zoning letters mailed to the owner record have not been returned. There
[32:04] has been no communication from the owner to the code enforcement office. The
[32:08] tax record shows property taxes are traditionally paid. If
[32:12] declared a nuisance by the board, the property will be abated by the ci by the city.
[32:17] any costs incurred by the city will be invoiced to the property
[32:21] owner. Staff recommendation is the board declare the property a
[32:25] nuisance. The board order staff to have the city abate to the property.
[32:30] if so, order, the city will bring the property into compliance by removal of the
[32:34] nuisance. The city's contractor will make the repair needed to reattach
[32:39] the spouting. We're not going to remove it, we're going to reattach it.
