[0:03] the meeting to order. If everyone will
[0:04] stand for the pledge of
[0:05] >> allegiance
[0:12] to the flag of the United States of
[0:14] America and to the republic for which it
[0:18] stands, one nation under God,
[0:21] indivisible, with liberty and justice
[0:24] for all.
[0:26] >> You'll remain standing for a moment of
[0:28] silence.
[0:43] You may be seated.
[1:01] I guess uh for upcoming events, Battle
[1:03] It Out will be in between meetings. Uh
[1:07] Battle It Out is August the 21st, uh
[1:10] Chestnut Square Park, 6 to9. Grown-ups,
[1:14] your moment has arrived. Step into the
[1:16] spotlight. Revive your childhood fun and
[1:19] go ahead
[1:21] in a thrilling battle royale
[1:24] style challenges.
[1:26] earn points and claim the grand prize.
[1:29] Now, since I've never been, I have no
[1:31] clue what that's all about. So, uh
[1:33] Hayden, you want to tell me what what
[1:35] that's about or
[1:36] >> Yeah. So, we'll have essentially
[1:39] life-size games, right? So, think
[1:41] battleship that you grew up on as a kid,
[1:44] but playing it on a full size volleyball
[1:46] court or Nerf battles and things like
[1:50] that. So, if you're competitive and you
[1:52] like to win, we'll see you out there.
[1:54] >> Well, very good. All right. Well, I need
[1:56] to go this year. We How many years have
[1:58] we had that? A couple of years now.
[2:00] >> This probably our third year.
[2:01] >> Third year. Okay. And then uh we will
[2:04] have a meeting before, but I want to go
[2:06] ahead and and talk about it. Is Rock the
[2:08] Trail on September the 12th at Crossing
[2:11] Pass Park. That way give you a little
[2:12] advance notice to uh mark your calendar.
[2:16] If I'm not mistaken, that's a Taylor
[2:18] Swift. Um so I know we have a lot of
[2:21] Swifties in here tonight. So, u if if
[2:24] you're a Swifty, make sure you're you're
[2:27] uh at the I know I know part of my
[2:29] family will be here. So, anyway, but uh
[2:32] anyhow, so I look forward to that. That
[2:33] ought to be a lot of fun. Is that the
[2:35] only one that's being is there? It's a
[2:37] long is is it that because I know it's
[2:39] like four hours, isn't it?
[2:40] >> Yeah, we'll have another band to start
[2:43] it off that's more like nostalgic 2000s
[2:46] music.
[2:46] >> Gotcha. Gotcha. Well, very good. All
[2:49] right. Well, those are welcoming and
[2:51] upcoming events. Let's have uh mayor and
[2:53] council introductions. Uh
[2:56] let's start with did did I did I forget
[2:59] something or no? Okay, good. Because I
[3:01] usually do. Clarence, why don't you
[3:02] start us off?
[3:08] » It's always weird to start when you say
[3:09] Clarence. Start off introducing
[3:11] yourself. But I'm Clarence also Brooks
[3:13] Jr.
[3:15] >> Crystal Bholic.
[3:17] >> Mayor David Conn.
[3:19] >> Melanie Cox, town attorney. Marcus
[3:21] McIntyre,
[3:22] >> Adam McLam, town manager.
[3:25] >> Very good. Okay, that uh we don't have
[3:29] any anybody have any u thing to add any
[3:31] additions or deletions? If not, can I
[3:34] get a motion to pass the agenda?
[3:37] >> Motion to approve the agenda.
[3:38] >> All in favor? Unanimous.
[3:42] Very good. We have some presentations
[3:45] tonight. It's uh my pleasure tonight to
[3:48] call my friend and on my friend and
[3:50] neighbor uh who I see uh around the
[3:54] neighborhood. I saw him yesterday or day
[3:56] before yesterday I saw him in the
[3:58] neighborhood is Dr. Steven Smith. Dr.
[4:00] Smith was u here a few uh months ago
[4:04] with was it sweet potato pie?
[4:06] >> Yes,
[4:07] >> it was. You've now written another book.
[4:09] >> I have.
[4:10] >> Doctor, come on up and tell us about it.
[4:16] exciting stuff going on around town. We
[4:18] got Squid Games coming up, but uh books
[4:21] go. That's a good side joke, but okay.
[4:25] Uh last time I was here, I wrote my book
[4:27] Chef Parley and sweet potato pie is
[4:29] about me and my daughter and a five
[4:31] generation year old recipe.
[4:33] >> Dr. Smith, if you would talk, take the
[4:36] talk. Oh, okay.
[4:37] >> Because there's people watching and
[4:38] >> Oh, I forgot. Yeah, the microphone. Hi,
[4:41] people at home.
[4:42] >> There you go.
[4:43] Okay. And so it went really well. It's
[4:46] now on Amazon,
[4:49] Thrifty Books, and even in Walmart. So
[4:51] I'm going to try to get it put in
[4:52] Walmart store. So progress is being
[4:55] made. In between that time, I wrote my
[4:58] second book, which is entitled The Box,
[5:01] and it's about all the things that you
[5:04] can do with a regular old cardboard box.
[5:06] And so I wrote it to remind us that you
[5:09] don't have to have a lot of money, just
[5:12] time spent with your child and an
[5:14] imagination. And it walks through my own
[5:16] true story of me and my daughter playing
[5:18] with things and a cardboard box kind of
[5:21] creations. Has activities at the end and
[5:24] a bunch of fun facts about cardboard to
[5:27] encourage nonscreen fun and family
[5:30] interactions. And so, uh, I've been
[5:33] around some of the bookstores in Union
[5:35] County, including the book lady who's
[5:38] fantastic.
[5:39] And if you want a copy of it,
[5:42] Amazon, um, my author name is Dr. Steo,
[5:47] you can visit my website, which is now
[5:50] up. I did it by myself from the ground
[5:51] up. It took seven months. www.dsteo.com.
[5:57] It has the books for sale. It has free
[6:00] downloadable color and activity pages,
[6:04] music that I created where you can vote
[6:06] for your favorite one, and free games.
[6:08] Nothing's going to be behind a payw wall
[6:10] because I want people to interact and
[6:12] have fun for free. And my website will
[6:14] be a good one for you to use to
[6:16] introduce your child to the internet in
[6:19] a space that you trust because it's
[6:21] secure, lockdown, ADA compatible, and
[6:25] nothing's going to cost you except for
[6:27] buying the book. So
[6:30] over there somewhere is a signup sheet.
[6:33] So if you want to attach to my
[6:35] newsletter, I'll send emails out letting
[6:38] you know if anything on the website
[6:40] updates. I got the best contest in the
[6:43] world in my mind. So I'll remind you
[6:46] when those contests start or if I'm
[6:49] about around town giving away books or
[6:52] at a bookstore doing signings. So, I'm
[6:54] trying to be as open as humanly
[6:56] possible, but this is still the
[6:58] beginning. I hope to turn this into a
[7:00] cartoon that might stream on like
[7:02] Netflix, HBO, something like that one
[7:04] day. Um, and so book two is out there
[7:08] and here it is. I'll pass it around if
[7:10] you want to see it. I don't want to be a
[7:11] distraction to the meeting though
[7:14] because this fun stuff will make you
[7:16] forget why you're here. But does anybody
[7:19] have any questions for me? I'm Steve
[7:21] Smith, Dr. Steve Smith, formerly of the
[7:24] public safety advisory committee and the
[7:27] parks. If your kids play at parks or
[7:29] grandkids, I love it because I was like,
[7:32] I helped to build these. So, it's a
[7:34] reason why I turned down a lot of jobs
[7:36] around the country after I got my
[7:38] doctorate degree. It's because I love
[7:39] living here with my neighbors, you all,
[7:43] safe law enforcement. And so, it's a
[7:45] good environment. And uh I plan to put
[7:47] it in my book and write about that, too.
[7:50] So, any questions? But thank you for
[7:53] having me either way.
[7:55] Signup sheet is here. I'll pass that
[7:59] around.
[8:00] You put your email there and I'll keep
[8:02] it in there. I'm not going to send you
[8:04] spam or crazy stuff. I promise you. Um,
[8:08] and I'll answer any questions that you
[8:10] have. Steve Smith again. Dr.steo.com is
[8:13] the website. Wish me luck.
[8:18] >> Dr. Steel, I got a question for you.
[8:20] How's your last How's sweet potato
[8:21] doing? Sweet potato pie. Is it doing
[8:23] pretty decent?
[8:24] >> It's doing really well. Um, and I
[8:26] haven't even started the formal
[8:27] marketing because I'm still setting up
[8:29] the infrastructure, but I I even have it
[8:32] on sale at um a bookstore in Los
[8:34] Angeles. Actually, when I was out there
[8:37] interviewing for a ding position in San
[8:39] Diego, I went by a store called Maiden
[8:42] Compton, which is a Compton Los Angeles
[8:45] store. or they were revitalizing that
[8:46] area and they sell books by all those
[8:50] founding rappers and entertainers and
[8:52] stuff. And I was like, "Would you sell
[8:53] my book, please?" And he's like, "Yes,
[8:55] bring it on." And he sold, uh, 27 copies
[8:59] of it so far without even trying. And he
[9:02] wants like 50 more later. And so, um,
[9:05] it's growing. It's growing. And I can't
[9:07] wait to see how it'll grow when I
[9:09] actually start marketing the thing. So,
[9:12] the third book is going to be entitled
[9:14] The Airport. And I'm really proud of
[9:16] that one because it will feature
[9:20] situations where you're dealing with
[9:22] parents that travel for work and they
[9:24] miss their kids and things along with
[9:26] what airports look like through the eyes
[9:28] of a kid. So, we can remind ourselves
[9:30] there's joy and happiness to be had
[9:32] everywhere. So, when you're in those
[9:34] miserable or seemingly miserable
[9:36] situations, put on your kid eyeballs and
[9:38] you'll start to have fun again,
[9:39] possibly. So, that one's coming out
[9:41] soon.
[9:43] >> Any more questions?
[9:44] >> That's it. Thank you. I appreciate you
[9:46] coming again. And when you bring your
[9:48] next book,
[9:49] >> make it about food again cuz uh we like
[9:51] the sweet potato pie you brought last
[9:53] time. And uh if if you'll bring if
[9:56] you'll bring food, we we'll eat it. Uh
[9:59] we enjoy it.
[10:00] >> And make it something like banana
[10:02] pudding or something too. You
[10:04] >> put it in order to see how it's going.
[10:06] Okay.
[10:07] >> Very good.
[10:08] >> Meatloaf is number four. me.
[10:10] >> Thank you.
[10:12] >> Thank y'all. Thank you all for coming.
[10:16] » Okay. I don't believe we have anybody
[10:19] signed up tonight for public comments.
[10:22] >> We we have another item. Adam.
[10:25] >> Oh, the CRP.
[10:26] >> I was trying to get through the meeting
[10:28] a little quicker. Marcus. Uh, no.
[10:30] >> I got to keep you honest.
[10:31] >> Sorry, Adam. Uh, financial model, our
[10:34] CIP, Mr. Mclam and Miss Massie. Um
[10:39] apologize.
[10:46] » Thank you.
[10:57] » I feel very close to y'all. I don't know
[10:59] if we moved this up or not, but good
[11:01] evening, mayor and council. Um, we have
[11:04] been going back and forth about this
[11:07] financial model now for probably four or
[11:10] five months. We've been talking about
[11:11] it, telling you what we have, what we're
[11:13] able to do, uh, some different steps and
[11:15] different things. So, tonight, um,
[11:18] finally want to push this out to y'all
[11:20] and let y'all see some of the
[11:21] information that can come out of the
[11:23] model and then so that y'all can ask
[11:25] additional questions as we move forward
[11:27] in the future.
[11:29] Um, so we I've said this before,
[11:31] internally we have a CIP team, a team
[11:33] that meets uh once a month, talks about
[11:36] all of our active CIP projects. Out of
[11:38] that group, we have a smaller group
[11:41] that's been working on this model. And
[11:42] that's Alicia Massie, Alicia Gaddy, and
[11:45] myself been trying to get this ready for
[11:47] y'all to be able to give this to y'all.
[11:49] So, I want to tell them thank you for
[11:50] all the work they've done with and for
[11:52] this tonight. Couple of things that just
[11:55] walk through really quickly what we'll
[11:57] do. um want to give just a very quick
[12:00] review of the CIP so everybody
[12:01] understands what that is we'll talk
[12:03] about the financial model what it is
[12:06] some of the variables and assumptions
[12:08] that are built into it so that you
[12:09] understand how we're getting the
[12:10] outcomes and then we'll review quite a
[12:13] few scenarios and then ask y'all any
[12:16] questions what I handed to y'all is a
[12:18] cheat sheet as you're looking and we're
[12:20] talking about all these rather than all
[12:22] the detail that's there that is very
[12:24] simple straightforward
[12:27] so So, what is a CIP? So, for us, a CIP
[12:29] is a strategic plan. It tells how we're
[12:32] going to get somewhere in the future,
[12:33] right? It has a list of projects. It
[12:35] goes far beyond that. It tries to meet
[12:37] y'all's priorities for how you want to
[12:39] see these projects move forward. Uh we
[12:42] are talking about right now an FY27
[12:45] through FY31 CIP. for the next 5 years.
[12:51] The model or the what y'all have been
[12:53] given so far makes up 24 projects. In
[12:56] that right now, there are 11 funded
[12:58] projects, five partially funded, six
[13:01] unfunded, and three future projects.
[13:05] All right, the financial model we worked
[13:08] with first tryon advisors. They were the
[13:11] ones that built the model and all the
[13:13] background information that's in there.
[13:15] Now we can update the model and have and
[13:17] run different scenarios. So that's how
[13:19] we got to this point. The model can
[13:21] analyze a number of things, but these
[13:23] are just a few that we can put in there.
[13:25] So it'll look at all town funding
[13:27] sources. We can look at different tax
[13:29] rates. We can look at our debt service
[13:32] capital reserve policy. We can look at
[13:36] um growth assumptions, expenditure and
[13:39] the growth rate and how fast things are
[13:41] growing. We we can also look at
[13:44] different models for funding projects
[13:46] which are your PIGO, your debt or your
[13:48] outside funding, whether that be grants
[13:50] or through CRTPO uh with Todd and
[13:54] Council Member Oscel Brooks and the work
[13:56] they do there.
[13:59] All right, talk really quick about some
[14:01] of those variables and assumptions so
[14:03] you know what you're going to see in
[14:04] just a second. So those variables again
[14:06] can be any number of those things. I
[14:08] will not read them again. all those that
[14:10] are over there on the
[14:12] my left I guess it would be your left
[14:14] too left hand side um the assumptions I
[14:17] do want to talk about those so we have
[14:19] some assumptions built into the model
[14:22] always when you're do when you're
[14:23] looking at any kind of budget or
[14:25] forecast we're going to assume
[14:29] uh lower on the growth side and higher
[14:33] on the expenditures and we're going to
[14:34] do that to make sure that we always have
[14:36] enough to fund those things right So we put in growth rates of 3% for our
[14:42] nonrevalu years. So growing at a 3% rate
[14:45] on non-revaluers.
[14:47] Um
[14:49] we have grown more than that the last
[14:51] couple of nonrevalu years, but that's
[14:53] the rate that we we went with and a
[14:56] five-year growth on reval years. We know
[14:58] that we've been much higher than that
[15:00] the last couple of revals. We don't
[15:02] think it'll continue to be that high in
[15:03] the future. So that's we're modeling
[15:06] that at five. Also another assumption is
[15:09] that if if and when we do model debt,
[15:12] we're modeling take taking that first
[15:14] payment for the debt the year after the
[15:17] debt is issued. So if it's issued in
[15:20] FY30, we would take be the first payment
[15:22] would be due in FY31. So there's a year
[15:25] lag and when your first debt payment is
[15:30] right now we have six scenarios that
[15:32] we've run through the model tonight.
[15:34] Yes, you do see on that cheat sheet it
[15:36] is correct. You see one, two, three, and
[15:39] five. You don't see one for zero or
[15:41] four. So zero is just a base, right?
[15:44] That's just flat what the budget has for
[15:47] this year. No projects are in it. Four.
[15:50] Reason why you don't see four is an
[15:52] actual like scenario that you were given
[15:54] is because it is done in model two or
[15:58] scenario two with the addition of one
[16:01] additional project. So that's why when
[16:03] you're running these models, they do
[16:04] take time. So, we we chose a few to run
[16:07] through uh as actual scenarios.
[16:11] All right. Well, any questions that far
[16:14] before we start talking about the actual
[16:16] scenarios themselves? And if I can't
[16:18] answer the question, I'm going to look
[16:19] over my shoulder this direction to help
[16:21] answer the question.
[16:24] We good? Good. All right. I'll keep
[16:26] going.
[16:28] So, scenario one funds all of those
[16:32] projects that you see up there. Those
[16:34] are your existing funded projects. So
[16:37] that's all of the funded projects are
[16:39] funded. It does show when you model it
[16:42] out in the future that the debt service
[16:45] cap reserve policy would need to be
[16:47] reduced to 5 cent and FY29. If you know
[16:51] right now we're at 5 1.5 cent. So we're
[16:53] showing that you would need to reduce
[16:54] that a little bit.
[16:58] So this is one of the output screens
[17:00] that we get out of the model. Um, I'll
[17:02] walk through on this one with a little
[17:04] bit more detail and not on the other
[17:06] ones. You can see it. Um, so you can see
[17:11] in FY24, FY25, the tax rate was 18.5
[17:15] cents. In FY26, it went down to 17 and
[17:19] it's 17 from there after, right? We're
[17:21] modeling it at a 17 cent tax rate. Um,
[17:25] now you come over to the debt service
[17:27] capital reserve fund column, which is
[17:29] the next one over. You can see that in
[17:32] FY28
[17:34] we reduce that or sorry FY29 we reduce
[17:38] that to 5 cent. Um and that's to be able
[17:40] to make the model work as it goes out in other columns. You see here we're
[17:46] able to set targets and minimums for
[17:48] general fund. So you can see we set up
[17:51] at the top a target of 50% a minimum of
[17:55] that is y'all's policy is that minimum
[17:57] of 30% for your fund balance. So you can
[18:01] see as it goes down it starts so uh
[18:05] >> nothing is highlighted here at the top.
[18:07] It didn't flag any of these cells
[18:09] because you are above 50%. When you drop
[18:12] below 50% it starts flagging them just
[18:14] to let us know. And as it goes down, you
[18:17] can see the model does go below 30 right
[18:20] here. We wouldn't allow that to happen
[18:22] that far out. What you would do is you
[18:24] would fund a project out of debt service
[18:26] capital reserve rather than let the mo
[18:29] we wouldn't let us dip below your 30%
[18:31] minimum. Um, but it wasn't worth
[18:34] rerunning the model to move a project
[18:36] when you're less than a percent uh that
[18:39] far out because you're talking as far as
[18:42] uh FY38 at that point.
[18:46] Um you can also see we can look at the
[18:49] debt service capital reserve that is
[18:51] what this five or five and a half cent
[18:54] is pulling over here is how much money
[18:56] is getting generated or what or how much
[18:58] surplus you have in that given year and
[19:00] then what the fund balance is. And then
[19:03] you have the last fund that you're
[19:04] seeing here on the screen is the one
[19:06] that uh is has the money for the public
[19:10] works facility and the uh community
[19:13] center in it.
[19:16] All right.
[19:18] >> Sorry, mayor. Can I ask a question?
[19:20] >> Sure.
[19:21] >> Um,
[19:23] sorry. Um,
[19:26] can you talk about 2026 growth rate? Um,
[19:30] we see 3.4125.
[19:32] That's an actual rate. We're in 26 right
[19:35] now. Um,
[19:36] >> we're in 27 now.
[19:38] >> So, well, all right. But the 37.18
[19:42] that's a that's an anomaly and there's
[19:45] an explanation behind it. I know.
[19:47] >> So that was the revalure and that's why
[19:49] it is so much higher. Um and that's why
[19:52] we modeled future revaluers. They're
[19:54] there in the green. We modeled them at
[19:57] 5%.
[19:59] They probably will be higher than 5%.
[20:02] They could be lower. I mean, we I've
[20:04] been with the town long enough that I
[20:06] know the years that we did have a
[20:08] decrease when we did revals.
[20:10] >> Yeah.
[20:11] >> Um, so again, you want to be
[20:12] conservative when we're modeling those.
[20:14] You don't want to take those assumptions
[20:16] that it's much higher than that.
[20:19] >> And then
[20:19] >> so yes, that is an anomaly at 37,
[20:22] >> right? And that's because of the reval,
[20:24] right?
[20:25] >> Yes, sir.
[20:25] >> Okay.
[20:27] Um, second question. You talk about the
[20:30] fund balance and we're looking at 26
[20:33] because we're in 27 now, but we're
[20:36] talking about past. The 10.6 represents
[20:38] the $4 million
[20:41] for the community center that we put
[20:43] aside along with the 6.8 or almost 7
[20:46] million for the public works. That's
[20:47] what those two numbers are, right?
[20:48] >> That is correct.
[20:49] >> All right. Good. That that's it.
[20:52] >> And I'm asking for the benefit of myself
[20:54] and the public. Very good. Thank you,
[20:56] Marcus.
[20:56] >> Yep.
[20:58] >> So, with each scenario, we also get a
[21:00] bunch of graphs that get uh put out, and
[21:02] these allow us to look at some people,
[21:05] myself, I'm more of a visual person than
[21:07] a t tabular person, but you have both to
[21:11] be able to look at this. So, you can see
[21:13] this gives the exact same information,
[21:15] but uh it makes it a little bit clearer
[21:16] to see at times. So, if you look at um
[21:22] if you go back to this one and you see
[21:26] in
[21:27] FY27,
[21:29] if all of the projects get built out and
[21:31] get, you know, expenditures happen the
[21:33] way that we think that they will, the
[21:35] 5.5 cent that is going in will not be
[21:39] quite enough to pay for all of those
[21:42] projects into the debt service capital
[21:44] reserve fund. So you would have to go
[21:46] into the the fund balance of that fund.
[21:50] Is it okay to say it that way? Okay. The
[21:52] fund balance of that fund to pay the
[21:55] 730.
[21:57] Right? So you can actually see that
[21:59] graphically here. Right? You see it dip.
[22:02] It doesn't mean that there's no money in
[22:04] that fund. It just means we're spending
[22:06] more than the five a half cent. We're
[22:08] going into we're spending some of that
[22:11] savings account of that fund.
[22:12] >> But that would be a one-time event
[22:14] though. Correct.
[22:15] >> Because
[22:15] >> it's one time.
[22:16] >> Yeah.
[22:17] >> And then the following year there's
[22:19] enough money and there is again
[22:20] >> and if it's a onetime event, what would
[22:22] we be able to build with that?
[22:24] >> I'm sorry.
[22:25] >> If it's a one-time event, what would be
[22:27] how what what dollar amount would we be
[22:30] able to spend?
[22:33] if it's a onetime event.
[22:35] >> So, you're saying that if we let's say
[22:37] we have $5 million in that fund and
[22:41] does that mean that we would spend 5.7
[22:44] million cuz
[22:46] >> So, you'd still have
[22:48] >> we wouldn't have anything. We would have
[22:50] spent the 5.7, right?
[22:52] >> So, in that fund right now there's
[22:55] roughly
[22:58] $10 million 9.8 eight. We're going to
[23:01] spend
[23:04] >> if we spend if we spend 10.2 or 10,
[23:08] >> but we wouldn't do that. We wouldn't let
[23:09] it go into the negative.
[23:10] >> Yeah, I I got you. Go ahead. Sorry.
[23:17] » Go ahead.
[23:20] » Okay.
[23:21] >> I apologize. I'm just asking questions
[23:23] as we go. So what we would do is uh like
[23:26] if what is the 5.5 equivalent to this
[23:30] year?
[23:32] Uh but dollar-wise is it $5 million?
[23:36] Okay. So the five and a half
[23:39] cent this year is right around $5
[23:42] million.
[23:43] >> Yeah. This year, if we all the projects
[23:46] get completed that are planned to get
[23:48] completed, money to be spent, we're
[23:50] looking at 5.7
[23:53] to be spent, but there's 9.8 available
[23:57] overall. So, we would spend the 5
[24:00] million. We would go into the savings
[24:01] account and we would grab the 700 and we
[24:04] would put it in with the other one to
[24:06] pay for the onetime expense. This year,
[24:09] still having
[24:11] I can't do the math in my head. Uh 6 7 8
[24:14] 9 I know
[24:15] >> almost $4 million sitting in the savings
[24:17] account,
[24:19] >> right? Yeah.
[24:21] >> Um no
[24:22] >> no because then we would add
[24:24] >> No, we the 9 million the 9 million we're
[24:27] only going to pull what the excess that
[24:29] we need which is the 700. We'd still
[24:31] have the 9 plus million.
[24:32] >> You'll still have 9 million. Yeah,
[24:33] >> I got you. I follow you. You're right.
[24:35] I'm wrong. I follow you.
[24:39] Yeah.
[24:40] >> Yes,
[24:40] >> I got you. Okay.
[24:43] We tracking.
[24:45] >> All right. So, you can see we also put
[24:47] the graph up here where you can see
[24:48] tracking that um minimum line. So,
[24:52] council's policy is that minimum line,
[24:55] that red line you see at the top. Um the
[24:58] last graph, and all of them look the
[25:00] same on all of these future ones,
[25:02] showing our debt instruments and when
[25:03] debt is dropping off. So it makes more
[25:05] sense when we look at future ones
[25:07] because some of the other models have us
[25:08] taking potentially if council chose to
[25:11] taking future debt. So that's why we're
[25:13] showing you a debt instrument column so
[25:16] you can see when those drop off.
[25:17] >> Clarifying question what you just said
[25:19] there is that as we go forward for
[25:20] instance we have an installment loan for
[25:22] this building. You're take the model
[25:24] takes into consideration when that debt
[25:26] is paid off and therefore those funds
[25:28] become available for use. That is
[25:30] correct. So, as we're modeling through
[25:32] our existing debt service as as it's
[25:36] coming off and we're modeling this off
[25:37] into the future, that is giving us the
[25:40] ability to know how much we're going to
[25:41] have available if we so choose to do X
[25:44] project or Y project.
[25:45] >> That is correct.
[25:46] >> Good.
[25:48] >> Any questions about scenario one or
[25:50] about the data you're actually seeing
[25:52] because the other ones mirror this. So,
[25:56] >> good. So, this is just a one year it's
[25:58] just a a one-year deficit is what you
[26:02] about. Yeah. Yeah. And then the next
[26:03] year we're going to be back back up
[26:05] which really shouldn't going to affect
[26:07] much of anything.
[26:08] >> It's not even a deficit. It's only just
[26:10] pulling money out of your savings.
[26:12] >> Well, that's true.
[26:13] >> It's not a deficit. You're right.
[26:15] There's Yeah.
[26:15] >> Yep.
[26:17] >> All right. So, scenario two
[26:20] funds all of the projects you see listed
[26:22] here. So that's funding projects off of
[26:25] that CIP that are in the funded category
[26:29] and the partially funded category
[26:32] minus the community center. It does not
[26:35] model funding the community center. So
[26:38] it it is that scenario that um council
[26:42] member McIntyre you asked about at the
[26:44] last meeting. You wanted to see a
[26:46] scenario that funded Indian Trail Road
[26:49] and funded the public works facility. So
[26:51] that's what we did here is we just
[26:53] pulled the community center out um to be
[26:56] able to show that model. So that's what
[26:58] this is showing.
[26:58] >> And what is just for the public's uh
[27:02] memory, what is the estimated cost of
[27:05] the public works and the road? 8 million
[27:08] and 21 million respectively.
[27:11] >> Uh Todd
[27:14] phase two 8 million 7 million
[27:17] >> Indian Trail Road phase two or about 8
[27:21] million.
[27:21] >> Okay. About 8 million
[27:22] >> and then 21 million
[27:24] >> and 21 million is public works. Now you
[27:27] see here that's phase one of the public
[27:30] works facility. Remember council asked
[27:32] we had a master plan and council said go
[27:34] back and get us a phase one. So that's
[27:36] what we did and this is the phase one.
[27:39] Um but we have
[27:41] 7 million in the bank.
[27:44] >> Yeah. So, you would need an installment
[27:47] financing, some kind of other way to
[27:50] fund the additional 14 million. So,
[27:53] that's what you'll see when we show you
[27:54] this model is we modeled it as a $14
[27:58] million installment debt financing. Same
[28:01] thing this building was at. Um, not 14
[28:04] million, but same type of debt
[28:06] instrument. Uh, right now we're seeing
[28:08] rates in the 5% for 20 years.
[28:13] So, mayor, you mind? Mayor, I apologize
[28:15] for asking so many questions. I'm sorry.
[28:17] I just want to make sure I understand
[28:18] that. So, you don't mind if I ask the
[28:20] questions, right?
[28:21] >> I do not. I don't mind. I don't mind.
[28:23] >> I I appreciate that, sir. So, we have 21
[28:27] million in terms of the estimated cost
[28:29] of the public works as we've rendered,
[28:31] but we have 7 million available.
[28:32] Therefore, we need 14 for the Indian
[28:35] Trail Road. We have 8 million cost
[28:37] estimate, right? in today's dollars,
[28:39] right? That's I think it's 8 million,
[28:41] but we have about $800,000 close. Let's
[28:44] just say a million dollars um that we
[28:46] probably have in there as partially
[28:48] funded. That means that we only need
[28:50] seven. So 14 plus that seven give us we
[28:53] would need to go to market or to get
[28:55] debt of 21 million for those two
[28:57] projects.
[28:58] >> So the way the model is run, we actually
[28:59] don't need to go to market for Indian
[29:01] Railroad.
[29:02] >> Okay.
[29:02] >> We only need to go for the public works
[29:04] facility.
[29:04] >> We only need 14.
[29:06] >> Correct.
[29:07] So good story. Then
[29:10] >> uh we do show with this model you'll see
[29:13] reducing the debt service capital
[29:15] reserve policy in FY29
[29:18] to 4 1.5 cent from the 5 and a half that
[29:21] it is today. The story gets better um
[29:25] with this model because you can actually
[29:28] take on the debt instrument of 40 $14
[29:31] million with no tax increase.
[29:35] So, because of council's,
[29:38] you know, what you've done in the past,
[29:41] having the capital uh debt service,
[29:44] capital reserve policy, putting money
[29:46] aside, thinking forward, you're able to
[29:49] take on a debt of $14 million without
[29:53] having to have a tax increase to be able
[29:55] to fund that.
[29:56] >> All right, important question. We have
[29:58] AAA rating from both S&P and and
[30:01] Moody's, right? So that means that if we
[30:03] go to market, we should get a good rate.
[30:04] Right now you're talking about 5%. Would
[30:07] it benefit the town or and its residents
[30:10] to issue a bond? Would we get a better
[30:13] rate interest rate in terms of the
[30:15] coupon rate we pay um on issuing a bond?
[30:18] We'd have to get approval and so on.
[30:20] It's a more lengthy process than going
[30:22] and um going to a financial institution
[30:24] and getting that debt or do we want to
[30:27] stay at the 5%. Because the 5% the 5%
[30:31] rate in today is still assuming a
[30:35] 20-year payback period, right?
[30:38] >> And a bond is also a 20 year that's a
[30:40] max we can go to. It's a 20-year period.
[30:42] What would be and I I I'm looking at you
[30:45] Alicia. What would be the your best
[30:48] advice here in terms of how we fund this
[30:53] through either installment or uh issue a
[30:58] bond seeking bond approval.
[31:01] Sorry,
[31:04] those are important discussions that we
[31:06] are having by the way. What is Oh,
[31:11] » so I was actually pulling up an email
[31:13] that we got today from another financial
[31:15] advisor. Um, so bond rates are hovering
[31:18] around 5% as well.
[31:21] >> So I it would be half a dozen in one and
[31:24] half dozen in the other.
[31:25] >> Yeah.
[31:26] >> Okay. Alicia has something another the
[31:29] other
[31:29] >> Alicia.
[31:41] » Yeah.
[31:42] >> Also, if you
[31:45] the way it's modeled,
[31:48] we would hope that rates would we would
[31:50] get because we are AAA, right? You hope
[31:52] that you get a better rate than 5%. But
[31:54] again, we're going to model it on the
[31:56] high end. We're going to model it at the
[31:58] what we think is the worst case scenario
[32:00] because we want to make sure that we're
[32:02] not giving y'all information that's as
[32:04] incorrect as we can we can possibly hope
[32:07] for. Again, I won't go through
[32:09] everything. I'll point this out very
[32:11] quickly this time. Uh you can see in
[32:14] FY29,
[32:16] we're showing that dropping to four and
[32:18] a half cent rather than the five and a
[32:20] half cent. Remember that's that money
[32:21] that is going over to the capital
[32:24] reserve. You do see a few more years in
[32:27] here that we're going to go into the
[32:29] fund balance for the capital reserve to
[32:31] fund some of those projects. Think you
[32:35] we just said we're going to fund Indian
[32:36] Trail Road through not having to go for
[32:39] a debt instrument. Indian Trail Road
[32:40] phase 2. That's how you're doing that,
[32:42] right? You're going to go into what
[32:44] you've been saving. and that's the
[32:45] reason why you've been saving those
[32:46] funds is to put those over to fund that
[32:49] project. Um, you can see we stay well
[32:52] above the target of 30%.
[32:56] We don't go below like 36% in these two.
[33:00] Um, I didn't point it out earlier, but
[33:03] the value of a penny, you can see there
[33:05] in column 13. Um, you can see it's it's
[33:09] approaching a million dollars uh for for
[33:12] one penny. Again,
[33:16] you can see this graphically. Uh the
[33:18] orange, the one that I'll point out is
[33:20] the debt um looking at the debt graph at
[33:24] the bottom there. That is the one that
[33:26] starts to show that we are taking on
[33:27] that debt instrument for the public
[33:29] works facility. Uh again you can see we
[33:32] on purpose we pulled that debt in
[33:36] FY28
[33:38] is when we modeled it for the first
[33:40] payment to be in FY29.
[33:48] Since this is the first one that has
[33:50] debt in it I'll stop for a second and
[33:53] any other questions
[33:57] >> I have a simple question. When we borrow
[33:59] from the fund balance, how long how much
[34:01] time do we have before we have to
[34:02] replace that money?
[34:06] » Yeah, I was going to say none, but
[34:08] >> we're we're not borrowing from it. It's
[34:11] that's what we put that money aside for.
[34:13] So, it's it's a um an eligible use for
[34:15] us to use fund balance whenever we're
[34:17] doing capital projects. That's money
[34:19] that we've put aside. So, it's our
[34:21] money. We're just shifting it to the
[34:23] capital project so we don't have to pay
[34:25] it back. It's not a borrowing.
[34:27] >> Yeah. And then other question would be
[34:31] seeing that we are in the process of
[34:34] getting Indian Trail Road phase one out
[34:37] to bid. If we so choose to
[34:41] include
[34:42] uh phase two both legs
[34:47] because we have the equipment out there.
[34:49] Maybe it's going to be one particular
[34:51] and that's kind of Todd. I'm looking at
[34:53] you.
[34:53] >> I was going to
[34:54] >> I'm kind of looking at you Todd Huninger
[34:56] over through the mic there. That's where my head is focused. Um,
[35:00] could we possibly kind of get some
[35:03] savings there? Because you you kind of
[35:05] get what I'm asking, right?
[35:06] >> Cuz as we're going to do that in terms
[35:08] of one, the disruption to the residents
[35:11] would be once, not then and then after,
[35:15] >> but also just possibly getting some, you
[35:18] know, savings there because it's going
[35:20] to be one continuous strip, right,
[35:23] versus the two sections. Yep.
[35:25] >> So, I I don't know. not something to
[35:27] sort.
[35:27] >> No. So Todd and I have had plenty of
[35:29] conversations and this is his his train
[35:32] and he should be congratulated for
[35:34] driving it forward. Um
[35:37] the plan has kind of been to get phase
[35:41] one done, get phase or get phase one bid
[35:44] out, get it started, and then hopefully
[35:46] right after that phase two would go out.
[35:49] This maybe the same contractor would
[35:50] pick it up and there would be no gap in the two.
[35:54] >> Yeah. We're going to come to y'all at
[35:55] the end of this year.
[36:03] » And I sent y'all today an email with an
[36:05] updated timeline for phase one.
[36:11] » Very good.
[36:12] >> All right.
[36:13] So now we'll look at scenario
[36:15] three. So again, every scenario is
[36:17] building on the one before it, right? So
[36:19] scenario three now is all of the funded
[36:24] and partially funded projects and we've
[36:26] added in the community center.
[36:29] Uh one thing that I did not say before
[36:31] and I'll say now uh one thing that we
[36:33] are able to do in the model as well as
[36:35] you can see there we we are able to
[36:37] model in operating expenses and actually
[36:41] we can model
[36:43] operating and revenue expenses. So when
[36:48] you build a new facility, right, you
[36:49] have new power, you have new water, you
[36:51] have new all those things. We can
[36:52] actually build that into the model. And
[36:54] when you're looking at the community
[36:55] center, you can actually model in the
[36:59] potential revenue that could be
[37:01] generated off of the facility as well.
[37:05] Um, so in this model, because we don't
[37:08] have any outside funding right now, we
[37:10] don't know what that outside funding is.
[37:12] I'll agree with the mayor's sentiment. I
[37:14] hope we can get all 36 million outside
[37:17] funded, but right now we don't have
[37:20] that. We don't we aren't to that point
[37:21] yet. So, we're modeling it at 36 million
[37:25] as a bond debt again at 5% for 20 years.
[37:30] uh we again the debt service capital
[37:32] reserve policy uh would drop and you do
[37:35] see there this is the first model that
[37:37] we are showing you that would require a
[37:40] tax increase potentially in FY31
[37:45] um and that is to cover that those two
[37:47] debts now that you have of the community
[37:50] center and the public works facility so
[37:52] you potentially the model is showing
[37:55] debt of 47
[37:58] 7 million.
[38:01] >> Why 47? Not 14 plus 36.
[38:03] >> Is my math wrong? 14 50 million.
[38:06] >> 50 million.
[38:06] Sorry. So showing 50 million
[38:10] with a 2 cent tax increase.
[38:12] >> And then one question on to piggyback on
[38:14] that. That means that we still build
[38:15] Indian Trail Road from what we have.
[38:18] We're not borrowing for that.
[38:19] >> We are not.
[38:20] >> 14 million
[38:21] >> is for the the public works facility
[38:24] with a total cost of 21.
[38:27] >> Correct. So we have seven in the bank
[38:29] plus 14 in trail road which is 7 million
[38:33] plus the 1 million that's a total of
[38:36] eight.
[38:36] >> Yep.
[38:37] >> And then the 36 million because it cost
[38:40] 40 but we have four saved up.
[38:41] >> Mhm.
[38:42] >> Right. I just want to I'm just repeating
[38:44] those for people to kind of follow
[38:45] along.
[38:46] >> But
[38:46] >> and the next tax reval is in 2030.
[38:49] Right.
[38:50] >> Is in 2030. That is correct. And then
[38:53] this 50 million is the 14 million is
[38:56] over 20 years through just regular
[38:58] instrument. And the bond is over 20
[39:02] years.
[39:02] >> It's modeled the same way.
[39:04] >> Model the same way. So we're in 2026.
[39:08] When do you have this? When do you when
[39:10] did you model it out to kind of
[39:12] >> 201? So we modeled it
[39:15] >> we modeled it one year past the debt
[39:18] instruments dropping off on purpose so
[39:19] that we could show
[39:21] >> how far out that went.
[39:22] >> Okay.
[39:23] >> Um actually it's modeled out
[39:27] 20 I think 60 is what's in the model. I
[39:31] think the model goes all the way to60.
[39:33] We cut it at at one year past
[39:36] >> um when the debt would drop off.
[39:40] One thing that would be a little this is
[39:42] really good information, right? In terms
[39:44] of my assumption, I'll be honest, my
[39:47] assumption was a 5 cents increase to
[39:50] fund the um the the public the community
[39:55] center. So, two cents is better than
[39:57] five. The the the one thing that I'll
[40:00] say when I look at some of these is we
[40:03] had a list of partially we had funded,
[40:06] partially funded, and those that were
[40:08] unfunded.
[40:09] If based on what you have here, and I'm
[40:12] not asking for this now, but if you can, just send an email. Um, what
[40:16] would remain unfunded
[40:18] after we've done this?
[40:19] >> So, you're going to see that in the next
[40:20] one.
[40:21] >> Oh, sorry. You see that you That's why
[40:23] you're the town manager.
[40:25] >> No, that's why I have great uh team
[40:28] members that put this together. I just
[40:30] stand I just stand up here that
[40:32] question.
[40:34] >> Go ahead. Uh so one thing I want to
[40:37] point out modeling at
[40:41] every $10 million of debt with our
[40:44] evaluation at the time at 5% interest
[40:49] over 20 years every $10 million equates
[40:52] to about a million dollar in debt. It's
[40:54] actually very easy numbers. A million
[40:57] dollar equates to a penny. I mean
[40:58] because we're hitting close to that is a
[41:02] penny, right? So you can kind of think
[41:04] of it that way. So what that means is
[41:06] this model again because of how prudent
[41:09] the town has been, the council has been,
[41:11] and doing the things that y'all do
[41:13] financially,
[41:15] you're actually able to absorb a large
[41:18] percentage. you're able to absorb um 14
[41:22] million in debt for the community center
[41:26] and or sorry for the public works
[41:28] facility and
[41:30] tw roughly 20 million give or take 18
[41:33] million of the community center,
[41:37] right? Because you're only needing to
[41:39] take two cent in in a tax increase. So
[41:43] you're able to absorb all that because
[41:44] you only needed that that two cent. All
[41:48] right, I'll go forward. Y'all can see
[41:51] kind of what we see here. Um, we did set
[41:54] a target on this debt service capital
[41:56] reserve. You can kind of see it starts
[41:58] to show up here a little bit. What that
[42:00] is, that target is just a cash flow
[42:02] thing. It's not a problem that these are
[42:04] showing up as red. It's just we're we're
[42:09] making sure that cash flow is okay in
[42:11] those future years.
[42:15] All right. You can see again those debt
[42:17] instruments coming on board, when they
[42:19] come on board, how they model themselves
[42:21] through.
[42:24] All right, scenario five is that last
[42:26] one.
[42:27] Um, what we did for scenario five is all
[42:31] of your fully funded, all of your
[42:33] unfunded, or sorry, fully funded,
[42:36] partially funded, and unfunded
[42:38] with one exception. We pulled the
[42:40] community center back out to just give a
[42:43] little bit of a better idea of what it's
[42:45] going to show for that. We know what the
[42:47] community center adds now, but we pulled
[42:49] it out just so we could see what was
[42:51] here. So, this is the list of all of the
[42:53] projects that would be funded through
[42:55] that.
[42:58] Um, public works is still in there.
[43:01] Again, that debt service capital reserve
[43:03] policy drops down from what it is today.
[43:07] And you could, we actually were able to
[43:08] see two different options depending on
[43:12] how council feels that they want to do
[43:14] things going forward in the future. If
[43:16] you run a payo model, which that means
[43:20] paying cash for the projects, right?
[43:21] You're not going to take on debt, uh, to
[43:24] fund those unfunded projects, which is
[43:26] those three listed underneath there. It
[43:28] shows that you would potentially need a
[43:30] 5 cent tax increase to cover that.
[43:34] If you run it as a transportation bond
[43:37] or a street bond or you know ones that
[43:40] we've done in the past, those same three
[43:43] groupings of projects would show about a
[43:46] penny and a half tax increase to fund
[43:49] that large grouping of sidewalk projects
[43:52] and those two intersection projects.
[43:55] The model that you actually see here is
[43:58] the one with the debt instrument, the
[44:01] transportation bond. Uh because you can
[44:03] see the 18.5 cent tax rate.
[44:10] That was a lot of information to throw
[44:12] at y'all. Um we've digested this for
[44:15] several weeks now or tried to at least.
[44:19] Um,
[44:22] you can see the graph is the same, but
[44:25] now I'll stop. I know y'all have asked
[44:26] questions as we've gone along, but we're
[44:29] here to answer any questions.
[44:32] I I just want everybody to realize that
[44:34] we're looking at scenarios and the
[44:36] definition of what a scenario is because
[44:41] I don't want to hear tomorrow we're
[44:42] raising taxes 5 cents or 3 cents or 2
[44:45] cents or or whatever because that's not what we're saying.
[44:50] A lot of this is um
[44:54] it's a scenario
[44:57] a future possibility. It's a projection
[45:00] into the future. We we
[45:02] >> and it's without any money that you know
[45:07] coming in and I you know for uh for a
[45:10] community center and I would hope that
[45:11] we'd bring in money not promising but I believe that we will you know bring in
[45:18] money for a community center uh like be
[45:22] nice to bring it all in and
[45:24] >> Yes sir. I know we talk a lot about the
[45:26] community center and we we talk a lot
[45:28] about uh what we want to see in the
[45:30] future and um I
[45:33] stopped last um a couple weeks ago I
[45:37] went to the aquatic center in in um
[45:40] Monroe and that's that's a community
[45:42] center um and I was really impressed. Uh
[45:47] they have 16,000
[45:49] uh people that that are that are
[45:52] members. That's a lot. That's a lot. a
[45:54] lot of people. I was very impressed with
[45:56] how nice it was. If you think about it,
[46:00] um we don't have a YMCA in and I don't
[46:02] think we do anywhere around.
[46:04] >> Not in Union County. No.
[46:05] >> As a matter of fact, I talked to
[46:06] somebody today that works there. They
[46:09] draw from South Carolina. If you think
[46:11] about it, they draw from uh 601 going
[46:15] out South Carolina way. They draw uh a
[46:18] lot of Indian Trail people. They draw
[46:20] Monroe people. They draw Marshville
[46:22] people. They they bring it all and they
[46:25] charge and and these are not exact
[46:27] numbers. So don't anybody say
[46:31] I know they they they pay $50 a month to be a part of that. And at $50 a month
[46:38] times 16,000 people is $800,000 a year
[46:41] in in revenue. I'm not saying that's and
[46:44] it probably took years to get that uh a
[46:46] number of years to get it. So, um uh but
[46:49] those are all possibilities of things
[46:51] that you you think of and um um
[46:56] it's a scenario, you know. So, anyway, I
[46:59] just I wanted to
[47:00] >> No, I think that's a good point that
[47:01] again these these aren't council's not
[47:03] approving to do anything tonight.
[47:05] Council's not even if you approve a CIP,
[47:09] you're still not approving
[47:11] any kind of increase or decrease or
[47:14] anything. You're just saying we like the
[47:17] CIP. We feel like this is a good plan,
[47:20] strategic plan to move forward.
[47:22] >> You got to have a plan. That's right.
[47:24] You know, CRTPO, which uh you know, our
[47:28] main delegate down here is is there. And
[47:32] uh you know, Charlotte Regional
[47:34] Transportation Planning Organization
[47:35] plans roads out to what how many years?
[47:39] Uh 30 years. 30 years down the road, you
[47:42] know, and you got to have a plan, you
[47:44] know, and if you don't have a plan,
[47:46] you're So,
[47:47] >> and that's what we feel like we we're
[47:49] for the first time, we're able to give
[47:50] y'all a lot of information to help you
[47:53] make the best decisions you can for
[47:55] those plans, right? We're we're able to
[47:57] give y'all a lot of data that in the
[47:59] past you may have heard us say, "Yeah,
[48:02] we think we can do that. Yeah, that
[48:03] looks good. We think we can." Now, we
[48:06] can really show what we think is
[48:09] actually going to come to could come to
[48:11] life. Um,
[48:15] I was going to say something else and I
[48:16] forget.
[48:18] >> Any other questions for me? Um, tonight
[48:21] I welcome any questions from y'all or
[48:23] from anyone.
[48:24] >> And we can always ask questions. Oh,
[48:26] yeah. Later, too. So, anybody has
[48:29] questions, feel free to ask.
[48:31] >> If there are additional scenarios or
[48:32] something different that you would like
[48:34] to see run a sixth or seventh,
[48:37] >> let us know. We can run those through.
[48:39] Um, again, just a reminder, we are
[48:41] working towards adopting some kind of
[48:44] CIP as we move forward in the future.
[48:47] Um, oh, I remember what I was going to
[48:48] say. Later tonight, Todd's going to come
[48:51] up and see if y'all want to go to CRTPO
[48:55] for outside funding for future projects.
[48:57] We're always going to be looking for
[48:59] those options for things that are there.
[49:01] So,
[49:02] >> very good.
[49:03] >> Thank you all again. I appreciate
[49:05] everybody's help.
[49:06] >> Very good job. Thank you for all your
[49:07] hard work.
[49:09] All right. Now, it bring
[49:10] >> Thank you.
[49:11] >> brings us uh
[49:14] up to public comments. And tonight, we
[49:17] don't have any. So, we're going to move
[49:20] over to law enforcement. And tonight,
[49:22] we're very fortunate to have Lieutenant
[49:24] Norris with us tonight.
[49:26] Lieutenant, come on up.
[49:30] >> Good evening.
[49:32] See, I'm not Captain Mullis.
[49:35] Couple couple feet lower to the ground.
[49:38] Um, I'm Lieutenant Coin Norris,
[49:40] Sheriff's Office. Um, we've had a very, busy month this past July. I'll
[49:45] just go over a couple of things,
[49:46] highlights, a couple things we touched
[49:48] on. Um, first off, thank you, uh,
[49:50] Crystal for the heading off the adoptive
[49:53] cop. Y'all hooked us up. Everybody felt super special. It's a great great
[49:58] deal. Great deal for the office there.
[50:01] Um, the uh, ABC investigation has been
[50:05] rocking right along. They did nine
[50:06] investigations this last month. It's
[50:08] totaled almost six and a half hours
[50:10] worth of worth of work on the uh keeping
[50:12] that in check. Everything looks good.
[50:14] Any trails?
[50:14] >> I saw one was when one was in like
[50:18] wasn't settled
[50:19] >> the very first one. Maybe you can tell
[50:21] me about it later.
[50:21] >> Yeah, they as far as far as the
[50:24] investigation. I think they I think they
[50:25] had two that were verbally warned. It's
[50:29] not a big deal. Everything's under
[50:31] control. Um, as far as the town's
[50:34] concerned, everything stays on track.
[50:35] >> What they were, you can tell me later
[50:36] what maybe the first one was.
[50:38] >> Yeah. Yeah. Um,
[50:40] as far as traffic enforcement, over a
[50:43] thousand citations or that's including
[50:47] verbal warnings, but thousand
[50:49] enforcement actions taken this last
[50:50] month. Um, very busy on traffic. We
[50:53] always stay busy on traffic Indian
[50:55] trail. 74 is a mad house, so that
[50:57] doesn't slow down for us.
[50:59] um answered over 5,277
[51:02] calls last month. So, averaged out about
[51:05] 170 calls answered per day or responded
[51:08] to. So, very very busy. Um all our
[51:11] violent crimes, breaking interms,
[51:13] aggravated assaults is all remaining
[51:14] very low, well under well under 2% on
[51:17] most of them. So, percent wide. So, very
[51:20] good on the stats. So, y'all have any uh
[51:23] specific questions? guys. I know the
[51:24] guys gals work real hard to
[51:27] >> keep everything safe. So,
[51:30] >> I was going to say something about adopt
[51:31] a cop at the end, but since you brought
[51:32] it up, I want to do just a quick shout
[51:35] out to Betty Prudin and to Katie Das and
[51:38] Bontra, the Bontara Seniors Club because
[51:40] they really took hold of this. I had
[51:42] some health issues last month and they
[51:44] made it possible for y'all as well. But
[51:45] our community, there's so many people
[51:47] even sitting in this room that adopted,
[51:49] you know, an officer. They have no idea
[51:50] what they're getting themselves into.
[51:52] Yeah.
[51:52] >> Um, but I also wanted to thank Captain
[51:54] Mullis and Lieutenant Evans who
[51:56] especially made trips there to pick up
[51:58] different baskets to make sure everyone
[51:59] was taken care of. So, thank y'all all
[52:01] for everything you do. Truly, we do
[52:03] appreciate you and the community loves
[52:04] y'all.
[52:05] >> No problem at all. We appreciate the
[52:06] support. Thank you.
[52:08] >> Very good. Well,
[52:09] >> y'all have a good evening.
[52:10] >> You too. Thank you. And and Crystal, I
[52:12] thank you too because u um you know I'm
[52:16] enjoy being part of it and it's a good feeling. It's a good feeling
[52:21] to to help you guys out or the best we
[52:24] can because of all the things you do.
[52:25] Put your life on the line for us every
[52:27] day. So, uh
[52:30] enjoy enjoy what enjoy those goodies.
[52:34] >> All right. Uh brings us to the consent
[52:37] agenda. Can I get a motion?
[52:41] » Motion to approve the consent agenda.
[52:43] >> All in favor?
[52:45] Unanimous.
[52:47] All right. brings us up to the first our
[52:49] first public hearing. Uh by addressing
[52:52] council, you acknowledge you've read the
[52:54] town's public comment rules and will
[52:56] abide by them. Reszoning petition CZ
[53:00] 202676
[53:03] 6500 Monroe Road. Miss D. There you go.
[53:06] >> Thank you. Good evening, Mayor and
[53:07] Council. Our first public hearing of
[53:10] four tonight is for 6500 Old Monroe
[53:13] Road. This is a conditional resoning.
[53:17] We're looking at a reasonzoning for 1.73
[53:20] acres from SF1 to CZGBD.
[53:24] Um the intent is to develop a bank with
[53:27] uh drive-thru windows and um within this
[53:31] overlay district, this is within the
[53:32] subreional overlay. It does require uh
[53:36] conditional zoning for drive-throughs
[53:38] and your applicants are on the screen
[53:40] there before you with NWF acquisitions
[53:43] and region law.
[53:46] I'm going to share with you this concept
[53:48] plan, but just please promise me that
[53:51] you understand this is actually more of
[53:53] a land use CZ. So, we are we are doing a
[53:58] CZ to allow the drive-thru for the bank.
[54:01] Um, but the applicant was willing to
[54:03] share kind of where they are with their
[54:05] concept plan and and so um thought we
[54:07] would just share this with you, but know
[54:09] that it's not tied to your approval
[54:11] tonight.
[54:16] And here is the uh photo of the property
[54:20] currently zoned SF1
[54:22] and it's uh been an abandoned structure
[54:25] for some time now.
[54:29] Take a look at the surrounding
[54:30] commercial. Um so this is adjacent to
[54:34] the ABC store
[54:36] here fuel centers and then there are two
[54:40] commercial projects. um one here and
[54:42] then Sun Valley Station. If you may may
[54:45] remember, they've picked back up and
[54:46] submitted for site plan review as well.
[54:49] Um and then of course you have your
[54:50] Brandon Oaks residents in the rear.
[54:55] Here's some uh photos of the site. This
[54:57] is looking southeast from Old Monroe
[55:01] Road.
[55:05] You see this is looking northeast with
[55:08] Sun Valley Commons to your left.
[55:14] There's another one a little bit further
[55:16] down. And then this is looking directly
[55:18] into the property. You can see the ABC
[55:20] store and our beautiful zoning sign.
[55:26] So existing conditions out there. Uh you
[55:28] do have a mix um with that SF 4 behind
[55:33] Brandon Oaks and then further down past
[55:35] the ABC store and Sun Valley station
[55:38] plans. uh it goes back into SF1 with
[55:40] kind of undeveloped property. Um but
[55:44] surrounding this specific parcel is all
[55:46] GBD
[55:48] future land use of course because it's
[55:50] in the subregional activity center
[55:52] overlay it does uh call this area out to
[55:55] be mixed use um shopping in an
[55:57] entertainment district. And so this
[55:59] furthers that
[56:03] this request is consistent with the
[56:05] comprehensive plan in the areas of
[56:07] economic development goal number one,
[56:09] land use and housing goal number one,
[56:10] and land use and housing goal number
[56:12] four.
[56:15] Community meetings were held on June
[56:17] 29th. We did have three residents
[56:19] attend. Um the main question was really
[56:22] residential impacts and town mitigation.
[56:25] There were no actual um comments in
[56:28] opposition. I think the Brandon Oaks
[56:30] community kind of blasted out a notice
[56:33] to all residents. So, we did have some
[56:35] residents that once they realized how
[56:37] far it was from their house and that it
[56:38] fronted Old Monroe Road, they they
[56:40] didn't really have too many questions
[56:42] for us. Um planning board um at their
[56:46] July 21st, 2026 meeting did u vote for
[56:50] approval for this request.
[56:53] And here are your recommended conditions
[56:55] for this. The first one you can kind of
[56:57] skip over. That's just a a standard.
[57:00] Hey, they still have to um adhere to all
[57:03] the other regulations, including um NC
[57:06] DO's regulations. The second one um is
[57:10] where we're going to add that use for
[57:13] banqu with drive-through facilities. But
[57:15] also note that um you know, this is
[57:18] going to have to go through construction
[57:20] drawings and site plans and things could
[57:22] change. And so we're leaving those
[57:24] permitted uses by right there as well so
[57:27] that they'll still have those options
[57:28] rather than just locking them into only
[57:30] a bank. Um and then we've got some rear
[57:33] landscape buffers, a budding residential
[57:36] with the most significant being that we
[57:37] want them to connect to that wall um
[57:40] that provides that buffer to the Spanish
[57:42] moss residents.
[57:46] and I'll be glad to answer any questions
[57:47] you may have following public public
[57:50] comment and the requested action is
[57:52] before you. Thank you.
[57:54] >> Okay. So, he wants to ask questions
[57:56] after public com after
[57:58] >> I'll take your questions anytime.
[58:00] >> Okay. Well, I you I have some. So, all
[58:01] right. And I'm anxious to uh you know, I
[58:04] saw the brick wall there. Does that
[58:06] they're going to cut a hole in that
[58:07] wall, right? They gonna have to, right,
[58:08] to to
[58:10] >> Yes. Yes. Yes. um that that portion that
[58:13] is um perpendicular to Old Monroe will
[58:15] come down, but you'll have a wall um
[58:18] that runs parallel with those those
[58:20] residences on
[58:22] >> see that start yesterday. So, we need we
[58:25] need that wall cut down and we need that
[58:27] road back there. And my question to you,
[58:29] >> you want some access,
[58:30] >> huh? Yeah, a little access there. Um,
[58:34] do you, and this might be a silly
[58:37] question, but
[58:40] when do you think they'll put the road
[58:42] in? When, first of all, is when do you
[58:44] think they'll start? Is, is this just
[58:46] something that if it gets approved, it's
[58:48] going to start pretty quickly?
[58:49] >> Well, you've got the parcel adjacent to
[58:51] it that has site plan approval as of
[58:54] October of 2025. So, likely they'll be
[58:57] the first ones um to extend the road.
[59:00] And then this property would would come
[59:02] next and and bring it all the way to the
[59:04] property that you're interested in
[59:06] connecting.
[59:07] >> How long do you I'm just cur because I
[59:08] get asked that question all the time,
[59:10] especially by the ABC store. What What
[59:11] are we talking a year maybe? Or is that
[59:13] was that optimistic?
[59:16] >> Well, there's
[59:18] that's really outside of our control
[59:19] because there's other governmental
[59:20] agencies that aren't quite as efficient.
[59:23] Um so it it takes time. Development
[59:25] takes a long time. Um, but I would say,
[59:29] you know, gosh, the one property got
[59:31] site plan approval in 2025. Like, it
[59:34] wouldn't surprise me if they weren't
[59:35] asking for a pre-construction meeting
[59:36] any time now and start, you know, start
[59:40] building and constructing. Um, this
[59:42] property, I would say at least a year to
[59:44] get through all of the site plan
[59:46] approvals and such.
[59:47] >> Now, here's here's the million-dollar
[59:49] question. Can we go ahead and build a
[59:51] road now? Can how soon can we build that
[59:53] road? um back there.
[59:55] >> Todd says if you give him the money,
[59:56] he'll build it today.
[59:59] >> Is that true, Todd?
[1:00:03] » No. So, the road's going to be funded by
[1:00:05] private development. So, we have to wait
[1:00:07] for the private development.
[1:00:09] >> I just wondered if maybe private
[1:00:10] development would want a little, you
[1:00:11] know, the AB the ABC store might
[1:00:13] contribute help contribute to that if it
[1:00:15] would speed it up. And does that make any sense? We can have
[1:00:18] those conversations, but I think it's
[1:00:20] hard for them to start investing real
[1:00:22] dollars until they have their permits in
[1:00:23] hand.
[1:00:24] >> I got you. I got you. Well, that makes
[1:00:26] sense. And pardon me for being a little
[1:00:29] optimistic and no
[1:00:30] >> excited about that, but okay. Thank you.
[1:00:33] You're welcome. Quick question.
[1:00:35] >> I have another question. Sure. Real
[1:00:36] quick. Um, I wasn't on council when the
[1:00:39] uh Sun Valley Station came through, so I
[1:00:41] know we're talking about the bank now,
[1:00:42] but what's going in the Sun Valley
[1:00:43] Station? Is the bowling alley? And
[1:00:46] >> so they've submitted for site plan
[1:00:47] approval for like a retail strip. Um
[1:00:50] don't know exactly what those tenants
[1:00:52] are. The previous tenants was like an
[1:00:54] entertainment um center that included
[1:00:57] bowling uh a gym and a a pet store. Um
[1:01:01] and then COVID hit and of course those
[1:01:03] industries especially the entertainment
[1:01:05] crashed. Um so it's coming back around
[1:01:07] now but the specific tenants aren't solidified at this time.
[1:01:11] >> Thank you.
[1:01:12] >> You're welcome.
[1:01:12] >> Okay. Well, at this time, uh, I would
[1:01:15] like to, um, open in someone make a
[1:01:18] motion to open and close public, uh,
[1:01:20] comments.
[1:01:20] >> Are you looking to me? I'll make a
[1:01:22] motion to open public comments. Sorry.
[1:01:24] Anybody sign up to speak?
[1:01:25] >> No. Open and close.
[1:01:26] >> I'll make a motion to open and close
[1:01:28] public comments for
[1:01:31] uh, CZ2026-0076500
[1:01:37] Old Monroe Road.
[1:01:39] >> Right. Okay. All in favor?
[1:01:41] >> Can I ask a question? unanimous
[1:01:53] » I wanted to ask some questions.
[1:01:56] >> Well, you you first of all, you would
[1:01:58] have needed to sign up, but you didn't.
[1:01:59] But that's okay. I um I'll give you
[1:02:02] permission uh to come up and Did you
[1:02:04] want to speak in public comments?
[1:02:06] >> Wait, wait, wait, wait one second. If we
[1:02:08] open it and you I'll just close it. We
[1:02:10] can't really
[1:02:11] >> Well, we did. We did we didn't do we
[1:02:13] actually didn't vote on it correctly or
[1:02:15] I mean we just did okay we voted on on
[1:02:18] >> I just want to follow proper procedure
[1:02:19] >> I would just you need to make a motion
[1:02:21] just to open public
[1:02:22] >> yeah let let me let me do that that way
[1:02:24] >> okay let's back up okay did you want to
[1:02:26] come up and speak
[1:02:31] » do do you want to come up and speak
[1:02:34] >> all right before you do before you do
[1:02:36] let me just make the motion All right
[1:02:38] I'll make a motion to open Public
[1:02:41] comments for
[1:02:44] CZ 2026-0076
[1:02:50] 6500 Old Monroe Road. May I explain to
[1:02:53] him the procedure, the time, and so on
[1:02:55] and so forth.
[1:02:56] >> All right. Go ahead. Can I Okay. All in
[1:02:58] favor? Unanimous. Now come up. You can
[1:03:00] speak
[1:03:02] >> if you just say your name and your
[1:03:04] address.
[1:03:04] >> And you have three minutes to speak.
[1:03:06] Okay. There's a little buzzer that'll go
[1:03:08] off.
[1:03:08] >> Okay. Um,
[1:03:10] so, um, I live at 1010 Spanish Moss
[1:03:13] Road. Uh, my name is Chase Anderson.
[1:03:16] This is my first home and first time
[1:03:19] attending these, so uh, forgive me for
[1:03:21] any misunderstanding, but um, I wanted
[1:03:25] to know that if there's going to be a
[1:03:27] wall built behind between my house and
[1:03:30] the bank,
[1:03:32] >> do you know how close that wall will be
[1:03:34] to my house?
[1:03:36] Um, we could we can take a look at it
[1:03:39] and do some measurements for you. Um, I
[1:03:43] do have my card here for you like to
[1:03:45] meet to discuss specifically.
[1:03:47] >> Um, let's look at
[1:03:54] your
[1:03:56] >> Randy. Sorry. The some of the res some
[1:03:58] of the people said that they couldn't
[1:03:59] hear. Yeah.
[1:03:59] >> I'm assuming you're somewhere in here.
[1:04:01] >> Yeah.
[1:04:02] So, they will be um it'll be on
[1:04:06] the wall will be constructed on this
[1:04:09] property. So, there will be some
[1:04:11] distance obviously with your backyard,
[1:04:12] but we can sit down with you and and
[1:04:15] show you the plans and and kind of give
[1:04:16] you some measurements oneonone if you'd
[1:04:18] like.
[1:04:18] >> Okay.
[1:04:20] Um, yeah. My other concern is just like
[1:04:22] how high the wall is to have privacy in
[1:04:24] case the drive-thru like the customers
[1:04:27] are kind of looking into my backyard.
[1:04:30] And um,
[1:04:34] another concern I had is the my backyard
[1:04:37] kind of slopes down low and if there's
[1:04:40] heavy rainfall and there's a wall, I
[1:04:42] don't know if that would cause some kind
[1:04:43] of flooding. So that was why I was
[1:04:44] wondering like how close the um wall
[1:04:48] will be to my house.
[1:04:49] >> Gotcha. So if you'll take a look at the
[1:04:51] site plan, you can kind of see that
[1:04:53] there's some some distance here between
[1:04:56] the bank operations and your property.
[1:04:59] There's going to be like a natural
[1:05:01] buffer area, but then you'll have the
[1:05:02] wall. Um the wall will match and be the
[1:05:05] same height, same materials and
[1:05:07] everything of the existing wall with the
[1:05:09] hair fuels center. Um and then as far as
[1:05:12] storm water, so they will be required to
[1:05:14] submit calculations to show um that they
[1:05:17] will not be diverting any water onto any
[1:05:20] other property. Um and that's through um
[1:05:23] you know engineered plans showing with
[1:05:26] exact calculations how they're going to
[1:05:28] account for the water.
[1:05:29] >> Okay.
[1:05:30] >> Yep.
[1:05:32] >> Uh thanks. That was that was all that I
[1:05:34] had. So I appreciate me.
[1:05:37] >> Don't worry about it. You didn't know
[1:05:38] the procedure. That's what we're here
[1:05:40] for. We're here to answer your questions
[1:05:42] and uh hopefully you got got them
[1:05:44] answered and then you got Brandy knows
[1:05:48] he's a good one to talk to. So,
[1:05:50] >> okay,
[1:05:51] >> Clarence Clarence has something. So,
[1:05:52] >> I'm going to add something real quick to
[1:05:54] Mr. Chase. Um Mr. Anderson, they went
[1:05:57] into this in more detail in the planning
[1:06:00] board meeting. So, I you know recommend
[1:06:02] you go back and look at the planning
[1:06:03] board meeting. It talks about that the
[1:06:05] concerns of lights coming into the homes
[1:06:07] and the walls the size and you actually
[1:06:08] have a planning board member here
[1:06:10] Richard Ser. So um I would encourage
[1:06:13] that and I'd like to if we don't have
[1:06:16] any other uh speakers I'll go ahead and
[1:06:18] make a motion to close public hearing.
[1:06:20] >> Okay. All in favor?
[1:06:22] Unanimous. Very good.
[1:06:26] Okay.
[1:06:27] We have no more council deliberation.
[1:06:30] >> I have a question for Brandy, sir.
[1:06:31] >> Okay. Brandy. Uh, Miss Brandy, you
[1:06:33] mentioned that it's a bank going there.
[1:06:35] Which bank?
[1:06:38] >> Uh, the applicant is here tonight, and
[1:06:40] if he would like to divulge that, I will
[1:06:42] let him do so.
[1:06:43] >> Oh, my my my approval or not hinges on
[1:06:46] the name of the bank.
[1:06:52] » For they're pointing to each other. I
[1:06:54] think they're trying to flip a coin.
[1:06:55] >> For full and fair disclosure, I work for
[1:06:58] a bank.
[1:06:59] >> Which bank?
[1:07:04] Exactly. That's why I'm asking you.
[1:07:08] >> No. Okay. Sorry. I'm not getting any
[1:07:10] answers from the back.
[1:07:12] >> You need to because the thing is I need
[1:07:13] to know if I if I should abstain or not.
[1:07:15] >> We can talk later.
[1:07:16] >> Yeah.
[1:07:18] >> Okay. So, okay. Now I know why you were
[1:07:20] asking the question. So, um Okay. So,
[1:07:24] can now can I get a motion?
[1:07:29] » Yes, you can.
[1:07:31] All right. I'd like to make a motion to
[1:07:33] approve ordinance 43, number 431,
[1:07:36] pertaining to petition CZ 2026-0076
[1:07:42] as presented.
[1:07:43] >> All in favor?
[1:07:45] >> Unanimous. Marcus, you can raise your
[1:07:46] hand all the way up. Halfway up
[1:07:49] anything. Go ahead.
[1:07:50] like to make a motion to adopt the
[1:07:52] statement of consistency findings for
[1:07:54] CZ2026-000076
[1:07:58] as read into the record by staff.
[1:08:01] >> All in favor? Unanimous and unanimous
[1:08:04] both ways. So, thank you, Brandy.
[1:08:06] >> Welcome.
[1:08:07] >> You go on. Go. You want to do the next
[1:08:10] one for me?
[1:08:11] >> Yes, absolutely. Our second one for the
[1:08:13] night is um zoning text amendment
[1:08:16] 20260084.
[1:08:18] This is Indian Trail Fairview Road
[1:08:20] corridor signage and we're looking at um
[1:08:22] amending the code
[1:08:26] and specifically we're looking to
[1:08:28] establish standards for signage for
[1:08:30] multi-tenant properties along Indian
[1:08:32] Fair View Road based upon the size of
[1:08:35] the property. Um and we've got two
[1:08:38] applicants who have requested this
[1:08:39] Premier Eye Care and the Church at
[1:08:41] Indian Trail.
[1:08:45] So, two signage requests actually came
[1:08:47] in the same week for
[1:08:51] essentially almost the same exact
[1:08:53] height. Um, it exceeded well exceeded
[1:08:55] the height requirements. And so when we
[1:08:57] started researching um we found out that
[1:09:01] the light industrial park um that is
[1:09:04] going to be coming across from the
[1:09:06] Church of Indian Trail already included
[1:09:08] that in their CZ. So, you've got one 15
[1:09:11] foot tall sign, you've got someone
[1:09:13] requesting a 14 foot tall sign, and
[1:09:15] you've got someone requesting a 15 foot
[1:09:17] tall sign. And then you think about what
[1:09:20] else is going on in that corridor. We
[1:09:22] can see 74 junction asking, maybe even
[1:09:25] our own public works facility. There's
[1:09:28] other light industrial folks that we're
[1:09:29] working with further down, Stinson
[1:09:31] hardest. Um, so we really started to
[1:09:33] realize that, okay, maybe this corridor
[1:09:35] is changing a lot faster than we
[1:09:36] realized. And um so we are putting forth
[1:09:40] that amendment tonight. Here's some of
[1:09:42] just the example of businesses. Um it
[1:09:47] was before my time so I don't know how
[1:09:48] it happened but Extreme Ice actually
[1:09:50] already has you know a pretty fairly
[1:09:52] tall sign. Um and then Indian Trail
[1:09:55] Corporate Park um is now Oak
[1:09:59] Trail Crossing. They've changed their
[1:10:01] name. Um that's the light industrial
[1:10:03] that that got the 15 foot tall sign. So
[1:10:06] we we really are changing the face of
[1:10:08] this corridor to no longer being
[1:10:10] residential at all.
[1:10:13] Um but the the amendment will establish
[1:10:16] standards um based upon the size of the
[1:10:19] property. It will improve visibility and
[1:10:21] wayfinding for businesses and um
[1:10:23] establish consistent signage standards.
[1:10:28] And so here's the revisions that we are
[1:10:30] looking at. Um there's strike through
[1:10:33] and underline in red. That's what's
[1:10:34] going away. And then the blue underline
[1:10:37] is the new um so we already have a
[1:10:40] specialized section for Highway 74 and
[1:10:42] um and Old Monroe Road and we decided
[1:10:44] that was the best place to add this in.
[1:10:46] Um so we're just adding in Indian Trail
[1:10:48] Fair View to that section and then we're
[1:10:52] adding it into the chart. So, what we've
[1:10:54] done is we've um we've increased the
[1:10:58] square footage and the height of the
[1:10:59] sign based on how the size of the
[1:11:02] property and this complies with the
[1:11:04] requests that we've had from both
[1:11:05] applicants.
[1:11:08] Your consistency findings for this
[1:11:10] request is that um it is reasonable and
[1:11:13] in the public interest as it promotes
[1:11:15] the goals of the comprehensive plan and
[1:11:16] economic development goal number two and
[1:11:18] quality of life goal number one.
[1:11:23] and I'll be glad to answer any questions
[1:11:24] you may have. Thank you,
[1:11:26] >> Marcus.
[1:11:27] >> Um, you mentioned that um there was
[1:11:30] there were three possible I care at
[1:11:34] Indian Trail and the the land being
[1:11:38] cleared there by whatever industrial
[1:11:40] park
[1:11:41] >> um they included it in theirs. What is
[1:11:44] what are what what is the what what's
[1:11:47] going to be the height of this each of
[1:11:48] these sites? Would it all be 15?
[1:11:50] >> 15. Yes.
[1:11:51] >> 15. So the 14 would basically have to
[1:11:53] come out to 15.
[1:11:55] >> Yeah. Uh no. Well, they could they could
[1:11:57] do less. It's just a max.
[1:11:59] >> No more than 15,
[1:12:00] >> right? And you'll see if you'll see on
[1:12:01] the chart like the tallest even, you
[1:12:04] know, even if you've got more than seven
[1:12:05] acres, the tallest is 15.
[1:12:08] >> Okay. All right.
[1:12:10] >> You good?
[1:12:11] >> I'm good. Thank you.
[1:12:12] >> Okay. All right. So, we have no one
[1:12:15] speaking for um public hearing. Can I
[1:12:18] get somebody to make a motion to open
[1:12:19] and close public hearing? Motion to open
[1:12:21] and close public hearing.
[1:12:23] >> All in favor? Unanimous.
[1:12:26] Okay, that uh brings us to Can I get a
[1:12:29] motion? Uh a motion to uh
[1:12:34] >> Yes.
[1:12:34] >> approve or go ahead.
[1:12:36] >> I'll make a motion to approve ordinance
[1:12:38] number 432 pertaining to petition ZT
[1:12:41] 2026-0084
[1:12:43] as presented.
[1:12:44] >> All in favor? Unanimous.
[1:12:47] And I would like to make the motion to
[1:12:49] adopt the statement of consistency
[1:12:51] findings for ZT2026-000084
[1:12:54] as read into the record by staff.
[1:12:57] >> All in favor?
[1:12:58] >> Unanimous.
[1:13:00] Okay, Brandy, you're up again.
[1:13:02] >> All right, moving right along. Our third
[1:13:04] is another zoning text amendment
[1:13:05] 20260085.
[1:13:08] This one is to remove the school impact
[1:13:11] study.
[1:13:13] So, we're looking at removing the
[1:13:15] requirement for a residential applicant
[1:13:18] to provide a school impact study. Um,
[1:13:20] that might sound crazy, but just hang in
[1:13:22] there with me. Um, we really do feel
[1:13:24] like that the changes will better serve
[1:13:26] the residents and the applicants
[1:13:28] overall. Um, and this is something that
[1:13:30] the planning department's putting forth
[1:13:32] as we've seen it be an issue. So, um,
[1:13:36] currently in the code now, if you are
[1:13:38] proposing 50 or more lots of residential
[1:13:42] development, you're required to pro
[1:13:43] provide a student impact study. Um, and
[1:13:46] it was supposed to help provide a a
[1:13:48] student yield, like projecting how many
[1:13:51] students this development would bring.
[1:13:53] Um, we have recently found that there is
[1:13:57] no one any longer doing these
[1:13:59] projections. these projections were kind
[1:14:02] of all over the place. Um they weren't really consistent. They were
[1:14:07] greatly contested. Um and so it just
[1:14:10] ended up not being very informative. Um
[1:14:13] we pulled the list serve for all the
[1:14:15] planners in the state and did not get
[1:14:17] one single person who um has it the way
[1:14:20] we have it that requires a student
[1:14:23] impact study. Um which made sense why we
[1:14:25] can't find anybody to do one. So, um,
[1:14:28] most communities
[1:14:31] require the reporting coming straight
[1:14:33] from the public school system. And so,
[1:14:37] they have folks um that really know what
[1:14:40] they're doing over there and they model
[1:14:42] this for the school system's own um
[1:14:45] needs as well and then they can just
[1:14:48] provide us with it as we have resonings.
[1:14:51] And so this has been something that
[1:14:52] we've been receiving from the county in
[1:14:55] addition to the the school impact study.
[1:14:58] Um but they they do provide the relevant
[1:15:01] um input to us that talks about um the
[1:15:04] actuals in the attendance areas, the
[1:15:08] school's rated capacity, um the total
[1:15:11] existing residential units contributing
[1:15:13] to the attendance area, and then they
[1:15:15] add any other comments that they feel
[1:15:16] may be appropriate for for the request.
[1:15:21] So, what we're looking at doing is um
[1:15:24] under the section where it says
[1:15:26] application procedures, we're not going
[1:15:28] to require the school impact study as a
[1:15:32] um as a requirement for the applicant,
[1:15:36] but instead we're going to be looking
[1:15:38] under a new section in staff reviews
[1:15:40] where that burden will be placed on
[1:15:42] staff when they receive a reasonzoning
[1:15:44] to reach out to the county to get this
[1:15:46] information so that then the community
[1:15:48] planning board and town council can take
[1:15:50] that into consideration rather than
[1:15:52] taking projections, you know, that that
[1:15:55] are kind of all over the place depending
[1:15:57] on who does the study.
[1:16:01] And again, this is where the new section
[1:16:03] will come in um under the subdivision
[1:16:05] regulations and the previous one will go
[1:16:08] away.
[1:16:10] So our consistency findings for this
[1:16:12] issue is this is a reasonable request
[1:16:15] and in the public interest because it
[1:16:16] promotes the goals of the comprehensive
[1:16:18] plan in the areas of community
[1:16:20] engagement goal number one and economic
[1:16:22] development goal number two.
[1:16:25] And I'll be glad to answer any questions
[1:16:26] you may have. Thank you.
[1:16:29] >> Clarence, I'll make it quick since we're
[1:16:32] talking about um impact studies. We have
[1:16:35] a lot of citizens here. Now would be a
[1:16:36] good time. um you always hear why don't
[1:16:38] we make um developers pay for
[1:16:41] improvements to our school with impact
[1:16:43] fees. So why is that something that we
[1:16:45] don't do?
[1:16:46] >> Right? So if you look at your tax bill
[1:16:48] um it breaks it down. You can see that
[1:16:50] the tax structure um there is designated
[1:16:53] funds that go to the school system. The
[1:16:55] model is set up that as you have growth
[1:16:58] ideally it should pay for the you know
[1:17:00] the needs of folks coming in. Um, and so
[1:17:04] as a town when it comes to reszonings,
[1:17:08] um, you know, things that are not
[1:17:09] legally under our control, we have to be
[1:17:11] careful about making decisions based on
[1:17:13] that. And schools is one of those,
[1:17:15] right? Because we don't, um, we don't
[1:17:17] have schools. We don't have a school
[1:17:19] system that we operate.
[1:17:20] >> And impact fees are illegal in North
[1:17:22] Carolina.
[1:17:22] >> Correct. Correct. You do have system
[1:17:24] development fees with water and sewer,
[1:17:26] which could kind of be considered the
[1:17:28] same thing, but actual impact fees are
[1:17:30] illegal. Um, let me just ask a follow-up
[1:17:33] question to that. I know you're going to
[1:17:34] ask, but I'm going to ask for your
[1:17:36] opinion here. Um, seeing that we're
[1:17:39] going to sort of ask the county for that
[1:17:42] information. This schools,
[1:17:45] um, water and sewer do not fall under
[1:17:47] our purview, right? So why why would we
[1:17:52] include that as a means of sort of maybe
[1:17:56] that could influence our decision one
[1:17:59] way or another when we're making this
[1:18:00] when we are deciding things like I I
[1:18:03] just think legally doesn't that expose
[1:18:06] us it becomes a slippery slope. I'm very
[1:18:08] cons I'm I'm curious about your answer
[1:18:10] but that that's sort of where I look at
[1:18:12] it because we do not control anything
[1:18:14] dealing with the schools. um we do not
[1:18:17] control anything water and sewer and
[1:18:19] we're removing it because it's not
[1:18:21] consistent as to what other
[1:18:23] municipalities or other plan um towns
[1:18:25] are doing. But how do we how do we
[1:18:28] really is should that something be part
[1:18:30] of should we even consider that? Should
[1:18:33] it be included?
[1:18:34] >> I mean I think it's okay to consider it
[1:18:37] whether you consider or not residents
[1:18:40] are going to come forward and complain
[1:18:42] right the schools are too crowded. Um,
[1:18:48] with legislative reasoning, you have a
[1:18:50] lot of um, discretion. So, as long as
[1:18:55] you're not denying it for an illegal
[1:18:57] reason, pretty much the courts are going
[1:19:00] to end up on our side.
[1:19:01] >> Yeah. Um, but if the focus of the
[1:19:04] conversation is only about schools and
[1:19:07] not about roads and traffic and property
[1:19:09] values and all the other reasons why,
[1:19:11] you know, people complain about new
[1:19:13] developments. I mean, potentially it
[1:19:16] could be a problem.
[1:19:17] >> Yes. I I I would never want that to be
[1:19:20] the focus of the conversation or the
[1:19:23] reason for your denial,
[1:19:24] >> but it's part of the decision tree now
[1:19:27] because it's included in there, even if
[1:19:29] it's not implicit or exor.
[1:19:32] >> I mean, I would be fine if if it was
[1:19:34] completely out.
[1:19:35] >> Yeah, I I think we would as well. Now,
[1:19:37] politically, it might be a little harder
[1:19:38] that it's not touched on in some way. I
[1:19:41] I'm just thinking of it from a decision
[1:19:42] tree standpoint, but anyway, I just ask.
[1:19:45] >> I did want to touch on um Clarence's
[1:19:48] question. Years ago, the county actually
[1:19:51] um hired attorneys from I don't know if
[1:19:53] it was Kentucky or somewhere who had
[1:19:56] been very successful around the country
[1:19:58] in litigating the impact fees. And that
[1:20:02] case went, you know, all through the
[1:20:04] court of appeals. And the courts in
[1:20:06] North Carolina have been very, very
[1:20:08] clear that it is illegal. you cannot do
[1:20:10] anything that could be defined as some
[1:20:13] sort of impact fee. And the same thing
[1:20:16] with with um reasonzoning, you know, if
[1:20:18] we allow it and say, "Oh, but if you, know, pay this much for the
[1:20:22] schools," then that's going to be
[1:20:23] overturned. If if there's going to looks
[1:20:24] like there's something we're trying to
[1:20:26] do to buffer the impact with the schools
[1:20:29] that they could interpret as a fee, then
[1:20:32] that's going to be stricken.
[1:20:33] >> Yeah.
[1:20:36] Is is there a desire to strike it all
[1:20:38] together?
[1:20:39] >> That would be my recommendation, but the
[1:20:41] attorney will advise us on that.
[1:20:43] >> I mean, I think that's the safest route.
[1:20:46] >> Yeah, I'd like to I I don't I would
[1:20:48] prefer we do not include it because
[1:20:50] >> and don't get the information from the
[1:20:52] county at all.
[1:20:55] >> Things if you give it then it becomes
[1:20:56] part of the decision tree. It's it's
[1:20:58] really to protect the planning board and
[1:21:00] the council where that's not part of the
[1:21:02] decision. Now, somebody in their own
[1:21:04] mind can make up you can decide however
[1:21:07] they want. But if I list it, then it's
[1:21:10] like I have the ingredients and I'm
[1:21:11] going to make this, right? I'm going to
[1:21:13] make brown bread, but I'm only using
[1:21:15] white flour. I'm not making brown bread.
[1:21:16] I'm making white white bread, right? But
[1:21:18] if I include the brown flour, then I am
[1:21:20] making that. You get what I'm saying?
[1:21:21] It's like I think it's it would be
[1:21:23] better to leave out because it it
[1:21:25] doesn't factor into into decision and it
[1:21:27] shouldn't and therefore it limits us. it
[1:21:29] legally it it protects the town, the
[1:21:32] residents and the planning board and
[1:21:35] everybody else.
[1:21:37] I mean
[1:21:39] that would be I speak for myself one of
[1:21:42] many
[1:21:43] >> but that would be
[1:21:44] >> I think as long as you understand like
[1:21:45] the school board may frown on that
[1:21:47] somewhat, right? Like we're not even we
[1:21:49] don't even care. We're just
[1:21:50] >> but we but it but it's not part of our
[1:21:53] decision and it it shouldn't be and it
[1:21:55] cannot be,
[1:21:56] >> right?
[1:21:59] I mean
[1:22:03] » a question if if how how do we do it? I
[1:22:05] know how we do it now but what what is
[1:22:07] the actual process of of when you do it?
[1:22:10] What what what how what is the school
[1:22:13] impact? Does that make sense? What what
[1:22:16] are we doing to
[1:22:17] >> get that information?
[1:22:19] >> Yeah. So the last one we did was over
[1:22:21] five years ago and there was one
[1:22:24] consultant at the time that did the
[1:22:26] work. Um but basically the developer
[1:22:28] pays this third party consultant to do a
[1:22:31] report to basically do some projections
[1:22:34] to say how many kids are going to do you
[1:22:37] know are going to be going into um Sun
[1:22:41] Valley High in Trail Elementary you know
[1:22:43] all the whatever whatever cluster it
[1:22:46] might be um they're projecting what what
[1:22:50] that development will bring um and you
[1:22:52] know if you think about it you yeah
[1:22:54] there's some difference in apartments
[1:22:56] and town homes and single family, but it
[1:22:59] it's really kind of a guessing game,
[1:23:01] honestly. Um, but that report would be
[1:23:04] included in in the planning board agenda
[1:23:06] packets and town council packets. Um,
[1:23:08] and and discussed as part of
[1:23:10] >> Do you find that because it was done by
[1:23:12] the developer that it it probably leaned
[1:23:17] towards
[1:23:19] positive things to say to you would
[1:23:22] think so, would you? Or would you not?
[1:23:24] the professional.
[1:23:25] >> I I I think you are asking an obvious
[1:23:27] question. Yes, I think it would.
[1:23:29] >> The professional we worked with um since
[1:23:31] I've been in Indian Trail, she actually
[1:23:34] had some pretty uh pretty contentious
[1:23:38] conversations with developers because
[1:23:40] she was not willing to do that. But I
[1:23:42] certainly think that there probably were
[1:23:44] some consultants that would lean very
[1:23:47] conservative.
[1:23:47] >> This a tough uh thing.
[1:23:50] I'm almost thinking what'd you bring it
[1:23:52] up for? I'm I'm kidding. Um but um yeah,
[1:24:00] any other questions? What What are your
[1:24:02] thoughts, Clarence and Crystal, in terms
[1:24:04] of I mean, we're going to we're going to
[1:24:07] remove that requirement. What about
[1:24:09] having that included? What are your
[1:24:10] thoughts?
[1:24:15] I mean, I agree that if we don't have
[1:24:17] it, there's, you know, nobody can see
[1:24:20] that it makes sense because we can't
[1:24:22] judge it. But then I don't know how the
[1:24:24] school board would look upon it. I guess
[1:24:25] they see that us asking for that
[1:24:27] information. Looks like we can do
[1:24:30] something with it, but I'm sure they
[1:24:31] know we can't. So,
[1:24:33] >> exactly.
[1:24:34] >> I mean, I'm fine with removing it
[1:24:36] because really and truly it does
[1:24:38] eliminate any question of if we
[1:24:40] considered that
[1:24:43] Clarence,
[1:24:44] >> thank you for asking. Um, I I see I see
[1:24:49] your point. Um, I think it's a good
[1:24:51] point that it can have a uh negative it
[1:24:57] could have a negative impact. Also, the
[1:25:00] fact that um
[1:25:03] we even have to have this discussion. We
[1:25:06] haven't really had any developers come
[1:25:07] to us and ask for any projects or
[1:25:10] housing projects and it's hard to find
[1:25:13] somebody anyways which slows down that
[1:25:14] process. But I really um I don't think
[1:25:18] it will be a
[1:25:24] negative move for us as far as the
[1:25:26] school board is concerned.
[1:25:27] >> I don't think so. Um then sorry I
[1:25:31] appreciate you you guys may I'm just
[1:25:33] asking a couple questions. Melanie, if
[1:25:35] we were to move on with this um here, um
[1:25:39] how would you how would you recommend we
[1:25:41] approach it? I'd like to make a motion,
[1:25:43] right? And what I'd like to do is to
[1:25:45] kind of give the planning board the no,
[1:25:48] sorry, the planning director and her
[1:25:50] staff sort of the instructions. How do
[1:25:52] we do that?
[1:25:54] >> If it's changed, it would have to go
[1:25:56] back to planning board, right? We can't
[1:25:57] vote on it removing it alto together
[1:25:59] because that's not what planning board
[1:26:01] considered and recommended. So we'd have
[1:26:03] to go through the process already. Would
[1:26:06] it be beneficial to approve it as is so
[1:26:09] at least we have something so in the
[1:26:11] event a developer comes forward, we
[1:26:13] don't have to tell them, hey, you have
[1:26:14] to do the school study and there's no
[1:26:16] one that can do it. Um
[1:26:18] >> yes,
[1:26:19] >> I I got you. I I follow. But I do think
[1:26:22] um I was looking through my emails to
[1:26:23] look for it, but um leaning
[1:26:26] on the I don't want to say it's illegal,
[1:26:29] but the court could find it's arbitrary
[1:26:30] and capriccious for us to turn down a
[1:26:33] development because of the school study.
[1:26:36] That was the language I was looking for.
[1:26:38] >> All right. So, mayor, I've answered I've
[1:26:41] questions have been answered. If you
[1:26:43] want, I can make a motion or if you have
[1:26:44] anything else.
[1:26:45] >> No, I I do. It's a very difficult um I
[1:26:49] kind of put my two cents in. It's it's a
[1:26:51] difficult decision to make.
[1:26:53] >> Uh because it's also a political
[1:26:55] decision.
[1:26:56] >> Yeah.
[1:26:57] >> It's a um
[1:26:59] look, you don't want to look at it
[1:27:01] politically because I don't believe it
[1:27:02] is a political, but other people may
[1:27:05] turn it into a political uh uh situation
[1:27:08] that you don't care. Uh that that and
[1:27:11] that doesn't I don't I really don't see
[1:27:14] it that way. I don't I don't see it that
[1:27:15] we don't care. I I see it that we're
[1:27:17] doing the right thing to do if because
[1:27:20] of what you want to do, but uh it would
[1:27:23] have been easy for me just not to say
[1:27:24] anything, be honest with you, and let
[1:27:26] you guys do it. So, go go ahead and I I
[1:27:29] kind of would like to see it. Um
[1:27:32] >> I want you to protect yourselves, too.
[1:27:34] So, I don't want you So, it's it's up to
[1:27:37] you guys. So it we're politicians and
[1:27:40] sometimes some things may be political.
[1:27:42] But that being said, sir, um Miss D, you and your staff would look into sort
[1:27:47] of the advancement of that in terms of
[1:27:49] removing it at some point.
[1:27:51] >> Yes, I I do agree um with Miss Cox, it
[1:27:53] would be great because this did just
[1:27:56] come up. So we didn't we're not just
[1:27:58] combing the code and trying to create
[1:27:59] funds things for y'all. So if we had if
[1:28:02] we got the school impact study removed
[1:28:05] then our next planning board meeting we
[1:28:07] can propose an amendment to to wosing.
[1:28:10] >> You go along that way and then I'll make
[1:28:12] a motion to open and close.
[1:28:15] >> Oh, sorry.
[1:28:17] >> Anybody signed up?
[1:28:18] >> No. Can I No, you can.
[1:28:19] >> I I'll make a motion to open and close
[1:28:21] public comments.
[1:28:23] >> All in favor?
[1:28:24] >> Yeah.
[1:28:24] >> Unanimous.
[1:28:25] >> Sorry, mayor. I was jumping ahead there.
[1:28:28] Um, and I'll make a motion to approve
[1:28:30] ordinance number 433
[1:28:33] pertaining to petition ZT2026-
[1:28:37] 080085
[1:28:39] as presented.
[1:28:40] >> All in favor?
[1:28:42] >> Unanimous.
[1:28:42] >> I'll make a second motion to adopt the
[1:28:45] statement of consistency findings for
[1:28:47] ZT2026-0085
[1:28:50] as read into the record by staff.
[1:28:52] >> All in favor? Unanimous.
[1:28:56] Okay.
[1:28:57] All right, last one for the night is CZ
[1:29:00] 202260086
[1:29:02] Hanfield Vet Clinic. This is a
[1:29:04] conditional resoning modification from
[1:29:06] the original CZ 2014003M.
[1:29:10] Um that M says that we've already
[1:29:12] modified it. Um we don't do two M's, so
[1:29:16] we're going with a new case number. Um
[1:29:20] so we are looking to add a land use uh
[1:29:23] for a veterinarian clinic and office. um
[1:29:28] without outdoor animal areas. Um and
[1:29:31] this is in the Hanfield Village Shopping
[1:29:33] Center. No new structures are planned.
[1:29:35] This is within an existing structure. Um
[1:29:38] and the original Hanfield Village uh CZ
[1:29:42] did not allow it. It excluded uh
[1:29:44] veterinarian services as um a prohibited
[1:29:47] use.
[1:29:49] So just a little bit about the
[1:29:50] conditional zoning. This is obviously
[1:29:52] the public shopping center. It was
[1:29:54] approved in 2015
[1:29:56] and amended in 2024 to allow
[1:29:59] drive-through facilities and a cigar
[1:30:01] shop on Wesley Chapel Stouts Road. You
[1:30:03] may remember that. Um, and this
[1:30:06] petition, just like the previous
[1:30:08] modification, doesn't change any of the
[1:30:10] original approvals. We're just changing
[1:30:12] the specific use for vet. Everything
[1:30:15] else remains in place. Um and again
[1:30:18] property conditions uh currently it's
[1:30:21] within that Sun Valley Activity Center
[1:30:23] overlay that we talked about on um the
[1:30:25] first public hearing for tonight. It's
[1:30:28] zone CZGBD which is general business
[1:30:31] district. And then obviously you've got
[1:30:33] um the Publix and all of the the
[1:30:36] tenants, the restaurants and personal
[1:30:38] services in that shopping center.
[1:30:42] surrounding conditions. It's adjacent to
[1:30:44] other shopping as well as the um Sun
[1:30:47] Valley High School and then there are
[1:30:49] some nearby residential subdivisions.
[1:30:54] This is the building. So, previously
[1:30:56] where um the joint chiropractic was and
[1:30:59] located behind the um copper t uh tap
[1:31:04] and table club Pilates Geico
[1:31:09] and then your existing zoning
[1:31:11] conditions. So, you can see that Sun
[1:31:13] Valley Commons is GBD. You've got the
[1:31:15] Hanfield Village that's GBD and then you
[1:31:17] do have some um SF1 surrounding it as
[1:31:20] well.
[1:31:22] future land use. Again, um it is in the
[1:31:25] subregional activity center overlay. It
[1:31:27] does um plan for this area to be an
[1:31:30] entertainment district and mixed use is
[1:31:32] what we are looking for. So, it complies
[1:31:34] with that and it complies with the
[1:31:37] comprehensive plan in the areas of
[1:31:38] economic development goal number one,
[1:31:40] land use and housing goal number one,
[1:31:42] and land use and housing goal number
[1:31:43] four.
[1:31:46] And why wouldn't they allow vet clinics
[1:31:49] um by right? So, we did look at a couple
[1:31:53] of the impacts um and really talked a
[1:31:57] lot in planning board about the outdoor
[1:31:59] areas um and really honed in with the
[1:32:04] tenant that it would be primarily vet
[1:32:08] clinic. They're not going to be having
[1:32:09] boarding where, you know, the dogs are
[1:32:11] going to um have to go in and out. Um
[1:32:15] and so the outdoor area would not be
[1:32:17] necessary. And we also have an example
[1:32:20] in the Sun Valley area already with PEP
[1:32:22] bar if y'all are familiar with that. Um
[1:32:25] we were a little concerned when that
[1:32:27] came in by Wright. Um but that has not
[1:32:29] been an issue with there needing to be
[1:32:31] any um outdoor facilities for the
[1:32:33] animals. They're they're they're in and
[1:32:35] out um quickly.
[1:32:39] So, our recommended conditions um is
[1:32:42] just this blue at the bottom and that it
[1:32:45] allows the veterinarian clinics and
[1:32:47] offices without outdoor animal areas may
[1:32:50] be permitted. Um and any indoor animal
[1:32:52] boarding must only be associated with
[1:32:55] medical care.
[1:32:58] The requested action is before you and
[1:33:00] I'll be glad to answer any questions you
[1:33:01] may have. Thank you.
[1:33:02] >> Okay. And again, we have no one signed
[1:33:04] up for public hearing. So, can I get an
[1:33:07] open and close on public hearing?
[1:33:10] >> Motion to open and close public hearing.
[1:33:12] >> All in favor? Unanimous.
[1:33:15] >> Can I get a motion?
[1:33:18] All right. Motion to approve ordinance
[1:33:20] number 434 pertaining to position
[1:33:23] petition CZ2026-0086
[1:33:28] as presented.
[1:33:29] >> All in favor?
[1:33:31] >> Unanimous. Motion to adopt the statement
[1:33:35] of consistency findings for
[1:33:37] CZ2026-000086
[1:33:41] as read into the record by staff.
[1:33:44] >> All in favor unanimous.
[1:33:49] » Okay, Randy. Thank you. Thank you.
[1:33:53] >> Brings us to old B business uh project
[1:33:55] update. Uh Chestnut Square Park phase 2B
[1:33:59] field and community center. Mr.
[1:34:01] Huninger.
[1:34:09] » Uh, thank you, Mayor Council.
[1:34:13] So, tonight we're going to talk u give
[1:34:15] you a little bit of the history less,
[1:34:18] you know, where we're, you know, how we
[1:34:20] came to be at this point. Uh, concept
[1:34:23] site plan and then the design contract.
[1:34:29] So, um, we back in January of last year,
[1:34:33] um, basic council decided to delay this
[1:34:37] project due to the fact, uh, staff came
[1:34:39] back to y'all to suggest this might be a
[1:34:42] good piece of property to for a future
[1:34:44] community center. And so then we came
[1:34:46] back to you the following month in
[1:34:47] February 2025 uh, to approve
[1:34:51] analysis uh, contract to see if this
[1:34:53] would be doable.
[1:34:55] Uh and then basically um Adam came back
[1:34:59] to y'all uh just recently to get council
[1:35:02] approval on concept 2B.
[1:35:07] So just right now the you know what we
[1:35:11] got out there is what we built was Chest
[1:35:13] Square Park phase 2A.
[1:35:16] So, just to go back to our CIP ordinance
[1:35:18] and give you a rundown of where where
[1:35:20] we're at is basically we expended those
[1:35:22] funds. This is what we expended to build
[1:35:24] that phase 2A section. Uh so, we used
[1:35:27] those four funding sources, Cal
[1:35:29] Preserve, part Bond, storm water, skip
[1:35:31] grant. Uh and I'm not going to go
[1:35:33] through the amounts, but basically that
[1:35:35] equaled about 3.19
[1:35:37] basically $3.2 million.
[1:35:41] and so what we have remaining in that
[1:35:43] $7.5 million CIP
[1:35:47] uh is uh basically 4.3 uh and you have
[1:35:50] those fund four funding sources general
[1:35:53] fund capital reserve part bond and then
[1:35:55] a little bit of storm water which we
[1:35:57] probably won't use. Um, but just to be
[1:36:00] transparent, that's that's exactly what
[1:36:02] the amounts were.
[1:36:05] So, uh, when we came to y'all with a
[1:36:10] chestnut phase 2, this was what was
[1:36:13] going to be the total, uh, site layout
[1:36:16] and what was going to be built in the
[1:36:17] future. Obviously, we're not building
[1:36:19] that now. U, so that parking lot area is
[1:36:22] changing. Uh, the fields being
[1:36:25] repositioned. Um, and so, uh, just to
[1:36:28] give you a sense of what y'all approved
[1:36:30] way back then, that was what that was
[1:36:32] what was technically approved. Now, we
[1:36:34] doesn't we don't have to build that
[1:36:35] weird parking lot area with the circle,
[1:36:37] um, and so forth and so on. So, I think
[1:36:40] it's been a good decision. So, this is
[1:36:43] what you approved in June, uh, concept
[1:36:45] 2B.
[1:36:47] All right. So, again, we've shifted the
[1:36:50] field down. Um the way this the this con
[1:36:54] this uh submittal agreement that you're
[1:36:56] going to uh ask to be approved tonight
[1:36:58] basically we'll replplat this property.
[1:37:00] So this property line you see down here
[1:37:02] at the b bottom going across the field
[1:37:06] will no longer be there that this
[1:37:07] property will be one property not two
[1:37:10] separate properties. Uh so we're going
[1:37:12] to clean up that u and then again you
[1:37:15] get more parking. Um
[1:37:17] and uh we we'll uh still do the part do
[1:37:21] the uh bathroom facility at the existing
[1:37:23] parking lot that was built in phase 2 A
[1:37:26] um and then um finish out the boardwalk.
[1:37:31] So what you approved in that original
[1:37:34] contract analysis was $59,700.
[1:37:37] We're pretty much have expended all that
[1:37:38] money. And so the supplemental agreement
[1:37:41] is broken down into two main sources.
[1:37:44] And I'll give you a breakdown of that in
[1:37:46] a minute. Um, so you basically have the
[1:37:48] Chesnut Square part two phase 2B design,
[1:37:52] which is around $274,000.
[1:37:55] And then you'll have the community
[1:37:56] center um design renderings. Uh, again,
[1:38:00] giving you a sense of what that's could
[1:38:02] be in the future, give you options of
[1:38:04] what you could choose,
[1:38:06] um, the facade and everything. Um, that
[1:38:09] will be part of that. Uh, and you
[1:38:11] basically that 177,000 you see there is
[1:38:15] going to give you almost uh a 50% design
[1:38:18] of that building. I mean, you're going
[1:38:19] to get a good sense of what that
[1:38:21] building is going to look like from in
[1:38:23] from inside and out. U
[1:38:26] so just just so we're clear about that.
[1:38:28] Um and so that breakdown of that
[1:38:31] supplement agreement is again
[1:38:34] any any plan you've got to go back and
[1:38:36] do some surveying. Uh so we're going to
[1:38:38] do a little bit of surveying. The
[1:38:39] schematic design is 38,000. That's
[1:38:41] basically getting you at 30% design
[1:38:43] plans and then it comes back to us to
[1:38:45] review as staff and you know again
[1:38:48] that's when you're going to find if you
[1:38:49] got any hiccups with grade or anything
[1:38:51] like that. Um hopefully that's not the
[1:38:53] case but again that's a stepping stone
[1:38:56] and then you go into um basically
[1:38:58] construction docks in permitting which
[1:39:00] gets you to basically your 90 to 90 to
[1:39:03] 100% plans. That's all in that 89,000.
[1:39:08] Um,
[1:39:10] and that's includes storm water. You
[1:39:12] know, we we still got to make sure the
[1:39:14] pond itself uh can can take the
[1:39:17] impervious that we're putting back the
[1:39:18] additional impervious we're putting back
[1:39:20] out there. We may have to put a smaller
[1:39:22] pond in a different in a a different
[1:39:24] location. Don't know that yet, but
[1:39:26] again, that's part of that that money.
[1:39:29] And then the sub services, that's
[1:39:31] basically all the subcontractors. You've
[1:39:33] got you got the the guy that's going to
[1:39:35] design this uh synthetic turf field. All
[1:39:38] right, that's a separate consultant.
[1:39:41] Then you have your architectural design
[1:39:45] of the building and all that. And then
[1:39:47] you have um
[1:39:50] and also the bathroom stuff. Again, we
[1:39:52] have to go back and take a look at make
[1:39:54] sure what we designed back then. We did
[1:39:57] have somewhat of a a permanent design
[1:39:59] for that building, but again, that's
[1:40:00] been several years old. So he has to go
[1:40:02] back and make sure it's up to code now
[1:40:04] the any updated building code standards.
[1:40:07] So you got a little bit of services in
[1:40:08] that. And then of course we got to get a
[1:40:10] new cost estimation to figure out
[1:40:12] exactly what it's going to cost us. Cuz
[1:40:14] again you have 4.3. I can't guarantee
[1:40:17] you it's going to come in below that. Uh
[1:40:20] hopefully it does, but we we'll know
[1:40:22] that sooner or rather than later when we
[1:40:24] get to that 60% plan stage. And so we'll
[1:40:27] come back to y'all then. And then
[1:40:29] basically we we'll have to do some
[1:40:31] material testing services out there. Uh
[1:40:33] so you've got to factor that in, you
[1:40:35] know, a pot of money to make sure you
[1:40:37] have enough to do that. And then
[1:40:39] reimburse is just, you know, documents,
[1:40:42] printing, stuff like that.
[1:40:46] Uh what's not in this number is uh the
[1:40:50] permitting itself is trying to get the
[1:40:52] documents together, but do you know
[1:40:53] obviously the town do pays the
[1:40:55] permitting fees for those third party uh
[1:40:57] agencies. So, that's a little bit of
[1:40:59] money. It's not much, but again, it's
[1:41:01] not technically in that number. Just so
[1:41:02] you're we're clear.
[1:41:05] Any questions about uh the breakdown
[1:41:09] um of those two amounts? Again, you've
[1:41:11] got 40 451,700 is your total amount. And
[1:41:16] that gets you again that 177 is inside
[1:41:19] that sub subcontractor services. So,
[1:41:22] that's your total plus your community
[1:41:24] center renderings, which is your 50%
[1:41:26] design plans.
[1:41:28] All right. Anyway, I'll take questions
[1:41:30] if anybody has any. Um,
[1:41:33] before we go into the ordinance, let's
[1:41:36] ask questions and I'll explain what the
[1:41:38] orange change is.
[1:41:39] >> Anybody have any questions?
[1:41:40] >> Yeah. The um the 451 represents the
[1:41:43] 50some, the 177, and the 280 something.
[1:41:46] Right.
[1:41:46] >> No, the 59 the 50ome we already paid
[1:41:48] for. All right. That that was the
[1:41:50] >> 177 and the 280 something.
[1:41:52] >> Correct. Yes. Um the 177 is going to
[1:41:55] come out from the community
[1:41:58] fund, right? Pulling from two sources,
[1:42:01] >> right? And you'll see that. Yeah.
[1:42:02] >> All right. That's all I asked. That's
[1:42:05] all I I'm asking.
[1:42:08] Any other questions? So, um I thought of
[1:42:12] this question earlier, but u which
[1:42:14] really has nothing to do with this, but
[1:42:16] this
[1:42:17] uh this was approved,
[1:42:20] uh the phase 2B was approved unanimously
[1:42:24] council, was it not? Okay. I just wanted
[1:42:27] to make sure that it was already
[1:42:29] everybody understood that it was
[1:42:30] unanimously passed. Go ahead. That was my comment.
[1:42:35] >> When you say phase 2b, what I guess what
[1:42:37] is it? It was approved for us to go get
[1:42:40] these numbers to bring back to council
[1:42:43] for them to approve the project itself.
[1:42:45] The the schematic design that Todd
[1:42:47] showed that showed the community center,
[1:42:50] >> the field, and the parking lot, the
[1:42:52] second one. Yes, that was approved by
[1:42:54] council at the
[1:42:55] >> two meetings ago.
[1:42:56] >> Right.
[1:42:58] >> Okay.
[1:42:58] >> Yeah.
[1:42:58] >> Okay. All right. Uh move on.
[1:43:02] >> Okay. So the way the ordinance breaks
[1:43:04] down is basically you're adding an
[1:43:07] additional cap reserve fund which is the
[1:43:08] community center fund to fund that 177
[1:43:11] which is on the second um your other
[1:43:13] funding sources don't change. Um
[1:43:17] so basically you're adding that 17 on
[1:43:19] top of the 7 and a half million.
[1:43:25] And if you have any more questions I'll
[1:43:27] be happy to answer them. If there's no
[1:43:29] more questions, I just I just want to um
[1:43:34] just bring this up very quickly. Um
[1:43:38] the importance of having a I I I've read
[1:43:41] and seen where
[1:43:44] uh why haven't we move forward with
[1:43:47] trying to um collect money or try to ask
[1:43:51] for money for for the community center?
[1:43:54] And um um I just
[1:43:59] You can't really ask for money until you
[1:44:00] have until you have something to show
[1:44:02] them. And um I kind of would like that.
[1:44:05] Adam, would you like to
[1:44:07] or or mention or say
[1:44:11] in other words, we've got to you've got
[1:44:14] to have a if you're going to ask
[1:44:15] somebody for $40 million,
[1:44:18] you can't tell them what you think it's
[1:44:20] going to look like. You got to show them
[1:44:22] what it's got to look like. Is is this
[1:44:24] is what my point is trying to be. Not
[1:44:26] that I think anybody's gonna give us $40
[1:44:29] million, but what if they did? You know,
[1:44:31] that'd be great. Or a million dollars or $500,000 or $200,000 that before you
[1:44:37] do that, you've got to you've got to
[1:44:39] show them. You don't go buy a
[1:44:41] Rolls-Royce without without seeing it,
[1:44:44] you know, without knowing what it is. So
[1:44:46] I I just kind of want that out there
[1:44:48] because I have seen several people
[1:44:51] question the fact that why well I'll
[1:44:54] just point we haven't we haven't or
[1:44:57] haven't gotten any money and I want to
[1:44:58] do my best to get money for it and but
[1:45:01] that's the reason and right
[1:45:03] >> and and that's what that 177 is going to
[1:45:05] give us. So that'll give us like Todd
[1:45:07] just said to 50% design plans roughly
[1:45:11] >> roughly
[1:45:12] >> between two and three external
[1:45:15] renderings of the community center so
[1:45:18] that council, the public, park and rec
[1:45:21] park and recck committee, everybody can
[1:45:23] weigh in to what that looks like at that
[1:45:25] point.
[1:45:25] >> If I can add this too, mayor, um it it's an important step in our evolution
[1:45:31] right as a town where we want to
[1:45:33] construct a community center. We've
[1:45:35] identified a place for it that where
[1:45:37] we'd like to see it, but without without
[1:45:40] the the a plan, right, which is
[1:45:42] basically saying at this point in time,
[1:45:44] we want to build this. This is how much
[1:45:46] we estimate it to cost. It'll cost us. I
[1:45:50] think that is what you will need as the
[1:45:51] mayor, as the face of the town going out
[1:45:53] and asking people for money. They're
[1:45:55] going to ask you, well, what are you
[1:45:57] going to build? You have something to
[1:45:58] show, right? Even if it's the plan, how
[1:46:01] much it's going to cost? you have an
[1:46:02] estimate of what it's going to cost if
[1:46:04] you had the money one time. So I think
[1:46:06] these things are necessary for us to
[1:46:08] move on to that next phase. And anybody
[1:46:11] who you know brings up a point in saying
[1:46:13] well why haven't you asked for money? I
[1:46:14] mean I'm just going to be honest.
[1:46:18] So let's not worry about these. Let's
[1:46:20] not worry about you know the people who
[1:46:22] some very small minority who think that
[1:46:25] way. Let's put this forward and get
[1:46:27] there and therefore we go that we you
[1:46:29] know
[1:46:29] >> well I think it's it's I think it's
[1:46:31] necessary. I just want the public to
[1:46:32] realize too that that's that's what
[1:46:34] we're doing. That's that's why we're
[1:46:36] doing and and I think it's a it's a good
[1:46:38] idea. So, thank thank you for for that.
[1:46:42] So,
[1:46:43] >> so we have a you know several motions we
[1:46:46] got to do um to get this get the finish
[1:46:48] line.
[1:46:49] >> Okay. Can I uh can I get a motion?
[1:46:54] Somebody want to make a motion?
[1:46:56] >> Congress.
[1:46:57] I would like to make a motion
[1:47:00] to approve design contract supplemental
[1:47:03] agreement number one with McAdams as
[1:47:06] presented.
[1:47:07] >> All in favor?
[1:47:08] >> Unanimous.
[1:47:09] >> Also would like to make a motion to
[1:47:11] approve the amended U Chestnut Park
[1:47:15] phase 2 ordinance number 094 as
[1:47:19] presented.
[1:47:20] >> All in favor? Unanimous.
[1:47:23] I also would like to make a motion to
[1:47:26] approve the budget amendments for
[1:47:27] Chestnut Park phase two as pres
[1:47:31] presented.
[1:47:33] >> Yes. Okay. All in favor? Unanimous.
[1:47:37] And I am done with my motions.
[1:47:39] >> Okay. Next we have Stallings Fire
[1:47:41] Department storm water relocation. Mr.
[1:47:43] Huninger, go right ahead.
[1:47:47] >> All right. So, um,
[1:47:52] just so you know, I did talk to, uh, the
[1:47:54] storm water committee about what I'm
[1:47:55] about to present tonight. Uh, and they,
[1:47:58] uh, they recommended moving forward, uh,
[1:48:01] with my request. So, just give you a
[1:48:04] rundown one more time in case uh,
[1:48:06] somebody audience doesn't know what's
[1:48:09] going on here. U,, so you got the
[1:48:12] property of Stalin's Fire Department
[1:48:13] along road and that's basically what it
[1:48:15] looks like.
[1:48:17] You got a you got a rideway that was
[1:48:20] bought by the NC DOT to do the old mower
[1:48:22] widening and so they purchased this. So
[1:48:26] that impacts their dried attention which
[1:48:28] is in the green area. So uh they came to
[1:48:31] the town because uh you know they
[1:48:33] haven't they don't have any experience
[1:48:34] you know you know trying to get this
[1:48:37] thing moved uh contractwise or anything
[1:48:40] else. Um so um we uh the DOT did give
[1:48:46] them a certain amount of money to uh
[1:48:48] move the dry pond back to the back. We
[1:48:51] have uh as a as a staff has have
[1:48:54] recommended that we do not just uh
[1:48:57] remove replace the dry pond. We want to
[1:49:00] get this site back in compliance. Um and
[1:49:03] that would be to put a water quality
[1:49:05] feature back there. And so, uh, our
[1:49:08] consultant that that we hired, uh, that
[1:49:11] the the fire department is paying, um,
[1:49:14] basically, uh, designed a wet pond back
[1:49:16] there.
[1:49:18] And it's because, as you can see all
[1:49:20] that impervious on the screen. Um, uh,
[1:49:23] the fire department when it was first
[1:49:25] built was the building structure itself
[1:49:27] and then the front parking area. And
[1:49:29] then they had a little bit of park uh,
[1:49:30] asphalt in the back for the trucks to
[1:49:32] obviously drive around the building. But
[1:49:34] all that parking at the that you see at
[1:49:37] the back here
[1:49:39] uh basically was built due to the fact
[1:49:42] this is a place you go and cast your
[1:49:44] votes. So they need the parking area to
[1:49:46] have somebody to park back there. Um and
[1:49:49] so that got added. I don't know when. Um
[1:49:53] but again that's not being captured by
[1:49:55] any kind of a storm water uh facility.
[1:49:58] Uh and so it needs to come back into
[1:50:00] compliance. So um so I've talked to
[1:50:03] them. We um
[1:50:05] we did put a little bit of design funds
[1:50:08] uh together. It was about $7,000 storm
[1:50:11] funds uh that uh I did go to the
[1:50:14] committee for and and we just approved
[1:50:15] as staff because it was a low amount. Uh
[1:50:17] so we did uh add a little bit of design
[1:50:20] funds to get that water quality designed
[1:50:23] feature design. But that's the reason
[1:50:24] why we we need to put this back in
[1:50:26] compliance in our stormwater permit our
[1:50:28] MS4 permitting. It really encourages
[1:50:31] retro, we call it retrofitting a uh uh
[1:50:34] property. And so being this is a
[1:50:36] government facility, we think this is uh
[1:50:39] this be our first one, but we think it's
[1:50:40] a good idea to spend $200 to help uh
[1:50:43] this uh property get back in compliance
[1:50:46] because technically they didn't have to
[1:50:48] do this. I mean, they all they needed to
[1:50:50] do was because our grandfather didn't is
[1:50:51] move that dry pond and we feel like
[1:50:53] that's not um a good a permanent
[1:50:56] solution.
[1:50:58] So where we at right now is we have full
[1:51:01] design plans completed. We have an
[1:51:02] engineer estimate that was completed
[1:51:04] that has been uh shared to the um sen
[1:51:07] fire department fire chief. Um
[1:51:11] uh obviously all that impervious I just
[1:51:14] showed you all that parking lot area the fire department does want to uh
[1:51:18] rehab all the asphalt. So that is wasn't
[1:51:21] part of this scope. You know obviously
[1:51:22] DOT is not paying for all that based on
[1:51:24] the rideway acquisition. So, they've got
[1:51:26] to come up with those funds. So, that's
[1:51:28] what they're doing right now is they're
[1:51:30] going back to the county and trying to
[1:51:32] get more funds for the project. Um, they
[1:51:35] feel like they can get those fairly
[1:51:37] soon. So, we're tenatively going to
[1:51:39] advertise this in September if they can
[1:51:41] get those funds. If not, it'll just get
[1:51:43] delayed till, you know, whenever. Um,
[1:51:47] but we we still are trying to get this
[1:51:49] thing bid out as soon as we can to go
[1:51:50] ahead and get the process start because
[1:51:52] we we do know road is finally coming
[1:51:55] soon.
[1:51:57] Um,
[1:51:59] and then there's obviously a little bit
[1:52:01] more a little bit of material testing.
[1:52:03] Um, so we we have a called one of our
[1:52:06] consultant we've used in the past. It's
[1:52:07] very small amount but there will be a
[1:52:09] little bit of testing that need to be done.
[1:52:12] So DOT basically gave them $38,816
[1:52:17] to move this pond. And obviously to move
[1:52:20] it, you had to redo some of the storm
[1:52:23] water pipe mean, you know, all the
[1:52:24] parking lots drained towards open road.
[1:52:26] Now it's got to drain to the back. So
[1:52:27] you got to reverse all of it. So all
[1:52:29] that's included in the 308. Uh the
[1:52:31] design obviously taken some of that. Um
[1:52:35] so right now that that's a total of 358
[1:52:38] because again they're going to need
[1:52:40] every bit of 308. So, they knew the 49
[1:52:42] was going to be extra
[1:52:44] and they're basically in charge of all
[1:52:46] the overages. Uh, again, we're going to
[1:52:48] help them out with some storm funds, but
[1:52:50] that's that's it as far as that goes.
[1:52:52] So, just wanted to give you a clo more
[1:52:55] closeup what I was talking about with
[1:52:56] the imper the impervious. Again, that's
[1:52:58] all new asphalt back there. So, it's a
[1:53:00] very big area u that they want to
[1:53:02] improve. So, that's a big number they've
[1:53:04] got to go get. And so
[1:53:07] now again, we gave them seven grand to
[1:53:11] uh to design the water quality feature.
[1:53:13] Um but now they've got to go back and
[1:53:15] get our total in engineers estimate with
[1:53:18] everything included 750,000.
[1:53:21] Um uh the uh their total would be the
[1:53:26] 259 plus the parking lot. And to convert
[1:53:30] that to make that a water quality, we
[1:53:32] basically we took several line items
[1:53:33] that are considered water quality line
[1:53:35] items like your your plantings
[1:53:38] um uh some of the vegetation
[1:53:41] um and and uh for instance a trash rack
[1:53:45] uh appearance uh you know items for the
[1:53:48] structure stuff like that that ends up
[1:53:49] being around 92 and again that's an
[1:53:51] engineer's estimate. I haven't bid it
[1:53:53] out yet. Don't know what the total
[1:53:54] number is going to be but needed funds
[1:53:56] for the county. They need to go back and
[1:53:58] get 397,000 to make this work. But what
[1:54:01] I'm asking the town to do, uh, the
[1:54:04] council is approved using, uh, not to
[1:54:06] exceed $100,000 of storm water funds uh,
[1:54:09] to help build the, uh, water quality
[1:54:11] pond.
[1:54:13] And I'll be happy to answer any
[1:54:14] questions.
[1:54:16] >> Question.
[1:54:17] >> Yeah. So, they need 397.
[1:54:20] >> They need 397. Not well, not including
[1:54:22] our stuff. That's all them. And there
[1:54:25] they will they be able to get that
[1:54:27] money.
[1:54:27] >> I'm been told that shouldn't be a
[1:54:30] problem.
[1:54:30] >> Okay.
[1:54:32] >> I think if anything,
[1:54:35] you know, the asphalt parking lot won't
[1:54:36] get won't happen. But the obviously I
[1:54:38] think getting the that's that's about
[1:54:40] 150 something thousand just to do the
[1:54:42] asphalt.
[1:54:42] >> Yeah.
[1:54:43] >> So he they've got at least get 160
[1:54:45] $170,000. I
[1:54:46] >> mean we we I'm I'm fully supported. We
[1:54:48] love we love our firemen, right? They
[1:54:51] do, you know, first responders. to do um
[1:54:54] service when hopefully there's not a
[1:54:56] fire, but if there is and it's also a
[1:54:58] place where a lot of people go to vote
[1:54:59] to as well. It's a very big polling
[1:55:00] place.
[1:55:00] >> Yeah, it's it's a lot of parking back.
[1:55:02] So, um I'm sure it gets used uh
[1:55:05] seasonally.
[1:55:07] >> I have a question. Um
[1:55:09] >> Yes, sir.
[1:55:10] >> Since the um DOT, I guess, to took part
[1:55:14] of that land, correct? Correct. And this
[1:55:16] is a reason why we're doing it.
[1:55:18] >> Yes. Uh, do you know how much money the
[1:55:20] fire department received for that for
[1:55:22] that land?
[1:55:23] >> That was that 308
[1:55:24] >> as a 308. So, so
[1:55:27] out of that 375 that they need, am I
[1:55:30] understanding that right? 308 of it.
[1:55:32] >> Yeah. 750 total, they've got basically
[1:55:36] 308 to play with and they need more.
[1:55:38] They need the difference now.
[1:55:39] >> Okay. Yeah.
[1:55:40] >> I just wanted to make sure I knew I
[1:55:42] understood what Yeah. Yeah. No.
[1:55:44] >> Okay. Okay.
[1:55:45] >> All right. Can I get a motion?
[1:55:51] » I would like to make a motion to approve
[1:55:54] the request for using the additional
[1:55:56] $100,000
[1:55:58] of stormwater funds for construction
[1:56:00] costs for the Stalins Fire Department
[1:56:02] storm water recloation
[1:56:04] project as presented.
[1:56:06] >> All in favor? Unanimous.
[1:56:08] >> All right. Thank you, Mayor Council.
[1:56:10] >> Thank you.
[1:56:12] >> Okay.
[1:56:16] All right. So, we're going to move on to
[1:56:20] budget amendments. Excuse me. Economic
[1:56:23] development agreement. I'm sorry.
[1:56:28] I I had skipped to the next one
[1:56:30] in my mind. So, yes, we are on the
[1:56:33] economic our economic development for
[1:56:35] the Indian Trail Waterline. Um, so
[1:56:38] council back in March of this year uh
[1:56:42] directed myself and and the team to work
[1:56:46] on an agreement with Indian Trail Town
[1:56:50] Center LLC for not for an amount not to
[1:56:54] exceed half a million dollars. Uh we
[1:56:56] have worked with uh Melanie, gotten that
[1:57:00] agreement drafted. It uh went to Taipar.
[1:57:04] They were good with it. It's come back
[1:57:05] to us. So now we are here tonight to uh
[1:57:08] ratify that agreement. Also with that is
[1:57:12] the budget amendments that it'll take to
[1:57:14] do that. Um
[1:57:17] it is my recommendation to in this
[1:57:20] year's budget. We allotted $200,000 for
[1:57:24] economic development to use that. And in
[1:57:26] the past y'all have put aside and saved
[1:57:29] out of past budgets an amount of
[1:57:32] $320,000
[1:57:33] for economic development. So, take 300
[1:57:36] of that, the 200 of this year's budget,
[1:57:38] adds up to 500 to be able to fund that.
[1:57:41] Um, leaving in that, let's call it the
[1:57:45] economic development savings account.
[1:57:47] Again, I'm not using a budgetary term.
[1:57:50] I'm using just a a general term would
[1:57:52] still be about $20,000 sitting there for
[1:57:55] future projects that council wanted to
[1:57:58] do incentives for. Remember, this
[1:58:00] doesn't mean that council does not have
[1:58:01] money to do incentives. You would just
[1:58:03] have to do budget amendments from
[1:58:05] unassigned fund balance to move that
[1:58:07] money in the future if you wanted to
[1:58:10] >> explain very well.
[1:58:12] >> So, uh, can I get a motion?
[1:58:14] >> Well, before you do so, I I just want to
[1:58:16] say something. I I was part of the the
[1:58:18] original council that approved this and
[1:58:23] for some reason it wasn't I don't know
[1:58:25] what the reason is. Um, it it it wasn't
[1:58:28] enacted upon and that we're back here
[1:58:30] again voting on this. So Melanie based
[1:58:32] on this this is executable that we don't
[1:58:34] have to come back again that's a
[1:58:36] clarifying question
[1:58:40] >> once taipar
[1:58:41] >> once the party agrees
[1:58:43] >> correct correct I think the issue last
[1:58:45] time it was a three-party agreement and
[1:58:48] the county never executed it
[1:58:49] >> all right okay thank you sorry may I
[1:58:51] just wanted to clarify that
[1:58:53] >> all right
[1:58:54] >> uh one thing I probably should have said
[1:58:55] is the um the funds aren't due to taipar
[1:58:59] until after the line is in the ground
[1:59:01] and fully operational and approved by
[1:59:03] the county. Um, so there the asset will
[1:59:07] be in place before any funds are given
[1:59:11] over to uh the developer.
[1:59:14] >> Well, maybe I shouldn't ask this
[1:59:15] question, but did the county pay it into
[1:59:18] or do we know or do we
[1:59:19] >> No,
[1:59:20] >> they did not.
[1:59:21] >> That's why we're making a new agreement
[1:59:24] that does not include the county as the
[1:59:26] old one did.
[1:59:27] >> Gotcha. Well, I was afraid of that, but
[1:59:29] Okay. All right. So, tap. So, they have
[1:59:32] to eat that. Is that basically what's happening there?
[1:59:36] >> All All litigation monitor, too.
[1:59:38] >> Okay. All right. Well, I'm glad to see
[1:59:41] Indian Trail step up and doing what they need to do. Um All
[1:59:44] right. Now, can I get a can I get a
[1:59:47] motion?
[1:59:47] >> I'll make a motion to approve the
[1:59:49] request for you. Oh, I'm sorry, wrong
[1:59:51] one. Make approve make a motion to
[1:59:54] approve the economic development
[1:59:56] incentive agreement as presented by Mr.
[1:59:58] Mlam. All in favor? Unanimous.
[2:00:02] >> I'll make a motion to approve the
[2:00:03] accompanying bud budgets amendments as
[2:00:06] presented.
[2:00:08] >> All in favor? Unanimous.
[2:00:10] >> And then I'll make a motion to approve
[2:00:12] the accompanying journal entry as
[2:00:14] presented.
[2:00:15] >> All in favor? Unanimous.
[2:00:20] Very good. Thank you. Um, this brings us
[2:00:23] up to CRTPO delegate and alternate
[2:00:26] minutes correction. Miss Sims, Mr.
[2:00:28] Mclam.
[2:00:30] >> So, from time to time, uh, when we're
[2:00:32] putting together minutes, we may reverse
[2:00:35] something in the minutes or things like
[2:00:37] that. Um, working with Melanie, if that
[2:00:40] happens, there are general statutes that
[2:00:42] allow us to update those, but you have
[2:00:45] to have clear and concise information to
[2:00:47] be able to do that. Because our minutes
[2:00:50] uh because our meetings are on YouTube,
[2:00:52] we have that information. So, uh, to do
[2:00:55] this, what we're going to do is show a
[2:00:56] very short, it's a minute and 20
[2:00:59] seconds, if that, uh, clip from the
[2:01:02] meeting that this took place at, and
[2:01:04] then we would ask for council to make a
[2:01:06] motion to update the minutes to what
[2:01:09] happened at the meeting. So, this is the short clip of the meeting.
[2:01:14] >> Okay. Next is the uh, CRTPO, Charlotte
[2:01:17] Regional Transportation Planning
[2:01:18] Organization, and um, I need a
[2:01:21] nomination. Uh, I think I know who has
[2:01:24] done a fantastic job with it. And uh,
[2:01:27] who would like to nominate Clarence? Oh.
[2:01:31] >> Huh? Would you?
[2:01:36] » All in favor?
[2:01:38] Unanimous.
[2:01:40] All right. Alternate delegate.
[2:01:44] Clarence, would you like to
[2:01:46] >> like to nominate Mayor Con?
[2:01:49] >> All in favor?
[2:01:51] unanimous.
[2:01:53] >> So, the way that we wrote the minutes
[2:01:55] was that uh the way that the minutes
[2:01:58] were written and approved was that Mayor
[2:02:01] Conn was the primary delegate and
[2:02:05] council member Oscar Brooks was the
[2:02:08] alternate delegate, but as you can see
[2:02:10] through the recording, it was actually
[2:02:12] the exact opposite. So, all we're
[2:02:14] looking for is uh approval to update the
[2:02:18] minutes.
[2:02:21] » I I can make that motion for you if you
[2:02:23] want, mayor.
[2:02:24] >> Sure. Go ahead.
[2:02:25] >> Yeah. I'll make a motion to approve the
[2:02:27] correction of the December 9th, 2025
[2:02:31] meeting reflecting council member Als
[2:02:33] Brooks, Clarence Als Brooks as the
[2:02:36] primary delegate and the mayor, Mr.
[2:02:39] David Cohen as the alternate delegate of
[2:02:43] CRTPO as presented.
[2:02:45] >> Uh, all in favor? Unanimous.
[2:02:48] >> Thank you.
[2:02:52] >> I just want to quickly say that um
[2:02:56] Clarence had been the uh the primary
[2:02:59] delegate for quite some time. Uh, and
[2:03:03] then of course we we did, but
[2:03:07] it it did get put on social media by a
[2:03:12] council person who actually voted for
[2:03:14] it, voted in this and and said that
[2:03:19] um that that was incorrect that he went
[2:03:21] by the minutes even though he knew
[2:03:23] better. So anyway, I'm not going I'm not
[2:03:26] going to divulge in that. It's just kind
[2:03:28] of a sad situation. But let's move on to
[2:03:31] uh new business CRTPO call for projects.
[2:03:36] Mr. Huninger.
[2:03:49] All right. So, um
[2:03:52] uh talk to talk to Adam about this and
[2:03:55] uh try to get a sense of, you know, what
[2:03:57] projects could we submit? uh this fall
[2:04:00] call again uh if you don't recall I
[2:04:03] talked a little bit about this
[2:04:04] previously uh but they you've got a a
[2:04:07] significant amount of money um uh for
[2:04:10] this fall call usually it's only around
[2:04:12] 30 million and there are a little bit
[2:04:14] over 50 uh due to not being not using uh
[2:04:18] some monies uh in the pre previous
[2:04:22] uh iterations. So, um I think it's a
[2:04:25] it's an opportunity to at least um you
[2:04:28] know, at least submit at least one
[2:04:29] project. If we don't do two, we're going
[2:04:31] to I'm going to show you two projects
[2:04:32] tonight, but again, if we can at least
[2:04:35] do one of them, I think would be a good
[2:04:36] idea, uh just because there's
[2:04:38] opportunity there. And I think you're
[2:04:40] going to get a lot of applicants, so
[2:04:41] it's probably going to be a tough um a
[2:04:44] tough application process uh to get
[2:04:46] award funding, but I think we ought to
[2:04:48] take a a shot at it. So, uh, two
[2:04:51] projects tonight like to talk about is
[2:04:53] Chestnut Lane Potter Road intersection
[2:04:55] improvements. That's one of the
[2:04:56] intersections in our, uh, transportation
[2:04:58] master plan and Price Mil Creek
[2:05:02] Greenway.
[2:05:04] All right. So, uh, if you go to your the
[2:05:07] transportation master plan, that
[2:05:08] basically this is the drawing you'll see
[2:05:10] u, uh, in the main body of the document
[2:05:12] and the appendixes. Um, so
[2:05:16] what what the uh suggestions or
[2:05:18] recommendations were was to basically uh
[2:05:21] add uh two right turn lane movements on
[2:05:24] and I'll I'll zoom in here in a minute
[2:05:26] on two legs of the intersections and
[2:05:28] then extend uh left turn lanes on the
[2:05:31] other sections and then basically
[2:05:34] improves all pedestrian uh uh uh safety
[2:05:38] features like the curb ramps, the ped uh
[2:05:41] push buttons
[2:05:43] But right now there's no crosswalks out
[2:05:45] there right now. There's it's all the
[2:05:46] striping is kind of gone. Um and so and
[2:05:50] then add
[2:05:51] a sidewalk that's missing uh at in the
[2:05:54] Stalin section.
[2:05:57] So if you look at it, uh so it would be
[2:06:00] this right turn lane would be a brand
[2:06:01] new lane. Right now it's a straight
[2:06:03] right combo. you would build a brand new
[2:06:06] right turn lane uh coming up from the
[2:06:09] neighborhoods on the east side or west
[2:06:11] side of the town going to eastly
[2:06:14] um you would add a right turn lane right
[2:06:16] now that's a straight right and then you
[2:06:18] would extend the left turn lane along
[2:06:20] Potter going north
[2:06:23] um and then the left turn lane
[2:06:26] uh I believe I didn't highlight it but I
[2:06:29] believe that's on Potter going south you
[2:06:31] would extend that left turn lane a
[2:06:32] little bit as well
[2:06:34] uh And then again do improvements. Um
[2:06:37] refle reflectivity markings. Uh all
[2:06:41] these curb ramps need to be updated. Uh
[2:06:44] and then add that go if you go back to
[2:06:46] the other drawing. This section of
[2:06:48] sidewalk here is is not there on the uh
[2:06:52] this is the Indian parcel but it's
[2:06:54] basically Stalin's uh you know
[2:06:56] subdivisions that need to be connected
[2:06:57] back to this intersection. Um, so I we
[2:07:01] pic I picked this one or suggested this
[2:07:03] to Adam because uh we're going to come
[2:07:05] to y y'all in September with pro with
[2:07:09] suggestion to do a joint venture with
[2:07:11] Stalins's to uh connect the sidewalk on
[2:07:14] Chestnut on the west side of town uh
[2:07:18] where the new subdivision have been
[2:07:20] built uh west of Kenwood South if y'all
[2:07:22] know that area. there's uh missing
[2:07:24] sidewalk connections and they would like
[2:07:27] the uh us to partner with them that you
[2:07:29] know Chestnut Lane in that area is a
[2:07:32] mixed bag of Stalins and Indian parcels.
[2:07:36] So would like to extend that sidewalk
[2:07:38] all the way to Weddington Road. Is that correct? Weddington Road. Yeah.
[2:07:43] So, I think if we're going to do that,
[2:07:46] if y'all decide to do that, then I think
[2:07:48] it's a good idea to go ahead and get
[2:07:49] this started in the process. Again,
[2:07:53] you're talking about if we would get
[2:07:56] approved in 2026, we wouldn't be able to
[2:07:58] do design till 2029. So, it would be a
[2:08:03] long ways away. Um, but again, you would
[2:08:06] be able to at least start the process of
[2:08:08] getting this updated. So I thought just
[2:08:11] be being that it's not um uh moneywise
[2:08:15] it's a few million
[2:08:19] because just those turn lanes that's
[2:08:21] pretty much what's you're eating the
[2:08:22] money. Uh but if we can get a 8020 split
[2:08:25] it would be a little over half million
[2:08:26] to the town to be to spend. Again, you
[2:08:29] would have several years from 29 all the
[2:08:32] way to 2031
[2:08:36] u to uh spend out that money and then
[2:08:38] get reimbursement for it. So
[2:08:41] anyway, and then the next one is Price
[2:08:44] Mil Creek Greenway. U this this project
[2:08:47] is actually in the priorit
[2:08:49] prioritization 8. U that's a process of
[2:08:52] trying to get projects into the step.
[2:08:55] And so they've um they've started that
[2:08:57] process. Right now it has been ranked.
[2:09:00] It is not ranked very well. Uh we do
[2:09:02] have two projects uh in the pedestrian
[2:09:05] what they call it non-highway group.
[2:09:08] It's this project and our sidewalk
[2:09:09] connections project. And if you don't if
[2:09:11] you don't recall that that's all our gap
[2:09:13] connections. We have like eight to nine
[2:09:16] streets that we combined all together.
[2:09:19] that actually got ranked high out of 40
[2:09:22] non-highway projects in P8. Uh that is
[2:09:26] number seven. So I feel like that's got
[2:09:28] a a great shot of getting to the step.
[2:09:31] So um I wouldn't mess with that right
[2:09:34] now, but Price Mill is in the middle of
[2:09:36] the road, lower half. It's just it's
[2:09:38] been sitting there, Lord knows since me
[2:09:41] and Adam been here. Um and so it's just
[2:09:43] never going to get funded through that
[2:09:45] process.
[2:09:46] I think it's an ideal candidate greenway
[2:09:49] wise because again road is coming. I
[2:09:51] know some people don't think that but it
[2:09:53] is coming and you're going to have a
[2:09:55] 10ft multi-use path on that side road
[2:09:57] that this greenway will connect to. And
[2:09:59] as you can see it's going to connect you
[2:10:02] know six subdivisions um u well six
[2:10:07] subdivision have opportunities to get to
[2:10:09] that greenway. Some of them going to
[2:10:10] have to walk a little longer than
[2:10:11] others, but it it's to me going to get
[2:10:14] used more probably most more than most
[2:10:16] greenways we've got planned in the
[2:10:17] future. Um, and again, we've got
[2:10:21] uh it's one one and a half miles and if
[2:10:23] you look at the drawn county parcels, we
[2:10:27] already own about 80% of the property
[2:10:29] already that we don't even have to pay
[2:10:30] for. Um, so that's a savings in itself.
[2:10:34] Uh, we don't have to go back and buy
[2:10:36] that permanent easement from these
[2:10:38] folks. we would just have to deal with
[2:10:40] heritage subdivision which I think they
[2:10:42] would welcome uh that connection. Um and
[2:10:47] then we se several parcels right there
[2:10:49] uh along road where we have already part
[2:10:52] property.
[2:10:54] So again uh think it's a ideal candidate
[2:10:57] uh to move forward with if you would
[2:10:59] like. Um this is a big number because we
[2:11:03] use DO's estimating tool. Uh, so I
[2:11:07] haven't really had chance to really
[2:11:08] break down the cost. I don't think it's
[2:11:11] going to cost $4.7 million, but again,
[2:11:14] that's what the the the program spit
[2:11:17] out. Um, so that would obviously at 8020
[2:11:21] split that would be a million dollars
[2:11:23] we'd be on the hook for, which again, I
[2:11:25] don't think it's going to cost that much
[2:11:26] to build. Um, if we act sooner rather
[2:11:31] than later.
[2:11:32] and I'll be happy to ask answer any
[2:11:34] questions about those two projects.
[2:11:37] >> Do you recommend you act a little
[2:11:39] hesitant about doing both projects?
[2:11:42] >> No, I just um No, I don't have a
[2:11:44] hesitency, but uh I mean I I wanted to
[2:11:46] be transparent the fact that you know
[2:11:48] there's there's only three intersections
[2:11:50] we have in a master plan. We we already
[2:11:52] got one starting like we're going to
[2:11:53] start doing design for Stinson Hardest
[2:11:55] Yroview.
[2:11:58] So there's only two left. It's that one
[2:12:00] and Fate Church in Unionville. Faith
[2:12:01] Church is pretty high costwise.
[2:12:04] Um, but I picked again picked this one
[2:12:07] because
[2:12:08] I would think not, you know, I'm not
[2:12:11] making a decision for y'all, but I would
[2:12:12] think the partnership with Stalins to do
[2:12:13] that sidewalk connection is probably a
[2:12:15] good project to to move forward with.
[2:12:17] And if you're going to do that, then,
[2:12:19] you know, why not try to improve this
[2:12:20] intersection? It's it doesn't fail right
[2:12:23] now. It's fine right now, but we we do
[2:12:26] forecast the 2050. it will fail in 2050
[2:12:29] and that's crash ratio data and
[2:12:32] everything. It's going to fail. Um you
[2:12:35] have about 25 crashes a year at the
[2:12:37] intersection. We did look at, you know,
[2:12:41] uh redoing the intersection to a
[2:12:42] roundabout to an RCI intersection. It
[2:12:45] just it doesn't work because Potter has
[2:12:47] more um more volume and it's only a
[2:12:50] two-lane road um than Chestnut does. So
[2:12:54] that that
[2:12:56] uh misbalance with the traffic uh is not
[2:12:59] acceptable those types and roundabout
[2:13:01] wouldn't would fail in 2050. So you
[2:13:03] don't want to build a roundabout.
[2:13:05] >> So this is a cheaper option is build
[2:13:07] some turn lanes and and do some
[2:13:09] pedestrian improvements.
[2:13:11] >> So our recommend I mean like the
[2:13:13] recommendation from myself and the team
[2:13:16] would be to go after both projects.
[2:13:18] >> Okay.
[2:13:19] >> Yeah. I think that that speaks volumes.
[2:13:21] And if you don't have any questions or
[2:13:24] Clarence
[2:13:26] >> question um and did I understand you say
[2:13:30] uh Stalins is submitting the project
[2:13:33] also as a joint.
[2:13:34] >> No no this is Stalins um
[2:13:38] uh went to their board uh to see if they
[2:13:40] would be willing to fund it now without
[2:13:42] any help. So, they have agreed to do
[2:13:46] that and so we'll be coming to y'all to
[2:13:48] actually build a project without any
[2:13:50] help from any uh funding sources.
[2:13:52] >> That's a completely different project
[2:13:54] than the ones that we're talking about
[2:13:55] right now. These are two projects. We
[2:13:58] will come at the next council meeting
[2:14:00] with another project that is uh solely
[2:14:03] sidewalk connections and a
[2:14:07] bridge uh over the creek down there at
[2:14:11] the low point on um Chestnut. Yeah, it's a it's technically a low priority
[2:14:17] project for us in our ped plan, but
[2:14:19] since Stalins is willing to spend money
[2:14:22] to do it, to me, I think that, you know,
[2:14:25] that helps assist us in saying that, you
[2:14:27] know, uh we maybe should we should look
[2:14:30] at moving forward, you know, sooner
[2:14:31] rather than later since we are getting
[2:14:33] help with it.
[2:14:34] >> Okay, good.
[2:14:36] >> But tonight, we would need a motion to
[2:14:38] go to put both of these projects in for
[2:14:42] the fall call. Can I get a motion?
[2:14:44] >> Yeah.
[2:14:46] >> I'll make a motion to submit both of the
[2:14:49] projects presented by Mr. Huninger for
[2:14:52] the fall call for projects with CRTPO.
[2:14:56] >> All in favor unanimous.
[2:14:59] >> Thank you.
[2:15:00] >> All right. Thank you, Mayor.
[2:15:01] >> Thank you, Todd. All right. That brings
[2:15:03] us up to uh CRTPO update. I'll do on
[2:15:07] time. Sure. Also, Brooks, we're we're
[2:15:09] getting down to the nitty-gritty.
[2:15:14] You tell me to take my time.
[2:15:16] >> No, no, but no. We're We're telling you
[2:15:17] we're doing good on time. Don't mess it
[2:15:19] up.
[2:15:22] » Well, thank you, Mr. Also Brooks. Um,
[2:15:25] >> that was good.
[2:15:26] >> Councilman McIntyre would say Also
[2:15:28] Brooks. Clarence also Brooks.
[2:15:30] All right.
[2:15:34] Ready? All right. So, kind of catch up
[2:15:37] what's going on here on Monday, May
[2:15:40] 11th. The city of Charlotte voted six to
[2:15:43] five to resend the support for the
[2:15:45] current I77 South Express lanes.
[2:15:49] From what I was told, it was kind of a
[2:15:51] spare of the moment thing that they
[2:15:53] didn't really know what was going to
[2:15:54] happen. They had one council member that
[2:15:56] wasn't really sure which way they were
[2:15:58] going to lean, but the final result was
[2:16:00] a six to five. So, with that said, at
[2:16:04] the May CRTPO meeting, the mayor of
[2:16:06] Matthews made a motion for CRTPO's board
[2:16:08] to vote to follow Charlotte's footsteps
[2:16:11] and receing its support for the I77
[2:16:13] South Lane project. Um, now this item
[2:16:17] wasn't on our agenda for the main
[2:16:19] meeting, so it needed a uh supermajority
[2:16:22] to pass. With that said, Charlotte, we
[2:16:25] have a weighted vote and Charlotte
[2:16:27] carries 40 votes. The motion pass with
[2:16:29] the supermajority.
[2:16:33] Are you advanced? Okay, there you go.
[2:16:35] Thank you. So, no, go ahead. You're
[2:16:39] doing a good job. Um, so after the uh
[2:16:44] that vote was cast to resend support,
[2:16:47] then soon after that, Senator Vicky
[2:16:49] Sawya proposed language for bill Senate
[2:16:51] Bill 257. The language discussed that a
[2:16:55] reimbursement rule that would require
[2:16:57] the municipalities of the no that voted
[2:16:59] to resend it support for the I77 South
[2:17:02] Express lanes to be responsible repay NC
[2:17:05] DOT back between 6064 million for the
[2:17:09] primary the preliminary cost and I'm
[2:17:12] happy to say that Indian Trail was not
[2:17:15] part of that. Um, you know, we were not
[2:17:18] one of those municipalities. And with
[2:17:21] that said, I cast a vote that we did not
[2:17:25] rece
[2:17:30] on the agenda. I didn't have time to
[2:17:31] come back to the council to discuss
[2:17:33] anything. Um, so that was my decision at
[2:17:37] the time.
[2:17:38] >> Can I interrupt you for just one second?
[2:17:39] >> Yes, sir. I want to interrupt you and
[2:17:41] just say before you did that is Clarence
[2:17:44] did not vote with a majority, the super
[2:17:47] majority. He he voted against the super
[2:17:49] majority. Therefore, Indian Trail did
[2:17:53] not owe millions of dollars uh to
[2:17:58] for what what this is all about. And I'm
[2:18:00] just just saying that kudos to our CRTBO
[2:18:06] rep who I know
[2:18:09] Monrose
[2:18:11] got got caught up in all that and knows
[2:18:13] a couple of million dollar or they don't
[2:18:15] act could owe a couple of million
[2:18:17] dollars along with other towns. And I
[2:18:20] just just wanted it to be known that you did the right thing that you
[2:18:24] didn't join you didn't join the super
[2:18:26] majority. you didn't you didn't uh vote
[2:18:30] for an item that wasn't on the agenda
[2:18:32] that they put on the agenda and rush
[2:18:34] through and I'm just going to say good
[2:18:36] job and go on.
[2:18:37] >> Thank you. So, if we broke it down, uh
[2:18:40] what NC do is saying is they spend about
[2:18:43] $60 million to this point uh you know on
[2:18:45] this project and um excuse me and since
[2:18:50] we have a weighted vote, Indian Trail is
[2:18:52] at two votes. Uh we that's based on
[2:18:56] population. Indian Trail is at about
[2:18:58] 45,000 in population. Once Indian Trail
[2:19:01] hits 50,000 then we will receive another
[2:19:03] vote or unless something changes and
[2:19:05] then we have three votes. So what they
[2:19:07] did is they broke it down uh the 40
[2:19:10] votes of Charlotte was you know how much
[2:19:12] they would pay and then each other
[2:19:14] municipality that voted against it how
[2:19:16] much they would pay based on their vote
[2:19:18] which is based on the population. So
[2:19:22] with that said, at the July CRTPO
[2:19:24] meeting, a few municipality reps hinted
[2:19:27] that after having some discussion with
[2:19:29] their boards, they might have second
[2:19:31] thoughts about voting to resend. Um, so
[2:19:35] the motion, it was asked, the motion
[2:19:37] failed at that time, but we were advised
[2:19:40] that the money was still in step and
[2:19:42] that we could cast another vote at the
[2:19:45] September meeting. So with that said, um
[2:19:49] I want you to come back, present it to
[2:19:52] our two board members that are here now
[2:19:55] and uh see if you have any feedback. I
[2:19:57] strongly suggest that we continue the
[2:19:59] same path uh until we have more
[2:20:01] information or more information is
[2:20:02] available because uh NCA DOT was saying
[2:20:06] that they haven't presented um all their
[2:20:09] information yet. So,
[2:20:13] >> so um what whatever path you choose that
[2:20:16] we don't end up owing money is the path
[2:20:18] I said I suggest. Um, having said that,
[2:20:22] I I don't agree with that with a
[2:20:24] punitive measure, but I do think that
[2:20:26] the deliberation that you've, you know,
[2:20:28] you've engaged in has been very well
[2:20:30] serving and and I know the mayor talked
[2:20:33] about, you know, Clarence's um, uh,
[2:20:36] approach to this, but many of you didn't
[2:20:38] know Clarence was not on the town
[2:20:39] council and he was coming to every one
[2:20:42] of those CRTPO meetings because I was a
[2:20:44] representative, I think, at that time.
[2:20:47] And Clarence has taken an a very um he
[2:20:51] he's he's taken this on very seriously
[2:20:54] in that Charlotte as you know has 40
[2:20:56] votes. We have two. So Charlotte always
[2:20:59] the projects kind of this bigger city in
[2:21:02] your you know big banks and other big
[2:21:04] companies there. But in Indian Trail
[2:21:06] Clarence being there at the table
[2:21:07] attending the meetings gives us
[2:21:09] representation that Todd and his team
[2:21:11] can present projects and we can get them
[2:21:13] funded. Right. So that kudos to Clarence
[2:21:16] for really taking this on and being our
[2:21:19] primary delegate to the fact that when I
[2:21:22] was on there, I never got up here and
[2:21:23] speak. So you can see he's elevated sort
[2:21:25] of the representation and what he's
[2:21:27] bringing back to the to the council and
[2:21:29] to the residents. So kudos to you,
[2:21:30] Clarence. But whatever path you choose
[2:21:33] that make sure we don't we don't pay but
[2:21:35] we get money, I'm I'm all right with it.
[2:21:38] >> Thank you.
[2:21:41] >> I second everything he just said. But
[2:21:43] no, honestly, you've you've obviously
[2:21:45] made a good decision whenever you were
[2:21:47] put under the pressure and I I fully
[2:21:50] support what you do.
[2:21:52] >> Thank you. I appreciate that.
[2:21:54] >> Well, again, with that said, um
[2:21:58] I have not done this on my own. I've
[2:22:01] been supported and coached and mentored
[2:22:05] by, you know, various people. I
[2:22:07] appreciate that. The mayor himself, the
[2:22:09] mayor is the alternate. the mayor and I
[2:22:11] actually we still have discussions.
[2:22:13] He'll call me, he gets the agenda, he'll
[2:22:15] call me about things that are going on
[2:22:18] in CRTPO and we have that discussion and
[2:22:21] so I try my best to make sure that I
[2:22:24] don't go up there and say what Clarence
[2:22:26] wants to say. So, um it is something
[2:22:29] that I still continuously have
[2:22:31] conversation and I did sent to the town
[2:22:34] manager an email to send out to all the
[2:22:36] council so that the council could have
[2:22:38] feedback as well. So, all right. No
[2:22:41] other questions or comments?
[2:22:44] All right. Well, we'll keep it going
[2:22:45] then. Thank you.
[2:22:46] >> Hang on. There's one other thing that
[2:22:48] you had asked. Can you pull up that
[2:22:50] picture?
[2:22:51] >> Oh, okay. Actually, I do have a So,
[2:22:55] um, yes, we what we did, we have some
[2:22:59] citizens here, concerned citizens, and
[2:23:01] we got a phone call from a citizen that
[2:23:04] had some questions about their road and
[2:23:07] paving, and uh, thought it was a good
[2:23:08] idea to get Phelix, who's the uh,
[2:23:11] engineer up there from or we got some NC
[2:23:15] DOT uh, reps up there, the mayor, Todd
[2:23:18] Huntinger, town manager, and myself. and
[2:23:21] we asked them to come down so that we
[2:23:22] can um so that they can see the
[2:23:26] conditions of some of the roads in
[2:23:28] Indian trail and put eyes on it to u so
[2:23:30] that we can have a more in-depth
[2:23:33] conversation of the streets and the
[2:23:35] traffic in Indian trail. So, and I also
[2:23:40] I should have started a presentation
[2:23:42] with this, but I would like to do a did
[2:23:45] you know on my presentation and I have a
[2:23:48] question. So, this is more of a question
[2:23:50] cuz I don't know. So, if you know that's
[2:23:52] good or what do you call someone who
[2:23:54] lives in Indian Trail? So,
[2:23:56] >> I call him an Indian trailian.
[2:23:58] >> That's what you call him.
[2:23:59] >> That's what I call him. But I mean, I
[2:24:01] don't know.
[2:24:01] >> I think we need an official. I'm not
[2:24:03] going to tell you what my wife calls me
[2:24:05] sometimes. And it's not necessarily
[2:24:06] Indian trilian, but no, she's I'm
[2:24:09] kidding.
[2:24:09] >> But do you call her?
[2:24:11] >> You know, being born born and raised, we
[2:24:14] never never we we stuck more with
[2:24:17] Spartans. We were we were proud to be
[2:24:18] Sun Valley people. So we we never had
[2:24:22] anything to do as far as Indian trail
[2:24:24] goes. Again, Indian Trail was much
[2:24:26] smaller. It was about all the state
[2:24:28] chumps lived on in Sun Valley.
[2:24:29] >> You got that right. You got that right.
[2:24:31] Um, but no, I I throw that question out
[2:24:34] to the community and I would like if
[2:24:36] anyone has any uh there's people been
[2:24:39] here longer than me, but or if anybody
[2:24:41] has any suggestions, I would like to
[2:24:44] know. So that's the do you know what
[2:24:47] just good people call them that or and just to
[2:24:52] I think we ought to work on a flag for
[2:24:54] Indian Trail. I' I'd like to have our
[2:24:55] own flag, but that's don't we won't get
[2:24:57] in that discussion. Just something to
[2:24:58] think about. We'll call them good people
[2:25:00] that love their council and love to
[2:25:01] support their council. Everything they
[2:25:03] do, that's what we'll call them. Thank
[2:25:05] you. I appreciate it.
[2:25:06] >> Thank you, Clarence.
[2:25:09] >> You're welcome.
[2:25:10] >> All right, this brings us up to the
[2:25:11] manager report.
[2:25:13] >> Mr. Mclam,
[2:25:14] >> I'll be short tonight. Just two things.
[2:25:16] Uh first one is Todd and his team got
[2:25:19] authorization to uh rideaway
[2:25:21] authorization today for
[2:25:24] uh highway 74 mixeduse path and greenway
[2:25:29] from NC do. So we will start moving
[2:25:32] forward on the rightway that we need for
[2:25:33] that project to keep it moving forward.
[2:25:36] Uh and the last one I will we are not
[2:25:39] going to sing but I will say happy
[2:25:41] birthday to Miss Trina. It is her
[2:25:43] birthday today. So
[2:25:46] Well, I'll sing. No, I'm kidding. Just kidding. I wouldn't put
[2:25:51] you through that on your birthday. Thank
[2:25:53] you, Adam. Very, very good. Very good
[2:25:55] job tonight on all all that was
[2:25:58] explained. Brings us to council member
[2:26:00] comments.
[2:26:01] >> Council member McIntyre.
[2:26:02] >> All right, let's go. Let's make it
[2:26:03] quick. Um,
[2:26:06] before I close tonight, I want to
[2:26:08] reflect on something special that
[2:26:09] happened in our community today. Um, we
[2:26:11] had the privilege of unveiling the
[2:26:13] street in honor of Mr. Jerham Sutton.
[2:26:17] Mr. Sutton means a great deal to this
[2:26:18] community and recognizing him reminds us
[2:26:21] of the lasting impact one person can
[2:26:24] have through service to others. I also
[2:26:28] want to thank Miss Bhalik for her
[2:26:30] continued efforts with adopt cot.
[2:26:33] Supporting the men and women who serve
[2:26:34] and protect our community matters and we
[2:26:37] appreciate her commitment. And while
[2:26:39] we're talking about service, I'll say
[2:26:41] this. Public service requires courage.
[2:26:44] Leadership is not about showing up only
[2:26:46] when decisions are easy or the votes are
[2:26:48] comfortable. The people elect us to show
[2:26:51] up, take a position, cast the difficult
[2:26:53] votes, and be accountable to them. When
[2:26:57] the moment gets uncomfortable, that is
[2:26:59] precisely when leadership matters most.
[2:27:02] Avoiding a difficult decision does not
[2:27:04] make the responsibility disappear.
[2:27:07] In that same spirit of responsibility
[2:27:09] and service that's going to carry on
[2:27:12] into our schools as the new year begins.
[2:27:15] My wife and I, one of our sons starts
[2:27:17] his college journey on Thursday. And we
[2:27:20] are incredibly proud of him. Of course,
[2:27:23] there's one small benefit. His room is
[2:27:27] going to officially become my new gym. I
[2:27:30] also wish Mr. Mlam and Miss and Mrs. Cox
[2:27:35] and their families the very best as
[2:27:36] their children begin their college
[2:27:38] journeys as well. To all of our students
[2:27:40] returning to elementary, middle, high
[2:27:42] school, college, I wish you a safe and
[2:27:45] successful year. And to our teachers,
[2:27:47] educators, administrators, school
[2:27:49] resource officers, crossing guards,
[2:27:51] cafeteria workers, coaches, and support
[2:27:53] staff. Thank you. Um my mother worked in
[2:27:56] education for aboutif
[2:28:02] um working in education is more than a
[2:28:04] job. It's a vocation. We know they do
[2:28:06] not pay the teachers and and everybody
[2:28:09] else as much as they should but these
[2:28:11] are very important people within our
[2:28:13] community and we are very grateful for
[2:28:15] the commitment to our children.
[2:28:18] Um,
[2:28:19] I want to thank each and every one of
[2:28:21] you for here tonight for putting up
[2:28:23] profess for listening to the questions
[2:28:24] that I asked and and and you know other
[2:28:30] uh members of of the council asked. Um,
[2:28:32] we don't just ask this question in a
[2:28:34] vacuum. We ask them to really get
[2:28:36] information and to make informed
[2:28:37] decisions because we take this very
[2:28:39] seriously. Staff, I know it's a little
[2:28:41] bit late for you. We do appreciate all
[2:28:43] that you do. Um the good thing is we
[2:28:45] only have one month um one meeting this
[2:28:48] month before we get back to our two
[2:28:49] regular meetings. Mayor, thank you for
[2:28:51] putting up with me. But to each of you
[2:28:53] who serve and who participate, I want to
[2:28:55] say thank you to each of you. You matter
[2:28:56] a lot to the community. It's an honor to
[2:28:59] sit up here and to be able to serve you
[2:29:01] in the best that we can. And with that,
[2:29:03] I say to everybody, have a wonderful
[2:29:05] rest of the summer and have a pleasant
[2:29:07] evening.
[2:29:08] >> Council member Vholik.
[2:29:11] >> All right. Okay. See, I was going to say
[2:29:12] I'm going to take all of Marcus's time,
[2:29:15] but then he talked a lot, so I'm going
[2:29:17] to make mine short, I hope. No. Um, I
[2:29:20] wanted to kind of piggyback a little
[2:29:22] bit. Uh, the unveiling today of was it
[2:29:24] Jerome Sutton Way? Correct. Yeah.
[2:29:26] >> Um, it just felt good. It felt good to
[2:29:28] do something good for someone who meant
[2:29:30] so much. And as the cars drove by and
[2:29:32] people were honking and waving and just
[2:29:34] seeing how it put a smile on his face
[2:29:36] and I looked at him and I said, "How do
[2:29:38] I get my name, you know, up there?" And
[2:29:39] he's like, "It's not for me. for the
[2:29:41] kids and that really truly does someone
[2:29:43] that's humble. It really shows us how
[2:29:46] good the people in Indian Troll are. So,
[2:29:48] I also wanted to mention him. Um I hear
[2:29:51] congratulations are in order for someone
[2:29:54] Alicia. Um so, I wanted to say that. And
[2:29:57] then let's see. I have a whole bunch of
[2:29:59] I'm trying really hard to make this
[2:30:00] shorter. Um summer is always a little
[2:30:03] bit slower with meetings, but
[2:30:06] August starts things back up. So, I have
[2:30:08] a central line meeting tomorrow. um
[2:30:10] going back with the Chamber for Women in
[2:30:12] Business and Leadership Union coming up.
[2:30:14] So hopefully we'll get some ideas to
[2:30:16] bring back for council to maybe use in
[2:30:18] our town. And then I wanted to recognize
[2:30:20] Common Heart as they celebrated their
[2:30:22] 20th anniversary recently. Um I did get
[2:30:24] to go to that ribbon cutting which was
[2:30:26] really fun and it's really nice to see
[2:30:28] someone in our community again making
[2:30:31] such a difference. So um I already said
[2:30:34] thank you to all my adopt people. Again,
[2:30:36] thank you to the sheriff's department
[2:30:37] for keeping us safe. I know y'all are
[2:30:39] busy. Um hopefully I'll get to do a ride
[2:30:41] along soon and see how busy y'all are.
[2:30:43] Um but everybody, thank y'all for coming
[2:30:45] and have a great night.
[2:30:47] >> Council member Also Brooks,
[2:30:50] I want to say thank you to the citizens
[2:30:52] that are here tonight. Um and investing
[2:30:55] in your government, seeing how your
[2:30:56] government runs and being a part of it.
[2:30:59] Say congratulations to Miss Massie and
[2:31:01] Mr. Cobb on their promotions. Um, want
[2:31:04] to say happy birthday to Indian Trail
[2:31:06] Citizen Sherry Hammonds. Uh, this is
[2:31:10] fundraiser season. Crisis Assistance
[2:31:13] Ministries is having a fundraiser going
[2:31:15] on. I ask you to go to their website and
[2:31:17] look and feel free to donate if you feel
[2:31:19] led.
[2:31:21] Um, the Veterans Memorial out there, I
[2:31:25] want you to know that there are
[2:31:26] scholarships. If you know a veteran that
[2:31:28] needs your name out there, uh, and if a
[2:31:30] scholarship is needed, you come talk to
[2:31:32] me, um, or Mr. Patrick Oconor back
[2:31:35] there, Mr. McIntyre, uh, not to single
[2:31:39] you out, but I want to say thank you for
[2:31:41] the questions that you asked this
[2:31:43] evening. Uh, those financial questions
[2:31:45] help me and it helps me learn more
[2:31:47] things that I don't think about. So, I
[2:31:49] greatly appreciate that.
[2:31:51] Um, also to the citizens, I would
[2:31:53] encourage you to also watch the uh,
[2:31:55] planning board meetings. They go into a
[2:31:57] little more depth on the things that you
[2:31:59] hear and because I can see it in your
[2:32:01] faces. Sometimes we're discussing things
[2:32:03] and if it goes over your head or it
[2:32:05] seems like, hey, they're not really
[2:32:06] getting into the meat of things. I
[2:32:08] encourage you to watch the planning
[2:32:09] board meetings as well and they're on
[2:32:11] YouTube. Also, I've always said thank
[2:32:14] you to the employees that work on
[2:32:16] holidays so that we can enjoy whether
[2:32:18] it's Fourth of July parade or whatever.
[2:32:20] We can enjoy things, but forgive me, I
[2:32:23] should be including law enforcement,
[2:32:24] first responders. They're there at the
[2:32:27] parades and things like that so that we
[2:32:29] can um have a good time. And I never say
[2:32:32] thank you to our town attorney who does
[2:32:35] a great job as well. So, with that said,
[2:32:38] I really appreciate seeing everyone here
[2:32:40] tonight. Hope you continue to come. Hope
[2:32:43] you spread the good word in Indian Trail
[2:32:45] and I hope you bring people with us with
[2:32:47] you so they can see how their government
[2:32:49] runs. Have a good night.
[2:32:52] >> Very good.
[2:32:52] >> Mayor Con,
[2:32:54] >> um I'd like to thank Lieutenant North.
[2:32:56] You did a good job tonight. Uh tell Andy
[2:32:59] he better not miss too many more
[2:33:00] meetings. Uh that that you you did a
[2:33:03] great job. Also Jerome Sutton is quite a
[2:33:06] great guy and couldn't happen to a
[2:33:08] better person. and Marcus, thank you for being who you are and uh answer uh
[2:33:15] asking those questions and and the same
[2:33:19] all of you. Um
[2:33:22] you uh you're you're here tonight.
[2:33:24] was a night night we had to
[2:33:26] answer some big questions and make some
[2:33:28] big decisions. And I think what you
[2:33:30] said, Marcus, was was meant a lot. It
[2:33:33] meant a lot. So, thank y'all. Real
[2:33:35] quick, I I meant to do this earlier. I
[2:33:37] didn't. I also wanted to tell you about
[2:33:39] what all I saw at the aquatic center.
[2:33:41] I'm not going to get into that. I'm
[2:33:42] going to save that for next time, but uh
[2:33:44] real quick, mayor's pretty busy this
[2:33:47] week. I think it's important that the public know that that I don't
[2:33:51] sit around do nothing. Uh so, uh I went
[2:33:54] to the co uh copper tapping uh tapping
[2:33:57] table, new restaurant. It's where the uh
[2:34:00] East Coast wings were. Good restaurant.
[2:34:02] Um, they're going to be here the next
[2:34:04] meeting and they're going to present
[2:34:06] something and I'm gonna try to talk them
[2:34:07] into bringing our food.
[2:34:09] >> Stick to stick.
[2:34:11] >> What now?
[2:34:12] >> Stick. I put my order stick.
[2:34:13] >> I put your steak. Okay. No, but but I am
[2:34:15] going to I'm going to try to see if I
[2:34:18] can do that. Uh, attended ABC board me
[2:34:20] uh in meeting and I think we're going to
[2:34:23] get a big check from pretty soon. I
[2:34:25] think that's really good. Uh, also
[2:34:27] attended the Crimestoppers lunch
[2:34:29] meeting. Crimestoppers will be here in
[2:34:31] September uh for uh the meeting in
[2:34:35] Indian Trail. It's never been in Indian
[2:34:36] Trail. It's going to be here and I'm
[2:34:39] very proud of that. So, uh I'm glad it's
[2:34:41] coming. We had Facebook Live, a great
[2:34:43] meeting with the the Legion Post. We we
[2:34:47] talked to some good people there. Uh we
[2:34:50] had uh I I spoke at a um something
[2:34:53] called the convention estates at the um
[2:34:57] uh Golden Corral on sat a couple of
[2:34:59] Saturdays ago. I was the guest speaker
[2:35:01] and I enjoyed it. It was it was a lot of
[2:35:04] fun. Uh coffee with the mayor this last
[2:35:06] time was at the VFW. Some of you were
[2:35:08] here were there. Uh I see in this room
[2:35:10] were there. Uh it was great. Uh we had a
[2:35:13] big crowd there. Uh may the mayor cooked
[2:35:16] hamburgers and hot dogs and had good
[2:35:18] stuff. And um before I forget to say
[2:35:20] this, I I I'm not taking credit for all
[2:35:23] this because staff helps me out a lot
[2:35:25] with all this stuff. Staff staff is uh
[2:35:28] behind the mayor 100%. We had some great
[2:35:31] questions. Uh and they got some answers.
[2:35:34] Uh went to Kimberly's place, moved to
[2:35:36] Monroe. I don't know if anybody knew
[2:35:37] that. Kimberly's Place used to uh be
[2:35:40] right here in town. They've got a nice
[2:35:41] place that they bought up in uh Monroe.
[2:35:43] very nice. Went up there and visited
[2:35:45] them. Uh we did a uh a ride with the
[2:35:49] with DOT Clarence and I and you saw
[2:35:51] everybody that was in that picture.
[2:35:53] Uh rode through some neighborhoods and
[2:35:56] Wesley Chapel Road. Uh something I don't
[2:35:59] have on here and I wanted to say this. I
[2:36:01] got a call from a resident the other day
[2:36:04] uh that was uh that actually complained
[2:36:06] about u uh rightfully so complained
[2:36:10] about Wesley Chapel Road. And uh I
[2:36:12] called DOT and um they said they'd try
[2:36:16] to help us out. They actually uh said we
[2:36:20] need to put some long they called them
[2:36:22] long patches and within two days they
[2:36:24] had two long patches on Wesley two or
[2:36:27] three long patches on Wesley Chapel
[2:36:29] Road. And uh that I thought that was
[2:36:31] Have you seen them out there Clarence?
[2:36:33] Which is it's amazing uh that that it happened that fast. Um, uh, met
[2:36:38] with the senior group downstairs, went
[2:36:40] to the aquatic center, met met with 316
[2:36:43] sports with, uh, John Sprinkle, uh,
[2:36:46] Ronnie Bowers and Jeff and Seth
[2:36:48] Sullivan, a Christian uh, sports here in
[2:36:51] town with First, it's not First Baptist
[2:36:54] Church anymore. It is
[2:36:55] >> Church of Indian Trail.
[2:36:56] Uh, we had
[2:36:58] breakfast with the sheriff, ate with a
[2:37:00] Andy and the chief, and Adam and myself
[2:37:04] about every month and a half. Uh Adam
[2:37:07] and I visited the uh residence that got
[2:37:11] flooded. Their yard got flooded and uh
[2:37:13] Adam being the man he is um is going to
[2:37:16] try to work with them. I don't think
[2:37:18] it's Indian Trail's fault at all. They had bought a house in a in a flood
[2:37:22] zone. But it's just just who we are and
[2:37:25] it's just who you are, Adam. And it's
[2:37:27] just just what I'm so proud to work with
[2:37:29] the town that we're going to help them
[2:37:30] anyway or do our best to help them
[2:37:32] anyway. um stopped by Moore Park. Uh and
[2:37:36] uh I'd say Jim's left. I saw Jim and I
[2:37:39] saw multiple people for the water line
[2:37:41] there. There's y'all having some some uh
[2:37:45] bumps in the road over there putting
[2:37:47] that water line in. So, uh but anyway, I
[2:37:50] think it's getting straightened out. Um
[2:37:53] met with a couple cha Chaseep on some
[2:37:56] future projects. Uh went to back to
[2:37:59] school bash on Saturday. Uh, man, I
[2:38:02] enjoyed that. Giving away uh uh some
[2:38:05] bags and school supplies to children and
[2:38:08] uh we had some good food and it was just
[2:38:10] a great time. Uh went and worked with
[2:38:13] the Deerstein neighborhood. I uh Miss
[2:38:16] Moore was here tonight uh and uh went
[2:38:20] worked with them. But without all that
[2:38:22] being said, that the mayor gets pushed
[2:38:26] by the and helped by the staff and
[2:38:28] staff. Thank you so much, Adam. you're
[2:38:30] great to work with and council. I
