[3:40] Mr. Schills, thank you for being here.
[3:43] Please state your name and organization.
[3:45] >> Thank you, Charles William Shiells with University health.
[3:54] I'm here in support of the special obligation bonds
[3:56] to revitalize the Lakewood campus.
[3:59] You all have heard the presentation a couple of weeks
[4:02] ago.
[4:03] And we appreciate the executive voting and legislation
[4:10] moving forward on this.
[4:11] We think this is a unique opportunity
[4:12] to revitalize what is a valuable county asset that provides
[4:17] health services, particularly to the underserved of Jackson
[4:22] County.
[4:22] It is a unique.
[4:23] We are the only safety net hospital in Missouri
[4:26] that is supported by County.
[4:28] We serve 130,000 patients, many of them are the Lakewood campus.
[4:34] These plans will move this forward and some of the county
[4:37] will be proud of and the patients can
[4:39] receive extraordinary services.
[4:40] The short version is it replaces buildings
[4:43] that were built in 1908, 1928 with new modernized facilities.
[4:47] It also makes an investment in others
[4:51] in the county and the ability to deliver primary care.
[4:54] We appreciate the leadership of the County executive.
[4:56] We appreciate you moving forward on this.
[4:58] This will be a legacy issue for this executive County
[5:03] legislature.
[5:04] We appreciate your support.
[5:06] >> Thank you so much.
[5:08] Do we have any questions from the legislature?
[5:15] >> Madam Chair, I just want to say that on the record that over
[5:18] my past two terms here, this has been an issue,
[5:21] something we have been needing to get done even before I came
[5:24] on eight years ago.
[5:25] And so I just want to make it clear --
[5:28] crystal clear that my support for this is unwavering.
[5:30] And I will urge my colleagues to support this plan
[5:33] that is being proposed by the County Executive
[5:35] and that we finish the job on an area that
[5:40] has served so many of our constituents
[5:42] over the past how many years now?
[5:46] 100 and what?
[5:48] >> Going back to 1851.
[5:51] >> Just a short time.
[5:53] Anyway, this has my full and complete support.
[5:55] >> Thank you so much.
[5:58] Since there is no other testimony,
[6:00] the public hearing is now closed.
[6:12] We want to make sure that our county clerk has this exhibit.
[6:16] Thank you so much.
[6:20] Now we will have -- as a matter of fact, madam clerk,
[6:26] could you please read 22367?
[6:31] >> Authorizing the County executive to take necessary
[6:33] preliminary steps to facilitate the issuance of special
[6:36] obligation bonds for improvements to university
[6:38] health facilities and services.
[6:39] Legislature as a whole.
[6:42] >> I know this is a bit of an order,
[6:44] but is there any discussion?
[6:46] >> I'll move to adopt.
[6:49] >> My second.
[6:50] >> It has been moved and seconded.
[6:52] Any discussion?
[6:55] Hearing none madam clerk , please call the roll.
[7:01] >>
[7:02] [members voting]
[7:15] Five yes, three absent, one excused.
[7:19] >> Thank you so much to the legislature.
[7:22] I applaud you for taking this action today.
[7:27] We will hear from our county executive.
[7:30] >> Madam chairwoman, members of the legislature,
[7:34] the annual audit compiled every year has been completed.
[7:39] It dealt with fiscal year ending December 31st, 2025.
[7:42] I have given all of you a copy of this last week.
[7:48] Next legislative meeting, next Monday, we
[7:52] will have the auditor here in person
[7:54] if you have any questions.
[7:55] As you understand, within 30 days of being presented
[7:59] with the audit, the independent auditor
[8:01] shall be present to be able to take any questions from you.
[8:05] That'll be August 17th.
[8:07] After that the legislature votes to accept
[8:09] the county's financial statements for public record.
[8:12] Then it can be released to that --
[8:16] the annual comprehensive audit report is available after that
[8:20] vote.
[8:20] As you are reading over the next week,
[8:23] there were two specific issues that they brought up.
[8:27] One was the opioid issue.
[8:31] We have an opioid settlement with the county.
[8:35] We receive several millions of dollars every year.
[8:38] And in the past, they have not accounted
[8:43] for the future opioid payments coming to the county.
[8:47] So the auditor said that's something
[8:49] that ought to be dealt with because we weren't sure what
[8:51] was coming in and we do know.
[8:53] We should know.
[8:54] And last year it was not compiled.
[8:56] We are on top of that now.
[8:58] The other one is that they found some informational services,
[9:02] some servers that have outlasted their usage is
[9:06] one of the issues of their findings.
[9:09] But the rest of it is in this report that you have a copy of.
[9:12] Next week the auditor will be here
[9:14] to take any of your questions.
[9:15] And that is all I have.
[9:16] >> Thank you.
[9:17] Do we have any questions for the County executive?
[9:22] I do want to ask one question.
[9:25] That is in regard to our senior tax Levy.
[9:27] I know that lowered is in place.
[9:30] They are working diligently.
[9:31] Can you give us an update on that?
[9:34] >> As you know and for people that are watching and Listening,
[9:38] the senior tax Levy that this party was part
[9:45] of the partnership that got it together, the board is empty.
[9:50] It had several millions of dollars in empty.
[9:52] We got the board appointed.
[9:54] I think in the springtime.
[9:57] They are working now.
[9:57] I have a meeting with them to talk to them
[9:59] in the next couple of weeks.
[10:01] But they have a plan.
[10:02] And I would like to ask them to come to the legislature
[10:04] and say here is a plan.
[10:05] I'll be quite honest with you.
[10:06] When I pointed to members of the board,
[10:08] I told them I want you to spend some money.
[10:10] I want you to spend that money you've
[10:12] got in the bank for seniors, the people of Jackson County
[10:14] have been taxed on to get it out there.
[10:16] And they all said you bet.
[10:18] And so they have a plan.
[10:19] They have a formula.
[10:21] If it is okay with this body, I would
[10:22] like to have them come and say here
[10:23] is our plan for the next 3 or 4 years of spending.
[10:25] I say spending tax money.
[10:28] I mean giving to the seniors that need that service.
[10:31] But I would like to ask if I could
[10:33] bring the board or at least the board chair
[10:35] in front of the legislature and make that.
[10:37] >> Sure we look forward to that.
[10:39] I certainly welcome that.
[10:42] >> Clarification.
[10:44] So could we make sure that our legislative auditor has met with
[10:51] and understands how the board feels like they're
[10:55] going to proceed with the distribution of funds, selection
[10:57] of who is going to be awarded funds?
[11:01] We have some rules we have to comply with.
[11:04] And being a new board, I don't want
[11:07] to get them started on the wrong track.
[11:09] >> That's a very good point because the board thinks they
[11:12] can spend dollars on good programs.
[11:13] But there was a compliance issue and stuff goes.
[11:16] I will get Mr. Thomas on board with them.
[11:19] And he can review the proposal and their plan.
[11:22] >> Thank you.
[11:22] >> Thank you so much.
[11:25] Perfection is proposed ordinances and reports
[11:28] of committee ordinance 6050.
[11:32] >> Private and law enforcement officers from concealing
[11:34] their faces or badges during the performance of duties
[11:36] and establishing penalties and exemptions,
[11:38] legislature as a whole.
[11:40] >> Move to adopt.
[11:43] >> Second.
[11:44] >> It has been moved and seconded to adopt.
[11:47] >> Sorry, moved to perfect.
[11:50] >> It has been moved to perfect and sent to the.
[11:52] I would like to hear from our county council in regard
[11:55] to this matter.
[11:58] >> Thank you Madam Chair.
[12:01] This refers back to the anti masking
[12:03] ordinance that was proposed back in January of this year.
[12:06] The counselor's office previously
[12:08] had sent an opinion over.
[12:10] And without reading it entirely, it goes to the fact
[12:14] that the supremacy clause would supercede the issue
[12:23] for the federal law that applies for this matter
[12:27] on federal agents.
[12:40] US vs State of California came out recently --
[12:48] prevent officers from performing their functions.
[12:52] The plan is in motion for injunction pending appeal.
[12:55] The federal government won that case.
[12:58] And they supported the injunction
[13:00] so it could not go into place against the federal officers.
[13:04] That continuously happened in Virginia.
[13:06] There was cases from New York and the city of Philadelphia
[13:12] and the city of Los Angeles.
[13:14] They consistently said the supremacy Clause
[13:16] would take effect.
[13:18] And therefore, for that and the opinion you previously wrote,
[13:22] we believe it should be unsigned,
[13:24] and we will be subject to liability
[13:27] if we were to enact that ordinance.
[13:32] >> Thank you so much.
[13:33] Any questions?
[13:35] >> Madam chair thank you Madam Chair.
[13:39] I will just say that the amount of attacks
[13:44] and personal challenges that this has given and specifically
[13:48] to the Latino community is something
[13:52] that should frighten all of us.
[13:54] I understand what the County Councilor just said
[13:58] and I respect that opinion.
[14:00] The reason why I'll be voting yes Is because of the way
[14:08] the federal government has been using this
[14:11] as a tactic to bring fear to communities
[14:12] that have done nothing wrong.
[14:14] And until this United States starts to understand that no one
[14:17] is illegal, a person cannot be illegal,
[14:20] we will have to face whatever comes down from the federal
[14:23] government and from these courts.
[14:25] But my heart and soul Are with those
[14:32] who face there terrible times, especially
[14:35] the young children who are just trying
[14:37] to make their way in this life.
[14:39] But that is I wanted to give my reasoning why I'll
[14:43] be voting yes, madam chair.
[14:45] >> Thank you so much.
[14:47] Any other comments?
[14:49] >> I would like to say that I totally understand the supremacy
[14:54] clause.
[14:54] I totally understand that people's rights, however,
[14:58] are being violated.
[14:59] And I also understand that I am in a position where
[15:02] I am responsible to look at the finances for the County.
[15:10] If we pass this, we will be setting ourselves up for --
[15:15] I can't even estimate how many fees
[15:18] we would have to pay and attorney fees
[15:20] and what have you when a precedent has been
[15:24] set for the Supremacy Clause.
[15:27] I am stating here because this is what I believe.
[15:31] I believe it is wrong for people to be
[15:35] accosted by members of law enforcement
[15:38] that do not show their face.
[15:40] That do not wear their badges.
[15:43] But I am also a public servant.
[15:45] And I must serve the county to the best of my ability.
[15:49] Madam clerk, would you please call the roll?
[15:55] [members voting]
[15:56] >> Just to clarify, madam chair, this is ordinance 6050?
[16:03] >> Correct.
[16:04] >> My vote on the ordinance is no.
[16:09] [members voting]
[16:32] >> 2 yes, 3 no, 2 abstaining, 1 absent, 1 excused.
[16:46] >> Ordinance 6077.

[17:00] residential facilities with a severability clause,
[17:02] the legislature as a whole.
[17:13] >> From Committee?
[17:16] We will hold 6077.
[17:21] Ordinance 6091.
[17:23] >> Submitting to the qualified voters of Jackson County
[17:27] a general election to be heldNovember 3, 2026,
[17:30] a authorizing Jackson County to impose a countywide sales tax
[17:32] of one half one percent for public transportation purposes.
[17:38] Legislature as a whole.
[17:40] >> I will move to perfect.
[17:42] >> Is there a second?
[17:43] >> I second.
[17:44] >> Is there discussion?
[17:52] >> One quick procedural question,
[17:53] did we do a public hearing on this and we were --
[18:04] were we required to?
[18:06] >> I don't know.
[18:07] I'd have to ask the attorneys.
[18:10] >> I don't recall there being a public hearing.
[18:15] >> I don't believe there was.
[18:16] We also haven't signed it because there is
[18:18] no statute applicable to this.
[18:19] And that is what we testified to last week.
[18:22] Shared that before, I think, as being recommended.
[18:49] >> Any other discussion?
[18:52] Madam Clerk?
[18:53] >> On the motion to perfect, Anderson.
[18:59] >> No.
[19:00] >> Smith.
[19:01] >> No.
[19:03] >> Abarca.
[19:06] Huskey.
[19:07] >> No.
[19:08] >> Franklin.
[19:11] >> No.
[19:12] >> Lauer.
[19:13] Smith, Peyton.
[19:15] >> No.
[19:16] >> 7 no, 1 absent, 1 excused.
[19:22] >> Ordinance 6097.
[19:30] >>establishing the position of Legislative Intern
[19:32] within Office of the Jackson County Legislature
[19:32] and setting forth governing the appointment, supervision,
[19:34] and employment of Legislative Interns.
[19:38] legislature as a whole.
[19:41] >> Madam chair?
[19:42] I am working on a substitute for this.
[19:45] So if the body is okay with it and you're okay with it,
[19:48] I would like to hold.
[19:50] >> We will hold.
[19:51] Ordinance 6105.
[19:58] >> repealing sections 1030. and 1040. of the County Code, 1984,

[20:44] >> I will second.
[20:45] >> All those in favor of perfection?
[20:50] [members voting]
[20:51] >> Do we need a roll call?
[20:52] >> No, just for the adoption.
[20:54] Is there a motion to adopt?
[20:57] >> I second.
[20:59] >> Yes, but do we want to adopt?
[21:02] >> Do we have enough here?
[21:04] >> A motion to adopt.
[21:06] Is there a second?

[23:34] [members voting]
[23:40] 7 yes, 1 excuse, one absent.
[23:54] >> Resolutions in Committee?
[23:55] Resolution 22323, we have voted on.
[24:02] No.
[24:04] >> Directing the County Executive,
[24:05] the Department of Public Works, and all appropriate County
[24:05] departments and agencies to develop and implement
[24:05] a comprehensive framework governing the siting,
[24:05] construction, expansion, and operation of artificial
[24:05] intelligence and high-capacity data center facilities within
[24:05] Jackson County, Missouri, and establishing conditions
[24:05] necessary to protect public infrastructure, utility systems,
[24:05] environmental resources, public safety,
[24:07] and neighboring communities.
[24:28] legislature as a whole.
[24:31] >> Will be holding this.
[24:32] Resolution 22355.
[24:38] >>authorizing the County Executive to execute Memorandum
[24:41] of Understanding with the Kansas City,
[24:41] Missouri Parks Recreation Department
[24:41] related to the maintenance of the parks
[24:42] within the County's Park System.
[24:47] legislature as a whole.
[24:49] >> Move to adopt.
[24:51] >> Second.
[24:51] >> It has been moved and seconded to adopt is there
[24:53] a discussion?
[24:56] >> This is directing the County executive to execute an MOU that
[25:00] is not yet drafted.
[25:02] And we don't really tell the County executive
[25:05] what to do via resolution.
[25:07] So I think this was just not constructed quite right.
[25:12] The idea I think is to partner with the Kansas City Parks
[25:14] and Rec.
[25:15] It might be a delightful idea.
[25:16] But in this format, I just don't think
[25:19] we are calling out the right things
[25:20] or authorizing the right things.
[25:22] Is that a fair assessment?
