[2:00] question um and a comment, two things. I was out. I'm a big proponent of the disc

[2:05] golf course. I think we all know that here. I was out playing disc golf the

[2:09] other day and um I felt Terry, you know, he was really a big supporter of the

[2:15] disc golf course and it just made me start thinking about everything and I

[2:19] was like, you know, I called Bob Sanders today and he's the um Nag's head

[2:24] commissioner and also one of the heads of the disc golf club which is highly

[2:29] successful, hugely popular. People come here to play disc golf. Anyways, the

[2:33] point of the story is that I was playing. I called him. I said, "Hey,

[2:37] wasn't there weren't there all kinds of um markings out on this course because I

[2:41] thought that it was going to be considered that y'all were going to

[2:43] build a pavilion and and a parking lot and some things like that." And I just I

[2:48] guess my question was if anything like that was happening. Um, and also I

[2:53] remember Bob had mentioned that there was going to be a committee possibly um,

[2:57] formed with the local disc golf club just to kind of make sure that

[3:01] everybody, you know, thought everything was going well. And I he had said that

[3:04] nobody had reached out to him about that. So I didn't know if maybe if that

[3:08] committee was still happening. And then my comment was, wouldn't it be, this is

[3:16] just something I thought out there. Wouldn't it be amazing and awesome if we

[3:19] did name like the big pavilion after Terry or and honor it because I know

[3:24] that was a huge thing. I talked to him a lot on the phone about it. Um I don't

[3:27] know just a thought and like I said just questions because I remember seeing um I

[3:32] can't think of the markings out there on the course a while ago. So yeah, that

[3:54] here today on behalf of the League of Women Voters, wanting to um, present you

[4:00] guys with the 2026 Citizens Guide. This is a guide that's filled with all kinds

[4:04] of information, state, federal, um, local government information, election

[4:10] information, all kinds of of things that people like. Um, this is our 37th year

[4:18] presenting them and we're in the midst right now of distributing and I I get a

[4:24] little waverly when I speak in public so excuse me. We're right now distributing

[4:28] 6,400 um throughout Dair County from Duck to Hatteris Village um to mainland

[4:34] Rono Island um and you can find them in libraries at the towns at at businesses

[4:39] all throughout. wanted to come out here to present these to you all and also

[4:43] thank the town for their gracious gracious contribution. We have sponsors

[4:48] on the back that have helped make this happen. That's financially as well as

[4:52] town employees have answered questions to make sure that this is the most

[4:56] accurate information possible. So, the the League of Women Voters, just so you

[5:01] guys know, is a nonpartisan political organization that encourages informed

[5:06] and educated active participation in um government and we influence public

[5:13] policy through education and advocacy and this is part of our process.

[5:18] Membership is also open to anyone of voting age, men and women. So, thank

[5:45] public comment. Um Katie, I'm so happy to hear that you enjoyed disc golf. I

[5:50] think it I think our board wholeheartedly agrees with you that it

[5:52] is a wonderful resource that we certainly prioritize.

[5:57] Um improvements to the disc golf course has been a priority of ours for a long

[6:01] time. We're still looking for ways to incorporate those in future planning and

[6:06] future in capital investments. Um you know that that hasn't changed. I don't

[6:12] have a can I give you exact timeline where we're going to break ground and do

[6:15] things not today. But uh that is definitely something that's been on

[6:20] important to us and hasn't changed for quite a long time. Uh

[6:26] to my knowledge at this time there is no committee in discussion for

[6:30] improvements. uh talking about the Terry's legacy and

[6:34] committee work. the the Westside group invested lots of time and I think we

[6:38] have some Westside Group members maybe here um really looking into that and and

[6:43] prioritizing you know pedestrian uses and and really

[6:49] maximizing that space as a while and in regards to you know potentially naming a

[6:54] future improvement after Terry's memory I think that is definitely something

[6:59] that's on our list is definitely top of mind for us we're just going kind of

[7:05] when that opportunity arises, take advantage of it. But yes, Terry hasn't

[7:11] gone far from our hearts and minds and won't and that won't happen. Um,

[7:18] Kathleen, I love those books.

[7:22] It's a they're a wonderful resource to share and have around Dair County.

[7:31] and they uh you know I'm glad that we the league keeps this I mean 37 years is

[7:36] I didn't know it's that long that's rather impressive to have uh this

[7:41] resource out there for folks to have so thank you and thank the lead for all

[7:45] their all their good work any other response to

[7:50] » I would just say that uh definitely agree something in this town will be

[7:54] named after Terry Gray uh I'm sure most everybody agrees with that in this room.

[8:13] We recently had the property surveyed. Kind of step one getting the ball

[8:15] rolling and what we're doing at Bum Track. Uh, we had the property surveyed.

[8:18] The last survey that was done was 2008. So, there's disc off there. There's a

[8:22] lot more going on there. Um, edge of waters changed, wetlands have changed.

[8:26] So we got the property uh new boundary survey and we also got a new wetland

[8:30] delineation which was just approved by the core of engineers. Um that's good

[8:33] for five years. So now we can kind of start the concept planning planning

[8:36] stages. Um really what do we want to see there? So mapping the holes of disc golf

[8:42] and what's actually there and being used was important to really see what other

[8:45] kind of space we have and how other things may work. So, um, we'll be

[8:49] looking for services for some concept design and stuff that we'll bring back

[8:52] to the board and then that'll be opened up, you know, in a public setting. So,

[8:56] that's kind of where we where we are and where we're going.

[9:19] ordinance 93.01 certain conditions declared nuisances nuances uh clarity

[9:26] clarify business code compliance cameras.

[9:34] and this is really more housekeeping. This was identified by staff that the

[9:38] current regulations do not address the appropriate nuisances that are

[9:42] associated with building code compliance issues. Uh the proposed amendment

[9:46] clarifies that all construction that poses a risk to public safety are

[9:50] considered a nuisance. And this is the following language as you can see on the

[9:53] screen. Uh building code compliance. This will include any any structure or

[9:57] construction including addition, alteration, repair, and or remodel that

[10:01] are not compliant with the North Carolina building code effective on the

[10:04] date of their construction or have not been permitted in coordinates with North

[10:07] Carolina building code presenting a risk to public health or safety. Staff

[10:11] recommends the board of commissioners approve the amendment as presented. And

[10:14] I'm happy to answer any questions on particulars if you have any.

[10:24] » We're just kind of clearing up the language like the dur language of this,

[10:27] but in practice it's not going to change.

[10:40] nuisance. Our ordinance right now really only is catered to decks, stairs,

[10:44] handrails. There's a lot there's a lot of other things out there that that

[10:48] » if if we're really trying to get these things accomplished, it'll be a tool

[10:51] that will be helpful. >> Um we, you know, we can cite people for

[10:54] violations of the electrical code and things of that nature. But when we're

[10:58] talking nuisances, this is something, you know, that it's got to really fall

[11:01] in that box of, you know, presenting a risk to public health or safety. But

[11:06] it's a it's really a housekeeping amendment to address some of

[12:49] » At your January 12th, 2026 meeting, the board unanimous unanimously approved the

[12:54] timeline and process by which to build the vacancy created by the death of

[12:58] sitting commissioner Terry Grace, Senior on November 27th, 2025.

[13:04] As part of the process, interested residents had to submit an application

[13:07] by February the 2nd, 2026. And then my office then transmitted

[13:12] those applications to you for review in which you as individuals could then

[13:18] meet with the applicants that were qualified, which all that we forwarded

[13:24] um over to you to be considered this evening.

[13:35] As part of this evening's process, you will the board staff recommended and the

[13:40] board will be conducting a nomination and ballot process which has been

[13:44] utilized by the board which has been adopted and utilized by the board for

[13:48] the last two or three vacancies that were created by the board uh over over

[13:54] the several years. So what is going to occur is I will

[13:59] entertain a motion or excuse me a nomination

[14:03] and as pure as per your rules of procedure any nomination requires a

[14:10] second. So that means that if I would nominate Casey Barnell if he were

[14:14] qualified. >> Oh boy.

[14:18] » Luckily he is not. He like I live in Kittyhawk.

[14:23] Um >> then if I had a nomination I would there

[14:27] a second would be required for the person to be considered.

[14:33] One thing that as from staff's point of view which I would like to just happen

[14:38] to comment is that it was my honor and privilege to read all these applications

[14:43] and I do not I couldn't make the choice myself. You

[14:48] have an amazing pool of citizens who are interested in serving.

[15:45] high quality of applicants that we had to choose from and how lucky and pleased

[15:50] we are as a board that have such talented qualified people who want to

[16:00] who genuinely love our town and want to be a part of this board to help make it

[16:04] better. And I enjoyed all of the interviews I had with several candidates

[16:09] getting to know everybody. And uh as Mr. Odell said, "You guys didn't make this

[16:14] easy on us at all." So, it definitely is a tough tough tough choice.

[22:07] meeting um referred to that hardened structures. The science panel is coming

[22:12] up with um a presentation which should happen in April. So, um, I'll keep

[22:19] everyone updated on that, but nothing specific to Kota at the moment.

[22:58] this evening. And uh Captain Carter, I'd like to please invite you to the podium

[23:04] to discuss our uh kind of a new idea that's recently come about Operation

[23:10] Ride Safe. >> Good evening, Mayor, Commissioners. Miss

[23:13] Diaz. Um, Operation Ride Safe was something we were asked to look into for

[23:19] ebikes. Um, yeah, there's a quite a few of them on our multi-use paths now,

[23:25] sidewalks, whichever way you want to prefer it. Um, and it's a shared space

[23:29] and we our main goal is to figure out how to share it uh as safely as possible

[23:33] with everybody. So, our COP officer, Anthony Lane, has uh put something

[23:38] together uh more in lines with education and with talking to our juveniles. uh

[23:43] juveniles create a another issue for the stops and those kinds of things. So,

[23:47] we're trying to go about it as as democratically as possible with the

[23:51] parents, the schools, and having the uh having them kind of police their own so

[23:56] that uh it just comes out easier for the children and for everybody that's going

[24:01] to share these spaces. Uh so, he's doing that with uh he's meeting with the

[24:05] school resource officers, trying to meet with the principles. He's spending time

[24:09] out on Bay Drive if it's nothing more than like, you know, asking them to make

[24:12] sure they wear a helmet, make sure they they share uh that they they drive as sa

[24:17] or ride as safe as possible. And um and just being out in the public to make

[24:23] everyone aware that that that we do have to share these spaces and and do it as

[24:26] safely as possible. Um that's pretty much the the overall of it. you know,

[24:32] we're we're compiling data, talking to the kids and talking to the schools, um,

[24:37] and trying to ensure that all the ebikes are actually ebikes. And for those,

[24:41] we'll be trying to make sure that we get to the parents and those things first,

[24:45] um, to give them a chance to correct all of that on their own. And then I'll I'll

[24:49] be happy to take any questions from you um, that you may have.

[24:57] I'll just say I I believe wholeheartedly in the in the kids of this town. Uh and

[25:02] there's some, you know, they're they're really spectacular young men and women.

[25:08] And I think that yes, with just simple education and working with them, not

[25:13] against them, you're going to, you know, get the response you want. Uh because,

[25:19] you know, uh again, we have really, you know, good school here, good good

[25:24] parents, good families. Um and just don't want them to feel um like they're

[25:31] being um attacked at the same time. Educate them. Obviously, helmets, we've

[25:36] been we've been on that for a long time, but certainly on a on an ebike. and then

[25:41] uh uh the speed that that goes and then just educating them about sharing the

[25:45] multi-use path and all the various things. They're not drivers yet. They

[25:50] don't understand necessarily everything. How to yield, how to stop. So, uh and

[25:55] the more education I believe will be that'll work.

[25:58] » That's what we're hoping for because this span of kids is not just say high

[26:01] school kids. Uh I've met them as young as in fifth grade I think that officer

[26:07] Lane has already and spanning through there. So there there's a huge spread of

[26:11] of age groups and maturity uh amongst that and that's the best way right now

[26:16] we can figure out how to you know keep everybody in the town happy and safe.

[26:20] » Oh yeah many motorcycles you know in in all for all intents and purposes

[26:26] » and some of those we'll be looking at to ensure that they meet the laws of North

[26:31] Carolina as best we can. >> Oh yeah. Thank you and everybody uh with

[26:35] the police department for putting this together and I think Officer Lane is a

[26:39] wonderful representative to be interacting with kids. I've attended a

[26:44] bike safety course he did for Cub Scouts and he really has the people skills to

[26:50] relate to young people of all ages and I think uh you know having him out

[26:54] modeling the right behaviors and teaching kids how to handle these things

[26:57] safely is a great way to invest his and our our town's time.

[27:05] it at least twice a day right now trying to reach all of these kids.

[27:21] evening. Um, as the board knows, we currently lease the property that the

[27:26] Chamber of Commerce building is on, and that lease is um coming up for one of

[27:30] its renewals. Um, the board has indicated to staff that they are

[27:34] interested in leasing a portion of the old town hall fire station to Mustang

[27:41] Music Outreach Program, which is a 501c3 nonprofit. Um, we've been working with

[27:47] them um on providing community- based music education um outreach and

[27:53] relatable charity events that benefit the visitors and the red um residents.

[27:58] So through the consensus with the board, we've been exploring different options

[28:02] with that. What we're presenting you with this evening is the information

[28:07] that's governed by general statute 168272,

[28:10] which requires a 30-day public notice period before municipality may enter um

[28:16] consider entering into lease arrangements. And that's simply what

[28:20] this is. is putting the public on notice um that we look are looking at these two

[28:25] um leases. The Mustang music outreach would be a new lease and the chamber

[28:31] would just be a continuation and these will be on on future agendas

[28:36] for your actions. Thank you. >> Thank you.

[28:39] If I could add to that too, just um under a just to clarify or add some

[28:46] additional um information as to why we were um requesting that that you all

[28:52] seek this out. Um John and I have have been working on stay the child and one

[28:56] of the biggest outcomes in the surveys for stay the child was recreation

[29:01] outside of sports. You know, we're this county is really good at recre sports,

[29:06] that kind of thing in terms of recreation and we lack a little bit in

[29:11] in outside of sports or even alternative, you know, we have great

[29:14] alternative sports obviously, but music, fine arts, that kind of thing. We just

[29:19] don't have as many opportunities. And so that was one thing that we saw through

[29:23] that survey in addition to the parks and recck survey. So just it comes with a

[29:28] little data behind it. >> Yeah. instead of us just decid like

[29:31] saying we you know there there's some there's some backup to it. really the

[29:36] decision to get to this point, like you said, really started at the state of the

[29:40] child conference two years ago >> and a need that was identified that uh

[29:45] for young people to kind of have more options in music and the arts and such

[29:50] where it's an opportunity and to leverage a portion of that building for

[29:54] this purpose, I think, and to partner with an established nonprofit who has uh

[30:01] give them a space to grow and they have a lot of trust and and use already as a

[30:06] natural partnership. So, we're Thank you, town manager, for

[31:21] number of complicated accounting standards. Um we're looking for the

[31:25] contract for fiscal year 2526 audit and then it would have the

[31:31] proposal for estimates for the um next two fiscal years and approval of the

[31:36] consent agenda would authorize the manager to execute the contract

[31:39] agreement audit services for 2526 and approve the firm's continuing

[31:44] services through 2728. Staff recommends consent agenda approved

[31:49] as presented. I'll make a motion to approve the
