[11:29] thing that wasn't in there was the minute. So,
[11:33] » did you get that one from the attorney? >> Yep. She sent that in another email.
[11:38] » She did. >> Yes. This one?
[11:40] » Yep. I got We got that one. Is this Do you have a completed one of this?

[11:53] » Yeah.
[11:56] The uh what I have is >> she just on the electronic one, it was
[12:03] highlighted in areas that he didn't complete it. So that's why I just asked
[12:06] » they asked if they could finish it here during the meeting. They weren't.
[12:13] » This ain't Mr. Terrell's first um rodeo. >> Mr. Zel is uh did the
[12:19] » I know. But is Mr. Trello and his sister going to be here today?
[12:22] » His wife. >> Oh, okay.
[12:25] » Joy, >> I don't know her. No,
[12:28] » our county commissioner. >> Oh, so this ain't the same. This ain't
[12:31] » Yes, >> this is the same.
[12:33] » I didn't look. >> No.
[12:36] » Is this Mark? >> No, it says Dean.
[12:38] » Oh, Dean. Okay. Is that a brother then? >> It is a brother
[12:41] » because it usually is um What's his sister's name that lives in
[12:46] um Wales in the Stone House? >> Yeah, you do. Neo
[12:51] » Kathy. >> Yeah, that sounds right.
[12:53] » Kathy is one of the sisters. >> Yep.
[12:56] » And then the other one is has that business up at by Lexington.
[13:01] » I don't know. >> Hey, Bill.
[13:04] » Hey. >> So,
[13:20] Good to see you. >> Gary says, "Good to be seen."
[13:26] » Yeah, I guess >> I got a piece of concrete in my eye.
[13:54] Okay,
[13:59] » I'm buying a ConX box. >> What is that?
[14:05] Don't worry. Don't worry. >> I got a 24 foot
[14:10] » neck trailer. >> I know what I'm folding to that sucker.
[14:15] » As far as uh Sparingville Baptist Church, they had a permit for footings
[14:20] only and it expires on 11 of 26. >> Okay.
[14:26] » I I don't know what else to do to that. They have never
[14:30] » You're still not doing it, huh? >> No.
[14:31] » No. >> No. So, I I'll give you a copy of this.
[14:35] It's footings only. We did give them a permit. They paid for the permit and
[14:40] it's good till November. >> Okay.
[14:44] » Chickens
[14:48] that. Next one is
[15:04] should.
[15:12] » All right. So, this is something that we picked up from the MTA meeting.
[15:15] » Okay. >> It's in regards to the state trying to
[15:18] take over the zoning and planning. >> Okay. And there's a
[15:24] » there's a lot more information if you go off with your phone and you take a
[15:29] picture of this. >> Okay.
[15:30] » You can get more there's a copy in here for everybody.
[15:33] » Okay. >> Okay.
[15:34] » Sounds good. >> Trying to make it so their houses can
[15:37] only be have to be 5t apart >> and take away the all your rights along
[15:44] with Okay.
[15:46] » Yeah. Of
[15:59] course.
[16:10] » Oh, okay. So, this one this one.
[16:16] Yes.
[16:26] » Thank you. >> You're welcome.
[16:27] » Do you have any more? >> I need more.
[16:30] » Do you want more paper as
[16:41] » Oh, okay. So, okay.
[16:56] See what's on there. Gillette. That's okay. That's this one.
[17:06] » Where's Peggy? >> Okay.
[17:09] » There's
[17:13] only So, hello. Hey, Becky.
[17:18] » Can I do you have the um >> can I ask for the meeting book to look
[17:24] up these two ponds in preparation for our item for our item today?
[17:30] » Can I see the meeting book so I can take some notes on what we did with these two
[17:34] approvals? So, this was this was
[17:41] » No, this is going to be a while. >> Do you guys still just put them in the
[17:45] book?
[17:49] » Okay. I just know I'd like this like the time. Usually, we do $1,000 times and
[17:54] something else >> just to be consistent.
[17:58] » Hanging in there. >> You don't? Yeah.
[18:02] » Yeah. Did you guys hear about the pope? >> No.
[18:05] » They requested special prayer for him Sunday. Thought he had the bird flu.
[18:10] » They checked him out and by Joe he did have the bird.
[18:15] » They think he got it from a cardinal.
[18:22] » Yeah, this will work. >> Still going to take me get some used to
[18:26] your new uh >> not yet new soul patch.
[18:30] You got one, too. >> You look like you're ready to start a
[18:32] rock band, though. >> No, I was just asking for the meeting
[18:36] minutes to be consistent for it up here. >> That's a solid idea. I like that. Uh,
[18:41] that's being a true conservative show. >> You're not resorting to doctors. You're
[18:45] taking medical into your >> Yep. This is cool.
[18:50] » I heard the >> This is back in January
[18:56] process. I just wanted consistency on the ponds.
[19:00] » But why I guess why Mr. >> recently
[19:06] told him he had 6 months >> 14 days in rehab.
[19:10] » What happened? >> He had until August.
[19:12] » Yeah, that's part of it. Okay. >> You start
[19:24] kind of infection from the
[19:28] medicine they were why you talk >> and it was
[19:31] » we did this back in April. >> Glad you're still with us.
[19:33] » We'll take a review. >> I guess we'll give an up. We'll give it
[19:37] an up. What is he asking for?
[19:42] » And you know I was praying to go
[19:48] » that's how bad it was.
[19:52] » Life insurance for kids. Okay. And a bunch of grandkids.
[20:01] » They probably got any great grandkids. >> They probably celebrate my
[20:06] » Oh, yeah. Cuz they're sick of seeing you in pain.
[20:11] » But didn't they make him get a bond? >> Well,
[20:14] » isn't that what the bond for? >> I lost all my balance.
[20:17] » You didn't have to get one. >> That's fine.
[20:21] » Did he have to get one? My wife brought me
[20:24] » cuz
[20:30] they overseen. >> All right.
[20:33] » I haven't been driving because of my >> Yeah. Is Mr. Francis going to be here?
[20:39] » I've graduated from >> No, Mr. Francis.
[20:43] » Still graduating.
[20:51] » Very cool. below this one right here. >> Okay, so they're just going to sit and
[20:56] talk to us then. >> Yes.
[20:57] » Okay, that's fine. You cannot negotiate during
[21:02] » recondition
[21:06] training session. >> What's that one
[21:11] » of what they're wanting to do there? What is the request?
[21:15] » Okayur, >> but are they going to send something? I
[21:18] read that and I don't want to impose on a definition or I borrow your car and I
[21:25] drive >> his right. Well, his request was to come
[21:29] to us. >> Where's that supposed to be?
[21:31] » Yes. But we also >> some out
[21:38] » that's the way. >> Yeah.
[21:41] » Yeah. And there's some >> But he doesn't I got what I read.
[21:44] » I don't care how >> he doesn't want to do this. He just
[21:47] wants the partial. He wants to come and request a reconditional reszoning as
[21:52] industrial with stipulations. >> Correct. But he has to say that.
[21:59] » So this is more of just a kind of show with chitchatting.
[22:03] » I don't think I have a >> he wants temper. He wants to feel the
[22:08] temperature, right? >> Oh, here it is.
[22:11] » But also here it is. >> You got one.
[22:16] That ain't my fault. I thought the township was back.
[22:22] » The definition I think would be
[22:25] » I'm sure whoever does, >> right? But he doesn't want to do that.
[22:29] That's what not what >> I've been to some of them.
[22:34] » Right. I read this doesn't want to do it.
[22:38] » But if you could find a definition, that's why that green
[22:44] » with the outside of it all the
[22:48] setbacks.
[22:53] » So they just talk about what they want. >> We read our definition
[22:58] » and then the question would be what additional
[23:02] » do you want? What additional >> gotcha I understand that
[23:07] » actually I did. >> So this is more but you can't make any
[23:10] » not much pain. Th this is not you cannot negotiate. That was made very clear.
[23:17] They request and it's an up or down yes or no then you say no go back and then
[23:23] they supposed to read between the lines I guess with meeting minutes being so
[23:27] what did they talk about like vegetation buffers
[23:32] » limitation yeah that kind of right and then they come back with the present or
[23:37] come back but Mr. against the neighbor. Where is Mr.
[23:42] » Mr. Zel? >> There he is.
[23:44] » Get over by. >> Okay, I'm good.
[23:46] » Telegraph. >> So, where's that right there?
[23:49] » With the pictures. >> Hey, bud. How are you?
[23:53] » Good to see you. >> Good to see anybody. Hi.
[23:56] » This is This is different than the drawing in the This must be in addition
[24:01] to >> Let me Let me Let me ask you something.
[24:06] » This is Did you hear about the folk Sunday? that's there.
[24:10] » They they asked for special prayer for him. They thought he had the third flu.
[24:15] » Okay, now I got to get >> after they checked, he did.
[24:18] » I I understood it with the >> I think he got it from the cardinal
[24:22] » when I was looking at >> I knew
[24:24] » not this one. >> Oh,
[24:26] » there was a >> Yes. I didn't hear anything about the
[24:29] pope, but we hear about >> pretty good one. You come up with that
[24:34] yourself? Huh? >> You're not on social media, so I don't
[24:37] think you got it on social media. >> There's a difference.
[24:40] » Is that a old joke you were told? >> No joke.
[24:49] » Hey, this guy's got a shiny head. >> Yep.
[24:52] » Looks good. >> Kind of look like you.
[24:54] » Yeah. >> Yours is nice, Mr.
[24:57] » Yes. >> Yeah. I wish my
[24:59] » this was the better drawing cuz I understood this one.
[25:03] » But this is this is >> you know I've all
[25:07] » the tailor. No, the tailor goes in front with it.
[25:13] » Then it's wrong.
[25:17] » Mhm. >> Cuz cuz it's uh
[25:22] » we never come in. Where's Mr. does not match this? No,
[25:27] » I think >> no.
[25:30] » One lady miss >> this pond.
[25:32] » Miss, >> there's nothing on here that
[25:35] corresponds. >> She's so quiet. I don't I can't think of
[25:40] her name. >> This is Charles Place right here.
[25:43] Charles right there. >> The one far away.
[25:47] » Harris. >> Then this was the old Taylor, right?
[25:52] » If this is the one, this is the newer house.
[25:55] Then this was I don't know who owns it now. This is the other this is
[26:00] » Oh, there we go. >> Henry, what's the first one?
[26:03] » Jennifer Henry. >> She's
[26:06] don't drive. >> Oh, okay. Cool.
[26:09] » Because then this is the parcel that she crossed out.
[26:12] » This is must be the house. Is this supposed to be our house right here?
[26:16] » No. >> And then this is the barn here.
[26:18] » We quit. To >> me, this would be where the bond is
[26:21] going. >> Correct. Shut the door. This ain't his.
[26:24] » I got a buddy. He's growing crazy. >> Why did they throw this?
[26:30] » Yeah, he's lives there now, but this used to be
[26:34] » Paul Cyrus. Good work.
[26:36] » I know Pauly Taylor, but he in the back >> was on board.
[26:43] » That's his house. >> That one I don't know. And then the kids
[26:46] live over here. >> But she was a dealer.
[26:48] » I think he's in his house. >> He looks young. I know that.
[26:51] » That's a brand new house. But it's been here now probably for like
[26:55] five years. >> He's got a good crew. So maybe he can
[26:57] » This used to be This is where you >> There was two boys and they rode the bus
[27:01] with me. >> Yes.
[27:03] » And they're the ones that brought the gun that
[27:08] » he doesn't live there anymore either. And they they used to be Taylor.
[27:12] » No. Then there's this one.
[27:23] beach. >> This one here is on.
[27:28] Where's he going to get the sand on? >> No, this one's This is Z. This is this
[27:33] one. >> That's this one off the table.
[27:38] » Are you talking You're talking about getting
[27:41] » Yeah, Gillette. They've been here before.
[27:43] » That's on t That's on the pier. >> That's on the pier across from where
[27:46] he's renting. But where they do that? >> Well, they've been working there before.
[27:53] They're the ones that >> jump
[27:58] the next
[28:03] Google Earth. Show my wife >> and they named it after you.
[28:07] » I'm going to live on Dunlap until I >> Now, is Dunlap the same road that turns
[28:13] the potato? >> Same road. So both sides were named
[28:17] yesterday. I guess it's just >> Well, Taylor tried to change the name.
[28:24] » Can we start years ago?
[28:27] » Well, >> like the Hatsfield McCoy.
[28:30] » I pledge allegiance to the flag of the United States of America and to the
[28:34] republic for which it stands, one nation under God, indivisible, with liberty and
[28:40] justice for all. >> And roll call, please.
[28:44] here. >> Here
[28:55] » I have a approval of the agenda. >> I'll move to approve the agenda for the
[29:02] April 28, 2026 planning commission meeting.
[29:07] » A second. >> Have approval and a second. All those in
[29:10] favor signify by saying I. >> I. Post same sign.
[29:15] Approval of the minutes for February 24th, 2026.
[29:20] » I'll move to approve the minutes with one correction on page one, letter C. If
[29:25] we can change the word board to commission.
[29:35] » I second.
[29:38] I have a a motion to accept. All those in favor of significant
[29:49] one. Got it. >> Okay.
[29:53] » Okay. We're going to have a open public
[29:56] hearing for
[30:00] 2780 Taylor Drive pond and sand removal. We're going to open the meeting at
[30:06] » Do you want a motion, Mr. Motion to open it?
[30:08] » Yeah. I'll move to open a public hearing for 2780 Taylor Drive upon insane
[30:14] removal request at 6:32. A second.
[30:19] » All those in favor signify by saying I. >> I.
[30:22] » Approved. Any this uh disapproval?
[30:28] Say I discussion.
[30:32] » Who is there? Anybody here
[30:36] for the Taylor Road? >> I'm
[30:44] Could you step up to the mic, please? Marty,
[30:57] » before you start, can we clear this up? Didn't Didn't he have a He was here once
[31:03] before. >> He had a permit for um
[31:07] » different address. >> Burma.
[31:09] » Allen Road. >> Burma.
[31:11] » It's Burma. >> Burma.
[31:13] » Burma >> near Angelwood or Engle Court.
[31:20] » That for me that that probably won't continue.
[31:24] » He was working for us at the time and he left. We just never did any of it.
[31:29] Honestly, I'm sorry to waste your time on that one.
[31:31] » No, that's all right. We revoked it last time we met.
[31:33] » Yeah. Okay. >> Yeah. So, what are we looking to do?
[31:37] » Another pit 1.4 acres on Mr. Zville's property and uh in behind there. I don't
[31:44] know if you're familiar with where their property is, but it's kind of in track
[31:46] with where we go into our property. It's real close. We go down to baseball road.
[31:50] So, it's it's right there. It's it's it makes sense for him. It makes sense for
[31:53] us, but probably a 1.4 acre pond.
[31:59] Uh, I think it's 240 by 230 basically the dimensions. It's all pure sand. It'd
[32:05] be great for our community to have sand. There's very limited amounts of
[32:10] resources in our spot. The only other spots for sand are on
[32:15] Cribons Road and of course out of Mid Michigan. So, we appreciate the
[32:19] opportunity to have more material here. If you really a shortlived project, I
[32:23] believe we we'd be and out of there in one season, maybe two at the most. So we
[32:27] have that road bonded um as well as Finch Road bonded. So truck traffic is
[32:32] already allowed there and
[32:36] we maintain it as far as dust and >> you you only expect two acres of sand
[32:43] though >> one 1.4 four, but we can probably go
[32:46] down, you know, 20 ft.
[32:53] » That's pure sand down that road. >> Yeah.
[32:58] » What parcel is is this? >> Yeah. So, that's that's a clarity
[33:03] question because what we have in paper, this one
[33:06] » something doesn't jive. It doesn't match the one I got electronically because
[33:11] this here includes your ne the neighbors, Mr. Zobel,
[33:15] » right? Which is >> Yeah. So, in regards to this needs to be
[33:18] updated, I'm going to use some old names and it
[33:23] shows my age because I know where you are, Mr. Zobel. And then the White House
[33:27] next door used to be Taylor's, but I don't know who owns it anymore. Next
[33:31] door is another Taylor and then the Kates are next door to them.
[33:34] » Yes. So, I know the area, but the other drawing that I got electronically was a
[33:39] little better because it did show the proposed pond.
[33:42] » Okay. >> And this one doesn't because I Huh.
[33:45] » Where is the proposed pond? Is that partial C or
[33:48] » it's Mr. Zobel's and like the house drawing was much better too?
[33:53] » Because this is Flbog. This is Taylor right here. This is Mr. Zobel's house.
[33:58] » So, >> it's up here, right? The 19.59 acres.
[34:02] » Here's Flb here. Okay. Here's my house. Here's my barn.
[34:06] » The the pond would be right back here behind the barn.
[34:09] » Yeah. >> And one piece of hardware or two pieces
[34:12] of >> Well, this is all this is all
[34:15] » Well, you have two different >> were they were bought at two different
[34:18] times. >> And so this is online. Um, it'll be
[34:25] » Do you have the the >> the other drawing? I can pull it up on
[34:28] my phone, which I was leaving. >> This is much better.
[34:34] » Will you be leaving the property to go to flinch ball?
[34:36] » No. Once you go right the expressway. >> Oh,
[34:39] » they wrote it here. >> So, it's right behind Yes, sir. Right
[34:43] directly behind the the barn here. >> Yeah.
[34:46] » So, you'll be going across somebody else's property.
[34:48] » No, he's coming off. >> You're coming off Taylor, right? off of
[34:51] Taylor. Come right >> be coming through my property. I've got
[34:54] a drive that that goes back to the back to the Taylor.
[34:56] » Well, that's what I mean. He's gonna he's going to go off Taylor to Flinch
[34:59] Ball. >> No,
[35:01] » I think he's come in Taylor, get his sand, and go back out to Taylor and go.
[35:06] » He's never going down flinch. >> No, we have no reason to go back to
[35:08] Flinch Ball. >> Okay.
[35:09] » No, Mr. T, you have a pit off of Flinchbug, the dirt portion.
[35:13] » We do, >> but it doesn't connect because
[35:15] » does not connect. >> It doesn't. Everybody's parcels there
[35:18] are very deep, >> very separate, too. Yes.
[35:20] » But you've all How long had you had your pit there?
[35:24] » Probably 30 years. >> Yeah.
[35:26] » Because it connected to the golf course, correct?
[35:28] » No, there was a piece in the middle of that.
[35:30] » Oh, it did. >> Oh, okay.
[35:32] » All right. >> So, thank you, Mr. Zel.
[35:36] » Draw it on there. >> No, but that would probably be a
[35:39] condition. If we're going to use this one
[35:42] » versus what electronically we got, >> it's going to need to be updated.
[35:48] » So, that's fine. Okay.
[35:51] » I just don't know. It didn't come with the paper packet that everybody else
[35:55] got. It was in the electronic packet. The other drawing looked better.
[36:00] » Are we going to have problem? Do you have two different parcel ID numbers
[36:03] then? >> What for?
[36:07] » Have you combined the parcels with the with the county?
[36:11] » Well, yeah, I think did that. >> Well, we can look that up. Okay,
[36:18] we can look it up.
[36:33] Okay.
[36:41] » You plan on hauling out until 10 o'clock at night?
[36:44] » No. No. We our guys are everybody's getting older now. So,
[36:53] » okay. So, how late do you want to how late are
[36:57] you going to be hauling out? >> You know, most time it's put on there at
[37:00] 7 o'clock, but we're we're never at 7 o'clock. We're done at 5. You know,
[37:04] » 7 to 5 then. >> Yeah. We could be out there by 5. It'd
[37:07] nice to have six in emergency for something, but it wouldn't be our guys
[37:10] won't stay that late. Any
[37:23] other questions of of the board? Why were
[37:28] » people within 300 ft did get letters? We had no phone calls and no response.
[37:34] » Is there anybody here in the audience that wants to say anything?
[37:45] It's all one parcel if anybody I looked it up.
[37:58] » It is. >> Yep.
[38:01] » You got a copy that was in the newspaper in the mailing list.
[38:08] » What newspaper? time zero.
[38:11] » Okay.
[38:25] The board
[38:28] » I'm seeing you wrote down 5:00 p.m. on your paper.
[38:32] » That's what he said. >> Yeah. Mo most time though, guys. It
[38:35] probably be six o'clock. I'd like to have it at that time. We won't work that
[38:38] late, but an emergency like not have to say we're restricted to 5.
[38:41] » But he's going to he's wanting you to put that that would be in the permit
[38:46] that you'd be done at 5. That is really enough.
[38:49] » I would say most all the time we're done by four or five o'clock, but our guys
[38:52] leave at 5. So, you know, if something happened that they're out working on a
[38:55] machine or something at the last minute, I say 5.
[38:58] » Hauling out of there, hours of trucking out there.
[39:00] » Yeah. We don't we don't leave work past 5 usually
[39:03] » at all. These guys all want to go home by then.
[39:06] So they're back at the shop.
[39:10] » We got to keep this open for a half an hour.
[39:13] » Uh, no. We really don't.
[39:17] » We really don't. If there's nobody Okay. >> Why don't we just give them till 7 just
[39:21] to give them some lenency in case emergency?
[39:23] » Well, that's what Hey, are you Can you read minds?
[39:27] » Can you read minds down there, Mr. >> I'm just thinking about how it works to
[39:32] work in construction? Yeah. So, just being fair to those that we've
[39:39] approved before, including Mr. Trello, is there any objection in regards to
[39:45] We've previously approved Monday through Friday, 7:00 a.m. to 7:00 p.m. We've
[39:49] asked for a $1,000 reclamation bond. And then I see the application says no more
[39:54] than 20 feet, but we've we've also included that in our approvals before.
[39:59] And then you've shared with us a 1.4 4 acre pond which we've we would we've put
[40:04] in um and then as shared we need an updated
[40:09] drawing probably you know probably as a condition is that
[40:14] would that be hardship on the applicant. >> No the only I ask for is if we hardly
[40:19] ever work Saturdays anymore but the emergency came up that we'd have on
[40:22] Saturday. So, in regards to that part,
[40:34] » so you're saying you want to be able to call out on Saturday
[40:38] » just in case. Yes. >> Just in case. Did you hear him say that?
[40:40] » Yeah. >> Today, though, we wouldn't need any more
[40:44] than that. It doesn't happen often at all.
[40:54] Pleasure of the board. >> Well, you got to close the public
[40:56] hearing for >> I have a question, Mr. Chair.
[40:59] » I'm just thinking out loud. Um, with all that traffic going on and off that
[41:04] pavement, will that cause any damage to the edge of the pavement that the county
[41:09] should be made aware that we'll need them to come fix or
[41:11] » We have had no damage on Taylor Road at all. All the trucks have come in out of
[41:16] there. So, yeah. No, it's a heavier road.
[41:19] » You guys have that bonded anyways though, don't you?
[41:22] » We do. >> Yeah. I was going to Are you
[41:24] » We could It's easier to ask you, can you share with us what that is now with the
[41:28] road commission? >> I know we're bonded on flinch. I believe
[41:33] we're still bonded on Taylor. Might be able to answer that question.
[41:38] » On Taylor. >> Yeah, because Taylor's going to be
[41:42] considered a class A. We've been able to run that all season
[41:44] » because Taylor would be a class A all Yeah. All season,
[41:47] » which Flimblog is just the dirt road. >> Got it.
[41:52] » Okay.
[41:55] » But at the end of the day, it's not our decision. It's the road commission's
[41:58] decision. So, it could be another condition, but it's they're going to
[42:03] have to get it whether you like it or not.
[42:04] » Yeah. >> Yeah. I don't know what the
[42:12] » Got it.
[42:17] » Pleasure of the board. >> Is that for 278 Taylor?
[42:24] » 278. That's the address. >> Yep. That's Yeah. I guess the other
[42:30] question is I know you shared, but when you say seasons, give us a time period,
[42:34] Mr. that you're asking cuz you've asked you said one season or two seasons. So
[42:39] what does that mean? >> I believe that with that amount we could
[42:42] possibly take the second season part of that to finish it. Yes.
[42:45] » So is that 12? >> It' be two years.
[42:56] » Is it a hardship if we do um 12 months with an extension? Because we've done
[42:59] that before with you, Mr. Till. >> We can do that. That's right.
[43:07] Mr. Miller, any questions? >> Any questions?
[43:14] » No, >> Mr. Oer.
[43:18] » Sounds like a green light to me. >> Mr. Howard,
[43:21] » it's okay, Mr. D. >> I want to see it go.
[43:28] » We're in a public hearing. >> Okay.
[43:32] I make a motion that we close the public hearing for 2780 Taylor Road at 6 46.
[43:44] » Second. >> All those in favor signify by saying I.
[43:48] » I. >> All oppose.
[43:50] » Same sign. Closed. >> Okay.
[43:52] » Now we need a motion. >> Wait, they did this different now on our
[43:57] agenda. He's down here.
[44:01] So, we're now down to old business.
[44:08] » Yeah, but he's up here, too. >> I know, but that's down here.
[44:17] » So, >> now,
[44:19] right, >> can we revise the agenda after we
[44:23] approve the agenda? >> Yeah, but I just noticed that's
[44:27] something new. >> Yeah.
[44:30] Do you need a revision of the agenda so we can pass this now?
[44:34] » We have to make a motion now. >> Yes.
[44:37] » Yes. >> I'd like to
[44:40] make a motion that we um
[44:45] move number six up to the spot of number four.
[44:59] Okay, I have a motion. Do I have a second?
[45:05] » I'll second. >> Have a motion to move uh
[45:09] » I new business up to number four. >> All those in favor signify by saying I.
[45:14] » I post same sign carries. Now make your motion.
[45:21] » I think he's writing up a motion. >> I knew Mr. I didn't know I was going to
[45:24] do that. >> I had a feeling. I I'll move to approve
[45:29] the application associated with a soil removal permit at 2780 Taylor Road with
[45:35] the following conditions. An updated drawing
[45:41] indicating the placement of the pond. The pond being 1.4 acres at a 20ft
[45:48] depth. Operation hours being Monday through Friday, 7 am to 7 pm with
[45:53] Saturday hours on a case-byase basis by township administration, a $1,000
[45:59] reclamation bond, and a 12 month approval period with the um option of
[46:08] extension before the planning commission.
[46:11] » Do I have a second? >> I'll second.
[46:16] » Do we need that red back? Did I miss anything, Mr. Melvin?
[46:20] » I think you did good. >> Thank you, Mr.
[46:22] » I have a motion and a second. All those in favor of the motion signify by saying
[46:26] I. >> I.
[46:27] » Oppose. Same sign. >> Carries.
[46:31] » Thank you, gentlemen. >> Thank you.
[46:35] » Did you call me Mr. Miller? >> No, I said Milton.
[46:39] » You okay? >> No. Milt.
[46:42] » Did I say >> How did I say that?
[46:46] » I don't know. Sorry,
[46:49] » you got me working extra now. >> He'sn't He was He'll tell you later. He
[46:55] was >> We're going to go to number four. Old
[46:59] business.
[47:03] » Yep. >> Development of district definition.
[47:07] Final review. >> You're up, sir.
[47:11] » Well, with the committee that we had um there was recommendations from the
[47:18] committee and also our attorney and I hope everybody looked at the attorney's
[47:23] recommendation >> and we could get that definition
[47:28] so we can get our master plan off and printed. It's been November of 2024
[47:34] since when we started this. I'd like to get
[47:40] some printed copies of our master plan, new master plan. So, if you take time to
[47:48] look at that, I appreciate your comments and come up with a final decision,
[47:55] please. >> Why Why is there a change of the the
[48:01] definition or not definition, but the like the district name from the PUD to
[48:07] » We're not P no PUD. >> But why?
[48:09] » Uh the attorney says you don't need a flood development at this time.
[48:16] can be a later >> small or what? Pardon me?
[48:19] » Because we're just too small or why >> it could take another year to go through
[48:26] the all the counties, all the townships. >> Oh, so the other townships are not
[48:31] having puds either. >> Um, St. Clair.
[48:38] » So move our master plan, we start the PUB.
[48:44] Mhm. I see it. >> I read it.
[48:55] » You talked about green belts. We talked about uh
[49:00] in the definition, talked about setbacks,
[49:06] talked about traffic studies, talked about utility studies, and that was all
[49:11] in with the attorney's recommendation.
[49:18] It was November of 2024 we started meeting.
[49:24] » So last week I asked him to come up with um
[49:29] his opinion and he did and you have that that's two pages.
[49:33] » Yes.
[49:38] And also there was uh um in our page 135 our old ordinance in industrial they
[49:46] gave uh setbacks. The committee added five feet to the
[49:53] side yard set back and also in the residential district to have a green
[50:00] belt between R1 and R2 which is on
[50:10] club to the south tracks to the north. >> Yeah.
[50:14] » Highway to the east. So, it's trapped right in the middle there with a little
[50:19] residential district there.
[50:28] » So, any comments on the attorney's opinion?
[50:32] » No, I don't. The only comment this is still a zoning amendment.
[50:38] » Yeah.
[50:50] What's your
[50:55] developmental focus? He wanted special land use taken out and special exception
[51:01] use put in. Mhm.
[51:04] » He wanted to strike the putt development and
[51:11] light industrial added to the special exception
[51:16] for that district.
[51:22] He was okay with the permitted uses. He was okay with except for the
[51:28] the plug that's also attached in your
[51:34] agenda. It should have a little
[51:41] » what the chart. Are you referencing the chart?
[51:50] » That was part of it. >> Yeah,
[51:52] » that was the other part of it where we >> wanted to strike that and strike the
[51:57] pudge development. >> You got that one.
[52:01] And >> this is just for the
[52:07] So I guess the question that I have is for the group being do you want to talk
[52:12] about this? Do you want to just move to schedule a public hearing which is
[52:15] required for a zoning amendment and do it at that time? What does the group
[52:19] want to do? Because you have to have the public hearing. It's got to be
[52:22] advertised. >> Correct. The the group is here tonight
[52:27] regarding their property which this falls in that district. Mhm.
[52:32] » So that's why they here with open ears to listen to.
[52:36] » Would you like to explain your concept? >> You guys allow me to
[52:42] » go for it. We'd like to hear it. >> Go ahead.
[52:56] » Have you guys share one if possible?
[53:04] Sorry. >> Thank you.
[53:07] » Yeah. >> So, you guys should be pretty familiar
[53:09] with this property. I know uh >> you state
[53:12] » Yeah. Greg Dan with Interstate Capital. Um this property was locked down for a
[53:19] couple decades through lawsuits and >> leans and failed project. Right. So, for
[53:27] the last five years, our uh firm has been chasing this and right outside the
[53:31] lean, which I think, you know, eliminated from this property in May of
[53:34] 24. Um, we were able to put this under contract last year in July. We closed in
[53:39] August on this property. Um, our intention has always been the same. um
[53:46] bring a commerce park to the I 94 I69 corridor. You know, something that could
[53:52] interact with the bridge traffic, continue to attract business and jobs
[53:57] for the region. Um most importantly noted, not a data center under any
[54:03] circumstances. Um so these are industrial buildings. They're modern. Um
[54:08] they're 32 foot clear each and every one of them, maybe a little bit greater. Um,
[54:14] this is the design that, you know, you guys are uniquely uh positioned for in
[54:19] Kimble Township, having rail that serves this with Canadian National and access
[54:24] to a double uh stack tunnel going into win going into Sarnia
[54:28] » and the Blue Water Bridge, which your rates beat the crap out of the
[54:31] Ambassador Bridge south of us and even now the Gordy How coming online.
[54:35] » So, there's been an increase in truck traffic over the past two years the
[54:38] Gordi's been being built. It's been rerouted to Blue Water. I was just in
[54:42] Canada over the weekend and there was a backup for probably seven miles of
[54:46] semi-truckss trying to look to get into the US. All your your bridge. So to
[54:51] actually, you know, utilize it, that type of commerce, it hasn't been able to
[54:57] be taken advantage of by anybody in Slair County ever. No one's come in and
[55:02] said, "Hey, we're going to build a 380,000
[55:06] foot building to attract customers and then in reference attract jobs." And
[55:12] those jobs then attract hotels and sea stores and grocery stores and
[55:17] residential builders, you know, all the things that come with the community's
[55:20] growth. So, we've been really focused on that tenant pool. Um, reaching out to
[55:27] Canadian companies that are looking to reshore or onshore here in the US. We've
[55:31] got at least a dozen conversations opened. I know I talked to certain
[55:35] members here, you know, about certain opportunities that are local that are in
[55:40] other municipalities locally um that are they're busting at the seams. They need
[55:44] to grow and they need to be somewhere else. Um so to really find a spot for
[55:48] those to land that makes sense. you know, this is the opportunity of a
[55:53] lifetime for for some of those those areas. It's something this property
[55:56] could have, you know, seriously been used for decades ago and was absent of
[56:00] being able to use. So, with this, we're bringing, you know, we've talked to now
[56:05] the mini storage, the hotel, etc., and the road commission on what that road
[56:12] would look like to get redone and turned into a public rideway that's 80 foot. um
[56:17] utility extensions that are already there but likely would need to be
[56:20] upgraded. Um talked to the MEDC, Michigan Economic Development
[56:24] Corporation, as well as different state reps on how we could find some public
[56:29] funding that could be supplied to Kimble Township slash the development to be
[56:34] able to install those. If not, they're on our dime. Um but really um just to
[56:41] attract the right kind of business, you know, stuff you guys want to see other
[56:46] municipalities locally can't no can no longer serve and opportunities that will
[56:50] end up elsewhere if if we're not bringing them to the table with you guys
[56:54] as partners. Um so we paid careful attention here with setbacks with
[57:00] continuing to maintain natural features. You've got we've got two massive ponds
[57:04] on the freeway entrance there. There's people fishing on them. There's dirt
[57:08] bikes rolling through here outside of the nuisance that's been to you from a
[57:12] fire department standpoint and just emergency services. Um, I think there's
[57:16] a great opportunity there and we've earmarked and left this open to be able
[57:21] to, you know, bring some sort of park service that we'd be willing to deed
[57:25] over to Kimble, something that you guys could utilize for yourselves to attract
[57:30] and, you know, really bring amenities to the residents. those come in the form of
[57:35] fishing or a walking trail, etc. That's almost 50 acres worth of property there.
[57:40] Um, including those ponds that we're willing to work with you guys for um and
[57:46] gift you in any means. Um,
[57:51] and we've taken dual note. I mean, I I've I've camped out here now probably
[57:56] two weeks total uh since we closed in August and rode my dirt bikes and my
[58:00] four-wheelers around here and stayed in my RV on the property. And the that gun
[58:06] range is is quite a significant amount of noise to say the least. So, what
[58:10] we're bringing to the table from between the rail and the gun range and the
[58:16] freeway, I don't even think you'd hear anything that that we'd be adding to
[58:20] that scenario because there's a ton of road noise on the weekends. It's
[58:23] semi-automatic and sometimes fully automatic weapons and the rail passes
[58:27] probably six times a day. So, um yeah, I've met with some of your neighbors. I
[58:33] have 17 of them that border our property on the west line there on Allen Road.
[58:37] Um, I've had the pleasure of meeting a couple of them and I've got Darius
[58:41] Udrich in the back here who's our director of communications and in charge
[58:45] of governance and community outreach. We'll be meeting with the rest of them
[58:48] and putting in what is today a 330 foot setback um from that property line far
[58:54] greater than what what Neil has propo proposed
[58:58] » and something that where it leaves all that natural buffering in place. Um
[59:02] there would be a access point back there if you guys require it. not something
[59:05] that we require, but you know, per your fire code, you might need a um emergency
[59:11] access to the rear there. Other than that, it would be lockboxed and it'd be
[59:14] a knockway that you guys would only utilize in a in case of emergency. Um
[59:21] yeah, and we happy to answer any questions for you guys.
[59:25] So what is your model being? You used a term back in the day it was
[59:30] industrial park then it turned into business park and then some now is just
[59:36] lease buildings on property that is not sold. So what is your model here in
[59:42] regards to structure? >> So we're we're long-term holders. Um we
[59:46] don't look to to trade anything. So for the right user, you know, if they were
[59:50] talking something someone that was major jobs and maybe for this larger building
[59:54] that's there, >> um that could attract an ecosystem, you
[59:58] know, an automotive manufacturer maybe that would have suppliers and logistics
[1:00:02] companies that they would need to have close to their campus. Um we might look
[1:00:06] at selling something. Otherwise, we would be looking to build these, hold
[1:00:09] them. I'd be your single phone call and I'd be the one who'd be able to bend
[1:00:13] that tenant for whatever they may or may not be doing
[1:00:16] » that that doesn't fit in with your guidelines.
[1:00:19] » And then how flexible are the buildings being um one tenant, two tenants, that
[1:00:26] being that you just want the box, I guess, approved, but you want to be able
[1:00:32] to do whatever you you know, whatever inside to um split them up.
[1:00:36] » Yeah, that's a great question. So in West Michigan, we stood um two million
[1:00:40] square feet in total since 2020. >> That's five sites. We've got Ford,
[1:00:45] Fizer, Zoetis, Bradford White, real large heating and cooling company for
[1:00:49] headquarters. Um all of those buildings were speculatory. So we didn't know who
[1:00:54] who our tenant was going to be, right? We we tapped into the marketplace like
[1:00:57] we're doing now with reaching across the Canadian companies and locals
[1:01:01] » to figure out what type of building or blend it could be. We'd love a single
[1:01:04] tenant. >> That's ideal. Um, does that happen? It
[1:01:07] has all five times out there. >> Mhm.
[1:01:10] » Um, but we also made all those buildings really versatile. So, they've got
[1:01:13] parking lots on two different areas here. We've got docks and we can
[1:01:17] partition that building typically between two or and or three or even four
[1:01:21] times um depending on the tenant demand >> with a two-hour fire wall between
[1:01:27] » right I'm just asking in regards to% these buildings you you can see in other
[1:01:30] parts of the state um in regards to the aesthetics of it
[1:01:35] people will have different opinions but you can see these there's an Aldi's
[1:01:39] Amazon those type of shipping type buildings these are shells
[1:01:44] » they are And as a result of them, you don't necessarily know what's inside per
[1:01:49] se because I'm assuming you have the ability to do the moving wall aspect and
[1:01:53] you get x amount of entrance and or docks.
[1:01:56] » Yeah. And it's not just the wall the wall side of it too. So when we build a
[1:01:58] building like this, we won't pour the floor.
[1:02:00] » Okay. >> Because we don't know how many
[1:02:02] employees, bathrooms, office space. We don't know what that what they're going
[1:02:05] to need from an underground standpoint. So for us to come back and cut out six
[1:02:08] or eight inch floors is is wild in some cases. And then they want 20 bathrooms
[1:02:12] per gender. Mhm. >> Um, so what we'll do is we'll leave the
[1:02:16] floor out of that building or we'll pour maybe 3/4 of the floor less these two
[1:02:20] office corners that we have and we'll leave enough area for them to be able to
[1:02:24] manipulate. Um, we would prefer to land manufacturing
[1:02:29] companies. Those are more longerterm leases or really stable opportunities
[1:02:33] and they pay a lot more. Um, so that's our number one objective and what we're
[1:02:37] seeking. Um but you know the logistics companies have to support those as well.
[1:02:41] And with this being commerce with the bridge, I definitely see some logistics
[1:02:46] opportunities being a able to um land here as well.
[1:02:50] » So yeah, building will be uh we'll say built where it's versatile enough where
[1:02:56] it can transition to either one of those type of users.
[1:02:59] And sometimes, you know, we've been lucky with the buildings we built where
[1:03:03] we've put them up and, you know, two of them we were putting steel in the ground
[1:03:07] when, hey, I want this building. >> Mhm.
[1:03:10] » And we were able to identify and then we had some pivot time if they want to do
[1:03:14] some customization. Um, otherwise, yeah, typically a a shell of some kind that we
[1:03:20] have with no floor and lighting, fire suppression, electricity set up to
[1:03:24] multimeter and split. Same with gas, water, sewer. um so that it can pivot
[1:03:30] however that needs to. >> If I may, Mr. Chair, just two I'm not
[1:03:35] asking for an answer, just two points. >> Sure.
[1:03:38] » Traffic will come up in this conversation if it proceeds.
[1:03:41] » Sure. >> The other in regards to the battery
[1:03:45] plant in St. Clair. It's empty. It's big.
[1:03:49] » Sure. >> So, how are you going and you know, how
[1:03:51] are you going to address that in regards to comments of people?
[1:03:54] » Yeah. So, I think we've already performed a traffic study on this. I
[1:03:58] don't know if we have our um findings back, but I know there's going to have
[1:04:01] to be on Range Road in particular some additions in del lanes and traffic
[1:04:06] signaling that will need to be installed. And that's I mean that's
[1:04:09] that's the nature of what comes with this for sure.
[1:04:12] » Um I don't think it make anything worse.
[1:04:15] That's the whole point of the traffic study is to make it make it better. Um,
[1:04:20] this is a an intersection where it's it's the right kind of intersection to
[1:04:25] be able to do an opportunity like this. You know, the other side of the freeway,
[1:04:28] you guys have the roundabout. >> It's not as ideal as it is just to have
[1:04:32] straight on and off ramps. So, >> um, but some of the reasoning behind
[1:04:37] that is is good in this this occasion. Those roundabouts and semi-truckss,
[1:04:42] they're always too tiny. So, um, there's probably something possibly over there
[1:04:47] that might need to be accomplished as well,
[1:04:50] but those are all things that, yeah, we'll have to tackle as part of our site
[1:04:53] plan approvals and part of passing any and all questions that your team would
[1:04:58] have for us.
[1:05:02] » Mr. Chair, I have a question. >> Yes. Yes, representative Greg. So you it
[1:05:06] seems like you have a lot of infrastructure all throughout the
[1:05:09] country and I'm just thinking out loud as a potential resident who's seen these
[1:05:15] big white buildings. In your experience, has there been any oversight where you
[1:05:21] have the exterior of the building blending in with the environment as far
[1:05:25] as just creating, you know, like instead of just having a white wall, you have
[1:05:30] some decorative where it looks like the woods. Like I've got a friend, he's got
[1:05:34] a tow truck yard. The side of his fence looks like woods.
[1:05:38] » You sure? You got like a real real tree print slat inside of
[1:05:40] » it. Just a just a thought because I residents talk about stuff like they
[1:05:44] don't want these white walls in their woods. They don't want just giant white
[1:05:47] build. >> Yeah. Well, they won't they won't be
[1:05:48] white walls and you know there's a ton of color selections that we can choose
[1:05:52] from when we put the way when we do these kind of things. Um for what is
[1:05:56] facing residents beyond that 300 buffer and that's that's the reason we're
[1:06:00] leaving a lot of these trees in play. Number one, twothirds of this plan, if
[1:06:05] not threequarters of it, is not even near a resident. It's gun range, it's
[1:06:09] freeway, it's railroad. So, there's 17 residents in question here um that are
[1:06:15] that have any type of of line of sight or visibility to this. And that's a wall
[1:06:20] that we can install at, you know, dark green or black or any of those number of
[1:06:25] things. But we don't do white walls. So, that would be it would be a darker or
[1:06:28] lighter tone of gray and be a couple different kinds of them. We not putting
[1:06:33] a big white wall in for anybody. >> Sure.
[1:06:35] » Our committee came up with no data center, utility study, traffic study, BM
[1:06:41] bonding based upon valuation, preliminary drawings, all parcels be
[1:06:47] joined together because they're separate parcels now.
[1:06:51] » Six of them.
[1:06:54] » That was the committee's recommendation. If you have your traffic study, is it
[1:06:59] addressing the railroad being
[1:07:02] which has always been the issue where you get stuck? And that's another
[1:07:08] hot topic in the community. I know you cannot solve it but it's always it is a
[1:07:13] point of conversation that will be brought up because you're increasing
[1:07:16] traffic and then with even without your traffic we have issues where range is
[1:07:23] blocked Griswald is blocked and the other
[1:07:28] section of range is blocked and >> he's got he's got spurs spurs
[1:07:32] » right so I'm just saying in regards to that does your does your traffic study
[1:07:37] address that or will that address that in regards Yeah, it will be addressing
[1:07:40] that and likely the road will have to be widened for another lane or two on each
[1:07:44] side to address maneuvering and additional traffic queuing and any type
[1:07:49] of traffic signaling that will need to be installed.
[1:07:51] » Mhm. >> I'm not a traffic engineer by any means.
[1:07:54] I I build relationships and partnerships with municipalities.
[1:07:58] I've got a team that does that and they're really good at it and they're
[1:08:01] seasoned. So, they'll be addressing all of that for you guys.
[1:08:08] So that's why the the if we could get the master plan with the definition
[1:08:16] in place and not for their reasons for our reasons to have a a draft finalized.
[1:08:24] » Mr. Chair, I'd like to say one more thing. So I along with Neil and other
[1:08:28] members, we sat down with Greg and his team multiple times. We sat down with
[1:08:31] the lawyer and in plain English, it makes things harmonious. It makes us
[1:08:36] more attractive. It makes people like his team and other potential tenants and
[1:08:41] teams within the township. It makes it things simpler for them to do business
[1:08:45] with us. And we've all seen instances where a lot of our old ordinances, a lot
[1:08:51] of our old things make things kind of fickle and that's why we've talked on
[1:08:56] the trustee board, we need to readress some things and make things more user
[1:09:00] friendly. So, um, all my experiences with Greg and his team, they seem like
[1:09:07] great people. They want to invest in this community and, um, yeah, I mean,
[1:09:11] I've reached out to Greg after I first met him and I gave him some ideas. I
[1:09:14] reached out to Mark Hilo who's in the process of expanding Gilo Pickles and I
[1:09:18] said, "Hey, this might be a great opportunity." And he said, "Yeah, I'll
[1:09:20] think about it." So, I mean, there's lots of opportunities. So, I just wanted
[1:09:23] to express that.
[1:09:28] » Any other comments?
[1:09:31] So that's the right ide.
[1:09:40] » Thank you guys for allowing me. >> Thank you.
[1:09:42] » Thank you. >> Thanks.
[1:09:52] » Good evening uh members of the planning commission. Uh thank you for the
[1:09:55] opportunity to speak here this evening. My name is Larry Opleski. I'm with the
[1:09:58] law firm Dickinson. Right. We're outside zoning council for the developer. Just
[1:10:03] wanted to say a few words about the development district idea. Uh you know,
[1:10:08] we we've looked at everything you guys have been working on and you know, we
[1:10:11] think you do great work. However, for this particular development, what we'd
[1:10:15] really like to encourage is uh moving in the direction of a conditional resoning.
[1:10:21] You know, I know you folks have been doing this for a long time, so you don't
[1:10:23] need me to explain it to you, but just in a nutshell, Michigan Zoning Enabling
[1:10:27] Act uh allows a township such as yourself to accept an application for a
[1:10:32] conditional resoning. And what that means is there's a a back and forth
[1:10:37] discussion between the developer and the municipality in regards to, okay, if
[1:10:41] we're going to give you this resoning, here's the conditions we want to see
[1:10:45] that you have to abide by, otherwise the zoning goes back to what it was before,
[1:10:49] essentially. Um and really, you know, in regards to the benefits for that,
[1:10:54] there's there's two main ones that I want to highlight here. Number one is
[1:10:57] the timing um to move forward with the development district in which I believe
[1:11:01] this would be a special uh exception, special land use. Um the all the
[1:11:06] processes that have to go in front of that, that's going to take months and
[1:11:09] months and months. Um time which frankly the developer would really rather not
[1:11:14] spend. We'd rather get jobs and uh commerce here sooner rather than later.
[1:11:19] Um, so timing is one and the other one is really flexibility. Um, in my
[1:11:25] experience, and I've been doing zoning and land use work for more than a decade
[1:11:30] now, conditional resonings are really the sweet spot when it comes to a
[1:11:33] development like this because we can offer you setbacks. Uh, we can offer you
[1:11:39] additional screening. we can offer you uh many of the items that that Greg just
[1:11:43] mentioned whereas typically you wouldn't be able to uh require a lot of those
[1:11:48] things under some different land use approval processes. So um in regards to
[1:11:53] this particular parcel and we've discussed this with uh Mr. Francis as
[1:11:57] well um it's it's I don't think I'm speaking out of term by saying it's his
[1:12:01] opinion that a conditional resoning is the more desirable uh aspect for this
[1:12:05] particular project and for this particular property. So, uh, we would
[1:12:09] really encourage you to to move in that direction. Um, happy to answer any
[1:12:14] questions, any comments. >> But, Mr. Counselor, isn't that your
[1:12:18] ball? It's in your court to come forward with that application.
[1:12:22] » Yes. And we can have that to you within a matter of days.
[1:12:25] » Correct. And then it's there is no negotiation. It's an up or down. Yes or
[1:12:29] no? So what we would be what ideally what we'd be doing is we'd want to have
[1:12:34] uh some discussions some of which have already been had to see what sort of
[1:12:39] conditions would make this palatable for the community right what would protect
[1:12:42] the best interests of of your residents >> but yes you're right under under state
[1:12:46] law you can't technically require us to have certain conditions but we're
[1:12:50] certainly not going to put something forward that we don't think is going to
[1:12:53] be acceptable to you >> right you have to offer we say yes or no
[1:12:57] » that's correct
[1:13:03] All right. Well, if there's no other questions, I appreciate the the board's
[1:13:06] time this evening. >> That's the board's pleasure.
[1:13:15] » Well, we were >> Could we expedite things? I mean, after
[1:13:19] you just said within days we can have something. Can we expedate it now to
[1:13:23] where we vote now once it's in? No. >> Green light? No. you would have to have
[1:13:27] a public hearing and advertise in mail. >> Right on.
[1:13:30] » Yeah. >> We don't even have a
[1:13:33] application for conditional recessive. Yeah.
[1:13:37] » So, just to recap what is being asked of us.
[1:13:41] I think there's three different things just for clarity. I question the master
[1:13:46] plan thing because we approved it. Did the township approve it?
[1:13:49] » Yes. >> And it did provide some guidance in
[1:13:51] regards to the development district in the PUD, but that's good to go. Correct.
[1:13:55] » Correct. So then it leaves us two items that being there is being a request from
[1:14:00] administration. Bill and I sat on a couple of the committees too about the
[1:14:04] issue about the development district which is mentioned in the in the master
[1:14:08] plan. However, it's not in the zoning code and moving forward with something
[1:14:13] to address that matter which is the item before us.
[1:14:16] » The definition. >> Yep. The definition which would which
[1:14:18] would require a zoning amendment process >> once we get the definition. Yes. But you
[1:14:25] have to have the you have to have the public hearing. And so that's one item
[1:14:29] to address. The second item to be addressed in regards to this partial in
[1:14:33] question based on the presentation and the correspondence from the township
[1:14:38] attorney, there is the request to do or we should not be surprised about a
[1:14:44] conditional reszoning being request of us.
[1:14:46] » Correct. >> But that has to come from the applicant,
[1:14:48] not from the township. >> Yes. And so as a result of that, that
[1:14:52] may or may not be at our next month's meeting because such application
[1:14:56] requires the public hearing and the notice. Correct.
[1:15:00] » Correct. >> And then it's up to us in regards to
[1:15:02] whatever they present to us if we like or not like or approve or not approve,
[1:15:07] but we are not negotiating >> at the public hearing.
[1:15:10] » At the public hearing. So, it's really an up or down asis or you just say
[1:15:16] or pass, you know, an approval and then that's
[1:15:21] similar to a zoning that would then be codified through the zoning process
[1:15:26] because it would be a reszoning because we would still have to follow that's
[1:15:29] going to the county >> metro planning.
[1:15:32] » Yeah. Metro planning county and to the township board at the final approval.
[1:15:35] » Metro planning today. >> Yeah. So, and I believe it's 14 days,
[1:15:40] correct? At minimum. So, in regards to Mr. Locer's comment about can we
[1:15:45] expedite I'm just saying there is minimum at to
[1:15:49] expedite this process and being a public body. All we could offer him or the
[1:15:53] applicant if it was approved was two meetings in one month.
[1:15:58] » We could >> that's
[1:15:59] » I don't know if that 60 days is required with a conditional use.
[1:16:04] » What do you mean 60 days? public hearing own metro planning back to township and
[1:16:10] then the township board approves. >> Oh, you're talking about the whole
[1:16:14] that's a Mr. Francis. But at a minimum, we're going to have to have a public
[1:16:17] hearing and and say yay or nay to a conditional resoning.
[1:16:20] » That's correct. >> Right. And it goes to the town board
[1:16:23] because it's an agreement. >> It's set for public. But you don't have
[1:16:27] » I don't have an application. And to my understanding, an application and
[1:16:31] payment triggers a a meeting or I mean triggers a public hearing anyways.
[1:16:36] » Correct. >> We don't do that.
[1:16:38] » Correct. >> You said the public hearing.
[1:16:41] » No, we haven't. No, the application does.
[1:16:46] » Yeah. >> The application sets it because they
[1:16:48] have to pay. >> They they apply,
[1:16:51] » right? >> We don't have they have the fee
[1:16:54] » once we get the application and fee, >> right?
[1:17:00] say the township board set. >> No, you guys, the clerk's office does
[1:17:04] that. They do the and it comes on our agenda and we hold the public hearing,
[1:17:10] » right? Okay. >> So, the item really before us tonight is
[1:17:15] whether this board wants to set a public hearing on the zoning amendment
[1:17:20] associated with the development district because that's associated with the
[1:17:23] zoning code.
[1:17:28] What's the pleasure? >> Not most of it.
[1:17:32] » You got to be a Philadelphia lawyer, don't you?
[1:17:35] » Well, I'm just trying to work >> the definition.
[1:17:38] » No, you need a definition. >> Definition.
[1:17:41] » That's where I'm But a conditional resoning is not going to require that
[1:17:44] definition. >> It is not at all
[1:17:46] » because it's currently zoned something commercial.
[1:17:49] » Correct. >> So,
[1:17:51] » he can come and ask for >> blue.
[1:17:54] » Correct. for a conditional resoning. >> Yes.
[1:17:58] » Yeah. >> I just want here to explain the
[1:18:02] reasoning for the time frame here. >> I understand.
[1:18:05] » But we need to get the ball rolling. >> Yeah.
[1:18:07] » Here. >> Two and a half years.
[1:18:10] » Well, yeah. I know. That's We're getting all getting older here.
[1:18:13] » Yeah. Amen. >> So, Mr. Tuttle in regards to I think the
[1:18:19] question being because it's on our agenda this item that's being brought
[1:18:23] before by Neo and the township attorney for development focused district. Do you
[1:18:29] want to have a does the board want to act on this by setting a public hearing?
[1:18:35] » I think we should. Yeah. >> Well, that's the question to set the
[1:18:38] public hearing and as a result it's a zoning amendment. So, it requires a
[1:18:42] public hearing. >> Y
[1:18:43] » them putting in the newspaper. We hold a public hearing. We say yay or nay with a
[1:18:47] recommendation. It goes to Metro >> and then it also goes to the township
[1:18:52] board and they have the final say. >> I think he's looking for you to make the
[1:18:55] motion. >> I think Mr. Tuttle can do this.
[1:18:59] » I'm very confident. >> Killing me here.
[1:19:00] » I'm very confident. >> See, my face is now beat red. Thank you.
[1:19:05] » Your head. >> You're fine. It's warm out.
[1:19:08] » Oh god. >> Planning commission meeting 30 days from
[1:19:12] now. >> Yes.
[1:19:13] » Yes. So
[1:19:15] » because you don't have an election, correct madam clerk?
[1:19:19] » Okay. >> How many day notice do you have to have
[1:19:21] for uh prudence? What is it? >> 14 days.
[1:19:25] » Is it 14 business days? >> May 26.
[1:19:30] » That's our next meeting. >> Correct.
[1:19:34] » Fine. move to schedule a public hearing to address
[1:19:39] the development focus district definition and zoning amendment at the
[1:19:44] next planning commission meeting scheduled for May 26, 2026.
[1:19:48] » Mr. Chair, here's a question. You wanted >> if we only need 14 days.
[1:19:53] » How many people do we need for a quorum to hold a meeting?
[1:19:56] » Four. >> I mean, we've done this before.
[1:20:01] Can we do a meeting in 14 days to get these guys rolling? I'll show up to a
[1:20:06] meeting. >> I will I would expect everybody to show
[1:20:09] up. >> Right. Mr. Locer, it's two different
[1:20:12] things. >> Okay.
[1:20:13] » He wants a reconditioning. >> Yeah.
[1:20:15] » They have to make that request. >> Okay.
[1:20:19] » And he said it could take what? >> Within a week.
[1:20:22] » Yeah. We can have it by end of week. We were just wanted to introduce and make
[1:20:25] sure >> Yeah. We were
[1:20:28] being friendly and doing it the right way before we sent it.
[1:20:30] » Well, I appreciate that. >> So, we have faces to names when it's on
[1:20:33] the agenda. >> Sure. Please.
[1:20:37] » What? >> On video, too.
[1:20:38] » Oh, okay. >> Okay.
[1:20:42] » Made a motion. >> I made the motion.
[1:20:44] » Need a second. >> I second it.
[1:20:46] » All those in favor signify by saying I. >> I. I.
[1:20:50] » I. Oppose. Same sign. >> Carries. Now the ball's in your court.
[1:20:57] I guess my other comment is someone going to address the question of Neil's
[1:21:00] by asking either Metro or Mr. Francis on both on both items being they do review
[1:21:06] zoning amendment. I believe they do because I think we've done this in the
[1:21:09] past. But then in regard to are they because we're general law are they going
[1:21:13] to review conditional resoning requests even though it's you know specific to us
[1:21:19] but it is still considered a zoning amendment. I I I think that'll be proper
[1:21:24] » and and seeing how it we have the uh
[1:21:30] our uh everything's been approved already.
[1:21:33] » Master plan >> master planning is it going to be
[1:21:37] » it fits. >> Okay.
[1:21:43] » Are you ready? >> Did you vote on
[1:21:47] » No, we didn't vote on the I >> We didn't We didn't vote. No, no,
[1:21:51] » I thought was we didn't know. >> Just
[1:21:55] » All those in favor. >> We did say that.
[1:21:57] » We did do that. >> We did.
[1:21:59] » No, we did. >> Let's do it again. If he doesn't
[1:22:01] remember, let's do it again. >> All those in favor of the motion signify
[1:22:05] by saying I >> I
[1:22:06] » oppose. Same sign. >> Thank you.
[1:22:08] » There you go. >> Thank you.
[1:22:10] » We did it once. >> Yeah.
[1:22:12] » You at least deny. >> All right. Okay.
[1:22:17] Thank you, gentlemen. >> Thank you.
[1:22:20] Okay, >> we'll maybe see you next month
[1:22:23] » or before. >> We will.
[1:22:24] » Okay, B, right?
[1:22:29] » Y >> Wessle Lepier Road Pond and Sand
[1:22:32] Removal. >> There you go. I think Mr. Gillette's
[1:22:34] here. >> Steve Wessel.
[1:22:37] » Mr. Wessel's here, too, >> cuz he's Yeah.
[1:22:45] » What do you need, sir? >> I don't know. I'm not not sure why I'm
[1:22:49] here. I think you're just looking for an update.
[1:22:52] » I think so.
[1:22:56] » The update is your address. >> Miss Rubel needs your name and address.
[1:23:01] » Steven.
[1:23:06] » Okay.
[1:23:10] » The update is um we uh hadn't done much work over the winter. It was a bad
[1:23:16] winter. So, uh, but soon as the frost laws were lifted, we've been out there
[1:23:20] every day, uh, working and, uh, we're about halfway done.
[1:23:27] So, our minutes from the last time we met, which was not last month, but it
[1:23:31] was what was um, because we just approved these
[1:23:36] meeting minutes. So, in February, we extended it until August 2026 for
[1:23:42] you. >> Okay.
[1:23:44] » And I want to make sure that this is correct. It says Lepier Road, Mr.
[1:23:47] Washington's property. That is yours, correct?
[1:23:49] » Uh, yeah, >> it should say Wessle then.
[1:23:52] » Yeah, it should say Wessle. Yeah. >> Um, we'll need to make a note of that
[1:23:55] before we leave today. This isn't right. Are you going to need more time than
[1:24:00] than um August? And if so, are you going to come back next month then? Do you
[1:24:04] want to come back next month? >> Yeah, we my contractor says we might
[1:24:10] need more time. So, >> Mr. Gilencia,
[1:24:14] » would you like me to walk up, please?
[1:24:20] » Would you give your name, please? >> Good afternoon. Matt Gillette. Uh,
[1:24:25] address is 4259 Gravity Road, Clyde. As far as completion date, uh, we got
[1:24:32] roughly, let's say, 35,000 yards left. We hauled
[1:24:37] out of the 45,000 yards, roughly about 7,000 yards so far.
[1:24:42] uh in order to keep peace within the community and keep truck traffic down.
[1:24:46] We don't want to pound it with trucks. So, we're trying to extend it out a
[1:24:49] little bit further. That way, it's a little more gentle to the public and our
[1:24:53] neighboring properties. >> So, realistically, we're probably
[1:24:57] looking at the end of the year to finish this up. So, a tenative completion date
[1:25:02] of 123126.
[1:25:06] » When does frost laws come on? Isn't that November?
[1:25:08] » Frost laws come on during the spring. >> Oh, spring. Okay. All right.
[1:25:18] » Mud mudmat was added. >> Correct. And I got pictures of that
[1:25:21] timestamped. So, uh, Neil reached out and we had a sit down meeting Friday and
[1:25:27] informed us that he wanted a mudmat. Monday, we put a mud mat in. Um, got
[1:25:31] pitch approved. So, that's ready to go. >> Would there be hardship if there was a
[1:25:36] motion to October? I just know practicality for us. we because of the
[1:25:40] holidays in November and December, we may not have a meeting and it may you
[1:25:43] know expire without us being able to meet just depending on you know how
[1:25:48] November with Thanksgiving in our schedule and so would there be a
[1:25:53] hardship if we saw you then in October instead and then if you need the
[1:25:57] additional time then we go with that. >> Yeah, we could always review at October
[1:26:00] and you know we'll have a better understanding midway through the year
[1:26:03] too if we need extended time based on what projects we have etc. So I'm just
[1:26:09] thinking of feasibility because sometimes we don't meet those two months
[1:26:12] because of how the holiday meets or falls.
[1:26:21] » any other questions? >> Yeah. Is there anything else that we
[1:26:26] need to address in regards to conditions that aren't being met or just
[1:26:31] items? >> The conditions were met.
[1:26:36] the county satisfied.
[1:26:40] » So there isn't if we enough gr time would be granted to address the slopes
[1:26:45] that need to be corrected. And this um I guess that was an item last time that we
[1:26:51] talked about this because it's not finished that we're not addressing the
[1:26:54] slopes or >> it's too wet to do the slopes.
[1:26:57] » Yeah. So the process of digging this out because the water table is high. We're
[1:27:00] digging out with the water in there. when we're close to completion of size,
[1:27:04] we're going to drain the pond down and then put a dozer in the bottom to clean
[1:27:08] up the side slopes and make it, >> you know, compliant in that way. But
[1:27:12] » I believe we're leaving the slopes a little more gentle, but they they look a
[1:27:16] little jagged just because we're digging underwater. It's hard to see.
[1:27:20] » Okay. >> Did you have a question?
[1:27:22] » What are your hours of operation? >> Mon Monday through Friday, 7 to 7
[1:27:33] Okay. Um, well, right now, and I I spoke to Neil about this, we're actually
[1:27:38] hauling sand out of there to take to our shop, which is a couple of addresses
[1:27:42] down to the west. >> Uh, so we can do early and late loading.
[1:27:46] Um, >> uh, well, that property we're loading as
[1:27:51] early as 5:30, 5 in the morning, and sometimes 8 o'clock at night,
[1:27:56] » which is that that's a totally separate property. That's in Clyde Township, too.
[1:28:00] were um >> street
[1:28:04] » industrial there that he'd be industrial. So I didn't see anything in
[1:28:08] the in there for time time constraints but could be wrong if if I have
[1:28:16] supplied
[1:28:21] » again >> any other questions or comments
[1:28:26] » I'll accept a motion >> but it's miss it's Wessel it's not
[1:28:30] Washington correct >> correct
[1:28:32] » yep we got it I just want See, cuz that's right here.
[1:28:40] » And we're doing this asleep here. Okay. >> So, you're you're only trucking company
[1:28:45] in and out of there. >> Uh there's occasional other trucks that
[1:28:49] we bring in, but we don't usually bring any more than five trucks, you know,
[1:28:52] five trucks running multiple rounds a day. You're usually running two, maybe
[1:28:57] three rounds out of there a day. So, >> and a class A.
[1:29:00] » Correct. Yep. And I got an email from Andrew McNiff stating that we don't need
[1:29:04] a road bond or a special use permit for the road, stating that that is only for
[1:29:10] oversize overwidth uses and that because we're hauling legal loads out of the
[1:29:14] property that he doesn't require us to have a bond or use for that specific
[1:29:19] road because it's class A. >> And then help us out. That's the road
[1:29:22] commission, correct? >> That is the road commission. Yes.
[1:29:25] » I have that same >> Y just to let everybody else know. I was
[1:29:29] just by there today and the road's pretty clean. So, it does you can't tell
[1:29:33] that there's trucks going in and out of there. So, pretty clean.
[1:29:37] » So, we uh >> our our yard loader that we use to load
[1:29:40] out of that property in our yard. We have a pickup broom that we use. So,
[1:29:45] daily we're sweeping up on the road and then, you know, unlike a lot of rooms,
[1:29:50] we're not just kicking it off to the shoulder. We're actually kicking or
[1:29:52] picking it up then bringing it back to our shop to dispose of.
[1:29:57] » Okay. I'll move to extend the pond and soil
[1:30:02] removal permit for Lepier Road, Mr. Wessel's property to September
[1:30:09] 28th, 2026
[1:30:13] from August 2026.
[1:30:20] » Second. >> I have a motion
[1:30:22] » and a second. >> All those in favor signify by saying I.
[1:30:27] I >> oppos same sign.
[1:30:30] » Car >> just for clarification to meet with this
[1:30:35] about an extension or if we need to do an update. What date will that be or
[1:30:38] will you >> That is the 26th.
[1:30:40] » That'll be the 26th. >> That's our regular meeting date.
[1:30:43] » All right. And then uh one last thing on that too. We did amend the um soil
[1:30:48] removal permit to add me as an interested party or uh interested party
[1:30:52] so that my contact is on there as well. Um okay. I know you're out of town often
[1:30:56] working and like I said our business our operations is two doors down so we're
[1:31:01] there every day. >> Okay.
[1:31:03] » Okay. >> Thank you, Mr. Jul.
[1:31:05] » Thank you.
[1:31:09] » Okay. We have uh C Spartanville Baptist building update.
[1:31:32] Okay, as an update, we are continuing to discuss with the city engineer the types
[1:31:37] of soils that are on the site >> and possibly getting an infiltration
[1:31:41] test to prove that the pond that is designed is adequate.
[1:31:46] » So, I here I have Do you got foot puddings in the ground?
[1:31:49] » No. >> No footings yet?
[1:31:51] » No. There is a permit. >> Yeah.
[1:31:54] » 11 of 2025 was issued to get them started. They haven't done anything. So,
[1:32:02] just an update for you. >> Okay.
[1:32:05] » So, hopefully this be can be addressed before the November expiration for this
[1:32:11] project. And if not, we'll see you in Nove, you know, November or earlier
[1:32:15] because I think we've extended this out of courtesy for a while now.
[1:32:20] » We have. Yes. >> So I believe it's November is when the
[1:32:24] current expiration quote unquote would occur for the plans
[1:32:28] » of the footing permit. >> Yeah. The footing permit. But it's kind
[1:32:30] of tied to We did that with the site plane, too. We have an incomplete site
[1:32:34] plan. >> Correct.
[1:32:37] » Third party. >> Yeah. So we'll see you November or maybe
[1:32:41] earlier than November if this matter is addressed.
[1:32:44] » Yes. >> Got it.
[1:32:46] » Okay. >> Thank you.
[1:32:50] Okay. >> Pastor got all dressed up and didn't say
[1:32:54] a word. >> Does he?
[1:32:59] » Do you feel okay about that or >> me?
[1:33:02] » Yeah. That you don't have to say anything.
[1:33:04] » No. Um, >> now if you talk, you got to go to the
[1:33:08] you got to go to the mic then. >> We drug you out here.
[1:33:17] » That's the engineer. >> Yes. So, Abe Braun, 5240 Griswald Road,
[1:33:23] » um Kimble, Michigan. So, so yeah, basically
[1:33:27] that's who I've been talking to and last updates he's been telling me is seemed
[1:33:32] like largely um he told me the parking lot and
[1:33:36] retention pond were settled with Tetrate Tech and that the last thing that we
[1:33:40] were waiting on was small stuff, basically semantic. So, I asked him,
[1:33:43] "So, will we be good to go tonight?" He said, "No."
[1:33:46] » No. And so, and then also the reason we've not started with our footings is
[1:33:50] our contractor wanted to get the plants more done before we're digging and
[1:33:54] putting them in and then they're sitting there. So, um,
[1:33:57] » yeah, >> we just don't want to be the hold up.
[1:34:00] » Sure. No, that's the thing. It doesn't I don't think it's you guys. It seems like
[1:34:03] it's our engineer with the other one and and I'm I've sought counsel from
[1:34:08] contractors about scratching our engineer and starting
[1:34:12] over, but are we too close to do that? Like, like what's the smart play here?
[1:34:15] So, it seems like we're kind of stuck waiting a little bit.
[1:34:19] » Um, so yeah, I don't think it's you guys at all.
[1:34:22] » So, at the end of the day, if we don't we don't have to see you. We just need
[1:34:26] the letters that say the the numbers are correct at a minimum. We don't have to
[1:34:32] see you, but we extended it until November kind of out of courtesy as
[1:34:36] said. >> No, I appreciate it. And that's the
[1:34:37] thing, too. I've not seen the corresponding emails. I'm just hearing
[1:34:40] what he's telling me. So, I don't really >> know exactly where we're at. So, it's a
[1:34:44] little complicated >> because we went back and forth and we
[1:34:47] have two letters from two different third parties that said the same thing.
[1:34:50] » Sure. No, I I understand and from what I've seen and from the people I know who
[1:34:54] are contractors who have looked at them, they had questions as well. Like, so
[1:34:58] I've seen that. >> So,
[1:35:01] » thank you guys. >> Thank you.
[1:35:02] » Thank you. >> We're not talking about that, are we?
[1:35:03] » Huh? >> Why? That's not on the agenda, Mr.
[1:35:06] Chair. >> Oh, well, it's coming up.
[1:35:08] » Okay. I have uh No. audience
[1:35:13] participation. Do we have anybody that wishes to
[1:35:17] participate? No,
[1:35:20] » we just appreciate that there's people here.
[1:35:22] » I really do. >> I've sat here for years and there's not
[1:35:25] been people here. >> See what's going on Taylor Road. I
[1:35:30] missed that beginning. >> Yes. But you got to come up here and
[1:35:34] » Yeah. need your name and address. >> My name is Harry Mowski. 6236 Winch
[1:35:39] Road. Um, you guys allowed that compost to go right next to me on on the one
[1:35:45] side of the property and then now on the other side you guys are thinking of
[1:35:49] putting a sand pit. >> I'll comment about I know where he's
[1:35:52] you're at. >> I'm right dead. I'm right alongside of
[1:35:55] Trello's property and now he's going to sandwich me in where we're smelling the
[1:36:00] compost and I've been up here different times and they said the permit's going
[1:36:04] to expire and apparently it just kept extending. I I've talked to Rob
[1:36:10] Yuzakowski for that >> different times and this thing just
[1:36:13] keeps going and going and going. >> But it's the compost. I don't understand
[1:36:17] that statement. >> The leaves that come in uh at Fledge
[1:36:23] Trolls. >> Okay.
[1:36:25] » Yes. >> And the state permit from Eagle.
[1:36:30] » Okay. And it was supposed to be short-term according to the people at
[1:36:34] the township here and then it just keeps extending.
[1:36:38] » I've been here 38 years and I never said short term.
[1:36:42] » Okay. Well, the people that I talked to here, um Rob Yuzakowski was one of them
[1:36:46] and then some of >> I'm the zoning and planning.
[1:36:50] » Okay. >> I'm not talking on behalf of the chair,
[1:36:52] but we're the two oldest ones here. >> I've never
[1:36:55] » No, that hasn't come to us. >> The to the
[1:36:58] » the composting has not. >> No.
[1:37:00] » No. So you don't even know they're composting back there. There's
[1:37:03] » multiple trucks going in there. Semi-truckss coming in there all the
[1:37:06] time. >> That way for
[1:37:08] 10 years. >> Yes.
[1:37:10] » And I complained at that time and I filled out the forms and did everything.
[1:37:13] Then >> Eagle made them do is slope and there
[1:37:17] was an area where they ruined the wetlands. They had to
[1:37:23] mitigate the wetlands. Almost five acres. Yes.
[1:37:28] They just cleared out. >> Is this a state state? He's got a state
[1:37:32] permit to do the composting. >> Yes.
[1:37:35] » So that's got nothing to do with us. >> Eagles, I was out there with 13
[1:37:39] different people from the state of Michigan.
[1:37:42] » There's a problem. >> No.
[1:37:44] » Yeah. 13 different people. >> Yeah.
[1:37:48] And then if he's going to do this sand pit, like when he drained the pond for
[1:37:54] the composting to get the sand out of there, all of our ponds drop
[1:37:58] dramatically all in the whole area because it's all sand and it just all
[1:38:02] levels out. If he's going to do the same thing on the other side of us, it's
[1:38:05] going to do the exactly the same thing. That that water is going to drop
[1:38:09] dramatically again. And I don't know where he's going to get rid of that
[1:38:11] water. >> I think he's only going what, one ft. 20
[1:38:16] ft deep.
[1:38:21] » That's your neighbor. >> What's that?
[1:38:23] » That's your neighbor. >> How are you?
[1:38:29] » You got approval of the big pond 1.4 acres.
[1:38:34] » Mhm. >> Yep.
[1:38:37] » Hours of operation >> 77
[1:38:41] » for one year. >> For one year. And he come back if need
[1:38:43] be. again. How long was the composting? Was
[1:38:48] that a one-year also? And now into it. >> That's a non-ending
[1:38:54] contract for the composting. >> That is a state permit.
[1:39:00] » You probably have to go ask the state about that permit.
[1:39:06] » Yeah, >> because we don't handle states.
[1:39:10] So does the state permit overrun our township ordinance
[1:39:15] » being from another county >> which they are
[1:39:20] » they are and they're >> I have documentation
[1:39:23] » and they're selling it to Michigan Pete begging the black dirt as agricultural
[1:39:31] to sell the Michigan they beg it and sell it to black dirt
[1:39:38] » and that has affected to my well quality and health because that stuff is blown
[1:39:43] around for. Um, >> Mr. Chair, if I may speak, I think what
[1:39:49] he's asking us is he lives in our township and what are we going to do
[1:39:51] about it? >> Yeah.
[1:39:54] » No, he's he's >> they have a state permit. So there's
[1:39:58] » and he's disgruntled and he wants us to communicate with the state for him
[1:40:02] because we represent him. >> We have andowski
[1:40:05] and myself been out there. They line they line the tops when they turn it,
[1:40:10] that's when you get the stain. Are you with Vincent Heating and
[1:40:15] Plumbing or >> I used to be. Yeah.
[1:40:20] » And it was, you know, the first year was horrible. I mean, we had billions of
[1:40:24] flies. I mean, it was >> And doesn't Marty keep in contact with
[1:40:28] you? >> Marty does. Yeah.
[1:40:29] » Okay. >> And um
[1:40:32] but anyway, just that's why I wasn't sure where the property is located. Is
[1:40:36] that the one right next to my property or is that the one where
[1:40:40] » closer to the expressway? >> It's behind Mr.
[1:40:44] » It's Zobels. >> I'm sorry. Where's that?
[1:40:48] » I'm sorry. I still didn't hear you. >> I'm Taylor.
[1:40:51] » Y
[1:40:54] » Oh, Zobel Farm. So, you guys going to be digging over there?
[1:40:56] » Yes, sir. >> Yeah. Okay.
[1:41:02] » Right. South of the exit or entrance. All right.
[1:41:06] » Yes. >> So, are they making that are they how
[1:41:09] much sand are they hauling out of there? Cuz that's I haven't heard anything of
[1:41:12] that until, you know, it came out public.
[1:41:15] » There was a uh you got a letter stating that there was a public hearing,
[1:41:20] » correct? That's why I'm here today. >> Yeah. And it was in a newspaper. So,
[1:41:24] that's only we don't call people tell them there's a meeting.
[1:41:28] That's why we have a public hearing. >> Yep. I guess I just um How how big is
[1:41:33] the pond going to be? I I don't know anything. I don't know what's
[1:41:36] » the application was 1.4 acres 20t deep.
[1:41:40] » Okay. So, it's just a normal pond then. Gotcha. Right.
[1:41:43] » All right. I was under the assumption that Trello has been asking me if he
[1:41:47] could get on my property and dig. He's wants that sand bad. So, that's why I
[1:41:53] thought he jumped over there and was going to do the same thing. You know,
[1:41:55] try to dig on each side, but that's just a pond. I don't have a problem with
[1:41:58] that. >> So,
[1:41:59] » so can I ask I just flinch bog? Which portion? Flinchbog. Um, next to DNM.
[1:42:07] That part of Flinch or No, wait a minute. That's bar.
[1:42:10] » If you go down Taylor office 69, you would turn left.
[1:42:13] » I'm behind >> towards the golf course.
[1:42:16] » You are going towards the golf course. Yes.
[1:42:17] » Where his trucks are. You're on the other. Okay.
[1:42:20] » Yep. I'm on the >> You're not on the populated side of Fl.
[1:42:24] » That's why I bought there. I wanted to be by myself in the
[1:42:26] » I understand where you're at now. It just took me a minute. It's a horrible
[1:42:28] thing >> because then the other side of Flinch
[1:42:30] Bog does the turnaround and turns into bug. Right.
[1:42:33] » Operation. >> Okay.
[1:42:38] » That's an old name. >> Yeah.
[1:42:41] » That property. >> Yeah.
[1:42:42] » He was doing the same thing then. >> Yeah. Atti met with me. Um he came over
[1:42:48] to the house. He talked to me and showed me the plans that he was going to do and
[1:42:50] how far he was going to go and the time frame he was going to go and then um Mr.
[1:42:55] Trello ended up buying that >> continue that same operation.
[1:43:00] » Okay. So anyway, I just wasn't sure what the pond
[1:43:04] was and I in my mind I'm thinking it's grander than what it was. So I'm
[1:43:08] thinking, oh boy, I'm going to be in between a sand pit and
[1:43:13] » correct. >> So
[1:43:14] » anything under two? >> Yes. Anything under two acres is not
[1:43:19] state reviewed. >> Okay.
[1:43:21] » Been doing this for a while and that is a loophole. I'm just going to call it
[1:43:25] what it is. >> I was picturing something like on
[1:43:27] Abbottzford Road there. You know the that pit that they dug?
[1:43:30] » Oh, >> on there which is huge. Not Abbottzford
[1:43:33] and Rice. >> The old tree farm. Are you talking about
[1:43:36] that? >> Yeah. Yeah.
[1:43:38] » Tree farm. That that's what I was picturing out by me. So,
[1:43:40] » no no not no >> no good. I hope you have beautiful.
[1:43:46] » No. >> All right. Thank you for listening.
[1:43:49] » Make you feel a little better. >> All right.
[1:43:51] » Uh, anybody else?
[1:43:56] Just be quick. >> Yes.
[1:43:58] » Education. It would be easier that >> Yeah.
[1:44:02] » Yeah. The rest. So, um we're currently renting our operations base and looking
[1:44:09] for a place to reside. We're currently in light light industrial area which is
[1:44:13] implied. Um we've talked to a couple people in Kimble that have some
[1:44:18] properties. One of them is Perry Westbrook that has that property on
[1:44:21] Watams. But >> watoms and what?
[1:44:25] » Between I want to say it's between Griswald and Ravenswood on the east
[1:44:30] side. It's the industrial building blue. It's got a bunch of scrap metal out
[1:44:34] front. >> Um little bit of a
[1:44:38] » They had all the construction
[1:44:42] the building's way out back. >> Oh,
[1:44:46] but it's not. >> What's that? Okay.
[1:44:48] » Between >> uh right next to I can't remember what
[1:44:52] the name of the church is, but there's a church right next
[1:44:56] company. >> Oh, okay.
[1:44:57] » Yep. My question to you guys is the rumors I'm hearing and I don't know
[1:45:01] exactly how to look up one the zoning and two where to access you know I guess
[1:45:07] the allow what we're allowed to do in certain zoning areas but
[1:45:12] one how can I find where what that zoning is and two if it's zoned let's
[1:45:18] say commercial is there an option to be able to ask for reszoning to zone it
[1:45:23] into something different where one new owners can clean up the property make it
[1:45:27] useable But also, you know, as an excing company, we do screening, we do
[1:45:31] crushing. So, we'd have to have a use to allow that. I'm not familiar with how
[1:45:36] that works. >> It's not light because the light area
[1:45:39] there on Watams is more ne more closer to the railroad where the I don't know
[1:45:44] what it is now, but it used to be the hardware store or the lumber yard and
[1:45:48] area and that's more that's the light industrial area right there.
[1:45:51] » I think it's I think it's uh agricultural.
[1:45:54] » It's agricultural. He used to call he had a sign up there at one time said
[1:45:58] Westbrook Farms. >> Gotcha. All right. So, as far as special
[1:46:03] uses out there, it's probably unlikely to get some sort of a screening
[1:46:07] operation approved or whatnot. I mean, I guess where where do I find
[1:46:13] » the regulations? Is that correct? >> The zoning ordinance. Okay.
[1:46:16] » For soil. No. >> Uh, no. For property zoning and then
[1:46:21] allowed uses. >> Come see me tomorrow. Okay. All right,
[1:46:25] that's all I have. Thank you guys. >> That's early, isn't it? 8:30.
[1:46:33] » Oh, I thought it was 8:30. >> Oh, that must be
[1:46:38] » okay.
[1:46:41] » Anybody else? There was no ZBA. >> Wait a minute. Mr. Z.
[1:46:46] » Yes. >> Okay.
[1:46:52] » That's his plan. asked for a batch. >> Oh.
[1:46:57] » So anyways, it's right here.
[1:47:05] » Yeah, with the drawing of the You got to put the pond in there.
[1:47:07] » It is. >> Oh,
[1:47:09] » right there. Okay. >> Okay.
[1:47:12] » Yeah, we didn't get it. So, >> yeah. I'm
[1:47:14] » just saying what we got was this.
[1:47:19] » Put it on here. >> It doesn't matter to us. You just need
[1:47:22] to draw something with with the pond on it and get it to me tomorrow.
[1:47:26] » Okay. >> Yep. There you go.
[1:47:28] » To put with the application. >> Okay.
[1:47:30] » Yeah.
[1:47:34] » Because Yeah. The one that we It took us a minute. It wasn't all yours.
[1:47:39] » It took us >> Well, the township got approved for some
[1:47:41] uh special granting through Lisa Mlan's office. That's kind of a big deal. Okay.
[1:47:45] » Um we're working on that. But uh we have
[1:47:50] plans for the broad property down by uh at the bottom of Milwauke.
[1:47:56] » Mhm. >> Decker property.
[1:47:58] » Is that what it's called? >> Harold Decker owned it.
[1:48:01] » Okay. So um we're still waiting on grants to come through the community
[1:48:07] foundations to acquire it from them. Um I think it's going to be a good project.
[1:48:14] So, you have a a kayak >> be a canoe uh landing, right?
[1:48:18] » We're getting a kayak launch gifted to us from the county. So, that'll be fun.
[1:48:24] Um yeah, it's exciting. Um I put together
[1:48:28] an ordinance to uh I'm looking at the property at the
[1:48:33] corner of Grizzled and Watams and they want to put those eight duplexes and I I
[1:48:39] think having that many driveways that close to a busy
[1:48:44] intersection will be an issue. So, I drafted an ordinance to protect the
[1:48:49] residents for safety issues. Um Rob pushed it through the county road
[1:48:55] commission and we're seeing where it can go because I want to make sure that
[1:48:59] we're not we don't have people having to pull out of their driveway and cause an
[1:49:04] accident. So, it's going to be a big project if
[1:49:09] there's that many houses there. We don't need uh it's going to be a subdivision.
[1:49:13] There should be access from within, not 30 driveways on a corner. So,
[1:49:20] yeah, that's what I've got. >> Okay.
[1:49:24] Anybody else with anything? I have one. I was talked to somebody mentioned it
[1:49:31] again today to me. Chickens.
[1:49:36] » They're everywhere. >> Broad eggs.
[1:49:41] » Not just broad eggs. I know, but the lady sees them
[1:49:45] » complaining on broadex. It's on. >> I know. But I mean, we have an ordinance
[1:49:52] here and >> we do
[1:49:57] » cuz I know what in regards to livestock.
[1:50:03] » I know we had to deal with horses off of Burma or Harvey. Oh, it's Harvey, wasn't
[1:50:07] it? Yes. >> And flint ball, too.
[1:50:19] So the motion last time we brought this up is to leave
[1:50:26] » okay so I guess the one question is just as if minimum
[1:50:32] » how many chickens does she have you know >> doesn't matter just talking chickens
[1:50:38] » I eat chickens >> but She have roosters.
[1:50:41] » No, >> but there is someone complaining.
[1:50:44] » Yeah. >> Why can't we talk her into building a
[1:50:48] chicken trailer? >> No. It's actually a beautiful best
[1:50:51] looking little chicken house I ever seen. I got pictures. Absolutely.
[1:50:57] » I don't need to like cut the chair off. However, he sits on the ZBA and this I
[1:51:02] read this ordinance. This is a ZBA issue. So, it says all such I'm going to
[1:51:08] just say poultry. Mhm. >> She'll also be prohibited in any area of
[1:51:13] the township which is platted lands less than
[1:51:18] » they have to have three acres which broadex doesn't and further provide a
[1:51:21] minimum of 1acre or land shall be devoted but it says the determination of
[1:51:25] the ZBA established under the statute of this ordinance shall in the absence of
[1:51:28] fraud be conclusive on the question of whether such are obnoxious
[1:51:33] » and also caged. >> That doesn't say that. So it sounds like
[1:51:37] to me it's that's a ZBA question.
[1:51:41] Good. >> Mr. Chair, I got one more thing
[1:51:44] » that sounds because Broadex is platted, correct? I think Broadex is platted and
[1:51:49] nothing over there is more than one acre.
[1:52:00] But you have what? >> 300.
[1:52:03] » But does she have more than three acres? >> Those are those are
[1:52:08] » those are the small. I just know that was the issue at Harvey.
[1:52:11] » 300 >> because that lady with the horses had
[1:52:13] acreage. >> She had one he had 300 chickens.
[1:52:17] » Good lord. >> Key West.
[1:52:23] » Gary's got a question. Yes. >> I wanted to share one more thing. With
[1:52:26] the assistance of our county commissioner Joy Terrell, we proposed a
[1:52:29] moratorum. You know, the big talk right now is data centers. So, Joy helped us
[1:52:34] draft a moratorum to protect the township and keep us in check to protect
[1:52:39] the township from uh data centers. So, >> and not that
[1:52:45] supply data center, but just in case it happens. So, appreciate Joy. So,
[1:52:50] » so >> I know I know
[1:52:53] » what is your recommendation on the chickens there?
[1:52:56] » Well, that's what the ordinance says. If it's obnoxious or noise, that's
[1:52:58] determined by the ZBA. >> We're going to take it to ZBA and then
[1:53:02] we'll we'll put it in and we'll make the >> enforcement
[1:53:06] department. The Harvey issue was because we lost I shouldn't say lost, but they
[1:53:11] even when USDA came out is because that area was planted. However, she had more
[1:53:16] than three acres. Correct. over there in Harvey
[1:53:20] » in BRex. They don't have more than three acres over there.
[1:53:23] » No.
[1:53:27] » That one I don't remember. I just remember the Harvey one
[1:53:30] » cuz it was hard >> flinch ball. They had one and that poor
[1:53:32] horse was up to his belly. >> Are you talking about flinch off the
[1:53:35] bottom? >> Okay, got it.
[1:53:39] » So >> I got it.
[1:53:41] » Nobody said nothing. >> I'll move to adjourn at 7:55.
[1:53:44] » There you go. >> I second.
[1:53:46] » All in favor? I
[1:53:50] » can we uh can we uh any residents complain about chickens? Can we barter
[1:53:56] with them and say, "Hey, >> give these people eggs and maybe they'll
[1:53:59] go." >> Mr. Tunnel, I apologize. Mr. Milton,
[1:54:02] » is that a potential like, "Hey, don't complain and we'll give you eggs."
[1:54:06] » Not us. But >> and he sat over here. So that's why it
[1:54:09] just triggered. I was just You were Mr. Milk through Oh, wait a minute.
[1:54:14] » The other thing we forgot. Shoot. She needs to change the meeting minutes
[1:54:18] so it doesn't say Washington. >> We vote to adjourn.
[1:54:20] » We did. >> We did.
[1:54:31] » Good to have you back. >> Do we go to Is this the one that we went
[1:54:34] to before still? >> Yeah, but it's always the same.
[1:54:38] » I think
[1:54:43] » I'd like to see him get something different. Is this Are you sure it's the
[1:54:46] same? >> What time is this one? I didn't even see
[1:54:50] it. It is. It says 4 p.m. So, it's 5 to 8.
[1:55:02] » All right, Mr. To. >> Well, we got to call a meeting on the
[1:55:04] zoning land. >> Do you want does you guys want these?
[1:55:07] » Cuz this guy, >> he read too far.
[1:55:12] So, Becky, I totally forgot, but Mr. Washington needs to be changed to Mr.
[1:55:16] Wessle. >> Okay.
[1:55:19] » And then this is yours.
[1:55:23] » Can you get the book back? >> We got to talk that one. Put
[1:55:34] » If we want to go to this, we just emailed it to Michelle
[1:55:37] » or you. Okay.
[1:55:42] Yeah. >> And these people that are
[1:55:53] » Who's the one with chickens over by When you say Griswald Road is
[1:56:04] » Oh, so you're further down. Okay. Okay. >> In that area. Yeah.
[1:56:08] » Okay. because I know there's a couple over by.
[1:56:12] » Yeah, I was gonna say yes.
[1:56:22] » Well, it's the dude that was here earlier
[1:56:24] » and I seriously feel that I'm in Key West when I drive down
[1:56:31] and I I hate chickens. I do. It's the marijuana is the marijuana.
[1:56:44] I signed for the training. I put
[1:57:10] And you're doing still
[1:57:15] » is there not in August.
[1:57:23] That's what threw us
[1:57:32] Okay, just let me figure it out.
[1:58:32] That's how we move things along.
[1:58:40] It was going to gracise.
[1:59:12] Yes. Anyway,
[1:59:42] 15 minutes.
[1:59:51] That's what we do.
