Um this property was locked down for a
[53:19]
couple decades through lawsuits and

the last five years, our uh firm has
been chasing this and right outside the
[53:31]
lean, which I think, you know,
eliminated from this property in May of
[53:34]
24. Um, we were able to put this under
contract last year in July. We closed in
[53:39]
August on this property. Um, our
intention has always been the same. um
[53:46]
bring a commerce park to the I 94 I69
corridor. You know, something that could
[53:52]
interact with the bridge traffic,
continue to attract business and jobs
[53:57]
for the region. Um most importantly
noted, not a data center under any
[54:03]
circumstances. Um so these are
industrial buildings. They're modern. Um
[54:08]
they're 32 foot clear each and every one
of them, maybe a little bit greater. Um,
[54:14]
this is the design that, you know, you
guys are uniquely uh positioned for in
[54:19]
Kimble Township, having rail that serves
this with Canadian National and access
[54:24]
to a double uh stack tunnel going into
win going into Sarnia
[54:28]
» and the Blue Water Bridge, which your
rates beat the crap out of the
[54:31]
Ambassador Bridge south of us and even
now the Gordy How coming online.
[54:35]
» So, there's been an increase in truck
traffic over the past two years the
[54:38]
Gordi's been being built. It's been
rerouted to Blue Water. I was just in
[54:42]
Canada over the weekend and there was a
backup for probably seven miles of
[54:46]
semi-truckss trying to look to get into
the US. All your your bridge. So to
[54:51]
actually, you know, utilize it, that
type of commerce, it hasn't been able to
[54:57]
be taken advantage of by anybody in
Slair County ever. No one's come in and
[55:02]
said, "Hey, we're going to build a
380,000
[55:06]
foot building to attract customers and
then in reference attract jobs." And
[55:12]
those jobs then attract hotels and sea
stores and grocery stores and
[55:17]
residential builders, you know, all the
things that come with the community's
[55:20]
growth. So, we've been really focused on
that tenant pool. Um, reaching out to
[55:27]
Canadian companies that are looking to
reshore or onshore here in the US. We've
[55:31]
got at least a dozen conversations
opened. I know I talked to certain
[55:35]
members here, you know, about certain
opportunities that are local that are in
[55:40]
other municipalities locally um that are
they're busting at the seams. They need
[55:44]
to grow and they need to be somewhere
else. Um so to really find a spot for
[55:48]
those to land that makes sense. you
know, this is the opportunity of a
[55:53]
lifetime for for some of those those
areas. It's something this property
[55:56]
could have, you know, seriously been
used for decades ago and was absent of
[56:00]
being able to use. So, with this, we're
bringing, you know, we've talked to now
[56:05]
the mini storage, the hotel, etc., and
the road commission on what that road
[56:12]
would look like to get redone and turned
into a public rideway that's 80 foot. um
[56:17]
utility extensions that are already
there but likely would need to be
[56:20]
upgraded. Um talked to the MEDC,
Michigan Economic Development
[56:24]
Corporation, as well as different state
reps on how we could find some public
[56:29]
funding that could be supplied to Kimble
Township slash the development to be
[56:34]
able to install those. If not, they're
on our dime. Um but really um just to
[56:41]
attract the right kind of business, you
know, stuff you guys want to see other
[56:46]
municipalities locally can't no can no
longer serve and opportunities that will
[56:50]
end up elsewhere if if we're not
bringing them to the table with you guys
[56:54]
as partners. Um so we paid careful
attention here with setbacks with
[57:00]
continuing to maintain natural features.
You've got we've got two massive ponds
[57:04]
on the freeway entrance there. There's
people fishing on them. There's dirt
[57:08]
bikes rolling through here outside of
the nuisance that's been to you from a
[57:12]
fire department standpoint and just
emergency services. Um, I think there's
[57:16]
a great opportunity there and we've
earmarked and left this open to be able
[57:21]
to, you know, bring some sort of park
service that we'd be willing to deed
[57:25]
over to Kimble, something that you guys
could utilize for yourselves to attract
[57:30]
and, you know, really bring amenities to
the residents. those come in the form of
[57:35]
fishing or a walking trail, etc. That's
almost 50 acres worth of property there.
[57:40]
Um, including those ponds that we're
willing to work with you guys for um and
[57:46]
gift you in any means. Um,
[57:51]
and we've taken dual note. I mean, I
I've I've camped out here now probably
[57:56]
two weeks total uh since we closed in
August and rode my dirt bikes and my
[58:00]
four-wheelers around here and stayed in
my RV on the property. And the that gun
[58:06]
range is is quite a significant amount
of noise to say the least. So, what
[58:10]
we're bringing to the table from between
the rail and the gun range and the
[58:16]
freeway, I don't even think you'd hear
anything that that we'd be adding to
[58:20]
that scenario because there's a ton of
road noise on the weekends. It's
[58:23]
semi-automatic and sometimes fully
automatic weapons and the rail passes
[58:27]
probably six times a day. So, um yeah,
I've met with some of your neighbors. I
[58:33]
have 17 of them that border our property
on the west line there on Allen Road.
[58:37]
Um, I've had the pleasure of meeting a
couple of them and I've got Darius
[58:41]
Udrich in the back here who's our
director of communications and in charge
[58:45]
of governance and community outreach.
We'll be meeting with the rest of them
[58:48]
and putting in what is today a 330 foot
setback um from that property line far
[58:54]
greater than what what Neil has propo
proposed
[58:58]
» and something that where it leaves all
that natural buffering in place. Um
[59:02]
there would be a access point back there
if you guys require it. not something
[59:05]
that we require, but you know, per your
fire code, you might need a um emergency
[59:11]
access to the rear there. Other than
that, it would be lockboxed and it'd be
[59:14]
a knockway that you guys would only
utilize in a in case of emergency. Um

So what is your model being?
You used a term back in the day it was
[59:30]
industrial park then it turned into
business park and then some now is just
[59:36]
lease buildings on property that is not
sold. So what is your model here in
[59:42]
regards to structure?
>> So we're we're long-term holders. Um we
[59:46]
don't look to to trade anything. So for
the right user, you know, if they were
[59:50]
talking something someone that was major
jobs and maybe for this larger building
[59:54]
that's there,
>> um that could attract an ecosystem, you
[59:58]
know, an automotive manufacturer maybe
that would have suppliers and logistics
[1:00:02]
companies that they would need to have
close to their campus. Um we might look
[1:00:06]
at selling something. Otherwise, we
would be looking to build these, hold
[1:00:09]
them. I'd be your single phone call and
I'd be the one who'd be able to bend
[1:00:13]
that tenant for whatever they may or may
not be doing
[1:00:16]
» that that doesn't fit in with your
guidelines.

» And then how flexible are the buildings
being um one tenant, two tenants, that
[1:00:26]
being that you just want the box, I
guess, approved, but you want to be able
[1:00:32]
to do whatever you you know, whatever
inside to um split them up.

» Yeah, that's a great question. So in
West Michigan, we stood um two million
[1:00:40]
square feet in total since 2020.
>> That's five sites. We've got Ford,
[1:00:45]
Fizer, Zoetis, Bradford White, real
large heating and cooling company for
[1:00:49]
headquarters. Um all of those buildings
were speculatory. So we didn't know who
[1:00:54]
who our tenant was going to be, right?
We we tapped into the marketplace like
[1:00:57]
we're doing now with reaching across the
Canadian companies and locals
[1:01:01]
» to figure out what type of building or
blend it could be. We'd love a single
[1:01:04]
tenant.
>> That's ideal. Um, does that happen? It
[1:01:07]
has all five times out there.
>> Mhm.
[1:01:10]
» Um, but we also made all those buildings
really versatile. So, they've got
[1:01:13]
parking lots on two different areas
here. We've got docks and we can
[1:01:17]
partition that building typically
between two or and or three or even four
[1:01:21]
times um depending on the tenant demand
>> with a two-hour fire wall between
[1:01:27]
» right I'm just asking in regards to%
these buildings you you can see in other
[1:01:30]
parts of the state
um in regards to the aesthetics of it
[1:01:35]
people will have different opinions but
you can see these there's an Aldi's
[1:01:39]
Amazon those type of shipping type
buildings these are shells
[1:01:44]
» they are And as a result of them, you
don't necessarily know what's inside per
[1:01:49]
se because I'm assuming you have the
ability to do the moving wall aspect and
[1:01:53]
you get x amount of entrance and or
docks.
[1:01:56]
» Yeah. And it's not just the wall the
wall side of it too. So when we build a
[1:01:58]
building like this, we won't pour the
floor.
[1:02:00]

>> Because we don't know how many
[1:02:02]
employees, bathrooms, office space. We
don't know what that what they're going
[1:02:05]
to need from an underground standpoint.
So for us to come back and cut out six
[1:02:08]
or eight inch floors is is wild in some
cases. And then they want 20 bathrooms
[1:02:12]
per gender. Mhm.
>> Um, so what we'll do is we'll leave the
[1:02:16]
floor out of that building or we'll pour
maybe 3/4 of the floor less these two
[1:02:20]
office corners that we have and we'll
leave enough area for them to be able to
[1:02:24]
manipulate. Um,
we would prefer to land manufacturing
[1:02:29]
companies. Those are more longerterm
leases or really stable opportunities
[1:02:33]
and they pay a lot more. Um, so that's
our number one objective and what we're
[1:02:37]
seeking. Um but you know the logistics
companies have to support those as well.
[1:02:41]
And with this being commerce with the
bridge, I definitely see some logistics
[1:02:46]
opportunities being a able to um land
here as well.

» So yeah, building will be uh we'll say
built where it's versatile enough where
[1:02:56]
it can transition to either one of those
type of users.

And sometimes, you know, we've been
lucky with the buildings we built where
[1:03:03]
we've put them up and, you know, two of
them we were putting steel in the ground
[1:03:07]
when, hey, I want this building.

» And we were able to identify and then we
had some pivot time if they want to do
[1:03:14]
some customization. Um, otherwise, yeah,
typically a a shell of some kind that we
[1:03:20]
have with no floor and lighting, fire
suppression, electricity set up to
[1:03:24]
multimeter and split. Same with gas,
water, sewer. um so that it can pivot
[1:03:30]
however that needs to.

to be on Range Road in particular some
additions in del lanes and traffic

signaling that will need to be
installed. And that's I mean that's
[1:04:09]
that's the nature of what comes with
this for sure.

That's the whole point of the traffic
study is to make it make it better. Um,

this is a an intersection where it's
it's the right kind of intersection to

be able to do an opportunity like this.
You know, the other side of the freeway,

you guys have the roundabout.
>> It's not as ideal as it is just to have
[1:04:32]
straight on and off ramps. So,
>> um, but some of the reasoning behind
[1:04:37]
that is is good in this this occasion.
Those roundabouts and semi-truckss,
[1:04:42]
they're always too tiny. So, um, there's
probably something possibly over there
[1:04:47]
that might need to be accomplished as
well,

but those are all things that, yeah,
we'll have to tackle as part of our site
[1:04:53]
plan approvals and part of passing any
and all questions that your team would
[1:04:58]
have for us.

have the exterior of the building
blending in with the environment as far
[1:05:25]
as just creating, you know, like instead
of just having a white wall, you have
[1:05:30]
some decorative where it looks like the
woods. Like I've got a friend, he's got
[1:05:34]
a tow truck yard. The side of his fence
looks like woods.

» You sure? You got like a real real tree

» it. Just a just a thought because I
residents talk about stuff like they
[1:05:44]
don't want these white walls in their
woods. They don't want just giant white
[1:05:47]
build.

white walls and you know there's a ton
of color selections that we can choose
[1:05:52]
from when we put the way when we do
these kind of things. Um for what is
[1:05:56]
facing residents beyond that 300 buffer
and that's that's the reason we're

leaving a lot of these trees in play.
Number one, twothirds of this plan, if
[1:06:05]
not threequarters of it, is not even
near a resident. It's gun range, it's
[1:06:09]
freeway, it's railroad. So, there's 17
residents in question here um that are
[1:06:15]
that have any type of of line of sight
or visibility to this. And that's a wall
[1:06:20]
that we can install at, you know, dark
green or black or any of those number of
[1:06:25]
things. But we don't do white walls. So,
that would be it would be a darker or
[1:06:28]
lighter tone of gray and be a couple
different kinds of them. We not putting
[1:06:33]
a big white wall in for anybody.

» Our committee came up with no data
center, utility study, traffic study, BM
[1:06:41]
bonding based upon valuation,
preliminary drawings, all parcels be
[1:06:47]
joined together because they're separate

If you have your traffic study, is it

addressing the railroad

brought up because you're increasing

traffic we have issues where range is

of traffic signaling that will need to

I I build relationships and partnerships
with municipalities.

of that for you guys.

So that's why the the if we could get
the master plan with the definition
[1:08:16]
in place and not for their reasons for
our reasons to have a a draft finalized.

members, we sat down with Greg and his
team multiple times. We sat down with
[1:08:31]
the lawyer and in plain English, it
makes things harmonious. It makes us

more attractive. It makes people like
his team and other potential tenants and
[1:08:41]
teams within the township. It makes it
things simpler for them to do business
[1:08:45]
with us. And we've all seen instances
where a lot of our old ordinances, a lot
[1:08:51]
of our old things make things kind of
fickle and that's why we've talked on
[1:08:56]
the trustee board, we need to readress
some things and make things more user
[1:09:00]
friendly. So, um, all my experiences
with Greg and his team, they seem like
[1:09:07]
great people. They want to invest in
this community and, um, yeah, I mean,
[1:09:11]
I've reached out to Greg after I first
met him and I gave him some ideas. I
[1:09:14]
reached out to Mark Hilo who's in the
process of expanding Gilo Pickles and I
[1:09:18]
said, "Hey, this might be a great
opportunity." And he said, "Yeah, I'll
[1:09:20]
think about it." So, I mean, there's
lots of opportunities. So, I just wanted
[1:09:23]
to express that.

commission. Uh thank you for the

opportunity to speak here this evening.
My name is Larry Opleski. I'm with the
[1:09:58]
law firm Dickinson. Right. We're outside
zoning council for the developer. Just
[1:10:03]
wanted to say a few words about the
development district idea. Uh you know,
[1:10:08]
we we've looked at everything you guys
have been working on and you know, we
[1:10:11]
think you do great work. However, for
this particular development, what we'd
[1:10:15]
really like to encourage is uh moving in
the direction of a conditional resoning.
[1:10:21]
You know, I know you folks have been
doing this for a long time, so you don't
[1:10:23]
need me to explain it to you, but just
in a nutshell, Michigan Zoning Enabling
[1:10:27]
Act uh allows a township such as
yourself to accept an application for a
[1:10:32]
conditional resoning. And what that
means is there's a a back and forth
[1:10:37]
discussion between the developer and the
municipality in regards to, okay, if
[1:10:41]
we're going to give you this resoning,
here's the conditions we want to see
[1:10:45]
that you have to abide by, otherwise the
zoning goes back to what it was before,
[1:10:49]
essentially. Um and really, you know, in
regards to the benefits for that,
[1:10:54]
there's there's two main ones that I
want to highlight here. Number one is
[1:10:57]
the timing um to move forward with the
development district in which I believe
[1:11:01]
this would be a special uh exception,
special land use. Um the all the
[1:11:06]
processes that have to go in front of
that, that's going to take months and
[1:11:09]
months and months. Um time which frankly
the developer would really rather not
[1:11:14]
spend. We'd rather get jobs and uh
commerce here sooner rather than later.
[1:11:19]
Um, so timing is one and the other one
is really flexibility. Um, in my
[1:11:25]
experience, and I've been doing zoning
and land use work for more than a decade
[1:11:30]
now, conditional resonings are really
the sweet spot when it comes to a
[1:11:33]
development like this because we can
offer you setbacks. Uh, we can offer you
[1:11:39]
additional screening. we can offer you
uh many of the items that that Greg just
[1:11:43]
mentioned whereas typically you wouldn't
be able to uh require a lot of those
[1:11:48]
things under some different land use
approval processes. So um in regards to
[1:11:53]
this particular parcel and we've
discussed this with uh Mr. Francis as
[1:11:57]
well um it's it's I don't think I'm
speaking out of term by saying it's his
[1:12:01]
opinion that a conditional resoning is
the more desirable uh aspect for this
[1:12:05]
particular project and for this
particular property. So, uh, we would
[1:12:09]
really encourage you to to move in that
direction. Um, happy to answer any
[1:12:14]
questions, any comments.

ball? It's in your court to come forward
with that application.

» Yes. And we can have that to you within
a matter of days.
[1:12:25]
» Correct. And then it's there is no
negotiation. It's an up or down. Yes or

no? So what we would be what ideally
what we'd be doing is we'd want to have
[1:12:34]
uh some discussions some of which have
already been had to see what sort of
[1:12:39]
conditions would make this palatable for
the community right what would protect
[1:12:42]
the best interests of of your residents

[1:12:46]
law you can't technically require us to
have certain conditions but we're
[1:12:50]
certainly not going to put something
forward that we don't think is going to
[1:12:53]
be acceptable to you
>> right you have to offer we say yes or no
[1:12:57]

that being there is being a request from

issue about the development district
which is mentioned in the in the master
[1:14:08]
plan. However, it's not in the zoning
code and moving forward with something
[1:14:13]
to address that matter which is the item
before us.

would require a zoning amendment process
>> once we get the definition. Yes. But you

have to have the you have to have the
public hearing. And so that's one item
[1:14:29]
to address. The second item to be
addressed in regards to this partial in

question based on the presentation and
the correspondence from the township
[1:14:38]
attorney, there is the request to do or
we should not be surprised about a
[1:14:44]
conditional reszoning being request of
us.

>> Yes. And so as a result of that, that
[1:14:52]
may or may not be at our next month's
meeting because such application
