[8:28] You know, the summer residents are still far out, but the trans
[8:51] Jim, I'll see you. Evening.
[8:55] Hi, sweetie. What happened to you?
[9:00] Um, I heard that. Oh, yeah. They told him to up the toes.
[9:07] Not an easy recovery.
[9:12] Well, you had that short
[9:27] a bunch of rods. Well, I think
[9:40] It's pretty neat. Bunch of rides for
[9:56] appreciate
[10:05] Not the best.
[10:11] [Music] I used to know everybody on the island
[10:20] more.
[11:03] design and sheet focus. Okay.
[11:13] [Music]
[11:24] sign and she folks. Okay.
[11:36] Yeah. or Jean's not here to set us free straight this All right.
[12:34] There's something
[12:41] like a designer drink. Yes. Yes, I've been told that.
[13:05] We
[13:47] jump back.
[14:04] Yes.
[14:21] Hey Paulie.
[14:31] Okay, I've got 4:30. Max, are we good go technically?
[14:38] Thanks for coming. Town of Le Point Regular Planning and
[14:42] Zoning Town Plan Commission. 4:30
[14:48] July 2nd, 2025. Call to order. Roll call.
[14:54] David Alen, Charles Bremer, Tim Peters,
[14:58] Paul Wilharm. Public comment. Anybody?
[15:06] Steve? Yes.
[15:08] Public comment. Yes. I would like to uh thank Max and
[15:12] Rich for uh coming out to visit the studio and taking a look at what I have
[15:19] going on so that uh they can have firsthand knowledge of what I'm doing.
[15:28] Thank you, Steve. Approval of previous minutes TPC special
[15:34] meeting 611 2025. Uh anybody see anything Jim is is the time on that
[15:42] right? Wasn't that meeting after a public hearing? So I don't
[15:47] instead of being 4:33 is that proper time we had our public hearing meeting
[15:53] first had the public meeting first at 5:00. So start at 4:33. I've got 6 611
[16:01] 2025. I don't have a time. I was just saying on the craft minute it
[16:06] says 4:30. Oh, I I think we we uh Let's see here.
[16:10] Unless I missed something.
[16:17] I think we This was the
[16:21] Yeah, that should be 5:30. But we're starting at 5:30.
[16:30] Okay. Same thing with the at the end. So now
[16:35] there's So there's one mistake. Good catch.
[16:49] But it strange to me at the bottom that page it
[16:53] says another issue is whether any conditions imposed run with the land. I
[16:58] just put go with the land.
[17:03] Run with the land is a is a legal term. Yeah.
[17:09] Right. Lawyers step on us again.
[17:14] It's to differentiate between people that are only
[17:19] the owner and when that person is not human then it's gone.
[17:23] That that was Charlie brought that up.
[17:28] Thank you.
[17:32] Anything else? No.
[17:35] Have I got a motion to put these on file?
[17:39] I move to approve the TPC special meeting minutes of 611 2025 as
[17:46] corrected. Second.
[17:49] Discussion. All in favor? I
[17:55] 3D TPC public hearing 611 2022. I'd like to thank Max for this very detailed
[18:02] minutes that were compiled. Yeah.
[18:08] Hey,
[18:19] I I don't see anything. Anybody else?
[18:30] Anyone with a motion to place these on file?
[18:38] I'll move to place the TBC public hearing minutes of 611 2025
[18:44] on file as amended. Second discussion. All in favor?
[18:50] I I
[18:53] a zoning administrator's report written and verbal report.
[19:05] Administrator start
[19:12] here on Wednesday, July 2.
[19:17] Then the other thing just talking about I was struck by the difference between
[19:22] year to days last year versus year to date this year. I don't I didn't give
[19:27] the number you can see the town and the general building permits was 2761 last
[19:36] year was 12,000 dollar these are dollars.
[19:41] It's pretty shocking the difference in in the dollar value that
[19:47] permits alone. Um I mean there are a few other things. The
[19:51] lines below a different present
[20:01] use permits map changes but the building permits really really dropped so far
[20:08] this year. It's really startle.
[20:13] That's all. That's all. Well,
[20:17] very well could be the start of a economic slowdown. You never know.
[20:24] Did you get the rental permits in from that coming in?
[20:28] No. I mean, so that you know, in the process of this change, um, the zoning
[20:34] administrator used to be having that. That's why Ed had this that but uh it's
[20:40] been moved over to Katie Abbott as treasurer and Katie I
[20:47] didn't catch her today before I could get the data for that
[20:50] that might make so I think we will because you guys want
[20:53] to know that stuff we will incorporate that data we'll pull that in from Katie
[20:58] but I just didn't get it today I I had an exchange with Katie a couple weeks
[21:03] ago about that she was going to scan them and put them in the PDF Y so they
[21:06] can be distributed if anybody want. So um I'm not sure where she was and again
[21:12] I I didn't catch her today but yeah keen on seeing them.
[21:16] Okay,
[21:21] moving on. Old business discuss meets LUP modification.
[21:30] [Music] Rich went out there today.
[21:35] I don't know how Rich has some you can verify some
[21:42] information and things like that. Yeah. Yeah. So, so thanks to Bob and
[21:46] Nancy for um you know uh you know meeting with me today. I drove out and
[21:51] we spent quite a bit of time together and and we walked the site um and and
[21:57] and took some measurements. Um so, uh they've been very thoughtful and
[22:04] detailed in in laying out um you know the the property lines um and the stakes
[22:12] for the garage and for the house cabin um and and for the deck. um and with the
[22:21] variance um they meet or exceed all of their
[22:26] setbacks. Um so they they came in and met with Max and I yesterday um if
[22:32] you'll recall back on 6 public hearing and there were no comments received
[22:39] public hearing. Um there's no depicted wetlands in the immediate area. Um and
[22:46] uh I included in today's package um their application and the site map um as
[22:53] well as some statistics where we measured the the critical corners
[22:59] um and they all exceeded the the the variance in in setback. Um for example,
[23:07] you know, the northwest corner of the garage to the westbound was planned at
[23:11] 25. We measured it at 25 and a half. Um, you
[23:17] know, and and I've listed those on the on the last page, but like I said, they
[23:21] all exceed those setbacks were um, you know, I
[23:27] they've put a lot of thoughtful effort into citing those facilities and and
[23:33] staying within the the modified um, you know, modified setbacks.
[23:41] The only comment is they're asking for approval for the
[23:45] the dwelling the deck the garage but they're dropping they're not asking the
[23:50] TBC to approve the gazebo just so because of the issue we have set back
[23:56] from water so that is not what what they're asking for
[24:10] then you just need a signature and a date by the owner around here.
[24:14] Yes. Yeah. So, but you got the fiat already
[24:17] paid. Yes, we've got the checks. Um, and like
[24:20] I said, I mean, the stakes are in the ground for the corners and we measured
[24:25] all of them. Critical that, um, the way the lot is is situated is that they're
[24:31] building the house or proposing to build the house 25 ft from the west line. Now,
[24:38] the east line, if the house is um 25 feet wide, the east line is almost the
[24:43] normal setback. It's it's 48 feet. I think the normal setback in there is 50.
[24:48] So, um it's just on that that west side. But there's very good reason for you
[24:53] know why they've um you know selected the layout for for the cabin, for the
[24:59] garage, and for the deck. I I honestly think they did as as best
[25:04] as possible with the with the layout. Thanks,
[25:08] Rich. Motion to approve the land use permit
[25:13] for the M's property uh contingent upon it being signed.
[25:20] Discussion. All in favor? I I
[25:30] uh review and approve land use applications 1197 Big Bay Road, M.
[25:35] Smith, 1480 Middle Road, M North, 613 Brian's Road, C. Douglas, 257 Spirit
[25:44] Lane, Dave Beller,
[25:49] the 613 Brian Road Douglas, that is already
[25:54] approved. You guys already approved that. That was I didn't know that that
[25:58] had been approved. That's been approved. Maybe you want to speak to the the
[26:06] situation. Yes. Yeah. So, uh, Max and I, um, took a
[26:11] field trip yesterday out to Kevin's, um, property as well, um, and, uh, um,
[26:18] walked the area where he's going to be, um, proposing to build. Um, he has a a
[26:25] site plan. Nothing's marked yet. Um, the, you know, the application isn't
[26:30] complete. Um, it's not really ripe for discussion at this point. Um, but we did
[26:34] get a a great view of where he's planning and we talked about setbacks.
[26:39] Um and uh um the next step is uh I' I've gone through the file and I'm going to
[26:45] be reaching out to him, if not tomorrow, early next week with a detailed list of
[26:49] here's what you need to to submit for us to to move forward on this.
[26:54] Well, really the only two that we need to approve here is is uh Bay Hill
[27:01] Cottage and uh Middle Road. So yeah, so the the middle
[27:07] road, let's let's start there. Um the address actually should be 1468,
[27:14] not 1480. Um the same person owns both of those. Um
[27:21] uh this is another one in your package today. You'll find um so you know, I've
[27:26] taken a more detailed approach to these TPC review packages. Um I'm open to
[27:33] suggestions, thoughts. I'm trying to make um everyone's review a little bit
[27:38] easier. Um you know, having a picture so you're seeing screenshots. I think when
[27:44] I describe something um I want it to you understanding it the same way that that
[27:49] it actually is. Um, so this is one we're um requesting to have a old barn uh
[27:58] building um constructed. Um and uh um the application's been filled out
[28:05] completely and accurately. It was signed. We have a check for that. Um the
[28:09] site is staked and measured. Um and as well as an Ashlin County permit. Um, it
[28:16] does not need a sanitary permit because the the pole barn is not having any
[28:21] plumbing. Um, it is not a nonconforming lot. I could find no record of that. Um,
[28:29] and I you'll notice I skipped one on there and it was the wetland and and DNR
[28:33] permit. And um, so if you page there's a page for it's actually in
[28:42] color. You can actually see the the pole bar um highlighted it. So
[28:48] um that's where it's located. Um Max and I were both out there this morning. Um
[28:54] it's outside of the thousand foot criteria, you know, to the shoreline. Um
[29:00] and then you'll see a couple of pictures on the next page. One of them that that
[29:04] documents that I measured from the closest property corner to the
[29:08] shoreline. It was 1,035 ft. So close but outside. Um but the the last exhibit
[29:14] that's on here well on that page um is a depiction of the forested and upland
[29:20] wetlands. Um and this site is very close to the forested wetland site. Um,
[29:29] you know, I it's so hard to tell on on here just due to scale, but um
[29:36] I think coordination with the DNR is is is a good idea. Um, and then the very
[29:42] last page um as I measure it, you're going to see a lot of measuring from me.
[29:46] um is I went into an aerial photo and where the existing road is and more or
[29:56] less where the site is for that pole barn and from the road to the wetlands
[30:01] is about 25 ft, you know, 25.74 ft. So that's one of those that I'm like
[30:08] it's it's pretty close. You know, I I can't judge myself 100% accuracy that um
[30:15] it's missing the wetland. You didn't have any red flags on your
[30:19] site visit. No, no, there was a there was a marker
[30:24] there, but then I came back and I looked in Google Earth and then I also looked
[30:28] at the Ashlin County website just to to see, you know, we've got the setbacks
[30:32] from uh Max kind of walked through and down out to the street and walked
[30:38] through 40 trees. Yeah. Whenever we had a question years ago, we'd always uh
[30:42] confer with John Spangberg who was a wetland expert or analyst with Wisconsin
[30:48] DNR. I don't know who Phil, he's since retired. I think unfortunately he's
[30:53] passed away, but he was always pretty knowledgeable about wetland indicators.
[30:57] Yeah. So, I dealt with Well, I dealt with some of that in my my past life.
[31:02] And um to me it didn't jump out that that it was an issue, but the wetlands
[31:08] are close. Um and I just want to be careful for the
[31:12] town that I'm not approving something that's hasn't been vetted.
[31:20] Thank you.
[31:26] I'm comfortable with this. Do I have a motion? Make a motion to approve the
[31:31] land use permit
[31:35] 1468 middle road.
[31:40] Second. Discussion. All in favor?
[31:44] I I
[31:48] wanted to say that Rich when you highlight and put red on this it really
[31:52] jumps out and makes it a lot easier for us to understand.
[31:55] Great. Awesome. Is or isn't.
[31:57] That sounds good. Yeah. So that's that's very helpful.
[31:59] I appreciate it. And like I said, I'm looking for any sort of feedback on um
[32:04] you know, as we develop these, I want to give you something that's usable. Um so
[32:09] very I think it's No, I think it way exceeds
[32:12] industry standards. Yeah. Okay. Thanks.
[32:15] Y very good. I appreciate that. And we do have um one
[32:19] more. Yep. Um and this was for a deck
[32:24] um out on uh Fill Cottage Road. Um and uh
[32:33] this is one where we we we have the application now. Um my understanding was
[32:38] is that there was an attempt to reach out to us more than once. Um I don't
[32:45] know how many times. Um, and he did not get by from the town. Um, and he reached
[32:53] out to Max a couple weeks ago maybe and and just basically said, "I've got a
[32:59] crew and I need to build it and I'm I'm going to build it." Um, and uh, so we
[33:04] went out there today. We wanted to, you know, investigate it and take a closer
[33:07] look at it. And um, it is it is a small deck. I personally when I think of a
[33:13] deck I think of like this large structure that's got this is literally
[33:19] um I don't know 6 in off the ground maybe
[33:21] it's more of an apron right yeah it's it's a very short deck like
[33:26] one that does it's not high enough that it actually needs railings um and I know
[33:31] it's hard to see on here and I'm going to I'm going to start drawing on these
[33:34] so you can actually see them but this building here this this structure here
[33:40] the deck is literally in front of this and it's it's a tiny deck. There's there
[33:45] is that attached to the building? It is.
[33:47] Is it serve as an entrance or exit? It is attached where the entrance was.
[33:53] Yeah. And I think it has to be inspected by
[33:56] UDC. Okay.
[34:00] I'm pretty sure that in our current ordinance that that's a requirement.
[34:07] If it serves if it's attached and it serves as an entrance or exit to a
[34:11] building to a dwelling, it has to be inspected by UTC.
[34:17] Okay. The owner wasn't there when when Max and I were there, but we left a
[34:21] message with I think family members to to give us a call.
[34:27] So you you it's the town still wants the land use currently even though it has to
[34:32] be inspected by UDC I believe it's
[34:40] I'm not sure if we can approve it without it being inspected. No, but you
[34:44] can approve you could approve land use permit contingent on inspection by HC,
[34:48] right? I think that would be the proper
[34:52] procedure. Okay. But it's more than just two steps.
[34:56] It's a it's like like the size of this table type desk or deck.
[35:00] Yeah, more or less. Oh, okay. Well, yeah, it needs there's a
[35:03] fee required. Yeah, that's to meet setbacks. I was just envisioning it's
[35:07] more than just two steps going into a door.
[35:09] No, it's it's Yeah, it's one step. Yeah, that's fine.
[35:15] We will take care of that. And then the last two things on the on the very back
[35:18] page of that one um is I like to measure just from the shoreline. Um and it's
[35:23] 2200 ft. So, it's nothing there. And then um the bottom one is just a
[35:28] depiction of any wetlands that are in the general area and there's none. So, I
[35:33] just wanted to go through all of the aspects of it. So,
[35:37] perfect. Those are the three that we wanted to report on today and I I'll be
[35:42] working with Kevin and and anything else that we got coming in to keep these
[35:46] moving forward as quickly as possible. Thank you.
[35:49] Yeah, thank you so much. So, have I got a motion to approve this with
[35:55] contingencies?
[36:03] I'll approve the land use applications submitted by Marggo Whittig.
[36:08] um contingent upon review of the
[36:13] review for uniform dwelling code requirements.
[36:18] One second. Any discussion? All in favor? Hi.
[36:23] Hi. Hi.
[36:31] Who business review MCHU conditional use permit application?
[36:39] Well, last time we talked about
[36:44] having uh people coming up with a list of of uh
[36:49] Yeah.
[37:00] Everybody have their
[37:05] things on my list. Okay. um one that we discussed a
[37:08] commercial inspection given that people were going to be in
[37:14] visiting um would want the building to a standard
[37:18] that allows the public to be in there for essentially what I is our commercial
[37:23] purposes.
[37:27] Um uh occupancy tied to applicable or
[37:33] available parking spaces only
[37:44] on the point of the music uh up for discussion but I
[37:52] understand ambient music and that sort of thing. I I my twist on that was there
[37:59] would be no amplified music. Amplified music would be disruptive and again open
[38:04] to discussion but that was on my list.
[38:18] Anybody else got a few concerns or notations as well?
[38:24] some that mirror David's. Um, I too would like to see the property to be
[38:30] inspected by the town point building inspector if deemed necessary by the
[38:35] inspector. Same thing with parking.
[38:40] We want to make sure sufficient off- streetet parking provided per the zoning
[38:43] ordinance. And what I can see is two spaces in addition to the residential
[38:49] parking requirements and one space for every two employees and no parking on
[38:54] Benjamin Boulevard at any time. The live music
[38:59] also gives me some pause and concern. Um I can understand having music inside the
[39:06] building such as stereo or radio, something like that. I'm concerned about
[39:11] the advertising of live musical performances
[39:15] on the premise. Um, I don't think it should be permitted.
[39:22] Another concern would be off- premise directionary signs advertised in this
[39:26] business. Obviously, no off- premise directionary
[39:30] signs should be allowed. And per the ordinance only one on
[39:34] premise advertising sign not illuminated not to ex 12 square feet in area shall
[39:39] be permitted. The sign shall be in the lot setback not in the rightway provide
[39:43] it does not interfere with passage of vehicles or pedestrians.
[39:48] And last but not least would be no retail or
[39:52] wholesale products may be sold or offered on the site except those
[39:55] products and services that are actually produced on site by the applicant and
[40:00] associated family members. It's limited to being operated as an art
[40:05] studio gallery. Um,
[40:09] I don't know how to handle food and beverages being offered or or
[40:13] advertised. I don't think they should be advertised
[40:17] for sale because this is not a restaurant or a bar. And one last thing
[40:22] is uh get the the item of guest artist. Again, this is a a home emphasize home
[40:29] business. it's not located in a commercial zone. You you you are granted
[40:35] more in a commercial zone than in a W1 low density zone. So those are my
[40:41] concerns and list.
[40:46] Yeah.
[40:53] Something else, Charlie. Huh? No, no, no. Go ahead. Sorry.
[40:58] Um
[41:01] I agree with some of the uh issues that were mentioned previously.
[41:09] One that hasn't been mentioned yet I guess is the uh cop if it's state of the
[41:14] property or not but I think we can we can
[41:18] settle that. I don't think it's a big issue where we can restrict the uh BFP
[41:26] expire business. that the property is sold.
[41:28] Yeah. Just like the year. The CUP does not go with the land.
[41:33] I research that today you can't restrict it.
[41:40] But what you can do is put a term on it. The term expires and stuff. And if you
[41:45] set a term one year, let's say you set a one-year term for the traditional use,
[41:50] which can be the that's legal. You can set a term. But if
[41:55] if in that term within that term property was sold, the new owner would
[42:00] be able to have the same use until the end of the term. That's how it works.
[42:07] Okay. So, if you set a one-year term that I mean that's pretty tight. So, the
[42:13] likelihood that someone else would buy it and then be able to really think that
[42:19] they could develop something, you know, pretty big out of that, I think it's
[42:23] unlikely. As long as you put a term that's short,
[42:27] you know, not five years or 10 years, but a year you but you cannot
[42:32] statutoilally the town cannot restrict to person.
[42:37] Way I read it. You could uh Well, I looked at it pretty hard this
[42:42] morning. Okay. I have to revisit that and look
[42:46] again. But
[42:52] at at the end of the term, would they have to apply for a new CU?
[42:57] Is it renewable? Does it want to off, you know, is it renew selfrenew? I mean,
[43:02] it's how you would draft that. Okay.
[43:11] Alstrom. Um,
[43:18] I guess our next move, unless other people have
[43:23] things they want to discuss, is if we're going to look at possibly granting this
[43:28] cup, we have to sit down and look at the language and the actual conditions that
[43:34] we want to put on that CUP. Yeah. Recommend to the town board for
[43:40] approval. Yeah. But we have to come up with a list
[43:44] of conditions. Well, the only thing that bothers me is
[43:48] I I in my mind he has a lot of parking spaces out there and everything looks
[43:54] good except the advertised music that's out there um bringing people in to
[44:00] perform. It was a flute out there as kind of background music for for
[44:06] people wandering around, but now they're a wine and and and
[44:12] kind of a reception with music with being brought in and that concerns me. I
[44:18] Did you hear the flute at your house? I flung flute. No, I was last chair. No.
[44:25] Um I I've got a way to solve the music issue.
[44:29] Yeah. Three police reports referencing
[44:34] town of Le Point ordinance infraction is grounds for a CUP relication. Now the
[44:39] noise ordinance is a town ordinance chapter 336
[44:48] right here. Chasser 336 residential 7 a.m. to 1000 p.m. 55 dB
[44:56] 1000 p.m. to to 7 a.m. is 45 dB. The police carry decel readers with them. So
[45:03] if somebody complains, you know, I don't think anybody's going to
[45:07] complain. I just don't. But the point of my concern with that,
[45:12] sorry to interrupt, is the fact that it's a home business. if if
[45:17] they were doing the musical stuff themselves. But if you're having guest
[45:20] acts come property, it changes the whole dynamic of being a home business, does
[45:25] it not? And my
[45:30] I mean, where where do you start and stop going forward if you allow that?
[45:34] That's my concern, Paul. Sorry to interrupt.
[45:37] That's okay.
[45:40] Uh I don't know. That's that's my thought process. with the with the
[45:44] music, but I'm just one person here.
[45:51] And I believe there had not been an issue yet.
[45:55] No. On the number of years that they've been
[45:57] doing this, that there's been any complaints at all. There was no
[46:01] complaints or issues from the neighbor doing this.
[46:11] And as far as the the commercial building code, you know, I I would I
[46:16] think we would have to put it in there that that inspection has to happen
[46:20] within a certain period of time. 6 months might be reasonable.
[46:29] Sure. Yeah.
[46:38] the table on it. Has anyone out to James Price on that
[46:42] this issue at all? I mean, from the zoning office end of things.
[46:46] Well, it's it's my understanding that Steve has made an application that
[46:50] hasn't been submitted yet, but Okay. Just just question.
[46:54] Is that correct, Steve?
[46:59] Yeah, that's correct. Uh I was working with Max on uh figuring out what needed
[47:05] to be filled out uh because it's an existing building. The application that
[47:11] was provided was for new construction. So um as soon as we figure out what what
[47:20] is needed, what paperwork and and what amount uh we we plan on submitting that
[47:27] right away. And as far as as noise, if I may
[47:32] proceed, uh 55 dB,
[47:36] uh we're doing acoustic music. Um we had people walk up on Monday that
[47:45] thought that they asked us, I thought you have music. And we said, yeah, it's
[47:52] you know, it's going on. You could barely hear it outside of the building.
[47:59] So it's not amplified. It's uh to the point where it goes
[48:05] outside of the space.
[48:09] Yeah. So maybe about the same level as a squirrel cracking an acorn.
[48:15] Close. Close. And we're not selling food and we're not
[48:21] selling beverages. We're giving away a glass of wine or a bottle of water. So,
[48:27] this is not uh an effort for us selling
[48:34] uh or or getting into the food or beverage business and we never will be.
[48:42] Thanks, Steve. How Charlie, how many days do we have to to deal with this
[48:49] tweet? Do we have to act on this tonight?
[48:51] You're on the clock for 30 days after the public hearing on the 11th. So,
[48:56] okay. So you got to Yeah. So we need to
[48:58] You're probably Yeah. You'd want to meet sometime next week.
[49:00] Well, is that for because we're just recommending to the town board. So is
[49:05] that 30 days to the town board or is that 30 days?
[49:09] I think once you're done with the public hearing, the applicant has 30 days for
[49:12] us to make a recommendation to the town board and then I think after they
[49:16] receive it, they have 30. I think we're on the clock from the 11th
[49:20] to the 11th of this month. So I mean so basically we should make a decision
[49:25] tonight unless we have a meeting next week.
[49:34] I'm I'm happy to make a decision tonight with with you know a few provisions that
[49:39] we've talked about.
[49:49] can also limit the number of musical events he had
[49:55] make it for a month which is because
[50:01] I think right now they're just on Monday night,
[50:03] right? I mean I I honestly think
[50:07] three three police reports referencing infractions
[50:12] of of town ordinances, you know, should should cover it.
[50:19] But but isn't isn't that a nature of um that's not a preventative condition?
[50:24] We're trying to limit or shape activity rather than react to outcomes. I think
[50:32] in these conditions, well, the other thing, Dave, is on a
[50:38] conditional use permit, when you're looking at establishing conditions, you
[50:43] have to show substantial evidence, which is, and that goes on to say facts
[50:49] and information other than merely personal preferences or speculation. So,
[50:55] it's got to be based on actual facts or otherwise we get into a lot of trouble,
[51:01] right? Sure. I think it was act 67 that outline.
[51:06] Yeah. Act 67 basically says if an applicant
[51:12] agree meets or agrees to meet all the conditions that we list,
[51:17] right, we have to grant the
[51:20] gotcha. Yeah. I mean in in my mind people are here for for peaceable
[51:26] enjoyment and noise conflicts with that. So, you know, and in every cup, you
[51:32] know, to put something in there about, you know, three police reports
[51:38] referencing, you know, town ordinance infractions just kind of
[51:44] covers that. Mhm. Um and yeah, another thing is on the issue of uh selling
[51:52] products that are produced on site under home business in our current ordinance.
[51:58] It says no retail or wholesale products may be sold on the site except those
[52:03] produce and services that are actually produced on the site. So it's that's
[52:07] pretty much already covered. Yeah.
[52:14] But if he's advertising for wine and cheese tasting and he says I'm giving it
[52:18] away. We've never advertised cheese and um
[52:24] well my point is if you're advertising something
[52:28] is that part of a home business unless the wine is made on site. I'm getting
[52:32] back to this home business idea. It says for sale.
[52:37] Fine. I'm not going to argue the point. The point though is Jim is that a home
[52:42] business is designed for stuff that is produced on site or created on site and
[52:49] his application is for an art studio and gallery. It's not for a music venue.
[52:55] I'm just trying to Yeah.
[52:57] Not the eyes cross the teeth. I've been through a lot of these
[53:01] and I know how it's manipulated. [Music]
[53:13] Well, I'm comfortable with all of it except what bothers me is is the
[53:18] advertising of music. That's I know the reason is to bring people out to see his
[53:23] artwork and and the gallery and stuff to help them enjoy themselves while out
[53:29] there, but it seems like it's pushing the envelope
[53:34] for me to include that the music stuff. That's that's just my thought.
[53:42] Well, why don't you decide on a vote or whatever?
[53:50] Well, we're going to need a question.
[53:58] We actually want to work on this a little bit and write down provisions.
[54:05] I think we have to if we're going to try and see. I mean, we need to actually
[54:10] list the conditions. Running out of time, right? Well,
[54:17] for this meeting. We're not. But
[54:22] I think we should we should work on this and put it to rest.
[54:29] You've been waiting to get through.
[54:35] Well, one condition I guess that we all agree on is that it needs to be.
[54:42] Yes. And is 6 months. okay for that?
[54:50] I would hope so. I don't have a problem with it.
[54:59] Next. Well, we all agreed on sufficient off
[55:02] street parking per the zoning ordinance. I'd like to see no parking on Benjamin
[55:07] Boulevard personally, but that's up for discussion.
[55:17] Yeah, I I would agree with that. I think the the home business has to contain
[55:21] parking within property lines rather than a public way.
[55:30] Paul, your idea about the uh noise ordinance, I think that's put in there,
[55:36] too. Well,
[55:40] and I I guess I understand Suwellen and I understand Charlie. I mean, as far as
[55:47] the the music goes, I I think the the noise thing should be put in there
[55:52] whether there's music or no music. It's not
[55:58] personally I, you know, I I don't want to, you know, split hairs on a little
[56:04] art studio with somebody with a flute or a guitar.
[56:10] I personally don't have any pro a problem with that.
[56:18] I think regarding the music, the advertising of live music begins to blur
[56:23] a implied venue for me a little bit. I'd be open to hearing what everybody else
[56:29] has to say. But we begin to veer into that's a featured event versus the again
[56:39] back to the home base, the art and understand it's ambience and experience
[56:45] makes makes a better experience out there. But
[56:51] and if he has a radio going, a stereo, you know, that's background inside.
[56:56] Yeah, I have no issue with that. And again, that's where Paul's idea if it's
[57:00] too loud. Well, yeah, then that comes into play with the noise ordinance,
[57:04] which is on the books already, right?
[57:07] Again, my concern is having musical acts show up, whether it's person or, you
[57:12] know, I kind of
[57:14] did a blanket thing, you know, just referencing, you know,
[57:19] the point ordinance and fractions. I mean the noise ordinance is one tiny
[57:23] little thing, you know, all the ordinances.
[57:31] Well, I still feel that uh people that live out here on the island have it's
[57:38] not the easiest place to make a living. And if somebody has a home business or
[57:44] whatever and they're going to have people come in and perform music to draw
[57:48] in customers, I don't see a problem with that. As long as we have somebody that's
[57:53] going to make sure it doesn't get too loud and people aren't going to
[57:57] complain. Um I just think it's part of living out
[58:03] here operating a business. You have to do different things to
[58:08] to bring in the customers. I mean our you know the commercial zone is you know
[58:14] primarily residential and you know I think we need to think outside the box
[58:19] for
[58:22] well the applicant had a business in the commercial zone and now he's in a low
[58:26] density residential district. So that's his
[58:30] I absolutely agree with that. You know it's a little
[58:34] a little odd but it it is what it is. Well, it is in W1, which is 20 acre
[58:43] parcel. And the neighbors, you know, there's a few neighbors out
[58:49] there really, but they they showed up and they were all in
[58:53] favor, right?
[58:56] Nobody's nobody said anything negative. No,
[59:04] I can understand your concern about uh a business
[59:09] using different ways to bring in customers.
[59:14] But I think that's kind of a necessity out here. It's hard enough to
[59:20] have a business, a home business, and not be able to attract people to come
[59:26] and look at your products. Yeah, I understand that, Jim. But at the
[59:31] same time, the home business was designed so that someone could have a
[59:36] small business at home. It's not a commercial zone. I'm not gonna waste my
[59:41] breath continually beating that horse to death, but it's not a commercial zone
[59:45] out there. And if he's an art studio, God bless him. I wish him well, but it's
[59:51] that's what it is. That's what his application was for. And to present it
[59:55] at anything other than that, I think is misleading. And I I'm against any live
[1:00:00] music. The more we talk here, I'm just getting more and more against it. Sorry
[1:00:04] to say because I don't think there's any way to
[1:00:07] police it quite honestly to be honest with you. If you allow it, who's going
[1:00:11] to police it? Well, the only other thing he can do to
[1:00:16] bring customers out is word of mouth or signage. And we're we're tough on
[1:00:21] signage. We've dealt with that before. So
[1:00:27] if he doesn't advertise anything, he can basically, you know, have his friends
[1:00:34] and neighbors over and do anything he wants and he wouldn't even be the CUP.
[1:00:41] Yeah, but that's why we're here.
[1:00:45] It's not to look the other way, guys.
[1:00:53] Charlie, I'm still having a hard time understanding or against music.
[1:01:00] Guys, it's a home business. Have you read what a home business is and what
[1:01:04] it's not? Tell me. I mean, I don't want to get
[1:01:09] upset, but I I I just don't get it. What do you What do you think a home business
[1:01:14] is? Is it the same as a business downtown Le Point? Because it's not.
[1:01:19] Well, we have such a small commercial. I know. I've heard that and and I've
[1:01:23] been through the comprehensive plan and and this is allowing him to do something
[1:01:27] out of his house. But why are we constantly morphing it into more of a
[1:01:31] commercial enterprise? You also have to remember after we make
[1:01:35] a recommendation, the town board can just throw everything we just talked
[1:01:39] about into the trash and start it over. I hope they don't, but I've seen that
[1:01:44] too, Jim, and I know you have. So, but the town board can
[1:01:48] Yeah. But they do.
[1:01:50] That's part of our But I think I've said my piece. I'm not,
[1:01:54] you know, if someone else wants to talk, that's fine. That's my concern.
[1:01:59] It's clear, right? Not to me.
[1:02:03] Okay. Sorry. I don't know what else I can do.
[1:02:06] I mean, I see your point, but as it applies to the CUP,
[1:02:12] I don't I don't see uh the value of it. That's your opinion. I disagree.
[1:02:22] Well, I'm in Charlie's camp on that and Steve's my friend and I wanted to do
[1:02:27] Well, I he has very few avenues to pursue to bring people out there.
[1:02:35] So, I don't know what the situation I'm I'm just not comfortable with advertised
[1:02:42] u music out there. The purpose is to bring people out to enjoy his artwork.
[1:02:48] But I it it goes we it doesn't seem like what the home business was supposed to
[1:02:53] be supposed to be a cottage industry out of your home. I don't know. I don't want
[1:02:58] to I don't want to be difficult although I am
[1:03:05] Dave. What do you think?
[1:03:09] Well, I I am really hung up as a of the live music piece of this. I and I think
[1:03:15] it's uh I give you so um
[1:03:20] our our I'll just give you an example of of how things can escalate. My worry is
[1:03:24] that we are not putting in measures to keep you know to sort of shape the
[1:03:28] outcomes that we want to see given the conditional use. So we live pretty close
[1:03:33] to uh Bud Nelson's old hospitality room. And it was never loud music that really
[1:03:40] was disruptive. It was the 40 motorcycles that showed up that was
[1:03:44] disruptive around in our neighborhood. That's just an example. I would say even
[1:03:50] if we had acoustic here, I'll give you a really extreme example. Let's say we've
[1:03:55] got someone playing that room. So, it's it's an advertised live music acoustic
[1:03:59] only one guitar, but that guitar player happens, this is going to be a stretch,
[1:04:03] so give me some leeway here, but that guitar player happens to be run out,
[1:04:07] right? or a pretty uh exciting draw. Now we've got something that's shifting into
[1:04:14] a music venue a little bit more. And and I'm not saying they are or not. And I
[1:04:18] appreciate the ambient music um sort of enhancing the experience out there in
[1:04:24] and of itself. I'm not against that. To your point, a stereo or something that
[1:04:28] brings some ambient sound that can be pleasant. Um, but uh I'm worried about
[1:04:34] the escalation of what live music out there could become and having a set of
[1:04:40] reasonable controls, Paul, you brought them up of noise um you know uh
[1:04:46] violation that can that can actually be a after the fact remedy. But I think our
[1:04:54] focus here is to say shape the conditions that we want to see, you
[1:04:58] know, so the the business can right out of the gate be or the home business
[1:05:03] right out of the gate be uh acceptable in the neighborhood. So that's that's my
[1:05:08] hangup with a music venue is that um it's hard to,
[1:05:15] you know, apply what's the right act to have out there. Is it someone playing a
[1:05:23] flute or a guitar or is it, you know, something James Taylor showing up? Not
[1:05:29] saying that that's the case here, but that's the scale that I'm trying to to
[1:05:32] look at in terms of how that would be a draw.
[1:05:35] I've got three to five. No music, no live music. So, let's, you know, it's
[1:05:42] the way it is and let's move on. What's next on our list here?
[1:05:47] Well, I have to take issue with what Dave just said because once again I have
[1:05:52] to go back to what it says about substantial evidence, facts, and
[1:05:59] information other than merely personal preferences or speculation. And a lot of
[1:06:05] this what we're talking about is speculation.
[1:06:08] And we're supposed to use the facts. facts are he's been doing this for three
[1:06:14] years. Has been no problem. People that try and make a living out here on the
[1:06:21] island have a hard time. They need to do what they can to bring in customers.
[1:06:27] Another fact. So, if we get away from speculation and what might happen,
[1:06:34] I think we have to go back and look at what's happening now and has happened.
[1:06:41] Jim, I I I appreciate that perspective, but I think when you have a live music
[1:06:45] act that's not yourself in that it becomes a venue, and that's my
[1:06:50] perspective. It's not uh I think it's I think we're turning it into something
[1:06:56] else by having live music there. And that's not really that's not a if I may,
[1:07:02] I'm not speculating on that. I'm just saying, hey, if we're going to loud
[1:07:05] music, then in my mind, it becomes a venue.
[1:07:10] tend to agree. The purpose is for people to see his artwork, which is there there
[1:07:16] a lot there's a lot of artwork. It's a pleasant building. Um,
[1:07:21] and that's kind of veering away veering away from the focus being his artwork. I
[1:07:28] realize he was wants to as as I said before, I think the proper thing was
[1:07:33] signage, but we've kind of blown that one out. Um,
[1:07:38] I don't know what everybody wants to do on that.
[1:07:41] It has to get inspected. So, let's start with that.
[1:07:47] Well, the the problem with the inspection
[1:07:51] and I came up with a with a time limit on it because if if we require the
[1:07:56] inspection first, you know, then we're going to not be recommending the CUP. he
[1:08:02] would have to make application again after you know the the building was
[1:08:09] inspected and we had a commercial certification. So we can get around that
[1:08:14] by by recommending this tonight and put a six-month limit, you know, to to to
[1:08:22] have that that commercial certification. And if we don't get it in six months,
[1:08:27] then, you know, we have the right to revoke the CUP.
[1:08:31] Yeah. I don't know how James Price handles after the fact commercial
[1:08:34] permits. I mean, do you or anyone else? I have no idea.
[1:08:38] I have no idea. Yeah, I have no idea. So, that's why he
[1:08:40] said if deemed necessary by the inspector. Maybe he says it's not
[1:08:43] needed. I don't He did an after the fact inspection that
[1:08:46] I've been told on the uh the candle shop because that was a a vintage house when
[1:08:54] it was purchased and now it's a commercial candle enterprise. So, true,
[1:08:58] they can be done. Okay. Fahrenheit.
[1:09:05] So, I'm I'm still I I'm seeing here that that the the live music is off the
[1:09:13] table. It's unfortunate, but you know, we need to move on and and and come up
[1:09:18] with uh you know, the the rest of the provisions that were on people's list.
[1:09:24] And I think Okay, moving on. Then are we in
[1:09:27] agreement about the off no off premise directionary signs
[1:09:31] advertising his business? I mean he's allowed to have his sign
[1:09:35] at the business. Correct. Yep. Yeah. So
[1:09:38] yeah. Well that's our current ordinance. That's fine. I just want to make sure
[1:09:41] it's in there. If if our ordinance changes then you
[1:09:45] know then it would be different but how our
[1:09:50] current ordinance reads.
[1:10:01] Anything else?
[1:10:05] You want to read back the list? I've got the inspection 6 months off
[1:10:09] streetet parking uh noise ordinance and no directionary signs and and it looks
[1:10:16] like uh Max has been taking more detailed notes.
[1:10:22] There was the issue about
[1:10:28] you got the signage language. Okay.
[1:10:35] I think yeah there's it was basically there spy the the noise the parking
[1:10:40] commercial inspection the no live music and the no retail products. So
[1:10:47] Dave, did you have enough something that doesn't fit in there?
[1:10:51] Nope. No. I I think I don't know that we need to put in
[1:10:56] retail products other than produce on the site that city ordinance business.
[1:11:00] Okay. Which which ordinance? Pardon?
[1:11:02] Which which ordinance can I reference? Yeah. Um section uh 6.4.C.
[1:11:14] Right. So that then we would just well I guess it's implied condition is that
[1:11:20] compliance with all the existing ordinances that okay
[1:11:32] the existing ordinance of the state but does that mean if the ordinance changes
[1:11:35] in a year this will automatically change?
[1:11:40] Yeah, they could just put in there to the current ordinance
[1:11:47] because I don't think you want to have somebody comply with an ordinance that's
[1:11:50] out of date. No, as long as we're clear the assumption of
[1:11:55] the ordinance supersede everything else. I
[1:11:59] mean, has to be that. That's not what's up to debate here in terms of our
[1:12:03] conditions. It changes. It's outside of our purview
[1:12:07] anyway. or something changes at the state or county level, right?
[1:12:13] Yeah. It's just like the the it's the state statutes
[1:12:17] that with the commercial inspection. I mean,
[1:12:20] change of use commercial inspection, that's a that's a state statute,
[1:12:25] correct? Just one thing to circle back on if it hasn't been brought but and
[1:12:30] maybe I don't know how I've never seen one how they're drafting but do you want
[1:12:33] to put a term you know like it's a one-year term you
[1:12:39] want that in the as a condition well in my mind it certainly would have
[1:12:44] to be a lot longer than one year I just want to bring that back up and
[1:12:49] get got on all these subjects but if you're worried about past this this
[1:12:56] conditional use passing on to someone else.
[1:12:58] Yeah, I mean make the term for I'm just I'm just one guy, but in my
[1:13:03] mind I don't it wouldn't bother me if it if it went with the land because if if
[1:13:08] somebody else wants to, you know, step into Steve's footprint, you know, I mean
[1:13:13] what as long as they adhere to the terms of the cup, who cares?
[1:13:19] Yeah. I don't I mean I I don't have a problem with eliminating that whole
[1:13:22] thing about a time limit or whatever. I mean, I don't know why we need a time
[1:13:26] run. Yeah. I just I just remember they did it
[1:13:28] on the year and they wouldn't, you know, they did that with the homeowner only,
[1:13:34] right? Or that's what it was three, four years ago
[1:13:38] out there, right? It it stays with them, but once they sell it,
[1:13:41] right? But now Max is telling me that that or us that that's not, you know,
[1:13:46] how it should have been done, correct? You know, uh well, okay.
[1:13:52] Anybody with a with a motion to get this show on the road here?
[1:13:57] Option to recommend it down board. Yeah.
[1:14:16] I recommend to the town board approval of the Steven and Mary McHugh
[1:14:19] conditional use permit with the following conditions. Can I have those,
[1:14:24] please?
[1:14:29] Inspection by the UDC inspection within 6 months. Correct.
[1:14:36] Yeah. Commercial UDC inspection. Commercial UDC inspection. Those are
[1:14:41] just my scratch notes. That's fine.
[1:14:51] sufficient off streetet parking provided per zoning ordinance and no
[1:14:56] parking on Benjamin Boulevard.
[1:15:03] No live musical performances. Noise ordinance.
[1:15:09] Adherence to the tunnel point noise ordinance. Well, all all ordinances
[1:15:14] all ordinances. What else did we have? I think that's
[1:15:19] it. And no directionary signage. But again, that to Jim's point, that's
[1:15:24] already in the ordinance. You want to include it as
[1:15:27] doubling up. So be it. Again, the town board can change.
[1:15:32] Oh,
[1:15:36] that everything.
[1:15:40] Yeah. Well, in seconds. Uh, any discussion?
[1:15:44] So, you're saying there's no parking allowed on Benjamin Boulevard in this?
[1:15:48] That was my motion. Correct.
[1:15:55] He's got enough parking out there. I think
[1:15:57] if he has enough parking off street, it shouldn't be a problem. Yeah.
[1:16:10] Got a motion on a second discussing.
[1:16:16] Not comfortable with no parking on Ben Boulevard. I think if he's does a show
[1:16:21] where he's just showing new art and people come out and somebody wants to
[1:16:26] park on the Benjamin Boulevard, you go in and look at his art. I have problem
[1:16:31] with that. I can park on Benjamin Boulevard and get
[1:16:34] out of my vehicle and walk up and down. I can walk to the town park.
[1:16:45] Just because we list that as a condition, you know, it doesn't mean
[1:16:49] people, you know, aren't going to just park on
[1:16:53] Benjamin Boulevard. I know, but that's that would be a a reason to revoke his
[1:16:58] COP because right
[1:17:00] they violated one of the conditions and I don't know that everybody that
[1:17:06] would come out to Nard Studio would pull into the driveway to park. They don't
[1:17:12] know what they're going to get into in there, how packed it is possibly.
[1:17:18] Well, let's avoid that statement then. No parking on Benjamin.
[1:17:21] You okay with that? Not really, but uh if everyone else feels strongly about
[1:17:26] it, remove it. Remember again, it's not a commercial enterprise.
[1:17:31] I don't know what the town uh we're talking about ordinances. I don't know
[1:17:35] what the town ordinances about parking alongside that road anyways. Maybe
[1:17:38] there's no parking out there already in the book. So, you want to remove it,
[1:17:43] fine. But I can amend my motion to remove that.
[1:17:47] Okay.
[1:17:56] Oh, that's that's a amendment to remove that.
[1:18:01] So moved. Okay.
[1:18:02] Sure. Second. Discussion.
[1:18:06] All in favor? I
[1:18:11] Okay. Future agenda items or no, excuse me. Review review technical memorandum
[1:18:17] number three. Carla, maybe you can refresh my memory
[1:18:22] technical memorandum. You get that refresh version that uh I
[1:18:26] had submitted to Ed about two months ago with some changes.
[1:18:31] If not, I can I can send it to Rich and Okay.
[1:18:34] in a PDF form or something and he can distribute it to everyone.
[1:18:38] Oh, either electronically or hard copy.
[1:18:40] Yeah, I I reviewed that which you changed. I missed a few pages towards
[1:18:44] the end, but was there any big changes in it or
[1:18:48] I don't think so. I didn't find them.
[1:18:50] It was mostly housekeeping stuff as far as changing the language from the uh
[1:18:57] zoning and planning the town plan. That was a lot of it, but there was a few
[1:19:00] other small like incarcerating people for violating
[1:19:04] stuff. I don't think they have the power to do that. So,
[1:19:08] the heat's off.
[1:19:15] Thanks. Moving on. Future agenda items.
[1:19:23] Put that technical memorize number three back on.
[1:19:26] Yeah. And the same old same old with the LUP.
[1:19:31] Yes. Um, also I'd like to see chapter 205.
[1:19:37] Can read this. See? Oh, excellent.
[1:19:40] Where that? What's that?
[1:19:43] What's chapter 205? Chapter 205 is the building
[1:19:45] construction. Oh, yeah.
[1:19:48] We'll talk about it. I want to put signage back on.
[1:19:56] Signs for signage. Yeah,
[1:19:59] enforcement thereof. Enforcement thereof.
[1:20:02] Fine with me. And I don't know if everyone got a copy
[1:20:06] of the draft letter I had for the next gazette, but if you could put that on
[1:20:10] for discussion. Yeah.
[1:20:12] Or in the meantime, you want to give me your feedback. I encourage it. Welcome
[1:20:15] it. I think it's great idea. I'm going to read it again. The spirit of uh not
[1:20:21] chasing down things after the fact. I think notice we can give and educating
[1:20:26] people on what they need to do is is really helpful. So
[1:20:31] forward. I I think another future agenda item, maybe I can work with Rich on this
[1:20:35] one and maybe Katie of just doing a a a summary review of the rental permits
[1:20:40] that if all due by June 15th, I think in in the in the past, some of these
[1:20:49] renewals have snuck in after the 15th and they didn't have to advance to a
[1:20:55] brand new application. So, um it would in my mind be a good idea. um that if
[1:21:03] the applications were late that maybe our ordinance was enforced
[1:21:10] and in having to submit a new application.
[1:21:14] Yeah, we're working on rules for the reason.
[1:21:19] They are. Charlie, have you got time after the
[1:21:22] meeting to go over that letter that you're going to put in?
[1:21:26] Yeah. You have copy? Yeah. Okay. Yeah.
[1:21:29] Yeah. Right. Yeah,
[1:21:33] I got it too. At least you didn't highlight the whole
[1:21:36] thing. Appreciate that.
[1:21:43] And and we can always add stuff to the future agenda items.
[1:21:47] So, here I've got extended public comment. Anybody uh with any thoughts?
[1:21:52] Yes. From 3560.
[1:21:58] I've had several applications over the 20 years we've had a place up here and
[1:22:04] each time there's a port that is on the website or our company here that we fill
[1:22:09] out. Sometimes there's one page, sometimes there five or six and there's
[1:22:13] a fee associated with it. You go through a process like this and all of mine have
[1:22:19] been for finding committee meeting. So that's my experience. It isn't for me.
[1:22:26] When there's a finding, I have never received any sort of formalization to
[1:22:31] say here's the decision. I've never heard it said it was rejected, it's
[1:22:35] proved, it's conditional, not um I went through a very similar
[1:22:39] process. I had a variance for done in Minnesota that we dealt with the DNR and
[1:22:45] it was exactly the same for fill form, pay a fee, aerial surveys, get a survey
[1:22:52] done. So there's some involvement and some commitment on my part. Committed it
[1:22:58] went to about four meetings over a period of a couple months. They finally
[1:23:03] approved it. The next day I get a hard copy. It's called finding facts. And it
[1:23:09] specifically say here's what you ask for. Here's what you get and here's the
[1:23:13] instructions on how you get a dependent to your legal descriptions. Those are
[1:23:17] correct. when I went through the special
[1:23:21] exception application here started in August last
[1:23:26] year. Um, and at that special meeting a week or 10 days ago, you folks
[1:23:32] formalized it, but there's still no recognition that I can go back to to say
[1:23:38] here's what it is and I want to apply for a building permit. So, what I'm
[1:23:41] asking for is if you request an applicant, any of the people coming
[1:23:46] before you, to fill out a form, I would ask you to adopt a form letter reading
[1:23:51] that says here's the plans. So, that there's something that a person has that
[1:23:56] recognizes that you've even been here because I was told I have to go back to
[1:24:00] the many minutes of previous meetings to find what the results were and all it
[1:24:05] said was B was discussing B. And that was it. So I'm just asking for
[1:24:12] some sort of recognition, not necessarily for us, but virtually
[1:24:16] everybody that comes in here that somehow they get acknowledged that there
[1:24:20] was a discussion in the plan confirmation of the decision.
[1:24:24] Yeah. Yeah. You should be getting something
[1:24:26] like that. Yeah.
[1:24:27] Yeah. Completely agree. Yeah.
[1:24:30] Makes sense to me. You too. Being a resident of Minnesota
[1:24:34] and and now a resident of Wisconsin for seven years, things are a little
[1:24:38] different here than Minnesota. Well, I think being on the island is
[1:24:42] part of that as well. That's why we're here. We thought
[1:24:45] it would be more efficient that way. And I know in ' 92 when I was audited by
[1:24:49] the IRS, they didn't tell me why. They just sent me a bill.
[1:24:57] Yeah. Paul, two things Max give something to Jim about limit on
[1:25:05] C's time limits. I always thought it couldn't have
[1:25:10] uh limit on the ownership of the CP. You can go with property state of that
[1:25:16] owner, but then the last administrator told me to change that and you can put
[1:25:22] that limit on there only with that doesn't go with the
[1:25:27] property. I even said prove it to me. He gave me a
[1:25:31] part of a state statute saying that if you got something that Dr. fix that if
[1:25:36] something's changed in recent years. I'd sure like to see a copy of it. So, I
[1:25:39] want to put it in my DOA, but I know law changes all the time, but it just seems
[1:25:44] like you can and you can't. If you can, you can't. Whatever's most current, I
[1:25:49] appreciate it. And the other thing I have is more of a rhetorical question. I
[1:25:53] was just curious, is this a zoning board or economic development?
[1:26:04] Thank you, Paul. Next, we'll do better here in Minnesota.
[1:26:14] Uh, next scheduled meeting August 6.
[1:26:17] August 6th. Mhm.
[1:26:20] 4:30. Mhm. Everybody okay with 4:30?
[1:26:27] What time? Everybody's asking at 4:30. Okay. So,
[1:26:31] it's 4:30. 4:30. Yeah, it's 4:30.
[1:26:35] inside you. Yeah, just a reminder, we have a public
[1:26:37] hearing on August 27th.
[1:26:43] Matt, I looked into uh when we have to get the zoning ordinance to the public.
[1:26:49] Yeah, there's no requirement at all. Nothing
[1:26:52] at all.
[1:26:57] Trial by surprise. Okay, thanks. Should we meet more often
[1:27:04] going into that public hearing? Like I think so. I think we got uh the
[1:27:09] different sections have all come before the TPC and they've approved the drafts.
[1:27:14] So So you'll be presenting
[1:27:21] all the time. You've been working on it longer than
[1:27:23] any of us though.
[1:27:28] You you car
[1:27:34] adjournment.
[1:27:38] Oh, I the this meeting is adjourned. Yeah.
[1:27:41] Thanks. Thanks, Rich.
[1:27:45] Thank you. Good first meeting. Good work on Thanks.
[1:27:48] It's a gold standard packet right there in terms that bag anything, man. I
[1:27:54] appreciate it.
