they've been very thoughtful and

detailed in in laying out um you know
the the property lines um and the stakes
[22:12]
for the garage and for the house cabin
um and and for the deck. um and with the
[22:21]
variance
um they meet or exceed all of their
[22:26]
setbacks. Um so they they came in and
met with Max and I yesterday um if
[22:32]
you'll recall back on 6 public hearing
and there were no comments received
[22:39]
public hearing. Um there's no depicted
wetlands in the immediate area. Um and
[22:46]
uh I included in today's package um
their application and the site map um as
[22:53]
well as some statistics where we
measured the the critical corners
[22:59]
um and they all exceeded the the the
variance in in setback. Um for example,
[23:07]
you know, the northwest corner of the
garage to the westbound was planned at
[23:11]
25.
We measured it at 25 and a half. Um, you
[23:17]
know, and and I've listed those on the
on the last page, but like I said, they
[23:21]
all exceed
those setbacks were um, you know, I
[23:27]
they've put a lot of thoughtful effort
into citing those facilities and and
[23:33]
staying within the the modified um, you
know, modified setbacks.

The only comment
is they're asking for approval for the
[23:45]
the dwelling the deck the garage but
they're dropping they're not asking the
[23:50]
TBC to approve the gazebo just so
because of the issue we have set back
[23:56]
from water so that is not what what
they're asking for

date by the owner around here.

feet wide, the east line is almost the

normal setback. It's it's 48 feet. I
think the normal setback in there is 50.

But there's very good reason for you

know why they've um you know selected
the layout for for the cabin, for the
[24:59]
garage, and for the deck.
I I honestly think they did as as best

as possible with the with the layout.

the, you know, the application isn't
[26:30]
complete. Um, it's not really ripe for
discussion at this point. Um, but we did
[26:34]
get a a great view of where he's
planning and we talked about setbacks.

Um and uh um the next step is uh I' I've
gone through the file and I'm going to
[26:45]
be reaching out to him, if not tomorrow,
early next week with a detailed list of
[26:49]
here's what you need to to submit for us
to to move forward on this.

Well, really the only two that we need
to approve here is is uh Bay Hill
[27:01]
Cottage and uh
Middle Road. So yeah, so the the middle
[27:07]
road, let's let's start there. Um the
address actually should be 1468,
[27:14]
not 1480. Um the same person owns both
of those. Um

uh this is another one in your package
today. You'll find um so you know, I've
[27:26]
taken a more detailed approach to these
TPC review packages. Um I'm open to

suggestions, thoughts. I'm trying to
make um everyone's review a little bit

I describe something um I want it to you
understanding it the same way that that

the application's been filled out

completely and accurately. It was
signed. We have a check for that. Um the

site is staked and measured. Um and as
well as an Ashlin County permit. Um, it

does not need a sanitary permit because
the the pole barn is not having any
[28:21]
plumbing. Um, it is not a nonconforming
lot. I could find no record of that. Um,
[28:29]
and I you'll notice I skipped one on
there and it was the wetland and and DNR
[28:33]
permit. And um, so if you page
there's a page for it's actually in
[28:42]
color. You can actually see the the pole
bar um highlighted it. So
[28:48]
um that's where it's located. Um Max and
I were both out there this morning. Um
[28:54]
it's outside of the thousand foot
criteria, you know, to the shoreline. Um
[29:00]
and then you'll see a couple of pictures
on the next page. One of them that that
[29:04]
documents that I measured from the
closest property corner to the
[29:08]
shoreline. It was 1,035 ft. So close but
outside. Um but the the last exhibit
[29:14]
that's on here well on that page um is a
depiction of the forested and upland
[29:20]
wetlands. Um and this site is very close
to the forested wetland site. Um,
[29:29]
you know, I it's so hard to tell on on
here just due to scale, but um
[29:36]
I think coordination with the DNR is is
is a good idea. Um, and then the very
[29:42]
last page um as I measure it, you're
going to see a lot of measuring from me.
[29:46]
um is I went into an aerial photo and
where the existing road is and more or
[29:56]
less where the site is for that pole
barn and from the road to the wetlands
[30:01]
is about 25 ft, you know, 25.74
ft. So that's one of those that I'm like
[30:08]
it's it's pretty close. You know, I I
can't judge myself 100% accuracy that um
[30:15]
it's missing the wetland.
You didn't have any red flags on your
[30:19]
site visit.
No, no, there was a there was a marker

there, but then I came back and I looked
in Google Earth and then I also looked
[30:28]
at the Ashlin County website just to to
see, you know, we've got the setbacks
[30:32]
from uh Max kind of walked through and
down out to the street and walked

through 40 trees. Yeah. Whenever we had
a question years ago, we'd always uh
[30:42]
confer with John Spangberg who was a
wetland expert or analyst with Wisconsin
[30:48]
DNR. I don't know who Phil, he's since
retired. I think unfortunately he's
[30:53]
passed away, but he was always pretty
knowledgeable about wetland indicators.

Yeah. So, I dealt with Well, I dealt
with some of that in my my past life.

And um to me it didn't jump out that
that it was an issue, but the wetlands
[31:08]
are close.
Um and I just want to be careful for the
[31:12]
town that I'm not approving something

know, investigate it and take a closer
[33:07]
look at it. And um, it is it is a small
deck. I personally when I think of a
[33:13]
deck I think of like this large
structure that's got this is literally
[33:19]
um I don't know 6 in off the ground
maybe
[33:21]
it's more of an apron right
yeah it's it's a very short deck like
[33:26]
one that does it's not high enough that
it actually needs railings um and I know
[33:31]
it's hard to see on here and I'm going
to I'm going to start drawing on these
[33:34]
so you can actually see them but this
building here this this structure here

the deck is literally in front of this
and it's it's a tiny deck. There's there
[33:45]

ordinance. And what I can see is two
spaces in addition to the residential
[38:49]
parking requirements and one space for
every two employees and no parking on
[38:54]

The live music

also gives me some pause and concern. Um
I can understand having music inside the
[39:06]
building such as stereo or radio,
something like that. I'm concerned about
[39:11]
the advertising of live musical
performances
[39:15]
on the premise. Um, I don't think it
should be permitted.
[39:22]
Another concern would be off- premise
directionary signs advertised in this
[39:26]
business.
Obviously, no off- premise directionary
[39:30]
signs should be allowed.
And per the ordinance only one on
[39:34]
premise advertising sign not illuminated
not to ex 12 square feet in area shall
[39:39]
be permitted. The sign shall be in the
lot setback not in the rightway provide
[39:43]
it does not interfere with passage of
vehicles or pedestrians.

And
last but not least would be no retail or
[39:52]
wholesale products may be sold or
offered on the site except those
[39:55]
products and services that are actually
produced on site by the applicant and
[40:00]
associated family members.
It's limited to being operated as an art

property was sold, the new owner would

be able to have the same use until the
end of the term. That's how it works.

police carry decel readers with them. So

if somebody complains, you know,
I don't think anybody's going to

complain. I just don't.
But the point of my concern with that,

sorry to interrupt, is the fact that
it's a home business. if if
[45:17]
they were doing the musical stuff
themselves. But if you're having guest
[45:20]
acts come property, it changes the whole
dynamic of being a home business, does

And it was never loud music that really

was disruptive. It was the 40
motorcycles that showed up that was

disruptive around in our neighborhood.
That's just an example. I would say even

really extreme example. Let's say we've
[1:03:55]
got someone playing that room. So, it's
it's an advertised live music acoustic
[1:03:59]
only one guitar, but that guitar player
happens, this is going to be a stretch,

so give me some leeway here, but that
guitar player happens to be run out,
[1:04:07]
right? or a pretty uh exciting draw. Now
we've got something that's shifting into
[1:04:14]
a music venue a little bit more. And and
I'm not saying they are or not. And I

appreciate the ambient music um sort of
enhancing the experience out there in
[1:04:24]
and of itself. I'm not against that. To
your point, a stereo or something that
[1:04:28]
brings some ambient sound that can be
pleasant. Um, but uh I'm worried about
[1:04:34]
the escalation of what live music out
there could become and having a set of
[1:04:40]
reasonable controls, Paul, you brought
them up of noise um you know uh

violation that can that can actually be
a after the fact remedy. But I think our

focus here is to say shape the

I've had several applications over the
20 years we've had a place up here and
[1:22:04]
each time there's a port that is on the
website or our company here that we fill
[1:22:09]
out. Sometimes there's one page,
sometimes there five or six and there's
[1:22:13]
a fee associated with it. You go through
a process like this and all of mine have
[1:22:19]
been for finding committee meeting. So
that's my experience. It isn't for me.

When there's a finding, I have never
received any sort of formalization to
[1:22:31]
say here's the decision. I've never
heard it said it was rejected, it's
[1:22:35]
proved, it's conditional, not
um I went through a very similar
[1:22:39]
process. I had a variance for done in
Minnesota that we dealt with the DNR and
[1:22:45]
it was exactly the same for fill form,
pay a fee, aerial surveys, get a survey
[1:22:52]
done. So there's some involvement and
some commitment on my part. Committed it
[1:22:58]
went to about four meetings over a
period of a couple months. They finally
[1:23:03]
approved it. The next day I get a hard
copy. It's called finding facts. And it
[1:23:09]
specifically say here's what you ask
for. Here's what you get and here's the
[1:23:13]
instructions on how you get a dependent
to your legal descriptions. Those are
[1:23:17]
correct.
when I went through the special
[1:23:21]
exception
application here started in August last
[1:23:26]
year. Um, and at that special meeting a
week or 10 days ago, you folks
[1:23:32]
formalized it, but there's still no
recognition that I can go back to to say
[1:23:38]
here's what it is and I want to apply
for a building permit. So, what I'm
[1:23:41]
asking for is if you request an
applicant, any of the people coming
[1:23:46]
before you, to fill out a form, I would
ask you to adopt a form letter reading
[1:23:51]
that says here's the plans. So, that
there's something that a person has that
[1:23:56]
recognizes that you've even been here
because I was told I have to go back to
[1:24:00]
the many minutes of previous meetings to
find what the results were and all it
[1:24:05]
said was B was discussing B.
And that was it. So I'm just asking for
[1:24:12]
some sort of recognition, not
necessarily for us, but virtually
[1:24:16]
everybody that comes in here that
somehow they get acknowledged that there
[1:24:20]
was a discussion in the plan
confirmation of the decision.
