Alexander was a two-time all-American

Nick went 24 in singles, including an

8-1 mark in the MACCCC regular season
play. at the NJCAA Division 2 men's

just says that there was um a mention of

reflect what I said the reason the

mission statement the individuals that
were assigned that I have volunteered to
[32:14]
uh be a part of this task force. I even
had one of the members of the task force
[32:19]
come forth and and um and describe his
background and so forth. I think it's
[32:24]
important that the minutes we speak
through our minutes and I think it's
[32:28]
important and incumbent upon us to have
correct accurate minutes and I would
[32:33]
like the minutes to please delineate
exactly what was said, what was brought
[32:37]
up and for the record.

basically that after considerable

discussion and upon recommendation made
by the city of Long Beach tree board,

well, I read the tree board's report and
they are denying to have these trees
[38:40]
cut, but you know, and and it comes
across that it's contrary to what
[38:44]
they're saying in the minutes. It
doesn't make any sense to me. So, I'm
[38:49]
just to just to to let everyone know, I
have a later agenda item on here where
[38:54]
I'm going to propose uh to have the
planning commission me uh meetings live
[38:59]
stream. So, this there'll be no
confusion with this, but the minutes the
[39:02]
way they read don't make sense to me. It
doesn't doesn't sound like it's exactly
[39:07]
what transpired, but I don't know. I
wasn't there. we have we you know but
[39:12]
but to go along with what you're saying
I'm I'm in total agreement with you

Patrick on this on this motion but I
just wanted to put that caveat in there

that um the minutes need to reflect
exactly what business was transpired.

I my name is Ray Boss. Um planning
commission ward three. Um, there was

some discussion on whether or not I
should abstain because I had a personal
[41:06]
interest in it. That was not the case. I
had three people that were in the

neighborhood that told me they didn't
want this to be a short-term rental. The
[41:14]
big thing they were talking about was
there's something in the rental uh
[41:17]
application about having pets that the
yard's not fenced. Um, not only that,
[41:22]
afterwards I found out this house has
been listed on Airbnb prior to approval
[41:27]
of a short-term rental. And I don't know
if they've rented it out or not, but it
[41:30]
just it didn't sit right with me. And
there was a little bit of contention on
[41:34]
whether or not I should say anything.
And in the in the discussion, I guess
[41:39]
they misunderstood saying I was
abstaining. I was voting no to that. So
[41:43]
I and it was a 61 vote. I don't even
know that it'll even affect it, but I
[41:46]
just want to be on record of what I
voted.

» I'm representing Junior Auxiliary of
Gulfport along with a few members of our
[48:42]
executive board. The Gulfport chapter of
JA is a nonprofit that serves children
[48:48]
in Pas Christian, Long Beach, and
Golfport. Last year we served more than
[48:52]
57,000 children through more than 7,700
hours served. um for children in our
[48:59]
community through 12 ongoing service
projects. As a teacher here in Long
[49:04]
Beach School District, I'm able to see
the impact that these projects make on
[49:08]
our students on a daily basis. Just a
few weeks ago, we finished our fill the
[49:12]
bus campaign where we collected and
distributed school supplies to students
[49:16]
in need in our communities. We hosted a
back- tochool bash where students were
[49:20]
able to come and shop our clothing
closets, get free haircuts, and collect
[49:25]
backpacks filled with school supplies.
And then we held a second fill the buzz
[49:29]
event here in Long Beach at our town
green where we handed out an additional
[49:33]
260 backpacks.
One of our most impactful ongoing
[49:38]
projects is called Project Now. This
project fills requests from school
[49:42]
counselors within 24 hours to provide
new clothes, shoes, other basic needs,
[49:49]
as well as filling emergency vision and
dental requests. Just last week, we
[49:54]
provided 25 pairs of shorts to students
at Reeves Elementary through this
[49:58]
project. We also provide hygiene kits to
all the schools in our service area,
[50:03]
sponsor a backpack blessings program
that sends non-p perishable food items
[50:08]
home with children in need over the
weekends. We write pen pel letters back
[50:12]
and forth with students at Harper McConn
to help nurture their writing skills and
[50:17]
give away tens of thousands of dollars
in college scholarships annually through
[50:21]
our collegebound project. Last year,
Operation Christmas Cheer provided
[50:26]
Christmas presents for 33 children at
Corals Elementary and we hosted a
[50:31]
Christmas party at the Gulfport Aquarium
that included free admission for the
[50:35]
children and their families after the
event. Um, I don't want to take too much
[50:39]
more of your time tonight, but I could
go on for much longer talking about all
[50:43]
the different projects and the impact
that they have on our kids here in Long
[50:48]
Beach. And all of these projects are
funded solely through our annual charity
[50:52]
ball. This event is our main fundraiser
and without the support of our patrons,
[50:57]
many of these projects would not be
possible. Um, I printed some of these
[51:01]
for you guys, the patron um, packets. uh
that gives a lot more details about the
[51:07]
specifics and details of all the
different projects um as well as
[51:11]
different levels of financial support
that patrons can provide. So, we hope
[51:16]
that if the budget allows that the city
of Long Beach will consider partnering
[51:20]
with us and becoming a patron for Junior
Auxiliary of Golfport this year. And I
[51:25]

» Good evening. I'm Jonathan O. I live at
2168 Pineville Road here in Long Beach,
[55:30]
Mississippi. And I have lived there for
16 years. I retired out of the military
[55:34]
and my family and I decided to stay in
Long Beach. So, I want to take a couple
[55:38]
of minutes tonight talk about the
commercial or the communication
[55:41]
surrounding the ALPR cameras. They're I
first first learned about these cameras
[55:46]
when one is one. Sorry, I've never
spoken one of these.
[55:49]
» No problem. Take a deep breath. It'll be
fine.
[55:53]
» I first learned about these cameras when
one was when one was installed at the
[55:57]
end of my driveway. It caught me by
surprise and honestly, I didn't know
[56:00]
anything about this program. All right.
And then when I got home that night, I
[56:03]
turn on the news and bam, that's all you
see. You turn on social media, that's
[56:07]
all you see. So, and because of where
that camera is placed, every time my
[56:11]
family pulls out of our driveway,
because it's smack dab right at the end
[56:15]
of my driveway,
that camera is going to photograph my
[56:19]
family on average of 2,000 times a year.
So, I have concerns with that with those
[56:23]
pictures and that data. So, and then I
learned that the city approved this back
[56:29]
in February 18th of 2025 with a grant.
If I'm not mistaken, I saw it on the
[56:33]
agenda or the minutes, but I don't see
anything else on that. I watched the
[56:37]
YouTube video of that meeting and all I
hear is the NCIC, the National Criminal
[56:42]
or National Crime Information Center.
That's all they discuss in that meeting
[56:45]
on YouTube.
So, after that, I still have a lot of
[56:49]
questions um
such as what information are these
[56:53]
cameras collecting on us, especially
when my family's going out our driveway.
[56:57]
Uh who has access to it? How long is
this information kept? and can it be
[57:00]
shared with the other agencies and what
safeguards are in place? I'm I was in
[57:04]
the military. I know how data and how uh
it can be misused. So, and
[57:12]
what does this program cost taxpayers
going forward? I get it's a grant that
[57:15]
was taxpayer money. What's it going to
go forward when no grants run out and we
[57:19]
have to replace these with taxpayer
money from the citizens of the city? So,
[57:22]
I'm kind of concerned about that and I
think they're reasonable questions to
[57:25]
have answers to. Uh,
and that's what I'm want tonight. I want
[57:30]
answers. I want the city to We have
social media and I I know the city is
[57:35]
very good at putting out boil water
notices, construction notices, you know,
[57:39]
road closures. I never saw anything
about these cameras and I'm pretty
[57:43]
disappointed in I come home from an
appointment one day and it's sitting
[57:46]
right there. I don't know what it is.
So, you know, I'm it's going to get my
[57:49]
neck here standing up a little bit. I'm
like, what is this? And I've talked to
[57:52]
my alderman. I'm working with him. I
have faith in him. He said it's probably
[57:56]
going to move down the road. But the
last part of this is, you know, I
[58:02]
believe open communication helps people
understand why the decisions are made.
[58:06]
And I know you weren't here, mayor, for
when that decision was made. You got
[58:09]
elected after that. But public safety is
important to me. I do believe that. And
[58:14]
so is transparency, privacy, and trust.
And that's what I'm getting. I want some
[58:19]
transparency on these cameras from the
city. And I I don't know if that's too
[58:22]
much to ask, but that's what I'm asking
of you. I would otherwise I would never
[58:25]
be here. I I [clears throat] see what
you guys do during the day and all that
[58:28]
and the decisions you make and I never
come to these because I kind of like
[58:31]
what's going on in my city. But that
part right there, it compelled me to
[58:34]
come here. So, thank you for
letting me speak here tonight. I really
[58:40]
do appreciate it and I hope the city
will reconsider or will consider making
[58:44]
this information more readily available
to residents and also consider the
[58:47]
impact on nearby residents when deciding
where these cameras are placed. I don't
[58:52]
want to walk out down my stairs every
morning when I get up and I see a
[58:57]
government camera at the end of my
property. That's the first thing I see
[59:01]
and I don't think any American wants to
see that. But thank you for your time.

the cameras, but from a different
[59:25]
perspective.
It's not just about mass camera
[59:30]
surveillance. To me, this is about the
erosion of our natural and God-given
[59:35]
rights, constitutional rights. I don't
doubt that all of us, everyone in here
[59:40]
wants a safe city. We, for the most
part, have one. What I do doubt is what
[59:46]
was at stake was not fully considered
when we implemented this program.
[59:51]
It's not just about cameras. It's about
constitutional stewardship.
[59:56]
Our constitutional rights don't come
from the government. They they are
[1:00:01]
protected from the government. We the
people, everyone in here, everyone in
[1:00:07]
our city, all of you
are [clears throat] the natural owners
[1:00:11]
of authority. all of us. However, in
your professional capacity as elected
[1:00:17]
and appointed officials, we the people
have entrusted you as our stewards. Not
[1:00:23]
just our city administrators, but our
stewards of our constitutional
[1:00:27]
liberties. Stewards do not own that
which is entrusted to them. We the
[1:00:32]
people do. You all took an oath to the
constitution first and foremost. We the
[1:00:38]
people's concern is also not necessarily
because we distrust our current
[1:00:44]
stewards. The constitutional restraint
and framework exist because we don't
[1:00:49]
know who comes after you. And so that
framework keeps everything in check.
[1:00:54]
Rights and freedoms are never lost in a
sweeping overnight manner. Although CO
[1:01:00]
error uh restrictions attempted to and
in some cases succeeded in doing so, our
[1:01:05]
freedoms are never taken all at once.
They're taken one step at a time. Each
[1:01:10]
step presented as being justified,
reasonable, or necessary for public
[1:01:16]
safety until one day we look back and
realize we've traded away that that
[1:01:21]
which we cannot reclaim.
Some say if you've done nothing wrong,
[1:01:26]
you have nothing to fear. That's never
been the standard in America. American
[1:01:30]
standard is that the government has to
prove it has a reason before it intrudes
[1:01:35]
on our liberty and only then it does so
with probable cause and a warrant. It is
[1:01:41]
never we the people needing to prove
that we deserve liberty or privacy.
[1:01:47]
Here's what I ask of you. This is this
conversation's new. I realize that. I
[1:01:52]
have perused the minutes going back to
January of 24. I can find very little
[1:01:56]
discussion about these cameras yet they
are all around us at every city entrance
[1:02:02]
it appears. I do believe that the
contract or the memorandum of
[1:02:07]
understanding that we have is one of the
most restrictive in terms of the data. I
[1:02:12]
still don't agree with it. I believe
this this will be deemed a fourth
[1:02:16]
amendment constitutional violation in
short order as the Supreme Court updates
[1:02:21]
our fourth amendment which they're
they're in the middle of doing. But when
[1:02:24]
technology advances faster than the law,
will this board heir on the side of
[1:02:29]
governmental power? Or will it heir on
the side of constitutional liberties?
[1:02:34]
Will you be remembered for the wisdom to
restrain technology for the sake of our
[1:02:39]
constitutional liberty and that of
future Long Beach generations.
[1:02:45]
Long Beach is an exceptional city. We
all know that. That's why we live here.
[1:02:50]
Use your stewardship to make Long Beach
the exception to mass surveillance rules
[1:02:55]
and other forthcoming technology
ordinances or laws that limit the rights
[1:03:00]
and freedoms of we the people. Doing so
will shine a positive light on our city
[1:03:06]
and will attract even more
constitutionally oriented people here.

couple months. Uh Joseph being one of

them. We've talked about it and my
opinion I've really kind of dug in the
[1:03:31]
last probably month, month and a half to
the research and and some of it is we
[1:03:34]
all should be a little weary. Uh
not just with flock or I know we use
[1:03:41]
insight. I mean, Insight, the company
that we use, the same as Flock,
[1:03:46]

recorders, lots of companies, and
technically I go buy one and drive the
[1:04:14]
roads all day with it pointed at your
house. Uh, I get a discount if I share
[1:04:20]
that information with the system. It's
not just the cameras that you have on
[1:04:25]
the streets. It's a network of cameras.
You can have them at movie theaters, any
[1:04:29]
private business, and it is not
different systems. It is all one system.
[1:04:33]
And like I said, a lot of it, that's why
a lot of them are free. uh
[1:04:39]
whether what they're doing with the data
or not they're storing I mean it's it's
[1:04:42]
definitely we something that is very
concerning to me uh
[1:04:48]
like I said and we do share some of it
now I know another thing that I find a
[1:04:54]
little scary is like some of our federal
grants now uh to get the grant requires
[1:04:59]
you to share that information with the
federal government uh
[1:05:05]
which we have fun. So, I think we really
need to like
[1:05:10]
take a step and look at pol I mean,
we're talking about ebikes and all this.
[1:05:15]
I mean, this is this is 24hour a day
surveillance.
[1:05:20]
Uh, I think we really need to slow down
and come up with some policies or I
[1:05:27]
mean, if honestly at this point, if it
was up to me, I don't I don't like them.
[1:05:32]
If it was at my driveway, I probably
would have already accidentally ran over
[1:05:35]
it just to be completely honest with
you. Uh, but I do think this is and it's
[1:05:41]
not just one story of misuse. There's
probably somebody currently misusing
[1:05:46]
that information as we speak. It's every
day different stories. Uh, like the one
[1:05:53]
he said with the DEA, the insight,
look at their partners that they share.
[1:05:58]
It's all the way to Lexus Nexus, which
is like the largest police database that
[1:06:02]
you can get. It's got everybody's
fingerprints and DNA and all that. And
[1:06:06]
it's all connected.
One hack. I mean, Chad GPT just got
[1:06:11]
hacked the other day and all these. I
mean, one hack in everybody's travel.
[1:06:15]
And this isn't just a hey, ping you here
or there. This is a constant 20. I mean,
[1:06:20]
it's a surveillance apparatus. And I
don't I might be cynical, but the I
[1:06:26]
don't trust the federal after COVID and
all that like the some of the
[1:06:31]
three-letter agency. I it scares me. So
that's just my personal opinion on it.
[1:06:35]
Like I I am very weary of having cameras
everywhere. And this isn't a shot to the
[1:06:41]
police because I've had countless
arguments and conversations with some of
[1:06:45]
my best friends and family who are cops
and like their job is to protect. This
[1:06:49]
does make it easy for them to protect.
That's their first priority. So this is
[1:06:52]

coming is when you drive by, it can see

your Bluetooth
and everybody in your car, it can tell
[1:07:41]
who you are
by your Bluetooth and stuff. And that's
[1:07:45]
just what's next. I mean, like I said, I
want to say just insight, the ones we
[1:07:49]
have, I think it's on 90 10 billion
license plates read already. That's
[1:07:54]
that's not like

mean, they're tracking absolutely

where their job is not easy. It's their

imagination, but in in my mind, that's
an infringement upon my rights.

but the question is what action are we
going to take? What are we going to do

about it? We can sit up here and talk
about it, but we have to take some

Chief Seal is more qualified, knows much

cameras in the city of Long Beach and
how they're utilized. And I encourage

him to to do that. But I wanted to agree
with Mr. Is it Oen? I'm going to
[1:10:36]
mispronounce it. I apologize.

agree with him in one regard that more
information and dissemination of what
[1:10:48]
they are, how they work, and what they
do would be beneficial to the citizens
[1:10:53]
of Long Beach. Uh there's some obvious
things and some misconceptions
[1:10:59]
about automated license plate readers.
One of them is who gets the information.
[1:11:04]
And Chief Seal can tell you that the
information that these cameras in Long
[1:11:08]
Beach gather, there is a strict
requirement that is for law enforcement
[1:11:14]
resources and and use only and only
agencies that they share it with. The
[1:11:22]
federal government, when Patrick talks
about don't trust the federal
[1:11:24]
government, it's a little bit bigger
than that. And we're not sharing this
[1:11:29]
information with the vast resources of
the federal government. Um, we don't
[1:11:36]
uh make any money. These cameras, like
the ones that you see on social media
[1:11:41]
and the criticism, are privatelyowned
vendors who charge municipalities and
[1:11:48]
other agencies and are revenue driven by
catching expired tags or people without
[1:11:54]
insurance. They are revenue driven. The
city of Long Beach deres not one dime
[1:11:59]
from these cameras. They They are. And
and Patrick, who I respect his opinion,
[1:12:05]
talks about how scared they are. They're
no different from most of you. Ring
[1:12:09]
camera. Gentleman say he's on camera
2,000 times a year. If his neighbor's
[1:12:13]
got a Ring camera, it's that many on his
Ring camera. I got them on my house.
[1:12:17]
Ring cameras, doorbells, and it catches
everybody who drives by. if I was really
[1:12:21]
that interested in looking. They are
really no different with the exception
[1:12:25]
that they are an investigative tool of
the police department of a a certified
[1:12:31]
law enforcement agency who like these
stewards took an oath not to abuse their
[1:12:37]
authority. A and the difference in that
and my Ring camera is that law
[1:12:41]
enforcements have the ability to put
into this system, we have a a homicide
[1:12:48]
that involves a red Camaro, last three
tag digits, XYZ,
[1:12:54]
and and if that camera somewhere in our
city catches that vehicle, it will
[1:12:59]
notify law enforcement, here's where it
just was. And indeed, a homicide was
[1:13:06]
solved in and a substantial assistant in
a murder in the city of Long Beach by
[1:13:11]
just that that purpose, a camera
identified as suspect ve
[1:13:16]
um it is an investigative tool. Is it
could it be considered an invasion of
[1:13:22]
your privacy? Sure. But no more than the
cell phone you got in you. The guy
[1:13:26]
riding down to you in the highway next
to you has the right to pick his phone
[1:13:29]
up and video you. I don't like it. makes
me uncomfortable. I I'm not sure I'm
[1:13:34]
scared by it because I'm not more any
more scared by Ring cameras on my
[1:13:39]
doorbells. Um they are a legitimate
investigative tool which should have
[1:13:45]
some guard rails and does. Um, and at
some point we have to disseminate enough
[1:13:52]
information, as you suggested, and
educate our citizens to not be scared of
[1:13:57]
them and to understand they're there to
assist law enforcement to protect
[1:14:02]
persons and property. And it's a
valuable tool so long as it's not
[1:14:06]
abused. I agree with that. And at some
point, like the stewards of your city,
[1:14:10]
you have to with checks and balances
trust law enforcement not to abuse their
[1:14:16]
authority. and they can be uh a terrific
assistance to law enforcement. It's my
[1:14:21]
my experience as as a citizen in in my
town in my city and as a former
[1:14:28]
commissioner of the Mississippi
Department of Public Safety quite
[1:14:31]
frankly and I just want to share that
with y'all.
[1:14:33]
» And my fear maybe not well a little bit
still now uh but is this is just the
[1:14:40]
beginning is where does it go? I mean,
I get even maybe I would concede to if
[1:14:47]
you have one at the entrance of Long,
the entrances and the exits, but like
[1:14:53]
when you start putting them in
neighborhoods, that's different because
[1:14:57]
I mean to me, uh, but if it was taking a
picture of my house every time somebody
[1:15:02]
passed it, not only put out of your
driveway, I'm sure we have some or
[1:15:06]
there's some that every time somebody
pass it, it's taking a picture of
[1:15:09]
somebody's house. and a cell phone. If
if uh somebody a police officer wants to
[1:15:14]
get my cell phone records, they're going
to have to go get a warrant and
[1:15:19]
go to my cell phone company. These
cameras can easily be abused. Uh it is
[1:15:24]
on the police department, which I am
fully 100% sure that our police
[1:15:29]
department is doing what they're
supposed to do as far as auditing these
[1:15:32]
things. But you can't audit everyone.
And if other agencies around here, all
[1:15:36]
it takes is one bad actor. And I I just
that definitely just scares me. I know.
[1:15:43]
I mean, look in other countries. Look at
China. I mean, everything you do is on
[1:15:49]
camera and there's consequences to your
actions there. And some people are using
[1:15:52]
these as ticket writers and things like
that. Uh Ocean Springs, other places
[1:15:58]
locally. Uh like I said, just very scary
to me. And I think lack of information
[1:16:04]
or lack of even on my part also even
looking at it for the month is the lack
[1:16:09]
of knowledge. And then I think all of us
probably not to throw y'all in with me
[1:16:14]
because I'm as simple as they come, but
uh I don't think any of us know enough
[1:16:20]
about them to have 12 and have them in
neighborhoods.
[1:16:25]
That just seems like a overreach. We're
one of the safest communities in the
[1:16:29]
country. It looks like Chief Seal has
we
[1:16:36]
all chief, you have a few words to say.

Genitech
is the company name. Genitech G nec.

Anyone
[1:16:53]
needs to look that up? Uh they were
purchased. We've had them since uh those
[1:16:59]
since 2004,
the end of 2004.

Uh they were provided to us on a trial
run. Uh we sought out and got a grant uh
[1:17:12]
homeland security grant that paid for
those.
[1:17:15]
We do not share it with the federal
government. Uh we share our information
[1:17:22]
with uh Pascers, Jan, Beluxy, and
Gulfport.
[1:17:26]
Uh the tags, it takes a picture just of
the tag on the car. It doesn't take a
[1:17:32]
picture of who's in the vehicle.
It picks up the numbers.
[1:17:38]
Uh
it is stored for 90 days.
[1:17:43]
That is it. It's not sold to anyone
else. It's strictly used for law
[1:17:47]
enforcement purposes.
Uh
[1:17:51]
I was trying to think whether his
particular questions. Uh Alderman uh
[1:17:57]
Bonds called me about the location of
that one. That one was placed on
[1:18:01]
Pineville just inside the city limits
from uh Espie where we had a lot of
[1:18:09]
problems with uh people coming in off of
Cronier and the Pineville community
[1:18:14]
committing crimes in Long Beach. So
that's why that was picked there. He
[1:18:19]
brought the concerns of the gentleman to
me. Uh we have sent went out there with
[1:18:24]
with public works and it's going to be
moved 50 to 100 feet down the road out
[1:18:30]
from in front of his house.
Uh it was it's in a city easement across
[1:18:35]
the street. It's not on his side of the
road. And so he brought that concern
[1:18:41]
through his alderman and we definitely
you know took that into account and able
[1:18:46]
to move that.
[1:18:49]
We've actually had LPRs in Long Beach
since 2019.
[1:18:55]
First one we we purchased and it was at
Klondike and 28th Street and it's
[1:19:01]
mounted on it was mounted I think the
cameras are actually still up on the
[1:19:05]
traffic lights but they're they don't
work. They're out of the companies just
[1:19:10]
never came and taken them down. They
don't power or nothing to them. uh they
[1:19:17]
all are placed to uh the ingress and
egress of the city,
[1:19:24]
not in neighborhoods. uh their systems
that some agencies have on the coast
[1:19:29]
that uh
people freely give access to their Ring
[1:19:36]
cameras and it's dumped into police
departments picking everything up and
[1:19:40]
you have to go basically back you know
which the fourth amendment where do you
[1:19:45]
have expectation of privacy at and you
don't have expectation of privacy
[1:19:50]
driving down the road
that simple somebody take your
[1:19:55]
you have expectation of privacy in your
home.
[1:19:59]
Uh this has gone uh many several courts
of appeals including our fifth uh
[1:20:07]
circuit and they have ruled that it's
not unconstitutional.
[1:20:12]
It's up to the Supreme Court and they
rule it is then
[1:20:17]
have to remove them. But uh it's a very
valuable investigative tool
[1:20:24]
and I I understand the transparency, but
I'm I'm not going to publish
[1:20:31]
every investigative tool I have for
every criminal to know. Uh law
[1:20:37]
enforcement as a whole is struggling to
keep up technology wise, firepower wise
[1:20:43]
with criminals.
So, uh, used them. We found missing
[1:20:51]
people. Uh, as soon as we put these up
on the East Railroad, there was a drive
[1:20:57]
by shooting and within minutes we had a
suspect
[1:21:02]
by this camera,
made an arrest. We had a murder a couple
[1:21:08]
months ago on Allen Road.
picked the vehicle up, was able to get
[1:21:13]
the tag number, and made arrest in less
than 24 hours.
[1:21:19]
I think it's a valuable tool for public
safety. Uh, and and you're right,
[1:21:25]
Patrick, there's a lot of private You go
to Lowe's, Lowe's has block cameras.
[1:21:29]
They've had them for years. Walmart have
I mean pretty much every big box
[1:21:33]
retailer
>> a lot of uh not not here but uh in
[1:21:38]
bigger areas homeowner associations
and their homeowner dues pays for them
[1:21:43]
at the entrance to their uh
neighborhoods
[1:21:49]
again it's not
I know on the coast there a bad rap
[1:21:55]
ocean springs and I think Beluxy had had
them and that sent insurance tickets.
[1:22:01]
Uh there's another company out now that
and it's illegal to do speed enforcement
[1:22:08]
and traffic enforcement
uh automated like that, but they're
[1:22:13]
pushing now where you can uh handheld
radar guns and with a camera and shoot
[1:22:19]
and it mails the ticket. And we're not
we're not getting into anything like
[1:22:23]
that. The these are not for any type of
traffic enforcement or vehicle
[1:22:27]
enforcement. It's strictly an
investigative tool and there's uh
[1:22:32]
safeguards. We do run audits and if you
run a tag number in there, you have to
[1:22:38]
put a case number or a reason why. If an
officer logs in there to research
[1:22:44]
something, they have to put the case
number or the reason why so we can go
[1:22:49]
back and audit. We have a LPR policy
that includes in it misuse could could
[1:22:56]
lead to termination and it could lead to
criminal charges.
[1:23:01]
There unfortunately every profession but
every [clears throat]
[1:23:05]
there's there's bad apples in no matter
what tool you have.
[1:23:11]
If you have a taser, somebody can misuse
that, you know, and abuse it. Uh so it
[1:23:16]
it's all just on on your uh
your agency to follow the policies and
[1:23:23]
ensure that it's being done correctly.
[1:23:28]
» And and if anybody wants to, y'all could
have called me and got this information.

» So I'm hearing that it's a lack of
information. Maybe we could put some
[1:23:42]
facts
uh out on the city web page and maybe
[1:23:46]
clear up some of the confusion, but I'm
like [clears throat] uh our attorney is
[1:23:51]
a tool and that tool is to be used
correctly and I think it's a deterrent
[1:23:57]
uh for crime in our city, which I think
we're the number one safest city for
[1:24:01]
serious crimes. Would we be that if we
did not have those cameras? Uh you just
[1:24:06]
don't really know. But the thing about
it is they know if you don't have them
[1:24:11]
because then they got free reigns to go
where they want to do. So I see both
[1:24:15]
sides. Uh

of us should

is a societal American issue that we're

be on a camera 24. And I get private

public of the intent of these cameras.

Let's then step back and think about how
we're using them and see if we want to
[1:25:25]
go forward with them or not. But let the

know, some of the questions you heard in
[1:25:33]
here tonight and and try to help explain
them to the public. So, I think a good
[1:25:39]
opportunity to do that also, Courtney,
would be when uh Billy has uh the night

out against crime.

things they don't fully may not fully

educating people of what we use them

right direction to assure that we are
using them correctly. And so, uh, if we
[1:26:25]
could, let's just, uh, I don't know if

subdivision Compass Cove on Johnson
Road.
[1:30:23]
live at two Golden Drive, Gulport,
Mississippi. And um we've designed the
[1:30:28]
subdivision without any retention
basically because the site is full of
[1:30:33]
live oak trees and it's very flat and
detention was is basically impossible to
[1:30:39]
build without building up the entire
site to get an outfall for detention
[1:30:43]
pond. And uh to do that, you would
affect live oak trees and possibly
[1:30:49]
damage and lose more than he's already
been permitted to remove. The uh
[1:30:54]
drainage ordinance has a provision where
any site less than 3 acres and you're
[1:30:59]
filling less than 50% imperous surfaces
are exempt from the uh storm water
[1:31:07]
ordinance, the detention requirements.
Mr. ball. I respect his opinion, but he
[1:31:12]
feels that the newer ordinances have
have overridden this, but we couldn't
[1:31:17]
find any language that says that. And
there's a provision that if it's less
[1:31:22]
than three acres, you filling less than
50% of the property with with hard
[1:31:28]
surfaces. And I've done a calculations
on the surfaces, houses, driveways,
[1:31:33]
and sidewalks, and it's like 47%. I feel
I'm being conservative. That's probably
[1:31:38]
higher. and the covenant could actually
address that if need be to protect that,
[1:31:44]
make sure the site's not developed over
50%. But I guess we need to defer to the
[1:31:49]
attorney, Mr. Simpson, to review the
ordinances and see if that provision is
[1:31:53]
still valid or not. And uh there there
are new ordinances since that was
[1:31:59]
passed, but I can't really find where
that one was would say is not in effect
[1:32:03]
anymore. So, it was put in there for a
reason to allow. And this Johnson Road
[1:32:08]
site is basically flat. We're actually
some of the drainage goes to the south
[1:32:13]
toward Bo Brawn Drive and we're actually
reducing the drainage flow to that area
[1:32:18]
and Mr. Ball agrees with that. Rest of
it goes to Johnson Road and we've been
[1:32:23]
watching it through these torrential
rains we've had including the the
[1:32:27]
tropical storm and everything floods for
a little while but it's been draining
[1:32:31]
off great. I've talked to Mike Bulky who
lives on Southern Nooks Drive. He said
[1:32:35]
they hadn't had any drains problems even
during these torrential rains. And the
[1:32:39]
amount of increase we're increasing it
will be basically contained in the road
[1:32:45]
until it dries till it drains out which
it's such a small site to begin with.
[1:32:50]
It's it's not going to take long for
anything just like any detention area
[1:32:53]
would drain out. So, we're asking to u
that your your board accepts the uh
[1:33:00]
provision of that ordinance allowing the
exemption and um allow Mr. Mr. De's to
[1:33:07]
proceed with development. Otherwise,
he's going to cancel the whole project.
[1:33:11]
He's got seven lots there plan on
building very expensive houses just
[1:33:15]
because the value of the cost to develop
it. Probably half a million dollars and
[1:33:20]
up houses. And there's if this can't
this variance can't be approved then
[1:33:25]
basically the project will die and he'll
you'll allow be build three houses on
[1:33:29]
the property as as the ordinance
requires.
[1:33:34]
That's our request to review that
drainage ordinance.
[1:33:38]

issue um sometime early last week I
[1:33:48]
think David maybe even the week before.
uh and his office, we sat down and
[1:33:52]
looked at the ordinance
um conflicts is is really the only way I

know how to explain it. Uh section 174
of our land use ordinance article 15 as
[1:34:06]
Mr. Nissel represents creates an
exemption
[1:34:11]
uh for um avoiding postdevelopment
runoff if the site is less than 3 acres
[1:34:18]
and less than 50% imperous surface which
he represents in his platinary
[1:34:25]
plat that that it is. Um the problem
with that and and that reads fairly
[1:34:32]
clearly when you look at it on its own.
The problem is the very next section 175
[1:34:38]
says that each proposed residential or
commercial
[1:34:43]
uh or industrial development provide
detention basins to distort storm water
[1:34:50]
runoff in excess of the volumes before
the development. When you read those
[1:34:57]
right next to each other, they're
they're inconsistent with one another. I
[1:35:00]
I think section 175
does not contemplate a a 3acre size or 3
[1:35:08]
acre development relatively small with
less than 50% impervious service when it
[1:35:14]
talks about detention basis but
particularly when it's talking about
[1:35:20]
residential commercial and industrial
development
[1:35:24]
and when you also consider 1674 talks
about an exemption exempt from what I I
[1:35:31]
can only imagine maybe exempt from 175,
but it is not clear. It's clear as mud
[1:35:36]
when you read them separately and when
you put them next to each other, they
[1:35:40]
they're in conflict one another. But Mr.
Leisel is correct in that 174 appears to
[1:35:46]
provide an exemp an exemption for his
size development with with less than 50%
[1:35:53]
impervious surface. I know Mr. ball
later in this agenda has a has an
[1:35:58]
ordinance proposal to try to clarify and
prevent this conflict from arising in
[1:36:04]
the future. But these two sections are
inconsistent with one another is the
[1:36:10]
best explanation I can give you. David
may want to speak to it as well.

» Well, our position is that if there's an
exemption, there's an exemption.
[1:36:18]
Otherwise, why even have that paragraph
in there? Because if it's going to be
[1:36:21]
negated by another paragraph, why is it
even in there to begin with?

uh person that had that property have a
retention pond drawn up on that thinking
[1:36:37]
that he needed it.

looking at the plans that I saw, it's I
can't even see.

actually draining to [music] the street

and it drains out towards a big canal a
couple.

engineer. And our engineer says that it
[1:37:33]
will affect surrounding
areas,

» the downstream ditch basically because

» that's comes that was in his study. So
if you're if you were asking me, I live

down the road from you. Am I in favor of
Heck no. I'm going to get water in my
[1:37:48]
yard just because he built the
subdivision there. Is that fair to the
[1:37:51]
people that live in the neighborhood?
>> I don't know. I'm not an engineer, but
[1:37:54]
he is.

tension. And it's usually larger
subdivisions that do put a big impact.

» But it doesn't have to be a large
subdivision. It could just be a lot

affect your neighbors to the next either
either side of you.

» It's not it's not affecting neighbor
either. It drains into the street.

Everything I've designed drains into the
road unlike the one that Mr. Balls Boss
[1:38:18]
had done drains towards Bo Braun and
there was no drainage going there at
[1:38:22]
all.

through somebody's backyard.

ditch and there's an exemption that

[1:38:42]
situation you're in right now uh that
we're doing the same exact thing. So, if

we go down that road and start doing
exemptions, how you going to stop it?

but right now the ordinance allows for
[1:38:55]
it. That's what we relied on. If you
read 175, it don't matter how big your
[1:38:59]
lot is, how small it is, what big your
subdivision, you'll affect your
[1:39:02]
neighbor.

it avoids that. It says it's not
applicable. That's exactly what it says.
[1:39:10]
» And I don't think that was the intent.
Why would I Why would I allow you to
[1:39:14]
build something that's gonna negatively
affect your
[1:39:17]
because they said they looked at when
they drew it up or they wouldn't put it
[1:39:20]
in there said if it's less than three
acres and you're only improving less
[1:39:23]
than 50% it's not going to have a great
negative effect. That was the whole
[1:39:28]
purpose of it.

Simpsons represented the the issues that

made. I mean, the pro the the the
[1:39:47]
exemption is in the ordinance for a
reason.

increase in the in the impact of this
property to the city's infrastructure

[1:41:18]
this torrential rains we've had we've
been out and looked at it nobody's
[1:41:22]
complained about the drains getting near
their house and we're in the amount that
[1:41:26]
this little small seven lots is going to
prove is a drop in the bucket especially
[1:41:31]
considering these tropical storms we
just had with 12 inches of rain.
[1:41:35]

>> And if you didn't have any complaints,
[1:41:37]
then this little seven lots is like,
like I say, a drop in the bucket of the
[1:41:42]
increase. It'll that's what the
exemption I think is for for smaller
[1:41:46]
developments with a 50% or less
improvement area. And that's exactly why
[1:41:51]
that ordinance is written that way.
Somebody wrote it for a reason.

The ordinance needs to be cleaned up to
[1:43:01]
say exempted from what? Exempted from a
detention basin or from running on other
[1:43:07]
people's land. Yeah. The answer to that
ought to be no. You're not exempted from
[1:43:11]
damage in your neighbor's land. But you
are exempted if it doesn't u create a
[1:43:17]
burden on on adjacent property. It
should be cleaned up to say that. And I
[1:43:21]
think that that's David's recommendation
quite frankly. I
[1:43:25]

I kind of have to agree with Mr.
[1:43:28]
on this.

have the option to put a retention pond
in. He could go re-elevate the entire

channelizing a tiny bit on the south but

there there's a he he's reducing the
flow rate that crosses the property line
[1:44:20]
into Bo Braraw because he's going to
build ridge lines. his properties uh the
[1:44:25]
houses will be constructed so that a big
chunk of the lots the new lots will
[1:44:29]
drain to the street.
>> So less area is going to drain across
[1:44:33]
the southern property line to Bo Braun
and the majority of the rest of the
[1:44:38]
property and in fact all the property
will either drain to the street and then
[1:44:42]
out to Johnson Road or it'll drain
through the side through the rear yards
[1:44:46]
to Johnson Road. So, I don't think that
he's really negatively impacting
[1:44:53]
properties, adjacent properties. The the
impact I was concerned about is that it
[1:44:57]
will increase this property's impact to
the city's infrastructure, the
[1:45:03]
downstream drainage infrastructure,
which I think could have impact
[1:45:07]
downstream and to the upstream
properties. I mean, if you're using more
[1:45:10]
capacity in the ditch because of this
property, then it could have an upstream
[1:45:15]
impact, too. But but I guess do we have
excess capab capabilities that if it
[1:45:21]
does flow is it going to I think you
said when it rained hard you it really
[1:45:24]
wasn't a big impact. So

have not done that

and we can't undo if they affect
[1:47:25]
neighboring properties. uh we're going
to have to go back and fix that and

people can say why did you allow it just

have to abide by the ordinance the way
it's written but I don't have to like it
[1:47:37]

measure 3% impervious effect

torrential rain like we've had you're

And by these storms that we just
witnessed, it's obvious this 3 acre site
[1:48:04]
falls right in that exemption
requirement. I mean allowance because it
[1:48:09]
wouldn't affect it at all at all in that
storm. I don't care if it was solid
[1:48:12]
concrete or solid dirt. It's all going
to run off in those type of rains. So
[1:48:16]
that's why that provision was put in
there. Four small sites that you fill
[1:48:20]
less than 50%. I don't think it's a bad
one, but the only way to fix it would
[1:48:24]
just take that out altogether and just
and then it wouldn't we wouldn't have
[1:48:28]
any,

And I'm I have a lot of people from out

of town and a lot of local people that
come in to see me and they're concerned
[1:52:28]
about some of the issues about closing
the street because it's affecting a lot
[1:52:33]
of the local business. A lot of people
don't know how to maneuver around when
[1:52:36]
the street is blocked.
And we really want more people to live
[1:52:41]
here. We want to bring encourage people.
It's one of the top cities to live in in
[1:52:46]
the country right now. And we want to
encourage that. Too often people want to
[1:52:53]
make dollars and the rule for the
residents is left out. It they they they
[1:52:59]
just want to welcome people here and not
be up to the developers that going to
[1:53:04]
make the money.
[1:53:08]
My uh other concern is closing the the
street that affects the farmers market
[1:53:15]
and it's been moved many times in the
last several years.
[1:53:20]
The the farmers market people, we really
need them. They bring fresh produce,
[1:53:24]
fresh vegetables, fresh meat. And when
the local people can't go there to buy,
[1:53:28]
these people have prepared it and they
show up and their space is not available
[1:53:32]
and they either have to leave and take
their product home.
[1:53:38]
Um, I'm uh concerned also about the um
you call them Airbnbs, the rentals.
[1:53:47]
The short-time rentals are are
wonderful, but we don't want them taking
[1:53:51]
over our local neighborhoods. It's an
issue to most of us that live in the
[1:53:56]
neighborhoods, and we're seeing them
come in. And I think that they should
[1:53:59]
limit the how many they allow every
every year, all the new ones coming in
[1:54:05]
and how many in an area, and just keep
our neighborhoods nice and safe.
[1:54:11]
We need to find a way to promote
residential growth, and I agree with
[1:54:15]
that.
But we wouldn't want the developers
[1:54:18]
coming in from out of town, making the
money, and then leaving our little
[1:54:21]
community.
I'm just happy to live here and happy to
[1:54:25]
have y'all as my neighbors.
And um we were the first new business to
[1:54:31]
open south of the tracks after Katrina.
So, I've been here quite a while. I

had some discussion earlier about the

planning commission. The planning
commission um is very important to how

we conduct business in our city. And I
think it's incumbent upon us to try our
[1:55:08]
best to um live stream the planning and
development meetings. That way there'll
[1:55:14]
be no question as to what occurred and
what have you. We have a lot of people
[1:55:18]
that look at our board meetings via live
stream. I reached out to um um you know
[1:55:25]
to try to find out some cost and
everything and with um Mr. Triplet and I
[1:55:30]
think he gave some of these costs he
told me to um to Courtney. But we I I
[1:55:36]
think whatever it cost, you know, we
need to really take a serious look at uh
[1:55:40]
make a commitment to transparency with
the planning commission meetings. Um
[1:55:48]
and I'd put this put in the form of a
motion. maybe we can, you know, talk
[1:55:52]
about it. But, um, my motion would be to
to do it, put our best foot forward and
[1:55:57]
try our best to come up with a plan to,
uh, live stream our, um, planning and

development commission meetings.

least watched on YouTube was 16 people.

So over the uh average is about 314
views.

That's that's this meeting where the
work is, you know, approved or denied
[1:57:00]

I look at it and I go, "Okay, is that
[1:57:05]
using our using our
population of 16,500?"

Just going off of our last survey, I
mean, uh, census. Thank you, sir. Um,
[1:57:18]
that's 2 and a half% of, uh, the people

have and and I think that that estimate

got down to uh a number that's a whole
lot closer to our original budget and I

reduction. Um, so the revised contract

amount would be $2,830,895.

Uh, it's our suggestion that that you
could recommend approval. Um just for
[2:50:59]
the time base it's going to be it's also
might want to make known that it is a
[2:51:03]
unit price job so you're only going to
pay for what we install. Uh Bores is
[2:51:07]
[snorts] also doing the all FEMA repair.
So with them doing both there are going
[2:51:12]
to be increased efficiencies and stuff
we will not have to do like termination
[2:51:16]
boxes. They can just do a full run. We
can't quantify that right now because
[2:51:20]
we're not allowed to mess with any of
the stuff inside the bid. But later on
[2:51:25]
once we identify later on
[clears throat] we can but this is as
[2:51:29]
much as we can do right now. Um so I
kind of outlined my understanding of the
[2:51:35]
procurement process and what needs to be
done next officially. Um, so we got to
[2:51:41]
recognize the original bid at the
original amount, acknowledge the
[2:51:46]
negotiated deduction, uh, obviously
accept it, uh, and know award the
[2:51:51]
contract and then authorizes to proceed
with the execution of the contract. Mr.

any of this. U, but that's our

suggestion. Otherwise, you could lose
anywhere from 2 to 3 months. And we
[2:52:06]
really need to get this project started
no later than October so that we can
