[0:00] Just come up and state your name and address, please, sir.
[0:06] » Blaine Sutton, 130 Dearman. Thought my neighbor was going to be here. She's
[0:10] next door to the property, but I helped her with this property. Uh the property
[0:14] was overgrown and the rear door has been open for the last six months. I just
[0:20] wanted to make sure that uh that the house was walked around to make sure
[0:25] that the door was open, closed. I haven't been by it lately. So, I just
[0:30] want to make sure it's more than just the tree. I mean, the grass that's being
[0:35] looked at that it has been walked around.
[0:38] » I didn't see the back door on there. >> All right.
[0:44] Anyone else? For or against? Can I get a motion to close the public
[0:49] hearing? >> Some move.
[0:51] » Second. >> Second. Pleasure of the board.
[0:54] » Motion to adjudicate. Motion [snorts] to adjudicate.
[0:58] » So moved. >> Got a second.
[0:59] » Discussion. >> Discussion.
[1:00] » Just uh in the motion, just to make it clear, the grass is cut, but uh we need
[1:08] to make sure that the building is secured.
[1:12] » It's in the motion. All in favor? >> I.
[1:15] » All oppose? Motion carries. Next, uh I want to open a public hearing
[1:20] on Ocott Station Cove Lot 22. Can I get a motion? Motion
[1:26] » second. Second. Can you read the notice, please, Emma?
[1:29] » We've got copies. >> Notice of hearing was posted on subject
[1:32] property Scott Station Cove Lodge 22, Long Beach, Mississippi on July 27th,
[1:38] 2026 by zoning enforcement officer Dale Stoner and sent via certified mail to
[1:43] James and Anthony Holston at 1 19765 Westworm Road, Social,
[1:49] Mississippi 39574. notice was returned to sender on August
[1:53] 11th, 2026. >> Is there anyone in the audience that's
[1:57] for or against Scott Station Cove? >> Anyone for? Anyone against? [snorts]
[2:03] [clears throat] >> Can I give a motion to close the public
[2:05] hearing? >> So move.
[2:06] » Second. >> Motion to second. Any discussion? All in
[2:09] favor? >> I.
[2:10] » Pleasure of the board. >> Motion to adjudicate.
[2:13] » Second. >> A motion. Second to adjudicate with
[2:16] discussion. >> Mike, have you looked at these pictures?
[2:19] » I did not. Dale said it looked like somebody was out there cutting it.
[2:22] » That's what I was looking at. But it's it's super zoomed in. That's why I just
[2:26] want to make sure that what we're looking at there.
[2:29] » That's what they were working on, but like they only done the front half at
[2:31] this point. >> I think as long as we adjudicate that
[2:34] gives us the >> opportunity to go back in without going
[2:36] through the process. >> I just wanted to make sure we were being
[2:39] specific. >> All right, we got a motion. Had some
[2:41] discussion. All in favor? >> I.
[2:43] » All oppose? Motion carries. Next one is uh we can I get a motion to
[2:49] open the public hearing concerning 219 Clower Avenue?
[2:52] » Motion. >> Second.
[2:53] » Second. Emma. >> Notice of hearing was posted on subject
[2:57] property 219 Clower Avenue, Long Beach, Mississippi on July 31st, 2026 by zoning
[3:02] enforcement officer Dale Stoner and sent via certified mail to Ruth Williams um
[3:08] 18 219 Clower Avenue, Long Beach, Mississippi 39560. Notice had not been
[3:14] delivered as of August 14th. Is there anyone [clears throat] here to
[3:17] talk for or against 219 Clower Avenue? Anybody for or against? Nobody showing.
[3:24] Can I get a motion to close? Got a second. All in favor?
[3:28] » I. >> All oppose. Motion carries. Pleasure of
[3:30] the board. >> Mr. Mayor, I think uh looking at the
[3:33] pictures, I believe that this is in compliance. It looks like the grass has
[3:36] been cut. >> Okay.
[3:41] So, it looks like uh the issue has been taken care of. Uh, do we
[3:45] » unless somebody else sees something that I'm not looking at.
[3:49] » My only thing is with these properties, I think we need to and that one's fine,
[3:54] but the intention is not to have someone come cut them and take care
[4:00] of them every time we have to go through this process. It's
[4:04] » totally agree, but can we legally do that?
[4:07] » No. >> No.
[4:08] » No. I'm I'm just if they're in [snorts] >> understand and and it's an exercise that
[4:12] we end up doing every 90 days and and the neighbors around it get for a lack
[4:17] of better words pissed. I mean because what's the city doing other than we're
[4:21] sending a letter we're spending money taxpayer money to tell you to cut your
[4:25] grass, clean up your house. I mean, it it it it's very frustrating, not only
[4:31] for the the neighbors, but for us to continually get the calls as a board
[4:36] member saying, you know, sign this form and we'll take care of it. And all they
[4:40] do is run out there and cut the grass. So, uh, I'm just voicing a little
[4:44] concern. >> That's fine. It looks like we don't need
[4:46] a motion on that one. That one's kind of taking care of itself.
[4:50] » Uh, I think we I think we still need, uh, a vote on it being in compliance.
[4:55] » All right. So let's take a motion to Donald saying it's in compliance.
[5:00] » Second. >> Second. Any other discussion?
[5:02] » All in favor? >> All opposed? Motion carries. Next one.
[5:06] Can open the uh open the public hearing concerning 911 Beatress Drive.
[5:14] » Motion. Second. >> All in favor?
[5:16] » I. >> All opposed. All right. Emma. Notice

[5:23] Mississippi on July 30th, 2026 by zoning enforcement officer Dale Stoner and sent

[5:49] the public >> motion? Second.
[5:51] » Second. >> All in favor?
[5:52] » I. >> All opposed.
[5:54] » Motion to adjudicate. >> Second.
[5:56] » Second. >> Motion to adjudicate. [snorts]
[5:57] Got a second. Who was that? Pete. >> Yes.
[6:00] » Okay. Uh any discussion? >> All in favor?
[6:04] » I. >> All oppose? Motion carries. Can uh next
[6:09] one, we're going to open up the public hearing for 601 and 603 East Fifth
[6:15] Street. Can I have a motion? >> Motion. Got a motion.
[6:19] » Second. >> Got a second. Emma, could you?
[6:22] Notice of hearing was posted on subject property 601 and603

[7:08] » All in favor? >> I.
[7:10] » All opposed. >> All right. What's the motion? The
[7:13] » motion to adjudicate. uh did speak to the property owner. They're going to
[7:18] they have somebody lined up to cut it. Um it just as of this meeting, it's not
[7:22] cut. So, it is not in compliance. So, that's why I make the motion that uh we
[7:27] go ahead and adjudicate. >> Got a motion to adjudicate. We got a
[7:32] second. All any All in favor? >> I.
[7:35] » All opposed? Motion carries. Next one, we've got amendments to the municipal
[7:40] docket. There's two things that I'd like to move up and bring into executive
[7:45] session.
[7:48] Trying to see what the number of that one is.
[7:52] [cough and clears throat]
[7:58] What's that number, Emma? That >> number two under new business.
[8:02] » Huh? >> Number two under new business
[8:04] resolution. >> Okay. So want to go into executive
[8:09] session to discuss number two on the new business. Can I get a motion?
[8:13] » Motion to move. >> Second.
[8:16] » Second. >> All in [snorts] favor?
[8:18] » I. >> All right. Now, can I get a motion to go
[8:21] into executive session? >> Motion we go into executive session.
[8:24] » Second. >> All in favor? All
[8:26] » oppose? Motion carries. All right. [cough]
[25:18] out of executive session with no action taken. Second.
[25:21] » Second. Any discussion? All in favor? I. >> All oppose.
[25:25] » Can we have a motion to adopt the resolution?
[25:28] » So move. >> Got motion to adopt the resolution.
[25:32] » Second. >> Got a second. Any discussion?
[25:35] » Uh just to be more definitive, the resolution adopting services and
[25:40] facilities plan for the annexation. Yep. [snorts]
[25:43] [clears throat] >> Roll call. I
[25:46] » two I. >> Thre's I.
[25:50] » At large is I. >> Four's eye.
[25:53] » Five's I. >> Six is I.
[25:55] » All right. Everybody voted I. Motion carries.
[26:00] All right.
[26:03] Now, can I have um a motion to approve the municipal docket?
[26:08] » Motion. >> Motion.
[26:10] » Second. Second. All in favor? >> I.
[26:13] » All opposed. >> Motion carries. Now we've got public
[26:17] comments.
[26:22] » Looks like two of them is 18 and one of them's on nine.
[26:29] Which one are hidden?
[26:33] I guess that's the cameras and 18 is uh streaming. Okay.
[26:40] All right, then we'll we'll take these up when we get to those items.

[30:23] [applause]
[30:31] » Nothing better than a very smart >> mom and dad are here.
[30:35] » Mom and dad need to get a little bit of in there.
[30:37] » Mom and dad. So, you know, not only do we have a great Long Beach student, but
[30:41] he's also a great Old Miss uh uh student. So, very good.
[30:49] [applause]
[31:04] Good job, Sandy.
[31:18] » Yeah, look at that. >> Every day. [laughter]
[31:26] Okay. Next item. Approve the minutes mayor and board of alderman of August
[31:30] 4th regular meeting. Can I get a motion? >> Motion.
[31:32] » Motion. >> Second.
[31:34] » Second. Any discussion? >> All in favor?
[31:37] » I'm sorry. Discussion. Um I'd like to look at um
[31:43] the uh part page 422 of the board of alderman minutes. And I'd like to get
[31:49] some clarification or get some u maybe some itemization of what was sp stated.
[31:54] Uh I formed a ward 3 streetlight re review task force and in the minutes it
[32:01] just says that there was um a mention of a discussion of it. No action was taken.
[32:05] I just wanted to make sure the minutes reflect what I said the reason the
[32:09] mission statement the individuals that were assigned that I have volunteered to
[32:14] uh be a part of this task force. I even had one of the members of the task force
[32:19] come forth and and um and describe his background and so forth. I think it's
[32:24] important that the minutes we speak through our minutes and I think it's
[32:28] important and incumbent upon us to have correct accurate minutes and I would
[32:33] like the minutes to please delineate exactly what was said, what was brought
[32:37] up and for the record.
[32:41] » All right. Uh, any other discussion? >> Is that in the form of motion?
[32:47] » That's in the form of a motion. So, we got a motion on the floor to
[32:51] change the minutes of October >> to correct the minutes
[32:54] » to correct the minutes of August 4th. We got a motion. Do I have a second?
[32:58] » Second with discussion. >> Second with discussion.
[33:00] » Not to make it a big deal, but the fact that we took no action is where I'm
[33:06] going. Uh, how do we how do we
[33:12] form? I mean, I understand what you're saying. I'm just looking at it legally.
[33:17] We we didn't vote, but but we're going to put that in the
[33:22] minutes. Does that what I'm asking?
[33:24] » Makes total sense to me. If I have a a committee or a task force, I think it's
[33:30] important that the public understand that there is one that was formed, why
[33:34] it was formed, what its mission is, who's on it, and what are they tasked to
[33:39] do. And I think that's the reason why I wanted it entered into the minutes that
[33:45] the public, you know, because of transparency. The public can see that
[33:49] and that's the only reason. >> No, no, I get I see where you're coming
[33:51] from, but the fact that we didn't vote is why I'm questioning.
[33:54] » There was not a vote. This was >> Jeffrey and refresh my recollection
[33:58] because I'm strictly going off my memory. the discussion and uh regarding
[34:03] the lights and the gentleman you had come up and give information regarding
[34:08] the lights was in furtherance of a request by you to create a task force
[34:13] for your particular ward exclusively. >> Exactly.
[34:16] » And as I understand the remaining members of the board had no objection to
[34:21] that but required no action by them but but authorizes you in your ward to
[34:26] create a committee to give whatever advice you they see fit. I'm just using
[34:30] the minutes. Exactly. And I'm just using the minutes as a vehicle to communicate
[34:34] to the public of what was >> So the minutes I think could properly
[34:38] reflect and be corrected to show that alderman Jeff Jaffria advised the other
[34:45] members of the board that he desired to establish an advisory committee for that
[34:50] purpose within his ward to which no other member had an objection. Is that
[34:55] fair? >> It's that's exactly right. I'm within my
[34:58] purview to do that without board approval.
[35:01] » Exactly. >> Okay. Thank you. All right. You got
[35:04] that, Emma? >> Yes, sir.
[35:06] » I just didn't. >> All in favor?
[35:08] » All oppose? Motion carry. Next one is August 6 and the 10th uh special
[35:13] meeting. Can I get a motion? >> So moved.
[35:15] » Second. >> Any discussion?
[35:18] » All in favor? >> I.
[35:19] » All opposed? Motion carries. Next one is August 10th work session. Can I get a
[35:25] motion? >> Motion.
[35:26] » Second. Second. Any discussion? All in favor?
[35:30] » I. >> I.
[35:31] » All oppose. Motion carries. Next one is the approval of the planning commission
[35:36] meeting minutes of August 13th. >> Motion.
[35:39] » Got a motion. >> Second.
[35:41] » Second. >> Discussion.
[35:42] » Any discussion? >> I would like to pull out the number two
[35:47] Harbor Watch tree approval and discuss it separate from the remainder of the
[35:53] planning minutes. >> All right, we got number two coming out.
[35:55] Is there any other? >> Yes, sir. I'd like to uh pull the uh
[35:59] short-term rental um number three on new business.
[36:03] » Three. Any others? >> All right. What we'll do is we'll take
[36:07] » separate. >> Yeah. I'm going the minutes minus those
[36:11] two. >> Well, three. Uh hold on.
[36:17] » Whole thing. >> So, we got two and three now.
[36:20] » Uh West Beach Boulevard. >> That's That's the one I pulled. That's
[36:24] the Harbor Watch. Yeah. >> All right. Can I get a motion to approve
[36:28] the planning commission meetings excluding item number two and three?
[36:33] » Motion. >> Got a motion.
[36:34] » Second. >> Second. Any other discussion? All in
[36:37] favor? >> I.
[36:38] » All oppose. Motion carries. Uh it's going to be the pleasure of the board.
[36:44] If you want discussion on number two. >> Yeah. Can do we
[36:48] » make a motion? >> Motion to discuss.
[36:50] » Second with discussion. >> A motion to second discuss item number
[36:53] two. So [clears throat] this harbor watch uh it was approved for
[36:58] them to take out 15 or I don't know it's kind of if the drawings and then the
[37:05] numbers seem to kind of contradict themselves. So between 13 and 15
[37:10] protected trees. Um, basically
[37:15] it was a green light to clearcut the entire property that is on Highway 90
[37:20] and uh, White Harbor Road. Um, I just think that is counter to what we
[37:28] have been doing. Um, so I am going to barring any further discussion uh, make
[37:34] a motion to deny the tree removal uh, the plat with the tree removal.
[37:39] » All right. So is any other discussion before we take his motion? Correct.
[37:43] » All right. We got a motion on the table to deny number two.
[37:49] » We ready? >> Yeah, I'm ready.
[37:50] » We got a motion on the table to deny number two. Discussion.
[37:53] » We have a second. >> Need a second.
[37:56] » You have a second. >> Second. Discussion.
[37:59] » Mr. Mayor, I want to also kind of dovetail off of what um Alderman Bennett
[38:03] said here. I was reading the minutes for this particular uh issue and the way the
[38:09] minutes read again we speak through our minutes and I was not there at the
[38:15] planning commission meeting. The planning commission meetings are not
[38:18] livereamed. So uh no one has no unless you were
[38:23] there you don't know what transpired. So, I have to read the minutes. And the
[38:26] minutes I read in here, and it says uh basically that after considerable
[38:31] discussion and upon recommendation made by the city of Long Beach tree board,
[38:36] well, I read the tree board's report and they are denying to have these trees
[38:40] cut, but you know, and and it comes across that it's contrary to what
[38:44] they're saying in the minutes. It doesn't make any sense to me. So, I'm
[38:49] just to just to to let everyone know, I have a later agenda item on here where
[38:54] I'm going to propose uh to have the planning commission me uh meetings live
[38:59] stream. So, this there'll be no confusion with this, but the minutes the
[39:02] way they read don't make sense to me. It doesn't doesn't sound like it's exactly
[39:07] what transpired, but I don't know. I wasn't there. we have we you know but
[39:12] but to go along with what you're saying I'm I'm in total agreement with you
[39:15] Patrick on this on this motion but I just wanted to put that caveat in there
[39:19] that um the minutes need to reflect exactly what business was transpired.
[39:27] » Okay. Okay. >> And I'll add that no nothing against the
[39:31] development. We're grateful that somebody is coming to develop and build
[39:35] homes. Uh but they need to do it around the protected trees. All right. So we
[39:41] got a motion to deny number two. All in favor?
[39:45] » I. >> All opposed. Motion carries.
[39:47] » I need >> one. We already approved
[39:52] » 113. Oh yeah. Well, never mind. >> Yep. We already voted.
[39:57] » I go ahead. >> We got discussion on number three. We
[40:00] can come back on that and look at it. >> You can come back.
[40:03] » We're on item number three. Who's got >> who
[40:07] » motion? >> Motion to discuss. Item number three. We
[40:12] got a motion. >> That's a 412 41.
[40:14] » This is a [clears throat] short-term rental.
[40:15] » No, the 42. Yeah. Okay. >> Discussion. Correct.
[40:18] » Discussion. >> Mr. Mayor, again, um I read the minutes
[40:23] and I'm reading the minutes that uh it states in here that um the commissioners
[40:28] voted and with Commissioner Bass whom is the the commissioner Bass is in the
[40:33] audience tonight. He's my appointment from W three. It states that he
[40:36] abstained. I I assume that is a recusal. I I don't know. I wasn't there, but it's
[40:43] my understanding that um that is not correct. And Mr. and and if if you'll
[40:48] come up if we can ask him to come up and maybe tell us what happened and what
[40:52] your position was on this and vote. >> There was a bit of discussion on whether
[40:55] I my name is Ray Boss. Um planning commission ward three. Um, there was
[41:01] some discussion on whether or not I should abstain because I had a personal
[41:06] interest in it. That was not the case. I had three people that were in the
[41:10] neighborhood that told me they didn't want this to be a short-term rental. The
[41:14] big thing they were talking about was there's something in the rental uh
[41:17] application about having pets that the yard's not fenced. Um, not only that,
[41:22] afterwards I found out this house has been listed on Airbnb prior to approval
[41:27] of a short-term rental. And I don't know if they've rented it out or not, but it
[41:30] just it didn't sit right with me. And there was a little bit of contention on
[41:34] whether or not I should say anything. And in the in the discussion, I guess
[41:39] they misunderstood saying I was abstaining. I was voting no to that. So
[41:43] I and it was a 61 vote. I don't even know that it'll even affect it, but I
[41:46] just want to be on record of what I voted.
[41:50] » Thank Thank you, Mr. Mayor. I think and that's important because a lot of times
[41:54] we have dissenting votes and there's a reason for it and and quite frankly I'm
[41:59] more interested in those people than I am the majority sometimes. So thank you
[42:03] for stepping forward stepping up here. I would like to move that we send this
[42:07] back to the planning commission and let them revisit this and then bring it back
[42:13] to us when not only the minutes are correct or have been corrected to
[42:17] exactly what transpired but uh that they have another opportunity to revisit this
[42:21] and bring it back to the board. So, I'm going to move that we table this or send
[42:26] it back to the planning commission. >> Well, let me let me just put this is
[42:31] they haven't approved their minutes yet. So to send it back, these minutes aren't
[42:36] even approved yet. >> So
[42:39] » who who approves these minutes? Us or them?
[42:41] » Them. >> Okay. Well, then they send it back to
[42:43] get the minutes approved. >> Well, they at their next meeting, they
[42:46] will be approving it. So So whether we send it back or not, the correction can
[42:51] be made at their next meeting when they when they're pulling up their previous
[42:56] minutes. So, so that just for clarification, they still have the uh
[43:02] the option of fixing these minutes. >> I think it's important that it's caught
[43:06] here because if we approve it, then it becomes record.
[43:10] » So, it does need to be sent back to them to correct.
[43:13] » I think they would just need to correct have an accurate correction in their
[43:18] minutes, which would change the vote. >> Okay, I'm with I'm fine with that.
[43:25] » All right. So, the pleasure of the board. Uh,
[43:28] » I'll make the motion to approve >> table number.
[43:33] » What are we going to do with number three at this time? It's got to go back
[43:35] to the planning commission for a one change.
[43:39] » Well, I think there minutes. >> Is it a correction?
[43:42] » Because it's not going to change the results. Correct.
[43:44] » Exactly. So, my is the motion to approve the short-term rental
[43:47] » and I'll second that motion. [clears throat]
[43:49] » Any other discussion? All in favor? >> All oppose? Motion carries. I approve
[43:55] Dr. Claims number 081826. Can I get a motion?
[43:59] » Motion. >> Second.
[44:00] » Second. >> Any discussion? All in favor?
[44:04] » I. >> All opposed.
[44:06] » Going into unfinished business. Special event application request to use city
[44:10] stage and generator. Use a city barricades and permission to sell
[44:15] alcohol at town green truck in the south. Anne Smith. Is an here?
[44:23] » Mr. Mayor. Uh, we tabled it last time because Miss
[44:28] Smith was not here, >> right?
[44:30] » Um, I would recommend we table it one more time.
[44:32] » All right. >> Second.
[44:34] » Ann Smith is not here. >> Anyone else on behalf of the event here?
[44:38] » Uh, >> is anyone else on behalf of the event
[44:40] here? >> Nobody put on a Nobody signed.
[44:43] » All right. So, uh, with that being said, we're going to table number one and just
[44:46] move to the next meeting. >> Now, we're going to go to new business.
[44:51] » Mayor, I just have a question. If you let me interrupt for just a minute. Has
[44:53] anybody notified her that we expect her to be here by chance?
[44:56] » I did. I actually talked about then she should have been here
[45:00] » cuz I actually saw advertisement on Facebook last week of the event.
[45:04] » Yeah. Maybe maybe she had an emergency or something.
[45:06] » Can we get a motion to table that? >> Motion.
[45:08] » We did. >> Yeah.
[45:09] » There was a second. >> I was unanimously carried. All right.
[45:14] We're moving on to new business. moving 500,000 awarded to by the Mississippi
[45:19] Department of Marine Resources from Long Beach Northwestern Bulkhead project to
[45:24] the Gateway Phase 3 Pavilion project. Can I get a motion?
[45:30] » Second. >> Second.
[45:31] » Second. Any discussion? >> All in favor?
[45:35] » All oppose? Motion carries. >> Next one is here's we did the
[45:39] resolution, so that one's already done. Next one is special event application
[45:44] for the Long Beach Jubilee. >> Motion.
[45:47] » Motion. Got a second. Any discussion. All in favor?
[45:51] » All oppose. Motion carries. Special event application and fee wave. Motion
[45:56] second. Any discussion? >> All in favor?
[45:59] » All oppose? Motion carries. >> Next one is special event application
[46:03] for fee waiver for yoga in the park. >> Motion.
[46:08] » Got a motion. >> I can't make that. I can't second it
[46:11] because I can't touch my toes. So, [laughter]
[46:13] » second. >> I think that's a second.
[46:16] » Okay. >> Any discussion?
[46:18] » All in favor? >> I.
[46:20] » All oppose. Motion carries. The next one is use use of harbor and operations of
[46:27] food and beverage concessions for cruise in the coast. Rotary Club of Auxy. Can I
[46:32] get a motion? >> Motion.
[46:34] » Second. >> Second. Is anybody here from the Rotary
[46:37] Rotary Club? I think there is someone there.
[46:40] » Nobody says >> not from Blux.
[46:41] » From Blux. All right. Okay. And I what I'd like to we we kind of had this
[46:45] discussion when >> I'm gonna
[46:47] » when Woody Bailey was here. Uh next year I want to move towards the Long Beach
[46:51] Rotary Club having a bigger part in this and running that even if it's in uh in
[46:56] with Beluxy. I want them to be able to to do it.
[47:00] » All right. All in favor? >> Just discussion real quick with that.
[47:04] Uh, can I recommend that we send a letter to Woody
[47:08] » stating that just just to memorialize it?
[47:11] » Yeah, >> we were going to try to get it done this
[47:14] time in the game. >> Yeah, we met with him and all, but but
[47:19] if we send it >> now or right after the event, they have
[47:24] it on their books for a year that it's requested from the city. Yep.
[47:28] » And then let the organizations work it out. But the city is strongly pushing
[47:33] our local organizations. >> Will you add that to the motion?
[47:36] » That is correct. >> Also, before you add that before you add
[47:39] that as an alternative motion, I don't see any harm in also sending a a carbon
[47:43] copy to Keith Clayton, the executive secretary of the Rotary Club of Beluxy.
[47:48] So, he's aware of it too that we want to work in conjunction.
[47:52] » Not that we have a problem with them, but we would like to see our local guys.
[47:56] » All right. Anything else you want to add? [laughter]
[47:58] » The laundry list. >> All right. We we'll we'll draft that
[48:00] later. >> That's my that's my motion.
[48:02] » All right. All in favor? >> I
[48:04] » All oppose. Motion carries. Next one is uh sponsor the junior auxiliary of
[48:09] Guffport Charity Ball. Can I get a motion?
[48:12] » Motion. >> Second.
[48:13] » Second. Any discussion? >> Any discussion?
[48:20] » Oh, she's here. Great. >> Please, please state your name and
[48:25] address, please. >> Hi. Uh my name is Allison Curley. I live
[48:29] my address my home address. Okay. 2027 Pelican Circle.
[48:34] » Um I'm here to represent Long Beach. Yes. Long Beach.
[48:38] » I'm representing Junior Auxiliary of Gulfport along with a few members of our
[48:42] executive board. The Gulfport chapter of JA is a nonprofit that serves children
[48:48] in Pas Christian, Long Beach, and Golfport. Last year we served more than
[48:52] 57,000 children through more than 7,700 hours served. um for children in our
[48:59] community through 12 ongoing service projects. As a teacher here in Long
[49:04] Beach School District, I'm able to see the impact that these projects make on
[49:08] our students on a daily basis. Just a few weeks ago, we finished our fill the
[49:12] bus campaign where we collected and distributed school supplies to students
[49:16] in need in our communities. We hosted a back- tochool bash where students were
[49:20] able to come and shop our clothing closets, get free haircuts, and collect
[49:25] backpacks filled with school supplies. And then we held a second fill the buzz
[49:29] event here in Long Beach at our town green where we handed out an additional
[49:33] 260 backpacks. One of our most impactful ongoing
[49:38] projects is called Project Now. This project fills requests from school
[49:42] counselors within 24 hours to provide new clothes, shoes, other basic needs,
[49:49] as well as filling emergency vision and dental requests. Just last week, we
[49:54] provided 25 pairs of shorts to students at Reeves Elementary through this
[49:58] project. We also provide hygiene kits to all the schools in our service area,
[50:03] sponsor a backpack blessings program that sends non-p perishable food items
[50:08] home with children in need over the weekends. We write pen pel letters back
[50:12] and forth with students at Harper McConn to help nurture their writing skills and
[50:17] give away tens of thousands of dollars in college scholarships annually through
[50:21] our collegebound project. Last year, Operation Christmas Cheer provided
[50:26] Christmas presents for 33 children at Corals Elementary and we hosted a
[50:31] Christmas party at the Gulfport Aquarium that included free admission for the
[50:35] children and their families after the event. Um, I don't want to take too much
[50:39] more of your time tonight, but I could go on for much longer talking about all
[50:43] the different projects and the impact that they have on our kids here in Long
[50:48] Beach. And all of these projects are funded solely through our annual charity
[50:52] ball. This event is our main fundraiser and without the support of our patrons,
[50:57] many of these projects would not be possible. Um, I printed some of these
[51:01] for you guys, the patron um, packets. uh that gives a lot more details about the
[51:07] specifics and details of all the different projects um as well as
[51:11] different levels of financial support that patrons can provide. So, we hope
[51:16] that if the budget allows that the city of Long Beach will consider partnering
[51:20] with us and becoming a patron for Junior Auxiliary of Golfport this year. And I
[51:25] have these if you guys >> We have those included in our packet.
[51:28] Thank you. >> Okay.
[51:29] » Appreciate it, >> Mr. Mayor. Uh just we have a motion
[51:33] already in a second. I just want to add some discussion that Allison didn't
[51:37] mention and I want to remind the board and everybody here that the junior
[51:44] auxiliary were the main sponsor. They donated $25,000 to the city for the
[51:51] wheelway uh which was the first uh handicap wheelway on the coast. So they
[51:59] they've been a big uh part of Long Beach for several years now. So [snorts]
[52:05] » all right, we see we got some nice lady here want
[52:09] » Hi, my name is Karen Brogden. I'm president for Junior Auxiliary of Gport.
[52:12] My address is 1459 Taliho Circle in Gulfport. Um I just wanted to say
[52:16] because a few of the ladies here present are that are here today were not around
[52:21] when we had that project uh going. It's one of our legacy projects and uh we
[52:25] intend to actually work on revamping or doing something like that in the near
[52:28] future. We still have the supplies for it. I just wanted to let you know, yes,
[52:31] that's one of um that that's one of the many ways we intend to use the money to
[52:35] get involved in the city and to reinvest >> and it's a great project that and we
[52:39] still have most of the quote unquote infrastructure for it, right? You know,
[52:44] that will go back up once the gateway is uh finished.
[52:48] » Okay. Thank you. We appreciate your time.
[52:50] » Thank you. >> Thank you. Pleasure of the board.
[52:53] » We have a motion on the table. >> What's the What's the amount that didn't
[52:57] include >> Patrick? You have the motion. Did you
[53:01] have an amount on your motion? >> Didn't.
[53:05] » What What are you recommending? >> Put me on the spot. [laughter]
[53:18] » Any input? I can't. I've lost it.
[53:24] What's your package? >> What's the different? You got your hand
[53:26] out. >> I don't have it on me. Alison, what's
[53:28] the difference? Packages the levels.
[53:44] » I'll make the motion. Say go ahead. >> 1,000.
[53:47] » No. >> 25.
[53:48] » 2500. >> The genie. The genie circle is 2500.
[53:53] » And I'll say just to say I probably I work at the school. I don't know that
[53:58] we've ever called said, "Hey, this kid needs something that they didn't do." I
[54:02] mean, it's pretty much every time. So, >> yeah. Is that your motion?
[54:05] » 25. Second. >> Motion second. I will say that uh and
[54:10] this is a very from city of Long Beach. This is a very big donation because we
[54:16] are very very tight with funs. But you've got such a good program and it
[54:21] does so many good things that >> we've seen what they've done in Long
[54:24] Beach over the years. >> We appreciate what y'all do. So, we got
[54:26] a motion for 2500. All in favor? >> I.
[54:29] » All opposed? Motion carries. >> Next one is discussion of the emergency
[54:34] repair contract. >> Yes. Um just to bring all up to date,
[54:40] this contract [clears throat] is going to expire in a few months. So, I
[54:42] actually met with David before the meeting and he's going to be working on
[54:46] a new um contract to bring to us hopefully next month or so to to
[54:52] entertain. >> Okay.
[54:53] » Yeah. So, this this justformational. >> Thank you.
[54:57] » Well, do we need a vote to direct David or did we already do that?
[55:03] » We had it's been >> we did it already. That's okay. Just
[55:07] making sure. >> I didn't know if we needed a new one.
[55:09] » All right. Next item. uh installation of ALPR
[55:13] cameras. Jonathan, are you here? Jonathan,
[55:18] please state your name and address. And I think we have Joseph here as well
[55:21] that's going to also speak. So, Joseph, you you can talk next.
[55:26] » Good evening. I'm Jonathan O. I live at 2168 Pineville Road here in Long Beach,
[55:30] Mississippi. And I have lived there for 16 years. I retired out of the military
[55:34] and my family and I decided to stay in Long Beach. So, I want to take a couple
[55:38] of minutes tonight talk about the commercial or the communication
[55:41] surrounding the ALPR cameras. They're I first first learned about these cameras
[55:46] when one is one. Sorry, I've never spoken one of these.
[55:49] » No problem. Take a deep breath. It'll be fine.
[55:53] » I first learned about these cameras when one was when one was installed at the
[55:57] end of my driveway. It caught me by surprise and honestly, I didn't know
[56:00] anything about this program. All right. And then when I got home that night, I
[56:03] turn on the news and bam, that's all you see. You turn on social media, that's
[56:07] all you see. So, and because of where that camera is placed, every time my
[56:11] family pulls out of our driveway, because it's smack dab right at the end
[56:15] of my driveway, that camera is going to photograph my
[56:19] family on average of 2,000 times a year. So, I have concerns with that with those
[56:23] pictures and that data. So, and then I learned that the city approved this back
[56:29] in February 18th of 2025 with a grant. If I'm not mistaken, I saw it on the
[56:33] agenda or the minutes, but I don't see anything else on that. I watched the
[56:37] YouTube video of that meeting and all I hear is the NCIC, the National Criminal
[56:42] or National Crime Information Center. That's all they discuss in that meeting
[56:45] on YouTube. So, after that, I still have a lot of
[56:49] questions um such as what information are these
[56:53] cameras collecting on us, especially when my family's going out our driveway.
[56:57] Uh who has access to it? How long is this information kept? and can it be
[57:00] shared with the other agencies and what safeguards are in place? I'm I was in
[57:04] the military. I know how data and how uh it can be misused. So, and
[57:12] what does this program cost taxpayers going forward? I get it's a grant that
[57:15] was taxpayer money. What's it going to go forward when no grants run out and we
[57:19] have to replace these with taxpayer money from the citizens of the city? So,
[57:22] I'm kind of concerned about that and I think they're reasonable questions to
[57:25] have answers to. Uh, and that's what I'm want tonight. I want
[57:30] answers. I want the city to We have social media and I I know the city is
[57:35] very good at putting out boil water notices, construction notices, you know,
[57:39] road closures. I never saw anything about these cameras and I'm pretty
[57:43] disappointed in I come home from an appointment one day and it's sitting
[57:46] right there. I don't know what it is. So, you know, I'm it's going to get my
[57:49] neck here standing up a little bit. I'm like, what is this? And I've talked to
[57:52] my alderman. I'm working with him. I have faith in him. He said it's probably
[57:56] going to move down the road. But the last part of this is, you know, I
[58:02] believe open communication helps people understand why the decisions are made.
[58:06] And I know you weren't here, mayor, for when that decision was made. You got
[58:09] elected after that. But public safety is important to me. I do believe that. And
[58:14] so is transparency, privacy, and trust. And that's what I'm getting. I want some
[58:19] transparency on these cameras from the city. And I I don't know if that's too
[58:22] much to ask, but that's what I'm asking of you. I would otherwise I would never
[58:25] be here. I I [clears throat] see what you guys do during the day and all that
[58:28] and the decisions you make and I never come to these because I kind of like
[58:31] what's going on in my city. But that part right there, it compelled me to
[58:34] come here. So, thank you for letting me speak here tonight. I really
[58:40] do appreciate it and I hope the city will reconsider or will consider making
[58:44] this information more readily available to residents and also consider the
[58:47] impact on nearby residents when deciding where these cameras are placed. I don't
[58:52] want to walk out down my stairs every morning when I get up and I see a
[58:57] government camera at the end of my property. That's the first thing I see
[59:01] and I don't think any American wants to see that. But thank you for your time.
[59:06] That's all I have. Just something to consider.
[59:09] » Thank you so much. [applause]
[59:17] Joseph, please state your name. And >> Joseph Thompson, 100 South Seashore,
[59:21] Long Beach. I'm also here to speak about the cameras, but from a different
[59:25] perspective. It's not just about mass camera
[59:30] surveillance. To me, this is about the erosion of our natural and God-given
[59:35] rights, constitutional rights. I don't doubt that all of us, everyone in here
[59:40] wants a safe city. We, for the most part, have one. What I do doubt is what
[59:46] was at stake was not fully considered when we implemented this program.
[59:51] It's not just about cameras. It's about constitutional stewardship.
[59:56] Our constitutional rights don't come from the government. They they are
[1:00:01] protected from the government. We the people, everyone in here, everyone in
[1:00:07] our city, all of you are [clears throat] the natural owners
[1:00:11] of authority. all of us. However, in your professional capacity as elected
[1:00:17] and appointed officials, we the people have entrusted you as our stewards. Not
[1:00:23] just our city administrators, but our stewards of our constitutional
[1:00:27] liberties. Stewards do not own that which is entrusted to them. We the
[1:00:32] people do. You all took an oath to the constitution first and foremost. We the
[1:00:38] people's concern is also not necessarily because we distrust our current
[1:00:44] stewards. The constitutional restraint and framework exist because we don't
[1:00:49] know who comes after you. And so that framework keeps everything in check.
[1:00:54] Rights and freedoms are never lost in a sweeping overnight manner. Although CO
[1:01:00] error uh restrictions attempted to and in some cases succeeded in doing so, our
[1:01:05] freedoms are never taken all at once. They're taken one step at a time. Each
[1:01:10] step presented as being justified, reasonable, or necessary for public
[1:01:16] safety until one day we look back and realize we've traded away that that
[1:01:21] which we cannot reclaim. Some say if you've done nothing wrong,
[1:01:26] you have nothing to fear. That's never been the standard in America. American
[1:01:30] standard is that the government has to prove it has a reason before it intrudes
[1:01:35] on our liberty and only then it does so with probable cause and a warrant. It is
[1:01:41] never we the people needing to prove that we deserve liberty or privacy.
[1:01:47] Here's what I ask of you. This is this conversation's new. I realize that. I
[1:01:52] have perused the minutes going back to January of 24. I can find very little
[1:01:56] discussion about these cameras yet they are all around us at every city entrance
[1:02:02] it appears. I do believe that the contract or the memorandum of
[1:02:07] understanding that we have is one of the most restrictive in terms of the data. I
[1:02:12] still don't agree with it. I believe this this will be deemed a fourth
[1:02:16] amendment constitutional violation in short order as the Supreme Court updates
[1:02:21] our fourth amendment which they're they're in the middle of doing. But when
[1:02:24] technology advances faster than the law, will this board heir on the side of
[1:02:29] governmental power? Or will it heir on the side of constitutional liberties?
[1:02:34] Will you be remembered for the wisdom to restrain technology for the sake of our
[1:02:39] constitutional liberty and that of future Long Beach generations.
[1:02:45] Long Beach is an exceptional city. We all know that. That's why we live here.
[1:02:50] Use your stewardship to make Long Beach the exception to mass surveillance rules
[1:02:55] and other forthcoming technology ordinances or laws that limit the rights
[1:03:00] and freedoms of we the people. Doing so will shine a positive light on our city
[1:03:06] and will attract even more constitutionally oriented people here.
[1:03:10] Thank you.
[1:03:13] » [applause]
[1:03:16] » Oh, just I I definitely I've been get I've
[1:03:21] gotten quite a few calls over the last couple months. Uh Joseph being one of
[1:03:26] them. We've talked about it and my opinion I've really kind of dug in the
[1:03:31] last probably month, month and a half to the research and and some of it is we
[1:03:34] all should be a little weary. Uh not just with flock or I know we use
[1:03:41] insight. I mean, Insight, the company that we use, the same as Flock,
[1:03:46] » Genitech, >> is it Genitech?
[1:03:48] » What's it called? >> Genitech.
[1:03:50] » Well, the minutes from the one it's at Insight LPR.
[1:03:53] » That's one that DEA had.
[1:03:58] » Okay. But it's We still have the Insight cameras here. You know, they have a
[1:04:02] giant commercial side, so I could go buy one. Uh I could hook repo lots use them.
[1:04:10] recorders, lots of companies, and technically I go buy one and drive the
[1:04:14] roads all day with it pointed at your house. Uh, I get a discount if I share
[1:04:20] that information with the system. It's not just the cameras that you have on
[1:04:25] the streets. It's a network of cameras. You can have them at movie theaters, any
[1:04:29] private business, and it is not different systems. It is all one system.
[1:04:33] And like I said, a lot of it, that's why a lot of them are free. uh
[1:04:39] whether what they're doing with the data or not they're storing I mean it's it's
[1:04:42] definitely we something that is very concerning to me uh
[1:04:48] like I said and we do share some of it now I know another thing that I find a
[1:04:54] little scary is like some of our federal grants now uh to get the grant requires
[1:04:59] you to share that information with the federal government uh
[1:05:05] which we have fun. So, I think we really need to like
[1:05:10] take a step and look at pol I mean, we're talking about ebikes and all this.
[1:05:15] I mean, this is this is 24hour a day surveillance.
[1:05:20] Uh, I think we really need to slow down and come up with some policies or I
[1:05:27] mean, if honestly at this point, if it was up to me, I don't I don't like them.
[1:05:32] If it was at my driveway, I probably would have already accidentally ran over
[1:05:35] it just to be completely honest with you. Uh, but I do think this is and it's
[1:05:41] not just one story of misuse. There's probably somebody currently misusing
[1:05:46] that information as we speak. It's every day different stories. Uh, like the one
[1:05:53] he said with the DEA, the insight, look at their partners that they share.
[1:05:58] It's all the way to Lexus Nexus, which is like the largest police database that
[1:06:02] you can get. It's got everybody's fingerprints and DNA and all that. And
[1:06:06] it's all connected. One hack. I mean, Chad GPT just got
[1:06:11] hacked the other day and all these. I mean, one hack in everybody's travel.
[1:06:15] And this isn't just a hey, ping you here or there. This is a constant 20. I mean,
[1:06:20] it's a surveillance apparatus. And I don't I might be cynical, but the I
[1:06:26] don't trust the federal after COVID and all that like the some of the
[1:06:31] three-letter agency. I it scares me. So that's just my personal opinion on it.
[1:06:35] Like I I am very weary of having cameras everywhere. And this isn't a shot to the
[1:06:41] police because I've had countless arguments and conversations with some of
[1:06:45] my best friends and family who are cops and like their job is to protect. This
[1:06:49] does make it easy for them to protect. That's their first priority. So this is
[1:06:52] I would give Billy Seal my he could put me on live 360. I'm not worried about
[1:06:56] that. [laughter] >> But that
[1:06:58] » I I think Billy >> I do think that it is scary. I mean,
[1:07:03] look, just with just to go back to what Joseph said about COVID, like maybe I
[1:07:08] feel a little more comfortable with it because I think the some of the people
[1:07:12] in charge now at the higher federal level, but think about COVID and they
[1:07:16] say don't leave your house and don't now they're tracking every move like it if
[1:07:21] you leave here and drive to Crossroads, you're probably on 15 or 20 cameras like
[1:07:26] ping ping ping. I mean, pictures. The new I even looked into the patents of
[1:07:32] these cameras. The new thing that's coming is when you drive by, it can see
[1:07:37] your Bluetooth and everybody in your car, it can tell
[1:07:41] who you are by your Bluetooth and stuff. And that's
[1:07:45] just what's next. I mean, like I said, I want to say just insight, the ones we
[1:07:49] have, I think it's on 90 10 billion license plates read already. That's
[1:07:54] that's not like >> me. That's very scary.
[1:07:58] » I fully agree with you. The more I look into it, the more concerning it is. I
[1:08:01] mean, they're tracking absolutely everything.
[1:08:04] » I understand the concept of trying to the police want an easier job to do. But
[1:08:08] by definition, our Bill of Rights is put in place to put the constraints on them
[1:08:12] where their job is not easy. It's their job to prove that we're doing something
[1:08:14] wrong and just an open open access to all your information. To me, in my mind,
[1:08:19] I'm not I'm not a lawyer and I'm not a judge by any any stretch of the
[1:08:22] imagination, but in in my mind, that's an infringement upon my rights.
[1:08:27] And I may be wrong. I'm sure at some point the Supreme Court will have to
[1:08:30] address this and make a call on that, but that's just the way I see it.
[1:08:33] » I'd like to offer an opinion as well. Um, Joseph, I congratulate you because
[1:08:38] you're way more eloquent than Patrick um in explaining [laughter] the situation.
[1:08:42] Um, >> he's been trying to train me up.
[1:08:45] » Uh, and Patrick and I and Timmy and I and several of us have had this
[1:08:50] discussion before. I too [snorts] echo the sentiments that you have and um
[1:08:57] makes me a little weird leery as well the being the devil's advocate I posed
[1:09:03] this question to Patrick and I said what's the difference in one of these
[1:09:06] that you're pinging off of every cell tower if you go from here to Miami
[1:09:09] they'll know exactly the route you took and his answer was will you choose to
[1:09:12] own one of these well you do but try to go one day without one but that being
[1:09:17] said I would speak to the forward. Gentlemen, he's exactly right. We're
[1:09:23] stewards uh of of of these people's wishes and and uh we we get their votes.
[1:09:30] We're elected to do something. We can sit up here and agree with them how
[1:09:34] we're uh in favor and and and we can sympathize,
[1:09:39] but the question is what action are we going to take? What are we going to do
[1:09:41] about it? We can sit up here and talk about it, but we have to take some
[1:09:46] [applause]
[1:09:48] we have to take some action um to scale back in my opinion. And don't get me
[1:09:54] wrong, I don't know what that answer is. Um but I think it should be a priority.
[1:09:59] It's just my opinion. I >> I I think so too. And you you're seeing
[1:10:02] this issue all across the country right now. It it's on the news every day. More
[1:10:06] abuse. And I don't want that happening in Long Beach. I mean, I like I said, I
[1:10:11] trust our police department. I know they're not going to do anything wrong.
[1:10:14] But >> Steve, you had something you'd like to
[1:10:16] add? >> I just I wanted to speak, I
[1:10:19] [clears throat] guess, to the other perspective a little bit. And I think
[1:10:22] Chief Seal is more qualified, knows much more detailed about these particular
[1:10:27] cameras in the city of Long Beach and how they're utilized. And I encourage
[1:10:32] him to to do that. But I wanted to agree with Mr. Is it Oen? I'm going to
[1:10:36] mispronounce it. I apologize. >> Oen, sir. Okay. I wanted I wanted to
[1:10:41] agree with him in one regard that more information and dissemination of what
[1:10:48] they are, how they work, and what they do would be beneficial to the citizens
[1:10:53] of Long Beach. Uh there's some obvious things and some misconceptions
[1:10:59] about automated license plate readers. One of them is who gets the information.
[1:11:04] And Chief Seal can tell you that the information that these cameras in Long
[1:11:08] Beach gather, there is a strict requirement that is for law enforcement
[1:11:14] resources and and use only and only agencies that they share it with. The
[1:11:22] federal government, when Patrick talks about don't trust the federal
[1:11:24] government, it's a little bit bigger than that. And we're not sharing this
[1:11:29] information with the vast resources of the federal government. Um, we don't
[1:11:36] uh make any money. These cameras, like the ones that you see on social media
[1:11:41] and the criticism, are privatelyowned vendors who charge municipalities and
[1:11:48] other agencies and are revenue driven by catching expired tags or people without
[1:11:54] insurance. They are revenue driven. The city of Long Beach deres not one dime
[1:11:59] from these cameras. They They are. And and Patrick, who I respect his opinion,
[1:12:05] talks about how scared they are. They're no different from most of you. Ring
[1:12:09] camera. Gentleman say he's on camera 2,000 times a year. If his neighbor's
[1:12:13] got a Ring camera, it's that many on his Ring camera. I got them on my house.
[1:12:17] Ring cameras, doorbells, and it catches everybody who drives by. if I was really
[1:12:21] that interested in looking. They are really no different with the exception
[1:12:25] that they are an investigative tool of the police department of a a certified
[1:12:31] law enforcement agency who like these stewards took an oath not to abuse their
[1:12:37] authority. A and the difference in that and my Ring camera is that law
[1:12:41] enforcements have the ability to put into this system, we have a a homicide
[1:12:48] that involves a red Camaro, last three tag digits, XYZ,
[1:12:54] and and if that camera somewhere in our city catches that vehicle, it will
[1:12:59] notify law enforcement, here's where it just was. And indeed, a homicide was
[1:13:06] solved in and a substantial assistant in a murder in the city of Long Beach by
[1:13:11] just that that purpose, a camera identified as suspect ve
[1:13:16] um it is an investigative tool. Is it could it be considered an invasion of
[1:13:22] your privacy? Sure. But no more than the cell phone you got in you. The guy
[1:13:26] riding down to you in the highway next to you has the right to pick his phone
[1:13:29] up and video you. I don't like it. makes me uncomfortable. I I'm not sure I'm
[1:13:34] scared by it because I'm not more any more scared by Ring cameras on my
[1:13:39] doorbells. Um they are a legitimate investigative tool which should have
[1:13:45] some guard rails and does. Um, and at some point we have to disseminate enough
[1:13:52] information, as you suggested, and educate our citizens to not be scared of
[1:13:57] them and to understand they're there to assist law enforcement to protect
[1:14:02] persons and property. And it's a valuable tool so long as it's not
[1:14:06] abused. I agree with that. And at some point, like the stewards of your city,
[1:14:10] you have to with checks and balances trust law enforcement not to abuse their
[1:14:16] authority. and they can be uh a terrific assistance to law enforcement. It's my
[1:14:21] my experience as as a citizen in in my town in my city and as a former
[1:14:28] commissioner of the Mississippi Department of Public Safety quite
[1:14:31] frankly and I just want to share that with y'all.
[1:14:33] » And my fear maybe not well a little bit still now uh but is this is just the
[1:14:40] beginning is where does it go? I mean, I get even maybe I would concede to if
[1:14:47] you have one at the entrance of Long, the entrances and the exits, but like
[1:14:53] when you start putting them in neighborhoods, that's different because
[1:14:57] I mean to me, uh, but if it was taking a picture of my house every time somebody
[1:15:02] passed it, not only put out of your driveway, I'm sure we have some or
[1:15:06] there's some that every time somebody pass it, it's taking a picture of
[1:15:09] somebody's house. and a cell phone. If if uh somebody a police officer wants to
[1:15:14] get my cell phone records, they're going to have to go get a warrant and
[1:15:19] go to my cell phone company. These cameras can easily be abused. Uh it is
[1:15:24] on the police department, which I am fully 100% sure that our police
[1:15:29] department is doing what they're supposed to do as far as auditing these
[1:15:32] things. But you can't audit everyone. And if other agencies around here, all
[1:15:36] it takes is one bad actor. And I I just that definitely just scares me. I know.
[1:15:43] I mean, look in other countries. Look at China. I mean, everything you do is on
[1:15:49] camera and there's consequences to your actions there. And some people are using
[1:15:52] these as ticket writers and things like that. Uh Ocean Springs, other places
[1:15:58] locally. Uh like I said, just very scary to me. And I think lack of information
[1:16:04] or lack of even on my part also even looking at it for the month is the lack
[1:16:09] of knowledge. And then I think all of us probably not to throw y'all in with me
[1:16:14] because I'm as simple as they come, but uh I don't think any of us know enough
[1:16:20] about them to have 12 and have them in neighborhoods.
[1:16:25] That just seems like a overreach. We're one of the safest communities in the
[1:16:29] country. It looks like Chief Seal has we
[1:16:36] all chief, you have a few words to say. >> We have we have 10 LPRs that are
[1:16:41] Genitech is the company name. Genitech G nec.
[1:16:49] Anyone
[1:16:53] needs to look that up? Uh they were purchased. We've had them since uh those
[1:16:59] since 2004, the end of 2004.
[1:17:04] Uh they were provided to us on a trial run. Uh we sought out and got a grant uh
[1:17:12] homeland security grant that paid for those.
[1:17:15] We do not share it with the federal government. Uh we share our information
[1:17:22] with uh Pascers, Jan, Beluxy, and Gulfport.
[1:17:26] Uh the tags, it takes a picture just of the tag on the car. It doesn't take a
[1:17:32] picture of who's in the vehicle. It picks up the numbers.
[1:17:38] Uh it is stored for 90 days.
[1:17:43] That is it. It's not sold to anyone else. It's strictly used for law
[1:17:47] enforcement purposes. Uh
[1:17:51] I was trying to think whether his particular questions. Uh Alderman uh
[1:17:57] Bonds called me about the location of that one. That one was placed on
[1:18:01] Pineville just inside the city limits from uh Espie where we had a lot of
[1:18:09] problems with uh people coming in off of Cronier and the Pineville community
[1:18:14] committing crimes in Long Beach. So that's why that was picked there. He
[1:18:19] brought the concerns of the gentleman to me. Uh we have sent went out there with
[1:18:24] with public works and it's going to be moved 50 to 100 feet down the road out
[1:18:30] from in front of his house. Uh it was it's in a city easement across
[1:18:35] the street. It's not on his side of the road. And so he brought that concern
[1:18:41] through his alderman and we definitely you know took that into account and able
[1:18:46] to move that.
[1:18:49] We've actually had LPRs in Long Beach since 2019.
[1:18:55] First one we we purchased and it was at Klondike and 28th Street and it's
[1:19:01] mounted on it was mounted I think the cameras are actually still up on the
[1:19:05] traffic lights but they're they don't work. They're out of the companies just
[1:19:10] never came and taken them down. They don't power or nothing to them. uh they
[1:19:17] all are placed to uh the ingress and egress of the city,
[1:19:24] not in neighborhoods. uh their systems that some agencies have on the coast
[1:19:29] that uh people freely give access to their Ring
[1:19:36] cameras and it's dumped into police departments picking everything up and
[1:19:40] you have to go basically back you know which the fourth amendment where do you
[1:19:45] have expectation of privacy at and you don't have expectation of privacy
[1:19:50] driving down the road that simple somebody take your
[1:19:55] you have expectation of privacy in your home.
[1:19:59] Uh this has gone uh many several courts of appeals including our fifth uh
[1:20:07] circuit and they have ruled that it's not unconstitutional.
[1:20:12] It's up to the Supreme Court and they rule it is then
[1:20:17] have to remove them. But uh it's a very valuable investigative tool
[1:20:24] and I I understand the transparency, but I'm I'm not going to publish
[1:20:31] every investigative tool I have for every criminal to know. Uh law
[1:20:37] enforcement as a whole is struggling to keep up technology wise, firepower wise
[1:20:43] with criminals. So, uh, used them. We found missing
[1:20:51] people. Uh, as soon as we put these up on the East Railroad, there was a drive
[1:20:57] by shooting and within minutes we had a suspect
[1:21:02] by this camera, made an arrest. We had a murder a couple
[1:21:08] months ago on Allen Road. picked the vehicle up, was able to get
[1:21:13] the tag number, and made arrest in less than 24 hours.
[1:21:19] I think it's a valuable tool for public safety. Uh, and and you're right,
[1:21:25] Patrick, there's a lot of private You go to Lowe's, Lowe's has block cameras.
[1:21:29] They've had them for years. Walmart have I mean pretty much every big box
[1:21:33] retailer >> a lot of uh not not here but uh in
[1:21:38] bigger areas homeowner associations and their homeowner dues pays for them
[1:21:43] at the entrance to their uh neighborhoods
[1:21:49] again it's not I know on the coast there a bad rap
[1:21:55] ocean springs and I think Beluxy had had them and that sent insurance tickets.
[1:22:01] Uh there's another company out now that and it's illegal to do speed enforcement
[1:22:08] and traffic enforcement uh automated like that, but they're
[1:22:13] pushing now where you can uh handheld radar guns and with a camera and shoot
[1:22:19] and it mails the ticket. And we're not we're not getting into anything like
[1:22:23] that. The these are not for any type of traffic enforcement or vehicle
[1:22:27] enforcement. It's strictly an investigative tool and there's uh
[1:22:32] safeguards. We do run audits and if you run a tag number in there, you have to
[1:22:38] put a case number or a reason why. If an officer logs in there to research
[1:22:44] something, they have to put the case number or the reason why so we can go
[1:22:49] back and audit. We have a LPR policy that includes in it misuse could could
[1:22:56] lead to termination and it could lead to criminal charges.
[1:23:01] There unfortunately every profession but every [clears throat]
[1:23:05] there's there's bad apples in no matter what tool you have.
[1:23:11] If you have a taser, somebody can misuse that, you know, and abuse it. Uh so it
[1:23:16] it's all just on on your uh your agency to follow the policies and
[1:23:23] ensure that it's being done correctly.
[1:23:28] » And and if anybody wants to, y'all could have called me and got this information.
[1:23:37] » So I'm hearing that it's a lack of information. Maybe we could put some
[1:23:42] facts uh out on the city web page and maybe
[1:23:46] clear up some of the confusion, but I'm like [clears throat] uh our attorney is
[1:23:51] a tool and that tool is to be used correctly and I think it's a deterrent
[1:23:57] uh for crime in our city, which I think we're the number one safest city for
[1:24:01] serious crimes. Would we be that if we did not have those cameras? Uh you just
[1:24:06] don't really know. But the thing about it is they know if you don't have them
[1:24:11] because then they got free reigns to go where they want to do. So I see both
[1:24:15] sides. Uh >> like I said, I just think it's a
[1:24:19] » not an anti-law enforcement. I think all of us should
[1:24:24] » I don't know. Maybe I just might have different opinion, but I
[1:24:27] » I think so. >> I think everybody should have issues
[1:24:30] with have like we're moving to a society and this isn't a Long Beach issue. This
[1:24:33] is a societal American issue that we're moving to society where you're going to
[1:24:38] be on a camera 24. And I get private people have cameras and stuff, but
[1:24:43] » these are government networks. >> How many people can log on to MD dot
[1:24:46] right now and watch watch how many traffic intersections?
[1:24:50] » I mean, I get I don't like that either. >> I I think it would be good for us to get
[1:24:54] the information out the difference in between these cameras and the actual
[1:24:57] flock cameras that you're hearing. >> Well, they're all kind of the same.
[1:25:01] They are, but they're they're we're using them differently just to get some
[1:25:04] information out there. But I think we need to as a board look further into
[1:25:09] » So, I think the first action is to wrap this thing up. Let's put some facts out
[1:25:15] there and let's start to inform the public of the intent of these cameras.
[1:25:21] Let's then step back and think about how we're using them and see if we want to
[1:25:25] go forward with them or not. But let the facts get out and Courtney, you can put
[1:25:30] them on our web page just to find, you know, some of the questions you heard in
[1:25:33] here tonight and and try to help explain them to the public. So, I think a good
[1:25:39] opportunity to do that also, Courtney, would be when uh Billy has uh the night
[1:25:43] out against crime. >> Oh, yeah.
[1:25:45] » We could put one out there as an example and list
[1:25:49] uh people that we've captured uh how they've helped us uh and educate the
[1:25:54] public on how they're used. So, we're not tonight's discussion wasn't to come
[1:25:59] out with the decision, but we're going to come out with trying to help ease the
[1:26:05] issues that people are seeing because of things they don't fully may not fully
[1:26:09] understand. So, being educated and educating people of what we use them
[1:26:14] for, how they're protected, and things like that, I think is a start in the
[1:26:17] right direction to assure that we are using them correctly. And so, uh, if we
[1:26:25] could, let's just, uh, I don't know if we need a motion to say, uh, Billy, put
[1:26:29] some items together. >> I'll work with Courtney and we'll put
[1:26:33] out some information. >> We'll put them on the web page. And in
[1:26:35] the meantime, we'll continue to, uh, look into this. All right. Next item,
[1:26:42] schedule work session for FY27 budget. >> All right. Does uh,
[1:26:48] » Good. Can Yeah. Can everybody make August 25th?
[1:26:52] » Uh, >> when?
[1:26:54] » August 25th. >> I think that's next next Tuesday.
[1:27:01] » Yes. >> Where is it?
[1:27:02] » All right. Anybody can't make it. >> Uh, I'm pretty sure I'll be in trial
[1:27:06] late that day, but as a possibility I can make it. If a trial starts on the
[1:27:11] 24th. >> Okay.
[1:27:12] » And this will be at 5:00. Is that >> I don't know.
[1:27:15] » Okay. >> But I mean, I'll be here if I can.
[1:27:18] » All right. Anybody else have concern with August 25th?
[1:27:21] » I'm good. >> Can I get a motion?
[1:27:22] » Motion. >> Second.
[1:27:24] » Any discussion? Motion carries. Next one is uh funding sources for uh previously
[1:27:30] approved purchasing of one tractor and two excavators for the public works
[1:27:34] department. Uh we were thinking about the uh two excavators that could come
[1:27:39] out of the water and sewer fund and the uh tractor possibly coming out of the
[1:27:46] internet diversion tax. >> Yes.
[1:27:48] » Uh can I get a motion? >> I'll make that motion, Mr. Mayor. Just
[1:27:52] with the way that >> Let me get a second.
[1:27:54] » Oh, sorry. >> Second. We got a motion. Got a second.
[1:27:56] All right. Go ahead. Just my concern was adding uh debt services if we have that
[1:28:02] money to use for these uh three pieces of equipment that are basically used
[1:28:08] daily that we just buy them outright.
[1:28:15] » Buy them out of those two funds. >> Yes, sir. Yes, sir. That was just that
[1:28:19] was just the discussion. I was just saying why we did it.
[1:28:22] » All right. So, we got a motion. Second. Any more discussion? All in favor?
[1:28:26] » I. All oppose. >> Motion carries. Huh?
[1:28:30] » Yeah. The two excavators and a tractor coming out of the
[1:28:34] » All right. Very good. >> Do you need another timeline?
[1:28:37] » Another one. Uh, sir.
[1:28:41] » Certification of substantial completion of the Long Beach Gateway Phase 2
[1:28:45] project. Can I get a motion to accept that?
[1:28:48] » Motion. >> Got a motion to
[1:28:50] » second. >> Got a second. Discussion. Uh, the
[1:28:52] gateway phase 2 is nearing completion. Uh this is really kind of the uh we'll
[1:28:58] go into the punch list. We hope to have it open in the next couple of weeks.
[1:29:02] Only thing that's holding it up from being open is uh some of the shrubs and
[1:29:07] all didn't transition well and have died. So uh before we open it, we're
[1:29:12] going to make sure all the shrubs is doing great. All the palm trees are
[1:29:17] trimmed and nice. So we're hoping to have that within the next week or two.
[1:29:22] » So can I get a mo? Go ahead. All in favor? I.
[1:29:25] » All oppose. Motion carries. >> Next one is uh professional services of
[1:29:30] Long Beach Gateway phase three proposal. This is this is the phase three where
[1:29:36] we're going to put the five canopies across the gateway project. That project
[1:29:40] has been funded. Uh so this is a this is the last phase of the gateway project.
[1:29:47] Can I get a motion to motion? >> Got a motion. Second. Second. Any
[1:29:51] discussion? >> All in favor?
[1:29:53] » I. All oppose. Motion carries. Next one we've got appeal the planning commission
[1:29:59] decision. Timothy Brian De's and Bobby Nissel.
[1:30:06] Please come up and state your name and address and for the record.
[1:30:12] » Good afternoon boardman. I'm Bobby Niesel engineer for Tim Tim Diesel
[1:30:18] subdivision Compass Cove on Johnson Road.
[1:30:23] live at two Golden Drive, Gulport, Mississippi. And um we've designed the
[1:30:28] subdivision without any retention basically because the site is full of
[1:30:33] live oak trees and it's very flat and detention was is basically impossible to
[1:30:39] build without building up the entire site to get an outfall for detention
[1:30:43] pond. And uh to do that, you would affect live oak trees and possibly
[1:30:49] damage and lose more than he's already been permitted to remove. The uh
[1:30:54] drainage ordinance has a provision where any site less than 3 acres and you're
[1:30:59] filling less than 50% imperous surfaces are exempt from the uh storm water
[1:31:07] ordinance, the detention requirements. Mr. ball. I respect his opinion, but he
[1:31:12] feels that the newer ordinances have have overridden this, but we couldn't
[1:31:17] find any language that says that. And there's a provision that if it's less
[1:31:22] than three acres, you filling less than 50% of the property with with hard
[1:31:28] surfaces. And I've done a calculations on the surfaces, houses, driveways,
[1:31:33] and sidewalks, and it's like 47%. I feel I'm being conservative. That's probably
[1:31:38] higher. and the covenant could actually address that if need be to protect that,
[1:31:44] make sure the site's not developed over 50%. But I guess we need to defer to the
[1:31:49] attorney, Mr. Simpson, to review the ordinances and see if that provision is
[1:31:53] still valid or not. And uh there there are new ordinances since that was
[1:31:59] passed, but I can't really find where that one was would say is not in effect
[1:32:03] anymore. So, it was put in there for a reason to allow. And this Johnson Road
[1:32:08] site is basically flat. We're actually some of the drainage goes to the south
[1:32:13] toward Bo Brawn Drive and we're actually reducing the drainage flow to that area
[1:32:18] and Mr. Ball agrees with that. Rest of it goes to Johnson Road and we've been
[1:32:23] watching it through these torrential rains we've had including the the
[1:32:27] tropical storm and everything floods for a little while but it's been draining
[1:32:31] off great. I've talked to Mike Bulky who lives on Southern Nooks Drive. He said
[1:32:35] they hadn't had any drains problems even during these torrential rains. And the
[1:32:39] amount of increase we're increasing it will be basically contained in the road
[1:32:45] until it dries till it drains out which it's such a small site to begin with.
[1:32:50] It's it's not going to take long for anything just like any detention area
[1:32:53] would drain out. So, we're asking to u that your your board accepts the uh
[1:33:00] provision of that ordinance allowing the exemption and um allow Mr. Mr. De's to
[1:33:07] proceed with development. Otherwise, he's going to cancel the whole project.
[1:33:11] He's got seven lots there plan on building very expensive houses just
[1:33:15] because the value of the cost to develop it. Probably half a million dollars and
[1:33:20] up houses. And there's if this can't this variance can't be approved then
[1:33:25] basically the project will die and he'll you'll allow be build three houses on
[1:33:29] the property as as the ordinance requires.
[1:33:34] That's our request to review that drainage ordinance.
[1:33:38] » Anybody else want to speak to have have you had time to pull up?
[1:33:41] » I I'm I met with David Ball about this issue um sometime early last week I
[1:33:48] think David maybe even the week before. uh and his office, we sat down and
[1:33:52] looked at the ordinance um conflicts is is really the only way I
[1:33:58] know how to explain it. Uh section 174 of our land use ordinance article 15 as
[1:34:06] Mr. Nissel represents creates an exemption
[1:34:11] uh for um avoiding postdevelopment runoff if the site is less than 3 acres
[1:34:18] and less than 50% imperous surface which he represents in his platinary
[1:34:25] plat that that it is. Um the problem with that and and that reads fairly
[1:34:32] clearly when you look at it on its own. The problem is the very next section 175
[1:34:38] says that each proposed residential or commercial
[1:34:43] uh or industrial development provide detention basins to distort storm water
[1:34:50] runoff in excess of the volumes before the development. When you read those
[1:34:57] right next to each other, they're they're inconsistent with one another. I
[1:35:00] I think section 175 does not contemplate a a 3acre size or 3
[1:35:08] acre development relatively small with less than 50% impervious service when it
[1:35:14] talks about detention basis but particularly when it's talking about
[1:35:20] residential commercial and industrial development
[1:35:24] and when you also consider 1674 talks about an exemption exempt from what I I
[1:35:31] can only imagine maybe exempt from 175, but it is not clear. It's clear as mud
[1:35:36] when you read them separately and when you put them next to each other, they
[1:35:40] they're in conflict one another. But Mr. Leisel is correct in that 174 appears to
[1:35:46] provide an exemp an exemption for his size development with with less than 50%
[1:35:53] impervious surface. I know Mr. ball later in this agenda has a has an
[1:35:58] ordinance proposal to try to clarify and prevent this conflict from arising in
[1:36:04] the future. But these two sections are inconsistent with one another is the
[1:36:10] best explanation I can give you. David may want to speak to it as well.
[1:36:14] » Well, our position is that if there's an exemption, there's an exemption.
[1:36:18] Otherwise, why even have that paragraph in there? Because if it's going to be
[1:36:21] negated by another paragraph, why is it even in there to begin with?
[1:36:25] » Well, and I guess and I'm didn't a previous
[1:36:31] uh person that had that property have a retention pond drawn up on that thinking
[1:36:37] that he needed it. >> I think it was Mr. Ball's boss actually
[1:36:39] that owned it and he had a very small one draining towards the south. and
[1:36:45] looking at the plans that I saw, it's I can't even see.
[1:36:48] » And and I guess where I'm coming from is I don't care what size house you build.
[1:36:54] I don't care what lot you build. You should not affect anybody in your
[1:36:58] surrounding area on what you're building.
[1:37:00] » And we >> and that's just my standpoint because we
[1:37:02] got examples of it right now >> that we're fighting
[1:37:06] » uh because it's it's affecting the surrounding neighbors. So, I will never
[1:37:12] vote in favor of putting a burden on somebody else, no matter where the
[1:37:16] neighborhood's at or how big it is, how big your homes are or anything else.
[1:37:19] » Well, based on my design, it's not. It's actually draining to [music] the street
[1:37:23] and it drains out towards a big canal a couple.
[1:37:27] » So, all I got to rely on is our engineer. And our engineer says that it
[1:37:33] will affect surrounding areas,
[1:37:37] » the downstream ditch basically because Yeah,
[1:37:40] » that's comes that was in his study. So if you're if you were asking me, I live
[1:37:45] down the road from you. Am I in favor of Heck no. I'm going to get water in my
[1:37:48] yard just because he built the subdivision there. Is that fair to the
[1:37:51] people that live in the neighborhood? >> I don't know. I'm not an engineer, but
[1:37:54] he is. >> I I understand.
[1:37:56] » And I know you are, too. >> Sure. And it's And I understand the
[1:37:58] tension. And it's usually larger subdivisions that do put a big impact.
[1:38:03] » But it doesn't have to be a large subdivision. It could just be a lot
[1:38:07] affect your neighbors to the next either either side of you.
[1:38:10] » It's not it's not affecting neighbor either. It drains into the street.
[1:38:14] Everything I've designed drains into the road unlike the one that Mr. Balls Boss
[1:38:18] had done drains towards Bo Braun and there was no drainage going there at
[1:38:22] all. >> I'm surprised. I don't know how that
[1:38:24] would even work to begin with. It' go through somebody's backyard.
[1:38:28] » Yeah. Yeah, >> but this goes strictly to a front yard
[1:38:30] ditch and there's an exemption that y'all have in your ordinance and that's
[1:38:33] what we're asking you to to uphold. >> Well, I looked at that, too, and I also
[1:38:37] looked at the 175 that counters it and I think we got a church in the same
[1:38:42] situation you're in right now uh that we're doing the same exact thing. So, if
[1:38:47] we go down that road and start doing exemptions, how you going to stop it?
[1:38:52] » Well, you need to revise your ordinance, but right now the ordinance allows for
[1:38:55] it. That's what we relied on. If you read 175, it don't matter how big your
[1:38:59] lot is, how small it is, what big your subdivision, you'll affect your
[1:39:02] neighbor. >> 174,
[1:39:05] it avoids that. It says it's not applicable. That's exactly what it says.
[1:39:10] » And I don't think that was the intent. Why would I Why would I allow you to
[1:39:14] build something that's gonna negatively affect your
[1:39:17] because they said they looked at when they drew it up or they wouldn't put it
[1:39:20] in there said if it's less than three acres and you're only improving less
[1:39:23] than 50% it's not going to have a great negative effect. That was the whole
[1:39:28] purpose of it. >> What I'd like to do, David, would you
[1:39:30] like to to comment on any of this? >> I don't I don't know that I could add
[1:39:35] anything. I mean, I think Mr. Mr. Simpsons represented the the issues that
[1:39:39] I brought up. I think there are ordinance provisions that prevent this.
[1:39:43] Mr. Niss's point, in my opinion, is well made. I mean, the pro the the the
[1:39:47] exemption is in the ordinance for a reason.
[1:39:50] » I may not like it, but that may be where you're at. I don't I don't know.
[1:39:54] » So, when the water drains to the road, to the front of it, where does it go
[1:39:58] from there? >> It it will continue downstream to the
[1:40:01] east on Johnson Road and then it will enter into a ditch system that kind of
[1:40:06] meanders south to canal one. Is there a culvert that runs?
[1:40:11] » There's a a couple culvert systems that it will be required to flow through to
[1:40:15] get to that ditch and then it and then I think it's open flow open ditch to canal
[1:40:20] [clears throat] one. >> So I guess my question is is that
[1:40:24] negatively going to affect people around them with his design.
[1:40:29] » Will it affect their actual home sites is what I'm
[1:40:33] » Yeah. I'm trying to I'm trying to understand if it gets to the road
[1:40:36] » Mhm. which means it's not going to affect anybody on either side. It gets
[1:40:40] to the road then it goes has to go to the uh I guess beat line
[1:40:44] » west. >> It goes west
[1:40:47] goes east. >> Goes east. Yes, sir. Sorry.
[1:40:48] » All right. So with it and when it goes east is it is it negatively impacting
[1:40:53] anybody or is it going down a covert in a in a ditch?
[1:40:56] » Well my position was that the increase in runoff even and and I'm really tried
[1:41:01] to stay away from the quantity. It's just qualitatively it will be an
[1:41:06] increase in the in the impact of this property to the city's infrastructure
[1:41:13] » which which there's an exemption that allows that and it does flow and during
[1:41:18] this torrential rains we've had we've been out and looked at it nobody's
[1:41:22] complained about the drains getting near their house and we're in the amount that
[1:41:26] this little small seven lots is going to prove is a drop in the bucket especially
[1:41:31] considering these tropical storms we just had with 12 inches of rain.
[1:41:35] » Mhm. >> And if you didn't have any complaints,
[1:41:37] then this little seven lots is like, like I say, a drop in the bucket of the
[1:41:42] increase. It'll that's what the exemption I think is for for smaller
[1:41:46] developments with a 50% or less improvement area. And that's exactly why
[1:41:51] that ordinance is written that way. Somebody wrote it for a reason.
[1:41:55] » Mhm. >> And we feel we fall underneath that
[1:41:57] exemption. >> What I mean,
[1:42:00] » sorry. >> What's your thoughts?
[1:42:04] I mean, when I read them and when I met with David,
[1:42:08] they both mean what they say. I mean, they're fairly clearly written. The
[1:42:12] problem is they're just in conflict with one another.
[1:42:16] » My question is, >> and so when you try to figure out when I
[1:42:19] try to figure out why would you have two that are inconsistent with each other,
[1:42:23] one of them does claim to be an exemption. So, you got to ask yourself
[1:42:26] to exempt from what? Is it this other one? isn't the one that says you can't
[1:42:31] do anything more. And it is an exemption that's based on some pretty strict
[1:42:37] limitations. Three acres in size and 50% of less than 50% of imperous surface
[1:42:44] area. So yeah, it was clearly written with the intent to allow something that
[1:42:49] size with that impervious u dimensions 50% or less uh to to be
[1:42:56] exempted. The question is The ordinance needs to be cleaned up to
[1:43:01] say exempted from what? Exempted from a detention basin or from running on other
[1:43:07] people's land. Yeah. The answer to that ought to be no. You're not exempted from
[1:43:11] damage in your neighbor's land. But you are exempted if it doesn't u create a
[1:43:17] burden on on adjacent property. It should be cleaned up to say that. And I
[1:43:21] think that that's David's recommendation quite frankly. I
[1:43:25] » I have to give my two cents on this one. I kind of have to agree with Mr.
[1:43:28] on this. >> The provision is there and he he does
[1:43:33] have the option to put a retention pond in. He could go re-elevate the entire
[1:43:37] piece of property to form a pond, but that would put more water going
[1:43:42] elsewhere off the property once you reelevate the entire
[1:43:45] » kill some trees. What we'll do >> and it would harm the trees. So, in my
[1:43:50] mind, he's taking the better way out with using this provision
[1:43:54] » and it's not draining to anybody's yard. That's
[1:43:57] » well that's a big thing. That's what my concern is. So from your study does it
[1:44:03] it will it affect anybody else's yards? >> No. No sir. Not not the yards directly.
[1:44:10] I mean his runoff well I guess you are channelizing a tiny bit on the south but
[1:44:15] there there's a he he's reducing the flow rate that crosses the property line
[1:44:20] into Bo Braraw because he's going to build ridge lines. his properties uh the
[1:44:25] houses will be constructed so that a big chunk of the lots the new lots will
[1:44:29] drain to the street. >> So less area is going to drain across
[1:44:33] the southern property line to Bo Braun and the majority of the rest of the
[1:44:38] property and in fact all the property will either drain to the street and then
[1:44:42] out to Johnson Road or it'll drain through the side through the rear yards
[1:44:46] to Johnson Road. So, I don't think that he's really negatively impacting
[1:44:53] properties, adjacent properties. The the impact I was concerned about is that it
[1:44:57] will increase this property's impact to the city's infrastructure, the
[1:45:03] downstream drainage infrastructure, which I think could have impact
[1:45:07] downstream and to the upstream properties. I mean, if you're using more
[1:45:10] capacity in the ditch because of this property, then it could have an upstream
[1:45:15] impact, too. But but I guess do we have excess capab capabilities that if it
[1:45:21] does flow is it going to I think you said when it rained hard you it really
[1:45:24] wasn't a big impact. So >> do we have the capacity to handle?
[1:45:29] » I I that that could be determined. I I have not done that
[1:45:35] » without doing a drain. I only I don't opinion and I'm not a I'm as far from
[1:45:40] engineer as you could probably be but I don't want to pick and choose like if we
[1:45:45] have an ordinance and we have a policy and even if it's wrong or
[1:45:52] we need to change it in the future. I I don't know that
[1:45:58] I don't like the picking and choosing like
[1:46:00] » he is he is going to clear up >> if it's there now tonight. If it's there
[1:46:04] now, then you you all got one. >> I agree. He he's put the footwork in to
[1:46:08] draw the subdivision based off of our current ordinances.
[1:46:12] » And I agreed with with Mr. Ball that we should amend the ordinance and and give
[1:46:18] it clarity and clean it up because if an appeal of this board's decision went to
[1:46:24] circuit court, I've learned very clearly a circuit court's going to construe the
[1:46:29] ordinance against the drafter, which is us, the city. We wrote it.
[1:46:34] » Yes. >> And if we don't like the way it was
[1:46:35] written anymore, that's our going to be our fault, not not the developers. I
[1:46:38] ain't >> You can basically take that cleaned up.
[1:46:41] However, I don't know that it's >> made that clear.
[1:46:43] » I don't think so either. >> Right. Yeah.
[1:46:45] » My my opinion. >> Is that your war?
[1:46:48] » We need to fix. >> Yes. That was my war.
[1:46:51] » Are you good with it? >> I'm good with it.
[1:46:53] » I'll make a motion to approve his appeal to to allow the development.
[1:46:58] » We got a motion. >> Second.
[1:47:00] » Second. Any further discussion? point of discussion, mayor, that I want to make.
[1:47:04] Um, I I understand the ordinance is written. I understand what council said
[1:47:09] about circuit court basically telling you you're going to eat this one. Uh,
[1:47:15] however, everybody on this board's aware of what we're doing on Magnolia Run
[1:47:19] right now and how aggravating that is and we can't undo if they affect
[1:47:25] neighboring properties. uh we're going to have to go back and fix that and
[1:47:29] people can say why did you allow it just the point I'm not saying that we don't
[1:47:33] have to abide by the ordinance the way it's written but I don't have to like it
[1:47:37] » and I I believe like Magnolia would be over the AC
[1:47:40] » it is but the point is you still got the same problem if if they're not correct
[1:47:45] you talking about a 3% how do you measure 3% impervious effect
[1:47:52] » well basically when you have a torrential rain like we've had you're
[1:47:55] getting 100% runoff off. Even though it's bare ground, it's all running off.
[1:48:00] And by these storms that we just witnessed, it's obvious this 3 acre site
[1:48:04] falls right in that exemption requirement. I mean allowance because it
[1:48:09] wouldn't affect it at all at all in that storm. I don't care if it was solid
[1:48:12] concrete or solid dirt. It's all going to run off in those type of rains. So
[1:48:16] that's why that provision was put in there. Four small sites that you fill
[1:48:20] less than 50%. I don't think it's a bad one, but the only way to fix it would
[1:48:24] just take that out altogether and just and then it wouldn't we wouldn't have
[1:48:28] any, >> right?
[1:48:30] » I feel good about what we've heard so far that it won't hurt or negatively
[1:48:34] impact any other owners in that area. So, that was my main concern is just
[1:48:39] don't put it off on somebody else. >> Absolutely.
[1:48:42] » So, we got a motion on the table >> and a second
[1:48:44] » and a second. All in favor? >> All oppose? Motion carries.
[1:48:48] » Thank you. Welcome. Thank you. Next one is Long Beach Historical
[1:48:55] Society Cemetery Tour. Mr. Skelly. >> All right. Can I get a motion to allow
[1:49:01] them to do the cemetery tour? >> Motion.
[1:49:05] » Second. >> Second.
[1:49:06] » All in favor? >> All opposed. Motion carries.
[1:49:12] Next one is uh placement of portletes and Harbor Gateway parking lot for the
[1:49:18] light in the darkness march for Jesus. >> So move.
[1:49:23] » Got a motion. >> Second.
[1:49:24] » A second. Any discussion? All in favor? >> I.
[1:49:28] » All opposed? Motion carries. The next one is a request for beautifification
[1:49:33] project. Okay. Beautification project on 28th Street by the Long Beach Rotary
[1:49:38] Clubs. Anybody here to talk?
[1:49:44] » Come on. I'll be back. >> Okay.
[1:49:48] » We just want to say how much >> I thought you were going to do.
[1:49:51] » That's all right. I'm here. So, we would like to um beautify the welcome to Long
[1:49:56] Beach sign that's at the northwest corner of Beet Line and 28th Street by
[1:50:00] Bradley's by putting a durable planter at the bottom with some flowers in it. I
[1:50:08] believe in the letter you had a before and after concept picture. So all we're
[1:50:12] in and the details we want to be consistent unlike the welcome to Long
[1:50:17] Beach signs that we have right now. Um and we'll work with Courtney.
[1:50:22] » No, we do got new ones now. We just got the new ones,
[1:50:25] » but that's just for downtown. So this is not downtown.
[1:50:28] » I like your idea. Here's my only thing. Uh who's going to maintain them?
[1:50:32] » Us. We have budgeted um quarterly maintenance and that's going to be our
[1:50:38] community service project for our club. >> It's a great
[1:50:41] » to maintain it quarterly. >> I'll make the motion.
[1:50:43] » All right. So, we got second. >> I say I I saw the drawing look nice.
[1:50:47] Just can't wait to see it. >> That'll be I guess on the southeast
[1:50:50] corner there, the wooded corner of >> It's the northwest corner on Bradley's
[1:50:53] side of >> Bradley. Okay. Okay.
[1:50:55] » Just discussion to clarify the mayor's uh question about who's going to
[1:51:01] maintain it. I think that's something that separate note that we need to
[1:51:05] discuss in the future when we have things adopted
[1:51:08] » that people want to donate a plan or or take over things. We need to know
[1:51:14] exactly how they're going to do it. That's a side discussion.
[1:51:18] » Most people mean well and and y'all do. I know it's all about beautifification
[1:51:21] and we're trying to do a lot of things >> to beautify our city and we appreciate
[1:51:25] y'all coming out and stepping up and helping us.
[1:51:27] » This is one hopefully we can do the rest of them too. Not us, but hopefully
[1:51:32] somebody will. >> Thank you.
[1:51:34] » You're welcome. >> All right. All in favor? I
[1:51:36] » All oppose. Motion carries. Next one is discussion for the planning commission
[1:51:41] proposed live streaming of meeting. Alderman Jafrey.
[1:51:45] » Mr. Mayor. Um as as >> everybody all right.
[1:51:52] » Is Miss Sammy going to Ray. Is Miss Sammy going to speak at this point?
[1:51:58] » Pardon? >> Okay. want to make a motion. What do you
[1:52:01] want? >> Um, Miss Sammy want to just say a few
[1:52:04] words about this. >> Yes, she's on the agenda.
[1:52:06] » Okay. Miss Sammy.
[1:52:12] » Hi, I'm Sammy Taylor. I've been here for over 20 years. I live on 416 East 3rd
[1:52:18] Street, Long Beach. And I'm I have a lot of people from out
[1:52:24] of town and a lot of local people that come in to see me and they're concerned
[1:52:28] about some of the issues about closing the street because it's affecting a lot
[1:52:33] of the local business. A lot of people don't know how to maneuver around when
[1:52:36] the street is blocked. And we really want more people to live
[1:52:41] here. We want to bring encourage people. It's one of the top cities to live in in
[1:52:46] the country right now. And we want to encourage that. Too often people want to
[1:52:53] make dollars and the rule for the residents is left out. It they they they
[1:52:59] just want to welcome people here and not be up to the developers that going to
[1:53:04] make the money.
[1:53:08] My uh other concern is closing the the street that affects the farmers market
[1:53:15] and it's been moved many times in the last several years.
[1:53:20] The the farmers market people, we really need them. They bring fresh produce,
[1:53:24] fresh vegetables, fresh meat. And when the local people can't go there to buy,
[1:53:28] these people have prepared it and they show up and their space is not available
[1:53:32] and they either have to leave and take their product home.
[1:53:38] Um, I'm uh concerned also about the um you call them Airbnbs, the rentals.
[1:53:47] The short-time rentals are are wonderful, but we don't want them taking
[1:53:51] over our local neighborhoods. It's an issue to most of us that live in the
[1:53:56] neighborhoods, and we're seeing them come in. And I think that they should
[1:53:59] limit the how many they allow every every year, all the new ones coming in
[1:54:05] and how many in an area, and just keep our neighborhoods nice and safe.
[1:54:11] We need to find a way to promote residential growth, and I agree with
[1:54:15] that. But we wouldn't want the developers
[1:54:18] coming in from out of town, making the money, and then leaving our little
[1:54:21] community. I'm just happy to live here and happy to
[1:54:25] have y'all as my neighbors. And um we were the first new business to
[1:54:31] open south of the tracks after Katrina. So, I've been here quite a while. I
[1:54:35] thank you for listening to me. >> Thank you.
[1:54:38] » Thank you, Miss Amy. >> Great job,
[1:54:39] » everybody. She owns a little shop up here by the railroad tracks.
[1:54:42] » The stone man, the gem lady, North North Jeff Davis. you need to come by there
[1:54:46] and visit. She's got a wonderful little shop.
[1:54:48] » Thank you. >> Thank you, Miss Sammy.
[1:54:49] » Thanks, Miss Sammy. Mr. Mayor, just while we're on this topic here, um just
[1:54:53] wanted to let everyone know that we we had some discussion earlier about the
[1:54:58] planning commission. The planning commission um is very important to how
[1:55:03] we conduct business in our city. And I think it's incumbent upon us to try our
[1:55:08] best to um live stream the planning and development meetings. That way there'll
[1:55:14] be no question as to what occurred and what have you. We have a lot of people
[1:55:18] that look at our board meetings via live stream. I reached out to um um you know
[1:55:25] to try to find out some cost and everything and with um Mr. Triplet and I
[1:55:30] think he gave some of these costs he told me to um to Courtney. But we I I
[1:55:36] think whatever it cost, you know, we need to really take a serious look at uh
[1:55:40] make a commitment to transparency with the planning commission meetings. Um
[1:55:48] and I'd put this put in the form of a motion. maybe we can, you know, talk
[1:55:52] about it. But, um, my motion would be to to do it, put our best foot forward and
[1:55:57] try our best to come up with a plan to, uh, live stream our, um, planning and
[1:56:04] development commission meetings. >> Is that a motion?
[1:56:07] » That's a motion. >> Got a motion.
[1:56:11] » Got a second. >> Second.
[1:56:12] » Second. Discussion. >> Discussion. Um you so I looked at this
[1:56:19] and and just as far as I want to give some facts out there on what what we're
[1:56:25] looking at. So taking an average of all of our meetings throwing out the most
[1:56:32] watched and the least watched. The most watched was a uh 3100 which was a
[1:56:38] special uh meeting. Uh and then our least watched on YouTube was 16 people.
[1:56:46] So over the uh average is about 314 views.
[1:56:55] That's that's this meeting where the work is, you know, approved or denied
[1:57:00] for final. I look at it and I go, "Okay, is that
[1:57:05] using our using our population of 16,500?"
[1:57:11] Just going off of our last survey, I mean, uh, census. Thank you, sir. Um,
[1:57:18] that's 2 and a half% of, uh, the people of our city that that watch these
[1:57:23] meetings. I just want to make sure that we're spending the money correctly. The
[1:57:29] other note is I don't looking at every other city across the coast, none of
[1:57:34] them post uh their their planning commission meetings. I just I I go,
[1:57:43] okay, should we look at doing the minutes more in depth or is it something
[1:57:50] that is needed to be filmed? >> Can So I'd actually just
[1:57:55] » I'm just throwing out just numbers and seen them used before. It's called
[1:58:00] Applaud. Courtney, I know she's over there
[1:58:04] scrambling to take the minutes. She can put it on the back of her phone. It'll
[1:58:07] listen to everything and take completely detailed minutes, gives overviews, all
[1:58:13] that stuff. It's 150 bucks. Uh, as far as the minutes, it can be like extremely
[1:58:20] detailed almost down to the exact. I mean, I think that some of the errors
[1:58:25] we've had obviously are just look at them sitting over there trying to like
[1:58:29] scribble down and write. So, I will make a substitute motion that we pay the
[1:58:36] 70 bucks right now to go ahead and get that device uh to run during the
[1:58:42] meetings as a backup to them. They can go back and look at it and do that. So,
[1:58:47] I'm going to make that substitute. >> I guess we could just post those minutes
[1:58:50] on the website. You can >> to go back and read
[1:58:53] » what prices we got a substitute motion. Do we have a
[1:58:57] second >> second discussion?
[1:59:00] » At that point, we could just publish those on the website for everybody to go
[1:59:02] back and read versus video. And >> can I can I say something? Go ahead.
[1:59:06] » So in a lot of our team and Zoom calls that we do have, people pay the claude
[1:59:11] or AI whatever to take the notes. And when I tell you it takes every word, it
[1:59:16] will say I am uh the uh and then then it's up to I feel like it I think it's a
[1:59:24] good idea, but I don't know if it's adding more leg work.
[1:59:27] » Give me an overview like you can say and it'll give you it won't go to I know
[1:59:32] what you're >> sometimes you'll do a motion and a
[1:59:34] substitute motion and in the minutes the motion that took the action if I'm
[1:59:38] correct Emma is what gets recorded. And so if we were to record that and post
[1:59:44] that, you would have it would be confusing for people to read in my
[1:59:47] opinion. >> You can dump you can actually get in
[1:59:50] there and give just like an you can say give an overview of each topic and it'll
[1:59:55] just hit you with like the the main points and the because we've I mean
[1:59:59] we've used them at [clears throat] the school before,
[2:00:00] » but that's what it hear from what it hears. Correct.
[2:00:03] » Correct. >> Well, I mean so that goes back to our
[2:00:06] our main issue. Wouldn't it be through the microphones? And and I'm guilty of
[2:00:11] it, not speaking clearly into the microphone from time to time, you know?
[2:00:15] So, I just I'm going, hey, if we're going to do something, let's let's make
[2:00:19] sure we're spending the money, right? You know, and if it means us filming it,
[2:00:24] then film it. But I just want to make sure again, if we're spending money,
[2:00:30] it's for the right reasons. >> I love when people say spending money
[2:00:33] for the right reasons. You're singing my my song there. Um and I I support that
[2:00:38] and I just I just think that we this is a matter of discussion amongst the
[2:00:42] board. We need to come up with some type of plan that we can do it cost
[2:00:46] effectively. Um the number of people um you know there's not a lot of people
[2:00:51] that look at it. Not people are not interested in it but I submit that there
[2:00:55] are some people out there that that that uh would it would be a benefit and and
[2:01:00] we can bring that subscribership up if we got them engaged in the city. I think
[2:01:05] our attendance and our meetings are are up and that's a good thing. And um so
[2:01:10] any well anyway from transparency standpoint I I just think we need to to
[2:01:15] look at ways that we can accomplish this cost-effectively. I totally agree with
[2:01:19] you. Well, and and just saying that too is in the past, you know, being
[2:01:25] multiple terms, I used to go to it and at that point in time I was told,
[2:01:29] listen, my being there can sway a vote and I have an appointment there and so I
[2:01:37] shouldn't be at those meetings. That was that was from our our legal advice at
[2:01:41] the time, not uh not Steve, but you know, so how do we fix it and just cost
[2:01:48] effectively that that's what I would like to
[2:01:51] » Right. So we we got a motion on the table to buy the new IT equipment.
[2:01:55] » That's just gives them even if they don't a
[2:01:58] reference for them to go back without having to go watch the video and they
[2:02:02] can look at a complete transcript of and
[2:02:08] » and it's like 150 bucks. I'm just saying were you because your issue of the
[2:02:12] minutes being >> which I agree with.
[2:02:15] » It's a mistake. I see them over here like frantically writing. I think that's
[2:02:18] just a backup that they don't have to go watch a video for and it's like I said
[2:02:23] it's like I think 150 bucks I would say. >> So who's the person going to be
[2:02:26] operating this equipment? Pardon?
[2:02:30] » I mean, you're basically saying you have to go to every Thursday. Every Thursday
[2:02:34] meeting is a planning commission meeting. Somebody saddled with that
[2:02:37] response. >> Take the minutes clerks of that meeting.
[2:02:39] » Whoever I mean, you could just hand it just you just it's this big. It hooks on
[2:02:43] your phone. It takes like two seconds. >> How will it on a layout like we have
[2:02:48] here? >> It'll hear you.
[2:02:50] » It will hear. >> It'll hear you.
[2:02:51] » All right. >> Uh let me make one other point. I was
[2:02:54] talking to Kenny before the meeting just for a few minutes and he was talking
[2:02:57] about possibly having some students that could get involved from a learning
[2:03:02] perspective. Maybe that's an option we could explore with Kenny and see if if
[2:03:07] maybe we can do this and do it cost effectively.
[2:03:10] » They're vote. >> They're [clears throat] vote. Yeah,
[2:03:12] exactly. So this could be a great way just like you know some of our votech
[2:03:17] people doing oil changes and we talked about maybe that we now we understand
[2:03:20] why we can't do that but we have some resources within the city that we can
[2:03:24] probably draw down upon at a very reasonable uh cost to get this
[2:03:28] accomplished so it's worth >> do it at a very discounted rate
[2:03:33] » so very very cheap make another substitute motion I think these are all
[2:03:37] great ideas I think we should >> well I don't think you can go in with
[2:03:40] another major motion in the substitute. So, we
[2:03:45] got to vote on >> I just think it's if we just record
[2:03:47] them. I mean, that's not like a new technology. I I feel like
[2:03:52] » your motion. >> We're talk We're all talking about Kenny
[2:03:54] can tell us in two seconds what we need to
[2:03:56] » fly camera in here. >> Not to put you on [laughter] the spot.
[2:03:58] » Are you going to withdraw your motion? >> No. I think
[2:04:01] » motions on the table. >> Y'all need that for meetings and
[2:04:03] everything. >> Wouldn't hurt to have one here.
[2:04:05] » I have one question. You said it connects to a phone.
[2:04:08] » Yeah. So, we would buy a phone that has >> Y'all don't have an iPad here.
[2:04:14] » Yes, >> we don't have iPads.
[2:04:17] » There's $160,000. >> I can't help you. Never mind.
[2:04:21] » I I take my motion away. >> All right.
[2:04:24] » The motion has died. >> I'll make a substitute motion that we
[2:04:27] table this and we each come up with some new ideas before the next meeting
[2:04:30] because I think it's a great idea and come up with some ideas and present at
[2:04:34] the next board meeting. >> I second that.
[2:04:37] So, the motion is to take no motion. All in favor?
[2:04:40] » I I >> All oppose. Motion carries. Next one is
[2:04:44] uh departmental business mayor's office. Uh
[2:04:48] like I told y'all earlier, the gateway is real close to being open. We're
[2:04:53] waiting for plants to come in down there. They started on the southern
[2:04:57] quay, which is the I think that's going really the last part of the major cement
[2:05:02] that's going to be poured. They started that last night around 3:00. Uh so
[2:05:07] everything's running on schedule. Uh Gateway is looking good. So
[2:05:13] we'll be letting y'all know here real soon uh when we're going to open up the
[2:05:17] gates to the Gateway project. That's all I have. Next one is uh personnel police
[2:05:23] department one rehire and five step increases. Can I get
[2:05:27] » Mayor? I'd like to make a motion that uh we pull the rehire from the police
[2:05:32] department as well as the next agenda item, the rehire for the fire department
[2:05:37] and take that matter up into executive session. And I don't have a problem with
[2:05:42] doing that after the meeting at the conclusion if that's the pleasure of the
[2:05:45] board. >> That's you're just asking on the police
[2:05:47] department to remove [snorts] the rehire.
[2:05:49] » Just the rehire police and fire. >> All right. We'll do them one at a time.
[2:05:53] So, we got a motion to on the police department to accept the fivest step
[2:05:57] increases. >> Second. Got a second. Any more
[2:06:00] discussion? All in favor? >> All oppose? Fire department.
[2:06:05] » You're wanting to remove the >> remove the rehire and approve the
[2:06:08] fivestep increase. >> Can I get a motion to approve the
[2:06:11] fivestep increases? >> Motion.
[2:06:13] » Second. >> Motion second. Any discussion? All in
[2:06:16] favor? >> All oppose? Motion carries. Now, we'll
[2:06:20] go back to the rehire. Uh, how do we want to handle? Did you say you want to
[2:06:24] go in? >> We can go in executive session now or we
[2:06:27] can wait till the conclusion of the meeting, whatever.
[2:06:29] » I think we take it now. >> Let's go.
[2:06:31] » So, is that a motion to go in executive session?
[2:06:34] » Second. >> Second.
[2:06:35] » All in favor? >> All oppose? Motion carries.
[2:06:38] » We're going to make me take two bathrooms.
[2:35:42] Motion to come out of executive session. No action taken.
[2:35:46] » Motion second. All in favor? I. >> All oppose. Motion carries. Now we're
[2:35:50] back to police department rehire. Can I get a motion?
[2:35:55] » Motion to rehire for the uh police department.
[2:35:58] » Second. >> Motion to rehire. Second. Any
[2:36:00] discussion? All in favor? >> I.
[2:36:02] » All oppose. Motion carries. fire department rehire. Can I get a motion?
[2:36:06] » Mayor, I'd like to make a motion that we table this item uh and any subsequent
[2:36:13] PERS retirees that wish to return to either the police or fire department
[2:36:18] until such time as we have a policy in place that governs the legislation that
[2:36:23] we the uh that was adopted in Jackson on July 1st. So, uh, until we have a policy
[2:36:30] in place, governor, I'll say we table that rehire because he's a pers retiree.
[2:36:34] » All right. And then you have individuals that you want to put on that.
[2:36:37] » We have to second. >> Do we have a second?
[2:36:40] » Second. >> All right. Do you have anybody you want
[2:36:42] to put on that committee to >> I would uh I would like to uh have M
[2:36:46] alderman McCaffrey and Alderman Bond uh join me in in reviewing a policy to see
[2:36:52] if some we can come up with something. >> All right. So, we got that motion on the
[2:36:55] table. >> Got a second.
[2:36:57] Second. Any discussion?
[2:37:04] » Yes. >> Going to include the department heads.
[2:37:06] Correct. >> Yes. Yes.
[2:37:10] » All in favor? >> I.
[2:37:11] » All oppose. Motion carries. >> All right. Do we have any? Let's see. We
[2:37:16] got a library retirement. Can I get a motion?
[2:37:18] » Motion. >> Second.
[2:37:20] » Second. Any discussion? >> Discussion. Just thanking them for their
[2:37:24] service. What for the city? Tina's Tina's mom, right?
[2:37:28] » Yeah. Yeah. She was a real good employee.
[2:37:32] All in favor? >> I.
[2:37:33] » All oppose? Motion carry. City clerk. >> Fire department.
[2:37:38] » Yes, sir. I have something I need to make y'all aware of. Um,
[2:37:45] found out today uh Miss Emma and I did um we spoke to Stephen Omera from SNPG.
[2:37:54] » You got it. and the
[2:37:59] fire truck loan or leasey, however it was put that
[2:38:04] y'all voted on in the second meeting in July and approved
[2:38:10] um to go for the 4.79%
[2:38:16] 10-year loan term uh with Bank of the Ozark.
[2:38:22] Um, apparently the guy that placed that offer to us uh
[2:38:29] was not authorized to do so. >> Wow.
[2:38:33] » So, what they've come back and counter offered
[2:38:38] is uh do a seven-year term with a balloon note at the end if we want to
[2:38:44] stay with the same paper. Or you'all know as well as I do, we can
[2:38:50] put it back out for bit.
[2:38:53] That is left up to y'all. >> That's 7.49 for
[2:38:58] seven years with the balloon >> a three year balloon payment at the end.
[2:39:03] Now I I thought about it for a few for a little bit after he called me today. I
[2:39:08] don't know where the rebate money will be in in seven
[2:39:14] years. I don't you know I don't know how much it may go up.
[2:39:19] there there's no way to figure. So I I don't know if that money would be there
[2:39:25] for a balloon payment. So it would still be on whoever's in y'all's place.
[2:39:30] » Figure it out >> to either refinance it for three years
[2:39:34] or make the balloon payment >> or you could refinance a balloon
[2:39:38] payment. >> That's what I'm saying. Refinance those
[2:39:41] last three years to turn it into [cough and clears throat] a 10year. So
[2:39:45] there is no 10-year option with the not with land.
[2:39:49] » He was not allowed to do that. What he did and I guess he probably didn't
[2:39:54] understand it.
[2:39:58] » Wasn't if I'm trying to jog my memory, wasn't the 4.79 10year
[2:40:03] » a change from something they originally offered us the first time?
[2:40:06] » It was. This seems to this is at least the third time
[2:40:11] that they have changed the terms on us which is concerning to me why they can't
[2:40:16] seem to >> something I was going to ask you.
[2:40:19] » Yeah. >> Was we we had a contract that was signed
[2:40:23] by the mayor on the 22nd of July. I >> mean they offered they made an they
[2:40:29] extended an offer which we accepted. I don't know why they just say
[2:40:32] [clears throat] now we're not really going to go in long
[2:40:35] with that. the guy didn't have authority that I don't think is this board's a
[2:40:39] problem. Quite frankly, >> shouldn't punish us for their mistakes.
[2:40:41] » I would like the opportunity to have that conversation with Mr. Omar.
[2:40:44] » I agree with that. Yeah. >> I'll make the motion that Steve reach
[2:40:48] out to this company. >> Heck in second. [laughter]
[2:40:51] » Any more discussion? >> You're just like, we changed our mind.
[2:40:54] That's not going to work. >> Yeah, I didn't feel good about it.
[2:40:56] Matter of fact, I dug the the paperwork up that mayor signed and it was on July
[2:41:02] 22nd. So, I don't I don't know if this binds legal contract or or what?
[2:41:09] » Let's find out. >> All right. All in favor of let uh
[2:41:12] » Mr. >> Yes.
[2:41:13] » clarify that motion. The motion is >> well to investigate the contract
[2:41:19] » South Mississippi Planning Development. >> Stephen Omera and uh
[2:41:23] » and get an explanation of the financing agreement problem.
[2:41:28] » Is that your motion? >> Yes, sir. I have a second.
[2:41:31] » Yes. >> Second.
[2:41:32] » All in favor? >> I oppose. Motion carries. Pete second.
[2:41:35] Sorry. >> Okay. [clears throat] All right. Next
[2:41:38] one is >> verification.
[2:41:39] » Fire department. >> Fire department.
[2:41:40] » Police department. Are you done? [laughter]
[2:41:45] » What do you want? Go ahead. >> He's not ready to go home yet.
[2:41:50] » All right. Go ahead and [laughter] talk. >> I just wanted
[2:41:54] » I'm getting dizzy. Hurry up. Just wanted to uh give give the guys at ADOY um they
[2:42:01] started you know we do hydrants every year flow test and maintenance and all.
[2:42:05] Um this year we are um going to repaint from the CSX
[2:42:12] railroad track south this year. Um, I had a guy donate a small trailer for use
[2:42:19] and a water container and we've been able to borrow the six-wheeler from H2O.
[2:42:26] They've gone around and pressure washed the ones that we are going to paint. Um,
[2:42:31] we're also in partners with H2O on this whole project. We are supplying the
[2:42:38] labor and they are supplying the paint. So, um, we're going to move to the next
[2:42:45] area. Uh, every year we were doing that. >> Awesome. Excellent.
[2:42:49] » So, um, I just wanted to give her give those guys a shout out and and H2O also.
[2:42:56] » Thank you, Mike, for working. >> Appreciate it.
[2:42:58] » Yeah. Thank you. >> Are you done?
[2:43:00] » I am done now. >> Sit down.
[2:43:01] » Thank you. >> Police department.
[2:43:03] » Just real quick, two things. uh compliment my patrol division on a uh
[2:43:10] successful start of a a school year with the traffic. It was a challenging with
[2:43:15] the change in the schools and times [clears throat and snorts] and I think
[2:43:19] we they did a really good job of working with uh Mr. Roage and the transportation
[2:43:25] at the school. So, I just want to give them a shout out and uh it was mentioned
[2:43:30] earlier about Night Out Against Crime. just go ahead and put it on. It's a
[2:43:35] Friday this year. It's going to be October 16th. So, appreciate all y'all
[2:43:39] coming down there evening. And if you know of any community partners that may
[2:43:44] want to set a booth up, please contact us. [snorts]
[2:43:48] » Right. >> Thank you.
[2:43:49] » That it chief >> engineering
[2:43:54] notes. [clears throat]
[2:43:56] [laughter] First item that I've got is this uh code
[2:44:00] revisions, suggested ordinance revisions to to really
[2:44:04] » maybe close the loophole that we just >> motion perhaps identify.
[2:44:10] » Second. >> We got a motion and a second. Any
[2:44:12] discussion? >> All in favor?
[2:44:15] » All opposed? >> Motion carries.
[2:44:19] [clears throat] >> Uh next item is corrective action letter
[2:44:21] number four from DEQ for our MCU ARPA project number 425.
[2:44:27] They've sent this letter. They actually acknowledge that we've already taken the
[2:44:31] required corrective actions, but they're just asking us to acknowledge that that
[2:44:34] these needed to be done. >> Then I need the authority to sign.
[2:44:38] » Motion. >> Motion.
[2:44:38] » Motion second. Any discussion? >> All in favor?
[2:44:42] » All oppose? Motion carries. >> Uh the next one, and I should pass this
[2:44:48] out already, but it's change order two, I believe, for the the all repairs. And
[2:44:55] it's really this letter is very much the same as the as the one you've already
[2:45:00] got. [cough] It doesn't include the change order. I
[2:45:03] really just want to make sure we get this spread as the additional letter to
[2:45:06] the city. Look at the key change here in my opinion
[2:45:10] » that we're [clears throat] doing some language that Mima has suggested which
[2:45:14] is that these changes the electrical revisions and the um the structural
[2:45:20] connections for our peers are a codes and standard upgrade or a codes and
[2:45:25] standard requirement and and those will help in terms of MIMA and FEMA
[2:45:31] acceptance and reimbursement. It's a motion. [clears throat]
[2:45:35] » Second. >> Motion.
[2:45:36] » Second. >> Just quick discussion. This is no
[2:45:39] different than what was in our packet. Right.
[2:45:42] » It It's That's right. The only thing that's different is the letter I just
[2:45:45] gave, not the change order itself. Just the letter and it has some slightly
[2:45:48] different language about codes and standards. So, that'll be what gets
[2:45:51] spread in the minutes. That was actually a request from MIMA is spread it in
[2:45:55] your, you know, put that kind of language in your minutes.
[2:45:58] » Got it. I just want >> motion. All right. All in favor?
[2:46:01] » I did I not give you >> all opposed?
[2:46:04] » Motion carries. >> I will get you one. I'm sorry.
[2:46:06] » Emma, I got it for you. >> Project close out.
[2:46:09] » Yes, sir. Um project closeout. This is Daughtery Apartments pump station.
[2:46:16] Project is is completed. We're satisfied. We've been through a a normal
[2:46:20] punch list process. Everything's ready to go.
[2:46:22] » So move. >> Second.
[2:46:24] » Any discussion? All in favor? >> All oppose? Motion carries. Next one is
[2:46:29] another project closeout. >> Yep. Parkwood pump station. Same same as
[2:46:33] before. >> I move.
[2:46:34] » Second. >> Second. All in favor?
[2:46:36] » I. >> All oppose. Motion carries. Another
[2:46:39] close out. >> Latil pump station. Same as before.
[2:46:42] » So move. Second. [clears throat and cough]
[2:46:44] » Discussion. All in favor? >> I.
[2:46:46] » All oppose. Motion carries. Another project close out.
[2:46:50] » Pinerest circle area drainage improvements. That's right. Same as
[2:46:54] before. Everything's completed. >> Move. Second.
[2:46:56] » Motion. Second. [clears throat] Any discussion? All in favor?
[2:47:00] » I. >> All oppose. Motion carries. David, y'all
[2:47:03] did a f outstanding job making sure these things are
[2:47:06] » I was just about to say he's he said they were going to come in on time. All
[2:47:09] these stations. >> We're not quite there. Yeah. But
[2:47:12] [laughter] they're coming on in. We're getting there. We're almost there.
[2:47:17] » Next one is asphalt patch and striping on project close out.
[2:47:21] » Another close out for >> Rosalie Drive. That also everything's
[2:47:26] good to go. Second. Second. >> Motion. Second. Any discussion? All in
[2:47:29] favor? I. >> All oppose? Motion carries. Asphalt
[2:47:33] patch and striping on Klondike Road. >> Yeah, this is that that patched area
[2:47:37] that that was cut on Klondike Road. We I think we had a water man failure. It's
[2:47:42] ready to be repaired. We estimate 10,000 or I'm sorry 11,000 to repair that by
[2:47:47] our normal turn bid asphalt contractor and and probably another 10 to do
[2:47:52] striping. We're still waiting on that kind of better estimate from the county,
[2:47:57] but we we think 10 is is an upside. Probably won't be any more than that.
[2:48:00] So, if y'all want to do that repair via our normal process the way we've been
[2:48:05] doing these lately, that's >> the intersection of um
[2:48:07] » right there by Plus. >> Yeah. By the [snorts]
[2:48:10] » asked about that daily. >> We thought about paving towards
[2:48:14] [clears throat] >> Heinville right there. that that road
[2:48:17] hasn't been [clears throat]
[2:48:19] » while we're paving the extra tonnage might get the price
[2:48:24] » paving towards the west. >> We can we can we can include it. You're
[2:48:28] not going to really gain any efficiencies in terms of the money.
[2:48:31] » Look, same thing you >> I was think maybe tying it in it might
[2:48:34] » just look liquor store and the little short little oak tree.
[2:48:40] » Yes. >> Horrible
[2:48:42] just to look. >> We can bring that back at the next
[2:48:45] meeting. >> Yeah. just see if a bit of you know it
[2:48:47] may go same it may be the same because of the tonnage let's just right that's
[2:48:51] what I was thinking tonnage >> it won't really affect I mean we're
[2:48:54] we're kind of working in the range of the this the medium
[2:48:59] » bid price and so you know we we won't get out of that for another thousand
[2:49:04] tons so we're not going to get a better price per ton on this one but if you
[2:49:07] want to if so if you want to go forward with Klondike we could do that or we
[2:49:10] could come back next time with a with a estimate for both Klondike and that
[2:49:14] little piece of be done at the same time to possibly save money on tonnage.
[2:49:19] » I it won't save any money. >> All right. So then
[2:49:22] » then then I would just approve it. Yeah. >> Motion to asphalt patch and striping
[2:49:27] Klondike Road. Do I have a motion to approve?
[2:49:30] » Motion. >> Second.
[2:49:31] » Second. Any further discussion? All in favor?
[2:49:33] » I. >> All oppose. Motion carries. Next one is
[2:49:36] the long char [clears throat] platforms.
[2:49:39] » Yeah, I'll I'll offer just a few comments. Andrew Corp led a pretty
[2:49:43] healthy charge and and the mayor too with Borise. They've offered a pretty
[2:49:47] substantial credit uh and and negotiated reduced offer and I think Randall may
[2:49:54] have a letter which y'all which y'all have and and I think that that estimate
[2:49:57] got down to uh a number that's a whole lot closer to our original budget and I
[2:50:03] think Randall has some suggested like what's your next course of action stuff
[2:50:06] in his letter. >> You want to talk to it Randall?
[2:50:12] I do appreciate both [snorts] Over Street and [clears throat]
[2:50:16] uh Andy Court was both in there negotiating good for the city and and I
[2:50:20] think uh it came out good for the city. >> Yeah. So, we met with at the mayor's
[2:50:25] office on August 13th with representatives from Dave Bores uh about
[2:50:30] an hourong conversation, several different things. Um, the result was he
[2:50:35] offered us a $167,800 credit or deduct, however you want to
[2:50:41] say it, which is roughly 5.6% reduction. Um, so the revised contract
[2:50:48] amount would be $2,830,895.
[2:50:54] Uh, it's our suggestion that that you could recommend approval. Um just for
[2:50:59] the time base it's going to be it's also might want to make known that it is a
[2:51:03] unit price job so you're only going to pay for what we install. Uh Bores is
[2:51:07] [snorts] also doing the all FEMA repair. So with them doing both there are going
[2:51:12] to be increased efficiencies and stuff we will not have to do like termination
[2:51:16] boxes. They can just do a full run. We can't quantify that right now because
[2:51:20] we're not allowed to mess with any of the stuff inside the bid. But later on
[2:51:25] once we identify later on [clears throat] we can but this is as
[2:51:29] much as we can do right now. Um so I kind of outlined my understanding of the
[2:51:35] procurement process and what needs to be done next officially. Um, so we got to
[2:51:41] recognize the original bid at the original amount, acknowledge the
[2:51:46] negotiated deduction, uh, obviously accept it, uh, and know award the
[2:51:51] contract and then authorizes to proceed with the execution of the contract. Mr.
[2:51:56] T, you can correct me if I misspoke on any of this. U, but that's our
[2:52:02] suggestion. Otherwise, you could lose anywhere from 2 to 3 months. And we
[2:52:06] really need to get this project started no later than October so that we can
[2:52:09] have the harbor back operational for next boating season, summer.
[2:52:15] » So, we got a a motion to exhibit
[2:52:27] to I guess I authority to sign. We got a motion.
[2:52:31] » Second. >> Second. Any other discussion? All in
[2:52:33] favor? >> I.
[2:52:34] » All oppose? Motion carries. >> Public works.
[2:52:38] » Yes. I just >> Thank you, Rand.
[2:52:39] » Thanks, Rand. >> Thanks, Rand.
[2:52:41] » I just need to ask the board's [clears throat] permission to um
[2:52:44] advertise for our next annual bids. Um come for that time. So, I need to
[2:52:49] advertise for those. >> So, move.
[2:52:52] » Can you just reiterate which ones we bid out? No, it's asphalt.
[2:52:56] » Asphalt, chlorine, uh, water parts, sewer parts, polyethylene pipe,
[2:53:02] concrete. >> I believe that's all of them.
[2:53:07] » Just wanted to make sure motion [clears throat]
[2:53:10] » second. >> Second. Any further discussion? All in
[2:53:13] favor? >> Oppos?
[2:53:16] » Recreation. >> Uh, just two things. Uh, the trees that
[2:53:20] Autumn McGuey and y'all approved to be trimmed were done. So
[2:53:25] today the dead is that cut out of them if you want to go look. And the new
[2:53:28] guard rails are up and look really good. [clears throat]
[2:53:32] » Awesome. Thank you. >> Where's the guard rails at?
[2:53:38] » Handrails. >> It does look good.
[2:53:40] » It does. >> Thank you.
[2:53:42] » Austin did a good job with that. >> Building building office.
[2:53:46] » We have nothing to say. [laughter]
[2:53:49] » It's a good thing. Uh Harvard
[2:53:55] And I tell you just [laughter] >> just a quick quick update. Last night at
[2:54:00] 3:00 they started pay they started putting the cement in the southern quay.
[2:54:06] So what they're doing is as you come in from the west on the west side of
[2:54:10] southern quay. Once they do it they're done. So they're moving their way east.
[2:54:15] And y'all need to get in there and take a look at it. Does look good.
[2:54:18] [clears throat] >> I'm not going at 3.
[2:54:20] » Not not at 3 a.m. last night. >> No you won't. All right. Uh Courtney,
[2:54:26] community affairs. >> Um I just wanted to note that with all
[2:54:29] the personnel, we've had a lot of people who are retiring or leaving. So we have
[2:54:33] a lot of positions that are open and those close on Monday. So you only have
[2:54:37] that short window. So if y'all know of anybody that would like to apply for
[2:54:40] those positions or if you'll share the city's Facebook post, we'll get some
[2:54:44] applicants. We've had a lot of people call, a lot of people come and get
[2:54:46] applications, but the more the marrier. >> I have a qu I have a question.
[2:54:49] [clears throat] Where what about job descriptions, Courtney? Are they listed?
[2:54:53] » They are not on the website. I only post what I'm given, but you can ask for them
[2:54:58] if they want to come up and ask for it. >> And they can apply online as well, can't
[2:55:01] they? >> Correct. And then just turn it in on
[2:55:03] person in person. >> Someone needs the job description and
[2:55:07] ask for it. >> And you can call and ask for the pay
[2:55:09] [clears throat] because I think >> Can we Can we post that out there if you
[2:55:12] need a job description? Can is that okay to post that?
[2:55:15] » I would have to ask civil service because I don't know,
[2:55:18] » but I can ask. It doesn't hurt to ask. I think he's saying that they can call
[2:55:22] come and get a job description. >> Yeah, he's asking if I can post it
[2:55:24] online. >> The actual job description.
[2:55:26] » Yeah, >> he's asking if he can post it online.
[2:55:28] » No, no, >> he's asking if I can like the city.
[2:55:30] » Yeah, I'm just wondering if if you know when someone looks at a job, they need
[2:55:33] to know what the job entails. What is this job? And I would think they would
[2:55:37] want to look at that prior to filling an application out because they may not be
[2:55:41] qualified for the job. >> I mean, look into that.
[2:55:44] » Okay. All right. >> All right. Uh any Derelick properties?
[2:55:48] » Yes. you a report from city attorney. >> Uh, believe it or not, we need a short
[2:55:53] executive session to discuss West Wall lease.
[2:55:57] » All right, >> I'll make that motion.
[2:56:00] » In a second. >> All in favor?
[2:56:02] » I You want to let them go? >> [laughter]
[2:56:07] » Hey, y'all can
[3:10:49] I have a motion to adjurnn. >> I move.
[3:10:52] » Now you can go Patrick. >> All right.
[3:10:55] » Real quick, I did guys. I wanted to make
