[10:06]
Okay, I'd like to call the meeting to
order and have roll call.
[10:10]
» Matt Armstrong here.
>> Tom Young here. Brandon
[10:13]
» here.
>> Here
[10:16]
» stand
[10:23]
to the flag of the United States of
America and to the republic for which it
[10:29]
stands. One nation under God,
indivisible, with liberty and justice
[10:34]
for all.
[10:43]
I'd like to start the night off with a
certificate of appreciation
[10:48]
in memory of John Birkhart
in recognition of his seven years of
[10:53]
dedicated service on council, four years
leading as mayor, 10 years helping as an
[10:59]
EMT firefighter, and 11 years as a
selfless maintenance superintendent. His
[11:06]
22 years serving and caring for the L
village of Lavenville made it a better
[11:11]
place. He will be missed by all who have
the honor of knowing him. In witness
[11:17]
whereof, the mayor of the village of
Lavinville does hereby set her hand and
[11:21]
cause the mayoral seal of the village of
Lavville to be affixed on this 21st day
[11:27]
of September, 2026.
[11:34]
Next up, we have consent items. The
minutes from September 8th.
[11:40]
» I make a motion to approve the minutes
as presented.
[11:43]
» Second,
>> yes.
[11:45]
» Matt Armstrong,
>> yes.
[11:46]
» Tom Young,
>> yes.
[11:47]
» Bill Huffman,
>> yes.
[11:49]
» Lumpy,
>> yes.
[11:51]
» Next up, guests. Do we have any guests
that are here to speak tonight?
[11:57]
» Go ahead. I'm with the Bigfoot committee
and I just wanted to thank the village
[12:01]
for letting us use the town and the
theater for our event this year. It went
[12:06]
pretty well. And also huge thanks to
Kathy for helping us in the morning with
[12:11]
our ticket sales.
>> You're welcome. And you can teach old
[12:16]
dogs new tricks. I had to use an iPhone
for ticket sales.
[12:21]
Seems scary
>> learning curve for all of us.
[12:23]
» I did it. So, and I have the change left
over that you didn't need. parking
[12:28]
meter. She left me changed so she
wouldn't get a ticket out here.
[12:32]
» She saved all the receipts. We made 20
bucks.
[12:36]
[laughter]
>> Nice.
[12:38]
» Yeah, it was really successful. And I
will say I met a lot of people involved
[12:42]
with the the group that puts the show
on. Super nice people and uh yeah, we
[12:48]
had a good crowd. So, thank you for all
your help on that. So, [snorts]
[12:53]
um the McMullins are here.
>> Yes. Hi, Mayor.
[12:58]
We're here on behalf of home assisted
care just wanted to state for the record
[13:03]
the offer that we presented.
>> Yes.
[13:05]
» And so do that now.
>> Yeah, you can go ahead.
[13:09]
» All right. I we just I wanted to put on
record that we had offered to sell our
[13:14]
facility for to the village for 1.9 and
we did talk about
[13:19]
doing 1.5 after that. Um and in talking
with the local builders, we know that
[13:26]
they
were able to come up with a $500,000
[13:29]
figure to renovate our facility to
possibly meet their needs for the
[13:34]
municipal and police station and we know
that um I think the school was kind of
[13:40]
like the idea of having the police
station right next door too. So, and we
[13:44]
just wanted to go on record with what we
offered and
[13:47]
say we're still open for negotiation if
if anything would change.
[13:52]
We appreciate that. And yeah, we
appreciated working with you guys on the
[13:57]
possibility of purchasing the property.
And as of now, we're going in a little
[14:02]
bit different direction, but things
change
[14:07]
or anybody want to come and check out
the building.
[14:17]
because the total would have been under2
million versus $4 million. So, we could
[14:23]
have saved $2 million.
[14:28]
» Well, for the for the record, we're
still figuring out the total number. I
[14:33]
mean, we're we're back to the drawing
board to try to determine if we can get
[14:36]
the number closer to two. So, we haven't
decided to go with a $4 million option
[14:42]
as opposed to a $2 million option. We're
back to working on getting the number
[14:46]
out at this time.
>> Well, we work [clears throat] with you
[14:49]
on that
>> because we understand that uh the
[14:54]
building that's proposed would be
8,000 square foot versus 16,000 square
[15:01]
foot. So, you could have
double the space
[15:07]
for half the amount of money to be able
to grow and have more storage.
[15:15]
Thank you.
>> Yeah, thank you. Any other guests want
[15:19]
to speak tonight?
[15:24]
» Oh,
>> yep. Um, so we're bringing a petting
[15:30]
suit to town. You guys are well aware of
that. Um, and we wanted to
[15:37]
know if there's any input or uh
requirements on um when we use that lot,
[15:44]
what kind of I don't know if you'd call
it just gravel that we should put down
[15:48]
for parking
um and the location of the uh the
[15:53]
entrance
um to it as well. We had some uh
[16:00]
thoughts on where we would put it. I
think has some pictures
[16:05]
that we would like to show you guys.
[16:10]
» Did you
>> Yeah. And the other the other question
[16:12]
they had that we talked briefly about.
So, we talked a little bit about a fence
[16:17]
not too long ago and they were
requesting to put the fence on the
[16:20]
property line. So, they had survey work
done and currently there are some wooden
[16:27]
poles that are in place that were I
assume at one point to placed on the
[16:32]
property line for the property. Uh it's
the area that's always been viewed as
[16:36]
the property line. Uh we mow around that
area. Uh so when they did their survey,
[16:42]
they were a couple feet
inside of those poles.
[16:48]
And she inquired to me about council
giving approval to extend the fence from
[16:54]
that actual property line a couple feet
to what has always been viewed as a
[16:58]
property line. Uh I stated to her that
that's a decision to determine if they
[17:03]
could do that. I do have a couple
pictures if
[17:07]
if you guys want to see the distance
from it or if someone wants to Are the
[17:12]
flags still up?
>> Yeah.
[17:15]
» So, all those telephone poles around
along Route Three were thought to be
[17:19]
part of the old aerial course. Um those
are actually like a villages property.
[17:25]
» Are they on village property or on the
state rideway? It's
[17:28]
» in the rightway. It's
>> in the state rideway.
[17:31]
So I guess for years they were treated
as the property right. I'm not sure how
[17:35]
that became
30 40 years ago.
[17:43]
» We have authority to
>> Yeah. I was going to say I don't think
[17:47]
» we would have to we would have to
request it to ODOT. Typically in the
[17:51]
past they would refer to the villages
approval there. So it's kind of a
[17:56]
two-step process that would involve ODOT
and the council.
[18:00]
If council gave approval, the next step
would be making sure they don't have an
[18:04]
issue with it.
>> Guess if it's only a couple feet.
[18:10]
» And our thought is, you know, if if we
didn't do it that way, those would have
[18:14]
to come out, too, because they're
rotting and they would fall on our fence
[18:18]
that we're going to put up. So, that
would save you guys from doing that. We
[18:21]
could take them out when we were doing
work down there anyways with the
[18:25]
equipment.
[18:28]
I think it's only a couple feet. I would
rather just go on the line then you
[18:32]
don't have to worry about it. Is it this
two feet or you think?
[18:39]
» I'm not sure the exact
got a picture but I didn't measure it.
[18:43]
» Yeah, it kind of changes [clears throat]
down the line where they did the survey
[18:46]
at it varies a little down through.
>> I mean I can get some measurements to
[18:53]
get the exact distance.
>> Any thoughts?
[18:58]
Trying to understand where these are.
Are we talking on the be on the east
[19:01]
side of it?
[19:05]
» No. On the route side,
>> there's a number of poles there.
[19:11]
» You just have like a cable run through
them.
[19:13]
» Used to. Yep.
>> Yeah.
[19:20]
» Yeah. I mean, I guess to Garrett's
point,
[19:23]
we can be a conduit to talking to ODOT,
but I don't think own anything there. I
[19:28]
mean, we don't we don't have any rights.
I mean, it's not our it's not our land
[19:32]
there.
>> I think that that's
[19:37]
» Yeah, I would say it would be up to the
state to make that decision, not us.
[19:41]
» It's on the Yeah. So, it's on the
>> So, this big piece that comes around, I
[19:46]
mean, that that's not owned by the
village, right?
[19:48]
» No, it's state that's the state right
away there.
[19:51]
» Yeah. So essentially in the past and
anytime we've asked to do anything in
[19:55]
the state right away, they've said
it's in the village whatever the village
[19:59]
wants.
But so like I said, it's kind of this
[20:03]
two-step process. Village needs to be
okay with it before ODOT says they're
[20:09]
okay with it or vice versa. So
then if you look at the map, you'll see
[20:17]
how the property line kind of goes like
this. It would make make it a little bit
[20:22]
straighter, too.
[20:27]
» Again, it's it's ODOT's property. It's
not our It's their right away.
[20:31]
» It's their right away.
>> I agree. They'll say, "Is is the village
[20:34]
okay with this?" That's the question I
think here is presenting to the council.
[20:38]
You're welcome to be okay with it, but
ultimately it's not going to be our
[20:41]
property. It's not our right away. It's
there.
[20:43]
» So, we don't need any kind of motion or
anything. Just say yes, we agree with
[20:47]
it. I think a motion authorizing Garrett
to you know convey to the to the to ODOT
[20:53]
that you're okay with it.
>> The only thing just real quick council
[20:56]
before you say that the only thing I
will mention just in fairness to you
[20:59]
folks understand that ODOT gives
permission until they don't give
[21:02]
permission. So anything you put up in a
rideway they can show up tomorrow.
[21:09]
Just in fairness to
>> I would make a motion we allow them to
[21:13]
put their fence on the on the rightway
as long as it's okay with the state.
[21:20]
» Second.
>> Bill Huffman.
[21:22]
» Yes.
>> Matt Armstrong.
[21:24]
» Yes.
>> Tom Young.
[21:25]
» Yes.
>> Brandon Ber.
[21:26]
» Yes.
>> Cory.
[21:27]
» Yes.
[21:30]
» Thank you everyone. [clears throat]
Thank you for coming. Yeah. And
[21:34]
» on that on the driveway where the
culvert would have to go right there. Um
[21:40]
we haven't really touched on that. So
where we were thinking is on the right
[21:44]
side um right before where you guys
dump. Um that would keep it away from
[21:49]
Route Three for traffic purposes. And
there are like three super young trees
[21:54]
right there that would have to come
down. We'd be happy to take them down.
[21:58]
Um I did send a picture of that.
that goes back and forth on the iPads or
[22:03]
not?
[22:06]
» Yeah, I mean taking the trees down would
not be an issue for us. I mean they are
[22:10]
very small trees.
>> Where is that?
[22:16]
» So when you make the back side
I see where we dump. Are we talking
[22:22]
north of our our dump place or south of
our dump place?
[22:25]
» So you guys dump right here. It's right
here. It's just kind of really grown up
[22:30]
in
>> So these kind of they're
[22:31]
» stick
[22:39]
to the extent that the council can see
>> we have what used to be Wall-E, right?
[22:47]
That was conveyed to us by the the uh
county commissioners some years ago and
[22:53]
they're indicating right here.
So I guess the council being asked
[22:58]
about, you know, permission off of our
property here, them be able to access.
[23:03]
Now, again, where they're wanting to
access, we're talking about state
[23:05]
property there, so we can't make any
promises about those trees or cut across
[23:10]
that, and that's not ours. But I guess
the question to council is, is it
[23:14]
permissible to allow them to to access
to here and make a driveway off of our
[23:19]
property that used to be Wall-E?
>> We let the semi drivers go down through
[23:24]
there.
>> That is in the historic position. the
[23:26]
village is is that property is just kind
of open uh to this point. Yeah, the
[23:32]
village has been pretty
>> pretty use.
[23:37]
» So, we need another [snorts] motion to
allow them to do that.
[23:40]
» Yeah. And again, just with clarity that
we can only allow what we have. We can't
[23:44]
say anything about state portion
>> what the state says.
[23:47]
» Yeah.
>> I would make that motion that we uh
[23:51]
allow them to put their driveway in as
long as the state goes along with their
[23:54]
portion.
Second Billman.
[23:57]
» Yes.
>> Matt Armstrong.
[23:58]
» Yes.
>> Tom Young.
[23:59]
» Yes.
>> Vinegar.
[24:00]
» Yes.
>> Yes.
[24:05]
» Okay. Did you Is that all?
>> Yep. That was it. Okay. All right. Um
[24:11]
any other guests tonight? All right. We
are going to move on to departmental
[24:16]
reports.
>> Okay. Just a few things. So, if you
[24:20]
drove uh on Bustle Street last week, you
noticed the house came down. Uh they
[24:25]
came on Wednesday and finished up
Thursday.
[24:28]
I knew they were coming at a certain
point. They didn't really give any
[24:31]
notice and by the time I noticed house
was already down. So obviously it didn't
[24:34]
take too long. I do have u someone
coming to put a quote in for the lot to
[24:40]
extend the lot. Same person that did the
lot that's there just to kind of get a
[24:44]
price on it. Whether or not we want to
move forward at this point of the year,
[24:48]
I'm not sure. I mean we won't be able to
get it in by the bear. So but I'm just
[24:51]
going to get a price so we're kind of
aware what we're looking at.
[24:54]
Uh, I do have a couple quotes here for
the speed study if you guys want to look
[24:58]
at them. So, I I went on the ODOT
qualified list and got the two
[25:04]
engineering firms that are closest to
us. Uh, one has a cost of 6,500. One has
[25:10]
a cost of 11,800. So, obviously there's
a pretty wide range there. Um, we could
[25:15]
look at additional quotes if you'd like.
I do have an email out to Jeff Rogers
[25:20]
from District 3 to kind of discuss the
situation to determine the severity of
[25:27]
it, how quickly we need to act on this.
Just kind of have a good idea of that.
[25:32]
He actually sent me an email regarding
something else and mentioned the
[25:37]
non-compliance of the speed limit sign.
So, it is something that they're
[25:41]
discussing there. So, I just kind of
want to touch base with him and see how
[25:45]
they're viewing the situation. you know
how quickly they want us to act on this
[25:49]
and then you know at that point we can
decide whether or not we want to uh do
[25:53]
the speed study or change the speed
limit or just discuss how we want to
[25:56]
move forward.
One one question coming in three from
[26:02]
Worcester.
If
[26:06]
we did change it and
right about the flooring store put a if
[26:12]
they would allow put a 35 mph sign ahead
like some of these other areas have.
[26:20]
I think that would slow it down
>> quite a bit. Now it doesn't help the
[26:25]
other side.
But it does help that side coming in
[26:29]
because the other way you're you're at
35 and you got to pick up
[26:34]
» where coming in kind of like with that
down route three you know 35 ahead of
[26:40]
people start slowing down because they
know boom 35 is there.
[26:43]
» So whether that would be
>> something that they would allow that may
[26:48]
save all this from
>> I think when I called it that was
[26:52]
something they said they would
do if we I don't know if we have to
[26:58]
recommend it or ask for it, but I think
that is something that was suggested and
[27:02]
I think that would really help um
>> make it a lot easier.
[27:06]
» Yeah.
I mean ultimately but the average the
[27:10]
other studies with an average speed of
[clears throat] 42 once 43 the other
[27:15]
time
gut instinct says they might recommend
[27:19]
45 instead of 50 for a short period of
time but it's only
[27:26]
» worth
but yeah I think
[27:30]
alerting to the 35 will get people to
slip down
[27:35]
» [snorts]
[27:38]
» But I talked to Garrett about it. I I
think we we [snorts] know what a stud is
[27:42]
going to cost.
Um maybe wait and and see if this
[27:48]
gentleman has any other input. I'd hate
to do a study if we know. It's just if
[27:53]
it's going to be 50 or 45. I'm not sure
spending thousands of tax dollars to do
[27:59]
a study is Yeah. is going to be
something
[28:05]
» beneficial.
>> So I can give J Garrett a chance to
[28:13]
talk to them first. And also I I would
like a a deadline. Do we just have to do
[28:20]
it before we do the TAP grant
renovations or do we need to do it now?
[28:28]
» Um
>> well, they've been harping on it since
[28:31]
22.
>> Yeah,
[28:33]
» I mean
just get it done. So
[28:37]
» keep bringing it up.
>> And the first that I had heard from
[28:42]
anyone on it was
myself was when I got that email. I
[28:47]
mean, I know Bill's spoken to a few
people, but no one has contacted me and
[28:51]
said we need to address this. So
I don't feel like it's been something
[28:56]
they've been harboring on us about. I
think it has been brought back up with
[28:59]
the TAP funding being talked about. So
it's on their radar now for sure.
[29:06]
» Yeah, that's kind of that's kind of what
my conversation was with him when I was
[29:09]
asking about the tap and and he brought
that up.
[29:15]
» So hopefully I can speak to him this
week and find out, you know, how quickly
[29:19]
they want us to act on it. I agree with
the fact it's a lot of money to spend to
[29:23]
figure out what we kind of already know
they're going to say.
[29:26]
The only other thing I have is I just
want to remind everyone fall cleanup is
[29:31]
October 14th and 15th. I'll try to bring
up the next meeting also, but that's
[29:36]
coming up here in a few weeks. So that's
all I have.
[29:41]
Jenny, do you have anything?
[29:45]
» Yes.
I need to seek for approval to move
[29:50]
forward with the selling of the old
truck since we've kind of we're trying
[29:56]
to figure out the correct procedures.
Now we kind of have that all figured out
[29:59]
and hey, that's the the dollar is
$1,000. So bring that I guess. But as
[30:10]
cost us money to sit in there. So on a
tire $500 tire just to sell.
[30:16]
» So are are you want to sell it on go
deals or
[30:20]
» Okay.
I was told that's the way we have to do.
[30:24]
» Well, you're allowed to do seal bid or
or put it in like an auction somewhere,
[30:29]
but gun deals is probably the most
efficient. It's kind of the simplest.
[30:33]
» Yeah. All the other items are
[30:39]
asking for council to move forward with
that. We have to pass by motion.
[30:53]
» Well, council would take a vote tonight
to approve. We've already passed our our
[30:56]
annual gov deals resolution to allow for
things to happen on gov deal. I was in
[31:02]
my head that for approval of the sale,
that's by ordinance. But
[31:07]
» I think it's anything over $1,000 has to
be approved by council.
[31:10]
» Well, it has to be approved by council.
What I'm saying is I'm trying to figure
[31:13]
out I'm trying to remember if it needs
an ordinance or just a simple approval.
[31:15]
So for tonight, you can just do it by
motion if you want, but if we need an
[31:19]
ordinance, I'll have it.
Second,
[31:26]
» yes. Matt Armstrong,
>> yes.
[31:28]
» Bill Huffman,
>> yes.
[31:30]
» Yes.
There we go. Thank you. Uh, Chief
[31:35]
Corell.
>> Uh, yes. Um, last meeting I had asked
[31:40]
for approval to bring some sick time
over for a new full-time employee. Uh,
[31:47]
knowing how long he was employed in his
previous job, I thought he was going to
[31:50]
have less sick time than he has. So I
want to bring it back to you because it
[31:54]
was a lot more than I thought because
his previous job allowed roll over from
[31:58]
the job before that that I did not know
about. So he actually had 198 hours way
[32:05]
more than I thought. So I would maybe
just ask you to revisit to be fair to
[32:11]
give maybe a percentage of that like 33%
or 25% or something like that if that be
[32:17]
fair. I didn't expect it to be that I
wanted to bring it back to you.
[32:22]
Um 33% would be 65 hours. 25% would be
approximately 49.
[32:33]
» I would say 25 sounds more light. That's
over a week.
[32:37]
» Yeah. No, I understand
[32:41]
that a motion. I would move that we uh
authorize to uh pay this patrolman 25%
[32:48]
of what he had requested for his sick
leave.
[32:52]
» Just to be clear for the record, by pay
you mean allow him to bring over that
[32:56]
much from his previous
>> Yes. Yes.
[33:02]
» Sorry.
>> Bill Huffman.
[33:04]
» Yes.
>> Tom Young.
[33:05]
» Yes.
>> Matt Armstrong.
[33:06]
» Yes.
>> Yes.
[33:08]
» Cory.
>> Yes.
[33:12]
Thank you.
>> Moving on to legislation
[33:17]
» or December 30, 2026, an ordinance
amending the boundaries of the village
[33:21]
of Loud Architectural Review District.
This is the second reading.
[33:29]
» Hearing no action, no other legislation
there.
[33:32]
» Okay. Uh next we'll move on to old
business. Do you have any old business?
[33:36]
Councilman Armstrong?
>> No, you're councilman. No, your honor.
[33:40]
» Council Bener.
>> Yes, your honor.
[33:42]
» Councilman Huffman.
>> Yes, your honor. I was at the country
[33:45]
market the other day and ran into Taylor
from the motel
[33:49]
» and he wondered where we were at on his
situation.
[33:53]
» Garrett, do you have
>> any update on that? Yeah. So, I reached
[33:57]
out to the engineer reviews and they're
working on giving us uh basically doing
[34:02]
a capacity study to determine how much
capacity we have in that area. So,
[34:09]
they're going to essentially review the
lines and everything that ties into that
[34:14]
and kind of see how much capacity we
have available to us. Uh they kind of
[34:19]
said that's step one in determining
essentially how much we can handle and
[34:23]
then once we get that done, we'll move
on to the next step. So that's what
[34:26]
they're working on currently. So I think
probably within the next probably before
[34:30]
the next council meeting, I'll have an
idea of kind of what we're looking at
[34:33]
there, what what capacity we're at with
that particular area.
[34:38]
» And they're going to figure what the
what the maximum capacity is from all
[34:42]
the places that that comes from then,
too.
[34:44]
» Correct. Y
>> okay.
[34:48]
» Anything else?
>> I'll let him know. No, that's all your
[34:50]
art.
>> Okay, Councilman Lumpy.
[34:52]
» No, you're not.
>> All right. Moving on to new business. We
[34:56]
have a street closure request from the
Chamber of Commerce for the Halloween
[35:00]
parade.
>> I'll make a motion that we uh allow the
[35:05]
Halloween parade to proceed.
>> Second.
[35:10]
» Bill [snorts] Huffman.
>> Yes.
[35:11]
» Armstrong.
>> Yes.
[35:12]
» Tom Young.
>> Yes.
[35:14]
» Yes.
>> Yes.
[35:17]
» Okay. Do we have any business?
>> No, your honor.
[35:20]
» Councilman Young.
>> Councilman Binger.
[35:22]
» No, your honor. Casman Huffman.
>> No, your honor.
[35:24]
» Casy.
>> No, your honor.
[35:26]
» Okay. All right. We are
>> [snorts]
[35:30]
» um I Yeah, I want to bring up one thing
um in new business, but it's kind of
[35:35]
old, I guess. I just want to thank the
American Legion um for the memorial they
[35:40]
put on September 11th in Central Park.
Uh the color guard was there doing a
[35:46]
presentation.
Jeff Marada, their commander, spoke and
[35:51]
we had a really nice turnout, including
a lot of students from, I believe, our
[35:56]
BUD school and two bus loads of um
students came in from the high school
[36:02]
and our fire department was very
[clears throat] humbled, I think, that
[36:06]
day by the outpouring um of the people
who attended. All the kids went through
[36:12]
and shook their hands and fists and so
forth. Parisville came over and we also
[36:17]
have a police department present. So I
just want to thank everybody involved.
[36:23]
[snorts]
Uh next we are going to move on to the
[36:26]
claims ordinance.
>> Second.
[36:30]
» Tom Young.
>> Yes.
[36:32]
» Bill Huffman.
>> Yes.
[36:33]
» Matt Armstrong.
>> Yes.
[36:36]
» Ber.
>> Yes.
[36:37]
» Cory Monkey. [snorts]
>> Yes.
[36:39]
» All right. And tonight I need um
approval from council to move into
[36:44]
executive session to consider the
appointment of a public official.
[36:49]
» I make a motion to go into executive
session for consideration of a public
[36:54]
official. Second,
>> yes.
[36:57]
» Bill Huffman,
>> yes.
[36:58]
» Matt Armstrong,
>> yes.
[36:59]
» Tom Young, yes. Lumpy,
>> yes.
